SECOND JUDICIAL CIRCUIT OF SAN JOSÉ.- At dieciséis horas y treinta y cinco minutos on veinte de marzo de dos mil diecisiete.- POSSESSORY INFORMATION PROCEEDING brought by VISTA ALTO DEL MONTE SOCIEDAD ANÓNIMA, corporate identification number CED1 - - , represented by its general attorney-in-fact with unlimited authority [Nombre1], of legal age, married, homemaker, resident of [Dirección1], identity card number CED2 - - .   1. 1The petitioner company instituted these possessory information proceedings so that, through this procedure, the following parcel of land may be registered in the Public Property Registry: “Land consisting of pasture and brushland, located at [Dirección2], Province of Alajuela, bounded on the north by Aderita Sánchez López, on the south by Vista Alto del Monte S.A., on the east by Aderita Sánchez López, and on the west by [Dirección3], with frontage measuring cincuenta y dos metros con sesenta y dos centímetros lineales, described in cadastral plan number A-1696037-2013 dated 24 de octubre del 2013. It measures ocho mil trescientos seis metros cuadrados,” (See Virtual Desktop of the Agrarian Court of Alajuela, Pleadings Tray, file dated 10/06/13 at 10:58:04 a.m.).-

  5. 5The legal requirements were observed in the conduct of the proceeding, and the decision contains no apparent errors or omissions capable of rendering it null and void.-

Drafted by Judge DARCIA CARRANZA; and,

CONSIDERING:

I.The findings of proven fact are affirmed because they are well supported by the record. The following shall also be deemed proven facts: 8.- The property that is the subject of the title proceeding has been privately held for more than 60 years (see testimony of [Nombre2], [Nombre3], and [Nombre4] (see testimony on the virtual desktop, Oral Hearing 03/12/2015 09:34:44)). 9.- The land that is the subject of the title proceeding has been devoted to pasture (see testimony on the virtual desktop, Oral Hearing 03/12/2015 9:34:44).

II.The finding that the fact was not proven is not affirmed because, upon considering the evidence globally and as a whole, and contrary to the ruling of the judge a quo, this Chamber finds that ten-year possession beginning ten years before the protected wildlife area (área silvestre protegida) was declared was indeed proven.

III.Attorney Karen Daniela Oconitrillo Quesada, in her capacity as special judicial attorney-in-fact for VISTA ALTO DEL MONTE SOCIEDAD ANONIMA, the petitioner company, formally filed an APPEAL against decision N° 78-2016 issued at catorce horas y treinta minutos on treinta de agosto del año dos mil dieciséis. The appeal was brought on the grounds that the decision lacks a factual and legal basis and improperly assesses the evidence. The challenge is based on the reasoning I shall now set forth: The decision denies the possessory information proceeding solely on the following ground: “... However, after analyzing the evidence presented in the record, it is concluded that this requirement lacks evidentiary support. In this regard, the witness [Nombre4], identity card CED7, states that he is 23 years old and has known the property for approximately eighteen years. Accordingly, he has known the land since 1997, by which time it had already been designated as a protected zone (zona protectora).

This follows from the fact that the evidence was received on 03 de diciembre del 2015, as may be inferred from the minutes of the testimonial evidence incorporated on that date. The testimonial evidence can also be heard in the audio file incorporated on 03 de diciembre del 2015. Although the witness statements establish that the land has been used for livestock farming, it cannot be determined that the petitioner company or its transferor exercised those acts of possession (actos de posesión) before the ten-year period preceding the creation of the protected zone. Based on the foregoing, it is not appropriate to find that the requirement imposed by section 7 of the Ley de Informaciones Posesorias has been proven with respect to the ten-year possession required to register properties in protected areas. Given the disposition reached, and because it is unnecessary, the remaining grounds stated by the State entity in its final submission will not be considered.”- First, in the quoted portion of the decision, the Judge states that the present proceedings cannot be granted for one very specific reason: Mr. [Nombre4] is 23 years old and has known the property for approximately eighteen years.

Accordingly, he has known the land since 1997, by which time it had already been designated as a protected zone... It cannot be determined that the petitioner company or its transferor exercised those acts of possession before the ten-year period preceding the creation of the protected zone. However, this representation considers that interpretation incorrect for the following reasons: The prevailing legal scholarship states the following regarding possession in adverse-possession proceedings (proceso de usucapión): “Both legal scholarship(3) and case law(4) distinguish two types of agrarian adverse-possession actions (acciones de usucapión agraria): ordinary and special. Ordinary agrarian adverse possession requires compliance with the requirements established in the Civil Code for acquiring property by acquisitive prescription (prescripción positiva). The plaintiff must prove the exercise of possession as owner, publicly, peacefully, and uninterruptedly.

Such possession, however, must not be ‘civil’ but agrarian, which entails the exercise of agrarian possessory acts (actos posesorios agrarios) intended to cultivate and improve the property sought to be acquired by adverse possession, in fulfillment of the social function of agrarian property. The required period of possession is the same, namely ten years. The requirements of color of title (justo título) and good faith (buena fe) are also imposed for ordinary agrarian adverse possession. Color of title may transfer possession, in which case the plaintiff must establish that possession was acquired from a prior transferor, whether through a bill of sale, assignment, donation, or even testimonial evidence, but must prove the duration of personal possession and the duration of the transferred possession in order to complete the ten-year period of possession.” The case file clearly contains more than one type of evidence, as the applicable law provides and permits, and the evidence must also be considered in its entirety.

First, pages 15 and 16 contain a private sale showing that Ms. [Nombre5] sold the property to Vista Alto del Monte S.A., the petitioner in these proceedings, and that the transferor had previously acquired it from Mr. [Nombre6], who in turn had acquired it from his father, [Nombre7], more than 50 years ago, as fully confirmed by the petitioner’s witnesses [Nombre2], [Nombre3], and [Nombre4], as will be analyzed below. Clearly, the aforementioned witnesses provided not only a concise and clear account, but their testimony also identifies the chain of title (tracto sucesivo), which has been duly proven by the testimonial and documentary evidence already cited and contained in the record, extending back more than 50 years. Thus, the testimonial evidence offered by my client may be summarized as follows: Mr. [Nombre4], who states in his testimony that he has known the property for as long as he can remember and knows from personal knowledge that the property has belonged to his family and that the property to be titled, which is the subject of these proceedings, belonged to his uncle, as well as that his father acquired it from his parent (his grandfather), a circumstance reflected in his testimony, in which he stated that he has known these circumstances for as long as he can remember

of sound judgment, and therefore his testimony cannot be deemed incorrect or untruthful. In addition, Article 7 of the Ley de Informaciones Posesorias provides: “When the property referred to in the possessory information proceeding (información posesoria) is located within a protected wildlife area (área silvestre protegida), regardless of its management category, the applicant for title (titulante) must demonstrate that the applicant holds the legal rights to ten-year possession (posesión decenal), exercised at least ten years before the effective date of the law or decree creating that protected wildlife area.... Without exception, the registered survey plats (planos catastrados) submitted in possessory information proceedings must be certified by the Ministry of Environment and Energy, through the responsible agency, which shall attest whether the property for which title is sought is located inside or outside such protected wildlife areas.

(As amended by Article 72, subsection c), of Ley Forestal No.7575 of February 13, 1996)....” Under the aforementioned article, the applicant for title must demonstrate that the applicant holds the legal rights to ten-year possession, exercised at least ten years before the effective date of the law or decree creating that protected wildlife area, a circumstance fully established by the evidence submitted in the case file, since, as indicated, the property belonged to Mr. [Nombre7] more than 50 years ago, well before 1976, when the protected wildlife area was decreed. The cited article does not establish that ten-year possession before the declaration of the protected area must be demonstrated through three witnesses, as the a quo stated; rather, it provides that the petitioner must demonstrate ownership of the legal rights of possession exercised ten years before the corresponding declaration, a circumstance established by documentary evidence and also by testimonial evidence.

The trial judge’s error lies in having analyzed only the testimony of [Nombre4], while excluding from the analysis the witnesses [Nombre2] and [Nombre3], as well as the documentary evidence cited above. Moreover, in our view, the requirement is not that the witnesses referred to in Article 6 of the Ley de Informaciones Posesorias be more than 50 years old, but that they have knowledge of the derivative possession (posesión derivada). All the witnesses agreed that the petitioner’s possession derived by succession from different owners over a period of more than 50 years. The evidence in the case file, specifically the testimonial evidence of the three witnesses examined, clearly demonstrated the applicant’s ten-year possession; moreover, the ten-year possession predating the declaration of the protected area was duly established by the testimonial evidence in the record, by the personal knowledge testimony of two witnesses, [Nombre2] and [Nombre3], and by the hearsay testimony (declaración de referencia) of the witness [Nombre4].

