CONSIDERING:
I.The Procuraduría General de la República timely raises an objection for lack of subject-matter jurisdiction (excepción de incompetencia en razón de la materia). It bases its argument on judgment number 959-F-S1-2013 of the First Chamber of the Supreme Court of Justice, issued at 09 hours 25 minutes on 01 de agosto de 2013, asserting that the matter falls within the jurisdiction of the administrative courts (jurisdicción contencioso administrativa) because public-domain property (dominio público) is involved. It further argues that the potential subject matter of the proceeding is the dispute over the possessory rights (derechos posesorios) of private parties within the State Natural Heritage (Patrimonio Natural del Estado), including the Refugio de Fauna Silvestre Barra del Colorado (folios 45 to 46).
II.This action is brought to obtain a declaration that the plaintiff is the lawful owner and possessor of an unregistered property located in [Dirección1] Sarapiquí and seeks, among other relief, acquisitive prescription (usucapión) in the plaintiff’s favor. Subject-matter jurisdiction (competencia por razón de la materia) in agrarian matters is established in general terms by Articles 1 and 2 of the Ley de Jurisdicción Agraria. Likewise, Section 113 of the Ley Orgánica del Poder Judicial provides that the agrarian courts shall hear matters relating to agrarian law, regardless of the amount in controversy, as well as any other matters assigned to them by law. The fundamental criterion is the agricultural production activity (actividad agraria de producción), whether involving animal husbandry or crop cultivation, or related work, as well as sustainable agro-environmental activities. Supplementary parameters that have been established include the nature or suitability of the productive property, its size, and the parties participating in the agrarian proceeding as plaintiffs or defendants.
The nature or suitability of the property is closely linked to agrarian holdings (fundos agrarios)—incorrectly referred to in legislation as rural parcels (predios rústicos)—that are devoted or suitable for devotion to productive agricultural activities or to forest conservation and sustainable forest management. The participants likewise acquire the designation of “agrarian subjects” (sujetos agrarios) because of their engagement in productive agricultural activities. In this matter, the property at issue (bien objeto de litis) comprises 280 hectares and is suitable for agricultural use, as explained above. For that reason, this Chamber considers this to be a matter within the jurisdiction of the agrarian courts, given its specialized subject matter. This position is supported by the analysis of the Sala Constitucional de la Corte Suprema de Justicia in judgment number 9928, issued at 15 hours on 9 de junio de 2010, which held that if the claim in the proceeding, based on its substantive content, is governed by the agrarian legal framework, even though it relates to administrative conduct or a specific manifestation of the administrative function—insofar as a public entity or body is involved—it must be heard and decided by the specialized agrarian courts, taking into account the material or substantive content of the claim and the applicable legal framework.
Specifically, the aforementioned Sala Constitucional stated the following in that decision: “The constituent amending authority, or reforming power, established a constitutional reservation of the subject-matter jurisdiction of the contentious-administrative courts by providing that their purpose is to ‘guarantee the legality of the administrative function.’ Consequently, the ordinary legislature, in exercising its freedom to shape or configure the law, may not assign that jurisdiction to any judicial branch other than the contentious-administrative branch, since doing so would deprive the institutional guarantee and the fundamental right enshrined in Article 49 of the Constitution of their substance. On this particular point and following a more considered assessment, this Constitutional Court modifies or reverses the position set forth in Judgments Nos. 3095-94 at 15:57 hrs. on 3 de agosto de 1994, 7540-94 at 17:42 hrs. on 21 de diciembre, both of 1994, 5686-95 at 15:39 hrs. on 18 de octubre de 1995, and 14999-2007 at 15:06 hrs. on 17 de octubre de 2007.
The foregoing means that when a litigant asserts a claim challenging the invalidity of administrative conduct or its substantive nonconformity with the administrative legal system, or that of any individual manifestation of the administrative function—whether a formal or material omission, formal activity or material action, or an administrative legal relationship—the contentious-administrative courts must invariably hear and decide it. Obviously, if the claim, based on its substantive content, is governed by labor, family, or agrarian law, even though it relates to administrative conduct or a specific manifestation of the administrative function—insofar as a public entity or body is involved—it must be heard and decided by the courts having jurisdiction over those matters, because what is not actually being challenged is the substantive conformity or nonconformity of the administrative function or conduct with the administrative legal system, which is what Article 49 of the Constitution reserves to the contentious-administrative courts.
