WHEREAS

I.By order issued at 15:08 hours on 29 July 2015 (f. 170), the Agrarian Court of the Second Judicial Circuit of the Atlantic Zone referred the case file to this Court by virtue of the objection for lack of jurisdiction raised by the Office of the Attorney General of the Republic. In that defense (f.120), it states that the First Chamber of the Supreme Court of Justice has recently issued decisions holding that cases involving the public domain and, specifically, the State Natural Heritage fall within the jurisdiction of the Administrative Litigation courts. Its filing partially quotes decision N.959-F-SI-2013 of 9:25 hours on 1 August 2013, which annulled the judgments of the Agrarian Court and the court of first instance because the disputed property was located within the Barra del Colorado National Wildlife Refuge, finding that because property subject to the public domain was involved, the competent jurisdiction was Administrative Litigation.

It also mentions decisions of that High Court numbered: 123-C-91-S1-2010 of 08:40 hours on 28 January 2010, 239-C-S1-2010 of 10:8 hours on 18 February 2010, 350-F-S1-2012 of 09:45 hours on 14 March 2012, and 253-C-S1-2013 of 11:25 hours on 28 February 2013. The State Attorney’s Office adds that, in this case, the subject of the dispute concerning a private individual’s possessory rights is likewise land located within the Barra del Colorado National Wildlife Refuge referred to in the cited judgment. Accordingly, it states, it requests that the Court hear its defense and rule pursuant to article 16(b) of the Agrarian Jurisdiction Act.

II- In the case at bar, the plaintiff brings an ordinary action against the Instituto de Desarrollo Rural, stating that since 2001 he has exercised possession over a portion of the property registered under folio [Placa1] in the province of Heredia. On 28 March 2008, the defendant entity prepared an official letter requesting that the Ministry of Public Security evict those whom it characterized as illegal occupants. INDER officials appeared at the property in June 2008 without the police and told those in situations similar to his that they had to vacate the land because it was unsuitable for agriculture and substantial investment would be required before it could be allotted. Nevertheless, those persons were observed to be engaged in properly managed production, and he told them that he could not leave and that, at the very least, they should reimburse him for the amounts invested over so many years.

Subsequently, on 28 February 2012, they again requested the eviction. In the complaint, he identifies the property’s registered owners and states that in December 2001 the land was conveyed by public deed to the then IDA. He describes how he entered the land together with other families and with his own family because he lacked work and means of subsistence. He lists the work he performed to make the property productive. He states that they have been subjected to three eviction proceedings that have neither been carried out nor afforded due process. He asserts that officials from that entity had previously visited them and told them that they had to leave, without showing any documentation. He alleges that the only document shown on the day they arrived with the police had been issued 4 years earlier, after which they proceeded to destroy shacks. He states that he has exercised possession for more than ten years in compliance with the conditions required by law and has never resorted to force or violence.

As the principal relief sought in his action, he requests that acquisitive prescription over the land be declared in his favor and that its registration in his name be ordered, clarifying that he seeks a declaration of special agrarian acquisitive prescription based on his use of the land due to his need for a means of meeting his own needs and those of his family. In its answer to the complaint (f. 35), INDER acknowledges that the property is registered in its name and reports that it is located within the protected area of the Barra del Colorado National Wildlife Refuge, created in June 1985 by decree [Nombre1]. 16358-MAG. In its answer, the defendant entity argues that the plaintiff knows who the former registered owners were and that his possession ceased to be peaceful, continuous, and in good faith. It adds that his possession is not even recognized under article 92 of the Land and Colonization Act and that, moreover, he acknowledges that evictions were carried out in that settlement, which establishes his bad faith.

It states that the land is located within a Protected Zone, which makes it public-domain property with all the attributes of public ownership, and that it has been subject to that protection since 1985. It argues that decision N.4587-97 states that protection is afforded only to an actual occupant in good faith who demonstrates possession for 10 years before the protected area was created. Furthermore, INDER is subject to article 15 of the Ley Forestal when its lands are classified as suitable for forestry. In its answer to the complaint, the entity objects that the plaintiff fails to satisfy the requirements of ordinary acquisitive prescription and special agrarian acquisitive prescription because he has not received the legal privilege of a Declaration of Precarious Occupancy in his favor, and thus the defect of bad faith continues. It contends that various evictions have occurred on the land and that persistent occupancy is insufficient for acquisitive prescription.

It reiterates that the only possession that would qualify is that described in the cited decision of the Constitutional Chamber, referring to possession exercised for ten years before the protected area was created, which occurred in June 1985. Regarding administrative evictions, it invokes article 455 of the Code of Civil Procedure, which permits them as a prerogative of the registered owner, and argues that, with respect to illegal invasions, the Ministry of Public Security is not required to afford due process when public-domain property is involved, in accordance with Constitutional Chamber decision N. 5916-94. It states that, in this case, INDER has made no allotment in favor of the plaintiff and that the General Public Administration Act requires compliance with due process only when subjective rights are affected, pursuant to article 214. It therefore rejects the allegations that the plaintiff’s right to due process was violated because he has no recognized subjective right.

