At fifteen hours and twenty-three minutes on trece de octubre de dos mil dieciséis.
Appeal of the criminal judgment filed in the present proceedings brought against [Nombre2] , , born on nueve de diciembre de mil novecientos setenta y dos, holder of identity card number CED1 , for the offense of Violation of the Ley Forestal, to the detriment of Natural Resources. Judges Ivette Carranza Cambronero, Jaime Robleto Gutiérrez, and [Nombre3] participated in deciding the appeal. The defendant [Nombre1] , attorney [Nombre4] in his capacity as privately retained defense counsel for the accused, and [Nombre5] on behalf of the Procuraduría General de la República appeared in the appellate proceedings.
Whereas:
1. By Judgment No. 60-2016, issued at diecisiete horas del dieciséis de febrero de dos mil dieciséis, the Trial Court of Pérez Zeledón, Flagrancy Section, ruled: “POR TANTO: In accordance with the foregoing and Articles 39 and 41 of the Constitución Política, 8 and 9 of the Convención Americana sobre Derechos Humanos, 6, 9, 142, 184, 265 to 267, 270, 360 to 365, 367, 368, and 432, all of the Código Procesal Penal, 1, 30, 31, 45, 50, 59 to 63, and 71 of the Código Penal, 1045 of the Código Civil, as well as the special provisions applied, 31, 56, and 63 of the Ley Forestal, [Nombre1] is hereby found criminally responsible as the perpetrator of the offense of VIOLATION OF THE LEY FORESTAL, committed to the detriment of NATURAL RESOURCES, and in that capacity is sentenced to ONE MONTH OF IMPRISONMENT, to be served in the correctional facility designated by the prison regulations, with credit for any time spent in pretrial detention (prisión preventiva), if applicable. Once the judgment becomes final, this ruling shall be communicated to the Juzgado de Ejecución de la Pena, the Instituto Nacional de Criminología, and the Registro Judicial for action within their respective authority. (For a probationary period of THREE YEARS, [Nombre1] is granted the benefit of a suspended sentence (Beneficio de Ejecución Condicional de la Pena), and the accused is advised of the grounds that would result in revocation of this benefit. The accused is ordered to pay the costs of the proceedings. THE CIVIL CLAIM FOR DAMAGES (ACCIÓN CIVIL RESARCITORIA) filed by THE STATE, represented through the PROCURADURÍA GENERAL DE LA REPÚBLICA, against [Nombre1] is GRANTED without specifying the amount, and the parties must resort to civil proceedings to enforce it. The forfeiture (comiso) of the lumber seized in these proceedings is ordered, and said lumber shall be placed at the disposal of the State. With respect to the vehicle bearing license plates [Placa1] - it is ordered that definitive possession thereof be granted to whoever proves to be the legal representative of the corporation that owns it. SERVICE IS HEREBY ORDERED. (OR, IF THE JUDGMENT WAS DELIVERED ORALLY, INDICATE THAT THE PARTIES ARE DEEMED SERVED AT THE HEARING AND THAT THE AUDIO AND VIDEO RECORDING OF THE JUDGMENT IS MADE AVAILABLE TO THEM). [Nombre6] - DECIDING JUDGE.” (sic)
2. The accused [Nombre1] and his defense counsel, attorney [Nombre7], filed appeals against the foregoing ruling.
3. After the corresponding deliberation was conducted in accordance with Article 466 of the Código Procesal Penal, as amended by Ley 8837, published on nueve de diciembre de dos mil once (Creation of an Appeal from the Judgment), the Court considered the issues raised in the appeals.
4. The applicable legal requirements have been observed in the proceedings.
Judge [Nombre8] drafts the opinion; and,
Considerations:
I.Because they meet the applicable requirements, both appeals of the criminal judgment, filed by privately retained defense counsel [Nombre7] and by the accused [Nombre1] against oral ruling number 60-TFPZ-2016, issued by the Tribunal de Flagrancia del Primer Circuito Judicial de la Zona Sur, Pérez Zeledón seat, at 17:00 hours on 16 de febrero de 2016, are considered. That judicial ruling found the accused [Nombre9] criminally responsible as the perpetrator of the offense of violation of the Ley Forestal, to the detriment of natural resources, and consequently sentenced him to one month of imprisonment and granted him the benefit of a suspended sentence for three years. It also granted the civil claim for damages filed by the Procuraduría General de la República.
II.On 08 de junio de 2016, during the first hearing, the corresponding oral hearing was held as part of this appellate stage (etapa impugnaticia). On that occasion, this Criminal Judgment Appeals Court was composed of Judge [Nombre3] and Judges Ivette Carranza Cambronero and Rosibel López Madrigal. However, as of today, the latter judicial officer has retired, and Judge Jaime Robleto Gutiérrez therefore sits on this Chamber in her place. This substitution is valid for purposes of this appeal pursuant to Articles 41 of the Constitución Política and 4 of the Código Procesal Penal, in order to avoid delays in the proceedings and resolve the legal status of the accused, on the understanding that the audiovisual recording of the oral hearing has been reviewed and in accordance with the case law of the Sala Constitucional, which has held that “...it is constitutionally valid that, in cassation hearings or oral proceedings in which no evidence is received orally or in which the parties’ arguments are already set forth in writing without anything new being submitted, judges other than those who participated in the hearing may take part in rendering the decision if, and only if, they are capable of doing so and there are justified reasons—which must be placed on the record—preventing those who attended the oral hearing from meeting promptly to consider and decide the matter...” (Sala Constitucional, N° 6681 at 15:30 hours on 10 de diciembre de 1996 and Nº 17553 at 12:23 h. on 30 de noviembre de 2007)” (Sala Constitucional, N° 6880 at 15:05 h. on 22 de mayo de 2013. Emphasis added). Although the cited precedent concerns an appeal in cassation (recurso de casación), it is equally applicable to the appeal at issue here.
III.In identical terms—in briefs bearing different dates and headings, but with the same wording—the appellants claim, in the first ground raised, erroneous application of substantive law. In that regard, they state that the conduct attributed to the defendant does not constitute an offense and, consequently, he should have been acquitted. They point out that he is charged with the illegal transportation of timber, as established in Article 56 of the Ley Forestal, but that Article 28 of that same law provides that forest plantations, among other circumstances, do not require a permit for transportation. They contend that the timber in question came from a teak plantation, according to certificate of origin 15-2014-LSS, issued by a duly authorized forestry manager (regente forestal). Likewise, they argue that, under Article 30 of that same body of law, once the timber has been processed at the primary processing facility, it requires neither a permit—meaning a transportation permit—nor a certificate of origin.
According to the complainant, the court below and the prosecution witnesses, officials of MINAET (sic), err in finding that the CED2 presented at the time of the events had expired, because that document is required only for harvesting the timber and demonstrating the existence of the plantation. Furthermore, according to the appellants, the court below failed to analyze Articles 28 and 30 of the Ley Forestal, thereby violating Article 2 of the Code of Criminal Procedure. Lastly, according to the complainants, it is argued that: “...although it is true that among the teak timber seized there are (sic) pieces of the [Nombre10] species, the fact remains that there is a complete absence of evidence establishing whether it came from a forest or pastureland and, because its origin cannot be determined, criminal conduct cannot be attributed...”. In the fourth and final ground, both appellants allege a violation of due process and the right of defense due to defects in the charging instrument, which does not satisfy the requirements of Article 303 of the Code of Criminal Procedure.
