WHEREAS
I- By order issued at 15:33 hours on 11 de mayo del 2016 (folio 251), the Agrarian Court of the First Judicial Circuit of the Atlantic Zone (Limón) referred to this Court the jurisdictional challenge based on subject matter (excepción de incompetencia por razón de la materia), timely filed by the defendant (folios 138 to 140).
II- In its complaint, the plaintiff states that it is the registered owner and possessor of three adjoining properties classified as agricultural. The first has an area of 100.361,27 square meters, the second property 213.939,79 square meters, and the third tract 362.510,13 square meters. Their combined area is approximately 120 hectares. Its purpose, it states, is to exploit the existing soil material on the properties by applying for a concession for its extraction, in addition to protecting the biodiversity that has been preserved. It alleges that, since acquiring the properties, it has exercised full possession. It states that Tajo Chirripó S.A., arbitrarily and unlawfully, has conducted extraction operations within its properties, affecting flora and fauna in violation of its rights. These operations have affected the riverbed (cauce) and the land covered by its waters during the highest floods.
It explains that the lands from that point onward are registered in its name. This has caused the diversion of the body of water. Furthermore, its survey plan shows that it is the registered owner of the adjoining land. It states that mining file N. 30-90 of Geología y Minas contains the geologist’s reports concerning the damage that occurred and that part of our lands was incorporated into the concession, although neither the current registered owner nor the previous owners authorized their inclusion in the material-extraction operations. The extraction activity has been conducted to the detriment of reforestation areas and the riverbank. All of this violates article 33 of Ley Forestal and articles 8 and 11 of Ley de Biodiversidad. The foregoing, it argues, is the reason for the complaints it has filed in order to compel the immediate suspension of the work and the eventual assessment of the environmental damage. As relief in its complaint, it principally requests declarations that:
III- Having reviewed the record, this Court finds that this matter is agrarian in nature because the complaint does not seek review of an administrative act or conduct, or of the legality of an action by the State in the exercise of its oversight authority. Rather, it constitutes an action in rem (acción real) concerning the right of ownership and possession over real property. The jurisdictional challenge based on subject matter must be denied because the relief sought in the complaint is directed toward declaring that the defendant interfered with the possession and ownership rights over three registered properties of an agrarian nature, over which public, peaceful, uninterrupted possession has been exercised as owner. It also concerns liability for damage caused to the properties through the extraction of material from the riverbed and surrounding lands, as well as an order requiring the defendant company to refrain from interfering with the plaintiff’s possession.
The defendant did not file a counterclaim. The subject matter of the proceeding is therefore defined by the allegations in the complaint and the answer. As may be inferred from the preceding recital, this is not an action seeking the annulment of administrative acts, but rather an action in rem with ancillary claims for damages between private parties. The nature of the registered properties, their historical and legal origins, the existence of a concession in favor of the defendant to extract material from a publicly owned riverbed, and the possible overlap between the lands and the area made available for exploitation by the State are issues that pertain to the merits of the proceeding. All of this must be assessed in determining whether the action brought is admissible or should be denied. The claim in this proceeding does not fall within the conditions defining administrative contentious jurisdiction (jurisdicción contenciosa administrativa) under article 1 of the Código Procesal Contencioso Administrativo.
This Chamber finds that the purpose of the proceeding is not to guarantee or restore the legality of conduct by the Administración Pública subject to Public Law, to resolve matters arising from an administrative legal relationship, or to address illegality through action or omission under the legal system or misuse of authority. Agrarian jurisdiction (competencia agraria) based on subject matter cannot be extended and is defined in general terms by articles 1 and 2 of the Ley de Jurisdicción Agraria, which is a special law. Those provisions empower judges in this field to adjudicate or resolve disputes related to the conduct of agrarian, agro-environmental, or related activities. An agrarian property (fundo agrario) is one devoted to such activities or suitable for being devoted to them. For the latter situation, it is important to consider its size, the location of the land, and the type of production that may be carried out on it.
In the case under review, this is deemed a matter that must be heard by the specialized agrarian jurisdiction based on subject matter because the lands involved are properties of an agricultural nature and because of their areas, as shown by the registry reports for the properties registered in the name of the plaintiff company under registration numbers [Placa1], [Placa2], and [Placa3], all in Limón, with areas of 100.361,27 square meters, 213.939,79 square meters for the second property, and 362.510,13 square meters for the third tract. (folios 9 to 11).
