SECOND JUDICIAL CIRCUIT OF SAN JOSÉ.- At fifteen hours and twenty-one minutes on the twenty-eighth of April, two thousand seventeen.- POSSESSORY TITLE PROCEEDING brought by [Nombre1] , of legal age, married once, nurse, resident of Ciudad Neily, identity card CED1 - - , who assigned her rights in litigation to [Nombre2] , of legal age, married for the third time, retired, resident of Golfito, Puntarenas, identity card CED2 - - . RESULTANDO:

  1. 1The petitioner instituted this possessory title proceeding so that, through this process, the following property may be recorded in the Public Registry of Property: “Land: virgin forest, secondary forest, and brushland. Located at: Río [Dirección1], , [Dirección2] Corredores, Province of Puntarenas. Cadastral survey plan: No P-767201-2002. Area: two hundred thirty-nine thousand seven hundred eighty-seven square meters and fifty-seven square decimeters. Boundaries: North: [Nombre4] , South: [Nombre5] , East: [Nombre4] and [Dirección3] with a frontage of eighty-seven meters and sixty-nine linear decimeters, and [Nombre6] .”, (folios 07, 36 and 162).-
  2. 2The Procuraduría General de la República entered an appearance in the proceeding under the terms appearing at folios 16 to 19; the Instituto de Desarrollo Rural likewise entered an appearance under the terms appearing at folio 22.-
  3. 3Judge Juan Gutiérrez Villalobos of the Agrarian Court of the Second Judicial Circuit of the Southern Zone, Corredores, by judgment N° 44-2017 issued at fifteen hours and fifty-nine minutes on the sixteenth of February, two thousand seventeen, ruled: “POR TANTO: “The possessory title proceeding is approved. Subject to the encumbrances referred to in article 17 of the Ley de informaciones Posesorias and without prejudice to third parties holding superior rights, the Registrar of the Property Registry is ordered to record for the first time, in the name of [Nombre2] , of legal age, holder of identity card number CED6 , married for the third time, retired, resident of La Virgen de Pavón, Golfito, Puntarenas, the property described in the survey plan recorded with the National Cadastre under number P-767201-2002, which is described as follows: Land consisting of virgin forest, secondary forest, and brushland, located in [Dirección4] , , Province of Puntarenas.Area: two hundred thirty-nine thousand seven hundred eighty-seven square meters and fifty-seven square decimeters. [Nombre7] to the North: [Nombre4] , South: [Nombre5] , East: [Nombre4] and West: [Dirección5] and [Nombre6] . The property at issue in this proceeding is valued at five million colones. RESTRICTIONS AND LIMITATIONS: 1- In addition to those set forth in article 19 of the Ley de Informaciones Posesorias, the property to be titled shall be recorded subject to the reservations concerning the rights-of-way (derechos de vía) of public roads established in articles 4 of the Ley General de Caminos Públicos and 19, subsection a, of the Ley de Informaciones Posesorias). 2- The area adjacent to watercourses is a protection area (área de protección), pursuant to article 33, subsection b), of Ley Forestal n° 7575, and the cutting or removal of trees is prohibited. Likewise, the channel and waters of that watercourse are in the public domain (Ley de Aguas, articles 1, subsection IV, subsection III). 3) The surface water and groundwater existing on the property (wells, etc.) are in the State public domain and do not form part of the property. A certified copy of this judgment shall serve to record the aforementioned property in the Property Registry.”, (folios 178 to 179).-
  4. 4Attorney Lydiana Rodríguez Paniagua, in her capacity as government counsel, filed an appeal expressly stating the grounds on which she relies to challenge the trial court’s position, (folios 183 to 190).-
  5. 5The statutory requirements were observed in the conduct of the proceeding, and there are no errors or omissions capable of rendering the judgment null and void.-

DRAFTED BY JUDGE [Nombre8] , AND;

CONSIDERANDO:

I.This Court adopts the statement of facts found proven in the judgment under appeal, as it faithfully reflects the contents of the record.-

II.Deputy Government Counsel Lydiana Rodríguez Paniagua appeals the judgment issued at fifteen hours and fifty-nine minutes on the sixteenth of February, two thousand seventeen, arguing that the property sought to be recorded consists of forestlands and forests within national reserves and is therefore subject to the public domain and has constituted the State’s natural heritage since Ley Forestal 4465 de 1969, article 33, as amended by Ley Forestal 7174 de 1990, and that its public-domain status (carácter demanial) is maintained in Ley 7575 in articles 13 and 14.- She contends that the witnesses’ statements do not establish the ten years of possession required to acquire by adverse possession (usucapir). She alleges nullity because the survey plan does not show the existence of springs (nacientes).- (see folios 183 to 190).-

III.The Court does not agree with the appellant’s grounds for appeal for the following reasons: The soil study prepared by the Instituto Nacional de Innovación y Transferencia de Tecnología Agropecuaria (INTA) indicates that the property described in cadastral survey plan number P-767201-2002 consists of pastureland, scrubland, and forest, according to folio 77.- The testimony of [Nombre9] at folio 28, [Nombre5] at folio 29, and [Nombre6] at folio 30 refers to the petitioner’s ten years of possession and to the land having been used for agriculture, including the planting of beans, corn, cardamom, secondary-growth brushland, pastures, and an area of disturbed forest, which is secondary forest.- Although it is true that, by majority decision of a differently constituted panel of the Court, the ten-year period of possession of forestland is deemed to run before the land became subject to the public domain pursuant to Ley Forestal de 1969, that rule does not apply to this specific case.

It should be noted that this property consists of disturbed forest, secondary-growth brushland, or secondary forest, which means that the land was regenerated by its possessor; moreover, the judicial inspection shows that this resource has been cared for. The Comisión Nacional de Certificación Forestal de Costa Rica defines secondary forest as “... land with woody vegetation of a secondary successional nature that develops after the original vegetation has been removed by human activities or natural phenomena; with a minimum area of 0,5 ha and a density of no fewer than 500 trees per ha of all species, with DBH (dap) of no less than 5 cm” (CNCF 1999, Comisión Nacional de Certificación Forestal. 1999. Estándares y procedimientos para el manejo sostenible y la certificación forestal en Costa Rica. San José,. Costa Rica. 54 p.) Based on this definition and the INTA technical study appearing at folios 77 and 78, the original forest was converted into scrubland and pastureland and was later converted into secondary-growth brushland; the forest was disturbed and, as stated, has been cared for by its possessor.

Declaring this type of secondary forest to be public-domain property (bien demanial) would discourage this type of forest-regeneration activity, because possessors would prefer to keep their land as pastureland so that it remains within their property and they do not risk having it declared State-owned. Silvicultural activity and secondary-forest regeneration are necessary activities for capturing carbon from the atmosphere and therefore constitute environmental measures against global warming. These activities benefit the environment, and it would therefore be inconsistent to penalize possessors who undertake this type of forest-regeneration activity by denying them the opportunity to obtain title to their property. Nor is the property located within any protective zone; on the contrary, it lies outside protected wild areas, according to the document at folio 2. Based on the foregoing, the witness statements referring to ten years of possession establish a period sufficient to acquire by adverse possession, because the requirement of exercising possession publicly, peacefully, continuously, and in good faith for ten years has been satisfied.

It is unnecessary to address ten years of possession predating Ley Forestal, because the land was converted into secondary forest through an activity carried out by the possessors, and it would be contradictory to penalize them by refusing to recognize that activity as valid for acquiring by adverse possession.- Nor is it appropriate to order the preparation of a new survey plan because, according to the study by the Instituto Costarricense de Acueductos y Alcantarillados appearing at folios 47 - 53, there are no springs or water supplies serving any population.-

IV. For the reasons stated, the judgment under appeal must be affirmed as to the matters appealed.-

VOTO N° 378-F-17 TRIBUNAL AGRARIO. SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ.- A las quince horas y veintiuno minutos del veintiocho de abril de dos mil diecisiete.- PROCESO DE INFORMACIÓN POSESORIA promovida por [Nombre1] , mayor, casada una vez, enfermera, vecina de Ciudad Neily, cédula de identidad CED1 - - , quien cedió sus derechos litigiosos a [Nombre2] , mayor, casado en terceras nupcias, jubilado, vecino de Golfito, Puntarenas, cédula de identidad CED2 - - . Intervienen como partes la PROCURADURÍA GENERAL DE LA REPÚBLICA, representada por la licenciada Lydiana Rodríguez Paniagua, mayor, soltera, abogada, vecina de Alajuela, cédula de identidad CED3 - - , en su condición de procuradora, y el INSTITUTO DE DESARROLLO RURAL, cédula jurídica CED4 - - - , representada por su gerente general con facultades de apoderado generalísimo sin límite de suma [Nombre3] , mayor, casado, ingeniero agrónomo, vecina de Heredia, cédula CED5 - - . Actúa como apoderada especial judicial de la parte promovente, la licenciada Florita Vásquez Calderón, carné uno seis seis dos nueve. Tramitado ante el Juzgado Agrario del Segundo Circuito Judicial de la Zona Sur, Corredores.-