The a quo’s interpretation requiring the testimony of all three witnesses to demonstrate ten-year possession predating the declaration of the protected area would constitute a restrictive interpretation of the law, because it would mean that the legislature had enacted a law applicable only for a limited time, which it did not; once more than 80 years have passed since a particular area was declared protected, it will be difficult, if not impossible, to find three witnesses old enough to establish that they were present at the time and place of that ten-year possession predating the declaration of the protected area and could personally attest to that fact. Accordingly, the possession that the law requires to be clearly demonstrated through testimonial evidence is the ten-year possession preceding the filing of the corresponding title proceedings (diligencias de titulación), and not, as the Judge interprets it, that the ten-year possession predating the declaration must be demonstrated solely through testimonial evidence (the three witnesses, as stated in the preceding paragraph); the latter may be demonstrated by other means, including testimonial and documentary evidence.

It considers that it was fully and conclusively established, as shown by the evidence gathered in these proceedings, that the ten-year possession predating the declaration of the protected area dated July 17, 1976, and the chain of title (tracto sucesivo) for the property in question were duly demonstrated. It states that it is noteworthy to the ad quem that these proceedings, as it has been explaining, included not only the testimony of [Nombre4], but also other testimonial evidence consisting of the depositions of [Nombre2] and [Nombre3], aged 70 and 61, respectively, who consistently testified to their personal knowledge of the property that is the subject of these title proceedings for more than 50 years (see folios 93 - 94, containing the audio recording of the witness examination hearing held on December 3, 2015); their testimony reliably establishes the possession exercised and the chain of title through the company that currently owns the property and the previous owners, including the ten-year period of possession predating the declaration of the protected area.

Likewise, the witness [Nombre4], aged 23, testified with absolute clarity regarding the ten-year possession exercised by the plaintiff company and its immediate predecessor in title and, based on his family knowledge of the succession history of the property for which title is sought, also recounted the right of possession (derecho de posesión) over that property dating back to when it belonged to his grandfather, [Nombre7]; this was truthful, informed, and consistent testimony that cannot in any way be discredited as the Trial Judge did. Likewise, in the appealed judgment, the Judge states as follows: “Although the witness statements indicate that the land has been used for livestock farming, it cannot be determined that such acts of possession (actos de posesión) were exercised by the applicant company or its transferor more than ten years before the protected area was created. Based on the foregoing, it is not appropriate to deem the requirement established in Article 7 of the Ley de Informaciones Posesorias to have been proven with respect to the ten-year possession required to register properties in protected areas.” Regarding this issue, the Judge is also mistaken because, as demonstrated by the depositions of the witnesses examined and by the land-use certification (certificación de uso de suelo) in the record, possession was exercised through the use of the property as pasture throughout that entire period, an activity that in itself entails specific maintenance and unquestionably constitutes an act of possession of the property.

In this regard, see folios 93 - 94, containing the audio recording of the witness examination hearing held on December 3, 2015, and folios 36- 37, containing the inspection certification for possessory information proceedings. Accordingly, not only the legislation but also the doctrinal and case-law interpretations of our highest Courts have established the meaning of derivative possession, which was clearly demonstrated in this case file; therefore, Vista Alto del Monte S.A. has acted in full compliance with Articles 1, 6, and 7 of the Ley Informaciones Posesorias. Regarding evidence and the granting of title in protected wildlife areas, the Tribunal Agrario, in Judgment N° 00192 of February 28, 2013, at 11:45: 00 a.m., under case file EXPN1, stated as follows: “XIX.- One of the most controversial issues concerning restrictions on property for the fulfillment of its environmental function is the possession and granting of title to forests and land located in protected areas.

The treatment of this issue within the context of possessory protection (protección posesoria), private property, and acquisitive prescription (usucapión) has been the subject of analysis and debate in both legal scholarship and case law. The concept of ecological possession (posesión ecológica) is not universally accepted. Various doctrinal approaches have been advanced, and the case law requires proof that the ecological function has been fulfilled in order to protect possession and ownership. The entire issue arises from the application of Article 7 of the Ley de Informaciones Posesorias, which currently provides: ‘Article 7.- When the property referred to in the information is located within a protected wildlife area, regardless of its management category, the applicant for title must demonstrate that the applicant holds the legal rights to ten-year possession, exercised at least ten years before the effective date of the law or decree creating that protected wildlife area.

Properties located outside those areas that contain forests may be titled only if the petitioner demonstrates that the petitioner holds the legal rights to ten-year possession, exercised for at least ten years, and has protected that natural resource, it being understood that the property must be properly demarcated and enclosed by fences or cleared boundary paths...’ (Ley de Informaciones Posesorias, Article 7. Amended by Ley Forestal, No. 7575 of February 5, 1996). Regarding the application of this provision, contrary to what the a quo stated in her substantive analysis—as to the impossibility of applying the aforementioned Article 7 retroactively—the Sala Constitucional has held that this provision may be applied retroactively from the time the property becomes subject to the public domain (dominio público), because ten-year possession consolidated before the declaration of any reserve or protected area is protected by the aforementioned legal provision (see decision of the Sala Constitucional, No. 4597, at 15:45 on August 5, 1997).

The Court therefore does not agree with the trial judge’s assertion in that regard. In any event, as we shall see, the circumstances of these proceedings are entirely different, because neither the plaintiff nor the defendant has possessed as owner (a título de dueño) land that belonged, and continues to belong, to the State Forest Estate (Patrimonio Forestal del Estado). (...) Furthermore, it is important to clarify that, in this case, the legislature established a series of more stringent requirements for obtaining title through a possessory information proceeding, precisely to prevent adverse effects on the Patrimonio Forestal del Estado, protected areas, and their biodiversity. Therefore, the Ley of possessory information proceedings (informaciones posesorias), in Article 7, requires proof, in addition to possession for ten years before the creation of the respective protected area, that the forest has been preserved.

The ten years preceding its creation are required precisely to protect those private parties who had consolidated their possessory right (derecho de posesión) ten years before the area was created, that is, before it became subject to the public domain (dominio público) (See, among others, Tribunal Agrario, No.124 de las 11:30 horas del 14 de marzo del 2003). The opposition of the State entity, both the Instituto de Desarrollo Rural and the Procuraduría General de la República, has been continuous and systematic. In addition, Article 11 of the Ley de Informaciones Posesorias is mandatory in providing that the judge: “Shall reject it upon determining that the applicant is improperly seeking title to national public lands (baldíos nacionales) or land belonging to any State institution, as well as forest reserves, national parks, or biological reserves.” This is intended to prevent State property from being titled through non-contentious judicial proceedings (diligencias de jurisdicción voluntaria).

This rule would apply in these ordinary declaratory proceedings concerning agricultural acquisitive prescription (usucapión agraria) claimed by the plaintiff company. Ordinary agricultural acquisitive prescription, by contrast, requires, in addition to the foregoing requirements, color of title (justo título) and good faith (buena fe). It may involve an original basis (such as a possessory right) or a derivative basis (through a contract transferring possession (contrato traslativo posesorio)). As to good or bad faith, the former is always presumed; however, a person is a possessor in bad faith (poseedor de mala fe) if, upon taking possession, that person had sufficient grounds for doubt (Articles 284, 287, and 286 of the Código Civil). Good or bad faith is linked to the person’s conviction that the property possessed is that person’s own and that the person who transferred it was its lawful owner.

One of the appellant’s principal grounds of appeal concerns the requirements for ordinary agricultural acquisitive prescription, asserting that the requirements established by our legal system have been met, namely color of title, good faith, and possession for ten years in a quiet, public, peaceful, and uninterrupted manner. Section 853 of the Código Civil requires three fundamental elements without which acquisitive prescription cannot operate, namely, color...” That decision highlights the evidentiary requirement concerning possession for ten years before the establishment of the Protective Zone (Zona Protegida); however, it does not restrict proof to any particular type of evidence or establish any maximum number of witnesses. It must be noted that the purpose of the State’s involvement through its various entities is to prevent title from being improperly granted over national public lands or land belonging to any State institution, as well as forest reserves, national parks, or biological reserves.

That situation differs from the present case because it has been clearly established that this is private property and that it was possessed for 10 years before the decree designating [Dirección4] as a Protective Zone (Zona Protectora).

IV.After carefully and jointly analyzing all the evidence submitted in these possessory information proceedings, filed by the applicant company Vista del Monte Sociedad Anónima, represented by señora [Nombre1], and assessing the evidence conscientiously and without strict adherence to the rules of ordinary law (Article 54 of the Ley de Jurisdicción Agraria), this Court reaches the inescapable conclusion that these proceedings must be approved because the requirements established by the legal system for proving ten-year possession (posesión decenal), exercised both by the applicant and by its prior transferor, have been met. The Ley de Informaciones Posesorias establishes the procedure by which any person who has acquired ownership rights through acquisitive prescription may register them with the Registro Público, thereby safeguarding the right of access to property set forth in Article 45 of the Constitución Política.

