CONSIDERING
I.The Court adopts proven facts 1 through 5 because they are supported by the evidence in the record. However, it does not adopt facts 6 and 7 in view of what will be decided at this level.
II.The finding that there are no unproven facts relevant to deciding this matter is not approved, because at this level the following is found: Actual and effective possession exercised before or since the year one thousand nine hundred seventy-four. (there is no evidence establishing it)
IV.The State’s representative brings her appeal based on the following grounds of error (agravios): 1) The challenged judgment finds that ten-year possession before the effective date of Decree No. 15436-MAG of 30 March 1984 was established through documentary evidence, by applying Article 4 of the Ley de Informaciones Posesorias. However, that type of evidence is not appropriate because that provision states that a conforming survey plan of the land must be submitted, which was not done. This is because deed No. 12588 of 18 August 1980—that is, six years after the date by which possession had to be demonstrated—describes land measuring 6988.96 square meters, while plan No. C-1563085-2'012 shows an area of 8500 square meters. Deeds numbers 114, 416 and 163 describe land measuring 9938.5 square meters. This evident lack of correspondence prevents the identity of the parcels from being established under the terms of Article 4.
The basis for acquiring the excess 1511.14 or 2949.54 square meters is not explained. This was neither analyzed nor justified in the judgment. The Tribunal Agrario has so held in decisions 140-F-2015, 1108-F-12, 654-F-07, 755-F-03. 2) The statements contained in deed 12588 cannot be treated as evidence of the duration of possession, pursuant to the Tribunal’s precedents No. 621-F-14, 493-F-13 and 282-F-13. In light of the foregoing, the judgment must be reversed.
V.Article 6 of the Ley de Informaciones Posesorias establishes that proof of ten-year possession (posesión decenal) for obtaining title through this mechanism shall be established by the testimony of three witnesses, who must be residents of the canton in which the property is located, precisely to ensure that they are suitably able to attest to that factual possessory situation (situación posesoria de hecho). However, in the case of a protected wild area (área silvestre protegida), regardless of its management category (categoría de manejo), Article 7 of that body of law emphatically prescribes that the title applicant (titulante) must demonstrate that he or she holds—whether personally or derivatively—the legal rights to the ten-year possession exercised at least ten years before the law or decree designating that area took effect. Furthermore, Article 4 of that same law provides that if a public deed (escritura pública) documenting acquisition of the property is submitted and more than ten years have elapsed, testimonial evidence (prueba testimonial) shall not be necessary.
In light of the foregoing, this Court considers that the provision in Article 4 should not be interpreted separately from Article 7, because testimonial evidence is essential to establish a factual situation that will form the basis of the substantive right (derecho de fondo) permitting recognition of a right of ownership ad usucapionem over the property. It should be noted that the property itself falls within the public domain (dominio público), such that if the applicant seeks to invoke the exception established in Article 7 to obtain title to property located in an area of that nature, the applicant must ultimately provide clear and detailed proof addressing the factual elements necessary to satisfy the special requirement of that provision, making testimonial evidence essential. Documentary evidence (prueba documental) may certainly supplement the body of evidence and, depending on the particular circumstances of the case, may serve to reinforce the age of the right established through testimony, as judicial inspection (reconocimiento judicial) may also do on occasion; however, this does not mean that such documentary evidence constitutes the core evidence, since it is well known that a person may hold a document that is unsupported by any actual possessory conduct.
Accordingly, this Court does not agree with the a quo’s determination that assessing the testimonial evidence introduced into the proceedings was entirely unnecessary. In this case, after examining the testimonial evidence under the principle of unity of evidence (principio de unidad de la prueba) and the principle of free assessment of evidence (principio de libre valoración) set forth in Article 54 of the Ley de Jurisdicción Agraria, the Court concludes that the exercise of ten-year possession predating the Decree at issue, No. 15436-MAG del 5 de junio de 1984, which designated that territory as Zona Protectora Río Navarro-Río Sombrero, was not established so as to permit title to be granted over property that, in principle, belongs to the public domain. It is true that the petitioner is a relatively recent possessor, having acquired the property through public deed No. 163 del 17 de abril del 2008, executed before Notary William Cordero Navarro, from [Nombre3] (image 69 of the electronic trial-court record displayed as a single document); nevertheless, it had to be conclusively established that his predecessors had exercised those possessory acts (actos posesorios) since at least año1974, given that the Decreto Ejecutivo, as stated above, dates from 1984.
It was not enough to establish possession during the last ten years, or even during the last thirty years; rather, the entirety of that continuous possession over the last forty-two years had to be established. Thus, although the witness [Nombre4] stated that he was seventy-five years old and had known the property for fifty years, the only fact he clearly conveyed was that the petitioner had possessed it for eight years, stating that the petitioner acquired it from [Nombre5], who may have held it for more than five years. At most, therefore, he had personal knowledge of approximately 13 years of possession and of the acts carried out by the petitioner, but he could not identify the previous owners, much less the genuine and effective possessory acts they may have performed; indeed, he did not even explain what acts the aforementioned [Nombre5] may have carried out. In any event, it is noteworthy that he stated that the petitioner acquired the property from [Nombre5], which contradicts deed No. 163 del 17 de abril del 2008, executed before Notary William Cordero Navarro, showing that [Nombre3] sold the property to the petitioner, [Nombre1].
The testimony of [Nombre6] is likewise deficient because, despite stating that he was seventy years old and had known the property since he was twelve, and describing a chain beginning with [Nombre7], followed by [Nombre8], who later sold to [Nombre3], and finally the petitioner, he did not specify the nature of the possessory acts of [Nombre7], [Nombre9], and [Nombre3], nor did he make any temporal reference to possession during the 1970s, describing only the petitioner’s acts. He did agree with the preceding witness that [Nombre3] held it for approximately five years and that the petitioner had held it for the same period, but those were not the only years that had to be established; rather, the substance of the possession exercised since 1974 had to be shown, as has repeatedly been stated. The inadequacy of his testimony is further highlighted when compared with the documentary evidence, since according to deed No. 416, executed before Notary Tatiana Fernández Mora del 25 de octubre del 2002, [Nombre3] acquired the property from [Nombre10], [Nombre11], [Nombre12], [Nombre13], [Nombre14], [Nombre15], [Nombre16], and [Nombre17], all [Nombre18], and not from [Nombre8].
Likewise, [Nombre19] provided the fewest elements to establish the longstanding possession (posesión de vieja data) required in this matter, as he stated that he had known the property for ten or twelve years. Although he stated that the petitioner purchased it from [Nombre3], he did not specify how many years [Nombre3] may have possessed it. He identified a cousin named [Nombre8] as a previous owner but did not describe what possession that person may have exercised; in any event, he emphasized that he had known the property only recently, and therefore his testimony is not suitable for establishing the entirety of the required possession or for remedying the deficiencies in the testimony of the preceding witnesses. In a different vein, the documentary evidence in the record does not establish the underlying possessory requirement, which is the fundamental basis of the possessory title proceeding (información posesoria).
This is because the oldest deed submitted is No. 12588 de las 7 horas del 18 de agosto de 1980, executed before Notary César Solano Campos, by which [Nombre20] sold the property to [Nombre3]; however, it is not a document from 1974 or earlier that could provide an initial significant indication of longstanding possession. Likewise, stating in a public deed that ten-year possession is being transferred does not prove that such possession actually occurred, since the Notary attests to the legal act, but not to the truthfulness of the parties’ statements concerning factual circumstances predating that instrument. The outcome would have been different if [Nombre20]’s possession had been established through testimony, but no witness mentioned it. In view of the foregoing, the Office of the Attorney General (Procuraduría) is correct that possession was not properly established and that documentary evidence cannot constitute the appropriate means of proof in this case.
Nevertheless, contrary to the appellant’s contention, there may be differences in area between what is conveyed by public deed as unregistered property (finca sin inscribir) and what is ultimately surveyed and recorded in the cadastre (catastra) for purposes of obtaining title, because property is sometimes transferred using approximate measurements, particularly when the transaction occurred long ago, and the important consideration is reasonable certainty that it is the same property. However, that is not the reason why this application for title should be denied; rather, it should be denied because genuine and effective possession since 1974 was not established.
IV.In accordance with the foregoing, the proper disposition is to reverse the judgment and, in its place, deny these possessory title proceedings.
POR TANTO
The judgment is reversed. In its place, these possessory title proceedings are denied.

VOTO N° 823-F-16 TRIBUNAL AGRARIO. SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ.- A las quince horas y dieciocho minutos del treinta y uno de agosto de dos mil dieciséis.- INFORMACIÓN POSESORIA promovida por [Nombre1] , mayor, divorciado, floricultor, vecino de Quebradilla de Cartago, cédula de identidad número CED1 - - . Intervienen en el proceso la PROCURADURÍA GENERAL DE LA REPÚBLICA, representada por Susana Fallas Cubero, mayor, abogada, vecina de Cartago, cédula de identidad número CED2 - - , en su condición de procuradora adjunta; y el INSTITUTO DE DESARROLLO RURAL, cédula jurídica CED3 - - - , representado por Marjorie Mayela Madrigal Muñoz, mayor, divorciada, abogada, vecina de Alajuela, cédula de identidad número CED4 - - , en calidad de apoderada generalísima sin límite de suma. Actúa como abogado director del promovente, el licenciado William Cordero Navarro, colegiado seis mil sesenta y ocho. Tramitado ante el Juzgado Agrario de Cartago.-
RESULTANDO:
Redacta la Jueza FISHER GONZÁLEZ y;
CONSIDERANDO
I.El Tribunal avala los hechos probados del 1 al 5 por ser el resultado de las probanzas que consta en autos. Sin embargo no se comparten los hechos 6 y 7 dado lo que se resolverá en esta instancia.
II.No se aprueba lo referente a la inexistencia de hechos indemostrados de relevancia para resolver este asunto siendo que en esta sede se tiene el siguiente: La posesión real y efectiva ejercida antes o desde el año mil novecientos setenta y cuatro. (no hay prueba que la acredite)
IV.La representación del Estado interpone su recurso de apelación con base en los siguientes agravios: 1) La sentencia impugnada tiene acreditada la posesión decenal previa a la vigencia del Decreto No. 15436-MAG del 30 de marzo de 1984, por medio de prueba documental, aplicando el artículo 4 de la Ley de Informaciones Posesorias. Pero ese tipo de prueba no es idónea, pues esa norma refiere debe de presentarse un plano conforme del terreno, lo cual no se cumplió. Lo anterior porque la escritura No. 12588 del 18 de agosto de 1980, es decir de seis años posteriores a la fecha que debía demostrarse la posesión, describe un terreno de 6988.96 metros cuadrados y el plano No. C-1563085-2'012 una medida de 8500 metros cuadrados. Las escrituras números 114, 416 y 163 describen un terreno de 9938.5 metros. Esa evidente falta de correspondencia impide establecer una identidad de los terrenos en los términos del artículo 4.
De los 1511.14 o 2949.54 metros cuadrados excedentes no se justifica la causa de adquisición. Ello no fue analizado ni justificado en la sentencia. El Tribunal Agrario así lo ha indicado en votos 140-F-2015, 1108-F-12, 654-F-07, 755-F-03. 2) Las manifestaciones contenidas en la escritura 12588 no pueden tenerse como elemento probatorio del tiempo de posesión según precedentes del Tribunal No. 621-F-14, 493-F-13 y 282-F-13. En razón de lo expuesto deberá de revocarse la sentencia.
V.El artículo 6 de la Ley de Informaciones Posesorias establece que la justificación de la posesión decenal para poder titular por este mecanismo se acreditará con la declaración de tres testigos, los cuales deberán ser vecinos del cantón en el que se sitúa el fundo, precisamente para velar que puedan dar fe en forma idónea de esa situación posesoria de hecho. Sin embargo, tratándose de un área silvestre protegida sea cual sea su categoría de manejo, el artículo 7 de ese cuerpo legal prescribe enfáticamente, que el titulante deberá de demostrar ser el titular (ya sea en forma personal o derivada) de los derechos legales sobre la posesión decenal, ejercida por lo menos con diez años de antelación a la vigencia de la ley o decreto en que se afectó esa área. Por otro lado, el artículo 4 de esa misma ley, dispone que si se aporta escritura pública de adquisición del bien, y han transcurrido más de diez años, no será necesaria la prueba testimonial.
Expuesto lo anterior, este Tribunal considera que esa norma del ordinal 4 no debe interpretarse en forma aislada del artículo 7, pues la prueba testimonial es fundamental a efectos de acreditar una situación de hecho, que será la base del derecho de fondo que permita declarar un derecho de propiedad ad usucapionem sobre el bien. Nótese que la materialidad queda afectada al dominio público, de forma tal que si se pretende reclamar la excepción que establece el artículo 7 para titular un bien situado en un área de esa naturaleza, en definitiva debe de demostrarse en forma clara, circunstanciada, con prueba que refiera los elementos de hecho necesarios para cumplir con el requisito especial de esa norma, lo que hace primordial la prueba testimonial. Ciertamente la prueba documental puede ser un complemento del universo probatorio, y dependiendo de las particularidades del caso puede servir para reforzar la antiguedad del derecho probado testimonialmente, lo que ocurre también en ocasiones con el reconocimiento judicial, pero ello no implica que ese elemento documental sea la prueba medular, pues es sabido se puede ostentar un documento sin ningún contenido posesorio material.
De este modo no se comparte el criterio de la a quo que era del todo innecesario valorar la prueba testimonial traída al proceso. En la especie, examinada la prueba testimonial bajo el principio de unidad de la prueba y el principio de libre valoración contenido en el artículo 54 de la Ley de Jurisdicción Agraria, se concluye que no se demostró el ejercicio de una posesión decenal anterior al Decreto que nos ocupa, No. 15436-MAG del 5 de junio de 1984, que afectó ese territorio como Zona Protectora Río Navarro-Río Sombrero, que permita autorizar la titulación de un bien en principio perteneciente al dominio público. Es lo cierto que el promovente es un poseedor relativamente reciente, ya que adquiere mediante escritura pública No. 163 del 17 de abril del 2008, ante el Notario William Cordero Navarro, de [Nombre3] (imagen 69 del expediente electrónico de primera instancia visualizado como documento único); pero debió de probarse en forma fehaciente que sus antecesores ejercieron esos actos posesorios al menos desde el año1974, toda vez el Decreto Ejecutivo como se indicó supra data de 1984.
No bastaba con probar la posesión de los últimos diez años, o incluso de los últimos treinta, sino propiamente toda esa posesión continua desde hace cuarenta y dos años. Así el testigo [Nombre4] , aunque manifestó tener setenta y cinco años de edad y conocer la finca desde hace cincuenta, lo único que logra referir con claridad es que el promovente la posee desde hace ocho años, quien indica la adquirió de [Nombre5] que la tuvo tal vez más de cinco años. Por ello a lo sumo le consta una posesión de unos 13 años así como los actos que ha realizado el promovente, pero no sabe precisar quiénes eran los anteriores dueños, ni mucho menos los actos posesorios reales y efectivos que pudieron haber desplegado, notándose incluso que no explica los eventuales actos que realizara el citado [Nombre5]. En todo caso llama la atención que indica la parte promovente adquirió de [Nombre5] , lo que contradice la escritura No. 163 del 17 de abril del 2008, otorgada ante el Notario William Cordero Navarro en la que sse aprecia que es [Nombre3] quien vende al promovente [Nombre1] .
Por su parte la declaración de [Nombre6] , también padece de insuficiencias, pues pese a declarar que cuenta con setenta años de edad y conocer la propiedad desde que tenía doce, refiriendo una cadena que inicia con [Nombre7] , luego [Nombre8] , quien después vende a [Nombre3] , y finalmente el promovente, no precisa en qué consistieron los actos posesorios de [Nombre7], [Nombre9] y [Nombre3], ni hace alguna referencia espacial a la posesión de los años setenta, solamente detalla los del promovente. Ciertamente coincide con el anterior testigo que [Nombre3] la tuvo como cinco años y el promovente igual término, pero esa cantidad de años no era la que debía demostrarse únicamente, sino el contenido de la posesión ejercida desde 1974, como reiteradamente se ha indicado. La insuficiencia de su declaración se debilita aún más cuando se confronta con la prueba documental, pues según escritura No. 416 otorgada ante la Notaria Tatiana Fernández Mora del 25 de octubre del 2002 [Nombre3] adquiere de [Nombre10], [Nombre11], [Nombre12], [Nombre13], [Nombre14], [Nombre15] , [Nombre16], [Nombre17] , todos [Nombre18] , y no de [Nombre8] .
Asimismo [Nombre19] , es el que menos elementos aporta para demostrar esa posesión de vieja data requerida en este asunto, pues manifestó conocer la propiedad desde hace diez o doce años. Aunque expone que el promovente compró a [Nombre3], no precisa los años que pudo haber poseido el citado [Nombre3] . Señala a un primo suyo de nombre [Nombre8] como anterior dueño, pero no detalla qué posesión pudo haber ejercido, y en todo caso enfatizó que conoce la finca recientemente, de ahí que su declaración no sea apta para demostrar toda la posesión requerida, o bien para complementar las insuficiencias de los anteriores declarantes. En otro orden de ideas, la prueba documental que consta en autos no permite acreditar ese presupuesto posesorio de fondo, base fundamental de la información posesoria. Lo anterior porque la escritura más antigua que se aporta es la No. 12588 de las 7 horas del 18 de agosto de 1980 ante el Notario César Solano Campos en la que [Nombre20] vende a [Nombre3] , pero no se trata de un documento de 1974 o anterior, que permita tener un primer elemento de antigüedad importante.
Asimismo el manifestar en una escritura pública que se transmite una posesión decenal no es prueba de que ésta en la realidad haya operado, toda vez el Notario da fe del acto jurídico, no así de la veracidad de las manifestaciones que hagan las partes en torno a situaciones de hecho anteriores a ese instrumento. Diferente hubiese sido si se prueba con testimonial la posesión de [Nombre20] , la cual ningún testigo refiere. En virtud de lo anterior lleva razón la Procuraduría que no se ha probado en forma idónea la posesión, y que la prueba documental no puede ser el medio procedente para este caso. Sin embargo, contrario a lo que sostiene la apelante, pueden existir diferencias de medida entre lo transmitido en una escritura pública como finca sin inscribir y lo que finalmente se catastra para titular, pues en ocasiones se pueden transar bienes con medidas aproximadas, máxime si son de vieja data, siendo lo importante que se tenga certeza razonable que es el mismo bien. Pero lo anterior no es el motivo por el cual se considera que debe de rechazarse la presente titulación, sino porque no se probó esa posesión real y efectiva desde 1974.
IV.De conformidad con lo anteriormente expuesto, lo procedente es revocar la sentencia para en su lugar rechazar las presentes diligencias de información posesoria.
POR TANTO
Se revoca el fallo. En su lugar se rechazan las presentes diligencias de información posesoria.
