The land to which title is to be granted shall be subject to the reservations set forth in the Ley General de Caminos Públicos, under which the minimum width of highways is twenty meters and that of local roads is fourteen meters, along the [Dirección3] boundary (Articles nineteen of the Ley de Informaciones Posesorias and four of the Ley General de Caminos Públicos). It shall also be subject to the provisions of article thirty-three, subsection b), of the current Ley Forestal, under which an area extending fifteen meters from watercourses constitutes a protected area (área de protección) in which the cutting or removal of trees is prohibited if the land is level, or extending fifty horizontal meters if the land is rugged; it is therefore subject to the statutory restrictions established in article thirty-four of the aforementioned Law along the [Dirección4] and [Dirección5] boundaries. The channel and waters of the watercourses are in the public domain (Ley de Aguas, articles one, subsection IV, and three, subsection III).
Any surface water and groundwater existing on the property (wells, springs (nacientes), lagoons, etc.) are also in the public domain and do not form part of the property. I.This Tribunal does not adopt the statement of facts deemed proven in the judgment under appeal, given the manner in which this matter must be resolved.- *
II.Deputy Attorney General Lydiana Rodríguez Paniagua appeals judgment number 158-S-2015, issued at seven hours fifty-five minutes on September thirty, two thousand fifteen, arguing, among other grounds, that since 15 de enero del 2015 her office had opposed approval of the possessory title proceeding unless a new plan was submitted that proportionally excluded the wetland area.- (See appellate brief in the image dated 2 octubre 2015).- *
III.This approving judgment was issued prematurely because, when the field study was conducted by the Sistema Nacional de Áreas de Conservación, the existence of a 0.49 ha area corresponding to a wetland (humedal) was determined; that study appears in the report contained in the file dated 09/01/15, 10:20:39 am. The study image cartographically depicts the wetland area that must be protected.- * Likewise, the Instituto de Acueductos y Alcantarillados, UEN Gestión Ambiental, identifies in image 99 the water-fragility study (estudio de fragilidad hídrica) and notes the importance of preserving the spring (naciente) located on the property; therefore, its radius must be excluded. In light of the foregoing, and because this was noted at the appropriate time, it is necessary not only for the existence of the wetland to be depicted on the survey plan (plano), but also for its corresponding dimensions to be shown; that is, the area must be clearly demarcated on cadastral plan (plano catastrado) A-1606725-2012.
Accordingly, an order must be issued requiring the preparation of a new plan that excludes the spring area and describes the location and corresponding dimensions of the wetland. Those requirements were not satisfied by the petitioner, and therefore the study submitted by the Sistema Nacional de Áreas de Conservación and the Acueductos y Alcantarillados water-fragility study must be observed. Title was approved without addressing those matters, and consequently the judgment was premature and must be annulled; a cadastral plan excluding the indicated spring and describing the location and corresponding dimensions of the wetland must be submitted.- *
* * * * * * * * * * * * IV.- Dissenting Opinion of Judge Castro García.* The undersigned judge respectfully disagrees with the opinion annulling the decision that approved these possessory-information proceedings (proceso de información posesoria) and ordering the title applicant (titulante) to exclude from the plan underlying these proceedings the spring protection area and the wetland area, on the ground that they are deemed to be in the public domain (dominio público). In this judge’s view, based on her review of the proceedings, the approving judgment should be affirmed, because the petitioner demonstrated compliance with all requirements of the Ley de Informaciones Posesorias and established the type of possession exercised over the land that he acquired by adverse possession (usucapión) and for which he requested the issuance of a registrable title (título inscribible). First, the property is not located within any protected wildlife area (área silvestre protegida), and testimonial evidence demonstrated that he has possessed the property for more than thirty years.
The judicial inspection (reconocimiento judicial) showed that the forested areas were well protected and that the spring area had forest cover (cobertura forestal) throughout its protection area. This was also confirmed by the testimonial evidence. In addition, the submitted soil study states that the land is being used in conformity with its proper use (uso conforme). No national or international legal provision declares wetlands to be subject to the public-domain regime * (except for mangroves, which the Ley de Zona Marítimo Terrestre expressly classifies as such). That ecosystem, which is of great environmental importance and receives enhanced protection under the body of environmental law (bloque normativo ambiental), may, like any ecosystem located within real property, be titled as private property. Its possessor or owner has a legal duty to abide by the limitations on private-property rights (límites al derecho de propiedad privada) entailed by ownership of environmentally significant property.
The management of those environmental resources may be undertaken by private parties and through joint management (comanejo) and coordination with the government entities vested with substantive authority (competencia material) for oversight and control. Accordingly, I disagree with the decision requiring the petitioner to exclude the wetland area on the property from the plan and not to consider it part of his property. On this matter, this Tribunal has ruled, quoting an opinion of the Sala Constitucional:* "* IV. It is important to mention, although the representative of the State did not raise it as a ground for appeal (agravio), that wetlands are those “areas of marsh, fen, peatland, or water, whether natural or artificial, permanent or temporary, with water that is static or flowing, fresh, brackish, or salt, including areas of marine water the depth of which at low tide does not exceed six meters.” In this case, there is no evidence supporting the conclusion that the petitioner affected them in any manner by interrupting their natural cycles, such as through the construction of dikes or drains, drainage, drying, filling, or any other alteration causing the deterioration or elimination of such ecosystems, as provided in Articles 98, 100 and 128 of the Ley Orgánica del Ambiente; Article 70, subsection f), of Decreto Ejecutivo Nº 34433-MINAE del 11 de marzo de 2008, Reglamento a la Ley de Biodiversidad Nº 7788 de 30 de abril de 1998; and Decreto Ejecutivo 35803-MINAET, entitled “Criterios técnicos para la identificación, clasificación y conservación de humedales.” Quite the contrary, the technical body identified as the Instituto Nacional de Innovación y Transferencia de Tecnología Agropecuaria certified that, in this case, the property has been used in conformity with its soil type......
Returning to the foregoing, with respect to the ground for appeal raised by the representative of the State asserting that ten-year possession (posesión decenal) was not established, it is important to note that, to the contrary, the witnesses whose testimony was received in these proceedings stated that they know the property and have personal knowledge that possession has been exercised over it since many years before the date required by law. In addition, this Tribunal disagrees with the arguments of the representative of the State that the presence of forest on the property converts it into public-domain property, because Article 7 of the Ley de Informaciones Posesorias authorizes the titling of forested properties provided that the requirements established by that provision are met; those requirements were previously cited, and compliance with them was verified. It should be noted that the constitutionality and nonretroactivity of that provision were upheld by the Sala Constitucional in opinion [Telf1], which removed the property from the public domain (desafectó) by allowing it to be titled.- V. In light of the foregoing, pursuant to the opinion of the Sala Constitucional [Telf1], Articles 98, 100 and 128 of the Ley Orgánica del Ambiente; Article 70, subsection f), of Decreto Ejecutivo Nº 34433-MINAE del 11 de marzo de 2008, Reglamento a la Ley de Biodiversidad Nº 7788 de 30 de abril de 1998; Decreto Ejecutivo 35803-MINAET, entitled “Criterios técnicos para la identificación, clasificación y conservación de humedales”; Articles 1, 2, 6, 7 and 11 of the Ley de Informaciones Posesorias; and Articles 6, 26, 54 and 79 of the Ley de Jurisdicción Agraria, the judgment must be affirmed insofar as it was appealed, with the addition at this stage that reforestation of the property with species endemic to the country is recommended, as reflected in the certifications issued by the Instituto Nacional de Innovación y Transferencia en Tecnología Agropecuaria (folios 61 and 96).” (Voto N.561-F-11).
Real property containing diverse ecosystems may be titled, as provided by Article seven of the Ley de Informaciones Posesorias. II - Now, with respect to the spring and its protection area, which the majority opinion requires to be excluded from the plan and treats as grounds for annulment of the judgment on appeal, this judge likewise disagrees. The Ley de Aguas N. 276 establishes in Article 31 when land surrounding springs and water resources is to be reserved for the public domain. It provides: “The following are declared to be reserved to the Nation: a) Land surrounding drinking-water collection sites or supply intakes, within a perimeter having a radius of no less than two hundred meters.” (boldface not in the original). * In the case at bar (subjúdice), those circumstances are not present, because the spring located on the land is not subject to any collection system for supplying water to any concession holder or population, nor is it reserved for future plans.
