Judge Córdoba Ramírez is the author of this opinion, and this judgment is rendered unanimously; and
CONSIDERING:
I.Proven facts (hechos probados). The following facts are relevant to the resolution of these proceedings:
II.Unproven facts (hechos no probados): The following are relevant to the resolution of these proceedings: 1) That Mr. Nombre112673 complied with what he was ordered to do under the terms of the “Inspection Form / Sanitary Order” (“Hoja de Visita / Orden Sanitaria”) identified by number DO-MC-01-RE-006, issued at ten thirty on treinta y uno de mayo del dos mil trece by Abraham Acosta Vargas, an official of the Servicio Nacional de Salud Animal. (Pages 46 through 50, 106, and 107, all from the judicial case file, considered together with the absence of evidence supporting a finding to the contrary); 2) That, based on the manner in which the claimant allegedly acquired ownership of the fifteen steers, the competent authorities implementing the system for the identification, movement control, and traceability of cattle were able to determine the animals’ origin and original ownership, as well as the manner in which they allegedly entered the country and, consequently, whether the legal requirements and sanitary procedures governing their importation had been fulfilled. (The absence of evidence supporting a finding to the contrary, compounded by the insufficient evidentiary value of the invoices appearing on pages 46 through 50 of the judicial case file);
III.Regarding the objections raised by the claimant. In support of his action, the claimant stated—the following being expressed in summary form—that he is the owner and a good-fa third party with respect to eighteen head of livestock, as indicated in the movement permit (guía de movilización) for Farm number 0599580. He stated that those animals are duly marked with his livestock brand (fierro) (originating from the farm he owns), which is also registered in his name with the Registro de Marcas de Ganado under the initials “Placa20457.” He stated that he prepared the corresponding permit for the movement of those cattle and that the person he identified as Nombre112674 was authorized to transport the animals. He stated that on Dirección13654 in San Vito, in front of the “MAG” offices, the person who identified himself as Dr. Abraham Acosta Vargas (a SENASA official) stopped the truck bearing license plates Placa20458, in which the steers were being transported while it was driven by Nombre112674.
He added that the official proceeded to detain the load, alleging, based on the brand they bore, that the animals came from Panamá. At ten thirty on that same day, the same official issued what was identified as “inspection form / sanitary order 0679,” granting him eight hours to demonstrate the animals’ origin. He contends that he complied with that demand within the specified period by submitting invoices documenting his purchase from third parties of the cattle that were being transported (property that he asserted he had acquired in good faith). In response, he explained, the SENASA official considered those documents insufficient to establish what was required and therefore refused to accept them. At fifteen hundred hours on that same treinta y uno de mayo del dos mil trece, the person identified as Dr. Roberto Carranza Echeverría, also a SENASA official, issued sanitary measure (medida sanitaria) number DRB-007-2013, ordering the slaughter of fifteen steers pursuant to the “precautionary” principle (principio de “precautoriedad”) in order to prevent risks to animal health in the country.
Subsequently, at eighteen twenty-six on the same day, by seizure report (acta de decomiso) number of.DRB-073-2013, those fifteen steers were seized (decomiso), although three of them were returned by the Administration. The steers were in fact slaughtered. He stated that on dieciséis de junio del dos mil trece, Mr. Carranza requested information concerning the date on which the animals were slaughtered; the value assigned to them; whether they had been determined to be diseased so as to authorize their slaughter; and whether any technical study or analysis had been performed on them to detect any disease. In the claimant’s view, those actions violated the principles of legality (principios de legalidad) and due process (debido proceso). In this regard, he alleged that he submitted the aforementioned invoices within the period granted to him. However, with respect to the permits corresponding to his acquisition of the cattle, he states that the period granted to him for that purpose was not honored, because the seizure and the order that the animals be slaughtered occurred one hour and thirty minutes before that period expired.
Moreover, the steers were killed the following day, that is, primero de junio del dos mil trece. The defendant Administration stated that the date corresponding to the act ordering that action was not treinta y uno de mayo, but primero de junio, and that the stated date was the result of a clerical error (error material). Having stated the foregoing, he objects that, although he was given eight hours to demonstrate the steers’ origin and without having been afforded a hearing (traslado), the official proceeded that same day, before the period expired, to seize the animals and order their slaughter. He states that the steers were slaughtered on primero de junio del dos mil tres and that notice of the act ordering their death was provided to him only afterward, namely, on tres de junio del dos mil trece, granting him a period in which to challenge something that had already been carried out.
He also alleged that the Administration’s decision lacked any technical basis and that no such basis was stated in the challenged act; it therefore lacked grounds, substance, and supporting reasons, and no determination had been made as to whether the animals were diseased, whether they had been improperly imported or stolen, and/or whether their transport constituted an illegal movement of cattle under the Ley de Control de Ganado Bovino number 8799. He added that the animals were not described, their characteristics were not recorded in an inventory, and no detailed reasons were provided concerning the brands that allegedly caused the SENASA official to harbor doubts. He considers that the authorities acted on the basis of unsupported assumptions, without grounding the decision in the precautionary or interim-protection principle (principio precautorio o cautelar). He asserts that no rule requires him to establish the legitimacy and origin of the stamps or brands appearing on the animals as livestock brands, but only to demonstrate that he has a registered brand, a requirement with which he complies.
He refers to the existence of a statutory prohibition against importing, bringing into transit, or moving animals that may potentially carry or serve as vectors for infectious agents, parasites, or toxins that endanger the environment, veterinary public health, or animal health, but not to any provision concerning the brand or brands. He further states that only animals imported in violation of that prohibition must be slaughtered pursuant to Article 52 of Ley número 8495, which leads him to assert that it applies only to importers—a status he does not hold, because he purchased the cattle in good faith within the national territory. During the closing-arguments hearing (audiencia de conclusiones), counsel for the claimant explained, based on a statement made by one of the witnesses, that in any event it is common in the area to encounter persons who do not comply with the statutory transportation requirements that ensure cattle traceability, and that Mr. Nombre112673 could therefore have acquired the cattle from one of those persons.-
IV.Regarding the defense arguments presented on behalf of the defendants. In their answers to the complaint (contestación a la demanda), both defendants opposed it in the following terms:
V.Regarding the subject matter of these proceedings. This Court deems it appropriate to address the claims asserted in the complaint, as they relate to the theory of the case (teoría del caso) on which the action is based, so that the discussion that follows may be as clear and orderly as possible. As an initial matter, this Chamber considers that the claims asserted in the complaint must be examined in an order different from that outlined therein. Thus, one claim is clearly identified as the principal claim, seeking annulment and, through these proceedings, the removal of formal administrative acts which, once their effects had been implemented, allegedly caused the damages and/or losses being claimed; the latter claims are equally clearly ancillary to the first. This means, irrespective of how the merits of the case are ultimately decided, that the damages claims necessarily depend on the success of the principal claim, and their outcome hinges on that first level of analysis.
Accordingly, this Court will determine the appropriate disposition of the claim identified as the fourth claim, insofar as it seeks a declaration of nullity (nulidad) of the act contained in what was identified as the “Inspection Form / Health Order 0679 (Hoja de Visita / Orden Sanitaria 0679) de las diez horas treinta minutos del 31 de mayo del año 2013; Health Measure DRB-007-2013 (Medida Sanitaria DRB-007-2013) dictada a las quince horas del día treinta y uno de mayo del año dos mil trece and Seizure Record Of.DRB-073-2013 (acta de decomiso Of.DRB-073-2013) de las dieciocho horas veintiséis minutos del treinta y uno de mayo del 2013.” Thereafter, and only if it becomes necessary to order the annulment of those acts in whole or in part, the Court would proceed to rule on the merits of the compensation sought for the damages allegedly caused. It should be noted at the outset that the claim seeking the return to the plaintiff of the cattle that were slaughtered is inadmissible because it is materially impossible to return property that had already been destroyed, even before the complaint was filed.
VI.Regarding the lack of merit of the complaint in all respects.- This Court finds that the claimant has no superior legal entitlement to obtain the relief sought in his complaint, which requires that it be dismissed in all respects, based on the following considerations.-
Both carrying the movement permit (guía) during transport operations and delivering it at the destination are duties of the person transporting the livestock, just as requiring it is the duty of the person receiving the livestock. Failure to follow this procedure undermines the system to such an extent that it prevents the Administration from exercising, as mandated by law, effective control over animal health, as noted above. Accordingly, in handling these documents, the regulated party (administrado) must act diligently and with at least a minimum degree of rigor. Article 16 of the Cattle Control and Prevention and Punishment of Cattle Robbery, Theft, and Receipt of Stolen Property Law (Ley Control de Ganado Bovino, prevención y sanción de su Robo, Hurto y Receptación), although addressing a purpose different from that referred to in the General Law of the National Animal Health Service (Ley General del Servicio Nacional de Salud Animal), underscores the importance of having access to the aforementioned information by stating that, through it: “Senasa shall maintain an updated information system on the movement of cattle, products, and by-products within the national territory; this information shall be shared with the Livestock Corporation (Corporación Ganadera, Corfoga).
