WHEREAS:
I.Evidence to assist the court in reaching a decision (prueba para mejor resolver). As evidence in this appeal, the appellant offers the testimony of four witnesses to state that the defendant has operated the concession in compliance with the applicable legal provisions and has not encroached upon the plaintiff’s property, as well as the testimony of the Mining Coordinator for the Región Huetar Atlántica, who has supervised the extraction work. It also requests examination of a party (prueba confesional), documentary evidence (pruebas documentales), an order requiring the submission of a certified copy of the mining case file in the appellant’s name, expert evidence (prueba pericial), and an oral hearing. All of these requests are denied pursuant to Article 52 of the Ley de Jurisdicción Agraria, because the record transmitted to this Court by the lower court is sufficient to decide the appeal filed against the precautionary measure; furthermore, the requested evidence does not refute the existence of a spring (naciente) located within the plaintiff’s property, at [Dirección1] from the bank of the river subjected to extraction activities under the concession granted to the defendant.
II.The defendant [Nombre3] files an appeal (folio 97) against interlocutory judgment (auto sentencia) 102-14 of 15 hours and 53 minutes on 8 de octubre del 2014, issued by the Juzgado Agrario del II Circuito Judicial de la Zona Atlántica, invoking grounds for nullity (motivos de nulidad) against the ruling on the precautionary measure (medida cautelar) issued in the ordinary proceeding brought against her by AGROMECÁNICA F Y P. As grounds for nullity, she states:
This is deemed essential because the party requesting the measure could use the proceeding to delay the case or without any practical purpose. In this particular case, there is no record of an inspection visit or assessment by the relevant authority, and weight has been given solely to the plaintiff’s assertions. It requests that the precautionary measures (medidas cautelares) sought by the plaintiff be denied on the grounds that they are reckless and unfounded, since the technical reports attached as evidence show that there is no, and has never been, soil erosion caused by the defendant; rather, it results from natural factors. Nor has my client diverted the riverbed. This is demonstrated by the technical and scientific reports submitted with this answer. It alleges bad faith on the part of the plaintiff, who, without sufficient supporting evidence, has filed an additionally false and reckless action, to the direct detriment of my client, for the purpose of obtaining illegitimate and unjust profit.
It offers the testimony of the following persons as evidence: [Nombre5].- , identification card CED8, geologist, divorced, resident of Las Juntas de Abangares, Guanacaste, [Dirección2] , Carnet Colegio Geólogos de Costa Rica 218, Environmental Consultant number 161-98. 2.- [Nombre6] , of legal age, married twice, Agricultural Engineer with a doctorate in Soils, [Dirección3] , -, Los Ángeles, San Rafael de Heredia, SETENA Consultant No. Cl-84-2009. 3.- [Nombre7], identification card number CED9, single, business administrator, resident of Cristo Rey de Puerto Viejo de Sarapiquí. They would testify that the concession has operated in compliance with the provisions of that entity and has never encroached upon the defendant’s property. It also offers Lic. Esteban Bonilla Elizondo/ Mining Coordinating Geologist for Región Huetar Atlántica to testify in his capacity as an official of the Dirección de Geología y Minas who has directed and supervised extraction activities under the mining concession (concesión minera).
As documentary evidence (prueba documental), it requests that the Dirección de Geología y Minas be ordered by writ to provide a copy of certified expediente 7-2010; a photographic sequence of the project in question and official letter DGM-CMRHA-121-2014 Fecha 21 de Octubre de 2014 addressed to M.Sc.Enid Gamboa Robles.Deputy Director a.i Dirección de Geología Minas From: Lic. Esteban Bonilla Elizondo/Mining Coordinating Geologist for Región Huetar Atlántica Subject: Review of response to resolution N 753 and official letter DGM-RNM-599-2014Related to Complaint 25-2014 in the area covered by Expediente 7-2010 were submitted. It requests that the president of the plaintiff corporation be summoned for examination of a party (confesional), so that he may answer interrogatories concerning the questions I will formulate on the date scheduled for that purpose. As expert evidence (prueba pericial), it requests that Lic. Esteban Bonilla Elizondo/ Mining Coordinating Geologist for Región Huetar Atlántica be summoned to testify in his capacity as an official of the Dirección de Geología y Minas who has directed and supervised extraction activities under the mining concession and has dismissed the complaints filed.
They request that the APPELLATE COURT (TRIBUNAL DE ALZADA) GRANT AN ORAL HEARING IN DEFENSE OF OUR ARGUMENTS. It requests that the appeal be granted, that the plaintiff be ordered to pay damages, and that both attorney fees and litigation costs be awarded against it.
III.This Tribunal has repeatedly identified the three basic prerequisites for granting precautionary measures (medidas cautelares): subsidiarity (residualidad), likelihood of success on the merits (apariencia de buen derecho), and risk arising from delay (peligro de demora). All these requirements are weighed within highly expedited proceedings (proceso sumarísimo), in which the evidence contained in the record is assessed. Precautionary measures must not, and are not intended to, decide the merits of the matter prematurely. Their purpose, pursuant to Article 242 of the Código Procesal Civil, which applies supplementarily to this matter, is as follows: “…when there is a well-founded fear that one party, before judgment is rendered, may cause serious and difficult-to-repair harm to the other party’s right. To prevent such harm, the judge may authorize or prohibit the performance of specific acts, order that property be placed in custody, or require the posting of security (caución).” Regarding the appropriateness of issuing such measures to protect natural resources and agricultural production, it has been held: “Legal scholarship has developed, within the principle of the Judge’s broad powers, the ‘Precautionary Authority of the Agrarian Judge’ (Poder Cautelar del Juez Agrario), whose purpose is precisely to protect such situations in order to serve not the interest of a party, but that of the community.
Thus, measures have been created to safeguard both production and the conservation of natural resources. The Agrarian Judge’s precautionary authority is clearly important for adopting measures intended to protect production, whether by prohibiting or authorizing certain types of acts (voto 173-F-08).
IV.To analyze the factual basis on which the appealed precautionary measure was ordered, it is necessary to examine the complaint, the answer, and the evidence submitted with the case file forwarded by the trial court. This is necessary to verify the instrumental nature (instrumentalidad) of the ordered measure and determine whether the appellant’s objections are well founded. At folio 22, the record contains a complaint filed by Agromecánica F y P S.A against Indaco Horquetas S.A. In the complaint, the plaintiff states that it owns property registration [Placa1] in Heredia, with an area of 19 hectares 8571,31 square meters and described in survey plan H-0463158-1982. The property was reforested with melina under the Pago de Servicios Ambientales system, and the area near the river was planted with zotacaballo trees, while the melina was in the harvesting phase (aprovechamiento). (fact 1). It states that the property is a kind of island surrounded by the Río Puesto Viejo and that there had never been any problem with erosion washing away the property.
It asserts that (fact 3), by decision R-80-2012-MINAET, the defendant was granted a ten-year concession (concesión) to extract materials from the channel of the Río Puerto Viejo, signed by the Executive Branch (the President and the relevant Minister). It states that (fact 4) the operative portion (parte dispositiva) of that decision provides that, while carrying out the extraction work, the concession holder must comply with the recommendations and technical conditions established in official letter DGM-CRHA-075-2011 of 22 de junio del 2011, which are detailed in recital V (resultando V) and form an integral part of the concession, as well as with any other recommendation issued by the Dirección de Geología y Minas and the Secretaría Técnica Ambiental. In the fifth fact, it quotes verbatim part of decision R-80-2012 MINAET granting the concession, which, insofar as relevant, states that through memorandum DGM-CRHA-075-2011 of 22 de junio del 2011, the Dirección de Geología y MInas issued technical recommendations and concluded that the Registro Nacional Minero should proceed with the concession-granting process, taking into account the characteristics and recommendations for approval resulting from the analysis of the EsIA Exploitation Program (Programa de Explotación de EsIA) and the field observations.
Among them, it states that the project is located between coordinates [Dirección4]/ on the Río Sucio map sheet, scale 1:50000, of the IGNCR. The land proposed for the operations is located within [Dirección5], in the province of Heredia, 5 kilometers [Dirección6] from the Río Frío intersection, in the locality of [Nombre8]. It indicates that mining operations must not be conducted outside the concession area. The concession area does not include the islet located between sections 7 and 14 of the exploitation program; therefore, under normal conditions, machinery may not enter that land. It states that a 15-meter river protection zone (zona de protección) must be respected with regard to the formation of stockpiles of accumulated materials and any other works, as well as roads along the river channel. The sixth fact of the complaint alleges that the defendant decided to invade the islet with heavy machinery, entered it, encroached upon it, and caused a large part of it—an area of approximately two hectares—to disappear.
It adds that the defendant failed to respect the protection zones, caused spring (naciente) areas to disappear, and diverted the river’s natural channel by dredging, extracting material, and carrying out activities inherent to riverbed extraction, thereby causing erosion of the plaintiff’s property and its neighbors’ properties. As portions of the properties disappeared, sandbars formed in the river to facilitate the extraction of materials, and the trees that mitigated impacts on the river’s protection zones were felled and washed away as a result of the defendant’s actions. It alleges (fact 7) that the remainder of its property, including the existing springs and reforested trees, is currently at risk of being invaded and disappearing. In the eighth fact, it describes the damages (daños y perjuicios) it claims to have suffered. It identifies as actual damage (daño) the loss of approximately two hectares of its property, valued at one hundred million, and the loss of the reforested melina trees in the amount of three million five hundred thousand colones.
Consequential damages (perjuicios) consist of interest on that sum, as well as the cost—still to be established by expert evidence—of restoring the new protection zones through reforestation and filling work, prudently estimated at twenty million colones. In the section of the complaint entitled Relief Sought (Pretensión), it states by way of introduction that these are sui generis facts in which a concession holder, acting under legally granted permits to extract materials, violated the prohibition against entering the plaintiff’s islet, forcibly entered it, and removed trees and part of the islet, all for the purpose of facilitating extraction in areas where water springs emerged, which constitute protection zones, thereby causing two hectares of land to disappear. This is an area where the defendant is working, which became part of the Río Puerto Viejo channel, and where it has materials stored.
Given that the conduct of a third party entrusted by the State with extraction under a concession exceeds what is legally permitted and causes damages, and because restoration of the property is impossible, Article 325 of the Código Civil must be applied. It therefore requests a judgment declaring:
V.The complaint described above was filed on 1 de setiembre del año 2014, and the order serving the complaint (auto traslado) was issued by decision at 08:13 horas del 5 de setiembre del mismo año, setting the judicial inspection concerning the precautionary measure for 16 de setiembre siguiente. The record contains (folio 34) minutes of the judicial inspection stating that a video camera would be used, and the corresponding compact disc containing the recording was attached to the case file. In those minutes, the judge describes the situation observed. The video shows an area covered with rocks and a river channel crossing part of it; according to the judge, the plaintiff indicated that this channel had not existed and that the area had formed an integral part of the total area of its property. The judge records observing a small islet or island bordered by a river channel, an area that the plaintiff stated had formed part of its property and that was found to be separated at the time of the visit.
Some zotacaballo trees and banana plants were growing in the area, and various vegetation was observed. The plaintiff showed where the river channel had previously flowed and stated that it now had a visible branch that had not existed before. That branch of the river is beside the earthen embankment of the plaintiff’s property, which shows erosion in some sections and rises steeply above the visible river channel. The judge further describes finding, approximately fifteen meters from the embankment being undermined by the river branch and within the plaintiff’s land, a spring surrounded by various vegetation and having a substantial water flow, which is shown in the video. The video likewise shows a melina tree lying on the ground along the bank of the channel, as well as several meters of exposed soil and roots along the bank. The recording indicates that the original river channel through which the river flows still exists, but it also shows a branch extending into what are now sand-and-stone bars bordering the plaintiff company’s property.
The plaintiff alleges that these bars did not previously exist at their current location, nor did the river branch that extends into what had formerly been its land. On 8 de octubre del 2014, the precautionary measure that is the subject of this appeal was decided (folio 39).
VI.Having analyzed the proceedings and the grounds for appeal, this Court does not find that an order having the effect of a judgment (auto sentencia) was issued subject to nullity, or that the legal provisions alleged by the appellant were violated. First, the ground for nullity concerning the absence of established facts in the appealed decision cannot be sustained, because what was issued was an order having the effect of a judgment, and although sound procedural practice recommends including a list of established facts, this is not mandatory if the facts and evidence underlying the judicial decision can be identified from its text; that omission may be remedied at this level of review if deemed necessary. Interlocutory decision number 102-14, issued at 15 hours and 53 minutes on 8 de octubre del 2014, sets forth the factual basis found by the court below (A quo), with reference to the evidence, for partially granting the interim measures (medidas cautelares) in the manner ordered.
It should be noted that the court found the existence of a spring (naciente) within the plaintiff company’s property, which it stated was located at [Dirección1] from the boundary of the property along the riverbank, which was undergoing erosion and had exposed roots. This fact was verified through the judicial inspection (reconocimiento judicial) conducted and preserved on a compact disc forming part of this case file. Based on that fact, the court decided to grant the measure in part and ordered that the defendant halt any work in that area affecting the wall of the property, because of the potential impact on the spring. Nor can the contention that the trial judge granted the measure without any evidentiary or legal basis be sustained. A reading of the order having the effect of a judgment described in this decision reveals a legal analysis of each requirement for the requested atypical interim measure (medida cautelar atípica), as well as the reasons for the ruling, with reference to the evidence available at this preliminary procedural stage.
This reviewing court agrees with those conclusions regarding the proper protection that must be afforded to the spring found near the riverbank and within the plaintiff’s property. The contention that evidence submitted when the appealed measure was issued was not considered, allegedly leaving the appellant without a defense, is rejected. The allegation that the judicial inspection failed to refer to the presence of operating machinery is likewise rejected. After listening to and viewing the video of the judicial inspection conducted on 16 de setiembre del 2014, no machinery was observed in operation, nor did the judge indicate that any was present. That omission does not undermine the court below’s observation regarding the existence of a flowing spring and its location 15 or 20 metros from the river’s edge and from the eroding wall with exposed roots. The contention that the judge failed to consider official communication DGM-CMRHA-121-2014 of 21 de octubre del ese mismo año is rejected.
The judicial inspection was conducted on 16 de setiembre, and the interlocutory order having the effect of a judgment was issued at 15:58 horas on 8 de octubre del 2014. As of that date, the official communication that the appellant claims was not considered had not yet been issued. Nevertheless, because it is important in assessing the appropriateness of the measure adopted, a reading of the document shows that it is a report addressed to the Dirección de Geología y Minas by the Coordinador Minero de la Región Huetar Atlántica, dated 21 de octubre del año 2014. The document begins by stating that on 12 de agosto, a visit to concession area 7-2010 was requested to verify the information recorded in the geological logbook. As background, it states that decision 753 of 5 de agosto del 2014 reported the outcome of complaint 25-2014, including official communication DGM-CRHA-032-2104. It further states that the complaint was dismissed and that the concessionaire was required to improve the existing road surface to facilitate the entry of machinery to the islet.
