DECISION N° 663-C-16 AGRARIAN COURT. SECOND JUDICIAL CIRCUIT OF SAN JOSÉ.- At fourteen hours and thirty-three minutes on quince de julio de dos mil dieciséis.- DEMOLITION INTERDICT (INTERDICTO DE DERRIBO) filed by CARIARI COUNTRY CLUB SOCIEDAD ANONIMA, legal entity identification number CED1 - - , represented by its president, Mr. [Nombre1], vested with powers as a general attorney-in-fact without limitation as to amount, of legal age, married, business administrator, resident of San José, identity card number CED2 - - ; against THE STATE. Attorney Erasmo Rojas Madrigal, of legal age, widowed, attorney-at-law, resident of San José, identity card number CED3 - - , participates in these proceedings as special judicial attorney-in-fact for the plaintiff company. WHEREAS
I.In the ruling issued at 15:31 on ocho de junio del dos mil dieciséis, the court below declined jurisdiction (se inhibió por incompetencia) based on subject-matter jurisdiction, finding that this is not an agrarian interdict proceeding because the property is not agrarian in nature and is the land of a country club golf course (Associated Documents Tray 08/06/2016 03:31:01 pm).-
II.Regarding jurisdiction over demolition interdicts, this Court has ruled: “II. A demolition interdict is appropriate when the poor condition of a building, structure, or tree poses a threat to the rights of possessors or passersby, or may harm public property. It follows from the complaint that the alleged danger is associated with a 15-meter-tall almond tree, which, according to the complaint, poses a risk to passersby that increases during the rainy season. The specific harm is alleged by a person who states that he works in commercial premises located beside that tree. In this regard, the Court finds that this proceeding does fall within the jurisdiction of the Agrarian Jurisdiction because trees are natural resources that form part of national biodiversity. Trees, as natural resources, are regulated, among other provisions, by the Ley de Biodiversidad, Article 11(3) of which provides that the environmental public interest is one of the criteria for applying that legislation.
Specifically, the provision states: ‘The use of elements of biodiversity must safeguard the development options of future generations, food security, ecosystem conservation, the protection of human health, and improvement of citizens’ quality of life.’ Such matters must be considered in deciding these proceedings because a natural resource is at issue, and subject-matter jurisdiction to make that determination is reserved by law to this Jurisdiction. In essence, Article 108 of the Ley de Biodiversidad provides: ‘In biodiversity matters, and until an environmental jurisdiction exists, every dispute shall fall within the exclusive jurisdiction of the Contentious-Administrative Jurisdiction. As exceptions to the preceding rule, offenses against biodiversity shall be adjudicated by the criminal jurisdiction; likewise, disputes arising between private parties that do not involve an administrative act or public-domain property shall fall within the jurisdiction of the Agrarian Jurisdiction.’ It follows from the foregoing that, since this is a proceeding in which a private person asserts a claim relating to a natural resource, it falls within the subject-matter jurisdiction of the agrarian courts under the cited legislation; therefore, the declination of jurisdiction (inhibitoria) ordered by the Court must be rejected.” (Voto N. 1577 -C-12 de las 12:15 del 20 de diciembre de 2012. III- In this case, the plaintiff, Club Cariari Country Club S.A., in its capacity as possessor and owner of property registered under number CED4 in Heredia, filed these proceedings alleging danger from a tree located along the boundary between its land and a stream or irrigation ditch (acequia) (see photographs 3 and 4 in the Site Visit Report submitted by Forestry Engineer Daniel Céspedes Zumbado as documentary evidence with the complaint), where cedar, foreign poró, pine, espavel, and gravilia trees stand within a protected area (zona de protección). It states that, if the tree were to fall, it would affect the electrical lines, posing a risk to the club’s clients, staff, facilities, and adjoining properties. This Court finds that, regardless of the nature of the property on which the tree sought to be felled is located due to the alleged danger, because that forest element forms part of the natural resources, these proceedings fall within the jurisdiction of this court pursuant to Article 108 of the Ley de Biodiversidad. As to territorial jurisdiction, under Article 16 of the Ley de Jurisdicción Agraria, the court of origin must continue the proceedings, because the property on which the tree at issue in this interdict is located lies in the district of Asunción, canton of Belén, province of Heredia.
IV.In view of the foregoing, pursuant to Articles 11(3) and 108 of the Ley de Biodiversidad and Articles 1 , 2 and 16 of the Ley de Jurisdicción Agraria, the declination of jurisdiction must be rejected, and the case file must be remanded to the court of origin so that it may continue processing the case.
THEREFORE:
The declination of jurisdiction ordered by the Agrarian Court of the First Judicial Circuit of Alajuela is rejected. This proceeding is declared to fall, by reason of subject matter, within the jurisdiction of the Agrarian Jurisdiction and, by reason of territory, within the jurisdiction of the court of origin. Once this decision becomes final, the case record shall be remanded to the court of origin so that it may continue processing the case.

