Goicoechea, at seventeen hours and forty-five minutes, on veintiuno de octubre de dos mil quince.- APPEAL (RECURSO DE APELACIÓN) filed in the present proceedings against Nombre01, of legal age, married, Costa Rican, holder of identity card number CED01, born in Alajuela on 24 de abril de 1960, a forestry manager (regente forestal) by occupation, son of Nombre02 and Nombre03, resident of Limón, Guápiles, Dirección01.; and Nombre04, of legal age, married, Costa Rican, holder of identity card number CED02, born in San José on 11 de julio de 1965, a merchant by occupation, son of Nombre05 and Nombre06, resident of Heredia, Sarapiquí, Horquetas, opposite the El Cruce school, in a light-blue mixed-construction house; for the offense of VIOLATION OF THE LEY FORESTAL AND OTHER OFFENSES, to the detriment of NATURAL RESOURCES AND ANOTHER PARTY.

Judges Elizabeth Montero Mena and Kathya Jiménez Fernández, and Judge Giovanni Mena Artavia, participated in deciding the appeal. Attorney Jenny Valverde Jiménez appeared before this Court in her capacity as public defender for defendant Nombre01; defendant Nombre01 appeared through a document authenticated by Attorney Víctor Manuel Loría Guadamuz; and Attorney Samantha Fonseca Ureña appeared as representative of the Ministerio Público, Fiscalía Adjunta de Sarapiquí.

WHEREAS:

I.By judgment number 45-2015, issued at seventeen hours and thirty minutes on catorce de mayo de dos mil quince, the Tribunal de Juicio de Heredia, Sede Sarapiquí, ruled: “POR TANTO: In accordance with the foregoing and pursuant to Articles 39 and 41 of the Constitución Política, 05 subsection 6) and 08 of the Convención Americana Sobre Derechos Humanos, 14 of the Pacto Internacional de Derechos Civiles y Políticos, 01, 22, 30, 31, 39, 45, 50, 51, 59, 71, 73, 74, 110, 367 and 372 of the Código Penal; 01, 06, 09, 45, 75, 111, 142, 182 to 184, 265 to 270 and 324 to 368 of the Código Procesal Penal, 1045 of the Código Civil, 122 subsection 2) and 124 of the Reglas Vigentes sobre Responsabilidad Civil of the Código Penal de 1941, 01, 02, 16 subsection a), 39 and 42 of Decreto Ejecutivo Número 36562-JP of the Presidencia de la República and the Ministerio de Justicia y Paz concerning Fees for Professional Legal Services, 01, 03 subsections d), f), and g), 21, 28, 56, 58 subsection a), and 61 subsections a) and c) of Ley 7575 or ‘Ley Forestal,’ and 22 and 23 of the Reglamento a la Ley Forestal, this Court, by unanimous vote, finds Nombre01 criminally responsible as the perpetrator of ONE OFFENSE OF IDEOLOGICAL FALSEHOOD (FALSEDAD IDEOLÓGICA), committed to the detriment of PUBLIC FAITH, for which offense he is sentenced to FOUR YEARS’ IMPRISONMENT.

This sentence shall be served in the correctional facility designated by prison regulations, with credit for any pretrial detention served. In view of the length of the sentence imposed and the fact that he has current criminal convictions on his record, the convicted person is not granted the Benefit of Conditional Execution of Sentence (Beneficio de Ejecución Condicional de la Pena). Nombre01 and Nombre04 are ACQUITTED of all punishment and liability for the offenses of USE OF A FALSE DOCUMENT, ILLEGAL HARVESTING OF TIMBER ON PRIVATE PROPERTY, LAND-USE CHANGE (CAMBIO DE USO DE SUELO), AND ILLEGAL HARVESTING OF TIMBER IN A PROTECTION ZONE, which they had been charged with committing to the detriment of PUBLIC FAITH and THE STATE’S NATURAL RESOURCES. The civil damages action (acción civil resarcitoria) brought by THE STATE against civil defendant Nombre01 is GRANTED, and that civil defendant is consequently ordered to pay the claimant the claimed ENVIRONMENTAL PROPERTY DAMAGE, which is set at EIGHT MILLION SEVEN HUNDRED THIRTY-SEVEN THOUSAND FOUR HUNDRED EIGHTY-TWO COLONES (¢8,737,482,00), plus the interest accrued on that amount as of today, for a total of THIRTEEN MILLION FORTY-SIX THOUSAND TWO HUNDRED FORTY-FIVE COLONES AND FORTY-NINE CÉNTIMOS (¢13,046,245.49).

The personal and procedural costs of the private criminal complaint (querella) and the civil damages action brought shall be borne by the defendant and awarded to THE STATE; the personal costs for the private criminal complaint are set at SIX HUNDRED THOUSAND COLONES (¢600,000.00), and the personal costs for the civil action brought are set at TWO MILLION SIX HUNDRED NINE THOUSAND TWO HUNDRED FORTY-NINE COLONES AND EIGHT CÉNTIMOS (¢2,609,249.08). The procedural costs of both the private criminal complaint and the civil action shall be assessed in the corresponding civil proceedings. The civil damages action brought by THE STATE against civil defendant Nombre04 is DENIED; as it pertains to him, the claim is decided without any special award of costs because there were reasonable grounds for litigation. The statute-of-limitations defense (excepción de Prescripción) is DENIED, and the defenses of Lack of Standing to Sue and Be Sued and Failure to State a Legal Right (Falta de Legitimación Activa y Pasiva y Falta de Derecho), all raised by third-party civil defendant HACIENDA PEÑAS GRANDES S.A., are GRANTED; accordingly, the civil damages action brought by THE STATE against that legal entity is DENIED.

Because there were no reasonable grounds for litigation, the personal and procedural costs of that action shall be borne by the State and awarded to the defendant company, with the stated personal costs set at ONE MILLION SEVEN HUNDRED THIRTY-NINE THOUSAND FOUR HUNDRED NINETY-NINE COLONES AND THIRTY-NINE CÉNTIMOS (¢1,739,499.39). The aforementioned procedural costs of that civil action shall be assessed in the corresponding civil proceedings. All remaining costs of the proceedings shall be borne by the State. FORFEITURE (COMISO) to THE STATE is ordered of the orange Husqvarna-brand chainsaw, serial number , together with its bar and chain, as well as the timber seized from defendant Nombre04. Once the judgment becomes final, these assets shall be placed at the disposal of the Administración Forestal del Estado. Once this judgment becomes final, it shall be entered in the Registro Judicial, and the customary certified copies shall be forwarded to the Instituto Nacional de Criminología and the Juzgado de Ejecución de la Pena.

In due course, the case file shall be archived and removed from the court office’s general docket. Notice shall be given by a full reading, scheduled for eleven hours on the upcoming veintiuno de mayo del año dos mil quince. (sic).”

II.Attorney Jenny Valverde Jiménez, public defender for defendant Nombre01, and defendant Nombre01, through a document authenticated by Attorney Víctor Manuel Loría Guadamuz, filed an appeal against the foregoing decision.

III.After the corresponding deliberation was conducted in accordance with Article 465 of the Código de Procesal Penal, the Court considered the issues raised in the appeal.

IV. The applicable legal requirements have been observed throughout the proceedings

Appellate Judge Jiménez Fernández writes the decision; and,

CONSIDERING:

I.Appeals (recursos de apelación): (i) Attorney Jenny Valverde Jiménez, Public Defender for Nombre01, filed an appeal against judgment N° 45-2015 of the Heredia Criminal Court, Sarapiquí venue, issued at eleven hours on catorce de mayo del 2015. FIRST GROUND: “Disagreement with the assessment of the evidence.” She states that the court determined that the offense of ideological falsehood (falsedad ideológica) had been established because it was deemed proven that false information had been entered in the certificate of origin (certificado de origen), namely, “that the trees were from a plantation”; however, in reaching that conclusion, the judges committed the defect of failure to consider evidence (preterición de prueba), because they omitted analysis of essential evidentiary elements and testimony offered by the defendant’s own defense. She argues that the trial court did not examine whether the trees could in fact have been individually planted.

She states that the court failed to assess the defendant’s theory of defense that the document lacked a specific space in which to indicate that the trees had been individually planted and, therefore, that his action in listing them as such on the certificate of origin was valid. Nevertheless, although the judgment credits the individual planting of the trees, it confines its analysis to whether this could constitute a forest plantation (plantación forestal) under Article 3 of Ley Forestal. She indicates that the court concluded that individually planted trees are precisely those planted by a person without an expectation of timber production; however, it is false to assert that the absence of the objective of timber production defines an individually planted tree. She argues that because a plantation does not constitute a forest, it falls outside the protection of Ley Forestal, and that if the judgment had assessed the account given by her client and his witnesses—that the trees had been planted individually—it could not have concluded that they could not be included on the certificate of origin as a plantation, particularly because the form contains no specific space for that purpose, since individual planting is not subject to state protection.

SECOND GROUND: “Disagreement with the assessment of the evidence.” She states that the objective element of the offense of Ideological Falsehood—that it involve a public document—cannot be established because the certificate of origin in which that circumstance was allegedly entered was never introduced into the proceedings; therefore, the defendant should have been acquitted. THIRD GROUND: “Disagreement with the legal reasoning.” She states that Article 367 of the Criminal Code was erroneously applied because submission to the MINAET Forestry Administration of the certificate of origin for the timber, in which false information had allegedly been entered, could never have caused harm. Furthermore, the charging document does not specify any date in connection with the commission of the offense of Ideological Falsehood or with the submission of the certificate of origin; consequently, the document at issue could not have had the potential to cause harm because the authorities already knew the circumstances of the property, and her client therefore could not have fraudulently induced them to issue a permit.

Indeed, it was deemed proven that the accused prepared a certificate of origin that he submitted to MINAET to obtain a timber-harvesting permit (permiso de aprovechamiento de la madera); however, it could not be proven that he participated in the extraction or that any document issued by him was used for that purpose. FOURTH GROUND: “Violation of due process (debido proceso) due to lack of reasoning concerning the civil action (acción civil).” She states that the trial court found a causal link (nexo causal) between the defendant’s act of entering false information in a certificate of origin and the environmental damage (daño ambiental) caused by the felling of trees, even though it acquitted him because his participation in the felling was not deemed proven. The judgment is contradictory, however, because it is not possible to maintain that the accused is civilly liable for the damage while also stating that he did not cause it through the felling.

Furthermore, the decision lacks evidentiary reasoning establishing a link between the damage caused by cutting the trees and the ideological falsehood attributed to the defendant. She requests that the grounds be upheld and that the judgment be declared ineffective with respect to the civil award. (ii) Appeal by defendant Nombre01. SOLE GROUND: “Disagreement with the assessment of the evidence. Violation of the rules of sound rational judgment (sana crítica racional), specifically the logical rule of derivation (subprinciple of derivation or sufficient reason), closely connected to a lack of analytical and intellectual reasoning, due to absent, insufficient, and contradictory reasoning in the judgment.” He states that the trial court’s conclusion is not supported by documentary, expert, or testimonial evidence, or by any technical criterion, and that it conflicts with environmental regulations and the witnesses’ statements, because he never committed the offense of ideological falsehood.

He indicates that the information he entered in that certificate was true and supported by technical criteria, and that the prosecution witnesses and former owners of the property where the felling occurred (Nombre07 and Nombre08) stated that they had planted those trees; therefore, if he stated that the trees were from a plantation, it was because they were. This was precisely what he stated in his testimony as the defendant, forestry manager (regente forestal), and an expert in the field. He states that he testified regarding technical subjects such as plantations; Article 28 of Ley Forestal, concerning tree-cutting permits (permisos de corta de árboles); agroforestry systems (sistemas agroforestales); and individual plantations (plantaciones individuales), and that the law does not require a cutting permit. He states that he was acquitted in the disciplinary proceedings concerning these same events conducted by the Colegio de Ingenieros Agrónomos because the technical inspections could not rule out that what existed at the site was a forest plantation.

When persons plant using their own resources, the area is not considered a forest and therefore does not require a cutting permit; consequently, he did not enter any false information in the document. He further emphasizes that the trial court deemed it established that the cleared area was not a forest and therefore necessarily was something else, whether a plantation, scrubland (charral), or otherwise. The court did not explain why it rejected the classification of the area as a plantation, as he had explained extensively in his testimony. He asserts that witnesses Nombre07 and Nombre08 stated that they planted beside and on top of trunks; however, none of the expert examinations or inspections conducted by MINAE agents, nor the testimonial evidence, indicates that the trunks were also taken into account. If the trunks were counted as trees, the sampling would be incorrect because it would yield a quantity greater than the number that actually existed.

The court states that there was no plantation because there were more than 500 trees per hectare; however, no such limitation exists if they were planted. He states that the court rejected his testimony without relying on technical criteria that are valid from an environmental and legal standpoint. Furthermore, the defense witnesses were not credited, while only those from MINAE were, even though the judgment accepts that his witnesses told the truth in stating that, after converting the property into pastureland, they proceeded to plant trees. The appellant therefore questions why the court found that he had made a false statement by indicating that it was a plantation, given that it is immaterial whether the former owners planted the trees for timber production because the law does not require that purpose; a plantation may have a different purpose. He reiterates that whether the person who planted the trees ever intended to produce timber has nothing to do with the technical definition of a plantation.

He states that, upon reviewing the certificate of origin, the tree-plantation box must be checked for an individual plantation, and doing so is not unlawful. He states that the court below (a quo) reversed the burden of proof (carga de la prueba), thereby violating due process. He contends that his technical opinion as a Forestry Engineer and Forestry Manager should have been given greater evidentiary weight than the statements of MINAE officials who lacked that status and academic degree, particularly because no expert report exists to discredit his account. He requests that the judgment be annulled and the case remanded for new proceedings. Position of the Public Prosecutor’s Office: Sarapiquí Prosecutor Samantha Fonseca Ureña responded to the hearing granted. She requested that the appeal be denied because the trial court properly assessed the evidence and the judgment is duly reasoned.