This Constitutional Court considers that the determining criteria for distinguishing the scope of jurisdiction of the contentious-administrative courts from that of other specialized judicial branches—which the ordinary courts must henceforth take into consideration—shall therefore be the following: 1°) the material or substantive content of the claim, and 2°) the applicable legal framework; accordingly, if the substantive conformity or nonconformity of a specific manifestation of the administrative function with the body of legality is disputed, the conflict of interest must necessarily be heard by the contentious-administrative courts” (boldface appears in the original). Because of its binding nature pursuant to Article 13 of the Ley de Jurisdicción Constitucional, the foregoing ruling of the Sala Constitucional de la Corte Suprema de Justicia requires an analysis of the material or substantive content of the claim asserted in the complaint in order to determine whether the proceeding falls within the jurisdiction of the Jurisdicción Agraria.
In view of the foregoing, the objection for lack of jurisdiction (excepción de incompetencia) raised by the Procuraduría General de la República shall be denied. Moreover, this Chamber has previously addressed the issue; by way of illustration, judgment number 996-C-15 stated: “IV- Regarding the public-domain status (demanialidad) of all land forming part of the Patrimonio Natural del Estado. In addressing this issue, consideration must be given to Sections 13, 14, and 15 of the Ley Forestal, which define the Patrimonio Natural del Estado and its effects on the decision ultimately rendered on the merits. In addition, it will also be necessary to consider Article 58 of the Ley de Biodiversidad, which defines the concept of a protected wild area (área silvestre protegida) as a form of management, consistent with the management category, of ecological systems located on the land surfaces of the national territory, and which reads: ‘ARTICLE 58.- Protected wild areas Protected wild areas are delimited geographical zones consisting of land, wetlands, and portions of the sea.
They have been so declared because they have special significance due to their ecosystems, the existence of threatened species, their importance for reproduction and other needs, and their historical and cultural significance. These areas shall be devoted to conserving and protecting biodiversity, soil, water resources, cultural resources, and ecosystem services in general. The objectives, classification, requirements, and mechanisms for establishing or reducing these areas are set forth in the Ley Orgánica del Ambiente, No. 7554, of 4 de octubre de 1995. The prohibitions affecting natural and legal persons within national parks and biological reserves are established in the Ley de la Creación del Servicio de Parques Nacionales, No. 6084, of 24 de agosto de 1977. During the process of meeting the requirements for establishing state protected wild areas, the corresponding technical reports shall include the relevant recommendations and justifications for determining the most appropriate management category to which the proposed area should be subject.
In all cases, the establishment of areas and categories shall give due consideration to rights previously acquired by Indigenous or rural populations and other natural or legal persons located within or adjacent to the area.’ (boldface does not appear in the original). Furthermore, Article 60 of that law provides: ‘ARTICLE 60.- Ownership of protected wild areas Protected wild areas, in addition to those owned by the State, may be municipal, mixed, or privately owned. Given their great importance in ensuring the conservation and sustainable use of the country’s biodiversity, the Ministerio del Ambiente y Energía and all public entities shall encourage their creation and shall also oversee and assist in their management.’ It should also be noted that the same statute amended the third paragraph of Article 37 of the Ley Orgánica del Ambiente to read: ‘c) Article 37.- Powers of the Executive Branch Privately owned properties affected pursuant to this article because they are located within national parks, biological reserves, wildlife refuges, forest reserves, and protective zones shall become part of state protected areas only once they have been paid for or legally expropriated, unless they are voluntarily placed under the Régimen Forestal.
In the case of forest reserves, protective zones, and wildlife refuges, if payment or expropriation has not occurred and while it remains pending, the areas shall be subject to an environmental land-use plan (plan de ordenamiento ambiental) that includes an environmental impact assessment (evaluación de impacto ambiental) and, subsequently, to a plan for the management, recovery, and restoration of resources.’ The arguments of the state entity—that merely because the registered property of the state entity forms part of the Refugio Nacional de Vida Silvestre Barra del Colorado and is in the public domain, the matter must be heard by the contentious-administrative courts—are unpersuasive. Nothing prevents this proceeding from being adjudicated by the agrarian courts. Furthermore, as stated above, within protected wild areas, except for biological reserves and national parks, given the purposes and absolute conservation objectives of those management categories, public and private properties may coexist in the other categories, and their owners may be public entities or private persons.
To hold otherwise would entail an entirely state-centered view of environmental management, eliminating the modern approach of co-management (comanejo) of the environment with civil society. The social effects of such an approach would not benefit the survival of ecosystems in practice, given the limited capacity of the State and its institutions to directly manage, monitor, and safeguard environmental resources. It would also have the practical effect of imposing on the State the duty to compensate all owners of private properties located in every area administered under a management category, including those who exercise possession while respecting the regenerative capacity of ecosystems and voluntarily submit to the Régimen Forestal. Such compensation is justified only in the management categories of national parks and biological reserves. Regarding the incorporation of forested land into the public domain (demanialización), this Court considers that, in this case, the issue must be resolved in the judgment on the merits.
It should nevertheless be noted that the Ley de Informaciones Posesorias permits the titling of forested land located within or outside protected wild areas, provided the statutory requirements are met, in accordance with Article 7 of the Ley de Informaciones Posesorias, as amended by the current Ley Forestal. Furthermore, the Ley Forestal regulates the conservation, protection, management, and utilization of forest resources under technical and legal criteria that ensure their perpetuity. See in this regard the body of provisions concerning private forest property beginning with Article 19.
Protection of the State’s right to intervene to safeguard environmental interests that it considers may be harmed is already ensured by the participation of the Procuraduría General de la República as a party to the proceedings (litis). For these reasons, the objection for lack of jurisdiction (excepción de incompetencia) raised by the Procuraduría General de la República is denied.”

CONSIDERANDO:
I.La Procuraduría General de la República, en tiempo, interpone la excepción de incompetencia en razón de la materia. Basa su argumento en la sentencia de la Sala Primera de la Corte Suprema de Justicia número 959-F-S1-2013 de las 09 horas 25 minutos del 01 de agosto de 2013, afirmando el asunto es de conocimiento de la jurisdicción contencioso administrativo porque está por medio dominio público. Suma a su razonamiento, el eventual objeto de proceso es la discusión de derechos posesorios de particulares dentro del Patrimonio Natural del Estado incluido el Refugio de Fauna Silvestre Barra del Colorado (folio 45 a 46).
II.Esta demanda es interpuesta para pedir que se declara como legítimo dueño y poseedor de una finca sin inscribir ubicada en [Dirección1] Sarapiquí, pide la usucapión a su favor, entre otros. La competencia agraria por razón de la materia está determinada en forma genérica por los artículos 1 y 2 de la Ley de Jurisdicción Agraria. Así mismo, el numeral 113 de la Ley Orgánica del Poder Judicial indica, conocerán los juzgados agrarios de lo relativo a la materia agraria, cualquiera que sea la cuantía y de los demás asuntos que les encomienden las leyes. El criterio fundamental es, la actividad agraria de producción, sea de cría de animales o cultivo de vegetales, o cuando se trate de labores conexas, así como agroambientales sostenibles. Como parámetros complementarios, se han establecido la naturaleza o aptitud del bien productivo, su extensión, y los sujetos que participan dentro del proceso agrario como personas actoras o demandadas.
La naturaleza o aptitud del bien está estrechamente vinculada a los fundos agrarios (denominados incorrectamente por la legislación como predios rústicos), dedicados o susceptibles de destinarse al ejercicio de actividades agrarias productivas, o a la conservación de bosques y manejo sostenible de éstos. Los intervinientes, igualmente, adquieren su calificativo de "sujetos agrarios" por su dedicación al ejercicio de actividades agrarias productivas. En este asunto el bien objeto de litis se trata de 280 hectáreas la cual es de aptitud agraria según se expuso. Por esa razón considera esta Cámara se trata de un asunto que es competencia de los tribunales agrarios dada la especialidad de la materia. En apoyo de esta tesis se expone lo analizado por la Sala Constitucional de la Corte Suprema de Justicia mediante el voto número 9928 de las 15 horas del 9 de junio de 2010 en el que dispuso, si la pretensión del proceso, por su contenido material, aunque esté relacionada con alguna conducta administrativa o manifestación específica de la función administrativa –en la medida en que interviene un ente u órgano público- se encuentra regida por el régimen jurídico agrario, debe ser conocida y resuelta por los tribunales especializados agrarios, tomándose en consideración el contenido material o sustancial de la pretensión y el régimen jurídico aplicable.
