BACKGROUND:
1 . The petitioner instituted this proceeding seeking a judgment ordering that the following-described land be registered in her name in the Real Property Registry of the Registro Nacional: land used for pasture cultivation, with the remainder consisting of secondary scrubland (tacotales) and mountain forest, located at [Dirección1], ( ), ( ), in the province of San José. Boundaries: NORTH: Río Angostura, Roblesa S.A.; SOUTH: Río División separating it from the Estate of [Nombre3]; EAST: Roble S.A.; and WEST: Río Angostura, [Nombre4], according to cadastral survey plan (plano catastrado) SJ-uno dos tres siete cinco cero nueve- dos mil siete, in the name of [Nombre1], dated siete de setiembre de dos mil siete, having an area of doscientos sesenta y ocho hectáreas cinco mil seiscientos treinta y tres metros con quince decímetros cuadrados ( 268 ha 5633,15 m²) (initial petition: fol. 8; cadastral survey plans on folios and 293).- 2 .
The representatives of the State and the Instituto de Desarrollo Rural were duly notified of this proceeding. The INDER representative stated that the land is located within the Reserva Forestal Los Santos (folio 58). The State representative opposed approval of these proceedings on the grounds set forth at folios 43 a 45, 111 a 114,260 a 262, 387 a 388, 422 a 423.- 3 .- Judge Sugeily Hernández Azofeifa of the Agrarian Court of the First Judicial Circuit of the Southern Zone, Pérez Zeledón, by judgment number 130-S-2015 issued at dieciocho horas y nueve minutos del veintidós de junio del año dos mil quince, ruled: “THEREFORE: The present POSSESSORY TITLE PROCEEDINGS brought by [Nombre1] ARE DENIED. Once this decision becomes final, the proceeding shall be deemed concluded and the case file shall be archived” (Folios 425 a 434).- 4 .- The petitioner filed an appeal expressly setting forth the reasons for challenging the trial court’s position (folios 456 a 463).- 5 . - The statutory requirements were observed in the conduct of the proceeding, and the judgment contains no errors or omissions capable of rendering it null and void.- Drafted by Judge ULATE CHACÓN, and,
CONSIDERING:
As grounds for nullity, the appellant alleges a lack of immediacy in the taking of evidence and contends that, because a new survey plan was submitted, a new judicial inspection (reconocimiento judicial) should be conducted and the court below should hear the testimonial evidence anew. Pursuant to article 26 of the Ley de Jurisdicción Agraria, the Court finds that the asserted grounds for nullity are without merit.
II.PROVEN FACTS.- The findings concerning the proven facts are affirmed, but at this appellate stage the following is also deemed established: 1) The title applicant, [Nombre1], by tacking the possession of her predecessors in interest, has possessed the property since at least mil novecientos cincuenta y tres, quietly, openly, peacefully, and continuously, carrying out agricultural activity on the property consisting primarily of pastureland and structures and, currently, forest protection (See cadastral survey plan at folio 1, certification of public deeds at folios 2 a 5, folios 126 a 128, and the testimony of [Nombre5], [Nombre6], and [Nombre7] at folios 74 a 77).
III.The determination concerning the unproven facts is not affirmed because it is based on a partial analysis of the evidence submitted in these proceedings. As to the first fact, the Court reaches the opposite conclusion; as to the second, it is irrelevant to the purpose of the possessory title proceeding, namely, the formalization of title to the property.
IV.The trial judge denied these proceedings essentially because, in her view, the title applicant failed to establish through competent evidence ten years of possession before 12 de noviembre de 1975, when the Reserva Forestal Los Santos was created. She gave no weight to the documentary evidence submitted.
V.The appellant challenges the trial court’s judgment in its entirety. She contends that all statutory requirements necessary for approval of the possessory title proceedings were satisfied. She essentially alleges a violation of the rules governing the assessment of evidence, asserting that the documentary evidence submitted was not evaluated, even though it establishes more than fifty years of possession, including the required ten-year period; she further contends that the decision was reached through a partial analysis lacking a comprehensive interpretation of the applicable provisions. She cites cadastral survey plan number SJ-15734-1975, noting that the property’s adjoining landowners and characteristics are verified in accordance with deed No. 74 del 21 de setiembre de 1953, executed before Notary Public Jorge Fernández Alfaro, to which the survey plan itself refers, as well as deed No. 116-18, executed before notaries Rolando Zellini Duarte and Dinorah Mora Barrantes on 18 de octubre de 1988, thereby establishing possession prior to 1955.
She challenges the erroneous assessment of this documentary evidence and the improper application of article 6 y 7 de la Ley de Informaciones Posesorias, because the testimony of [Nombre5], [Nombre8], and [Nombre7], at folios 74 a 77, must be considered supplementary evidence to the documentary evidence, which amply proves ten years of possession predating the creation of the Reserva Forestal de Los Santos. This is particularly true of [Nombre8]’s testimony, which clearly and unequivocally identifies the chain of transfers. She asserts that the deed executed in 1953 is not merely the memorialization of a legal transaction, as the court below portrayed it, but is closely related to cadastral survey plan 1-15734-1975, which establishes possession and constitutes a valid legal act. Finally, regarding the unproven fact relating to easements (servidumbres), she contends that the court below erred by violating article 19 inciso a) de la Ley de Informaciones posesorias concerning reservations: “If the property is landlocked or fronts on public roads less than twenty meters wide, it shall be subject to the reservations established by the Ley General de Caminos Públicos.” She further explained that the easements have not been created because there is no registrable title to the property, as she stated at folios 372 y 373, an argument the Court did not address.
VI.The appellant is correct in her grounds of appeal (agravios). It must be noted that, in cases of this kind, the petitioner is required to demonstrate ecological possession (posesión ecológica), and in particular that the forest resource (recurso forestal) has been conserved. Indeed, Article 7 of the Possessory Information Act (Ley de Informaciones Posesorias) clearly provides: “When the property referred to in the proceeding is located within a protected wilderness area (área silvestre protegida), regardless of its management category (categoría de manejo), the title claimant (titulante) must demonstrate that he or she holds the legal rights arising from ten-year possession (posesión decenal), exercised for at least ten years before the effective date of the law or decree that created that wilderness area.” In the present case, the title claimant was required to demonstrate conclusively that possession predated 1965.
In the opinion of this Tribunal, the documentary evidence submitted is sufficient for that purpose. Judgment number 4587-97 of Sala Constitucional resolved an action challenging an earlier interpretation by Tribunal Agrario, which in such cases required ten years of personal possession and did not recognize derivative possession (posesión derivada). Far from declaring Article 7 of Ley de Informaciones Posesorias unconstitutional, Sala Constitucional held that it was consistent with the Constitución Política, both to protect the right to a healthy and ecologically balanced environment and to preserve the possibility that private owners who had perfected their agrarian real right (derecho real agrario) through acquisitive prescription (usucapión), by demonstrating ten years of possession before the designation, could establish their ownership and obtain title to the property by relying on transferred possession (posesión trasmitida).
This is consistent with Article 4 of Ley de Informaciones Posesorias, which was violated by the lower court’s interpretation requiring testimonial evidence (prueba testimonial) in such cases. The cited provision clearly states: “When the title claimant proves lawful acquisition by means of a public instrument (documento público) that is not suitable for registration in the Registro Público, testimonial evidence shall not be required if 10 or more years have elapsed since the respective acquisition. In such a case, it shall be sufficient to submit the approved survey plan (plano conforme) of the property and for the visual inspection (inspección ocular) to confirm that it is properly demarcated, is under possession, and is at that time subject to rational exploitation...” (Emphasis added). In other words, the agrarian legislature considered public documentary evidence sufficient to establish prior possession, since it is evident that a deed executed more than ten years earlier reflects the adverse possessor’s intent to possess the property.