This fact was recorded by the entity legally vested with substantive authority over the matter, namely the Instituto Costarricense de Acueductos y Alcantarillados, which stated in the report contained in the record: “It is noted that there is no record of water intakes on that property or in its surrounding area.. The Departamento de Aguas MINAET was consulted, and note DA-3249-21010 dated 17/09/2010 states that there are no registered concessions for the use of water to supply populations.. According to the analysis conducted in our information system concerning the use of water to supply populations, there is currently no such use on the property identified in expediente N. EXPN1- , nor is it included in future plans for that purpose. ... there is a spring on the property that gives rise to a body of water. This spring is not being collected to supply any aqueduct.” No provision declares every spring or river and its protection area to be in the public domain; only those that have been tapped or are reserved by the State for future use are in the public domain, pursuant to the cited Article 31.
This does not apply to water resources and riverbeds containing channels, surface water, and groundwater, whose nature is public-domain by operation of law (Ley de Aguas and Ley de MInería). Under Article 33 of the Ley Forestal, the obligation of the owners or possessors of land containing bodies of water that have not been tapped under the terms cited above (supra) is to preserve and properly manage the legally established protection areas. These are the so-called limitations on private property (limitaciones a la propiedad privada) developed by constitutional doctrine regarding the right to private property, and they require avoiding any activity that causes contamination. In this judge’s opinion, the reason issuance of a registrable title should be authorized for the petitioner in this particular case is that, when the amendment to Article 7 of the Ley de Informaciones Posesorias established in Ley Forestal N. 7575 del año 1996 entered into force, private parties were authorized to title and possess property containing forests, ecosystems of that nature, or natural resources, regardless of the forest species contained therein.
This is provided that it is demonstrated that possession was exercised in a manner protecting the environment and its ecosystem balance (equilibrio ecosistémico), and for a ten-year period preceding the creation of the protected wildlife area in which the property is located, if applicable, or throughout the years of possession of the property. Such is the case here. Tramitado ante el Juzgado Agrario del Segundo Circuito Judicial de Alajuela, San Carlos.-* RESULTANDO:* * * * * * * * * * * * * 1.- La parte promovente interpuso el presente proceso de información posesoria para que por medio de esta vía se proceda a inscribir en el Registro Público de la Propiedad la finca que se describe así:* "...terreno de repasto, sito en [Dirección1] , , Los Chiles de la Provincia de Alajuela, con los siguientes linderos: AL NORTE: Bosque de la Garita Internacional Sociedad Anónima; AL SUR: [Nombre2] y [Nombre3] ; AL ESTE: [Dirección2] con frente a la misma de quinientos treinta y cinco metros con cero nueve centímetros lineales y AL OESTE: Bosque de la Garita Internacional Sociedad Anónima, MIDE: De acuerdo al Plano catastral aportado número A-1606725-2012 de fecha 25 de setiembre de 2012, una superficie de CIENTO OCHENTA Y DOS MIL TRESCIENTOS CUARENTA Y OCHO METROS CUADRADOS.* "* , (Ver Escritorio Virtual del Juzgado Agrario del Segundo Circuito de Alajuela, San Carlos, documentos asociados, de las catorce horas treinta y ocho minutos con cincuenta y dos segundos del veintiuno de marzo del dos mil trece, folio 14; Escritos, de las siete horas cuarenta y ocho minutos con cincuenta y cinco segundos del dieciocho de marzo del dos mil trece; de las seis horas uno minutos con seis segundos del nueve de julio del dos mil trece; y documentos asociados, de las siete horas cincuenta y cinco minutos con seis segundos del treinta de setiembre del dos mil quince, Expediente Digitalizado/Incorporar Documento Externo sin aso/ CAUSA PRINCIPAL,* Escrito Eelectronico/mar 18 2013 7:48AM/MANIFESTACION,* Escrito Eelectronico/jul 9 2013 6:01PM/APORTE PLANO A-1606725-2012,* Sentencia primera instancia (plantilla) (actualiza fase conclusiva)/EV=30/09/2015 08:00, respectivamente ). -* * * * * * * * * * * * * * 2.- La Procuraduría General de la República se apersonó al proceso en los términos visibles a folio s 40 al 46 ; a su vez el Instituto de Desarrollo Rural, s e apersonó al proceso en los términos visibles a folio 63, (Ver Escritorio Virtual del Juzgado Agrario del Segundo Circuito de Alajuela, San Carlos, documentos asociados, de las catorce horas treinta y ocho minutos con cincuenta y dos segundos del veintiuno de marzo del dos mil trece, Expediente Digitalizado/Incorporar Documento Externo sin aso/ CAUSA PRINCIPAL).-* * * * * * * * * * * * * 3.- La jueza Silvia Elena Sánchez Blanco , del Juzgado Agrario del Segundo Circuito Judicial de Alajuela, San Carlos , mediante la sentencia número 158-S-2015 de las siete horas cincuenta y cinco minutos del treinta de setiembre del dos mil quince , resolvió: “POR TANTO:* De conformidad con la LEY DE INFORMACIONES POSESORIAS número ciento treinta y nueve del catorce de julio de mil novecientos cuarenta y uno y sus reformas, se aprueban estas diligencias de INFORMACIÓN POSESORIA, en la cual han intervenido como partes la Procuraduría General de la República y el Instituto de Desarrollo Rural.