II.The appeals are without merit. Because the issues raised in both challenges are interconnected, all relating to the assessment of the evidence and the determination of the proven facts, they are considered jointly and denied. It is noted that, because the acquittal rendered in this matter was not challenged, the ruling remains undisturbed with respect to the offenses of use of a forged document, illegal harvesting of timber, land-use change (cambio de uso del suelo), and illegal harvesting of timber in a protection zone (zona de protección), as well as with respect to the legal status (criminal acquittal) of co-defendant Nombre04. A. Regarding the criminal matters. According to the prosecution’s charging instrument and the facts established in the written judgment, appearing at folios 243 to 297, as well as in the supplementary ruling at folio 300, Nombre01 was charged with, and it was proven, that: “1- On an undetermined date, but before and near 27 de Mayo de 2009, within the property owned by Hacienda Peñas Grandes, located in Puerto Viejo de Sarapiquí, specifically in the locality of La Esperanza, two hundred forty-seven trees of the botarrama, roble coral, areno guabo, arenillo, gallinaza, and gavin species, with diameters ranging from 19 to 72 centimeters, were felled; four of the botarrama trees were located in the protection zone of a stream, and none of the foregoing had any permit from the State Forestry Administration (Administración Forestal del Estado). 2- Taking advantage of his status as forestry supervisor (regente forestal) and public certifying officer (fedatario público), the defendant Nombre01 inserted false information into a public document, specifically the certificate of origin (certificado de origen), by stating that the harvestable timber came from a plantation. 3- The defendant Nombre04 submitted the aforementioned certificate of origin to the office of the State Forestry Administration” (cf. fol. 272).

As a result of these events, he was held civilly liable in the civil action for damages (acción civil resarcitoria) brought by El Estado and ordered to pay for the environmental damage (daño ambiental), which was set at EIGHT MILLION SEVEN HUNDRED THIRTY-SEVEN THOUSAND FOUR HUNDRED EIGHTY-TWO COLONES (¢8,737,482,00), plus the interest accrued on that amount as of the date of the judgment, totaling THIRTEEN MILLION FORTY-SIX THOUSAND TWO HUNDRED FORTY-FIVE COLONES AND FORTY-NINE CÉNTIMOS (¢13,046,245.49), as well as the attorney’s fees and court costs of the private prosecution (querella) and the civil action for damages; the attorney’s fees for the former were set at SIX HUNDRED THOUSAND COLONES (¢600,000.00), and those for the civil action brought were set at TWO MILLION SIX HUNDRED NINE THOUSAND TWO HUNDRED FORTY-NINE COLONES AND EIGHT CÉNTIMOS (¢2,609,249.08). Contrary to what the appellants alleged and understood, the judges reached those conclusions based on a joint and meticulous analysis of the testimonial evidence (Nombre09, Nombre10, Nombre07, and Nombre08); the defendant’s statement; and the documentary evidence admitted into the record (Dirección02 of the Ministerio de Ambiente, Energía y Telecomunicaciones, at folios 1 to 10.

The majority of this Chamber considers that the detailed and exhaustive analysis of the body of evidence duly admitted at trial dispelled any doubt that might have arisen regarding the authorship of defendant Nombre01 in the offense of making false statements in a public document (falsedad ideológica).

As the trial court stated, “the testimony of both Nombre09 and Nombre10 establishes an indisputable fact: that the event did in fact occur; that is, a simple reading of the report, supported by these witnesses’ testimony at trial, leaves no doubt that the felling and harvesting of the two hundred forty-seven trees at the site and the land-use change did in fact occur” (cf. fol. 274). Although the accused Nombre01 could not be held responsible for those acts, the evidence was conclusive in establishing him as the perpetrator of the offense of making false statements in a public document with which he was charged. The appellants’ principal challenge, as well as the defendant’s own defense, has been that, if the existence of a forested area was not proven—and the defendant did not deny it, since he merely marked on the form that the area was a plantation because there was no other option matching the actual condition of the land assessed—then the absence of an expert opinion stating otherwise, together with the accused’s scientific and technical knowledge, validates the assertion that the site was a “plantation” and explains why no false information was entered in the document at issue.

Nevertheless, upon properly weighing the evidentiary elements discussed extensively in the challenged judgment, it was established, first, that because of the public position he held at MINAE, Nombre01 qualified as a public certifying officer; second, that the document he issued was public in nature; and third, that the statement contained therein was false. Although the existence of a forest was not indisputably established—although it could be inferred from other evidence—it was proven that no plantation had ever existed at the site. A plantation was precisely the condition to which the accused attested through his statements, resulting in the felling of the species present in the area without a proper management plan (plan de manejo) and causing the environmental damage claimed, which was also recognized in the challenged judgment. The court below emphasized “that co-defendant Nombre01 himself stated that co-defendant Nombre04 had sought him out, because of his status as forestry supervisor, to assess the land intended for exploitation.

In other words, Nombre04 sought a professional in the field to determine whether the area to be exploited was a plantation, a forest, or under what category it could be classified. The evidence presented at trial also leads to the conclusion, as we will analyze below, that the defendant falsely stated in that document that it was indeed a plantation area and therefore that no management plan for a forest area needed to be processed, and that issuance of the certificate of origin was sufficient for its exploitation (...) One fact of particular importance at trial should be emphasized: the issue to be proven appeared to be whether the affected area was secondary forest (bosque secundario), but the fact is that the accused was not charged with having denied in the document the existence of a forested area, but rather with having asserted the existence of a plantation. (...) In other words, the false statement that the Ministerio Público and the Procuraduría alleged the defendant had inserted was that, under the public faith authority conferred upon him by his position, he certified that a plantation existed there” (cf. fol. 276-777, emphasis added).

The Court also explained in detail, one by one, the reasons why the defendant Nombre01’s statement was proven false, while simultaneously dismantling his alibi. It noted that, from the outset, the MINAE report established that its personnel visited the affected area and performed various procedures which, in their judgment, showed that the impacted area was secondary forest. They verified this condition by extrapolating data that led them to conclude mathematically that more than 500 trees per hectare existed in those areas, thereby satisfying the definition of secondary forest under Decreto Ejecutivo Número 27998, which provides the procedure for sustainable forest management (manejo sostenible de bosques). Furthermore, testimony was received from the former owners of the property, who, in addition to explaining the reforestation process (proceso de reforestación) they had carried out, agreed that the purpose was not timber harvesting, as is the case with forest plantations.

To explain the difference between such forest plantations and a forest, the court below stated that the concept of a forest plantation is not the same as the concept of individually planted trees, because the former is defined in article 3 of Ley Forestal, specifically as a tract of land of one or more hectares cultivated with one or more forest species whose principal, though not exclusive, purpose is timber production; whereas individually planted trees are precisely those planted by a person without an expectation of timber production, a characterization also mentioned by the defendant. Therefore, if the distinction is clear and was also recognized by the defendant, the absence or omission of a box on the form at issue, which the defendant himself prepared, cannot justify his arbitrarily marking a different one. The judgment further reiterated that the site was not a plantation, as the defendant falsely claimed, because witnesses Nombre08 and Nombre07, the former owners of the property examined, agreed that the trees planted there had never been planted with the intention of establishing a plantation, nor was their principal purpose timber production.

This was yet another indication that led the judges to conclude that a secondary forest area may indeed have developed through succession as a result of the lack of maintenance over a great many years. To complete its demonstration that the defendant’s alibi aimed at avoiding responsibility for the events was untenable, the court below properly compared the various versions he had given and stated: “It is nevertheless worth highlighting an important point: when the defendant appears to realize that his arguments will not be sufficient, he gives a second statement, or expands upon the first, and on this occasion redirects his efforts—not toward establishing that these were individually planted trees, nor toward establishing that it was in fact a plantation, nor toward discrediting the report through technicalities, but toward asserting that what must actually be proven against him is that a forest existed there, rather than a secondary forest.

Let us examine his statement: what is at issue is proving that the area from which some trees were cut was secondary forest, while the statutory definition pertains to forest. Essentially, certain documents concerning the investigation of forestry offenses, prepared by the Poder Judicial, explain in detail that, for there to be land-use change in an area, it must be determined that the area is forest; they do not say primary or secondary, but rather that it must meet the conditions for classification as forest. This matter is clearly established in the Reglamento a la Ley Forestal, which states that, for an area to qualify as forest, three cumulative conditions must be met: it must exceed two hectares; there must be trees of different cuts, different heights and diameters, and a representative variety of forest species, with more than sixty trees per hectare exceeding 15 centimeters in diameter; and more than seventy percent of the area must be covered by these trees. Thus, what the testimony of the MINAE officials has sought to prove here is that the area was secondary forest, not that it was forest, and that causes me great concern.

At this point, the defendant diametrically changes the issue under discussion, since it is quite possible that, at that stage in the development of the trial, he assumes that the Court will not give much weight to his attempt to discredit the report, and therefore focuses his challenge on establishing the difference between forest (bosque) and secondary forest (bosque secundario), an idea that, in any event, is not the Court’s guiding consideration either, since, as already established, the issue to be proved is whether or not the affected area was a plantation area (área de plantación). As an additional matter, the defendant prepared a document, which was admitted into evidence by the Court, through which he seeks to demonstrate that an error involving a single tree in the count has a multiplying effect and that this would lead to the conclusion that the area was not forest. Consistent with the reasoning set forth thus far, and to avoid repetition, this will not be analyzed further, since we have already indicated that it lacks the necessary force to discredit the factual basis of the accusation, and we consider this extensive assessment of the defendant’s testimony sufficient to conclude that none of the many premises he relied upon carries any weight in demonstrating his innocence of the act under investigation.” In the opinion of the majority of this Chamber, the extensive analysis conducted by the trial court, together with objective evidence such as the information contained in report SN-024-2009, prepared by MINAE, in whose form or content no defect or irregularity has been detected that would cast doubt on the information recorded therein, clearly establishes the accused’s responsibility, just as the judges found.

It should be noted that, even though the technical expert evidence (pericia técnica) cited as missing by the defense was not introduced, the review conducted of the impacted area did establish that it was a secondary forest; that the permits required from the Forestry Administration (Administración Forestal) had not been obtained for the harvesting of the timber (aprovechamiento de la madera); and that the permits and false information issued by Nombre01, stating that the area was a plantation, contributed to the logging of approximately 13.2 has, or approximately 240 trees. Furthermore, there is an indisputable fact that dispels any doubt regarding the nature of the affected area: the Forestry Administration had previously denied Nombre04’s request for endorsement, or “approval,” of the document issued by the defendant herein stating that it concerned a plantation. Thus, the nature of the land whose harvesting the accused authorized without the corresponding permits was entirely clear and could readily and conclusively have been verified by him.

The information contained in this document concerning the nature of the exploited land is unclear only to the accused, since the “approval” requested by Nombre04 had previously been denied even though the forest manager (regente forestal), Nombre01, had asserted that the land was a plantation, when in fact it was not. As the a quo found, this conduct prevented the State Forestry Administration from carrying out its mission, because if the forest manager had not attested to that falsehood, the only way that timber could have been extracted would have been through the involvement of that office. In addition to the foregoing, the trial court concluded by stating: “The documentary evidence supplements and provides further support for the conclusion reached by the Court, since it establishes beyond any doubt that the forest plantation (plantación forestal) which the defendant claimed existed at the site did not, in fact, exist.

From the photographs submitted, it may be deduced with reasonable clarity that, visually, the impacted area—which the forest manager and defendant herein, Nombre01, asserted was a forest plantation—displayed, as of the date of the report, characteristics that, under the rules of sound judicial reasoning (reglas de la sana crítica), correspond to a forest area: the individual trees are located very close to one another, their canopies are extremely broad, secondary vegetation is present among them, undergrowth (sotobosque) is present, and there is evidence that the area had received no human maintenance” (cfr. f. 286). Accordingly, the falsehood attributed to Nombre01 is not negated by the absence of expert evidence additional to the information supplied by the evidence analyzed by the judges—the principle of freedom of evidence (principio de libertad probatoria), artículo 182 del Código Procesal Penal; it is not justified on the ground that he lacked boxes to check, particularly when the accused claims to have extensive experience and knowledge in the field and to understand the implications of his actions as a forest manager; nor is it dispelled because the disciplinary proceeding brought against him before the Colegio de Ingenieros Agrónomos was decided in his favor.

Regarding this last point, the Court properly explained that the rules governing that proceeding bear no relation whatsoever to those governing criminal proceedings and, more importantly, that the evidence presented at trial was not the same evidence used in that administrative proceeding; therefore, those conclusions could have no relevance and did not in any way bind the determination made in the criminal proceeding. For the foregoing reasons, as to the criminal issues, both appeals are denied. B. The civil claim. The defense argues that it is contradictory to find that a causal link (nexo causal) existed between the defendant’s conduct—entering false information in a certificate of origin (certificado de origen)—and the environmental damage (daño ambiental) caused by the felling of trees, despite his acquittal because his participation in that second act had not been proven. It also contends that the ruling lacks evidentiary support establishing that link and therefore requests that the claim be granted.

The objection is denied. In properly granting the civil claim, the trial court found that, pursuant to artículo 41 Constitucional, numeral 103 del Código Penal in relation to 37 and 71 del Código Penal, as well as numerales 122 and 125 de las Reglas Vigentes sobre Responsabilidad Civil del Código Penal de 1941 and 1045 del Código Civil, the civil defendant was obligated to compensate for the damage because his criminal conduct—falsely describing the nature of the land—resulted in significant environmental damage, as established by expert evidence. It is true, as the appellant notes, that the logging itself and, in essence, the actual felling of the trees were not proven against the accused in the criminal proceeding. However, the actual damage caused by the unknown person or persons who cut down the trees—depredation facilitated by the conduct that was indeed proven against the defendant—constitutes the causal link that the defense claims is missing.

In this regard, the a quo explained that: “First, as clearly set forth in the preceding sections, the defendant Nombre01 has been found responsible for committing an offense and, consequently, has been proven to have committed an intentional act that was statutorily defined, unlawful, and culpable (acción, típica, antijurídica y culpable), which caused actual harm to collective interests through environmental damage and resulted in the penalty imposed, namely the sentence of imprisonment. In other words, he has been found criminally responsible as the perpetrator of a duly proven criminal wrong, that is, a punishable act (hecho punible) that was statutorily defined and unlawful and that, as stated, impaired the aforementioned legally protected interest (bien jurídico), for which criminal liability was imposed upon him. Accordingly, as properly established by our legal system cited supra, compensation is warranted.” (...) “In the present case, the cause of the environmental damage was, without any doubt, the intentional conduct attributed to the defendant: in his capacity as forest manager and, as such, as a public certifying officer (fedatario público), he falsely stated in a public document that the area intended for harvesting was a plantation area, when in fact it was not, thereby allowing timber exploitation (explotación maderera) to occur without any oversight by the State Forestry Administration.

