The property was valued at five million colones, and the proceeding at the same amount. The adjoining landowners entered appearances, acknowledged service, and raised no objection, and the notice was published in the respective Boletín Judicial. The property remains subject to the limitations and restrictions of the Ley Forestal; the cutting or removal of trees is prohibited. It is also subject to Articles 1, 19, 20, 33, and 34 of the Ley de Aguas. The surface water and groundwater existing on the property are in the public domain and do not form part of the parcel. In accordance with the instructions of INTA, the titleholder must always maintain ground cover (cobertura del suelo) to prevent degradation and properly conserve the soil. The property must always be used for productive forestry activities or permanent crops. The forested sectors must remain under conservation. If any party files an appeal against this decision, that party must also submit the appeal electronically.

In this regard, see Decisions No 778-F-08 6 and 801.F.08, both issued by the Tribunal Agrario San José on September 14, 2009. Although the cited provision indicates that inclusion of these reservations in the text of the judgment is unnecessary for their validity and effectiveness, it must be borne in mind that their purpose is to protect public-domain property (bienes demaniales), such as public roads. Accordingly, this Tribunal considers that, to improve the effectiveness of those provisions through the constructive notice afforded by registry publication, the applicable statutory reservations should be expressly included in judgments granting relief in proceedings of this kind. Furthermore, the supplementation requested by the Procuraduría causes no harm whatsoever to the titleholder.” Decisions N” 778-F-08 6 and 801-F-08, both of the Tribunal Agrario. She adds that no authentic document was submitted to prove the proper creation of the easement and therefore requests correction of the property’s eastern boundary. 2.- The technical studies establish, and the challenged judgment-order even finds as proven, that the property to be titled is forested in nature (mountain land); it therefore forms part of the national reserves and has been subject to the public domain since Ley Forestal 4465 of 1969, Article 33, as amended by Ley Forestal 7174 of 1990 (Articles 32 and 33), a public-domain status maintained by Ley 7575, Articles 13 and 14. She further argues that the witnesses’ testimony does not demonstrate possession sufficient for acquisition by adverse possession (usucapión) by the filing party. * * * * * * * * * * * * * III.- The appellant is incorrect on the first ground of appeal insofar as she attempts to characterize the internal road as a right-of-way easement, but she is correct that the boundary must be corrected for the reasons set forth below.

In describing the property’s boundaries, the court below stated that the property was bounded on the east by [Nombre3], [Nombre4], and an internal road (see judgment in the electronic folder, decisions subfolder). The survey plan submitted in the proceeding, SJ-1786295-2014, shows that a road does indeed exist on the property, but it is not located along the property boundary; rather, it is depicted as an internal road running through several areas of the property (see cadastral survey plan in the electronic folder, filings subfolder, initial petition file, image 5). Therefore, the road must not be included as a boundary, and only [Nombre3] and [Nombre4] should be listed. Nor could it be regarded as an easement, because the road is an internal access route that forms part of the property and does not burden any other property. * * * * * * * * * * * * * IV.- Regarding the second ground of appeal (agravio), it is important to mention that, concerning the interpretation of Article 7 of the Ley de Informaciones Posesorias and the State Natural Heritage (Patrimonio Natural del Estado), the Court has repeatedly stated: “...

