This Tribunal hears, in its capacity as non-hierarchical superior (jerarca impropio), the appeal filed by Ms. Nombre105271, holder of identity card CED81942, against official letter N°IC-228-2016 issued on 6 de mayo del 2016 by the Intendencia del Concejo de Distrito de Cóbano. Nombre100376, holder of identity card CED27160, participates as an intervenor in support (coadyuvante), representing ASOCIACIÓN PARA LA CONSERVACIÓN Y DESARROLLO DE LA COMUNIDAD DE MONTEZUMA (ASOMONTE), legal entity identification number CED76669.- Judge Chaves Torres drafts the decision; and,

WHEREAS:

I.Proven facts. The following are deemed proven facts of relevance:

  • 1)On 15 de abril del 2013, Ms. Nombre105271 filed an application with the Concejo del Distrito de Cóbano seeking recognition of resident status (condición de poblador) in the “comunidad de Montezuma de Cóbano.” (See folio 18 of the administrative case file submitted by the Intendente del Concejo del Distrito de Cóbano).
  • 2)On 22 de abril del 2016, because she had received no response to the application described in the preceding fact, the appellant informed the respondent body that, having submitted all documents required to be deemed an occupant or resident (ocupante o poblador), she was invoking affirmative administrative silence (silencio positivo), governed by the Ley General de la Administración Pública, artículos 330, 331 y 340, as well as Ley 8220. (See folios 15 and 16 ibídem).
  • 3)On 6 de mayo del 2016, through official letter N° IC-228-2016, the Intendencia del Concejo Municipal de Distrito decided to reject the application of affirmative administrative silence, finding that the request to qualify “...under the status of occupant or resident does not meet all the requirements necessary for granting the relief requested; furthermore, affirmative administrative silence does not apply in the Maritime-Terrestrial Zone (Zona Marítimo Terrestre) (Sala Constitucional, Votos 2658-93 y 5559-96, Tribunal Contencioso Administrativo, Sección Segunda, N°307-98 y dictamen C-230-97)...”. (See folios 09 through 14 ibídem).
  • 4)On 2 de junio del 2016, Ms. Nombre105271 filed with the same municipal authority a motion for reconsideration with a subsidiary appeal (recursos de revocatoria con apelación en subsidio) against official letter IC-228-2016. The motion for reconsideration was denied by the local authorities, and the appeal was forwarded to this Tribunal for adjudication. (See folios 1 through 8 ibídem).-

II.Arguments of the appellant: By way of summary, without prejudice to the comprehensive review conducted of all arguments presented, the grounds for challenge (motivos de impugnación) raised in the appeal are as follows: contrary to artículos 70 y 44 de la Ley 6043, the municipal authority imposes the additional requirement of legal adulthood in order for a person to be considered an occupant or resident when ley 6043 entered into force, an interpretation with which the appellant states she disagrees; and she has lived in Montezuma since her birth in 1964, that is, thirteen years before the law entered into force. (See folio 8 of the administrative case file). For its part, counsel for the intervening Asociación concludes that the respondent body must comply with the mandate imposed upon it by the Constitución Política and the Código Municipal, which, among other duties, assigns it “...the obligation to contribute to the constant aspiration of improving the quality of life of its inhabitants (municipal residents)... and, more than accepting affirmative administrative silence, the Concejo Municipal del Distrito de Cóbano must duly and deservedly recognize all residents and occupants of Montenzuma and Cabuya, who succeeded in building, over more than 80 years, a community that now enjoys international renown for its hospitality, generating regional and national wealth...”. (See submission filed on 9 de setiembre del 2016 and incorporated into the electronic case file).-

III.Regarding the specific case. As a preliminary matter, it must be clarified that the municipal appeal under “non-hierarchical review” (jerarquía impropia) or “non-hierarchical oversight” (control no jerárquico) is conducted by this Tribunal pursuant to artículo 181 de la Ley General de la Administración Pública and is limited to reviewing the legality of the Administration’s actions within the scope of the grievances (agravios) asserted by the appellant and duly developed in the appellate brief. Consequently, the grievances constitute a central element of challenges before this forum, since they provide the basis upon which the Non-Hierarchical Reviewing Authority (Contralor no Jerárquico), which is responsible for hearing the appeal, may analyze whether the decision should be annulled or modified. Accordingly, the decision of the lower authority is reviewed in light of the appellant’s arguments challenging the factual and legal grounds upon which the contested decision rests.

To perform this review, it is essential that the appellant specifically challenge the arguments presented by the lower authority on which its decision rests factually and legally. In this case, the Concejo Municipal del Distrito de Cóbano based its rejection of the requested application of affirmative administrative silence on two grounds: the inapplicability of affirmative administrative silence to the petition due to the substantive law involved—the Maritime-Terrestrial Zone and environmental law—and the failure to satisfy the requirements of the original application—recognition as a resident and/or occupant. In this regard, it must be specified that administrative silence is deemed affirmative when expressly established as such, or when the matter concerns authorizations or approvals that must be granted in the exercise of supervisory and protective functions, and when it concerns permits, licenses, and authorizations (artículo 331 de la Ley General de la Administración Pública).

Within its scope of application in favor of regulated parties (administrados), the enabling administrative act (acto administrativo habilitante) entails the preexistence of a subjective right (derecho subjetivo), legitimate interest (interés legítimo), or mere tolerance by the Administration (simple tolerancia de la Administración), the exercise of which is subject to prior compliance with the requirements imposed by the legal system. For this reason, numeral 80 del Código Municipal provides that the “municipality must decide license applications within a maximum period of thirty calendar days, counted from their filing. Once that period has expired and the requirements have been met without any response from the municipality, the applicant may commence the activity.” This provision is consistent with the content of artículo 331 de la Ley General de la Administración Pública; thus, the affirmative administrative silence provided for here may be enforced by applying the relevant provisions of Ley N°8220, because ordinal 7 de la Ley de Protección al ciudadano del exceso de requisitos y trámites administrativos N°8220 is fully consistent with the provisions of the Ley General de la Administración Pública and further develops the same legal doctrine (instituto), namely affirmative administrative silence, in relation to the same factual circumstance.

Indeed, its text expressly limits its application to the “...granting of permits, licenses, or authorizations, once the time allowed by the legal system for the Administration to issue a decision has expired without a decision having been rendered, they shall be deemed approved...”, the purpose of which is to eliminate an unfounded situation of legal uncertainty (incerteza jurídica). Given the exceptional nature of this doctrine, the general rule is that the Administration’s silence is deemed negative, except in those cases expressly specified by ordinary legislation. Nevertheless, the implied administrative act (acto administrativo presunto) arising from affirmative administrative silence must comply with the body of legality (bloque de legalidad), because the absence of its essential prerequisites means that no such act exists, even if the responsible body or official fails to issue a decision within the established time limits.

In this case, the appellant did in fact file, in abril del 2016, an application whose clear purpose was to assert affirmative administrative silence in the processing of her recognition or certification as a resident and/or occupant before the Concejo Municipal del Distrito de Cóbano, given the passage of time without action on the application she had filed in abril del 2013. This Chamber finds that, before analyzing the requirements of the application to determine whether affirmative administrative silence could have arisen and reviewing the merits of the subject matter of the application, priority must be given to determining whether, in light of the previously cited provisions (LGAP, Código Municipal y Ley N°8220), that doctrine formally applies to the application filed by the appellant. In this context, the administrative act that remains pending must result in the Administration acting upon an application for a permit, license, or authorization, which is not the case here, since what the applicant seeks is recognition of a status, quality, or characteristic that would distinguish her from other applicants with respect to the right to a concession (derecho de concesión) as an occupant, or from other possessors of property located in the Maritime-Terrestrial Zone as a resident.

Therefore, strictly speaking, that act is not a license, permit, or authorization within the meaning of the cited provisions, and the doctrine of affirmative administrative silence consequently does not apply to it. This is sufficient reason to affirm the rejection of affirmative administrative silence issued by the Intendente Municipal del Distrito de Cóbano in official letter N°IC-228- del 6 de mayo del 2016.

IV.In view of the inapplicability of positive administrative silence (silencio positivo) analyzed in the preceding recital (considerando), the Municipal Council of the District of Cóbano must rule on the initial application submitted by the appellant and verify whether, in this matter, the requirements established by the legal system (ordenamiento jurídico) for declaring the status of “occupant” (ocupante) or “settler” (poblador) have been met. In this regard, this Section has consistently applied the criteria developed in Voto N°265-2013, namely, that such statuses—settler and occupant—may be declared after the enactment of Ley 6043 and that, in such a situation, they constitute “declaratory administrative acts” (actos administrativos declarativos)—that is, with ex tunc effect—which attest to the existence of a factual or legal situation that preexisted and had become established when the respective act was issued.

It is plainly indisputable that, in cases such as this one, recognition of the status of settler or occupant is NOT a constitutive administrative act (acto administrativo constitutivo)—that is, one with ex nunc effect. Logically, the declaration of a preexisting situation must be based on compliance with the requirements established by the legal system at the time the declared legal situation became established. Thus, just as the requirement of having inhabited the respective strip of the maritime-terrestrial zone (zona marítimo terrestre) for a certain period must be established as of the effective date of Ley 6043, so too—and with even greater reason—must the other requirements, such as the absence of other properties registered in the applicant’s name, be assessed in light of the circumstances existing when that law entered into force, and not as of the date on which the interested party submitted the application.

Finally, regarding the requirement invoked by the Municipal Council of the District of Cóbano, based on the nonbinding legal opinion of the Procuraduría General de la República, number OJ-088-2008, that opinion incorrectly equates the concepts of legal capacity (capacidad jurídica)—the capacity to hold rights, which every human being possesses—with capacity to act (capacidad de actuar)—the autonomous exercise and disposition of rights. In this regard, the Procuraduría General de la República held as follows: “Nor would it be appropriate to recognize settler status for persons born after 1949, because when Ley 6043 entered into force, those persons were required not only to have occupied the land for more than ten years, but also to have reached the age of majority by then in order to exercise such occupation. To verify the foregoing, certification from the Registro Civil concerning the interested party’s date of birth will be required.

The occupants’ use of the restricted zone must likewise predate Ley 6043 and must have occurred while they were adults. It would therefore be improper to recognize that status for persons born after 1959, and that circumstance must likewise be verified through the corresponding birth certificate.” (Procuraduría General de la República, Opinión Jurídica O.J.-088-2008). However, this Court’s position, based on Articles 31 and 36 of the Código Civil concerning existence and capacity, is that although minors—in most cases—cannot directly assert or “negotiate” rights and obligations and require a representative for that purpose under the terms established by the legal system, it is equally true that minors DO possess full legal capacity to be subjects to whom legal consequences are attributed or, more simply, to hold rights recognized by the body of applicable law (bloque de legalidad).

V.Mandatory exhaustion of administrative remedies (agotamiento preceptivo de la vía administrativa) in cases involving Municipal District Councils: In view of the characteristics of this proceeding, which concerned a procedure for the mandatory exhaustion of administrative remedies before a Municipal District Council rather than before a municipal entity as such, it has been deemed appropriate to reiterate this Chamber’s findings in voto 612-2015. In that decision, this Section held: “To date, this Section has on several occasions questioned the existence of mandatory exhaustion of administrative remedies in proceedings involving Municipal District Councils—bodies that are not municipal entities—when imposed through legislation. In this regard, this Chamber has previously held: ‘Moreover, a brief observation should now be made regarding mandatory exhaustion in municipal matters. The Sala Constitucional has determined that it is applicable only in the two circumstances that, in its view, are governed by the Constitución Política itself.

Accordingly, and given this Section’s inability to submit a judicial constitutional consultation (consulta judicial de constitucionalidad), the question is hereby raised as to the constitutional validity of extending, through statutory provisions, a mandatory appeals regime (régimen recursivo preceptivo) to Municipal District Councils when, in the Chamber’s view, that regime is limited to municipalities’ (Tribunal Contencioso Administrativo, Sección Tercera, voto 275-2014).”

VI.Corollary. Based on the reasoning set forth above, the appeal is denied, and the decision under appeal is affirmed for the reasons stated. The Municipal District Council must rule on the appellant’s application after verifying the existence of the requirements identified in recital IV.

THEREFORE

The appeal is denied, and the challenged decision is consequently affirmed for the reasons stated. The Municipal Council of the District of Cóbano shall take note of recital IV and proceed to rule on the pending application.

CONSIDERANDO:

I.Hechos probados. Se tiene como hechos probados de relevancia, los siguientes:

  • 1)Que el 15 de abril del 2013, la señora Nombre105271 presentó en el Concejo del Distrito de Cóbano una gestión tendiente al reconocimiento de la condición poblador, en la "comunidad de Montezuma de Cóbano". (Ver folio 18 del expediente administrativo aportado por la Intendente del Concejo del Distrito de Cóbano).
  • 2)Que el 22 de abril del 2016, la persona apelante dado que no obtuvo respuesta de la gestión descrita en el hecho anterior, le manifiesta al órgano recurrido que por haber presentado todos los documentos para que se le tuviese como ocupante o poblador se acoge al silencio positivo, regulado en la Ley General de la Administración Pública, artículos 330, 331 y 340, asi como en la Ley 8220. (Ver folios 15 y 16 ibídem).
  • 3)Que el 6 de mayo del 2016, con oficio N° IC-228-2016 la Intendencia del Concejo Municipal de Distrito decide rechazar la aplicación del silencio positivo por considerar que la solicitud de acogerse "...a la figura de ocupante o poblador no cumple con todos los requisitos necesarios para el otorgamiento de lo solicitado, adicionalmente no es de aplicación el silencio positivo en Zona Marítimo Terrestre (Sala Constitucional, Votos 2658-93 y 5559-96, Tribunal Contencioso Administrativo, Sección Segunda, N°307-98 y dictamen C-230-97)...". (Ver folios 09 al 14 ibídem).
  • 4)Que el 2 de junio del 2016, la señora Nombre105271 , presenta ante la misma autoridad municipal, recursos de revocatoria con apelación en subsidio contra el oficio IC-228-2016, resultando rechazada la impugnación horizontal por parte de las autoridades locales, se elevó la apelación para ser conocida por este Tribunal. (Ver folios 1 al 8 ibídem).-

II.Alegatos de la parte recurrente: A manera de síntesis, sin perjuicio de la lectura integral que se ha hecho del total de las argumentaciones vertidas, los motivos de impugnación expuestos en el recurso de apelación, son los siguientes: que contrario a lo que establecen los artículos 70 y 44 de la Ley 6043, la autoridad municipal establece un requisito adicional de mayoridad para ser considerado como ocupante o poblador al momento de entrada en vigencia la ley 6043, interpretación que se alega no compartir, y que ha vivido en Montezuma desde su nacimiento en 1964, es decir trece años antes de entrar en vigencia la ley. (Ver folios 8 del expediente administrativo). Por su parte la representación de la Asociación coadyuvante concluye que el órgano recurrido, le corresponde cumplir con el mandato que le impone la Constitución Política y el Código Municipal que entre otras funciones le atribuye "...la obligación de contribuir con la constante aspiración del mejoramiento de la calidad de vida de sus habitantes (munícipes)... y mas que aceptar un silencio positivo le corresponde al Concejo Municipal del Distrito de Cóbano, brindar el debido y meritorio reconocimiento a todos los pobladores y ocupantes de Montenzuma y Cabuya, quienes lograron levantar, desde hace mas de 80 años, una comunidad que hoy resuena internacionalmente por su hospitalidad generando riqueza regional y nacional...".(Ver escrito presentado el pasado 9 de setiembre del 2016, incorporado en el expediente electrónico).-

III.Sobre el caso concreto. De previo se debe aclarar que la apelación municipal en "jerarquía impropia" o "control no jerárquico" es desarrollada por este Tribunal a la luz del artículo 181 de la Ley General de la Administración Pública, limitándose a revisar la legalidad de lo actuado por la Administración dentro del límite de los agravios expresados por la parte recurrente debidamente desarrollados en el líbelo recursivo. Por consiguiente, los agravios resultan en un elemento medular de las impugnaciones en esta sede, toda vez que con base en ellos el Contralor no Jerárquico, a quien corresponde conocer del recurso pueda analizar si cabe anular o modificar lo resuelto. En este orden se revisa lo dispuesto por el inferior, según los argumentos de la parte apelante que combatan los fundamentos fácticos y jurídicos en los cuales se cimienta la resolución objeto de recurso. Resulta indispensable, para poder efectuar esa labor de control, que los argumentos vertidos por el inferior, en los cuales hace descansar fáctica y jurídicamente su resolución, sean atacados de manera concreta por el recurrente.

En la especie el Concejo Municipal del Distrito de Cóbano, con la resolución impugnada fundamenta el rechazo a la aplicación del silencio positivo solicitado, en dos pilares, en la inaplicabilidad del silencio positivo a la petición en razón del derecho de fondo -zona marítimo terrestre y derecho ambiental-, y el incumplimiento de los requisitos en la gestión original -reconocimiento de poblador y/o ocupante-. En este orden es menester precisar que el silencio se entiende positivo cuando así se establezca expresamente, o cuando se trate de autorizaciones o aprobaciones que deban acordarse en el ejercicio de funciones de fiscalización y tutela y cuando se trate de permisos, licencias y autorizaciones (artículo 331 de la Ley General de la Administración Pública). En el ámbito de aplicación a favor de los administrados el acto administrativo habilitante, comprende la preexistencia de un derecho subjetivo, interés legítimo o simple tolerancia de la Administración, cuyo ejercicio queda sujeto al previo cumplimiento de los requisitos exigidos por el ordenamiento jurídico.

Por esta razón, el numeral 80 del Código Municipal, establece que la "municipalidad deberá resolver las solicitudes de licencia en un plazo máximo de treinta días naturales, contados a partir de su presentación. Vencido el término y cumplidos los requisitos sin respuesta alguna de la municipalidad, el solicitante podrá establecer su actividad". Esta norma concuerda con el contenido del artículo 331 de la Ley General de la Administración Pública, de modo que el silencio positivo aquí previsto, se puede ejecutar en aplicación de las normas que al respecto contiene la Ley N°8220, ya que lo dispuesto en el ordinal 7 de la Ley de Protección al ciudadano del exceso de requisitos y trámites administrativos N°8220, es completamente coincidente con lo regulado en la Ley General de la Administración Pública y establece un desarrollo del mismo instituto (silencio positivo) relacionado con el mismo supuesto de hecho, veáse que textualmente enmarca su aplicación al "...otorgamiento de permisos, licencias o autorizaciones, vencido el plazo de resolución otorgado por el ordenamiento jurídico a la Administración, sin que esta se haya pronunciado, se tendrán por aprobadas...", cuyo objetivo es suprimir una situación infundada de incerteza jurídica.

Debido a la excepcionalidad de esta figura, la regla general es que el silencio de la Administración se entiende negativo, salvo los casos expresamente indicados por la ley ordinaria. Sin embargo, el acto administrativo presunto que surge a la luz del silencio positivo debe ser conforme con el bloque de legalidad, pues ante la ausencia de sus presupuestos esenciales supone la inexistencia del mismo, aunque el órgano o funcionario encargado no se pronuncie dentro de los plazos establecidos. En este caso se tiene que efectivamente la parte recurrente presentó en abril del 2016, una gestión con el objetivo claro de hacer valer el silencio positivo en la tramitación del reconocimiento o acreditación de poblador y/o ocupante ante el Concejo Municipal del Distrito de Cóbano, considerando el transcurso del tiempo sin que se hubiese atendido su gestión presentada en abril del 2013. Es criterio de ésta Cámara que antes de analizar los requisitos de la gestión, para que se pudiese configurar el silencio positivo y fiscalizar la materia de fondo sobre la que versa la gestión, es prioritario determinar si a la luz de las normas previamente citadas (LGAP, Código Municipal y Ley N°8220) le resulta aplicable formalmente dicho instituto (silencio positivo) a la gestión presentada por la persona apelante.

En este contexto se tiene que el acto administrativo que esta pendiente de ser emitido, debe tener por consecuencia la atención por parte de la Administración de una solicitud de permiso, licencia o autorización, lo cual no se configura en la especie, ya que la persona gestionante lo que espera es el reconocimiento de una condición, cualidad o característica que le estaría diferenciando de otros solicitantes con respecto al derecho de concesión (ocupante) o bien de otros poseedores de bienes ubicados en la zona marítimo terrestre (poblador), por lo que dicho acto no es en sentido estricto una licencia, permiso o autorización, en los términos de las normas citadas y por ende no le resulta aplicable el instituto del silencio positivo, razón suficiente para confirmar el rechazo del silencio positivo dictado por la Intendente Municipal del Distrito de Cóbano en su oficio N°IC-228- del 6 de mayo del 2016.

IV.En virtud de la inaplicabilidad del silencio positivo analizada en el considerando anterior, deberá el Concejo Municipal del Distrito de Cóbano, resolver la gestión inicial presentada por la persona apelante y verificar si en este asunto se cumplen los requerimientos establecidos por el “ordenamiento” jurídico para declarar la condición de “ocupante” o de “poblador”. En este sentido ha sido criterio reiterado de esta Sección los presupuestos desarrollados en el Voto N°265-2013, y que dichas condiciones -poblador y ocupante-, pueden ser declarados con posterioridad a la emisión de la Ley 6043, y que en tal situación se está frente a “actos administrativos declarativos” –es decir con efectos ex tunc-, que acreditan la existencia de una situación fáctica o jurídica –preexistente y consolidada al momento del dictado del respectivo acto-. Resulta abiertamente incontrovertible que en casos como el presente la acreditación de la condición de poblador o de ocupante, NO es un acto administrativo constitutivo – es decir con efectos ex nunc-.

Lógicamente, la declaración de una situación preexistente, se fundamentará en el cumplimiento de los requisitos establecidos por el “ordenamiento” jurídico al momento de la consolidación de la situación jurídica declarada. Así de igual modo que el requisito de haber habitado la respectiva franja de la zona marítimo terrestre durante un período de tiempo, debe acreditarse al momento de la entrada en vigencia de la Ley 6043, igualmente y por mayoría de razón los demás requisitos como el de la inexistencia de otras propiedades a nombre de la persona solicitante también deben revisarse a la luz del momento de la entrada en vigencia de la referida ley, y no a la fecha de la presentación de la solicitud por parte del interesado. Finalmente, en cuanto al requisito sostenido por el Concejo Municipal de Distrito de Cóbano, fundamentado en la opinión jurídica –no vinculante- de la Procuraduría General de la República número OJ-088-2008, la cual asimila equivocadamente los institutos de la capacidad jurídica –ser titular de derechos- que posee todo ser humano, con el de la capacidad de actuar –ejercicio autónomo y disposición de derechos-.

En esta dirección la Procuraduría General de la República consideró lo siguiente: “Tampoco cabría reconocer la condición de poblador a quienes hubiesen nacido con posterioridad a 1949, pues al entrar a regir la Ley 6043 esas personas no sólo debían tener una ocupación superior a la decenal, sino además, contar para entonces con la mayoría de edad para ejercerla. Para corroborar lo anterior será necesaria la certificación del Registro Civil sobre la fecha de nacimiento del interesado. El uso de la zona restringida por parte de los ocupantes también debe ser anterior a la Ley 6043 y como sujetos mayores de edad. Por ello, resultaría impropio reconocer esa figura a quienes hubiesen nacido después de 1959, debiéndose verificar igualmente esa circunstancia a través de la constancia de nacimiento respectiva”. (Procuraduría General de la República, Opinión Jurídica O.J.-088-2008). Sin embargo es criterio de este Tribunal que con base en los artículos 31 y 36 del Código Civil, relativos a la existencia y la capacidad, si bien las personas menores de edad -en la mayoría de los casos-, no pueden hacer valer o “negociar” derechos y obligaciones directamente, requiriendo para tal efecto de un representante en los términos regulados por el “ordenamiento” jurídico, no menos cierto es que las personas menores de edad SÍ cuentan con plena capacidad jurídica para constituirse como centros de imputaciones normativas, o en palabras más simples, ser titulares de derechos reconocidos por el bloque de legalidad.

V.Del agotamiento preceptivo de la vía administrativa en el caso de los Concejos Municipales de Distrito: En razón de las características del presente procedimiento, el cual se enmarcó en un trámite de agotamiento preceptivo de la vía administrativa ante un Concejo Municipal de Distrito y no ante un ente municipal propiamente dicho, se ha estimado conveniente reiterar lo considerado por esta Cámara en el voto 612-2015. En dicha resolución esta Sección consideró: “A la fecha ya esta Sección en diversas oportunidades ha cuestionado la existencia de un agotamiento preceptivo de la vía administrativa en procedimientos relativos a Concejo Municipales de Distrito -órganos que no son entes municipales, ello mediante regulación de rango legal. En esta dirección ya esta Cámara ha considerado: "Por otra parte, cabe ahora hacer una breve consideración respecto del tema del agotamiento preceptivo en materia municipal.

La Sala Constitucional ha determinado que esta es solo procedente en los dos supuestos que a su criterio, están regulados en la propia Constitución Política. Por lo anterior, y dada la imposibilidad de esta Sección de gestionar una consulta judicial de constitucionalidad, se procede a dejar sentada la interrogante relativa a la regularidad constitucional de que mediante normas de rango legal, se extienda a los Concejos Municipales de Distrito un régimen recursivo preceptivo, que a criterio de la Sala está restringido a los municipios" (Tribunal Contencioso Administrativo, Sección Tercera, voto 275-2014)”.

VI.Corolario. Con base en la argumentación expuesta, se rechaza el recurso de apelación interpuesto, siendo que se confirma la resolución venida en alzada por las razones dadas, y debe el Concejo Municipal de Distrito proceder a resolver la gestión de la persona apelante verificando la existencia de los requisitos señalados en el considerando IV.

POR TANTO

Se declara sin lugar el recurso y por ende se confirma por las razones dadas la resolución impugnada. Tome nota el Concejo Municipal del Distrito de Cóbano del considerando IV y proceda a resolver la gestión pendiente de ser atendida.
