APPEAL AGAINST JUDGMENT (RECURSO DE APELACIÓN DE SENTENCIA) filed in these proceedings brought against [Nombre1], an adult Costa Rican citizen, identity card CED1, for the offense of DISOBEDIENCE OF A PUBLIC AUTHORITY, to the detriment of the MINISTERIO DE SALUD. Judges Adriana Escalante Moncada, [Nombre2], and Yadira Godínez Segura participated in deciding the appeal. Attorney [Nombre3], in his capacity as public defender for the accused (encartado), [Nombre1], and attorney [Nombre4], representative of the Ministerio Público, appeared in the appeal proceedings.

FINDINGS OF FACT (RESULTANDO):

I. By judgment number 244-2016, issued at thirteen hours and thirty

minutes on June 9, 2016, the Tribunal de Juicio de Heredia ruled: “POR TANTO: In accordance with the foregoing; Articles 28, 36, 39, and 41 of the Constitución Política; Article 8 of the Convención Americana sobre Derechos Humanos; Article 14 of the Pacto Internacional de Derechos Civiles y Políticos; Article 26 of the Declaración Americana de Derechos y Deberes del Hombre; Articles 10 and 11 of the Declaración Universal de Derechos Humanos; Articles 1, 2, 6 through 9, 16, 45, 141 through 144, 180 through 184, 265, 324, 326, 341, 343, 360, 363, 365, and 367 of the Código Procesal Penal; Articles 1, 4, 11, 17, 18, 20, 30, 45, 50, 51, 59, 60, 62, 71, and 214 of the Código Penal; and Articles 1, 2, 4, 7, 298, 300, 301, 302, 355, 356, and 363 of the Ley General de Salud Pública, it is hereby ruled: A) [Nombre1] IS FOUND CRIMINALLY RESPONSIBLE AS THE PERPETRATOR of the offense of DISOBEDIENCE OF A PUBLIC AUTHORITY, committed to the detriment of the MINISTERIO DE SALUD, and is therefore sentenced to the minimum term of SIX MONTHS’ IMPRISONMENT, to be served at the correctional facility designated by the prison regulations, with credit for time spent in pretrial detention (prisión preventiva). Nevertheless, because he meets the necessary requirements, the person now found criminally responsible is granted the benefit of conditional suspension of sentence (ejecución condicional de la pena), on the condition that, during the three-year period, he does not commit an intentional offense for which he is sentenced to more than six months’ imprisonment. He is likewise ordered to comply with the health order (orden sanitaria) requiring him to suspend operation of the cabinetmaking workshop and remove the machinery and equipment from the location where noncompliance with the order was identified. Should he fail to comply with this condition or the other condition stated above, the benefit granted to him shall be revoked, and he shall serve the sentence imposed herein. B) This matter is decided without a specific award of costs (especial condenatoria en costas), and the costs of the proceedings shall be borne by the State. Once the judgment becomes final, it shall be entered in the Registro Judicial, and the customary certified copies (testimonios de estilo) shall be forwarded to the Instituto Nacional de Criminología, the Juzgado de Ejecución de la Pena, and the Archivo Judicial. In due course, the case file shall be archived and removed from the docket book. LET IT BE KNOWN” (sic).

II.Attorney [Nombre3], in his capacity as public defender for the accused, [Nombre1], filed an appeal against the foregoing judgment.

III.Following the corresponding deliberation, pursuant to Article 465 of the Código Procesal Penal, the Tribunal de Apelación de Sentencia del III Circuito Judicial de Alajuela, San Ramón, proceeded to hear the appeal.

IV. The relevant legal requirements were observed throughout the proceedings

Appellate judge [Nombre5] drafted the opinion; and, CONSIDERING (CONSIDERANDO):

I.Attorney [Nombre3], in his capacity as public defender for the accused, [Nombre1], filed an appeal against judgment number 244-2016, issued by the Tribunal de Juicio de Heredia.

II.In the sole ground for appeal (motivo de impugnación), defense counsel states that the facts established in the judgment do not constitute the offense of disobedience of authority (desobediencia a la autoridad). He maintains that legal scholarship and case law consistently accept that commission of the offense set forth in Article 314 of the Criminal Code requires that the order issued by the public official be lawful; otherwise, it could not be concluded that the official acted in the lawful exercise of the official’s duties. He maintains that Order ASRH-R-C-0919-2013, issued to him by the Heredia Governing Health Area of the Ministry of Health, through official [Nombre6] , is wholly unlawful. He asserts that the health directive (directriz sanitaria) issued violates the principle of legality (principio de legalidad) governing the Public Administration. He states that the unlawfulness lies in the fact that the General Health Law does not authorize a public official to issue directives accompanied by a warning that the recipient may be subjected to criminal proceedings.