In Article 1, the Law refers to the requirements established by Article 856 of the Código Civil, namely possession for more than ten years, exercised as owner, publicly, peacefully, uninterruptedly, and in good faith. It does not require an instrument transferring possession (título traslativo posesorio) if the person claiming acquisitive prescription has exercised possession under those conditions for more than ten years, because such an instrument is unnecessary once the period required to acquire ownership has been completed. Pursuant to Article 863 of the Código Civil, the applicant is required only to do the following: “When the title applicant (titulante) has not possessed the real property for ten years, the applicant may rely on possession exercised by the applicant’s transferors, but in such case must submit a public instrument evidencing the transfer of the applicant’s right, although not that of prior possessors.” This means that only when the possession of the transferor is to be added to the ten-year possession period is it necessary to submit an instrument transferring possession or, alternatively, to prove the transferred possession through competent testimonial evidence (prueba testimonial idónea).

V.A possessory information proceeding is a non-contentious judicial process (actividad judicial no contenciosa) for formalizing a registrable title to an ownership right acquired through acquisitive prescription, upon satisfaction of the corresponding statutory requirements. Possession as owner must be demonstrated to have been quiet, public, peaceful, and uninterrupted (Article 1 of the Ley de Informaciones Posesorias and Article 856 of the Código Civil). In addition to lacking a title registered or eligible for registration in the Registro Público, the title applicant must expressly state that the parcel (finca) has not previously been registered in the Registro Público. For reasons of public interest, and to prevent duplicate registration of the same property or to protect third parties with rights superior to those of the title applicant, the law requires notice to certain parties. It also establishes an opposition procedure within the possessory information proceeding if any interested party believes that the granting of title (titulación) would be prejudicial (Article 8).

The Ley de Informaciones Posesorias directs the Judge to treat adjoining landowners (colindantes) as parties and therefore to serve them personally from the outset of the proceedings, because the title sought could encompass part of the land belonging to them. Notice must also be given to co-owners or condominium owners (condueños o condóminos), where any exist. Likewise, to safeguard the interests of the State, the Procuraduría General de la República and the Instituto de Desarrollo Agrario must be treated as parties to protect, in the former case, property subject to the public domain and, in the latter, State-owned agricultural property (propiedad agraria estatal) (Article 5). Finally, the Law directs that all interested parties who may have a legitimate interest in the proceedings be summoned through publication of a notice (edicto) in the Boletín Judicial (see the same Section 5 ibídem).-

VI.Regarding the principle of free assessment of evidence (libre valoración probatoria) in agrarian matters, this Tribunal has stated: “VI. …The examination or assessment of evidence (apreciación o valoración probatoria) consists of the selection that the judge must make from among the sources of evidence obtained in order to establish which of them are effective for resolving the dispute submitted for adjudication. This selection allows the judge to choose between the divergent positions presented by each party to the procedural relationship. This activity requires several basic intellectual steps identified by legal scholarship: Evidentiary activity always involves three basic aspects: perception, representation or reconstruction, and deductive or inductive reasoning. A judge cannot acquire knowledge of a fact without personally perceiving something through the senses; to that end, as [Nombre8] states, contact between the judge and the reality that must be adjudicated is unavoidable.

The judge may observe the facts directly or indirectly through accounts given by other persons or through certain objects or documents. This is always a sensory operation, without which it would be impossible to assess the content and persuasive force of evidence. Once the facts have been perceived individually, they must be historically reconstructed, and this cannot be done in isolation, because the reconstruction must be undertaken as a whole and with the care necessary to avoid admitting facts that distort reality or alter its meaning. General rules of experience are also valid for purposes of this assessment…. The perception of the means, conditions, and place in which the events occurred will subsequently allow the judge to perform an interpretive task. Indeed, once the judge has perceived the evidence, the judge must interpret the evidentiary information in order to give it legal meaning.

Third, the judge must establish the degree of effectiveness attributable to each item of evidence, both from a formal standpoint—whether the type of evidence is recognized by law and has been duly produced—and from a substantive standpoint—the sincerity or truthfulness of the source, in order to determine whether the witness is lying or whether the document has been altered. A fourth step consists of verifying whether the judge is legally bound by any type of evidence under the statutory or fixed-evidence system (sistema de prueba legal o tasada). This does not apply when the judge may assess the evidence freely, as is the case in agrarian matters. Finally, the judge must reconstruct the disputed facts as, in the judge’s view, they occurred, considering and carefully evaluating all sources of evidence as a whole. This entails assessing the evidence as a whole, from which the duty to state the reasons for the judgment arises.

The agrarian judge comes into contact with the facts through direct and immediate perception or observation ‘in situ.’ The agrarian judge’s conviction is a psychological act applied to a specific, living situation inherent in agrarian reality. The Agrarian Judge must examine the credibility of what a witness or party says in order to properly assess its value. The judge must also analyze social experience, the setting—the agrarian world—in which the dispute unfolds, and even the culture and conduct of rural inhabitants. Accordingly, consideration must be given, on the one hand, to the authenticity and sincerity of each item of evidence in the case of documents, confessions, and testimony and, on the other, to its accuracy and credibility. This safeguards the principles of loyalty and probity in the resulting evidentiary element. The parties to the proceeding have the right to know all relevant factors that contributed to the formulation of the decision.

The reasons and legal grounds for the decision are what permit review by the higher court. In other words, the agrarian judge associates a particular situation—the specific case—with similar real-world situations that the judge has come to know through experience.” (Tribunal Agrario, No. 206 de las 14:50 horas del 26 de marzo de 1999). The foregoing view is shared by the Sala Primera de la Corte Suprema de Justicia, which held: “The system of free assessment of evidence surpasses both the traditional statutory-evidence system and the sound-judgment standard (sana crítica) governing civil proceedings. The manner in which agrarian proceedings were conceived allows the judge broad discretion to assess the facts alleged by the parties. That system is not arbitrary; on the contrary, under the free-assessment system, the evidence must be assessed through reasoned and critical analysis grounded in logic, experience, and psychology.

In stating the reasons for the decision, the judge must set forth the grounds for the conviction that led to the ruling. Unlike the statutory-weight system (sistema de tarifa legal), under which evidence is assessed according to predetermined legal rules and even its admissibility must be established in advance by the Legal System, under the free-assessment system the judge has discretion to admit evidence according to the judge’s own criteria.” (N° 398-F-01 de las 16 horas del 6 de junio del 2001). It has likewise ruled on this issue: “The Ley de Jurisdicción Agraria, both in Article 54, with respect to trial judges, and in Article 61, with respect to cassation judges, authorizes assessment of the evidentiary material without strict adherence to the rules of ordinary law. In such cases, the judge must state the principles of equity or law upon which the judge’s reasoning is based. This is the free-assessment system, not assessment according to conscience (valoración a conciencia), since the latter is characteristic of non-lawyer adjudicators.” (N°46-F-95 de las 15 horas del 26 de abril de 1995). (VOTO 673-F-2003 de las 11:25 hrs. del 15 de octubre de 2003).-

VII.Against that background, the Tribunal considers that the representative of the petitioner is correct in her grounds of appeal. The core of her challenge concerns the trial judge’s dismissal of these proceedings due to the insufficiency of the testimony of witness [Nombre4]—who was only 23 years old—to prove that the petitioner company had possessed the property for ten years before the declaration of the [Dirección5] Protegida. It bears recalling, as stated in the preceding recitals (considerandos), that in this area evidence is freely assessed without strict adherence to the rules of ordinary law (Article 54 of the Ley de Jurisdicción Agraria) and that, in possessory-information proceedings (informaciones posesorias), every agrarian judge is obligated to verify with certainty that the statutory requirements for acquiring ownership by adverse possession (usucapir) have been met. Indeed, upon analyzing the evidence presented as a whole with respect to ten-year possession (posesión decenal), witness [Nombre2] stated, insofar as relevant, that he was over seventy years old and had known the property for which title is sought for more than 60 years.

He further stated that the land had been used as pasture and had belonged to [Nombre9], who sold it to his father, [Nombre7]; the land was subsequently divided among his siblings, and the portion for which title is sought was allotted to his brother [Nombre6], who sold it approximately ten years ago to [Nombre5], who is doña [Nombre1]’s sister. The declarant [Nombre3] stated that he was 71 years old and had known the property his entire life, for well over fifty years; that it had belonged to [Nombre9], who sold it to [Nombre7]; that the land had been used as pasture; that it was subsequently divided among [Nombre7]’s children; that this portion of the property was allotted to [Nombre6]; and that [Nombre6] sold it approximately ten years ago, he believed to the company. Witness [Nombre4] stated that he was 23 years old, that he had known the property his entire life, and that what he remembered was that the property belonged to his uncle [Nombre6], who sold it approximately ten years ago to [Nombre5], who is doña [Nombre1]’s sister, and that she sold it to the petitioner company approximately three years ago.

He stated that he knew from what others had told him that the land had belonged to his grandfather [Nombre7], who had purchased it from [Nombre9] (see testimony in the virtual case file, Oral Hearing 03/12/2015 09:34:44). Although it could be questioned, as the State Attorney did and as the court a quo relied upon in dismissing the matter, whether this last witness was unsuitable for purposes of proving ten-year possession because he stated that he had known the property for “eighteen years,” the fact remains that his testimony must be assessed together with the entire body of evidence (acervo probatorio) brought into the proceeding by the judge a quo, in order to determine whether his statements are consistent with the other evidence in the record. All the witnesses agreed that the company seeking title and its transferors had possessed that property for more than fifty years. In this regard, and still within the parameters of the free assessment of evidence under the aforementioned Article 54 of the Ley de la Jurisdicción Agraria, the Tribunal analyzes the foregoing testimony together with the public deed of sale (escritura pública de compraventa) for the property at issue in these proceedings, executed between [Nombre1], as representative of the petitioner company, and [Nombre5], which provides: “…FIFTH: THE SELLER TRANSFERS TO THE BUYER THE POSSESSION SHE HAS EXERCISED OVER THIS PROPERTY QUIETLY, PUBLICLY, PEACEFULLY, UNINTERRUPTEDLY, IN GOOD FAITH, AS OWNER, WITH BOUNDARIES SEPARATING IT FROM THE NEIGHBORING PROPERTIES, AND FOR MORE THAN TWELVE YEARS.” This satisfies both the provisions of the third paragraph of Article 1 of the Ley de Informaciones Posesorias and those of section 6 of that Law, because the former states: “When the person seeking title has not possessed the property for ten years, that person may rely upon the possession exercised by the transferors; in such a case, however, a public document recording the transfer of that person’s right must be submitted, although documents concerning previous possessors need not be submitted” (emphasis not in the original); and the latter states: “Possession shall be substantiated by the testimony of three witnesses who reside in the canton where the property is located and who shall be questioned as to how long they have known the property and whether they have personal knowledge that it has been possessed by the person seeking title or by previous owners for a continuous period of no less than 10 years…” (emphasis not in the original).

Having jointly analyzed the entire body of evidence contained in the record, this Tribunal has no doubt that the petitioner’s ten-year possession has been established; pursuant to the foregoing provisions, the petitioner has relied upon the possession exercised by its previous transferor, [Nombre5], for purposes of obtaining the title it seeks.- In addition, the cited testimonial evidence establishes longstanding possession of the property for which title is sought, extending over more than sixty years among all possessors in the transferred chain of possession (cadena posesoria) relating to the property for which title is sought.

VIII.In view of all the foregoing, the appellant’s claims of error being well-founded, the judgment rendered must be reversed. In its place, the possessory title proceedings (diligencias de Información Posesoria) filed by VISTA ALTO DEL MONTE SOCIEDAD ANÓNIMA, corporate identification number CED1 - - , represented by its general attorney-in-fact with unlimited authority (apoderada generalísima sin límite de suma), [Nombre1] , of legal age, married, homemaker, resident of [Dirección1] , identity card number CED8 - - , are granted, and it is ordered that the following-described land be registered in the Public Property Registry (Registro Público de la Propiedad) in the name of VISTA ALTO DEL MONTE SOCIEDAD ANÓNIMA: Land consisting of pasture and scrubland, located in [Dirección2] , Province of Alajuela, bounded to the north by [Nombre10] , to the south by Vista Alto del Monte S.A., to the east by [Nombre10] , and to the west by [Dirección3] , with fifty-two linear meters and sixty-two centimeters of frontage, as described in cadastral survey plan (plano catastrado) number A-1696037-2013 dated 24 de octubre del 2013.

It measures eight thousand three hundred six square meters. These proceedings and the land are valued at five million colones. The property remains subject to the statutory reservations (reservas legales) of the Ley de Caminos Públicos pursuant to Article 19 of the Ley de Informaciones Posesorias. The trial court shall issue the corresponding certified enforceable judgment (ejecutoria) and is authorized to make any corrections necessary to obtain registration.

POR TANTO:

The judgment rendered is reversed. In its place, the possessory title proceedings filed by VISTA ALTO DEL MONTE SOCIEDAD ANÓNIMA, corporate identification number CED1 - - , represented by its general attorney-in-fact with unlimited authority, [Nombre1] , of legal age, married, homemaker, resident of [Dirección6] de Atenas, identity card number CED8 - - , are granted, and it is ordered that the following-described land be registered in the Public Property Registry in the name of VISTA ALTO DEL MONTE SOCIEDAD ANÓNIMA: Land consisting of pasture and scrubland, located in [Dirección7] , Atenas, Province of Alajuela, bounded to the north by [Nombre10] , to the south by Vista Alto del Monte S.A., to the east by [Nombre10] , and to the west by [Dirección3] , with fifty-two linear meters and sixty-two centimeters of frontage, as described in cadastral survey plan number A-1696037-2013 dated 24 de octubre del 2013. It measures eight thousand three hundred six square meters. The property remains subject to the statutory reservations of the Ley de Caminos Públicos. These proceedings and the land are valued at five million colones. The trial court shall issue the corresponding certified enforceable judgment and is authorized to make any corrections necessary to obtain registration.

VOTO N° 244-F-2017 TRIBUNAL AGRARIO. SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ.- A las dieciséis horas y treinta y cinco minutos del veinte de marzo de dos mil diecisiete.- PROCESO DE INFORMACIÓN POSESORIA promovida por VISTA ALTO DEL MONTE SOCIEDAD ANÓNIMA, cédula jurídica CED1 - - , representada por su apoderada generalísima sin límite de suma [Nombre1] , mayor, casada, de oficios domésticos, vecina de [Dirección1] , cédula de identidad número CED2 - - . RESULTANDO:

  1. 1La sociedad promovente interpuso las presentes diligencias de información posesoria para que por medio de esta vía se proceda a inscribir en el Registro Público de la Propiedad el terreno que se describe así: " Terreno de naturaleza de potrero y charral, situado en el [Dirección2] , de la Provincia de Alajuela, colinda al norte con Aderita Sánchez López, al sur con Vista Alto del Monte S.A., al este con Aderita Sánchez López, y al oeste con [Dirección3] con un frente de cincuenta y dos metros con sesenta y dos centímetros lineales, descrito en el plano catastrado número A-1696037-2013 de fecha 24 de octubre del 2013. Mide ocho mil trescientos seis metros cuadrados," (Ver Escritorio Virtual del Juzgado Agrario de Alajuela, en Bandeja de Escritos, archivo del 10/06/13 de las 10:58:04 a.m.).-

3 .- El juez Rodolfo Vásquez Vásquez, del Juzgado Agrario de l Primer Circuito Judicial de Alajuela, mediante sentencia número 78-2016 de las catorce horas treinta minutos del treinta de agosto de dos mil dieciséis , resolvió: “ POR TANTO: " De acuerdo a lo expuesto y citas de ley SE RECHAZAN LAS PRESENTES DILIGENCIAS DE INFORMACIÓN POSESORIA interpuestas por VISTA ALTO DEL MONTE SOCIEDAD ANÓNIMA, (Ver Escritorio Virtual del Juzgado Agrario de Alajuela, en Documentos Asociados, archivo del 31/08/16 de las 10:01:37 a.m.).- 4 .- La licenciada Karen Daniela Oconitrillo Quesada , en su condición de apoderada especial judicial de la sociedad promovente, formuló recurso de apelación con indicación expresa de las razones por las cuales refuta la tesis del Juzgado de instancia , (Ver Escritorio Virtual del Juzgado Agrario de Alajuela, en Bandeja de Escritos, archivo del 08/09/16 de las 02:03:30 p.m.).- 5 . - En la substanciación del proceso se han observado las prescripciones legales, y no se notan la existencia de errores u omisiones en el fallo capaces de producir su nulidad. - Redacta el juez DARCIA CARRANZA; y,

CONSIDERANDO:

I.Se comparte lo dispuesto en cuanto a hechos probados, por tener buen sustento en los autos. De dicha naturaleza téngase el siguiente: 8.- El inmueble objeto de titulación ha estado en manos privadas desde hace más de 60 años (ver testimonial de [Nombre2] , [Nombre3] y [Nombre4] (ver testimonios en el escritorio virtual, Audiencia Oral 03/12/2015 09:34:44). 9.- El terreno objeto de titulación ha estado dedicado a pastos (ver testimonios en el escritorio virtual, Audiencia Oral 03/12/2015 9:34:44).