Had it not been for the unlawful action committed by the defendant herein, the governmental entity would have been obligated to control and supervise the activities conducted in the affected area and to authorize or deny them” (cfr. f. 289-291). The appellant is likewise incorrect in asserting that no evidence establishes the damage, because the trial court determined it on the basis of objective evidence introduced into the proceeding, stating: “With respect to material environmental damage (daño material de índole ambiental), MINAE’s findings and the assessment conducted for that purpose establish that an environmental impact (impacto ambiental) did in fact occur. It was quantified at eight million seven hundred thirty-seven thousand four hundred eighty-two colones, plus the interest requested as of the date of the closing arguments presented at trial by the civil plaintiff, for a total of thirteen million forty-six thousand two hundred forty-five colones and forty-nine céntimos.” Thus, the same evidence on which the analysis of the defendant’s criminal liability was based established the harm claimed by the civil plaintiffs.

For the foregoing reasons, in the opinion of the majority of this Chamber, the grounds supporting the granting of the civil claim are properly stated and detailed in the challenged judgment, and the claim on appeal is therefore denied.

III. DISSENTING OPINION OF JUDGE MONTERO MENA

The appeals are granted. A. Appeal filed by attorney Jenny Valverde Jiménez, Public Defender. First through third grounds. Because they are intrinsically related, they are decided jointly. The appellant argues that the trial court found that the offense of ideological falsification (falsedad ideológica) had been committed because it deemed it proven that false information had been entered in the certificate of origin, namely that “the trees were from a plantation”; however, in reaching that conclusion, the judges committed the error of failing to consider evidence (preterición de prueba), since they omitted analysis of essential evidence relating to the defendant’s personal defense (defensa material), such as the testimony of defense witnesses Nombre07 and Nombre08, and also failed to examine whether the trees could in fact have been planted individually. In this regard, it is important to consider first that the judgment deemed the following proven: 1.- “On an undetermined date, but before and near 27 de Mayo de 2009, within the property owned by Hacienda Peñas Grandes, located in Puerto Viejo de Sarapiquí, specifically in the locality of La Esperanza, two hundred forty-seven trees of the botarrama, roble coral, areno guabo, arenillo, gallinaza, and gavin species, with diameters ranging from 19 to 72 centimeters, were felled, and four of the botarrama trees were located within the protection zone (zona de protección) of a stream, without any permit from the Administración Forestal del Estado. 2.- The defendant Nombre01, taking advantage of his status as forest regent (regente forestal) and public certifying officer (fedatario público), inserted false information into a public document, specifically the certificate of origin, by stating that the harvestable timber came from a plantation (...)”.

Notwithstanding the foregoing, this Chamber observes, as argued in the appeal, that the Court omitted analysis of a series of matters that were of crucial importance in establishing the alleged criminal conduct. First, to make the foregoing finding, it was necessary to prove that the devastated area constituted a forest under section 3(d) of the Ley Forestal, which literally provides: “d) Forest (Bosque): A native or indigenous ecosystem, whether disturbed or not, regenerated through natural succession or other forestry techniques, occupying an area of two or more hectares and characterized by the presence of mature trees of different ages, species, and sizes, with one or more canopies covering more than seventy percent (70%) of that area, and containing more than sixty trees per hectare having a diameter of fifteen or more centimeters measured at breast height (DAP).” Determining whether it met that condition was therefore necessary because this directly affected whether the State afforded protection to the devastated area, an issue that could not be disregarded when examining the statement made by the defendant in the certificate of origin.

The decisive issue was whether that statement was contrary to the legal system, which was not determined in this particular case; instead, the judgment was based on a series of imprecisions, as will be discussed. Regarding this particular issue, the court below indicated: “(...) Let us see: as to the offense of Ideological Falsification, the accused is not charged with having denied in the document the existence of a forested area, but with having asserted the existence of a plantation. We might say that although the assertion (sic) that a plantation existed may be closely related to the denial that a forest existed, one proposition is not necessarily the product of the other, since there are numerous possibilities as to what may have existed at the site. In other words, the false statement that the Public Prosecutor’s Office and the Procuraduría alleged the defendant had inserted was his certification, under the public trust vested in him by his office, that a plantation existed there; consequently, the prosecution’s theory had to be directed toward proving that this assertion was false, while the defense theory had to be directed toward proving that it was not false.

Both efforts did in fact occur, but the line of reasoning pursued by the parties and by the defendant himself in exercising his personal defense focused on the theory that sought to conclude, a contrario sensu, that only if the area could be established to be forest could it be concluded that it was not a plantation and that, accordingly, the statement could be characterized as false. The Court does not agree with that line of reasoning, because it is not true that the assertion that a plantation existed could be found false exclusively upon proof that the affected area was forest. Following this reasoning, the Court reached the conclusion that it was indeed proven that the statement made by defendant Nombre01 was false, but not because the existence of secondary forest (bosque secundario) in the area had been established with absolute certainty, but solely because the evidence established that a plantation had never existed there.

We must note, however, that although the Court was not absolutely convinced that a secondary forest had existed there, we were able to conclude that there was an extremely high probability that it had (...).” This Chamber notes, as evidenced by the quoted text, that the trial court committed a serious contradiction in the judgment because, although it deemed proven that defendant Nombre01, taking advantage of his status as forest regent and public certifying officer, inserted false information into a public document, specifically the certificate of origin, by stating that the harvestable timber came from a plantation, when setting forth the reasons for that conclusion it stated that they did not rest on the necessary proof that a secondary forest existed at the site, but instead inferred its nonexistence from the assertion that the evidence had established that a plantation had never existed there, without adequately explaining what was actually intended to be asserted.

From that standpoint, the judgment lacks sufficient grounds (infundamentado). Furthermore, the appellant is correct in arguing that the defense witnesses were not properly analyzed because, as recorded at folios 268 through 271 verso, Nombre07 testified: “(...) There was an area of pastureland, grazing land; at first there was an area with timber, but we converted it to grassland; we cut it by clear-cutting. Everything was felled. We had the option of planting saplings over the former stumps, and along the fences as well (...)”; and Nombre08 testified: “There were 54 hectares in total. I kept the Sardinal river plain cleared as pastureland and grazing land. I decided to clear the undergrowth (socolar) on 30 hectares to remove the timber and convert it to grassland. Clearing the undergrowth means clearing the small brush in order to plant grass and then fell the trees. (...) Years later, I had an accident and decided to replant it with timber trees, but not in rows; only one part by the river, consisting of approximately two hectares of laurel, and the remainder with botarrama, a little roble, the occasional fruit tree, areno, and pilón; they were planted mixed together because it was already grassland.

We even looked for the roots and parts of the trunks to protect them from the cattle, because it was grazing land, fenced and everything. (...) I know that he preserved the timber because on one occasion he told me that he was going to harvest the laurel area, I believe it was in two thousand eight or thereabouts, but he died after that. The entire property was converted into grazing land in approximately 78 (...)”. Both witnesses agreed that the entire property had been planted with grass and was replanted with timber trees; it bears noting that they had previously owned the property. Nevertheless, the trial court did not conduct any substantial analysis of this testimony, even though it stated that the witnesses’ testimony was truthful. Despite that finding, it concluded that the testimony did not prove the area was a plantation, without presenting logical reasons for reaching that conclusion, since it is insufficient merely to state that there was a strong possibility that no plantation existed at the site.

(See folio 280). This statement by the Court is wholly contradictory because, on the one hand, it indicates that the witnesses were telling the truth, but it must be recalled that they stated that the entire property had been planted with grass and that they subsequently replanted the site with various tree species. The inference drawn by the court below is therefore illogical because, having credited the witnesses’ statements on this central matter, which directly affects the facts deemed proven, it cannot find both that the witnesses were telling the truth and that no plantation existed at the site, since this is plainly contradictory and violates the rules of sound rational judgment (sana crítica racional). Similarly, the trial court stated that: “(...) the map appearing at folio 12 was submitted in the case, noting that although the witnesses state that the program used to prepare that map automatically highlights in green the areas corresponding to forest, the fact is that the program highlights forest plantations in the same color.

Although this statement is regarded as truthful by this Court, since even the prosecution witnesses acknowledged as much in response to questions from defense counsel, it is not conclusive for purposes of the decision because, although that map could establish that the affected area was in fact a plantation and that there was therefore no false statement in the questioned document (documento dubitado), the fact remains that, as will be seen below, the record contains numerous (sic) indicia (indicios) demonstrating that no plantation ever existed there, either before or at the time of the events. (...). We must note, however (sic), that although the Court was not absolutely convinced that a secondary forest had existed there, we were able to conclude that there was an extremely high probability that it had (...)”. This Chamber finds that the judgment is affected by contradictory reasoning (fundamentación contradictoria), because the Court presents two assertions or judgments that are mutually exclusive.

Given the issue being adjudicated, it was unavoidably necessary to determine whether the timber extracted came from a forest or a plantation, since this directly affected the core of the conduct attributed to the accused; that is, inserting false statements into a public or authentic document. Logically, when the facts are analyzed in context, it is clear that the two cannot coexist: the area was either a forest, whether primary or secondary, or a plantation.

Upon analyzing the judgment as a whole, it is evident that, although the court below stated that no forest plantation (plantación forestal) existed at the site and that, consequently, the defendant’s statement in the certificate of origin was false, and analyzed the account given by the witness Nombre08, who testified that he had planted trees on the property he owned, the trial court nevertheless rejected that account on the premise that whoever planted the trees found in the affected area never did so with the intention of producing timber. It rejected that possibility because, in its view, the trees had not been properly maintained and the witness had sold the property without harvesting that resource; it therefore ruled out the primary purpose required by the definition of a forest plantation. However, that conclusion is at odds with the rules of sound human understanding because, although timber production may have been the intention when developing a project of that kind, it clearly is not the only possible intention, since nothing would have prevented the witness from deciding to sell the property in that condition, particularly because he himself testified that he had extracted timber from the farm on previous occasions.

The court below also rejected that possibility based on the testimony of the witness Nombre07, who stated that the farm was used for livestock raising and agriculture, and therefore reasoned that it was not plausible that a forest plantation would also have been maintained there for the purpose of producing timber, because the crops and animals would not have allowed it. Yet, whether to accept or reject the defense theory, it did not analyze the witnesses’ clear statements that they planted the trees beside and on top of the stumps of trees that had been felled when the entire property was planted with grass, precisely to protect them from the livestock. Another relevant aspect is that the court itself reached the following conclusion: “(...) the MINAE report contains inconsistencies and weaknesses that make it unreliable in supporting the proposition that a forest existed, primarily because it is unclear which trees were counted for the sample and whether all of them had the diameters required by the aforementioned definition; this does not therefore mean that the Court deemed it proven that it was instead a forest plantation, since all the evidence gathered and reproduced leads to the opposite conclusion, namely, that it was not a plantation.” Notwithstanding the foregoing, the trial court did not clearly state the logical reasons that led it to conclude that the area was not a forest plantation; rather, it merely used dogmatic assertions and legal syllogisms without conducting a genuine analysis of the evidence before it.

Por tanto, the ruling thus rendered is contradictory, because the Judges’ assertions were not developed within a logical chain of reasoning upon which the decision could be based. It must be borne in mind that a criminal judgment, as a logical and legal unit, cannot contain contradictory statements or reasoning, as established by Article 142 of the Code of Criminal Procedure, which provides that the statement of reasons (fundamentación) for the judgment must be clear and precise, while the third paragraph of that same article provides: “No statement of reasons exists when the rules of sound judicial assessment (sana crítica) have not been observed with respect to evidence or evidentiary elements of decisive value.” In the present case, the failure to analyze evidence concerning core issues related to the alleged act resulted in contradictory findings of fact, thereby rendering the judgment null and void; accordingly, the proper course is to sustain the grounds and remand the case for new proceedings.

Fourth ground. The appellant claims that due process was violated because no statement of reasons was provided for the civil action; the complainant is correct. As stated in the preceding recital (considerando), because the judgment did not determine whether the place from which the timber was extracted was a forest or a forest plantation, the trial court could not establish a causal nexus between the defendant’s conduct in stating in the certificate of origin that the timber to be extracted came from a plantation and the environmental damage caused by felling the trees. Indeed, it is unreasonable to enter an acquittal for the offenses of Illegal Timber Harvesting on Private Property and Timber Harvesting in a Protected Zone on the ground that no evidence capable of establishing criminal liability for those acts was presented during the adversarial proceedings, as the trial court held in its judgment, while at the same time finding the causation necessary to establish civil liability for the offense of Ideological Falsehood (Falsedad Ideológica), even though, as stated in the preceding recitals, it was essential in this case, in order to establish the defendant’s criminal liability, for the court below to determine with certainty whether the devastated area was a forest or a forest plantation.

This directly affects civil liability because, depending on that conclusion, the causal nexus either could or could not be established, since it was not proven with certainty that the logged area was a forest rather than a plantation; therefore, it cannot be asserted with the required degree of certainty that the accused directly caused the unlawful logging of a forest area. Consequently, the appellant’s argument regarding causation is legally well-founded, because that inseparable relationship between the accused’s conduct and the cutting of the trees cannot be established. It is clear that, in view of the manner in which this criminal appellate court is ruling, such a determination was not possible because of the contradictory statement of reasons in the ruling under appeal. Por tanto, the ground is sustained, and the judgment is vacated insofar as its civil component orders the civil defendant Nombre01 to pay for the environmental property damage caused.

For the foregoing reasons, the ground is sustained. B. Appeal by the defendant Nombre01. SOLE GROUND: “Objection to the assessment of the evidence. Violation of the rules of rational sound judicial assessment, specifically the logical rule of derivation (the subprinciple of derivation or sufficient reason), closely linked to a lack of analytical and intellectual reasoning, due to an absence of reasoning and to insufficient and contradictory reasoning in the judgment.” He states that the trial court’s conclusion is unsupported by documentary, expert, or testimonial evidence or by any technical criterion, and that it contravenes environmental regulations and the witnesses’ testimony, because he never committed the offense of Ideological Falsehood. He asserts that the information he entered in that certificate was true and supported by technical criteria, and that the prosecution witnesses and former owners of the farm where the logging took place, Nombre07 and Nombre08, stated that they had planted those trees; therefore, if he stated that the trees were from a plantation, it was because they were.

This was precisely what he stated in his testimony as the defendant, forest supervisor (regente forestal), and expert in the field. He states that he testified about technical matters such as plantations, Article 28 of the Ley Forestal concerning tree-felling permits, agroforestry systems (sistemas agroforestales), individual plantations (plantaciones individuales), and the fact that the law does not require a felling permit. He says that he was acquitted in the disciplinary proceedings conducted by the Colegio de Ingenieros Agrónomos concerning these same events, because the technical inspections could not rule out that what existed at the site was a forest plantation. When individuals plant using their own resources, the area is not considered a forest and therefore does not require a felling permit, which is why he did not enter any false information in the document. He further emphasizes that the trial court deemed it proven that the logged area was not a forest, meaning that it must necessarily have been something else, whether a plantation, brushland (charral), or otherwise.