It characterizes the claimant’s occupancy as clandestine, violent, interrupted, and in bad faith. It denies the plaintiff’s right to acquire title by prescription under the Public-Domain Doctrine and because he has failed to satisfy the requirements of article 853 of the Civil Code. Because joinder of the State as a party was ordered, the State Attorney’s Office answered the complaint, basing its defense on the position that private possession of lands belonging to the State Natural Heritage is impermissible because such lands are subject to the public domain, even when the disputed land is registered in INDER’s name. (f.139). In support of its defense of lack of entitlement, it states that the property forms part of a property registered in INDER’s name and is located within a protected wilderness area that is part of the State Natural Heritage, pursuant to article 13 of the Ley Forestal and articles 32 and 38 of the Organic Environmental Act. Furthermore, the cultivation activities described by the plaintiff instead constitute environmental damage.

III- The action being heard in these proceedings is one for acquisitive prescription (prescripción) over part of a property registered in the name of the Instituto de Desarrollo Rural. In addition, the registered property is located within a protected wildlife area (área silvestre protegida), under the National Refuge management category, known as Refugio Nacional de Vida Silvestre Barra del Colorado. It should be noted that, although the Sala Primera has issued a series of decisions holding that the matters debated in those particular cases fell within the jurisdiction of the Administrative Litigation Courts (jurisdicción Contenciosa Administrativa), this must be analyzed in each case in light of its own particular circumstances. When a final judgment is issued in these proceedings, consideration must be given to the provisions of Articles 13 and 14 of the Ley Forestal regarding the concept of the State’s Natural Heritage (Patrimonio Natural del Estado), as well as to the rights asserted by the plaintiff, which is a matter going to the merits.

Nevertheless, for purposes of determining subject-matter jurisdiction (competencia material), it is also important to mention various legal provisions that grant the Agrarian Courts jurisdiction to hear cases such as this one. In the case under consideration, reference should be made to the ruling issued in decision 985-F-14 of this Court: “The new Ley de Transformación del Instituto de Desarrollo Agrario en Instituto de Desarrollo Rural (INDER), No. 9036 of 11 May 2012, in Article 16 concerning the powers and authority of INDER, provides in subsection q): ‘INDER shall endeavor to resolve problems arising from the occupation of national reserves and from the precarious possession (ocupación en precario) of privately owned land. INDER is empowered, when appropriate, to redistribute and reorganize areas that are the subject of conflict.’ This is so because Article 80 of that same Law, in Title III concerning Final and Transitional Provisions, specifically stated: ‘Ley No. 2825, Ley de Tierras y Colonización of 14 October 1961, shall remain in force insofar as it does not conflict with this Law.

In the event of doubt between the two, the principles of Ley No. 2825 shall prevail. Chapter VI of Ley No. 2825, Regulación de Conflictos entre Propietarios y Poseedores en Precario, and its related regulations shall expressly remain in force in all respects.’ In that regard, the Ley de Tierras y Colonización itself, in the chapter” [establishes] the procedure instituted in Article 94 of the Ley de Tierras y Colonización, which provides: “ARTICLE 94.- The resolution of disputes arising from the precarious possession of land (posesión precaria de tierras) shall be sought primarily through direct purchase-and-sale agreements between the owner and the occupants, with the intervention of the Instituto, and in the manner indicated in the following articles. Before filing any judicial action that may involve an issue of precarious possession of land, owners must submit their claim to the Instituto in accordance with the procedures referred to in this Chapter.

If three months have elapsed from receipt of the respective application without the Instituto having declared the existence of a land-possession dispute, or one year has elapsed from such declaration without the dispute having been resolved, the administrative procedure shall be deemed exhausted, and the claimants may apply to the Courts. Notwithstanding the foregoing, any interested party may request that the Judge or Alcalde of the jurisdiction in which the property is located conduct an on-site inspection (inspección ocular), upon notice to the parties, to verify any facts or indications that might change or disappear over time. While the matter is pending before the Instituto, the prescription period shall not run for any party. Once the dispute has been resolved by the Instituto with the owner’s consent, or expropriation has been ordered by the Executive Branch, the owner shall have no judicial action, whether civil or criminal, against the possessors in their capacity as such.

