The following attorneys act as counsel of record (abogados directores): for the petitioner, Róger Alexis Barboza Lépiz, bar membership number five thousand fifty-two; and for the Asociación de Desarrollo para la Ecología, attorney Jorge Aquiles Brenes Martínez, bar identification number thirteen thousand seven hundred eighty-eight. Proceeding heard before the Agrarian Court of the First Judicial Circuit of the Atlantic Zone, seated in Limón.- Judge Alvarado Paniagua drafts the decision; and,
WHEREAS:
I.The unlimited general attorney-in-fact of the Asociación de Desarrollo para la Ecología appeals the ruling issued at thirteen hours and forty-four minutes on March four, two thousand fifteen, stating that the areas for which title is sought are located within the Río Banano protected zone (zona protectora) and the buffer zone (zona de amortiguamiento) of that protected zone, and that the grounds for opposition raised by the Instituto de Acueductos y Alcantarillados must therefore be seriously considered, since that watershed (cuenca) is a source of water supply for the population. He states that, by a ruling issued at thirteen hours and forty-four minutes on March four of the current year, the Court summarily dismissed (rechazar de plano) the opposition. He asserts that the judge disregarded the provisions of Article 8 of the Ley de Informaciones Posesorias concerning suspension of the proceedings so that the parties may establish their rights in a declaratory proceeding (juicio declarativo), and the proceeding may be archived. He states that there are prior proceedings in which the possessory information petition had already been denied. (see appeal brief at folios [Telf1]).-
II.For purposes of resolving this matter, the following procedural events are relevant: a) The unlimited general attorney-in-fact of the Asociación de Desarrollo para la Ecología entered an appearance (se apersona) in the possessory information proceeding and filed an opposition thereto in a brief submitted on February 27, 2015, as evidenced by the acknowledgment of receipt at folio 2472.- b) The public notice (edicto) summoning all persons interested in these possessory information proceedings to appear and assert their rights within ONE MONTH from the date of publication was published on May 26, 2014, in Boletín Judicial Número 99. (folio 117 of volume I). The appellant’s appearance in opposition occurred several months after expiration of the one-month period within which the opposition was required to be filed; it was therefore untimely and, as such, must be dismissed.- The foregoing is legally grounded in the second paragraph of Article 5 of the Ley de Informaciones Posesorias, which establishes that one-month period as mandatory (perentorio), in accordance with the procedural principles of promptness and economy, as procedural safeguards for the parties.- This Court does not agree with the grounds for dismissal stated by the court below (a-quo), because this opposition is inadmissible due to the untimeliness of its filing, as stated above; nor does this Court rule on the remaining grounds of appeal or on standing to participate in the proceeding (legitimación de participación procesal), as these are matters that must in any event be analyzed only upon judgment, since they concern the merits and were also raised by the State’s representative, and may even be reviewed by the court on its own motion (oficiosamente).- Accordingly, the challenged ruling must be affirmed insofar as it dismisses the opposition of the Asociación de Desarrollo para la Ecología, albeit on the grounds stated by this appellate court.-
The undersigned judge concurs with the decision reached in this ruling; however, she considers it necessary to add the following grounds: First, the standing (legitimación) of Eco Proyección del Nuevo Milenio S.A. to file the opposition must be analyzed in order to determine whether it may appear and oppose these proceedings. Without addressing the merits of the dispute, because the arguments presented by that corporation’s representative may be considered only upon judgment, given that the opposition to the Possessory Information Proceeding was dismissed as untimely, it must be taken into consideration that this is an eminently environmental matter. Indeed, Article 45 of the Political Constitution, which governs the property right—to be formalized in this Possessory Information Proceeding—must be analyzed in conjunction with Article 50, which provides: "... Every person has the right to a healthy and ecologically balanced environment.
To that end, every person has standing to report acts that infringe that right and to seek reparation for the damage caused...". In this regard, it may be inferred from the opposing corporation’s arguments that its principal contention is: "The petitioning corporation is attempting to register a property that forms (sic) part of the Río Banano protected zone, with another part lying within the buffer zone of that protected zone; accordingly, the positions expressed by Acueductos y Alcantarillados, an institution that opposes such titling, must be seriously considered, just as the Instituto de Desarrollo Agrario, now INDER, did in another Possessory Information Proceeding concerning this same property..." (folios 2476 and 2477). It follows from the foregoing that the argument concerns an environmental matter; therefore, pursuant to the aforementioned Article 50, the corporation does have standing to oppose the proceeding.