III.- Although the Land and Colonization Act (Ley de Tierras y Colonización) of 1961 and Ley Forestal of 1969 provided that forest-covered lands without private occupation formed part of the national reserves, that dedication to the public domain (afectación al dominio público) has evolved in accordance with the development of Human Rights, specifically with the incorporation of third-generation rights, which include the human right to a healthy and ecologically balanced environment. Ley Forestal of 1996 amended Article 7 of Ley de Informaciones Posesorias to permit acquisitive prescription over forest-covered lands, provided that ecological possession was demonstrated through conservation of the forest resource for more than ten years, with transferred possession being available for that purpose (see judgment of Sala Constitucional No. 4587-97). Tribunal Agrario had held that such possession had to be personal, but Sala Constitucional declared that interpretation unconstitutional.
For that reason, the Tribunal corrected its position in subsequent decisions, stating: “V.- With respect to the appellant’s claim that the trial judge erred in applying Article 7 of Ley de Informaciones Posesorias, which he considers to have been declared unconstitutional, and that the proceedings must therefore be analyzed in light of Article 1 of that Act, this Tribunal finds that he is incorrect, because the cited Article 7 was not declared unconstitutional; rather, what was declared unconstitutional was the Tribunal’s prior interpretation under which possession exercised by previous transferors was not counted. Accordingly, because Article 7 of Ley de Informaciones Posesorias remains in force, the petitioner must demonstrate ten years of possession before the declaration of the protected wilderness area, as stated by Sala Constitucional in decision No. 4587-97 (published in Boletín Judicial No. 188 dated 1 de octubre de 1997).
It is important to note that the law would not be applied retroactively, as the appellant claims, because the ten-year period of possession required for acquisitive prescription is established in the Código Civil, and the challenged provision merely highlights certain elements inherent to acquisitive prescription that are also defined in the general legislation, namely: the object of possession and the conditions under which possession must be exercised for it to qualify for acquisitive prescription. In this regard, it is important to note what Sala Constitucional stated on the matter in the cited decision: ‘...The challenged first paragraph of Article 7 of Ley de Informaciones Posesorias, the text of which predates the latest amendment enacted by Ley Forestal No.7575 of 13 de febrero de 1996, governs the titling of real property located within an area declared to be a national park, biological reserve, forest reserve, or protected zone.
That article provides that the title claimant must demonstrate that ten-year possession was exercised at least ten years before the effective date of the law or decree that created the wilderness area. The challenged provision governs the titling of real property that has been dedicated to the public domain through its declaration as a protected wilderness area, regardless of its specific category. It must now be determined whether, under the circumstances contemplated by the challenged provision and in light of the doctrinal and jurisprudential criteria governing the institutions of acquisitive prescription and the possession required for acquisitive prescription, as discussed above, the challenged provision regulates a special form of possession required to acquire ownership of real property, imposing specific requirements that may infringe the right to property or the principle against retroactive application of the law to the detriment of acquired rights or vested legal situations, as protected by the Constitution.
First, it should be noted that the challenged article does not modify—either by increasing or reducing—the ten-year period of possession required for acquisitive prescription, which is established in Article 860 of the Código Civil for the generality of cases in which ownership of real property is sought through positive prescription (prescripción positiva). The extension of the period that the petitioner alleges infringes the right to property does not occur because, given the nature of the property for which title is sought (public property), the period of possession qualifying for acquisitive prescription must elapse before the property is dedicated to the public domain. In other words, the declaration of a protected wilderness area prevents possession after the dedication from being counted and precludes fulfillment of the requirements for acquisitive prescription if the right had not been acquired by that time—that is, if the ten years of possession qualifying for acquisitive prescription under the conditions established by law had not elapsed.
This is merely the natural result of applying the concepts governing the object of possession and the requirement that possession be exercised as titleholder, which are necessary for possession ad usucapionem. It should be recalled that property dedicated to the public domain, whatever its particular characteristics, cannot be acquired through acquisitive prescription if the conditions necessary for acquisition of the right were not satisfied before the dedication occurred. In that regard, although the challenged provision appears to regulate a specific case of acquisitive prescription, it does not create a regime containing requirements different from those established in the Código Civil for the generality of cases. Likewise, the alleged retroactive effect of the provision does not arise, because the ten-year period of possession required for acquisitive prescription is established in the Código Civil, and the challenged provision merely highlights certain elements inherent to acquisitive prescription that are also defined in the general legislation, namely: the object of possession and the conditions under which possession must be exercised for it to qualify for acquisitive prescription.
In other words, the provision does not establish any different principle—or more stringent requirement—with respect to the application of the general rules of acquisitive prescription. It merely specifies how those rules must be applied, which accords with the logical result arising from the public-domain status (condición de bien demanial) of the property for which title is sought. Accordingly, the amendment to Article 7 of Ley de Informaciones Posesorias, whose text is challenged, cannot be considered to have introduced a different regime concerning the requirements for acquisitive prescription that could have worsened the situation of persons exercising possession ad usucapionem over lands that were declared to be of public interest.’ (Tribunal Agrario, No. 173 de las 16:29 horas del 31 de marzo del 2003).
VII.Accordingly, a possessor seeking to acquire by acquisitive prescription (usucapión) land covered by forest that formed part of the national reserves must demonstrate ten-year possession (original or transferred) and that the forest resource has been conserved. This criterion was recently affirmed by the Sala Constitucional in Voto No. [Telf1], issued at 9 hours on 7 de enero del 2015, in response to a judicial consultation on constitutionality concerning titling within the national reserves: “VI.- TITLING OF LAND IN THE NATIONAL RESERVES, THE NATURAL HERITAGE OF THE STATE, THIRD PARTIES WITH SUPERIOR RIGHTS, AND PRIVATE PROPERTY. For purposes of the consultation submitted for its consideration, this Constitutional Court deems it necessary to draw a clear distinction between the concept of National Reserves and that of the Natural Heritage of the State, formerly known as the Agricultural Heritage of the State.
The Ley de Tierras y Colonización, No. 2825 del 14 de octubre de 1961, in Article 7, established the so-called Agricultural Heritage of the State, based on a conception of agricultural property as originating in the Nation. The Agricultural Heritage of the State encompassed all inalienable lands that could not be acquired by claim or possession, including, among others, the maritime-terrestrial zone, islands, the border strip, the strips along navigable rivers, and [Dirección2] National Parks (Articles 7 through 10). In other words, the Heritage encompasses lands characterized by their inalienability, subject to the public domain, and included within some management category, such as National Parks. The Law subsequently introduces a broad concept of National Reserves in Article 11, stating that: ‘Unless proven otherwise, the following belong to the State as national reserves: a) All lands within the boundaries of the Republic that are not registered as private property or as property of the Municipalities or Autonomous Institutions; b) Those not protected by ten-year possession; c) Those that have not been designated by special laws for the establishment of agricultural colonies; and d) In general, all lands that, while not privately owned, are not occupied for public services.’ It follows from the foregoing that lands forming part of the national reserves, as lands suitable for agriculture, livestock farming, or forestry, possessed by private parties for more than ten years and not forming part of the Agricultural Heritage of the State, were eligible for legal recognition.