IX. The Higher Agrarian Court had interpreted Article 7 of the Ley de Informaciones Posesorias, before it was amended by the new Ley Forestal, as requiring personal possession (posesión personal) exercised beginning ten years before the creation of the forest reserve (reserva forestal) or protected area (área protegida) (See, to that effect, Votos No. 169 issued at 9:40 a.m. on 22 de marzo de 1991 and No. 251 issued at 2:00 p.m. on 17 de abril de 1991). It explained: "This Court has no doubt that Article 7 of the Ley de Informaciones Posesorias, before the amendment introduced by Ley Forestal number 7124 of veintiocho de junio de mil novecientos noventa and in its current text, departs from the general rule established in Article 1 of the Ley de Informaciones Posesorias, which provides: "When the title applicant (titulante) has not had ten-year possession (posesión decenal) of the property, the applicant may rely on that exercised by the applicant’s transferors, pursuant to Article 863 of the Civil Code; but in such case, the applicant must submit a public instrument (documento público) evidencing the transfer of the applicant’s right, although not that of prior possessors"; the foregoing is stated for the following reason: insofar as relevant, the cited Article 7 provided before the amendment: "When the property to which the possessory title proceeding (información) refers contains a forested area covering one-half or more of its total area, lawful acquisition must be proven by means of a public instrument executed more than ten years earlier." If, in the latter situation, the title applicant was required to submit a public instrument executed more than ten years earlier proving the acquisition of the property for which title was sought, it was because, in those cases, the intention was that the ten-year possession had been exercised personally by the title applicant, since that evidence guaranteed the direct possession (posesión directa) of the person instituting the possessory title proceeding (información posesoria), as no one would submit a title executed more than ten years earlier without having personally retained possession.

What occurred with the amendment was that it expressly stated what had previously been implicit, because it now establishes that when the property is located within an area declared a national park, biological reserve, forest reserve, or protective zone (zona protectora), the title applicant must prove having exercised ten-year possession beginning at least ten years before the effective date of the respective law or decree creating the corresponding protected wilderness area (área silvestre)....". However, that interpretation of Article 7 of the Ley Forestal was challenged as "unconstitutional" by the title applicant herein, and the Constitutional Chamber, in Voto No. 4587-97 (published in Boletín Judicial No. 188 dated 1 de octubre de 1997), held, insofar as relevant, as follows: "The action is partially granted and, consequently, the interpretation of Article 7 of Ley de informaciones Posesorias No. 139 of 14 de julio de 1941, whose text corresponds to the amendment enacted by Ley Forestal No. 7174 of 28 de junio de 1990, is declared unconstitutional insofar as, under that interpretation, obtaining title to land located within national parks, biological reserves, forest reserves, or protective zones requires personal possession beginning ten years before the effective date of the law or decree creating the protected wilderness area, and possession transferred by prior possessors (posesión transmitida por anteriores poseedores) may not be relied upon in such cases.

This judgment is declaratory and has retroactive effect, without prejudice to rights acquired in good faith...". Thus, current possessors may rely on transferred possession (posesión trasmitida)." (Decision issued at 2:50 p.m. on 20 de febrero de 1998 corresponding to Voto No. 113).* * * * * * * * * * * * * * V.- Accordingly, a possessor seeking to acquire by adverse possession (usucapión) land covered by forest must prove ten-year possession, whether original or transferred, and that the forest resource (recurso forestal) was conserved. In this case, the requirement established in Articles 1, 6, and 7 of the Ley de Informaciones Posesorias is deemed proven. Indeed, the petitioner (promovente) submitted registered cadastral plan (plano catastrado) SJ-1786295-2014, which shows that the property is used for citrus cultivation and mountain forest (montaña) (see registered cadastral plan in the electronic folder, pleadings subfolder, initial complaint file, image 5), and the conforming land-use study (estudio de uso conforme del suelo) clearly states that the land consists of agroforestry land and primary forest (bosque primario), indicating that an activity consistent with the land use has been conducted.