II.No se comparte el hecho tenido por no demostrado pues analizada la prueba en su conjunto en forma global, contrario a lo dicho por el juez a quo, esta Cámara considera que si se demostró la posesión decenal diez años antes de la declaratoria del área silvestre protegida.

III.La Licda. Karen Daniela Oconitrillo Quesada, en calidad de apoderada especial judicial de la sociedad VISTA ALTO DEL MONTE SOCIEDAD ANONIMA,sociedad promovente interpuso formal RECURSO DE APELACION contra la resolución N° 78-2016 de las catorce horas y treinta minutos del treinta de agosto del año dos mil dieciséis, recurso que se plantea por carecer la misma de fundamento de hecho y de derecho, así como errónea valoración de la prueba. La impugnación se interpone con base en los razonamientos que paso a exponer: La resolución declara sin lugar la información posesoria basada solo en el siguiente argumento: "... Empero, analizada la prueba evacuada en autos, se concluye que dicho extremo adolece de falta de probanzas. Al respecto, el deponente [Nombre4] , cédula CED7, declara que tiene 23 años de edad, y la finca la conoce desde hace aproximadamente dieciocho años. En ese sentido conoce el terreno desde el año 1997, y para entonces ya había sido afectado a zona protectora.

Lo anterior en virtud la recepción de la prueba se llevó a cabo el 03 de diciembre del 2015, según se infiere de la minuta de prueba testimonial incorporada en esa fecha. Además, se puede escuchar la prueba testimonial en archivo de voz incorporado en fecha 03 de diciembre del 2015. Aunque de las declaraciones testimoniales se deriva que el terreno se ha dedicado a ganadería, no es dable determinar que tales actos de posesión los ejerciera la sociedad titulante o su transmitente con anterioridad a diez años a la creación de la zona protectora. Con base en lo expuesto, no es pertinente tener por demostrado el requisito exigido en el numeral 7 de la Ley de Informaciones Posesorias, en cuanto a la posesión decenal requerida para inscribir fincas en áreas protegidas. Por la forma en que se resuelve, y por innecesario, no se entra a conocer acerca de los demás motivos señalados por el ente estatal en su último escrito".- En primer lugar, el señor Juez indica en el extracto de resolución, que no se puede declarar positivas las presentes diligencias por un motivo muy puntual, cual es que el señor [Nombre4] tiene 23 años de edad, y la finca la conoce desde hace aproximadamente dieciocho años.

En ese sentido conoce el terreno desde el año 1997, y para entonces ya había sido afectado a zona protectora... No es dable determinar que tales actos de posesión los ejerciera la sociedad titulante o su transmitente con anterioridad a diez años a la creación de la zona protectora. Sin embargo esta representación considera que esta interpretación es incorrecta, por los siguientes motivos: La doctrina mayoritaria señala acerca de la posesión en el proceso de usucapión lo siguiente: "Tanto en la doctrina(3) como en la jurisprudencia,(4) se han distinguido dos tipos de acciones de usucapión agraria: La común y la especial. La usucapión agraria común, requiere del cumplimiento de los requisitos exigidos en el Código Civil para poder adquirir por prescripción positiva. El actor debe demostrar el ejercicio de una posesión a título de dueño, en forma pública, pacífica e ininterrumpida. Pero dicha posesión no debe ser “civil”, sino agraria, lo cual implica el ejercicio de actos posesorios agrarios, tendientes a cultivar y mejorar el bien que se pretende usucapir, bajo el cumplimiento de la función social de la propiedad agraria.

El plazo de la posesión requerida es el mismo, sea diez años.En cuanto a los requisitos de justo título y la buena fe, también se exigen para la usucapión agraria común. El justo título puede ser traslativo de la posesión, caso en el cual el actor debe acreditar que ha adquirido de un anterior transmitente, sea por medio de una carta venta, cesión, donación, o incluso a través de prueba testimonial, pero debe demostrar el tiempo de la posesión personal y el tiempo de la posesión trasmitida, para completar de ese modo la posesión decenal." Claramente en el expediente se refleja no solo un tipo de prueba, pues la normativa lo establece y lo permite, además de que la prueba se tiene que ver en integridad. En primer lugar, a folios 15 y 16 consta una venta privada, misma en la que se refleja que la señora [Nombre5] le vendió el inmueble a la sociedad promovente de estas diligencias Vista Alto del Monte S.A, siendo que dicha transmitente lo adquirió anteriormente del señor [Nombre6] , quien a su vez lo había adquirido de su padre [Nombre7] hace más de 50 años, como los testigos de la parte promovente [Nombre2] , [Nombre3] y [Nombre4] lo confirman en su integridad, como más adelante analizará.

Evidentemente, no solo existe un relato conciso y claro por los indicados deponentes, sino que también se identifica en dicha prueba testimonial el tracto sucesivo, el cual ha quedado debidamente demostrado con la prueba testimonial y documental ya citada que consta en autos, que viene desde hace más de 50 años. Así la prueba testimonial, ofrecida por mi representada, se puede resumir de la siguiente manera: El señor [Nombre4] , quien reconoce en su declaración que conoce la finca desde que tiene uso de razón y sabe por su conocimiento personal que dicha propiedad ha pertenecido a su familia y que el inmueble a titular objeto de estas diligencias era de su tío, así como que su padre adquirió de progenitor (su abuelo), situación que evidenció en su testimonio donde indicó que conoce dichas circunstancias desde que tiene uso

de razón, por lo cual no se puede considerar que su testimonio no es correcto o veraz. Aunado a lo anterior, al verificarse el artículo siete de la Ley de Informaciones Posesorias establece: " Cuando el inmueble al que se refiera la información esté comprendido dentro de un área silvestre protegida, cualquiera que sea su categoría de manejo, el titulante deberá demostrar ser el titular de los derechos legales sobre la posesión decenal, ejercida por lo menos con diez años de antelación a la fecha de vigencia de la ley o decreto en que se creó esa área silvestre.... Sin excepción alguna, los planos catastrados que se aporten en diligencias de información posesoria, deberán ser certificados por el Ministerio del Ambiente y Energía, por medio del ente encargado, el cual dará fe de si el inmueble que se pretende titular se encuentra dentro o fuera de esas áreas silvestres protegidas. (Así reformado por el artículo 72, inciso c), de la Ley Forestal No.7575 del 13 de febrero de 1996)...".

De acuerdo al artículo supra citado, se establece que el titulante deberá demostrar ser el titular de los derechos legales sobre la posesión decenal, ejercida por lo menos con diez años de antelación a la fecha de vigencia de la ley o decreto en que se creó esa área silvestre, situación que está completamente acreditada con las pruebas aportadas en el expediente, ya que como se ha indicado, la propiedad perteneció hace más de 50 años al señor [Nombre7] , mucho antes del año 1976 en que se decreto el área silvestre. No se desprende del artículo indicado que se tenga que demostrar la posesión decenal antes de la declaratoria de zona protegida con los tres testigos, como lo ha indicado el a quo, sino que el que artículo lo que indica es que el promovente debe demostrar ser el propietario de los derechos legales de posesión ejercida con diez años de antelación a la declaratoria respectiva, situación acreditada con prueba documental y también con prueba testimonial.

El error de juzgador de instancia consiste en que solo analizó el testimonio de [Nombre4] , dejando por fuera de sus análisis a los testigos [Nombre2] y [Nombre3] , así como de la prueba documental indicada supra. Amén de lo anterior en nuestro criterio es que los testigos que cita el numeral seis de la ley de informaciones posesorias tengan más de 50 años, sino que conozcan de la posesión derivada. Todos los testigos han coincidido en que la posesión que ejerce la promovente viene por sucesión de diferentes propietarios desde hace más de 50 años. La prueba existente en el expediente, y específicamente la prueba testimonial de los tres testigos evacuados, demostró claramente la posesión decenal de parte de la titulante y además la posesión decenal anterior a la declaratoria de zona protegida fue debidamente acreditada con la prueba testimonial que consta en autos y con el testimonio personal de dos testigos [Nombre2] y [Nombre3] y la declaración de referencia del testigo [Nombre4] .

La interpretación que hace el ad-quo en el sentido de exigir el testimonio de los tres testigos para demostrar la posesión decenal anterior a la declaratoria de zona protegida, sería una interpretación restrictiva de la ley, pues el legislador estaría creando una ley para un tiempo determinado, y no fue así, ya que en el momento en que hayan pasado más de 80 años de la declaratoria de determinada zona protegida, será difícil por no decir que imposible, tener tres testigos que por su edad puedan acreditar que estuvieron en el tiempo y en el espacio de dicha posesión decenal anterior a la declaratoria de zona protegida, para demostrar personalmente dicho hecho. Es así, que la posesión que la ley exige que debe demostrarse claramente con prueba testimonial es la posesión decenal anterior a la presentación de las diligencias de titulación respectivas y no como interpreta el Juez en cuanto a que la posesión decenal anterior a la declaratoria, deba demostrarse solo con la prueba testimonial (los tres testigos de acuerdo a lo establecido en el párrafo anterior) la cual podrá demostrarse de otra manera, incluyendo prueba testimonial y documental.

Considera que quedó total y absolutamente claro, tal y como consta en la prueba recabada de este proceso, que la posesión decenal anterior a la declaratoria de zona protegida de fecha 17 de julio de 1976 y el tracto sucesivo del inmueble referido, fueron debidamente demostrados. Dice, llama la atención del ad quem que en este proceso, como ha venido indicando, no solo se contó con el testimonio de [Nombre4] , sino, además se contó con otro prueba testimonial, consistente en las deposiciones de: [Nombre2] y [Nombre3] , de 70 y 61 años de edad respectivamente, quienes declararon en forma coincidente su conocimiento personal del inmueble objeto de esta titulación desde hace más de 50 años, (ver folios 93 - 94 donde se incorpora el audio de grabación de la audiencia de recepción de testigos del día tres de diciembre del dos mil quince) testimonios que acreditan fehacientemente la posesión ejercida y el tracto sucesivo por la sociedad propietaria actual y por lo anteriores propietarios, posesión que incluye el periodo decenal anterior a la declaratoria de zona protegida.

Asimismo, el testigo [Nombre4] de 23 años de edad declaró con claridad meridiana la posesión decenal ejercida por la sociedad actora y su inmediata anterior propietaria, y además referenció, por el conocimiento familiar que tiene del historial sucesorio del inmueble a titular, el derecho de posesión sobre dicho inmueble desde que perteneció a su abuelo [Nombre7] , declaración veraz, con conocimiento de causa y congruente, que de ninguna forma puede desacreditarse tal y como lo hace el Juzgador de Primera Instancia. Asimismo, en el fallo recurrido el Juzgador establece lo siguiente: "Aunque de las declaraciones testimoniales se deriva que el terreno se ha dedicado a ganadería, no es dable determinar que tales actos de posesión los ejerciera la sociedad titulante o su transmitente con anterioridad a diez años a la creación de la zona protectora. Con base en lo expuesto, no es pertinente tener por demostrado el requisito exigido en el numeral 7 de la Ley de Informaciones Posesorias, en cuanto a la posesión decenal requerida para inscribir fincas en áreas protegidas.

" Con relación a este aspecto, el Juzgador también se equivoca, pues tal y como ha quedado demostrado con las deposiciones de los testigos evacuados, así como con la certificación de uso de suelo que consta en autos, que la posesión fue ejercida desarrollándose durante todo este tiempo la actividad de pastos, actividad que por sí sola implica un mantenimiento específico y es definitivamente un acto de posesión del inmueble. Ver en este sentido los folios 93 - 94 donde se incorpora el audio de grabación de la audiencia de recepción de testigos del día tres de diciembre del dos mil quince y los folios 36- 37 en la cual se encuentra la certificación de inspección para informaciones posesorias. Así las cosas, no solo la legislación sino la interpretación doctrinal y jurisprudencial de nuestros máximos Tribunales han establecido la claridad de la posesión derivada, claramente demostrada en este expediente, por ello la sociedad Vista Alto del Monte S.A. lo ha hecho todo de conformidad con el artículo 1, 6 y 7 de la Ley Informaciones Posesorias.

Señala en relación a la prueba y titulación en áreas silvestres protegidas el Tribunal Agrario, el Tribunal Agrario en la Sentencia N° 00192 del 28 de febrero de2013 de las 11:45: 00 a.m. bajo el expediente EXPN1 estableció lo siguiente: "XIX.- Uno de los temas más controvertidos, en materia de limitaciones a la propiedad, para el cumplimiento de su función ambiental, es el de la posesión y titulación de bosques y terrenos ubicados en áreas protegidas. El tratamiento de este tema, en el ámbito de la protección posesoria, de la propiedad privada y de la usucapión ha sido objeto de análisis y discusión, tanto en doctrina como en jurisprudencia. El tema de la posesión ecológica, no es de pacífica aceptación. Se han dado diversos planteamientos doctrinales y la jurisprudencia exige demostrar el cumplimiento de la función ecológica para proteger la posesión y propiedad. Todo se origina en la aplicación del artículo 7 de la Ley de Informaciones Posesorias, que en la actualidad establece: “Artículo 7.- Cuando el inmueble al que se refiera la información esté comprendido dentro de un área silvestre protegidas, cualquiera que sea su categoría de manejo, el titulante deberá demostrar ser el titular de los derechos legales sobre la posesión decenal, ejercida por los menos con diez años de antelación a la fecha de vigencia de la ley o decreto en que se creó esa área silvestre.

Las fincas ubicadas fuera de esas áreas y que contengan bosques, sólo podrán ser tituladas si el promovente demuestra ser el titular de los derechos legales de posesión decenal, ejercida por lo menos durante diez años y haber protegido ese recurso natural, en el entendido de que el inmueble tendrá que estar debidamente deslindado y con cercas o carriles limpios...” (Ley de Informaciones Posesorias, artículo 7. Reformado por Ley Forestal, No. 7575 del 5 de febrero de 1996). En relación con la aplicación de esta disposición, contrario a lo señalado por la a-quo en sus consideraciones de fondo -en cuanto a la imposibilidad de aplicar retroactivamente el artículo 7 mencionado - la Sala Constitucional ha indicado que es posible aplicar dicha disposición en forma retroactiva, desde que se produce la afectación al dominio público, pues la posesión decenal consolidada antes de la declaratoria de cualquier reserva o área protegida encuentra tutela en la referida disposición legal (ver voto de la Sala Constitucional, No. 4597 de las 15:45 horas del 5 de agosto de 1997).

De ahí que no comparta el Tribunal la afirmación de la juzgadora de instancia en tal sentido. En todo caso, la situación de este proceso, como veremos, es totalmente diferente, ya que ni el actor, ni el demandado han poseído a título de dueños, terrenos que han pertenecido y continúan perteneciendo al Patrimonio Forestal del Estado. (...) Por otra parte, es importante aclarar que en este caso, para poder titular mediante información posesoria el legislador estableció una serie de requisitos mayores, justamente para evitar que el Patrimonio Forestal del Estado y las áreas protegidas se vean afectadas, así como su biodiversidad. Por ello la Ley de informaciones posesorias en su artículo 7 exige demostrar, aparte de la posesión decenal anterior a la creación de la respectiva área protegida, que se ha conservado el bosque. Los diez años anteriores a la creación se exigen, justamente, para proteger a aquellos sujetos privados que habían consolidado su derecho de posesión diez años antes de la creación del área, es decir, antes de que ocurriera la afectación al dominio público (Ver, entre otros, Tribunal Agrario, No.124 de las 11:30 horas del 14 de marzo del 2003).

La oposición del ente del Estado, tanto del Instituto de Desarrollo Rural, como de la Procuraduría General de la República, ha sido permanente y sistemática. Aunado a lo anterior, el artículo 11 de la Ley de Informaciones Posesorias es imperativo al indicar que el juez: "Rechazará la misma si llegare a constatar que se pretende titular indebidamente baldíos nacionales o terrenos pertenecientes a cualquier institución del Estado, lo mismo que reservas forestales, parques nacionales o reservas biológicas." Con ello se pretende evitar, que por las diligencias de jurisdicción voluntaria, se puedan titular bienes del Estado. Regla que aplicaría en este proceso ordinario declarativo de una usucapión agraria que reclama la sociedad actora. En la usucapión agraria común, en cambio, se exige además de los anteriores requisitos el justo título y la buena fe. Puede tratarse de una causa originaria (como el derecho de posesión) o derivada (mediante un contrato traslativo posesorio).

Para el caso de la buena o mala fe, la primera se presume siempre, sin embargo, es poseedor de mala fe quien en el acto de la toma en posesión tuvo suficientes motivos para que dudara (artículos 284, 287 y 286 del Código Civil). La buena o mala fe se liga al convencimiento de la persona de que está poseyendo un bien propio, y la persona que le trasmitió era su legítima propietaria. Uno de los principales agravios del recurrente giran entorno a los requisitos de la usucapión agraria común, aduciendo cumple con los presupuestos exigidos por nuestro ordenamiento jurídico, a saber, justo título, buena fe, y posesión decenal en forma quieta, pública, pacífica e ininterrumpida. El numeral 853 del Código Civil exige tres requisitos fundamentales sin los cuales no puede operar la usucapión, a saber, justo..." En dicha resolución se hace notar la necesidad probatoria en cuanto a la posesión decenal anterior a la constitución de la Zona Protegida, sin embargo no se limita a la necesidad de un tipo de prueba ni algún máximo de testigos.

Es inevitable indicar que los fines en los cuales interviene el Estado con sus diversas entidades, es con el fin de que no se titule indebidamente baldíos nacionales o terrenos pertenecientes a cualquier institución del Estado, lo mismo que reservas forestales, parques nacionales o reservas biológicas, situación que difiere del presente caso, ya que queda claramente demostrado que se trata de una propiedad privada y que se poseyó 10 años antes del decreto que estableció como Zona Protectora a [Dirección4] .

IV.Luego de analizar detenidamente y en conjunto la totalidad de los elementos probatorios aportados a las presentes diligencias de información posesoria, presentadas por la empresa promovente Vista del Monte Sociedad Anónima representada por la señora [Nombre1] , y valorada la prueba a conciencia y sin sujeción estricta a las normas de derecho común (artículo 54 de la Ley de Jurisdicción Agraria), este Tribunal llega a la ineludible conclusión que estas diligencias deben ser aprobadas, por cumplirse con los requisitos exigidos por el ordenamiento jurídico para demostrar la posesión decenal ejercida tanto por la promovente como por su anterior transmitente. La Ley de Informaciones Posesorias establece el trámite para que toda persona que ha adquirido el derecho de propiedad por usucapión, pueda inscribirlo en el Registro Público, y de ese modo garantiza el derecho de acceso a la propiedad contemplado en el artículo 45 de la Constitución Política.

La Ley, en el artículo 1, hace referencia a los requisitos exigidos por el artículo 856 del Código Civil, es decir una posesión por más de diez años, ejercida a título de dueño, en forma pública, pacífica, ininterrumpida y de buena fe. No exige un título traslativo posesorio, si el usucapiente tiene más de diez años de ejercer la posesión en esas condiciones, porque no le hace falta, al haber completado el tiempo necesario para adquirir el dominio. Solo se le exige a tenor de lo dispuesto en el artículo 863 del Código Civil: "Cuando el titulante no haya tenido la posesión decenal del inmueble podrá aprovechar la ejercida por sus transmitentes, pero en este caso deberá presentar documento público en que conste el traspaso de su derecho, aunque no el de anteriores poseedores". Ello significa que solo cuando se pretende sumar al tiempo de la posesión decenal, la del trasmitente, se exige presentar un documento traslativo posesorio, o bien, demostrar con prueba testimonial idónea la posesión trasmitida.

V.La información posesoria es un trámite de actividad judicial no contenciosa para la formalización de un título registrable sobre un derecho de propiedad que se ha llegado a adquirir por la usucapión, cumpliendo para ello con los requisitos legales correspondientes. Se exige demostrar la posesión a título de dueño, en forma quieta, pública, pacífica e ininterrumpida (artículos 1 de la Ley de Informaciones Posesorias y 856 del Código Civil). El titulante, aparte de carecer de título inscrito o inscribible en el Registro Público, debe manifestar expresamente que la finca no ha sido inscrita con anterioridad en el Registro Público. Por razones de interés público, y para evitar una doble inscripción registral sobre un mismo bien, o bien, para tutelar a terceros de mejor derecho que el titulante, la ley exige notificar a ciertos sujetos. También estableció un trámite de oposición dentro de la información posesoria, en caso de que alguno de los interesados se sienta perjudicado por la titulación (artículo 8).

La Ley de informaciones posesorias ordena al Juez tener como partes y por tanto notificarles personalmente desde el inicio de las diligencias, a los colindantes, ello por cuanto la titulación podría abarcar parte de las tierras que les pertenecen. También se ordena notificar a los condueños o condóminos cuando existan. Igualmente, en resguardo de los intereses del Estado, se debe tener como parte a la Procuraduría General de la República y al Instituto de Desarrollo Agrario, para el resguardo de la propiedad sujeta en el primer caso al dominio público, y en el segundo a la propiedad agraria estatal (artículo 5). Finalmente, la Ley ordena citar a todos los interesados, mediante la publicación de un edicto en el Boletín Judicial, que puedan tener un interés legítimo en el proceso (ver mismo numeral 5 ibídem).-

VI.Sobre el tema de la libre valoración probatoria en materia agraria, esteTribunal ha indicado: “ VI. …La apreciación o valoración probatoria consiste en la actividad de selección que debe realizar el juez, entre las fuentes de prueba obtenidas, a fin de establecer cuáles de ellas son las eficaces para resolver el conflicto sometido a su conocimiento. Dicha selección le permite decidirse por una de las tesis divergentes presentadas por cada parte de la relación procesal. Dicha actividad requiere de varios pasos intelectivos básicos, que ha señalado la doctrina: En la actividad probatoria encontramos siempre tres aspectos básicos que son la percepción, la representación o reconstrucción y el razonamiento deductivo o inductivo. El conocimiento de un hecho por parte del juez no se puede obtener sin que él mismo perciba algo con los propios sentidos y para ello, tal como lo afirma [Nombre8], es inevitable el contacto entre el juez y la realidad acerca de la cual se debe juzgar.

El contacto del juez con la observación de los hechos puede hacerse de una forma directa o de un modo indirecto a través de la relación que hacen otras personas de algunas cosas o documentos. Se trata siempre de una operación sensorial, sin la cual sería imposible apreciar el contenido y la fuerza de convicción de una prueba. Una vez percibidos aisladamente los hechos, debe procederse a su reconstrucción histórica, y ésta no puede ser hecha en forma aislada, ya que se requiere que se efectúe en su conjunto y con el cuidado necesario para que no se admitan hechos que alteren la realidad o la hagan cambiar de significado. Son también válidas para la apreciación, las reglas generales de la experiencia…. La percepción de los medios, las condiciones y el lugar en el cual se desarrollaron los hechos, le va a permitir luego desarrollar una labor interpretativa. En efecto, una vez que el juez ha percibido los medios de prueba, debe realizar una i nterpretación de los datos probatorios para darles significado jurídico.

En tercer lugar, es necesario que el Juez establezca el grado de eficacia que merezca cada medio de prueba, tanto desde el punto de vista formal (en cuanto a la existencia del medio de prueba en la ley y si se ha producido debidamente) como material (la sinceridad o veracidad de la fuente, para determinar si el testigo no miente, o si el documento ha sido o no alterado). Un cuarto paso consistiría, en verificar si el Juez tiene alguna vinculación legal con algún tipo de prueba (en el sistema de prueba legal o tasada). Ello no se aplicaría cuando el Juez puede apreciar libremente la prueba, como es el caso de la materia agraria. Finalmente, el Juez debe lograr una reconstrucción de los hechos discutidos, tal y como a su criterio fueron sucediendo, tomando y depurando todas las fuentes de prueba, en su conjunto. Se trata de apreciar en conjunto la prueba, de lo cual se deriva el deber de motivación de la sentencia.

El Juez agrario entra en contacto con los hechos mediante la percepción u observación “in situ”, directa e inmediata. La convicción del juez agrario es un acto psicológico aplicado a una situación concreta, viva, propia de la realidad agraria. El Juez Agrario debe examinar la credibilidad de lo que dice un testigo, o de una parte, para justipreciar su valor. Pero también debe analizar la experiencia social, el medio -mundo agrario- en donde se desenvuelve el conflicto, e incluso la cultura y el comportamiento del campesino. Por ello debe tenerse en cuenta, por un lado la autenticidad y sinceridad de cada prueba cuando se trate de documentos, confesiones y testimonios; por otro lado, determinar su exactitud y credibilidad. Con ello se garantizan los principios de lealtad y probidad en el resultado del elemento probatorio. Las partes dentro del proceso tienen derecho a conocer todos los factores relevantes que han contribuido a la formación del fallo.

Los motivos y fundamentación del fallo son los que permiten el control en la vía jerárquica superior Es decir, el juez agrario se asocia una situación particular (del caso concreto), con situaciones semejantes de la realidad que el juez con su experiencia logra conocer". (Tribunal Agrario, No. 206 de las 14:50 horas del 26 de marzo de 1999). Lo anterior es compartido por la Sala Primera de la Corte Suprema de Justicia al considerar: "El sistema de la libre valoración de la prueba supera el clásico sistema de la prueba legal así como el de la sana crítica, que rigen en el proceso civil. La forma como ha sido concebido el proceso agrario le permite al juez valorar ampliamente los hechos alegados por las partes. Dicho sistema no es arbitrario, por el contrario en la libre valoración de la prueba la misma deber ser razonada, crítica, basarse en la lógica, la experiencia y la sicología. En la motivación del fallo el juez debe exponer los motivos de convicción que lo llevan a resolver en los términos que lo hace.