On this point, they state that the convicted person, [Nombre1], was charged with the offense of illegally transporting timber without the corresponding documents, “when the fact is that the criminal provision of of (sic) Article 56 does not refer to the conduct of moving, which is not synonymous with transporting” (see appeals). In addition, the interested parties state that the charge does not describe the timber as originating from a plantation, and therefore the accused should have been acquitted. In support of their position, they cite decision number 682, issued at 15:00 hours, on August 25, 1997, by the former Criminal Cassation Court, according to which the aforementioned Article 56 does not refer to the transportation of timber originating from land other than forest or plantation land. They identify the harm caused as the very existence of the defect, and in the section entitled “Appellant’s Final Request,” private counsel asks that all the grounds raised be granted, that the challenged judgment be declared null and void, and that his client be acquitted of all punishment and liability.
In the same section of his appeal, also signed by defense counsel, the accused makes the same request and additionally asks this Court to order the forfeiture of the timber and order its return; to dismiss the State’s private criminal complaint and civil action; and to award personal and procedural costs. The objections cannot be upheld and, given that they are identical, they will be decided jointly. For purposes of analyzing the issue raised, it is appropriate to begin with a brief overview of the challenged judgment. Thus, the factual basis charged and found to be true against the defendant is as follows: “That on January 14, 2016, between approximately 8:30 and 9:30 hours, in Buenos Aires de Puntarenas, specifically in the center of the town, the accused [Nombre11], knowing that his actions were unlawful, was apprehended by Fuerza Pública officers while transporting, in a white Frighliner-brand truck bearing license plate [Placa1], timber without the corresponding transportation permit required by law or forestry authorization from the State.
Specifically, he transported 3.874 m 3 of sawn teak, 0.5 m3 of teak logs, and 0.034 of [Nombre10], which is a protected species.” (cf. oral judgment). Regarding the legal classification assigned to the proven facts, the judgment held: “...Article 56 of Ley 7575, which is the Ley Forestal, states: ‘Logs, squared timber, or sawn timber originating from forests or plantations may not be moved unless the corresponding documentation is available.’ Article 56 is where the conduct with which you are charged is identified, and it expressly prohibits moving logs (repeats), a plantation, specifically teak plantations, which was the timber you were transporting, without the corresponding documentation, regardless of whether it comes from a forest; the article makes no distinction, it does not matter whether it comes from a forest or a plantation: if you do not have those permits, you cannot transport the timber, and it is precisely here that your conduct fits perfectly, correct.
The documentary evidence also confirms...the CED2, which is another document that would have authorized you, does not exist; the one submitted in the case file had expired in September 2014, and the witness who is an SINAC official, named [Nombre12], had already told us that documents of this kind have no validity once they expire. Likewise, Article 31 of the Ley Forestal states that, to remove timber from properties to any other part of the national territory...a certificate issued by the forestry manager is required; as we said, one had existed since 2014, but it had expired...In that regard, the protected legal interest, namely natural resources, was harmed, particularly considering that the timber you were transporting also included [Nombre10], timber that has been subject to a logging ban since 1997; in other words, this species has been protected by a logging ban for almost twenty years.
Although Mr. [Nombre13] told us that an unnamed person gave him this timber, that is not credible; it is very expensive timber precisely because it is so scarce. This further establishes the unlawfulness of the conduct, and your culpability has been proven, since you told us that you are mentally sound...you stated that you have spent ten years transporting goods for this gentleman, and that provides sufficient experience to know what things you may or may not transport before agreeing to transport them; you were fully aware...of the acts you were carrying out...”. (cf. audio file dated February 16, 2016, sequences, according to the time counter, from 24:57 to 35:23). This concludes the relevant portions of the judgment. That said, the first observation that must necessarily be made is that, merely from reading the prosecution’s charge and the factual basis established, as the historical act alleged, it is absolutely clear that the defendant was accused of transporting timber without the State permit required to do so.
For that purpose, the charge included the means by which the accused carried out that transportation, “the white Frighliner-brand truck bearing license plate [Placa1],” as well as the temporal and spatial circumstances in which the perpetrator engaged in the conduct, “on January 14, 2016, between approximately 8:30 and 9:30 hours, in Buenos Aires de Puntarenas, specifically in the center of the town.” Likewise, it described the type of timber transported, its exact quantity, and other characteristics: “3.874 m 3 of sawn teak, 0.5 m3 of teak logs, and 0.034 of [Nombre10], which is a protected species.” In other words, it is readily apparent that the charge was clear, although it cannot be overlooked that greater precision would have been desirable regarding the type of required documentation that the accused was not carrying at the time of the act and that would have evidenced State authorization to transport the timber in question.
Nevertheless, the foregoing does not in any way mean that the charge was defective or gave rise to an arbitrary judgment. In other words, the accused clearly knew the act of which he was charged—which is what matters—and had the opportunity to pursue whatever defense strategy he deemed appropriate. Certainly, greater precision regarding the type of State authorization that was missing would have helped avoid the confusion that the appellants—particularly defense counsel—have attempted to create throughout the proceedings. Nevertheless, it bears repeating that this does not mean that any defect exists. According to the complainants, the conduct attributed to the convicted person does not constitute an offense because the timber he transported came from a plantation, and no permit authorizing him to do so could be required in light of Article 28 of the Ley Forestal, which expressly provides, insofar as relevant: “Exception from harvesting permit requirements.
Forest plantations, including agroforestry systems and individually planted trees and their products, shall not require a permit for harvesting, transportation, processing, or export...”. In fact, a correct reading of the criminal provisions at issue readily leads to the conclusion that, regardless of the origin of the timber being transported, that action will always be prohibited if the corresponding authorization is not available, and such authorization is therefore required in every case. In other words, regardless of its origin, documentation authorizing its transportation or movement cannot be dispensed with. This is established by Articles 56 and 31 of the Ley Forestal, as applied in this case, in relation to Article 63 of that same body of law, which respectively provide: ARTICLE 56.—Movement of timber. Logs, squared timber, or sawn timber originating from forests or plantations may not be moved without the corresponding documentation.” ARTICLE 31.—Permit for conveying timber.
To remove logs, squared timber, or sawn timber originating from forest plantations from a property to any part of the national territory, a certificate of origin issued by the forestry manager or the Regional Environmental Council for the area shall be required. If this document is issued by the forestry manager, the copy must bear the acknowledgment-of-receipt stamp of the State Forestry Administration...”. ARTICLE 63.—Imprisonment from one month to one year. A term of imprisonment from one month to one year shall be imposed on anyone who: a) Violates the provisions of Article 56 of this law...”. (Emphasis added). Regarding the type of documentation required in each case, the Regulations to the Ley Forestal, No. 25721, Executive Decree number 25721 of October 17, 1996, effective since January 23, 1997, provide: “Article 30: Transportation of forest products originating from plantations and agroforestry systems.
The certificate of origin referred to in Articles 31 and 55 of the Ley Forestal must certify the existence of a forest plantation or agroforestry system on a particular property and must state the planted area, number of trees, species, location, and name of the owner. This certificate, unique to each property or area to be harvested, shall be issued only once prior to moving the timber, whether in log or sawn form, and a copy must be delivered to the A.F.E.
For control purposes during transportation, once the copy of the Certificate of Origin (Certificado de Origen) has been delivered to the A.F.E., the owner shall be entitled, without any additional requirement and immediately, to a number of transportation permits (guías de transporte) proportional to the reforested area or the volume to be extracted. The permits shall be completed by the owner each time timber is transported and must be delivered to the primary processing facility (centro de industrialización primaria) as proof of origin. The A.F.E., by administrative decision (resolución administrativa), shall establish the minimum information that the transportation permit must contain. Any natural or legal person whose raw material from forest plantations (plantaciones forestales) or agroforestry systems (sistemas agroforestales) is integrated into a forest-products industry may, if desired, use an alternative system for transportation permits.
This system consists of a [Placa2] that must be placed at the rear of the load. The Director of the A.C., in agreement with the producers, shall establish its required characteristics and the identification number for each producer. The preparation and cost of the emblem shall be borne by the regulated party (administrado)." "Article 31: To move timber in log, block, or squared form that is not covered by the preceding article, a [Placa3] and a transportation permit issued by the A.F.E. (Administración Forestal del Estado), the forestry manager (regente), the person in charge at the Municipality, or the Consejo Regional Ambiental, as applicable, shall be required. The A.F.E., by administrative decision, shall establish the minimum information that the permit must contain. The A.C., the forestry manager, the forestry professional (profesional forestal), the municipal official, and the Consejo Regional Ambiental, as applicable, shall be responsible for preparing and providing the holder of the permit or forest management plan (plan de manejo) with the corresponding permits at cost.
The transportation permit shall specify only the permit number or approval number of the forest management plan, as applicable, and the name of the owner of the property from which the timber originates. The permit holder shall be responsible for completing the remaining information." Note that the only difference that might ultimately be found with respect to the relevant documentation—the normative element (elemento normativo) of Article 56 of the Ley Forestal, which in turn constitutes a blank criminal statute (tipo penal en blanco)—would depend on the site from which the timber being transported originates, which, as applicable, gives rise to the issuance of authorization documents of a different nature. Specifically, this normative concept must be supplied by the judge conducting the trial, based on the factual predicate (supuesto de hecho) at issue, through a lawful process and taking the implementing regulations of the law into account.
Thus, contrary to the complainants’ understanding, if the timber comes from a plantation, a prior certificate of origin does indeed provide the basis for the CED3, so that it may be delivered to the primary processing facility each time the timber is transported. However, this does not mean that the certificate of origin ceases to be required in order to move the timber off the property, as established in Article 31 of the Ley Forestal, transcribed above. Moreover, as is obvious, a regulatory provision could not repeal this provision of the Ley Forestal, under which a certificate of origin is required to move timber off the property. In this regard, the Sala Tercera de la Corte Suprema de Justicia has had occasion to rule and has held that: "...This Chamber considers that, based on a combined reading of these provisions, they must be interpreted to mean that timber harvested from plantations, as in the present case, does not require a harvesting, transportation, processing, or export permit, pursuant to Article 28 of the Ley Forestal.
However, this does not exempt the owner of the timber and the carrier from carrying documents proving the origin of that timber, as required by Article 31 of the same statute; those are the documents referred to in Article 56. It must be made clear that, although no government permit is required to harvest or transport the timber, the issuance of a CED2 is required for it to be moved from one place to another, logically for the purpose of ensuring the lawful origin of the timber and ruling out its illegal extraction through theft, for example...." (Sala Tercera de la Corte Suprema de Justicia, at 10:13, on 27 de junio de 2014). It must be added, consistently with the position taken throughout this decision, that before being processed, all timber from a plantation shall also require the corresponding transportation permit derived from the same certificate of origin in order to be taken to the primary processing facility; and that the requirement to carry the corresponding certificate of origin is specifically intended to ensure oversight of the exploitation of the natural resource in question, which is always regulated by the State.
In the case under review, as the challenged judgment found, the defendant acted without authorization under the legal system because the defense submitted a certificate of origin that was not valid when the events occurred: its validity period ran from 4 de marzo de 2014 to 4 de setiembre de ese mismo año, whereas the investigated unlawful act occurred on 14 de enero de 2016. The appellants contend that this conclusion is mistaken because that certificate is valid only for harvesting the timber and demonstrating the plantation’s existence. However, it is unclear what interpretation other than that adopted in the judgment could be given to an expired official document, except that it has ceased to produce any legal effect; furthermore, it is not true that the document is required only during one stage of the harvesting process (proceso de aprovechamiento), as was made clear above. In any event, the complainants attempt to attribute to the repeatedly cited Article 30 content that it does not have, since that article expressly refers to the need for a CED2 to transport forest products (productos forestales) originating from plantations, which is the situation governed by the provision.
Separately, the appellants argue that transporting is not the same as moving for purposes of finding that the elements of Article 56 of the Ley Forestal were established. They do not, however, state the reasons for their view, and under proper Spanish usage, these are transitive verbs with the same meaning. In this regard, the Diccionario de la Real Academia Española states that transportar means "To take someone or something from one place to another" (http://dle.rae.es/?id=aMgmTGw), while movilizar means "To set into activity or motion." Furthermore, taking into account that the defendant also transported pieces of [Nombre10], it is important to note that he likewise did not have the transportation permit required by Article 31 of the Reglamento de la Ley Forestal, also cited above. The offense in question was therefore established on that basis as well, even apart from the foregoing considerations, and it is entirely immaterial whether the timber came from forest or pasture (potrero), because no such legal distinction exists. For the foregoing reasons, the claims are denied.
IV.In the second ground, the complainants argue that the judgment contains contradictory reasoning (fundamentación contradictoria), because, in their view, the court based the defendant’s conviction solely on the statements and report submitted by MINAET (sic) officials, which it found credible. However, in a clear violation of the principles of objectivity and impartiality, it failed to address the scope established in Article 28 of the Ley Forestal. Furthermore, they contend, there is a complete lack of reasoning regarding the injury caused to the legally protected interest (bien jurídico), given that forest plantations are not part of the State forest estate (patrimonio forestal del Estado), pursuant to Article 13 of the same Ley Forestal. They believe that, for this reason, the court below (a quo) erred in denying the defective procedural activity (actividad procesal defectuosa) raised on that basis during the trial.
The claim is denied. As regards the application of substantive law (ley de fondo), reference is made to the considerations set forth in the preceding Considerando of this judgment. Moreover, the argument that forest plantations do not constitute part of the State forest estate and are therefore not subject to its protection must likewise be rejected. The complainants overlook the fact that Article 50 of the Constitución Política establishes the environment as a legally protected interest that must be safeguarded by the State. In relevant part, it provides: “...Every person has the right to a healthy and ecologically balanced environment. Accordingly, every person has standing to report acts that infringe that right and to seek reparation for the harm caused. The State shall guarantee, defend, and preserve that right. The law shall determine the corresponding liabilities and penalties.” The Sala Constitucional has had occasion to rule on the matter and has established: “...Regarding the right to enjoy a healthy and ecologically balanced environment in educational institutions.—The right to health recognized in Articles 21 of the Constitución Política, 1 and 11 of the Declaración Americana de los Derechos y Deberes del Hombre, 4 of the Convención Americana sobre Derechos Humanos, and 10 of the Protocolo Adicional a la Convención Americana sobre Derechos Humanos en Materia de Derechos is closely linked to the right to live in a healthy and balanced environment, enshrined in Article 50 of the Constitution.
Environmental quality is a fundamental parameter of quality of life, as are health, food, employment, housing, and education, among others. Consequently, the State has an obligation to provide adequate protection for the environment, for which purpose it must take the measures necessary to ensure that the environment is free from pollution and that alterations caused by either human beings or nature, in the immediate or distant surroundings, do not constitute harm to the environment or to the health of the people who live there....” (SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA, decision number 2012-12430, at nueve horas cinco minutos del siete de setiembre de dos mil doce). Likewise, the Convenio sobre Diversidad Biológica y Anexos (Río de Janeiro, 1992), ratified by Law number 7416 of 30 de junio de 994, reiterates this State obligation as follows in Article 6: “General measures for conservation and sustainable use.
Each Contracting Party shall, in accordance with its particular conditions and capabilities: (a) Develop national strategies, plans, or programs for the conservation and sustainable use of biological diversity or adapt existing strategies, plans, or programs for this purpose, which shall reflect, among other things, the measures set out in this Convention that are relevant to the Contracting Party concerned; and (b) Integrate, as far as possible and as appropriate, the conservation and sustainable use of biological diversity into relevant sectoral or cross-sectoral plans, programs, and policies.” In Article 2, the same Convention defines, among other concepts: “‘Biological diversity’ means the variability among living organisms from all sources, including, among other things, terrestrial, marine, and other aquatic ecosystems and the ecological complexes of which they are part; this includes diversity within species, between species, and of ecosystems. ‘Ecosystem’ means a dynamic complex of plant, animal, and microorganism communities and their non-living environment interacting as a functional unit. ‘Domesticated or cultivated species’ means a species whose evolutionary process has been influenced by human beings to meet their own needs....” Thus, there is not the slightest doubt that every natural resource is protected by the State as part of its responsibility to care for the environment and therefore constitutes a legally protected interest, irrespective of what the law defines as the State forest estate.
It is clear that, by enacting the Ley Forestal and its provisions, the Costa Rican State merely fulfilled the commitment it had thus undertaken internationally and gave full effect to the cited constitutional provision. Accordingly, the claim is rejected.
V.In the third ground, the interested parties claim that the Procuraduría General de la República lacks standing (legitimación) to appear as a civil claimant (actor civil) and private prosecutor (querellante), because they believe that, although such standing is asserted under the guise of alleged diffuse interests (intereses difusos), it does not exist because plantations are not part of the State forest estate. The claim cannot succeed. Environmental protection gives rise to a diffuse interest, as our highest constitutional court has also recognized, holding: “In environmental law, the concept of standing tends to be extended and broadened to such a degree that the traditional concept must necessarily be abandoned. Any person must be understood to be a party, and that person’s right does not arise from property titles or specific rights or causes of action that the person might exercise under conventional law; rather, the interest may be what modern legal scholars call a diffuse interest, whereby the original standing of a person with a legitimate interest, or even of a merely interested person, is diffused among all members of a particular category of persons who are thus equally affected by the unlawful acts that infringe their rights.” (SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA, decision 0503-94, at 15:15 hours, on 26 de enero de 1994).
Nevertheless, the standing to bring proceedings (legitimación activa) of the Procuraduría General de la República in criminal proceedings does not necessarily derive from that concept, but rather from the corresponding provision in Article 2.i of the Ley Orgánica de la Procuraduría General de la República, under which, in relevant part, the functional authority of that entity is to: “Act in defense of the national patrimony, the resources existing in the maritime-terrestrial zone, the territorial sea, the exclusive economic zone, and the continental shelf. Bring the appropriate legal actions to safeguard the environment in order to guarantee every person’s constitutional right to a healthy and ecologically balanced environment. Ensure the proper application of conventions, international treaties, laws, regulations, and other provisions concerning those matters. Investigate, on its own initiative or at the request of a party, any act or omission that infringes the aforementioned legal framework.
Be recognized as a party, from the outset of the proceedings, in criminal cases involving allegations of an offense or violation of environmental legislation or the Ley sobre la Zona Marítimo-Terrestre. For this purpose, it may institute criminal proceedings (acción penal) on its own initiative, without being subordinate to the actions and decisions of the Ministerio Público; file the same appeals that the Código de Procedimientos Penales grants to the latter; and bring a civil action for damages (acción civil resarcitoria)....” Therefore, contrary to the view expressed, it is incorrect to assert that the State entity lacks standing to act in this type of matter as a private prosecutor and civil claimant. Accordingly, the objections are denied.
VI.Separately, this Chamber has determined that the digital records in this case file contain no video recording, but only an audio recording, of the challenged judgment, with no reason for this appearing in the record. In this regard, the trial court is encouraged to use the technological means available to it to create an audiovisual record of the hearings, thereby ensuring better access for the parties and the higher authorities responsible for reviewing them. This should be done in accordance with the institutional policies on oral proceedings implemented for this subject matter in “Procedimiento para la Grabación de las Audiencias Orales y Actos de Investigación, PRE-CO-01-2013,” issued by the Comisión de Oralidad del Poder Judicial and approved on 24 de octubre del 2013, at Session No. CED4 of the Consejo Superior del Poder Judicial, Article XLVIII.
Por tanto:
The appeals filed are denied in all respects. The trial court shall take note of the recommendation concerning the recording of hearings. Let notice be given.

Recurso de apelación de sentencia penal interpuesto en la presente causa seguida contra [Nombre2] , , nacido el nueve de diciembre de mil novecientos setenta y dos, con cédula de identidad número CED1 , por el delito de Infracción a la Ley Forestal, en perjuicio de Los Recursos Naturales. Intervienen en la decisión del recurso, los jueces Ivette Carranza Cambronero, Jaime Robleto Gutiérrez y [Nombre3] . Se apersonaron en apelación, el encartado [Nombre1] , los licenciado[Nombre4] en calidad de defensor particular del imputado y [Nombre5] en representación de la Procuraduría General de la República.
Resultando:
1. Que mediante sentencia No. 60-2016 de las diecisiete horas del dieciséis de febrero de dos mil dieciséis, el Tribunal de Juicio del Pérez Zeledón, sección Flagrancia, resolvió: "POR TANTO: De conformidad con lo expuesto y artículos 39 y 41 de la Constitución Política, 8 y 9 de la Convención Americana sobre Derechos Humanos, 6, 9, 142, 184, 265 a 267, 270, 360 a 365, 367, 368 y 432 todos del Código Procesal Penal, 1, 30, 31, 45, 50, 59 a 63, 71 del Código Penal 1045 del Código Civil así como normas especiales aplicadas, 31, 56 y 63 de la Ley Forestal se declara a [Nombre1] autor responsable del delito de INFRACCIÓN A LA LEY FORESTAL cometido en perjuicio de LOS RECURSOS NATURALES, imponiéndosele en tal carácter una pena de UN MES DE PRISIÓN que deberá descontar en el establecimiento carcelario que indiquen los reglamentos penitenciarios, previo abono de la preventiva sufrida si la hubiere. Comuníquese lo resuelto al Juzgado de Ejecución de la Pena, al Instituto Nacional de Criminología y al Registro Judicial para lo de sus cargos, una vez firme la sentencia. (Por un período de prueba de TRES AÑOS se le concede a [Nombre1] el Beneficio de Ejecución Condicional de la Pena, advirtiendo al imputado de los motivos que darían lugar a la revocatoria de dicha gracia. Se condena al imputado al pago de las costas del proceso. Se declara CON LUGAR LA ACCIÓN CIVIL RESARCITORIA establecida por EL ESTADO representada por medio de la PROCURADURÍA GENERAL DE LA REPÚBLICA en contra de [Nombre1] la cual se dicta en abstracto, debiendo las partes ir a la vía civil a hacer efectiva la misma. Se ordena el comiso de la madera decomisada en este proceso, pasando la misma a la orden del Estado. En cuanto al vehículo placas [Placa1] - se ordena la puesta en posesión en forma definitiva a quien demuestre ser el representante legal de la sociedad anónima propietaria del mismo. NOTIFÍQUESE. (O SI SE DICTÓ LA SENTENCIA EN FORMA ORAL INDICAR QUE QUEDAN LAS PARTES NOTIFICADAS EN EL ACTO Y SE DEJA A SU DISPOSICIÓN LA GRABACIÓN EN AUDIO Y VIDEO DE LA SENTENCIA). [Nombre6] - JUEZ/A DECISOR/A." (sic)
2. Que contra el anterior pronunciamiento, el sindicado [Nombre1] y su defensor el licenciado [Nombre7] interpusieron los recursos de apelación.
3. Que verificada la deliberación respectiva de conformidad con lo dispuesto por el artículo 466 del Código Procesal Penal, reformado por Ley 8837 publicada el nueve de diciembre de dos mil once (Creación de Recurso de Apelación de la Sentencia), el Tribunal se planteó las cuestiones formuladas en los recursos.
4. Que en los procedimientos se han observado las prescripciones legales pertinentes.
Redacta la Jueza [Nombre8] , y;
Considerando:
I.Por cumplir con los requisitos exigidos, se conocen sendos recursos de apelación de la sentencia penal, interpuesta por el defensor particular [Nombre7] y por el acusado [Nombre1] , contra la resolución oral número 60-TFPZ-2016, dictada por el Tribunal de Flagrancia del Primer Circuito Judicial de la Zona Sur, sede Pérez Zeledón, a las 17:00 horas, de 16 de febrero de 2016. Dicho pronunciamiento judicial declaró al acusado [Nombre9] , autor responsable del delito de infracción a la ley forestal, en perjuicio de los recursos naturales, en razón de lo cual, se le impuso el tanto de un mes de prisión y se le concedió el beneficio de ejecución condicional de la pena por tres años. Asimismo, se declaró con lugar la acción civil resarcitoria interpuesta por la Procuraduría General de la República.
II.El día 08 de junio de 2016, durante la primera audiencia, se llevó a cabo la respectiva vista oral, dentro de esta etapa impugnaticia. En esa ocasión, este Tribunal de Apelación de Sentencia estuvo integrado por el juez [Nombre3] , así como, las juezas Ivette Carranza Cambronero y Rosibel López Madrigal. Sin embargo, al día de hoy, esta última funcionaria judicial se ha acogido a su jubilación, razón por la cual, en su lugar, integra esta Cámara el juez Jaime Robleto Gutiérrez. Sustitución que resulta válida, para los efectos de este recurso, en atención a lo dispuesto por los artículos 41 de la Constitución Política y 4 del Código Procesal Penal, con el fin de evitar dilaciones en el proceso y resolver la situación jurídica del encausado, en el entendido de que se ha tenido a la vista el registro audiovisual de la audiencia oral y de conformidad con la jurisprudencia de la Sala Constitucional que ha dispuesto que «...resulta constitucionalmente válido que en aquellas vistas o audiencias orales de casación en las que no se reciban elementos de prueba en forma oral o, que las argumentaciones de las partes consten ya por escrito, sin que se aporte nada nuevo, puedan intervenir otros jueces, distintos a los que participaron en la vista, a la hora de tomar la decisión, si y sólo si, están en capacidad de hacerlo y existen razones justificadas (que deberán constar) que impidan que quienes estuvieron en la audiencia oral se reúnan en fecha próxima a estudiar y resolver el asunto...' (Sala Constitucional, N° 6681 de las 15:30 horas del 10 de diciembre de 1996 y Nº 17553 de las 12:23 h. del 30 de noviembre de 2007)» (Sala Constitucional, N° 6880 de las 15:05 h. del 22 de mayo de 2013. El resaltado se suple). Aunque el precedente citado se refiere al recurso de casación, resulta igualmente aplicable tratándose de la impugnación que nos ocupa.
III.Los recurrentes de forma idéntica -en memoriales de fecha y encabezado distintos, pero de igual redacción- reclaman, en el primer motivo incoado, el errónea aplicación de la ley sustantiva. En ese sentido, indican que la conducta atribuida al encartado es atípica y por consiguiente debió haberse absuelto. Señalan, que se atribuye la conducta de transporte ilegal de madera, establecido en el artículo 56 de la Ley forestal, pero que, el artículo 28 de esa misma ley, establece que las plantaciones forestales, entre otros supuestos, no requieren permiso para su transporte. Aducen, que la madera en cuestión era proveniente de una plantación de teca, según el certificado de origen 15-2014-LSS, emitido por un regente forestal debidamente autorizado. De igual forma, argumentan que, según el artículo 30 de ese mismo cuerpo de normas, una vez procesada la madera en el centro de industrialización primaria no requiere ni guía, se entiende, de transporte, ni certificado de origen.
Según el quejoso, el a quo y los testigos de cargo, funcionarios del MINAET (sic), yerran al entender que el CED2 que se presentó, al momento de los hechos, se encontraba vencido porque ese documento solo se requiere para el aprovechamiento de la madera y demostración de la existencia de la plantación. Además, según los recurrentes, el a quo omitió realizar un análisis de los artículos 28 y 30 de la Ley Forestal, con lo que se violentó el artículo 2 del Código Procesal Penal. Por último, según los quejosos, se argumenta que: "...si bien es cierto dentro de la madera de teca que se decomisó, existen una (sic) piezas de la especie [Nombre10], lo cierto es que existe una ausencia total de prueba que determine si la misma proviene de un bosque o potrero y al no poderse determinar la procedencia no es posible imputar una conducta delictiva...". En el cuarto y último motivo, ambos recurrentes alegan violación al debido proceso y al derecho de defensa por defectos en la pieza acusatoria, que no cumple con los requisitos del artículo 303 del Código Procesal Penal.
Al punto, indican que se atribuye al sentenciado [Nombre1] el delito de transporte ilegal de madera sin los documentos respectivos, "cuando lo cierto es que el tipo penal del del (sic) artículo 56 no refiere a la conducta de movilizar el cual no es sinónimo de trasladar" (ver recursos). Además, indican los interesados que la acusación no describe que se trata de madera proveniente de una plantación, por lo que lo correspondía era la absolutoria de la persona acusada. Refieren, en apoyo de su posición, la resolución número 682, de las 15:00 horas, del 25 de agosto de 1997, del antiguo Tribunal de Casación Penal, según la cual, el artículo 56 mencionado no se refiere al transporte de madera proveniente de terrenos que no sean de bosque o plantación. Señalan como agravio causado, la existencia misma del vicio y en lo que se enuncia como "Petitoria final del recurrente", el abogado particular solicita se declare con lugar la totalidad de los motivos incoados, se ordene la nulidad de la sentencia recurrida y se absuelva de toda pena y responsabilidad a su representado.
En el mismo apartado, en su recurso, suscrito también por el defensor, el imputado realiza la misma solicitud y añade, solicita a esta Sede, que se ordene el comiso de la madera y se ordene su devolución; sea declarada sin lugar la querella y la acción civil estatales y se condene al pago de las costas personales y procesales. Los reparos no pueden atenderse y dada su identidad, se procede a su resolución conjunta. Para efectos de análisis del punto planteado, conviene partir de una breve semblanza del fallo impugnado. Así, consta que la plataforma fáctica acusada y tenida por cierta contra el justiciable, es la siguiente: "Que el 14 de enero de 2016, entre las 8:30 y las 9:30 horas, aproximadamente, en la localidad de Buenos Aires de Puntarenas, propiamente en el centro de la localidad, el acusado [Nombre11] , a sabiendas del carácter ilícito de sus actos, fue sorprendido por funcionarios de la Fuerza Pública al momento de trasladar en el vehículo automotor tipo camión, marca Frighliner, color blanco, placa [Placa1] , madera sin contar con la guía de transporte respectiva acorde a la ley, ni autorización forestal del Estado.
Propiamente, trasladó 3.874 m 3 de teca aserrada, 0.5 m3 de teca en troza y 0.034 de [Nombre10], que es una especie vedada." (cfr. sentencia oral). En cuanto a la calificación jurídica otorgada a los hechos demostrados, se entendió en sentencia: "...Señala el artículo 56 de la ley 7575, que es la ley forestal, 'No se podrá movilizar madera en trozas, escuadrada ni aserrada proveniente de bosque ni de plantación, sino se cuenta con la documentación respectiva". El artículo 56 es donde se encuentra identificada la conducta, que se le está achacando a usted y prohíbe expresamente movilizar madera en trozas (repite), una plantación que es propiamente las plantaciones de teca, que madera que usted trasladaba, sin contar con la documentación respectiva, independientemente que provenga de bosque, el artículo no hace la distinción, no importa, si proviene de un bosque o una plantación si usted no cuenta con esos permisos, usted no puede trasladar la madera y es aquí precisamente cuando la conducta que usted realiza encuadra perfectamente, verdad.
La prueba documental viene a ratificar también...el CED2 , que es otra de las cosas que lo hubiera autorizado, no existe, el que se ha hecho llegar a los autos, desde setiembre de 2014, estaba vencido, y ya el testigo que es funcionario del SINAC, de nombre [Nombre12] nos había dicho que este tipo de documentos una vez vencidos no tienen validez alguna. Igualmente, el artículo 31 de la ley forestal nos indica que, para sacar de las fincas a cualquier otra parte del territorio nacional...se requerirá un certificado expedido por el regente forestal que como dijimos, existía desde el año 2014 pero se encontraba vencido...En ese sentido, el bien jurídico tutelado, que son los recursos naturales se vieron afectados, sobre todo si se toman en consideración que entre la madera que usted trasladaba, trasladaba también [Nombre10], que es madera que tiene una veda desde el año 1997, es decir, casi veinte años tiene esta especie de estar vedada, y si bien es cierto, don [Nombre13] nos dijo que una persona, que no dice el nombre, le regaló esta madera, no es creíble, es una madera muy cara, precisamente, por lo escasa que es.
Esto aún más a exponer la antijuricidad de la conducta y se ha demostrado su culpabilidad, pues usted nos ha indicado que usted es una persona mentalmente sana...nos relató que tiene diez años de dedicarse al transporte, para este señor, y eso da la experiencia suficiente para saber que cosas puede trasladar o no, para que accediera a trasladarla, usted tiene pleno conocimiento...de los actos que está realizando...". (cfr. archivo de audio de fecha 16 de febrero de 2016, secuencias, según contador horario, de 24:57 a 35:23). Hasta aquí los alcances de la sentencia en lo que interesa. Ahora bien, una primera observación que necesariamente debe hacerse es que, de la sola lectura de la acusación fiscal y la plataforma fáctica demostrada, como hecho histórico imputado, se entiende con absoluta claridad que se atribuyó al justiciable haber trasladado madera sin contar con el permiso estatal para hacerlo.
Para ello, se estableció se incluyó como parte de la imputación, el medio en que el acusado realizó dicho transporte, "el vehículo automotor tipo camión, marca Frighliner, color blanco, placa [Placa1] ", así como, las condiciones temporales y espaciales en que el agente desarrolló su conducta, "el 14 de enero de 2016, entre las 8:30 y las 9:30 horas, aproximadamente, en la localidad de Buenos Aires de Puntarenas, propiamente en el centro de la localidad". De igual forma, se describió el tipo de madera que fue trasladada, así como su cantidad exacta y otras características, "3.874 m 3 de teca aserrada, 0.5 m3 de teca en troza y 0.034 de [Nombre10], que es una especie vedada". Es decir, salta a la vista, que se trata de una imputación clara, frente a lo que no puede soslayarse que una mayor precisión hubiese resultado deseable, en lo que atañe al tipo de documentación requerida, que el imputado no portaba consigo al momento de la acción y que daría cuenta de la autorización estatal para el transporte de madera en cuestión.
Sin embargo, lo anterior, no implica que se trate en modo alguno de una acusación defectuosa que diera origen a una sentencia arbitraria. Es decir, el imputado conocía con claridad el hecho del que se le acusaba, que es lo importante, del que tuvo oportunidad de desplegar la estrategia de defensa que consideró conveniente. Ciertamente, una mayor precisión cuanto al tipo de autorización estatal que se echaba de menos hubiese contribuido a evitar la confusión que han intentado crear los recurrentes durante todo el proceso -en especial la defensa técnica. No obstante, se insiste, ello no significa que exista defecto alguno. Para los quejosos, la conducta atribuida al sentenciado es atípica, puesto que la madera que transportó provenía de una plantación y no podría exigírsele permiso alguno que autorizara al acusado para hacerlo, en atención a lo dispuesto en el artículo 28 de la Ley Forestal que así lo dispone expresamente en lo que interesa: "Excepción de permiso de corta.
Las plantaciones forestales, incluidos los sistemas agroforestales y los árboles plantados individualmente y sus productos, no requerirá permiso de corta, transporte, industrialización ni exportación...". En realidad, una correcta lectura de las normas penales en cuestión, permite concluir con entera facilidad que, no importa el origen de la madera que se transporte, esa acción será siempre prohibida, si no se cuenta con la autorización respectiva, que se requerirá entonces en todos los casos. Es decir, sea cual sea su origen, no podrá obviarse la existencia de una documentación que permita su transporte o su movilización. Así lo establecen los artículos 56 y 31 de la Ley Forestal, aplicados en la especie, en relación con el artículo 63 de ese mismo cuerpo de normas, que, en su orden, disponen: ARTICULO 56.- Movilización de madera. No se podrá movilizar madera en trozas, escuadrada ni aserrada proveniente de bosque ni de plantación, si no se cuenta con la documentación respectiva." ARTICULO 31.- Permiso para trasegar madera.
Para sacar de la finca hacia cualquier parte del territorio nacional, madera en trozas, escuadrada o aserrada, proveniente de plantaciones forestales, se requerirá un certificado de origen expedido por el regente forestal o el Consejo Regional Ambiental de la zona. En caso de que este documento sea expedido por el regente forestal, la copia deberá contar con el sello de recibido de la Administración Forestal del Estado...". ARTICULO 63.- Prisión de un mes a un año. Se impondrá prisión de un mes a un año a quien: a) Contravenga lo dispuesto en el artículo 56 de esta ley...". (El resaltado se suple). En cuanto al tipo de documentación que se requiere en cada caso, el Reglamento a la Ley Forestal, Nº 25721, Decreto Ejecutivo número 25721 del 17 de octubre de 1996, vigente desde el 23 de enero de 1997: "Artículo 30: Del transporte de los productos forestales provenientes de plantaciones y sistemas agroforestales.
En el certificado de origen a que se refiere el artículo 31 y 55 de la Ley Forestal deberá certificarse la existencia de una plantación forestal o un sistema agroforestal en determinada finca, e indicarse el área plantada, el número de árboles, las especies, la ubicación, el nombre del propietario o propietaria. Este certificado único para cada finca, o área a explotar, será expedido por una única vez previo a la movilización de la madera ya sea en troza o aserrada y deberá entregarse copia a la A.F.E. Para efectos de control en el transporte una vez entregada la copia del Certificado de Origen a la A.F.E., el propietario o propietaria tendrá derecho sin ningún requisito adicional y en el acto, a un número proporcional de guías de transporte de acuerdo al área reforestada ó volumen a extraer que serán llenadas por el propietario o propietaria cada vez que transporte madera, y deberán ser entregadas al centro de industrialización primaria para respaldar la procedencia.
La A.F.E. vía resolución administrativa establecerá los requisitos mínimos que deberá contener la guía de transporte. Toda persona física o jurídica que tenga integrada su materia prima proveniente de plantaciones forestales o sistemas agroforestales a una industria forestal, podrá acogerse si lo desea a un sistema alternativo para las guías de transporte. Este sistema consiste en un [Placa2] que debe colocarse en la parte trasera de la carga. El Director del A.C. en acuerdo con los productores o productoras, establecerán las características que contendrá y el número de identificación requerido para cada productor o productora. La elaboración y costo del emblema correrá por cuenta del administrado." "Artículo 31: Para movilizar madera en troza, en bloc o escuadrada, no comprendidos en el artículo anterior, deberá contarse con un [Placa3] y una guía de transporte emitida por la A.F.E. (Administración Forestal del Estado), por el regente, por el encargado de la Municipalidad o el Consejo Regional Ambiental cuando corresponda.
La A.F.E. vía resolución administrativa establecerá los requisitos mínimos que deberá contener la guía. Será responsabilidad del A.C., del Regente, del profesional forestal, del responsable de la municipalidad y del Consejo Regional Ambiental, según corresponda, la edición y entrega al titular del permiso o plan de manejo de las correspondientes guías, al costo. La guía de transporte únicamente determinará el número de permiso o aprobación del plan de manejo según corresponda, nombre del propietario o propietaria de la finca de la cual proviene. El llenado del resto de la información será responsabilidad del titular del permiso." Nótese que la única diferencia que eventualmente se verificaría en lo que atañe a la documentación respectiva -elemento normativo del artículo 56 de la ley forestal que a su vez conforma un tipo penal en blanco- dependería del sitio del que proviene la madera que se transporta, que, según el caso, da lugar a la emisión de documentos de autorización de naturaleza diferente.
Precisamente, este concepto normativo debe ser suplido por la persona juzgadora encargada del juicio, según el supuesto de hecho del que se trate, en un proceder lícito, tomando en cuenta la reglamentación de la ley. Así, contrario a lo que entienden los quejosos, si se trata de madera proveniente de una plantación, un certificado de origen previo da partida ciertamente a la CED3 con el fin de que sea entregada al centro de industrializacion primaria cada vez que la madera sea transportada. Sin embargo, eso no implica que para movilizar la madera fuera de la finca, ese certificado de origen deje de ser requerido, en la forma en que se establece en el artículo 31 de la Ley Forestal, transcrito líneas atrás. Amén de que, como es obvio, una norma reglamentaria no podría derogar este contenido de la ley forestal, según el cual, para movilizar madera fuera de la finca se requiere un certificado de origen.
Al respecto, la Sala Tercera de la Corte Suprema de Justicia, ha tenido oportunidad de pronunciarse y ha entendido que: "...Considera esta Sala, que, con base en la lectura integrada de estas normas, debe interpretarse que, la madera cortada de plantaciones, como la del presente caso, no requerirán permiso de corta, transporte, industrialización ni exportación, de acuerdo con el artículo 28 de la Ley Forestal. Sin embargo, ello no exime al propietario de la madera y al transportista, de portar consigo los documentos que acrediten el origen de dicha madera, tal como lo ordena el artículo 31 del mismo cuerpo legal, siendo a esa documentación a la que se refiere el artículo 56. Debe tenerse claro que, si bien no se requiere permiso estatal para cortar o transportar la madera, sí se exige la expedición de un CED2 para que circule de un sitio a otro, ello con el fin, como es lógico suponer, de garantizar la procedencia legítima de la madera, para descartar su extracción ilegal por robo, por ejemplo...".
(Sala Tercera de la Corte Suprema de Justicia, a las 10:13 horas, de 27 de junio de 2014). A lo que deberá agregarse, de acuerdo con lo que se ha venido sosteniendo en esta resolución, que, antes de ser procesada, toda madera proveniente de una plantación, requerirá también la respectiva guía de transporte derivada del mismo certificado de su origen, a fin de ser llevada al centro de industrialización primaria; y que, la exigencia de portar el respectivo certificado de origen, precisamente, pretende lograr el control sobre la explotación del recurso natural en cuestión, siempre regulada por el Estado. En el caso bajo examen, tal y como lo analizó la sentencia impugnada, el imputado actúo sin autorización del ordenamiento jurídico, por cuanto, se aportó por la defensa un certificado de origen que no se encontraba vigente al momento en que los hechos ocurren, puesto que tiene como fecha de vigencia del 4 de marzo de 2014 al 4 de setiembre de ese mismo año, siendo que el hecho ilícito investigado ocurrió el 14 de enero de 2016.
Para los recurrentes, se trata de una conclusión equivocada, puesto que la vigencia de ese certificado es únicamente para el aprovechamiento de la madera y demostración de la existencia de la plantación. Sin embargo, no se entiende qué otra lectura diferente a la otorgada en sentencia, puede darse a un documento oficial vencido, sino es que, ha dejado de producir todo efecto jurídico, además, de que, no es cierto que el documento sea requerido solo durante una fase del proceso de aprovechamiento, como quedó claro líneas atrás. De cualquier forma, los quejosos intentan otorgar al artículo 30 de repetida cita, un contenido del que carece, puesto que este alude expresamente a la necesidad del CED2 para el transporte de productos forestales provenientes de plantaciones, que es el supuesto que regula la norma. En otro orden, los recurrentes reclaman que transportar no es lo mismo que movilizar, a efectos de haberse tenido por configurado el artículo 56 de la Ley Forestal.
Sin embargo, no apuntan las razones de su opinión, siendo que, de acuerdo con el correcto idioma español, se trata de verbos transitivos que implican una misma acepción. Al respecto, el Diccionario de la Real Academia Española, dispone que transportar es "Llevar a alguien o algo de un lugar a otro" (http://dle.rae.es/?id=aMgmTGw) y movilizar, significa "Poner en actividad o movimiento". Por otra parte, tomando en cuenta que además el imputado transportó piezas de [Nombre10], es importante mencionar que tampoco contaba con la guía de transporte prevista en el artículo 31 del Reglamento de la Ley Forestal, también ya citado, por lo que igualmente, e incluso al margen de las consideraciones anteriores, se configura el delito en cuestión, sin que ninguna importancia ostente si el mismo provenía de bosque o potrero, pues la distinción legal del todo no existe. Por lo expuesto, las quejas se declaran sin lugar.
IV.En el segundo motivo, los quejosos argumentan fundamentación contradictoria de la sentencia, por cuanto, en su criterio, el tribunal fundamentó la condena del imputado asumiendo como única prueba válida las declaraciones y el informe rendido por los funcionarios del MINAET (sic), que le mereció credibilidad. Sin embargo, en una evidente violación a los principios de objetividad e imparcialidad, omitió referirse a los alcances establecidos en el artículo 28 de la Ley Forestal. Además, aducen, existe una ausencia total de fundamentación sobre la lesión que se produjo al bien jurídico, si las plantaciones forestales no son parte del patrimonio forestal del Estado, de acuerdo con el artículo 13 de la misma Ley Forestal. Opinan que, por esa razón, mal hizo el a quo en declarar sin lugar la actividad procesal defectuosa planteada en ese sentido durante el juicio. No se acoge el reclamo. En cuanto a lo que atañe a la aplicación de la ley de fondo, se remite a las consideraciones realizadas en el Considerando anterior de este fallo.
Por lo demás, el argumento esbozado en cuanto a que las plantaciones forestales no constituyen patrimonio forestal del Estado y que, por eso, no constituyen objeto de su protección, debe igualmente rechazarse. Olvidan los quejosos que el artículo 50 de la Constitución Política, prevé el medio ambiente como bien jurídico que debe ser tutelado por el Estado. Al respecto, dispone en lo que interesa: "...Toda persona tiene derecho a un ambiente sano y ecológicamente equilibrado. Por ello, está legitimada para denunciar los actos que infrinjan ese derecho y para reclamar la reparación del daño causado. El Estado garantizará, defenderá y preservará ese derecho. La ley determinará las responsabilidades y las sanciones correspondientes". La Sala Constitucional ha tenido oportunidad de pronunciarse sobre el tema y ha establecido que: “…Sobre el derecho a gozar de un ambiente sano y ecológicamente equilibrado en los Centros de Educación.-El derecho a la salud reconocido en los artículos 21 de la Constitución Política, 1 y 11 de la Declaración Americana de los Derechos y Deberes del Hombre, 4 de la Convención Americana sobre Derechos Humanos y 10 del Protocolo Adicional a la Convención Americana sobre Derechos Humanos en Materia de Derechos, se encuentra íntimamente ligado al derecho a vivir en un ambiente sano y equilibrado, consagrado en el artículo 50 constitucional.
La calidad ambiental es un parámetro fundamental de la calidad de vida; al igual que la salud, alimentación, trabajo, vivienda, educación, entre otros. En consecuencia, el Estado tiene la obligación de procurar una protección adecuada al ambiente, para lo cual debe tomar las medidas necesarias a fin de que el medio esté libre de contaminación, y que las alteraciones producidas tanto por el hombre como por la naturaleza, en el entorno próximo o lejano, no constituyan una lesión al ambiente ni a la salud de las personas que en él habitan…”. (SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA, resolución número 2012-12430, a las nueve horas cinco minutos del siete de setiembre de dos mil doce). De igual forma, el Convenio sobre Diversidad Biológica y Anexos (Río de Janeiro, 1992), ratificado por ley número 7416 del 30 de junio de 994, reitera esta obligación estatal, de la siguiente forma, en el artículo 6: "Medidas generales a los efectos de la conservación y la utilización sostenible cada Parte Contratante, con arreglo a sus condiciones y capacidades particulares: a) Elaborará estrategias, planes o programas nacionales para la conservación y la utilización sostenible de la diversidad biológica o adaptará para ese fin las estrategias, planes o programas existentes, que habrán de reflejar, entre otras cosas, las medidas establecidas en el presente Convenio que sean pertinentes para la parte contratante interesada.
Y b) Integrará, en la medida de lo posible y según proceda, la conservación y la utilización sostenible de la diversidad biológica en los planes, programas y políticas sectoriales o intersectoriales." La misma Convención, en el artículo 2, define, entre otros conceptos: "Por "diversidad biológica" se entiende la variabilidad de organismos vivos de cualquier fuente, incluidos, entre otras cosas, los ecosistemas terrestres y marinos, y otros ecosistemas acuáticos y los complejos ecológicos de los que forman parte; comprende la diversidad dentro de cada especie, entre las especies y de los ecosistemas. Por "ecosistema" se entiende un complejo dinámico de comunidades vegetales, animales y de microorganismos, y su medio no viviente que interactúan como una unidad funcional. Por "especie domesticada o cultivada" se entiende una especie en cuyo proceso de evolución han influido los seres humanos para satisfacer sus propias necesidades...".
De modo que, no existe la menor duda de que todo recurso natural es objeto de protección por parte del Estado, como parte de su responsabilidad por el cuido del medio ambiente, y por lo tanto, un bien jurídico tutelado, con independencia de lo que la ley describe como patrimonio forestal estatal. Es claro que, mediante la emisión de la Ley Forestal y sus contenidos, el Estado costarricense no hizo más que cumplir su compromiso adoptado así internacionalmente y dar plena vigencia a la disposición constitucional de cita. Así las cosas, la queja se rechaza.
V.En el tercer motivo, reclaman los interesados falta de legitimación de la Procuraduría General de la República para constituirse en actor civil y querellante, puesto que consideran que, aunque se establece la misma bajo la apariencia de supuestos intereses difusos, al no ser las plantaciones parte del patrimonio forestal del Estado, esa legitimación no existe. El reclamo no podría prosperar. La protección del medio ambiente da origen a un interés difuso, según lo ha reconocido también nuestro más alto tribunal constitucional, al establecer: “En el derecho ambiental, la noción de legitimación tiende a extenderse y ampliarse en una dimensión tal, que lleva necesariamente al abandono del concepto tradicional, debiendo entender que cualquier persona es parte y que su derecho no deviene de títulos de propiedad o derechos o acciones concretas que ella pudiera ejercer por el derecho convencional, sino que el interés podría ser lo que los modernos tratadistas denominan el interés difuso, mediante el cual la legitimación original del interesado legítimo o aún del simple interesado, se difunde entre todos los miembros de una determinada categoría de personas que resultan así igualmente afectadas por los actos ilegales que los vulneren.” (SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA, resolución 0503-94, de las 15:15 horas, de 26 de enero de 1994).
No obstante, la legitimación activa de la Procuraduría General de la República, dentro de los procesos penales, no necesariamente se deriva de ese concepto, sino de la respectiva previsión en el artículo 2.i de la Ley Orgánica de la Procuraduría General de la República, según el cual, en lo que interesa, es compentencia funcional de este ente: "Actuar en defensa del patrimonio nacional, de los recursos existentes en la zona marítimo-terrestre, el mar territorial, la zona económica exclusiva y la plataforma continental. Tomar las acciones legales procedentes en salvaguarda del medio, con el fin de garantizar el derecho constitucional de toda persona a un ambiente sano y ecológicamente equilibrado. Velar por la aplicación correcta de convenios, tratados internacionales, leyes, reglamentos y otras disposiciones sobre esas materias. Investigar, de oficio o a petición de parte, toda acción u omisión que infrinja la normativa indicada.
Ser tenida como parte, desde el inicio del procedimiento, en los procesos penales en que se impute la comisión de una infracción o la violación de la legislación ambiental y de la Ley sobre la Zona Marítimo-Terrestre. Para ello, podrá ejercitar la acción penal, de oficio, sin estar subordinada a las actuaciones y las decisiones del Ministerio Público; interponer los mismos recursos que el Código de Procedimientos Penales concede a aquel y ejercer la acción civil resarcitoria...". De ahí que, contrario a lo que se opina, no es correcto afirmar que el ente estatal carece de legitimación para actuar en este tipo de asunto como querellante y actor civil. Así las cosas, los reparos se declaran sin lugar.
VI.En otro orden, esta Cámara ha constatado que, como parte de los registros digitales de este expediente, no existe grabación en video, solo en audio, de la sentencia que se impugna, sin que conste motivo alguno para ello. Al respecto, se sugiere al tribunal sentenciador que haga uso de los medios tecnológicos a su alcance para la elaboración el respaldo audiovisual de las audiencias, para garantizar un mejor acceso a las partes y a las autoridades superiores encargadas de su revisión. Todo, acorde con las políticas institucionales para la oralidad implementadas para esta materia, en "Procedimiento para la Grabación de las Audiencias Orales y Actos de Investigación, PRE-CO-01-2013", emitida por la Comisión de Oralidad del Poder Judicial y aprobado el 24 de octubre del 2013, en la Sesión No. CED4, del Consejo Superior del Poder Judicial, Artículo XLVIII.
Por tanto:
Se declaran sin lugar los recursos de apelación interpuestos, en todos sus extremos. Tome nota el tribunal sentenciador, en cuanto a lo que se sugiere en cuanto al tema de grabación de audiencias. Notifíquese.
