Goicoechea, at thirteen hours and fifty minutes, on doce de octubre de dos mil dieciséis.- APPEAL (recurso de apelación) filed in the present proceedings brought against Nombre01, of legal age, Costa Rican, identity card number CED01, born in San José on 28 de julio de 1978, son of Nombre01 and Nombre02, resident of Quepos; Nombre03, of legal age, Costa Rican, identity card number CED02, born on 14 de diciembre de 1965, son of Nombre04 and Nombre05, resident of Pococí; and Nombre06, of legal age, Costa Rican, identity card number CED03, born in San José on 22 de enero de 1975, son of Nombre07 and Nombre08, resident of Acosta; for the offense of FRAUD AND ANOTHER OFFENSE, to the detriment of [Nombre09 001] AND OTHERS. Judge Roy Antonio Badilla Rojas, Judge Elízabeth Montero Mena, and Judge Giovanni Mena Artavia participated in deciding the appeal.

Attorney Yorhanny Campos Piedra appeared before this court as privately retained defense counsel (defensor particular) for defendant (imputado) Nombre03; attorney Víctor Rafael Herrera Flores as privately retained defense counsel for accused person (encartado) Nombre06; attorney Abraham Chaves Acuña as counsel for the Oficina de Defensa Civil de la Víctima; and attorney Jorge Matamoros Guevara as privately retained defense counsel for prosecuted person (encausado) Nombre01. Attorney Mariela Brenes Carballo, representing the Fiscalía Adjunta de Pococí y Guácimo del Ministerio Público, and attorney Abraham Chaves Acuña, as counsel for the Oficina de Defensa Civil de la Víctima, filed responses.

BACKGROUND (RESULTANDO):

I.By judgment number 156-201 6, issued at fifteen hours on doce de abril de dos mil dieciséis, the Tribunal Penal del Segundo Circuito Judicial de la Zona Atlántica, Guápiles, ruled: “THEREFORE (POR TANTO): In accordance with the rules of reasoned sound judgment (sana crítica racional), Articles 8 of the American Convention on Human Rights, 28, 39 and 41 of the Political Constitution, 1, 18, 30, 31, 45 and 47, 71, 73 and 103, 216 and 218 of the Criminal Code, the rules currently in force regarding civil liability under the 1941 Criminal Code; Articles 6 and 16 of the Notarial Code, and 1, 6, 9, 142, 265 to 270, 360, 361, 363 to 365, 366, 367, 368, 491 and 492 of the Code of Criminal Procedure, in deciding this matter unanimously, it is hereby resolved: TO ACQUIT Nombre06, Nombre01 AND Nombre03 of all punishment and liability for the acts relating to [Nombre09 001]; TO ACQUIT Nombre03 of criminal liability for the charged offenses; TO FIND Nombre06, as principal (autor), and Nombre01, as accomplice (cómplice), responsible for EIGHT completed offenses of fraud in material concurrence of offenses (concurso material), to the detriment of [Nombre09 003], [Nombre 004], [Nombre 005], [Nombre 006] and [Nombre 007], [Nombre 019] and [Nombre09 028], [Nombre 010] and [Nombre 011], [Nombre 012] and [Nombre 013], [Nombre 014] and [Nombre 015]; TO FIND Nombre06, as principal, responsible for one offense of simulated transaction fraud (Fraude de Simulación), to the detriment of [Nombre 019] and [Nombre09 028], and therefore to impose the following sentences upon them: Nombre06, four years of imprisonment for each offense of fraud and seven years of imprisonment for the offense of simulated transaction fraud, for a total of thirty-nine years of imprisonment, which, under the sentencing rules governing material concurrence of offenses, is adjusted to TWENTY-ONE YEARS OF IMPRISONMENT as the sentence he must ultimately serve; Nombre01 is sentenced to one year of imprisonment for each offense of fraud, for a total of eight years of imprisonment, which, under the sentencing rules governing material concurrence of offenses, is adjusted to THREE YEARS OF IMPRISONMENT as the sentence he must ultimately serve; the convicted persons shall serve the sentences imposed at the place and under the conditions established by prison regulations, with credit for any pretrial detention (prisión preventiva) they may have served, and, given the length of the sentence imposed, no judicial benefit is granted to defendant Nombre06; convicted person Nombre01 is granted the benefit of a suspended sentence (ejecución condicional de la pena) for a period of five years, during which he may not commit a new intentional offense for which a prison sentence exceeding six months is imposed; should he do so, he must serve the sentence suspended by this judgment.

THE CIVIL ACTION FOR DAMAGES (Acción Civil Resarcitoria) brought through the Oficina de la Defensa Civil de la Víctima on behalf of [Nombre09 003], [Nombre 004], [Nombre 005 006], [Nombre 019], [Nombre 010], and [Nombre 012], and against Nombre03, Nombre06, and Nombre01, IS GRANTED IN ALL RESPECTS; they are therefore ordered to pay jointly and severally (en forma solidaria) to the civil plaintiffs (actores civiles) the pecuniary damages (daños materiales) and non-pecuniary damages (daños morales) that their conduct has been determined to have caused the injured parties, as well as both categories of costs of the civil action for damages in favor of the Oficina de la Defensa Civil de la Víctima del Ministerio Público; as to pecuniary damages, liability is awarded without fixing an amount (se condena en abstracto), because the Court lacks sufficient evidence to determine their amount; as to non-pecuniary damages, the amount payable to each injured party who has joined the proceedings as a civil plaintiff is set at TEN MILLION COLONES; and as to costs, because the amount of compensation for pecuniary damages cannot be fixed at this time, they likewise are awarded without fixing an amount; with respect to the amounts awarded for non-pecuniary damages, the civilly liable parties shall have fifteen days from the date the judgment becomes final (firmeza de la sentencia) to pay the injured parties the amounts fixed, and if they fail to do so within that period, the interested parties must pursue the matter in the civil courts, which they must also do for the determination and payment of the amounts corresponding to pecuniary damages and costs.

The interested parties must apply to the civil courts to resolve the protection of the property rights relating to the properties that are the subject of these proceedings, in light of what has been decided herein; for that purpose, the annotations entered in the land-registry records (asientos registrales) shall remain in place for up to ten years while the corresponding matters are resolved in those proceedings, in view of the existence of third parties with legitimate or legally protectable interests. The pretrial detention of convicted person Nombre06 IS EXTENDED for a period of SIX MONTHS from this date through DOCE DE OCTUBRE DEL AÑO DOS MIL DIECISÉIS. The criminal matter is decided without a specific award of costs. It is ordered that certified copies of the necessary portions of the record (testimoniar las piezas necesarias) be prepared and brought to the attention of the Dirección General de Notariado and the Ministerio Público so that the conduct of defendant Nombre03 in relation to these events, in his capacity as Notary Public, may be investigated, as may the amount stated as the sale value of the properties and the actual amount of the purchase-and-sale transactions.

Once this judgment becomes final, the corresponding notice shall be given to the Juez de Ejecución de la Pena, the Instituto Nacional de Criminología, and the Registro Judicial. Notice shall be given by reading.- THE THEREFORE SECTION IS SUPPLEMENTED (SE ADICIONA POR TANTO): The operative portion (parte dispositiva) of the foregoing judgment is supplemented to add that certified copies of portions of the record shall be transmitted to the Ministerio Público so that it may investigate whether [Nombre09 026] had any criminal involvement in the events under investigation in connection with the mortgages granted in his favor.” (sic.,).

II.Attorney Yorhanny Campos Piedra, as privately retained defense counsel for defendant Nombre03; attorney Víctor Rafael Herrera Flores, as privately retained defense counsel for accused person Nombre06; attorney Abraham Chaves Acuña, as counsel for the Oficina de Defensa Civil de la Víctima; and attorney Jorge Matamoros Guevara, as privately retained defense counsel for prosecuted person Nombre01, filed appeals against the foregoing ruling.

III.Following the corresponding deliberation in accordance with Article 465 of the Code of Criminal Procedure, the Court considered the issues raised in the appeal.

IV. The applicable legal requirements have been observed in the proceedings

Appellate Criminal Judgment Judge Badilla Rojas authors the opinion; and, CONSIDERING (CONSIDERANDO):

l.- Attorney Yorhan n y Campos Piedra, privately retained defense counsel (defensor particular) for the defendant (encartado) Nombre03, filed a formal appeal (recurso de apelación) against judgment number 156-2014(sic.), issued by the Tribunal Penal del Segundo Circuito Judicial de la Zona Atlántica, Pococí seat, at 16:00 hours on 19 de abril de 2016, in which the accused was acquitted of criminal liability and his client, Nombre03, was found jointly and severally liable under civil law (responsable civil solidario), together with co-defendants (co encartados) Nombre06 and Nombre01, for the damages suffered by the injured parties and for both sets of costs in favor of the Oficina de la Defensa Civil de la Víctima. First ground: Disagreement with the legal reasoning (fundamentación jurídica) relied upon by the court in the aforementioned judgment to find defendant Nombre03 civilly liable.

He emphasizes that although defendant Nombre03 was not found criminally liable for the acts under investigation, either as a principal or, much less, as an accomplice, he was nevertheless held civilly liable for damages, losses, and costs due to an alleged breach of proper notarial practice in his duties as a Notary Public, clearly violating the principles of the natural judge (Juez Natural) and legality (legalidad), because violations within this jurisdiction are adjudicated by the Juzgado Notarial, the Tribunal Notarial, and the Sala Primera, as applicable, according to repeatedly established jurisdictional criteria. He emphasizes that if the Tribunal de Guápiles believed that disciplinary liability (responsabilidad disciplinaria) had been incurred in the notarial sphere, it should have ordered that the corresponding certified record (testimonio de piezas) be forwarded to the Juzgado Notarial so that the defendant would have had the opportunity to exercise his right of defense and present exculpatory evidence (prueba de descargo), and be tried by a body composed of specialists in notarial matters.

It is evident that the natural-judge principle was violated through intrusion into the jurisdiction of another body and that the legality principle was also breached, thereby preventing due process (debido proceso) in this case. He considers that the penalty lacks adequate reasoning (falta de fundamentación de la pena), because his client was held civilly liable for conduct that does not constitute an offense (hecho atípico), based on Article 311, subsection b, and that it was unjustified to impose liability for damages, losses, and costs, which should have been determined in the notarial jurisdiction. Second Ground. Lack of legal reasoning. Due process and the right of defense are violated. He contends that the civil judgment (condenatoria civil) entered against defendant Nombre03 in the judgment is wholly inconsistent with the principle of congruence between the charge and the judgment (correlación entre acusación y sentencia).

He asserts that an analysis of the charge brought by the Ministerio Público and the facts alleged by the Defensa Civil de la Víctima against Nombre03 readily shows that they are entirely different from the facts found proven by the court, insofar as both the charge and the civil action (acción civil) are based on a causal nexus (nexo de causalidad) arising from his joint conduct with the other accused persons. Nevertheless, although the Court held that this accused person’s conduct did not constitute an offense, it ordered him, jointly and severally, to pay damages, losses, and costs to the injured parties due to an alleged breach of his notarial duty. He requests that this ground be sustained and that the challenged judgment be vacated. Third Ground. Lack of legal reasoning. Due process and the right of defense are violated. The appellant disagrees with the court’s reasoning in finding that the conduct charged against his client did not constitute an offense while nevertheless holding him civilly liable on the ground that liability existed from the standpoint of Notarial Law.

He requests that the judgment be vacated for lack of adequate reasoning, because an acquittal based on doubt was entered when it should have been an acquittal based on certainty, given the finding that the charged conduct did not constitute an offense. (See appeal at folios 1491 to 1506.) The three grounds are decided jointly because the issues addressed are interrelated. The objection has merit. After reviewing the challenged decision in its entirety, it can be determined that there is a serious issue of congruence between what was alleged in the civil damages action (acción civil resarcitoria) and the relief awarded when that claim was examined. It should be noted that the statement of facts in the civil damages action alleged the following: “FACTS OF THE CIVIL DAMAGES ACTION: First: The accused persons and civil defendants (demandado civiles) Nombre01, Nombre06, and Nombre03, acting by common agreement and with full control over the act, devised a plan to obtain an unlawful financial benefit by depriving persons of modest means of their properties.

To accomplish this, they would deceive them by falsely leading them to believe that they would purchase their properties for exorbitant sums of money. Accordingly, the injured parties and civil plaintiffs (actores civiles), faced with those offers, would agree to sell and, having been induced into error, would sign documents they were led to believe were options to sell, when in fact they would be formal transfers of the properties. In exchange, they would be given bills of exchange (letras de cambio) to keep them under that misapprehension, falsely leading them to believe that payment for the sale of their properties would be made on the dates specified therein. Subsequently, once the injured parties and civil plaintiffs had signed the transfers, the accused and civil defendant Nombre06 would mortgage those properties in favor of third parties. Second: At the end of octubre del año dos mil trece, on an unspecified date, defendant and civil defendant Nombre01 went to the business known as Bar El Sarpe, owned by the injured party and civil plaintiff [Nombre09 003], located in Cuajiniquil de la Cruz, Guanacaste.

For the purpose of carrying out the criminal plan devised together with the accused persons and civil defendants Nombre06 and Nombre03 and obtaining an unlawful financial benefit, he told him that defendant and civil defendant Nombre06 was interested in purchasing his property, located two kilometers south of the center of Cuajiniquil in Cuajiniquil de la Cruz de Guanacaste, for the sum of one hundred ninety-one million nine hundred ninety-nine thousand four hundred ten colones (¢ 191.999.410,00). Accused Nombre01 told him that he first had to sign the transfer of his property so that accused Nombre06 could obtain the money and pay him. Accordingly, on once de noviembre de dos mil trece, defendant Nombre01 took the injured party [Nombre09 025] to the office of the attorney, notary, accused person, and civil defendant Nombre03, located fifty meters south of Palí in Guápiles. There, having been induced into error and believing that he would be paid for his property and was signing an option to sell, the injured party actually signed public deed (escritura pública) number 292, appearing at folio 147 verso of volume 21 of attorney Nombre03’s notarial protocol (protocolo), corresponding to the transfer of his property, which is recorded in the Registro de la Propiedad, Guanacaste section, real-property folio registration, for the sum of two million five hundred thousand colones (¢ 2.500.000,00)Y.

At that time, accused Nombre06 signed two bills of exchange in his favor, one in the amount of fifty million colones (¢ 50.000.000,00), due on veintiséis de diciembre de dos mil trece, and the other in the amount of one hundred forty-one million nine hundred ninety-nine thousand four hundred ten colones (¢ 141.999.410,00), due on once de junio de dos mil catorce. Through these instruments, he would keep the injured party under that misapprehension by leading him to believe that he would indeed be paid, which did not occur, since no payment has been made to him to date. Third: To complete the process of obtaining an unlawful financial benefit for himself, defendant Nombre06, on trece de noviembre de dos mil trece, before notary Yiell Flores Madrigal in the city of San José, pursuant to deed 309 appearing at folio 179 verso of volume 4 of her notarial protocol, proceeded to mortgage the property of the injured party [Nombre09 003] in favor of [Nombre 031] for the sum of thirty-two million five hundred thousand colones (¢ 32.500.000,00).

Fourth: On diez de diciembre de dos mil trece, accused and civil defendant Nombre01 went to the residence of the injured party and civil plaintiff [Nombre09 004], located in Cuajiniquil de la Cruz, Guanacaste. For the purpose of putting into operation the criminal plan devised together with accused persons Nombre06 and Nombre03 and obtaining an unlawful financial benefit, he told him that he was a real-estate broker and that defendant Nombre06 was interested in purchasing his two properties located in Cuajiniquil de la Cruz, Guanacaste, Asentamiento Nombre10, for the sum of two hundred forty-four million nine hundred ninety-four thousand nine hundred ninety-nine colones (¢ 244.994.999,00). Motivated by that sum of money, the injured party agreed. Thus, on treinta de noviembre de dos mil trece, accused Nombre01 took the injured party [Nombre09 004] to the office of the attorney, notary, accused person, and civil defendant Nombre03, located fifty meters south of Palí in Guápiles.

There, the defendants induced the injured party into error by leading him to believe that what he would sign was a promissory note (pagaré), that this would give them authority to check the property in the Registro Público to determine whether it had any recorded encumbrances, and that in this manner they also undertook to pay him the sum of fifty million colones (¢ 50.000.000,00)Y on quince de enero de dos mil catorce and the sum of one hundred ninety-four million nine hundred ninety-four thousand nine hundred ninety-nine colones (¢ 194.944.999,00) on treinta de junio de dos mil catorce. Having been induced into error, the injured party signed the promissory note at that time, when in fact what he signed was the transfer of his properties recorded in the Registro de la Propiedad, Guanacaste section, real-property folio registration, through public deed number 316, appearing at folio 159 recto of volume 21 of defendant Nombre03’s notarial protocol.

Fifth: To complete the process of obtaining an unlawful financial benefit for himself, defendant Nombre06, on once de enero de dos mil catorce, before notary Yiell Flores Madrigal in the city of San José, pursuant to deed 2 appearing at folio 02 verso of volume five of her notarial protocol, proceeded to mortgage the property of the injured party [Nombre09 004], recorded in the Registro de la Propiedad, Guanacaste section, real-property folio registration 94727-000, in favor of [Nombre 031] for the sum of ten million four hundred thousand colones (¢ 10.400.000,00).