El terreno a titular quedará afectado por las reservas que indica la Ley General de Caminos Públicos, en cuanto a que el ancho mínimo de las carreteras es de veinte metros y de los caminos vecinales de catorce metros, por el rumbo [Dirección3], (Artículos diecinueve de la Ley de Informaciones Posesorias y cuatro de la Ley General de Caminos Públicos). Así como por lo dispuesto en el artículo treinta y tres inciso b) de la Ley Forestal vigente, un área de quince metros contiguo a las corrientes constituye área de protección y queda prohibida la corta o eliminación de árboles, si el terreno fuera plano y de cincuenta metros horizontales si el terreno fuera quebrado, y por lo tanto, queda sujeta a las restricciones legales que señala el artículo treinta y cuatro de la Ley supracitada por los rumbos [Dirección4] y [Dirección5]. El cauce y las aguas de las corrientes son de dominio público (Ley de Aguas, artículos uno, inciso IV, y tres, inciso III).
También las aguas superficiales y subterráneas existentes en el inmueble (pozos, nacientes, lagunas, etc.) son de dominio público y no forman parte de la finca. Proceda el REGISTRO PÚBLICO DE LA PROPIEDAD a inscribir libre de gravámenes, condueños, con las cargas reales ya señaladas, y sin perjuicio de terceros de mejor derecho, a nombre de [Nombre1] , mayor, casado una vez, agricultor, vecino de San Ramón de Alajuela, [Dirección6] de Correos de Costa Rica, cédula de identidad número CED5- - ; terreno de repasto, sito en el Porvenir, [Dirección7] , del cantón catorce Los Chiles de la Provincia de Alajuela, con los siguientes linderos: AL NORTE: Bosque de la Garita Internacional Sociedad Anónima; AL SUR: [Nombre2] y [Nombre3] ; AL ESTE: [Dirección2] con frente a la misma de quinientos treinta y cinco metros con cero nueve centímetros lineales y AL OESTE: Bosque de la Garita Internacional Sociedad Anónima, MIDE: De acuerdo al Plano catastral aportado número A-1606725-2012 de fecha 25 de setiembre de 2012, una superficie de CIENTO OCHENTA Y DOS MIL TRESCIENTOS CUARENTA Y OCHO METROS CUADRADOS.