Otherwise, the occupants shall be subject to any generally applicable legal penalties that may be warranted. Filings submitted by the parties to the Instituto in proceedings for the resolution of disputes concerning the precarious possession of land and other matters related to agrarian issues shall be exempt from authentication and from the use of revenue stamps. (Emphasis added). From the foregoing provision, we may draw the following elements relevant to the determination of this matter:

  • 1)Before filing any judicial action, property owners or occupants experiencing issues of precarious possession must exhaust the agrarian administrative procedure established in the Ley de Tierras;
  • 2)the Instituto de Desarrollo Agrario, now Instituto de Desarrollo Rural (INDER), has three months to declare whether or not the dispute exists;
  • 3)once the dispute has been declared, the Instituto has one additional year in which to intervene and seek a peaceful resolution, either through the direct purchase of the property or through expropriation. Consequently, there are two ways to exhaust administrative remedies (agotar la vía administrativa): the first occurs through the Instituto’s administrative silence (silencio administrativo); the second occurs one year after the existence of the dispute has been declared, because that is the period the agrarian legislature granted the Agency to attempt to resolve the dispute. In the latter case, the legislature’s purpose was clearly to leave judicial recourse available—that is, to give the owner or possessors the opportunity to defend their rights in court. Likewise, interpretation of the provision leads to the conclusion that any owner who considers himself disturbed, threatened, or harmed by the Instituto’s administrative action, where no administrative resolution has been reached within the year through purchase and sale or expropriation, may seek the appropriate judicial remedy to claim compensation from the State itself.” From this quotation and the matters debated in this case, and although the Sala Primera has on various occasions adopted the institutional criterion (criterio organicista) for assigning jurisdiction over administrative litigation matters, it is apparent that the dispute presented here pertains to the very essence of Agrarian Law. This is because the claim concerns property registered in the name of INDER over which special agrarian adverse possession (usucapión especial agraria) is alleged to have occurred through cultivation undertaken to meet the needs of the plaintiff and his family unit. This allegation is denied by those appearing as defendants. It should be noted that no review or annulment of any administrative act of INDER or the Ministerio de Seguridad Pública is being sought, and the mere involvement of State entities is insufficient to establish that a matter must be decided through administrative litigation proceedings. Rather, the subject matter and cause of action of the proceedings must be examined. What is being challenged is not INDER’s conduct in its capacity as an autonomous entity, but its position as the registered owner of land over which the plaintiff alleges special agrarian adverse possession.

IV- Regarding the public-domain status (demanialidad) of all lands forming part of the State’s Natural Heritage (Patrimonio Natural del Estado). On this issue, Articles 13, 14, and 15 of the Ley Forestal, which define the State’s Natural Heritage and its effects on the decision ultimately rendered on the merits, must be borne in mind. In addition, it will also be necessary to consider the provisions of Article 58 of the Ley de Biodiversidad, which defines the concept of a protected wildlife area (área silvestre protegida) as a form of management, consistent with the management category (categoría de manejo), of ecological systems located within the land areas of the national territory, and which reads: “ARTICLE 58.- Protected wildlife areas Protected wildlife areas are geographically delimited zones consisting of land, wetlands, and portions of the sea. They have been declared as such because they are of special significance due to their ecosystems, the existence of threatened species, their importance for reproduction and other needs, and their historical and cultural significance.

These areas shall be dedicated to conserving and protecting biodiversity, soil, water resources, cultural resources, and ecosystem services in general. The objectives, classification, requirements, and mechanisms for establishing or reducing these areas are set forth in the Ley Orgánica del Ambiente, No. 7554, of 4 de octubre de 1995. The prohibitions affecting natural and legal persons within national parks and biological reserves are set forth in the Ley de la Creación del Servicio de Parques Nacionales, No. 6084, of 24 de agosto de 1977. During the process of satisfying the requirements for establishing state protected wildlife areas, the respective technical reports shall include the relevant recommendations and justifications for determining the most appropriate management category to which the proposed area should be subject. In all cases, the establishment of areas and categories shall give careful consideration to rights previously acquired by Indigenous or farming populations and other natural or legal persons located within or adjacent to the area.” (boldface does not appear in the original).

Furthermore, Article 60 of that law provides: “ARTICLE 60.- Ownership of protected wildlife areas Protected wildlife areas, in addition to those owned by the State, may be municipal, mixed, or privately owned. Given their great importance in ensuring the conservation and sustainable use of the country’s biodiversity, the Ministry of Environment and Energy and all public entities shall encourage their creation and shall also oversee and assist in their management.” It is also appropriate to note the amendment that this same statute introduced to the third paragraph of Article 37 of the Ley Orgánica del Ambiente, so that it reads: “c) Article 37.- Powers of the Executive Branch Privately owned properties affected pursuant to this Article because they are located within national parks, biological reserves, wildlife refuges, forest reserves, or protective zones shall become part of state protected areas only once they have been paid for or lawfully expropriated, except when they are voluntarily placed under the Forestry Regime (Régimen Forestal).

In the case of forest reserves, protective zones, and wildlife refuges, when payment or expropriation has not occurred, and until it does occur, the areas shall be subject to an environmental land-use plan (plan de ordenamiento ambiental) that includes an environmental impact assessment (evaluación de impacto ambiental) and, subsequently, to a plan for the management, recovery, and replacement of resources.” The arguments of the state entity—that merely because the registered property belonging to that entity forms part of the Refugio Nacional de Vida Silvestre Barra del Colorado and is in the public domain, the matter must be heard within the contentious-administrative jurisdiction—are unpersuasive. Nothing prevents this proceeding from being adjudicated within the agrarian jurisdiction. Moreover, as stated above, within protected wildlife areas, with the exception of biological reserves and national parks given the absolute conservation purposes and objectives of those management categories, public and private properties may coexist in the other categories, and their owners may be public entities or private persons subject to each protected wildlife area’s land-use plan and to the restrictions and limitations entailed by ownership of a property of this nature.

To hold otherwise would entail an entirely state-centered view of environmental management, eliminating the entire modern approach of environmental co-management with civil society. The social effects of such an approach do not support the survival of ecosystems in practice, given the limited capacity of the State and its institutions to directly manage, monitor, and safeguard environmental resources. This is a function that civil society must perform in its capacity as owners of properties subject to the Forestry Regime or to environmental restrictions. It would also have the practical effect of imposing on the State a duty to compensate all owners of private properties located in every area managed under a declared management category, including those who exercise possession in a manner that respects the ecosystems’ regenerative capacity and voluntarily submit to the Forestry Regime. In this Court’s view, such compensation is justified only within the management categories of national parks and biological reserves because the objectives and criteria of these categories are the most restrictive.

Regarding the conversion of forested lands into public-domain property (demanialización de terrenos boscosos), this Court finds that, in this case, it is an issue that must be resolved in the judgment on the merits. Nevertheless, it should be noted in this regard that the Ley de Informaciones Posesorias permits title to be obtained over forested lands located within or outside protected wildlife areas, provided that the statutory requirements are satisfied, in accordance with Article 7 of the Ley de Informaciones Posesorias, as amended by the current Ley Forestal; Article 92 of the Ley de Tierras y Colonización likewise so provides. Furthermore, the Ley Forestal regulates the conservation, protection, management, and use of forest resources under technical and legal criteria that ensure their perpetuity. See in this regard the body of provisions concerning private forest property beginning with Article 19.

The State’s right to intervene to protect environmental interests that it considers may be harmed in the case under review is already safeguarded by the participation of the Procuraduría General de la República as a party to the dispute. For these reasons, the objection for lack of jurisdiction (excepción de incompetencia) filed by the Procuraduría General de la República is denied.

IV- In view of the foregoing reasons; Articles 1 and 2 of the Ley de Jurisdicción Agraria, 58 and 60 of the Ley de Biodiversidad, and 37 of the Ley Forestal; because the action concerns a declaration of special agrarian acquisitive prescription (usucapión especial agraria) in favor of a private individual over part of a property registered in the name of INDER; and because the revocation or invalidity of administrative acts has not been alleged, it is declared that this matter falls within the subject-matter jurisdiction of the agrarian courts. The objection for lack of jurisdiction raised must be denied. Once this decision becomes final, this case file shall be remanded to the court of origin for the proceedings to continue.

INSTITUTO DE DESARROLLO AGRARIO VOTO [Nombre1]° 966-C-15 TRIBUNAL AGRARIO. SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ.- A las nueve horas y treinta y uno minutos del veinticinco de setiembre de dos mil quince.- PROCESO ORDINARIO DE LUIS ENRIQUE ARIAS ESPINOZA, mayor, soltero, agricultor, cédula de identidad CED1 - - ; contra el INSTITUTO DE DESARROLLO RURAL, cédula jurídica CED2 - - representado por su apoderado general judicial Gabriel Rojas Vargas, mayor, casado, abogado, cédula de identidad CED3 - - , vecino de Heredia; y el ESTADO apersonándose la Procuraduría General de la República representada por su Procurador Agrario Víctor Bulgarelli Céspedes, mayor, casado, abogado, vecino de Heredia, cédula de identidad CED4 - - . Actúa como abogado director de la parte actora el licenciado José Luis Marín Quirós, carné diez mil seiscientos noventa y ocho. Tramitado ante el Juzgado Agrario del Segundo Circuito Judicial de la Zona Atlántica, Guápiles.- Redacta la Jueza Castro García y;

CONSIDERANDO

I.El Juzgado Agrario del Segundo Circuito Judicial de la Zona Atlántica, en auto de las 15:08 horas del 29 e julio del 2015 (f. 170), remitió el expediente a este Tribunal, en virtud de la excepción de incompetencia interpuesta por la Procuraduría General de la República. En dicha defensa (f.120) expone, la Sala Primera de la Corte Suprema de Justicia ha venido emitiendo recientes resoluciones donde declara que el conocimiento de asuntos donde esta de por medio el dominio público y de forma específica el Patrimonio Natural del Estado, corresponde conocerse por la jurisdicción contenciosa administrativa. En su escrito cita parcialmente parte de voto N.959-F-SI-2013 de las 9:25 horas del 1 de agosto del 2013, en donde se resolvió anular sentencia del Tribunal Agrario y del Juzgado Agrario de origen, por ubicarse el inmueble en litis dentro del Refugio Nacional de Vida Silvestre Barra del Colorado, estimando que al estar involucrado un inmueble afecto al dominio público, la jurisdicción competente es la Contenciosa Administrativa.