Private parties obtained such recognition through possessory title proceedings (Información Posesoria) or through the mechanism created by Multiple Land Titling, subsequently called ‘Titling of Lands Located in the National Reserves.’ Subsequently, Ley Forestal No. 4465 de 1969 introduced the concept of the Forest Heritage of the State, assigning the Dirección General Forestal the forestry administration of forest reserves, national parks, State forest nurseries, protection zones, and biological reserves. At that time, the Public Administration recognized that the two legal regimes coexisted within the so-called ‘national reserves’; consequently, in 1972, representatives of the Ministerio de Agricultura y Ganadería (to which the Dirección General Forestal reported), the Instituto de Tierras y Colonización, and the Instituto Costarricense de Turismo entered into an agreement precisely defining the authority of the three agencies over the national reserves (Convenio MAG-ITCO-ICT), 7 marzo 1972, La Gaceta No. 89 del 10 de mayo de 1972).
This occurred because the still-effective Ley de Tierras y Colonización entrusted the Instituto de Tierras y Colonización, the agency responsible for land subdivision and colonization, with the administration of national reserves suitable for agricultural and livestock use. For its part, Ley Orgánica del Ambiente No. 7554 de 1995 incorporated the concept of protected wildland areas (áreas silvestres protegidas), stating that they form part of the Natural Heritage of the State and establishing their permanent protected status (carácter irreductible) (Articles 32 through 38). Subsequently, the current Ley Forestal No. 7575 de 1996 incorporated, in Title Two, Sole Chapter, the concept of the Natural Heritage of the State, even clarifying which portions of the national reserves it encompasses: ‘The Natural Heritage of the State shall consist of the forests and forest lands of the national reserves, of areas declared inalienable, of properties registered in its name, and of those belonging to municipalities, autonomous institutions, and other Public Administration bodies, except for real property securing credit transactions with the Sistema Bancario Nacional that becomes part of its assets.
The Ministerio del Ambiente y Energía shall administer the Heritage.’ Because they are not forest lands, the foregoing excludes from the Natural Heritage of the State lands suitable for agricultural and livestock use, which remain part of the national reserves and may be acquired by private parties through acquisitive prescription. Finally, that same Ley Forestal de 1996 amended Article 37 of the Ley Orgánica del Ambiente and Article 7 of the Ley de Informaciones Posesorias to authorize acquisition by acquisitive prescription and, consequently, registration through possessory title proceedings (as well as through the repealed procedure for titling within national reserves) of lands belonging to the national reserves and suitable for forestry, and even lands in private possession that had been included within a category of protected wildland area (Natural Heritage of the State), provided that ten-year possession predating the creation of the respective area was demonstrated and that the acts of agricultural possession consisted of activities aimed at forest or ecological protection.
In light of all the foregoing, it is therefore clear that the administrative procedure created by the Ley de Titulación Múltiple de tierras (subsequently, the Ley de Titulación en las Reservas Nacionales) served to expedite the titling procedures for agricultural possessors who had completed a short period of acquisitive prescription (first three and later five years), so that they could obtain title to the property and gain access to land, agricultural credit, and adequate housing. This was without prejudice to third parties with superior rights, understood as private parties who could have brought an action asserting a superior right of possession within areas regarded as national reserves; they had only three years in which to assert such a claim, failing which the title would become fully vested, because the limitation period for extinguishing claims (prescripción negativa) had been shortened by the legislature.
A different situation arises, however, with private property affected by those multiple land-titling proceedings. It was logical that, upon the creation of a Multiple Titling Program, property constituted and registered in the name of the Instituto de Tierras y Colonización, and later the Instituto de Desarrollo Agrario, would overlap with properties registered in the names of private parties (because the requirement was that at least 20% of the land within the defined geographic area lack title registered in the Public Registry). Accordingly, this meant that the title granted by ITCO covered land in the national reserves, not land previously registered as the private property of individuals. The foregoing clarifies that if titling was authorized and the resulting title covered, in whole or in part, a privately owned property that had previously been registered, the registered owner would have the right to recover the property, as established by the same provision, but not within the three-year period applicable to third parties with superior rights; rather, within the ten-year period.” (END OF QUOTATION).
VIII.In this case, the court below erred both in assessing the documentary evidence submitted in the proceedings, by failing to analyze it in accordance with Article 54 of the Ley de la Jurisdicción Agraria, and in improperly interpreting and applying the provisions governing agricultural acquisitive prescription (usucapión agraria) contained in the Código Civil and the Ley de Informaciones Posesorias. Specifically, Articles 853 and 854 of the Código Civil and Articles 1 and 6 of the special Law provide that persons who have acquired property through agricultural acquisitive prescription (ipso iure, that is, by operation of law), once the minimum conditions required by law have been satisfied, may institute possessory title proceedings in order to obtain a title eligible for registration in the Registro Público de la Propiedad and thereby secure legal certainty in the exercise of their rights.
Because this is a non-contentious jurisdiction proceeding (jurisdicción no contenciosa), each and every statutory requirement must be satisfied, including: submitting a cadastral survey plan (plano catastrado); notifying adjoining landowners; publishing a public notice (Edicto) for the benefit of third parties; submitting certifications from the Ministerio de Ambiente to determine whether the property lies within a protected area (Area protegida); proving ten-year possession through the testimony of three witnesses from the locality or, alternatively, submitting a document transferring possession (documento traslativo posesorio) that was executed more than ten years earlier, in which case the applicant for title is exempt from testimonial evidence; and stating the current value of the property and the condition of the land in terms of its use and conservation, among other requirements.
IX.In these proceedings, initially instituted by Hacienda San Buena Ventura Sociedad Anónima, through its attorney-in-fact (apoderado) [Nombre6], with the rights subsequently assigned to [Nombre1], the current claimant for title (titulante), contrary to the finding of the lower court (a-quo), the Court has analyzed each and every requirement imposed by the legislature and concludes that those requirements have been met, based on the set of facts deemed sufficiently proven. Regarding the requirement that the trial judge found lacking, it should be noted that, pursuant to Article 4, the claimant first submitted Cadastral Survey Plan (Plano Catastrado) number SJ-15734-1975, dated 1 de febrero del 1972, which describes a parcel of land measuring 294 hectares and 4.952,20 square meters and states that the land is located in [Dirección3] San Isidro de El General, [Dirección4], Province of San José, bounded to the north by Río Angostura, to the south by río División, to the east by Corporación JAPACHECO S.A., and to the west by [Nombre5] and [Nombre9].
The Plan also stated that the properties were acquired through a deed executed before Notary Jorge Fernández Alfaro at 11:00 hours on 21 de setiembre de 1953. Indeed, according to Deed No. 74 dated 21 de setiembre de 1953, executed before Notary Public Jorge Fernández Alfaro, to which the Plan itself refers, [Nombre10] sold to Corporación JAPACHECO, represented by [Nombre11], “his unregistered property, described as follows: land consisting of clearings, natural pastures, and mountain forest, located in [Dirección5] , , Province of San José, bounded: to the north and east by property belonging to the purchasing company known as ‘Rancho Beyo’; to the south, partly by land belonging to the seller, partly by land belonging to [Nombre12], and partly by land belonging to [Nombre13] and [Nombre3], in all cases with Quebrada División lying between them; and to the west by public lands (Baldíos); measuring approximately three hundred hectares...
