SECOND JUDICIAL CIRCUIT OF SAN JOSÉ.- At sixteen hours and eight minutes on veintinueve de abril de dos mil dieciséis.- ORDINARY PROCEEDING (PROCESO ORDINARIO) instituted by [Nombre1], of legal age, married, farmer, resident of Limón, identity card number CED1 - -; against the INSTITUTO DE DESARROLLO AGRARIO, now the INSTITUTO DE DESARROLLO RURAL, legal entity identification number CED2 -, represented by its general judicial attorney-in-fact (apoderado general judicial), attorney Rolando Chaves Castro, also known as Rolando Castro Arce, whose personal particulars are not stated in the record. That entity, in turn, filed a counterclaim (reconvención) against [Nombre1], whose personal particulars were stated above. Attorney Álvaro Yannarella, bar number tres mil setecientos ochenta y nueve, appears as counsel of record for the plaintiff. Heard before the Agrarian Court of the First Judicial Circuit of the Zona Atlántica.
BACKGROUND (RESULTANDO):
Judge Alvarado Paniagua drafts the opinion; and CONSIDERING (CONSIDERANDO):
I.In appealing the judgment issued at nueve horas on veintiocho de setiembre del dos mil doce, the plaintiff seeks to have it declared void, arguing that it contains an ultra petita or extra petita defect because, in granting the action for recovery of property, the ruling encompasses all of [Dirección3] , , , , even though the counterclaimant sought relief only against parcels [Dirección4], , and not against [Dirección5], as to which it consented to the claim when answering the complaint. As another defect, he states that the lower court (a-quo) failed to rule on all his claims because it did not analyze the fact that the parcels identified in the complaint left the Instituto’s ownership when they were awarded to Banco Popular and were subsequently reacquired by the Instituto only in the registry, without possession being acquired, since possession was always held by the plaintiff. He contends that this failure to examine and weigh the evidence renders the judgment void by omission.
The Court does not agree that the defects asserted by the appellant constitute grounds for nullity. It should be noted that, in the relief requested in the counterclaim at folio 264, recovery of parcels numbered [Dirección6], , , and [Dirección7] is expressly sought; accordingly, the lower court’s ruling concerning those four parcels did not incur any ultra petita defect. The same is true of the second ground for nullity alleged by the appellant, concerning the award of the property to Banco Popular and its subsequent reacquisition by the defendant Instituto. The lower court did address that issue, stating that active standing (legitimación activa) in an action for recovery of property arises from registered title, thereby excluding the element of possession. That matter concerns the judge’s interpretation of the requirements for active standing, which entails the free assessment and interpretation of the law and does not constitute a ground for nullity based on denial of the right of defense or violation of due process (debido proceso).
Pursuant to article 199 of the Código Procesal Civil, applied supplementarily to agrarian matters by reference from article 26 of the Ley de Jurisdicción agraria, the application to annul the challenged judgment must be declared without [Nombre2], as no defects or omissions capable of violating the right of defense or due process are apparent. (See appellate brief at folios 822 to 827).-
II.This Court adopts the findings of proven facts (hechos probados) contained in the appealed judgment because they faithfully reflect the record, except for finding number fifteen, which the Court does not adopt because the plaintiff’s possession was established, as stated in finding number sixteen. The following is likewise established: 19) The plaintiff, [Nombre1], was a member of the group of banana farmers who entered into a contract with Bananera D por G Sara Sociedad Anónima on 16 de octubre de 1991. The plaintiff participated by growing bananas on [Dirección8] , [Dirección9], 93, with the knowledge of the Instituto de Desarrollo Agrario, now the Instituto de Desarrollo Rural. (See contract at folios 531 to 543, testimony of IDA official David Romero Aguilar at folio 448, and IDA official letter [Placa11] dated 5 de enero de 1990, appearing at folio 348). 20) By resolution number 22, session 103-89 of 19 de diciembre de 1989, communicated to Caja Agraria on 10 de enero de 1990, a loan was approved for the specified group of parcel holders, including Mr. [Nombre1] of [Dirección10] (see official letters at folios 287-288).-
III.The Court does not adopt the findings of unproven facts (hechos indemostrados), as they are immaterial to the resolution of this matter.- The following is deemed an unproven fact: It was not established that Board of Directors resolution number dieciséis, corresponding to session cero cero ocho- noventa, dated 23 de enero de 1990, of the Instituto de Desarrollo Agrario, now the Instituto de Desarrollo Rural, was revoked or annulled and thereby ceased to be effective. There is no evidence in that regard.-
IV.The plaintiff appeals the judgment rendered at nine hours on veintiocho de setiembre del dos mil doce, alleging the following: He considers it proven that the plaintiff acquired possession many years ago and did so in good faith. There are administrative acts that have not been revoked or annulled, and even today no petition for annulment has been filed through a lesividad proceeding (proceso de lesividad), which would be the only means of annulling the resolution adopted in Session 008, Article 16, dated 23 de enero de 1990; such action is also subject to a limitation period, which in cases of absolute nullity is 4 years after issuance of the act. He states that the annulment of [Nombre3]’s right was intended to facilitate the bank loan obtained for the banana project. He considers that the subsequent administrative acts issued in 2001, aimed at evicting him from the property, are vitiated by absolute nullity (nulidad absoluta), because they disregard a final and effective act, namely Session 008-90, and no administrative proceeding could be issued or commenced against a final and effective act; the record does not show that such act was revoked or annulled pursuant to section 173 of the Ley General de Administración Pública.