Menciona además, los votos de ese Alto Tribunal números: 123-C-91-S1-2010 de las 08:40 horas del 28 de enero del 2010, 239-C-S1-2010 de las 10:8 horas del 18 de febrero del 2010, 350-F-S1-2012 de las 09:45 horas del 14 de marzo del 2012 y 253-C-S1-2013 de las 11:25 horas del 28 de febrero del 2013. Agrega, el ente procurador, en este caso el objeto de discusión de derechos de posesión de un particular lo es también sobre un terreno ubicado en el Refugio Nacional de Fauna Silvestre Barra del Colorado al que se refirió la sentencia citada. Por ello, menciona, pide que el Tribunal conozca su defensa en aras de resolver conforme al artículo 16 inciso b) de la Ley de Jurisdicción Agraria.

II- En el subjúdice, la parte actora interpone demanda ordinaria contra el Instituto de Desarrollo Rural indicando, desde el año 2001 ejerce la posesión en un sector de la finca inscrita bajo matricula [Placa1] de la provincia de Heredia. En fecha 28 de marzo del 2008, el ente demandado, se prepara oficio que solicita al Ministerio de Seguridad Pública el desalojo de lo que calificaron ocupantes ilegales. Los funcionarios del INDER se apersonaron a la finca en junio del 2008 sin la compañía de la policía y les indican a quienes están en similar situación suya, que debían desalojar el fundo, pues las tierras no eran aptas para agricultura y se requería invertir mucho para proceder a adjudicarlas. No obstante, se observó por esas personas estaban en producción gestionada adecuadamente y les manifestó que no podría salir y que al menos, le reconocieran los montos invertidos a lo largo de tantos años.

En forma posterior, el 28 de febrero del 2012 volvieron a solicitar el desalojo. Describe en la demanda, quienes han sido los dueños registrales del la finca indicando que en diciembre del 2001, se le vende en escritura pública el terreno al entonces IDA. Describe, ingresó al terreno junto con otras familias y con su núcleo familiar por carecer de trabajo y medios de subsistencia. Cita los trabajos que realizó a efectos de poner la finca en condiciones de producción. Menciona, han sido objeto de tres desalojos que no se han ejecutado ni se ha cumplido el debido proceso. Afirma, en forma previa los han visitado funcionarios de ese ente y les indican debían salir, sin que mostraran documentación alguna. Aduce, el único mostrado el día en que se presentaron con la Policía, fue uno emitido hacia 4 años y procedieron a destruir ranchos. Menciona ha ejercido posesión por mas de diez años en cumplimiento con las condiciones exigidas por ley, nunca ha recurrido a la fuerza o violencia.

Pide como pretensión de su acción principalmente se declare a su favor la prescripción positiva del terreno y se ordene la inscripción registral a su nombre, aclarando que se pide la declaratoria de una usucapión especial agraria fundada en el uso que ha dado a la tierra ante la necesidad de contar con un medio para satisfacer su necesidades y las de su familia. En la contestación de la la demanda del INDER ( f. 35) acepta la finca esta a su nombre e informa se ubica dentro de la zona protegida Refugio Nacional de Vida Silvestre Barra del Colorado creada en junio de 1985 por decreto [Nombre1]. 16358-MAG. El ente demandado argumenta en su contestación el actor conoce de los anteriores dueños registrales y que su posesión dejó de ser pacifica continua y de buena fe. Añade, ni siquiera se le reconoce su posesión en los términos del artículo 92 de la Ley de Tierras y Colonización, además de que reconoce que en ese asentamiento se ejecutaron desalojos, lo que configura su mala fe.

Indica, es un terreno ubicado dentro de Zona Protegida y eso lo convierte en bien de dominio público con todos sus atributos de demanialidad y desde 1985 fue sometido a esa tutela. Argumenta, en voto N.4587-97 incida solo se tutela al ocupante poseedor real de buena fe que demuestre 10 años antes de la creación de la zona protegida. Además, el INDER se encuentra sujeto al artículo 15 de la Ley Forestal cuando sus terrenos se califiquen de vocación forestal. En su respuesta a la demanda, el ente reprocha que el actor carece de los requisitos de la usucapión común y de la especial agraria, por cuanto no ha recibido el privilegio legal de tener a su favor una Declaratoria de Ocupación en Precario, y por ello el vicio de mala fe continua. Arguye en el terreno se han dado diversos desalojos y la ocupación insistente no es hábil para usucapir. Reitera, la única que lo habilitaría es la descrita en el voto de la Sala Constitucional citado referida a la ejercida diez años antes de la creación de la zona protegida, que es en junio de 1985.

Sobre los desalojos administrativos, invoca el artículo 455 del Código Procesal Civil que los permite como prerrogativa del titular registral y respecto a las invasiones ilegales, el Ministerio de Seguridad Pública no esta obligada obligada al debido proceso, cuando median bienes de dominio publico acorde con lo citado por la Sala Constitucional N. 5916-94. Cita, en este caso no ha mediado una adjudicación del INDER a favor del actor y la Ley General de la Administración Pública, exige el cumplimiento del debido proceso, solo en caso de interferir derechos subjetivos según el articulo 214. Por lo que rechaza las acusaciones de la violación del debido proceso al actor, al no contar con derecho subjetivo alguno reconocido. Califica la ocupación del accionante como clandestina, violenta, interrumpida y de mala fe. Niega el derecho del actor a usucapir dada la Teoría de la Demanialidad y el incumplimiento de los requisitos del artículo 853 del Código Civil.