The court did not explain why it ruled out the possibility that the area was a plantation, as he had explained at length in his testimony. He asserts that the witnesses Nombre07 and Nombre08 stated that they planted beside and on top of the stumps; however, nothing in any expert assessment or inspection conducted by Minae agents, or in the testimonial evidence, indicates that the stumps were also taken into account. If the stumps were counted as trees, the sample would be inaccurate because it would show a greater number than actually existed. The court states that no plantation existed because there were more than 500 trees per hectare; however, if the trees were planted, no such limitation exists. He contends that the court rejected his testimony without relying on technical criteria that were valid from an environmental and legal standpoint. Furthermore, it did not credit the defense witnesses and instead credited only those from Minae, even though the judgment accepts that his witnesses told the truth when they stated that, after converting the farm into pastureland, they proceeded to plant trees.

The appellant therefore questions why the court found that he had made a false statement by recording that the area was a plantation, when it was immaterial whether the former owners planted the trees for timber production because the Law does not require that purpose, as a plantation may exist for a different purpose. He reiterates that whether the person who planted the trees ever intended to produce timber has no bearing on the technical definition of a plantation. He says that, upon reviewing the certificate of origin, the box for tree plantation must be checked under individual plantation, and doing so is not unlawful. He asserts that the court below reversed the burden of proof (carga de la prueba), thereby violating due process. He states that his technical opinion as a Forestry Engineer and Forest Supervisor should have been afforded greater evidentiary weight than the statements of the Minae officials, who did not have that professional status or academic degree, and that no expert assessment existed to discredit his testimony.

The claim is sustained. Given that Judges Mena Artavia and Jiménez Fernández, by majority vote, with Judge Montero Mena dissenting, ruled in decision number 1328, at seventeen twenty-nine hours on the twenty-fifth of September of two thousand fifteen, to admit and adjudicate the appeal filed, the Court proceeds accordingly. In his sole claim, the defendant objects to the assessment of the evidence and alleges a violation of the rules of rational sound judicial assessment, specifically the logical rule of derivation (the subprinciple of derivation or sufficient reason), closely linked to a lack of analytical and intellectual reasoning and an absence of reasoning, which he considers insufficient and contradictory. He bases his argument on the fact that the trial court’s conclusion is unsupported by documentary, expert, or testimonial evidence or by any technical criterion, and contravenes environmental regulations and the testimony of Nombre07 and Nombre08. He argues that he never committed the offense of Ideological Falsehood.

As stated in the second recital (considerando segundo) of this judgment, to which the party is referred, the facts deemed proven by the a quo must be taken into consideration for the proper resolution of this matter, particularly the second, which states: “(...)2.- Taking advantage of his status as forestry manager (regente forestal) and public certifying officer (fedatario público), the accused, Nombre01, inserted false information into a public document, specifically the certificate of origin (certificado de origen), by stating that the harvestable timber came from a plantation (...)”. However, the party’s arguments are correct because, as previously analyzed, it was essential to establish conclusively that the devastated area was a forest within the meaning of section 3(d) of the Ley Forestal. The appellant is therefore correct in stating that the decision is not supported by technical evidence, since there could be no remaining trace of doubt regarding the accused’s responsibility.

The judgment fails to address this circumstance adequately, even though it directly affected whether the State afforded protection to the devastated area and was important in establishing the falsity of the accused’s statement in the certificate of origin that the trees came from a plantation. The judgment, however, is entirely devoid of reasoning on that point. The judgment as rendered is contradictory. On the one hand, it asserts that, with respect to the offense of false statements in a public document (Falsedad Ideológica), the defendant was not accused of denying in the document the existence of a forested area, but rather of affirming the existence of a plantation. As the a quo indicates, affirming the existence of a plantation may be closely related to denying the existence of a forest, but one proposition is not necessarily a consequence of the other, since numerous possibilities exist as to what may have been present at the site.

Nevertheless, the matter cannot be presumed, as the Trial Court did; rather, in criminal proceedings, the facts must be established with certainty. It is therefore impossible to reach a criminal conviction based on assumptions. Accordingly, it is neither logical nor reasonable to state that, although the existence of an area of secondary forest was not established with absolute certainty and it was established only that a plantation had never existed there, and although the Court was not absolutely convinced that a secondary forest had existed there, it could nevertheless conclude that there was an extremely high probability that this had been the case. Such assertions are plainly unreasonable, because the issue is not whether there is a high probability, but whether no room for doubt remains. That degree of conclusiveness cannot be derived from the challenged decision. As is evident from the text of the judgment, the Trial Court committed a serious contradiction in its ruling: although it deemed proven that, taking advantage of his status as forestry manager and public certifying officer, the accused, Nombre01, inserted false information into a public document, specifically the certificate of origin, by stating that the harvestable timber came from a plantation, when explaining the reasons for reaching that conclusion, it clearly did not base them on the necessary proof that a forest existed at the site.

Instead, it inferred the forest’s existence from the finding that a plantation had never existed there, without adequately explaining what was actually proven. The accused is therefore correct in arguing that the assessment of the evidence (valoración de la prueba) violates the rules of sound rational judgment (sana crítica racional), specifically the logical rule of derivation (regla de lógica de derivación), because one fact cannot be affirmed merely from the denial of another. By reasoning in this manner, the Trial Court commits a fallacy, thereby violating section 142 of the Código Procesal Penal. Moreover, the decision does indeed suffer from insufficiency of evidence (insuficiencia probatoria), as stated in the second recital, to which the parties are referred to avoid repeating arguments; the reasoning set forth there applies equally to this portion of the judgment. As indicated, the defense evidence (prueba de descargo), specifically the testimony of Nombre07 and Nombre08, was not properly analyzed—that is, harmoniously and comprehensively, rather than selectively as the Court did.

It should be noted that if the witnesses, who at the relevant time owned the property, stated that the entire property had been planted with grass and had subsequently been replanted with timber trees, the Court clearly committed the defect identified by the appellant. Although it stated that the witnesses’ testimony was truthful, it nevertheless concluded that this did not prove that the area was a plantation, without providing logical reasons for rejecting their statements. It was not sufficient to assert that there was a substantial possibility that no plantation existed at the site; valid reasons had to be given for discrediting the testimony. This directly affects the judgment’s proper statement of reasons (debida fundamentación del fallo). The Trial Court could not assert that the witnesses were telling the truth while simultaneously refusing to credit their testimony, because that is plainly contradictory and violates the rules of sound rational judgment.

In this case, it was necessary to determine whether the timber extracted came from a forest or a plantation, since that determination directly affected the core of the conduct attributed to the accused—namely, inserting false statements into a public or authentic document. That determination, however, was not made clear in the judgment. Although the a quo states—without supporting that assertion with evidence—that no forest plantation existed at the site and concludes that the accused’s statement in the certificate of origin was false, it bases its theory on the premise that whoever planted the trees found in the affected area never intended to produce timber and that, because this intent (animus) was absent, the offense was established, since, in its view, the plantation had not been properly maintained and the owner had also sold the property without exploiting that resource. That conclusion is erroneous because, although section (f) of the Ley Forestal provides: “Forest plantation (Plantación forestal): Land measuring one or more hectares, cultivated with one or more forest species, the principal, but not sole, purpose of which shall be timber production,” that purpose does not necessarily mean that other motivations cannot coexist with it.

Although timber production may be the intention when a project of that kind is undertaken, it is not a sine qua non requirement, and other purposes may coexist with it. It could even be the case that timber production was initially the reason for the plantings but that, over time, the owner changed their mind; this would not cause the forest plantation to cease to exist. The same is true if the property is no longer maintained: that circumstance alone cannot cause the plantation to disappear and become a forest, since its original character does not derive from primary or secondary forest, but from human action that altered its condition. Por tanto, the decision thus rendered is contradictory and violates the requirement that the judgment be properly reasoned under section 142 of the Código Procesal Penal; accordingly, the proper course is to grant this ground of appeal and order a remand for new proceedings (reenvío para nueva sustanciación).

For the foregoing reasons, this ground of appeal is granted. Por tanto, I vote to grant the challenges, vacate the judgment, and remand the matter to the appropriate Court so that, with a newly constituted panel, it may conduct a new trial.-

POR TANTO:

By a majority vote, the appeals filed by Jenny Valverde Jiménez, counsel for the public defense of Nombre01, and by the accused in the exercise of his right to conduct his own defense are denied. Judge Montero Mena dissents and grants the appeal from the judgment filed by Jenny Valverde Jiménez, counsel for the public defense of Nombre01, solely with respect to the offense of making a false statement in a public document (Falsedad Ideológica) of which he was convicted. She sustains the ground for appeal and vacates the judgment with respect to the civil portion ordering the civil defendant, Nombre01, to pay for the material environmental damage caused. In all other respects, the judgment remains undisturbed. Resolución: 2015-1416 Resolución: 2015-1416 TRIBUNAL DE APELACIÓN DE SENTENCIA PENAL. Segundo Circuito Judicial de San José. Goicoechea, a las diecisiete horas cuarenta y cinco minutos, del veintiuno de octubre de dos mil quince.- RECURSO DE APELACIÓN interpuesto en la presente causa seguida contra Nombre01, mayor, casado, costarricense, cédula de identidad número CED01, nacido en Alajuela el 24 de abril de 1960, de oficio regente forestal, hijo de Nombre02 y Nombre03, vecino de Limón, Guápiles, Dirección01.; y Nombre04, mayor, casado, costarricense, cédula de identidad número CED02, nacido en San José el 11 de julio de 1965, de oficio comerciante, hijo de Nombre05 y Nombre06, vecino de Heredia, Sarapiquí, Horquetas, frente a la escuela El Cruce, casa mixta de color celeste; por el delito de INFRACCIÓN A LA LEY FORESTAL Y OTROS, en perjuicio LOS RECURSOS NATURALES Y OTRO. Intervienen en la decisión del recurso, las juezas Elizabeth Montero Mena, Kathya Jiménez Fernández, y el juez Giovanni Mena Artavia. Se apersonaron en esta sede la licenciada Jenny Valverde Jiménez, en calidad de Defensora pública del imputado Nombre01,; el encartado Nombre01, en documento autenticado por el licenciado Víctor Manuel Loría Guadamuz, y la licenciada Samantha Fonseca Ureña, representante del Ministerio Público, Fiscalía Adjunta de Sarapiquí.

RESULTANDO:

I.Que mediante sentencia número 45-2015, de las diecisiete horas treinta minutos, del catorce de mayo de dos mil quince, el Tribunal de Juicio de Heredia, Sede Sarapiquí, resolvió: "POR TANTO: De conformidad con lo expuesto y con sustento en los artículos 39 y 41 de la Constitución Política, 05 inciso 6) y 08 de la Convención Americana Sobre Derechos Humanos, 14 del Pacto Internacional de Derechos Civiles y Políticos, 01, 22, 30, 31, 39, 45, 50, 51, 59, 71, 73, 74, 110, 367 y 372 del Código Penal; 01, 06, 09, 45, 75, 111, 142, 182 a 184, 265 a 270 y 324 a 368 del Código Procesal Penal, 1045 del Código Civil, 122 inciso 2) y 124 de las de Reglas Vigentes sobre Responsabilidad Civil del Código Penal de 1941, 01, 02, 16 inciso a), 39 y 42 del Decreto Ejecutivo Número 36562-JP de la Presidencia de la República y el Ministerio de Justicia y Paz sobre Honorarios por Servicios Profesionales de la Abogacía, 01, 03 incisos d), f), y g), 21, 28, 56, 58 inciso a) y 61 incisos a) y c) de la Ley 7575 o "Ley Forestal", 22 y 23 del Reglamento a la Ley Forestal, este Tribunal por unanimidad de votos emitidos, declara a Nombre01 autor responsable de UN DELITO DE FALSEDAD IDEOLÓGICA cometido en perjuicio de LA FE PÚBLICA, delito por el cual se le impone como pena el tanto de CUATRO AÑOS DE PRISIÓN.

Sanción que deberá descontar en el centro carcelario que los reglamentos penitencia rios indiquen, previo abono de la preventiva sufrida, si la hubiere. En atención al monto de la sanción impuesta, y a que registra antecedentes penales vigentes, no se le otorga al sentenciado el Beneficio de Ejecución Condicional de la Pena. Se ABSUELVE de toda pena y responsabilidad a Nombre01 y Nombre04 por los delitos de USO DE DOCUMENTO FALSO, APROVECHAMIENTO ILEGAL DE MADERA EN PROPIEDAD PRIVADA, CAMBIO DE USO DE SUELO, Y APROVECHAMIENTO ILEGAL DE MADERA EN ZONA DE PROTECCIÓN que en perjuicio de LA FE PÚBLICA y LOS RECURSOS NATURALES DEL ESTADO se les han venido atribuyendo. Se declara CON LUGAR la acción civil resarcitoria incoada por EL ESTADO en contra del demandado civil Nombre01 y en consecuencia se condena a dicho demandado civil a pagar al actor el DAÑO MATERIAL DE ÍNDOLE AMBIENTAL reclamado, el cual se fija en la suma de OCHO MILLONES SETECIENTOS TREINTA Y SIETE MIL CUATROCIENTOS OCHENTA Y DOS COLONES (¢8,737,482,00) más los intereses correspondientes a tal suma al día de hoy para un total de TRECE MILLONES CUARENTA Y SEIS MIL DOSCIENTOS CUARENTA Y CINCO COLONES CON CUARENTA Y NUEVE CÉNTIMOS (¢13,046,245.49).

Son las costas personales y procesales de la querella y la acción civil resarcitoria incoadas a cargo del demandado y a favor del ESTADO, fijándose el monto de las costas personales por la querella en el tanto de SEISCIENTOS MIL COLONES (¢600,000.00) y el rubro de las costas personales de la acción civil incoada en el tanto de DOS MILLONES SEISCIENTOS NUEVE MIL DOSCIENTOS CUARENTA Y NUEVE COLONES CON OCHO CÉNTIMOS (¢2,609,249.08). Las costas procesales de ambas, la querella y la acción civil se deber án liquidar en la vía civil correspondiente. Se declara SIN LUGAR la acción civil resarcitoria incoada por EL ESTADO en contra del demandado civil Nombre04, demanda que se resuelve en lo que a él respecta sin especial condenatoria en costas por haber existido razón plausible para litigar. Se declara SIN LUGAR la excepción de Prescripción, y CON LUGAR las excepciones de Falta de Legitimación Activa y Pasiva y Falta de Derecho incoadas todas éstas por la tercera demandada civil HACIENDA PEÑAS GRANDES S.A., y por ende se DECLARA SIN LUGAR la acción civil resarcitoria incoada por EL ESTADO en contra de dicha persona jurídica.