In describing the field visit conducted on 14 de octubre de ese año, the Mining Coordinator states that the relevant documents were prepared and that the Supervising Geologist and the concessionaire’s representative were present. The report describes the existence of two branches of the river, conditions affecting access across the riverbed, and the flow areas visited. The conclusions and recommendations state that the complainant’s access route to the islet runs through the publicly owned riverbed (cauce de dominio público), with systems maintaining flows close to 90 M/segundos of rainfall, and that the rearrangement of the system’s alluvial bars and the flow covering the entire hydraulic cross-section are normal. It further states that, in the author’s assessment, “the extraction of materials has not caused the changes in the riverbed that prevent access to the islet or to the property located on the left bank, and that the changes are attributable to natural conditions and normal erosional and depositional patterns of meandering river systems involving the río Puesto Viejo.” It states that, according to the supervising geologist, access to the islet had remained open and products originating from the islet had been transported out.
Based on the recommendations made therein, the complaint appears to concern problems with access to the plaintiff’s property across the riverbed, and improvements to those crossings were ordered, which have become difficult because of weather and rainfall conditions. This Court considers that the document is important for deciding the merits of the proceedings, in which it is alleged that the defendant’s activities in exercising the concession caused a change in the riverbed, but not for deciding this interim measure. This is because the document concerns oversight inherent in the exercise of a concession to extract materials from a publicly owned riverbed by the competent authorities, in response to an existing complaint concerning the access crossings to the so-called islet. That issue differs from the measure granted in the appealed decision, which concerns the protection of a spring located within the plaintiff’s property.
Another matter to be assessed is the appellant’s argument that the action was brought in bad faith and recklessly because documents rejecting complaints were not submitted, and that those technical and scientific documents show that the defendant is not responsible for the conduct alleged by the plaintiff. In the view of this Court, those assessments are matters to be resolved in the principal proceedings when determining whether to grant or dismiss the claim, and must be analyzed by the judge who issues the judgment on the merits. It is not appropriate to assess such matters in these summary interim proceedings (proceso sumarísimo cautelar). Although the report cited in this decision is a technical document issued within the respective authority of the Registro Minero and the Dirección de Geología y Minas, it refers to matters other than the spring whose protection is sought, which is not even considered in the report because the report was issued in connection with other factual and legal circumstances.
The appellant alleges that its constitutionally guaranteed right of defense and its right under Article 8 of the American Convention on Human Rights were violated by the limited assessment of the evidence and the curtailment of its right to prove its assertions. That argument cannot be sustained because, as shown by the description of the actions taken in connection with the interim measure and the proceedings, and as reflected in this record, its right to appeal the ruling and to submit useful, relevant, and necessary evidence rebutting what the judge observed during the judicial inspection was protected. The matter was decided while preserving a balance between the party’s interest as a concessionaire holding the right to extract materials from the publicly owned riverbed under authorization obtained through lawful channels and the corresponding duty to protect the right to a healthy and ecologically balanced environment, guaranteed by Article 50 of the Constitution and by the entire body of national and international environmental law governing the matter.
It should be recalled that the principles of prevention and precaution apply in environmental matters. The latter was appropriately invoked by the trial judge to protect the water resource found on the plaintiff company’s land, and the judge stated that, because the decision was provisional, it could be modified if evidence warranting such modification were introduced into the proceedings. The burden of proof in environmental matters differs from and is the reverse of the traditional regime applicable to civil liability matters. It is reversed, and the developer of an activity is required to establish, through technical, scientific, and legal means, that its actions do not affect the environment. That burden of proof does not rest on the plaintiff. These concepts are inherent in Environmental Law and find legal support in the constitutional provision cited above, Ley Orgánica del Ambiente N. 7554, Ley de Biodiversidad, and the various international instruments governing the conduct of persons residing in the Costa Rican State.
In this regard, and for further clarification, the Sala Primera de Justicia stated in its decision issued at 11:00 horas on 12 de octubre del 2009: “one of the guiding principles of Environmental Law, underlying Articles 46 and 50 of the Political Constitution, is the precautionary principle, or the principle of prudent avoidance. According to legal doctrine, this field involves not only known risks, but also potential scientific uncertainty regarding the extent of certain harm. This principle therefore requires that, when reasonable doubt arises concerning the dangerousness of any activity having environmental or human-health effects, the activity be avoided or the appropriate measures be taken to prevent the potential harm, although not yet scientifically proven, from occurring. It has two prerequisites: lack of scientific certainty and a threat of harm. It is expressly embodied in the ‘United Nations Conference on Environment and Development,’ or ‘Rio Declaration’: ‘Principle 15.- In order to protect the environment, the precautionary approach shall be widely applied by States according to their capabilities.
Where there is a threat of serious and irreversible damage, lack of full scientific certainty shall not be used as a reason for postponing cost-effective measures to prevent environmental degradation.’ Ley de Biodiversidad, number 7788 of 30 de abril de 1998, in turn, provides: . ..... In this regard, the Sala Constitucional, in decision 1250-99 issued at 11 horas 24 minutos on 19 de febrero de 1999, stated: ‘... Prevention seeks to anticipate negative effects and to ensure the protection, conservation, and proper management of resources. Accordingly, the guiding principle of prevention is based on the need to take and implement all precautionary measures to avoid or contain potential harm to the environment or human health. Thus, when there is a risk of serious or irreversible harm—or doubt in that regard—a precautionary measure must be adopted, including, where appropriate, postponement of the activity concerned.
This is because, in environmental matters, coercive action after the fact is ineffective; once socially harmful biological consequences have already occurred, punishment may carry moral significance, but it will scarcely compensate for the harm caused to the environment.’ (The underlining does not appear in the original. See also, among others, decisions 9773-00 of that judicial body, issued at 9 horas 44 minutos on 3 de noviembre de 2000, and 1711-01, issued at 16 horas 32 minutos on 27 de febrero de 2001).”
Then, in voto 3480-03, issued at 14 hours 2 minutes on 2 de mayo de 2003, it further clarified that concept: “Properly understood, the precautionary principle (principio precautorio) refers to the adoption of measures not in the absence of knowledge of facts that generate risk, but in the absence of certainty as to whether such facts will actually have harmful effects on the environment.” (Emphasis added). Likewise, in decision [Telf1], issued at 14 hours 14 minutes on 3 de julio de 2003, it stated: “...4.- Precautionary principle: … The term prevention derives from the Latin ‘preventivo,’ which refers to the action and effect of preventing, and to those preparations and arrangements made in advance to avoid a risk or carry something out. Prevention seeks to anticipate negative effects and ensure the protection, conservation, and proper management of resources. Consequently, the guiding principle of prevention is founded on the need to take and implement all precautionary measures to avoid or contain possible harm to the environment or human health.
Thus, where there is a risk of serious or irreversible harm—or doubt in that regard—a precautionary measure must be adopted, and the activity in question may even be postponed. This is because, in environmental matters, ex post coercion is ineffective, since once the biologically and socially harmful consequences have already occurred, enforcement may have moral significance, but it will hardly compensate for the damage caused to the environment.” (To the same effect, see voto 2008-17618, issued at 11 hours 51 minutes on 5 de diciembre de 2008 by that Chamber).” The appellant may submit evidence to the case file, by such means as it deems necessary, establishing that the spring (naciente) located at [Dirección7] from the riverbank and within the plaintiff’s property will not be harmed by the extraction of material from the riverbed, an activity for which it is authorized under a concession.
Such evidence must be submitted before the court below (A quo), through the appropriate procedural channels, in order to overturn the ruling and demonstrate that the spring, as an existing watercourse, is not at risk of being harmed. This is in view of its proximity to the riverbed where extraction work is carried out. In another respect, and having considered its grievance, the argument that its right of defense and the principle of immediacy (principio de inmediatez) inherent in Agrarian Law (Derecho Agrario) were violated because notice of the appealed measure was served three months later is also rejected. First, the delay in serving that notice does not expose it to liability, because it could exercise its right to appeal only after being notified, as it did. Moreover, the principle of immediacy in this specialized field essentially requires that the agrarian judge who renders the judgment must have received the evidence.
At least, that was how this guiding principle of agrarian proceedings was originally conceived, although it has subsequently been reinterpreted following the enactment of the Ley de Jurisdicción Agraria. In the case at bar, this principle is fully satisfied, because the same judge who conducts the judicial inspection (reconocimiento judicial) is the one who issues the appealed measure. The argument that the court below failed to consider that islands cannot be privately owned is rejected, because that issue pertains to the principal proceeding.
VII.Regarding the grievance concerning the absence of the prerequisites for the approved interim relief (medida cautelar). In the appealed interlocutory judgment, the court below reasons in the third recital that it deems residuality (residualidad) to have been established, given the evidence submitted consisting of photographs, a survey plan of the property over which possession has been exercised, and the observations made during the cited judicial inspection conducted on the bank of the property; these demonstrated the existence of a spring (naciente) that is at risk. That decision states that a large number of exposed roots were observed and that, in the area along the bank, the soil appeared unstable; it also notes the presence of a significant water spring near the bank, and that if work continues on the nearby wall of the property, it will collapse and cause irreparable harm to the spring.
The interlocutory judgment states that the interim relief must be partially granted because there is no other way to protect that body of water from harm. Regarding the likelihood of success on the merits (apariencia de buen derecho), the judge deemed it established because the relief sought in the complaint included the protection of public property. The court reasons that the assessment of plausibility is based on the evidence obtained prima facie and must be at least apparent, since full certainty will be determined in the judgment. The ruling states that the main proceeding seeks payment of damages caused to the property by the plaintiff’s actions, while the interim relief sought consists of suspending the concession granted to the plaintiff and, should the material continue to be extracted, adopting mitigation measures (medidas de mitigación) to prevent the property from being washed away.
The appealed decision reasons that what is decided does not constitute a prejudgment, since evidence remains to be collected and, by virtue of the “pro natura principle” (“principio por natura”), the requirement of likelihood of success on the merits is satisfied. Regarding the risk arising from delay (peligro de demora), the court below found that the urgency of issuing measures was justified pursuant to Article 242 of the Código Procesal Civil, because it is not possible to expedite the issuance of the judgment on the merits and incidental harm may occur as a result of the delay. The ruling held that the plaintiff was correct in requesting that the defendant company be prohibited from performing work along the boundaries of the property because the spring found on that property could be affected, thereby requiring protection that cannot be postponed. It ordered that the interim relief be partially granted and that Sociedad Indaco Horquetas S.A. suspend the work performed along the boundaries of the plaintiff’s property in order to protect the natural resource, while denying the suspension of the concession.
It warned that this was a provisional and preventive decision, without prejudice to its modification upon the submission of additional evidence. MINAET was asked to conduct an inspection at the site in order to advise the Court whether it would be feasible to adopt any containment measure that would protect the spring and the wall located on the bank of Río Sucio, specifically along the boundary of the plaintiff’s property. After the decision was issued, Área de Conservación Cordillera Volcánica Central, in response to an official request from the Court, reported (folio 50) that the matter requested did not fall within that office’s jurisdiction because it involved actions to be carried out in the riverbed, as well as the use of material from it, which falls within the jurisdiction of Dirección de Aguas del MINAET and Dirección de Geología y Minas. By order issued at 10:38 hours on October 27, 2014 (folio 52), it was ordered that a writ be directed to those competent offices so that they could indicate whether it was feasible to adopt containment measures to protect the spring; however, the response provided by those offices does not appear in this case file.
Accordingly, this grievance must be rejected. Likewise, the request made in the appeal brief that the plaintiff be ordered to pay costs and damages must be rejected. Such claims are matters for the principal decision in the ordinary proceeding and may not be sought within an interim-relief proceeding, such as the one before us. The appropriate procedural avenue must be pursued for that request.
VIII.It is important to note that the concession granted to the defendant company has been legally established and that the activity has not been suspended, since that interim relief was not granted. That activity was granted as a concession by the State, and its oversight is exercised by Departamento de Geología y Minas through the legal mechanisms established by Código de Minería and its regulations. The concession authorization (título autorizatorio de concesión) permits it to extract material from the river in question under the conditions established by that agency, which are based on technical criteria specific to the field of geology and related disciplines. Compliance with the technical recommendations issued by the project’s responsible professional (persona regente) and the mining authorities in accordance with the environmental impact assessment instrument (instrumento de evaluación de impacto ambiental) governing the management of riverbed extraction activities constitutes the means by which the State ensures that extraction is carried out in harmony with the environment, surrounding resources and features, and the body of water.
This is a lawful activity of great importance to the country’s economic development. Because that activity must be regulated in view of the environmental impact it entails and is technically managed, and by virtue of the principle of proper administrative coordination (principio de la debida coordinación administrativa) governing environmental management, it is appropriate to issue an official communication to Dirección de Geología y Minas and Departamento de Aguas informing them of the decisions rendered in this proceeding at both levels of jurisdiction, so that they may incorporate the existence of that spring on the plaintiff’s property—which they may be unaware of—into the instruments used to oversee riverbed material extraction activities. This communication will enable it to be considered in any technical recommendations that those agencies deem appropriate to issue within their substantive environmental powers, for the purpose of protecting the body of water observed by the lower-court judge.
IX.For the foregoing reasons, and pursuant to Articles 1 and 2 of Ley de Jurisdicción Agraria and Article 242 of Código Procesal Civil, the evidence offered in the appeal brief challenging the interim relief must be rejected, and the appealed interlocutory judgment must be affirmed.
THEREFORE:
The evidence offered with the appeal of the interim relief is rejected. The requested nullity is denied. Interlocutory judgment one hundred two-fourteen, issued at fifteen hours and fifty-three minutes on October 8, 2014, is affirmed. This decision and the decision issued by the Court concerning this interim relief shall be communicated to Dirección de Geología y Minas and Departamento de Aguas to inform them of the decisions rendered in this proceeding at both levels of jurisdiction, so that they may incorporate the existence of the spring on the plaintiff’s property into the instruments used to oversee riverbed material extraction activities. VOTO N° 000693-F-2015 TRIBUNAL AGRARIO. SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ.- A las trece horas y dieciséis minutos del trece de julio de dos mil quince.- PROCESO ORDINARIO planteado por SOCIEDAD AGROMECANICA F Y P SOCIEDAD ANÓNIMA, cédula jurídica número CED1 - - , representada por su presidente con facultades de apoderado generalísimo sin límite de suma [Nombre1] , cédula de identidad CED2 - - ; contra SOCIEDAD INDACO HORQUETAS SOCIEDAD ANÓNIMA, cédula jurídica número CED3 - - , representada por su presidente con facultades de apoderado generalísimo sin límite de suma [Nombre2] , mayor, separado, ingeniero, cédula de identidad CED4 - - . Actúa como apoderado especial judicial de la parte actora, el letrado Roberto Soto Vega, cédula de identidad CED5 - , ; y de la parte demandada la licenciada Ana Lucrecia Quirós Montoya, cédula de identidad CED6 - - , colegiada cinco mil doscientos cuarenta y tres; y Wilbert Montenegro Reyes, cédula de identidad CED7 - - , colegiado seis mil seiscientos setenta y dos. Tramitado ante el Juzgado Agrario del Segundo Circuito Judicial de la Zona Atlántica, Guápiles.- Redacta la jueza Castro García; y,
CONSIDERANDO:
I.Prueba para mejor resolver. La apelante ofrece como prueba de esta apelación, la declaración de cuatro testigos para que indiquen la demandada ha explotado la concesión apegada a las disposiciones legales y no ha invadido la finca de la accionante y el testimonio de funcionario Coordinador Minero de la Región Huetar Atlántica que ha supervisado la labor de extracción. Además solicita prueba confesional, pruebas documentales, la solicitud de remisión de copia certificada de expediente minero a nombre de la recurrente y prueba pericial, así como audiencia oral. Todo lo cual se rechaza con fundamento en el artículo 52 de la Ley de Jurisdicción Agraria, dado que con lo que consta en el legajo remitido a esta sede por el Juzgado es suficiente para resolver el recurso interpuesto contra la medida cautelar; además, lo solicitado no logra desvirtuar que existe una naciente ubicada dentro de la finca de la actora a [Dirección1] de la rivera del río sometido a actividades extractivas en virtud de la concesión a la demandada.