The seller states that he acquired the property hereby conveyed through a purchase from [Nombre14] , who possessed it openly, peacefully, continuously, and as owner for a period of four years, which possession he transferred to the executing party, Mr. [Nombre10], who has also personally exercised possession in the aforementioned manner for a period of eleven years and hereby transfers it...” (page 127). This means that the property involved in this title proceeding (titulación) has been under private, agricultural possession since at least 1940, when the periods of possession of the prior possessors are added. Subsequently, Mr. [Nombre15], by instrument No. 116-18 executed before notaries Rolando Zellini Duarte and Dinorah Mora Barrantes on 18 de octubre de 1988, sold to Hacienda San Buenaventura Sociedad Anónima the property described in Plan SJ-15734-75 (see pages 2 to 5, 14, and 15), with the purchasing company represented by Mr. [Nombre6]; that company, in turn, assigned and transferred all rights to [Nombre1] on 11 de junio del 2002 (see filing on page 79), which assignment was deemed accepted and completed by the ruling issued at ten hours on diecisiete de junio del dos mil dos.
The appellant is therefore correct in asserting that this documentary evidence was erroneously assessed and that Articles 6 and 7 of the Ley de Informaciones Posesorias were improperly applied, because the testimony of [Nombre5], [Nombre8], and [Nombre7], appearing on pages 74 to 77, was also incorrectly assessed. The witness [Nombre8] stated that he knew Mr. [Nombre6], clearly indicated that the property belonged to JAPACHECO, and accurately described the boundaries of the property (page 76). The witness [Nombre7] also stated that he had known Mr. [Nombre6] for at least fourteen years during his possession of the property and expressly recounted that approximately twenty-five years earlier the property had belonged to the Pachecos, which is unquestionably connected with JAPACHECO S.A. (pages 75-76), which, according to the documentary evidence, acquired it in 1953. Finally, the witness [Nombre5] stated that Mr. [Nombre1] had held the property for more than ten years and that it had previously belonged to Mr. [Nombre15], who had held it for “...many years...”; [Nombre15] was precisely the prior possessor together with JAPACHECO S.A. The witness also referred to the natural boundaries, namely [Dirección6] and [Dirección7], stating that the property consists of mountain forest and dense brush.
The judicial inspection record (acta de reconocimiento judicial) (page 73), the soil study (estudio de suelos) (pages 309 to 310), and the new Cadastral Survey Plan, namely No.SJ-237509-2007, moreover, attest to the transformation undergone by the property for the purpose of conserving forest resources, a fundamental requirement for approving these possessory title proceedings (diligencias de información posesoria), because it can be seen that the entire parcel is devoted to natural forest and has been managed in a manner consistent with that activity; maintaining and preserving the property’s current use is therefore recommended. Finally, it should be added that the fact that the easements (servidumbres) referred to in the plan, which physically exist, have not been legally established does not preclude approval of the possessory title application (información posesoria), because, as the appellant correctly states, the Ley de Informaciones Posesorias itself provides that parcels are subject to the Ley de Caminos Públicos, and the establishment of a right-of-way easement (servidumbre de paso) is a matter unrelated to the acquisition of land through adverse possession (usucapión), as this Court has repeatedly held.
POR TANTO:
The judgment under appeal is reversed. Consequently, the Registro Público de la Propiedad is ordered to register in the name of [Nombre1], single, business administrator, resident of cartago, identity card CED7 - , as an independent property, the land described as follows: Mountain forest land located in [Dirección8], , , , , Province of San José. It measures two hundred sixty-eight hectares, five thousand six hundred thirty-three square meters and fifteen square decimeters (268 ha 5633,15 m2), according to Cadastral Survey Plan number SJ-1237509-2007. [Nombre16] to the north, with Rio Angostura lying between it and Roblesa Sociedad Anónima; to the south, with Río [Dirección9] lying between it and Sucesión de [Nombre3]; to the east, with Roblesa Sociedad Anónima; and to the west, with Río Angostura and [Nombre4] . She has possessed the land as owner and devoted it to natural forest, exercising open, peaceful, and uninterrupted possession for more than seventy years when the possession of her prior transferors is added.
The adjoining landowners (colindantes) and interested third parties were notified, and none opposed these proceedings. The Instituto de Desarrollo Agrario and the Procuraduría General de la República were admitted as parties. The parcel to be registered has a current value of SIX MILLION FIVE HUNDRED THOUSAND COLONES. The proceedings were valued at five million colones. The property remains subject to the restrictions and limitations of the Ley Forestal, Article 15, the Ley de Caminos Públicos, and the Ley de Aguas currently in force, as well as the provisions of the Ley de Uso, Manejo y Conservación de Suelos and its implementing regulations. The lower court shall issue the corresponding writs (mandamientos) for enforcement.

VOTO N° 021-F-16 TRIBUNAL AGRARIO. SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ.- A las catorce horas y veintiuno minutos del dieciocho de enero de dos mil dieciséis.- PROCESO DE INFORMACIÓN POSESORIA, promovido por [Nombre1] , quién es mayor, soltera, administradora de empresas, vecina de Cartago, cédula de identidad CED1 - - . Intervienen en el proceso, EL ESTADO encabezado por la PROCURADURÍA GENERAL DE LA REPÚBLICA (PGR) , representad o por Susana Fallas Cubero, mayor, abogada, vecina de San José, cédula de identidad CED2 - - , en su condición de Procuradora Adjunta, y el INSTITUTO DE DESARROLLO RURAL (INDER), cédula jurídica CED3 - - - , representado por su apoderad o general ísimo sin límite de suma , el ingeniero agrónomo [Nombre2] , mayor, casad o , vecin o de Goicoechea , cédula de identidad número CED4 - - . Actúan como apoderad os especial es judicial es de la parte promovente los licenciados: Jorge Isaac Ortiz Álvarez, mayor, abogado, carnet CED5 , y Adrián Montero Granados, mayor, abogado, carnet CED6 . Tramitado ante el Juzgado Agrario del Primer Circuito Judicial de la Zona Sur, Pérez Zeledón.
RESULTANDO:
1 . La promovente planteó este proceso a fin que en sentencia se ordene la inscripción a su nombre en el Registro Inmobiliario del Registro Nacional , el terreno que se describe así: naturaleza de cultivo de pastos, resto tacotales y montaña, ubicado en [Dirección1], ( ), ( ), de la provincia de San José. Linderos: NORTE: Río Angostura , Roblesa S.A. SUR: Río División en medio con Sucesión de [Nombre3] , ESTE: Roble S.A.; y OESTE: Río Angostura, [Nombre4] , s egún plano catastrado SJ-uno dos tres siete cinco cero nueve- dos mil siete , a nombre d e [Nombre1] , fechado siete de setiembre de dos mil siete , mide de extensión doscientos sesenta y ocho hectáreas cinco mil seiscientos treinta y tres metros con quince decímetros cuadrados ( 268 ha 5633,15 m²) (escrito inicial : fl. 8; p lano s catastrado s de folios y 293 ).- 2 . L o s representantes del Estado y del Instituto de Desarrollo Rural fueron debidamente comunicadas de este proceso.