He states that he was one of the parcel holders (parceleros) who participated in the banana project and was also a party to the agreement entered into with Banco Popular, under which ownership of the properties given as collateral would revert to the Instituto, which would then return them to the parcel holders and would not evict them, granting them the use, usufruct, and right of habitation of the parcels. This is because the Banco transferred to the IDA only the registered title, not possession of the properties, which was exercised by the parcel holder. He argues that the Instituto merely purchased the registered title to those properties from Banco Popular and never the right of possession. He considers that he has acquired the property by adverse possession (usucapido), because he holds color of title (justo título) and acted in good faith, and has exercised agrarian possession (posesión agraria) for more than ten years, as owner, peacefully and continuously. (see appeal brief at folios 787 to 854) The subsequent expansion of the grounds for appeal at folios 861-871 cannot be entertained because it was submitted outside the statutory appeal period.-
The plaintiff brings this action seeking a judgment granting the following relief: “I) That the present action be declared with [Nombre2] in all respects. II. That the right of possession be declared in favor of the plaintiff. III. Consequently, that the right of ownership be declared in favor of the undersigned plaintiff, and that the defendant entity, Instituto de Desarrollo Agrario, through its attorney-in-fact, be ordered to appear before Notary Public José Antonio Brenes Trejos to execute a public deed transferring, before the Registro Nacional and into the name of the undersigned plaintiff, the properties REAL PROPERTY FOLIOS: REGISTRATION NUMBERS 20987-000, 20989-000, 20993-000, 21015-000, all in the Limón registry district; for that purpose, the Notary Public and Attorney authenticating this document, Lic. José Antonio Brenes Trejos, is authorized to perform the related notarial function.
IV. In default of the foregoing, that an order be issued to the Registro Nacional directing that the properties bearing real-property-folio registration numbers [Placa1], [Placa2], [Placa3], [Placa4], all in the Limón registry district, be registered in my name. V. That the defendant entity be ordered to pay both categories of costs in these proceedings.” (folio 11).- The claim seeking a declaration in his favor of the right of ownership and the resulting registration in his name with the Registro Nacional must be granted, because he acquired the right of ownership over properties 20987-000 (parcel 79), 20989-000 (parcel 80), 20993-000 (parcel 82), and 21015-000 (parcel 93), located in [Dirección11], Batán, Province of Limón, through a purchase from his transferor, [Nombre3]. That transfer was authorized by the Instituto when, through Board of Directors Resolution number 16, corresponding to Session 008-90 of 23 de enero de 1990, which remains in effect (because it was not shown to have been revoked or annulled), it recommended the transfer of parcels 79, 80, 82, and 93 in favor of Mr. [Nombre1], noting that the four parcels had been granted to a single person, which implies that this right was recognized just as it had previously been approved for his transferor, [Nombre3].
(see the cited resolution at folios 76 and 122) The aforementioned Board of Directors Resolution satisfies sections 67 and 68, subsection 1), of the Ley de Tierras y Colonización, which require authorization from the Instituto to transfer title to the landholding (predio). Accordingly, from that moment onward, the transfer of the right of ownership over the properties was perfected, there being no defect preventing that legal transaction, which became perfected upon issuance of the required authorization. Those ownership rights should subsequently have been registered in favor of the plaintiff; this was not done, giving rise to this dispute. The Instituto subsequently annulled the title to parcels [Dirección12], , , in the name of [Nombre3], through Resolution 81-92 of 2 de noviembre de 1992, after he had already transferred title to the plaintiff with due authorization from the Board of Directors.
However, there is no indication that the transfer authorization was also annulled, and it would therefore remain in effect, irrespective of the grounds the Instituto may have had for annulling the award made to [Nombre3], whether so that the Instituto could pledge the parcels as bank collateral for the community’s banana-growing project—as the plaintiff alleges—or because it believed that an unlawful transfer had occurred—as the defense alleges—. It is deemed an unproven fact that Board of Directors Resolution number sixteen, corresponding to Session zero zero eight-ninety, of 23 de enero de 1990, issued by the Instituto de Desarrollo Agrario, now Instituto de Desarrollo Rural, was revoked or annulled and thereby ceased to be in effect; for that purpose, the existence of a lesividad proceeding to reverse the right granted to him would have had to be shown. Thus, we have the following: “Within the Costa Rican legal system, specifically since the Ley General de la Administración Pública of 1978, there exists, under the general designation of modification and extinguishment of an administrative act (modificación y extinción del acto administrativo), a differentiated system that clearly distinguishes between revocation, on grounds of expediency, convenience, and merit, of a valid or perfected and effective administrative act, and annulment, on grounds of legality, which applies exclusively to invalid and, theoretically, ineffective administrative acts.
The general rule is that administrative acts enjoy stability and therefore cannot be revoked on grounds of expediency and convenience; the exception consists of revocation and annulment, which will be examined in the following section. Pursuant to section 153, paragraph 3º, LGAP, revocation is the extinguishment of an administrative act on grounds of expediency, convenience, or merit—discretion—thereby being clearly distinguished from annulment—due to absolute or relative nullity—which proceeds primarily on grounds of legality. Revocation of an administrative act takes effect from the time it is ordered and prospectively, meaning that the original act remains effective until revocation occurs. Obviously, prospectively, the respective public administration may not base new administrative acts upon the previously revoked act. A declaration that an administrative act is invalid, whether because of relative or absolute nullity, suppresses or eliminates the effects of the administrative act.
Such annulment may occur through administrative or judicial proceedings. The general rule is that the respective public administration may not annul an act declaring rights in favor of an administered party (administrado), with the exceptions being annulment or ex officio review and revocation. For that purpose, as a general principle, the public administration must bring a lesividad proceeding as plaintiff, after first declaring that the act is detrimental to public, economic, or other interests (sections 10, paragraph 5°, and 34 of the CPCA); this proceeding has traditionally been understood as a safeguard for administered parties” ([Nombre4], . Revocation and Annulment of Administrative Acts in Costa Rica, at www.ernestojinesta.com).- Likewise, on this particular issue, the Sala Constitucional stated in Vote No. 897-98 of 11 de febrero de 1998 that “...the Administration is prohibited from extinguishing, through its own actions, acts that it has issued conferring subjective rights (derechos subjetivos) upon private parties.