RESULTANDO:

  1. 1La parte promovente interpuso el presente proceso de información posesoria para que por medio de esta vía se proceda a inscribir en el Registro Público de la Propiedad una finca que se describe así: "Terreno: montaña virgen, bosque secundario y breñon. Sito: Río [Dirección1], , [Dirección2] Corredores, Provincia de Puntarenas. Plano catastrado: No P-767201-2002. Extensión: doscientos treinta y nueve mil setecientos ochenta y siete metros con cincuenta y siete decímetros cuadrados. Linderos: Norte: [Nombre4] , Sur: [Nombre5] , Este: [Nombre4] y [Dirección3] con un frente de ochenta y siete metros con sesenta y nueve decímetros lineales y [Nombre6] .", (folios 07, 36 y 162).-
  2. 2La Procuraduría General de la República se apersonó al proceso en los términos visibles a folio 16 a 19; a su vez el Instituto de Desarrollo Rural, se apersonó al proceso en los términos visibles a folio 22.-
  3. 3El juez Juan Gutiérrez Villalobos, del Juzgado Agrario del Segundo Circuito Judicial de la Zona Sur, Corredores, mediante la sentencia N° 44-2017 de las quince horas y cincuenta y nueve minutos del dieciséis de febrero de dos mil diecisiete, resolvió: “POR TANTO: "Se aprueba la información posesoria. Con las afectaciones a que se refiere el artículo 17 de la Ley de informaciones Posesorias y sin perjuicio de terceros de mejor derecho, se ordena al Señor Registrador del Registro de la Propiedad inscribir, por primera vez, a nombre de [Nombre2] , mayor, portador de la cédula de identidad número CED6 , casado en terceras nupcias, jubilado, vecino de La Virgen de Pavón, Golfito, Puntarenas, la finca descrita en el plano inscrito en el Catastro Nacional bajo el número P-767201-2002, que se describe así: Terreno de montaña virgen, bosque secundario y breñon sito en el [Dirección4] , , de la Provincia de Puntarenas Mide: doscientos treinta y nueve mil setecientos ochenta y siete metros con cincuenta y siete decímetros cuadrados. [Nombre7] al Norte: [Nombre4] , Sur: [Nombre5] , Este: [Nombre4] y Oeste: [Dirección5] y [Nombre6] .El inmueble objeto de este proceso se estima en la suma de cinco millones de colones. RESTRICCIONES Y LIMITACIONES: 1- Además de las contenidas en el artículo 19 de la Ley de Informaciones Posesorias, el inmueble a titular debe inscribirse afecto a las reservas en cuanto a derechos de vía de las calles públicas que disponen los artículos 4 de la Ley General de Caminos Públicos y 19, inciso a, de la Ley de Informaciones Posesorias).2-Que el área contigua a las corrientes es área de protección, según el artículo 33, inciso b), de la Ley Forestal n° 7575, y queda prohibida la corta o eliminación de árboles. Asimismo que el cauce y las aguas de esa corriente son de dominio público (Ley de Aguas, artículos 1, inciso IV, inciso III) 3) Las aguas superficiales y subterráneas existentes en el inmueble (pozos, etc), son de dominio público estatal y no forman parte de la finca. Sirva la certificación de esta sentencia para inscribir en el Registro de la Propiedad la finca relacionada.", (folios 178 a 179).-
  4. 4La licenciada Lydiana Rodríguez Paniagua, en su condición de procuradora, interpuso recurso de apelación con indicación expresa de las razones en que se fundamenta para refutar la tesis del juzgado de instancia, (folios 183 al 190).-
  5. 5En la substanciación del proceso se ha observado las prescripciones legales, y no se da la existencia de errores u omisiones capaces de producir la nulidad del fallo.-

REDACTA LA JUEZA [Nombre8] , Y;

CONSIDERANDO:

I.Este Tribunal prohija la relación de hechos tenidos por probados en el fallo recurrido al ser fiel reflejo de lo constante en autos.-

