Appeal (recurso de apelación) filed in these proceedings against [Nombre1], of legal age, married, born on July twelfth, nineteen sixty-eight, holder of CED1; and [Nombre2], of legal age, married, born on September twenty-ninth, nineteen seventy-two, holder of identity card number CED2, for the offense of Violation of the Ley Forestal, to the detriment of Natural Resources. Judges [Nombre3], Gustavo Chan Mora, and [Nombre4] participated in deciding the appeal. Attorney [Nombre5] appeared in the appellate proceedings in his capacity as Criminal State Attorney (Procurador Penal).
Findings:
1. By judgment number 323-2015, issued at two ten p.m. on June second, two thousand fifteen, the Tribunal del Primer Circuito Judicial de la Zona Atlántica ruled: "POR TANTO: In accordance with the foregoing and Articles 30, 31, 33, 34, 311, and 312 of the Code of Criminal Procedure (Código Procesal Penal), a final dismissal (sobreseimiento definitivo) is hereby entered due to extinguishment of the criminal prosecution (extinción de la acción penal) in favor of [Nombre6] and [Nombre2] for the offense of VIOLATION OF THE LEY FORESTAL with which they had been charged to the detriment of NATURAL RESOURCES. Procedural costs shall be borne by the State. NOTICE SHALL BE GIVEN. [Nombre7] - DECIDING JUDGE." (sic)
2. Attorney [Nombre5] filed an appeal against the foregoing ruling.
3. After the corresponding deliberation was conducted in accordance with Article 466 of the Code of Criminal Procedure, as amended by Ley 8837, published on December ninth, two thousand eleven (Creation of the Appeal from a Judgment), the Court considered the issues raised in the appeal.
4. The applicable legal requirements have been observed throughout the proceedings.

Considerando:
I.By a written submission, attorney [Nombre5], in his capacity as Criminal State Attorney and on behalf of the Costa Rican State, appeals final dismissal judgment number 323-2015, issued at two ten p.m. on June second, two thousand fifteen, by the Tribunal de Juicio del Primer Circuito Judicial de la Zona Atlántica, which dismissed the case against defendants (encartados) [Nombre1] and [Nombre2] due to extinguishment of the criminal prosecution. Under the principles of informality, breadth, accessibility, and flexibility governing appeals from criminal judgments, the present challenge (impugnación) is deemed to satisfy the basic minimum requirements necessary for the Court to hear and decide the objections raised by the appellant as part of the comprehensive review of the challenged judgment, as established by Article 8.2(h) of the American Convention on Human Rights and Articles 458, 459, 460, and 462 of the Code of Criminal Procedure. The appellant states his objections as follows.
II—SOLE GROUND: Violation of due process (debido proceso) through approval of an alternative measure (medida alterna) during the trial phase without the consent of the victim—the State. The appellant contends that the rights of the Procuraduría General de la República were violated because that institution formally appeared as the victim from the outset and likewise provided an address for service of notices. From that point forward, it enjoyed all rights afforded under the rules of criminal procedure, one of which was the right to grant or withhold consent to the application of any alternative measure. He states that its participation in the proceedings was active, since page 29 shows that it filed motions opposing the return of chainsaws and requesting photocopies. Even when the preliminary hearing (audiencia preliminar) was scheduled, his client requested the preparation of reports so that any potential alternative measure could later be assessed on the basis of reliable information.
He adds that the Tribunal de Juicio de la Zona Atlántica scheduled an oral trial for May fifteenth, two thousand fifteen. On that date, the parties informed the Judge that they had agreed upon an alternative measure, specifically suspension of the proceedings subject to probation (suspensión del proceso a prueba), and presented its conditions, which the Judge approved without informing or notifying his client by any means. As the victim, his client had decision-making authority on that occasion, and the environmental interest was never vindicated because of the manner in which the agreement was approved. He contends that the Ministerio Público assumed powers that did not belong to it without obtaining the consent of the Procuraduría General de la República. He further contends that the procedural stage at which this occurred was improper, because it should have occurred before the trial and not on the very date set for the trial.