El representante del INDER indicó que el terreno corresponde a tierras en la Reserva Forestal Los Santos (folio 58) . La representante del Estado se opuso a la aprobación de las presentes diligencias en los términos que corren a folios 43 a 45, 111 a 114,260 a 262, 387 a 388, 422 a 423 .- 3 .- La jueza Sugeily Hernández Azofeifa, del Juzgado Agrario de l Primer Circuito Judicial de la Zona Sur, Pérez Zeledón mediante sentencia número 130-S-2015 de las dieciocho horas y nueve minutos del veintidós de junio del año dos mil quince , resolvió : "POR TANTO: SE RECHAZAN las presentes diligencias de INFORMACIÓN POSESORIA promovidas por [Nombre1] . Firme esta resolución, téngase por terminado el proceso y archívese el expediente" (Folios 425 a 434).- 4 .- La promovente formuló recurso de apelación con indicación expresa de las razones por las cuales refuta la tesis del Juzgado de instancia , (folio s 456 a 463 ). - 5 . - En la substanciación del proceso se han observado las prescripciones legales, y no se nota la existencia de errores u omisiones en el fallo capaces de producir su nulidad. - Redacta el Juez ULATE CHACÓN, y,
CONSIDERANDO:
El recurrente aduce como motivo de nulidad la falta de inmediatez de la prueba, y considera que al presentarse un nuevo plano, debería de realizarse un nuevo reconocimiento judicial, y que la a-quo realice nueva evacuación de la prueba testimonial. Al tenor de lo dispuesto en el artículo 26 de la Ley de Jurisdicción Agraria, el Tribunal considera no proceden los motivos de nulidad invocados.
II.HECHOS PROBADOS.- Se comparte lo dispuesto en cuanto a los hechos demostrados, pero en esta instancia se tiene como acreditado lo siguiente: 1) La titulante, [Nombre1] , sumando la posesión de sus trasmitentes, han poseído desde al menos el año mil novecientos cincuenta y tres, en forma quieta, pública, pacífica e ininterrumpida, desarrollando una actividad agraria en el fundo, consistente fundamentalmente en repastos, construcciones, y actualmente, protección forestal (Ver Plano Catastrado de folio 1, certificación de escritura públicas de folios 2 a 5, folios 126 a 128, así como los testimonios de [Nombre5] , [Nombre6] y [Nombre7] , de folios 74 a 77).
III.No se comparte lo dispuesto en cuanto a los hechos indemostrados, pues parte de un análisis parcial de la prueba traída a estas diligencias. En cuanto al primero, el Tribunal concluye todo lo contrario y, en cuanto al segundo, resulta irrelevante para los fines de la información posesoria, que es la formalización del título de propiedad.
IV.La Juzgadora de primera instancia, rechazó las presentes diligencias, básicamente por cuanto según su criterio el titulante no demostró con prueba idónea la posesión decenal antes del 12 de noviembre de 1975, cuando se creó la Reserva Forestal Los Santos. No le dio ningún valor a la documental aportada.
V.El recurrente combate en su totalidad la sentencia de primera instancia. Considera se cumplieron con todos los requisitos legales necesarios para aprobar las diligencias de información posesoria. Aduce básicamente, una violación a las normas de valoración probatoria, indicando que se ha dejado de valorar la prueba documental aportada, de la cual se desprende una posesión decenal que suma más de cincuenta años, resolviendo en forma parcial y carente de una interpretación global de las normas. Cita el Plano Catastrado número SJ-15734-1975, notándose que se verifican los colindantes y características del inmueble, conforme a las escrituras No. 74 del 21 de setiembre de 1953, otorgada por el notario Público Jorge Fernández Alfaro, a la cual hace referencia el mismo Plano, además la escritura No. 116-18 otorgada ante los notarios Rolando Zellini Duarte y Dinorah Mora Barrantes, el 18 de octubre de 1988, con lo cual se acredita una posesión anterior a 1955.
Combate la errónea valoración de dicha prueba documental, y la indebida aplicación del artículo 6 y 7 de la Ley de Informaciones Posesorias, por cuanto las declaraciones testimoniales de [Nombre5] , [Nombre8] y [Nombre7] , de folios 74 a 77, deben ser valoradas como prueba complementaria a la documental que, sobradamente, prueba la posesión decenal anterior a la Reserva Forestal de Los Santos. Especialmente la declaración de [Nombre8] , que indica la cadena de transmisión, de manera clara e indubitable. La escritura hecha en 1953, señala, no es una simple puesta en papel de un negocio jurídico, como lo hace ver la a-quo, sino que está en estrecha relación con el plano catastrado 1-15734-1975, que demuestra la posesión y es un acto jurídico válido. Finalmente, aduce, en cuanto al hecho indemostrtado, relativo a las servidumbres, aduce que la a-quo comete un erro, en el sentido de que viola el artículo 19 inciso a) de la Ley de Informaciones posesorias, en cuanto a las reservas "Si el fundo es enclavado o tiene frentes a caminos públicos, con ancho inferior a veinte metros, estará afecto a las reservas que indica la Ley General de Caminos Públicos", además de que explicó que las servidumbres no están constituidas por falta de título inscribible de propiedad, como lo hizo ver a folios 372 y 373, sobre lo cual el Juzgado no respondió.
VI.Lleva razón la recurrente en sus agravios. Es necesario indicar que en este tipo de casos, se le exige al promovente demostrar una posesión ecológica, y en particular haber conservado el recurso forestal. Efectivamente, el artículo 7 de la Ley de Informaciones Posesorias indica claramente: “Cuando el inmueble a que se refiere la información esté comprendido dentro de un área silvestre protegida, cualquiera que sea su categoría de manejo, el titulante deberá demostrar ser el titular de los derechos legales de posesión decenal, ejercida por lo menos con diez años de antelación a la fecha de vigencia de la ley o decreto en que se creó esta área silvestre”. En el presente caso, la titulante debía demostrar, en forma indubitable, una posesión anterior a 1965. A juicio de este Tribunal, la prueba documental aportada resulta suficiente para ello. La sentencia número 4587-97 de la Sala Constitucional, resolvió una acción por la cual se impugnaba una antigua interpretación del Tribunal Agrario, que exigía para esos casos una posesión decenal personal, sin reconocer la posesión derivada.
La Sala, lejos de declarar la inconstitucionalidad del artículo 7 de la Ley de Informaciones Posesorias, lo declara acorde con la Constitución Política, para proteger no sólo el derecho a un ambiente sano y ecológicamente equilibrado, sino también para dejar a salvo la posibilidad de que los propietarios privados que habían consolidado por usucapión su derecho real agrario, demostrando diez años de posesión anterior a la afectación, pudieran demostrar su dominio y acceder a un título de propiedad, valiéndose de la posesión trasmitida. Ello va en consonancia con lo dispuesto en el artículo 4 de la Ley de Informaciones Posesorias, el cual resulta conculcado por la interpretación de la a-quo, de exigir en estos casos la prueba testimonial. La citada norma indica claramente: "Cuando el titulante demostrare su legítima adquisición por medio de documento público que no fuere apto para su inscripción en el Registro Público, no será necesario que ofrezca prueba testimonial, si hubieren transcurrido 10 o más años de la respectiva adquisición.
En tal caso bastará que presente el plano conforme de la finca y que en la inspección ocular se constate que está debidamente deslindada, que es objeto de posesión y que en ese momento está sometida a explotación racional..." (Lo subrayado no es del original). Es decir, el legislador agrario consideró suficiente la prueba documental pública, para acreditar la posesión anterior, pues resulta evidente que una escritura de más de diez años de otorgada refleja la voluntad del usucapiente de poseer el inmueble. III.- Si bien es cierto, la Ley de Tierras y Colonización de 1961 y la Ley Forestal de 1969, establecían que los terrenos cubiertos de bosque, sin ocupación privada eran parte de las reservas nacionales, dicha afectación al dominio público ha venido cambiando conforme la evolución de los Derechos Humanos, y específicamente con la incorporación de los de tercera generación, en los cuales se incluye el derecho humano a un ambiente sano y ecológicamente equilibrado.