Por no haber existido razón plausible para litigar, son las costas personales y procesales de tal acción a cargo del Estado y a favor de la empresa demandada, fijándose el monto de las costas personales indicadas en el tanto de UN MILLÓN SETECIENTOS TREINTA Y NUEVE MIL CUATROCIENTOS NOVENTA Y NUEVE COLONES CON TREINTA Y NUEVE CÉNTIMOS (¢1,739,499.39). Las costas procesales referidas de dicha acción civil se deberán liquidar en la vía civil correspondiente. Son el resto de los gastos del proceso a cargo del Estado. Se ordena EL COMISO a favor del ESTADO de la motosierra marca Husqvarna, color naranja, serie , con su respectiva hoja y cadena, así como de la madera decomisada al endilgado Nombre04. Bienes que firme el fallo se ordena poner a la orden de la Administración Forestal del Estado. Firme esta sentencia inscríbase en el Registro Judicial y remítanse los testimonios de estilo ante el Instituto Nacional de Criminología y el Juzgado de Ejecución de la Pena.

Oportunamente archívese el expediente y sáquese del libro general de entradas del despacho. Mediante su lectura integral para la cual se señalan las once horas del próximo veintiuno de mayo del año dos mil quince, notifíquese. (sic)".

II.Que contra el anterior pronunciamiento, la licenciada Jenny Valverde Jiménez, Defensora pública del imputado Nombre01, y el encartado Nombre01, en documento autenticado por el licenciado Víctor Manuel Loría Guadamuz, interpusieron recurso de apelación.

III.Que verificada la deliberación respectiva de conformidad con lo dispuesto por el artículo 465 del Código de Procesal Penal, el Tribunal se planteó las cuestiones formuladas en el recurso de apelación.

IV. Que en los procedimientos se han observado las prescripciones legales pertinentes

Redacta la jueza de Apelación de Sentencia Jiménez Fernández; y,

CONSIDERANDO:

I.Recursos de apelación: (i) La licenciada Jenny Valverde Jiménez, Defensora Pública de Nombre01, interpuso recurso de apelación de sentencia en contra de la resolución N° 45-2015 del T ribunal Penal de Heredia, sede Sarapiquí, de las once horas del catorce de mayo del 2015. PRIMER MOTIVO: "Inconformidad con la valoración de la prueba". Refiere que el tribunal estableció que se configuró el delito de falsedad ideológica, debido a que se tuvo por demostrado que en el certificado de origen se introdujo un dato falso, "que los árboles eran de plantación"; sin embargo, para arribar a dicha conclusión los jueces incurrieron en el vicio de preterición de prueba, debido a que omitieron analizar elementos probatorios de carácter esencial, testimonios ofrecidos por la defensa material del imputado, reclama que el el tribunal de mérito no examina si efectivamente los árboles podrían ser plantados individualmente.

Dice que se omite valorar la tesis defensiva del imputado en el sentido de que la ausencia de un espacio específico en el documento para indicar que eran árboles plantados individualmente, por lo que su actuación resulta válida al haberlos incluido como tales en el certificado de origen. Sin embargo a pesar de que el fallo da crédito acerca de la plantación individual de los árboles, se limita a analizar si eso puede constituir una plantación forestal en los términos del artículo 3 de la Ley Forestal. Indica que el tribunal concluye que los árboles plantados individualmente son precisamente aquellos que una persona siembra sin una expectativa de producción maderable, empero es falso, sostener que la ausencia del objetivo de producción de madera, define al árbol plantado individualmente. Que la plantación por no constituir un bosque queda fuera de la protección de la Ley Forestal y que si se hubiera valorado en sentencia la versión de su defendido y sus testigos, en el sentido de que los árboles fueron plantados de manera individual, no se podría concluir que estos no se podían incluir en el certificado de origen como plantación, máxime que el formulario no contiene un espacio especifico para ese efecto, pues la plantación individual no es objeto de tutela estatal.

SEGUNDO MOTIVO: " Inconformidad con la valoración de la prueba". Dice que no es posible acreditar el elemento objetivo del tipo de Falsedad Ideológica, documento público, pues, el certificado de origen en el que se habría insertado tal circunstancia nunca fue traído al proceso, por lo cual debió absolverse al imputado. TERCER MOTIVO: "Inconformidad con la fundamentación jurídica". Refiere que se aplicó erróneamente al artículo 367 del Código Penal, pues la presentación ante la Administración Forestal del MINAET, del certificado de origen de la madera en que supuestamente se habría introducido información falsa, nunca podría haber generado perjuicio. Además de que la acusación no describe fecha alguna en relación con la ejecución del delito de Falsedad Ideológica, ni con la presentación del certificado de origen, por lo cual el documento cuestionado no pudo tener la potencialidad de causar perjuicio, pues las autoridades tenían conocimiento previo de la situación de la finca, por lo que no pudo su defendido inducirlos de manera fraudulenta a emitir un permiso.

Pues, se tuvo por probado que, lo que hizo el sindicado fue un certificado de origen que presentó al MINAET, para obtener un permiso de aprovechamiento de la madera, empero no se pudo probar, que él hubiera participado en la extracción, ni que documento alguno emitido por este haya sido utilizado para tal efecto. CUARTO MOTIVO: " Violación al debido proceso por falta de fundamentación en relación con la acción civil". Dice que el tribunal de sentencia tiene establecido la existencia de un nexo causal entre el accionar del imputado al introducir un dato falso en un certificado de origen, y el daño ambiental ocasionado con la tala de árboles, a pesar de que lo absolvió por no tenerse por demostrada su participación el la tala. Sin embargo, es contradictorio el fallo, pues, no es posible sostener que el acusado es responsable civilmente de daño, y a la vez, decir que él no lo ocasionó mediante la tala.

Además de que la resolución es ayuna de fundamento probatorio que acredite el nexo entre el daño generado con la corta de los árboles y la falsedad ideológica atribuida al imputado. Solicita declarar con lugar los motivos y decretar la ineficacia del fallo en torno a la condenatoria civil. (ii) Recurso del imputado Nombre01. ÚNICO MOTIVO: "Inconformidad con la valoración de la prueba. Violación de las reglas de la sana crítica racional, concretamente la regla de lógica de derivación (sub principio de derivación o razón suficiente), vinculado estrechamente a una falta de fundamentación analítica e intelectiva, por ausencia de fundamentación, fundamentación insuficiente y fundamentación contradictoria del fallo". Refiere que la conclusión del tribunal de sentencia no se encuentra respaldada en prueba documental, pericial o testimonial, ni en ningún criterio técnico, contraviniendo la normativa ambiental y el dicho de los testigos, pues, él nunca incurrió en un delito de falsedad ideológica.

Indica que la información que inserto en dicho certificado, es verdadera, sostenida con criterios técnicos, además de que los testigos de cargo y ex dueños de la finca (Nombre07 y Nombre08) donde se realizó la tala, afirmaron que ellos habían sembrado dichos árboles, por lo que si afirmó que los árboles eran de plantación era porque así fue. Tal y como lo indicó en su declaración, como imputado, regente forestal y experto en la materia. Refiere que declaró acerca de tópicos técnicos como plantación, artículo 28 de la Ley Forestal, referida al tema de permiso de corta de árboles, sistemas agroforestales, plantaciones individuales, la ley no obliga a contar con permiso de corta. Dice que sobre estos mismos hechos fue absuelto en el proceso disciplinario que se llevó a cabo en el Colegio de Ingenieros Agrónomos, ya que a partir de las inspecciones técnicas no se pudo descartar que lo existía en el lugar fuera una plantación forestal, cuando personas siembran con recursos propios, no se considera bosque por ello no requiere permiso de corta y es por ello que no insertó ningún dato falso en el documento.

Además resalta que el tribunal de sentencia tiene por acreditado que el área talada no es bosque, indefectiblemente es otra cosa, ya sea plantación, charral etc. No se razonó porque se descarta que el área sea una plantación, tal y como lo explicó ampliamente en su declaración. Afirma que los testigos Nombre07 y Nombre08, señalaron que ellos sembraron a las par de troncos y sobre ellos, sin embargo, en ninguna pericia o inspección realizada por agentes del Minae, o en la prueba testimonial se extrae que se haya tomado en cuenta los troncos también, puesto que si tomaron estos como árboles, el muestreo no estaría correcto, puesto que daría una cantidad mayor a la que realmente existe. El tribunal afirma que no existe plantación pues existían más de 500 árboles por hectárea; sin embargo, si son plantados no existe limitación. Refiere que el tribunal desecha su declaración sin sustentarse en criterios técnicos y válidos desde el punto de vista ambiental y en la Ley.

Además de que no se da crédito a los testigos de descargo, sino únicamente a los del Minae, a pesar de que el fallo acepta que sus testigos dicen la verdad al afirmar que luego de haber transformado la finca en un área de pasto, procedieron a sembrar árboles, y entonces porqué, se cuestiona el impugnante se afirmó que incurrió en una falsedad al consignar que se trataba de una plantación, no siendo trascendente si los ex dueños sembraron los árboles para la producción de madera ya que ello no lo exige la Ley, pues, para que exista una plantación la finalidad puede ser distinta a la anterior. Reitera que si la intención de quién sembró los árboles nunca fue la producción de madera, ello no tiene nada que ver con la definición técnica de plantación. Dice que si se revisa el certificado de origen, en plantación individual hay que marcar la casilla de plantación de árboles, que hacer eso no es ilegal.

Refiere que el a quo invierte la carga de la prueba violentando el debido proceso. Dice que su criterio técnico como Ingeniero Forestal y Regente Forestal debían tener mayor peso probatorio que lo expresado por los funcionarios del Minae que no tienen esa condición ni grado académico, además de que no existe ningún peritaje para desacreditar su dicho. Solicita decretar la nulidad del fallo y se ordene el reenvío para nueva sustanciación. Posición del Ministerio Público: La Fiscal de Sarapiquí, Samantha Fonseca Ureña, contestó la audiencia conferida. Solicitó que se rechazara el recurso, pues, el tribunal de juicio valoró correctamente la prueba, la sentencia se encuentra debidamente fundamentada.

II.Los recursos de apelación no son atendibles. Por la conexidad de los temas planteados en ambas impugnaciones, todos relacionados con la valoración de la prueba y determinación de los hechos probados, se conocen conjuntamente y se declaran sin lugar. Se advierte que ante la no impugnación de la sentencia absolutoria dictada en este asunto, se mantiene incólume lo resuelto en relación con los delitos de uso de documento falso, aprovechamiento ilegal de madera, cambio de uso de uso suelo y aprovechamiento ilegal de madera en zona de protección, así como relacionado con la situación jurídica (absolutoria penal) del coimputado Nombre04. A. Sobre los extremos penales. De acuerdo con la acusación fiscal y los hechos demostrados en la sentencia escrita, visible de folio 243 a 297, así como en la resolución que la complementa, de folio 300; a Nombre01 se le atribuyó, y demostró, que: " 1- En una fecha indeterminada, pero antes y cerca del 27 de Mayo de 2009, dentro de la finca propiedad de Hacienda Peñas Grandes, ubicada en Puerto Viejo de Sarapiquí, propiamente en la localidad de La Esperanza, fueron talados doscientos cuarenta y siete árboles de las especies botarrama, roble coral, areno guabo, arenillo, gallinaza y gavin con diámetros comprendidos entre los 19 y 72 centímetros, siendo que cuatro de los árboles de la especie botarrama se encontraban en zona de protección de una quebrada, lo anterior sin que se contara con permiso alguno de la Administración Forestal del Estado. 2- El imputado Nombre01 aprovechando su condición de regente forestal y fedatario público, insertó información falsa en un documento público, propiamente el certificado de origen, al afirmar que la madera aprovechable era de plantación. 3- El imputado Nombre04 presentó el certificado de origen supra citado ante la oficina de la Administración Forestal del Estado" (cfr. f. 272).

Con ocasión de estos hechos, se le condenó civilmente por la acción civil resarcitoria incoada por El Estado a pagar el daño ambiental que se fijó en la suma de OCHO MILLONES SETECIENTOS TREINTA Y SIETE MIL CUATROCIENTOS OCHENTA Y DOS COLONES (¢8,737,482,00) más los intereses correspondientes a tal suma al día del dictado de la sentencia, que ascienden a la suma de TRECE MILLONES CUARENTA Y SEIS MIL DOSCIENTOS CUARENTA Y CINCO COLONES CON CUARENTA Y NUEVE CÉNTIMOS (¢13,046,245.49), más las costas personales y procesales de la querella y la acción civil resarcitoria, fijándose por la primera el monto de las costas personales en la suma de SEISCIENTOS MIL COLONES (¢600,000.00) y el rubro de las costas personales de la acción civil incoada en el tanto de DOS MILLONES SEISCIENTOS NUEVE MIL DOSCIENTOS CUARENTA Y NUEVE COLONES CON OCHO CÉNTIMOS (¢2,609,249.08). Contrario a lo alegado y apreciado por los impugnantes, a tales conclusiones arribaron los juzgadores, a partir del análisis conjunto y minucioso de la prueba testimonial (Nombre09, Nombre10, Nombre07, y Nombre08); declaración del acusado; y la documental incorporada (Dirección02 del Ministerio de Ambiente, Energía y Telecomunicaciones, de folios 1 a 10.

Copias de la resolución final del proceso disciplinario del Colegio de Ingenieros Agrónomos de Costa de Rica de folios 221 a 232. Documento confeccionado por el imputado Nombre01 de folio 235). Es criterio de la mayoría que conforma esta Cámara, que el análisis detallado y exhaustivo del elenco probatorio debidamente incorporado a debate, superó cualquier duda que pudiese derivarse respecto de la autoría del acusado Nombre01 en el delito de falsedad ideológica.

Tal como lo expuso el Tribunal de instancia " de los testimonios tanto de Nombre09 como de Nombre10 se extrae un hecho que es indubitable, y es que el hecho efectivamente acaeció, es decir es indudable frente a la simple lectura del informe y con el respaldo de las declaraciones de estos testigos en debate, que la tala, el aprovechamiento de los doscientos cuarenta y siete árboles en el sitio, y el cambio de uso del suelo efectivamente sucedieron" (cfr. f. 274) y, aún cuando no es posible responsabilizar de tales acciones al encartado Nombre01, la prueba sí fue contundente para tenerlo como autor del delito de falsedad ideológica que se le atribuyó. El cuestionamiento esencial de los recurrentes, y la defensa material del acusado, ha estribado en que si no se demostró la existencia una área boscosa, y el imputado tampoco la negó pues se limitó a marcar en la fórmula que esa zona correspondía a una plantación (ya que no había otra alternativa coincidente con la realidad del terreno evaluado), entonces, la inexistencia de un peritaje que diga lo contrario, unido al conocimiento científico y técnico del acriminado validan la afirmación de que se estaba ante una "plantación" y esa es la razón por la que no se consignaron datos falsos en el documento cuestionado.

No obstante, con una ponderación correcta de los elementos probatorios, a los que se hizo extensa referencia en el fallo recurrido, primero se tuvo por acreditado que Nombre01, por el cargo público que ostentaba en el MINAE reunía la condición de fedatario público; segundo, que el documento que emitió era de naturaleza pública; y tercero que la afirmación consignada en el mismo era falsa, pues aunque no quedó demostrado, indubitablemente, la existencia de bosque (que con base en otros elementos pudo presumirse), sí se probó que en el lugar nunca existió una plantación, que fue la característica de la que dio fe el encartado con sus afirmaciones, y que provocó que se talaran la especies existentes en la zona, sin contarse con un debido plan de manejo, y causándose el daño ambiental reclamado, también reconocido en el fallo impugnado. Destacó el a quo "que el propio co imputado Nombre01 afirmó que él había sido buscado por el coencartado Nombre04, por su condición de regente forestal para que valorara el terreno que se pretendía explotar, dicho de otro modo, Nombre04 buscó un profesional en la materia para que determinara si el área a explotar era plantación, era bosque o en que condición podía encasillarse, y de la prueba reproducida en debate se concluye también como lo analizaremos más adelante que falsamente el imputado afirmó en tal documento que sí era un área de plantación y que por tanto no requería de tramitarse ningún plan de manejo de área de bosque y que con la emisión del certificado de origen bastaba para su aprovechamiento (...) Cabe resaltar un dato de particular importancia en el debate, y es que el tema probando parecía ser el determinar si el área afectada era bosque secundario o no, pero lo cierto del caso es que no se imputa al encartado haber negado en el documento la existencia de un área boscosa, sino haber afirmado la existencia de una plantación.

(...) En otras palabras la afirmación falsa que el Ministerio Público y la Procuraduría atribuían como la que insertó el imputado es que aseguró bajo la fe pública que su cargo le confiere que allí existía una plantación (cfr. f. 276-777, el subrayado es propio). En forma detallada explicó el Tribunal, también, una a una las razones por las que quedó demostrado que la afirmación del imputado Nombre01 fue falsa, al tiempo que desvestía su coartada. Refirió que desde un inicio, el informe del MINAE estableció que ellos se apersonaron al área afectada y realizaron diversos procedimientos que a su criterio determinaban que el área impactada era bosque secundario, condición que verificaron extrapolando datos que los llevaron a concluir, matemáticamente, que en esas áreas existían más de 500 árboles por hectárea, entonces se cumplía con la previsión del concepto de bosque secundario del Decreto Ejecutivo Número 27998, que prevé la forma de llevar a acabo un manejo sostenible de bosques.

Que además, se contó la declaración de los anteriores propietarios de la finca, quienes además de explicar el proceso de reforestación que le aplicaron, coincidieron en que el fin no era el aprovechamiento de la madera (como ocurre con las plantaciones forestales). Para explicar la diferencia, entre esas plantaciones forestales y el bosque, expuso el a quo que no es lo mismo el concepto de plantación forestal que el concepto de árboles plantados individualmente, pues el primero responde al artículo 3 de la Ley Forestal, propiamente a un terreno de una o más hectáreas, cultivado de una o más especies forestales cuyo objetivo principal, pero no único, será la producción de madera; mientras que los árboles plantados individualmente son precisamente aquellos que una persona siembra sin una expectativa de producción maderable (caracterización que también refirió el acusado); por lo que, si la diferencia es clara, y también era reconocida por el acusado, no puede justificarse que la ausencia, omisión o falta de una casilla en la fórmula cuestionada y confeccionada por el acusado, lo llevara a marcar, antojadizamente, otra.

Se reiteró en el fallo, además, que no se trataba de una plantación, como lo afirmó falsamente el acusado, porque los testigos Nombre08 y Nombre07, propietarios anteriores de la finca examinada, coincidieron en que los árboles allí plantados, nunca fueron plantados con la intención de constituir allí una plantación ni su finalidad principal era la producción de madera; indicio más que llevó a los juzgadores a concluir que, en efecto, pudo existir un área de bosque secundario por sucesión, a raíz de la falta de mantenimiento que, por muchísimos años, operó. Para terminar de evidenciar la coartada del acusado dirigida a descartar su responsabilidad en los hechos, válidamente, contrastó el a quo las diversas versiones que ha rendido, e indicó "Vale sin embargo si rescatar un punto importante: cuando el imputado parece percatarse que sus alegatos no serán suficientes, brinda una segunda declaración o una ampliación de la primera, y en esta ocasión redirige sus esfuerzos, ya no a establecer que se trata de árboles plantados individualmente, ni a establecer que sí era efectivamente una plantación, tampoco a devaluar el informe mediante tecnicismos, sino a establecer que en realidad lo que a él se le debe comprobar es que allí existía un bosque y no un bosque secundario, veamos lo que declara: se trata de demostrar que el área de donde se cortaron algunos árboles era bosque secundario y la definición en la ley está para bosque, básicamente, en algunos documentos de investigaci ón de delitos forestales que han sido preparados por el Poder Judicial se habla detalladamente de que para que un área exista un cambio de uso, debe definirse que es área bosque, no dice primario o secundario, sino que debe cumplir con las condiciones para que sea bosque, asunto que está claramente establecido en el Reglamento a la Ley Forestal, en donde dice que para que sea bosque tienen que darse tres condiciones conjuntas, que es que sea más de dos hectáreas, que existan árboles de diferentes cortes, de diferentes alturas, diámetros, una variedad representativa de especies forestales, donde hayan más de sesenta árboles por hectárea mayores de 15 centímetros de diámetro y que esa área esté cubierta en más de un setenta por ciento, por la presencia de éstos árboles.

Entonces lo que se ha querido demostrar acá mediante el testimonio de los funcionarios del MINAE es que el área era bosque secundario, no que era bosque, entonces eso me da una gran preocupación. Cambia en este punto diametralmente el punto discutido el imputado, pues es muy posible que a esas alturas del desarrollo del debate presume que el Tribunal no le dará gran peso al descrédito del informe, y centra entonces el cuestionamiento a establecer la diferente entre bosque y bosque secundario, idea que de toda suerte tampoco es el hilo conductor del Tribunal, pues como ya se definió el tema probando es si era o no el área afectada un área de plantación. Como dato adicional el imputado elaboró un documento, siendo admitido como prueba por el Tribunal, con el cual pretende el imputado demostrar que el error de un solo árbol en el conteo tiene un efecto multiplicador, y que ello haría concluir que el área no era bosque, lo cual por coherencia de ideas con lo que se ha venido sosteniendo y a efecto de no ser repetitivo no será objeto de mayor análisis, pues ya hemos señalado que eso no tiene la fuerza necesaria para desacreditar la plataforma fáctica atribuida, y consideramos que esta extensa valoración de la declaración del imputado es suficiente para concluir que ninguna de las múltiples premisas que utilizó, son de peso alguno para demostrar su inocencia en el hecho investigado." En criterio de la mayoría de esta Cámara, el amplio análisis realizado por el Tribunal de instancia, unido a una prueba objetiva, como la información que consta en el informe SN-024-2009, confeccionado por el MINAE, y en cuyo forma o contenido no se detecta vicio o irregularidad alguna que permita dudar de la información que registra, la autoría del acusado es clara, en la misma forma que lo apreciaron los juzgadores.

Nótese que aún cuando no se haya incorporado la pericia técnica que extraña la defensa, lo cierto es que se verificó de acuerdo con la revisión que se practicó de la zona impactada que se trataba de un bosque secundario, que para el aprovechamiento de la madera no se contó con los permisos que debía extender la Administración Forestal, pero que las guías y la información falseada que extendió Nombre01, al decir que el área se trataba de una plantación, contribuyeron a que se talara cerca de 13.2 has, aproximadamente 240 árboles. Además, hay un hecho indubitable que diluye cualquier tipo de duda acerca de la naturaleza del área afectada, y es que al mismo Nombre04 se le había negado el refrendo, o "visto bueno," en la Administración Forestal, del documento que le había extendido el aquí encartado diciendo que se refería a una plantación, de manera que era totalmente claro y absolutamente comprobable y verificable por parte del encausado la naturaleza del terreno cuyo aprovechamiento autorizó sin que se contara con los permisos correspondientes.

La información que contiene este documento acerca de la naturaleza del terreno explotado, solo no es clara para el acusado, pues resulta que, desde antes, se había rechazado el "visto bueno" solicitado por Nombre04 a pesar de que el regente Nombre01 había asegurado que se estaba ante una plantación, pues en realidad no lo era. Esta conducta, tal como lo apreció el a quo, no permitió que la Administración Forestal del Estado, cumpliera su misión, pues si el regente forestal no hubiera dado fe de esa falsedad, la única manera de poder extraer esa madera, hubiere sido mediante la intervención de la citada oficina. Aunado a lo anterior, finaliza el Tribunal de instancia diciendo, "la prueba documental complementa y brinda mayor abundamiento a la tesis a la que arriba el Tribunal, pues evidencia sin lugar a dudas que en el sitio no existió la plantación forestal que el imputado afirmó que sí existía.

De las fotografías aportadas se puede deducir con meridiana claridad que visualmente la zona impactada, misma que el regente forestal y aquí imputado Nombre01 afirmó que se trataba de una plantación forestal, mantenía para la fecha del informe caracter ísticas que seg ún las reglas de la sana crítica corresponden a un área de bosque, pues los individuos se encuentran a espacios muy cercanos entre sí, con coberturas de ramaje sumamente amplias, con presencia de vegetación secundaria entre sí, con presencia de sotobosque y evidencia de que no existía ningún mantenimiento en el área por el hombre" (cfr. f. 286). De manera que la falsedad que se atribuye haber sido cometida por Nombre01 no se descarta por la ausencia de un peritaje adicional a los datos suministrados por la prueba analizada por los juzgadores (principio de libertad probatoria, artículo 182 del Código Procesal Penal); no se justifica en que le faltaron casillas para marcar -menos cuando el acusado dice tener basta experiencia y conocimiento en la materia y en los alcances de sus actuaciones como regente forestal-; y tampoco se diluye porque el proceso disciplinario que se le llevó ante el Colegio de Ingenieros Agrónomos en su contra fuera resuelto a su favor.

Sobre este último extremo, bien explicó el Tribunal que las reglas que rigen aquel no tienen relación ninguna con las reglas de un proceso penal, y aún más importante que la prueba reproducida en el debate no fue la misma que se utilizó en ese proceso administrativo y que, por lo tanto, aquellas conclusiones no podían tener relevancia, ni vinculaban, de manera alguna lo que en vía penal se resolviera. En razón de lo expuesto, sobre los extremos penales, se declaran sin lugar ambos recursos de apelación. B. Sobre el reclamo civil. Para la defensa, es contradictorio tener por establecida existencia de un nexo causal entre la conducta del imputado, al introducir un dato falso en un certificado de origen, y el daño ambiental ocasionado con la tala de árboles, a pesar de que lo absolvió por no tenerse por demostrada su participación este segundo hecho. Aduce también que la resolución carece de fundamento probatorio que acredite ese nexo; por lo que solicita se acoja el reclamo.

Sin lugar el reproche. Al acoger la pretensión civil, en forma correcta, el Tribunal de instancia estimó que, de acuerdo con el artículo 41 Constitucional, numeral 103 del Código Penal en relación con el 37 y 71 del Código Penal, así como de los numerales 122 y 125 de las Reglas Vigentes sobre Responsabilidad Civil del Código Penal de 1941 y el 1045 del Código Civil; se imponía al demandado civil la obligación de resarcir el daño, en virtud de que consecuencia de su actuación delictiva (falsear la naturaleza del terreno) se generó un daño ambiental importante, así determinado pericialmente. Es cierto, como lo señala la impugnante, que la tala propiamente, y en esencia la materialización de la corta de los árboles no le fue demostrada penalmente al acusado; pero, la causación del daño efectivo que se ocasionó por parte de sujeto o sujetos desconocidos, al cortar los árboles, depredación que fue facilitada por la conducta que sí se lee demostró al imputado, constituye el nexo causal que extraña la defensa.

En ese sentido, detalló el a quo que " En primer orden, como bien ha quedado expuesto en los apartes anteriores, al imputado Nombre01 se le ha considerado responsable de haber cometido un delito, por ende se le ha acreditado la comisión de una acción, típica, antijurídica y culpable, a título doloso, que causó un daño efectivo a los intereses colectivos por daño ambiental, e implicó el reproche impuesto, como fue la sanción penal de prisión impuesta. Ello, implica, en otros términos, que se le ha considerado autor responsable de un injusto penal, sea un hecho punible (típico y antijurídico) debidamente acreditado, productor, como se dijo, de una afectación al bien jurídico citado, por lo cual se le ha reprochado penalmente; razón por la cual, como bien establece nuestro ordenamiento jurídico citado supra, procede una indemnización." (...) En el presente caso, la causa generadora del daño al medio ambiente lo es, sin lugar a ninguna duda, el actuar doloso atribuido al imputado , sea que en su calidad de regente forestal y como tal de fedatario público consignó falsamente en un documento público que el área que se pretendía aprovechar era área de plantación, cuando en realidad no lo era, permitiendo así que se suscitara la explotación maderera sin control alguno por parte de la Administración Forestal del Estado; toda vez que de no haber sido por la acción ilícita realizada por el aquí procesado, el ente gubernamental hubiere estado en la obligación de controlar, supervisar y además autorizar o no, las acciones que en el área intervenida se dieron." (cfr. f. 289-291).

Tampoco le asiste razón a la impugnante al decir que no hay prueba que acredite el daño pues el mismo fue determinado por el Tribunal de instancia con base en elementos objetivos incorporados al proceso; y dijo: "En lo que respecta al daño material de índole ambiental, tenemos que efectivamente y a partir de lo establecido por el MINAE, en la valoración realizada a esos efectos existió un impacto ambiental, que fue cuantificado en el monto de ocho millones setecientos treinta y siete mil cuatrocientos ochenta y dos colones, más los intereses solicitados a la fecha de las conclusiones esbozadas en debate por el actor civil, para un total de trece millones cuarenta y seis mil doscientos cuarenta y cinco colones con cuarenta y nueve céntimos". De manera tal que la misma prueba en la que se basó el análisis de responsabilidad penal contra el encartado, reveló la afectación reclamada por los actores civiles.