He cites decision number 2013010285 of the Sala Constitucional de la Corte Suprema de Justicia regarding the victim’s right to accept or reject an alternative measure. As grounds for prejudice, he alleges a violation of due process because a final dismissal was entered during the trial stage, when it could not legally have been entered, but, more seriously, it was entered without the participation of the victim—the State, whose status was disregarded by the court. He requests that the appeal be granted, that the final dismissal judgment be vacated, and that the case be remanded (reenvío) for an oral and public trial. The claim is granted. As can be seen from the appeal filed, it is based on the argument that a party to the criminal proceedings who had duly entered an appearance in the case was left without a defense (indefensión); specifically, in this case, the Procuraduría Penal de la República, which participated from the outset as the victim—the State, because the legal interest protected (bien jurídico tutelado) in these proceedings is natural resources and, consequently, the potentially criminal conduct of both defendants involved environmental damage.
The Criminal State Attorney is correct. Although he had appeared from the beginning of the proceedings, participated as the victim, provided an address for service of notices, and remained attentive to judicial summonses, he was never informed that in two thousand thirteen, when the case was scheduled for trial, the defendants had reached an agreement with the Fiscalía to submit to the alternative measure of suspension of the proceedings subject to probation. In other words, a review of the record shows that, on that occasion, the State Attorney stated in a detailed written submission (see electronic case file) that he would not attend the preliminary hearing but requested that the Juzgado Penal commit the case for trial (elevación a juicio) before the trial court. Nowhere in that document did he state that he agreed with any alternative measure. If such a measure were adopted—as indeed it was—he should have been notified because the legal interest protected in this case is natural resources, which by their very nature are protected by the State, and the State had duly entered an appearance and remained attentive to the proceedings.
On the day of trial, as reflected in the record, the Fiscalía reached an agreement with the defendants without considering the victim’s position. The State Attorney challenges that agreement because he was never informed of it and because, in general, it had nothing to do with compensation for the environmental damage. Worse still, according to the documents in the digital case file, the defendants never complied with the obligations they undertook, and the Fiscalía failed to take the measures incumbent upon it to prevent that noncompliance. This clearly left the case without adequate representation, particularly because the Procuraduría General de la República was not treated as a party even though it had duly entered an appearance for all purposes. As the appellant correctly notes, under Article 25 of the Code of Criminal Procedure, it had to be informed of any agreement or reparation plan (plan reparador) before approval, since the victim’s consent to such an agreement is a sine qua non requirement.
That requirement was violated by the lower court, rendering its actions defective because they contained errors that impaired due process for the parties—in this case, the victim, who never obtained redress for the damage it reported. The rights of victims under our current criminal procedure system are unquestionable and cannot be disregarded as they were in this case, particularly because an agreement or arrangement was reached without the participation of the victim—the State, which had a direct interest in determining whether the terms of the agreement were related to the offense under investigation and to compensation for the environmental damage allegedly caused by both accused persons. All of this was disregarded in this case by the Tribunal de Juicio and the Ministerio Público, which could never assume the authority of the Procuraduría to enter into agreements falling directly within the victim’s authority—in this case, the State, which had duly appeared through the Criminal State Attorney.
Based on the foregoing, the appeal filed by attorney [Nombre5] on behalf of the Costa Rican State is granted, the dismissal judgment is vacated, and the case is remanded for a new adjudication that takes into account the participation of the criminal division of the Procuraduría General de la República, which has at all times entered an appearance in the proceedings.

Recurso de apelación interpuesto en la presente causa seguida contra [Nombre1] , mayor, casado, nacido el doce de julio de mil novecientos sesenta y ocho, con CED1 ; y [Nombre2] mayor, casado, nacido el veintinueve de setiembre de mil novecientos setenta y dos, con cédula de identidad número CED2 , por el delito de Infracción a la Ley Forestal, en perjuicio de Los Recursos Naturales. Intervienen en la decisión del recurso los jueces [Nombre3] , Gustavo Chan Mora y [Nombre4] . Se apersonó en apelación el licenciado [Nombre5] en calidad de Procurador Penal.
Resultando:
1. Que mediante sentencia número 323-2015 de las catorce horas diez minutos del dos de junio del año dos mil quince, el Tribunal del Primer Circuito Judicial de la Zona Atlántica, resolvió: "POR TANTO: De conformidad con lo expuesto,artículos 30, 31, 33, 34, 311, 312 del Código Procesal Penal, se dicta sobreseimiento definitivo por extinción de la acción penal, a favor de [Nombre6] y [Nombre2] por el delito de INFRACCIÓN A LA LEY FORESTAL que en perjuicio de LOS RECURSOS NATURALES se les venía atribuyendo. Son las costas procesales a cargo del Estado. NOTIFÍQUESE. [Nombre7] - JUEZ/A DECISOR/A." (sic)
2. Que contra el anterior pronunciamiento, el licenciado [Nombre5] interpuso el recurso de apelación.
3. Que verificada la deliberación respectiva de conformidad con lo dispuesto por el artículo 466 del Código Procesal Penal, reformado por Ley 8837 publicada el nueve de diciembre de dos mil once (Creación de Recurso de Apelación de la Sentencia), el Tribunal se planteó las cuestiones formuladas en el recurso.
4. Que en los procedimientos se han observado las prescripciones legales pertinentes.
Redacta el Juez [Nombre8] , y;
Considerando:
I.Mediante escrito del licenciado [Nombre5] , en su condición de Procurador Penal, en representación del Estado Costarricense, presenta recurso de apelación en contra de la sentencia de sobreseimiento definitivo número 323-2015 de las catorce horas diez minutos del dos de junio de dos mil quince, del Tribunal de Juicio del Primer Circuito Judicial de la Zona Atlántica; fallo que sobreseyó a los encartados [Nombre1] y [Nombre2] por extinción de la acción penal. En virtud de la aplicación de los principios de informalidad, amplitud, accesibilidad y flexibilidad propios del recurso de apelación de sentencia penal, se estima que la impugnación de marras reúne los presupuestos básicos y mínimos que se requieren para que la misma posibilite el conocimiento y decisión de los reparos planteados por el recurrente en orden al examen integral de la sentencia impugnada, tal y como lo establece el artículo 8.2h de la Convención Americana sobre Derechos Humanos, y los artículos 458, 459, 460 y 462 del Código Procesal Penal, cuyas inconformidades expone de la siguiente forma.
II-ÚNICO MOTIVO: Violación al debido proceso al homologarse una medida alterna en fase de juicio sin el consentimiento de la víctima- Estado. Considera el apelante que se han violado los derechos de la Procuraduría General de la República, pues tal ente, se apersonó desde el inicio formalmente como víctima y de igual forma señaló para recibir notificaciones, siendo que desde ese momento gozaba de todos los derechos previstos en la normativa procesal penal, uno de los cuales, es dar o no su consentimiento en relación a la aplicación de cualquier medida alterna. Señala que su participación en el proceso ha sido activa pues al folio 29 consta que sus gestiones se han presentado para no devolución de motosierras, solicitando fotocopias, incluso para el señalamiento de la audiencia preliminar, de parte de su representada se solicitó la realización de informes para valorar en su momento, una eventual medida alterna con información de calidad.
Agrega que el Tribunal de Juicio de la Zona Atlántica señaló para la celebración de juicio oral y en tal fecha que fue el quince de mayo de dos mil quince, las partes le informaron al Juzgador que habían llegado a una medida alterna, propiamente la suspensión del proceso a prueba, exponiendo las condiciones, lo cual fue homologado por el Juez, sin informar o notificar por algún medio a su representada, la cual como víctima tenía poder de decisión en tal ocasión, siendo que el interés ambiental nunca fue satisfecho por la forma en que se homologó el pacto. Considera que el Ministerio Público se arrogó facultades que no le competen sin tener la anuencia de la Procuraduría General de la República. Considera que el momento procesal también en el cual se efectuó es invalido pues lo correcto era antes del debate y no en la propia fecha de la realización del mismo. Cita la resolución número 2013010285 de la Sala Constitucional de la Corte Suprema de Justicia, con relación al derecho de la víctima para aceptar o rechazar una medida alterna.
Como agravio señala una lesión al debido proceso, pues se dictó un sobreseimiento definitivo en etapa de juicio, sin que legalmente se pudiera hacer en ese momento, pero lo más grave es que se dio sin participación de la Víctima- Estado, condición que fue ignorada por el órgano jurisdiccional. Solicita se declare con lugar el recurso, se anule la sentencia de sobreseimiento definitivo y se ordene un reenvió para la celebración del juicio oral y público. Con lugar el reclamo. Como se observa del recurso incoado, el mismo se basa en el argumento de la indefensión a que fue sometida una parte del proceso penal debidamente apersonada a los autos, es decir, específicamente en este caso, la Procuraduría Penal de la República, la cual se constituyó desde el inicio del proceso como víctima- Estado, al ser el bien jurídico tutelado en autos, los recursos naturales y por ende, mediar un daño ambiental en la posible conducta delictiva de ambos imputados.
Lleva razón el Procurador penal, pues al haberse apersonado desde el principio del proceso y haberse constituido como víctima, señalar lugar para notificaciones y estar atento al llamamiento judicial, nunca se le informó de que los imputados en el año dos mil trece, cuando se señaló para debate, habían llegado a un acuerdo con la Fiscalía de someterse a una medida alternativa de suspensión del proceso a prueba. Es decir, si se observan los autos, el Procurador en dicha oportunidad manifestó ( ver expediente electrónico) mediante sendo escrito que no se iba a presentar a la audiencia preliminar pero que solicitaba al Juzgado Penal proceder con la elevación a juicio para ante el Tribunal sentenciador, es decir, no impuso por ningún extremo del documento que estaba de acuerdo con alguna medida alternativa, la cual de darse, - como en efecto se dio- debía de habérsele puesto en conocimiento, pues el bien jurídico tutelado en la especie son los recursos naturales que por antonomasia son protegidos por el Estado y el mismo estaba debidamente apersonado y atento al proceso.
El día del debate, según consta en autos, la Fiscalía, sin tomar en cuenta la posición de la víctima, llegó a un acuerdo con los encartados, mismo que el Procurador critica, pues nunca se le informó y en general no tiene dicho pacto, nada que ver con el resarcimiento al daño ambiental, y lo peor del caso es que de acuerdo a los documentos que obran en el expediente digital, nunca los imputados cumplieron los acuerdos a que se comprometieron y la Fiscalía no hizo lo de su cargo para evitar que se diera tal incumplimiento, dejando en forma clara la causa en un estado de indefensión, sobre todo al no tenerse como parte a la Procuraduría General de la República, la cual estaba debidamente apersonada para todos los efectos y, como bien señala el recurrente, de acuerdo al artículo 25 del Código Procesal Penal, tenia que ser informada de cualquier acuerdo o plan reparador previo a cualquier homologación, pues la conformidad de la víctima en un acuerdo de estos, es un requisito sine qua non, lo cual fue violentado por la autoridad jurisdiccional recurrida, convirtiendo sus actuaciones en defectuosas por contener vicios que alteran el debido proceso para las partes, en este caso la víctima, la cual nunca encontró reparación al daño por ella denunciado.
Los derechos de las víctimas en nuestro sistema procesal penal actual, son incuestionables y no pueden ser soslayados de la forma en que se hizo en este caso, máxime que se hizo un acuerdo o pacto, sin la participación de la víctima- Estado, directamente interesada en verificar si los acuerdos tenían relación o no, con el delito investigado y el resarcimiento al daño ambiental aparentemente causado por ambos endilgados. Todo esto en esta causa se ignoró de parte del Tribunal de Juicio y del Ministerio Público, el cual nunca podría arrogarse la competencia de la Procuraduría para proceder a llegar a acuerdos que le competen directamente a la Víctima, en este caso el Estado debidamente apersonado por el Procurador Penal. Por lo expuesto, se declara con lugar el recurso incoado por el licenciado [Nombre5] , en representación del Estado Costarricense, se anula la sentencia de sobreseimiento dictada, se ordena el juicio de reenvió para una nueva sustanciación tomando en cuenta la participación de la Procuraduría General de la República en su área penal, la cual siempre ha estado apersonada a los autos.