Thus, subjective rights constitute a limit on the powers to revoke (or modify) administrative acts, for the purpose of requiring greater procedural safeguards. When the Administration issues an act and subsequently issues another contrary to the first, to the detriment of subjective rights, it disregards those rights, which it had granted through the first act, whether by error or for any other reason. This means that the only avenue available to the State to remove one of its own acts from the legal system is the judicial lesividad proceeding, because that proceeding is conceived as a procedural safeguard in favor of the administered party; alternatively, our legal system permits the Administration to act contrary to its own prior acts through administrative proceedings in cases of absolute, evident, and manifest nullity, following an opinion from the Contraloría General de la República and the Procuraduría General de la República (as an additional safeguard in favor of the administered party), and pursuant to Article 173 of the Ley General de la Administración Pública.
Consequently, if the Administration has failed to observe the rules governing these procedures, or has omitted them entirely or in part...the doctrine of one’s own acts (principio de los actos propios) establishes the invalidity of the act as the effect of that irregularity.”- Accordingly, the right granted to the administered party cannot be disregarded, because the transfer of the parcels in question to the plaintiff, [Nombre1], was recognized when the authorization required by sections 67, first paragraph, and 68, subsection 1), of the Ley de Tierras y Colonización was issued.- Starting from the first premise, namely that the right of ownership over the four parcels was transferred to the plaintiff with the Instituto’s authorization, and the second premise, namely that those parcels remained registered in the name of the Instituto de Desarrollo Agrario, the conclusion is as follows: that Instituto must effect the registered transfer in favor of the person who validly acquired the parcels in question, particularly since he was subsequently deemed a beneficiary upon satisfying the eligibility requirements under the Ley de Tierras y Colonización, No. 2825 of 14 de octubre de 1961, Chapter IV of which governs the land-parceling system (régimen de parcelación de tierras).
INDER must execute and deliver the public deed of transfer in favor of the plaintiff within the appropriate period, without further administrative delay, because the conditions required by the legal system were satisfied, including authorization for the transfer of title made by the original award recipient, Jesús López; this was ratified when the plaintiff was found to meet the requirements for beneficiary status, as declared in Session 030-00 of 10 de abril de 2000.- With respect to the administrative actions undertaken beginning on 26 de febrero del 2001 and intended to evict the plaintiff, it is not possible to assess whether they are barred by the statute of limitations or have lapsed, because that issue was not included among the claims in the action, as transcribed above. -
VI.The appellant is correct that it is not feasible to consider him an unlawful possessor in bad faith, because the possession (posesión) he has maintained to date has been exercised pursuant to a valid legal transaction (negocio jurídico), with the knowledge and acquiescence of the Instituto de Desarrollo Agrario, now INDER, from the time the Instituto authorized the transfer of title (traspaso del dominio) made to him by Mr. [Nombre3] of [Dirección13], , , . As stated, the Board of Directors’ resolution remains in force and has not been affected by the events involving the bank loan under which the property was awarded to Banco Popular y de Desarrollo Comunal, because the property remained registered in the name of the Instituto when the Banco reversed the Registry entry. The plaintiff did not participate directly in this loan under his name expressly; however, he participated in the agreement whereby the Instituto de Desarrollo Agrario reacquired the parcels for the purpose of conveying them again to the affected banana growers, the plaintiff being one of them, since he had already been in lawful possession for some time.
This is apparent from the document appearing at folios 272 to 276, which is an agreement with Banco Popular, and at 531-543, which is the banana project agreement, in both of which the plaintiff participated). In addition to this evidence, there is the testimony of witness [Nombre5] at folio 450, who acknowledges that the plaintiff is among the affected banana growers and that, to avoid causing this parcel holder further harm, an attempt was made to assign the parcels to him and other members of his family. That witness stated: “With respect to these parcels, the Institution had already determined that the plaintiff was entitled to only one and that the other three parcels would be assigned to three families, including three families who would even be relatives of Mr. [Nombre6] () I clarify that they were Mr. [Nombre1]’s family, to minimize the harm as much as possible.” (See testimony at folio 450.) The foregoing means that the defendant Institution acknowledges that, at some point, it issued an act authorizing the transfer in favor of the plaintiff and that his occupation was lawful.
Regarding the challenge to the plaintiff’s possession, it should be noted that it was established that, although the plaintiff works at the Asamblea Legislativa, he has not abandoned the parcels, because the technical study appearing at folios 295 to 329 shows the possessory acts (actos posesorios) performed by the plaintiff and his family, consisting primarily of agricultural and residential use. The testimony of [Nombre5] at folio 448 addresses the plaintiff’s occupation of the parcels at issue, stating the following in reference to the plaintiff: “I have seen him conduct productive activities on these four properties together with his family; the first of those activities was banana farming, and thereafter there has been the production of rice, papaya, and date bananas, basically, as well as some other crops in small areas.” (See testimony at folios 448 and 449.) Accordingly, the right of possession (derecho de posesión) must be recognized as one of the attributes encompassed by the right of ownership (derecho de propiedad), since his possession has genuine substance according to the cited evidence.
The action for recovery of property constitutes the most effective and forceful defense of ownership and consists of the claim whereby the owner of a thing who has been deprived of it seeks to recover it from the person possessing or holding it without being its owner. This action in rem (acción de naturaleza real) is brought against any possessor who lacks title of ownership (título de dominio). There are three requirements for the validity of an action for recovery of property:
The generic defense sine actione agit is denied because it encompasses the defenses already discussed.- 2) With respect to the defenses raised against the counterclaim, they are sustained except for acquisitive prescription (prescripción positiva) and expiration (caducidad). The defense of expiration is denied for the reasons stated by the court below (a-quo), which indicated that this proceeding does not concern any claim involving the expiration of a specific action. The defense of acquisitive prescription is denied because this matter does not concern recognition of agrarian adverse possession (usucapión agraria). Adverse possession (usucapión) applies when the instrument of transfer or acquisition is a non domino, from one who is not the owner, but not when it is a domino or a verus domino, that is, when it originates from the owner or true owner, because in that case, if the instrument is valid, it immediately produces all its effects; and if it contains a defect of another kind, because it originates from the true owner, it may be validated through the passage of the ten-year period.