IV- In addition to the foregoing, this Tribunal has ruled in disputes involving the development of concession-based activities for extracting material from the soil and subsoil that jurisdiction over such cases lies with the specialized agricultural courts; a criterion confirmed by the Sala Primera de la Corte Suprema de Justicia: “III-. These proceedings concern a breach of contract (incumplimiento contractual) relating to the purchase and sale of a parcel of land measuring more than seventy-three hectares, involving its use as a quarry or open pit (cantera o tajo) for the extraction of its rock material (see documentary evidence concerning the option to purchase real property at folios 27, 31). It should also be noted that the record contains abundant documentary evidence concerning the activity intended to be carried out on the property, and it is certain that this involves quarry operations, since powers of attorney are granted, concessions are requested, and all the documentation concerning the processing of permits to conduct such activity is included (see documentary evidence at folios 40 to 47, 1308 to 1521, among others).
From the foregoing, it is evident that the property is agricultural in nature and intended for quarry operations. At first glance, this might not appear to be an agricultural dispute (conflicto agrario); however, it must not be overlooked that mining activity concerns the exploitation of the soil and subsoil. Article 25 of the Ley de Uso, manejo y Conservación de Suelos provides as follows: ‘When an exploration permit or a concession for subsoil exploitation is granted in areas suitable for agriculture, the permit-holding or concession-holding company or individual shall include in the work plan and investment plan the corresponding budget items required to restore any soil destroyed or damaged by the exploitation or extraction works.’ In this case, the disputed property is land suitable for agricultural use, consisting of forest, pastureland, and fruit trees, as shown by the survey plan depicting the land, visible at folio 1, and measuring more than 73 hectares.
Section 56 of the Ley de Uso Manejo y Conservación de Suelos Nº7779 of 30 de abril de 1998 clearly states that jurisdiction to hear and decide matters arising from the application of that law shall lie with the Tribunales Agrarios. Based on the foregoing, and because this case concerns a dispute over breach of contract in which enforcement of the contract or payment of the resulting damages is sought, involving property that is inherently agricultural in nature and on which mining activity is intended to be conducted, the Tribunales Agrarios have jurisdiction by express statutory delegation. In view of the foregoing, the objection for lack of subject-matter jurisdiction (excepción de falta de competencia en razón de la materia) raised by the defendant is denied. To the same effect, see ruling Nº 1256-C-11 of this Tribunal, issued at 12 horas del 15 de noviembre de 2011. That ruling was subsequently affirmed by ruling Nº 562-C-S1-2012 of the Sala Primera de la Corte Suprema de Justicia, at 10:10 horas del 10 de mayo de 2012, which held: ‘...
III. – The soil resource as an object protected by Environmental Law and Agricultural Law. Environmental protection legislation arose from the need to safeguard the vital elements of the ecosystem from human actions that degrade the capacity of systems and their resources to perpetuate themselves. Within this body of legislation, Ley de Manejo, Uso y Conservación de Suelos no. 7779 was enacted for the purpose of protecting, conserving, and improving soils through integrated and sustainable management alongside other natural resources, by means of promotion and planning. Regarding the jurisdiction of the agricultural courts over matters involving soil resources and matters arising from the application of Ley no. 7779, it is important to note that Agricultural Law emerged as a branch of law centered on production activities, and its functional jurisdiction includes disputes arising from the application of the Ley de Uso, Manejo y Conservación de Suelos and its regulations; this is pursuant to Article 56 of that law, which provides, insofar as relevant: “The Tribunales Agrarios shall have jurisdiction to hear and finally decide matters arising from the application of this Law.” It is on this understanding that this Chamber finds that the mining exploitation of the real property at issue must be heard by the specialized agricultural courts, since the protected subject matter is connected with the regulated purpose and field of study of Agricultural Law.’ In view of the foregoing, the objection for lack of subject-matter jurisdiction is denied.” (Boldface does not appear in the original). V- In view of the foregoing and pursuant to Articles 1, 2, and 16 of the Ley de Jurisdicción Agraria and section 56 of the Ley de Uso Manejo y Conservación de Suelos, the objection for lack of subject-matter jurisdiction filed by Tajo Chirripó S.A. is denied. It is hereby determined that this matter falls within the subject-matter jurisdiction of the agricultural courts (jurisdicción agraria). Once this ruling becomes final, the case file shall be remitted to the trial court so that it may continue hearing these proceedings.