In his view, the public authority may issue the order but may not warn that failure to comply entails criminal liability. He explains that Article 378 of the General Health Law attributes a different consequence to noncompliance with a health order (orden sanitaria), since that provision states that anyone who fails to comply with a special order or measure shall be subject to a penalty of five to thirty fine-days (días multa). He adds that another reason the order is unlawful is that its content is authorized neither by law nor by the rest of the legal system. He states that the powers conferred upon the Ministry of Health to control noise pollution (contaminación sónica) do not include suspending an activity or removing machinery from real property. He maintains that, based on Articles 292, 342, 355, and 356 of the General Health Law, the order issued to his client is unlawful because its content is not authorized by the body of applicable law (bloque de legalidad) that must govern the conduct of the Public Administration, particularly because this is a punitive proceeding in which the safeguards afforded to citizens against the State’s power to punish (ius puniendi) must be respected.

As another circumstance revealing the order’s unlawfulness, the appellant states that official [Nombre6] , the public servant who issued the health order, lacked legal authority to issue it. In this regard, he states that Article 337 of the General Health Law identifies the officials who may issue health orders and that the position held by the aforementioned public servant, who serves as an environmental manager, is not included in that list; she is therefore not authorized to issue orders of this kind. He requests that the challenged judgment be vacated and that the accused be acquitted of all punishment and liability. The claim is partially granted. To properly decide the claims raised, it is necessary to address separately the various objections made by the appellant. Thus, the appellant challenges the lawfulness of the order for three principal reasons: i) the Public Administration is not authorized to issue orders accompanied by a warning that noncompliance would entail criminal liability; ii) the public official who issued the order lacked authority to issue that directive; and iii) the content of the order is unlawful because the Ministry of Health is not authorized to suspend an activity or order the removal of machinery from a specified location.

The appellant’s arguments in this regard are unfounded. The fact that Health Order N. ARSH-R-C-019-2013, served on August 14, 2013 (appearing at folio 19 of the record), expressly states that noncompliance could result in a complaint for the offense of disobedience of authority under Article 314 of the Criminal Code does not render it unlawful, because the Public Administration was informing the regulated party (administrado) in advance of the possible commission of a criminal offense in the event of noncompliance with the previously served directive. It should be added in this regard that the Public Administration is obligated to inform regulated parties not only of the possible consequences of failing to comply with an order or directive, but also of all available information so that they may exercise whatever rights or avenues of appeal (recursos impugnaticios) they deem appropriate. Furthermore, as established in the judgment and reflected in the summary of evidence, attorney [Nombre6] is an official of the Heredia Health Area and, by virtue of her position, was assigned to address the complaint filed with the Ministry of Health by a neighbor against the accused regarding the noise and environmental pollution generated by the woodworking activity he conducted at his residence.

It was also established that official [Nombre6] issued Health Order ARSH-R-C019-2013. These two facts were not disputed during the proceedings, nor does the appellant contest them on appeal. What the appellant questions is whether official [Nombre7] had legal authority to issue the cited order, as well as the content of that order. On this point, after analyzing the General Health Law, this Chamber concludes as follows: Articles 340 and 341 of the General Health Law provide that the health authority (autoridad sanitaria) is empowered to issue orders to prevent or avert health risks or harm. In addition, Article 349 of the law under discussion provides: “Ministry officials holding inspection positions who have been specially commissioned to verify violations of this law or its regulations shall have the status of health authorities and shall enjoy a presumption of truthfulness (fe pública) with respect to complaints filed against natural or legal persons for facts or acts involving violations of such provisions or constituting an offense.

Quarantine Inspectors shall have the same status.” It is clear from the foregoing provisions that health inspectors who have been commissioned to verify violations of health regulations have the status of public authorities and, in that capacity, are authorized to issue general or special orders to prevent or avert harm to human health. Likewise, Article 356 of the law under discussion sets forth the actions that a health authority may perform or order when issuing a health order. Articles 357 through 365 of that special law also specify the scope of the actions that a health authority may perform or order when issuing an order of this kind. This latter group of provisions shows that the health authority is indeed empowered to halt construction work and to order the removal of property or products. Returning to the case under examination, it was established that the director of the Heredia Health Area delegated to official [Nombre8] the handling of the complaint filed with that office by a citizen, and that the aforementioned public servant, in her capacity as a health inspector, visited the residence of the accused, [Nombre1] , where he was conducting woodworking activities without the corresponding health permits.

Because a violation of health regulations was confirmed, on August 14, 2013, official [Nombre6] issued and served upon the accused, [Nombre1] , Health Order N. ARSH-R-C-019-2013, ordering him to cease operation of the woodworking shop and remove the machinery and equipment, for which he was granted five days. The defendant failed to comply with that order, insofar as he continued the woodworking activity. Based on the foregoing statutory analysis and the proven facts, it is concluded that official [Nombre6] was legally vested with authority to issue a health order. Likewise, the content of the order falls within the scope of the powers assigned to the Ministry of Health; therefore, the directives contained therein to halt the work and remove the machinery are not unlawful. On the contrary, they are considered useful and necessary to prevent harm to the health of persons living in that area.

The appellant is correct, however, regarding whether the facts deemed proven satisfy the statutory elements of the offense (tipicidad). In the judgment, the trial judge found that noncompliance with the health order constituted the offense of disobedience of authority set forth in Article 314 of the Criminal Code and rejected application of Article 378 of the General Health Law. In this regard, the legal reasoning contained in the judgment on that issue is insufficient because the judge merely stated that the petty offense (contravención) set forth in Article 378 of the General Health Law could not be applied because the proven conduct constituted a criminal offense. That analysis is insufficient because what should have been examined in this case was whether there is an apparent concurrence of statutory provisions (concurso aparente de normas) between the conduct set forth in Article 314 of the Criminal Code and the petty offense established in Article 378 of the General Health Law.

Apparent concurrence of statutory provisions is governed by Article 23 of the Criminal Code, which provides: “When the same conduct is described in several mutually exclusive statutory provisions, only one of them shall apply, as follows: the special provision prevails over the general provision; a provision that wholly encompasses another is preferred over the latter; and a provision that the law has not expressly or implicitly subordinated to another shall apply instead of the ancillary provision.” Article 314 of the Criminal Code provides: “A term of imprisonment of six months to three years shall be imposed on anyone who fails to comply, or fails to ensure compliance in all respects, with an order issued by a court or by a public official in the exercise of the official’s duties, provided that it was personally communicated, except where the order concerns that person’s own detention.” Article 378 of the General Health Law, for its part, provides: “Anyone who fails to comply with special or general orders or measures issued by health authorities shall be subject to a penalty of five to thirty fine-days, unless the act constitutes a criminal offense.” Examination of these two provisions supports the conclusion that, under both, the conduct described concerns failure to comply with an order issued by a public official.

Nevertheless, Article 378 of the General Health Law contains several elements that make it more specific than the conduct described in Article 314 of the Criminal Code. Article 378 contains several statutory elements (elementos normativos) that distinguish it from Article 314 of the Criminal Code. For example, Article 378 of the General Health Law describes failure to comply with a special or general order issued by a health authority. In other words, such orders may not be issued by just any public official, but only by those vested with the status of a health authority. In addition, the conduct set forth in Article 378 of the General Health Law directs the prohibition toward persons who have been issued a health order; that is, it does not concern just any type of order issued by a public official, but rather an order intended to prevent or avert harm to human health or the environment. As stated above, in this Chamber’s view, the trial judge should have analyzed whether there was an apparent concurrence of statutory provisions governed by Article 23 of the Criminal Code.

In that legal analysis, one of the principles applicable when dealing with a concurrence of offenses (concurso) of this nature is the principle of specialty (principio de especialidad). According to legal scholarship, this principle exists “when a criminal offense definition (tipo penal), through the addition of other elements, specially and more precisely regulates the factual situation that another criminal offense definition regulates generally. Or, stated differently, specialty exists when one criminal offense definition contains all the elements of another criminal offense definition, from which it differs because it contains at least one additional special element” ([Nombre9] . Criminal Law. General Part. Volume 3. San José. Continental. 2010 pp 586-587). It follows from the foregoing that, under the principle of specialty, the more specific criminal offense definition prevails over the more general one.

In the case under review, the more specific criminal offense definition is that set forth in the Ley General de Salud, which must prevail over the general offense defined in Article 314 of the Código Penal. Likewise, it bears noting that the Ley General de Salud is a special statute (norma especial) and was enacted after the Código Penal. In this regard, the Código Penal was published in La Gaceta number 257 of November 15, 1970, but entered into force on November 15, 1971. The Ley General de Salud, for its part, was published in La Gaceta number 222 of November 24, 1973, but did not enter into force until February 24, 1974. Furthermore, although the criminal offense definition currently contained in section 314 of the Código Penal was amended by law number 8720 of March 4, 2009, the fact remains that, both in its original 1970 version and in its current version, the conduct punished is the same: failure to comply with an order issued by a public official.

