Appeal filed in the present proceedings brought against [Nombre1], of legal age, in a domestic partnership (unión de hecho), born cuatro de noviembre de mil novecientos sesenta y dos, holder of identity card number CED1, for the offense of illegal timber harvesting, to the detriment of Natural Resources. Judges Ingrid Estrada Venegas, [Nombre2]., and Gustavo Chan Mora participated in deciding the appeal. Attorney [Nombre3] appeared in the appeal in his capacity as legal representative of Mr. [Nombre4].

Findings:

1. By judgment 883-2014, issued at fifteen hours and forty minutes on veinte de noviembre de dos mil catorce, the Trial Court of the First Judicial Circuit of the Southern Zone, Pérez Zeledón seat, ruled: “POR TANTO: Pursuant to Articles 39, 41, and 50 of the Political Constitution; Articles 1, 30, 45, and 103 of the Criminal Code; Article 140 and Article 361, subsection d), of the Code of Criminal Procedure; Article 1045 of the Civil Code; sections 122, 123, and 124 of the current rules governing civil liability under the 1941 Criminal Code; Articles 19, 20, 58, subsection b), and 61, subsection c), of Ley Forestal número 7575; Article 90 of the Wildlife Conservation Law; and Article 52 of the Soil Use and Conservation Law. The civil damages action (Acción Civil Resarcitoria) brought by the Procuraduría General De La República is granted solely with respect to the omission and failure to order the restoration of the property to its original condition. Mr. [Nombre4], identity card CED2 -, is ordered to uproot the crops currently occupying the affected forest area, covering two hectares specifically on Finca [Dirección1], [Dirección2], Biolley, Buenos Aires de Puntarenas, 4 kilometers east of the local school, namely the coffee and banana crops, within six months after this judgment becomes final. Notify Mr. [Nombre5], in his capacity as the registered owner of the property, so that he may comply with the order. Should he fail to do so, notify the State’s Administrative Environmental Officials so that they may carry out the aforementioned uprooting, in which case the expenses shall be borne by Mr. [Nombre5] in his capacity as registered owner. 2. Attorney [Nombre3] filed an appeal against the foregoing ruling.

3. Following the corresponding deliberation pursuant to Article 466 of the Code of Criminal Procedure, as amended by Ley 8837 published on nueve de diciembre de dos mil once (Creation of the Appeal from Judgment), the Court considered the issues raised in the appeal.

4. The relevant legal requirements were observed throughout the proceedings.

Drafted by Judge [Nombre7]; and,

Whereas:

I.Attorney [Nombre3], in his capacity as representative of Mr. [Nombre4], filed an appeal against judgment number 883- 2009 of the Trial Court of the First Judicial Circuit of the Southern Zone, Pérez Zeledón seat, issued at 15:40 hours on 20 de noviembre de 2014. In his first ground, he expresses disagreement with his client’s participation in criminal proceeding 10-200773- 0634-PE, brought against [Nombre1] and [Nombre8] for the offense of illegal timber harvesting. When the Criminal Judgment Court of Appeals of Cartago remanded the case so that the Trial Court could rule on the restitution and restoration of the affected forest in the protected zone (zona protectora), after first granting the property owner a hearing, it may be inferred that the latter requirement was intended to allow Mr. [Nombre5] to exercise his right of defense insofar as he might be affected in his capacity as registered owner.

Nevertheless, Mr. [Nombre9] was made to appear in the criminal proceedings as a defendant (imputado), as shown by the request for a public defender signed by attorney [Nombre10] and by the appointment of that professional, while in the trial on remand the judge referred to Mr. [Nombre11] as a defendant. This course of action violated his client’s fundamental rights and exceeded the instructions of the Court of Appeals of Cartago, which never stated that he was to be made a defendant and assigned defense counsel, since he was neither charged in the proceedings nor mentioned in the civil damages action brought by the Procuraduría General de la República. Second, he challenges the ruling on the civil damages action, which was granted and ordered Mr. [Nombre4] to uproot the crops in the affected forest area within six months; however, the civil damages action was not brought against him, and it is therefore improper for him to bear the civil consequences of the criminal proceedings.