Sixth: On once de de diciembre de dos mil trece, the accused (encartado) and civil defendant (demandado civil), Nombre01, appeared at the home of the victim (ofendida) and civil plaintiff (actora civil), [Nombre09 005], located in Cuajiniquil de la Cruz, Guanacaste. In order to set in motion the criminal plan devised together with the defendants (imputados) and civil defendants Nombre06 and Nombre03 and to obtain an improper financial benefit, he told her that he worked for Nombre06, who was interested in purchasing her property located in Agua Caliente de Santa Elena de la Cruz, Guanacaste, for the sum of ciento sesenta y nueve millones de colones (¢ 169.000.000,00). The victim accepted the proposal, and that same day he took her to the office of the attorney and notary public, defendant and civil defendant Nombre03, located in Guápiles, cincuenta metros sur de Palí. There, the accused misled the victim into believing that she would be signing an option to purchase (opción de venta) and that, through two bills of exchange (letras de cambio), defendant Nombre06 was undertaking to pay her the sum of cincuenta millones de colones (¢ 50.000.000,00) on veintiséis de enero de dos mil catorce and the sum of ciento diecinueve millones de colones (¢ 119.000.000,00) in julio de dos mil catorce.

The victim, having been misled, then signed the purported option to purchase, whereas what she actually signed was the conveyance (traspaso) of her property recorded in the Property Registry (Registro de la Propiedad), Guanacaste division, real-property folio registration, for the price of dos millones quinientos mil colones (¢ 2.500.000,00), by means of public deed (escritura pública) número 330, appearing on folio 165 front of volume 21 of the notarial protocol of attorney Nombre03. Seventh: To complete the acquisition of an improper financial benefit for himself, on veinte de diciembre de dos mil trece, accused Nombre06 appeared before notary Yiell Flores Madrigal in the city of San José and, pursuant to deed 324, appearing on folio 198 reverse of volume 4 of her notarial protocol, proceeded to mortgage the property of victim Nombre11, recorded in the Property Registry, Guanacaste division, real-property folio registration, in favor of Nombre12 for the sum of seis millones de colones (¢ 6.000.000,00).

Eighth: On an unspecified date, but during noviembre de dos mil trece in the morning, an individual known as “Chuchequero” appeared at the home of the victim and civil plaintiff [Nombre09 006] in Cuajiniquil de la Cruz, Guanacaste, and told him that some people were interested in purchasing properties and gave him the telephone number of defendant and civil defendant Nombre01. The aggrieved party (agraviado) therefore called him, and the defendant, in order to set in motion the criminal plan devised together with defendants and civil defendants Nombre06 and Nombre03 and to obtain an improper financial benefit, told the victim that accused Nombre06 was the person interested in purchasing properties, that he purchased them in two installments, and that if the victim wished to sell them, he had to travel to Guápiles to sign the option to purchase. The victim agreed, and on veintinueve de noviembre de dos mil trece, accused Nombre01 appeared at the victim’s home and took him, together with his wife [Nombre09 007] and his brother [Nombre09 017], to Guápiles.

The following day, that is, treinta de noviembre de dos mil trece, they went to the office of the attorney and notary public, defendant and civil defendant Nombre03, located in Guápiles, cincuenta metros sur de Palí. There, defendant Nombre06 told him that he would purchase the property and pay for it in two installments: one on quince de enero de dos mil catorce, when he would deliver the sum of cincuenta millones de colones (¢ 50.000.000,00), and the second payment, to finalize the sale, on veintinueve de junio de dos mil catorce, in the amount of ciento veinticuatro millones ciento cincuenta y nueve mil seiscientos diez colones (¢ 124.159.610,00), for a total amount of ciento setenta y cuatro millones ciento cincuenta y nueve mil seiscientos diez colones (¢ 174.159.610,00). At that time, the sale of his property, recorded in the Property Registry, Guanacaste division, real-property folio registration, and interest 002, would be formalized.

The victim and his wife [Nombre09 007] agreed and signed in the belief that they were signing an option to purchase, whereas what they actually signed was public deed número 315, appearing on folio 157 reverse of volume 21 of the notarial protocol of attorney Nombre03, by which they conveyed the property to accused Nombre06. At that time, in order to keep victim [Nombre09 006] under the mistaken belief that he would be paid on the dates already indicated, accused Nombre06 delivered the two bills of exchange to him. Ninth: To complete the acquisition of an improper financial benefit for himself, on once de diciembre del dos mil trece, accused Nombre06 appeared before notary Yiell Flores Madrigal in the city of San José and, pursuant to deed 322, appearing on folio 196 reverse of volume 4 of her notarial protocol, proceeded to grant a first-priority mortgage (hipoteca en primer grado) on the property of victim [Nombre09 006], recorded in the Property Registry, Guanacaste division, real-property folio registration, in favor of Nombre13 for the sum of trece millones de colones (¢ 13.000.000,00).

Tenth: On an unspecified date, but at the beginning of noviembre del dos mil trece in the afternoon, an individual known as “Chuchequero” appeared at the home of the victim and civil plaintiff [Nombre09 012] and told him that defendant and civil defendant Nombre01 was interested in purchasing properties and gave him his telephone number. The following day, the victim called him, and accused Nombre01, in order to set in motion the criminal plan devised together with defendants and civil defendants Nombre06 and Nombre03 and to obtain an improper financial benefit for himself, told him that they did indeed wish to purchase land in that area. The aggrieved party told him that he would sell only catorce hectáreas of his property, recorded in the Property Registry, Guanacaste division, real-property folio registration, for the sum of ciento doce millones de colones (¢ 112.000.000,00). Accused Nombre01 agreed, and on once de noviembre de dos mil trece, they met in Cuajiniquil Centro, whereupon accused Nombre01 took him to Guápiles, to the office of the attorney and notary public, defendant and civil defendant Nombre03, located in Guápiles, cincuenta metros sur de Palí.

In accordance with the previously established plan to deceive the victim and dispossess him of his property, Nombre03 told him that he was going to sign an option to purchase for the property, without reading the document to him; the victim did not read it because he does not know how to read. At that time, to keep the victim in error and make him believe that he would indeed be paid, defendant Nombre06 gave him two bills of exchange: one stating that the first payment for the sale of the property would be made on veintiséis de diciembre de dos mil trece in the amount of cincuenta millones de colones (¢ 50.000.000,00), and the second stating that payment would be made on once de junio de dos mil catorce in the amount of sesenta millones sesenta y siete mil ochocientos cuarenta y siete colones (¢ 60.Telf01). Immediately thereafter, accused Nombre03 told the victim that the sale of the property would be formalized once the entire amount had been paid, whereas what the victim actually signed was the conveyance of his entire property, and to date defendant Nombre06 has not paid him.

Eleventh: To complete the acquisition of an improper financial benefit for himself, on trece de noviembre de dos mil trece, accused Nombre06 mortgaged the property of victim Nombre14 for treinta y dos millones quinientos mil colones in favor of [Nombre 026]. Twelfth: On veinte de diciembre de dos mil trece, accused and civil defendant Nombre01 appeared at the home of the victim and civil plaintiff [Nombre09 019], located at Dirección01 in Cuajiniquil de la Cruz, Guanacaste. In order to set in motion the criminal plan devised together with defendants and civil defendants Nombre06 and Nombre03 and to obtain an improper financial benefit, he told her that accused Nombre06 was interested in purchasing her property located in Cuajiniquil, distrito Santa Elena, asentamiento Juan Santamaría. The property has an area of doscientos treinta y seis metros cuadrados and is recorded in the Public Registry (Registro Público), Guanacaste division, real-property folio registration [Valor 001].

They agreed on a price of veinte de ciento noventa y dos millones ciento treinta y dos mil seiscientos cincuenta colones ¢ 192.132.650,00). Subsequently, on veintiuno de diciembre de dos mil trece, accused Nombre01 took victim [Nombre09 019] and her husband [Nombre09 028] to the office of the attorney and notary public, defendant and civil defendant Nombre03, located in Guápiles, cincuenta metros sur de Palí. There, the accused misled the victim into believing that they would pay her for her property and that she would be signing an option to purchase, whereas what she and her husband [Nombre09 028] actually signed was its conveyance, pursuant to deed 339, appearing on folio 168 reverse of volume 21 of the notarial protocol of attorney Nombre03. The property is recorded under real-property folio registration 5-[Valor 001]. That same day in the afternoon, specifically at Mall Cariari in Pedregal de Heredia, accused Nombre06 signed two bills of exchange: one in the amount of cincuenta millones de colones (¢ 50.000.000,00), due on tres de febrero de dos mil catorce, and the other in the amount of ciento ochenta y seis millones ciento treinta y dos mil seiscientos cincuenta colones (¢ 186.132.650,00), due in junio de dos mil catorce.

Through these instruments, he would keep the victim under the mistaken belief that he would indeed pay her, which did not occur, as he has not paid her to date. Thirteenth: To complete the acquisition of an improper financial benefit for himself, on veinte de febrero de dos mil catorce, accused Nombre06 conveyed the property of victim [Nombre09 019] to Nombre15. On dos de julio de dos mil catorce, Nombre15 mortgaged the victim’s property for doce mil dólares ($ 12.000,00) in favor of Nombre16.

Fourteenth: Without specifying the date, but at the beginning of November two thousand thirteen, an individual known as “Chuchequero” appeared at the home of the injured party and civil plaintiff (actor civil) [Nombre09 010] and told him that the accused and civil defendant (imputado y demandado civil) Nombre01 was interested in purchasing his parcel and immediately called him by telephone, telling the aggrieved party that he would consult with his partner regarding the sale price, which was one hundred eighty-one million colones (¢ 181.000.000,00). Approximately two days later, the accused Nombre17 a Nombre08, for the purpose of continuing the criminal plan devised together with the accused and civil defendants Nombre06 and Nombre03 to dispossess people of their properties without paying them anything, called the injured party and told him that the accused Nombre06 had accepted the price and would pay it in two installments.

Accordingly, on the twenty-first day of November two thousand thirteen, they met in San José, where the accused Nombre01 took the injured party to the office of the attorney and notary and accused and civil defendant Nombre03, located in Guápiles, fifty meters south of Palí. The accused Nombre06 subsequently appeared there, and all of them, acting by mutual agreement and for the purpose of obtaining an undue financial benefit and dispossessing the injured party of his property without paying him its value, induced him and his wife, deceived into believing that they would in fact be paid and that they were signing an option to purchase, to sign the conveyance (traspaso) of their property pursuant to instrument 305, appearing on the reverse of folio 153 of volume 21 of attorney Nombre03’s notarial record (protocolo), and recorded in the Property Registry under Guanacaste district, real-property folio registration.

To keep them in error, the accused Nombre06 gave him two bills of exchange (letras de cambio), one payable on the fifth day of January two thousand fourteen in the amount of fifty million colones (¢ 50.000.000,00), and another payable on the fifth day of August two thousand fourteen in the amount of one hundred thirty-one million six hundred fourteen thousand colones (¢ 131.614.000,00), which the accused has not paid to date. Fifteenth: To complete the procurement of an undue financial benefit for himself, on the twenty-ninth day of November two thousand thirteen in San José, before notary Yiell Flores Madrigal, pursuant to instrument 316 appearing on the front of folio 193 of volume four of her notarial record, the accused Nombre06 mortgaged the property of the injured party [Nombre 010] for ten million colones (¢ 10.000.000,00) in favor of [Nombre 026]. Sixteenth: The injured parties and civil plaintiffs [mbre09 0 003], [Nombre 012], [Nombre 004], [Nombre 006],[mbre09 0 005], [Nombre 010] and [mbre09 0 019] suffer not only financial harm but also emotional harm, as their capacities to feel and perceive have been affected as a result of the events described, causing feelings of fear, anguish, anger, and helplessness in the face of the actions of those brought to justice, resulting in evident non-pecuniary harm (daño moral), compounded by having to resort to proceedings such as these, which are tedious and lengthy, in an effort to enforce their personal rights.” (See civil-action case file (legajo de acción civil) and judgment at folios 1421 reverse through 1425 reverse).

At all times, the connection of the accused Nombre03 to the civil claim (reclamo civil) was based on his joint participation in the criminal plan devised by the three accused, with a complete allocation of roles. Nevertheless, after the adversarial proceedings had taken place and it had been established that Nombre03’s actions did not constitute a criminal offense, he was held liable on the civil claim for performing his notarial duties carelessly, with the following being stated regarding this accused: “as for the notary Nombre03, although he does not meet the requirements of a principal offender or an accomplice, because he failed to discharge his duties as a notary, neglecting or failing to safeguard the rights of the injured parties as parties to the purchase and sale agreements he authenticated—duties inherent in his office as a notary, under which he was required to ensure the legitimacy of the acts he authenticated—thereby allowing the deception and, subsequently, mbre03’s undue financial benefit to be realized, and perhaps later causing the injured parties to lose their properties, together with all the other pecuniary and non-pecuniary harm indicated; therefore, because all three contributed to causing the harm that the injured parties have suffered and will suffer, the appropriate disposition is for all three to contribute jointly and severally to compensating the civil plaintiffs for the aforementioned harm.” (See folio 1478).

Thus, the civil plaintiff presented a factual theory alleging intentional conduct (hecho doloso) in the criminal sphere, which was not proven in connection with the criminal action (acción penal); Nombre03 was acquitted, yet was held civilly liable for negligent conduct (acción culposa) (acting carelessly). This grossly conflicts with the principle of congruence (principio de congruencia) and the right of defense (derecho de defensa), insofar as the defense strategy was constructed on the basis of the allegation of criminally intentional conduct, but despite being acquitted of that conduct, he was held liable for negligent conduct that was not mentioned in the facts pleaded. This Chamber does wish to make clear that when an acquittal is entered on the criminal action, this does not necessarily mean that the civil action for damages (acción civil resarcitoria) must automatically be dismissed; rather, a person who has been acquitted may be held civilly liable in cases of non-contractual civil liability (responsabilidad civil extracontractual), such as those provided for in article 1045 of the Código Civil, as well as in cases of strict civil liability (responsabilidad civil objetiva), subject to its exceptions (article 1048 subsection 5 of Código Civil).

However, that theory was not pleaded in this manner in the statement of facts set forth supra, nor does the judgment explain that the causal nexus (nexo causal) connecting Nombre03’s conduct arose from a hazardous activity, or that notarial practice is considered likely to create a potential risk to members of the public who seek the services of a licensed professional. This Chamber therefore finds that the appeal must be granted and that it is improper to hold a civil defendant liable for an activity of which he was not accused and whose connection to the harm allegedly suffered by the civil plaintiffs was not explained. Consequently, the appropriate disposition is to grant the appeal, vacate the challenged judgment insofar as it holds Nombre03 civilly liable, and, in its place, by majority vote, dismiss the civil action for damages brought against Nombre03.

II.Dissenting opinion of Judge Montero Mena. Although I deeply respect the opinion of my fellow Judges, I must depart from it for the following reasons: I consider that the Civil Action brought against the defendant Nombre03 was properly adjudicated by the court below, and that such liability is also established through a correct interpretation of the civil law governing this type of proceeding, because, even though a judgment of acquittal was rendered, civil liability did in fact remain. It is relevant to note that civil fraud (dolo civil) has been defined in the case law as: “Any assertion of what is false or concealment of what is true, and any artifice, cunning, or scheme employed by one of the parties to procure the execution of a legal act. Fraud may be determinative or incidental: the former consists of schemes that ultimately lead a person to execute the act. Incidental fraud is fraud that is not determinative of the act and therefore does not invalidate it.

Nevertheless, the party who committed it must compensate the other party for any harm resulting therefrom. Fraud may be affirmative or negative, depending on whether the defect of consent results from a fraudulent act or omission, respectively. Fraud must meet the following requirements to constitute a defect of consent: it must be serious; determinative of the other party’s execution of the act; it must have caused substantial harm; and it must not involve mutual fraud. When these requirements are met, fraud will result in the nullity of the act (the act will be voidable on grounds of relative nullity (nulidad relativa)). Likewise, pursuant to the general rules of liability, anyone who has engaged in fraudulent conduct must compensate the injured party for the damages and losses arising from such conduct.” Voto N° 032-2015. In this case, I consider that civil fraud was proven because, as a result of the actions undertaken by the defendant, the victims ultimately disposed of their assets, and his participation was decisive in vitiating the consent of the appearing parties when they executed acts that ultimately conferred an economic benefit on the accused.

Similarly, the Contentious-Administrative Court, Fourth Section, at eight o’clock on diez de abril de dos mil quince, stated: “[…]. Indeed, in matters of contract, fraud means any artificial device used to deceive and induce a person to consent to a contract. For fraud to constitute grounds for nullity, it must originate with the contracting party opposing the party who was the victim of the deception. Its essence lies in deception, false promises, or the exaggeration of expectations or benefits, thereby producing defective consent. We therefore see that the artificial means used by one person to deceive another may consist of either an act or an omission, that is, affirmative or negative fraud. Affirmative fraud would consist of an artifice or maneuver exceeding the bounds of the cunning customarily employed by all contracting parties, while negative fraud, according to Nombre18, consists of concealing a defect or anomaly.” Although, as occurred in this case, a judgment of acquittal was ordered, this does not relieve the judges of their duty to analyze the facts under the governing principles of non-contractual civil liability (responsabilidad civil extracontractual) and the existence of compensable harm (daño resarcible), because, with respect to the civil action for damages (acción civil resarcitoria), although it is ancillary to the criminal proceeding, it must be governed by the general provisions of the Civil Code.

In this case, the civil judgment was based on the same event under investigation, understood as a civil wrong (ilícito civil); therefore, the manner in which the Court ultimately ruled was correct, and for that reason that portion of the judgment should not be vacated. In this regard, the Criminal Cassation Chamber has held: “(...) civil liability is independent of the commission of an unlawful act: ‘Consistent with this reasoning, the case law has stated that: “... a judgment imposing civil liability may properly be entered even in the absence of a criminal wrong, provided that there is another source of law, distinct from the criminal-law framework, that permits such a judgment...,” (decision # 619, issued at 11:20 hours on 9 de junio de 2000. See, to the same effect, # 1130, issued at 9:18 hours on 23 de noviembre de 2001, both from this Third Chamber). In the present case, the required source of law is found in the non-contractual liability regime set forth in the Civil Code, beginning with Article 1045 thereof.