Dado que se ordenó intergrar la litis con el Estado, el ente procurador contestó la demanda, girando su tesis de defensa en que no cabe la posesión de particulares sobre terrenos del Patrimonio Natural del Estado por estar afectos al dominio público, aún y cuando el de la litis se encuentre inscrito a nombre del INDER. (f.139). En la fundamentación excepción de falta de derecho señala, al finca es parte de una finca inscrita a nombre del INDER y se ubica dentro de un área silvestre protegida que integra el Patrimonio Natural del Estado, acorde con el artículo 13 de la Ley Forestal, y 32 y 38 de la Ley Orgánica del Ambiente. Además, los actos descritos por el actor para cultivo son más bien daños ambientales.

III- La acción que se ventila en este proceso lo es de prescripción sobre parte de un fundo inscrito a nombre del Instituto de Desarrollo Rural. Aunado a lo anterior, la finca inscrita se ubica dentro de un área silvestre protegida, bajo la categoría de manejo Refugio Nacional, denominada Refugio Nacional de Vida Silvestre Barra del Colorado. Cabe acotar, si bien es cierto la Sala Primera ha emitido una serie de resoluciones en las que ha decidido que lo que se debatía en ese caso particular correspondía ser conocido por la jurisdicción Contenciosa Administrativa, ello debe analizase en cada asunto que presenta sus particularidades propias. En este proceso deben ser considerados al momento de emitirse una sentencia definitiva las regulaciones de los artículos 13 y 14 de la Ley Forestal sobre le concepto del Patrimonio Natural del Estado, y los derechos que reclama el accionante, lo cual es un tema del fondo.

No obstante, para efectos de fijar la competencia material, es importante mencionar también diversas normas legales que otorgan a la jurisdicción agraria competencia para conocer casos como el presente. En el caso en estudio cabe citar lo resuelto en el voto 985-F-14 de este Tribunal: " La nueva Ley de Transformación del Instituto de Desarrollo Agrario en Instituto de Desarrollo Rural (INDER), No. 9036 del 11 de mayo del 2012, en su artículo 16 sobre las competencias y potestades del INDER, se establece en el inciso q) "El Inder deberá procurar la solución de los problemas que resulten de la ocupación de las reservas nacionales y de la ocupación en precario de tierras de dominio privado. El Inder queda facultado, cuando proceda, para redistribuir y reordenar las áreas que sean objeto de conflicto". Ello es así porque, precisamente, el mismo artículo 80 de dicha Ley, en su título III sobre Disposiciones finales y transitorias indicó: "Mantiénese vigente la Ley No. 2825, Ley de Tierras y Colonización de 14 de octubre de 1961, en lo que no contraviene esta ley.

En caso de duda entre ambas prevalecerán los principios de la Ley No. 2825. Expresamente, se mantendrá la vigencia en todos sus extremos, el capítulo VI de la Ley No. 2825, Regulación de Conflictos entre Propietarios y Poseedores en Precario, y su normativa conexa". En ese sentido, la misma Ley de Tierras y Colonización, en el capítulo" el procedimiento instaurado en el artículo 94 de la Ley de Tierras y Colonización, que establece: "ARTICULO 94.- La solución de conflictos derivados de la posesión precaria de tierras, se buscará fundamentalmente a través de contratos directos de compraventa entre el propietario y los ocupantes, con intervención del Instituto, y en la forma en que se indica en los artículos siguientes. Previamente al establecimiento de una acción judicial cualquiera en que pueda estar comprendido un problema de posesión precaria de tierras, los propietarios deberán presentar su reclamo ante el Instituto, conforme a los procedimientos mencionados en este Capítulo.

Transcurridos tres meses a partir del recibo de la gestión respectiva sin que el Instituto haya declarado la existencia de un conflicto de posesión de tierras, o un año desde esa declaratoria sin que el conflicto haya sido solucionado, se tendrá por agotado el procedimiento administrativo, y los accionantes podrán dirigirse a los Tribunales. No obstante lo anterior, cualquiera de los interesados podrá solicitar al Juez o Alcalde de la Jurisdicción en que esté situada la finca, que lleve a cabo una inspección ocular, con citación de partes, para comprobar cualesquiera hechos o señales que pudieren variar o desaparecer con el tiempo. Mientras el asunto esté en el Instituto, no correrá el término de la prescripción para ninguna de las partes. Solucionado el conflicto por el Instituto con la conformidad del propietario u ordenada la expropiación por el Poder Ejecutivo, el propietario carecerá de toda acción judicial, sea civil o penal, contra los poseedores en calidad de tales.