Third, he objects to the appointment of [Nombre12] as public defender for Mr. [Nombre9], because she represented the defendants in the proceedings, thereby creating a conflict of interest (colisión de intereses) in the representation of the case; moreover, [Nombre11]’s participation as a defendant was also improper. It should be noted that, at the oral hearing, attorney [Nombre13], who presented the arguments orally, referred in general terms to the matters set forth in the written appeal.

II.In view of the relationship between the claims raised, they shall, for reasons of procedural economy (economía procesal), be resolved jointly below. The arguments have merit, for the reasons that follow. First, it must be noted that judgment number 883-2014, issued at 15:40 on 20 de noviembre de 2014 by the Trial Court of the First Judicial Circuit of the Southern Zone, which is the judgment challenged herein, resulted from the ruling of this Court of Appeal, sitting with a different panel, in decision 2014-032, issued at 14:57 on 28 de enero de 2014. On that occasion, the appeal (recurso de apelación) filed by the Procuraduría General de la República was granted, and although it was stated that the judgment was partially vacated, what was actually ordered was a remand (reenvío) solely for the Trial Court to “...rule on the restitution and restoration of the forest affected within the protected zone, after first granting the property owner a hearing.

In all other respects, the judgment under appeal is affirmed.” As was also stated in Considerando I of the aforementioned decision 2014-032, this was the sole relief requested by the Procurador. From this perspective, the first point that must be clarified is that, as of that time, not only had the acquittal entered in favor of [Nombre8] and [Nombre1] become final, but so too had the dismissal of the civil action for damages (acción civil resarcitoria) brought by the Procuraduría General de la República; consequently, by granting the civil action for damages in judgment N°883- 2014, the lower court (a quo) rendered an unlawful decision, since that issue had already been definitively resolved. Indeed, that ruling was wholly unnecessary because the decision concerning restitution and restoration, which was the subject of the remand, does not arise from the civil action but is instead a consequence that, in this matter, follows from the principle of irreducibility of forests (principio de irreductibilidad del bosque), which establishes the requirement that damage caused to the environment be repaired.

Furthermore, as the appellant correctly notes, the purpose of the hearing that was to be granted to the registered owner (propietario registral) was not to make him an accused person (imputado) or a civil defendant (demandado civil), but rather to afford him an opportunity to state whatever he deemed appropriate in defense of his interests, particularly because the work required to restore the affected area must be performed on land belonging to him. In that regard, although Mr. [Nombre4], in his capacity as owner of the property, was initially and properly notified at 11:01 on 5 de mayo de 2014 of the hearing scheduled for trece horas treinta minutos del seis de noviembre de dos mil catorce, it was subsequently due to an error attributable to Ms. [Nombre10], the Court’s case-management judge (jueza tramitadora), that on that same day, through official letter N° 90-2014, a public defender was requested for Mr. [Nombre14] on the assertion that he was an accused person, even though he did not have that status (see page 476 of the cited case file).

From that moment onward, in a wholly irregular manner, the person who was merely the registered owner was treated in the case file as a defendant (encartado), a circumstance that was incorrectly recorded in those same terms in the minutes of the hearings held on 14 and 20 de noviembre de 2014 (see pages 587, 588, 503 and 504 of the electronic case file), and was even stated as such in the certification of the reading of the operative portion (parte dispositiva). Likewise, the appellant is also correct in challenging the Court’s decision ordering Mr. [Nombre4], identification number CED3, to uproot the crops currently occupying the affected forest area, covering two hectares specifically on Finca La [Dirección3] del [Dirección2] Biolley, Buenos Aires de Puntarenas, 4 kilómetros al este de la escuela del lugar, namely the coffee and banana crops, within six months after the judgment becomes final.