In addition, the testimony of [Nombre6] , [Nombre7] and [Nombre8] establishes that they have known the property for which title is sought for approximately 20 years; that the property has been used for citrus cultivation and mountain forest; and that they acknowledged that the property had belonged to [Nombre9] and [Nombre10] , who transferred it to the petitioner more than nine years ago (see witness testimony in the electronic folder, associated documents subfolder, oral trial). It follows from all the foregoing that the area for which title is sought has been possessed for more than ten years by the petitioner, when combined with the possession of the petitioner’s prior transferors, and that such possession has been exercised while properly protecting the existing natural resources. Plano catastrado número SJ-1786295-2014.", (Ver escritorio virtual del Juzgado Agrario del Segundo Circuito Judicial de San José, Goicoechea, escritos incorporados en fecha 10/03/2015 a las 05:59:07 p.m. y 03/08/2015 a las 03:27:59 p.m.* ).* -* * * * * * * * * * * * * * 2.-* * * La Procuraduría General de la República se apersonó al proceso en los términos visibles en el escritorio virtual del Segundo Circuito Judicial de San José, Goicoechea, escrito incorporado en fecha 02/02/2016 a las 03:37:28 p.m.* ;* a su vez el Instituto de Desarrollo Rural, s* e apersonó al proceso en los términos visibles en el escritorio virtual del Juzgado Agrario del Segundo Circuito Judicial de San José, Goicoechea, escrito incorporado en fecha 11/01/2016 a las 10:54:11 a.m., este último renunciando a futuras notificaciones.-* * * * * * * * * * * * * 3* .- El juez Juan Carlos Castillo López, del Juzgado Agrario del Segundo Circuito Judicial de San José, Goicoechea,* mediante la sentencia* N° 2016000179 de* las* ocho horas y cuarenta y seis minutos del dieciocho de noviembre de dos mil dieciséis* , resolvió: “POR TANTO:* "De conformidad con los artículos 1, 4, 6, 15, 16 y 19 todos de la Ley de Informaciones Posesorias y numerales853, 856 y 860 todos del Código Civil se aprueban las presentes diligencias de Información Posesoria.

Se ordena al Registro Público de la propiedad inscribir a nombre de [Nombre1] , conocido como [Nombre1], quien es mayor, divorciado una vez, mecánico, vecino de San Antonio de Desamparados, [Dirección4] , cédula de identidad número CED5, sin perjuicio de terceros de mejor derecho la finca que se describe como terreno de montaña, cítricos y un rancho, el cual se encuentra ubicado en Bajos de Jorco, [Dirección5] , sea Palmichal del cantón doce, sea Acosta de la provincia de San José, con una cabida de dieciséis mil cuatrocientos cinco metros cuadrados, colinda al NORTE con [Nombre3] , al SUR con calle [Dirección2] con frente a la misma de sesenta y dos metros con cincuenta y dos centímetros lineales y ancho de diecisiete metros, al ESTE con [Nombre3] , [Nombre4] y [Dirección6] y al OESTE con [Nombre5] y [Dirección7] con frente lineal de ciento ochenta y ocho metros con veintidós centímetros y quebrada, según plano catastrado número SJ- 1786295-2014.

Se estimó inmueble en cinco millones de colones y del trámite en igual suma. Los colindantes se apersonaron, se dieron por notificados y no se opusieron y el edicto fue publicado en el Boletín Judicial respectivo. Queda afecto a limitaciones y restricciones de la Ley Forestal, queda prohibida la corta o eliminación de árboles. También queda afectado a la Ley de Aguas artículos 1, 19,20,33 y 34. Las aguas superficiales y subterráneas existentes en el inmueble son de dominio público y no forman parte de la finca. Deberá el titulante de conformidad con lo indicado por el INTA mantener siempre el suelo con cobertura para evitar la degradación y conservarlo adecuadamente. Utilizar siempre la propiedad en actividad productiva Forestal o cultivos permanentes. Los sectores de Bosque mantenerla conservación. Si alguna de las partes va a presentar recurso de apelación contra esta resolución deberá remitir además, el recurso de apelación por formato electrónico.

Por motivo de la inserción de la oralidad en materia agraria, si es el deseo de la parte que el Tribunal de alzada les confiera una audiencia oral, lo hagan saber en el mismo escrito de apelación, o en su defecto señalar un correo electrónico en donde se les pueda notificar.", (* Ver escritorio virtual del Juzgado Agrario del Segundo Circuito Judicial de San José, Goicoechea, documento asociado en fecha 18/11/2016 a las 8:46:38 a.m.* ).* -* * * * * * * * * * * * * 4.- La licenciada Lydiana Rodríguez Paniagua, en su condición de procuradora, solicitó adicionar el por tanto del auto-sentencia N° 2016000179 de las ocho horas y cuarenta y seis minutos del dieciocho de noviembre de dos mil dieciséis, para que sea consignando lo siguiente: " a) Que el inmueble a titular queda afectado a las reservas en cuanto a derechos de vía de las calles públicas que disponen los artículos 4 de la Ley General de Caminos Públicos y 19, inciso a, de la Ley de Informaciones Posesorias.