Concretamente, la Sala Constitucional aludida, señaló en la decisión en mención lo siguiente: "El constituyente derivado o poder reformador estableció una reserva constitucional de la competencia material de la jurisdicción contencioso-administrativa al estatuir que su objeto es “garantizar la legalidad de la función administrativa”, razón por la cual el legislador ordinario, en el ejercicio de su libertad de conformación o configuración, no puede atribuirle esa competencia a otro orden jurisdiccional que no sea el contencioso-administrativo, puesto que, de ser así, estaría vaciando de contenido la garantía institucional y el derecho fundamental que consagra el artículo 49 de la Constitución. Sobre este punto en particular y, bajo una mejor ponderación, este Tribunal Constitucional varía o revierte la tesis expuesta en los Votos Nos. 3095-94 de las 15:57 hrs. de 3 de agosto de 1994, 7540-94 de las 17:42 hrs. de 21 de diciembre ambos de 1994, 5686-95 de las 15:39 hrs. de 18 de octubre de 1995 y 14999-2007 de las 15:06 hrs. de 17 de octubre de 2007.
Lo anterior significa que cuando un justiciable deduce una pretensión para cuestionar la invalidez o disconformidad sustancial con el ordenamiento jurídico-administrativo de una conducta administrativa o cualquier manifestación singular de la función administrativa (omisión formal o material, actividad formal o actuación material o relación jurídico-administrativa), debe conocerla y resolverla, indefectiblemente, la jurisdicción contencioso-administrativa. Obviamente, si la pretensión, por su contenido material, aunque esté relacionada con alguna conducta administrativa o manifestación específica de la función administrativa –en la medida en que interviene un ente u órgano público-, se encuentra regida por el régimen jurídico laboral, de familia o agrario, debe ser conocida y resuelta por esos órganos jurisdiccionales, por cuanto, no se cuestiona, propiamente, conformidad o disconformidad sustancial de la función o conducta administrativa con el ordenamiento jurídico-administrativo que es lo que el artículo 49 constitucional le reserva a la jurisdicción contencioso-administrativa.
Este Tribunal Constitucional, estima que los criterios determinantes para deslindar el ámbito competencial de la jurisdicción contencioso-administrativa de otros ordenes jurisdiccionales especializados –que, en adelante, deben tenerse en consideración por la jurisdicción ordinaria- serán, entonces, los siguientes: 1°) El contenido material o sustancial de la pretensión y 2°) el régimen jurídico aplicable; de modo que si se discute la conformidad o disconformidad sustancial de una manifestación específica de la función administrativa con el bloque de legalidad, el conflicto de interés, será, necesariamente, de conocimiento de la jurisdicción contencioso-administrativa" (lo resaltado con negrita corresponde al original). El pronunciamiento expuesto de la Sala Constitucional de la Corte Suprema de Justicia, por su naturaleza vinculante de conformidad con lo dispuesto en el artículo 13 de la Ley de Jurisdicción Constitucional, exige analizar el contenido material o sustancial de la pretensión expuesta en la demanda, para poder determinar si se está en presencia o no de un proceso competencia de la Jurisdicción Agraria.
En razón de lo expuesto procederá rechazar la excepción de incompetencia interpuesta por la Procuraduría General de la República. A mayor abundamiento de razones esta Cámara se ha referido al tema; para ilustrar el voto número 996-C-15 indicó: "IV- Respecto el tema de la demanialidad de todos los terrenos que forman parte del Patrimonio Natural del Estado. En esa tema debe tenerse presentes las normas 13, 14 y 15 de la Ley Forestal que definen el Patrimonio Natural del Estado y sus efectos en la decisión que por el fondo se llegue a emitir. Aunado a lo anterior, también será necesario considerarse lo regulado en el artículo 58 de la Ley de Biodiversidad que define el concepto de área silvestre protegida como forma de gestión acorde con la categoría de manejo los sistemas ecológicos que estuvieren incorporados en la superficies terrestres del territorio nacional que reza: "ARTÍCULO 58.- Áreas silvestres protegidas Las áreas silvestres protegidas son zonas geográficas delimitadas, constituidas por terrenos, humedales y porciones de mar.
Han sido declaradas como tales por representar significado especial por sus ecosistemas, la existencia de especies amenazadas, la repercusión en la reproducción y otras necesidades y por su significado histórico y cultural. Estas áreas estarán dedicadas a conservación y proteger la biodiversidad, el suelo, el recurso hídrico, los recursos culturales y los servicios de los ecosistemas en general. Los objetivos, la clasificación, los requisitos y mecanismos para establecer o reducir estas áreas se determinan en la Ley Orgánica del Ambiente, No. 7554, de 4 de octubre de 1995. Las prohibiciones que afectan a las personas físicas y jurídicas dentro de los parques nacionales y las reservas biológicas están determinadas, en la Ley de la Creación del Servicio de Parques Nacionales, No. 6084, de 24 de agosto de 1977. Durante el proceso de cumplimiento de requisitos para establecer áreas silvestres protegidas estatales, los informes técnicos respectivos deberán incluir las recomendaciones y justificaciones pertinentes para determinar la categoría de manejo más apropiada a que el área propuesta debe someterse.
En todo caso, el establecimiento de áreas y categorías tomará muy en cuenta los derechos previamente adquiridos por las poblaciones indígenas o campesinas y otras personas físicas o jurídicas, subyacentes o adyacentes a ella. " (la negrita no corresponde al original). Por otra parte, el artículo 60 de esa norma señala: "ARTÍCULO 60.- Propiedad de las áreas silvestres protegidas Las áreas silvestres protegidas, además de las estatales, pueden ser municipales, mixtas o de propiedad privada. Por la gran importancia que tienen para asegurar la conservación y el uso sostenible de la biodiversidad del país, el Ministerio del Ambiente y Energía y todos los entes públicos, incentivarán su creación, además, vigilarán y ayudarán en su gestión.". Cabe agregar también de esa misma norma legal la reforma que introdujo a la Ley Orgánica del Ambiente en el párrafo tercero del artículo 37, para se lea: " c) Artículo 37.-Facultades del Poder Ejecutivo Las fincas particulares afectadas según lo dispuesto por este artículo, por encontrarse en parques nacionales, reservas biológicas, refugios de vida silvestre, reservas forestales y zonas protectoras, quedarán comprendidas dentro de las áreas protegidas estatales solo a partir del momento en que se hayan pagado o expropiado legalmente, salvo cuando en forma voluntaria se sometan al Régimen Forestal.
Tratándose de reservas forestales, zonas protectoras y refugios de vida silvestre y en caso de que el pago o la expropiación no se haya efectuado y mientras se efectúa, las áreas quedarán sometidas a un plan de ordenamiento ambiental que incluye la evaluación de impacto ambiental y posteriormente, al plan de manejo, recuperación y reposición de los recursos." Los argumentos del ente estatal que indica, que solo por formar parte la finca inscrita del ente estatal del Refugio Nacional de Vida Silvestre Barra del Colorado y ser de dominio público, debe conocerse dentro de la jurisdicción contenciosa administrativa, no se comparten. Pues, nada obsta para que en la jurisdicción agraria pueda dilucidar este proceso, además de que, como se citó dentro de las áreas silvestres protegidas, a excepción de reservas biológicas y parques nacionales, dadas sus finalidades y objetivos de conservación absoluta de esas categorías de manejo, en los demás si pueden coexistir fincas públicas y privadas cuyos propietarios pueden ser entes públicos o personas privadas.
Entender lo contrario conlleva a una visión absolutamente estatal de la gestión ambiental, eliminando toda la moderna visión del comanejo con la sociedad civil del ambiente. Cuyos efectos sociales no benefician en el campo la supervivencia de los ecosistemas, dada la limitada capacidad del Estado y sus instituciones de gestionar en forma directa, vigilar y resguardar los recursos ambientales. Además de producir el efecto practicó de imponer el deber del Estado de indemnizar a todos los titulares de fincas privadas ubicadas en todas las áreas manejadas como una categoría de manejo, aún los que desarrollen una posesión en respeto de la capacidad de regeneración de los ecosistemas y se sometan en forma voluntaria al Régimen Forestal. Cuando ello solo resulta justificado en las categorías de manejo de parque nacional y reserva biológica. Sobre la demanialización de terrenos boscosos, estima este Tribunal, en este caso en un tema que deberá resolverse en la sentencia de fondo.
Sin que deje de mencionarse al respecto, Ley de Informaciones Posesorias permite la titulación de terrenos boscosos, ubicados dentro o fuera de áreas silvestres protegidas, siempre y cuando se cumplan los requisitos legales, acorde con el artículo 7 de la Ley de Informaciones Posesorias reformado por la Ley Forestal vigente. Aunado a que la Ley Forestal norma regula la conservación, tutela, gestión y aprovechamiento de recursos forestales bajo criterios técnicos y legales que aseguren su perpetuidad. Vease al respecto el conjunto de normas dedicado a la propiedad forestal privada a partir del artículo 19. La protección del derecho del Estado de intervenir en tutela de los intereses ambientales que estime puedan lesionarse, ya se encuentran representados al tener como parte de la litis a la Procuraduría General de la República. Por tales razonamientos, se rechaza la excepción de incompetencia interpuesta por la Procuraduría General de la República".
POR TANTO:
Se rechaza la excepción de incompetencia en razón de la materia interpuesta por la Procuraduría General de la República.