It should be noted that, in this case, what the Court of Appeal identified was the Trial Court’s failure, in judgment 575-2013, to rule on the restitution and restoration of the forest that had been affected, as well as the need to inform the registered owner that this matter would be discussed so that he could exercise his rights in defense of his interests; however, this did not necessarily mean that, solely by virtue of that status, he was the person responsible for restoring the forest. It must be borne in mind that the summary proceeding (sumaria) was conducted against [Nombre8] and [Nombre1], in whose favor a judgment of acquittal was entered pursuant to the principle of in dubio pro reo, on the grounds that they were not the owners of the property where the events occurred and that, although significant environmental damage did occur, there was no certainty that the accused participated in the acts under investigation and caused the harm to the natural resources (see page 422 of the electronic case file).

From this perspective, although the Court did fail on that occasion to rule on restitution, which was necessary in light of the proven environmental damage, the particular circumstance in this matter is that it could not be established, in accordance with the prosecution’s charging request (requisitoria fiscal), who caused that damage—that is, who the offender was—and therefore it is likewise impossible to identify any particular person as responsible for repairing it. Under those circumstances, it is impossible to identify any person as responsible for carrying out the restitution, including Mr. [Nombre4] in his capacity as owner of the property, because although he may not benefit from the damage caused, he is not required to provide restitution, since no connection between him and the commission of the unlawful act (ilícito) has been established. From this perspective, what remains is the obligation of the Costa Rican State to guarantee and defend the right to the environment, as provided in artículo 50 de la Constitución Política.

Accordingly, the proper course in this case is to grant the appeal and declare ineffective the judgment issued by the Tribunal Penal del Primer Circuito Judicial de la Zona Sur, sede Pérez Zeledón, number 883-2014, at 15:40 on 20 de noviembre de 2014.

III.For reasons of judicial economy (economía procesal), it is deemed appropriate to decide the merits of the matter. It should be emphasized, however, that there is an unavoidable duty to restore the affected protection area (área de protección) to its original condition, as correctly stated by attorney [Nombre15], representative of the Procuraduría General de la República, during the oral hearing held before this Court on March 24 of the current year. Nor is this duty affected by the statement made on that same occasion by Mr. [Nombre4], who indicated that he disagreed with uprooting what had been planted because he believed that the environmental impact (impacto ambiental) would be more severe. It must be borne in mind that, as this Appellate Chamber previously stated when composed partly of different judges, “in Costa Rica, the system governing ownership of real property is subject to a series of restrictions arising precisely from the regulation, in Article 50 of the Constitución Política, of the Fundamental Right to a Healthy and Ecologically Balanced Environment.

To safeguard that Fundamental Right, the Costa Rican State has imposed restrictions on the right of ownership, as well as on certain rights derived from or related to it. Consequently, for example, private parties are absolutely precluded from exercising that property right over what is known as the State’s natural heritage (patrimonio natural del Estado), namely, the forests and forest lands within national reserves, areas declared inalienable, properties registered in the name of the State, and those belonging to municipalities, autonomous institutions, and other agencies of the Public Administration. The law itself declares such real property inalienable and exempt from attachment and further provides that private parties, even when in possession thereof, may not perfect any right over it, for example through adverse possession or acquisitive prescription (usucapión o prescripción positiva) (as may be inferred from a systematic reading of Article 50 of the Constitución Política and Articles 13 and 14 of the Ley Forestal).

Although differing in degree, another example stemming from the fundamental right protected by Article 50 of the Fundamental Law of the Republic of Costa Rica consists of the restrictions imposed on private ownership of land with forest cover (cobertura boscosa), among which the following are well known: (1.) prohibitions on land-use change (cambio en el uso de suelos); (2.-) the mandatory application for and granting of permits to cut forest, and restrictions on that activity based on proportionality criteria; and (3.-) the required preparation of management plans (planes de manejo), subject to mandatory prior approval by the Administración Forestal del Estado, where a private party intends to exploit a forest located on real property (artículo 19 de la Ley Forestal). Further examples of restrictions on ownership rights over real property include precisely the designation of protection areas around springs (nacientes), along the banks of rivers, creeks, and streams, as well as around natural and artificial lakes and reservoirs, and in recharge areas and spring aquifers (artículo 33 de la Ley Forestal).