On this subject, the First Chamber of the Supreme Court of Justice has stated that: “... Non-contractual liability falls upon anyone who, outside any prior contractual relationship, has caused harm within the legal sphere of another person through fault or by initiating a hazardous activity or creating a social risk. This liability does not arise from the breach of a specific relationship, but from the violation of the general duty not to harm others. Its regime is based on Articles 1045, 1046, 1047, and 1048 of the Civil Code. The first of these provides: ‘Anyone who, through fraud, fault, negligence, or recklessness, causes harm to another is obligated to make reparation for that harm and the resulting losses.’—This principle is the foundation of all civil liability (...) Accordingly... for a liability claim such as the one at issue to be granted, the following must be conclusively established: a) the existence of harm or loss, which must be certain, real, and actual; b) the objective magnitude of the harm, meaning that the claim must warrant relief, because legal protection is unavailable if the harm is insignificant; c) that the person who caused the harm was a third party in relation to the affected person; and d) a causal relationship between the harm and the allegedly unlawful conduct that caused it...,” (Resolution # 320, issued at 14:20 hours on 9 de noviembre de 1990).

It must now be clarified (because this appears to be the point on which the lower-court Judges erred) that the defining characteristics of fault in civil matters are not identical to those governing its counterpart in the context of criminal liability, because the legal system in force does not treat every act of recklessness or negligence causing harm to a third party as criminal (consider, for example, the offense of “property damage,” which cannot be committed through negligence). The First Chamber’s own decision clarifies that: “... fault entails negligent, careless, or improvident conduct that unintentionally causes harm... Fault therefore consists of a failure to exercise the care, caution, and diligence required. Diligence has been understood as the reasonable and ordinary caution that must accompany all acts from which harm might arise, depending on the type of activity involved and on what can and should be expected of a normally reasonable and sensible person operating within the relevant technical field.

That is, whether the person acted with the care, attention, or perseverance required and with the reflection necessary to prevent harm to the legally protected property of others. Legal scholarship further indicates that the requisite diligence encompasses not only the precautions and safeguards mandated in each case by regulations, but also all prudence necessary to prevent harm,” (see voto Nº 53 issued at 15:10 hours on 27 de mayo de 1998. To the same effect, numbers 17 issued at 15:00 hours on 29 de enero de 1992 and 398 issued at 16:00 hours on 6 de junio del 2001). It is for this reason that, in various prior decisions, the Third Chamber has emphasized that the event giving rise to civil liability is the harm caused, not the criminal nature of the conduct.’ Resolución número 2006-00087, issued at 15:15 hours on 13 de febrero de 2006. Regarding the principle that the civil action is ancillary to the criminal action, it has been established that: ‘…The phrase “when appropriate,” contained in the third paragraph of Article 40 of the Code of Criminal Procedure, must necessarily be interpreted to mean that, notwithstanding the criminal acquittal, the court may rule on the civil action when other legal grounds, distinct from the offense, remain upon which that duty to compensate may be based.

In other words, when the proven facts are sufficient to demonstrate the existence of civil liability, without any requirement that the substantive rule giving rise to the obligation to compensate for the harm originate in Criminal Law, and without any requirement that the criminal or administrative liability of a particular public official be demonstrated. The foregoing interpretation is the only one that may be derived from the principles of Procedural Economy (Economía Procesal) and Restrictive Interpretation (Interpretación Restrictiva), in harmony with our constitutional legal framework, subject only to the requirement that the defendant be afforded an opportunity to defend against the claim….’ To this it must be added that such legal grounds may arise from contractual or non-contractual civil liability, as in this case. To hold otherwise would, as this Chamber also understood in the same precedent cited above, violate the constitutional principle of prompt and effective justice (justicia pronta y cumplida), creating the absurd result of requiring a party who has litigated the dispute in criminal court to resort once again to the judicial system to protect that party’s rights (...).” Accordingly, because this Judge considers that the lower-court judges relied on the existence of a causal link between the conduct of the civil defendant and the resulting outcome, civil liability was proven.

The fact that Nombre03 provided the injured parties with irregular notarial advice, thereby causing them to make dispositions of their assets on terms grossly unfavorable to their interests in purported sales of properties that were extremely valuable, and as a result of which they lost their real property in most cases, constitutes sufficient grounds to grant the civil action.

III.Attorney Víctor Herrera Flores, on behalf of the accused (encartado) Nombre06, filed an appeal (recurso de apelación) against judgment 156-2014(sic.), issued by the Criminal Court of the Second Judicial Circuit of the Atlantic Zone, Pococí seat, in which the accused Nombre06 was convicted of the offense of Fraud (Estafa). First Ground: Erroneous and insufficient assessment of the evidence. He emphasizes that the Court begins by justifying its judgment with arguments such as that the victims are persons of limited financial means and low educational attainment, and that they were persuaded to sell their farms; this is not true, since his client Nombre06 merely made an offer to Mr. [Nombre09 001], while the other victims offered to sell their farms on their own initiative, and no offer was made to them. It was also the victims who set the price of eight million per hectare in the area; the Court mentions an extraordinary offer, but no such offer ever existed.

It is stated that only the victims performed their obligations, whereas the accused Nombre06 did not, which is not true: the accused offered bills of exchange (letras de cambio) as security for payment, and when the first payment under the sale agreement was not made, the appropriate course was to enforce the security on account of the breach. Another erroneous argument highlighted by the Court in its judgment is that there was no money paid as a down payment, as is common in this type of transaction. The truth is that there are many transactions in which money is not necessarily paid at that stage, and the initial payment was to be made one month after the transfers were executed, that is, almost immediately. The Court stresses the lack of credibility of a bill of exchange as a credit instrument (instrumento de crédito); however, it is a valid and lawful instrument, and its use is therefore consistent with the law, regardless of whether the Court approves of it.

He considers the Court’s interpretation of the negotiations to be improper insofar as it requires the accused Nombre06 to have the necessary funds in his accounts when conducting the negotiations, a requirement he considers absurd, since if that had been the case there would have been no need to negotiate using credit. Furthermore, at no time did the accused have the fraudulent intent (dolo) to defraud the victims, because he was entirely willing to return each of the farms to its original owners. However, only Mr. [Nombre09 001] accepted the return, which was in fact completed; all the others wanted the money, not the farms. Nevertheless, the transaction could not be completed because the accused was placed in pretrial detention (prisión preventiva) at the time, although his intention was always to fulfill his obligations toward the victims. According to the appellant, the Trial Court made a serious error in its judgment by confusing a bill of exchange with a check drawn against insufficient funds, even though they are entirely different commercial instruments, and the appellant explains the differences between them.

He requests that, in view of the inconsistencies identified and the erroneous assessment of the evidence, the appeal be granted, the judgment be declared ineffective, and the case be remanded (reenvío) for proper further proceedings. (See appeal at pages 1507 to 1523.)

Attorney Jorge Matamoros Guevara, on behalf of the accused Nombre01, formally filed an appeal against judgment 156-2014(sic.), issued by the Criminal Court of the Second Judicial Circuit of the Atlantic Zone, Pococí seat, on the following grounds: First Ground: Inaccurate assessment of the evidence received. The appellant believes that the Court improperly assessed the evidence received during the adversarial phase (fase de contradictorio). He emphasizes that, instead of analyzing the testimonial evidence (prueba testimonial) received, the Court merely transcribed the facts alleged by the Public Prosecutor’s Office (Ministerio Público), and that the ruling lacks any analytical rigor. The evidence is not even compared to identify its contradictions; of particular relevance is that witness Nombre19 was the person who made the purchase offers, yet at trial he asserted a diametrically opposite account.

He stresses that the Court failed to assess and rule on that testimony and merely transcribed what the witness said without indicating whether it accepted or discredited it. This deficiency is present throughout the remaining testimonial evidence, but it is more evident in the case of witness Nombre19 because he is a key witness to the events who was originally called by the Public Prosecutor’s Office. With regard to the documentary evidence (prueba documental), although updated registry reports (estudios registrales) were available, the Court failed to detect that the properties of four of the victims, [Nombre09 021], [Nombre09 004], and [Nombre09 015], were never transferred; they suffered no loss, and the records merely showed expired notices (anotaciones caducas) that were no longer in force. In the case of [Nombre09 004], there is no notice whatsoever, a fact that would have been apparent from even a superficial analysis of the evidence.

Another error is evident in the analysis of the bills of exchange, where it is stated that they were issued without economic backing (contenido económico). This is logical, because no bill of exchange requires economic backing; rather, by its nature, it embodies a payment obligation to be performed as of a date stated in the document. The Court failed to consider that the bills remain enforceable through collection proceedings (vía de cobro) even today and may be recorded against the farms held in Nombre09 Nombre06’s name; it is therefore untrue that they lacked any validity. According to the appellant, the ruling also improperly interprets the participation of the accused Nombre17: in one part of the judgment he is described as Nombre06’s partner, while elsewhere he is described as an intermediary between Nombre06 and the victims, leaving the matter unclear. Even more conspicuous inaccuracies appear in the interpretation and application of the statutory definitions of offenses (tipos penales), particularly concerning fraud, because the victims suffered no pecuniary loss (perjuicio patrimonial) at any time, and, in the case of at least the four victims already identified, the properties never left their ownership.

He therefore requests that the challenged judgment be reversed and his client acquitted of all punishment and criminal liability or, in the alternative, that the case be remanded so that it may be properly adjudicated and the identified contradictions clarified. (See appeal at pages 1530 to 1544.)

These appeals, both that of Attorney Víctor Herrera Flores and that of Attorney Jorge Matarrita, are decided jointly because the issues are interconnected. The claims have merit. The Trial Court introduces several considerations into its analysis of the legal grounds and statutory definitions of offenses that this Chamber cannot endorse, particularly because people’s chosen manner of conducting negotiations must be respected, provided that it is permitted by the legal system, regardless of whether it is uncommon. At the beginning of its analysis, the Trial Court stated: “The facts found proven here constitute conduct falling within statutory offenses because they are described in criminal statutes as prohibited conduct, specifically Article 216 subsection 2) of the Criminal Code, denominated Fraud, which punishes anyone who, by causing another person to act under a mistake through simulation, distortion, or concealment of true facts, causes harm to the property of another in order to obtain an unlawful financial benefit for himself or a third party; as well as Fraudulent Simulation (Fraude de Simulación), established in Article 218, which punishes anyone who, to the detriment of another and in order to obtain any undue benefit, executes a simulated contract, act, proceeding, or court filing.

Those are precisely the acts that were proven here to have been committed by Nombre03 with the assistance of Nombre17 or Nombre17 and the multimillion sums within a very short period were induced to deliver, by means of a title-transferring contract (contrato traslativo de dominio), their farms to the accused Nombre03, who almost immediately proceeded to dispose of them by conveying them without paying the victims a cent; and, in the case of [Nombre09 019], by transferring the farm he had acquired from [Nombre09 019] to his partner Nombre15 without paying her a cent, after which Nombre15 mortgaged it to Nombre20, who acquired it at auction. Nombre15 never even visited the farm in question, much less took possession of it; she only appeared to sign the acceptance of the sale and subsequently the mortgage. The conduct also falls within these offenses because it meets the objective and subjective elements of both statutory definitions; let us examine them:

WITH RESPECT TO THE OFFENSE OF FRAUD: INDUCING A MISTAKE: All of the victims—simple farmers with little or no formal education, some unable even to read or write, poor, extremely poor, and mostly elderly—were persuaded to sell their farms, for which they would receive large sums of money approaching, and in some cases even exceeding, two hundred million colones. Given their socioeconomic circumstances, the offer appeared to them to be the opportunity of a lifetime, because it would enable them and their families to escape their lives of poverty and deprivation and possibly to die under more dignified conditions. Consider that, given their circumstances—particularly their poverty and the weather phenomena affecting the Guanacaste area, especially its highest region, including La Cruz, where their farms were located—they had managed to generate very little wealth from those farms. Consequently, when presented with such an offer, they decided to sell their lands, which the Instituto de Desarrollo Agrario, IDA, now INDER, had granted them years earlier precisely to help them build better lives.

For these very simple people, the amounts they were offered for their farms were an irresistible lure, and they all rushed to sell their farms. Nombre17 told them that someone would buy their farms, and even without knowing the buyer—who turned out to be the accused Nombre06, who did not even visit or inspect the farms, their condition, their boundaries, or their property lines—they agreed to sell to him, so favorable was the offer under their circumstances. On the very day they were told that their farms would be purchased, some of the victims left their residences in the Cuajiniquil de la Cruz area of Guanacaste and traveled to Guápiles, Pococí, in the Province of Limón, on the other side of the country, arriving as late as nighttime to sell their farms. THE OFFER WAS (sic.) THAT IRRESISTIBLE. It is true that some of the victims state that, when they signed at the office of the accused Nombre03, they believed they were signing a purchase option (opción de compra), but ultimately they all acknowledge that they agreed to sell their farms.

Selling and purchasing land is a lawful activity; the defense attorneys are correct in that respect. However, the victims were not paid a single cent when they sold their farms. Instead, they were given two bills of exchange, with the promise that the first, for fifty million colones—the same amount in every case—would be paid approximately one month after the transfer was completed, and that the second, for the remainder of the sale price—which in every case was stated to be only 2,5 million colones—would be paid six months later.

In their simplicity, the injured parties (ofendidos) believed the promise of payment to be genuine and agreed to sell properties to Nombre06 BY SIMULATING FALSE FACTS OR CONCEALING TRUE FACTS: The method of payment was precisely the means used to cause the injured parties to fall into error, since, in connection therewith, the defendant (imputado) and his assistant Nombre17, with the participation of the notary Nombre03, simulated false facts or concealed true facts; the circumstances, and specifically the evidence, establish BEYOND ANY DOUBT that Nombre06 NEVER HAD THE INTENTION OR WILLINGNESS TO PAY THE INJURED PARTIES ANY SUM OF MONEY FOR THEIR PROPERTIES. The facts so demonstrate. As defense counsel themselves maintain, the purchase agreement is perfected by the mere agreement as to the property and the price; that is true. Therefore, the purchase and sale agreement, as such, is a lawful act; except that, in this case, one of the parties—the sellers—performed their part of the agreement by transferring their property to Nombre06, but Nombre03 neither paid, nor has paid, nor intends to pay the sellers the corresponding sums for their properties.

Commercial practice teaches us that, when purchasing a property, the seller is paid at least part of the sale price, and payment of the remaining portion is secured by a first-priority mortgage (hipoteca en primer grado), so that the seller may proceed against that same property if the buyer fails to pay the outstanding balance; it is clear that nothing prevents a sale and purchase from being completed without any sum being paid at that time, BUT THIS IS NOT COMMON PRACTICE. In this case, such a situation defies all logic in view of the injured parties’ financial circumstances: as very poor persons, they were not in a position to extend credit to their buyer. On the contrary, it demonstrates the bad faith of the accused (encartado), Nombre06, in the transaction. Why were the injured parties not protected by a mortgage guarantee (garantía hipotecaria) over their own properties, so that they would be covered in the event of nonpayment for the purchases?

In their defense, the defendants maintained that this was done at the injured parties’ request because it would have entailed expenses that the injured parties lacked the money to pay” (see folios 1465 verso through 1467 recto). It is true that the injured parties have limited financial resources and education, but that did not prevent them, within the transaction in which they were interested at the time, from choosing to enter into a purchase and sale on credit, with payment subject to conditions and made in installments, securing their transaction through bills of exchange (letras de cambio). Both this type of credit transaction and the use of bills of exchange as security are entirely valid commercial arrangements under our legal system. It is possible, and also permissible, that the injured parties chose not to use mortgage guarantees in order to avoid paying registration taxes; contracting parties are not required always to use a mortgage guarantee.

Nor is it permissible to require a person who purchases an asset on credit to have money backing the transaction, as stated: “Why? Because a bill of exchange whose payer has no money with which to pay it IS NOTHING BUT PAPER.” (See folios 1468 verso). In fact, in a commercial transaction involving security for payment, such as a mortgage, mortgage certificate (cédula hipotecaria), bill of exchange, promissory note (pagaré), etc., the debtor is not required to demonstrate that funds are held in the debtor’s accounts to secure payment of the transaction; rather, the debtor is granted an agreed-upon period so that payment may be made as promised once sufficient liquidity is available. In fact, these arguments, presented in summary form as part of the legal reasoning (fundamentación jurídica), cannot be accepted because they are contrary to the legal system itself. Whether the arrangement is risky is a matter for the persons involved to decide, but that does not deprive it of legality.

The reasoning set forth is therefore insufficient and flagrantly violates Article 142 of the Código Procesal Penal. Both appeals must consequently be granted; the challenged judgment and the trial that preceded it are vacated, and, so that reasoning consistent with the law may be provided, a remand trial (juicio de reenvío) is ordered for all appropriate legal purposes. The remand trial shall address the entirety of the criminal action brought against the accused Nombre01 and Nombre06; the acquittal of the accused Nombre03 shall remain unchanged.

IV.Lic. Abraham Chaves Acuña, in his capacity as representative of the civil plaintiffs (actores civiles) and the Oficina de Defensa Civil de la Víctima, filed an appeal (recurso de apelación) against judgment number 156-2014(sic.), issued by the Tribunal Penal del Segundo Circuito Judicial de la Zona Atlántica sede Pococí, on the grounds described below. First Ground. Violation of due process (debido proceso). The appellant disagrees with the Court’s decision to uphold the civil award (condenatoria civil) but refer the parties to the civil courts to defend their rights, because there are disputed third-party rights, and also not to declare the instrumental falsity (falsedad instrumental) of the transfers of the victims’ properties and return them to their original owners. The appellant also disagrees with the view that allowing third parties to participate would distort the criminal proceedings; on the contrary, the appellant contends that the court has a duty to grant a right to be heard and to participate to those whose rights may be affected.

He further emphasizes that most of the properties were mortgaged in favor of Mr. [Nombre09 026], who did participate by filing a private criminal complaint (querella) and civil action (acción civil) but was excluded by the Criminal Judge, and that the failure to apply Article 491 clearly affects the victims, who cannot pursue another proceeding because of their financial limitations, while the interpretation adopted in the judgment places their properties at permanent risk. He considers that, although third parties have rights deserving protection, those rights cannot prevail over the rights of persons who held absolute rights to the properties belonging to them. Moreover, it would be extremely burdensome for them to resort to ordinary civil proceedings to seek protection of their rights, and he considers it unjust that, because of an omission that can be corrected, the rights of third parties should be addressed without distorting the criminal proceedings.

Second Ground: Erroneous application of substantive law (ley sustantiva). He contends that, in issuing its judgment, specifically with respect to the attorney’s fees awarded to the Oficina de la Defensa Civil de la Víctima, the Court misinterpreted Article 266 of the Código Procesal Penal because, although part of the award is entered without specifying an amount (condena en abstracto), the judgment does establish a liquidated and enforceable amount for emotional distress damages (daño moral). He explains that the unspecified award concerned pecuniary damages (daño material), but with respect to emotional distress damages, the Court awarded seven of the victims ten million colones each, for a total of seventy million colones. Accordingly, 20 percent should be awarded on 15 million colones, and 15 percent should be calculated on the excess, namely 55 million; the appropriate amount of costs (costas) relative to the amount awarded should therefore be eleven million two hundred fifty thousand colones.

He requests that this appeal be granted and the case remanded (reenvío), with the potentially affected persons being afforded the right to be heard, thereby allowing adjudication of the protection of the property rights associated with the properties at issue in this appeal solely for purposes of considering the request for a declaration of instrumental falsity. He therefore requests that the judgment remain undisturbed with respect to its civil and criminal aspects and that, in the interest of procedural economy (economía procesal), the mortgages granted in favor of Mr. [Nombre09 026] be declared instrumentally false, and that the correct amount of attorney’s fees be awarded to the Oficina de la Defensa Civil de la Víctima pursuant to the fee decree in force on the date of the events. (See appeal at folios 1524 to 1529). Both grounds are resolved jointly because the issues raised are related.

The claims have merit. The representative of the civil plaintiffs, acting through the Oficina de Defensa Civil de la Víctima, has raised several matters of interest. To address each argument in an orderly manner, this recital (considerando) is divided as follows: A.- Regarding the right to be heard. The trial court made several observations when it denied the civil plaintiffs’ request to declare the instrumental falsity of the deeds that affected their interests in the properties transferred at the time in favor of Nombre06. In that regard, it stated: “REGARDING THE REQUEST FOR A DECLARATION OF INSTRUMENTAL FALSITY: The interested parties must resort to the civil courts to adjudicate the protection of the property rights associated with the properties at issue in these proceedings, in light of the decision rendered herein. For that purpose, the notices entered in the registry records shall remain in effect for up to ten years while the corresponding matters are resolved in those proceedings, given the existence of third parties with legitimate or protectable interests.

In analyzing this request by the attorney from the Oficina de Defensa Civil de la Víctima, the Court encounters a highly complex situation. We have no doubt that the purchase and sale transactions, having been carried out through deceit, were fraudulent, because they were undertaken with the knowledge that the buyer, Nombre06, did not have the money to pay the agreed purchase price. The victims were instead given two bills of exchange (letras de cambio) with no financial backing, solely as a means of inducing them to consent to transfer their land to Nombre06 so that an improper financial benefit could later be obtained—improper because he would never honor payment of the agreed price, while the payment guarantee he gave the farmers was a spurious instrument because the buyer had neither the money nor other assets against which those bills of exchange could be enforced. This is sufficient reason to order the annulment of the respective deeds, excluding, as already noted, the case of [Nombre09 001], whose property was returned to him.

However, because the properties were immediately mortgaged to third parties, with the mortgage liens (gravámenes hipotecarios) appearing in the mortgage deeds at folios 17, 42, 63, 82, 146 and 177 and entered in the properties’ land-registry records, as may also be observed in the updated Registro Público search appearing at folios 1191 to 1207, resolution of this issue requires respect for the due process rights of third parties with legitimate interests that might warrant protection; in other words, those third parties should have been joined to the proceedings, which was not done. Had they been joined, however, it would have distorted the criminal proceedings before us because of the nature of the rights and claims belonging to the respective interested parties. We do not know the status of those mortgage loans, whether foreclosure proceedings (ejecuciones) have been filed, and, if they have, it would be necessary to determine the type of proceeding in which the matter should be resolved.

In the case of [Nombre09 019], it must be determined whether the mortgage foreclosure (ejecución hipotecaria) evidenced by the entries appearing in the registry complied with due process as to her, in her capacity as the current possessor of the land. There is also an open criminal proceeding against Nombre15, the outcome of which is unknown to us. It is clear that the victims’ rights to their properties have become disputed rights, which, by their nature, must be heard in ordinary civil proceedings, with all persons who may have interests deserving possible judicial protection being summoned. The most prudent course, therefore, is to abide by Article 491 of the Código Procesal Penal and order that this issue be adjudicated in the civil courts, where the matters established in these proceedings and this judgment will serve as input for the corresponding decision. The Court cannot resolve this issue without having afforded the third-party registrants an opportunity to be heard.

One fact draws the Court’s particular attention, and we do not wish to leave it unmentioned: according to the accounts of all the victims, without exception, as of the days on which they testified at trial, NOT A SINGLE ONE OF THE PRESENT MORTGAGE CREDITORS HAS EVER APPEARED at the victims’ properties or homes, whether to inspect the properties and their nature, to ascertain who possesses them, or to learn why they are in possession of the land. It has been established through the victims’ testimony, the defendants’ testimony, and Nombre17’s testimony that the properties remain in the victims’ possession, and that possession alone must be examined as a matter warranting protection through judicial proceedings. Nor has a single defendant been notified of the existence of a civil collection action (acción cobratoria civil) as a third-party possessor, not even [Nombre 019], according to her testimony, although the Registro Público search appearing at folio 1200 indicates that her property had already been awarded to the German national Nombre20 after he purchased it at auction for failure to pay the mortgage imposed on it by Nombre03 through Nombre15.

We ask ourselves how that could have occurred when [Nombre09 019] remains in possession of the property and says that she knows nothing about that award. Nombre03’s mortgage creditors appeared and stated that they would be willing to substitute the collateral (garantías) in exchange for his release, including Mr. [Nombre 026], as shown at folios 382 and 484; he even described himself as an ‘alleged creditor’ in a filing authenticated by the same attorney and notary who executed all but one of the mortgages ¿? The most striking case is that of [Nombre 026]. As in the other cases, the victims state that he has not visited Cuajiniquil or any of the properties, even though, according to the copies of the mortgages appearing in the record at the folios cited above and the Registro Público searches at folios 1191 to 1207, he allegedly extended loans to Nombre03 totaling more than one hundred million colones, secured by mortgages on the properties of several of the victims in this case.

We ask ourselves: how does someone lend such a large sum of money without seeing the asset that will serve as collateral, without knowing its state, nature, or condition? How is it that more than two years have passed since he apparently extended those loans, yet there is no indication anywhere that he has filed any collection action concerning them, despite knowing, as has been established, that Nombre03 did not have the money to repay them? Of course, we are aware that Mr. Nombre21 appeared in these proceedings and sought to be recognized as an injured party (damnificado) and private complainant (querellante) in connection with those loans, but that was as far as the matter went. We ask ourselves: could there have been a group behind Mr. Nombre06 interested in acquiring those lands with Nombre06’s assistance? The defendant began his statement by indicating that Nombre22 and Nombre23 had asked him to obtain those lands.

Mr. [Nombre09 026] may merely be a third party in good faith. The Court cannot simply [overlook] illegitimate conduct, but in view of the information described above, we are compelled, and consider it appropriate, to request that the Ministerio Público undertake an investigation into whether he may have acted in collusion (contubernio) with the defendants Nombre24 and other persons interested in acquiring the land belonging to the farmers of Cuajiniquil. The operative portion (parte dispositiva) of this judgment shall therefore be supplemented to this extent and in relation to Mr. [Nombre09 026]. (see folios 1478 front to 1479 reverse).”

It is true that third parties’ right to be heard (derecho de audiencia) is necessary for them to exercise the defense of their rights, in application of due process (debido proceso), as established by Article 39 of the Constitución Política, but this does not mean that their interests must be separated from the criminal proceedings (proceso penal), because, contrary to the Trial Court’s reasoning, this Chamber finds that the legislature has progressively adapted the procedural mechanisms (figuras procesales) necessary for the corresponding civil claims to be brought within the criminal proceedings through the civil action for damages (acción civil resarcitoria), provided for in Articles 37 to 41 of the Código Procesal Penal and exercised pursuant to Articles 111 to 124 of the same legal code; this allows compensatory rights (derechos resarcitorios) to be addressed without distorting the nature of the criminal proceedings.

These arguments are clear with regard to those who enter an appearance in the proceedings (se apersonan al proceso) to defend their rights, as is the case of the injured parties (ofendidos) represented by the Oficina de la Defensa Civil de la Víctima, but this does not mean that they are the only persons who may be affected by the offense; this concept is broader because it must also encompass the rights of affected persons (damnificados) and good-faith third parties (terceros de buena fe) who have not asserted civil claims but who have the right to be heard within the proceedings and to be informed thereof in order to protect their rights, as provided in Article 70 of the Código Procesal Penal, which states verbatim: “Article 70.—Victims. The following shall be considered victims: a) The person directly injured by the offense. b) The spouse, the person who has cohabited with the victim for more than two years, the son or daughter, the adoptive mother and father, relatives within the third degree of consanguinity or the second degree of affinity, and the judicially declared heir, in offenses resulting in the death of the injured party. c) Shareholders, associates, or members, with respect to offenses affecting a legal entity (persona jurídica) committed by those who direct, administer, or control it. d) Associations, foundations, and other registered entities, in offenses affecting collective or diffuse interests (intereses colectivos o difusos), provided that the purpose of the organization is directly connected with those interests.

(As amended by Article 16 of the Ley de Protección a Víctimas, Testigos y demás intervinientes en el Proceso Penal N° 8720 of 4 de marzo de 2009).” Allowing these parties to participate likewise does not distort the nature of the criminal proceedings; indeed, protecting the rights of the direct and indirect victims of the offense does not alter the criminal proceedings in any respect; on the contrary, the legislature’s intent is to protect them. This means that creditors who provided funds secured by the properties at issue in this case may participate and may be included within the concept of persons affected by the offense or interested good-faith third parties (terceros interesados de buena fe), whose rights may be protected within these same proceedings without their having to resort to separate proceedings. Accordingly, for the retrial following remand (juicio de reenvío), all creditors or persons affected by the instrumental nullity (nulidad instrumental) of the deeds must be summoned to the proceedings so that they have an opportunity to defend their rights, and they must accept the proceedings at their current stage, so that they do not have to resort to separate proceedings, thereby giving effect to the principle of effective judicial protection (tutela judicial efectiva) set forth in Article 41 of the Constitución Política.

The claim is therefore granted, and the judgment is vacated insofar as it concerns the civil action for damages. b.—Costs arising from the judgment (costas en razón de sentencia). In view of the acceptance of the first part of the appeal, a ruling on costs is omitted as unnecessary.

V. REGARDING THE PRECAUTIONARY MEASURE (MEDIDA CAUTELAR)

Since this Chamber is annulling the challenged judgment and ordering a retrial (juicio de reenvío) of defendants Nombre01 and Nombre06, it is deemed necessary to extend the precautionary measure of pretrial detention (prisión preventiva) imposed on defendant Nombre06, solely to ensure his presence at the retrial; therefore, pursuant to the provisions of section 258 of the Code of Criminal Procedure (Código Procesal Penal), the precautionary measure of pretrial detention currently in effect is extended for SIX MONTHS, from 5 de noviembre 2016 until 05 de mayo de 2017.- THEREFORE (POR TANTO):

The appeals filed are granted, with the following procedural consequences: By majority vote, the challenged judgment is partially annulled with respect to the civil action for damages (acción civil resarcitoria), which is dismissed as against defendant Nombre03. Judge Montero Mena dissents. By unanimous vote, the challenged judgment and the trial preceding it are annulled as against defendants Nombre01 and Nombre06, with respect to whom a retrial is ordered before the court of origin, sitting with a newly constituted panel, so that it may issue the ruling required by law. The acquittal of defendant Nombre03 remains unchanged. The judgment is also annulled insofar as it concerns the civil action for damages filed against Nombre17 and Nombre25. The pretrial detention of defendant Nombre06 is extended for a period of SIX MONTHS, commencing on 5 de noviembre 2016 and continuing until 05 de mayo de 2017. Resolución: 2016-1435 Resolución: 2016-1435 TRIBUNAL DE APELACIÓN DE SENTENCIA PENAL. Segundo Circuito Judicial de San José. Goicoechea, a las trece horas cincuenta minutos, del doce de octubre de dos mil dieciséis.- RECURSO DE APELACIÓN interpuesto en la presente causa seguida contra Nombre01, mayor, costarricense, cédula de identidad número CED01, nacido en San José el 28 de julio de 1978, hijo de Nombre01 y Nombre02, vecino de Quepos; Nombre03, mayor, costarricense, cédula de identidad número CED02, nacido el 14 de diciembre de 1965, hijo de Nombre04 y Nombre05, vecino de Pococí y Nombre06, mayor, costarricense, cédula de identidad número CED03, nacido en San José el 22 de enero de 1975, hijo de Nombre07 y Nombre08, vecino de Acosta; por el delito de ESTAFA Y OTRO, en perjuicio de [Nombre09 001] Y OTROS. Intervienen en la decisión del recurso, el juez Roy Antonio Badilla Rojas, la jueza Elízabeth Montero Mena y el juez Giovanni Mena Artavia.

Se aperson aron en esta sede el licenciado Yorhanny Campos Piedra en su condición de defensor particular del imputado Nombre03, el licenciado Víctor Rafael Herrera Flores en calidad de defensor particular del encartado Nombre06, el licenciado Abraham Chaves Acuña, como abogado de la Oficina de Defensa Civil de la Víctima, el licenciado Jorge Matamoros Guevara, defensor particular del encausado Nombre01 . Contestó la licenciada Mariela Brenes Carballo, en representación de la Fiscalía Adjunta de Pococí y Guácimo del Ministerio Público y el licenciado Abraham Chaves Acuña, como abogado de la Oficina de Defensa Civil de la Víctima.

RESULTANDO:

I.Que mediante sentencia número 156-201 6 , de las quince horas del doce de abril de dos mil dieciséis, el Tribunal Penal del Segundo Circuito Judicial de la Zona Atlántica, Guápiles, resolvió: "POR TANTO: De conformidad con las reglas de la sana crítica racional, artículos 8 de la Convención Americana de Derechos Humanos, 28, 39 y 41 de la Constitución Política, 1, 18, 30, 31, 45 y 47, 71, 73 y 103, 216 y 218 del Código Penal reglas vigentes sobre responsabilidad civil del Código Penal de 1941; artículos 6 y 16 del Código Notarial, 1, 6, 9, 142, 265 a 270, 360, 361, 363 a 365, 366, 367, 368, 491 y 492 del Código Procesal Penal, al resolver este asunto por unanimidad se acuerda: ABSOLVER de toda pena y responsabilidad a Nombre06, Nombre01 Y Nombre03 por los hechos en relación con el señor [Nombre09 001], ABSOLVER de responsabilidad penal a Nombre03 por los delitos acusados; DECLARAR a Nombre06 autor y a Nombre01, cómplice, responsables de OCHO delitos de Estafa consumada en concurso material, en perjuicio de [Nombre09 003], [Nombre 004], [Nombre 005], [Nombre 006] y [Nombre 007], [Nombre 019] y [Nombre09 028], [Nombre 010] y [Nombre 011], [Nombre 012] y [Nombre 013], [Nombre 014] y [Nombre 015]; DECLARAR a Nombre06, autor responsable de Un delito de Fraude de Simulación en perjuicio de [Nombre 019] y [Nombre09 028], y por ello se les impone las siguientes penas: a Nombre06, Cuatro años de prisión por cada delito de estafa y Siete años de prisión por el delito de Fraude de Simulación, para un total de Treinta y nueve años de prisión, que por las reglas de la penalidad del concurso material se adecuan a VEINTIÚN AÑOS DE PRISIÓN como la pena que finalmente deberá descontar; a Nombre01 se le impone una pena de Un año de prisión por cada delito de estafa para un total de Ocho años de prisión que por las reglas de penalidad del concurso material se adecúan a TRES AÑOS DE PRISIÓN, como la pena que finalmente deberá descontar; la pena impuesta deberán descontarla los condenados en el lugar y condiciones que establezcan los reglamentos penitenciarios previo abono de la prisión preventiva que hubieren sufrido, y por el monto de la pena impuesta no se concede beneficio judicial alguno al imputado Nombre06; al condenado Nombre01 se le concede el beneficio de la ejecución condicional de la pena por un plazo de Cinco años en el cual no podrá cometer nuevo delito doloso en el que se le imponga una pena de prisión superior a seis meses, pues de hacerlo deberá descontar la que en esta sentencia se suspende.