Al respecto, véase Votos No 778-F-08 6 y 801.F.08, ambos del Tribunal Agrario San José, 14 de septiembre del 2009. Pese a que la norma citada indica no es necesario para la validez y eficacia de estas reservas que se incluyan en el texto de la sentencia, debe tomarse en cuenta que su fin es la tutela de bienes demaniales como la son las calles públicas. De esta forma, considera este Tribunal, para lograr mejorar la eficacia de dichas normas a través de la publicidad registral que su inscripción permite, es permite que en las sentencias estimatorias de este tipo de procesos, se incluyan expresamente las reservas de ley respectivas. Además, con la adición pedida por la Procuraduría, no se le causa perjuicio alguno a la parte titulante". Votos N" 778-F-08 6 y 801-F-08, ambos del Tribunal Agrario. Se trata de una afectación legal, que no puede ser dejada sin efecto ni variada a voluntad de los particulares, ni por resolución judicial.

Lo anterior a fin de que sea respetado por la promovente y terceros registrales (principio de publicidad registral)", (* Ver escritorio virtual del Juzgado Agrario del Segundo Circuito Judicial de San José, Goicoechea, escrito incorporado en fecha 22/11/2016 a las 02:21:37 p.m.* )* . El Juzgado Agrario del Segundo Circuito Judicial de San José, Goicoechea, en resolución de las dieciséis horas y dos minutos del veintisiete de enero de dos mil diecisiete, respecto a la adición resolvió: "Analizado ese memorial lleva razón la Procuraduría General de la República en el sentido que se omitió indicar las afectaciones propias de la Ley General de Caminos Públicos, de ahí que al tenor del artículo 158 del Código Procesal Civil aplicable por disposición del 26 de la Ley de Jurisdicción Agraria, se adiciona la supracitada sentencia en el sentido que el fundo a titular, descrito en el plano catastrado SJ-178695-2014, queda afecto a los derechos de vía de las calles públicas, conforme lo disponen los artículos 4 de la Ley General de Caminos Públicos y 19 de la Ley de Informaciones Posesorias.", (* ver escritorio virtual del Juzgado Agrario del Segundo Circuito Judicial de San José, Goicoechea, documento asociado en fecha 27/01/2017 a las 16:02:18* )* .* * * * * * * * * * * * * 5* .-* La licenciada Lydiana Rodríguez Paniagua, en su condición de procuradora interpuso recurso de apelación con indicación expresa de las razones en que se fundamenta para refutar la tesis del juzgado de instancia (* ver escritorio virtual del Juzgado Agrario del Segundo Circuito Judicial de San José, Goicoechea, escrito incorporado en fecha 22/11/2016 a las 02:21:37 p.m.* )* .* * * * * * * * * * * * * 6.- En la substanciación del proceso se* han observado las prescripciones legales, y no se* nota la existencia de errores u omisiones capaces de producir la nulidad del fallo.* Redacta la Jueza Rojas Madrigal, y,* * * CONSIDERANDO:* * * * * * * * * * * * * * * I.- HECHOS PROBADOS: Este Tribunal comparte lo dispuesto en relación con los hechos probados por tener buen sustento en los autos. * * * * * * * * * * * * * II.- La Procuradora Adjunta, Lydiana Rodríguez Paniagua, interpuso recurso de apelación contra la resolución dictada por el Juzgado Agrario del Segundo Circuito Judicial de San José, Goicoechea a las ocho horas cuarenta y seis minutos del dieciocho de noviembre del dos mil dieciséis, argumentado: 1.- La resolución recurrida tiene por acreditado que el inmueble descrito en el plano base de estas diligencias colinda por el rumbo este con camino interno (servidumbre de paso) y la Ley de Informaciones Posesorias es un mecanismo inadecuado e ilegal para constituirla.

