Goicoechea, at eight thirty in the morning on veintiséis de junio de dos mil quince.- APPEAL filed in the present proceedings brought against [Jose 004], [...],G who is charged with the offenses of ILLEGAL TREE FELLING (TALA ILEGAL DE ÁRBOLES), HARVESTING OF FOREST PRODUCTS (APROVECHAMIENTO DE PRODUCTOS FORESTALES), LAND-USE CHANGE (CAMBIO DE USO DE SUELO), ENCROACHMENT INTO A PROTECTED AREA (INVASIÓN DE ÁREA DE PROTECCIÓN), ENCROACHMENT INTO A PROTECTED AREA, AND UNLAWFUL OCCUPATION (USURPACIÓN), to the detriment of FOREST RESOURCES and [Jose 001]. PROCEDURAL BACKGROUND:

I.By judgment number 740-2014, issued at seven thirty in the morning on tres de setiembre de dos mil quince, the Criminal Court of the Second Judicial Circuit of the Atlantic Zone, Guápiles, ruled: “THEREFORE (POR TANTO): In accordance with the foregoing, Articles 39 and 41 of the Political Constitution; 1, 9, 30 to 33, 265, 267, 360, 361, 363, 364, 365, and 366 of the Code of Criminal Procedure; 225 of the Criminal Code; and 19, Articles 58 and 61 of the Ley Forestal, the statute-of-limitations objection (excepción de prescripción) raised by the defendant’s counsel is hereby sustained with respect to the offenses of UNLAWFUL OCCUPATION and ENCROACHMENT INTO A FOREST CONSERVATION AREA (INVASIÓN DE UN AREA DE CONSERVACIÓN DE BOSQUE) with which he has been charged, and the defendant is accordingly ACQUITTED of all punishment and liability for those offenses. In addition, pursuant to the universal principle of in dubio pro reo (indubio pro reo), [Jose 004] is ACQUITTED of all punishment and liability for the offense of LAND-USE CHANGE, to the detriment of NATURAL RESOURCES, with which he had been charged by the Public Prosecutor’s Office and the Office of the Attorney General of the Republic.

The lifting of any precautionary measure (medida cautelar) imposed on the accused by virtue of this case is hereby ordered. The Civil Actions for Damages (Acciones Civiles Resarcitorias) brought by the Office of the Attorney General of the Republic and [Jose 001] against [Jose 004] are hereby denied. Judgment is rendered without a special award of costs in either the criminal or civil proceedings. Notice shall be given by reading. VÍCTOR PERA RUEDA. JUDGE.- (sic., )”.

II.Attorney Olman Antonio Rodríguez Brunett, in his capacity as Criminal State Attorney, and Attorney Evelyn Baltodano Zúñiga, counsel for the Office of Civil Defense of the Victim, filed an appeal against the foregoing ruling.

III.Following the corresponding deliberation, in accordance with Article 465 of the Code of Criminal Procedure, the Court considered the issues raised in the appeal.

IV. The pertinent legal requirements have been observed in the proceedings

Appellate Judge Solís Zamora writes the opinion; and,

CONSIDERING:

I.The principal case record at folio 406 establishes that the oral hearing was held before Judges Rafael Gullock Vargas, Patricia Vargas González, and Ana Isabel Solís Zamora. However, to consider the merits of this matter and issue the present decision, Judge Gullock Vargas must be replaced by Judge Marianela Corrales Pampillo because he is temporarily away from this Court. This substitution does not affect the procedural interests or safeguards of the parties because it has been confirmed that, during the oral hearing, the grounds for appeal were not expanded and no evidence was received; therefore, the principle of oral proceedings (principio de oralidad) is not infringed, as the Constitutional Chamber stated in decision number 17553 of 30 de noviembre de 2007: “…In this case, the inquiry concerns the constitutional conditions governing the participation of the same cassation judges in the oral hearing and in the decision on the merits of that appeal.

The inquiry is answered by maintaining the position expressed by this Chamber in judgment 6681-96, issued at fifteen thirty on diez de diciembre de mil novecientos noventa y seis, insofar as it states that it is constitutionally valid, in cassation hearings or oral proceedings in which no evidence is received orally, or in which the parties’ arguments are already set forth in writing and nothing new is presented, for judges other than those who participated in the hearing to take part in rendering the decision if, and only if, they are capable of doing so and there are justified reasons—which must be placed on the record—preventing those who attended the oral hearing from meeting at an upcoming date to review and decide the matter.” (To the same effect, see the decision issued by this same Constitutional Court under number 12593-2011 at 15:44 on 20 de setiembre de 2011).

II.By means of the document at folios 365 to 377, attorney Olman Rodríguez Brunett, Counsel representing the State, files an appeal against judgment 740-2014, issued at 7:30 hours on 3 de setiembre de 2014 by the Trial Court of the Second Judicial Circuit of the Atlantic Zone, whereby the accused [Jose 004] was acquitted. As the sole ground for appeal, he alleges the failure to apply the principle of the irreducibility of forests (principio de irreductibilidad del bosque) due to the trial judge’s failure to provide reasons, insofar as the judge did not rule on the restorative effect of returning things to their original state and failed to apply Article 140 of the Code of Criminal Procedure. The appellant states that the judge is required to order the recovery of forest areas. The proven facts established direct material harm to the ecological balance of an area measuring five hectares, in which a land-use change (cambio de uso del suelo) occurred through the planting of grass.