A diferencia del sistema de tarifa legal, en el cual las pruebas se aprecian con sujeción a reglas legales previas, e incluso la admisibilidad de pruebas debe estar previamente señalado por el Ordenamiento Jurídico, en el sistema de libre apreciación el juez tiene libertad para admitir pruebas conforme a su criterio.” (N° 398-F-01 de las 16 horas del 6 de junio del 2001). Asimismo, sobre este tema ha resuelto: “La Ley de Jurisdicción Agraria, tanto en su artículo 54, para los jueces de instancia, como en el 61, para los jueces de casación, autoriza a valorar el elemento probatorio sin sujeción estricta a las normas de derecho común. En este caso el Juez deberá expresar los principios de equidad o de derecho sobre el cual funde su criterio. Se trata del sistema de la libre valoración y no el de la valoración a conciencia pues esta última es típica de los juzgadores no juristas.” (N°46-F-95 de las 15 horas del 26 de abril de 1995). (VOTO 673-F-2003 de las 11:25 hrs. del 15 de octubre de 2003).-

VII.Bajo esa tesitura, considera el Tribunal lleva razón la representante de la promovente, en sus agravios. Este radica en lo medular sobre el rechazo de las diligencias que hace el juzgador de instancia por la insuficiencia de la declaración del testigo [Nombre4] para demostrar la posesión decenal de la sociedad promovente previa a la declaratoria del [Dirección5] Protegida por tener solo 23 años. Debe recordarse, como se señaló en los considerandos anteriores, que en esta materia la prueba se valora libremente, sin sujeción estricta a las normas de derecho común (artículo 54 de la Ley de Jurisdicción Agraria), y tratándose de informaciones posesorias, es obligación de todo juez agrario verificar con certeza que se cumplan los requisitos exigidos por la Ley para poder usucapir. Efectivamente, y analizando la prueba aportada en conjunto, en cuanto a la posesión decenal, tenemos que el testigo [Nombre2] manifestó en lo que interesa tener más de setenta años, y de conocer el fundo objeto de titulación desde hace más de 60 años.

Dijo además, el terreno se ha dedicado a pastos y que perteneció a [Nombre9] , el cual se lo vendió a su papá [Nombre7] , luego el terreno se repartió entre sus hermanos correspondiéndole el pedazo objeto de titulación a su hermano [Nombre6], quien se lo vendió hace como diez años a [Nombre5], quien es hermana de doña [Nombre1]. El deponente [Nombre3] ,. indicó tiene 71 años y dijo conocer el fundo de toda la vida, mucho más de cincuenta años, que el mismo perteneció a [Nombre9] y este le vendió a [Nombre7], que el terreno a sido de pastos, luego se repartió entre los hijos de [Nombre7], que ese sector del fundo le correspondió a [Nombre6] y que este lo vendió hace como diez años, cree que a la sociedad. El testigo [Nombre4] dijo tener 23 años de edad, que conoce el fundo de toda la vida, que lo que el recuerda es que el fundo era de su tío [Nombre6], quien se lo vendió a [Nombre5], quien es hermana de doña [Nombre1], hace unos diez años y que esta se lo vendió a la sociedad promovente hace unos tres años.

Dijo conocer por referencia que el terreno fue de su abuelo [Nombre7], quien se lo había comprado a [Nombre9] (ver testimonios en el escritorio virtual, Audiencia Oral 03/12/2015 09:34:44). Aún cuando podría cuestionarse, como lo hizo la Procuradora, y fue lo que fundamentó el juez ad quo para el rechazo, que para los efectos de comprobar la posesión decenal, este último testigo es inidóneo por haber manifestado conocer desde hacía "dieciocho años", lo cierto es que dicha declaración debe valorarse con todo el conjunto o acervo probatorio traído al proceso por el juez a-quo, a fin de verificar si lo manifestado por él coincide con las demás probanzas existentes en autos. Todos los testigos han coincidido en que la empresa titulante, y sus transmitentes, han sido los poseedores por más de cincuenta años de esa propiedad. Sobre este particular, y siempre dentro de los cánones de la libre valoración probatoria del citado artículo 54 de la Ley de la Jurisdicción Agraria, el Tribunal analiza los testimonios antes apuntados en conjunto con la escritura pública de compraventa del inmueble objeto de estas diligencias efectuada entre el [Nombre1] como representan te de la sociedad promovente y [Nombre5] , según la cual se estableció: "...QUINTA: QUE LA VENDEDORA TRASPASA A LA COMPRADORA LA POSESIÓN QUE HA EJERCIDO SOBRE EL PRESENTE INMUEBLE EN FORMA QUIETA, PÚBLICA, PACÍFICA, ININTERRUMPIDA, DE BUENA FE, A TÍTULO DE DUEÑA Y DESLINDADO DE LOS FUNDOS VECINOS Y POR MAS DE DOCE AÑOS.".Con ello, se estaría cumpliendo tanto con lo preceptuado en el párrafo tercero del artículo 1 de la Ley de Informaciones Posesorias como por el ordinal 6 de la citada Ley pues en el primer caso se dice: "Cuando el titulante no haya tenido la posesión decenal del inmueble podrá aprovechar la ejercida por sus transmitentes, pero en este caso deberá presentar documento público en que conste el traspaso de su derecho, aunque no el de anteriores poseedores", (subrayado no es del original) y en el segundo caso: "La justificación de la posesión se acreditará con la declaración de tres testigos, vecinos del cantón donde se halle situado el inmueble, a los cuales se interrogará desde cuándo conocen la finca, si les consta si ha estado sometida por el titulante o por anteriores dueños a posesión durante un período continuo no inferior a 10 años..." (subrayado no es del original), ante lo cual hecho el análisis conjunto de la totalidad del acervo probatorio constante en los autos, no le queda duda alguna a este Tribunal sobre la acreditación de la posesión decenal de la promovente, la cual amparada en las normas supracitadas, ha aprovechado la ejercida por su anterior transmitente [Nombre5] para efectos de la titulación que pretende realizar.- Además de lo anterior con la prueba testimonial citada se logra demostrar una posesión de vieja data sobre el fundo a titular de más de sesenta años, entre todos los poseedores en la cadena posesoria trasmitida del inmueble objeto de titulación.

VIII.En razón de todo lo expuesto, llevando razón la recurrente en sus agravios, deberá revocarse la sentencia dictada. En su lugar se acoge el trámite de diligencias de Información Posesoria interpuesto por VISTA ALTO DEL MONTE SOCIEDAD ANÓNIMA, cédula jurídica CED1 - - , representada por su apoderada generalísima sin límite de suma [Nombre1] , mayor, casada, de oficios domésticos, vecina de [Dirección1] , cédula de identidad número CED8 - - y se ordena se proceda a inscribir en el Registro Público de la Propiedad a nombre de VISTA ALTO DEL MONTE SOCIEDAD ANÓNIMA, el terreno que se describe así: Terreno de naturaleza de potrero y charral, situado en el [Dirección2] , de la Provincia de Alajuela, colinda al norte con [Nombre10] , al sur con Vista Alto del Monte S.A., al este con [Nombre10] , y al oeste con [Dirección3] con un frente de cincuenta y dos metros con sesenta y dos centímetros lineales, descrito en el plano catastrado número A-1696037-2013 de fecha 24 de octubre del 2013.

Mide ocho mil trescientos seis metros cuadrados. Se estiman estas diligencias así como el terreno en la suma de cinco millones de colones. Queda afecta a las reservas legales de la Ley de Caminos Públicos conforme al artículo 19 de la Ley de Informaciones Posesorias. Proceda el Juzgado de instancia a emitir la ejecutoria correspondiente y se le autoriza a hacer las correcciones que sean necesarias a fin de lograr la inscripción registral.

POR TANTO:

Se revoca la sentencia dictada. En su lugar se acoge el trámite de diligencias de Información Posesoria interpuesto por VISTA ALTO DEL MONTE SOCIEDAD ANÓNIMA, cédula jurídica CED1 - - , representada por su apoderada generalísima sin límite de suma [Nombre1] , mayor, casada, de oficios domésticos, vecina de [Dirección6] de Atenas, cédula de identidad número CED8 - - y se ordena se proceda a inscribir en el Registro Público de la Propiedad a nombre de VISTA ALTO DEL MONTE SOCIEDAD ANÓNIMA, el terreno que se describe así: Terreno de naturaleza de potrero y charral, situado en el [Dirección7] , Atenas de la Provincia de Alajuela, colinda al norte con [Nombre10] , al sur con Vista Alto del Monte S.A., al este con [Nombre10] , y al oeste con [Dirección3] con un frente de cincuenta y dos metros con sesenta y dos centímetros lineales, descrito en el plano catastrado número A-1696037-2013 de fecha 24 de octubre del 2013. Mide ocho mil trescientos seis metros cuadrados. Queda afecta a las reservas legales de la Ley de Caminos Públicos. Se estiman estas diligencias así como el terreno en la suma de cinco millones de colones. Proceda el Juzgado de instancia a emitir la ejecutoria correspondiente y se le autoriza a hacer las correcciones que sean necesarias a fin de lograr la inscripción registral.