Agrega, no se aportó ningún documento auténtico que comprobara la debida constitución de la servidumbre; por lo que solicita sea rectificado el lindero este del inmueble. 2.- Consta en los estudios técnicos y hasta por acreditado lo tiene el auto sentencia impugnada que la naturaleza del bien a titular es boscosa (montaña), por lo cual forma parte de las reservas nacionales y está afecto al dominio público desde la Ley Forestal 4465 de 1969, artículo 33, reformada por la Ley Forestal 7174 de 1990 (artículos 32 y 33) y carácter demanial que mantiene la Ley 7575, artículos 13 y 14. Aduce además, que las declaraciones de los testigos no demuestran la posesión apta para usucapir en cabeza del promovente. * * * * * * * * * * * * * III.- No lleva razón la recurrente en el primer punto de apelación al tratar de hacer ver el camino interno como servidumbre de paso, pero sí tiene razón en cuanto a que debe rectificarse dicha colindancia por las razones que se exponen a continuación.

El a quo al realizar la descripción del inmueble como colindantes en el rumbo este indicó a [Nombre3] , [Nombre4] y camino interno (ver sentencia en carpeta electrónica, subcarpeta resoluciones). Del plano aportado al proceso SJ-1786295-2014 se desprende que efectivamente existe un camino en el inmueble, pero éste no se encuentra en el lindero de la propiedad, sino se refleja como un camino interno que pasa por varios sectores del inmueble (ver plano catastrado en carpeta electrónica, subcarpeta escritos, archivo demanda inicial, imagen 5); por lo que no debe incluirse al camino como colindante, sino únicamente a [Nombre3] y [Nombre4] . Tampoco podría considerarse éste como una servidumbre, ya que el camino es un acceso interno que forma parte de la propiedad, sin que afecte a alguna otra propiedad. * * * * * * * * * * * * * IV.- Respecto al segundo agravio, es importante mencionar que sobre el tema de la interpretación del artículo 7 de la Ley de Informaciones Posesorias y el Patrimonio Natural del Estado, el Tribunal en reiteradas resoluciones ha expresado: “...

IX. El Tribunal Superior Agrario, había interpretado el artículo 7 de la Ley de Informaciones Posesorias, antes de ser reformado por la nueva Ley Forestal, en el sentido de exigir una posesión personal, ejercida con diez años de antelación a la creación de la reserva forestal o área protegida (Véase en tal sentido los Votos No. 169 de las 9 horas 40 minutos del 22 de marzo de 1991 y No. 251 de las 14 horas del 17 de abril de 1991). Para ello explicó: "A este Tribunal, no le cabe duda de que el artículo 7 de la Ley de Informaciones Posesorias, antes de la reforma introducida al mismo por la Ley Forestal número 7124 del veintiocho de junio de mil novecientos noventa y en su texto actual, se aparta de la regla general establecida en el artículo 1 de la Ley de Informaciones Posesorias que establece: "Cuando el titulante no haya tenido la posesión decenal del inmueble podrá aprovechar la ejercida por sus transmitentes, según lo dispuesto en el artículo 863 del Código Civil; pero en este caso deberá presentar documento público en que conste el traspaso de su derecho, aunque no el de anteriores poseedores; se dice lo anterior por lo siguiente: en lo que interesa el numeral 7 citado antes de la reforma disponía: "Cuando el inmueble a que se refiera la información contenga un área de bosque de la mitad o más de su extensión habrá necesidad de probar la debida adquisición, con documento público con más de diez años de otorgado." Si al titulante en el último supuesto se le exigía, aportar documento público con más de diez años de otorgada que probara la adquisición del inmueble a titular, era porque se pretendía que en esos casos, la posesión decenal la hubiera ejercido el titulante en forma personal, ya que con esa prueba se garantizaba la posesión directa de quien promovía la información posesoria, pues nadie iba a aportar un título otorgado más de diez años atrás si no había conservado personalmente la posesión.