It was also found that ecological damage had occurred. In the appellant’s view, all the evidence, as well as the opinion expressed in the judgment, establishes that serious environmental harm occurred, specifically to the very humid tropical forest ecosystem within a five-hectare area where the land use was changed. At folio 372, he specifies the harm caused by the conduct. Despite all of this, the court below omitted to rule on returning things to their original state, as required by section 140 of the applicable Code. He adds that the principle of the irreducibility of forests arises from the imperative need to repair harm to the ecosystem and the environment, thereby allowing the land to revert to forest. He considers that the Trial Court should have ruled on this matter so that the area could regenerate naturally by allowing its own natural self-regulation mechanisms to operate. He proposes ensuring that no one enters the affected site.

He requests that the claim be granted, that the judgment be partially vacated, and that the restoration of things to their original state be ordered, directing that no person—whether the injured party or the accused—interfere with the land in any manner that modifies or alters the ecosystem, and that its permanent regeneration be ensured so that it may once again become part of the primary humid tropical forest. At the oral hearing, State Counsel Federico Quesada Soto appeared and reiterated the contents of the appeal filed, while correcting his request insofar as he stated that the obligation to restore things to their original state should not be imposed upon the accused; rather, the order should be directed to the injured party because he owns the property and cannot be allowed to benefit from an unlawful act. In his view, the owner must be advised that he may not engage in any activity on the property, which can regenerate only if the affected area remains undisturbed.

Position of counsel for the accused: Attorney Melvin Acedo Cantón, private defense counsel for the accused, agrees with the correction made by State Counsel at the hearing and does not oppose those terms. The argument is well-founded. The Trial Court acquitted the accused of all punishment and liability and found the following to have been proven: “1. The injured party [Jose 001] owns a property located in the Province of Limón, Canton of Pococí, district of Colorado, in the locality known as [Jose 007], survey plan [Valor 001], registered under real-property folio number [Valor 002], which, at the time of the events, was protected under the ‘Forest Regime’ (Régimen Forestal), with a total area of approximately one hundred and forty-five hectares. 2. On an undetermined exact date, but between the months of July 2009 and May two thousand ten, an unidentified person, acting clandestinely and taking advantage of the fact that the aforementioned property of the injured party [Jose 001] was unoccupied, invaded its southeastern sector, entered the property, and unlawfully cut down trees and removed the existing vegetation in a forest area, without authorization from the State Forestry Administration or the injured party. 3.- Thus, progressively, during the aforementioned period, trees were felled, undergrowth was cleared, and grass was planted on the injured party’s property for the purpose of dispossessing him of that portion of the property and changing the land use by converting it from forest into pasture, affecting an area of approximately 5 hectares and causing economic and non-pecuniary harm to the injured party and harm to the environment.” (cf. folios 340 verso to 341).

As can be seen, the existence of environmental harm was established, and that harm was directly related to the change in land use on the injured party’s property. Nevertheless, the judge omitted to rule on the restoration of the area, even though this is a consequence that must necessarily be resolved in a judgment addressing matters of this kind—environmental matters. Before reaching a decision, however, the rules governing this particular situation must be analyzed. Article 140 of the Code of Criminal Procedure provides: “At any stage of the proceedings and at the request of the injured party, the court may order, as a provisional measure (medida provisional), that things be restored to the condition in which they existed before the act, provided that there are sufficient grounds for deciding the matter.” This provision authorized the judge, in cases where the violation has been proven and such relief is appropriate, to seek to restore all circumstances to their original condition.

However, this is a “provisional measure,” and subsection 1) of section 103 of the Criminal Code must be applied when making the final determination in the case. In this regard, if it was found that a change in land use occurred, reference must be made to Ley 7575, known as “Ley Forestal,” Article 2 of which provides: “The Executive Branch is authorized, through the Ministry of the Environment and Energy, to establish protected wilderness areas (áreas silvestres protegidas), regardless of their management category, on privately owned land, by virtue of the natural resources existing in the area sought to be protected, and such land shall mandatorily become subject to the forest regime. This land may be voluntarily incorporated into protected wilderness areas or purchased directly where the parties agree. Otherwise, it shall be expropriated in accordance with the procedure established in the Expropriations Act, No. 7495, of 3 de mayo de 1995 and its amendments.

When, upon scientific and technical justification of the public interest, it is determined by law that the land is essential for conserving biological diversity or water resources, a restriction on ownership shall be established that prohibits cutting down trees and changing the land use. This restriction shall be recorded as an encumbrance in the Public Registry. The State shall give priority to the expropriation of such land.” This provision defines the State’s obligation to maintain wilderness areas, as well as its obligation to undertake efforts to prevent the reduction of areas subject to the forest regime, as is the case with the property at issue, which, according to the proven facts, fell within this legal category. Subsection g of section 3 of the Ley Forestal defines that category as a: “Set of legal, economic, and technical provisions and restrictions established by this Law, its regulations, and other rules and acts deriving from its application, for the purpose of regulating the conservation, renewal, use, and development of forest resources.” As a corollary to the foregoing, and specifically within Title Three, entitled “Private Forest Property,” this same body of law provides in Article 19 that: “On forest-covered land, changing the land use or establishing forest plantations shall not be permitted...” The foregoing means that the proven facts concerning the deforestation of a portion of the property owned by the injured party [Jose 001]—a property subject to the Forest Regime—not only affected the region’s ecosystem but also violated mandatory rules, and the trial judge was therefore required to rule on this matter.