This latter issue, however, is not subject to analysis in this proceeding because it was not included in the claims. The legal characterization set forth in the reasoning of this judgment is the recognition of the right of ownership based on acquisition through a purchase authorized by the corresponding Instituto; therefore, the appellant’s arguments that recognition of his right is based on acquisition through acquisitive prescription or adverse possession cannot be accepted. The defense of lack of a legal right is sustained because, by authorizing the transfer of title to the plaintiff through Board of Directors’ resolution number 16 008-90 dated January 23, 1990, the Instituto deprived the registered ownership appearing in its name of substantive effect. For this reason, the defense of lack of standing to sue is also sustained, because the counterclaimant was not the owner of the properties; and the defense of lack of standing to be sued is likewise sustained because the defendant is not an unlawful possessor, his right having been demonstrated as indicated.
No ruling is made on the defense of lack of a current interest because it is unnecessary; since the counterclaimant failed to demonstrate its right, it is unnecessary to determine whether it has a current interest.-
IX.In light of the foregoing, the judgment shall be partially reversed, and in its [Nombre2] it is hereby ruled: the defenses (excepciones) of lack of legal right (falta de derecho), lack of active and passive standing (falta de legitimación activa y pasiva), and the general defense of sine actione agit raised by the defendant are denied; the denial of the defense of lack of present interest (falta de interés actual) is affirmed; and the claim (demanda) filed by [Nombre1] against the Instituto de Desarrollo Agrario, now the Instituto de Desarrollo Rural, shall be declared with [Nombre2], being denied as to anything not expressly granted and granted as follows: Plaintiff [Nombre1] is declared to hold the right of ownership (derecho de propiedad), with all its attributes; the defendant Instituto de Desarrollo Rural, through its attorney-in-fact, is ordered to appear before a Notary Public to execute a public deed (escritura pública) transferring and registering in the plaintiff’s name with the Registro Nacional the properties recorded under REAL PROPERTY FOLIOS: REGISTRATION NUMBERS 20987-000, 20989-000, 20993-000, 21015-000, all in the Limón registration district, within ten days after this judgment becomes final (firmeza).
In the event of noncompliance, the judge shall execute the instrument on behalf of the obligated party, as provided in Article 698 of the Código Procesal Civil, which applies supplementarily.- With regard to the counterclaim (contrademanda), the defenses of lack of legal right, lack of active and passive standing, and lack of interest are sustained, and the denial of the defenses of lapse (caducidad) and acquisitive prescription (prescripción positiva) is affirmed. THE COUNTERCLAIM filed by the Instituto de Desarrollo Agrario against [Nombre1] IS DECLARED WITHOUT [Nombre2] IN ALL RESPECTS. Attorney’s fees and court costs (costas personales y procesales) shall be borne by the unsuccessful Instituto, such award being mandated by Article 221 of the Código Procesal Civil and Article 55 of the Ley de Jurisdicción Agraria.
POR TANTO:
The motion for nullity (nulidad) is declared without [Nombre2]. The judgment IS PARTIALLY REVERSED, and in its [Nombre2] it is hereby ruled: the defenses of lack of legal right, lack of active and passive standing, and the general defense of sine actione agit raised by the defendant are denied; the denial of the defense of lack of present interest is affirmed; and THE CLAIM filed by [Nombre1] against the Instituto de Desarrollo Agrario, now the Instituto de Desarrollo Rural, IS DECLARED WITH [Nombre2], being denied as to anything not expressly granted and granted as follows: Plaintiff [Nombre1] is declared to hold the right of ownership, with all its attributes; the defendant Instituto de Desarrollo Rural, through its attorney-in-fact, is ordered to appear before a Notary Public to execute a public deed transferring and registering in the plaintiff’s name with the Registro Nacional the properties recorded under REAL PROPERTY FOLIOS: REGISTRATION NUMBERS CED8 - , CED9 , CED10 - and CED11, all in the Limón registration district, within ten days after this judgment becomes final.

[Nombre7] - DECIDING JUDGE [Nombre8] - DECIDING JUDGE [Nombre9] – DECIDING JUDGE
VOTO N° 393-F-16 TRIBUNAL AGRARIO. SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ.- A las dieciséis horas y ocho minutos del veintinueve de abril de dos mil dieciséis.- PROCESO ORDINARIO establecido por [Nombre1] , mayor, casado, agricultor, vecino de Limón, cédula de identidad número CED1 - - ; contra el INSTITUTO DE DESARROLLO AGRARIO actual INSTITUTO DE DESARROLLO RURAL , cédula jurídica número CED2 - , representado por su apoderad o general judicial el licenciado Rolando Chaves Castro conocido como Rolando Castro Arce, de calidades desconocidas en autos. A su vez dicha entidad planteó reconvención contra [Nombre1] , de calidades antes mencionadas. Interviene como abogado director del actor el licenciado Álvaro Yannarella, colegiado número tres mil setecientos ochenta y nueve. Tramitado ante el Juzgado Agrario del Primer Circuito Judicial de la Zona Atlántica.
RESULTANDO:
Redacta la Jueza Alvarado Paniagua, y;
CONSIDERANDO:
I.La parte actora, al apelar la sentencia de las nueve horas del veintiocho de setiembre del dos mil doce, invoca nulidad contra la misma, aduciendo se ha incurrido en el vicio de ultra petita o extra petita, ya que al acogerse la acción reivindicatoria se hace sobre todas las [Dirección3] , , , , cuando el reconventor únicamente dirigió sus pretensiones contra la s parcelas [Dirección4], , no así contra la [Dirección5], siendo que respecto a esa parcela se allanó al contestar la demanda. Indica como otro vicio, que el a-quo no resuelve todas sus pretensiones, pues no analiza el hecho de que las parcelas que se indicaron en la demanda, salieron de la esfera del Instituto al procederse a adjudicarse al Banco Popular y que posteriormente son readquiridas por el Instituto únicamente registralmente no adquiriéndose la posesión, pues la misma siempre la ostentó el actor. Considera esta falta de apreciación y valoración de pruebas hacen nula la sentencia por omisión.