Con la reforma lo que pasó fue que en forma expresa se dijo lo que implícitamente estaba dicho antes de ésta, porque ahora si se establece que cuanto el inmueble está ubicado dentro de una zona declarada parque nacional, reserva biológica, reserva forestal o zona protectora, el titulante tendrá que demostrar haber ejercido la posesión decenal con por lo menos diez años de antelación a la fecha de la vigencia de la respectiva ley o decreto en que se creó la respectiva área silvestre....". Sin embargo, esa interpretación del artículo 7 de la Ley Forestal, fue cuestionada de "inconstitucional", por la aquí titulante, y la Sala Constitucional, en Voto No. 4587-97 (publicado en el Boletín Judicial No. 188 de fecha 1 de octubre de 1997) declaró, en lo que interesa, lo siguiente: "Se declara parcialmente con lugar la acción y, en consecuencia, que es inconstitucional la interpretación del artículo 7 de la Ley de informaciones Posesorias No. 139 del 14 de julio de 1941, cuyo texto corresponde a la reforma producida por la Ley Forestal No. 7174 del 28 de junio de 1990, de acuerdo con la cual para titular terrenos comprendidos en parques nacionales, reservas biológicas, reservas forestales o zonas protectoras, se requiere posesión personal con diez años de antelación a la fecha de vigencia de la ley o decreto que crea el área silvestre protegida, y que no favorece en estos casos la posesión transmitida por anteriores poseedores.

Esta sentencia es declarativa y sus efectos retroactivos, sin perjuicio de derechos adquiridos de buena fe...". De manera tal que los poseedores actuales pueden aprovechar la posesión trasmitida". (Resolución de las 14:50 horas del 20 de febrero de 1998 que responde al Voto No. 113).* * * * * * * * * * * * * * V.- De manera que el poseedor que pretenda adquirir por usucapión un terreno cubierto de bosque, deberá demostrar la posesión decenal (originaria o trasmitida) y haber conservado el recurso forestal. En este caso, se tiene por demostrado el requisito exigido por la Ley de Informaciones Posesorias, en los artículos 1, 6 y 7. En efecto, el promovente aportó el plano catastrado SJ-1786295-2014 donde se advierte que el inmueble está dedicado a cítricos y montaña (ver plano catastrado en carpeta electrónica, subcarpeta escritos, archivo demanda inicial, imagen 5) y en el estudio de uso conforme del suelo se indica claramente que el terreno es agroforestal y bosque primario; señalando que se ha dado una actividad conforme con el uso del suelo.

Aunado a lo anterior, mediante las declaraciones testimoniales de [Nombre6] , [Nombre7] y [Nombre8] se desprende que conocen el inmueble a titular desde hace aproximadamente 20 años, la propiedad ha sido dedicada a cítricos y montaña y reconocieron que la propiedad había sido de [Nombre9] y [Nombre10] , quienes transmitieron al promovente hace más de nueve años (ver declaraciones testimoniales en carpeta electrónica, subcarpeta documentos asociados, juicio oral). De todo lo anterior se concluye, que el área a titular ha sido poseída por más de diez años por el promovente junto con la posesión de sus anteriores transmitentes y que la misma ha sido ejercida brindando la correcta protección a los recursos naturales existentes, de ahí que no lleve razón la recurrente en sus agravios, debiendo confirmarse la resolución recurrida, en lo que fue objeto de recurso; debiendo modificarse únicamente la descripción realizada en la colindancia este; quedando únicamente con [Nombre3] y [Nombre4] . * POR TANTO:* * * * * * * * * * * * * Se* confirma la sentencia apelada, en lo que ha sido objeto de apelación; debiendo modificarse únicamente la descripción realizada en la colindancia este; quedando únicamente con [Nombre3] y [Nombre4] . * * * * * * * * * * * * * * * * * * * * * * *LAYE435RDBZY61* [Nombre12] - JUEZ/A DECISOR/A *DKRQF9GDRO461* [Nombre13] - JUEZ/A DECISOR/A *RNJQXRJLT0W61* [Nombre14] - JUEZ/A DECISOR/A * * *