Finally, both legal provisions protect the same legally protected interest (bien jurídico tutelado), namely public authority. However, it may be added that Article 3 78 of the Ley General de Salud is more specific to the case under review because that provision also protects another legally protected interest, namely health and the environment, since the health orders (órdenes sanitarias) issued by that public authority within the scope of its powers are intended to prevent or avert harm to human health or the environment. Thus, in light of the legally protected interest and the specific circumstances of the case adjudicated, the provision that best describes the unlawful conduct is the one contained in Article 378 of the Ley General de Salud. Lastly, although Article 378 of the Ley General de Salud states that this statutory offense description (descripción típica) applies if the act does not constitute a crime, that legislative drafting technique does not entail the legal subordination of the provision contained in the special statute to the criminal offense definition in Article 314 of the Código Penal.

As analyzed in this judgment, when the Ley General de Salud was enacted, the legislature created a statutory offense definition (tipo normativo) containing a description more appropriately tailored to the conduct adjudicated in the case under review. Furthermore, accepting the legal subordination of the special provision to the general provision would amount to implicitly declining to apply the legal provision contained in the Ley General de Salud in every case involving noncompliance with a health order. Moreover, although the legislative drafting technique used in the special provision is contradictory, the role of judges is limited to applying the law in each particular case, and in this particular matter it is clear that the proven act is described in both distinct criminal provisions. Accordingly, this Criminal Judgment Appeals Chamber (Cámara de Apelación de Sentencia) finds that the determination of which provision applies must be governed by the specialty criteria and the general principles of Criminal Law cited above.

Consequently, this ground of appeal (motivo) is partially upheld. The facts found proven are reclassified. It is therefore established that the conduct attributed to the accused constitutes the petty offense (contravención) established in Article 378 of the Ley General de Salud, and the sentence imposed is consequently vacated. However, because the criminal action (acción penal) for the facts as reclassified is not time-barred, given that other procedural acts occurred between the examination of the accused (indagatoria del justiciable) and the issuance of the judgment that interrupted the two-year limitation period applicable to petty offenses, such as the scheduling of the preliminary hearing—folio 59—and the setting of the trial—folio 85—the appropriate course is to order a retrial on remand (juicio de reenvío) for a new determination of the sentence. In all other respects, the judgment remains undisturbed.

Por tanto

The appeal filed by the public defense is partially granted. The facts found to have been proven are reclassified as the infraction (contravención) set forth in Article 378 of the Ley General de Salud. The sentence imposed is vacated. A new trial is ordered solely for redetermination of the sentence. In all other respects, the judgment remains undisturbed.

RESULTANDO:

I. Que mediante sentencia número 244-2016 de las trece horas con treinta

minutos del día nueve de junio de dos mil dieciséis, el Tribunal de Juicio de Heredia, resolvió: "POR TANTO: De conformidad con lo expuesto, artículos 28, 36, 39 y 41 de la Constitución Política; 8 de la Convención Americana sobre Derechos Humanos; artículo 14 del Pacto Internacional de Derechos Civiles y Políticos; artículo 26 de la Declaración Americana de Derechos y Deberes del Hombre; artículos 10 y 11 de la Declaración Universal de Derechos Humanos; artículos 1, 2, 6 al 9, 16, 45, 141 al 144, 180 al 184, 265, 324, 326, 341, 343, 360, 363, 365 y 367 del Código Procesal Penal; artículos 1,4, 11, 17, 18, 20, 30, 45, 50, 51, 59, 60, 62, 71 y 214 del Código Penal, artículos 1, 2, 4, 7, 298, 300, 301, 302, 355, 356 y 363 de la Ley General de Salud Pública, se resuelve: A) SE DECLARA A [Nombre1] AUTOR RESPONSABLE del delito de DESOBEDIENCIA A LA AUTORIDAD PÚBLICA cometido en perjuicio del MINISTERIO DE SALUD, y en tal virtud se le impone la pena mínima de SEIS MESES DE PRISIÓN que deberá descontar en el centro carcelario que los reglamentos penitenciarios indiquen, previo abono de la preventiva sufrida. No obstante por reunir los requisitos necesarios se le otorga al ahora declarado responsable penal el beneficio de ejecución condicional de la pena en el entendido de que durante el plazo de tres años no cometa un delito de naturaleza dolosa por el que se le imponga una pena mayor a seis meses de prisión. Igualmente se le impone la condición de cumplir con la orden sanitaria de suspender la actividad de taller de ebanistería y retirar la maquinaria y equipo del lugar en que se advirtió el incumplimiento de la orden, siendo que, de incumplir esta condición o la otra que se ha indicado, se le revocará el beneficio otorgado y deberá descontar la pena que aquí se le ha impuesta. B) Se resuelve esta asunto sin especial condenatoria en costas, quedando a cargo del Estado los gastos del enjuiciamiento. Firme la sentencia inscríbase en el Registro Judicial y remítanse los testimonios de estilo para ante el Instituto Nacional de Criminología, el Juzgado de Ejecución de la Pena y el Archivo Judicial. Oportunamente archívese el expediente y sáquese del libro de entradas. HÁGASE SABER" (sic).