POR TANTO
The objection for lack of jurisdiction is denied. These proceedings are declared to fall within the subject-matter jurisdiction of the Juzgado Agrario del Primer Circuito Judicial de la Zona Atlántica. Once this ruling becomes final, the case file shall be remitted to that court so that it may continue processing the matter.

SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ.- A las ocho horas y treinta y ocho minutos del veintitrés de junio de dos mil dieciséis.- PROCESO ORDINARIO establecido por LINVAS CHIRRIPO SOCIEDAD ANÓNIMA, cédula jurídica CED1 - - , representada por [Nombre1] , mayor, divorciado, vecino de Milano de Germania de Siquirres, Limón, cédula de identidad número CED2 - - ; y [Nombre2] , mayor, casado, vecino de Heredia, cédula de identidad número CED3 - - , en su condición de presidente y tesorero respectivamente con facultades de apoderados generalísimos sin límite de suma; contra TAJO CHIRRIPO SOCIEDAD ANÓNIMA, cédula jurídica CED4 - - , representada por sus apoderados generalísimos sin límite de suma los señores [Nombre3] , pasaporte CED5 y [Nombre4] , pasaporte CED6 . CONSIDERANDO
I- El Juzgado Agrario del I Circuito Judicial de la Zona Atlántica (Limón ) por auto de las 15:33 horas del 11 de mayo del 2016 (folio 251), eleva a este Tribunal el conocimiento de la excepción de incompetencia por razón de la materia interpuesta dentro del plazo legal por la demandada (folio 138 a 140).
II- La parte actora, en la demanda describe es titular registral y poseedora de tres fincas conjuntas con naturaleza de agricultura. Con cabidas de 100.361,27 metros cuadrados, la segunda finca de 213.939,79 metros cuadrados y la tercera heredad de 362.510,13 metros cuadrados. Con área aproximada conjunta de 120 hectáreas. Su finalidad, apunta, es aprovechar el material del suelo existente en los terrenos mediante la solicitud de una concesión para su extracción, además de proteger la biodiversidad que se ha mantenido conservada. Desde que adquirió los terrenos, aduce, ha ejercido la plena posesión. Cita, la empresa Tajo Chirripó S.A. de forma arbitraria e ilegal, dentro de sus fincas ha realizado extracciones afectando flora y fauna en irrespeto de su derechos. Afectando el cauce del río y el terreno que cubren sus aguas en las mayores crecidas. Explica, los terrenos a partir de ese punto están inscritos a su nombre.
Produciendo la desviación del cuerpo de agua. Además, su plano demuestra que es titular registral del terreno colindante. Señala, en el expediente minero N. 30-90 de Geología y Minas constan los informes del geólogo de los daños ocurridos y que dentro de la concesión se incorporó parte de nuestros terrenos; sin que existan las autorizaciones del propietario registral actual o los anteriores para que sea parte de la explotación de material. La actividad de extracción se ha ejercido en perjuicio de áreas de reforestación y margen del río. Todo en violación del artículo 33 de Ley Forestal, 8 y 11 de Ley de Biodiversidad. Lo anterior, argumenta, es la causa de las denuncias que se han interpuesto por su parte, a fin de obligarse a la suspensión inmediata de las labores y eventual valoración del daño ambiental. Como pretensiones de su demanda solicita principalmente se declare:
III- Revisados los autos estima este Tribunal que el presente asunto es de naturaleza agraria al no estarse solicitando en la demanda la revisión de un acto o conducta administrativa o la legalidad de una actuación del Estado, en ejercicio de su control. Sino constituye una acción real del derecho de propiedad y posesión sobre un inmueble. Debe ser rechazada la excepción de incompetencia por la materia, dado que las pretensiones de la demanda se dirigen a declarar que la accionada ha perturbado los derechos de posesión y propiedad de tres fincas inscritas cuya naturaleza es agraria y sobre las cuales se ha ejercido posesión pública, pacífica, a título de dueña e ininterrumpidamente. La responsabilidad por daños causados a los inmuebles en virtud de extracción de material en el cauce y terrenos aledaños, así como se ordene a la sociedad demandada se abstenga de perturbar la posesión de la actora.