II.La demandada [Nombre3] interpone recurso de apelación (folio 97) contra el auto sentencia 102-14 de las 15 horas y 53 minutos del 8 de octubre del 2014 del Juzgado Agrario del II Circuito Judicial de la Zona Atlántica, en el que procede a invocar motivos de nulidad contra lo resuelto en la medida cautelar emitida dentro del proceso ordinario incoado en su contra por la sociedad AGROMECÁNICA F Y P. Como motivos de nulidad expone:
III.Este Tribunal reiteradamente ha señalado los tres presupuestos básicos de procedibilidad en las medidas cautelares: residualidad, apariencia de buen derecho y peligro de demora. Todos esos requisitos son ponderados dentro de un proceso sumarísimo, donde se valoran los elementos que existen en autos. Las medidas cautelares no deben, ni pretender resolver sobre el fondo del asunto de una forma anticipada. Su objetivo, de conformidad al ordinal 242 del Código Procesal Civil de aplicación supletoria a esta materia, son procedentes: "… cuando hubiere fundado temor de que una parte, antes de la sentencia, le cause al derecho de la otra parte una lesión grave y de difícil reparación. Para evitar el daño, el juez podrá autorizar o prohibir la práctica de determinados actos, ordenar el depósito de bienes o imponer el otorgamiento de una caución". Y sobre la pertinencia de su dictado en protección de los recursos naturales y la producción agraria se ha resuelto: " La doctrina ha desarrollado, dentro del principio de los amplios poderes del Juez, el "Poder Cautelar del Juez Agrario", cuya finalidad estriba precisamente en proteger esas situaciones para satisfacer un interés, no de la parte, sino un interés de la colectividad.
Así, se han creado medidas tendientes tanto a la tutela de la producción, como de la conservación de recursos naturales. Evidentemente, es importante el poder cautelar del Juez Agrario para tomar medidas tendientes a proteger la producción, ya sea prohibiendo o autorizando determinado tipo de actos (voto 173-F-08)
IV.Para analizar la base fáctica sobre la cual se ha dictado la medida cautelar apelada, se hace necesario el análisis de la demanda, contestación y pruebas aportadas al legajo remitido por el despacho de instancia. Lo anterior a fin de verificar la instrumentalidad de la medida ordenada y determinar si lleva razón el recurrente en sus reproches. Consta a folio 22 escrito de demanda incoada por Agromecánica F y P S.A, contra sociedad Indaco Horquetas S.A. Describe en la demanda la actora, es titular de la finca matrícula [Placa1] de Heredia, con cabida de 19 hectáreas 8571,31 metros cuadrados y descrita en el plano H-0463158-1982. Finca reforestada de melina bajo el sistema de pago por servicios ambientales y en las cercanías con el río estaba sembrada con especie de zota caballo y la melina en fase de aprovechamiento. (hecho 1). Cita, la finca es una especie de isla rodeada por el rio Puesto Viejo, sin que tuvieran nunca problemas de lavado de la finca.
Expone, (hecho 3) por resolución R-80-2012-MINAET, a la demandada se le otorgó concesión de explotación de materiales en el cauce del rio Puerto Viejo por el plazo de diez años firmada por el Poder Ejecutivo (Presidente y Ministro del Ramo). Cita, (hecho 4) en esa resolución se señala en la parte dispositiva que la concesionaria debe cumplir durante la ejecución de las labores de explotación con las recomendaciones y7 condiciones técnicas establecidas en el oficio DGM-CRHA-075-2011 del 22 de junio del 2011, donde se detallan en el resultando V y forman parte integral de la concesión, si como cualquier otra recomendación que emita la Dirección de Geología y Minas y la Secretaría Técnica Ambiental. En el hecho quinto transcribe literalmente parte de la resolución R-80-2012 MINAET que otorgó la concesión, que en lo que interesa señala que mediante memorando DGM-CRHA-075-2011 del 22 de junio del 2011 la Dirección de Geología y MInas emite recomendaciones técnicas y concluye que se recomienda al Registro Nacional Minero continuar con los trámites para el otorgamiento de la concesión, considerando las características y recomendaciones de otorgamiento que atiende al análisis del Programa de Explotación de EsIA y las observaciones de campo.
Como tales cita, el proyecto se ubica entre las coordenadas [Dirección4]/ de la Hoja Cartográfica Río Sucio escala 1:50000 del IGNCR. Los terrenos plateados para las operaciones se ubican dentro del [Dirección5] , de la provincia de Heredia, 5 kilómetros [Dirección6] del cruce de Río Frío. en la localidad de [Nombre8] . Indica, no se deben realizar operaciones mineras fuera del área concesionada. El área concesionada no incluye el islote ubicado entre las secciones 7 y 14 del programa de explotación, por lo que la maquinaria no podrá ingresar a dicho terreno en condiciones normales. Menciona, se debe respetar la zona del río de 15 metros en lo que se refiere a la conformación de los montículos de acumulación de materiales y de cualquier otra obra además de los caminos a lo largo del cauce. En el hecho sexto de la demanda se expone, la accionada decidió invadir la isleta con maquinaria pesada, se introdujo, invadió y desapareció gran parte de la misma en un área aproximada de dos hectáreas.
Agrega, no respetó las zonas de protección, desapareció áreas de nacientes, y desvió el cauce natural del río, dragando, extrayendo material y realizando actividades propias de la extracción de cauce que provocan deslave de su finca y la de sus vecinos, pues al desaparecer áreas de las fincas, se han formado playones en el río para facilitar el aprovechamiento de los materiales y lo árboles que mitigaban las zonas de protección del río que fueron derrivados y lavados por la acción de la demandada. Aduce ( hecho 7), actualmente el resto de su finca corre el peligro de ser invadida y desaparecida, con las nacientes existentes y los árboles reforestados. En el hecho octavo describe los daños y perjuicios que indica ha sufrido. Detalla como daño la perdida de aproximadamente dos hectáreas de su finca valorada en cien millones y la pérdida de los árboles reforestados de melina por un monto de tres millones quinientos mil colones y los perjuicios corresponden a los intereses sobre esa suma, así como el costo que pericialmente se llegue a determinar que cueste la recuperación de las nuevas zonas de protección con reforestación y labores de relleno, estimadas prudencialmente en la suma de veinte millones de colones.
En la sección de la demanda que denomina Pretensión, como preámbulo, dados los hechos sui generis donde un concesionario ingresa con permisos legalmente otorgados a extraer materiales, incumpliendo la prohibición de introducirse en el islote de su representada, ésta se introduce por la fuerza, elimina árboles y parte de la misma; todo con el objetivo de facilitar la extracción en áreas donde brotaban manantiales de agua que constituyen zonas de protección y que hacen desaparecer dos hectáreas de terreno. Zona en la que están laborando y que se convirtió en parte del cauce del Río Puerto Viejo y donde tienen almacenados materiales. Y dado que la acción de un tercero encomendado por el Estado para la extracción mediante concesión, va más allá de lo legalmente permitido causando daños y perjuicios, y que al no ser posible recuperar la cosa, se debe aplicar el numeral 325 del Código Civil, pide se declare en sentencia :
V.La demanda descrita se presentó el 1 de setiembre del año 2014 y se emite el auto traslado mediante resolución de las de las 08:13 horas del 5 de setiembre del mismo año, fijándose fecha para reconocimiento judicial de la medida cautelar el día 16 de setiembre siguiente. Consta (folio 34) minuta de acta de reconocimiento judicial en donde se indica que se utilizará cámara de video, adjuntándose al expediente el respectivo disco compacto que lo contiene. En tal, se describe por el juzgador la situación que observó. Se muestra en el video un sector cubierto de rocas y un cauce de río que lo atraviesa en una parte, que se indica por el juez se le señala por la actora, tal no existía y que esa área formaba parte integral de la cabida de su finca. Se consigna por el juez, visualiza un pequeño islote o isla bordeada por cauce de río, cuya zona le menciona la actora, formaba parte de su inmueble y que al momento de la visita se encontró separada.