Accordingly, the Trial Court could not avoid addressing this issue, because it concerns a mandatory public-order provision prescribing that the State must keep forested regions protected, which includes the obligation to order the restoration of the area in question to its original state. In this regard, Article 54 of Law number 7788, known as the Biodiversity Law, published in La Gaceta 101 on 27 de mayo de 1998 and effective as of its publication, is pertinent and provides: “When environmental harm exists within an ecosystem, the State may take measures to restore, recover, and rehabilitate it. For this purpose, it may enter into all types of contracts with private or public institutions of higher education, companies, and national or international scientific institutions in order to restore the damaged elements of biodiversity. In State-owned protected areas, this decision must come from the National System of Conservation Areas of the Ministry of the Environment and Energy.

Restoration on privately owned land shall proceed in accordance with Articles 51, 52, and 56 of this Law.” Section 51 of the aforementioned law provides: “For the purposes of this Law, the Ministry of the Environment and Energy, in collaboration with other public and private entities, shall establish a system of parameters enabling the identification of ecosystems and their components in order to take appropriate measures, including mitigation, control, restoration, recovery, and rehabilitation.” Under this provision, not only is the property owner obligated to restore and recover the forested area, but the Ministry of the Environment and Energy—as the State’s representative in this field—must also work jointly with the owner to return things to their original state. It must be emphasized that, in this case, the property owner was not the person who arranged for the change in land use or the clearing of the forest; his obligations must therefore be limited so as not to cause him further harm.

Thus, exercising the authority conferred by Article 465 of the Code of Criminal Procedure, the defect identified by the appellant is corrected, as the judgment omitted any reference to returning the forest to its original state. Consequently, the restoration of things to the condition in which they existed before the charged events occurred is ordered, and, as requested by the State’s representative, the following is directed: a. The Ministry of the Environment and Energy, as the supervisory entity and pursuant to Articles 51 and 54 of the Biodiversity Law, shall be required to devise a forest recovery plan and provide everything necessary for its implementation—including costs and personnel—as well as to supervise the forest’s regeneration and take the measures necessary to achieve it. This is ordered because of the entity’s obligation to safeguard the environment as a fundamental right protected by section 50 of the Political Constitution.

Likewise, the owner of the property in question shall permit MINAE personnel to enter so that they may fulfill these obligations, exercise proper oversight, and recommend measures, which must not cause financial detriment to the injured party; b.

Mr. [Nombre 001], the owner of the property located in the Province of Limón, Canton of Pococí, Colorado District, in the locality known as [Jose 007], recorded in the Real Property Registry under registration number [Valor 002]—who appears as the owner—or whoever currently holds title to it, is hereby warned that he must neither authorize nor personally carry out human intervention at the affected site involving modification or alteration of the ecosystem and the environment, so as to ensure the forest’s permanent regeneration over time and the reintegration of that area into the biomass of the tropical humid primary forest. Should it become necessary to do so, he must undertake the corresponding proceedings before the state authorities designated by law for that purpose. In addition, he must cooperate with MINAE personnel in complying with the provisions of this ruling, provided that doing so does not cause him any financial loss.

This decision is rendered on appeal because the obligation imposed causes no harm whatsoever to the latter, since this ruling provides for the restoration of matters to their original condition, so that the injured party may recover the property as it stood before the incursion by one or more unknown persons. The Trial Court, as the body responsible for enforcing this decision pursuant to Article 477 of the Code of Criminal Procedure (Código Procesal Penal), is ordered to summon the injured party, or the current owner of the property in question, in person to notify him of this ruling, and to issue the corresponding communications to the Regional Office of the Ministry of Environment and Energy (Oficina Regional del Ministerio de Ambiente y Energía) for the purpose of ensuring immediate compliance with this decision.

III.On folios 391 to 396, attorney Evelyn Baltodano Zúñiga, counsel for the Office of Civil Defense of the Victim, files an appeal against the same judgment, disagreeing with the reasoning supporting the dismissal of the civil action for damages (acción civil resarcitoria). The appellant argues that the court below rejected the claim because the causal link (nexo causal) between the accused’s conduct and the proven damages had not been established. In her view, proof of the damage caused was, by itself, sufficient to grant the injured party’s monetary claim. She requests that the claim be granted and that a retrial be ordered with respect to the challenged item. At the oral hearing, attorney Martín Mesén Sibaja appeared and reaffirmed the arguments submitted in writing. Position of the accused’s defense: Attorney Acedo Cantón states that the claims must be dismissed because the civil action was not rejected on the basis of its ancillary nature (accesoriedad), but because the causal link could not be established.

He requests that the argument be rejected. The claim is without merit. The trial court ruled as follows on the civil actions for damages—filed by the State and the injured party: “As has been stated, the Court has no doubt that both Mr. [Jose 001] and the rest of his family suffered damage, having received for several years the economic benefits resulting from having their property enrolled in the Payment for Environmental Services (Pago de Servicios Ambientales). They have likewise suffered harm because of the consequences that the suspension of that payment has caused the family, as well as all the non-pecuniary damage (daño moral) they have had to endure, particularly because the State is currently demanding repayment from them of money corresponding to PAS that was apparently disbursed. All of the foregoing, together with the fact that the [Jose 008] family has had to endure proceedings as lengthy as these and incur expenses in order to cope with the current proceedings, makes the injury caused to them indisputable.

Furthermore, the existence of social damage (daño social) is also evident, given the disturbance of an ecosystem that has been impaired by tree felling and land-use change (cambio de uso de suelo). The environment has been affected because oxygen is no longer generated following the elimination of the flora, and the fauna in the affected area has also had its habitat (sic) restricted. Despite all of this, no causal link can be established between any conduct by the defendant and the damages described, because it has not been possible to determine Mr. [Jose 004]’s responsibility for the acts attributed to him. This leads the Court to dismiss the civil actions for damages brought by Mr. [Jose 001] and by the Office of the Attorney General of the Republic itself against defendant [Jose 004]. Because the civil plaintiffs are deemed to have litigated in good faith, having submitted some evidentiary material in support of their claims, and because damage was in fact proven, no special award of costs is imposed in the civil proceeding.” (cf. folios 357 verso to 258).

As may be seen, the Court clearly establishes that neither the tree felling nor the land-use change could be linked to any conduct by the defendant. After reviewing the judgment, this Chamber endorses that conclusion because a causal relationship (relación de causalidad) between an act or omission by the accused and the damage caused is indispensable for granting the civil action. Accordingly, the appellant’s position cannot be accepted, as she disregards fundamental requirements for obtaining an award under that claim. Thus, although proof of damage is important, that is not all that must be established; it must also be corroborated that the damage resulted from an act or omission attributable to a person—natural or legal—at least under a theory of strict civil liability (responsabilidad civil objetiva). In the present matter, not even that circumstance can be said to exist, because the defendant was acquitted after it proved impossible to establish that he was the person who entered the injured party’s property and changed the land use of the property in question.

Finally, it is important to emphasize that it is not pertinent—as the appellant argues—to consider that the accused was absolved of civil liability as a direct consequence of his criminal acquittal. This is because, after reviewing the decision issued, it was confirmed that this assertion does not reflect what the trial judge actually ordered, since the civil ruling was issued after finding that it was impossible to connect the damage caused—and proven—on the property with any conduct by the defendant. For the foregoing reasons, the appeal is denied.

POR TANTO:

The appeal filed by attorney Olman Rodríguez Brunett, State Attorney representing the State, is granted. Consequently, the identified defect is corrected, and restoration to the original condition (restauración de las cosas al estado originario) is ordered under the terms and supervision established in the second recital (considerando) of this decision. The trial court, as the court responsible for enforcing this decision pursuant to Article 477 of the Code of Criminal Procedure (Código Procesal Penal), is ordered to summon the injured party personally, or the current owner of the property in question, to notify that person of this decision; that court shall also transmit the corresponding notices to the Regional Office of the Ministry of Environment and Energy so that this decision may be implemented immediately. The appeal filed by attorney Evelyn Baltodano Zúñiga, counsel for the Office of Civil Defense of the Victim, is denied. Let notice be given.

PODER JUDICIAL PODER JUDICIAL TRIBUNAL DE APELACIÓN DE SENTENCIA PENAL Resolución: 2015-00921 TRIBUNAL DE APELACIÓN DE SENTENCIA PENAL . Segundo Circuito Judicial de San José. Goicoechea, a las ocho horas treinta minutos del veintiséis de junio de dos mil quince.- RECURSO DE APELACIÓN interpuesto en la presente causa seguida contra [Jose 004], [...],G quien se le atribuye los delitos de TALA ILEGAL DE ÁRBOLES, APROVECHAMIENTO DE PRODUCTOS FORESTALES, CAMBIO DE USO DE SUELO E INVASIÓN DE ÁREA DE PROTECCIÓN, INVASIÓN DE ÁREA DE PROTECCIÓN Y USURPACIÓN en perjuicio de LOS RECURSOS FORESTALES Y [Jose 001]. Intervienen en la decisión del recurso, la jueza Ana Isabel Solís Zamora, quien preside, y las co-juezas Marianela Corrales Pampillo y Patricia Vargas González. Se apersonaron en esta sede el licenciado Olman Antonio Rodríguez Brunett, en calidad de Procurador Penal y la licenciada Evelyn Baltodano Zúñiga, Abogada de la Oficina de la Defensa Civil de la Víctima.

RESULTANDO:

I.Que mediante sentencia número 740-2014, de las siete horas treinta minutos del tres de setiembre de dos mil quince, el Tribunal Penal del Segundo Circuito Judicial de la Zona Atlántica, Guápiles, resolvió: "POR TANTO: De conformidad con lo expuesto, artículos 39 y 41 de la Constitución Política, 1, 9, 30 a 33, 265, 267, 360, 361, 363, 364, 365 y 366 del Código Procesal Penal, 225 del Código Penal, 19, artículos 58 y 61 de la Ley Forestal, se declara con lugar al excepción de prescripción presentada por la defensa de encartado en cuanto a los delitos de USURPACIÓN e INVASIÓN DE UN AREA DE CONSERVACIÓN DE BOSQUE que se le han venido atribuyendo y en tal sentido se ABSUELVE de toda pena y responsabilidad al encartado por dichos delitos. En otro orden de ideas, en aplicación del principio universal de indubio pro reo, se ABSUELVE de toda pena y responsabilidad a [Jose 004] por el delito de CAMBIO DE USO DE SUELO que en daño de LOS RECURSOS NATURALES, le venía atribuyendo el Ministerio Público y la Procuraduría General de la República.