El inmueble fue estimado en la suma de QUINCE MILLONES DE COLONES. Causa adquisitiva: posesión originaria, desde el diez de febrero del año mil novecientos setenta y dos. El terreno se encuentra fuera de áreas silvestres protegidas. Cuenta con naciente, quebrada y humedal no decretado.- Debe el promovente cumplir con las recomendaciones técnicas del Instituto Nacional de Innovación y Transferencia de Tecnología Agropecuaria, a saber, "...Mantener las áreas con cobertura boscosa natural de los sectores C y E. En vista de lo anterior el Juzgado Agrario del Segundo Circuito Judicial de Alajuela, San Carlos, dicta resolución de las diez horas cuatro minutos del nueve de octubre del dos mil quince , en la cual resuelve: “* El terreno a titular queda sujeto a las restricciones que contempla la Ley de Conservación de Vida Silvestre (artículos 98, 100 y 128), así como también quedan prohibidas todas las actividades orientadas a interrumpir los ciclos naturales de los ecosistemas del humedal, como la construcción de diques que eviten el flujo de aguas marinas o continentales, drenajes, desecamiento, relleno o cualquier otra alteración que provoque el deterioro y la eliminación de tales ecosistemas (artículo 45 de la Ley Orgánica del Ambiente No. 7554).", ( Ver Escritorio Virtual del Juzgado Agrario del Segundo Circuito Judicial de Alajuela, San Carlos, documentos asociados, de las diez horas cuatro minutos con cincuenta y seis segundos del nueve de octubre del dos mil quince, Plantilla, Gestiones Interlocutorias/ADICIONA SENTENCIA SOLICITADA POR PROCURADORA Y ADMITE APELACION /EV=09/10/2015 10:09 ). -* * * * * * * * * * * * * * 5* .- La licenciada Lydiana Rodríguez Paniagua, en su condición de procuradora adjunta, interpuso recurso de apelación con indicación expresa de las razones en que se fundamenta para refutar la tesis del juzgado de instancia, (Ver Escritorio Virtual del Juzgado Agrario del Segundo Circuito Judicial de Alajuela, San Carlos, escritos, de las diez horas cinco minutos con cuarenta y cuatro segundos del dos de octubre del dos mil quince, y de las diez horas siete minutos con cuarenta y un minutos del dos de octubre del dos mil quince, Incorporar Escrito - ESCRITO DE MANIFESTACION DE [Nombre4] documento - 02 Oct 2015 10:05AM, Incorporar Escrito - ESCRITO DE MANIFESTACION DE [Nombre4] documento - 02 Oct 2015 10:07AM, respectivamente).-* * * * * * * * * * * * * 6* .- En la substanciación del proceso no se ha observado las prescripciones legales, y se nota la existencia de errores u omisiones capaces de producir la nulidad del fallo.- * * * * * * * * * * * * * * Redacta la jueza Alvarado Paniagua, y;* * * * * * * * * * * * * CONSIDERANDO: *
I.Este Tribunal no prohija la relación de hechos tenidos por probados en el fallo recurrido dada la forma en que ha de resolverse este asunto.- *
II.La Procuradora Adjunta Lydiana Rodríguez Paniagua, apela la sentencia número 158-S-2015 dictada a las siete horas cincuenta y cinco minutos del treinta de setiembre del dos mil quince, al considerar entre otros argumentos, que desde el 15 de enero del 2015 esa representación se opuso a la aprobatoria de la información posesoria salvo que se aportara nuevo plano que excluyera el área del humedal en forma proporcional.- (ver escrito de apelación en imagen de fecha 2 octubre 2015).- *
III.Esta sentencia aprobatoria se ha dictado de manera anticipada por cuanto al realizarse el estudio de campo por parte del Sistema Nacional de Áreas de Conservación, se determinó la existencia de un área de 0.49 ha que corresponde a humedad, dicho estudio consta en informe visible a archivo del 09/01/15, 10:20:39 am. En dicha imagen del estudio se describe cartográficamente el área de humedal que debe ser protegido .- * Igualmente, se señala por parte del Instituto de Acueductos y Alcantarillados, UEN Gestión Ambiental en imagen 99, el estudio de fragilidad hídrica y se señala la importancia de conservar la naciente existente en el inmueble, por lo que ha de excluirse el radio de la misma. Por lo expuesto, y por haberse señalado en su oportunidad se hace necesario no solo se describa en el plano la existencia del humedal, sino también sus dimensiones correspondientes, es decir, debe quedar esa área bien delimitada en el plano catastrado A-1606725-2012, por lo que debe prevenirse la confección de un nuevo plano que excluyera el área de la naciente y describa la ubicación y dimensiones correspondientes respecto del humedal.
Dichos requisitos no fue completado por la parte promovente, por lo que debe observarse el estudio presentado por el Sistema Nacional de Áreas de Conservación, y el estudio de Acueductos y Alcantarillados sobre fragilidad hídrica. Se aprobó la titulación omitiéndose tales aspectos, por lo que deviene en anticipada la sentencia y la misma ha de anularse, debiendo cumplirse la presentación del plano catastrado que excluya la naciente indicada y describa la ubicación junto con las dimensiones correspondientes al humedal.- *
* * * * * * * * * * * * IV.- Voto Salvado de la Jueza Castro García.* La suscrita jueza respeta pero no comparte el voto que anula la resolución aprobatoria de este proceso de información posesoria, y que le previene al titulante excluya del plano base de este proceso el área de protección de naciente asi como la zona de humedal, al estimarse es de dominio público. Al respecto estima esta juzgadora de la revisión del proceso, la sentencia aprobatoria debe ser confirmada, pues el promovente demostró el cumplimiento de todos los requisitos de la Ley de Informaciones Posesorias y tipo de posesión sobre el terreno que ha usucapido y del cual pidió se le expida titulo inscribible. En primer orden, el fundo no se encuentra inmerso dentro de ninguna área silvestre protegida y demostró mediante prueba testimonial ha poseído el fundo por un periodo mayor a los treinta años, se observó en el reconocimiento judicial estar las áreas boscosas bien resguardadas y la zona de naciente con cobertura forestal en su área de protección.