No se comparte los vicios de nulidad expuestos por el recurrente. Nótese en la pretensión de la reconvención a folio 264, expresamente solicita la reivindicación sobre las parcelas números [Dirección6], , , y [Dirección7], de allí que al pronunciarse el a-quo sobre esas cuatro citadas, no se incurre en algún vicio de ultrapetita. Igualmente ocurre con el segundo vicio de nulidad que aduce el impugnante, sobre lo referente a la adjudicación del inmueble al Banco Popular y posteriormente readquirido por el Instituto accionado. Respecto a ello el a-quo si analiza el tema indicando que la legitimación activa de la acción reivindicatoria se da con la titularidad registral, excluyendo con ello el elemento de la posesión. Tal aspecto es relacionado con la interpretación del contenido de la legitimación activa que haga el juez, lo cual es una libre valoración e interpretación de la norma, que no constituye vicio de nulidad por indefensión o violación al debido proceso.
De conformidad con el artículo 199 del Código Procesal Civil aplicado supletoriamente a la materia agraria por remisión del artículo 26 de la Ley de Jurisdicción agraria, ha de declararse sin [Nombre2] la nulidad interpuesta contra la sentencia impugnada, al no observarse defectos u omisiones que pudieren violar el derecho de defensa o debido proceso. (ver escrito de impugnación a folios 822 a 827).-
II.Este Tribunal comparte la relación de hechos probados contenidos en el fallo recurrido al ser fiel reflejo de lo constante en autos , salvo el numerado quince el cual no es compartido a demostrarse la existencia de la posesión del actor tal como se indica en el hecho número dieciséis . De igual naturaleza se tiene: 19) El actor [Nombre1] , formó parte del grupo de agricultores de banano, quienes contrataron con la Bananera D por G Sara Sociedad Anónima, en fecha 16 de octubre de 1991. Siendo que el actor participó cultivando banano en las [Dirección8] , [Dirección9], 93, teniendo conocimiento de ello el Instituto de Desarrollo Agrario hoy Instituto de Desarrollo Rural. (Ver contrato de folio 531 a 543, declaración testimonial del funcionario del IDA David Romero Aguilar a folio 448, y oficio [Placa11] del 5 de enero de 1990 del IDA visible a folio 348). 20) Mediante acuerdo número 22, sesión 103-89 del 19 de diciembre de 1989, comunicada a la Caja Agraria el 10 de enero de 1990, se aprueba otorgar un crédito al grupo de parceleros que se indican entre ellos el señor [Nombre1] de las [Dirección10] (ver oficios a folios 287-288).-
III.No se comparte la relación de hechos indemostrados, al no ser de interés para la resolución de este asunto.- De esta naturaleza se tiene el siguiente: No se demostró que el acuerdo de Junta Directiva número dieciséis, correspondiente a la sesión cero cero ocho- noventa, del 23 de enero de 1990, del Instituto de Desarrollo Agrario hoy Instituto de Desarrollo Rural, fuera revocado o anulado perdiendo así su vigencia. No hay prueba al respecto.-
IV.La parte actora apela la sentencia de las nueve horas del veintiocho de setiembre del dos mil doce, aduciendo lo siguiente: Considera se ha probado la adquisición de la posesión por parte del actor data desde hace muchísimos años, y que ha sido de buena fe. Que existen actos administrativos no revocados o anulados que aún hoy no se ha solicitado la nulidad por medio de proceso de lesividad que sería el único medio para anular el acuerdo tomado en Sesión 008 artículo 16, de fecha 23 de enero de 1990, estando también sujeto a la caducidad de esa acción que en casos de nulidad absoluta es de 4 años después de emitido el acto. Indica el acto de nulidad del derecho de [Nombre3] , lo fue para facilitar el crédito bancario obtenido para el proyecto bananero. Considera los actos administrativos posteriores en el año 2001, dirigidos a desalojarle del inmueble están viciados de nulidad absoluta, ya que desconocen un acto firme y eficaz como lo fue la sesión 008-90 y que no podían emitirse o iniciarse ningún procedimiento administrativo contra un acto firme y eficaz, cuyo acto no consta en el expediente que se haya revocado o anulado de conformidad con el ordinal 173 de la Ley General de Administración Pública.
Manifiesta, él era uno de los parceleros que participó en el proyecto bananero, y también era parte del acuerdo llevado a cabo con el Banco Popular, donde se revertía la propiedad de las fincas dadas en garantía al Instituto y éste se las devolvería a los parceleros y no los desalojaría, otorgándoles el uso, usufructo y habitación de las parcelas. Lo anterior es porque el Banco le traspasa al IDA únicamente la propiedad registral no la posesión de los inmuebles la cual ejercía el parcelero. Arguye que lo que hace el Instituto es comprarle al Banco Popular la propiedad registral de tales inmuebles jamás del derecho de posesión. Considera ha usucapido el inmueble pues cuenta con justo título y buena fe, y ha ejercido posesión agraria mayor a diez años, a título de dueño, en forma pacífica y continua. (ver escrito de apelación a folio 787 a 854 ) La ampliación de agravios que se hace posteriormente a folios 861-871 no es de recibo por cuanto se hace fuera del plazo legal de apelación.-
La parte actora plantea esta acción para que en sentencia se resuelva lo siguiente: " I) Se declare con [Nombre2] la presenta demanda en todos sus extremos. II. Que se declare el derecho de posesión a favor del actor. III. En consecuencia, se declare el derecho de propiedad a favor del suscrito actor, se ordene al ente demandado Instituto de Desarrollo Agrario en la Persona de su apoderado, comparecer ante Notario Público José Antonio Brenes Trejos, a otorgar escritura pública traspasando ante el Registro Nacional a nombre del suscrito actor, las fincas FOLIOS REAL: MATRICULAS 20987-000, 20989-000, 20993-000, 21015-000; todas del partido de Limón, para tal efecto autorícese al Notario Público y Abogado aquí autenticante Lic. José Antonio Brenes Trejos, para que realice la función notarial relacionada. IV. En defecto de lo anterior, expídase mandamiento al Registro Nacional ordenando inscribir a mi nombre las fincas folio real matriculas [Placa1], [Placa2], [Placa3], [Placa4], todas del partido de Limón.
V. Se conde ne al ente demandado al pago de ambas costas del presente proceso. " ( folio 11 ).- La pretensión sobre la declaratoria a su favor sobre el derecho de propiedad y la consecuente inscripción en el Registro Nacional a su nombre, ha n de ser declarada s con lugar, dado que ha adquirido el derecho de propiedad sobre las fincas 20987-000 (parcela 79), 20989-000 (parcela 80), 20993-000 (parcela 82) y 21015-000 (parcela 93), ubicadas en el [Dirección11] , Batán de la Provincia de Limón, mediante compra que le hiciera a su transmitente [Nombre3] , siendo que dicho traspaso contó la autorización del Instituto, cuando mediante acuerdo de Junta Directiva aún vigente ( pues no se demostró fuera el mismo revocado o anulado) número 16, correspondiente a la sesión 008-90, del 23 de enero de 1990, recomienda el traspaso de las parcelas 79, 80, 82 y 93 a favor del señor [Nombre1] , refiriendo que las cuatro parcelas habían sido otorgadas a una sola persona, lo que implica se reconoció ese derecho tal y como le había sido aprobado a su transmitente [Nombre3] en su oportunidad.
(ver citado acuerdo a folios 76 y 122) Con el mencionado acuerdo de la Junta Directiva, se cumple con la disposición de los artículo s 67 y 68 inciso 1) de la Ley de Tierras y Colonización, que indica debe contarse con la autorización del Instituto para traspasar el dominio del predio, de allí es a partir de ese momento que la transmisión del derecho de propiedad sobre los inmuebles es perfecta, no existiendo el vicio impeditivo de esa negociación jurídica, que adquiere su perfección al darse la requerida autorización. Correspondía posteriormente hacer la inscripción registral de esos derechos de propiedad a favor del actor, lo que no se hizo, y ello es lo que origina este conflicto. Posteriormente, el Instituto anula el título de propiedad de las parcelas [Dirección12], , , a nombre de [Nombre3] , mediante acuerdo 81-92 del 2 de noviembre de 1992, cuando ya había éste hecho el traspaso del dominio al actor debidamente autorizado por la Junta Directiva, sin embargo no se indica se haya anulado también la autorización del traspaso lo cual aún estaría vigente, independientemente de las causas que tuviera el instituto para proceder a anular la adjudicación que le hiciera a [Nombre3] , ya sea para que el Instituto las diera en garantía bancaria por el proyecto del cultivo de banano en la comunidad -como lo aduce el actor- , o por que se considerara existiera un traspaso ilegal - como lo aduce la defensa - .
Se tiene como hecho indemostrado que el acuerdo de Junta Directiva número dieciséis, correspondiente a la sesión cero cero ocho- noventa, del 23 de enero de 1990, del Instituto de Desarrollo Agrario hoy Instituto de Desarrollo Rural, fuera revocado o anulado perdiendo así su vigencia, para ello debió demostrarse la existencia de un proceso de lesividad para revertir ese derecho que le fuera otorgado. Así tenemos que "En el ordenamiento jurídico costarricense, concretamente a partir de la Ley General de la Administración Pública de 1978, existe, bajo la denominación general de la modificación y extinción del acto administrativo, un régimen diferenciado que distingue, nítidamente, entre la revocación por razones de oportunidad, conveniencia y mérito de un acto administrativo válido o perfecto y eficaz y la anulación por razones de legalidad que opera, exclusivamente, respecto de los actos administrativos inválidos y, teóricamente, ineficaces.La regla general es que los actos administrativos gozan de estabilidad por lo que no pueden ser revocados por razones de oportunidad y conveniencia, la excepción está representada por la revocación y la anulación que será estudiada en el epígrafe siguiente.
De conformidad con el ordinal 153, párrafo 3º, LGAP, la revocación es la extinción de un acto administrativo por razones de oportunidad, conveniencia o mérito -discrecionalidad-, con lo que se distingue, claramente, de la anulación -por nulidad absoluta o relativa- que procede, fundamentalmente, por motivos de legalidad.La revocación del acto administrativo produce efectos desde su dictado y hacia el futuro, lo que significa que la eficacia del acto originario se mantiene hasta que se produce la revocatoria. Obviamente, hacia el futuro la administración pública respectiva no puede fundar nuevos actos administrativos en el previamente revocado. La declaratoria de invalidez del acto administrativo, ya sea por nulidad relativa o absoluta produce la supresión o eliminación de los efectos del acto administrativo. Esa anulación puede producirse en vía administrativa o jurisdiccional. La regla general es que la administración pública respectiva no puede anular un acto declaratorio de derechos para el administrado, siendo las excepciones la anulación o revisión de oficio y la revocación.
Para ese efecto, la administración pública, como principio general, debe acudir, en calidad de parte actora y previa declaratoria de lesividad del acto a los intereses públicos, económicos o de otra índole, al proceso de lesividad (artículos 10, párrafo 5°, y 34 del CPCA), el cual se ha entendido, tradicionalmente, como una garantía para los administrados" ([Nombre4] , . Revocación y Anulación del Acto Administrativo en Costa Rica, en www.ernestojinesta.com).- En igual sentido, sobre este particular la Sala Constitucional en el Voto No. 897-98 de 11 de febrero de 1998 señaló que “...a la Administración le está vedado suprimir por su propia acción aquellos actos que haya emitido confiriendo derechos subjetivos a los particulares. Así, los derechos subjetivos constituyen un límite respecto de las potestades de revocación (o modificación) de los actos administrativos, con el fin de poder exigir mayores garantías procedimentales.