SE DECLARA CON LUGAR en todos sus extremos la Acción Civil Resarcitoria interpuesta por medio de la Oficina de la Defensa Civil de la Víctima en favor de [Nombre09 003], [Nombre 004], [Nombre 005 006], [Nombre 019] , [Nombre 010], [Nombre 012] y en contra de Nombre03, Nombre06 y Nombre01, a quienes se les condena por ello a pagar en forma solidaria a los actores civiles los daños materiales, los morales que con su actuar se ha determinado produjeron a los ofendidos, lo mismo que ambas costas de la Acción Civil Resarcitoria en favor de la Oficina de la Defensa Civil de la Víctima del Ministerio Público; en cuanto a los daños materiales se condena en abstracto por no contar el Tribunal con elementos suficientes para determinar la cuantía de los mismos, en cuanto al daño moral se fija el monto a pagar a cada ofendido constituido en actor civil la suma de DIEZ MILLONES DE COLONES ; y respecto de las costas, al no poderse fijar en este acto el monto a indemnizar por concepto de daño material se condena igualmente en abstracto; respecto de los montos por concepto de daño moral se establece un plazo de quince días a partir de la firmeza de la sentencia para que los condenados civiles paguen a los ofendidos las sumas fijadas, y de no hacerlo en dicho plazo deberán acudir los interesados a la vía civil, igualmente que deberán hacerlo para la definición y pago de los rubros correspondientes a daño material y costas.

Las partes interesadas deberán acudir a la vía civil a dilucidar la tutela de los derechos de propiedad relacionados con las fincas objeto de este proceso y con vista de lo aquí resuelto, para lo cual se mantendrán las anotaciones realizadas en los asientos registrales hasta por diez años, mientras se resuelve en dicha vía lo correspondiente, en atención a la existencia de terceros con intereses legítimos o tutelables. SE PRORROGA la prisión preventiva del condenado Nombre06 por un plazo de SEIS MESES a partir de esta fecha y hasta el DOCE DE OCTUBRE DEL AÑO DOS MIL DIECISÉIS. En lo penal se resuelve sin especial condenatoria en costas. Se ordena testimoniar las piezas necesarias y poner en conocimiento de la Dirección General de Notariado, como del Ministerio Público para que se investigue la conducta del imputado Nombre03 en relación con estos hechos en su función de notario Público, como lo referente al monto consignado como valor de venta de las fincas y el monto real de los negocios de compra venta.

Firme esta sentencia comuníquese lo correspondiente al Juez de Ejecución de la Pena, al Instituto Nacional de Criminología, al Registro Judicial. Mediante lectura notifíquese..- SE ADICIONA POR TANTO Se adiciona la parte dispositiva de la sentencia anterior en el sentido de agregar que se ordena testimoniar piezas ante el Ministerio Público a efecto de que se investigue si el señor [Nombre09 026] tiene alguna participación delictiva en los hechos investigados en relación con las hipotecas que se otorgaron a su favor. " (sic.,).

II.Que contra el anterior pronunciamiento interpus ieron recurso de apelación el licenciado Yorhanny Campos Piedra en su condición de defensor particular del imputado Nombre03, el licenciado Víctor Rafael Herrera Flores en calidad de defensor particular del encartado Nombre06, el licenciado Abraham Chaves Acuña, como abogado de la Oficina de Defensa Civil de la Víctima, el licenciado Jorge Matamoros Guevara, defensor particular del encausado Nombre01 .

III.Que verificada la deliberación respectiva de conformidad con lo dispuesto por el artículo 465 del Código de Procesal Penal, el Tribunal se planteó las cuestiones formuladas en el recurso de apelación.

IV. Que en los procedimientos se han observado las prescripciones legales pertinentes

Redacta el Juez de Apelación de Sentencia Penal Badilla Rojas; y,

CONSIDERANDO:

l.- El Lic. Yorhan n y Campos Piedra defensor particular del encartado Nombre03, ha promovido formal recurso de apelación en contra de la sentencia número 156-2014(sic.), dictada por el Tribunal Penal del Segundo Circuito Judicial de la Zona Atlántica, sede Pococí, de las 16:00 horas del 19 de abril de 2016, en la que se absolvió penalmente al acusado y se le condenó a su representado Nombre03 como responsable civil solidario junto con los co encartados Nombre06 y Nombre01, por los daños sufridos por los ofendidos y ambas costas en favor de la Oficina de la Defensa Civil de la Víctima. Primer motivo: Disconformidad con la fundamentación jurídica a la que llega el tribunal en la citada sentencia, para condenar civilmente al encartado Nombre03. Resalta que a pesar de que al encartado Nombre03 no se le tiene como responsable penal de los hechos investigados, ni en calidad de autor y menos de cómplice se le condena civilmente por daños, perjuicios y costas, por una supuesta falta de orden notarial en sus deberes como Notario Público, violentando claramente los principios de Juez Natural y legalidad, debido a que las faltas en esta jurisdicción se resuelven por parte del Juzgado Notarial, el Tribunal Notarial y la Sala Primera, según sea el caso, criterios jurisdiccionales que han sido sumamente reiterados.

Destaca que el Tribunal de Guápiles si estimaba que se incurrió en una responsabilidad disciplinaria a nivel notarial, debió ordenar el respectivo testimonio de piezas ante el Juzgado Notarial, para que el encartado tuviera la oportunidad de ejercer su derecho de defensa y presentar su prueba de descargo, siendo juzgado por un órgano integrado por especialistas en materia notarial, siendo evidente que se violentó el principio de juez natural, por intromisión en una competencia ajena y además el principio de legalidad fue quebrantado impidiendo ejercer en este caso un debido proceso. Considera que existe falta de fundamentación de la pena, por cuanto se condenó civilmente a su representado por un hecho atípico, respaldado por el artículo 311 inciso b, siendo injustificado que se determinara una responsabilidad en daños perjuicios y costas, cuya determinación se debió dar en sede notarial.

Segundo Motivo. Falta de fundamentación jurídica. Se violenta el debido proceso y el derecho de Defensa. Estima que la condenatoria civil de la cual es objeto el encartado Nombre03 en la sentencia, se realiza en absoluta contradicción al principio de correlación entre acusación y sentencia. Propone que si se analiza la acusación planteada por el Ministerio Público y los hechos propuestos por la Defensa Civil de la Víctima en contra de Nombre03, se puede determinar con facilidad que son hechos totalmente diversos a los tenidos por demostrados por el tribunal, en el tanto los de la acusación y los de la acción civil, se respaldan en un nexo de causalidad existente por la actuación conjunta con los otros acusados, sin embargo, el Tribunal estimó que en el caso de este acusado, dicha actuación es atípica, sin embargo, lo condena de forma solidaria al pago de daños perjuicios y costas en favor de los ofendidos por una supuesta falta a su deber notarial.

Solicita se declare con lugar el motivo y se anule la sentencia impugnada. Tercer Motivo. Falta de fundamentación jurídica. Se violentan el debido proceso y el derecho de defensa. Muestra el recurrente disconformidad con los argumentos expuestos por el tribunal al considerar que el hecho acusado a su representado es atípico, sin embargo, le condena civilmente, argumentando como fundamento que existe responsabilidad desde el punto de vista del Derecho Notarial. Solicita se anule la sentencia al incurrirse en la falta de fundamentación por haberse dictado una sentencia absolutoria por duda cuando debió ser por certeza al considerarse que el hecho acusado era atípico. (Ver recurso de folios 1491 a 1506) Se resuelven los tres motivos de manera conjunta por ser los temas tratados conexos entre sí. El reclamo es atendible. Luego de revisado el fallo impugnado de manera integral, se puede determinar que existe un serio problema de congruencia, entre lo planteado en la acción civil resarcitoria y lo condenado en el momento de examinar dicha demanda.

Nótese en la relación de hecho de la acción civil resarcitoria se planteó lo siguiente: "HECHOS DE LA ACCION CIVIL RESARCITORIA: Primero: Los imputados y demandado civiles Nombre01, Nombre06 y Nombre03, de común acuerdo y con pleno dominio del hecho, idearon un plan a efecto de obtener un beneficio patrimonial indebido, mediante el cual despojarían a personas humildes de sus propiedades, para lo cual los engañarían haciéndoles creer falsamente que les iban a comprar sus propiedades en sumas exhorbitantes de dinero, por lo que los ofendido y actores civiles ante esas propuestas aceptarían venderlas e inducidas en error firmaron documentos en los que les hacían creer que eran opciones de venta, cuando en realidad serían los traspasos formales de las propiedades a cambio les entregarían letras de cambio para mantenerlos en error, haciéndoles creer falsamente que en las fechas que en ellas se señalaban les iban a realizar el pago de la venta de sus propiedades, posteriormente una vez que los ofendidos y actores civiles firmaran los traspasos el imputado y demandado civil Nombre06 procedía a hipotecar esas propiedades a favor de terceras personas.

Segundo: A finales del mes de octubre del año dos mil trece, sin precisar fecha exacta, el encartado y demandado civil Nombre01 se presentó al negocio denominado Bar El Sarpe propiedad del ofendido y actor civil [Nombre09 003], sita en Cuajiniquil de la Cruz, Guanacaste, a quien con la finalidad de llevar a cabo el plan delictivo ideado junto con los acusados y demandados civiles Nombre06 y Nombre03 y obtener un beneficio patrimonial indebido, le indicó que el encartado y demandado civil Nombre06 estaba interesado en comprarle su finca ubicada en Cuajiniquil de la Cruz de Guanacaste dos kilómetros sur del centro de Cuajiniquil en la suma de ciento noventa y un millones novecientos noventa y nueve mil cuatrocientos diez colones (¢ 191.999.410,00), indicándole el imputado Nombre01 que debía de firmar primero el traspaso de su propiedad para que el imputado Nombre06 pudiera obtener el dinero y así cancelarle, por lo que el día once de noviembre de dos mil trece el encartado Nombre01 llevó al ofendido [Nombre09 025] hasta la oficina del abogado y notario e imputado y demandado civil Nombre03, sita en Guápiles cincuenta metros sur de Palí, lugar en el que el ofendido inducido a error, bajo la creencia que le pagarían su propiedad y que firmaba una opción de venta, lo que realmente firmó fue la escritura pública número 292 visible al folio 147 vuelto del tomo 21 del protocolo del licenciado Nombre03, que corresponde al traspaso de su propiedad, la cual se encuentra inscrita en el Registro de la Propiedad, partido de Guanacaste matrícula folio real por un monto de dos millones quinientos mil colones (¢ 2.500.000,00)Y en el acto el imputado Nombre06 le firmó dos letras de cambio, una por un monto de cincuenta millones de colones (¢ 50.000.000,00) a vencer el día veintiséis de diciembre de dos mil trece y la otra por monto de ciento cuarenta y un millones novecientos noventa y nueve mil cuatrocientos diez colones (¢ 141.999.410,00)a vencer el día once de junio de dos mil catorce, con las cuales mantendría en error al ofendido haciéndole creer que si le pagaría lo cual no sucedió ya que a la fecha no se le ha cancelado.

Tercero: Para terminar de obtener un beneficio patrimonial indebido para sí, el encartado Nombre06, el día trece de noviembre de dos mil trece ante la notaria Yiell Flores Madrigal, en la ciudad de San José, según escritura 309 visible a folio 179 vuelto del tomo 4 de su protocolo, procedió a hipotecar la propiedad del ofendido [Nombre09 003] a favor de [Nombre 031] por la suma de treinta y dos millones quinientos mil colones (¢ 32.500.000,00). Cuarto: El día diez de diciembre de dos mil trece, el imputado y demandado civil Nombre01 se presentó a la vivienda del ofendido y actor civil [Nombre09 004], sita en Cuajiniquil de la Cruz, Guanacaste, a quien con la finalidad de poner en marcha el plan delictivo ideado junto con los imputados Nombre06 y Nombre03 y obtener un beneficio patrimonial indebido, le indicó que era corredor de bienes y raíces y el encartado Nombre06 estaba interesado en comprarle sus dos fincas ubicada en Cuajiniquil de la Cruz, Guanacaste, Asentamiento Nombre10 en la suma de doscientos cuarenta y cuatro millones novecientos noventa y cuatro mil novecientos noventa y nueve colones (¢ 244.994.999,00),a lo que el ofendido motivado por esa suma de dinero aceptó, es así como el día treinta de noviembre de dos mil trece, el imputado Nombre01 llevó al ofendido [Nombre09 004] hasta la oficina del abogado y notario e imputado y demandado civil Nombre03, sita en Guápiles cincuenta metros sur de Palí, lugar en el que el ofendido inducido a error por parte de los encartados le hicieron creer que lo que firmaría era un pagaré y que con ello podían tener el poder para revisar la finca en el Registro Público para ver si tenía anotaciones y que además de esa forma comprometían a cancelarle el quince de enero de dos mil catorce la suma de cincuenta millones de colones (¢ 50.000.000,00)Y para el treinta de junio de dos mil catorce la suma de ciento noventa y cuatro millones novecientos noventa y cuatro mil novecientos noventa y nueve colones (¢ 194.944.999,00),en el acto el ofendido inducido a error firmó el pagaré, siendo que en realidad lo que firmó fue el traspaso de sus propiedades inscritas en el Registro de la Propiedad, partido Guanacaste matrícula folio real y mediante escritura pública número 316 visible a folio 159 frente del torno 21 del protocolo del encartado Nombre03.

Quinto: Para terminar de obtener un beneficio patrimonial indebido para sí el encartado Nombre06 el día once de enero de dos mil catorce ante la notaria Yiell Flores Madrigal en la ciudad de San José, según escritura 2 visible a folio 02 vuelto del tomo quinto de su protocolo, procedió a hipotecar la propiedad del ofendido [Nombre09 004] inscrita en el Registro de la Propiedad, partido Guanacaste matrícula folio real 94727-000 a favor de [Nombre 031] por la suma de diez millones cuatrocientos mil colones (¢ 10.400.000,00). Sexto: El día once de de diciembre de dos mil trece el encartado y demandado civil Nombre01 se presentó a la vivienda de la ofendida y actora civil [Nombre09 005], sita en Cuajiniquil de la Cruz, Guanacaste, a quien con la finalidad de poner en marcha el plan delictivo ideado junto con los imputados y demandados civiles Nombre06 y Nombre03 y obtener un beneficio patrimonial indebido le indicó que trabajaba para el encartado y demandado civil Nombre06, el cual estaba interesado en comprarle su finca ubicada en Agua Caliente de Santa Elena de la Cruz, Guanacaste en la suma de ciento sesenta y nueve millones de colones (¢ 169.000.000,00), a lo que la ofendida ante tal propuesta aceptó, por lo que ese mismo día la llevó hasta la oficina del abogado y notario e imputado y demandado civil Nombre03, sita en Guápiles, cincuenta metros sur de Palí, lugar en el que la ofendida inducida a error por parte de los encartados le hicieron creer que lo que firmaría era una opción de venta y mediante dos letras de cambio el imputado Nombre06 se comprometía a cancelarle el veintiséis de enero de dos mil catorce la suma de cincuenta millones de colones (¢ 50.000.000,00) Y en el mes de julio de dos mil catorce la suma de ciento diecinueve millones de colones (¢ 119.000.000,00) y en el acto la ofendida inducida a error firmó la supuesta opción de venta, siendo que lo que firmó realmente fue el traspaso de su propiedad inscrita en el Registro de la Propiedad, partido Guanacaste matrícula folio real por el precio de dos millones quinientos mil colones (¢ 2.500.000,00), esto mediante escritura pública número 330 visible a folio 165 frente del tomo 21 del protocolo del licenciado Nombre03.

Sétimo: Para terminar de obtener un beneficio patrimonial indebido para si el encartado Nombre06 el día veinte de diciembre de dos mil trece ante el notario Yiell Flores Madrigal en la ciudad de San José, según escritura 324 visible a folio 198 vuelto del tomo 4 de su protocolo, procedió a hipotecar la propiedad de la ofendida Nombre11 inscrita en el Registro de la Propiedad, partido Guanacaste matrícula folio real a favor de Nombre12 por la suma de seis millones de colones (¢ 6.000.000,00). Octavo: Sin precisar fecha exacta pero si en el mes de noviembre de dos mil trece, en horas de la mañana un sujeto conocido como "Chuchequero" se presentó a la vivienda del ofendido y actor civil [Nombre09 006] en Cuajiniquil de la Cruz, Guanacaste, a quien le indicó que habían personas interesadas en comprar fincas y le dio el número telefónico del imputado y demandado civil Nombre01, por lo que el agraviado lo llamó y el imputado con la finalidad de poner en marcha el plan delictivo ideado junto con los imputados y demandados civiles Nombre06 y Nombre03 y obtener un beneficio patrimonial indebido le indicó al ofendido que el endilgado Nombre06 era el que estaba interesado en comprar fincas, que las compraba en dos tractos y si deseaba venderlas tenía que ir hasta Guápiles a firmar la opción de venta, por lo que el ofendido aceptó y el día veintinueve de noviembre de dos mil trece, el endilgado Nombre01 se presentó a la vivienda del ofendido y lo llevó junto con su esposa [Nombre09 007] y su hermano [Nombre09 017] hasta Guápiles y al día siguiente, sea el treinta de noviembre de dos mil trece, se trasladaron a la oficina del abogado y notario e imputado y demandado civil Nombre03, sita en Guápiles cincuenta metros sur de Palí y ahí el imputado Nombre06 le indicó que le compraría la finca y se la cancelaría en dos tractos uno el día quince de enero de dos mil catorce momento en el cual le entregaría la suma de cincuenta millones de colones (¢ 50.000.000,00) y el segundo pago para finiquitar la venta el día veintinueve de junio de dos mil catorce por un monto de ciento veinticuatro millones ciento cincuenta y nueve mil seiscientos diez colones (¢ 124.159.610,00), para un monto total de ciento setenta y cuatro millones ciento cincuenta y nueve mil seiscientos diez colones (¢ 174.159.610,00) y en ese momento se formalizaría la venta de su propiedad inscrita en el Registro de la Propiedad, partido Guanacaste matrícula folio real y el derecho 002, a lo que el ofendido y su esposa [Nombre09 007] aceptaron y firmaron bajo la creencia que estaban firmando una opción de venta, siendo que lo que realmente firmaron fue la escritura pública número 315 visible a folio 157 vuelto del tomo 21 del protocolo del licenciado Nombre03, en la cual traspasaban la propiedad a favor del encartado Nombre06, en el acto el encartado Nombre06 para mantener inducido en error al ofendido [Nombre09 006] y hacerle creer falsamente que le pagaría en las fechas ya indicadas, le entregó las dos letras de cambio.