VOTO N° 663-C-16 TRIBUNAL AGRARIO. SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ.- A las catorce horas y treinta y tres minutos del quince de julio de dos mil dieciséis.- INTERDICTO DE DERRIBO interpuesto por CARIARI COUNTRY CLUB SOCIEDAD ANONIMA, cédula jurídica CED1 - - , representada por su presidente con facultades de apoderado generalísimo sin límite de suma el señor [Nombre1] , mayor, casado, administrador de empresas, vecino de San José, cédula de identidad número CED2 - - ; contra EL ESTADO. Actúa en este proceso como apoderado especial judicial de la sociedad actora el licenciado Erasmo Rojas Madrigal, mayor, viudo, abogado, vecino de San José, cédula de identidad número CED3 - - . CONSIDERANDO
I.La a quo, en resolución dictada a las 15:31 horas del ocho de junio del dos mil dieciséis se inhibió por incompetencia por razón de la materia, al considerar que no se trata de un proceso interdicto agrario ya que el inmueble no es de naturaleza agraria y que es terreno de cancha de golf de un country club (Bandeja de documentos asociados08/06/2016 03:31:01 pm).-
II.Sobre el tema de competencia en materia de interdictos de derribo, este Tribunal ha resuelto:" II. El interdicto de derribo procede cuando el mal estado de un edificio, construcción o árbol, constituyan una amenaza para los derechos de las personas poseedoras o transeúntes, o pueda perjudicar algún bien público. De la demanda se desprende, la peligrosidad alegada está vinculada con un árbol de almendro de una altura de 15 metros, el cual se indica, constituye un riesgo para las personas transeúntes, el cual se incrementa por la temporada lluviosa. La afectación concreta la plantea quien dice laborar en un local comercial que se localiza al lado de dicho árbol. Al respecto, estima el Tribunal sí se está en presencia de un proceso competencia de la Jurisdicción Agraria debido a que los árboles constituyen recursos naturales parte de la biodiversidad nacional. Los árboles como recursos naturales, se encuentran regulados, entre otras normas, por la Ley de Biodiversidad, la cual dispone en el inciso 3 del artículo 11 que uno de los criterios de aplicación de esa normativa lo constituye el interés público ambiental.
Concretamente, señala la norma: "El uso de los elementos de la biodiversidad deberá garantizar las opciones de desarrollo de las futuras generaciones, la seguridad alimentaria, la conservación de los ecosistemas, la protección de la salud humana y el mejoramiento de la calidad de vida de los ciudadanos". Tales aspectos deberán ser considerados para la resolución de este proceso, al estar de por medio un recurso natural; y la competencia material para tal determinación está reservada por ley a esta Jurisdicción. Básicamente, el numeral 108 de la Ley de Biodiversidad señala: "En materia de biodiversidad y mientras no exista una jurisdicción ambiental, toda controversia será competencia exclusiva de la jurisdicción contencioso administrativa. Como excepciones a la regla anterior, los delitos contra la biodiversidad serán juzgados por la jurisdicción penal; de igual modo, las controversias que se susciten entre particulares, donde no medie un acto administrativo ni del dominio público, serán competencia de la jurisdicción agraria".
De lo expuesto se concluye, al estarse en presencia de un proceso en el cual una persona particular plantea un reclamo en relación con un recurso natural, el mismo es parte de la competencia material de los tribunales agraria conforme a la normativa citada, de ahí que deba improbarse la inhibitoria declarada por el Juzgado".(Voto N. 1577 -C-12 de las 12:15 del 20 de diciembre de 2012. Señalando que de caer, afectaría el tendido eléctrico, con riesgo para clientes del club, colaboradores instalaciones y fincas colindantes. Estima este Tribunal, independientemente de la naturaleza del fundo donde se ubique el árbol que se solicita derribar en virtud de la peligrosidad alegada, al ser parte ese elemento forestal de los recursos naturales, compete a esta jurisdicción su tramitación, con fundamento en el numeral 108 de la Ley de Biodiversidad. Por razón del territorio, acorde con el artículo 16 de la Ley de Jurisdicción Agraria, es el juzgado de origen el que debe continuar con los procedimientos, pues el fundo donde se sitúa el árbol en cuestión objeto de este interdicto, tiene la situación en el distrito Asunción del cantón Belén de la provincia de Heredia.
IV.En razón de lo expuesto, con fundamento en los numerales 11 inciso 3 y 108 de la Ley de Biodiversidad, 1 , 2 y 16 de la Ley de Jurisdicción Agraria, deberá improbarse la inhibitoria y disponerse la remisión del expediente al Juzgado de origen para que continúe con la tramitación del proceso.
POR TANTO:
Se imprueba la inhibitoria declarada por el Juzgado Agrario del Primer Circuito Judicial de Alajuela. Se declara este proceso por razón de la materia es competencia de la Jurisdicción Agraria, y por razón del territorio del Juzgado de origen. Firme esta resolución, remítase los autos al juzgado de origen para que continúe con la tramitación del proceso.