Caso contrario los ocupantes quedarán expuestos a las sanciones legales comunes que puedan proceder. Los escritos presentados por las partes ante el Instituto, en diligencias de solución de conflictos de posesión precaria de tierras y otras relacionados con cuestiones agrarias, estarán exentas de autenticación y del uso de especies fiscales .(Lo subrayado es nuestro). De la anterior disposición, podemos extraer los siguientes elementos relevantes para la decisión del presente asunto:

  • 1)Previo a establecer cualquier acción judicial, los propietarios de fincas u ocupantes, con problemas de posesión precaria, deben agotar el procedimiento administrativo agrario contemplado en la Ley de Tierras
  • 2)El Instituto de Desarrollo Agrario, hoy Instituto de Desarrollo Rural (INDER) tiene tres meses para declarar, o no, la existencia del conflicto;
  • 3)Ante la declaratoria del conflicto, el Instituto tiene un año más, para poder intervenir buscando una solución pacífica al mismo, sea mediante la compra directa de la propiedad, o mediante la expropiación. Existen, en consecuencia, dos modos de agotar la vía administrativa: el primero, opera por el silencio administrativo del Instituto; el segundo, opera un año después de declarada la existencia del conflicto, pues es el plazo que el legislador agrario otorgó al Ente para tratar de solucionar el referido conflicto. En éste último caso, evidentemente, el propósito del legislador fue dejar abierta la vía judicial, es decir, darle al propietario o a los poseedores, la oportunidad de debatir en la vía judicial la defensa de sus derechos. De igual manera, la interpretación de la norma lleva a concluir que cualquier propietario que se sienta perturbado, amenazado o perjudicado con la actuación administrativa del Instituto,al no haber llegado a ninguna solución administrativa (mediante compraventa expropiación), dentro del año, podría acudir a la vía judicial correspondiente para reclamar una indemnización contra el mismo Estado. " . De esta cita y lo debatido en este asunto, y aunque se ha volcado la Sala Primera en diversas oportunidades por el criterio organisista en la radicación de la competencia de los asuntos constenciosos, se observa que el conflicto aquí planteado es propio de la esencia del Derecho Agrario. Lo anterior, pues se discute sobre la pretensión sobre un bien inscrito a nombre del INDER en el cual se alega ha recaído usucapión especial agraria, por desarrollarse actos de cultivo por necesidad del actor y su núcleo familiar. Misma que es negada por quienes figuran como demandados. Nótese que no se solicita la revisión o nulidad de ningún acto administrativo del INDER o del Ministerio de Seguridad Pública, y solo la intervención de los entes estatales no es suficiente para establecer que un asunto debe dilucidarse en la vía contenciosa administrativa. Sino que debe estudiarse el objeto y causa del proceso planteado. No se cuestiona la actuación del INDER actuando en su condición de ente autónomo, sino como titular registral de un terreno en el que el actor alega usucapión especial agraria.

IV- Respecto el tema de la demanialidad de todos los terrenos que forman parte del Patrimonio Natural del Estado. En esa tema debe tenerse presentes las normas 13, 14 y 15 de la Ley Forestal que definen el Patrimonio Natural del Estado y sus efectos en la decisión que por el fondo se llegue a emitir. Aunado a lo anterior, también será necesario considerarse lo regulado en el artículo 58 de la Ley de Biodiversidad que define el concepto de área silvestre protegida como forma de gestión acorde con la categoría de manejo los sistemas ecológicos que estuvieren incorporados en la superficies terrestres del territorio nacional que reza: "ARTÍCULO 58.- Áreas silvestres protegidas Las áreas silvestres protegidas son zonas geográficas delimitadas, constituidas por terrenos, humedales y porciones de mar. Han sido declaradas como tales por representar significado especial por sus ecosistemas, la existencia de especies amenazadas, la repercusión en la reproducción y otras necesidades y por su significado histórico y cultural.

Estas áreas estarán dedicadas a conservación y proteger la biodiversidad, el suelo, el recurso hídrico, los recursos culturales y los servicios de los ecosistemas en general. Los objetivos, la clasificación, los requisitos y mecanismos para establecer o reducir estas áreas se determinan en la Ley Orgánica del Ambiente, No. 7554, de 4 de octubre de 1995. Las prohibiciones que afectan a las personas físicas y jurídicas dentro de los parques nacionales y las reservas biológicas están determinadas, en la Ley de la Creación del Servicio de Parques Nacionales, No. 6084, de 24 de agosto de 1977. Durante el proceso de cumplimiento de requisitos para establecer áreas silvestres protegidas estatales, los informes técnicos respectivos deberán incluir las recomendaciones y justificaciones pertinentes para determinar la categoría de manejo más apropiada a que el área propuesta debe someterse. En todo caso, el establecimiento de áreas y categorías tomará muy en cuenta los derechos previamente adquiridos por las poblaciones indígenas o campesinas y otras personas físicas o jurídicas, subyacentes o adyacentes a ella.