Noveno: Para terminar de obtener un beneficio patrimonial indebido para si el encartado Nombre06 el día once de diciembre del dos mil trece, ante la notaria Yiell Flores Madrigal en la ciudad de San José, según escritura 322 visible a folio 196 vuelto del tomo 4 de su protocolo, procedió a hipotecar en primer grado la propiedad del ofendido [Nombre09 006] inscrita en el Registro de la Propiedad, partido Guanacaste, matrícula folio real a favor de Nombre13 por la suma de trece millones de colones (¢ 13.000.000,00). Décimo: Sin precisar fecha exacta pero si a inicios del mes de noviembre del dos mil trece en horas de la tarde se presentó a la vivienda del ofendido y actor civil [Nombre09 012] un sujeto conocido como "Chuchequero" quien le indicó que el imputado y demandado civil Nombre01 estaba interesado en comprar fincas y le dio el número de teléfono del mismo, por lo que al día siguiente el ofendido lo llamó y el encartado Nombre01 con la finalidad de poner en marcha el plan delictivo ideado junto con los imputados y demandados civiles Nombre06 y Nombre03 y obtener un beneficio patrimonial indebido para si, le indicó que efectivamente querían comprar tierras en esa zona, manifestándole el agraviado que le vendería únicamente catorce hectáreas de su propiedad inscrita en Registro de la Propiedad, partido Guanacaste matrícula folio real en la suma de ciento doce millones de colones (¢ 112.000.000,00), por lo que el endilgado Nombre01 aceptó y el día once de noviembre de dos mil trece, se vieron en Cuajiniquil Centro y el encartado Nombre01 lo llevó hasta Guápiles a la oficina del abogado y notario e imputado y demandado civil Nombre03 sita en Guápiles cincuenta metros sur de Palí quien de acuerdo al plan previamente establecido de engañar al ofendido, para despojarlo de su propiedad, le indicó que iba a firmar una opción de venta de la propiedad, sin leerle el documento y éste no lo leyó por cuanto no sabe leer y en el acto el imputado Nombre06 para mantener en error al ofendido y hacerle creer que si le pagaría le entregó dos letras de cambio, una que indicaba que el primer pago por la venta de la propiedad lo iba a hacer el veintiséis de diciembre de dos mil trece por un monto de cincuenta millones de colones (¢ 50.000.000,00) y la segunda indicaba que el pago se realizaría el día once de junio de dos mil catorce por un monto de sesenta millones sesenta y siete mil ochocientos cuarenta y siete colones (¢ 60.Telf01) de inmediato el encartado Nombre03 le indicó al ofendido que una vez que se cancelara la totalidad del dinero se formalizaba la venta de la propiedad, cuando lo que el ofendido firmó en realidad fue el traspaso de la totalidad de su propiedad y a la fecha el imputado Nombre06 no le ha cancelado.

Décimo primero: Para terminar de obtener un beneficio patrimonial indebido para si el encartado Nombre06 el día trece de noviembre de dos mil trece hipotecó la propiedad del ofendido Nombre14 por treinta y dos millones quinientos mil colones a favor de [Nombre 026]. Décimo segundo: El día veinte de diciembre de dos mil trece el encartado y demandado civil Nombre01 se presentó a la vivienda de la ofendida y actora civil [Nombre09 019] ubicada en Cuajiniquil de la Cruz, Guanacaste del Dirección01, a quien con la finalidad de poner en marcha el plan delictivo ideado junto los imputados y demandados civiles Nombre06 y Nombre03, y obtener un beneficio patrimonial indebido le indicó que el encartado Nombre06 estaba interesado en comprarle su finca ubicada en Cuajiniquil, distrito Santa Elena, asentamiento Juan Santamaría, dicha propiedad tiene una extensión de doscientos treinta y seis metros cuadrados e inscrita en el Registro Público, partido Guanacaste folio real matrícula [Valor 001], acordando un precio de veinte de ciento noventa y dos millones ciento treinta y dos mil seiscientos cincuenta colones ¢ 192.132.650,00), posteriormente el día veintiuno de diciembre de dos mil trece el encartado Nombre01 llevó a la ofendida [Nombre09 019] y su esposo [Nombre09 028] hasta la oficina del abogado y notario e imputado y demandado civil Nombre03 sita en Guápiles cincuenta metros sur de Palí, lugar en el que la ofendida inducida a error por parte de los encartados bajo la creencia que si le pagarían su propiedad y que firmaría una opción de venta, lo que firmó realmente fue el traspaso de la misma, junto con su esposo [Nombre09 028], según escritura 339 visible a folio 168 vuelto del tomo 21 del protocolo del licenciado Nombre03, propiedad que se encuentra inscrita a folio real matrícula 5-[Valor 001], ese mismo día en horas de la tarde propiamente en el Mall Cariari en Pedregal de Heredia el encartado Nombre06 firmó dos letras de cambio, una por un monto de cincuenta millones de colones (¢ 50.000.000,00) a vencer el día tres de febrero de dos mil catorce y la otra por un monto de ciento ochenta y seis millones ciento treinta y dos mil seiscientos cincuenta colones (¢ 186.132.650,00) a vencer en el mes de junio de dos mil catorce, con las cuales mantendría en error a la ofendida haciéndole creer que si le pagaría, lo cual no sucedió ya que a la fecha no le ha cancelado.

Décimo tercero: Para terminar de obtener un beneficio patrimonial indebido para si el encartado Nombre06 el día veinte de febrero de dos mil catorce traspasó la propiedad de la ofendida [Nombre09 019], a la señora Nombre15, siendo que el día dos de julio de dos mil catorce la señora Nombre15 hipotecó la propiedad de la ofendida por doce mil dólares ($ 12.000,00) a favor de Nombre16. Décimo Cuarto: Sin precisar fecha pero si a inicios del mes de noviembre de dos mil trece, un sujeto conocido como "Chuchequero" se presentó a la vivienda del ofendido y actor civil [Nombre09 010] a quien le manifestó que el imputado y demandado civil Nombre01 estaba interesado en comprar su parcela y de inmediato lo llamó por teléfono, indicándole al agraviado que a consultar con su socio sobre el monto de la venta, el cual era de ciento ochenta y un millones de colones (¢ 181.000.000,00), aproximadamente dos días después el imputado Nombre17 a Nombre08 con la finalidad de continuar con el plan delictivo ideado junto con los imputados y demandados civiles Nombre06 y Nombre03 de despojar a las personas de sus propiedades sin pagarles nada, llamó al ofendido y le indicó que el imputado Nombre06 había aceptado el precio y que se lo pagaría en dos tractos, por lo que el día veintiuno de noviembre de dos mil trece se encontraron en San José y ahí el endilgado Nombre01, llevó al ofendido hasta la oficina del abogado y notario e imputado y demandado civil Nombre03 sita en Guápiles cincuenta metros sur de Palí, posteriormente se presentó el imputado Nombre06 y ahí todos, de común acuerdo y con la finalidad de obtener un beneficio patrimonial indebido y lograr despojar al ofendido de su propiedad sin cancelarle el valor de la misma, lograron que él junto con su esposa, engañados de que si les iban a cancelar con la creencia que firmaban una opción de venta, firmaran el traspaso de su propiedad según escritura 305 visible a folio 153 vuelto del tomo 21 del protocolo del licenciado Nombre03 e inscrita en el Registro de la Propiedad, partido Guanacaste matricula folio real y para mantenerlos en error el imputado Nombre06 le entregó dos letras de cambio, una para ser cancelada el día cinco de enero de dos mil catorce por un monto de cincuenta millones de colones (¢ 50.000.000,00) y otra a cancelar el día cinco de agosto de dos mil catorce por un monto de ciento treinta y un millones seiscientos catorce mil colones (¢ 131.614.000,00), siendo que a la fecha el encartado no le ha cancelado.

Décimo quinto: Para terminar de obtener un beneficio patrimonial indebido para si el encartado Nombre06 el día veintinueve de noviembre de dos mil trece en San José, ante la notaria Yiell Flores Madrigal, según escritura 316 visible a folio 193 frente del tomo cuarto de su protocolo, hipotecó la propiedad del ofendido [Nombre 010] por diez millones de colones (¢ 10.000.000,00) a favor de [Nombre 026]. Décimo sexto: Los ofendidos y actores civiles [mbre09 0 003], [Nombre 012], [Nombre 004], [Nombre 006],[mbre09 0 005], [Nombre 010] y [mbre09 0 019], sufren no solo una afectación de carácter patrimonial sino también sufre una afectación de carácter emocional, siendo que se ven alteradas sus capacidades de sentir y percibir producto de los hechos descritos provocando sentimientos de temor angustia, cólera e impotencia ante la acción de los justiciables, traducidos en un evidente daño moral, aunado a ello por el hecho de tener que acudir a un proceso como el presente tedioso y largo, en busca de hacer valer sus derechos en su carácter personal." (Ver legajo de acción civil y sentencia de folios 1421 vuelto a 1425 vuelto).

En todo momento el vínculo del acusado Nombre03, es dentro del reclamo civil por su participación conjunta dentro del plan delictivo elaborado por los tres acusados, con plena distribución de funciones, sin embargo, cuando posteriormente una vez desarrollado el contradictorio y establecido que las acciones de Nombre03, no constituyen delito, se le condena en relación al reclamo civil por ejercer su labor notarial de manera descuidada, cuando en relación con este acusado se indicó: "en cuanto al notario Nombre03, por cuanto no obstante no reunir las condiciones de autor , ni cómplice, por no atender sus obligaciones como notario, descuidando o no atendiendo los derechos de los ofendidos como parte de los contratos de compra venta que autorizó, obligaciones que le eran inherentes por su función de notario, que debía velar por la legitimidad de los actos que autorizaba, lo que permitió que se concretara el engaño y más luego el beneficio patrimonial indebido de mbre03, , y más adelante quizá la pérdida de las fincas por parte de los ofendidos, con todos los demás daños materiales y el moral que se han indicado; es por ello que habiendo aportado los tres a la producción de los daños que sufren y sufrirán los ofendidos, lo procedente es que los tres solidariamente concurran a sufragar a los actores civiles los mencionados daños." (Ver folio 1478).

Se tiene entonces una propuesta fáctica por parte del actor civil por un hecho doloso en el plano penal, que no se demuestra en relación con la acción penal, Nombre03 es absuelto, pero si condenado en lo civil, por una acción culposa (actuar con descuido), esto riñe de manera grosera con el principio de congruencia y el derecho de defensa, en el tanto la estrategia defensiva se construye a partir de la imputación de una acción dolosa penalmente, pero a pesar de ser absuelto por ella se le condena por una acción culposa que no se mencionó en los hechos demandados. Si quiere dejar claro esta Cámara que cuando se resuelve una absolutoria por la acción penal, esto no implica necesariamente que se declare sin lugar la acción civil resarcitoria de manera automática, no, en el tanto se puede condenar civilmente a una persona absuelta, en caso de responsabilidad civil extracontractual como los contemplados en el artículo 1045 del Código Civil, al igual que en supuestos de responsabilidad civil objetiva, con sus excepciones (artículo 1048 inciso 5 de Código Civil), pero dicho planteamiento no se formuló así en la relación de hechos que se indicó supra, no se explica en la sentencia que el nexo causal que une la acción de Nombre03, se derive de una actividad riesgosa, que la actividad notarial sea una considerada como propensa a causar un potencial riesgo de la población al acudir a un profesional titulado.

Por ello estima esta Cámara que se debe declarar con lugar el recurso planteado y no es procedente condenar civilmente a un demandado civil por una actividad de la cual no fue acusada ni explicado su nexo con el daño alegado sufrido por los actores civiles, en consecuencia lo que corresponde es declarar con lugar el recurso de apelación planteado, anular la sentencia impugnada en cuanto condena a Nombre03 civilmente y en su lugar por mayoría declarar sin lugar la acción civil resarcitoria planteada en contra de Nombre03.

II.Voto salvado de la Jueza Montero Mena. Aún cuando respeto profundamente el criterio de mis compañeros Jueces, debo apartarme de este, por lo siguiente: Considero que la Acción Civil decretada en contra del justiciable Nombre03, fue debidamente sustanciada por el a quo, y además de que dicha vinculación se logra a través de un correcta interpretación de la materia civil que rige ese tipo de procesos, puesto que a pesar de que se haya dictado una sentencia absolutoria efectivamente persistía la responsabilidad civil. Resulta relevante considerar que jurisprudencialmente el dolo civil se ha establecido como: " toda aserción de lo que es falso o disimulación de lo verdadero, cualquier artificio, astucia o maquinación que se emplee por una de las partes para conseguir la ejecución del acto jurídico. El dolo determinante y dolo incidental, el primero está constituido por las maquinaciones que, en definitiva, llevan a la persona a celebrar el acto.

El incidental es aquel que no resulta determinante del acto; por tanto, no lo invalida. Sin embargo, el que lo hubiere cometido debe indemnizar a la otra parte el daño que de aquél se hubiere derivado. El dolo puede ser positivo o negativo, según que el vicio de la voluntad resulte de una acción o de una omisión fraudulenta, respectivamente.El dolo debe reunir los requisitos, para ser vicio de la voluntad: debe ser grave; determinante del otorgamiento del acto por la contraparte; debe haber causado un daño importante; no debe tratarse de dolo recíproco. Cuando reúna los requisitos expuestos, el dolo determinará la nulidad del acto (el acto será anulable, de nulidad relativa). Asimismo, por aplicación de las reglas generales de la responsabilidad, el que hubiere incurrido en acción dolosa deberá satisfacer al perjudicado los daños y perjuicios derivados de tal acción".Voto N° 032-2015. En este caso, considero que el dolo civil, se acreditó pues a partir de las acciones llevadas a cabo por el justiciable, las víctimas finalmente dispusieron de su patrimonio, siendo su participación determinante para viciar la voluntad de los comparecientes en el otorgamiento de actos que finalmente beneficiaron económicamente a los imputados.

En igual sentido el Tribunal Contencioso Administrativo, Sección Cuarta, a las ocho horas del diez de abril de dos mil quince, ha dicho: " [...]. En efecto, en materia de contratación se denomina dolo todo medio artificioso que se emplea para engañar e inducir a una persona a consentir en un contrato. Para que el dolo sea causa de nulidad debe provenir del contratante contrario al que ha sido víctima del engaño. La esencia está en el engaño, la falsa promesa, la exageración de esperanzas o beneficios, produciéndose un consentimiento viciado. Vemos entonces que los medios artificiosos de los que se vale una persona, para engañar a otra pueden ser tanto de acción como de omisión, es decir dolo positivo o negativo. El dolo positivo consistiría en un arte o maniobra que excedan los límites de la astucia que acostumbran emplear todos los contratantes, y dolo negativo según Nombre18 será callar un defecto o anomalía".

A pesar de que como en este caso se haya dispuesto, el dictado de una sentencia absolutoria, ello no releva a los juzgadores de analizar los hechos, según los principios informadores de la responsabilidad civil extracontractual, y la existencia de un daño resarcible, por cuanto, entratándose de lo relativo a la acción civil resarcitoria, a pesar de que está es accesoria de lo penal debe regirse por lo dispuesto en las normas generales del Código Civil. En este caso la condenatoria civil se fundamentó en el mismo evento investigado, entendido, como ilícito civil, por lo que la manera en la que finalmente resolvió el Tribunal, resulta correcta, y es por ello es que no procede anular esa parte de la sentencia. Al respecto, la Sala Casación Penal, ha considerado: "(...) la responsabilidad civil es independiente de la comisión de un ilícito:“Conforme a este orden de ideas, ha indicado la jurisprudencia que: “... es perfectamente viable el que sin un injusto penal, proceda la condena por responsabilidad civil, siempre que se cumpla con la exigencia de que haya otra fuente normativa distinta del ordenamiento penal que permita tal cosa...”, (fallo # 619, de 11:20 horas del 9 de junio de 2000.

Ver en igual sentido, # 1130, de 9:18 horas del 23 de noviembre de 2001, ambas de esta Sala Tercera). La fuente normativa requerida, se encuentra en el presente caso en el régimen de responsabilidad extracontractual contenido en el Código Civil, partiendo de su artículo 1045. Sobre este tópico, la Sala Primera de la Corte Suprema de Justicia ha manifestado, que: “... La responsabilidad extracontractual recae sobre quien, fuera de toda relación contractual previa, ha causado un daño en la esfera jurídica de otro sujeto, por culpa, o a través de la puesta en marcha de una actividad riesgosa o creación de un riesgo social. Esta responsabilidad no nace del incumplimiento de un vínculo determinado, sino de la violación del deber general de no dañar a los otros. Su régimen está basado en los artículos 1045, 1046, 1047 y 1048 del Código Civil. El primero de ellos dispone que: "Todo aquel que por dolo, falta, negligencia o imprudencia causa a otro un daño, está obligado a repararlo junto con los perjuicios".- Principio que es fundamento de toda responsabilidad civil (...) De esta forma... para acoger un reclamo de responsabilidad como el de marras, debe quedar fehacientemente demostrado: a) La existencia del daño o perjuicio, los cuales deben ser ciertos, reales, efectivos; b) La magnitud objetiva del daño, es decir, el reclamo debe ser merecedor de amparo, pues si es insignificante la protección jurídica no procede; c) El causante del daño haya sido un tercero en relación con el afectado; d) La relación de causalidad entre el daño y el actuar ilícito que se alega lo origina...

", (Resolución # 320, de 14:20 horas del 9 de noviembre de 1990). Ahora bien, debe aclararse (porque en este punto parece versar el yerro de los Juzgadores de instancia) que los caracteres definitorios de la culpa en sede civil, no son idénticos a los que rigen a su homónima en términos de responsabilidad penal, pues el ordenamiento jurídico vigente no considera delictiva toda imprudencia o negligencia causante de daño a un tercero (piénsese verbigracia, en el tipo penal de “daños”, que no admite su comisión a modo de culpa). En la propia decisión de la Sala Primera se aclara, que: “... la culpa supone un actuar negligente, descuidado, imprevisor que causa un daño sin quererlo… La culpa consiste, entonces, en una falta de cuidado, precaución y diligencia exigibles. La diligencia se ha considerado como la racional y ordinaria cautela que debe acompañar a todos los actos de los que puedan derivarse daños, según la clase de actividad de que se trate y la que puede y debe esperarse de persona, normalmente razonable y sensata, perteneciente a la esfera técnica del caso.

Es decir, si la persona obró con el cuidado, atención o perseverancia exigibles y con la reflexión necesaria con vistas a evitar el perjuicio de bienes ajenos, jurídicamente protegidos. Incluso, la doctrina indica que la diligencia obligada no abarca sólo las precauciones y cuidados ordenados en cada caso por los reglamentos, sino también toda la prudencia precisa para evitar el daño”, (ver voto Nº 53 de las 15:10 horas del 27 de mayo de 1998. En el mismo sentido los números 17 de las 15:00 horas del 29 de enero de 1992 y 398 de 16:00 horas del 6 de junio del 2001). Es por eso, que en distintos antecedentes la Sala Tercera ha insistido en que el hecho generador de la responsabilidad civil es el daño ocasionado y no en el carácter delictivo de la conducta.” Resolución número 2006-00087, de las 15:15 horas, del 13 de febrero de 2006. En cuanto al principio de accesoriedad de la acción civil sobre la penal, se ha establecido que: “…La frase ‘cuando proceda’, contenida en el párrafo tercero del artículo 40 del Código Procesal Penal debe necesariamente interpretarse en el sentido de que, a pesar de la absolutoria penal, el tribunal puede pronunciarse sobre la acción civil cuando subsistan otros supuestos normativos distintos al delito en los cuales pueda sustentarse ese deber de indemnizar.

Es decir, cuando los hechos acreditados sean suficientes para demostrar la existencia de responsabilidad civil, sin necesidad de que la norma sustantiva que genera la obligación de indemnizar el daño proceda del Derecho Penal, y sin necesidad de que se demuestre la responsabilidad penal o administrativa de un funcionario público determinado. La anterior interpretación es la única posible a derivar de los principios de Economía Procesal e Interpretación Restrictiva, en consonancia con nuestro ordenamiento constitucional, con el único requisito de que debe concederse al demandado oportunidad de defensa…”. A lo que habrá que añadirse que tales supuestos normativos pueden provenir de una responsabilidad civil contractual, o extracontractual, como en este caso. Admitir lo contrario implicaría, como también lo entendió esta Cámara en el mismo precedente citado, violentar el principio constitucional de justicia pronta y cumplida, resultando un absurdo remitir a la parte, que ha ventilado su conflicto en sede penal acuda nuevamente al aparato judicial en resguardo de sus derechos (...).

Así las cosas, al considerar esta juzgadora que los jueces de instancia se basaron en la existencia de un vínculo causal entre el accionar del demandado civil y el resultado producido, la responsabilidad civil se acreditó. El hecho de que Nombre03 asesorara notarialmente a los ofendidos, de manera irregular, lo cual hizo que tomaran disposiciones patrimoniales leoninas a sus intereses, en supuestas ventas de propiedades, que eran sumamente valiosas y de las cuales en la mayoría de casos perdieron sus inmuebles, es motivo suficiente para declarar con lugar la acción civil.

I ll.- El Licenciado Víctor Herrera Flores en representación del encartado Nombre06, promovió recurso de apelación en contra de la sentencia 156-2014(sic.), dictada por el Tribunal Penal del Segundo Circuito Judicial de la Zona Atlántica, sede Pococí, en la que se condenó al encartado Nombre06 por el delito de Estafa. Primer Motivo por errónea y escasa valoración de la prueba. Destaca que el tribunal inicia justificando su sentencia con argumentos como que los ofendidos son personas de escasos recursos económicos y baja escolaridad, además de que fueron convencidos de vender sus fincas, aspecto que no es cierto, ya que su representado Nombre06 únicamente le hizo una oferta al señor [Nombre09 001], el resto de ofendidos de iniciativa propia ofrecieron vender sus fincas, pero hacia ellos no hubo oferta alguna. También fueron los ofendidos quienes pusieron el precio de ocho millones por hectárea en la zona, el tribunal menciona de una oferta extraordinaria, pero esta nunca existió.

Se menciona que solo los ofendidos cumplieron mientras que el acusado Nombre06 no lo hizo, lo cual no es cierto, este encartado ofreció letras de cambio como garantía de pago, al incumplirse el primer pago de la compraventa lo que correspondía era ejecutar las garantías, por el incumplimiento. Otro de los argumentos erróneos que destaca el Tribunal en su sentencia es que no hubo dinero como pago inicial, común en este tipo de negocios, lo cierto es que hay gran cantidad de negocios en los que no necesariamente hay dinero, además de que el pago inicial se realizaría un mes después de firmar los traspasos, sea casi de inmediato. El Tribunal resalta la falta de credibilidad de la letra de cambio como instrumento de crédito, sin embargo, es un instrumento vigente y legal, por lo que su uso es acorde a derecho, por más que al Tribunal no le guste. Considera que la interpretación de la negociación por parte del tribunal es inadecuada, en el tanto se le exige al encartado Nombre06 tener el dinero necesario en sus cuentas al momento de hacer las negociaciones, aspecto que estima es absurdo, pues si así hubiera sido no se negociaría utilizando crédito.

Por otra parte, el encartado en ningún momento tuvo el dolo de estafar a los ofendidos, ya que tuvo la total disposición de devolver cada una de las fincas a sus propietarios originales, sin embargo, solo el señor [Nombre09 001] aceptó la devolución que efectivamente se realizó, todos los demás lo que querían era el dinero, no las fincas, sin embargo, la obtención del negocio no se pudo concretar porque en su momento se ordenó la prisión preventiva del encartado, pero su intención siempre fue poder cumplir con los ofendidos. Para el recurrente es un grave error la confusión que muestra el Tribunal de juicio en su sentencia cuando equipara la letra de cambio con un cheque sin fondos, figuras comerciales que son totalmente distintas y de las cuales el recurrente expone las diferencias. Solicita que ante las inconsistencias destacadas y la errónea valoración de la prueba se declare con lugar el recurso planteado y se ordene la ineficacia del fallo, se disponga el reenvío respectivo para una adecuada sustanciación del proceso.

(Ver recurso de folios 1507 a 1523) El Licenciado Jorge Matamoros Guevara en representación del encartado Nombre01 ha promovido formal recurso de apelación en contra de la sentencia 156-2014(sic.) dictada por el Tribunal Penal del Segundo Circuito Judicial de la Zona Atlántica, sede Pococí, en los siguientes términos: Primer Motivo: Inexacta apreciación de los elementos de prueba recibidos. Estima el recurrente que el Tribunal realiza una inadecuada valoración de los medios de prueba recibidos en la fase de contradictorio. Destaca que lejos de hacer un análisis de la prueba testimonial recibida, el Tribunal se limita a realizar una transcripción de los hechos acusados por el Ministerio Público, careciendo el fallo de cualquier rigor de orden analítico. Incluso la prueba ni siquiera es contrastada en sus contradicciones, siendo de interés que el testigo Nombre19 es quien realiza los ofrecimientos de compra, pero en juicio afirma una situación diametralmente opuesta.

Resalta que el Tribunal omite valorar y pronunciarse sobre dicho testimonio y se limita a transcribir lo dicho por el testigo sin indicar si lo avaló o lo desacredita, falencia que se muestra en el resto de la prueba testimonial, sin embargo, es más evidente en el caso del testigo Nombre19 porque es un testigo esencial de los hechos propuesto en su momento por el Ministerio Público. En relación con la prueba documental, a pesar de que se contó con estudios registrales actualizados el Tribunal no logró detectar que las propiedades de cuatro de los ofendidos, [Nombre09 021], [Nombre09 004] y [Nombre09 015], nunca fueron traspasados, no tuvieron perjuicio, sino que lo único que mostraban eran anotaciones caducas que no tiene vigencia alguna, en el caso de [Nombre09 004] no tiene anotación alguna, aspecto que se hubiera notado si se realiza tan solo un análisis superficial de la prueba. Otro error se evidencia en el análisis de las letras de cambio, cuando se menciona que se libraron sin contenido económico, aspecto que es lógico, porque ninguna letra requiere contenido económico, sino que por su naturaleza comprende un compromiso de pago que se hará a partir de una fecha indicada en el documento.

Se deja de tomar en consideración que las letras incluso al día de hoy son ejecutables por la vía de cobro y pueden ser anotadas sobre las fincas que tiene a su Nombre09 Nombre06, por lo que no es cierto que no tuvieran validez alguna. Otra inadecuada interpretación que hace el fallo, según el recurrente es de la participación del acusado Nombre17, mientras en una parte de la sentencia se le refiere como socio de Nombre06 en otro apartado se le refiere como intermediario entre Nombre06 y los ofendidos, situación que no queda clara. Inexactitudes más notorias se presentan con la interpretación y aplicación de los tipos penales, en especial en relación con la estafa, en el tanto en ningún momento existió perjuicio patrimonial para los ofendidos, y al menos en cuatro ofendidos ya indicados, nunca salieron las propiedades de su poder. Por lo anterior solicita se revoque la sentencia impugnada y se absuelva a su representado de toda pena y responsabilidad penal, de manera subsidiaria se ordene el reenvío respectivo para que se resuelva conforme corresponde y aclarando las contradicciones evidenciadas.

(Ver recurso de apelación de folios 1530 a 1544) Se resuelven estos recursos, tanto el del Lic. Víctor Herrera Flores como el Lic. Jorge Matarrita de manera conjunta por ser los temas conexos entre sí. Los reclamos son atendibles. Hay varios aspectos que el tribunal de juicio introduce dentro de su análisis de la fundamentación jurídica y los tipos penales que no pueden ser compartidos por esta Cámara, en especial porque se debe respetar el criterio de las personas en la forma de negociar, siempre y cuando esté permitido por el ordenamiento jurídico, no importa si es poco común. Al iniciar su análisis el Tribunal de juicio indicó: "Los hechos que se han tenido aquí por acreditados constituyen conductas típicas por estar descritas en normas penales como conductas prohibidas, concretamente los artículos 216 inciso 2) del Código Penal, denominada Estafa, que sanciona con pena a quien haciendo incurrir en error a otra persona, por medio de la simulación, de la deformación, o el ocultamiento de hechos verdaderos, lesione el patrimonio ajeno para obtener un beneficio patrimonial antijurídico para sí o para un tercero; lo mismo que Fraude de Simulación, previsto en el artículo 218, que sanciona al que en perjuicio de otro para obtener cualquier beneficio indebido, hiciere un contrato, un acto, gestión o escrito judicial simulado, siendo esas precisamente las conductas que aquí se acreditó fueron realizadas, por Nombre03 con la ayuda de Nombre17 o Nombre17 y el sumas millonarias en un plazo muy breve fueron determinados a entregar mediante un contrato traslativo de dominio sus fincas en favor del imputado Nombre03, quien casi de inmediato procedió a disponer de las mismas enajenándolas sin pagar un cinco a los ofendidos, y en el caso de [Nombre09 019], traspasando a su pareja Nombre15 la finca que había adquirido de [Nombre09 019], sin pagarle un cinco a esta, y luego Nombre15 la hipotecó a Nombre20, que se la adjudicó mediante remate, siendo que Nombre15 ni siquiera visitó en oportunidad alguna la mencionada finca, y menos entró en posesión de la misma, solo concurrió a firmar la aceptación de la venta y luego la hipoteca; también resultan típicas por reunir los elementos objetivos y subjetivos de ambos tipos penales; veamos: RESPECTO DEL DELITO DE ESTAFA: INDUCIENDO A ERROR: Los ofendidos todos, campesinos, sencillos, con escasa o ninguna educación formal, algunos sin siquiera saber leer o escribir, pobres, muy pobres, de avanzada edad la gran mayoría, fueron convencidos de vender sus fincas, por las cuales recibirían altas sumas de dinero, cercanas y aún superiores en algunos casos a los doscientos millones de colones, ofrecimiento que dadas sus condiciones socio económicas, les pareció la gran oportunidad de sus vidas, pues tal situación les permitiría cambiar toda su vida de pobreza y miserias, lo mismo que de sus familias, y posiblemente morir en condiciones más dignas, véase que por sus condiciones, especialmente por su pobreza, y que los fenómenos climatológicos que afectan la zona de Guanacaste, especialmente la parte más alta incluyendo La Cruz, lugar de asentamiento de sus fincas, era muy poco lo que habían logrado producir de riqueza con las mismas; esto hizo que ante semejante oferta, decidieran vender sus tierras, las que les había otorgado años atrás el Instituto de Desarrollo Agrario, IDA, hoy INDER, precisamente para ayudarles a labrarse una mejor situación de vida; para estas sencillísimas personas, las sumas de dinero que se les ofreció pagar por sus fincas, resultó un cebo imposible de resistir, y todos corrieron a vender sus fincas, Nombre17, les dijeron que había alguien que les compraría sus fincas, y aún sin conocer al comprador, que resultó ser el encartado Nombre06, que ni siquiera se presentó a conocer o recorrer las fincas, su estado, sus límites o linderos, estuvieron de acuerdo en venderle, tal era de buena la oferta en sus circunstancias, algunos de los ofendidos el mismo día en que se les dijo que les comprarían la finca salieron de su lugar de residencia en la zona de Cuajiniquil de la Cruz en Guanacaste hasta Guápiles, Pococí, provincia de Limón, al otro lado del país, llegando incluso en horas de la noche, para vender su finca, LA OFERTA RESULTO (sic.) ASI DE IRRESISTIBLE.

Es verdad que algunos de los ofendidos manifiestan que al momento de firmar en la oficina del imputado Nombre03 creyeron que lo que firmaban era una opción de compra, pero finalmente todos aceptan que estuvieron de acuerdo en vender sus fincas. Vender y comprar terrenos es una actividad lícita, llevan en eso razón los abogados defensores. Pero a los ofendidos no se les pagó al momento de vender sus fincas un solo cinco, sino que se les entregó dos letras de cambio, con la promesa de que la primera, por cincuenta millones de colones (el mismo monto en todos los casos) les sería pagada aproximadamente un mes después de realizado el traspaso, y la segunda por el resto del valor de la venta (que se consignó en todos los casos era por apenas 2,5 millones de colones) se les cancelaría seis meses después. En su sencillez los ofendidos creyeron como cierta la promesa de pago y aceptaron vender fincas a Nombre06 MEDIANTE LA SIMULACION DE HECHOS FALSOS U OCULTANDO VERDADEROS: Es precisamente la forma de pago el medio utilizado para hacer incurrir en error a los ofendidos, pues en la misma el imputado y su ayudante Nombre17, con el concurso del notario Nombre03, incurren en la simulación de hechos falsos u ocultación de hechos verdaderos, siendo que las circunstancias ,y la prueba concretamente, permiten acreditar SIN LUGAR A DUDAS, que Nombre06 NUNCA TUVO EL PROPOSITO O VOLUNTAD DE CANCELAR SUMA ALGUNA DE DINERO A LOS OFENDIDOS POR SUS FINCAS.

Los hechos así lo demuestran. Tal como lo sostienen los mismos abogados defensores, el contrato de compra se perfecciona con el simple acuerdo entre cosa y precio, eso es cierto. Por eso el contrato de compra venta como tal es un acto legítimo; tan solo que en este caso, una de las partes, los vendedores, cumplieron con su parte del contrato, traspasar su propiedad a Nombre06, pero Nombre03 ni pagó, ni ha pagado, ni tiene el propósito de pagar las sumas correspondientes a los vendedores por sus fincas. La práctica comercial nos enseña que al momento de comprar una finca, se paga al vendedor al menos una parte del valor de la venta, y el pago de la parte restante se garantiza con hipoteca en primer grado, de forma que el vendedor pueda perseguir la misma finca si su comprador no honra el pago de la parte insoluta; claro está que no existe impedimento alguno para que en el acto de vender y comprar no se pague suma alguna, PERO ELLO NO ES LA PRACTICA COMUN; en este caso tal situación aparece fuera de toda lógica por las condiciones económicas de los ofendidos, que siendo personas muy pobres no tenían las condiciones como para dar crédito a su comprador, y por el contrario acredita la mala fe del encartado Nombre06 en el negocio; porqué no se respaldó a los ofendidos con una garantía hipotecaria sobre sus propias fincas para que ante una falta de pago por las compras estuvieran cubiertos?

En su defensa los imputados sostuvieron que fue a petición de los ofendidos, porque significaba el pago de gastos para los que los ofendidos no contaban con dinero para sufragarlo" (ver folios 1465 vuelto a 1467 frente). Es cierto que se está entre ofendidos que tienen recursos económicos y académicos limitados, pero eso no les impide que dentro de la negociación que en su momento les interesó, pudieran elegir realizar una compra y venta con pago condicionado a crédito y en tractos, garantizando su transacción con garantía otorgada mediante letras de cambio, tanto el tipo de negocio a crédito, como el uso de garantías mediante letras de cambio, son situaciones mercantiles totalmente válidas vigentes dentro de nuestro ordenamiento jurídico, que las ofendidos eligieran no utilizar garantías hipotecarias con el fin de ahorrar el pago de impuestos de inscripción es posible y también permitido, los contratantes no están obligados a siempre usar la garantía hipotecaria.

Tampoco es viable imponer a una persona que compra un bien a crédito, tener dinero que respalde su transacción, cuando se indica: "Por qué, porque una letra de cambio cuyo pagador no tenga dinero con el cual pagar las mismas, SON SOLO PAPELES." (Ver folios 1468 vuelto). En realidad en una transacción mercantil, en la que se use una garantía de pago, como hipoteca, cédula hipotecaria, letra de cambio, pagaré, etc, no se le exige al deudor que demuestren tenencia de dinero en sus cuentas para garantizar el pago de la transacción, se le otorga un plazo a convenir para que una vez que tenga la liquidez económica pueda realizar el pago prometido. En realidad estos argumentos, resumidos como parte de una fundamentación jurídica no pueden ser admitidos, por ser contrarios al propio ordenamiento jurídico, que sea arriesgado es una situación que quedará a elección de las personas que intervienen, pero eso no elimina su legalidad, por ello la fundamentación expuesta es insuficiente, violentando de manera grosera el artículo 142 del Código Procesal Penal, debiendo ser declarados con lugar ambos recursos, se anula la sentencia impugnada lo mismo que el debate que la precedió y con el fin de que se realizada una fundamentación acorde a derecho, se ordena el juicio de reenvío para lo que en derecho corresponda. El juicio de reenvío versará sobre la totalidad de la acción penal planteada en contra de los acusados Nombre01 y Nombre06, la absolutoria del acusado Nombre03 se mantiene invariable.

IV.El Lic. Abraham Chaves Acuña, en su condición de representante de los actores civiles y la Oficina de Defensa Civil de la Víctima, presentó recurso de apelación en contra de la sentencia número 156-2014(sic.), dictada por el Tribunal Penal del Segundo Circuito Judicial de la Zona Atlántica sede Pococí, en los términos que se describen a continuación. Primer Motivo. Violación al debido proceso. No comparte el recurrente el criterio del Tribunal de declarar con lugar la condenatoria civil pero remitir a las partes a la vía civil en defensa de sus derechos, por existir derechos de terceros que son discutibles, además de no declarar la falsedad instrumental de los traspasos de las fincas de los ofendidos y regresarlas a sus propietarios originales. Tampoco comparte el recurrente el criterio de que admitiendo a los terceros se desnaturaliza el proceso penal, por el contrario para el recurrente, es un deber del tribunal dar el derecho de audiencia y participación de quienes se pueden ver afectados en sus derechos.

Destaca, por otra parte la mayoría de las fincas fueron hipotecadas en favor del señor [Nombre09 026], quien si participó con querella y acción civil pero fue excluido por el Juez Penal, además de que la no aplicación del artículo 491 afecta en forma clara a los ofendidos quienes no pueden ir a otro proceso por sus limitaciones económicas y esa interpretación en la sentencia pone en riesgo definitivo sus propiedades. Considera que si bien existen derechos de terceros que merecen ser tutelados, no pueden superar los derechos de quienes tenían absoluto derecho sobre las propiedades que le pertenecían, además de que les resulta sumamente onerosos acudir a la vía ordinaria civil para reclamar la defensa de sus derechos, estimando injusto que por una omisión que puede corregirse se le atiende los derechos a los terceros sin que se desnaturalice el proceso penal. Segundo Motivo: Errónea aplicación de la ley sustantiva.

Estima que el Tribunal al dictar su sentencia y específicamente en relación con los honorarios en favor de la Oficina de la Defensa Civil de la Víctima, equivocada la interpretación del artículo 266 del Código Procesal Penal, por cuanto a pesar de que condena una parte en abstracto si establece un monto líquido y exigible en cuanto al daño moral. Explica que la condena en abstracto fue por el daño material, pero en relación con el daño moral el Tribunal le concedió a siete de los ofendidos, diez millones de colones a cada uno por concepto de daño moral, para un total de setenta millones de colones, por lo que se le debe conceder el 20 por ciento sobre 15 millones de colones y sobre el exceso sea 55 millones debe calcularse el quince por ciento, el monto adecuado por concepto de costas en relación con el monto concedido debe ser de once millones doscientos cincuenta mil colones. Solicita se declare con lugar el presente recurso de apelación, ordenándose el reenvío en el que debe dársele el derecho de audiencia a los posibles afectados, y de esta forma dilucidar la tutela de los derechos de propiedad relacionados con las fincas objeto de este recurso para que se conozca solamente de la solicitud de declaratoria de falsedad instrumental, por lo que solicita que se mantenga incólume la sentencia en cuanto a los aspectos civiles y penales, y por razones de economía procesal se declare la falsedad instrumental de las hipotecas concedidas en favor del señor [Nombre09 026] y se conceda el monto correcto por concepto de honorarios en favor de la Oficina de la Defensa Civil de la Víctima, según el decreto de honorarios vigente para la fecha de los hechos.

(Ver recurso de folios 1524 a 1529). Se resuelven ambos motivos de manera conjunta por tener relación entre sí los temas planteados. Los reclamos son atendibles. Son varios temas de interés que ha planteado la representación de la parte actora civil por medio de la Oficina de Defensa Civil de la Víctima y para ordenar el trato de cada uno de los planteamientos se subdivide este considerando de la siguiente forma: A.- Sobre el derecho de audiencia. Hay varias apreciaciones que el tribunal de juicio realizó en el momento de rechazar la solicitud de los actores civiles de declarar la falsedad instrumental de las escrituras que afectaron sus intereses en relación con las fincas que se traspasaron en su momento en favor de Nombre06 , al respecto se refirió: "SOBRE LA SOLICITUD DE DECLARATORIA DE FALSEDAD INSTRUMENTAL: Las partes interesadas deberán acudir a la vía civil a dilucidar la tutela de los derechos de propiedad relacionados con las fincas objeto de este proceso con vista de lo aquí resuelto, para lo cual se mantendrán las anotaciones realizadas en los asientos registrales hasta por diez años, mientras se resuelve en dicha vía lo correspondiente, en atención a la existencia de terceros con intereses legítimos o tutelables.

Al analizar esta petición del abogado de la defensa civil de la víctima el Tribunal encuentra una situación bastante compleja; no nos queda duda que los negocios de compra venta por haber sido realizados con engaño son fraudulentos, puesto que se hicieron a sabiendas de que el comprador, Nombre06 no contaba con dinero para pagar el precio acordado por las mismas, y se recurrió a otorgar a los ofendidos dos letras de cambio sin contenido económico que las respaldara, únicamente como el medio para lograr que los ofendidos consintieran en entregar sus tierras a Nombre06 y así obtener luego un beneficio patrimonial indebido, indebido porque nunca honraría el pago del precio acordado, y la garantía de pago que otorgó a los campesinos es un título espúreo por no contar el comprador ni con el dinero ni con otros bienes sobre los cuales hacer efectivas dichas letras de cambio; esto es suficiente motivo para disponer la anulación de las escrituras respectivas, excluyendo como ya se indicó el caso de [Nombre09 001] a quien se le devolvió su finca; sin embargo, al haber hipotecado las fincas de inmediato a terceros, gravámenes hipotecarios que constan en las escrituras de hipotecas de folios 17, 42, 63, 82, 146 y 177 anotados en los asientos de inscripción registrales de las fincas, lo que también es es(sic.) posible observar de la consulta actualizada al Registro Público que constan a folios del 1191 al 1207; para resolver este punto debe respetarse el debido proceso como terceros con intereses legítimos que pudieran ser tutelados, o sea, haber traído al proceso a dichos terceros, lo cual no se hizo, pero que de haberse hecho habría significado la desnaturalización del proceso penal que nos ocupa por la naturaleza de los derechos y las acciones correspondientes a unos y otros interesados; no conocemos cual es el estado de dichos créditos hipotecarios, si se han presentado o no ejecuciones, y de haberse presentado debería determinarse en qué tipo de proceso debe resolverse la cuestión, en el caso de [Nombre09 019] deberá determinarse si la ejecución hipotecaria de la que dan fe las anotaciones que constan registralmente han cumplido con el debido proceso a ella como poseedora actual de los terrenos y también existe un proceso penal abierto en contra de Nombre15 que desconocemos cual ha sido su suerte.

Es notorio que los derechos de los ofendidos sobre sus fincas se han tornado derechos litigiosos, que por la naturaleza de los mismos deben ser conocidos en la vía civil ordinaria, con el llamamiento de todos los que pudieran tener intereses merecedores de una posible tutela judicial. Lo más prudente es entonces estarse a lo dispuesto en el numeral 491 del Código Procesal Penal y disponer que este aspecto sea dilucidado en la vía civil, donde lo conocido en este proceso y sentencia se convertirá en un insumo para lo que deba resolverse al respecto. No puede el Tribunal resolver este punto sin haber dado audiencia a los terceros anotantes. Llama poderosamente al Tribunal y no queremos dejar de señalarlo, el hecho de que según han narrado todos los ofendidos, sin excepción, a las fincas y casas de los ofendidos hasta los días en que depusieron en debate, NUNCA SE HA PRESENTADO UNO SOLO DE LOS HOY ACREEDORES HIPOTECARIOS, ni para conocer las fincas y su naturaleza, ni para saber quiénes tienen en posesión o porqué los terrenos, que ha quedado acreditado, con el dicho de los ofendidos, con el dicho de los imputados, con el dicho de Nombre17, que continúan en posesión de los ofendidos, y solo esta posesión ya debe analizarse como objeto de tutela en la vía jurisdiccional; tampoco alguno solo de los imputados ha sido notificado de la existencia de una acción cobratoria civil como terceros poseedores, ni aún [Nombre 019], según su dicho, en cuyo caso consta en la consulta del Registro Público visible a folio 1200 que su finca se habría ya adjudicado al alemán Nombre20, por haberla rematado por falta de pago de la hipoteca que le impuso Nombre03 a través de Nombre15; nos preguntamos cómo es que tal cosa ocurrió si [Nombre09 019], sigue manteniendo la posesión de la finca, y ella dice desconoce todo respecto de esa adjudicación.

Los acreedores hipotecarios de Nombre03 concurrieron a manifestar que estarían dispuestos a cambiar las garantías con tal de que se le devolviera su libertad, incluyendo al señor [Nombre 026], como consta a folio 382 y 484, incluso autodenominándose "presunto acreedor" en un escrito autenticado por la misma abogada y notaria que realizó todas las hipotecas, excepto una ¿? El caso más llamativo es el de [Nombre 026], que al igual que en los demás casos, indican los ofendidos que no ha visitado Cuajiniquil , ni alguna de las fincas, no obstante que según las copias de las hipotecas que constan en el expediente en los folios ya citados, y las consultas del Registró Público de folios 1191 a 1207 habría otorgado créditos a Nombre03 por más de cien millones de colones, hipotecando las fincas de varios de los aquí ofendidos. Nos preguntamos ¿cómo es que alguien presta semejante cantidad de dinero sin ver el bien que le servirá de garantía, sin conocer su estado, su naturaleza, su condición, cómo es que han pasado más de dos años desde que otorgó en apariencia dichos créditos y no consta por ningún lado que haya presentado cobro alguno por esos créditos, conociendo, como ha quedado acreditado, que Nombre03 no tenía dinero como para honrar dichos créditos?

Claro que no desconocemos que el señor Nombre21 se presentó a este proceso intentando ser tenido como damnificado y querellante con ocasión de dichos créditos, pero hasta allí. Nos preguntamos ¿será acaso que había un grupo detrás del señor Nombre06, interesado en hacerse con esas tierras con la ayuda de Nombre06? El imputado inició su declaración indicando que esas tierras se las habían solicitado Nombre22 y Nombre23. Es posible que el señor [Nombre09 026] sea tan solo un tercero de buena fe, el Tribunal no puede graciosamente conductas ilegítimas, pero ante los datos indicados, nos es obligado y nos parece saludable solicitar al Ministerio Público se avoque a investigar si es posible que actuara en contubernio con los imputados Nombre24 y otras personas interesadas en hacerse con los terrenos de los campesinos de Cuajiniquil. Es por ello que se ordenará adicionar la parte dispositiva de esta sentencia en este tanto y en relación con el señor [Nombre09 026].(ver folios 1478 frente a 1479 vuelto)".

Es cierto que el derecho de audiencia de los terceros es parte necesaria para que puedan ejercer la defensa de sus derechos, en aplicación del debido proceso, conforme lo establece el artículo 39 de la Constitución Política, pero eso no implica que deba separarse sus intereses del proceso penal, porque contrario a lo que razona el Tribunal de juicio, para esta Cámara el legislador ha ido acomodando las figuras procesales necesarias para que dentro del proceso penal se puedan realizar los reclamos civiles correspondientes, esto por medio de la figura de la acción civil resarcitoria, contemplada en los artículos 37 a 41 del Código Procesal Penal y cuyo ejercicio se establece a partir de los artículos 111 a 124 del mismo cuerpo legal, eso permite contemplar los derechos resarcitorios sin desnaturalizar el proceso penal. Estos argumentos son claros en relación con quienes se apersonan al proceso en defensa de sus derechos, como es el caso de los ofendidos representados por la Oficina de la Defensa Civil de la Víctima, pero eso no quiere decir que sean las únicas personas que se puedan ver afectadas por el delito, este concepto es más amplio porque también debe contemplarse los derechos de los damnificados y terceros de buena fe , que no han reclamado civilmente, pero que tienen derecho a ser escuchadas dentro del proceso y que se les informe del mismo en protección de sus derechos conforme lo indica el numeral 70 del Código Procesal Penal, que textualmente indica: "Artículo 70.- Víctimas Serán consideradas víctimas: a) La persona directamente ofendida por el delito. b) El cónyuge, la persona conviviente con más de dos años de vida en común, el hijo o la hija, la madre y el padre adoptivos, los parientes dentro del tercer grado de consanguinidad o el segundo de afinidad y el heredero declarado judicialmente, en los delitos cuyo resultado sea la muerte del ofendido. c) Las personas socias, asociadas o miembros, respecto de los delitos que afecten a una persona jurídica, cometidos por quienes la dirigen, administran o controlan. d) Las asociaciones, fundaciones y otros entes que tengan carácter registral, en los delitos que afecten intereses colectivos o difusos, siempre que el objeto de la agrupación se vincule directamente con esos intereses.

(Así reformado por el artículo 16 de la Ley de Protección a Víctimas, Testigos y demás intervinientes en el Proceso Penal N° 8720 de 4 de marzo de 2009)". El contemplar la participación de estas partes no implica tampoco desnaturalizar el proceso penal, de hecho la protección de los derechos de las víctimas, directas e indirectas del delito, no altera en lo absoluto el proceso penal, por el contrario el interés del legislador es protegerlos. Esto permite que teniendo participación los acreedores que facilitaron dineros con garantías sobre las fincas de interés en esta causa, se puedan incluir dentro del concepto de damnificados del delito o terceros interesados de buena fe, cuyos derechos se pueden proteger dentro de este mismo proceso sin que tenga que acudir a otro distinto. Por ello para el juicio de reenvío todos los acreedores o personas que se vean afectadas por la nulidad instrumental de las escrituras deben ser llamadas al proceso para que tengan oportunidad de defensa de sus derechos, debiendo asumir el proceso en el estado en que se encuentre, esto con el fin de que no tengan que acudir a otro proceso y así hacer efectivo el principio de tutela judicial efectiva que contempla el numeral 41 de la Constitución Política, por ello se declara con lugar el reclamo y se anula la sentencia en lo relativo a la acción civil resarcitoria. b.- Sobre las costas en razón de sentencia. En vista de haberse aceptado la primera parte del recurso, se omite pronunciarse por innecesario sobre las costas .

V. SOBRE LA MEDIDA CAUTELAR

Siendo que esta Cámara está anulando la sentencia impugnada y el ordenado el juicio de reenvío en contra de los encartados Nombre01 y Nombre06, se considera necesario prorrogar la medida cautelar de prisión preventiva del acusado Nombre06, con el fin único de garantizar su presencia en el juicio de reenvío, por lo que de conformidad con lo dispuesto en el numeral 258 del Código Procesal Penal, se prorroga la media cautelar de prisión preventiva vigente por SEIS MESES, desde el 5 de noviembre 2016 hasta el 05 de mayo de 2017.-

POR TANTO:

Se declaran con lugar los recursos de apelación planteados con las siguientes consecuencias procesales: Por mayoría se anula parcialmente la sentencia impugnada en relación con la acción civil resarcitoria, la cual se declara sin lugar en contra del encartado Nombre03. La Jueza Montero Mena salva el voto. Por unanimidad se anula la sentencia impugnada y el juicio que la precedió en contra de los acusados Nombre01 y Nombre06, en contra de quienes se ordena el juicio de reenvío para ante el tribunal de origen para que con nueva integración resuelva lo que en derecho corresponda. La absolutoria del encartado Nombre03 se mantiene invariable. Se anula también la sentencia en lo referente a la acción civil resarcitoria planteada en contra de Nombre17 y Nombre25. Se prorroga la prisión preventiva del encartado Nombre06 por el plazo de SEIS MESES, contados a partir del el 5 de noviembre 2016 hasta el 05 de mayo de 2017.