La Ley Forestal de 1996 reformó, el artículo 7 de la Ley de Informaciones Posesorias, para permitir la usucapión, en terrenos cubiertos de bosque, pero demostrando una posesión ecológica, a través de la conservación del recurso forestal, durante más de diez años, pudiéndose aprovechar la posesión trasmitida (ver sentencia de la Sala Constitucional No. 4587-97). El Tribunal Agrario sostuvo el criterio de que dicha posesión debía ser de carácter personal, pero la Sala declaró que el mismo era inconstitucional. Por eso el Tribunal, ha rectificado el criterio en resoluciones posteriores indicando: "V.- En cuanto a lo alegado por el recurrente respecto a que el juzgador de instancia comete un error al aplicar el artículo 7 de la Ley de Informaciones Posesorias, el cual considera fue declarado inconstitucional por lo que debe analizarse las diligencias a la luz de lo dispuesto por el artículo 1 de dicha Ley, considera este Tribunal no lleva razón pues el artículo 7 citado no fue declarado inconstitucional, sino lo fue la interpretación que venía haciendo el Tribunal en cuanto no se contabilizaba la posesión ejercida por los anteriores transmitentes.
De ahí, al estar vigente el ordinal 7 de la Ley de Informaciones Posesorias, debe el promovente demostrar una posesión decenal antes de la declaratoria del área silvestre protegida según lo indicó la Sala Constitucional en el voto No. 4587-97 (publicado en el Boletín Judicial No. 188 de fecha 1 de octubre de 1997). Es importante mencionar que tampoco se estaría aplicando retroactivamente la ley como lo indica el recurrente, porque el plazo de diez años de posesión para usucapir se encuentra establecido en el Código Civil y la disposición cuestionada simplemente destaca ciertos elementos propios de la usucapión que también están definidos en la normativa general, como son: el objeto de la posesión y las condiciones en que ésta se debe ejercer para ser apta para la usucapión. En ese sentido es importante señalar lo dicho por la Sala Constitucional al respecto en el voto citado “…El artículo 7 párrafo primero de la Ley de Informaciones Posesorias impugnado, cuyo texto es anterior a la última reforma por Ley Forestal No.7575 de 13 de febrero de 1996, regula el caso de la titulación de bienes inmuebles comprendidos dentro de un área declarada parque nacional, reserva biológica, reserva forestal o zona protectora.
Señala ese artículo que el titulante tendrá que demostrar haber ejercido la posesión decenal con por lo menos diez años de antelación a la fecha de vigencia de la ley o el decreto que creó el área silvestre. La disposición cuestionada regula el caso de titulación de un bien inmueble que ha sido afectado al dominio público con la declaratoria de área silvestre protegida, cualquiera que sea su especificidad. Corresponde ahora determinar si de acuerdo con la hipótesis que contempla la norma impugnada, a la luz de los criterios doctrinarios y jurisprudenciales que informan los institutos de la usucapión y de la posesión necesaria para usucapir, expuestos anteriormente, la norma cuestionada regula un tipo especial de posesión necesaria para adquirir la propiedad sobre los bienes inmuebles, que impone requisitos específicos que pueden infringir el derecho de propiedad o el principio de irretroactividad de la ley en perjuicio de derechos adquiridos o situaciones jurídicas consolidadas, regulados en la Constitución.
En primer término, debe señalarse que el artículo cuestionado no modifica -aumenta o disminuye- el plazo de diez años de posesión necesario para usucapir, fijado en el artículo 860 del Código Civil para la generalidad de los casos en que se pretende adquirir la propiedad de los bienes inmuebles por prescripción positiva. La ampliación del plazo que alega el accionante como infractor del derecho a la propiedad no se produce, porque dada la naturaleza del bien que se pretende titular (cosa pública), el plazo de posesión apta para la usucapión debe transcurrir antes de que se produzca la afectación del bien al dominio público. Es decir, la declaratoria de área silvestre protegida evita que cuente la posesión posterior a la afectación, e impide concretar los requisitos de la usucapión si a ese momento no se ha adquirido el derecho, o sea, no han transcurrido los diez años de posesión apta para usucapir con las condiciones que establece la ley.
Lo anterior es únicamente el resultado natural de aplicar los conceptos sobre el objeto de la posesión y su condición de ejercicio en calidad de titular, necesarios para la posesión ad usucapionem. Recuérdese que los bienes afectados al dominio público, tengan las especificaciones que tengan, no son susceptibles de adquisición por usucapión, si antes de producirse la afectación no se dieron las condiciones necesarias para la adquisición del derecho. En ese sentido, la disposición cuestionada, a pesar de que en apariencia regula un caso específico de usucapión, no crea un régimen con requisitos diferentes a los establecidos en el Código Civil para la generalidad de los casos. En ese sentido, tampoco se produce el alegado efecto retroactivo de la norma, porque el plazo de diez años de posesión para usucapir se encuentra establecido en el Código Civil y la disposición cuestionada simplemente destaca ciertos elementos propios de la usucapión que también están definidos en la normativa general, como son: el objeto de la posesión y las condiciones en que ésta se debe ejercer para ser apta para la usucapión.
Es decir, la norma no viene a establecer ningún principio diferente -o requisito más riguroso- en relación con la aplicación de las reglas generales de la usucapión. Simplemente especifica la forma en que deben aplicarse esas reglas, lo que coincide con un resultado lógico dada la condición de bien demanial del objeto a titular. De ahí que no se considere que la reforma al artículo 7 de la Ley de Informaciones Posesorias, cuyo texto se impugna, haya introducido un régimen diferente en relación con los requisitos de la usucapión, que haya podido agravar la situación de personas que se encontraban ejerciendo posesión ad usucapionem en terrenos que fueron declarados de interés público. (Tribunal Agrario, No. 173 de las 16:29 horas del 31 de marzo del 2003).
VII.De manera que el poseedor que pretenda adquirir por usucapión un terreno cubierto de bosque, que formaba parte de las reservas nacionales, deberá demostrar la posesión decenal (originaria o trasmitida), y haber conservado el recurso forestal. Dicho criterio, fue ratificado, recientemente por la Sala Constitucional, en el Voto No. [Telf1], de las 9 horas del 7 de enero del 2015, al responder una consulta judicial de constitucionalidad, relacionada con la titulación en las reservas nacionales: "VI.- LA TITULACIÓN DE TIERRAS EN LAS RESERVAS NACIONALES, EL PATRIMONIO NATURAL DEL ESTADO, LOS TERCEROS CON MEJOR DERECHO Y LA PROPIEDAD PRIVADA. Este Tribunal Constitucional, a propósito de la consulta sometida a conocimiento, considera necesario hacer la distinción clara entre el concepto de Reservas Nacionales, y aquél de Patrimonio Natural del Estado, antes denominado Patrimonio Agrícola del Estado.
La Ley de Tierras y Colonización, No. 2825 del 14 de octubre de 1961, en su artículo 7, estableció el llamado Patrimonio Agrícola del Estado, partiendo de una concepción de la propiedad agraria como originaria de la Nación. El Patrimonio agrícola del Estado comprendía todas las tierras inalienables y no susceptibles de adquirirse por denuncio o posesión, entre otras, la zona marítimo terrestre, las Islas, la franja fronteriza, las franjas de los ríos navegables, los [Dirección2] Parques Nacionales (artículos 7 al 10). Es decir, el Patrimonio comprende aquellos terrenos con características de inalienabilidad, sometidos al dominio público, y contenidos en alguna categoría de manejo, como los Parques Nacionales. Posteriormente la Ley introduce un concepto amplio de Reservas Nacionales, en el artículo 11, al indicar que “Mientras no se pruebe lo contrario, pertenecen al Estado en carácter de reservas nacionales: a) Todos los terrenos comprendidos dentro de los límites de la República que no estén inscritos como propiedad particular, de las Municipalidades o de las Instituciones Autónomas; b) Los que no estén amparados por la posesión decenal; c) Los que, por leyes especiales, no hayan sido destinados a la formación de colonias agrícolas; y d) En general todos los que, no siendo de propiedad particular, no estén ocupados en servicios públicos.” De lo anterior se desprende que los terrenos que forman parte de las reservas nacionales, como terrenos de vocación agrícola, ganadera o forestal, poseídos por los particulares durante más de diez años y que no formen parte del Patrimonio agrícola del Estado, eran susceptibles de reconocimiento jurídico.
