SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ.- At fifteen hours and fifty-six minutes on veintinueve de agosto de dos mil dieciséis.- POSSESSORY INFORMATION PROCEEDING (INFORMACIÓN POSESORIA) filed by ANCALES DE COTO BRUS SOCIEDAD ANÓNIMA, corporate identification number CED1 - - , represented by [Nombre1] , of legal age, married once, merchant, resident of Puntarenas, identification number CED2 - - . The parties appearing are the PROCURADURÍA GENERAL DE LA REPÚBLICA (PGR), represented by Lydiana Rodríguez Paniagua, of legal age, single, attorney, resident of Alajuela, identification number CED3 - - , and the INSTITUTO DE DESARROLLO AGRARIO, currently the INSTITUTO DE DESARROLLO RURAL, corporate identification number CED4 - - - , represented by Marjorie Mayela Madrigal Muñoz, of legal age, twice divorced, attorney, resident of San Ramón, Alajuela, identification number CED5 - - .   1. 1The filing party instituted a possessory information proceeding seeking, through this procedure, the registration in the Registro Público Inmobilirio of the property described as follows: “...described in survey plan (plano) number P-1765461-2014, registered with the Catastro Nacional, as follows: Pastureland and brushland with two dwelling houses. Bounded on the NORTH by: [Nombre2] and, in part, Río Jaba; South: [Dirección1] and [Nombre3] ; East: Río Jaba, [Nombre4] and [Nombre3] ; and West: [Nombre2] and [Nombre5] , located in La Manchuria, Provincia de Puntarenas, Cantón de Coto Brus, [Dirección2] ” (folios 14 to 15, 23 to 25; and 108).-
  2. 2The PGR entered an appearance in the proceeding (folios 40 to 43). INDER did so as well but waived service of notices (folio 44).
  3. 3Judge Maricel Zamora Arias, of the Juzgado Agrario del Segundo Circuito Judicial de la Zona Sur, Corredores, ruled as follows in judgment 157-2016 of 14 de junio de 2016: “POR TANTO: The possessory information proceeding is approved. Subject to the encumbrances (afectaciones) referred to in Article 17 of the Ley de informaciones Posesorias and without prejudice to third parties having superior rights, the Registrar of the Registro de la Propiedad is ordered to register, for the first time, in the name of ANCALES DE COTO BRUS S.A., corporate identification number CED7 , with its registered office in San Vito, Coto Brus, adjacent to the El Ceibo hotel and restaurant, represented by its general attorney-in-fact with full powers (apoderado generalísimo), [Nombre1] , who is of legal age, (SIC) married once, a merchant, and a resident of San Vito de Coto Brus, identification number CED8 , the property described in the plan registered with the Catastro Nacional under number P-1765461-2014, as follows: Pastureland and brushland with two dwelling houses.Bounded on the NORTH by: [Nombre2] and, in part, Río Jaba; South: [Dirección1] and [Nombre3] ; East: Río Jaba, [Nombre4] and [Nombre3] ; and West: [Nombre2] and [Nombre5] , located in La Manchuria, Provincia de Puntarenas, Cantón de Coto Brus, [Dirección3] . The property that is the subject of this proceeding is valued at five million colones.   4. 4Procuradora Lydiana Rodríguez Paniagua filed an appeal, expressly stating the grounds on which it was based in order to refute the trial court’s position (folios 111 to 113, and 114 to 116).-

5 .- Through pleadings filed on veinte y veintitrés de junio del dos mil dieciséis (folios 111 to 113, and 114 to 116), the PGR requested a supplementation (adición) of judgment 157-2016 of 14 de junio del 2016. The ruling of 8 de julio del 2015 held: “Regarding the request for SUPPLEMENTATION of judgment 157-2016 made by the Procuradora at folio 114, pursuant to Article 158 of the Código Procesal Civil, the POR TANTO of the judgment is supplemented as follows: 1) the right-of-way width (ancho de vía) of the public road bordering the property to be titled along the [Dirección4] boundary is 14.00 meters (Articles 4 of the Ley General de Caminos Públicos and 19, subsection a, of the Ley de Informaciones Posesorias); 2) the area adjoining watercourses is a protection area (área de protección), pursuant to Article 33, subsection b, of Ley Forestal N° 7575, and the cutting or removal of trees is prohibited, while the bed and waters of that watercourse are in the public domain (dominio público). (Ley de Aguas, Articles 1, subsection IV, and 3, subsection III). 3) The surface water and groundwater existing on the property are within the State public domain and do not form part of the property” (folio 117). - 6 .- The processing of the proceeding contains errors or omissions capable of invalidating the appealed judgment.- Judge ALPIZAR RODRIGUEZ drafts the opinion; and,

CONSIDERING:

I. In view of the manner in which this matter will be decided, no ruling is made regarding the facts deemed proven

II.In the challenged judgment 157-2016 of 14 de junio de 2016, the possessory information proceeding was approved and the registration of the property described in plan 6-1765461-2014 was ordered, subject to the restrictions established by the Ley de Aguas and the Ley de Caminos Públicos. The Procuraduría General de la República (PGR) appeals and requests that the judgment be declared null and void, considering it premature because the proceeding had not yet reached the judgment phase. It argues that what was omitted was a request for a report from the Instituto Costarricense de Acueductos y Alcantarillados (ICAA) to determine whether the spring (naciente) located on the land adjoining the boundary of the property to be registered supplied water to any population and whether it should be reserved for that purpose, because, if so, the 200 or 300 meters contiguous to that spring, within the portion comprising the land to be titled, should have been excluded from the plan. It emphasizes that public-domain property (bienes de dominio público) must be excluded from properties to be titled, according to the case law of the Tribunal Agrario. In this regard, it cites voto 128-10, which ordered the judgment set aside in a case involving circumstances identical to those asserted here (folios 1 11 to 116).

III.Article 26 of the Ley de Jurisdicción Agraria provides, insofar as relevant: “Where appropriate, the courts may, on their own initiative, declare proceedings null and void and order procedural steps to be repeated in order to correct irregularities that could affect the validity of the proceeding.” Likewise, Article 502 of the Código de Trabajo, applicable by reference under Article 60 of the Ley de Jurisdicción Agraria, states that once the record reaches the Tribunal on appeal, the Tribunal shall first review the proceedings. If it finds that any formality capable of causing an actual denial of the right to a defense (indefensión) has been omitted, it shall declare the acts or rulings null and void to the extent necessary to restore the ordinary course of the proceeding. Under these provisions, this Tribunal has consistently held that a declaration of nullity (declaratoria de nulidad) is appropriate when it is absolutely essential in order to prevent a denial of the right to a defense or to restore the ordinary course of the proceeding because essential procedural requirements were violated.

IV.In this case, the PGR informed the trial court on several occasions of the need to request a report on the status of the spring located on adjoining land (see folios 71, 78 and 96). Its existence is apparent from the underlying plan and from the testimony of witness [Nombre6] (folio 54). Although the PGR properly substantiated its request, the a quo denied it on every occasion. Its claim is therefore well-founded because the fact that the spring emerges on adjoining land does not relieve the party seeking title of its duty to demonstrate that the plan depicting the land to be titled does not encompass public-domain areas (zonas demaniales) or adversely affect public or State interests associated with environmental protection. Moreover, water resources suitable for human consumption constitute property serving the community, and for that reason the legislature expressly created a special regime for their protection (Sections 7 of the Ley de Tierras y Colonización, 4 of the Código de Minería, 33 of the Ley Forestal, and 31 and 32 of the Ley de Aguas). This position has indeed been upheld in precedents of this Tribunal under various judicial panels, including votos 128-F-10 of 19 de febrero del 2010 and 311-F-13 of 25 de marzo de 2013, in which, under circumstances similar to those asserted here, the judgment was set aside as premature.

V.In this regard, it is not permissible to apply a restrictive criterion such as that maintained by the a quo in denying the PGR’s request on the ground that requesting the report from ICAA was improper because the spring (naciente) was located on adjoining land. The trial judge must bear in mind that, in every proceeding involving environmental assets (bienes ambientales), the principles underlying Environmental Law (Derecho Ambiental), such as the precautionary and preventive principles, must be respected, as must the social and environmental function that every parcel of land must fulfill through its possessor or owner. The criterion maintained by the a quo, in addition to disregarding those principles, fails to consider that, from a natural and logical standpoint, ecosystems and spring protection zones (zonas de protección de nacientes) are not confined by divisions or boundaries established by human beings.

“In addition to the foregoing, the judge must consider what was agreed at the XVI Cumbre Judicial Iberoamericana, held in Buenos Aires, Argentina, on 25, 26 y 27 de abril de 2012, at which the Declaración de Buenos Aires 2012 was signed. In the section concerning information and transparency, and public participation in environmental matters, the following was declared: ‘INFORMATION AND TRANSPARENCY IN ENVIRONMENTAL MATTERS. It is important for the judge and the parties to have access to truthful, effective, reliable, and suitable environmental information so that effective judgments may be issued in environmental matters. It is important for judges to ensure that citizens and society have access to the environmental information they require or request, including information held by judicial bodies. It is important for judges to take into account how significant their contribution, as public officials, can be to environmental education and to raising public awareness regarding environmental protection.

It is important for judicial bodies to use suitable and efficient means to convey relevant environmental information to everyone, to inform society about their actions in environmental matters, and to clarify for the public environmental issues decided in judicial proceedings. It is important for judges to have broad access to all environmental information held by the parties, third parties, and public bodies, in accordance with each legal system and Principle 10 of the Declaración de Río. PUBLIC PARTICIPATION IN ENVIRONMENTAL MATTERS. Whenever possible, it is important for judicial bodies to adopt environmental-management policies and encourage measures for the rational and sustainable use of their resources. It is important for judicial bodies to consider their social and environmental responsibilities in their strategic planning, including: (a) adopting any environmental-protection measures that may be possible or necessary; (b) requiring judges and officials to exercise environmental responsibility in the performance of their duties; and (c) favoring practices that combat the waste of natural resources, promote sustainability, and prevent environmental harm.

It is important for each country’s procedural mechanisms to ensure broad participation by citizens and society in judicial actions relating to the environment. Whenever the judge hearing the case or the competent court deems it necessary or appropriate, it is important to hold public hearings to clarify matters relevant to the adjudication of environmental actions, at which society’s views may be heard and technical statements from specialists may be obtained concerning aspects relevant to the issuance of judgment. While respecting their impartiality and independence, it is important for judges to share the experience accumulated through their daily handling of environmental proceedings and problems, maintaining institutional contacts and cooperating with public bodies, social stakeholders, economic or professional associations, nongovernmental organizations, and the scientific and academic community, in order to improve the administration of justice, ensure the efficient application of environmental legislation, and publicize environmental-education and environmental-protection initiatives....’” Based on the foregoing, this Court considers that the person responsible for deciding matters in the judicial forum and the parties must have access to truthful, effective, reliable, and suitable environmental information so that effective judgments may be issued in environmental matters.

In the case of possessory information proceedings (informaciones posesorias), it is evident from Articles 45 and 50 of the Constitución Política that judges are required to ensure that the title eligible for registration in the Registro Público provides information aimed at producing the greatest well-being for all inhabitants of the country, promoting agricultural and agro-environmental production; encouraging the conservation and preservation of a healthy and ecologically balanced environment; and preventing harm that could affect future generations. Furthermore, the cited declaration establishes the importance of judges ensuring that citizens and society have access to the environmental information they require or request, including information held by judicial bodies. When possessory information proceedings are processed, the decision to be entered in the corresponding registry must provide the general public with accurate and transparent information.

Accordingly, it is important that all matters concerning water resources (recurso hídrico), and potentially sources supplying drinking water to communities, be clear and precise. The supply of drinking water is a right to which all men and women must have access. This issue has been addressed by the Sala Constitucional de la Corte Suprema de Justicia as follows: “III.- Fundamental right to drinking water. In its case law, this Court has recognized that the rights to health and life are fundamental human rights that depend—to a large extent—on access to drinking water, and that the competent bodies have an inescapable responsibility to ensure that society as a whole is not deprived of them....” (voto Nº18633 de 21 de diciembre de 2007) (voto 725 de 15 de junio de 2012 del Tribunal Agrario).

VI.Consequently, because omissions affecting due process (debido proceso) have been identified and cannot be remedied in this Court, as they fall within the functional jurisdiction of the first-instance judge, and out of respect for the parties’ due process rights, the appropriate course is to declare the challenged judgment prematurely null and void. The a quo shall correct the proceedings as indicated. The a quo is also advised that, pursuant to circular 14-07 of the Consejo Superior, sesión 07-07 del 30 de enero de 2007, art. LXVIII, judges must give priority to matters involving the reopening of proceedings (reposición de diligencias), particularly those arising from an annulment ordered by a higher court, so that the new judgment may be issued more promptly.

POR TANTO:

The first-instance judgment 157-2016 de 14 de junio de 2016 is annulled. The trial court shall correct the proceedings by requesting the report from the Instituto de Acueductos y Alcantarillados and taking whatever other measures are appropriate for the continuation of the proceeding in accordance with the legal system. Con las afectaciones a que se refiere el artículo 17 de la Ley de informaciones Posesorias y sin perjuicio de terceros de mejor derecho, se ordena al Señor Registrador del Registro de la Propiedad inscribir, por primera vez, a nombre de ANCALES DE COTO BRUS S.A., cédula jurídica CED7 , con domicilio social en San Vito, Coto Brus, contiguo al hotel y restaurante El Ceibo, representada por su apoderado generalísimo [Nombre1] quien es mayor, (SIC) casado una vez, comerciante y vecino de San Vito de Coto Brus con cédula de identidad CED8 , la finca descrita en el plano inscrito en el Catastro Nacional bajo el número P-1765461-2014, que se describe así: Terreno de potrero y tacotal con dos casas de habitación. Linda al NORTE: [Nombre2] y en parte con Río Jaba, Sur: [Dirección1] y [Nombre3] , Este: Río Jaba, [Nombre4] y [Nombre3] y Oeste [Nombre2] y [Nombre5] , situada en La Manchuria, de la Provincia de Puntarenas, Cantón de Coto Brus, [Dirección3] . El inmueble objeto de este proceso se estima en la suma de cinco millones de colones. Sirva la certificación de esta sentencia para inscribir en el Registro de la Propiedad la finca relacionada" ( folio 108 frente y vuelto).-
  4. 4La Procuradora Lydiana Rodríguez Paniagua interpuso recurso de apelación con indicación expresa de las razones en que se fundamenta para refutar la tesis del juzgado de instancia (folios 111 al 113, y 114 al 116).-

5 .- Por medio de escritos presentados el veinte y veintitrés de junio del dos mil dieciséis (folios 111 al 113, y 114 al 116), la PGR solicitó adición de la sentencia 157-2016 de 14 de junio del 2016. En resolución de 8 de julio del 2015 se resolvió: “ En cuanto a la solicitud de ADICIÓN a la sentencia 157-2016, que hace la Procuradora a folio 114, de conformidad con el artículo 158 del Código Procesal Civil, se adiciona al POR TANTO de la sentencia: 1) que el ancho de vía de la calle pública que colinda por el rumbo [Dirección4] con el predio a titular es de 14.00 metros (artículos 4 de la Ley General de Caminos Públicos y 19, inciso a, de la Ley de Informaciones Posesorias) 2) Que el área contigua a las corrientes es área de protección, según el artículo 33, inciso b, de la Ley Forestal N° 7575, y queda prohibida la corta o eliminación de árboles y que el cauce y las aguas de esa corriente son de dominio público. (Ley de Aguas, artículos 1, inciso IV, y 3, inciso III). 3) Las aguas superficiales y subterráneas existentes en el inmueble son de dominio público estatal y no forman parte de la finca" ( folio 117 ). - 6 .- En la substanciación del proceso existen errores u omisiones capaces que invalidan la sentencia recurrida .- Redacta la jueza ALPIZAR RODRIGUEZ , y;

CONSIDERANDO:

I. Por la forma en que se resolverá se omite pronunciamiento acerca de los hechos tenidos por demostrados

II.En la sentencia impugnada 157-2016 de 14 de junio de 2016 se aprobó la información posesoria y se ordenó inscribir el inmueble descrito en el plano 6-1765461-2014 , con las limitaciones que establece la Ley de Aguas y la Ley de Caminos Públicos. La Procuraduría General de la República (PGR) apela y solicita la nulidad del fallo, por considerarlo prematuro, al no estar el proceso en la fase procesal de sentencia. Alega , se omitió fue requerir un informe al Instituto Costarricense de Acueductos y Alcantarillados (ICAA), para que se constatara si la naciente ubicada en el terreno colindante por el rumbo del inmueble a inscribir, surtía de agua a alguna población y si convenía reservarla para tal fin, ya que de ser así, se debió haber excluido del plano los 200 o 300 metros continuos a ese manantial en la porción que comprenda el terreno a titular. Resalta, los bienes de dominio público deben excluirse de los inmuebles a titular, según jurisprudencia del Tribunal Agrario. Cita al respecto el voto 128-10, que ordenó se anulara la sentencia en un caso con un supuesto igual al reclamado (folios 1 11 a 116 ).

III.El artículo 26 de la Ley de Jurisdicción Agraria, en lo que interesa dispone: "Cuando sea del caso, los tribunales podrán, por iniciativa propia, declarar nulidades y disponer la reposición de trámites, a fin de corregir irregularidades que pudieran afectar la validez del proceso". Asimismo, el artículo 502 del Código de Trabajo, aplicado por remisión del artículo 60 de la Ley de Jurisdicción Agraria, señala que llegados los autos en apelación, el Tribunal revisará, en primer término, los procedimientos. Si encontrare que se ha omitido alguna formalidad, capaz de causar efectiva indefensión, decretará la nulidad de actuaciones o de resoluciones, hasta donde sea necesario para orientar el curso normal del juicio. Al amparo de dichas regulaciones, se ha mantenido el criterio en esta Sede que la declaratoria de nulidad procede cuando sea absolutamente indispensable su pronunciamiento, para evitar indefensión o para orientar el curso normal del procedimiento, por violación a formas esenciales en el trámite.

IV.En este caso, la PGR en varias oportunidades, hizo ver al Juzgado de instancia la necesidad de que se requiriese el informe sobre la condición de la naciente existente en un terreno colindante (ver folios 71, 78 y 96 ). Su existencia se desprende del plano base y de lo declarado por el testigo [Nombre6] (folio 54). Pese a que la PGR fundamentó debidamente su petición, la a quo le denegó en todas las ocasiones lo pedido. Por ende, lleva razón en su reclamo, dado que efectivamente, el hecho de brotar la naciente en un terreno colindante, no exime a la parte titulante de su deber de demostrar que el plano que grafica el terreno a titular, no comprende zonas demaniales ni tampoco afecta intereses públicos o estatales relacionados con la tutela del ambiente. Además, el recurso hídrico apto para consumo humano es un bien al servicio de la comunidad, y por ello de manera expresa la persona legisladora creó un régimen especial para su protección (numerales 7 de la Ley de Tierras y Colonización , 4 del Código de Minería, 33 de la Ley Forestal y 31 y 32 de la Ley de Aguas ) . Lo indicado ha sido sostenido efectivamente en precedentes de este Tribunal con diversas integraciones, como los votos 128-F-10 del 19 de febrero del 2010 y 311-F-13 de 25 de marzo de 2013, en los cuales, en casos con s upuesto s similares al reclamado se anuló la sentencia por anticipada.

V.Al respecto, no es admisible aplicar un criterio restrictivo como el sostenido por la a quo al rechazar la petición de la PGR, con base en que era improcedente requerir el informe al ICAA por estar la naciente en un terreno colindante. La juzgadora de instancia debe tener presente que en todo proceso en el cual estén de por medio bienes ambientales, deben respetar los principios que inspiran el Derecho Ambiental, tales como el precautorio y el preventivo, así como la función social y ambiental que debe cumplirse en todo terreno por quien lo posea o sea su dueño. El criterio sostenido por la a quo, además de irrespetar dichos principios, no considera que desde el punto de vista natural y lógico, los ecosistemas y zonas de protección de nacientes no se limitan por las divisiones o linderos establecidos por los humanos. "Abonado a lo anterior, debe considerar la persona juzgadora, lo acordado en la XVI Cumbre Judicial Iberoamericana, realizada en Buenos Aires, Argentina, los días 25, 26 y 27 de abril de 2012, donde se suscribió la Declaración de Buenos Aires 2012.

En el segmento relativo a la información y transparencia, y la participación pública en materia de medio ambiente, se declaró lo siguiente: " INFORMACIÓN Y TRANSPARENCIA EN MATERIA DE MEDIO AMBIENTE . Es importante que el juez y las partes tengan acceso a una información ambiental verdadera, eficaz, real e idónea para que se dicten sentencias y efectivas en materia ambiental. Es importante que los jueces velen para que la ciudadanía y la sociedad tengan acceso a la información ambiental que precisen o soliciten, incluyendo la información en poder de los órganos jurisdiccionales. Es importante que los jueces tengan en cuenta cuán significativa puede ser su contribución, como agentes públicos, a la educación ambiental y a la sensibilización de la opinión pública en materia de protección del medio ambiente. Es importante que los órganos jurisdiccionales utilicen medios idóneos y eficientes para transmitir a todos la información ambiental relevante, para informar a la sociedad sobre su actuación en materia de medio ambiente y para esclarecer al público cuestiones ambientales decididas en el ámbito judicial.

Es importante que los jueces tengan un amplio acceso a toda la información ambiental que obre en poder de las partes, de terceros y de órganos públicos, de acuerdo con lo establecido en cada ordenamiento jurídico y el Principio 10 de la Declaración de Río. PARTICIPACIÓN PÚBLICA EN MATERIA DE MEDIO AMBIENTE .Es importante que, siempre que sea posible, los órganos jurisdiccionales adopten políticas de gestión ambiental e incentiven medidas para un uso racional y sostenible de sus recursos. Es importante que los órganos jurisdiccionales consideren sus responsabilidades socioambientales en sus planificaciones estratégicas, incluyendo: (a) la adopción de las medidas de protección del medio ambiente que sean posibles o necesarias; (b) la exigencia de una responsabilidad ambiental a los jueces y funcionarios en el desempeño de sus obligaciones; y (c) la preferencia de prácticas que combatan el desperdicio de recursos naturales, incentiven la sostenibilidad y eviten daños al medio ambiente.

Es importante que los mecanismos procesales de cada país aseguren una amplia participación de la ciudadanía y de la sociedad en acciones judiciales que guarden relación con el medio ambiente. Es importante que el juez de la causa o tribunal competente, siempre que lo estime necesario o conveniente, realice audiencias públicas para esclarecer cuestiones relevantes para el juicio de acciones ambientales, en las que conozca la opinión de la sociedad y recabe declaraciones técnicas de especialistas sobre aspectos relevantes a la hora de dictar sentencia. Es importante que, respetando su imparcialidad e independencia, el juez comparta la experiencia acumulada en el trato cotidiano con procesos y problemas ambientales, manteniendo contactos institucionales y cooperando con órganos públicos, agentes sociales, asociaciones económicas o profesionales, organizaciones no gubernamentales y la comunidad científica y académica, en beneficio de la mejora de la prestación jurisdiccional, de la aplicación eficiente de la legislación ambiental y de la divulgación de iniciativas de educación ambiental y de protección del medio ambiente..."..

De lo anterior estima este Tribunal, la persona encargada de resolver los asuntos en sede judicial y las partes, deben tener acceso a una información ambiental verdadera, eficaz, real e idónea para que se dicten sentencias efectivas en materia ambiental. En el caso de las informaciones posesorias, es evidente, a partir de los numerales 45 y 50 de la Constitución Política, se impone a quien juzga velar porque el título inscribible en el Registro Público, suministre información tendiente a generar el mayor bienestar a todos los habitantes del país, estimulando la producción agraria y agroambiental; incentivando que se conserve y preserve un ambiente sano y ecológicamente equilibrado; evitando daños que puedan afectar a las futuras generaciones. Además, la declaración en cita, establece la importancia que los jueces y las juezas velen para que la ciudadanía y la sociedad tengan acceso a la información ambiental que precisen o soliciten, incluyendo la información en poder de los órganos jurisdiccionales.

Cuando se tramitan las diligencias de información posesoria, la decisión que se inscribirá en el registro correspondiente, deberá suministrar a la ciudadanía en general información precisa y transparente. Por lo anterior, es relevante que todo lo que concierne al recurso hídrico, y eventualmente a fuentes de abastecimiento de agua potable para las comunidades, sea diáfana y precisa. El suministro de agua potable es un derecho al que todos los hombres y mujeres deben tener acceso. Este tema ha sido abordado por la Sala Constitucional de la Corte Suprema de Justicia de la siguiente manera: ´ « III . - Derecho fundamental al agua potable. Este Tribunal ha reconocido en su jurisprudencia que el derecho a la salud y a la vida son derechos fundamentales del ser humano que dependen -en gran parte-del acceso al agua potable, y que los órganos competentes tienen la responsabilidad, ineludible, de velar para que la sociedad como un todo no los vea mermados..." (voto Nº18633 de 21 de diciembre de 2007) (voto 725 de 15 de junio de 2012 del Tribunal Agrario).

VI.En consecuencia, al haberse constatado omisiones que afectan el debido proceso, que no pueden subsanarse en esta Sede, por ser propias de la competencia funcional del juez de primera instancia y por respeto al debido proceso de las partes, lo procedente es declarar la nulidad, por anticipada, de la sentencia impugnada. Proceda el a- quo a corregir el procedimiento de acuerdo a lo indicado. Se le hace ver además que por circular 14-07 del Consejo Superior, sesión 07-07 del 30 de enero de 2007, art. LXVIII, las personas juzgadoras deben dar prioridad a los asuntos de reposición de diligencias, especialmente a los que se originen en la anulación decretada por un tribunal de grado superior, para que la nueva sentencia sea emitida con mayor celeridad.

POR TANTO:

Se anula la sentencia de primera instancia 157-2016 de 14 de junio de 2016. Proceda el Juzgado de instancia a corregir los procedimientos solicitando el informe del Instituto de Acueductos y Alcantarillados y lo que sea pertinente para la continuación del proceso en función de lo dispuesto en el ordenamiento jurídico. T ome nota de lo indicado en el último considerando.