Área que tiene plantados algunos árboles de zotacaballo y cepas de plátanos y se observa con vegetación diversa. Se muestra por la actora, por donde transcurría el cauce del río y que ahora tiene un brazo que se observa y antes no existía. Ese brazo del río, se encuentra al lado del paredón de tierra de la finca de la actora, que se nota en deslave en algunas secciones y con una altura pronunciada respecto al cauce de río que se visualiza. En otro orden describe el juzgador, como a quince metros del paredón que se esta socavando en el brazo del río y dentro del terreno de la actora, encontró una naciente bordeada de vegetación diversa con cauce hídrico importante, que es mostrada. De igual forma se observa en el video, un árbol de melina en el suelo y a la rivera del cauce, así como varios metros a lo largo del cauce con suelo y raíces expuestas a lo largo de la rivera. En esa grabación se detalla, existe el cauce original del rio por donde discurre, pero se muestra un brazo que se adentra en lo que actualmente son playones de arena y piedra y que colindan actualmente con la finca de la sociedad actora.
Que alega, antes esos playones no existían en el sitio actual, ni tampoco ese brazo del río que se adentra en lo que anteriormente era terreno de su representada. El día 8 de octubre del 2014, se resuelve la medida que se apela (folio 39).
VI.Analizado el proceso, así como los agravios, no estima este Tribunal se hubiera emitido un auto sentencia viciado de nulidad, ni la transgresión de las normas legales que acusa la apelante. En primer orden, no resulta atendible el motivo de nulidad sobre la falta de hechos probados de la resolución recurrida, pues lo emitido es un auto sentencia, que si bien en buena técnica procesal se recomienda agregar un elenco de hechos probados, no es obligatorio si de su lectura se logra identificar los hechos y pruebas que dieron fundamento a la decisión judicial, pudiendo esa omisión cumplirse en esta Instancia de estimarse necesario. En la resolución cautelar numero 102-14 de las 15 horas y 53 minutos del 8 de octubre del 2014, consta la base fáctica que constató el A quo, con mención de los elementos de prueba, para proceder a acoger parcialmente las medidas cautelares en la forma resuelta. Obsérvese, constató la existencia de una naciente dentro de la finca de la sociedad actora, que mencionó se encontraba a [Dirección1] de la colindancia de la finca con la rivera del río que estaba en proceso de deslave y con raíces expuestas.
Hecho que comprobó con el reconocimiento judicial realizado y resguardado en disco compacto parte de este expediente. Sobre ese hecho se toma la decisión de acoger parcialmente la medida y ordenar se paralice cualquier obra por parte de la demandada en ese sector que afecte la pared del inmueble, debido a la afectación que puede sufrir la naciente. Tampoco es de recibo el motivo referido a que el juez de instancia acogiera la medida sin ninguna fundamentación probatoria o jurídica. De la lectura de la auto sentencia que se describe en esta resolución, se observa el análisis jurídico de cada uno de los presupuestos de la medida cautelar atípica que se pide y las razones, mencionando la prueba que tuvo a mano en esta primaria fase procesal, para estimar que se debía resolver como se hizo. Conclusiones que comparte esta instancia judicial en cuanto a la debida tutela que debe darse a la naciente encontrada cerca de la rivera del río y dentro de la finca de la actora.
Respecto a la omisión de considerar prueba que aportara al momento de emitirse la medida apelada, lo cual acusa, le produce indefensión, se rechaza. Sobre la omisión apuntada en el reconocimiento judicial de referirse a la presencia de maquinaria laborando, se rechaza. De la escucha y visualización del video de reconocimiento judicial realizada el 16 de setiembre del 2014, no se observó maquinaria laborando, ni se indicó por el juez su presencia. Esa omisión no desvirtúa lo observado por el a quo respecto a la existencia de la naciente de agua con caudal y la distancia a 15 o 20 metros del borde del río y de la pared en deslave que tiene raíces expuestas. Respecto a la omisión del juez de considerar el oficio DGM-CMRHA-121-2014 del 21 de octubre del ese mismo año, se rechaza. Se nota el reconocimiento judicial se realizó el 16 de setiembre y el auto sentencia cautelar se emite a las 15:58 horas del 8 de octubre del 2014.
Fecha para la que aún no se había emitido el oficio que se reprocha por la apelante no se valora. No obstante, y por resultar importante a efectos de valorar la pertinencia de la medida adoptada, de su lectura se observa es un informe dirigido a la Dirección de Geología y Minas por parte del Coordinador Minero de la Región Huetar Atlántica fechado el 21 de octubre del año 2014. Inicia el documento indicando que 12 de agosto se solicita visita al área de concesión 7-2010 a fin de corroborar lo consignado en bitácora geológica. Como antecedente cita que por resolución 753 del 5 de agosto del 2014, se comunica el resultado de denuncia 25-2014, con inclusión de oficio DGM-CRHA-032-2104. Señalándose, la denuncia se declaró sin lugar y que debía la concesionaria hacer un mejoramiento de la superficie de rodamiento existente para facilitar el ingreso de maquinaria al islote. De lo descrito en la visita de campo que hizo el 14 de octubre de ese año, menciona el Coordinador minero se levantaron los documentos respectivos estuvo presente el Geólogo Regente y la representante de la concesionaria.
Describe sobre la existencia de dos brazos del río, aspectos sobre las condiciones de ingresos sobre el cauce y las áreas de flujo que se visitaron. En las conclusiones y recomendaciones, se señala respecto a la vía de ingreso al islote que usa el denunciante, lo es a través del cauce de dominio público con sistemas que mantienen caudales cercanos a los 90 M/segundos de precipitaciones y resulta normal el reacomodo de las barras aluviales del sistema y que el flujo abarque toda la sección hidráulica. Además señala, estima que "la explotación de materiales no ha provocado los cambios de cauce que impiden el ingreso al islote ni a la propiedad ubicada en la margen izquierda y que los cambios obedecen a condiciones naturales y patrones erosivos y depositacionales normales de los sistemas fluviales meándricos con el río Puesto Viejo ". Describe, según indica el regente el paso al islote estuvo habilitado y ha habido acarreo de productos provenientes del islote.
Dado lo allí recomendado, pareciera la denuncia lo es por problemas en el paso a la propiedad de la actora a través del cauce del río y se ordena el mejoramiento de esos pasos, lo cual se ha tornado difícil en virtud de las condiciones climáticas y pluviales. Considera este Tribunal, ese documento resulta de importante valoración para resolver el fondo del proceso en donde se reprocha ha mediado un cambio en el cauce del río debido a la actividad de la demandada en ejercicio de la concesión, no así esta medida cautelar. Pues se refiere a un control propio del ejercicio de una concesión de explotación de cauce de dominio público por los entes competentes, y en atención a denuncia existente y referida a los pasos de acceso al denominado islote. Aspecto diverso a la medida otorgada en la resolución apelada que tiene relación con la tutela de una naciente situada dentro de la finca del actor.