Tal reconocimiento lo alcanzan los particulares, a través de los procesos de Información Posesoria, o bien, mediante el instrumento que se creó a través de la Titulación Múltiple de Tierras, posteriormente denominada “Titulación de Tierras Ubicadas en las Reservas Nacionales”. Luego, la Ley Forestal No. 4465 de 1969, introduce el concepto de Patrimonio Forestal del Estado, confiriéndole la administración forestal, de las reservas forestales, los parques nacionales, los viveros forestales del Estado, las zonas protectoras y las reservas biológicas, a la Dirección General Forestal. En ese momento, la Administración Pública se percata de que dentro de las llamadas “reservas nacionales”, conviven los dos regímenes, por los que en 1972, suscriben un convenio representantes del Ministerio de Agricultura y Ganadería (de quien dependía la Dirección General Forestal), el Instituto de Tierras y Colonización y el Instituto Costarricense de Turismo, que definió con precisión las facultades de los tres organismos sobre las reservas nacionales (Convenio MAG-ITCO-ICT), 7 marzo 1972, La Gaceta No. 89 del 10 de mayo de 1972).
Lo anterior ocurre, porque la Ley de Tierras y Colonización, aún vigente, le confía la administración de las reservas nacionales, con vocación agropecuaria, al Instituto de Tierras y Colonización, órgano encargado de la parcelación y colonización. Por su parte, la Ley Orgánica del Ambiente No. 7554 de 1995, incorpora el concepto de áreas silvestre protegidas, indicando que forma parte del patrimonio natural del Estado y estableciendo su carácter irreductible (artículos 32 al 38). Posteriormente, la Ley Forestal vigente No. 7575 de 1996 incorpora, en el Titulo segundo, capítulo único el concepto de Patrimonio Natural del Estado, aclarando incluso, qué es lo que comprende de las reservas nacionales: “El patrimonio natural del Estado estará constituido por los bosques y terrenos forestales de las reservas nacionales, de las áreas declaradas inalienables, de las fincas inscritas a su nombre y de las pertenecientes a municipalidades, instituciones autónomas y demás organismos de la Administración Pública, excepto inmuebles que garanticen operaciones crediticias con el Sistema Bancario Nacional e ingresen a formar parte de su patrimonio.
El Ministerio del Ambiente y Energía administrará el patrimonio.” Lo anterior excluye como parte del patrimonio natural del Estado, por no ser forestal, los terrenos de aptitud agropecuaria, que siguen siendo parte de la reservas nacionales, y susceptibles de usucapión por parte de particulares. Finalmente, la misma Ley Forestal de 1996, modificó el artículo 37 de la Ley Orgánica del Ambiente, y el artículo 7 de la Ley de Informaciones Posesorias, para autorizar la usucapión, y por ende la inscripción mediante información posesoria (y el procedimiento derogado de la titulación en reservas nacionales), terrenos que pertenecen a las reservas nacionales, con vocación forestal e, incluso, terrenos en posesión privada, que quedaron comprendidos dentro de alguna categoría de área silvestre protegida (Patrimonio Natural del Estado), siempre y cuando se demostrara una posesión decenal anterior a la fecha de creación de la respectiva área, y los actos posesorios agrarios consistieran en actividades tendientes a la protección forestal o ecológica.
Con todo lo antes expuesto, resulta claro, entonces, que el procedimiento administrativo creado en la Ley de Titulación Múltiple de tierras (posteriormente, la Ley de Titulación en las Reservas Nacionales), vino a permitir agilizar los trámites de titulación de los poseedores agrarios, que habían cumplido una usucapión corta (primero de tres y luego de cinco años), para que pudieran obtener un título de propiedad, y tener posibilidades de acceso a la tierra, al crédito agrario y a la vivienda digna. Lo anterior, sin perjuicio de terceros de mejor derecho, entendiendo como tales, aquéllos particulares que pudieron haber ejercido una acción de mejor derecho de posesión, dentro de las zonas consideradas como reservas nacionales, para lo cual tenían solo tres años para reclamarlo, de lo contrario el título quedaría totalmente consolidado, pues el plazo de la prescripción negativa, fue reducido por el legislador.
Sin embargo, situación distinta ocurre con la propiedad privada afecta en esos procesos de titulación múltiple de tierras. Era lógico que al crear un Programa de Titulación Múltiple, la propiedad constituida e inscrita a nombre del Instituto de Tierras y Colonización, luego Instituto de Desarrollo Agrario, se sobreponía con propiedades inscritas a nombre de particulares (pues el requisito era que en la zona geográfica delimitada hubiera, al menos un 20% de terrenos sin título inscrito en el registro público). Ello suponía, en consecuencia, que el título que otorgaba el ITCO, lo era sobre terrenos de las reservas nacionales, no sobre terrenos inscritos anteriormente en propiedad privada de particulares. Lo anterior permite aclarar que si se autorizaba una titulación, y ese título recaía, total o parcialmente, sobre un inmueble particular anteriormente inscrito, el propietario registral tendría derecho a reivindicar, tal y como lo establece la misma norma, pero no dentro del plazo de tres años, aplicable a los terceros con mejor derecho, sino dentro del plazo de los diez años." (HASTA AQUÍ LA CITA).
VIII.En este caso, la a-quo erró tanto en la valoración de la prueba documental aportada a las diligencias, al no analizarlas conforme al artículo 54 de la Ley de la Jurisdicción Agraria, cuanto en la indebida interpretación y aplicación de las normas relacionadas con la Usucapión agraria, contenidas en el Código Civil y en la Ley de Informaciones Posesorias. Justamente, las disposiciones del Código Civil, artículos 853 y 854, y de la Ley especial, artículos 1 y 6, establecen la posibilidad de los sujetos que han adquirido un bien por usucapión agraria (ipso iure, es decir de pleno derecho), cuando se han cumplido las condiciones mínimas exigidas por la Ley, de acudir a la vía de la información Posesoria, a fin de obtener un título inscribible en el Registro Público de la Propiedad, para lograr de ese modo la certeza o seguridad jurídica en el ejercicio de su derecho. Siendo un trámite de jurisdicción no contenciosa, es necesario cumplir con todos y cada uno de los requisitos que establece la Ley, tales como: presentar plano catastrado, notificar a los colindantes, publicar un Edicto para efectos de terceros, presentar certificaciones del Ministerio de Ambiente, para determinar si el fundo está o no dentro de alguna Area protegida, probar su posesión decenal mediante la declaración de tres testigos del lugar, o bien, aportar documento traslativo posesorio con más de diez años de otorgado, caso en el cual se exime al titulante de la prueba testimonial, indicar el valor actual del inmueble, así como el estado de uso y conservación del suelo, entre otros.