" (la negrita no corresponde al original). Por otra parte, el artículo 60 de esa norma señala: "ARTÍCULO 60.- Propiedad de las áreas silvestres protegidas Las áreas silvestres protegidas, además de las estatales, pueden ser municipales, mixtas o de propiedad privada. Por la gran importancia que tienen para asegurar la conservación y el uso sostenible de la biodiversidad del país, el Ministerio del Ambiente y Energía y todos los entes públicos, incentivarán su creación, además, vigilarán y ayudarán en su gestión.". Cabe agregar también de esa misma norma legal, la reforma que introdujo a la Ley Orgánica del Ambiente en el párrafo tercero del artículo 37, para se lea: " c) Artículo 37.-Facultades del Poder Ejecutivo Las fincas particulares afectadas según lo dispuesto por este artículo, por encontrarse en parques nacionales, reservas biológicas, refugios de vida silvestre, reservas forestales y zonas protectoras, quedarán comprendidas dentro de las áreas protegidas estatales solo a partir del momento en que se hayan pagado o expropiado legalmente, salvo cuando en forma voluntaria se sometan al Régimen Forestal.

Tratándose de reservas forestales, zonas protectoras y refugios de vida silvestre y en caso de que el pago o la expropiación no se haya efectuado y mientras se efectúa, las áreas quedarán sometidas a un plan de ordenamiento ambiental que incluye la evaluación de impacto ambiental y posteriormente, al plan de manejo, recuperación y reposición de los recursos." Los argumentos del ente estatal que indica, que solo por formar parte la finca inscrita del ente estatal del Refugio Nacional de Vida Silvestre Barra del Colorado y ser de dominio público, debe conocerse dentro de la jurisdicción contenciosa administrativa, no se comparten. Pues, nada obsta para que en la jurisdicción agraria pueda dilucidar este proceso, además de que, como se citó dentro de las áreas silvestres protegidas, a excepción de reservas biológicas y parques nacionales, dadas sus finalidades y objetivos de conservación absoluta de esas categorías de manejo, en los demás si pueden coexistir fincas públicas y privadas cuyos propietarios pueden ser entes públicos o personas privadas sometidos al plan de ordenamiento territorial de cada área silvestre protegida y dentro de los límites y limitaciones que conlleva ser el titular de una finca de esta naturaleza.

Entender lo contrario conlleva a una visión absolutamente estatal de la gestión ambiental, eliminando toda la moderna visión del comanejo con la sociedad civil del ambiente. Cuyos efectos sociales no benefician en el campo la supervivencia de los ecosistemas, dada la limitada capacidad del Estado y sus instituciones de gestionar en forma directa, vigilar y resguardar los recursos ambientales. Función que deben de cumplir la sociedad civil en su condición de dueños o dueñas de una finca sometida al régimen forestal o limitaciones de carácter ambiental. Además de producir el efecto practicó de imponer el deber del Estado de indemnizar a todos los titulares de fincas privadas ubicadas en todas las áreas manejadas bajo una categoría de manejo declarada, aún de los que desarrollen una posesión en respeto de la capacidad de regeneración de los ecosistemas y se sometan en forma voluntaria al Régimen Forestal.

Cuando ello solo resulta justificado en las categorías de manejo de parque nacional y reserva biológica, a criterio de este Tribunal, debido a objetivos y criterios de estas categorias que son las mas restricitvas. Sobre la demanialización de terrenos boscosos, estima este Tribunal, en este caso en un tema que deberá resolverse en la sentencia de fondo. Sin que deje de mencionarse al respecto, Ley de Informaciones Posesorias permite la titulación de terrenos boscosos, ubicados dentro o fuera de áreas silvestres protegidas, siempre y cuando se cumplan los requisitos legales, acorde con el artículo 7 de la Ley de Informaciones Posesorias reformado por la Ley Forestal vigente y de igual forma lo establece el artículo 92 de la Ley de Tierras y Colonización . Aunado a que la Ley Forestal regula la conservación, tutela, gestión y aprovechamiento de recursos forestales bajo criterios técnicos y legales que aseguren su perpetuidad.

Vease al respecto el conjunto de normas dedicado a la propiedad forestal privada a partir del artículo 19. La garantía del derecho del Estado de intervenir en tutela de los intereses ambientales que estime puedan lesionarse en el caso en estudio, ya se encuentra asegurado al ser como parte de la litis la Procuraduría General de la República. Por tales razonamientos, se declara sin lugar la excepción de incompetencia interpuesta por la Procuraduría General de la República.

IV-En virtud de los motivos expuestos, los artículos 1 y 2 de la Ley de Jurisdicción Agraria, 58 y 60 de la Ley de Biodiversidad, 37 de la Ley Forestal, al versar la demanda sobre una declaración de usucapión especial agraria a favor de un particular de parte de finca inscrita a nombre del INDER y no haber sido alegada la revocatoria o nulidad de actos administrativos, se declara que este asunto es propio del conocimiento de la jurisdicción agraria por razones materiales. Se deberá declarar sin lugar la excepción de incompetencia incoada. Firme esta resolución, se ordena remitir este expediente al juzgado de origen a fin de continuar con los procedimientos.