Even when located on privately owned land, such zones are subject to prohibitions on exploitation and on the cutting or removal of trees and, as is relevant to the proper resolution of this matter, there is also a prohibition on encroachment (invasion)—and therefore on construction—in both conservation zones and the aforementioned protection zones (art 58 de la Ley Forestal). It follows with certainty from this statutory prohibition that no person could legitimately assert a right to exploit forest resources or to encroach upon spaces located within a protection zone. In the specific case under review, this means that no third party’s legitimate rights could be affected by a demolition order issued as a result of the offense adjudicated in these proceedings, because, irrefutably, within that protection zone, given the aforementioned prohibition, there is no possibility of asserting rights or an expectation of legitimate rights that could prevent demolition of the building referred to above.” (See resolution number 2014-292, at 11:00 a.m. on July 10, 2014).

Based on those same considerations, no third party may claim a legitimate right to prevent or obstruct the restoration of those areas, given the statutory restrictions on the right of ownership. Now, taking the foregoing into account, and given that the owner of the property, Mr. [Nombre4], is already aware that the affected forest must be restored, although he is not obligated to carry out the restoration himself, he is required to permit entry onto the property for that purpose, without thereby affecting any other legitimate aspects of his ownership rights. Accordingly, although it was not possible in this matter to determine the identity of the offender and, therefore, the person directly obligated to perform the restitution and restoration of the forest affected within the protection zone, in view of the Costa Rican State’s duty to provide effective protection for the Fundamental Right to a Healthy and Ecologically Balanced Environment, such restoration of the affected zone—which must be undertaken in every case involving environmental damage (daño ambiental)—shall be the responsibility of the competent department of the Ministerio de Ambiente, Energía y Telecomunicaciones (MINAET), which, in carrying it out, must ensure that no other legitimate aspects of [Nombre4]’s ownership rights are affected.

POR TANTO:

The appeal against the judgment filed by attorney [Nombre3], in his capacity as representative of Mr. [Nombre4], is granted. The judgment issued by the Tribunal Penal del Primer Circuito Judicial de la Zona Sur, sede Pérez Zeledón, number 883-2014, at 3:40 p.m. on November 20, 2014, is declared without effect. Ruling on the merits of the matter, the State is ordered to undertake the restitution and restoration of the forest affected within the protection zone. This responsibility shall lie with the competent department of the Ministerio de Ambiente, Energía y Telecomunicaciones (MINAET), which, in carrying it out, must ensure that no other legitimate aspects of [Nombre4]’s ownership rights are affected. Let notice be given.

Que mediante sentencia 883-2014 de las quince horas cuarenta minutos del veinte de noviembre de dos mil catorce, el Tribunal de Juicio del Primer Circuito Judicial de la Zona Sur, sede Pérez Zeledón, resolvió: " POR TANTO: De conformidad con los artículos 39, 41 y 50 de la Constitución Política, 1, 30, 45, 103 del Código Penal; 140, 361 inciso d) del Código Procesal Penal, artículo 1045 del Código Civil, numerales 122, 123 y 124 de las reglas vigentes sobre responsabilidad civil del Código Penal de 1941, artículos 19, 20, 58 inciso b), 61 inciso c) de la Ley Forestal número 7575, artículo 90 de la Ley de Conservación de Vida Silvestre y 52 de la Ley de Uso y Conservación de Suelos. Se declara con lugar la Acción Civil Resarcitoria incoada por la Procuraduría General De La República únicamente en relación a la omisión e inaplicación al restablecimiento de las cosas a su estado original, se ordena la señor [Nombre4] , cédula CED2 - , proceder al desarraigo de los cultivo que en este momento este ocupando el área del bosque afectado en una extensión de dos hectáreas propiamente en la Finca [Dirección1] del [Dirección2] Biolley, Buenos Aires de Puntarenas 4 kilómetros al este de la escuela del lugar, como lo es el cultivo de Café y Banano, en un plazo de seis meses a partir de la firmeza de la presente sentencia. Comunique lo anterior al señor [Nombre5] en su condición de dueño registral del inmueble para que proceda con lo ordenado. De no ser así comunique con los Funcionarios Ambientales Administrativos del Estado para que procedan el desarraigo antes indicado corriendo en tal caso los gastos a cargo del señor [Nombre5] en su condición de dueño registral. En lo demás se mantiene incólume el fallo. [Nombre6] . . Juez del Tribunal de Juicio. " (sic)