Se ordena el levantamiento de cualquier medida cautelar que pese sobre el imputado en virtud de esta causa. Se declaran sin lugar la Acciones Civiles Resarcitorias incoadas por La Procuraduría General de la República y [Jose 001] en contra de [Jose 004] Se falla sin especial condenatoria en costas tanto en lo penal como en lo civil. Notifíquese mediante lectura. VÍCTOR PERA RUEDA. JUEZ.- (sic., )".

II.Que contra el anterior pronunciamiento interpuso recurso de apelación el licenciado Olman Antonio Rodríguez Brunett, en calidad de Procurador Penal y la licenciada Evelyn Baltodano Zúñiga, Abogada de la Oficina de la Defensa Civil de la Víctima.

III.Que verificada la deliberación respectiva de conformidad con lo dispuesto por el artículo 465 del Código de Procesal Penal, el Tribunal se planteó las cuestiones formuladas en el recurso de apelación.

IV. Que en los procedimientos se han observado las prescripciones legales pertinentes

Redacta la Jueza de apelación Solís Zamora; y,

CONSIDERANDO:

I.A folio 406 del legajo principal, consta que se realizó la audiencia oral con la integración de los jueces Rafael Gullock Vargas, Patricia Vargas González y Ana Isabel Solís Zamora. Sin embargo, para conocer el fondo de este asunto y emitir la presente resolución, el juez Gullock Vargas debe ser sustituido por la jueza Marianela Corrales Pampillo, por encontrarse temporalmente fuera de este Tribunal. Este reemplazo no afecta los intereses procesales, ni las garantías de las partes, debido a que, se ha corroborado que durante la audiencia oral no se ampliaron los motivos de apelación, ni se evacuó prueba alguna, por lo que no se infringe el principio de oralidad, según ha dicho la Sala Constitucional mediante resolución número 17553 del 30 de noviembre de 2007: “…En este caso se plantea la consulta sobre las condiciones constitucionales para participación de los mismos jueces de casación en la audiencia oral y en la toma de la decisión de fondo sobre ese recurso.

Se evacua la consulta planteada en el sentido de que se mantiene el criterio emitido por esta Sala en la sentencia 6681-96 de las quince horas treinta minutos del diez de diciembre de mil novecientos noventa y seis, en cuanto señala que resulta constitucionalmente válido que en aquellas vistas o audiencias orales de casación en las que no se reciban elementos de prueba en forma oral o, que las argumentaciones de las partes consten ya por escrito, sin que se aporte nada nuevo, puedan intervenir otros jueces, distintos a los que participaron la vista, a la hora de tomar la decisión, si y sólo si, están en capacidad de hacerlo y existen razones justificadas (que deberán constar) que impidan que quienes estuvieron en la audiencia oral se reúnan en fecha próxima a estudiar y resolver el asunto.”. (En este mismo sentido, revisar la resolución emitida por este mismo Tribunal Constitucional bajo el número 12593-2011 de las 15:44 horas del 20 de setiembre de 2011).

II.A través de documento de folio 365 a 377, el licenciado Olman Rodríguez Brunett, Procurador en representación del Estado, interpone recurso de apelación contra la sentencia 740-2014, emitida al ser las 7:30 horas del 3 de setiembre de 2014 por el Tribunal de Juicio del Segundo Circuito Judicial de la Zona Atlántica, mediante la cual se absolvió al imputado [Jose 004]. En el único motivo, señala la inaplicación del principio de irreductibilidad del bosque por falta de fundamentación del juzgador, al no pronunciarse sobre el efecto devolutivo de las cosas a su estado originario y falta de aplicación del artículo 140 del Código Procesal Penal. Indica el recurrente, que es obligación del juez ordenar el rescate de áreas de bosque. En los hechos probados, se acreditó un daño material directo al equilibrio ecosistémico, en una superficie de cinco hectáreas, en el cual se cambió el uso del suelo con la siembra de pasto.

Además, también se tuvo por demostrado que hubo un daño ecológico. En criterio del impugnante, toda la prueba, así como el criterio externado en sentencia, tiene por cierto que hubo un grave daño ambiental, específicamente al ecosistema de bosque tropical muy húmedo en un área de cinco hectáreas, donde se cambió el uso del suelo. Aclara cuáles son los daños producidos con la acción a folio 372. A pesar de todo esto, el a quo omitió pronunciarse respecto a la devolución de las cosas a su estado original, conforme lo ordena el numeral 140 del Código de rito. Agrega que el principio de irreductibilidad del bosque deriva de un imperativo de necesaria reparación del daño al ecosistema y al ambiente, permitiendo que los terrenos vuelvan a ser bosque. Considera que el Tribunal de sentencia debió pronunciarse sobre esto, con el fin de que el área llegue a regenerarse naturalmente, al permitir el desarrollo de los propios mecanismos de autorregulación natural.

Propone que se asegure que nadie ingrese al sitio afectado. Solicita se acoja el reclamo, se anule parcialmente la sentencia, y se ordene la restitución de las cosas a su estado originario, ordenando que ninguna persona -tanto el ofendido, como el imputado- intervengan el terreno, de manera que exista modificación o alteración del ecosistema, y que se asegure su regeneración permanente, con el fin de que se integre de nuevo al bosque primario tropical húmedo. En la audiencia oral, se apersonó el Procurador Federico Quesada Soto, quien reitera el contenido del recurso interpuesto, rectificando su gestión, en el tanto indica que no debe ser al imputado a quien se le imponga la obligación de restituir las cosas a su estado original, ya que es al ofendido a quien debe dársele la orden, pues es el dueño del inmueble, y él no podría aprovecharse de un acto ilícito. En su criterio, debe hacérsele ver que no puede realizar actividad en esa propiedad, la cual únicamente puede regenerarse, si no se toca el área afectada.

Posición de la defensa del imputado: El licenciado Melvin Acedo Cantón, defensor particular del encartado, se muestra conforme con la rectificación que hizo el Procurador en la audiencia, y no se opone a esos términos. El alegato es procedente. El Tribunal de juicio absolvió al imputado de toda pena y responsabilidad, y tuvo por demostrado lo siguiente: "1. El ofendido [Jose 001], es propietario de una finca ubicada en la Provincia de Limón, Cantón de Pococí, distrito de Colorado, localidad conocida como [Jose 007], plano [Valor 001], inscrita según folio real matrícula [Valor 002], la cual se encontraba para la fecha de los hechos, protegida bajo el sistema de "Régimen Forestal", con un área total de aproximadamente ciento cuarenta y cinco hectáreas. 2. Sin determinarse fecha exacta pero entre los meses de julio del año 2009 y mayo del año dos mil diez, una persona no identificada , mediante la clandestinidad, aprovechando que la citada finca del ofendido [Jose 001] se encontraba sola, procedió a invadirla en el sector sureste, introduciéndose a dicho inmueble y realizando en zona de bosque la corta ilegal de árboles y eliminación de la vegetación ahí existente, sin contar con permiso de la Administración Forestal del Estado ni del ofendido. 3.- Así, progresivamente, en el período anteriormente indicado, se llevó a cabo en la finca del ofendido talas de árboles, chapeas y siembra de pasto con el fin despojarlo de la posesión de esa parte de la finca y cambiarle el uso al terreno convirtiéndolo de bosque a potrero, afectando un área aproximada de 5 hectáreas y generando un daño económico y moral al ofendido y al medio ambiente."(cfr. folios 340 vuelto a 341).

Como puede verse, se comprobó la existencia de un daño al ambiente, que tuvo relación directa con el cambio del uso de suelo en la finca del ofendido. No obstante, el juez omite pronunciarse respecto a la recuperación de la zona, a pesar de que se trata de una consecuencia de necesaria resolución en la sentencia que resuelve asuntos de esta índole -ambientales-. Ahora bien, de previo a tomar una decisión, deben analizarse las normas que rigen esta situación particular. El artículo 140 del Código Procesal Penal, dice: “En cualquier estado de la causa y a solicitud del ofendido, el tribunal puede ordenar, como medida provisional, el restablecimiento de las cosas al estado que tenían antes del hecho, siempre que haya suficientes elementos para decidirlo.”. Con esta disposición, se autorizó al juez para que, en los casos donde se haya demostrado la infracción, y sea procedente, se procure restablecer todas las circunstancias al estado original.

Sin embargo, esta es una "medida provisional", debiéndose acudir al inciso 1) del numeral 103 del Código Penal, cuando se trata de la decisión definitiva del caso. En relación con esto, si se tuvo por demostrado que hubo un cambio en el uso del suelo, debe acudirse a la ley 7575, denominada "Ley Forestal", cuyo artículo 2, establece: "Se faculta al Poder Ejecutivo para que, por medio del Ministerio del Ambiente y Energía, en terrenos de dominio privado, establezca áreas silvestres protegidas, cualquiera que sea su categoría de manejo, en virtud de los recursos naturales existentes en el área que se desea proteger, los cuales quedan sometidos en forma obligatoria al régimen forestal. Estos terrenos podrán ser integrados voluntariamente a las áreas silvestres protegidas o bien comprados directamente cuando haya acuerdo de partes. En caso contrario, serán expropiados de acuerdo con el procedimiento establecido en la Ley de Expropiaciones, No. 7495, del 3 de mayo de 1995 y sus reformas.

Cuando, previa justificación científica y técnica del interés público, se determine mediante ley que el terreno es imprescindible para conservar la diversidad biológica o los recursos hídricos, quedará constituida una limitación a la propiedad que impedirá cortar árboles y cambiar el uso del suelo. Esta restricción deberá inscribirse como afectación en el Registro Público. El Estado dará prioridad a la expropiación de los terrenos.". Esta norma, define la obligación estatal de mantener las áreas silvestres, así como los esfuerzos para impedir la disminución de los sectores sometidos al régimen forestal, como ocurre con la finca en discusión, la cual, según se tuvo por probado, estaba dentro de este parámetro legal, el cual, según se define en el inciso g, del numeral 3 de la Ley Forestal, es un: "Conjunto de disposiciones y limitaciones de carácter jurídico, económico y técnico, establecidas por esta ley, su reglamento, demás normas y actos derivados de su aplicación, para regular la conservación, renovación, aprovechamiento y desarrollo de los recursos forestales.".

Corolario de lo anterior, y específicamente dentro del Título Tercero denominado "Propiedad forestal privada", este mismo cuerpo legal establece, en el artículo 19, que: "En terrenos cubiertos de bosque, no se permitirá cambiar el uso del suelo, ni establecer plantaciones forestales...". Lo anterior implica que los hechos demostrados, acerca de la deforestación de un segmento de la finca propiedad del ofendido [Jose 001] -inmueble sometido al Régimen Forestal-, no solo afectó el ecosistema de la región, sino que, además, con ello se infringieron normas de aplicación obligatoria, razón por la cual el juez de juicio debió pronunciarse respecto a esto. En consecuencia, el Tribunal de juicio no podía evadir la referencia a este asunto, ya que se trata de una disposición legal de orden público, donde se prescribe que el Estado es el que debe mantener protegidas las regiones boscosas, todo lo que incluye la obligación de disponer la restauración de la zona dicha, a su estado original.

Al respecto, vale citar el artículo 54 de la Ley número 7788, denominada Ley de Biodiversidad, publicada en la Gaceta 101, el 27 de mayo de 1998, vigente desde su publicación, dice: "Cuando exista daño ambiental en un ecosistema, el Estado podrá tomar medidas para restaurarlo, recuperarlo y rehabilitarlo. Para ello, podrá suscribir todo tipo de contratos con instituciones de educación superior, privadas o públicas, empresas e instituciones científicas, nacionales o internacionales, con el fin de restaurar los elementos de la biodiversidad dañados. En áreas protegidas de propiedad estatal, esta decisión deberá provenir del Sistema Nacional de Áreas de Conservación del Ministerio del Ambiente y Energía. Para la restauración en terrenos privados se procederá según los artículos 51, 52 y 56 de esta ley." . Según el numeral 51 de la ley de cita, se establece que: " Para los efectos de esta ley, el Ministerio del Ambiente y Energía, en colaboración con otros entes públicos y privados, dispondrá un sistema de parámetros que permita la identificación de los ecosistemas y sus componentes, para tomar las medidas apropiadas, incluso la mitigación, el control, la restauración, la recuperación y la rehabilitación.".

De conformidad con esta disposición, no solo es obligación del propietario del inmueble la restauración y recuperación de la zona boscosa, sino que el Ministerio de Ambiente y Energía -como representante del Estado en la materia- debe trabajar en conjunto con éste, para devolver las cosas a su estado original. Debe hacerse hincapié, que en este caso, el dueño de la finca no fue quien dispuso el cambio de uso del suelo, ni la tala del bosque, por lo que las obligaciones de este, deben limitarse, con el fin de no generar mayor perjuicio. Así, en ejercicio de la potestad conferida en el artículo 465 del Código Procesal Penal, se corrige el vicio apuntado por el recurrente, al haberse omitido referencia alguna a la devolución del bosque a su estado original. Consecuentemente, se ordena la restauración de las cosas al estado que tenían antes de que ocurrieran los hechos que fueron acusados, y, conforme ha sido solicitado por el representante estatal, se manda lo siguiente: a. El Ministerio de Ambiente y Energía, como ente supervisor, conforme lo previsto en los artículos 51 y 54 de la Ley de Biodiversidad, tendrá la obligación de idear un plan de recuperación del bosque, asumiendo lo necesario para su ejecución -costos y personal-, así como, supervisar la regeneración de este, tomando las medidas necesarias para lograrlo.

Esto se ordena, por la obligación que tiene la entidad de resguardar el medio ambiente, como derecho fundamental protegido por el numeral 50 de la Constitución Política. Asimismo, el dueño de la finca en cuestión, deberá permitir el ingreso de los personeros del MINAE, con el fin de que ellos puedan cumplir con estas obligaciones, ejercer la debida vigilancia y sugerir medidas, las cuales no deben representar un menoscabo patrimonial para el ofendido; b. Al señor [Nombre 001], propietario de la finca ubicada en la Provincia de Limón, Cantón de Pococí, distrito Colorado, localidad conocida como [Jose 007], inmueble inscrito en folio real matrícula [Valor 002] -quien aparece como dueño- o a quien ostente el derecho de propiedad sobre ella en la actualidad, se le advierte que no debe autorizar -ni ejecutar personalmente- la intervención humana del sitio afectado -que implique modificación o alteración del ecosistema y el ambiente- de manera que se asegure la regeneración permanente del bosque, a través del tiempo, y que ese sector se reintegre a la biomasa del bosque primario tropical húmedo.

De verse en la necesidad de hacerlo, deberá gestionar lo correspondiente ante las autoridades estatales que la ley haya dispuesto para ello. Además, deberá colaborar con el personal del MINAE, para cumplir con lo dispuesto en esta resolución, siempre y cuando ello no implique un menoscabo patrimonial para él. Esta decisión se toma en sede de apelación, pues la obligación impuesta no genera perjuicio alguno a este último, ya que se está contemplando en esta resolución, el regreso de las cosas a su estado originario, de manera que el agraviado pueda ver recuperado el bien, tal y como estaba antes de la incursión de una o varias personas desconocidas. Se dispone que el Tribunal de sentencia, instancia encargada de la ejecución de esta decisión, conforme con el artículo 477 del Código Procesal Penal, cite personalmente al ofendido, o al dueño actual de la finca en cuestión, para notificarle esta resolución, así como que sea esa instancia la que gire las respectivas comunicaciones a la Oficina Regional del Ministerio de Ambiente y Energía, con el fin de darle cumplimiento inmediato a esta decisión.

III.De folio 391 a 396, la licenciada Evelyn Baltodano Zúñiga, abogada de la Oficina de la Defensa Civil de la Víctima, interpone recurso de apelación contra la misma sentencia por inconformidad con la fundamentación respecto a la declaratoria sin lugar de la acción civil resarcitoria. Alega la impugnante, que el a quo rechazó la demanda, al no haberse probado el nexo causal entre la actuación del imputado y los daños probados. En su criterio, con el sólo hecho de haberse demostrado el daño producido, era suficiente para declarar con lugar la petición económica del ofendido. Solicita se declare con lugar el reclamo y se ordene el juicio de reenvío en cuanto al rubro objetado. En la audiencia oral efectuada, se presentó el licenciado Martín Mesén Sibaja, quien ratificó lo dicho por escrito. Posición de la defensa del imputado: El licenciado Acedo Cantón, apunta que los reclamos deben ser desechados, ya que la acción civil no fue rechazada por accesoriedad, sino porque no se pudo demostrar el nexo causal.

Solicita se declare sin lugar el alegato. El reclamo es improcedente. El tribunal de juicio resolvió sobre las acciones civiles resarcitorias -interpuestas por el Estado y por el ofendido-, lo siguiente: "Tal y como se ha mencionado, no ha quedado duda alguna para el Tribunal de que ha existido una daño tanto para don [Jose 001] como para el resto de su familia, quienes recibieron por varios años, las ventajas económicas que les deparó tener su finca sometida al pago de servicios ambientales. Igualmente ha existido un perjuicio por las implicaciones que la suspensión de dicho pago ha acarreado a la familia y todo el daño moral que ha tenido que soportarse aún porque actualmente el Estado les está cobrando dinero por el concepto del PAS, que en apariencia fue girado. Todo lo anterior aunado al hecho de que la familia [Jose 008] haya tenido que soportar un proceso tan largo como este y; tener que realizar gastos económicos en atención a sobrellevar el proceso actual, hace indiscutible el agravio que se les ha causado.

Por otro lado, también es evidente la existencia de un daño social al darse un desequilibrio de un ecosistema que se ha visto limitado por la tala de árboles y el cambio de uso de suelo. El medio ambiente se ha visto afectado en razón de la generación de oxígeno que se deja de percibir por la eliminación de la flora y también la fauna del lugar intervenido, ha visto limitado su habitat (sic). Pese a todo ello, no se puede establecer un nexo causal de alguna conducta del encartado que diera por resultado los daños expresados, pues no ha sido posible determinar la responsabilidad del señor [Jose 004] en los hechos que se le endilgaron. Esto lleva al Tribunal a declarar sin lugar las acciones civiles resarcitorias incoadas por el señor [Jose 001] y por la misma Procuraduría General de la República en contra del demandado [Jose 004]. Por considerarse que se ha litigado de buena fe por parte de los actores civiles, contándose con algún material probatorio que fue presentado para fundamentar sus requisitorias y existiendo de hecho un daño probado, sin falla sin especial condenatoria en costas en la parte civil." (cfr. folios 357 vuelto a 258).

Como se observa, el Tribunal establece con claridad que no pudo relacionarse la tala de árboles, así como el cambio de uso del suelo, a alguna conducta desplegada por el encartado. Luego de examinar la sentencia, esta Cámara respalda ese criterio, ya que la relación de causalidad entre una acción u omisión del acusado y el daño producido, es indispensable para la declaratoria con lugar de la acción civil. De esta manera, no puede concedérsele la razón a la recurrente, pues ella desaplica conceptos fundamentales para obtener la condena de ese extremo. Así, aunque es importante la demostración de un daño, esto no es lo único que debe ser comprobado, sino que se requiere tener corroborado que fue producto de una acción u omisión atribuible a una persona -física o jurídica-, por lo menos, en la forma de responsabilidad civil objetiva. En el presente asunto, ni siquiera puede hablarse de esta circunstancia, pues el encartado fue absuelto por resultar imposible demostrar que fue la persona que invadió la finca del ofendido, y cambió el uso del suelo del inmueble en cuestión.

Finalmente, es importante hacer hincapié en que no resulta atinente -como lo indica la impugnante- considerar que el encausado fue absuelto en lo civil como consecuencia directa de la absolutoria en lo penal. Ello por cuanto, luego de examinar la resolución emitida, pudo corroborarse que lo dicho no corresponde con la realidad de lo dispuesto por el juez de juicio, ya que su decisión en lo civil recayó luego de establecer que no era posible relacionar los daños producidos -y demostrados- en la finca, con alguna conducta desplegada por el justiciable. En razón de lo anterior, se declara sin lugar el recurso.

POR TANTO:

Se declara con lugar el recurso interpuesto por el licenciado Olman Rodríguez Brunett, Procurador en representación del Estado. En consecuencia, se corrige el vicio apuntado y se ordena la restauración de las cosas al estado originario, en los términos y bajo la supervisión dispuesta en el segundo considerando de esta resolución. Se dispone que el Tribunal de sentencia, instancia encargada de la ejecución de esta decisión, conforme con el artículo 477 del Código Procesal Penal, cite personalmente al ofendido, o al dueño actual de la finca en cuestión, para notificarle esta resolución, así como que sea esa instancia la que gire las respectivas comunicaciones a la Oficina Regional del Ministerio de Ambiente y Energía, con el fin de darle cumplimiento inmediato a esta resolución. El recurso de la licenciada Evelyn Baltodano Zúñiga, abogada de la Oficina de la Defensa Civil de la Víctima, se rechaza. Notifíquese.