IX.En las presentes diligencias establecidas, inicialmente, por la Hacienda San Buena Ventura Sociedad Anónima, con su apoderado [Nombre6] , y luego cedidos los derechos a [Nombre1] , actual titulante contrario a lo indicado por la a-quo, el Tribunal ha entrado a analizar todos y cada uno de los requisitos exigidos por el legislador, y llega a la conclusión de que tales exigencias se cumplen, de acuerdo al elenco de hechos tenidos por suficientemente acreditados. En cuanto al requisito que hecha de menos el juzgador de instancia, debe indicarse que de conformidad con lo indicado en el artículo 4, la titulante presentó, en primer término, el Plano Catastrado número SJ-15734-1975, del 1 de febrero del 1972, en el cual se describe un Terreno de 294 Hectáreas 4.952,20 metros cuadrados, y en cuya descripción se indica que el Terreno está situado en [Dirección3] San Isidro de El General, [Dirección4] , Provincia de San José, colindando al norte con el Río Angostura, al Sur con el río División, al este, con la Corporación JAPACHECO S.A., y al Oeste con [Nombre5] y [Nombre9] .
Además, se indicó en el Plano que los inmuebles fueron adquiridos mediante escritura ante el Notario Jorge Fernández Alfaro, a las 11 horas del 21 de setiembre de 1953. Efectivamente, según la escritura No. 74 del 21 de setiembre de 1953, otorgada por el notario Público Jorge Fernández Alfaro, a la cual hace referencia el mismo Plano, se indica que [Nombre10] le vende a la Corporación JAPACHECO, representada por [Nombre11] "la finca de su propiedad sin inscribir que se describe así: terreno de abras, potreros naturales y montaña, sito en [Dirección5] , , de la Provincia de San José, lindante: Norte y Este con propiedad de la Sociedad compradora, llamada "Rancho Beyo", Sur, terrenos del vendedor en parte, en parte de [Nombre12] y en parte de [Nombre13] y [Nombre3] , todos con la Quebrada División en medio, y al Oeste con Baldíos, mide como trescientas hectáreas aproximadamente...Dice el vendedor que la finca que ahora traspasa la adquirió por compra que hizo a [Nombre14] , quien la poseyó en forma quieta pública y pacífica, sin interrupción alguna y a título de dueño por espacio de cuatro años, posesión que le trasmitió al otorgante señor [Nombre10] quien además ha ejercido personalmente la posesión en la misma forma explicada por espacio de once años y que trasmite en este acto..." (folio 127).
Lo anterior significa, que el inmueble objeto de esta titulación, ha estado sometido a la posesión particular, y agraria, desde al menos el año 1940, si se suma el tiempo de los anteriores poseedores. Posteriormente, Don [Nombre15] , mediante No. 116-18 otorgada ante los notarios Rolando Zellini Duarte y Dinorah Mora Barrantes, el 18 de octubre de 1988, le vende el inmueble a la sociedad Hacienda San Buenaventura Sociedad Anónima, el terreno descrito en el PLano SJ-15734-75 (ver folios 2 a 5, 14 y 15), siendo que la sociedad compradora está representada por don [Nombre6] , la cual a su vez, cede y traspasa todos los derechos a [Nombre1] , el 11 de junio del 2002 (ver escrito de folio 79), cesión que se tiene por aceptada y realizada, mediante resolución de las diez horas del diecisiete de junio del dos mil dos. De ahí que lleva razón el recurrente al indicar que ha existe una errónea valoración de dicha prueba documental, y la indebida aplicación del artículo 6 y 7 de la Ley de Informaciones Posesorias, por cuanto las declaraciones testimoniales de [Nombre5] , [Nombre8] y [Nombre7] , de folios 74 a 77, también han sido valoradas de manera incorrecta.
El testigo [Nombre8] dijo conocer a don [Nombre6] , indicando claramente que la finca pertenecía a JAPACHECO, indicando perfectamente las colindancias del inmueble (folio 76). El testigo [Nombre7] , también indicó conocer a don [Nombre6] , desde hacía al menos catorce años de posesión de la finca, y narró expresamente que hace aproximadamente veinticinco años la finca era de los Pacheco, lo que está relacionado, indudablemente, con JAPACHECO S.A. (folio 75-76), que según la prueba documental adquirió en el año 1953. Finalmente, el testigo [Nombre5] , refiere a que el señor [Nombre1] tenía más de diez años de tener la finca, y que antes era de don [Nombre15] , quien la tuvo "...tamaños años...", y justamente [Nombre15] era el anterior poseedor con la sociedad JAPACHECO S.A. También hizo referencia los linderos naturales,a saber el [Dirección6] y [Dirección7]., indicando que la misma es de montaña y breñones.
El acta de reconocimiento judicial (folio 73), el estudio de suelos (folios 309 a 310), y el Plano Catastrado nuevo, a saber el No.SJ-237509-2007, por otra parte, dan fe de la transformación sufrida por el inmueble en aras de la conservación del recurso forestal, requisito fundamental para aprobar estas diligencias de información posesoria, porque puede observarse que la totalidad del fundo está dedicado al bosque natural, y se ha realizado un ejercicio conforme a la actividad, con lo cual se recomienda mantener y preservar el uso actual del inmueble. Finalmente, debe agregarse, que el hecho de que no estén constituidas las servidumbres a que se refiere el plano y que existen materialmente, no es óbice para rechazar la información posesoria, porque como bien lo dice el recurrente, la misma Ley de Informaciones Posesorias refiere a que los fundos quedan afectos a la Ley de Caminos Públicos, y la constitución de una servidumbre de paso es un tema ajeno a la adquisición de un terreno mediante la usucapión, como reiteradamente lo ha indicado este Tribunal.
X.En consecuencia, deberá revocarse la sentencia apelada, para en su lugar aprobar las presentes diligencias de información posesoria.
POR TANTO:
Se revoca la sentencia apelada. En consecuencia, se ordena al Registro Público de la Propiedad, inscribir a nombre de [Nombre1] , soltera, administradora de empresas, vecina de cartago, cédula de identidad CED7 - , como finca independiente, el terreno que se describe así: Terreno de montaña, situado en [Dirección8], , , , , de la Provincia de San José. Mide doscientas sesenta y ocho hectáreas, cinco mil seiscientos treinta y tres metros con quince decímetros cuadrados (268 ha 5633,15 m2) según Plano Catastrado número SJ-1237509-2007. [Nombre16] al Norte con el Rio Angostura en medio de Roblesa Sociedad Anónima, al Sur con Río [Dirección9], en medio de Sucesión de [Nombre3] , al Este con Roblesa Sociedad Anónima, al Oeste con Río Angostura, y [Nombre4] . El terreno lo ha poseído a título de dueña, y lo ha dedicado a bosque natural, ejerciendo una posesión pública, pacífica e ininterrumpida por más de setenta años, sumando la posesión de sus anteriores trasmitentes.
Fueron notificados los colindantes y terceros interesados, sin que se opusieran al presente trámite. Se tuvo como parte al Instituto de Desarrollo Agrario y a la Procuraduría General de la República. El fundo a inscribir tiene un valor actual de SEIS MILLONES QUINIENTOS MIL COLONES. Las diligencias fueron estimadas en cinco millones de colones. El inmueble queda sujeto a las restricciones y limitaciones de la Ley Forestal, artículo 15, Ley de Caminos Públicos y Ley de Aguas vigentes, así como a las disposiciones de la Ley de Uso, Manejo y Conservación de Suelos y su reglamento. Por parte del a-quo expídase los mandamientos correspondientes para su ejecución.