En razón de lo expuesto, en criterio de la mayoría de esta Cámara, las razones que fundamentaron la aceptación del reclamo civil están debidamente expuestas y detalladas en la sentencia impugnada, por lo que el reclamo no es de recibo.

III. VOTO SALVADO DE LA JUEZA MONTERO MENA

Los recursos se declaran con lugar . A. Recurso de la licenciada Jenny Valverde Jiménez, Defensora pública. Motivos del primero al tercero. Por encontrarse intrínsicamente relacionados, se resuelven de forma conjunta. Reclama la impugnante que el tribunal de sentencia estableció que se configuró el delito de falsedad ideológica, debido a que se tuvo por demostrado que en el certificado de origen se introdujo un dato falso; al indicar que: "los árboles eran de plantación"; sin embargo, para arribar a dicha conclusión los jueces incurrieron en el vicio de preterición de prueba, ya que omitieron analizar elementos probatorios de carácter esencial, referidos a la defensa material del imputado tales como los testigos de descargo Nombre07 y Nombre08, además de que no se examinó si efectivamente los árboles podrían ser plantados individualmente. A este respecto, en primer término es importante considerar que en la sentencia se tuvo por demostrado : 1.- " En fecha indeterminada, pero antes y cerca del 27 de Mayo de 2009, dentro de la finca propiedad de de Hacienda Peñas Grandes, ubicada en Puerto Viejo de Sarapiquí, propiamente en la localidad de La Esperanza, fueron talados doscientos cuarenta y siete árboles de las especies botarrama, roble coral, areno guabo, arenillo, gallinaza y gavin con diámetros comprendidos entre los 19 y 72 centímetros, siendo que cuatro de los árboles de la especie botarrama se encontraban en la zona de protección de una quebrada, lo anterior sin que se contara con permiso alguno de la Administración Forestal del Estado. 2.- El imputado Nombre01 aprovechando su condición de regente forestal y fedatario público, insertó información falsa en un documento público, propiamente el certificado de origen, al afirmar que la madera aprovechable era de plantación (...)".

A pesar de lo anterior, observa esta Cámara que, conforme se reclama en la impugnación, el Tribuna omite analizar una serie de aspectos que resultaban de capital importancia para la acreditación de la delincuencia acusada. En primer término para realizar la anterior afirmación debía probarse que el área devastada se trataba de un bosque conforme el numeral 3, inciso d) de la Ley Forestal que literalmente señala: "d) Bosque: Ecosistema nativo o autóctono, intervenido o no, regenerado por sucesión natural u otras técnicas forestales, que ocupa una superficie de dos o mas hectáreas, caracterizada por la presencia de árboles maduros de diferentes edades, especies y porte variado, con uno o más doseles que cubran más del setenta por ciento (70%) de esa superficie y donde existan más de sesenta árboles por hectárea de quince o más centímetros de diámetro medido a la altura del pecho (DAP)". De manera que la determinación de tal condición era necesaria, pues, ello incidía directamente en la protección que el Estado le otorgaba o no a el área devastada, lo cual insoslayable al momento de examinar la afirmación realizada por el imputado en el certificado de origen, pues, lo trascendente era determinar si dicha manifestación resultaba contraria al ordenamiento jurídico, lo cual en este caso concreto no se hizo, sino que el fallo parte de una serie de imprecisiones tal y como se dirá.

Con relación a este tema en particular el a quo indicó: "(...) Veamos: en cuanto al delito de Falsedad Ideológica, no se imputa al encartado haber negado en el documento la existencia de un área boscosa, sino haber afirmado la existencia de una plantación. Podríamos afirmar que si bien la afirmación (sic) de la existencia de una plantación, puede estar íntimamente relacionada con la negación de la existencia de un bosque, una idea no es necesariamente producto de la otra, pues las posibilidades de lo que haya existido en el sitio son numerosas. En otras palabras la afirmación falsa que el Ministerio Público y la Procuraduría atribuían como la que insertó el imputado es que aseguró bajo la fe de pública que su cargo le confiere que allí existía una plantación, de tal modo que la hipótesis de cargo debía enfilarse hacia la demostración de que esa afirmación era falsa y en sentido contrario la tesis de descargo debía orientarse a demostrar que esa afirmación no era falsa.

Ambos esfuerzos efectivamente sucedieron, pero el hilo conductor que llevaban las partes y el propio imputado en el ejercicio de la defensa material se centraron en la tesis que pretendió concluir a contrario sensu, que únicamente si se lograba determinar que el área era bosque, podía concluirse que no era plantación, y que así las cosas la afirmación se podía señalar de falaz. El tribunal no comparte esa línea de pensamiento, pues no es cierto que exclusivamente bajo la comprobación de que el área afectada era bosque se podía concluir que la afirmación de la existencia de la plantación era falsa. Siguiendo con estas ideas, el tribunal arribó a la conclusión de que ciertamente quedó demostrado que la afirmación del imputado Nombre01 fue falsa, pero no porque haya quedado demostrado con certeza absoluta la existencia del área de bosque secundario, sino únicamente porque quedó demostrado que allí nunca existió una plantación.

Debemos señalar sin embargo que aunque el Tribunal no llegó a un convencimiento absoluto de que allí hubiere existido un bosque secundario, si pudimos concluir que existía un altísimo grado de probabilidad de que así fuera (...). ". Esta Cámara denota y conforme se evidencia en el texto transcrito que, el Tribunal de sentencia incurre en una grave contradicción en el fallo, pues, a pesar de tener como hecho probado que el imputado Nombre01 aprovechando su condición de regente forestal y fedatario público, insertó información falsa en un documento público, propiamente el certificado de origen, al afirmar que la madera aprovechable era de plantación; al momento de establecer las razones del porque concluye de esa manera, refiere que las razones para arribar a dicha conclusión, no se erigen a partir de la necesaria demostración de la existencia de un bosque secundario en el sitio, sino que deriva su inexistencia a partir de la afirmación de que quedó demostrado que allí nunca existió una plantación a partir del análisis de la prueba, sin que se justifique de manera adecuada realmente que fue lo que se pretendió afirmar, y desde es punto de vista el fallo deviene infundamentado.

Por otra, lleva razón la impugnante al argumentar que los testigos de la defensa no son analizados debidamente, porque tal y como consta a folios 268 a 271 vuelto, Nombre07 depuso: " (...) Había una parte de potrero, repasto, había una parte al principio que era de madera pero nosotros la hicimos de pasto, la cortamos al ajecho. Todo fue volteado. Nosotros tuvimos la opción de ir metiendo arbolitos sobre troncos anteriores, lo mismo en las cerca (...)" y Nombre08 declaró: " Eran 54 hectáreas en total. Yo tenía la vega del Sardinal limpia de potrero y repasto. Yo decidí socolar 30 hectáreas para sacar la madera y hacerla de pasto. Socolar es limpiar el monte pequeño, para sembrar pasto y después voltear. (...) A los años tuve un accidente y decidí resembrarla de madera pero no en línea, solo una parte en el río como unas dos hectáreas de laurel, y el resto de botarrama, un poquillo roble, alguno que otro fruta, areno, pilón, se metió revuelto, porque ya eso era pasto, inclusive buscábamos las raíces, parte de los troncos para protegerlos del ganado porque eso estaba repasto, alambrado y todo.

(...) Sé que conservaba la madera, porque en una ocasión me dijo que la parte de laurel ya la iba a sacar, creo que fue en el dos mil ocho o por ahí, pero después de eso él murió. La totalidad de la finca se convirtió en repasto como en el 78 más o menos (...)". Con relación al tema de que la finca en su totalidad estaba sembrada de pasto y que fue resembrada con árboles maderables, ambos testigos son coincidentes, valga decir, que estos en su momento eran los propietarios del lugar. Empero, con relación a estas deposiciones el tribunal de mérito, no realiza el mayor análisis, a pesar de afirma que la declaración de los testigos es verdadera; empero a pesar de lo anterior, concluye que ello no demuestra que el área fuera una plantación, sin esgrimir razones lógicas para arribar a esa conclusión, ya que no es suficiente con que se afirme, que existían amplias posibilidades de que en el lugar no existiera una plantación.

(Ver folio 280). Esta afirmación del tribunal es totalmente contradictoria, porque por una parte está indicando que los testigos dicen verdad, pero hay que recordar que estos afirmaron que la totalidad del inmueble estaba sembrado de pasto y que posteriormente ellos resembraron el lugar con diferentes especies de árboles, entonces, no resulta lógica la derivación que realiza el a quo, ya que al otorgarle credibilidad al dicho de los testigos, en este aspecto medular que, incide directamente en los hechos tenidos por demostrados, no es posible establecer por una parte que los testigos dicen verdad, pero que en el sitio no existió una plantación, pues ello evidentemente es contradictorio y vulnera las reglas de la sana crítica racional. En un sentido similar, afirma el tribunal de sentencia que: "(...) se aportó en la causa, propiamente el mapa de folio 12, haciendo ver que a pesar que los testigos afirman que el programa utilizado para el levantamiento de es mapa resalta automáticamente en color verde las zonas que corresponden a bosque, es lo cierto que el citado programa resalta en el mismo color las plantaciones forestales.

Tal afirmación si bien es considerada veraz por este Tribunal pues incluso así lo reconocieron los testigos de cargo, frente a preguntas de la defensa técnica, no resulta ser un elemento contundente para la toma de la decisión, pues a pesar de que ese mapa podría establecer que el área afectada era efectivamente una plantación y que por tanto no existía una afirmación falsa en el documento dubitado, lo cierto del caso es que como más adelante se verá, existen en autos una serie numerosa (sic) de indicios que demuestran que definitivamente allí nunca existió, ni antes ni al momento de los hechos una plantación. (...). Debemos señalar sin embargo (sic) que aunque el Tribunal no llegó a un convencimiento absoluto de que allí hubiere existido un bosque secundario, si pudimos concluir que existía un altísimo grado de probabilidad de que así fuera (...)". Esta Cámara aprecia que el fallo incurre en el vicio de fundamentación contradictoria, pues el tribunal el Tribunal presenta dos afirmaciones o juicios que efectivamente se excluyen entre sí, ya que por el tema que se juzgó, irremediablemente era necesario determinar si la madera que se extrajo provenía de un bosque o una plantación, pues ello incidía directamente en el núcleo de la acción atribuida al justiciable; es decir, insertar en un documento público o auténtico declaraciones falsas, y como resulta lógico al analizar los hechos en su contexto, es claro que no pueden coexistir, pues, o se trata de un bosque ya sea primario o secundario, o de una plantación.

Analizada que ha sido la sentencia en su conjunto, se denota que a pesar de que el a quo, refiere que en el sitio no existía una plantación forestal, y que por ende la afirmación del imputado en el certificado de origen era falsa, y analiza la versión dada por el testigo Nombre08, quien declaró que él había sembrado árboles en el inmueble del que era propietario; sin embargo, para descartar esa versión el tribunal de sentencia utiliza como argumento, la premisa de que quién sembró los árboles que se encontraban en el área afectada, nunca lo hizo con la intención de producción de madera, y descarta lo anterior, porque en su criterio no se le dio el mantenimiento adecuado, y además vendió la propiedad sin aprovechar ese recurso; y que por lo tanto se descarta ese objetivo principal que requiere la definición de plantación forestal; sin embargo, esa conclusión roza con las reglas del correcto entendimiento humano, pues, si bien la producción maderera puede ser la intención al momento de desarrollar un proyecto de ese tipo, es claro que no es la única, ya que nada obsta para que el testigo haya decidido vender el inmueble en tales condiciones, máxime que el mismo declaró que anteriores oportunidades había extraído madera de la finca.

Además descarta el a quo esa posibilidad a partir de la deposición de la testigo Nombre07, pues, esta manifestó que la finca estaba dedicada a la ganadería y agricultura, por lo cual no es razonable que también se mantuviera una plantación forestal con el objetivo de producir madera, ya que los cultivos y los los animales no lo permitirían; empero no analiza, ya sea para acoger o descartar la tesis defensiva, que los testigos fueron claros en indicar que sembraron apoyados en los troncos de árboles que habían sido talados al momento de sembrar la totalidad del inmueble de pasto, precisamente para protegerlos de los semovientes. Otro aspecto relevante, es que el mismo tribunal llega a la conclusión de que: "(...) el informe del MINAE tiene inconsistencias y debilidades que lo tornan en débil para la afirmación de la idea de la existencia del bosque, principalmente porque no queda claro cuáles árboles se contabilizaron para el muestreo, y si todos ellos tenían los diámetros que exige la definición ya aludida, ello no se traduce en que por ende el Tribunal tuviera por demostrado que si se trataba entonces de una plantación forestal, pues todas las evidencias recopiladas y reproducidas hace que se concluya lo contrario, es decir que no era una plantación." A pesar de lo anterior, no es claro el tribunal de sentencia, en las razones lógicas que lo llevan a concluir de que no se trata de una plantación forestal, sino que únicamente se utilizan frases dogmáticas y silogismos jurídicos, pero sin realizarse una verdadero análisis de los elementos probatorios que tuvieron a su haber.

Por tanto, la resolución así tomada resulta contradictoria, pues las aseveraciones que se desarrollan por parte de los Juzgadores no se hacen dentro de un orden de razonamientos lógicos, sobre los cuáles se erige la toma de decisión. Debe tenerse presente que la sentencia penal, como unidad lógico-jurídica que es, no puede contener afirmaciones o razonamientos contradictorios, conforme lo establece el artículo 142 del Código Procesal Penal, al indicar que la fundamentación de la sentencia debe ser clara y precisa y el párrafo tercero de este mismo artículo establece: "No existe fundamentación cuando se hayan inobservado las reglas de la sana crítica, con respecto a medios o elementos probatorios de valor decisivo." En el presente caso, a partir de la falta de análisis del material probatorio relacionado con temas medulares del hecho acusado, se incurre en una fundamentación fáctica contradictoria que ocasiona la nulidad de la sentencia, por lo cual lo que corresponde es declarar con lugar los motivos y ordenar el reenvío para nueva sustanciación.

Cuarto motivo. Reclama la impugnante que existe una violación al debido proceso por falta de fundamentación de la acción civil, lleva razón la quejosa: Conforme se ha indicado en el considerando anterior, al no haberse establecido en el fallo si en el lugar de donde se extrajo la madera era un bosque o una plantación forestal, no era posible para el tribunal de sentencia tener por establecido el nexo causal, entre la conducta desplegada por el imputado al introducir en el certificado de origen que la madera que iba a extraerse era producto de una plantación, y el daño ambiental que la tala de los árboles ocasionó, ya que, efectivamente no resulta razonable, establecer una sentencia absolutoria por los delitos de Aprovechamiento Ilegal de Madera en Propiedad Privada y Aprovechamiento de Madera en Zona de Protección, en virtud de que en el contradictorio no se reprodujo ninguna prueba capaz de establecer la responsabilidad penal en dichos hechos, según lo estableció el tribunal de sentencia en el fallo y por otra parte, acreditar la causalidad necesaria para establecer la responsabilidad civil por el delito de Falsedad Ideológica a pesar de que, tal y como se ha dicho en los considerandos anteriores, en este caso era determinante para poder establecer la responsabilidad penal del imputado, que el a quo estableciera con certeza si el área devastada era un bosque o una plantación forestal, lo cual incide directamente en la responsabilidad civil, pues, es claro que dependiendo de esa conclusión, el nexo de causalidad se lograba establecer o no, pues no se acreditó con certeza que el área talada fuera un bosque y no una plantación, y es por ello que no se puede afirmar con la contundencia necesaria que el encartado provocó, de forma directa, que se hiciera una tala ilegitima de un área de bosque.

Por ende el argumento respecto a la causalidad que esgrime la impugnante encuentra asidero legal, pues esa inescindible relación entre la actuación del encartado y la corta de los árboles no se puede establecer, y es claro que por la forma en que este tribunal de apelación de sentencia penal está resolviendo, ello no era posible debido a la fundamentación contradictoria en que se incurrió en la resolución que esta siendo apelada. Por tanto se declara con lugar el motivo, y se anula la sentencia en lo referente a la parte civil que establece que se condena al demandado civil Nombre01, a pagar el daño material de índole ambiental ocasionado. Por lo expuesto se declara con lugar el motivo. B. Recurso del imputado Nombre01. ÚNICO MOTIVO: "Inconformidad con la valoración de la prueba. Violación de las reglas de la sana crítica racional, concretamente la regla de lógica de derivación (sub principio de derivación o razón suficiente), vinculado estrechamente a una falta de fundamentación analítica e intelectiva, por ausencia de fundamentación, fundamentación insuficiente y fundamentación contradictoria del fallo".

Refiere que la conclusión del tribunal de sentencia no se encuentra respaldada en prueba documental, pericial o testimonial, ni en ningún criterio técnico, contraviniendo la normativa ambiental y el dicho de los testigos, pues, él nunca incurrió en un delito de falsedad ideológica. Indica que la información que inserto en dicho certificado, es verdadera, sostenida con criterios técnicos, además de que los testigos de cargo y ex dueños de la finca (Nombre07 y Nombre08) donde se realizó la tala, afirmaron que ellos habían sembrado dichos árboles, por lo que si afirmó que los árboles eran de plantación era porque así fue. Tal y como lo indicó en su declaración, como imputado, regente forestal y experto en la materia. Refiere que declaró acerca de tópicos técnicos como plantación, artículo 28 de la Ley Forestal, referida al tema de permiso de corta de árboles, sistemas agroforestales, plantaciones individuales, la ley no obliga a contar con permiso de corta.

Dice que sobre estos mismos hechos fue absuelto en el proceso disciplinario que se llevó a cabo en el Colegio de Ingenieros Agrónomos, ya que a partir de las inspecciones técnicas no se pudo descartar que lo existía en el lugar fuera una plantación forestal, cuando personas siembran con recursos propios, no se considera bosque por ello no requiere permiso de corta y es por ello que no insertó ningún dato falso en el documento. Además resalta que el tribunal de sentencia tiene por acreditado que el área talada no es bosque, indefectiblemente es otra cosa, ya sea plantación, charral etc. No se razonó porque se descarta que el área sea una plantación, tal y como lo explicó ampliamente en su declaración. Afirma que los testigos Nombre07 y Nombre08, señalaron que ellos sembraron a las par de troncos y sobre ellos, sin embargo, en ninguna pericia o inspección realizada por agentes del Minae, o en la prueba testimonial se extrae que se haya tomado en cuenta los troncos también, puesto que si tomaron estos como árboles, el muestreo no estaría correcto, puesto que daría una cantidad mayor a la que realmente existe.

El tribunal afirma que no existe plantación pues existían más de 500 árboles por hectárea; sin embargo, si son plantados no existe limitación. Refiere que el tribunal desecha su declaración sin sustentarse en criterios técnicos y válidos desde el punto de vista ambiental y en la Ley. Además de que no se da crédito a los testigos de descargo, sino únicamente a los del Minae, a pesar de que el fallo acepta que sus testigos dicen la verdad al afirmar que luego de haber transformado la finca en un área de pasto, procedieron a sembrar árboles, y entonces porqué, se cuestiona el impugnante se afirmó que incurrió en una falsedad al consignar que se trataba de una plantación, no siendo trascendente si los ex dueños sembraron los árboles para la producción de madera ya que ello no lo exige la Ley, pues, para que exista una plantación la finalidad puede ser distinta a la anterior. Reitera que si la intención de quién sembró los árboles nunca fue la producción de madera, ello no tiene nada que ver con la definición técnica de plantación.

Dice que si se revisa el certificado de origen, en plantación individual hay que marcar la casilla de plantación de árboles, que hacer eso no es ilegal. Refiere que el a quo invierte la carga de la prueba violentando el debido proceso. Dice que su criterio técnico como Ingeniero Forestal y Regente Forestal debían tener mayor peso probatorio que lo expresado por los funcionarios del Minae que no tienen esa condición ni grado académico, además de que no existe ningún peritaje para desacreditar su dicho. El reclamo se declara con lugar. Siendo que por voto de mayoría del los Jueces Mena Artavia y Jiménez Fernández; con el voto salvado de la Jueza Montero Mena, dispusieron mediante resolución número 1328, de las diecisiete y veintinueve horas del veinticinco de septiembre del dos mil quince, admitir y proceder a resolver la impugnación presentada, se procede conforme. El imputado en su único reclamo esboza, inconformidad con la valoración de la prueba, violación de las reglas de la sana crítica racional, concretamente la regla de lógica de derivación (sub principio de derivación o razón suficiente), vinculado estrechamente a una falta de fundamentación analítica e intelectiva y, ausencia de fundamentación, ya que considera que es insuficiente y contradictoria; apoya su dicho en en que la conclusión del tribunal de sentencia no se encuentra respaldada en prueba documental, pericial o testimonial, ni en criterio técnico, contraviniendo la normativa ambiental y el dicho de los testigos Nombre07 y Nombre08.

Arguye que nunca incurrió en un delito de falsedad ideológica. Tal y como se ha indicado en el considerando segundo de esta sentencia, al cual se remite a la parte, para la correcta resolución de este asunto, es necesario tomar en consideración los hechos que tuvo por demostrados el a quo, especialmente el segundo que expresa: "(...)2.- El imputado Nombre01 aprovechando su condición de regente forestal y fedatario público, insertó información falsa en un documento público, propiamente el certificado de origen, al afirmar que la madera aprovechable era de plantación (...)". Empero lleva razón la parte en sus argumentaciones, pues, efectivamente, tal y como se analizó anteriormente era trascendente que se demostrara fehacientemente que el área devastada era un bosque conforme el numeral 3, inciso d) de la Ley Forestal, de ahí que lleve razón el impugnante al indicar que el fallo no se sustenta en prueba técnica, ya que era necesario que no quedara ningún vestigio de duda acerca de la responsabilidad del imputado, circunstancia que el fallo no logra desarrollar de manera adecuada, ya que ello incidía directamente en la protección que el Estado le otorgaba o no a el área devastada y, era importante para acreditar la falsedad de la información de la afirmación realizada por el imputado en el certificado de origen en el sentido de que eran árboles provenientes de una plantación, empero el fallo denota una ausencia total de motivación en ese sentido.

La sentencia así dictada resulta contradictoria, ya que por una parte, esgrime que con respecto al delito de Falsedad Ideológica, no se imputa al encartado haber negado en el documento la existencia de un área boscosa, sino haber afirmado la existencia de una plantación; pues, tal y como lo indica el a quo, la afirmación de la existencia de una plantación, puede estar íntimamente relacionada con la negación de la existencia de un bosque, pero una idea no es necesariamente producto de la otra, ya que las posibilidades de lo que haya existido en el sitio son numerosas; sin embargo, no es posible suponer tal y como lo afirma el Tribunal de sentencia, sino que en el proceso penal los hechos deben ser acreditados por certeza, entonces, no es posible arribar a una sentencia condenatoria penal, basándose en suposiciones, por lo cual no resulta lógico ni razonable que se afirme que a pesar de que no quedó demostrado con certeza absoluta la existencia del área de bosque secundario, sino únicamente se acreditó que allí nunca existió una plantación, y que el Tribunal no llegó a un convencimiento absoluto de que allí hubiere existido un bosque secundario, pero si pudo concluir que existía un altísimo grado de probabilidad de que así fuera.

Nótese, que ese tipo de afirmaciones no resultan razonables, pues, no se trata de que existan altas probabilidades, sino que no debe quedar márgen para la duda, y tal contundencia, no se logra extraer de la resolución impugnada, pues se denota y conforme se evidencia en el texto del fallo, el Tribunal de sentencia incurre en una grave contradicción en el fallo, pues, a pesar de tener como hecho probado que el imputado Nombre01 aprovechando su condición de regente forestal y fedatario público, insertó información falsa en un documento público, propiamente el certificado de origen, al afirmar que la madera aprovechable era de plantación; sin embargo, al momento de establecer las razones del porque concluye de esa manera, es claro que no se erigen a partir de la necesaria demostración de la existencia de un bosque en el sitio, sino que deriva su inexistencia a partir de la afirmación de que quedó demostrado que allí nunca existió una plantación, sin que se justifique de manera adecuada realmente que fue lo que se probó.

Por ello lleva razón el imputado en su reclamo, al argumentar que la valoración de la prueba, vulnera las reglas de la sana crítica racional, concretamente la regla de lógica de derivación, ya que no es posible realizar una afirmación a partir de la negación de otro hecho. Al razonar el Tribunal de sentencia de esa manera incurre en la falacia, lo cual vulnera el numeral 142 del Código Procesal Penal. Además efectivamente la resolución contiene una insuficiencia probatoria, tal y como se indicó en el considerando segundo, al cual se remite a las partes para no reiterar argumentaciones, justificaciones que en este apartado del fallo cobran vigencia. Tal y como se indicó la prueba de descargo concretamente el testimonio de Nombre07 y Nombre08 no fue analizada de manera correcta; es decir de manera armónica e integral y no sesgada como lo hizo el tribunal, nótese que si los testigos quienes eran dueños del inmueble en su momento, manifestaron que la finca en su totalidad estaba sembrada de pasto y que fue resembrada con árboles maderables, es claro que el tribunal incurre en el vicio que apunta el recurrente, ya que a pesar de que se afirma que la declaración de los testigos es verdadera; por otra parte concluye que, ello no demuestra que el área fuera una plantación, sin esgrimir razones lógicas del porque su dicho no es de recibo, no es suficiente con que se afirme, que existían amplias posibilidades de que en el lugar no existiera una plantación, sino que debían darse razones válidas para desmerecer el testimonio.

Lo anterior incide directamente en la debida fundamentación del fallo, no es posible para el Tribunal sentenciador afirmar que los testigos dicen la verdad, y por otra parte no dar credibilidad a su dicho, porque ello evidentemente resulta contradictorio y vulnera las reglas de la sana crítica racional. En este caso era necesario determinar si la madera que se extrajo provenía de un bosque o una plantación, ya que ello incidía directamente en el núcleo de la acción atribuida al justiciable; es decir, insertar en un documento público o auténtico declaraciones falsas; sin embargo, tal determinación no quedó clara a partir de la sentencia. A pesar de que el a quo, refiere que en el sitio no existía una plantación forestal; -sin sustentar dicha afirmación en elementos probatorios-, y concluye que la afirmación del imputado en el certificado de origen era falsa, y para ello sustenta su tesis en la premisa de que quién sembró los árboles que se encontraban en el área afectada, nunca lo hizo con la intención de producción de madera, y que al faltar ese animus entonces el delito se configura, porque en su criterio no se le dio el mantenimiento adecuado, y además vendió la propiedad sin aprovechar ese recurso; sin embargo, esa conclusión es errónea, debido a que a pesar de que la Ley Forestal, en su inciso f) establece: " Plantación forestal: Terreno de una o más hectáreas, cultivado de una o más especies forestales cuyo objetivo principal, pero no único, será la producción de madera".

Dicha finalidad no implica necesariamente que no puedan coexistir otras motivaciones, pues, si bien la producción maderera puede ser la intención al momento de desarrollar un proyecto de ese tipo, no es un requisito sine qua non, sino que pueden coexistir otros, incluso podría darse el caso de que en un inicio esa sea la razón de ser de los sembradíos pero que con el transcurso del tiempo, se cambié de opinión, y no por ello la plantación forestal como deja de existir; igual sucede si se deja de dar mantenimiento al inmueble, esa sola circunstancia no tiene la capacidad de desaparecer la plantación y convertirla en un bosque, ya que su vocación original no deviene del bosque primario o secundario, sino de una acción humana que ha modificado su condición. Por tanto, la resolución así tomada resulta contradictoria, y vulnera la debida fundamentación del fallo conforme el artículo 142 del Código Procesal Penal, razón por la cual, lo que corresponde es declarar con lugar el motivo y ordenar el reenvío para nueva sustanciación.

Por lo expuesto, se declara con lugar el motivo. Por tanto, voto por declarar con lugar las impugnaciones, anular el fallo y remitir el asunto al Tribunal respectivo, para que con nueva integración realice el nuevo Juicio.-

POR TANTO:

Por mayoría, se declara sin lugar los recursos de apelación interpuestos por la licenciada Jenny Valverde Jiménez, defensora pública de Nombre01, y el formulado por el acusado en ejercicio de su defensa material. La jueza Montero Mena salva el voto, y declara con lugar el recurso de apelación de sentencia interpuesto por la licenciada Jenny Valverde Jiménez, Defensora pública de Nombre01, únicamente en relación al delito de Falsedad Ideológica por el cual fue condenado. Declara con lugar el motivo, y anula la sentencia en lo referente a la parte civil, que establece la condena al demandado civil, Nombre01, a pagar el daño material de índole ambiental ocasionado. En todo lo demás mantiene incólume la sentencia.