II.La Procuradora adjunta Licenciada Lydiana Rodríguez Paniagua, apela la sentencia de las quince horas cincuenta y nueve minutos del dieciséis de febrero del dos mil diecisiete, argumentando el inmueble que se pretende inscribir son terrenos forestales y bosques de las reservas nacionales por lo que están afectos a dominio público, y son patrimonio natural del Estado desde la Ley Forestal 4465 de 1969, artículo 33 reformada por la Ley Forestal 7174 de 1990, y el carácter demanial se mantiene en la Ley 7575 en los artículos 13 y 14.- Considera las declaraciones de los testigos no demuestran la posesión decenal apta para usucapir. Aduce nulidad, por cuanto el plano no refleja la existencia de las nacientes.- (ver folios 183 a 190).-

III.No se comparte los agravios expuestos por la apelante por las siguientes razones: Del estudio de suelos elaborado por el Instituto Nacional de Innovación y Transferencia de Tecnología Agropecuaria (INTA), se desprende que el inmueble descrito en el plano catastrado número P-767201-2002 es terreno con potrero, charral y bosque, según folio 77.- Los testimonios de [Nombre9] a folio 28, [Nombre5] a folio 29 y [Nombre6] a folio 30, hacen referencia a la posesión decenal del promovente, y que el terreno se ha utilizado para agricultura, como la siembra de frijoles, maíz, cardomomo, tacotal, pastos, un área de bosque intervenido, siendo secundario.- Si bien es cierto, por mayoría de otra integración de Tribunal se considera el conteo el plazo decenal de posesión de terrenos boscosos lo es antes de la afectación de dominio público según Ley Forestal de 1969, ello no es de aplicación a este caso concreto, pues nótese se trata de un inmueble compuesto de bosque intervenido, tacotal o bosque secundario, lo que implica ese terreno fue regenerado por parte de su poseedor, además del reconocimiento judicial se desprende se ha cuidado ese recurso.

La Comisión Nacional de Certificación Forestal de Costa Rica define el bosque secundario como “... aquella tierra con vegetación leñosa de carácter sucesional secundaria que se desarrolla una vez que la vegetación original fue eliminada por actividades humanas o fenómenos naturales; con una superficie mínima de 0,5 ha y una densidad no menor a 500 árboles por ha de todas las especies, con dap no menor a 5 cm” (CNCF 1999, Comisión Nacional de Certificación Forestal. 1999. Estándares y procedimientos para el manejo sostenible y la certificación forestal en Costa Rica. San José,. Costa Rica. 54 p.) Partiendo de esta definición y del estudio técnico del INTA visible a folios 77 y 78, el bosque original fue convertido en charral y potreros, y luego convertido a tacotal, se intervino el bosque, el cual como se dijo ha sido cuidado por su poseedor, declarar ese tipo de bosque secundario como bien demanial sería no incentivar ese tipo de actividad regeneradora de bosques, pues los poseedores preferirían mantener sus terrenos de naturaleza de potreros para tenerlos bajo su patrimonio y no correr el riesgo sean declarados estatales.

La actividad silvícola y la regeneradora de bosques secundarios son actividades necesarias para la captación de carbono en la atmósfera y por ende medidas ambientales contra el calentamiento global, actividades beneficiosas para el medio ambiente por lo que sería incoherente castigar a los poseedores que tienen ese tipo de actividad regeneradora de bosques denegándoles la obtención de su título de propiedad. Dicho inmueble tampoco está dentro de alguna zona protectora, por el contrario está ubicado fuera de áreas silvestres protegidas según documento de folio 2. Con base en lo anterior, las declaraciones testimoniales en las que se hace referencia a una posesión decenal, es tiempo apto para usucapir, pues se cumple con el requisito del ejercicio de una posesión decenal en forma pública, pacífica, continua, y de buena fe, sin que sea necesario referirnos a la posesión decenal anterior a la Ley Forestal, pues el terreno fue convertido a bosque secundario, actividad ejercida por los poseedores que sería un contrasentido castigar no teniendo esa actividad como válida para usucapir.- Tampoco procede hacer la prevención de cofección de nuevo plano, pues del estudio del Instituto Costarricense de Acueductos y Alcantarillados, visible a folios 47 - 53, no existen nacientes, ni abastecimientos de agua para alguna población.-

IV. Por lo expuesto deberá confirmarse el fallo recurrido en lo que ha sido objeto de apelación.-

POR TANTO:
