JUDGMENT APPEAL (RECURSO DE APELACIÓN DE SENTENCIA) filed in the present proceedings against Nombre04, of legal age, Costa Rican, holder of identity card number CED01, for the offense of Violation of the Ley Forestal, to the detriment of Natural Resources. Judges Adriana Escalante Moncada, Yadira Godínez Segura, and Annia Enríquez Chavarría participated in deciding the appeal. Attorney Óscar González Zamora, in his capacity as public defender for the defendant (imputado), Nombre04, and attorney María Gabriela Montealegre Tomas, representative of the Ministerio Público, entered appearances in the judgment appeal.

BACKGROUND:

I.By judgment number 54-2015, issued at fourteen hours on ...08, the Tribunal de Juicio de San Ramón ruled: “POR TANTO: In accordance with the evidence gathered, the rules of reasoned sound judgment (sana crítica racional), Articles 39 and 41 of the Constitución Política, sections 1, 2, 3, 4, 5, 6, 265, 343, 349, 351, 352, 354, 355 356, 357, 358, 360, 361, 363, 364, 365 and 367 of the Código Procesal Penal, 1, 30, 31, 45, 50, 51, 59 to 62, and 71 to 74 of the Código Penal; and Articles 33, 34, 57, and 58(a) of Ley Forestal N°7575, this Court, sitting as a single-judge court, finds the defendant Nombre04 criminally responsible as the perpetrator of the offense of encroachment into a protected area (Invasión a una área de protección), committed to the detriment of Natural Resources, and, in that capacity, sentences him to three months’ imprisonment, to be served at the place and in the manner prescribed by prison regulations.

The costs of the proceedings shall be borne by the State. Once this judgment becomes final, it shall be entered in the Registro Judicial, and notice shall be provided to the Instituto Nacional de Criminología and the Juzgado de Ejecución de la Pena for the matters within their respective purviews. Because the defendant meets the legal requirements, he is GRANTED THE BENEFIT OF A SUSPENDED SENTENCE (BENEFICIO DE EJECUCIÓN CONDICIONAL DE LA PENA) for a period of THREE YEARS, during which the accused must not commit any intentional offense punishable by more than six months’ imprisonment; otherwise, the benefit granted shall be revoked. NOTICE SHALL BE GIVEN. Elí Marcial Rodríguez Herrera. Trial Judge” (sic).

II.Attorney Óscar González Zamora, in his capacity as public defender for the defendant Nombre04, filed a judgment appeal against the foregoing ruling.

III.After conducting the corresponding deliberation in accordance with Article 465 of the Código Procesal Penal, the Tribunal de Apelación de Sentencia del III Circuito Judicial de Alajuela, ...01, proceeded to hear the appeal.

IV. The relevant legal requirements have been observed throughout the proceedings

Judgment drafted by appellate judge Escalante Moncada; and,

CONSIDERING:

I.On ...09, attorney Óscar González Zamora, in his capacity as public defender for the defendant Nombre04, filed a judgment appeal against decision number 54-2015, issued by the Tribunal de Juicio de San Ramón at 14:00 hours on ...06.

II.In the first ground of the appeal, the appellant asserts that substantive law was erroneously applied due to an incorrect allegation made by the Public Prosecutor’s Office in the charging document. He explains that the alleged factual account identified as the criminal act that the defendant pruned 36 Guaba trees, although the verb “to prune” is not contemplated as one of the forms of conduct contained in Article 58 of the Ley forestal; therefore, he was charged with acts that did not constitute a criminal offense. He states that this situation caused the Trial Court, in its reasoning, to deem conduct different from that charged to have been proven, because the defendant was convicted for invading the protection zone (zona de protección), conduct that was not charged by the prosecuting authority. He adds that the conduct charged does not describe circumstantial facts capable of falling within the statutory offense (figura típica) of invasion regulated in subsection a) of Article 58 of the Ley forestal.

He further contends that the judgment is contradictory in this respect because, on the one hand, it states that the defendant’s conduct consisted of invading the protection zone and, on the other, it rules out invasion and maintains that the purpose of cutting the trees was to improve conditions for the coffee plants existing in the area. The appellant criticizes the trial judges for failing to address in the judgment the defense theory that what actually occurred was the general pruning of 40 Guaba trees, rather than the pruning of 36 and the cutting of 4, an issue he considers essential because pruning trees is conduct not defined as a criminal offense (conducta atípica). In the second ground, he invokes a violation of the presumption of innocence (principio de inocencia). He maintains that the judge reversed the burden of proof because the judgment states that if a person is accused of an act without having committed it and knows who the guilty party is, that person must arrange for the relevant evidence to be produced in order not to bear responsibility belonging to another.

He objects to that reasoning because, under our procedural system, the Public Prosecutor’s Office is responsible for proving a person’s guilt, and the evidence presented in adversarial proceedings must be sufficient to overcome the presumption of innocence. In the third ground, he criticizes the judge’s assessment of the defendant’s statement, the testimony of Nombre05, and the documentary evidence because, in his view, the accused has a physical impairment that has long prevented him from using a chainsaw, and it was therefore not feasible to conclude that his client was the person who cut the trees. He requests that the grounds of appeal be upheld and that the defendant be acquitted of all punishment and liability. In the alternative, he requests that the judgment be vacated and a retrial ordered. Because all the claims concern the reasoning of the judgment and the assessment of the evidence, they will be decided jointly.

By majority vote, the appeal is granted. This Court has reviewed the contents of the judgment and examined the claims raised in the appeal, determining that the appellant is correct. To properly decide the claims presented, it is necessary to reproduce the factual basis (plataforma fáctica) deemed proven in the judgment, which was established as follows: “Without specifying the exact date, but during the month of ...01, the defendant Nombre04 went to the property located in ...02, Miramar map sheet, scale 1:50.000, at Lambert coordinates 229:350 and 481:131. Once at the site and without authorization from the State Forestry Administration, he pruned the branches of 36 Guaba trees and cut 4 trees of the same species at the trunk, at a height of two to four meters above ground level; these were also Guaba trees located within the protection zone of a permanent spring (naciente de agua permanente).” (verbatim copy of folio178).

According to the prosecution’s charging request (requisitoria fiscal) and the order committing the case for trial (auto de apertura a juicio) (folios 35 to 37 and 49 to 50), the legal classification assigned to that factual basis was the unlawful exploitation of forest resources (aprovechamiento ilegal de los recursos forestales) set forth in Article 58, subsection b), of the Ley Forestal. However, in the judgment, the acts were reclassified as the offense of invasion of a protection zone under the description in subsection a) of the aforementioned legislation. One of the issues challenged in the appeal concerns the legal classification assigned by the court below (a quo) to the factual account deemed proven because, in the opinion of the public defense, the proven conduct does not fall within the verb “to invade,” which is the core of the act described in subsection a) of Article 58 of the Ley Forestal.

The central claim in the first ground of appeal challenges the overly broad meaning that the trial judge attributed to the verb “to invade.” To resolve the disputed issue, it is necessary to analyze the conduct described in subsection a) of Article 58 of the Law under discussion, which provides as follows: “A term of imprisonment of three months to three years shall be imposed on anyone who: a) Invades a conservation or protection area, regardless of its management category, or other forest areas or lands subject to the forestry regime (régimen forestal), regardless of the area occupied and irrespective of whether they are privately held State lands, lands belonging to other Public Administration bodies, or privately owned lands. The perpetrators of or participants in the act shall not be entitled to any compensation for any construction or work they may have carried out on the invaded lands.” As is apparent from the aforementioned legislation, the criminal act is defined by the verb “to invade,” which, according to the dictionary of the Real Academia Española, has the following meanings relevant to the resolution of this matter: i) To break in, to enter by force; ii) To occupy a place abnormally or irregularly.

Likewise, “to occupy” means “to take possession of or seize a territory, place, building, etc., by invading or settling in it.” In the absence of a legal definition of the word “invade,” the provision must be interpreted by determining the meaning or meanings of the words in their linguistic sense and according to the grammatical meaning with which the terms are used in the corresponding sentence. In the situation under analysis, the entire paragraph contained in subsection a) of Article 58 of the Ley Forestal uses the word “invade” in both of its meanings—entry by force and unlawful occupation—which is consistent with the civil consequences of the criminal conduct described in that subsection, which stipulates the loss or demolition of buildings or works constructed in that area. Similarly, although it is not expressly stated, the grammatical construction of the statutory definition of the offense (tipo penal) unequivocally indicates that the verb “to invade” is also limited to the act of occupation.

Further support for the interpretation adopted by the majority of this Appellate Chamber is found in Article 2 of the Code of Criminal Procedure (Código Procesal Penal), which prohibits expansive or analogical interpretation, a provision grounded in the principle in favor of liberty (principio pro libertatis), which requires judges to interpret provisions in a manner that favors the accused’s liberty and not the opposite. Accordingly, based on the foregoing, the criminal act described in the relevant provision is the invasion or occupation of a protection or conservation area, whether through forcible entry or the occupation of such lands. Returning to the case under examination, the judgment reveals one undisputed fact: the defendant entered land—without it having been shown that he did so through the use of force or violence—on which there is a permanent spring; therefore, all trees planted within a radius of one hundred meters from the spring are located within a protection zone pursuant to Article 33 of the Ley Forestal.

It is therefore necessary to determine the meaning that the trial judge attributed to the verb “to invade” in this particular case. An examination of the judgment indicates that, for the trial court, invasion means performing any act prohibited by the legal system. In this regard, the trial judge reasoned: “Once the evidence has been assessed in its various aspects and the factual hypothesis alleged by the Public Prosecutor’s Office has been deemed proven, that conduct must be fitted within a criminal offense. In this respect, it is considered subsumed under the statutory offense in Article 58, subsection a), of Ley Forestal N° 7575, which states: "Article 58.- A term of imprisonment of three months to three years shall be imposed on anyone who: a) Invades a conservation or protection area, regardless of its management category, or other forest areas or lands subject to the forestry regime, regardless of the area occupied and irrespective of whether they are privately held State lands, lands belonging to other Public Administration bodies, or privately owned lands.

The perpetrators of and participants in the act shall not be entitled to any compensation for any construction or work they may have carried out on the invaded lands." The normative elements (elementos normativos) that must be proven consist of the operative verb, which, as indicated, comprises the act of invading; a second element, namely, a protection area; and, with reference to that same aspect, establishing the existence of a spring and that the act occurred within the land-based protection radius assigned to that water resource. Regarding the verb “to invade,” this Court considers that its interpretation is not limited by the civil-law concept of dispossession and remaining in a particular place. Although it also encompasses that meaning, it is further understood to include cutting and pruning prohibited by law; in other words, the verb “to invade” includes carrying out acts prohibited by law in the areas designated by law.

In this regard, Article 34 of the cited Ley Forestal prohibits the cutting or removal of trees within the protection areas described in the preceding article, namely Article 33: "Article 33.- Protection areas. The following are declared protection areas: a) Areas surrounding permanent springs, defined within a radius of one hundred meters measured horizontally... Article 34.- Prohibition on felling in protected areas. The cutting or removal of trees in the protection areas described in the preceding article is prohibited, except for projects declared by the Executive Branch to be in the national interest..." In this regard, it has been stated: There are various interpretations of the scope of the verb "to invade," ranging from the broadest, which includes any damage to the protected areas, to the strictest, advanced by those who contend that the offense is committed only when there is dispossession of land.

The Environmental Prosecutor’s Office of the Public Prosecutor’s Office, like the Criminal Cassation Court, has maintained an intermediate position by considering invasion to include dispossession of land, as well as all acts—even those committed by the landowner—that involve constructing any type of structure in protection or conservation areas, such as fences, tanks, houses, etc... This interpretation is based on what has been stated concerning the protected legal interest, because the criminalization of "invasion," particularly in the protection areas under Article 33 of the LF, which includes the prohibition on cutting in these areas contained in Article 34 of the same law, serves to protect the water resource and its associated ecosystems.” (emphasis added) (verbatim copy of folios 186 and 187).

It is clear from the foregoing excerpt that, for the trial court, the verb “to invade” includes not only the act of unlawfully occupying land, but also the performance of any other activity prohibited by the legal system. Apart from constituting an expansive interpretation (interpretación extensiva) of the verb “to invade,” the trial judge’s interpretation amounts to an analogy, because it equates the act of invading with any other conduct prohibited within the protection area (área de protección), even though this type of interpretation is expressly prohibited by Article 2 of the Código Procesal Penal. Accordingly, although the trial judge based his position on the provision contained in Article 34 of the Ley Forestal, which establishes that the cutting of trees—including the act of pruning them—located in protection or conservation areas is not permitted, that interpretation is expansive, and the reasoning provided in the judgment is therefore incorrect.

Although a systematic and purposive interpretation (interpretación sistemática y teleológica) of the law may be undertaken in order to consider the various connections between the particular provision and the rest of the legal system and, at the same time, to determine the scope of the legal provision under review, such methods are limited by the principle of legality (principio de legalidad), which, as already stated, prevents interpretation of the law from being extended to general parameters of application, as is sought in this case. Furthermore, as can be inferred from the factual allegations (cuadro fáctico) described in the indictment (acusación), the accused was not charged with forcibly entering the aforementioned property; consequently, the other mode of commission described in subsection (a) of Article 58 of the Ley Forestal cannot be established either. It must therefore be determined whether the conduct found proven in the judgment constitutes any other criminal offense.

In this regard, among the acts classified as criminal offenses under the aforementioned special legislation is the conduct described in subsection (b) of Article 58, which provides as follows: “b) Exploits forest resources (aproveche los recursos forestales) on lands belonging to the State’s natural heritage (patrimonio natural del Estado) and in protection areas for purposes other than those established in this law.” As expressly provided by Article 3 of the Ley Forestal, exploitation of forest resources (aprovechamiento de recursos forestales) “consists of the act of cutting or removing standing timber trees, or using fallen trees, carried out on private land not included in Article 1 of this law, which generates or may generate some profit, benefit, advantage, use, or gain for the person performing it or for the person whom that individual represents.” The express definition of the verb “to exploit,” which in this case is supplied by the Ley Forestal itself, supports the conclusion that cutting trees in protection areas is not only an act prohibited under Article 34 of the Ley Forestal, but also punishable conduct under the criminal offense defined in Article 58, subsection (b), of the aforementioned special legislation.

It must now be determined whether the facts found proven could fall within this other criminal offense. After examining the record, this Cámara de Apelación de Sentencia finds that the proven facts do not contain all the elements required to bring the conduct within the offense established in Article 58, subsection (b), of the Ley Forestal. As can be seen from the statutory description contained in subsection (b) of the provision under discussion, the gravamen of the criminal offense (núcleo de imputación del tipo penal) concerns forest exploitation (aprovechamiento forestal) on certain lands, including those designated as protection areas, as in the case under review. Regarding this particular offense, the Tribunal de Apelación de Sentencia del Segundo Circuito Judicial de San José has stated, insofar as relevant, as follows: “As can be seen, the gravamen of the criminal offense under Article 58, subsection (b), of the Ley Forestal concerns forest exploitation, but only on certain lands: lands belonging to the State’s natural heritage and protection areas.

Those aspects constitute normative elements of the offense (elementos normativos del tipo) that necessarily form part of the core allegation and must therefore be included in the charging document and in the facts found proven in the judgment, but never by merely repeating those normative concepts verbatim in the statement of facts as a substitute for the factual circumstances that should describe them. As with other offenses, when drafting the indictment, the prosecutor describes the act or conduct within a particular temporal and spatial context and, depending on the basic requirements imposed by the charged offense, adds other relevant circumstances, such as results and a description of special personal circumstances, among others. Thus, when the offense charged is theft, it is unacceptable to use a drafting method that merely states in the indictment that a particular item was taken from someone’s possession; instead, the manner in which the act occurred must be described.

Then, if that factual hypothesis is proven, the judge may assess and determine whether the proven allegations satisfy the elements of a criminal offense. The offense attributed to the defendant Nombre01. contains normative elements, and those elements require reference to other provisions established—in this case—in the Ley Forestal, which give substance to those expressions; in other words, they are specific criminal-law concepts. (...) The objective elements of the offense (tipo objetivo) established in Article 58, subsection (b), of the Ley Forestal punish the act of forest exploitation, and this entails describing the alleged conduct in order to determine subsequently whether, if proven, it constitutes exploitation. Once again, reference must be made to the Ley Forestal, Article 3 of which establishes that, for purposes of that law, exploitation means: ‘The act of cutting or removing standing timber trees, or using fallen trees, carried out on private land not included in Article 1 of this law, which generates or may generate some profit, benefit, advantage, use, or gain for the person performing it or for the person whom that individual represents.’ In other words, establishing the offense of exploitation requires not only identifying the conduct performed—which may take several forms—but also the potential or actual result generated, described in terms of a benefit to the perpetrator.

In short, by operation of law, this normative element refers to two distinct circumstances: 1) a series of acts (cutting or removing standing trees, or using fallen trees); and 2) a particular advantage, gain, use, or benefit accruing to the person performing the act or to a third party whom that person represents. The latter, moreover, is not limited to a purely economic benefit and may therefore take many different forms (landscaping, facilitating construction at the site, using the wood for artistic purposes, etc.). From that standpoint, in the case under review (sub examine), the prosecution’s charging request (requerimiento fiscal) clearly establishes only the first aspect of the normative element of ‘exploitation’: namely, that at least five trees were cut without the corresponding permit (within a protection area, by three individuals of unknown identity who had been hired by the accused, Nombre01.).

But forest exploitation is not established solely by describing the act—in this case, cutting trees; it also requires specifying the benefit arising or accruing to the perpetrator or to the person whom the perpetrator represents. In the record, the indictment describes that normative element only partially, because it never stated what profit, advantage, gain, or use the activity generated for the accused, and that is an indispensable requirement of the objective elements of the offense, that is, of Article 58, subsection (b), in conjunction with Article 3 of the Ley Forestal.” (Judgment number 444-2011). This Cámara de Apelación de Sentencia agrees with the foregoing reasoning because the indictment filed by the Ministerio Público must contain an objective description of the conduct that the law itself defines as an offense, which guarantees not only proper notice of the charge (adecuada imputación), but also the full exercise of the right of defense.

Returning to the case under review, the act charged by the prosecution (see folio 164) clearly establishes only the first aspect of the normative element of the offense of forest exploitation: namely, that the defendant cut 4 trees and pruned 36 trees, all located within a protection area, without having permits from the forestry administration. It did not, however, describe—as was indispensable—the nature of the benefit obtained by the accused through that prohibited act. All of these matters form part of the objective statutory elements (tipicidad objetiva) of the charged offense and must be known to the accused so that he may exercise his right of defense with respect to them as well. On this particular point, although the judge stated in the judgment that the trees were pruned and cut to improve conditions for an existing coffee plantation in the area, that fact was not included in the factual allegations (imputación fáctica) described in the indictment because, as stated, the indictment never specified what profit, advantage, gain, or use the activity generated for the accused, and that is an indispensable requirement of the objective elements established in Article 58, subsection (b), in conjunction with Article 3 of the Ley Forestal.

Nor was it investigated or alleged whether the existing coffee planting in the protection area had been established by the defendant or by a third party. In this particular case, there was not only an inadequate investigation by the Ministerio Público and the administrative authorities responsible for monitoring this type of protection area, but also, clearly, an inadequate charge, which precludes a finding that the aforementioned criminal offenses have been established. Likewise, the proven facts would not establish the offense provided for in Article 90 of the Ley de Conservación de Vida Silvestre, because the accused was not charged with destroying the protection area or removing plants from that area, and, moreover, that issue was not addressed during the trial phase (fase plenaria). In view of the foregoing, because the facts found proven do not constitute either the offense of invasion of a protected area or the offense of forest exploitation—the latter because of the evident deficiencies in the prosecution’s charging request—the ground raised is sustained and, pursuant to Article 179 of the Código Procesal Penal, correction (saneamiento) is not feasible because the procedural stage for amending the indictment has already concluded; accordingly, the defendant Nombre04 is acquitted of all punishment and liability for the offense of invasion and the unlawful act of forest exploitation to the detriment of forest resources. In view of this ruling, it is unnecessary to address the other grounds of appeal raised by the appellant.

III.Dissenting opinion (voto salvado) of co-judge Enríquez Chavarría. As explained below, I partially dissent from the majority opinion of this Criminal Judgment Appeals Chamber insofar as it vacates the appealed judgment and acquits defendant Nombre04 of all punishment and liability for the defendant’s conduct, described in the proven facts of the appealed judgment as pruning, without authorization from the State Forestry Administration, 36 Guaba trees and cutting 04 trees of the same species at the trunk, at a height of two to four meters above ground level, which were located within the protected area (zona de protección) of a permanent spring (naciente de agua permanente) (folio 178). The court below characterized these acts as the offense of encroachment upon a protected area (invasión a una zona de protección), provided for in Article 58(a) of the Ley Forestal, and, based on that legal characterization, the co-judges comprising the opinion concluded that such events could not be subsumed under that criminal offense and therefore acquitted the defendant.

The majority opinion also considered whether the charge against the defendant could constitute the offense of illegal timber harvesting (aprovechamiento ilegal de madera), determining that this legal characterization was likewise inapplicable—a conclusion with which I agree. However, the majority opinion did not consider that, in the view of this Criminal Judgment Appeals Judge, the acts charged against defendant Nombre04 may constitute the offense provided for in Article 90 of the Ley de Conservación de Vida Silvestre. That provision states: “Anyone who, without authorization, removes or destroys plants or their products in official protected areas (áreas oficiales de protección) or duly authorized private areas (áreas privadas debidamente autorizadas) shall be punished by a fine of one (1) to three (3) base salaries or imprisonment for two (2) to four (4) months, together with forfeiture (comiso) of the items constituting the proceeds of the offense.

(As amended by Article 1° of Ley N° 8689 of ...02).” To determine whether the accused’s conduct falls within this criminal offense, the elements constituting the stated unlawful act must be defined. In the case before us, the accused’s conduct concerned trees, which fall within the category of plants and which, according to the judgment, he pruned and cut. Thus, in the matter under examination (sub examine), the applicable operative verb (verbo típico)—among those provided for in the cited Article 90—would be “destroy.” According to the dictionary of the Real Academia de la Lengua Española, the meanings of the word “destroy” include: “to reduce something material to pieces or ashes, or to cause it serious damage” (consulted online, ...01). Based on this definition, pruning—that is, cutting tree branches—and also cutting four other trees at the trunk are equivalent to destroying that vegetation.

This conclusion is supported by the evidence assessed by the trial judge in the appealed judgment, from which it was established that some of the cut trees—at least 05—failed to recover and that this conduct also caused damage to the surrounding vegetation when the cut trees fell (see folios 182 and 188). The pruning and cutting of the trees were carried out without the defendant having state authorization to do so and occurred within a duly authorized private area. Under Article 2 of the Ley de Conservación de Vida Silvestre, duly authorized private areas are “private lands subject to the forestry regime (régimen forestal), Pago de Servicios Ambientales programs, ecological easements (servidumbres ecológicas), or any other conservation regime agreed to by their owners.” In this case, the area where the defendant cut the trees is private land subject to the forestry regime because, as stated in Article 3 of the Ley Forestal, the forestry regime consists of the “set of legal, economic, and technical provisions and restrictions established by this law, its regulations, and other rules and acts deriving from its application, for the purpose of regulating the conservation, renewal, use, and development of forest resources.” Article 33 of the same Ley Forestal designates as protected areas those that “border permanent springs, defined within a radius of one hundred meters measured horizontally.” Accordingly, the provision in question establishes a restriction on property for the purpose of protecting the entire surrounding area—within a radius of 100 meters—of permanent springs.

In the case before us, the judgment stated that the spring located at the scene was permanent and that the cut trees, 05 of which died, were located at a maximum distance of 40 meters and a minimum distance of ten. For the foregoing reasons, this appellate judge concludes that the acts for which the defendant was convicted constitute the offense of unlawful destruction of vegetation (destrucción ilegal de vegetación), provided for in Article 90 of the Ley de Conservación de Vida Silvestre. The appealed judgment is therefore reversed with respect to the legal characterization assigned to the acts proven against defendant Nombre04, and those acts are recharacterized under the cited provision. Because the offense under which the acts have been recharacterized provides for both a fine and imprisonment, the judgment must be vacated with respect to the sentence imposed, and the matter remanded for new proceedings solely on that issue.

Finally, regarding the considerations expressed by the co-judges who formed the majority, I must state that I also disagree with the definition given in that decision to the verb “encroach” (invadir), as used in Article 58(a) of the Ley Forestal. In this regard, I agree with the position expressed by the Tribunal de Casación Penal de San José in Voto 751-2002, issued at 10:45 hours on ...04, which states: “...It is true that the criminal conduct established by § 58.c of the Ley Forestal consists of encroaching upon a conservation or protected area, but the term does not mean dispossession or entry onto another person’s property. Because conservation areas entail a general restriction applicable to every owner of real property through which the rivers of ...03 flow, for the purpose of preserving the natural environment, health, ecology, and what little may still be saved for the balance of planet Earth, such restriction on ownership constitutes a regime requiring that the portion of the property under state protection remain intact, from which follows the possibility of performing there only those acts permitted by that regime.

Thus, encroaching upon the protected area means performing within it any unauthorized act, which may be committed by anyone, whether the owner or a third party. The appellant is therefore incorrect in asserting that his client, as holder of title to the property, a portion of which is restricted as a protected area, could not have encroached because the object of the conduct belonged to him; on the contrary, defendant Nombre02 committed the act, and it may be committed by any other person. For the foregoing reasons, the claim is denied.” This position was reiterated and expanded in Voto 713-2003, issued at 10:56 hours on ...03, by the same Tribunal de Casación Penal de San José, which stated: “...After analyzing the proven facts concerning the conduct described in Article 58(a), in relation to Articles 33(a) and 34 of the Ley Forestal, which define protected areas, this Chamber determines that deforestation (deforestar) within a protected area is carried out, according to the synonyms of the verb ‘encroach’ appearing in the Diccionario Consultor Larousse de Sinónimos, third edition of ...07, p. 437, through the acts of breaking into, entering, occupying, attacking, etc. Thus, the act of encroachment referred to by the appellant does not mean only encroachment for the purpose of exercising possession; in our view, as the legislature indicates, it may also occur through the act of breaking into, entering, or occupying, which the trial judge described as the conduct committed by the defendant, who was caught in the act after entering the area bordering a spring and stream and carrying out deforestation, thereby clearly causing significant environmental damage to the protected area.

The court below described this conduct at folio 231 when it stated: ‘the accused herein, Nombre03, who, without any authorization whatsoever, proceeded to deforest a protected or managed forest, causing harm to the flora and fauna of the area because, as stated, the defendant deforested part of a primary forest located in that area...’ Thus, as substantiated by the trial judge, the judgment established that the defendant satisfied the objective elements of the offense (tipicidad objetiva) described in the criminal provision by deforesting the protected area of a spring and stream, as well as the subjective elements of the offense (tipicidad subjetiva) by carrying out the conduct with full control over the criminal act he was committing....” The interpretation expressed in the cited decisions is a systematic interpretation (interpretación sistemática) of the provision and is consistent with the protection that the forestry legislation itself seeks to afford this country’s natural resources. Nor does it violate the defendant’s rights, insofar as it does not establish that every act performed within the protected area is punishable, but only those prohibited by the Ley Forestal itself.

THEREFORE (POR TANTO) By majority vote, the appeal filed by the defense is granted. Defendant Nombre04 is acquitted of all punishment and liability for the offense of encroachment and the offense of forest-resource harvesting (aprovechamiento forestal), to the detriment of the forest resource. In view of this disposition, a ruling on the appellant’s other grounds of appeal is omitted as unnecessary. Judge Enríquez Chavarría dissents, recharacterizes the acts as the offense of unlawful destruction of vegetation, provided for and punishable under Article 90 of the Ley de Conservación de Vida Silvestre, and orders that the case be remanded for new proceedings solely with respect to the imposition of the sentence. Notice shall be given.

RECURSO DE APELACIÓN DE SENTENCIA interpuesto en la presente causa seguida contra Nombre04, mayor, costarricense, cédula de identidad número CED01, por el delito de Infracción Ley Forestal en perjuicio de los Recursos Naturales. Intervienen en la decisión del recurso, las juezas Adriana Escalante Moncada, Yadira Godínez Segura y Annia Enríquez Chavarría. Se apersonan en apelación de sentencia, el licenciado Óscar González Zamora, en su condición de defensor público del imputado Nombre04 y la licenciada María Gabriela Montealegre Tomas, representante del Ministerio Público.

RESULTANDO:

I.Que mediante sentencia número 54-2015 de las catorce horas del ...08, el Tribunal de Juicio de San Ramón, resolvió: "POR TANTO: De acuerdo con las pruebas recabadas, reglas de la sana crítica racional, numerales 39 y 41 de la Constitución Política, ordinales 1, 2, 3, 4, 5, 6, 265, 343, 349, 351, 352, 354, 355 356, 357, 358, 360, 361, 363, 364, 365 y 367 del Código Procesal Penal, 1, 30, 31, 45, 50, 51, 59 a 62, 71 a 74 del Código Penal; artículos 33, 34, 57, 58 inciso a) de la Ley Forestal N°7575 este Tribunal en forma Unipersonal, resuelve declarar al imputado Nombre04 autor responsable de un delito de Invasión a una área de protección cometido en perjuicio de Los Recursos Naturales y en tal carácter se le impone una pena de tres meses de prisión que deberá descontar en el lugar y forma que determinen los reglamentos penitenciarios. Son las costas del proceso a cargo del Estado. Una vez firme esta sentencia, inscríbase en el Registro Judicial, comuníquese al Instituto Nacional de Criminología y al Juzgado de Ejecución de la Pena para lo de sus cargos.

Por reunir el imputado los requisitos legales para ello, se le CONCEDE el BENEFICIO DE EJECUCIÓN CONDICIONAL DE LA PENA por el plazo de TRES AÑOS, término dentro del cual el acusado no deberá cometer delito doloso alguno sancionado con pena superior a seis meses, caso contrario se revocará el beneficio otorgado. NOTIFÍQUESE. Elí Marcial Rodríguez Herrera. Juez de Juicio" (sic).

II.Que contra el anterior pronunciamiento, el licenciado Óscar González Zamora, en su condición de defensor público del imputado Nombre04, interpuso recurso de apelación de sentencia.

III.Que verificada la deliberación respectiva de conformidad con lo dispuesto por el artículo 465 del Código Procesal Penal, el Tribunal de Apelación de Sentencia del III Circuito Judicial de Alajuela, ...01, procedió a conocer del recurso.

IV. Que en los procedimientos se han observado las prescripciones legales pertinentes

Redacta la jueza de apelación de sentencia Escalante Moncada; y,

CONSIDERANDO:

I.El ...09, el licenciado Óscar González Zamora, en su condición de defensor público del imputado Nombre04, interpuso recurso de apelación de sentencia contra la resolución número 54-2015, emitida por el Tribunal de Juicio de San Ramón de las 14:00 horas del ...06.

II.En el primer motivo del recurso indica el apelante que existe una errónea aplicación de la ley sustantiva, debido a una equivocada imputación que formuló el Ministerio Público en la pieza acusatoria. Detalla que en el cuadro fáctico acusado se indicó como acción típica que el encartado podó 36 árboles de la especie Guaba, siendo que el verbo podar no está contemplado como una de las conductas contenidas en el artículo 58 de la Ley forestal, por lo que se le atribuyeron hechos que no eran constitutivos de delito. Refiere que esta situación provocó que el Tribunal de Juicio, en el análisis intelectivo tuv iera por demostrado una conducta diversa a la acusada, ya que se condenó al encartado por la acción de invadir la zona de protección, conducta que no fue acusada por el ente fiscal. Agrega que la conducta acusada no describe circunstancialmente hechos capaces de encuadrar dentro de la figura típica de invasión que está regulada en el inciso a) del artículo 58 de la Ley forestal.

Añade que en este aspecto, el fallo es contradictorio, ya que por un lado afirma que la conducta del imputado fue la de invadir la zona de protección y por otra parte, descarta la invasión y sostiene que la finalidad de la corta de árboles era para mejorar las condiciones del café existente en la zona. El apelante fustiga que los jueces de juicio no abordaron en la sentencia, la tesis defensiva de que en la realidad lo que se dio fue una poda general de 40 árboles de Guaba y no la poda de 36 y la corta de 4, aspecto que estima esencial, ya que la conducta de podar árboles es atípica. En el segundo motivo invoca violación al principio de inocencia. Sostiene que el juzgador revertió la carga de la prueba, ya que en el fallo se afirma que si una persona es acusada de un hecho sin haberlo cometido y sabe quién es el culpable , debe gestionar la prueba pertinente a fin de no cargar con una responsabilidad ajena.

Objeta dicha argumentación, ya que en nuestro sistema procesal le corresponde al Ministerio Público demostrar la culpabilidad de una persona y los elementos de prueba evacuados en el contradictorio deben ser suficientes para derribar el principio de inocencia. En el tercer motivo fustiga la valoración que hizo el juzgador de la declaración del imputado, del testimonio de Nombre05 y de la prueba documental, ya que en su criterio, el justiciable tiene un impedimento físico que desde mucho tiempo atrás le imposibilita utilizar una motosierra, por lo cual no era factible que se concluyera que fue su representado quien realizó la corta de árboles. Solicita se acojan los motivos de impugnación, se absuelva de toda pena y responsabilidad al encartado. Subsidiariamente peticiona que se anule el fallo y se ordene el juicio de reenvío. Por estar todos los reclamos vinculados con la fundamentación del fallo y la valoración de la prueba, se resolverán de forma conjunta.

Por voto de mayoría se declara con lugar el recurso. Este Tribunal se ha impuesto del contenido de la sentencia y ha examinado los reclamos del recurso, determinando que le asiste razón al apelante. Para una adecuada resolución de los reclamos planteados, es necesario transcribir la plataforma fáctica que se tuvo por demostrada en la sentencia, la cual quedó establecida de la siguiente manera: “Sin precisar la fecha exacta pero en el mes de ...01 el imputado Nombre04, se presentó a la finca ubicada en ...02, hoja cartográfica Miramar, escala 1:50.000 en las coordenadas Lambert 229:350 y 481:131. Una vez en el sitio y sin contar con el permiso de la Administración Forestal del Estado, podó las ramas de 36 árboles de la especie Guaba y cortó 4 árboles de la misma especie desde su tronco, a una altura de dos a cuatro metros desde el nivel del suelo, también de la especie Guaba los cuales se encontraban dentro de una zona de protección de una naciente de agua permanente.” (copia textual de folio178).

Según consta en la requisitoria fiscal y en el auto de apertura a juicio (folios 35 al 37 y del 49 al 50), la calificación jurídica asignada a dicha plataforma fáctica fue la de aprovechamiento ilegal de los recursos forestales contenida en el artículo 58 inciso b) de la Ley Forestal, sin embargo los hechos fueron recalificados en el fallo, a un delito de invasión a la zona de protección según la descripción del inciso a) de la citada normativa. Uno de los puntos objetados en el recurso, consiste en la calificación jurídica que le asignó el a quo al cuadro fáctico tenido por demostrado, ya que a criterio de la defensa pública, la conducta demostrada no encuadra en el verbo de invadir, el cual es el núcleo de la acción descrita en el inciso a) del artículo 58 de la Ley Forestal. El reclamo medular del primer motivo del recurso refuta el significado tan amplio que le dio el juzgador de instancia al verbo invadir.

Para dilucidar el punto en discusión es necesario analizar la conducta descrita en el inciso a) del artículo 58 de la Ley en comentario, el cual establece lo siguiente: “Se impondrá prisión de tres meses a tres años a quien : a) Invada un área de conservación o protección, cualquiera que sea su categoría de manejo, u otras áreas de bosques o terrenos sometidos al régimen forestal, cualquiera que sea el área ocupada; independientemente de que se trate de terrenos privados del Estado u otros organismos de la Administración Pública o de terrenos de dominio particular. Los autores o partícipes del acto no tendrán derecho a indemnización alguna por cualquier construcción u obra que hayan realizado en los terrenos invadidos”. Ahora bien, según se desprende de la citada normativa, la acción típica está definida por el verbo invadir, el cual según el diccionario de la Real Academia Española, tiene las siguientes acepciones de interés para la resolución del presente asunto: i) Irrumpir, entrar por la fuerza, ii) Ocupar anormal o irregularmente un lugar.

Asimismo, ocupar significa “tomar posesión o apoderarse de un territorio, de un lugar, de un edificio, etc., invadiéndolo o instalándose en él”. Ahora bien, a falta de una definición legal del vocablo invadir, es necesario hacer una interpretación de la norma, según la cual se debe averiguar el significado o significados de las palabras en su sentido lingüístico y conforme a la significación gramatical en que son empleados los vocablos dentro de la frase correspondiente. En el supuesto que se analiza, se observa que todo el párrafo contenido en el inciso a) del artículo 58 de la Ley Forestal utiliza el vocablo invadir en sus dos significados, ingresar por la fuerza y el de ocupación ilegal, lo cual guarda concordancia con las consecuencias civiles de la conducta delictiva descrita en dicho inciso, en el cual se estipula la pérdida o derribo de las edificaciones u obras realizadas en dicha zona.

De igual modo, aunque no se diga expresamente, por la construcción gramatical del tipo penal, se infiere inequívocamente que el verbo invadir está circunscrito también a la acción de ocupación. Otro fundamento que apoya la interpretación que realiza la mayoría de esta Cámara de Apelación se encuentra en el artículo 2 del Código Procesal Penal, que prohíbe la interpretación extensiva o la analógica, norma que tiene como sustento el principio pro libertatis, el cual obliga a los jueces a interpretar las normas de forma tal que favorezca la libertad del inculpado y no al contrario. Así las cosas, con base en lo anterior se tiene que la acción típica descrita en la norma de interés es la de invadir u ocupar un área de protección o conservación, ya sea mediante el ingreso forzoso o la ocupación de ese tipo de terrenos. Volviendo al caso bajo examen, del fallo se deduce que hay un hecho no controvertido y es el referido a que el encartado ingresó a un terreno -sin demostrarse que fue mediante el uso de la fuerza o la violencia-, en el cual existe una naciente permanente y por ende todos los árboles que están sembrados dentro del radio de cien metros de la naciente, están ubicados en una zona de protección de conformidad con la disposición del artículo 33 de la Ley Forestal.

Ahora bien, corresponde dilucidar cuál fue el significado que le otorgó el juez de juicio al verbo invadir en este caso en particular. De un examen de la sentencia, se deduce que para el Tribunal de instancia, invasión significa realizar cualquier acción que esté prohibida por el ordenamiento jurídico. En este sentido, el juez de instancia argumentó: “ Una vez valorada la prueba en sus diferentes aspectos y tenido por demostrada la hipótesis fáctica acusada por el Ministerio Público, corresponde adecuar dicha conducta a una figura penal, en este sentido se considera subsumida en el tipo penal del artículo 58 inciso a) de la Ley Forestal N° 7575, que señala: "Artículo 58.- Se impondrá prisión de tres meses a tres años a quien: a) Invada una área de conservación o protección, cualquiera que sea su categoría de manejo, u otras áreas de bosque o terrenos sometidos al régimen forestal, cualquiera que sea el área ocupada; independientemente de que se trate de terrenos privados del Estado u otros organismos de la Administración Pública o de terrenos de dominio particular.

Los autores y partícipes del acto no tendrán derecho a indemnización alguna por cualquier construcción u obra que hayan realizado en los terrenos invadidos". Ahora bien los elementos normativos que deben demostrarse los constituyen el verbo típico que según se indica esta compuesto por la acción de invadir, un segundo elemento una área de protección y por referencia a este mismo aspecto determinar la existencia de una naciente, así como que la acción estuviera dentro del rango de protección terrenal asignado a tal recurso hídrico. En cuanto al verbo invadir este Tribunal considera que su interpretación no resulta limitada por el derecho civil como despojo y mantenerse en un lugar determinado, que aunque la contempla también se entiende como la corta y poda prohibida por ley o sea el verbo invadir incluye realización de actos prohibidos por ley en las áreas designados por la ley. En este sentido el artículo 34 de la Ley Forestal indicada prohíbe la corta o eliminación de árboles en áreas de protección de las descritas en el artículo anterior o sea el artículo 33: "Artículo 33.- Á reas de protección.

Se declaran áreas de protección las siguientes: a) Las áreas que bordeen nacientes permanentes, definidas en un radio de cien metros medidos de modo horizontal... Artículo 34.- Prohibición de talar en áreas protegidas. Se prohíbe la corta o eliminación de árboles en las áreas de protección descritas en el artículo anterior, excepto en proyectos declarados por el Ejecutivo como de conveniencia nacional..." En este sentido se ha indicado: Existen diversas interpretaciones sobre el alcance del verbo "invadir", las cuales van desde la más amplia que incluye cualquier daño a las áreas objeto de tutela, hasta la más estricta, sostenida por los que afirman que solo se comete el delito, cuando hay despojo de terreno. La Fiscalía Ambiental del Ministerio Público, al igual que el Tribunal de Casación Penal, han mantenido una posición intermedia al considerar como invasión, el despojo de terreno, pero también todos aquellos actos, aunque sean cometidos por el dueño del terreno que implique construcción de cualquier tipo de edificación sobre las áreas de protección o de conservación, como por ejemplo cercas, tanques, casas, etc...

Esta interpretación se base en lo dicho sobre el buen jurídico protegido, pues la penalización de la "invasión", sobre todo en las áreas de protección del artículo 33 de la LF que incluye la prohibición de corta en estas áreas, contenida en el artículo 34 de la misma ley, se hace en función de la protección del recurso hídrico y de los ecosistemas asociados a este.” (el subrayado es suplido) (copia textual de folios 186 y 187). Del anterior extracto se desprende con claridad, que para el a quo el verbo invadir, incluye no solo la acción de ocupar de forma ilegal un terreno, sino la realización de cualquier otra actividad que esté prohibida por el ordenamiento jurídico. La interpretación que hace el juzgador de instancia aparte de ser una interpretación extensiva del verbo invadir, deviene en una analogía, pues equipara la acción de invadir, con cualquier otra conducta que esté vedada realizar dentro del área de protección, siendo que este tipo de interpretaciones está prohibida de forma expresa por lo establecido en el artículo 2 del Código Procesal Penal.

En este orden de ideas, aunque el juez de juicio sustentó su posición en la norma contenida en el artículo 34 de la Ley Forestal que establece que no es permitida la corta de árboles, -lo cual incluye la acción de podarlos- que se encuentren en áreas de protección o conservación, esa interpretación es extensiva, por lo que el fundamento otorgado en sentencia deviene en incorrecto. Aun cuando es posible realizar una interpretación sistemática y teleológica de la ley, para atender a las diversas conexiones de la norma en particular con el resto del ordenamiento jurídico y a la vez encontrar el alcance del precepto legal bajo estudio, tales métodos encuentran un límite en el principio de legalidad, que como ya se dijo impide llevar la interpretación de la ley a parámetros generales de aplicación, como se pretende en este caso. Adicionalmente, como se deduce del cuadro fáctico descrito en la acusación, al encartado no se le imputó la acción de haber ingresado por la fuerza al citado terreno, por lo que tampoco se podría configurar la otra modalidad de comisión descrita en el inciso a) del artículo 58 de la Ley Forestal.

Por otra parte, corresponde analizar si la conducta tenida por demostrada en el fallo es constitutiva de alguna otra delincuencia. En este sentido, entre las acciones tipificadas como delictivas en la citada normativa especial, se encuentra la descrita en el inciso b) del artículo 58, la cual establece lo siguiente: “ b) Aproveche los recursos forestales en terrenos del patrimonio natural del Estado y en las áreas de protección para fines diferentes de los establecidos en esta ley.” Según lo regula de forma expresa el artículo 3 de la Ley Forestal, el aprovechamiento de recursos forestales “consiste en la acción de corta, eliminación de árboles maderables en pie o utilización de árboles caídos, realizada en terrenos privados, no incluida en el artículo 1 de esta ley, que genere o pueda generar algún provecho, beneficio, ventaja, utilidad o ganancia para la persona que la realiza o para quien esta representa”.

La definición expresa del verbo aprovechar, que en este caso nos provee la propia ley forestal, permite concluir que la corta de árboles en las zonas de protección no sólo es una acción prohibida según la previsión contenida en el artículo 34 de la Ley Forestal, sino que es una conducta punible conforme el tipo penal establecido en el artículo 58 inciso b) de la citada normativa especial. Ahora bien, corresponde analizar si los hechos tenidos por demostrados, podrían encuadrar en esta otra conducta delictiva. Examinados los autos, estima esta Cámara de Apelación de Sentencia que los hechos demostrados no contienen todos los elementos necesarios que se requieren para adecuar dicha conducta al delito previsto en el artículo 58 inciso b) de la Ley Forestal. Como se observa, según la descripción típica contenida en el inciso b) de la norma en comentario, el núcleo de imputación del tipo penal, hace referencia al aprovechamiento forestal, en determinados terrenos, entre ellos, los declarados como áreas de protección, que es el caso aquí examinado.

Sobre este delito en particular, el Tribunal de Apelación de Sentencia del Segundo Circuito Judicial de San José ha externado -en lo conducente- lo siguiente: “Como se observa el núcleo de imputación del tipo penal del artículo 58 inciso b) de la Ley Forestal, hace referencia al aprovechamiento forestal pero de determinados terrenos: del patrimonio natural del Estado y en áreas de protección. Dichos aspectos constituyen elementos normativos del tipo que necesariamente forman parte del núcleo central de imputación y, que por ende, deben integrarse a la pieza acusatoria y a los hechos tenidos por demostrados en sentencia, pero nunca reiterando dentro de la relación de hechos de forma textual esos conceptos normativos, en sustitución de la especie fáctica que los debería describir. Como sucede con otros delitos, el fiscal al formular la acusación describe la acción o conducta dentro de un determinado segmento temporal-espacial y, según las exigencias básicas impuestas por el tipo penal imputado adicionará otras circunstancias pertinentes, por ejemplo, resultados, descripción de especiales condiciones personales, entre otros.

Entonces si se atribuye un delito de hurto, resulta inaceptable una técnica que se limite a indicar en la acusación que se dio un desaporamiento de un determinado bien, pues lo que debe hacerse es describir cómo se desarrolló el hecho, luego, si se comprueba esa hipótesis fáctica, el juzgador podrá valorar y determinar si esa enunciación demostrada se adecua a un tipo penal. El delito atribuido a la justiciable Nombre01. contiene elementos normativos, y éstos exigen la remisión a otras normas previstas -en este caso- en la Ley Forestal, que le dan contenido a esas expresiones; es decir, se trata de conceptos jurídico penales específicos. (...) El tipo objetivo previsto en el artículo 58 inciso b) de la Ley Forestal, sanciona la acción de aprovechamiento forestal y eso implica describir la conducta acusada para determinar luego, si demostrada, constituye un supuesto de aprovechamiento. De nuevo, es imprescindible una remisión a la Ley Forestal que en el artículo 3 establece que para efectos de esa ley, se considera aprovechamiento: "Acción de corta, eliminación de árboles maderables en pie o utilización de árboles caídos, realizada en terrenos privados, no incluida en el artículo 1 de esta ley, que genere o pueda generar algún provecho, beneficio, ventaja, utilidad o ganancia para la persona que la realiza o para quien esta representa." Es decir, la configuración del tipo penal de aprovechamiento requiere no solo indicar la conducta realizada (que pueden ser varias) sino también el eventual o efectivo resultado generado y que se describe en términos positivos para el agente.

En suma, este elemento normativo por disposición de ley, alude a dos diversas circunstancias: 1) una serie de acciones (corta, eliminación de árboles en pie o utilización de los caídos) y, 2) una determina ventaja, ganancia, utilidad o beneficio, a quien realiza la acción o a un tercero que representa; que por cierto, no se limita a un aspecto de contenido puramente económico y que por ende, se puede traducir en muy diversos supuestos (paisajisticos, posibilitar construcción de obras en el lugar, uso de la madera para fines artísticos, etc.). Desde ese punto de vista, en el sub examine, el requerimiento fiscal sólo establece con claridad el primer aspecto del elemento normativo "aprovechamiento", es decir, que sin el permiso correspondiente se dio la corta de al menos cinco árboles (dentro de un área de protección, que realizaron tres sujetos de calidades desconocidas contratados por la imputada Nombre01.).

Pero el aprovechamiento forestal no solo se integra con la descripción de la acción (en este caso la corta de árboles), requiere también puntualizar cuál es la situación de utilidad que dimana o emerge para el sujeto activo o para quien él represente. En autos, la acusación describe solo parcialmente ese elemento normativo, pues nunca se señaló cuál fue el provecho, ventaja, ganancia o utilidad que dicha actividad generó a la acusada y esa es una exigencia ineludible del tipo objetivo, sea de lo establecido en el artículo 58 inciso b) en relación con el artículo 3 de la Ley Forestal.” (Sentencia número 444-2011). La anterior línea de pensamiento es compartida por esta Cámara de Apelación de Sentencia, en razón de que la acusación que formule el Ministerio Público debe contener la descripción objetiva de la conducta que la propia ley prevé como delito, lo que no solo garantiza una adecuada imputación, sino el ejercicio pleno del derecho de defensa.

Volviendo al caso bajo examen, el hecho acusado por el ente fiscal (ver folio 164) sólo establece con claridad el primer aspecto del elemento normativo del delito de aprovechamiento forestal, es decir, que el imputado cortó 4 árboles y podó 36 árboles, todos ellos ubicados dentro de un área de protección, lo cual realizó sin contar con los permisos de la administración forestal, pero no describió, como era requisito indispensable, en qué consistió el aprovechamiento que el encartado obtuvo con esa acción prohibida, aspectos todos que forman parte de la tipicidad objetiva del delito atribuido y que deben ser conocidos por el encartado, con el fin de ejercer su derecho de defensa también sobre esos extremos. En este punto en particular, a pesar de que en la sentencia el juez argumentó que la poda y corta de árboles se hizo para mejorar las condiciones de un sembradío de café existente en la zona, ese hecho no se incluyó dentro de la imputación fáctica descrita en la acusación, ya que como se dijo, nunca se señaló cuál fue el provecho, ventaja, ganancia o utilidad que dicha actividad generó en el acusado y esa es una exigencia ineludible del tipo objetivo establecido en el artículo 58 inciso b) en relación con el artículo 3 de la Ley Forestal.

Tampoco se investigó o se imputó si la siembra existente de café en la zona de protección fue realizada por el justiciable o por una tercera persona. En este caso en particular, se denota no sólo una deficiente investigación por parte del Ministerio Público y de las autoridades administrativas encargadas de vigilar este tipo de zonas de protección, sino también es claro que existe una inadecuada imputación, lo que no permite tener por configurada las conductas penales aludidas. De igual manera, tampoco los hechos probados configurarían el delito previsto en el artículo 90 de la Ley de Conservación de Vida Silvestre, ya que al encartado no se le imputó la acción de destruir el área de protección o de extraer plantas de dicha zona, sumado a que ese extremo no fue objeto de discusión en la fase plenaria. En virtud de lo expuesto, por no encuadrar los hechos tenidos como probados en el delito de invasión a una zona protegida, ni tampoco en el de aprovechamiento forestal -esto último dadas las evidentes deficiencias que presenta el requerimiento fiscal-, se declara con lugar el motivo formulado y en apego a lo establecido en el artículo 179 del Código Procesal Penal, no siendo factible acudir al saneamiento, pues la fase para corregir la acusación formulada, ya precluyó; se absuelve al justiciable Nombre04 de toda pena y responsabilidad por el delito de invasión y por ilícito de aprovechamiento forestal en perjuicio del recurso forestal. En razón de lo resuelto, por innecesario se omite pronunciamiento respecto a los otros motivos de apelación formulados por el recurrente.

III.Voto salvado de la cojueza Enríquez Chavarría. Conforme se expondrá, disiento parcialmente del voto de mayoría de esta Cámara de Apelación de Sentencia Penal, en cuanto anula la sentencia recurrida y absuelve de toda pena y responsabilidad al imputado Nombre04, por la acción del encartado, descrita en los hechos probados del fallo apelado, como podar, sin contar con el permiso de la Administración Forestal del Estado, 36 árboles de la especie Guaba, y cortar 04 árboles de la misma especie desde su tronco, a una altura de dos a cuatro metros desde el nivel del suelto, los cuales se encontraban dentro de una zona de protección de una naciente de agua permanente (folio 178). Estos hechos, fueron calificados por el Juzgador a quo, como un delito de invasión a una zona de protección contemplado en el artículo 58 inciso a) de la Ley Forestal, y a partir de esa calificación jurídica las co-Juezas que conforman el voto de concluyeron que tales eventos no podían ser subsumidos en ese tipo penal, por lo cual absolvieron al encartado.

Ahora bien, en el voto de mayoría, también se valoró la posibilidad de que la acusación en contra del justiciable configurara un delito de aprovechamiento ilegal de madera, determinándose que tampoco era posible esa calificación jurídica -conclusión con la que concuerdo-. Sin embargo, en ese voto mayoritario no se consideró que los hechos acusados contra el justiciable Nombre04, en criterio de esta Jueza de Apelación de Sentencia Penal, pueden constituir el delito contemplado en el artículo 90 de la Ley de Conservación de Vida Silvestre. Este numeral señala que: “Será sancionado con pena de multa de uno (1) a tres (3) salarios base o pena de prisión de dos (2) a cuatro (4) meses, y el comiso de las piezas que constituyen el producto de la infracción, quien extraiga o destruya, sin autorización, las plantas o sus productos en áreas oficiales de protección o en áreas privadas debidamente autorizadas.

(Así reformado por el artículo 1° de la ley N° 8689 de ...02)”. Para determinar si la acción del acriminado se subsume en este tipo penal, deben definirse los elementos que configuran la ilicitud señalada. En el caso que nos ocupa, la acción del acusado recayó sobre árboles, los cuales se encuentran dentro de la categoría de plantas, los cuales se indicó que podó y cortó, por lo que en el sub examine, el verbo típico aplicable -dentro de los contemplados en el artículo 90 citado- sería el de destruir. Según el diccionario de la Real Academia de la Lengua Española, dentro de las acepciones de la palabra destruir se encuentra: "reducir a pedazos o cenizas algo material, u ocasionarle un grave daño” (consultado en línea, ...01) . A partir de este concepto, puede indicarse que la acción de podar -es decir cortar las ramas de los árboles-, y además cortar otros cuatro árboles desde el tronco, equivalen a destruir esa vegetación.

Esa conclusión encuentra sustento en la prueba valorada por el Juez de juicio en el fallo apelado, de la cual se derivó que algunos de los árboles cortados -al menos 05- no lograron recuperarse, pero que además esa acción causó daños a la vegetación circundante, producto de la caída de los árboles cortados (ver folio 182 y 188). La poda y corta de árboles, fue ejecutada sin que el imputado contara con autorización estatal para ello, y se produjo dentro de un área privada debidamente autorizada. Según el artículo 2 de la Ley de Conservación de Vida Silvestre, la áreas privadas debidamente autorizadas, son aquellos “terrenos privados sometidos al régimen forestal, a programas de pago de servicios ambientales, a servidumbres ecológicas o a cualquier otro régimen de conservación acordado por parte de sus propietarios”. En este caso, la zona en la que se realizó la corta de los árboles, por parte del encartado, se trata de un terreno privado sometido al régimen forestal, ya que según indica el numeral 3 de la Ley Forestal, el régimen forestal se conforma por el “conjunto de disposiciones y limitaciones de carácter jurídico, económico y técnico, establecidas por esta ley, su reglamento, demás normas y actos derivados de su aplicación, para regular la conservación, renovación, aprovechamiento y desarrollo de los recursos forestales.”.

Resulta que el artículo 33 de la misma Ley Forestal, declara como área de protección, las que “bordeen nacientes permanentes, definidas en un radio de cien metros medidos de modo horizontal.”, por lo cual la norma en cuestión establece una limitación a la propiedad, con la finalidad de proteger toda el área circundante -en un radio de 100 metros- de las nacientes permanentes. En el caso que nos ocupa, la sentencia señaló que la naciente que se ubicaba en el lugar de los hechos era de carácter permanente y que los árboles cortados, de los cuales 05 murieron, se encontraban a una distancia máxima de 40 metros y a una distancia mínima de diez. Por lo indicado, concluye esta Jueza de segunda instancia, que los hechos por los que se condenó al encartado, configuran un delito de destrucción ilegal de vegetación, contemplado en el artículo 90 de la Ley de Conservación de Vida Silvestre, por lo que se revoca el fallo apelado en cuanto a la calificación jurídica otorgada a los hechos demostrados contra el justiciable Nombre04, y se recalifican los mismos conforme la norma señalada.

Como el delito por el que se han recalificado los hechos contempla tanto pena de multa como de prisión, es necesario anular el fallo en cuanto a la imposición de pena impuesta, y reenviar el asunto para nueva sustanciación sobre este extremo únicamente. Por último, en relación con las consideraciones expuestas por las co-Juezas que votaron en mayoría, debo indicar que tampoco comparto la definición que hacen en dicha resolución en cuanto al verbo “invadir” contemplado en el artículo 58 inciso a, de la Ley Forestal. En este sentido, debo indicar que concuerdo con el criterio vertido por el Tribunal de Casación Penal de San José, en el voto 751-2002, de 10:45 horas del ...04, el cual se indica: “...Es cierto que la acción delictiva establecida por el § 58.c de la Ley Forestal consiste en invadir un área de conservación o de protección, pero el contenido del término no es el despojo o ingreso al dominio de otro.

Como las áreas de conservación suponen una limitación genérica, a todo propietario de inmuebles por los que corren los ríos de ...03, con la finalidad de preservar el ambiente natural, la salud, la ecología y lo poco que pueda salvarse para el equilibrio del planeta Tierra, tal restricción al dominio es un régimen que obliga a mantener intacta la porción del inmueble bajo la tutela estatal, de donde deriva la posibilidad de realizar en aquella únicamente los actos permitidos por ese régimen. De este modo, invadir el área de protección se traduce en realizar sobre ella cualquier acto no permitido, lo que puede hacer cualquiera ya sea propietario o un tercero. Por ello no lleva razón el recurrente cuando afirma que su patrocinado, por ser titular del derecho de propiedad del inmueble, limitado en una parte que es área de protección, no pudo invadir porque el objeto de la acción no es ajeno; antes por el contrario, cometió el hecho el imputado Nombre02 y lo puede cometer cualquiera otra persona.

Por lo expuesto se declara sin lugar el reclamo.”. Este criterio fue reiterado y ampliado en el voto 713-2003 de 10:56 horas del ...03, del mismo Tribunal de Casación Penal de San José, en el cual se expuso: “... Esta cámara luego del análisis de los hechos demostrados, en cuanto a la acción típica descrita en la norma del artículo 58 inciso a), en relación con las que describen las áreas protegidas 33 inciso a) y 34 de la Ley Forestal determina, que la acción de deforestar en un área protegida se ejecuta, según los sinónimos del verbo invadir que consta en el Diccionario Consultor Larousse de Sinónimos, tercera edición de ...07 pag. 437, con la acción de irrumpir, penetrar, ocupar, acometer etc., de tal forma que la acción de invadir a que alude el recurrente, no se refiere a la de invadir con fines de ejercer posesión, sino también puede efectuarse como lo indica el legislador a nuestro juicio con la acción de irrumpir, penetrar, ocupar, acción que describe el juzgador como la ejecutada por el imputado, el cual fue sorprendido cuando ejecutaba la acción, de haber penetrado en el área que bordea una naciente y quebrada y ejecutar una deforestación, con lo cual evidentemente causó un daño ambiental importante en la zona protegida.

La anterior acción la describe el a quo al folio 231 cuando indica: "el aquí acusado Nombre03, quien sin contar con permiso alguno procedió a deforestar un bosque protegido o intervenido, causando un perjuicio a la flora y fauna del lugar, pues, como se dijo, dicho encartado realizó la deforestación de parte de un bosque primario ubicado en esa zona..." de tal forma, que se demostró en el fallo tal y como lo fundamentó el juzgador, que el imputado ejecutó la tipicidad objetiva descrita en la norma penal, al deforestar la zona protegida de una naciente y quebrada y la tipicidad subjetiva al ejecutar la acción con total dominio del hecho delictivo que ejecutaba...”. La interpretación vertida en los fallos citados corresponde a una interpretación sistemática de la norma, y es acorde a protección que la misma normativa forestal pretende dar a los recursos naturales de este país. Tampoco atenta contra los derechos del imputado, en el tanto no se establece que es cualquier acción realizada en el área de protección la que se sanciona, sino tan solo aquellas que la misma Ley Forestal prohíbe.

POR TANTO

Por voto de mayoría se declara con lugar el recurso de apelación interpuesto por la defensa. Se absuelve al justiciable Nombre04 de toda pena y responsabilidad por el delito de invasión y por el delito de aprovechamiento forestal en perjuicio del recurso forestal. En razón de lo resuelto, por innecesario se omite pronunciamiento respecto a los otros motivos de apelación formulados por el impugnante. La jueza Enríquez Chavarría salva el voto, recalifica lo hechos a un delito de destrucción ilegal de vegetación, previsto y sancionado en el artículo 90 de la Ley de Conservación de Vida Silvestre y ordena el reenvío de la causa para nueva sustanciación, únicamente en cuanto a la imposición de la pena. Notifíquese.