II.Que contra el anterior pronunciamiento, licenciado [Nombre3] , en su condición de defensor público del encartado [Nombre1] , interpuso recurso de apelación de sentencia.

III.Que verificada la deliberación respectiva, de conformidad con lo dispuesto por el artículo 465 del Código Procesal Penal, el Tribunal de Apelación de Sentencia del III Circuito Judicial de Alajuela, San Ramón, procedió a conocer del recurso.

IV. Que en los procedimientos se han observado las prescripciones legales pertinentes

Redacta la jueza de apelación de sentencia [Nombre5] ; y,

CONSIDERANDO:

I.El licenciado [Nombre3] , en su condición de defensor público del encartado [Nombre1] , interpuso recurso de apelación de sentencia, contra el fallo número 244-2016, dictado por el Tribunal de Juicio de Heredia.

II.En el único motivo de impugnación, el defensor indica que los hechos acreditados en la sentencia no son constitutivos del delito de desobediencia a la autoridad. Sostiene que es pacífica la posición de la doctrina y la jurisprudencia, en aceptar que la realización del delito contenido en el artículo 314 del Código Penal, tiene como requisito la legitimidad de la orden impartida por el funcionario público, porque de lo contrario se descartaría que el funcionario haya actuado en el ejercicio legítimo de sus funciones. Sostiene que la orden ASRH-R-C-0919-2013, que le hiciera el Área Rectora del Ministerio de Salud de Heredia, por medio de la funcionaria [Nombre6] , es absolutamente ilegítima. Afirma que la directriz sanitaria impartida violenta el principio de legalidad que gobierna la Administración Pública. Refiere que la ilegitimidad radica en que la Ley General de Salud, no faculta al funcionario público a emitir directrices bajo advertencia de ser sujeto de un proceso penal.

En su criterio, la autoridad pública puede impartir la orden, pero no advertir que su incumplimiento conlleva responsabilidad penal. Detalla que el artículo 378 de la Ley General de Salud, le atribuye una consecuencia distinta al incumplimiento de una orden sanitaria, ya que la norma citada indica que el omiso en el cumplimiento de una orden o medida especial, sufrirá la pena de cinco a treinta días multas. Añade que otro motivo en el que radica la ilegalidad de la orden, es que el contenido de la misma no está autorizado ni por la ley ni por el resto del ordenamiento jurídico. Indica que dentro de las atribuciones conferidas al Ministerio de Salud, para controlar la contaminación sónica, no se encuentra la suspensión de alguna actividad o el retiro de maquinaria de un inmueble. Sostiene, que con base en lo preceptuado en los artículos 292, 342, 355 y 356 de la Ley General de Salud, la orden impartida a su representado es ilegítima, porque el contenido de la misma no está autorizado por el bloque de legalidad que debe regir el actuar de la Administración Pública, máxime que se trata de una actividad sancionatoria, en la cual se deben respetar las garantías brindadas al ciudadano frente al ius puniendi del Estado.