La Administración, al emitir un acto y con posterioridad al emanar otro contrario al primero, en menoscabo de derechos subjetivos, está desconociendo estos derechos, que a través del primer acto había concedido, sea por error o por cualquier otro motivo. Ello implica que la única vía que el Estado tiene para eliminar un acto suyo del ordenamiento es el proceso de jurisdiccional de lesividad, pues este proceso está concebido como una garantía procesal a favor del administrado, o bien, en nuestro ordenamiento existe la posibilidad de ir contra los actos propios en la vía administrativa, en la hipótesis de nulidades absolutas, evidentes y manifiestas, previo dictamen de la Contraloría General de la República y de la Procuraduría General de la República (como una garantía más a favor del administrado) y de conformidad con el artículo 173 de la Ley General de la Administración Pública. En consecuencia, si la Administración ha inobservado las reglas de estos procedimientos, o bien, las ha omitido del todo o en parte...el principio de los actos propios determina como efecto de dicha irregularidad la invalidez del acto”.- De tal forma, no es posible desconocer el derecho que le fuera otorgado al administrado, al reconocerse el traspaso de las parcelas de marras al actor [Nombre1] , al darse la autorización requerida por los artículos 67 párrafo primero y 68 inciso 1) de la Ley de Tierras y Colonización.- Partiendo de la primer premisa consistente en que existió la transmisión del derecho de propiedad sobre las cuatro parcelas a favor del actor y con autorización del Instituto, y la segunda premisa consistente en que dichas parcelas quedaron registralmente inscritas a nombre del Instituto de Desarrollo Agrario, se concluye : corresponde a dicho Instituto hacer el traspaso registral a favor de quien válidamente adquirió las referidas parcelas, máxime si posteriormente se le considera como beneficiario al llenar las condiciones para calificar, de conformidad con Ley de Tierras y Colonización, No. 2825 de 14 de octubre de 1961, regulada en su Capítulo IV el régimen de parcelación de tierras .
Deberá el Instituto extender u otorgar la escritura pública de traspaso por parte del I NDER y a favor del actor, en el tiempo debido, no incurriendo más en morosidad administrativa, pues las condiciones exigidas por el ordenamiento jurídico se cumplieron, como la autorización para el traspaso del dominio que le hiciera el original adjudicatario Jesús López, lo cual es ratificado al reunir las condiciones como beneficiario según fue así declarado mediante Sesión 030-00 del 10 de abril de 2000.- Las actuaciones administrativas a partir del 26 de febrero del 2001, tendientes a desalojar a la parte actora, no es factible entrar a valor si las mismas están prescritas o caducas, dado que ello no fue objeto de la pretensión de la demanda, según su transcripción supra. -
VI.Lleva razón el recurrente en cuanto n o es factible considerar lo como poseedor ilegítimo y de mala fe, pues la posesión que ostenta hasta la fecha, ha sido ejercida por motivo de un negocio jurídico válido, a vista y paciencia del Instituto de Desarrollo Agrario hoy INDER , ello a partir del momento en el que el Instituto autorizó el traspaso del dominio que le hiciera el señor [Nombre3] de las [Dirección13] , , , . Como se dijo, el acuer do d e Junta Directiva es aún vigente, y no se ha visto afectado por las vicisitudes ocurridas respecto al crédito bancario donde fuera adjudicado el Banco Popular y de Desarrollo Comunal, pues el inmueble continuó inscrito a nombre del Instituto cuando el Banco le revierte la Inscripción Registral . En este empréstito no tuvo participación directa el actor con su nombre en forma expresa, sin embargo, participa del acuerdo donde el Instituto de Desarrollo Agrario readquiere las parcelas, con la finalidad de entregarlas nuevamente a los productores bananeros perjudicados, siendo el actor uno de ellos, ya que estaba poseyendo ya válidamente tiempo atrás.
Según se desprende del documento visible a folios 272 a 276 que es acuerdo con el Banco Popular y 531-543 que es convenio del proyecto bananero y en ambos participa el actor). Aunada a esta prueba, se cuenta con la declaración del testigo [Nombre5] a folio 450, quien reconoce el actor es parte de los productores de banano perjudicados, y que para no causar mayor perjuicio a éste parcelero se trató de asignar las parcelas a éste y otros miembros de su familia, dicho testigo dijo: " Con respecto a estas parcelas la Institución ya había determinado que el actor tenía derecho solo a una y que las otras tres parcelas se iban a asignar a tres familias, y tres familias que incluso sería familiares de don [Nombre6] () aclaro eran familia de don [Nombre1] para evitar el menor perjuicio posible". (ver declaración de folio 450). Lo anterior implica la Institución demandada, reconoce que algún momento emitió un acto donde le autorizó el traspaso a favor del actor y que su ocupación era válida.
Respecto al cuestionamiento sobre la posesión del actor, nótese se tuvo demostrado que aunque el actor trabaje en la Asamblea Legislativa, no ha incurrido en abandono de las parcelas, pues del estudio técnico visible a folios 295 a 329, se desprende los actos posesorios ejercidos por el actor y su familia, consistente en uso agrícola principalmente y habitacional. El testimonio de [Nombre5] a folio 448, se señala la ocupación del actor en las parcelas de marras, indicando referiéndose al actor lo siguiente: " A él lo he visto desarrollar en estos cuatro terrenos, actividad productiva junto a su familia, la primera de esa actividad fue una actividad bananera, luego de eso ha sido actividad productiva con arroz, papaya y banano dátil, básicamente y algunos otros cultivos en áreas pequeñas.." (ver declaración a folio 448 y 449). De allí, deba reconocerse el derecho de posesión, como uno de los atributos contenidos en el derecho de propiedad, al tener su posesión contenido real según la prueba citada.