La parte demandada no contrademandó. Por lo que el objeto del proceso queda definido con lo expuesto en la demanda y contestación. Como logra deducirse de lo descrito en el considerando anterior, no estamos ante una acción que solicite la nulidad de actos administrativos, sino que corresponde a una acción real con pretensiones accesorias de daños entre particulares. La naturaleza de las fincas inscritas, sus orígenes histórico legales, la existencia de una concesión de extracción de material en cauce de dominio público a favor de la accionada y el eventual traslape de terrenos con el área dada en explotación por el Estado, corresponde a temas propios del fondo del proceso. Todo lo cual deberá ser valorado a la luz de determinar la procedibilidad de la acción interpuesta o su denegatoria. La pretensión de este proceso no corresponde a las condiciones que definen la jurisdicción contenciosa administrativa en el artículo 1 del Código Procesal Contencioso Administrativo.
Considera esta Cámara, el objeto del proceso no es garantizar o restablecer la legalidad de una conducta de la Administración Pública sometida al Derecho Público, resolver sobre aspectos de la relación jurídico-administrativa, ilegalidades por acción u omisión del ordenamiento jurídico o desviación de poder. La competencia agraria, por razón de la materia es improrrogable y está determinada en forma genérica por los artículos 1 y 2 de la Ley de Jurisdicción Agraria, que es ley especial. Dichas normas facultan a las personas juzgadoras de esta disciplina para dirimir o resolver los conflictos relacionados con el ejercicio de actividades agrarias, agroambientales o conexas a éstas. Se considera fundo agrario aquél destinado a dichas actividades o con vocación para destinarse a ellas. Para éste último supuesto, es importante tomar en cuenta la medida, la ubicación del terreno y el tipo de producción que se puede desarrollar en él.
En el caso en estudio se estima es un asunto que debe ser conocido por la jurisdicción especializada agraria por razón de la materia al ser los terrenos involucrados fundos de naturaleza agrícola y su cabida, según se desprende de los informes registrales de las fincas inscritas a nombre de la sociedad actora matriculas [Placa1], [Placa2] y [Placa3] todas de Limón con áreas de 100.361,27 metros cuadrados, la segunda finca de 213.939,79 metros cuadrados y la tercera heredad de 362.510,13 metros cuadrados. (folios 9 a 11).
IV- Aunado a lo anterior, este Tribunal ha resuelto en conflictos donde media el desarrollo de actividades de extracción de material de suelo y subsuelo concesiondas que corresponde a la materia especializada agraria el conocimiento de estas causas; criterio que ha confirmado la Sala Primera de la Corte Suprema de Justicia: " III-. En el presente proceso se trata de un incumplimiento contractual referido a la compraventa de un terreno con una medida de más de setenta y tres hectáreas cuya utilización de una cantera o tajo para el aprovechamiento del material rocoso del mismo (ver documental referida a opción de compraventa de bien inmueble a folio 27, 31). No está demás señalar que consta en el expediente abundante prueba documental referida a la actividad que se pretende desarrollar sobre el fundo y se tiene la certeza de que se trata de la explotación de un cantera, pues se otorgan poderes, se solicitan concesiones y existe toda la documental referida a la tramitología de los permisos para realizar tal actividad (ver documental de folios 40 a 47, 1308 a 1521, entre otros).
De lo expuesto resulta evidente el fundo es de naturaleza agraria con fines de explotación de una cantera. En principio pareciera no se trata de un conflicto agrario, sin embargo no se debe dejar de lado la actividad minera trata sobre la explotación del suelo y subsuelo. El artículo 25 de la Ley de Uso, manejo y Conservación de Suelos indica lo siguiente: "Cuando se otorgue un permiso de exploración o una concesión de explotación del subsuelo en áreas de aptitud agrícola, la empresa o persona física permisionaria o concesionaria deberá incluir, el plan de trabajo y el plan de inversiones, con los rubros correspondientes para lograr la recuperación del suelo que se destruya o deteriore con las obras de explotación o extracción." . En este caso la finca en disputa es un fundo de aptitud agraria cuya naturaleza es de bosque, potrero y frutales, según se desprende del plano graficado para representar el terreno visible a folio 1, con una medida de más de 73 hectáreas.
El ordinal 56 de la ley de Uso Manejo y Conservación de Suelos Nº7779 de 30 de abril de 1998, es claro en señalar la competencia para conocer y resolver los asuntos originados en la aplicación de esta ley corresponderá a los Tribunales Agrarios. Partiendo de lo expuesto y tratarse en este caso un asunto donde se discute el incumplimiento contractual tratando de que el mismo sea ejecutado o se paguen los daños y los perjuicios causados, estando en disputa sobre un bien eminentemente de naturaleza agraria y en el cual se pretende el desarrollo de una una actividad minera sobre el mismo, corresponde por delegación expresa de la ley conocer a los Tribunales Agrarios. Debido a lo anteriormente expuesto se rechaza la excepción de falta de competencia en razón de la materia opuesta por la parte demandada. En ese mismo sentido puede verse voto de este Tribunal Nº 1256-C-11, dictado a las 12 horas del 15 de noviembre de 2011.
Dicho voto dictado fue posteriormente ratificado por voto Nº 562-C-S1-2012 de la Sala Primera de la Corte Suprema de Justicia, de las 10:10 horas del 10 de mayo de 2012, en el cual se dispuso: "... III. – Sobre el recurso suelo como objeto de tutela del derecho Ambiental y del derecho Agrario. Las legislaciones tutelares del ambiente, surgen debido a l a necesidad de resguardar los vitales elementos del ecosistema de las acciones humanas, que degradan la capacidad de perpetuación de los sistemas y sus recursos. Dentro de complejo normativo, se emite la Ley de Manejo, Uso y Conservación de Suelos no. 7779, que tiene como finalidad la protección, conservación y mejoramiento de los suelos en una gestión integrada y sostenible con los demás recursos naturales, mediante el fomento y planificación. Ahora bien, sobre la competencia de la jurisdicción agraria en el conocimiento de materia del recurso suelos y de los asuntos originados en la aplicación de la Ley no. 7779; es importante, señalar que el nacimiento del Derecho Agrario como rama jurídica, gira en torno a la actividad de producción, siendo su competencia funcional la de conocer los conflictos originados en la aplicación de la Ley de Uso, Manejo y Conservación de Suelos y su reglamento ; lo anterior, de conformidad con el artículo 56 de dicha ley que reza en lo que interesa: "Corresponderá a los Tribunales Agrarios conocer y resolver, definitivamente, los asuntos originados en la aplicación de la presente Ley.” Es bajo esta inteligencia que estima esta Cámara, que la explotación minera del inmueble objeto de este asunto, debe residenciarse en la sede especializada agraria , al estar el objeto tutelado vinculado con el fin regulado y de estudio del Derecho Agrario.".
En virtud de lo expuesto se rechaza la excepción de incompetencia en razón de la materia intrepuesta." (La negrita no corresponde a su original). (Voto N. 033-C-14). Temas desarrollados en esa resolución que tienen relación con lo que ha sido traído a los autos en el subjúdice.
V- Por lo expuesto y con fundamento en el artículo 1, 2 y 16 de la Ley de Jurisdicción Agraria, numeral 56 de la Ley de Uso Manejo y Conservación de Suelos, se rechaza la excepción de incompetencia por razón de la materia interpuesta por Tajo Chirripó S.A. Se decreta que este asunto es competencia de la jurisdicción agraria por motivos materiales. Firme esta resolución remítase el expediente al juzgado de instancia a fin de seguir conociendo este proceso.
POR TANTO
Se rechaza la excepción de incompetencia . Se declara este proceso es competencia por razón de la materia del Juzgado Agrario del Primer Circuito Judicial de la Zona Atlántica. Firme esta resolución, remítase el expediente a este último despacho para que continúe con la tramitación del mismo.