Otro aspecto a valorar, son los argumentos esgrimidos por la apelante son la mala fe y temeridad de la demanda al no aportar documentos que han rechazado denuncias y que son documentos técnicos científicos que demuestran que de lo acusado por la actora no son responsables. En criterio de esta sede, tales valoraciones son temas propios a ser resueltos dentro del proceso principal en aras de estimar o desestimar la demanda y que deberá analizar el juez o jueza que emita sentencia principal. No correspondiendo a este proceso sumarísimo cautelar valorar tales aspectos. Si bien el informe citado en este fallo es un documento técnico emitido dentro de las competencias propias del Registro Minero y la Dirección de Geología y Minas, tal hace alusión a aspectos diversos a la naciente de agua que se pretende tutelar, que ni siquiera en considerada, al haber sido emitido en cumplimento de otras situaciones fácticas y jurídicas.
El apelante agravia, se le ha transgredido su derecho de defensa garantizado constitucionalmente y por el artículo 8 de la Convención Americana de Derechos Humanos, por la limitada valoración de la prueba y cercenarse su derecho a probar su dicho. Lo anterior no resulta de recibo, pues de la descripción de lo actuado dentro de la medida cautelar y el proceso, según consta en este legajo, se le ha resguardado su derecho a apelar lo resuelto, aportar las pruebas útiles, pertinentes y necesarias que desvirtúen lo observado en el reconocimiento judicial por el juez y se resolvió resguardando el equilibro entre el interés de la parte como concesionaria que ostenta el derecho de explotar el cauce de dominio público, por haber sido autorizado por las vías legales, y el correlativo deber de resguardo al derecho al ambiente sano y ecológicamente equilibrado, garantizado por el artículo 50 constitucional y todo el bloque normativo ambiental nacional e internacional que rige el tema.
Es de recordar que en materia ambiental, se aplican los principios de prevención y precaución. Este ultimo fue el invocado por el juez de instancia en forma atinada en aras de resguardar el recurso hídrico encontrado en el fundo de la sociedad actora, e indicó que al ser la resolución provisional, podría ser modificada si llegaran al proceso, elementos que así lo acreditaran. La carga de la prueba en materia ambiental es diversa e inversa al régimen tradicional que se aplica en temas de responsabilidad civil. Se invierte, y es el desarrollador de una actividad, el obligado a acreditar por las formas técnico científicas y legales que sus acciones no afectan el medio ambiente. No es al actor en quien recae esa carga probatoria. Tales conceptos son propios del Derecho Ambiental y encuentran sustento normativo en la norma constitucional mencionada, la Ley Orgánica del Ambiente N. 7554, Ley de Biodiversidad y los diversos instrumentos internacionales que rigen las actuaciones de las personas habitantes del Estado Costarricense.
Al respecto y para mayor ilustración, la Sala Primera de Justicia en resolución de las 11:00 horas del 12 de octubre del 2009: "uno de los principios rectores del Derecho Ambiental, que subyace en los numerales 46 y 50 de la Constitución Política, es el precautorio o de evitación prudente. De conformidad con la doctrina, en esta materia no solo existen riesgos ciertos, sino también puede caber incertidumbre científica respecto del alcance de algunos daños. Este postulado, entonces, exige que, cuando una duda razonable surja en relación con la peligrosidad de cualquier actividad de repercusiones ambientales o a la salud humana, se evite, o se tomen las medidas pertinentes para que ese eventual daño, científicamente no comprobado todavía, no llegue a producirse. Dos son sus presupuestos: falta de certidumbre científica y la amenaza de daño. De manera explícita se encuentra recogido en la “Conferencia de las Naciones Unidas sobre el Medio Ambiente y el Desarrollo”, o “Declaración de Río”: “Principio 15.- Con el fin de proteger el medio ambiente, los Estados deberán aplicar ampliamente el criterio de precaución conforme a sus capacidades.
Cuando haya peligro de daño grave e irreversible, la falta de certeza científica absoluta no deberá utilizarse como razón para postergar la adopción de medidas eficaces en función de los costos para impedir la degradación del medio ambiente”. Por su parte, la Ley de Biodiversidad, número 7788 del 30 de abril de 1998, dispone: . ..... En este sentido, la Sala Constitucional, en el voto 1250-99 de las 11 horas 24 minutos del 19 de febrero de 1999, señaló: “... La prevención pretende anticiparse a los efectos negativos, y asegurar la protección, conservación y adecuada gestión de los recursos. Consecuentemente, el principio rector de prevención se fundamenta en la necesidad de tomar y asumir todas las medidas precautorias para evitar contener la posible afectación del ambiente o la salud de las personas. De esta forma, en caso de que exista un riesgo de daño grave o irreversible –o una duda al respecto-, se debe adoptar una medida de precaución e inclusive posponer la actividad de que se trate.
Lo anterior debido a que en materia ambiental la coacción a posteriori resulta ineficaz, por cuanto de haberse producido ya las consecuencias biológicas socialmente nocivas, la represión podrá tener una trascendencia moral, pero difícilmente compensará los daños ocasionados en el ambiente”.(Lo subrayado no es del original. También, pueden consultarse, entre otros, los fallos de ese órgano jurisdiccional 9773-00 de las 9 horas 44 minutos del 3 de noviembre de 2000 y 1711-01 de las 16 horas 32 minutos del 27 de febrero de 2001). Luego, en el voto 3480-03 de las 14 horas 2 minutos del 2 de mayo de 2003, precisó aún más dicho concepto: “Bien entendido el principio precautorio, el mismo se refiere a la adopción de medidas no ante el desconocimiento de hechos generadores de riesgo, sino ante la carencia de certeza respecto de que tales hechos efectivamente producirán efectos nocivos en el ambiente.”(Lo subrayado es suplido).
De igual manera, en el fallo [Telf1] de las 14 horas 14 minutos del 3 de julio de 2003, indicó: “...4.- Principio precautorio : … El término prevención deriva del latín ‘preventivo’, que alude a la acción y efecto de prevenir, a aquellas preparaciones y disposiciones que se hacen anticipadamente para evitar un riesgo o ejecutar una cosa. La prevención pretende anticiparse a los efectos negativos, y asegurar la protección, conservación y adecuada gestión de los recursos. Consecuentemente, el principio rector de prevención se fundamenta en la necesidad de tomar y asumir todas las medidas precautorias para evitar o contener la posible afectación del ambiente o la salud de las personas. De esta forma, en caso de que exista un riesgo de daño grave o irreversible -o una duda al respecto-, se debe adoptar una medida de precaución e inclusive posponer la actividad de que se trate. Lo anterior debido a que en materia ambiental la coacción a posteriori resulta ineficaz, por cuanto de haberse producido ya las consecuencias biológicas y socialmente nocivas, la represión podrá tener una trascendencia moral, pero difícilmente compensará los daños ocasionados al ambiente.”(En igual sentido, puede consultarse el voto 2008-17618 de las 11 horas 51 minutos del 5 de diciembre de 2008 de dicha Sala)." La parte apelante puede acreditar a los autos, mediante los elementos que estime necesarios que la naciente ubicada a [Dirección7] de la ribera del río y dentro de la finca de la actora, no será dañada en virtud de la actividad de extracción de material del cauce del río a que esta autorizada por concesión.
Prueba que debe aportar ante el A quo y mediante las vías procedimentales para ello, a fin de revertir lo resuelto y demostrar que la naciente como curso de agua existente no corre riesgo de ser dañada. Considerando lo cerca que se encuentra del cauce del río en donde se realizan labores propias de extracción. En otro orden, y visto su agravio, también se rechaza el argumento de habérsele transgredido su derecho de defensa y el principio de inmediatez propio del Derecho Agrario, al haber sido notificada la medida apelada tres meses después. En primer orden, la tardanza en esa notificación no le hace incurrir en responsabilidad, pues hasta que le es notificada, puede ejercer su derecho a apelar, como ocurrió. Por otra parte, el principio de inmediatez en esta materia especializada consiste básicamente en que la persona juzgadora agraria que dicta la sentencia, debió haber recibido la prueba.