VI I .- AN Á LISIS SOBRE LA ACCI Ó N REIVINDICATORIA PLANTEADA POR EL RECONVENTOR: La acción reivindicatoria constituye la más eficaz y enérgica defensa de la propiedad, y que está constituida por aquella pretensión por virtud de la cual el propietario de una cosa que se ve privado de la misma se dirige para recobrarla contra el que la está poseyendo o detentando sin pertenecerle. Esta acción de naturaleza real se dirige contra todo poseedor que carezca de título de dominio. Son tres los presupuestos de validez de la acción reivindicatoria:
Se rechaza la genérica sine actione agit, por ser comprensiva de las anteriores ya expuestas.- 2) Con relación a las excepciones opuestas a la contrademanda, las mismas se acogen salvo la de prescripción positiva y caducidad . La de caducidad s e rechaza compartiéndose las razones expuestas por el a-quo al indicar que en este proceso no se ventila pretensión alguna relacionada con caducidad de alguna acción específica. Se rechaza la excepción de prescripción positiva, pues este asunto no se trata de un reconocimiento de la usucapión agraria, pues la usucapión opera cuando el título de transmisión o adquisición es a non domino, de quien no es dueño, mas no cuando es a domino o a verus domino, sea cuando emana del dueño o verdadero dueño, porque en este caso, si el título es perfecto surte de inmediato todos sus efectos, y si tiene algún vicio de otra índole, por emanar del verdadero propietario su convalidación puede producirse por el transcurso del plazo decenal, pero este último aspecto no es de análisis en este proceso al no haber sido objeto de las pretensiones.
La calificación jurídica dada en la motivación de esta sentencia, es de reconocimiento del derecho de propiedad por causa adquisitiva de compra que contó con la autorización del Instituto respectivo, no siendo de recibo los agravios del recurrente sobre que el reconocimiento de su derecho es por adquisión por prescripción adquisitiva o usucapión. Se acoge la excepción de falta de derecho, pues el Instituto al otorgar autorización del traspaso del dominio al actor mediante acuerdo Junta Directiva número 16 008-90 del en fecha 23 de enero 1990, vacía de contenido la propiedad registral que aparece a su nombre y por tal motivo también se acoge la falta de legitimación activa, pues el reconventor no era el dueño de los inmuebles, y la falta de legitimación pasiva también se acoge pues el demandado no es poseedor ilegítimo al haberse demostrado su derecho como se indicó. Se omite por innecesario pronunciamiento sobre la falta de interés actual, pues al no haberse demostrado el derecho por parte del reconventor, resulta innecesario determinar sobre su interés actual.-
IX.Por lo expuesto, deberá revocarse parcialmente la sentencia y en su [Nombre2] se resuelve: se rechaza las excepciones de falta de derecho, falta de legitimación activa y pasiva y la genérica sine actione agit opuestas por la accionada, se confirma el rechazo de la excepción de falta de interés actual y se declarará con [Nombre2] la demanda incoada por [Nombre1] contra el Instituto de Desarrollo Agrario hoy Instituto de Desarrollo Rural denegándose en lo que no se indique y admitiéndose así: Se declar a a favor del actor [Nombre1] el derecho de propiedad con todos sus atributos, se orden a al demandado Instituto de Desarrollo Rural en la p ersona de su apoderado, comparecer ante Notario Público a otorgar escritura pública traspasando ante el Registro Nacional a nombre del actor, las fincas FOLIOS REAL: MATRICULAS 20987-000, 20989-000, 20993-000, 21015-000; todas del partido de Limón dentro del plazo de diez días a partir de la firmeza de esta sentencia.
Si no hay cumplimiento, procederá el juez en nombre del obligado al otorgamiento dicho, según lo estipula el artículo 698 del Código Procesal Civil de aplicación supletoria.- Con relación a la contrademanda, se acogen las excepciones de falta de derecho, falta de legitimación activa y pasiva, falta de interés, y se confirma el rechaz o de la caducidad y prescripción positiva. S e declara SIN [Nombre2] LA CONTRADEMANDA incoada por el Instituto de Desarrollo Agrario contra [Nombre1] en todos sus extremos . Son las costas personales y procesales a cargo del Instituto perdidoso , condenatoria dada por imperativo legal del artículo 221 del Código Procesal Civil y artículo 55 de la Ley de Jurisdicción Agraria.
POR TANTO:
Se declara sin [Nombre2] la nulidad. SE REVOCA parcialmente la sentencia y en su [Nombre2] se resuelve: se rechaza las excepciones de falta de derecho, falta de legitimación activa y pasiva y la genérica sine actione agit opuestas por la accionada , se confirma el rechazo de la excepción de falta de interés actual y se declara CON [Nombre2] LA DEMANDA incoada por [Nombre1] contra el Instituto de Desarrollo Agrario hoy Instituto de Desarrollo Rural denegándose en lo que no se indique y admitiéndose así : Se declar a a favor del actor [Nombre1] el derecho de propiedad con todos sus atributos, se orden a al demandado Instituto de Desarrollo Rural en la p ersona de su apoderado, comparecer ante Notario Público a otorgar escritura pública traspasando ante el Registro Nacional a nombre del actor, las fincas FOLIOS REAL: MATRICULAS CED8 - , CED9 , CED10 - y CED11 ; todas del partido de Limón dentro del plazo de diez días a partir de la firmeza de esta sentencia.
Si no hay cumplimiento, procederá el juez en nombre del obligado al otorgamiento dicho. Con relación a la contrademanda, se acogen las excepciones de falta de derecho, falta de legitimación activa y pasiva, falta de interés, y se confirma el rechaz o de la caducidad y prescripción positiva. S e declara SIN [Nombre2] LA CONTRADEMANDA incoada por el Instituto de Desarrollo Agrario contra [Nombre1] en todos sus extremos . Son las costas personales y procesales a cargo del Instituto perdidoso .