Government authorities may use this information to control animal smuggling, as well as to control cattle rustling (abigeato) by judicial and administrative authorities,” which must be read in conjunction with Article 5 of its regulations, establishing duties to be performed by SENASA, including: “b) Coordinate with other administrative, police, and judicial authorities in controlling the movement of cattle, products, and by-products. / c) Collect, process, and analyze information on the movement of cattle, products, and by-products. / d) Create databases of the participants in the cattle, product, and by-product transportation and marketing chain.” (See also the text of Articles 6 and 26 of these regulations).-
It should be noted that, even when doubt may exist as to whether serious or irreversible harm to the environment will occur, the provision requires the adoption of the precautionary measure (medida precautoria), and even provides for the possibility of postponing “the activity in question,” all of which is ultimately justified by the well-known fact that natural resources constitute an essential element for sustaining human life and that, insofar as the environment is harmed, human health is likewise harmed as a consequence. We shall now proceed to analyze the facts deemed proven in light of the provisions cited above.-
6.1.- On the inadmissibility of the claims for annulment (pretensiones anulatorias). With respect to this point, the plaintiff requested that the judgment declare null and void the acts consisting of the “Site Inspection Record / Health Order issued at ten thirty on May thirty-one of the year thirteen; the subsequently prepared Seizure Report (acta de decomiso) Of.DRB-073-2013, as well as Health Measure (Medida Sanitaria) number DRB-007-2013 of the Dirección Regional Brunca, Pérez Zeledón,” all of which were administrative actions whose effects had already been exhausted before the filing of the action itself. It must be clarified to the plaintiff that he could have sought a determination, and the corresponding declaration, as to whether the actions taken complied with the law; however, at this point, a ruling on the nullity of those acts would provide no benefit to his interests, since it is materially impossible to restore the previous state of affairs if the livestock disposed of by the Administration has already been slaughtered.
The foregoing requires, as is hereby declared, that the action be deemed inadmissible to that extent and, of course, insofar as an order was sought for the return of the slaughtered steers, as is hereby ruled. Nevertheless, because the remaining relief sought is pecuniary in nature and relates to what the plaintiff has characterized as unlawful actions, nothing prevents a ruling on whether his position is well-founded. Such an analysis is mandatory in civil actions against the Public Treasury (acciones civiles de hacienda), even in the absence of a claim for annulment. A present interest (interés actual) constitutes a substantive prerequisite for the action and may therefore be reviewed sua sponte. Accordingly, in both cases analyzed supra, the action cannot proceed, and this is hereby declared sua sponte. This does not, however, preclude a ruling on the merits of the claims, since the relief the plaintiff requests the judgment to declare constitutes a typical civil action against the Public Treasury, which requires the adjudicator to determine whether the conduct alleged to have caused compensable harm complied with the legal system, an issue that the plaintiff does raise in his complaint.- 6.2.- Lawfulness of the challenged administrative conduct.
Taking as a starting point the situation in which the plaintiff placed himself by acquiring the cattle in question, it was established in these proceedings that, leaving that circumstance aside, on the thirty-first day of May, two thousand thirteen, at the request of Mr. Nombre112673, who was identified as Nombre112674 in his capacity as a carrier registered with the National Animal Health Service, he was hired and proceeded to transport or move, by motor vehicle, the steers owned by the plaintiff from the farm or farms owned by Mr. Nombre112675 to another location for sale. Although this was not a disputed fact, the movement permit (guía de movilización) issued for that purpose appears at pages 180 and 181 of the court record. That same day, the cattle transport operation being carried out by Mr. Nombre112674 was interrupted on a public roadway during inspection work performed by the National Animal Health Service official identified as Abraham Acosta Vargas.
After inspecting the load, this official, drawing on his experience in such inspection duties, observed that fifteen of the steers being transported bore on their bodies, in addition to the brand corresponding to Mr. Nombre112673’s branding iron, other brands that he recognized as those commonly used to identify this type of animal in the Republic of Panama, as well as brands that had not been fully and clearly declared in the appropriate space on the movement permit. At page 178 of the court record appears the document identified as “Inspection Report / Sanitary Order” (“Hoja de Visita / Orden Sanitaria”) issued for that purpose, which was served on Mr. Nombre112673 at ten thirty on the day the transport was inspected, without prejudice to the explanations provided at trial by Mr. Abraham Acosta Vargas himself concerning what occurred that day. The document is identified by number DO-MC-01-RE-006, and it is also recorded that it was served on the plaintiff at ten thirty on the thirty-first day of May, two thousand thirteen.
Effective that same day, the following was entered in the document as observations by official Acosta Vargas: “In the truck bearing license plate Placa20458, Mr. Nombre112674 (...) is transporting eighteen steers under permit #049308-0599880 from farm code 608-050639 belonging to Nombre112673. The animals bear brands that have not been fully and clearly declared in the appropriate place on the permit,” (emphasis not in the original), after which he issued the following sanitary order: “The owner, Nombre112673, is ordered, within 8 hours from this time, to produce the permits or commercial invoices demonstrating the provenance of the animals bearing those brands visible on the animals, both those declared and those not declared (Submit them at Subasta Coto Bruz),” (emphasis not in the original). Subsequently, at eighteen twenty-six on the thirty-first day of May, two, four minutes before the period granted to the plaintiff to provide evidence of the animals’ origin expired (which, under the law, could not be interpreted as anything other than requiring proof of the identity of the prior owner and the cattle’s place of origin, as would have been expected—that is, information contained in the movement permit that he should have requested and received from the third party who sold him the steers), the same SENASA official proceeded to seize (decomisar) those fifteen animals and, for that purpose, entered the following relevant considerations in the corresponding document: “...
I proceed to seize the following animals: 15 cattle, which were being transported in the vehicle bearing license plate Placa20458, under permit #049308-0599508, which did not show all the brands on its reverse side, since in section 2.4 the BY/E2 brand, registered to the responsible party Nombre112673, is drawn in the grid, (...). / The animals bear various brands that are not accounted for in the reports of entry into establishment SIREA 608-050639, belonging (sic) to Nombre112675 (...). / Grounds for seizure: Animals bearing brands not recorded at any establishment and inconsistent with those reported in the Entries (sic) into the establishment....” (Emphasis and underlining not in the original). The seizure report (acta de decomiso) appears at page 179 of the court record. At this juncture, it should be noted that the contents of both documents issued and brought to the plaintiff’s attention show that, entirely independently of whether the plaintiff himself and/or the carrier he hired had the required authorizations to conduct their activities, brands were found on the animals’ bodies that, according to the records maintained for that purpose by SENASA, had not been reported as belonging to cattle brought into Nombre112675’s establishment, which, during the period in question, had received cattle exclusively from seven farms, all of which operated with branding irons or brands different from those observed on the steers.
Furthermore, according to those same records, the brands observed did not belong to “any establishment,” that is, to any establishment within the national territory. Consequently, the simplest rational logic would lead to the conclusion that those cattle entered at some undetermined time from outside the territory of the Republic of Costa Rica, possibly, if one wishes, from the Republic of Panama, as concluded by Mr. Abraham Acosta Vargas, a veterinary professional with extensive experience in the SENASA organization over twenty-two years of service. This Court regards that conclusion as a proven fact, given the quality and probative force of his testimony, together with that of the Head of the SENASA Regional Directorate, Brunca Region, Roberto Carranza Echeverría, also a veterinarian, who holds a master’s degree in business administration and whose experience in this field dates back to nineteen seventy-nine; in this Court’s view, his testimony also demonstrated a very high degree of technical command of the subject.
This professional further stated that he had verified through photographs that the brands on the cattle matched those used in the Republic of Panama and did not match any brands registered in the country. He also demonstrated detailed knowledge of the technical, veterinary, and sanitary conditions under which cattle are handled in Panama, adding explanations concerning the risk to human health posed when animals imported from that origin are not subjected to the controls required by law. We understand these to be the controls associated with the import permit. Stated differently, when the plaintiff brought his steers into the establishment owned by Mr. Nombre112675, he did not have the corresponding movement permit recording their origin because he had not received it from the person from whom he obtained the cattle. In addition, brands imprinted on the cattle were simply not recorded at any establishment in the country.
In other words, because of the manner in which the plaintiff acted and given the information SENASA possessed concerning movements involving, among others, the establishment used for this purpose by Mr. Nombre112673 himself, it was unknown where those animals had come from and/or who their prior owner was, as well as whether, upon entering the country, they had undergone the required controls guaranteeing their sanitary and veterinary condition. At pages 184 through 197 appears the text of the sanitary measure (medida sanitaria) identified by number DRB-007-2013. Although it states that it was issued by the Brunca Regional Directorate of the National Animal Health Service, acting through its Director, Mr. Roberto Carranza Echeverría, at fifteen hundred hours on the thirty-first day of May, two thousand thirteen, there can be no doubt, for obvious reasons, that it was issued after the animals were seized by Mr.
Abraham Acosta Vargas. This conclusion is further supported by the statements made at trial concerning the procedure followed by both SENASA officials, each of whom remained confident, consistent, and highly knowledgeable about his duties and the activity at issue throughout his testimony; accordingly, this Court finds those statements highly credible in every respect. The aforementioned decision contains a sanitary measure adopted by the Regional Directorate in the following terms: “To order that the sanitary measure of ‘Sanitary Rifle at Slaughterhouse’ (‘Rifle Sanitario en Matadero’) be applied to the fifteen animals described, pursuant to the precautionary principle (principio de precautoriedad), in order to prevent risks to the country’s livestock health; this sanitary measure is mandatory and immediately enforceable. / The sanitary measure described above shall be implemented by this Regional Directorate.” In other words, their slaughter was ordered, as provided among its powers by Article 37; Article 51, which states: “Documentation for transport.
Natural or legal persons, as well as companies engaged in international, domestic, and in-transit transportation, shall be required to request from the interested parties the documents and requirements imposed by this Law and its Regulations before accepting them aboard. / If those documents are not carried, Senasa may order the slaughter of the animals...” Article 52, as applicable; and Article 89, subsection j), all of the General Law of the National Animal Health Service, without prejudice to the provisions of its regulations. Notwithstanding the clear explanations given at trial by the SENASA Regional Director, who issued this decision, regarding the grounds for the act, this Court considers those grounds to be set forth with equal clarity in its text. It should be noted that, after reviewing the information contained in the databases maintained by the institution for that purpose and the documentation that was available for the transport operation involving the plaintiff’s cattle, the administrative authority determined that the reverse side of the movement permit used for the transport did not list all the brands borne by the fifteen animals; that the animals had been reported as coming from Mr.
Nombre112675’s farm, where only 30 animals had been recorded since its registration; and that Mr. Nombre112673 had registered his cattle brand at Mr. Nombre112675’s property and therefore did in fact operate there under that brand. It was also taken into account that, as of the animals’ detention on the thirty-first day of May, two thousand thirteen, only seven cattle movements had been recorded as entries into Nombre112675’s farm, involving a total of one hundred seventy-two animals, all originating from seven farms that were also duly registered. What drew attention was that, although entries into this farm had been reported only from those establishments, none of the fifteen steers owned by Mr. Nombre112673 bore on their bodies the brands registered at those other establishments.
What this means is that the establishment of origin of those animals was unknown because the movement of the claimant’s steers had neither been reported nor documented. This would be explained insofar as it was deemed an unproven fact in these proceedings that Mr. Nombre112673 had complied with the order issued to him under the terms of the “Inspection Report / Sanitary Order” (“Hoja de Visita / Orden Sanitaria”), identified by number DO-MC-01-RE-006 and issued at diez horas con treinta minutos del treinta y uno de mayo del dos mil trece by National Animal Health Service official Abraham Acosta Vargas. This is likewise reflected at folios 46 to 50, 106, and 107 of the court record, together with the absence of evidence supporting a contrary conclusion, because, as should have been expected of the claimant, he neither possessed nor requested or received from the person or persons who sold him these animals the movement permit (guía de movilización) that he was legally required to obtain upon delivery of these steers.
Consequently, their movement was not reported to SENASA. With continued reference to the same decision or sanitary measure, of the seven establishments from which the cattle brought onto Nombre112675’s property were said at the time to have originated—which necessarily would have included the claimant’s cattle—four of the seven were engaged in dairy farming rather than beef production. This would explain why the seal or brand registered at those establishments was not observed on the cattle. However, the foregoing would not explain why, with respect to the other three farms that did produce or market beef cattle, none of the seals registered there had been branded on the animals. In addition, it was determined from the movement permit under which the claimant’s cattle were being transported that, although the so-called “sticker” affixed to it did in fact correspond to the carrier Nombre112674, the carrier code entered on the permit belonged to a third party identified as Carlos Salazar Martínez.
Considering as a whole the evidence available at that time to the respondent public authority, without the claimant having proven otherwise as required by law—because the burden of proof (carga de la prueba) was one of his obligations—this Court finds that, in this specific case, the Administration acted in full compliance with the legal system by validly presuming, in the absence of evidence pointing in another direction, that those cattle had entered the national territory without compliance with the mandatory requirements and procedures for the importation of animals and goods, and by further presuming that the sanitary provisions imposed by the legal system had plainly been disregarded. This entailed a potential and imminent risk to animal health and properly led, also through application of the precautionary principle (principio precautorio), to the order that the steers be slaughtered.
In his testimony, SENASA veterinarian and Director of one of its regional offices Roberto Carranza Echeverría explained that the situation presented three distinct types of hazards. He emphasized one in the area of animal health, insofar as animals entering without any controls might carry a transmissible disease. He associated another with veterinary concerns, particularly considering that certain products are distributed without restriction in Panamá, whereas in Costa Rica they are available only by veterinary prescription. Indeed, he stated that, for this reason, Panamá is prohibited from exporting cattle and/or cattle products to the Estados Unidos de América. He then mentioned the products used in Panamá to treat cattle grubs in animals, explaining that that country also permits the application of a product which, at the doses used there, is harmful to human health. He explained that although it is used in Costa Rica, it is available by prescription and in doses that greatly minimize the risk.
He added that this is why Costa Rica prohibits the importation of cattle from Panamá for slaughter, except when the animals are less than catorce días old and a withdrawal period (período de retiro) is observed to ensure that these products are naturally eliminated from the animal’s body. Finally, the decision issued under the terms described above was executed, after verification of the corresponding sanitary procedures, on primero de junio del dos mil trece. The required controls were conducted both ante mortem, as appropriate for suspect animals, and post mortem, ultimately determining that the animals’ meat was fit for human consumption. (Folio 213 of the court record). This did not in any way affect the validity of the sanitary order issued. It is sufficient to note, without further elaboration, that Chapter IV of the General Law of the National Animal Health Service (Ley General del Servicio Nacional de Salud Animal) governs the commercial exchange and transit of animals, as well as products and by-products of animal origin, and that its section 48 provides in its first paragraph: “SENASA shall consider conducting a risk analysis (análisis de riesgos) in order to determine the sanitary conditions governing the importation or transit of an animal or goods, or to verify the sanitary safety of products and by-products that enter or are marketed within the national territory and are subject to its oversight, in accordance with the powers set forth in this Law.” The section means that every animal of the species entering the country must be controlled for the purposes established by these regulations.
In light of the foregoing, the second paragraph of the same section makes sense when it provides: “As it may determine, SENASA may evaluate the veterinary-service system of the exporting country or country of origin, as well as its sanitary status, in accordance with the regulations in force. It may likewise conduct risk analyses for locally sourced products intended for domestic marketing.” Sections 49 and 50 refer to the “prior sanitary import permit” (“permiso sanitario previo de importación”) and the prohibition against the entry of animals lacking such a permit, among other factors subject to verification. The witness Roberto Carranza Echeverría was clear regarding the sanitary conditions arising from the veterinary situation prevailing in the República de Panamá and the potential risk to human health entailed by failing to control the entry of animals originating in that country, particularly insofar as veterinary medications or substances that are prohibited in other countries and/or at least more strictly controlled, as in Costa Rica, are used or administered to cattle there and are potentially capable of causing, if not significant direct harm to human health, then at least a potentially serious risk.
Finally, section 52 of this law authorized the action taken by providing as follows: “Illegal importation. Domestic, wild, aquatic, or other animals, (...) imported in violation of the law shall be immediately slaughtered, destroyed, seized, or returned to their country of origin, as appropriate. / Slaughtered animals and any products or by-products that are destroyed shall be disposed of in accordance with the technical standards issued for that purpose, in a manner that does not harm public health or the environment. / The costs of implementing the foregoing measures shall be borne by the importer or the importer’s representative.” The claimant’s argument that the regulation sought to be applied to him operates punitively only against importers is without merit. As stated above, the action taken in this regard arose from the circumstances under which he acquired ownership of the steers while failing to fulfill his obligations as a dealer in these animals.
The insufficient information concerning the animals’ origin is precisely a matter for which the claimant alone is blameworthy at the time he received the cattle because, regardless of how those animals entered the national territory, the fact remains that the legal system required him to demand the movement permit, which had to be completed accurately and in full, and placed upon him the responsibility of verifying that this had been done. He failed to do so, thereby undermining the oversight capacity to which his contribution is critical in this area, pursuant to what the law defined as the traceability/tracking system (sistema de trazabilidad/rastreabilidad).- 6.3.- On the application of the precautionary principle (principio precautorio) in the specific case. In the present case, this Court also finds that the actions taken complied with the law from the standpoint of the application of this principle.
Indeed, this is what occurred, insofar as the SENASA officials, both of whom had extensive experience and command of the subject matter under their oversight, correctly determined that, as a result of Mr. Nombre112673’s conduct when acquiring ownership of cattle that undoubtedly must, at some point, have entered the country from the Republic of Panama, the following circumstances arose: a) that the owner of those animals failed to require delivery of the movement permit (guía de movilización) when purchasing the steers, from the seller, the responsible party, whether or not that party was the carrier, or the person responsible for the establishment from which those animals came; b) given the foregoing, it was impossible to determine the origin of these cattle, beyond the fact that, bearing brands of the type used in the Republic of Panama, they had at some point entered from that nation; c) since the circumstances under which those cattle entered could not be verified, it could not even be determined whether the respective prior sanitary import permit (permiso sanitario previo de importación) or the international or official veterinary certificate (certificado veterinario internacional u oficial) from the country of origin had been obtained, much less whether the legislation in force had been complied with; d) that all of this compromised the traceability/tracking system (sistema de trazabilidad/rastreabilidad); e) that the presence of the cattle at issue under those conditions entailed a serious risk that could affect animal health, human health, and potentially even trade in general, whether in animals of the species and/or in products associated with their trade, at both the national and international levels.
These circumstances made it necessary to take precautionary measures (acciones precautorias). In this case, the imposition of the measure adopted, ordering the slaughter (sacrificio) of the steers, was fully justified given the uncertainty as to whether they had undergone veterinary and sanitary controls ensuring that they would not adversely affect the interests protected by the legislation governing the matter. The measure adopted is also considered appropriate from the standpoint of proportionality (proporcionalidad) and reasonableness (razonabilidad), in view of the repercussions that the possible entry and continued presence in the country of cattle whose origin and sanitary and veterinary condition were unknown posed to human and animal life and the environment, taking into account the implications that such harm could have for the market and trade in animals and associated products at the national and international levels.
The imposition of an action such as the one adopted, initially by veterinarian Abhanam Acosta Vargas and subsequently by Regional Director Roberto Carranza Echeverría, was not only permissible but also necessary, since at that time it was impossible, as a result of the plaintiff’s conduct, to verify that the procedures deemed sufficient under technical and scientific standards had been followed for entry into the country, so as to ensure that no pest would be introduced through the cattle and/or that no product posing a risk to the health of the final consumer would be marketed. Only if the governing regulations in this area had been complied with—which did not occur—could the existence or involvement of a serious risk of harm have been ruled out with complete certainty and in a timely manner. Accordingly, the challenged actions are not found to have departed in any respect from the legal system or to constitute an improper application of the precautionary principle, and it is so declared.-
VI.Corollary. The plaintiff failed to establish any of the prerequisites necessary for his claims to be granted, without prejudice to the fact that, under the terms of this judgment, the relief sought was partially inadmissible. The complaint must therefore be dismissed in its entirety, and judgment is hereby entered accordingly.-
VII.Regarding the defenses raised (excepciones). Counsel for the State raised the defenses it identified as failure to state a legal right (falta de derecho), lack of passive and active standing ad causam (falta de legitimación ad causam pasiva y activa), lack of a current interest (falta de interés actual), fault of the victim (culpa de la víctima), act of a third party (hecho de un tercero), expiration (caducidad), and statute of limitations (prescripción). Counsel for SENASA, for its part, raised the defenses of failure to state a legal right, fault of the victim, and act of a third party. With respect to the defense raised exclusively by counsel for the State, consisting of the alleged lack of passive and active standing ad causam, the defense under consideration must be rejected, and it is so declared. It is sufficient to note in this regard that counsel for the State fails to present any argument that would make it possible to understand the perspective from which, in his view, the allegation should be deemed well-founded.
Merely for the sake of completeness, and without speculating in this respect, in this specific case, under the regulations governing the cattle-trading activity conducted by the plaintiff, who is also duly registered as such with SENASA, it is clear that the actions of the defendant administration occurred within the framework of the legal relationship linking the claimant to this public administration; accordingly, standing, from the perspective advanced by counsel for the State, is more than evident. As regards the defenses identified by both defendants as fault of the victim and act of a third party, both are rejected. In each instance, the defendants confuse a defense with a substantive requirement governed by substantive law (derecho sustantivo) for the applicability of a ground exempting the public administration from liability (causa eximente de responsabilidad de la administración pública), pursuant to section 190(1) of the Ley General de la Administración Pública.
Accordingly, since what was raised is not, strictly speaking, a defense, its rejection is required. The defense of lack of a current interest was raised exclusively by counsel for the State. In relation to it, it must be noted that, with the same lack of procedural rigor and once again without presenting any argument whatsoever, counsel for the State argued the supposed applicability of that defense. This alone is sufficient to declare it inadmissible; consequently, insofar as it was raised by counsel for the State, it must be rejected. This is without prejudice to the fact that, as indicated, because this substantive prerequisite for the action (presupuesto material de la acción) may be reviewed sua sponte (de oficio), the Court addressed it sua sponte in this judgment with respect to the claims for annulment (pretensiones de corte anulatorio), as well as the claim seeking an order requiring the defendant to return the cattle that, as established, had been slaughtered before the complaint was even filed.
This Court must emphasize, with respect to the manner in which counsel for the State has proceeded, that as to the defenses it outlined and identified as expiration and statute of limitations, it stated nothing—either in its pleading or at the supplemental hearing (audiencia complementaria)—that would explain why it believed those defenses should be upheld. Its application in this regard must therefore be dismissed pursuant to Article 79 of the Código Procesal civil, which applies supplementally by virtue of Article 220 of the Código Procesal Contencioso Administrativo. Compounding the lack of formal rigor with which counsel for the State has again proceeded in this respect is the fact that the events giving rise to the alleged damages claimed date from treinta y uno de mayo del dos mil trece, whereas the complaint adjudicated in this judgment was filed with the courts on treinta de septiembre del mismo año.
It is therefore clear and evident that, whether the defense was intended to secure a declaration that the right of action had expired under the expiration period expressly established in the Código Procesal Contencioso Administrativo for seeking the nullity of formal conduct undertaken by the Public Administration (Article 39(a)(1)), or, as applicable, under the limitation period for the right of action in civil actions involving the public treasury (acciones civiles de hacienda), pursuant to Article 41(1) of the same body of law, in either case the defense or defenses would be manifestly inadmissible. In this regard, counsel for the State must be advised that acting in good faith is conduct required by the legal system as a matter of professional ethics, and counsel is therefore urged to act accordingly in the future. Finally, counsel for both defendants raised the defense of failure to state a legal right, which, based on the considerations set forth in this judgment, must be upheld, as the claimant failed to demonstrate a legal right to the relief sought.
This is without prejudice to the ruling declaring inadmissible the claims for annulment and the claim seeking the return of the cattle that SENASA lawfully slaughtered at the appropriate time, even before the complaint was filed.-
VII.Regarding costs (costas). Both counsel for the State and counsel for SENASA requested in their answers to the complaint that the plaintiff be ordered to pay both categories of costs and interest thereon. Pursuant to section 193 of the Código Procesal Contencioso Administrativo, procedural costs and attorney’s fees (costas procesales y personales) constitute a burden imposed upon the losing party by virtue of having lost. Therefore, because no circumstance exists in the case of Mr. Nombre112673—who lost this proceeding—that would justify exempting him from such an award under subsections (a) and (b) of that section or under Article 194 of the same body of law, he is ordered to pay both categories of costs incurred as a result of these proceedings in favor of the State and SENASA, together with interest at the statutory rate from the date on which the decision determining the corresponding amount becomes final until payment in full.-
POR TANTO
The Court sua sponte declares a lack of a current interest with respect to the claims for annulment and the claim seeking an order for the return of the steers and, consequently, denies the complaint in that respect. The defenses of lack of passive and active standing ad causam and lack of a current interest, insofar as they were raised exclusively by counsel for the State, are rejected. The matters raised as defenses by both defendants, which they characterized as fault of the victim and act of a third party, are rejected. The defense of failure to state a legal right raised by both defendants is upheld as to the remainder of the relief sought, and, to that extent, the complaint filed by Nombre112673 against the State and the Servicio Nacional de Salud Animal is denied in its entirety. Both categories of costs shall be borne by the plaintiff in favor of both defendants, together with interest at the statutory rate, calculated from the date on which the decision determining those costs becomes final until payment in full.- Let notice be served (Notifíquese).- Felipe Córdoba Ramírez Nombre38370 Nombre37769
ASUNTO: PROCESO DE CONOCIMIENTO ACTOR: Nombre112673 DEMANDADOS: El ESTADO Y EL SERVICIO NACIONAL DE SALUD ANIMAL Nº 19-2015-IV TRIBUNAL PROCESAL CONTENCIOSO ADMINISTRATIVO, SECCIÓN CUARTA, SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ, ANEXO A, Goicoechea, a las dieciséis horas del trece de marzo del dos mil quince.- Proceso de conocimiento incoado por el señor Nombre112673 , quien es mayor de edad, casado una vez, comerciante, vecino de Coto Brus, Valle Hermoso de Sabalito, un kilómetro este de la escuela, cédula de identidad número CED89221 (folios del 15 al 28) contra del ESTADO, representado por el Procurador Adjunto Ronny Bassey Fallas, quien es mayor de edad, abogado, vecino de San José, cédula de identidad número CED27907 (folios 54, y del 59 al 74) y el SERVICIO NACIONAL DE SALUD ANIMAL, representado por su Director General, señor Bernardo Jaén Hernández, quien es mayor de edad, divorciado, médico veterinario, vecino de San Pedro de Montes de Oca, cédula de identidad número CED89222 (folios del 145 al 165). Interviene como director procesal de la parte actora el licenciado Johnny Rodríguez Vega, carné del Colegio de Abogados número nueve mil trece.-
RESULTANDO:
Redacta el juez Córdoba Ramírez, se dicta el presente fallo por unanimidad; y
CONSIDERANDO
I.Hechos probados. De relevancia para la resolución del presente proceso se tienen los siguientes:
II.Hechos no probados: De relevancia para la resolución del presente proceso se tienen los siguientes: 1) Que el señor Nombre112673 haya dado cumplimiento a lo que se le ordenó en los términos de la "Hoja de Visita / Orden Sanitaria" identificada con el número DO-MC-01-RE-006 emitida a las diez horas con treinta minutos del treinta y uno de mayo del dos mil trece, por el funcionario del Servicio Nacional de Salud Animal, Abraham Acosta Vargas. (Folios del 46 al 50, 106 y 107 todos del expediente judicial, en asocio con la ausencia de elementos de convicción que permitan afirmar lo contrario); 2) Que con causa en la forma en que el actor habría adquirido en propiedad los quince novillos, se haya permitido a las autoridades competentes en implementación del sistema de identificación, control de movilización y rastreabilidad del ganado bovino, determinar la procedencia y propiedad originaria de los animales, así como la forma en que habrían ingresado al país y en consecuencia, si para ello se habría dado cumplimiento a los requisitos y procedimientos sanitarios que impone el ordenamiento jurídico a efectos de su importación. (La ausencia de elementos de convicción que permitan afirmar lo contrario, a lo que se suma la insuficiencia probatoria de las facturas visibles a folio del 46 al 50 del expediente judicial);
III.Sobre los reproches formulados por la parte accionante. Indicó la parte actora en soporte argumentativo de su acción, -ahora lo que sigue expresado a manera de síntesis- que es dueño y tercero de buena fe, de dieciocho semovientes conforme lo indica la guía de movilización de la Finca número 0599580. Que esos animales se encuentran debidamente marcados con su fierro (de origen de la finca de su propiedad) que además, está inscrito ante el Registro de Marcas de Ganado a su nombre con las siglas "Placa20457". Que confeccionó la guía respectiva a efecto de la movilización de ese ganado, encontrándose autorizado quien identificó como Nombre112674 para trasladar los animales. Que el día Dirección13654 en San Vito, frente las oficinas del "MAG", quien se identificó como el doctor Abraham Acosta Vargas (funcionario de SENASA) detuvo el camión placas Placa20458, en el que se transportaban los novillos mientras era conducido por Nombre112674 .
Agregó que el funcionario procedió a la retención de la carga, aduciendo que provenía de Panamá, con vista en el fierro que presentaban. Que al ser las diez horas treinta minutos del mismo día, el mismo funcionario emitió la que se identificó como "hoja de visita / orden sanitaria 0679" , mediante la que le fue otorgado el plazo de ocho horas par que demostrase la procedencia de los animales. Reprocha haber dado cumplimiento a esa prevención dentro del plazo indicado mediante la presentación de facturas de compra a terceros del ganado que se encontró siendo transportado (bienes que afirmó haber dice haber adquirido de buena fe). Frente a ello, explicó que el funcionario del SENASA consideró que no eran documentos suficientes para demostrar lo que se requería, de modo que no los recibió. Que a las quince horas del mismo día treinta y uno de mayo del dos mil trece, quien se identificó como el doctor Roberto Carranza Echeverría, también funcionario de SENASA, dictó la medida sanitaria número DRB-007-2013, mediante la que se ordenó el sacrificio de los novillos en un número de quince y en aplicación del principio de "precautoriedad" para evitar riesgos en la salud pecuaria del país, y que luego, a las dieciocho horas veintiséis minutos del mismo día, mediante el acta de decomiso número of.DRB-073-2013, se procedió al decomiso de aquellos quince novillos, siendo tres de ellos devueltos por la Administración.
Los novillos fueron en efecto sacrificados. Señaló que señor Carranza solicitó el día dieciséis de junio del dos mil trece información sobre la fecha del sacrificio de los animales; el valor que les fue otorgado; si se determinó que se encontraban enfermos para haber autorizado su sacrificio y si se les había realizado algún estudio o análisis técnico para detectar alguna enfermedad en ellos. En criterio de quien demanda, lo así actuado violentó los principios de legalidad y debido proceso acusando al efecto que dentro del plazo que le fue conferido presentó las facturas a las que hace referencia, más, en lo que corresponde a las guías correspondientes a la adquisición del ganado de su parte, expresa que no fue respetado el plazo que se le otorgó al efecto, pues el decomiso y orden para que fuesen sacrificados los animales se produjo una horas con treinta minutos previos al vencimiento de tal plazo, a lo que se suma, que el día siguiente se procedió a dar muerte a los novillos, esto es, el día primero de junio del dos mil trece, diciendo la administración demandada que la fecha de que corresponde con el acto que dispuso tal actuación, no fue del treinta y uno de mayo, como sí del primero de junio, siendo la data indicada correspondiente con un error material.
Dicho lo anterior, reprocha que pese a que se le dieron ocho horas para demostrar el origen de los novillos y sin haberle dado traslado, el mismo día y antes de que ese plazo venciere, el funcionario procedió al decomiso de estos animales y a ordenar su sacrificio. Que los novillos fueron sacrificados el día primero de junio del dos mil tres, y que la notificación del acto que ordenó su muerte, se le puso en conocimiento de forma posterior, sea, hasta el tres de junio del dos mil trece, otorgándole un plazo para impugnar algo que ya se había ejecutado. También acusó que lo dispuesto por la administración no encuentra fundamento técnico ni así se expresó lo propio en el acto que cuestiona, por lo que carece de motivo, contenido y fundamentación, no habiéndose establecido si los animales estaban o no enfermos, o en su caso que hayan sido importados de forma indebida, hurtados y/o, que se tratara de una movilización ilegal de ganado conforme la Ley de Control de Ganado Bovino número 8799.
Agregó que no fueron descritos los animales ni registradas sus características en un inventario, ni se abundó en razones sobre las marcas que habrían generado duda en el funcionario de SENASA. Estima que se actuó al amparo de meras presunciones sin fundamento, sin amparar lo resuelto al principio precautorio o cautelar. Afirma que no existe una norma que le exija presentar la legitimación y procedencia de los sellos o marcas que se encuentran en los animales como marca de ganado, como sí, que se demuestre tener una marca inscrita, lo que él cumple. Refiere a la existencia de una prohibición de ley para importar, transitar o desplazar animales que pueden ser potenciales portadores o vehículos de agentes infecciosos, parásitos o tóxicos que pongan en riesgo el ambiente, la salud pública veterinaria o la salud animal, pero no qué en aspecto se refieran al fierro o fierros, y son únicamente los animales que se importan en contravención con lo dicho que deben ser sacrificados conforme el artículo 52, de la Ley número 8495, lo que lleva a afirmar que opera para sólo para importadores, condición que no es la suya pues el ganado lo compró de buena fe dentro del territorio nacional.
Durante la audiencia de conclusiones, la representación de la parte actora explicó al amparo de alguna afirmación hecha por uno de los testigos, que en todo caso, es común en la zona encontrar personas que no se ajustan a los requerimientos que para el transporte impone la ley y que permiten la trazabilidad del ganado, por lo que el señor Nombre112673 , bien pudo haber adquirido el ganado de una de esas personas.-
IV.Sobre los alegatos de defensa formulados por la presentación de las partes demandadas. En su contestación a la demanda, ambas partes accionadas se pronunciaron en oposición a la misma en los siguientes términos:
V.Sobre el objeto del presente proceso. Este Tribunal estima pertinente hacer una referencia en relación a los extremos de la demanda, vinculados con la teoría del caso sobre la que se erige la acción, a fin de que la exposición que sigue resulte lo más clara y ordenada posible. En un primer orden de ideas, estima esta Cámara que se impone conocer las pretensiones formuladas en el escrito de demanda en un orden diverso al esbozado. Así, véase que se propone una pretensión que claramente se identifica como principal, que es de corte anulatorio y que supone, la remoción por esta vía, de actos administrativos de corte formal que luego, habrían de haber generado una vez ejecutados en sus efectos, los daños y/o perjuicios que se reclaman, estos últimos que con la misma claridad, corresponden con pretensiones accesorias a la primera. Esto implica y sin perjuicio de la forma en que haya de ser fallado el asunto por el fondo, que las pretensiones indemnizatorias, requieren como presupuesto insalvable el éxito de la pretensión principal, pendiendo su suerte de ese primer nivel de análisis.
De este modo, este Tribunal procederá a determinar lo que corresponde respecto de la pretensión identificada como cuarta, en la medida que conforme esta, se peticiona se declare la nulidad del acto comprendido en la que fue identificada como la “Hoja de Visita / Orden Sanitaria 0679 de las diez horas treinta minutos del 31 de mayo del año 2013; la Medida Sanitaria DRB-007-2013 dictada a las quince horas del día treinta y uno de mayo del año dos mil trece y el acta de decomiso Of.DRB-073-2013 de las dieciocho horas veintiséis minutos del treinta y uno de mayo del 2013”. Luego y sólo en el caso de que se imponga disponer la nulidad de esos actos en todo o en parte, habría de procederse a emitir pronunciamiento sobre el fondo en torno a lo que se pretende a título de indemnización por los daños presuntamente causados, no omitiéndose adelantar que respecto de la pretensión dirigida a que se haga devolución al actor del ganado bovino que fue sacrificado, de entrada resulta inadmisible por resultar materialmente imposible la devolución de un bien que fue en su momento destruido, incluso pre vio a la interposición de la demanda.
VI.Sobre la improcedencia de la demanda en todos sus extremos.- Es el criterio de este Tribunal que no media mejor derecho en el accionante para acceder a lo que peticionó en su escrito de demanda, lo que conduce a declararla sin lugar en todos sus extremos, en función de las siguientes consideraciones.-
6.1.- Sobre la improcedencia de las pretensiones anulatorias. En lo que corresponde con este punto, el actor requirió que en sentencia se declare la nulidad de los actos constituidos por la "Hoja de Visita / Orden Sanitaria de las diez horas treinta minutos del treinta y uno de mayo del año trece; la posteriormente levantada el acta de decomiso Of.DRB-073-2013, así como la Medida Sanitaria número DRB-007-2013 de la Dirección Regional Brunca, Pérez Zeledón, todas actuaciones administrativas que se agotaron en cuanto a sus efectos previo a la interposición de la demanda misma. Debe aclararse a la parte actora que bien pudo haber propuesto se discuta y así se declare lo que corresponda, sobre el ajuste a derecho o no en lo actuado, por cuanto ninguna utilidad a la fecha tendría para sus intereses un pronunciamiento sobre la nulidad de esos actos, siendo materialmente imposible mutar el estado de las cosas a partir de ahí, si el ganado del que dispuso la Administración ya fue sacrificado.
Lo anterior impondría como en efecto se declara la improcedencia de la demanda en ese tanto, y claro está, en la medida en que se peticionó se ordene la devolución de los novillos sacrificados, como en efecto así se resuelve. No obstante, siendo el resto de los extremos peticionados de corte patrimonial asociados a lo que el demandante ha calificado como actuaciones no ajustadas a derecho, nada impide se proceda a efectuarse un pronunciamiento sobre si habría de llevar o no razón al respecto, siendo presupuesto de análisis obligado cuando de acciones civiles de hacienda se trata, aún y prescindiéndose de una pretensión anulatoria. El interés actual se erige como presupuesto material de la demanda, por lo que siendo revisable de oficio, en ambos casos analizados supra, la demanda no tiene lugar y así se declara de oficio, no representando obstáculo lo anterior eso sí, para proceder a hacerse pronunciamiento sobre el fondo de lo demandado, en lo que se pide se declare en sentencia, constituye una típica acción de corte civil de hacienda, lo que supone de parte del juzgador, la determinación de si la conducta que supuestamente habría generado un daño resarcible, resultó ajustada o no al ordenamiento jurídico, discusión que sí propone quien demanda conforme su escrito de demanda.- 6.2.- Sobre el ajuste a derecho de la conducta administrativa cuestionada.
Tomando como punto de partida la situación en que el actor se colocó a sí mismo al adquirir el ganado bovino de interés, se acreditó en la presente causa que privando esa circunstancia, el día treinta y uno de mayo del dos mil trece y a requerimiento del señor Nombre112673 , quien fue identificado como Nombre112674 en su condición de transportista registrado ante el Servicio Nacional de Salud Animal, fue contratado y procedió a trasladar o movilizar mediante el uso del vehículo automotor, los novillos propiedad del actor, de la finca o fincas propiedad del señor Nombre112675 con dirección a otro sitio para su comercialización. No obstante no se trató de un hecho controvertido, consta la guía de movilización que a esos efectos fue levantada, a folios 180 y 181 del expediente judicial. El mismo día la operación de traslado del ganado que efectuaba el señor Nombre112674 , fue interrumpida la misma en la vía pública con ocasión del despliegue de labores de inspección que fueron realizadas por el funcionario del Servicio Nacional de Salud Animal identificado como Abraham Acosta Vargas.
Una vez inspeccionada la carga, en quince de los novillos transportados, observó este funcionario haciendo uso de su experiencia en estas tareas de inspección, que los animales llevaban impresas en su cuerpo, además de la marca que corresponde al fierro del señor Nombre112673 , otras que reconoció como usualmente utilizadas para identificar este tipo de animales en la República de Panamá, así como la existencia de marcas que no habían sido declaradas en su totalidad y de forma clara, en el espacio correspondiente en la guía de movilización. A folio 178 del expediente judicial consta el documento identificado como "Hoja de Visita / Orden Sanitaria" levantada al efecto, que le fue notificada al señor Nombre112673 a las diez horas con treinta minutos del día en que fue inspeccionado el transporte, sin perjuicio de las explicaciones dadas en juicio por el propio señor Abraham Acosta Vargas sobre lo ocurrido ese día.
El documento se encuentra identificado con el número DO-MC-01-RE-006, así como consta que le fue notificado al actor al ser las diez horas con treinta minutos del treinta y uno de mayo del dos mil trece. Con fecha de rige de ese mismo día, se señaló en el documento a título de observaciones por parte del funcionario Acosta Vargas lo siguiente: "En el camión placa Placa20458 el Sr. Nombre112674 (...) transporta dieciocho novillos con guía #049308-0599880 de finca código 608-050639 de Nombre112673 . Los animales presentan fierros que no han sido declarados en su totalidad y con claridad en el sitio que corresponde de la guía", (el resaltado no es del original) para seguido girar orden sanitaria en el siguiente sentido: "Se le ordena al propietario Nombre112673 que en un plazo de 8 horas a partir de ahora presente las guías o facturas comerciales donde demuestre la procedencia de los animales que presentan esas marcas de fierro visibles en los animales, tanto las declaradas como las no declaradas (Presentarlas en Subasta Coto Bruz)", (el resaltado no es del original).
Luego, al ser las dieciocho horas con veintiséis minutos del treinta y uno de mayo del dos, cuatro minutos previos al vencimiento del plazo otorgado al actor, para que diese prueba sobre el origen de los animales, (lo que no podría interpretarse de otra forma conforme la ley, habría comprendido acreditar la identidad de anterior propietario y lugar de procedencia del ganado conforme se habría esperado, sea información comprendida en la guía de movilización con que debía requerir y recibir del tercero que le vendió los novillos), el mismo funcionario de SENASA procedió a decomisar esos quince animales y al efecto, en el documento respectivo consignó las siguientes consideraciones en lo conducente: "... procedo al decomiso de los siguientes animales: 15 bovinos, los cuales eran transportados en vehículo Placas Placa20458, con la guía #049308-0599508, la cual no presentaba en su dorso todas las marcas de fierro, siendo que en el apartado 2.4, se dibuja en el cuadriculado la marca de fierro BY/E2, registrada para el responsable Nombre112673 , (...). / Los animales, presentan marcas varias, las cuales no son justificadas en los reportes de ingreso al establecimiento SIREA 608-050639, pertenecientes (sic) a Nombre112675 (...). / Motivo del decomiso: Animales con marcas no asentadas en ningún establecimiento y no concordantes con las reportadas en el Ingresos (sic) al establecimiento...".
(El resaltado y subrayado no es del original). El acta de decomiso consta visible a folio 179 del expediente judicial. A este punto debe indicarse, que de lo consignado en ambos documentos expedidos y puestos en conocimiento del actor, se extrae que con total independencia de si el actor mismo y/o el transportista que contrató, contaban o no con las autorizaciones de rigor para poder ejercer su actividad, en los cuerpos de los animales se encontraron marcas que conforme los registros que al efecto lleva SENASA, se determinó que no habrían sido reportadas como correspondientes al ganado ingresado al establecimiento de Nombre112675 , que lo fue para el período en cuestión exclusivamente de siete fincas, todas las cuales operan con fierros o marcas distintas a las observadas en los novillos, mientras que por otro lado, esas marcas observadas, no correspondían justo conforme los mismos registros, a "algún establecimiento" , sea, ninguno dentro del territorio nacional, lo que consecuentemente y por la más simple lógica racional, habría de dirigirnos a estimar que dicho ganado ingresó en algún momento -tampoco determinable- desde fuera del territorio de la República de Costa Rica, posiblemente si se quiere, de la República de Panamá tal y como lo estimó el señor Abraham Acosta Vargas, profesional en veterinaria de vasta experiencia dentro de la organización de SENASA por veintidós años de servicio, y así lo estima este Tribunal como un hecho probado dada la calidad y potencia probatoria que llevaron sus declaraciones, en concurso con las del Jefe de la Dirección Regional del Senasa, Región Brunca, Roberto Carranza Echeverría, también médico veterinario, con maestría en administración de empresas, con una experiencia que data de mil novecientos setenta y nueve en esta materia, quien mostró en su deposición además, un manejo técnico de la materia muy alto en criterio de este Tribunal.
Este profesional además indicó haber verificado a través de fotografías, que las marcas en el ganado corresponden con las que son usadas en la República de Panamá, así como que no correspondían con alguna de las registradas en el país. También demostró manejar con detalle información sobre las condiciones técnicas, veterinarias y sanitarias con las que se maneja el ganado en Panamá, a lo que agregó explicaciones sobre el riesgo que para la salud humana implica que al importarse animales de ese origen, no les sean aplicados los controles que manda la ley. Entendemos que se trata de los asociados al permiso de importación. Dicho lo anterior en términos diversos, al hacer ingresar el actor sus novillos al establecimiento propiedad del señor Nombre112675 , no portaba al efecto, por no haberla recibido de quien recibió el ganado, la respectiva guía de movilización que diera cuenta de su origen, a lo que se suma, que marcas impresas en el ganado simplemente no se encuentran asentadas en establecimiento alguno dentro del país.
Esto es, que por la misma forma en que habría maniobrado el actor y dada la información que SENASA poseía sobre los movimientos de entre otros, el establecimiento que usaba al efecto el propio señor Nombre112673 , se desconocía de dónde habían llegado a su poder esos animales, y/o, quien fue su anterior propietario, así como si al momento de su ingreso al país, habían pasado por los controles de rigor que garantizasen sus condiciones sanitarios y veterinarias. A folios del 184 al 197, consta el texto de la medida sanitaria identificada con el número DRB-007-2013, que pese indicar que fue dictada La Dirección Regional Brunca del Servicio Nacional de Salud Animal, en la persona de su Director señor Roberto Carranza Echeverría, al ser las quince horas del treinta y uno de mayo del dos mil trece, no cabe duda de que lo habría sido con posterioridad al decomiso de los animales efectuada por el señor Abraham Acosta Vargas por razones obvias, a lo que se deben sumar las manifestaciones hechas en juicio sobre el procedimiento seguido por parte de ambos funcionarios de SENASA que durante toda su deposición en ambos casos, se mostraron seguros, concordantes y muy conocedores de sus funciones y de la actividad que nos ocupa, de manera que para este Tribunal esas manifestaciones en todo nivel, llevan gran credibilidad.
Pues bien, la resolución mencionada comprende una medida sanitaria que fue adoptada por la Dirección Regional en el siguiente sentido: "Ordenar que a los quince animales descritos, les sea aplicada como medida sanitaria el "Rifle Sanitario en Matadero" en aplicación del principio de precautoriedad, a los efectos de evitar riesgos a la salud pecuaria del país, medida sanitaria esta que es de acatamiento obligatorio y de ejecución inmediata. / La ejecución de la medida sanitaria anteriormente descrita será ejecutada por esta Dirección Regional", esto es, que se ordenó su sacrificio, tal y como lo dispone como una de sus atribuciones, el artículo 37, el 51 en lo que reza: "Documentación para transportar. Las personas físicas o jurídicas, así como las compañías dedicadas al transporte internacional, nacional y en tránsito, estarán obligadas a requerir, de los interesados, los documentos y requisitos que imponen la presente Ley y su Reglamento, antes de recibirlos a bordo. / De no portar esos documentos, el Senasa podrá disponer el sacrificio de los animales...", el 52 en su caso y el 89, inciso j), todos de la Ley General del Servicio Nacional de Salud Animal, sin perjuicio de lo que dispone su reglamento.
No obstante las claras explicaciones sobre esta forma de actuar dadas en juicio por el Director Regional de SENASA, autor de esta resolución en juicio sobre el motivo del acto, considera este Tribunal que el mismo se encuentra plasmado, con igual claridad en su texto. Véase que se determinó al efecto en sede administrativa una vez efectuada una revisión de la información que consta en las bases de datos que al efecto lleva la institución y la documentación con la que sí contó la operación de transporte del ganado propiedad del actor, que en el dorso de la guía de movilización con que se estaba efectuando el transporte no constaban en su totalidad las marcas de fierro que poseían los quince animales en su cuerpo; que se había reportado que los animales provenían de la finca del señor Nombre112675 , en la que a partir de su registro solamente se acreditó la existencia de 30 animales; que el señor Nombre112673 , asentó su marca de ganado en la propiedad del señor Nombre112675 por lo que operaba efectivamente con ella.
También se tomó en cuenta que a la data de la detención de los animales el treinta y uno de mayo del dos mil trece, se contabilizaban como ingresos a la finca de Nombre112675 , únicamente siete movimientos de ganado que habrían ingresado a ese establecimiento para un total de ciento setenta y dos animales, todos provenientes de siete fincas también debidamente registradas. Había llamado la atención el hecho de que pese haberse reportado ingresos a esta finca únicamente de esos establecimientos, ninguno de los quince novillos propiedad del señor Nombre112673 llevaban en su cuerpo impresas las marcas asentadas en esas otros establecimientos. Esto lo que quiere decir, es que el establecimiento de origen de esos animales, resultó desconocido por no haber sido reportado ni documentado el movimiento de los novillos del actor, lo que se explicaría, en la medida en que como hecho no probado dentro de la presente causa, se ha tenido que el señor Nombre112673 haya dado cumplimiento a lo que se le ordenó en los términos de la "Hoja de Visita / Orden Sanitaria" identificada con el número DO-MC-01-RE-006 emitida a las diez horas con treinta minutos del treinta y uno de mayo del dos mil trece por el funcionario del Servicio Nacional de Salud Animal, Abraham Acosta Vargas.
Lo propio consta visible a folios del 46 al 50, 106 y 107 todos del expediente judicial, en asocio con la ausencia de elementos de convicción que permitan afirmar lo contrario, pues como habría de haberse esperado del actor, no poseía, ni requirió o recibió de quien o quienes le vendieron estos animales, la guía de movilización que se encontraba obligado por ley a poseer, contra entrega de estos novillos. Consecuentemente no fue reportado el movimiento de estos a SENASA. Siempre con vista en la misma resolución o medida sanitaria referida, de los siete establecimientos de los que se declaró en su momento, provenía el ganado ingresado a la propiedad de Nombre112675 -que necesariamente habría comprendido al del actor- cuatro de los siete se dedican a la actividad lechera, no así de carne. Lo que explicaría por qué el sello o marca asentada en estos establecimientos no se observaba en el ganado.
Mas lo anterior no explicaría por qué en relación con las otras tres fincas que si producen o comercializan ganado para carne, ninguno de los sellos en ellas asentada, se había hecho impreso en los animales. Además, se determinó con vista en la guía de movilización con que se encontraba siendo transportado el ganado del actor, que si bien el que se denominó "sticker" adherido a ella, correspondió efectivamente al transportista Nombre112674 , el código de transportista consignado en la guía correspondía a un tercero identificado como Carlos Salazar Martínez. En su conjunto analizados los elementos con que a ese momento contó la autoridad pública accionada sin que el actor hubiese acreditado lo contrario como se lo impone la ley -pues la carga de la prueba corresponde a una de sus obligaciones- estima este Tribunal que la Administración en el caso concreto actuó de forma totalmente ajustada al ordenamiento jurídico al presumir válidamente ante ausencia de elementos de convicción que apuntasen en otro sentido, a estimar que ese ganado habría ingresado al territorio nacional sin haberse dado cumplimiento con los requisitos y procedimientos obligatorios para la importación de animales y mercancías, y también por la vía de presunción, palmariamente inobservadas las disposiciones de carácter sanitario impuestas por el ordenamiento jurídico, lo que implicó un potencial e inminente riesgo para la salud animal, que adecuadamente condujo en aplicación además del principio precautorio, a disponer el sacrificio de los novillos.
En su declaración, el médico veterinario del SENASA y Director de una de sus sedes regionales, Roberto Carranza Echeverría explicó, que la situación representaba tres tipos distintos de peligros. Uno lo intensificó en el ámbito de la salud animal, en la medida en que animales que ingresen sin control alguno, tengan alguna enfermedad que sea transmisible. Otro lo asoció al aspecto veterinario, particularmente tomando en cuenta que en Panamá hay productos que se extienden irrestrictamente, mientras que en Costa Rica lo es únicamente bajo receta de un veterinario. De hecho afirmó, que Panamá tiene vedada la posibilidad con fundamento en esta razón, de importar ganado y/o sus productos a los Estados Unidos de América. Luego, haciendo mención a los productos con que en Panamá se trata el tórsalo en los animales, también se permite en esa nación la aplicación de un producto que conforme la dosis que aplican, son perjudiciales para la salud humana.
En Costa Rica explicó, aunque se usa, lo es bajo receta y en dosis que minimizan el riesgo en alto grado. Agregó que por eso Costa Rica tiene prohibido la importación de ganado de Panamá para su matanza, salvo cuando se trate de animales de menos de catorce días y que en relación con estos se respete un período de retiro que garantice que el del cuerpo del animal, naturalmente se desechen estos productos. Finalmente, la resolución dictada en los términos que se relacionan, fue ejecutada previa verificación de los procedimientos sanitarios correspondientes, el día primero de junio del dos mil trece. Los controles de rigor fueron efectuados tanto ante mortem como procede en caso de animales sospechosos, como post mortem, determinándose para terminar que la carne de los animales resultaba apta para el consumo humano. (Folio del 213 del expediente judicial). Lo que en nada afectó la validez de la orden sanitaria adoptada.
Baste con indicar sin necesidad de abundar en razones, que en el Capítulo IV, de la Ley General del Servicio Nacional de Salud Animal se regula el intercambio comercial y tránsito de animales, así como los productos y subproductos de origen animal, dentro del que su numeral 48, dispone en su primer párrafo que: "El Senasa considerará realizar el análisis de riesgos, a fin de determinar las condiciones sanitarias a las que se supeditará la importación o el tránsito de un animal o mercancía, o para comprobar la seguridad sanitaria de los productos y subproductos que ingresen o se comercialicen en el territorio nacional y que son objeto de su control, de conformidad con las competencias señaladas en la presente Ley". El artículo implica que todo ingreso de un animal de la especie al país debe ser controlado a los fines fijados por esta normativa. Adquiere sentido a partir de lo anterior lo que dispone el mismo numeral en su segundo párrafo, a saber, que: " Según lo determine; el Senasa podrá evaluar el sistema del servicio veterinario del país exportador o de origen, así como su estado sanitario, de conformidad con las normas vigentes.
Asimismo, podrá realizar análisis de riesgos para los productos de origen local destinados a la comercialización interna". Los artículos 49 y 50, refieren al "permiso sanitario previo de importación" y la prohibición de entrada de animales que no cuenten con el mismo, entre otros factores susceptibles de verificación. El testigo Roberto Carranza Echeverría fue claro respecto a las condiciones sanitarias a partir de su realidad veterinaria que priva en la República de Panamá y el posible riesgo para la salud humana que implicaría no controlar el ingreso de animales provenientes de esa nación, particularmente en la medida en que en ese país para efectos veterinarios, se usan medicamentos o aplican sustancias en el ganado, prohibidos en otros países, y/o al menos controlados con mayor rigor, como ocurre en Costa Rica, que son potencialmente aptos para generar sino daños directos importantes en la salud humana, sí un riesgo potencialmente grave.
Para terminar, el artículo 52 de esta ley amparó lo actuado el establecer lo siguiente: " Importación ilegal. Los animales domésticos, silvestres, acuáticos u otros, (...) importados en contravención de la legislación, serán sacrificados , destruidos, decomisados o reembarcados inmediatamente, a su país de origen, según proceda. / Los animales sacrificados y los productos o subproductos que se destruyan, deberán desecharse de conformidad con las normas técnicas que se emitan al respecto, de manera que no dañen la salud pública ni el medio ambiente. / Los gastos por la aplicación de las medidas anteriores, correrán por cuenta del importador o su representante". El alegato que formuló el accionante en la medida que estima que la regulación que se le pretendió aplicar opera púnicamente respecto de los importadores, no es de recibo. Lo actuado en este sentido obedeció como se indicó atrás, a las circunstancias bajo las cuales adquirió en propiedad los novillos faltando a sus obligaciones como comerciante de estos animales.
Justamente la insuficiente información en torno al origen de los animales, corresponde con un tema exclusivamente reprochable en al actor al momento de recibir el ganado bovino pues con independencia de la forma en que ingresaron esos animales al territorio nacional, lo cierto es que el ordenamiento jurídico le habría impuesto exigir la guía de movilización que debía encontrarse confeccionada de forma fidedigna y completa, bajo responsabilidad suya de verificar que ello fuese así, cosa que no hizo, vulnerando así la capacidad de control con la que su contribución es crítica en esta materia, al amparo de lo que la ley definió como sistema de trazabilidad/rastreabilidad.- 6.3.- Sobre la aplicación del principio precautorio en el caso concreto. En el presente caso también es criterio de este Tribunal que lo actuado se ajustó a derecho desde la óptica de la aplicación de este principio. Y es que así fue lo que ocurrió en el tanto funcionarios los funcionarios de SENASA, ambos con gran experiencia y dominio de la materia sujeta a su control, lograron constatar con acierto, que con causa en el actuar del señor Nombre112673 a la hora de adquirir en propiedad ganado bovino que sin duda en algún momento debió ingresar al país desde la república de Panamá se presentaban las siguientes situaciones: a) Que el propietario de esos animales haya exigido la entrega de la guía de movilización a la hora de comprar los novillos, de parte del vendedor, el responsable, ya sea transportista o no, o del responsable del establecimiento del que provenían esos animales; b) en la medida en que lo anterior sucedió así, que no resultaba posible conocer el origen de este Ganado, más allá de que llevando impresas marcas de las que son usadas en la República de Panamá, en algún momento ingresó proveniente de esa nación; c) que no pudiéndose corroborar las circunstancias en las que ingresó ese ganado, siquiera si al efecto se contó el respectivo permiso sanitario previo de importación, el certificado veterinario internacional u oficial del país de origen, menos si se dio cumplimiento o no a la legislación vigente; d) Que con todo ello, se vulneró el sistema de trazabilidad/rastreabilidad; e) Que la presencia del ganado de interés en esas condiciones implica un riesgo grave que podría afectar tanto la salud animal, la humana y eventualmente hasta el comercio en general, ya sea de animales de la especie y/o de productos asociados a su comercio a nivel tanto nacional como internacional.
Estas condiciones hacían necesaria la toma acciones precautorias. En este caso se justificaba plenamente la imposición de la medida adoptada ordenando el sacrificio de los novillos ante la incerteza de si habían pasado controles veterinarios y sanitarios que garantizaren que no afectarían aquellos bienes tutelados en la legislación que regula la materia, la medida adoptada por otro lado se estima adecuada desde el punto de vista de su proporcionalidad y razonabilidad en virtud de la repercusión que para la vida humana, animal y el ambiente representó la eventual entrada y permanencia en el país de ganado bovino respecto del que se desconocía su origen y condiciones sanitarias y veterinarias, teniendo en cuenta las implicaciones que podría tener una eventual afectación de este corte, en el mercado y comercio de animales y productos asociados a nivel nación al e internacional. La imposición una acción como la adoptada, no solo por parte del médico veterinario Abhanam Acosta Vargas, así como y posteriormente por el Director Regional Roberto Carranza Echeverría no solo resultó admisible, sino además necesaria, toda vez que a ese momento no se contaba la posibilidad de corroborar con causa en el actuar del actor, que para el ingreso al país se contó con el cumplimiento de los procedimientos que en técnica y ciencia resultan suficientes, para garantizar que no será introducida por medio del ganado una plaga y/o que se comerciará frente al consumidor final un producto que ponga en riesgo su salud.
Es si se hubiese dado cumplimiento a la normativa que priva en esta materia, cosa que no ocurrió, que se habría podido descartar, con toda certeza y oportunamente, la ocurrencia o mediación de un grave riesgo de daño, de manera que no se encuentra que las actuaciones cuestionadas, desajuste alguno con el ordenamiento jurídico o una indebida aplicación del principio precautorio, y así se declara.-
VI.Corolario. Quien demanda no acreditó ninguno de los presupuestos que habrían de hacer procedentes sus pretensiones, sin perjuicio de lo que en los términos en que se dicta la presente sentencia, lo peticionado en parte resultó inadmisible, por lo que se impone declarar la misma sin lugar en todos sus extremos y así se procede a fallar.-
VII.Sobre las excepciones interpuestas. La representación del Estado interpuso las excepciones que identificó como falta de derecho, falta de legitimación ad causam pasiva y activa, falta de interés actual, culpa de la víctima, hecho de un tercero, caducidad y prescripción. Por otra parte, la representación de SENASA interpuso las excepciones de falta de derecho, culpa de la víctima y hecho de un tercero. En lo que corresponde con la excepción interpuesta exclusivamente por parte de la representación del Estado, constituida por la acusada falta de legitimación ad causam pasiva y activa, se impone el rechazo de la excepción en análisis y así se declara, bastando con indicar al respecto que el representante estatal omite esgrimir estructura argumentativa alguna que permita comprender desde qué óptica es que en su criterio, lo acusado habría de resultar procedente. Sólo a mayor abundamiento de razones y sin elucubrar al respeto, en el caso concreto al amparo de la normativa que rige la actividad de comercialización de ganado bovino a la que se dedica el actor, encontrándose además debidamente registrado como tal ante SENASA, es claro que lo actuado por la administración demandad se produjo en el marco de la relación jurídica que vincula al accionante con esta administración pública, de modo que la legitimación desde la óptica planteada por la representación estatal, resulta más que evidente.
El lo que toca a la excepción que fue identificada por ambas partes demandadas como culpa de la víctima, y hecho de tercero, se rechazan ambas. En todos los casos confundan las partes demandadas lo que corresponde con una excepción, con un presupuesto de fondo regulado por el derecho sustantivo, para la procedencia de una causa eximente de responsabilidad de la administración pública conforme lo regulado en la Ley General de la Administración Pública en su numeral 190, inciso 1). Así las cosas, no siendo la interpuesta una excepción propiamente dicha, se insiste, se impone el rechazo la mima. La excepción de falta de interés actual fue interpuesta exclusivamente por parte de la representación estatal. En relación con esta, debe indicarse que con igual falta de rigor procesal, en ningún nivel argumentativo nuevamente, el representante del Estado argumentó la supuesta procedencia de tal excepción, pos lo que basta con ello para declarar su improcedencia, por lo que en lo que fue interpuesta de su parte, se impone el rechazo de la misma, sin perjuicio de que tal y como se indicó, en relación con este presupuesto material de la acción, siendo revisable de oficio, lo propio se indicó en la presenten sentencia de oficio, en torno a las pretensiones de corte anulatorio, así como a la pretensión dirigida a que se ordene a la parte demandada la devolución del ganado bovino que se acreditó, fue sacrificado en su momento, previo incluso a la interposición de la demanda.
Este tribunal debe insistir en relación con la forma en que se dirige la representación estatal, en que respecto de las excepciones esbozadas de su parte identificadas como caducidad y prescripción, nada, ni en su escrito de demanda, ni en la audiencia complementaria dice, que dé cuenta de las razones por las que estima que las mismas habrían de ser declaradas con lugar, por lo que se impone desechar su gestión en este sentido al amparo de lo dispuesto en el artículo 79 del Código Procesal civil, de aplicación supletoria en virtud de lo dispuesto en el artículo 220 del Código Procesal Contencioso Administrativo. Se suma a la falta de rigor formal con la que se conduce la representación estatal nuevamente en ese tanto, que los hechos generadores de los presuntos daños reclamados datan del treinta y uno de mayo del dos mil trece, mientras que la demanda que se conoce en los términos de la presente sentencia, fue presentada a estrados judiciales el día treinta de septiembre del mismo año, resultando notorio y evidente, que ya se haya pretendido invocar dicha excepción para que se declare el fenecimiento del derecho de acción al amparo del plazo de caducidad previsto expresamente en el Código Procesal Contencioso Administrativo para requerir la nulidad de una conducta formal desplegada por la Administración Pública (artículo 39, inciso a), apartado 1), en su caso en el plazo previsto para la prescripción del derecho de acción en tratándose de acciones civiles de hacienda al amparo de lo dispuesto en el artículo 41, inciso 1) del mismo cuerpo legal, en ambos casos la excepción o excepciones resultarían groseramente improcedentes.
En este sentido debe indicarse a la representación del estado que conducirse de forma leal es una conducta que se encuentra impuesta por el ordenamiento jurídico desde el punto de vista deontológico, por lo que se le insta a proceder de conformidad en el futuro. Finalmente, la representación de ambas partes demandadas interpusieron la excepción de falta de derecho, misma respecto de la que en función de las consideraciones hechas en los términos de la presente demanda, habrán de ser declaradas con lugar, no habiendo la parte accionante demostrado poseer derecho para acceder a sus pretensiones, sin perjuicio de lo fallado en términos de la inadmisibilidad de la pretensiones anulatorias y aquella dirigida a la devolución del ganado que fue legítimamente sacrificado por parte de SENASA en su oportunidad, precio incluso a la interposición de la demanda.-
VII.Sobre las costas. Tanto la representación estatal como la del SENASA peticionaron en su escrito de contestación a la demanda, que se condene a la parte actora al pago de ambas costas y al pago de intereses sobre estas. De conformidad con el numeral 193 del Código Procesal Contencioso Administrativo, las costas procesales y personales constituyen una carga que se impone a la parte vencida por el hecho de serlo, de forma tal que no mediando presupuesto alguno que en el caso del señor Nombre112673 , -vencido en este proceso-, justifique exonerarle de dicha condenatoria al amparo de los incisos a) y b) de dicho numeral, tanto como al amparo del artículo 194 del mismo cuerpo legal, se condena a este al pago de ambas costas generadas como consecuencia de la tramitación de la presente causa en favor del Estado y del SENASA, sobre las que habrá de reconocer intereses al tipo legal desde la firmeza de la resolución que determine la suma correspondiente y hasta su efectivo pago.-
POR TANTO
De oficio se declara la falta de interés actual respecto de las pretensiones anulatorias así como en relación con la dirigida a que se ordene la devolución de los novillos y en consecuencia, sin lugar la demanda en ese tanto. Se rechaza la excepción de falta de legitimación ad causam pasiva y activa, así como de falta de interés actual en lo que fueron exclusivamente interpuestas por la representación del Estado. Se rechazan las que a título de excepción esgrimieron ambas partes demandadas, en lo que denominaron como culpa de la víctima y hecho de tercero. Se acoge la excepción de falta de derecho interpuesta por ambas partes demandadas en cuanto al resto de lo pretendido y en este tanto, se declara sin lugar en todos sus extremos la demanda interpuesta por Nombre112673 en contra del Estado y el Servicio Nacional de Salud Animal. Son ambas costas a cargo del actor y en favor de ambas partes demandadas, mismas sobre las que habrá de reconocer intereses al tipo legal, que habrán de ser computados a partir de la firmeza de la resolución que así las determine y hasta su efectivo pago.- Notifíquese .- Felipe Córdoba Ramírez Nombre38370 Nombre37769