Lo cual también fue ratificado por la prueba testimonial. Aunado a lo anterior, el estudio de suelos aportado consigna un uso conforme. No existe norma legal nacional o internacional, que declare el régimen de dominio público sobre humedales * ( a excepción del manglar que así en forma expresa lo califica la Ley de Zona Marítimo Terrestre). Dicho ecosistema, de alta importancia ambiental y con tutela reforzada por el bloque normativo ambiental, como cualquier ecosistema al estar inmerso en un bien inmueble, es susceptible de ser titulado como propiedad privada, y es deber legal de su poseedor, poseedora, dueño o dueña acogerse a los límites al derecho de propiedad privada que conlleva ser propietario o propietaria de un inmueble de naturaleza ambiental. La gestión de esos recursos de naturaleza ambienbtal* pueden ser desplegadas por los particulares y en comanejo y coordinación con los entes estatales en quienes descansa la competencia material de fiscalización y control.
Por ello, no se comparte la decisión de señalarle al promovente la zona de humedal en la finca sea excluida del plano y no considerada como parte de su propiedad. Al respecto ha resuelto este Tribunal citando un voto de la Sala Constitucional:* "* IV. Es importante mencionar, aunque no haya sido objeto de agravios por parte de la representante del Estado, que los humedales, son aquellas "extensiones de marismas, pantanos, turberas o aguas de régimen natural o artificial, permanentes o temporales, estancadas o corrientes dulces, salobres o saladas, incluyendo las extensiones de agua marina cuya profundidad en marea baja no exceda de seis metros". En este caso, no existen elementos probatorios que permitan concluir que éstos han sido afectado de alguna forma por parte del promovente mediante la interrupción de sus ciclos naturales como la construcción de diques, drenajes, desecamiento, relleno o cualquier otra alteración que provoque el deterioro y la eliminación de tales ecosistemas, conforme lo establecen los artículos 98, 100 y 128 de la Ley Orgánica del Ambiente, el artículo 70 inciso f) del Decreto Ejecutivo Nº 34433-MINAE del 11 de marzo de 2008, Reglamento a la Ley de Biodiversidad Nº 7788 de 30 de abril de 1998, así como el Decreto Ejecutivo 35803-MINAET denominado "Criterios técnicos para la identificación, clasificación y conservación de humedales".
Todo lo contrario, la instancia técnica identificada como Instituto Nacional de Innovación y Transferencia de Tecnología Agropecuaria, certificó que en este caso se ha dado al inmueble un uso conforme de acuerdo al tipo de suelos...... Retomando lo anterior, con relación al agravio expuesto por la representante del Estado, en el sentido de que no se logró verificar la posesión decenal, es importante señalar que por el contrario, los testigos cuyas declaraciones se recibieron en este proceso, indicaron que conocen el bien y les consta el ejercicio de la posesión sobre éste, desde muchos años antes de la fecha exigida por ley. Aunado a ello, este Tribunal no comparte los argumentos de la representante del Estado en el sentido de que el bien al contener bosque pasa a ser un bien de dominio público, puesto que el artículo 7 de la Ley de Informaciones Posesorias autoriza la titulación de inmuebles con bosque siempre que se cumplan los requisitos establecidos por esa norma, los cuales ya fueron citados con antelación y verificado su cumplimiento.
Nótese que la constitucionalidad e irretroactividad de esa norma fue avalada por la Sala Constitucional en voto [Telf1], el cual desafectó dicho bien al permitir su titulación.- V. Por lo expuesto, con fundamento en el voto de la Sala Constitucional [Telf1], así como los artículos 98, 100 y 128 de la Ley Orgánica del Ambiente, el artículo 70 inciso f) del Decreto Ejecutivo Nº 34433-MINAE del 11 de marzo de 2008, Reglamento a la Ley de Biodiversidad Nº 7788 de 30 de abril de 1998, Decreto Ejecutivo 35803-MINAET denominado "Criterios técnicos para la identificación, clasificación y conservación de humedales", 1, 2, 6, 7 y 11 de la Ley de Informaciones Posesorias y 6, 26, 54 y 79 de la Ley de Jurisdicción Agraria, deberá confirmarse la sentencia en lo que ha sido objeto de apelación, agregándose en esta instancia que se recomienda la reforestación de la propiedad con especies endémicas del país, tal y como se desprende de las certificaciones del Instituto Nacional de Innovación y Transferencia en Tecnología Agropecuaria (folios 61 y 96)."( Voto N.561-F-11).
Es posible titular bienes inmuebles con ecosistemas diversos , al ser así dispuesto por el numeral sétimo de la Ley de Informaciones Posesorias. II - Ahora bien con respecto a la naciente que se pide excluir del plano y su área de protección, y es causal de nulidad de la sentencia venida en alzada por el voto de mayoría, tampoco esta conforme esta juzgadora. La Ley de Aguas N. 276 establece en su artículo 31, cuando se esta ante el supuesto de reservar para dominio público en caso de nacientes y recursos hídricos los terrenos que circundan esos cuerpos de agua. Al respecto señala: " Se declaran como reserva de dominio a favor de la Nación: a) Las tierras que circunden los sitios de captación o tomas surtidoras de agua potable, en un perímetro no menor de doscientos metros de radio." (la negrita no corresponde a su original). * En el subjúdice, no se esta ante ese supuesto, pues la naciente ubicada en el terreno no se encuentra bajo sistema alguno de captación para surtir de agua a concesionario o población alguna, ni esta reservada para planes futuros.
Tal aspecto ha sido consignado por el ente que por Ley ejerce la competencia material sobre el tema, cual es el Instituto Costarricense de Acueductos y Alcantarillados que indicó en el informe que costa en autos: " Se indica que no hay registro de captaciones en dicha propiedad o en sus alrededores.. Se consultó al Departamento de Aguas MINAET y en nota DA-3249-21010 con fecha 17/09/2010 se indica no existen concesiones registradas de aprovechamiento de aguas para uso poblacional .. De acuerdo al análisis que hemos realizado en nuestro sistema de información, sobre los aprovechamiento de agua para abastecimiento a poblaciones, en la propiedad que se señala en el expediente N. EXPN1- no existe ningún aprovechamiento en la actualidad, ni forma parte de futuros planes para tal fin. ... en la propiedad hay una naciente que da origen a un cuerpo de agua. Esta naciente no esta captada para abastecimiento a acueducto alguno." No existe norma alguna que decrete que toda naciente o río y su área de protección es dominio publico, solo las que han sido objeto de captación o están reservadas a futuro por el Estado, según el numeral 31 citado.
No así el recurso hídrico y los lechos de ríos que contienen el cauce, las aguas superficiales y subterráneas cuya naturaleza es demanial por imperativo legal (Ley de Aguas y Ley de MInería). La obligación de las personas dueñas o poseedoras de terrenos que contengan estos cuerpos de agua no captados en los términos citados supra, según el artículo 33 de la Ley Forestal es conservar y gestionar en forma adecuada las áreas de protección legalmente establecidas, son las denominadas limitaciones a la propiedad privada que desarrolla la doctrina constitucional del derecho de propiedad privada y evitar toda actividad que le genere contaminación. En criterio de esta juzgadora, la razón por la que debe autorizarse la emisión de un titulo inscribible para la persona promoventes en este caso particular, es que con la entrada en vigencia de la reforma al artículo 7 de la Ley de Informaciones Posesorias, establecido en la Ley Forestal N. 7575 del año 1996, se autorizó a las y los particulares a titular y poseer bienes que contengan bosques, ecosistemas de esa naturaleza o recursos naturales, independientemente de las especies forestales que en ellos estén contenidas.
Lo anterior, siempre y cuando se demuestre que se ejerció una posesión en resguardo del ambiente y su equilibrio ecosistémico y en un periodo decenal anterior a la creación del área silvestre protegida en la cual esta el fundo inmerso, si fuera el caso o bien en los años de posesión que se tenga sobre el fundo. Tal es el caso en estudio.