Refiere el apelante, como otro aspecto que devela la ilegalidad de la orden, es que la funcionaria [Nombre6] , quien fue la servidora que emitió la orden sanitaria, no tenía competencia legal para girar la misma. Al respecto refiere que el artículo 337 de la Ley General de Salud, detalla los funcionarios que pueden emitir órdenes sanitarias, y en ese listado no se encuentra el cargo desempeñado por la referida servidora, quien ejerce el cargo de gestora ambiental, y por ende no está facultada para emitir órdenes de este tipo. Solicita se anule la sentencia impugnada y se absuelva de toda pena y responsabilidad al imputado. Se declara parcialmente con lugar el reclamo. Para una adecuada resolución de los reclamos planteados, es necesario separar los diversos reproches que formula el recurrente. Así, se tiene que el apelante ataca la legitimidad de la orden por tres razones esenciales, a saber: i) que la Administración Pública no está legitimada para emitir órdenes bajo la advertencia de que su incumplimiento acarrearía responsabilidad penal, ii) La funcionaria pública que dictó la orden no tenía competencia para emitir esa directriz, y iii) El contenido de la orden es ilegal, ya que el Ministerio de Salud no está facultado para suspender una actividad u ordenar que se retire maquinaria de un sitio determinado.

En relación con estos reproches no le asiste razón al recurrente. El que la orden sanitaria número N. ARSH-R-C-019-2013, notificada el 14 de agosto de 2013 (visible a folio 19 de los autos) indique expresamente que su incumplimiento acarrearía como consecuencia una eventual denuncia por el delito de desobediencia a la autoridad, contenido en el artículo 314 del Código Penal, no es un acto ilegítimo, toda vez que la Administración Pública, le está informando con antelación al administrado sobre la eventual comisión de una conducta delictiva, en caso de un incumplimiento a la directriz previamente notificada. Al respecto, debe agregarse que la Administración Pública, está en la obligación de informar a los administrados, no solo sobre las eventuales consecuencias que puede acarrear el incumplimiento de una orden o directriz, sino que también la misma debe contener toda la información posible, en aras de que el administrado pueda ejercer los derechos o recursos impugnaticios que estime oportunos.

Por otra parte, conforme quedó demostrado en la sentencia y así se desprende del sumario de prueba, la licenciada [Nombre6] , es funcionaria del Área de Salud de Heredia, y con ocasión de su cargo, se le encomendó atender la denuncia que un vecino había interpuesto contra el encartado ante el Ministerio de Salud, por la contaminación sónica y ambiental que generaba la actividad de ebanistería que éste realizaba en su casa de habitación. También quedó demostrado, que fue la funcionaria [Nombre6] la que emitió la orden sanitaria ARSH-R-C019-2013. Estos dos hechos no fueron controvertidos durante el proceso, y tampoco el apelante los debate en alzada. Lo que cuestiona el recurrente, es si la funcionaria [Nombre7] tenía competencia legal para dictar la citada orden, así como el contenido de la misma. Sobre este particular y luego de hacer un análisis de la Ley General de Salud, esta Cámara concluye lo siguiente: Los artículos 340 y 341 de la Ley General de Salud, establecen que la autoridad sanitaria está facultadas para emitir órdenes para prevenir o evitar riesgos o daños a la salud.

Adicionalmente el artículo 349 de la ley en comentario, establece: “Tendrán carácter de autoridad de salud los funcionarios del Ministerio que desempeñen cargos de inspección que hayan sido especialmente comisionados para la comprobación de infracciones a esta ley o a sus reglamentos, tendrán fe pública en cuanto a las denuncias que se formulen contra personas físicas o jurídicas por hechos o actos que involucren infracción a tales disposiciones o que constituyen delito. Tendrán este mismo carácter los Inspectores de Cuarentena.” Del anterior articulado se deriva con claridad, que los inspectores de salud, que han sido comisionados para la comprobación de infracciones a las normas sanitarias, tienen carácter de autoridad pública y en tal condición están legitimados para emitir órdenes generales o especiales, para prevenir o evitar un daño en la salud de las personas. De igual manera, el artículo 356 de la Ley en comentario, establece las acciones que puede ejecutar u ordenar la autoridad de salud, al momento de emitir una orden sanitaria.

Asimismo, los artículos del 357 al 365 de dicha ley especial, detallan el alcance y las acciones que puede ejecutar u ordenar una autoridad de salud, cuando emite una orden de este tipo. De este último grupo de normas se tiene que en efecto, la autoridad sanitaria está facultada para paralizar obras, así como para ordenar el retiro de bienes o productos. Ahora bien, volviendo al caso examinado, quedó demostrado que a la funcionaria [Nombre8] se le delegó por parte de la directora del Área de Salud de Heredia, el trámite de la denuncia que fue interpuesta en esa dependencia por un ciudadano y la referida servidora pública en su carácter de inspectora de salud, visitó la casa de habitación del imputado [Nombre1] , en la cual éste desarrollaba la actividad de ebanistería, sin contar con los respectivos permisos sanitarios. Debido a que se constató la infracción a las normas sanitarias, la funcionaria [Nombre6] , en fecha 14 de agosto de 2013, le giró y notificó al encartado [Nombre1] , la orden sanitaria N. ARSH-R-C-019-2013, en la que se ordenaba suspender la actividad del taller de ebanistería y retirar maquinaría y equipo, para lo cual se le otorgó un plazo de cinco días.

Dicha orden fue incumplida por el justiciable, en el tanto continuó con la actividad de ebanistería. Conforme con el análisis normativo realizado, y al amparo de los hechos probados, se concluye que la funcionaria [Nombre6] , sí estaba investida de la competencia legal para emitir una orden sanitaria. Asimismo, el contenido de la orden está dentro del ámbito de competencia de las funciones asignadas al Ministerio de Salud, por lo que las directrices allí dispuestas de suspender la obra y retirar la maquinaria no devienen en ilegítimas, por el contrario, se estiman útiles y necesarias a fin de evitar un daño en la salud de las personas que viven en esa localidad. En lo que sí lleva razón el apelante, es en cuanto a la tipicidad de los hechos tenidos por demostrados. En la sentencia, el juez de juicio estimó que el incumplimiento a la orden sanitaria, era constitutivo del delito de desobediencia a la autoridad contemplado en el artículo 314 del Código Penal, descartando la aplicación del artículo 378 de la Ley General de Salud.

Al respecto, hay que indicar que la fundamentación jurídica que contiene el fallo, en torno a ese extremo es insuficiente, ya que el juzgador se limitó a indicar que no era factible aplicar la contravención contenida en el numeral 378 de la Ley General de Salud, ya que la conducta acreditada constituía un delito. Ese examen resulta insuficiente, porque en la especie, lo que se debía analizar es si existe un concurso aparente de normas entre la conducta contenida en el artículo 314 del Código Penal y la contravención establecida en el artículo 378 de la Ley General de Salud. El concurso aparente de normas se encuentra regulado en el artículo 23 del Código Penal, que al efecto indica: “cuando una misma conducta esté descrita en varias disposiciones legales que se excluyan entre sí, sólo se aplicará una de ellas, así: la norma especial prevalece sobre la general, la que contiene íntegramente a otro se prefiere a ésta y aquella que la ley no haya subordinado expresa o tácitamente a otra, se aplica en vez de la accesoria.” Ahora bien, el artículo 314 del Código Penal establece: “Se impondrá prisión de seis meses a tres años, a quien no cumpla o no haga cumplir, en todos sus extremos, la orden impartida por un órgano jurisdiccional o por un funcionario público en el ejercicio de sus funciones, siempre que se haya comunicado personalmente, salvo si se trata de la propia detención.” Por su parte, el artículo 378 de la Ley General de Salud establece: “el omiso en el cumplimiento de las órdenes o medidas especiales o generales dictadas por las autoridades de salud, sufrirá la pena de cinco a treinta días multa, si el hecho no constituye delito.” El examen de esas dos disposiciones permite concluir que en ambas normas la acción descrita se refiere al hecho de incumplir la orden emanada por un funcionario público.

No obstante ello, el artículo 378 de la Ley General de Salud tiene varios elementos especializantes en relación con la conducta descrita en el numeral 314 del Código Penal. El artículo 378 posee varios elementos normativos que lo diferencian del artículo 314 del Código Penal. Por ejemplo, el artículo 378 de la Ley General de Salud, describe el incumplimiento de una orden especial o general dictada por una autoridad de salud. Es decir, este tipo de órdenes no las puede emitir cualquier funcionario público, sino sólo aquellos que estén revestidos de carácter de autoridad de salud. Adicionalmente, la conducta contenida en el artículo 378 de la Ley General de Salud, dirige la acción prohibida hacia aquellas personas a las que se les ha impartido una orden sanitaria, es decir, no es cualquier tipo de orden emanada por un funcionario público, sino es una orden que lo que busca en prevenir o evitar daños en la salud de las personas o en el ambiente.

Como se indicó anteriormente, a juicio de esta Cámara, lo que debió analizar el juez de juicio, era si se estaba ante un concurso aparente de normas el cual es regulado en el artículo 23 del Código Penal. En ese análisis jurídico, se tiene que uno de los principios a aplicar cuando nos encontramos ante un concurso de esta naturaleza es el principio de especialidad. Este principio existe según la doctrina "cuando un tipo penal regula de manera especial y más precisa mediante la agregación de otros elementos, la situación fáctica que otro tipo penal regula de la manera general. O planteado el asunto de otro modo, la especialidad existe cuando un tipo penal tiene todos los elementos de otro tipo penal, del cual se diferencia porque al menos contiene un elemento adicional especial" ([Nombre9] . Derecho Penal. Parte General. Tomo 3. San José. Continental. 2010 pp 586-587). De lo anterior se deduce que conforme al principio de especialidad, el tipo penal más específico prima sobre el más general.

En el caso bajo examen, se tiene que el tipo penal más específico, es el contemplado en la Ley General de Salud, el cual debe prevalecer sobre el tipo general previsto en el artículo 314 del Código Penal. De igual manera, es menester traer a colación que la Ley General de Salud, es norma especial, y fue emitida con posterioridad al Código Penal. Al respecto se tiene que el Código Penal fue publicado en La Gaceta número 257 del 15 de noviembre de 1970, pero entró en vigencia el 15 de noviembre de 1971. Por su parte la Ley General de Salud fue publicada en La Gaceta número 222 del 24 de noviembre de 1973, pero entró en vigencia hasta el 24 de febrero de 1974. Adicionalmente, si bien el tipo penal contenido en el actual numeral 314 del Código Penal, fue reformado por la ley número 8720 de 4 de marzo de 2009, lo cierto es que tanto en su versión original de 1970, como en la actual, la conducta sancionada es la misma, el incumplimiento de una orden impartida por un funcionario público.

Finalmente, se tiene que ambos preceptos legales tienen como bien jurídico tutelado a la autoridad pública. Sin embargo, se puede agregar que el artículo 3 78 de la Ley General de Salud, resulta más específico al caso examinado, porque dicha norma también tutela otro bien jurídico, a saber, la salud y el ambiente, ya que las órdenes sanitarias emitidas por dicha autoridad pública en el marco de sus competencias, lo son para prevenir o evitar un daño en la salud de las personas o en el medio ambiente. Por lo que al amparo del bien jurídico tutelado y según las circunstancias específicas del caso juzgado, se tiene que la norma que mejor describe la conducta ilícita es la contenida en el artículo 378 de la Ley General de Salud. Por último, aunque la norma del artículo 378 de la Ley General de Salud, indica que esa descripción típica se aplica si el hecho no constituye delito, dicha técnica legislativa, no implica una subordinación legal de la norma contenida en la Ley especial, en relación con el tipo penal del artículo 314 del Código Penal.

Como se ha analizado en este fallo, al promulgarse la Ley General de Salud, el legislador creo un tipo normativo que contiene una descripción típica más adecuada a la conducta juzgada en el caso bajo examen. Adicionalmente, si se aceptara una subordinación legal de la norma general sobre la especial, ello significaría una desaplicación implícita del precepto legal contenido en la Ley General de Salud, en todos los casos en que se incumpla una orden sanitaria. Por otra parte, aunque es un contrasentido la técnica legislativa utilizada en la norma especial, la función de los jueces se limita a aplicar el Derecho en cada caso concreto y en este asunto en particular, se tiene claro que la acción acreditada se encuentra descrita en las dos figuras penales diversas, por lo que es criterio de esta Cámara de Apelación de Sentencia, que la determinación sobre cuál norma aplicar, debe regirse por los criterios de especialidad y los principios generales del Derecho Penal, antes referenciados.

En consecuencia, se declara parcialmente con lugar el motivo. Se recalifican los hechos tenidos por demostrados. Por ello, se tiene por establecido que la conducta atribuida al encartado es constitutiva de la contravención establecida en el artículo 378 de la Ley General de Salud y por ende se anula la pena impuesta. Ahora bien, siendo que acción penal, por los hechos así recalificados, no se encuentra prescrita, toda vez que entre la indagatoria del justiciable y el dictado de la sentencia, han operado otros actos procesales que han interrumpido el plazo de dos años de prescripción que rige en materia contravencional, tales como el señalamiento a audiencia preliminar -folio 59- y la convocatoria a debate -folio 85-, lo que procede es ordenar el juicio de reenvío para una nueva fijación de la pena. En lo demás queda incólume el fallo.

POR TANTO

Se declara parcialmente con lugar el recurso de apelación interpuesto por la defensa pública. Se recalifican los hechos tenidos por demostrados a la contravención contenida en el artículo 378 de la Ley General de Salud. Se anula la pena impuesta. Se ordena el juicio de reenvío para una nueva fijación de la pena. En lo demás queda incólume el fallo.