However, because it did so after the deadline, its application must be denied. It is important to note that when oppositions are filed in Possessory Information Proceedings, pursuant to Articles 5 and 8 of the Ley de Informaciones Posesorias, the judicial authority must limit itself to determining whether the opposition is well-founded and, of course, whether it was filed within the statutory period, in which case the authority must order the proceeding archived; or, if it is untimely, dismiss it. In neither circumstance should any assessment be made as to whether the grounds for opposition are legally sustainable—as was done in the challenged ruling—because that analysis must be reserved for the judgment, since this is a non-contentious proceeding (proceso de naturaleza no contenciosa).-
THEREFORE:

SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ.- A las trece horas y cincuenta y cuatro minutos del veintiséis de junio de dos mil quince.- 2 INFORMACIÓN POSESORIA promovido por ECO PROYECCIONES DEL NUEVO MILENIO SOCIEDAD ANÓNIMO, cédula jurídica número CED1 - - , representada por su presidente con facultades de apoderado generalísimo sin límite de suma [Nombre1] , mayor, casado, empresario, vecino de San Ramón de Alajuela, cédula de identidad número CED2 - - . Actúan como abogados directores los licenciados: del promovente Róger Alexis Barboza Lépiz, colegiado número cinco mil cincuenta y dos; y de la Asociación de desarrollo para la Ecología el letrado Jorge Aquiles Brenes Martínez, carné número trece mil setecientos ochenta y ocho. Tramitado ante el Juzgado Agrario del Primer Circuito Judicial de la Zona Atlántica, con sede en Limón.- Redacta la jueza Alvarado Paniagua, y;
CONSIDERANDO:
I.El apoderado generalísimo sin límite de suma de la Asociación de Desarrollo para la Ecología, apela la resolución de las trece horas cuarenta y cuatro minutos del cuatro de marzo del dos mil quince, al indicar las áreas que se pretenden titular están dentro de la zona protectora de Río Banano y la zona de amortiguamiento de dicha zona protectora por lo que se debe valorar seriamente los criterios de oposición que hace el Instituto de Acueductos y Alcantarillados, ya que esa cuenca es fuente de abastecimiento de agua para la población. Indica que mediante resolución de las trece horas cuarenta y cuatro minutos del cuatro de marzo del año en curso, el Juzgado resolvió rechazar de plano la oposición. Manifiesta el juez soslayó las disposiciones del artículo 8 de la Ley de Informaciones Posesorias, respecto a suspender la tramitación para que en juicio declarativo las partes definan sus derechos, y se archive el proceso. Indica existe antecedentes donde ya se le había rechazado la información posesoria. (ver escrito de apelación a folios [Telf1]).-
II.Para la resolución de este asunto, de interés se tienen los siguientes acontecimientos procesales: a) El apoderado generalísimo sin límite de suma de la Asociación de Desarrollo para la Ecología, se apersona al proceso de información posesoria haciendo oposición al mismo, en escrito presentado en fecha 27 de febrero del 2015, según consta acuse de recibido a folio 2472.- b) El edicto donde se emplazaba a todas las personas interesadas en estas diligencias de información posesoria, para que dentro de UN MES, contados a partir de su publicación, se apersonaren para hacer valer sus derechos, fue publicado en fecha 26 de mayo del 2014, en Boletín Judicial Número 99. (folio 117 del tomo I). El apersonamiento de oposición que hace el apelante sucede varios meses después de transcurrido el plazo de un mes dentro del cual debía darse la oposición, de allí la misma resulta extemporánea, y como tal ha de rechazarse.- Lo anterior tiene su fundamento jurídico en el artículo 5 párrafo segundo de la Ley de Informaciones Posesorias, que establece ese plazo de un mes como perentorio; siendo ello así en atención a los principios procesales de celeridad y economía, como garantías procesales de las partes.- No se comparte los argumentos de rechazo que expone el a-quo, dado que no se admite esta oposición por motivo de la extemporaneidad con la que fue presentado según se ha dicho supra; así como se omite pronunciamiento sobre los agravios restantes, así como la legitimación de participación procesal, por ser aspectos que han de ser analizados en todo caso, hasta en sentencia, pues son aspectos de fondo que también fueron expuestos por la representación estatal, incluso analizables aún oficiosamente.- Por lo expuesto, ha de confirmarse la resolución impugnada en cuanto rechaza la oposición de la Asociación de Desarrollo para la Ecología, pero con los argumentos expuestos en esta instancia.-
La suscrita jueza comparte la decisión tomada en esta resolución; sin embargo, estima necesario adicionar los siguientes argumentos: En primer orden, debe analizarse la legitimación de Eco Proyección del Nuevo Milenio S.A. para plantear la oposición, a fin de determinar si puede o no acudir a oponerse a esta tramitación. Sin entrar a conocer sobre el fondo de lo debatido, pues al haberse rechazado por extemporánea la oposición a la Información Posesoria, será hasta sentencia donde se conozca de los argumentos expuestos por la persona representante de dicha Sociedad, debe tomarse en consideración que se está en presencia de una temática eminentemente ambiental. En efecto, el numeral 45 de la Constitución Política que regula el derecho de propiedad -a formalizar en este proceso de Información Posesoria- debe analizarse integralmente con el 50, conforme al cual: "... Toda persona tiene derecho a un ambiente sano y ecológicamente equilibrado.
Para ello está legitimada para denunciar los actos que infrinjan ese derecho y para reclamar la reparación del daño causado...". Al respecto, se deduce de los alegatos de la Sociedad opositora que su argumento principal es: "La sociedad promovente se encuentra tratando de inscribir un inmueble que forma (sic) de la zona protectora del Río Banano y otra parte dentro de la zona de Amortiguamiento de dicha zona protectora, por lo cual se amerita valorar seriamente los criterios externados por Acueductos y Alcantarillados, institución que se opone a dicha titulación, tal y como lo hizo el Instituto de Desarrollo Agrario, actual INDER, en otra Información Posesoria sobre este mismo terreno..." (folio 2476 y 2477). De lo expuesto se desprende que el alegato está referido a la temática ambiental, por lo que conforme al artículo 50 referido, la sociedad sí está legitimada para actuar oponiéndose al trámite; sin embargo, al haberlo hecho en forma extemporánea, su gestión debe rechazarse.
Es importante señalar que cuando hay oposiciones a procesos de Información Posesoria, de conformidad con lo dispuesto en los artículos 5 y 8 de la Ley de Informaciones Posesorias, la autoridad judicial debe limitarse a analizar si la oposición es fundada y por supuesto, si está planteada dentro del plazo legal, supuesto en el cual debe disponer el archivo; o bien, si es extemporánea, rechazar la misma. En ninguno de esos supuestos deben hacerse valoraciones acerca de si los alegatos de oposición son o no procedentes -como se hace en la resolución recurrida- pues ese análisis debe reservarse para sentencia al tratarse de un proceso de naturaleza no contenciosa.-
POR TANTO:
