5. The statutory requirements were observed in the conduct of the proceeding, and the judgment contains no discernible errors or omissions capable of rendering it void.- Drafted by Judge Picado Vargas, and,
CONSIDERING:
II.Attorney Lydiana Rodríguez Paniagua, acting as Deputy Attorney General, appeals the judgment, arguing essentially: 1).- That the land for which title is sought is mountain land in nature; she cites Law 4465 of November 25, 1969, which established the State Forest Estate (patrimonio forestal del Estado), including those areas of national reserves containing forests, and therefore contends that it is public-domain property (bien demanial) under sections 13, 14, and 15 of Ley Forestal 7575. She cites a series of decisions, most notably 4587-97. She states that forests are part of the public domain because they form part of the State Natural Heritage (Patrimonio Natural del Estado) and therefore cannot be titled. 2.- She argues as error that the witnesses’ testimony does not establish the ten-year possession required for acquisition by adverse possession (usucapir) by the owner and requests reversal and denial of these proceedings (pages 216 to 222).-
III.Regarding the ground of appeal concerning the existence of an area with forest cover (cobertura boscosa) that cannot be acquired by adverse possession because it forms part of the State Natural Heritage, the appellant is incorrect. These proceedings were instituted to register in the Public Property Registry the grazing and mountain property located in [Dirección4] in the Province of Puntarenas, measuring fourteen hectares one hundred sixty-four thousand one hundred twenty-one square meters and four square decimeters, according to plan P-948397-2004 (page 2). That property is not part of a protected wildlife area (área silvestre protegida), as stated in the certification issued by the Sistema Nacional de Áreas de Conservación and submitted in the record (page 3). The soil study appearing on page 172 states that the land has been used in accordance with its soil characteristics; it certifies that its current use consists of overgrown pastureland, forest cover, and reforestation (page 172).
The Court conducted a judicial inspection (reconocimiento judicial) of the property, for which a record was drawn up stating that the land for which title is sought is a property devoted to secondary forest (bosque secundario) and pastures and is properly demarcated (page 90). The appellant contends that, because the judicial inspection included statements that the property contains secondary forest, the nature of the property to be registered is forested (mountain) and it therefore cannot be titled. This Court considers that neither the trial judge’s reference to the existence of an area of “mountain” on the property nor the inspection itself permits the inference or establishes the existence of forested areas within the technical meaning defined by Ley Forestal N. 7575. As may be gathered from the judicial inspection record itself on page 90, the court below stated that the land is devoted to secondary forest undergoing reforestation, a term that cannot properly be equated with forest, because it may be inferred from that record that the land is undergoing natural regeneration.
In addition, it must be taken into consideration that the proceeding includes a series of technical opinions rendered by legally qualified professionals, which assist the judge in determining whether forests exist, and what type, according to the technical definitions in Ley Forestal Nº 7575; the soil study itself indicates that the land consists of natural grasses, not forest. In this case, evaluation of the cited testimony and the soil study in the record supports the conclusion that the land does not contain forest as asserted by the appellant, but rather an area of scrubland (tacotal). Regarding the definition of secondary forest, which the appellant has sought to equate with the scrubland existing on the property for which title is sought, the Comisión Nacional de Certificación Forestal de Costa Rica defines secondary forest as “... land with woody vegetation of a secondary successional nature that develops after the original vegetation has been removed by human activities or natural phenomena; with a minimum area of 0,5 ha and a density of no fewer than 500 trees per ha of all species.” (CNCF 1999, Comisión Nacional de Certificación Forestal. 1999.

Likewise, the concept of scrubland is “dense brush” and must not be understood to constitute a forest. Ley Forestal N. 7575 defines forest as follows: “A native or indigenous ecosystem, whether disturbed or undisturbed, regenerated through natural succession or other forestry techniques, occupying an area of two or more hectares and characterized by the presence of mature trees of different ages, species, and sizes, with one or more canopies covering more than 70% of that area and containing more than sixty trees per hectare measuring fifteen or more centimeters in diameter at breast height.” In this case, no area of the property has been identified as meeting those conditions. For its part, Article Seven of the Ley de Informaciones Posesorias states that properties located outside protected wildlife areas and containing forests may be titled if the claimant demonstrates ownership of the legal rights arising from ten-year possession and that the claimant has protected the resource, without distinguishing between secondary and primary forests.
This follows from these definitions and from the INTA technical study appearing on page 64. To classify that type of vegetation as public-domain property or forest would constitute an incorrect application of the law and would fail to encourage this type of forest-regeneration activity. This activity is necessary for capturing carbon from the atmosphere and therefore constitutes an environmental measure against global warming; because such activities benefit the environment, it would be inconsistent to penalize possessors who undertake this type of forest regeneration by denying them title to their property. In view of the foregoing, the Court does not agree with the State representative’s contention that, because the land is regenerating naturally, it forms part of the State Natural Heritage, since, pursuant to Article 856 of the Código Civil, the property is capable of being acquired by adverse possession.
Accordingly, under Article 7 of the Ley de Informaciones Posesorias, the Court finds that the evidence submitted did establish the exercise of the required legal possession (posesión legal) over the property for ten years preceding the date on which this proceeding was instituted, and that the land at issue in these proceedings may be acquired by adverse possession because it is located outside any protected wildlife area, regardless of its management category, and because possessory acts (actos posesorios) aimed at conserving natural resources were carried out. (In this regard, Decision Nº51 issued at 15 hours 15 minutes on May 26, 1995, by the Sala Primera de la Corte Suprema de Justicia may be consulted).
IV.Regarding the ground of appeal asserting that the witnesses’ testimony does not establish ten-year possession, the appellant is likewise incorrect. Testimony was also received from witnesses [Nombre7], [Nombre8], and [Nombre9] (pages 87 to 89). The witnesses state that they had known the property for more than twelve, eight, and eight years, respectively. The witnesses stated that the property is currently possessed by the claimant and used for reforestation. Although two of them state that they have known the property for eight years, the claimant submitted public deeds from which the chain of possession (cadena posesoria) and the years of possession may be inferred (pages 7 to 9), demonstrating that possession has been exercised continuously by the claimant and the claimant’s transferor; they likewise know of no possessory disputes arising from the possession exercised over the land. This ground of appeal is therefore rejected.
THEREFORE:
The judgment is affirmed as to the matters appealed.

VOTO N° 206-F-14 TRIBUNAL AGRARIO. SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ.- A las diecisiete horas y catorce minutos del siete de marzo de dos mil catorce.- INFORMACIÓN POSESORIA promovida por [Nombre1] , mayor, casado, empresario, vecino de Punta Encanto del Golfo Dulce, Golfito, Puntarenas, cédula de identidad número CED1 - - . Intervienen en el proceso, la PROCURADURÍA GENERAL DE LA REPÚBLICA, representado por su procuradora adjunta Lydiana Rodríguez Paniagua, de calidades ignoradas en autos, y el INSTITUTO DE DESARROLLO RURAL, apersonándose en su representación Carmelina Vargas Hidalgo, mayor, divorciada una vez, abogada, cédula de identidad número CED2 - - , vecina de Escazú, en el carácter de apoderada general judicial. Actúa como apoderado especial judicial del promovente, el licenciado Hilario Andrey Aguero Santos, mayor, soltero, abogado, vecino de Corredores, cédula de identidad número CED3 - - , colegiado número dieciséis mil ciento ochenta y ocho. Tramitado ante el Juzgado Agrario del Segundo Circuito Judicial de la Zona Sur, Corredores.-
RESULTANDO:
5. En la substanciación del proceso se han observado las prescripciones legales, y no se nota la existencia de errores u omisiones en el fallo capaces de producir su nulidad.- Redacta el Juez Picado Vargas, y,
CONSIDERANDO:
II.La Procuradora licenciada Lydiana Rodríguez Paniagua apela el fallo dictado indicando en lo fundamental: 1).- Que el terreno a titular tiene naturaleza montaña, cita la ley 4465 de 25 de noviembre de 1969 en la cual se establecía el patrimonio forestal del estado incluyendo las áreas de las reservas nacionales que tuvieran bosques, por lo que se trata de un bien de carácter demanial al amparo de los dispuestos por los ordinales 13 , 14 y 15 de la Ley Forestal 7575. Cita una serie de votos entre los que destaca el 4587-97. Indica, los bosques son parte del dominio público al formar parte del Patrimonio Natural del Estado, por lo que no podría titularse. 2.- Agravia, la declaración de los testigos no demuestra la posesión decenal apta para usucapir en cabeza de su dueño y solicita la revocatoria para decretar la improbación de estas diligencias (folios 216 a 222).-
III.Sobre el agravio referido a la existencia de una zona con cobertura boscosa que no es apta para usucapir, por ser parte del Patrimonio Natural del Estado, no lleva razón la apelante. Estas diligencias se formulan con la finalidad de inscribir en el Registro Público de la Propiedad el inmueble de Repasto y Montaña ubicado en [Dirección4] de la provincia de Puntarenas, mide catorce hectáreas ciento sesenta y cuatro mil ciento veintiún metros con cuatro decímetros cuadrados, según plano P-948397-2004 (folio 2). Dicho bien no es parte de área silvestre protegida, conforme se indica en la certificación emitida por el Sistema Nacional de Áreas de Conservación aportada a los autos (folio 3). En el estudio de suelos que consta a folio 172 se indica, se ha ejercido el uso conforme al suelo; en el que se certifica el uso actual es de Pasturas encharraladas, Cobertura boscosa y reforestación (folio 172).
El Juzgado practicó un reconocimiento judicial del inmueble, del que se levantó un acta que consignó que el terreno a titular es una finca dedicada a bosque secundario y potreros, que se encuentra debidamente delimitada (folio 90). La apelante expresa al existir manifestaciones en el reconocimiento judicial de que es bosque secundario que la naturaleza del inmueble a inscribir es boscosa (montaña) no es posible titularlo. Estima esta Sede que la mención de la existencia de una zona de "montaña" en el inmueble, que fue manifestada por el juez de instancia, no puede desprenderse, ni se demuestra con ello, la existencia de zonas boscosas en los términos técnicos que define la Ley Forestal N. 7575. Como se puede extraer de la misma acta de reconocimiento judicial a folio 90, la a quo consignó que el terreno se encuentra dedicado a bosque secundario en reforestación, término que es improcedente equiparar a bosque, por cuanto se puede deducir del acta en mención que el terreno se encuentra en proceso de recuperación natural.
Aunado a ello, debe tomarse en consideración que el procedimiento cuenta con una serie de criterios técnicos vertidos por profesionales competentes legalmente, que coadyuvan al juez o jueza en la determinación de la existencia o no de bosques y de qué clase, según las definiciones técnicas en la Ley Forestal Nº 7575, por lo que el mismo Estudio de suelos indica que son pastos naturales, no bosque. En este caso de la valoración de los testimonios citados, y el estudio de suelos que consta en autos, es posible deducir que en el terreno no existe bosque en los términos expuestos por la apelante, sino un área de tacotal. Sobre la definición de bosque secundario, dado que la apelante ha querido equipararlo al área de tacotal existente en el fundo a titular, la Comisión Nacional de Certificación Forestal de Costa Rica define el bosque secundario como “... aquella tierra con vegetación leñosa de carácter sucesional secundaria que se desarrolla una vez que la vegetación original fue eliminada por actividades humanas o fenómenos naturales; con una superficie mínima de 0,5 ha y una densidad no menor a 500 árboles por ha de todas las especies." (CNCF 1999, Comisión Nacional de Certificación Forestal. 1999.

Asimismo el concepto de Tacotal es "matorral espeso" y no debe entenderse que es un bosque. La Ley Forestal N. 7575, define bosque de la siguiente forma: "Ecosistema nativo o autóctono, intervenido o no, regenerado por sucesión natural u otras técnicas forestales, que ocupa una superficie de dos o más hectáreas caracterizada por la presencia de árboles maduros de diferentes edades, especies y porte variado, con uno o más doseles que cubran más del 70% de esa superficie y donde existan más de sesenta árboles por hectárea de quince o más centímetros de diámetro medido a la altura del pecho". En este caso, no se precisa área en el fundo que acredite esos presupuestos. Por su parte, la Ley de Informaciones Posesorias en su artículo sétimo indica que las fincas ubicadas fuera de áreas silvestres protegidas y con bosques, podrían ser tituladas si el promovente demuestra ser el titular de los derechos legales de posesión decenal y haber protegido el recurso, sin hacer diferencias si son bosques secundarios o primarios.
Partiendo de estas definiciones y del estudio técnico del INTA visible a folio 64. Declarar ese tipo de vegetación como bien demanial o bosque, sería no aplicar la legislación correctamente, ni incentivar ese tipo de actividad regeneradora de bosques. Esta actividad es necesaria para la captación de carbono en la atmósfera y por ende medidas ambientales contra el calentamiento global, actividades beneficiosas para el medio ambiente por lo que sería incoherente castigar a los poseedores que tienen ese tipo de actividad regeneradora de bosques, denegándoles la obtención de su título de propiedad. De acuerdo a lo anterior, no se comparte lo señalado por la representante estatal, que el terreno al estar regenerando en forma natural forme parte del patrimonio natural del Estado, porque de conformidad con el artículo 856 del Código Civil, el fundo es apto para adquirir por usucapión. Por ende, conforme al artículo 7 de la Ley de Informaciones Posesorias, estima el Tribunal que efectivamente se acreditó con la prueba aportada, el ejercicio de la posesión legal exigida sobre el fundo, con diez años de antelación a la fecha en la que se promovió este proceso, y el terreno objeto de las presentes diligencias es apto para usucapir al encontrarse fuera de cualquier área silvestre protegida sea cual fuere su categoría de manejo y haber ejercido actos posesorios de conservación de los recursos naturales. (Al respecto puede ser consultado el voto Nº51 de las 15 horas 15 minutos del 26 de mayo de 1995 de la Sala Primera de la Corte Suprema de Justicia).
IV- Sobre el agravio referente a que la declaración de los testigos no demuestra la posesión decenal, tampoco lleva razón la apelante. También se recibió la declaración de los testigos [Nombre7] , [Nombre8] y [Nombre9] (folios 87 a 89). Los testigos aducen conocer la propiedad desde hacía más de doce, ocho y ocho años, respectivamente. Los testigos manifestaron que el inmueble es poseído actualmente por la promovente y la dedica a reforestación. Aún y cuando dos de ellos dicen conocer la finca desde hace ocho años, lo cierto es que el promovente aportó escrituras públicas donde se deduce la cadena posesoria y los años de posesión (folios 7 a 9) que comprueba que se ha ejercido la posesión en forma ininterrumpida por parte de la promovente y su transmitente y así como no conocen la existencia de conflictos posesorios originados en la posesión ejercida sobre el terreno, por lo que se rechaza tal agravio.
POR TANTO:
Se confirma la sentencia, en lo apelado.