Al menos así fue concebido originalmente este principio informador del proceso agrario, que ha tenido sus reinterpretaciones en forma posterior a la emisión de la Ley de Jurisdicción Agraria. En el subjúdice tal principio se cumple a cabalidad, pues el mismo juez quien celebra el reconocimiento judicial es quien emite la medida apelada. Se rechaza el argumento referido a que el a quo dejó de valorar que las islas no pueden ser objeto de propiedad privada, pues ese es un tema propio del proceso principal.
VII.Sobre el agravio de la ausencia de los presupuestos de la medida cautelar aprobada. En el auto sentencia apelado, el A quo razona en el considerando tercero que tiene por acreditada la residualidad, dada la prueba aportada de fotografías, plano de la finca sobre la que ha ejercido posesión, y lo observado en el reconocimiento judicial citado y realizado en la rivera de la propiedad; que demostraron la existencia de una naciente que corren riesgo. Se menciona en esa resolución, se visualizaron una gran cantidad de raíces expuestas y en el sector de la rivera el suelo se muestra inestable, ademas de observar cerca de la rivera una naciente de agua importante, y si en la pared de la finca cercana se continúan realizando labores, caerá y ocasionará un daño irreparable a la naciente. Señala el auto sentencia, se debe acoger parcialmente la medida cautelar pues no existe otra forma de proteger de daño a ese cuerpo de agua.
Respecto a la apariencia de buen derecho, se tuvo por demostrada para el juzgador, al solicitarse en la pretensión de la demanda el aseguramiento de un bien público. Motiva, el juicio de verosimilitud se funda en las pruebas obtenidas prima facie y debe ser al menos aparente, pues la plena certeza se determinará en sentencia. Señala el fallo, se pretende en el proceso principal el pago de daños y perjuicios ocasionados a la propiedad por las acciones de la actora y la pretensión cautelar reside en la suspensión de la concesión otorgada a la actora y que en caso de seguirse aprovechando el material sean adoptadas las medidas de mitigación que eviten el lavado de la finca. Razona la resolución recurrida, sin que lo que se decide sea adelanto de criterio, pues aun falta recabar prueba y en virtud del "principio por natura", se cumple con la apariencia de buen derecho. Sobre el peligro de demora, consideró el A quo la urgencia en el dictado de medidas lo justifican con fundamento en el artículo 242 del Código Procesal Civil.
Pues no es posible adelantar el dictado de la sentencia de fondo y se puede presentar un daño marginal ocurrido a causa del retraso. Se resolvió en el fallo, lleva razón la parte actora cuando solicita se le impida a la sociedad demandada realizar trabajos en los márgenes de la finca debido a que puede ser afectada la naciente encontrada en ese inmueble, tutela impostergable. Decretó acoger parcialmente la medida cautelar y ordenar a Sociedad Indaco Horquetas S.A. suspender los trabajos realizados en los márgenes de la propiedad de la actora a fin de proteger el recurso natural y rechazar la suspensión de la concesión. Se hizo la advertencia de que es una resolución provisional y preventiva, sin perjuicio de ser modificada con mayores elementos probatorios. Se solicitó a MINAET realizar un reconocimiento en el lugar, a fin de que indicaran al Despacho si resultaba factible adoptar alguna medida de contención que diera protección a la naciente y a la pared ubicada en la rivera del Río Sucio; específicamente en la colindancia de la finca de la actora.
Luego de su emisión, el Área de Conservación Cordillera Volcánica Central en respuesta de oficio del despacho, informa ( folio 50), lo solicitado no es competencia de esa oficina, pues involucra acciones a ser ejecutadas en el cauce del río, así como uso de material del mismo, lo cual es competencia de la Dirección de Aguas del MINAET y de la Dirección de Geología y Minas. Por auto de las 10:38 horas del 27 de octubre del 2014 ( folio 52) se ordenó dirigir mandamiento a esos despachos competentes a fin de indicar si es factible asumir medidas de contención que resguarden la naciente, sin que conste en este legajo la respuesta dada por esas instancias. Por lo que debe ser rechazado su agravio. De igual forma, debe rechazarse su pretensión expuesta en el escrito de apelación de que se condene en costas a la actora y a los daños y perjuicios. Pues tales pretensiones son propias de resolución principal del proceso ordinario y no caben ser peticionadas dentro del un proceso cautelar, como el que nos ocupa. Debe acudir para su solicitud a la vía procesal pertinente.
VIII.Es importante señalar que la concesión otorgada a la sociedad demandada se encuentra legalmente constituida y tal actividad no ha sido suspendida, pues esa medida cautelar no se acogió. Esa actividad ha sido concesionada por el Estado y su control lo ejerce el Departamento de Geología y Minas, mediante los medios legales establecidos por el Código de Minería y su reglamento. El título autorizatorio de concesión, le permite extraer material del río en cuestión, dentro de las condiciones que esa dependencia estableció y que obedecen a criterios técnicos propios de la disciplina geológica y relacionadas. El cumplimiento de las recomendaciones técnicas de la persona regente del proyecto y las autoridades mineras emitidas a la luz del instrumento de evaluación de impacto ambiental que rige la gestión de la actividad extractiva del cauce, constituyen la forma en que el Estado asegura que la extracción se desarrolle de forma armoniosa con el ambiente, los recursos y elementos aledaños y el cuerpo de agua.
Actividad lícita y de gran importancia para el desarrollo económico del país. Como esa actividad debe ser controlada en virtud del impacto ambiental que conlleva y es gestionado técnicamente, en virtud del principio de la debida coordinación administrativa que impera en la gestión ambiental, resulta conveniente que se emita un oficio a la Dirección de Geología y Minas y el Departamento de Aguas a fin de informar lo resuelto en este proceso en ambas instancias, con el objeto de que incorporen dentro de los instrumentos de ejercicio de control de la actividad de extracción de material del cauce, el elemento de la existencia de esa naciente en el terreno del actor, pues puede ocurrir que lo ignoren. Esta comunicación permitirá que sea un factor valorado en las recomendaciones técnicas que estimen esas dependencias emitir dentro de sus competencias sustantivas ambientales, en aras de tutelar ese cuerpo de agua observado por el juzgador de instancia.
IX.Por las razones expuestas, y con fundamento en el artículo 1 y 2 de la Ley de Jurisdicción Agraria , 242 del Código Procesal Civil, deberá rechazarse la prueba ofrecida en el escrito de apelación contra la medida cautelar y confirmarse el auto sentencia recurrido.
POR TANTO:
Se rechaza la prueba ofrecida con el escrito de apelación de medida cautelar. Se deniega la nulidad solicitada. Se confirma el auto sentencia ciento dos- catorce de las quince horas cincuenta y tres minutos del ocho de octubre del dos mil catorce. Comuníquese esta resolución y la emitida por el Juzgado sobre esta medida cautelar a la Dirección de Geología y Minas y al Departamento de Aguas a fin de informar lo resuelto en este proceso en ambas instancias, para que incorporen dentro de los instrumentos de ejercicio de control de la actividad de extracción de material del cauce, el elemento de la existencia de la naciente en el terreno del demandante. Emítase el oficio de rigor por parte del juez Tramitador de este Tribunal, y remítase antes de la devolución del legajo de medida cautelar al Juzgado de origen.- [Nombre9] - JUEZ/A DECISOR/A [Nombre10] - JUEZ/A DECISOR/A DAMARIS VARGAS VÁSQUEZ – JUEZ/A DECISOR/A