2. Que contra el anterior pronunciamiento, el licenciado [Nombre3] interpuso el recurso de apelación.

3. Que verificada la deliberación respectiva de conformidad con lo dispuesto por el artículo 466 del Código Procesal Penal, reformado por Ley 8837 publicada el nueve de diciembre de dos mil once (Creación de Recurso de Apelación de la Sentencia), el Tribunal se planteó las cuestiones formuladas en el recurso.

4. Que en los procedimientos se han observado las prescripciones legales pertinentes.

Redacta la Jueza [Nombre7] , y;

Considerando:

I.El licenciado [Nombre3] , en su condición de representante del señor [Nombre4] , interpuso recurso de apelación contra la sentencia del Tribunal de Juicio del Primer Circuito Judicial de la Zona Sur, sede Pérez Zeledón, número 883- 2009, de las 15:40 horas del 20 de noviembre de 2014. En su primer motivo señala la inconformidad con la participación de su representado dentro del proceso penal 10-200773- 0634-PE, seguido en contra de [Nombre1] y [Nombre8] por el delito de aprovechamiento ilegal de madera, ya que al disponer el Tribunal de Apelación de Sentencia de Cartago el reenvío para que el Tribunal de Juicio se pronunciara con relación a la restitución y restauración del bosque afectado en la zona protectora, previa audiencia al propietario del inmueble, esto último se deduce era para que el señor [Nombre5] pudiera ejercer su derecho de defensa en cuanto se pudiera ver afectado como propietario registral; sin embargo, al señor [Nombre9] se le apersonó al proceso penal como imputado, como se desprende de la solicitud de defensor público suscrita por la licenciada [Nombre10] , en la designación de dicho profesional, siendo que en el juicio de reenvío el juzgador se refiere al señor [Nombre11] como imputado.

Con tal proceder se violentaron los derechos fundamentales de su representado, se excedió lo dispuesto por el Tribunal de Apelación de Cartago, que en ningún momento indicó que se le debía convertir en imputado y nombrarle un defensor, ya que dentro del proceso él no fue acusado, ni mencionado en la acción civil resarcitoria incoada por la Procuraduría General de la República. En segundo lugar , se reclama lo resuelto sobre la acción civil resarcitoria, la cual fue declarada con lugar, ordenándose al señor [Nombre4] , a proceder al desarraigo de los cultivos en el área de bosque afectado, en un plazo de seis meses; sin embargo, la acción civil resarcitoria no se dirigió contra él, por lo que es improcedente que los efectos civiles del proceso penal los deba asumir. En tercer lugar, reprocha que se haya nombrado defensora pública a [Nombre12] , en representación del señor [Nombre9] , ya que ella fue la defensora de los imputados en el proceso, por lo que existe una colisión de intereses en la representación del caso, y tampoco era procedente la intervención de [Nombre11] en condición de imputado.

Cabe destacar, que en la audiencia oral, el licenciado [Nombre13] , quien se encargó de expresar oralmente los alegatos, se refirió en términos generales a los aspectos que constan en el escrito impugnaticio.

II.Apreciándose la relación entre los reclamos planteados, por razones de economía procesal se resolverán se seguido en forma conjunta. Los alegatos resultan atendibles, por lo que se dirá. En primer lugar, debe indicarse que la sentencia numero 883-2014, de las 15:40 horas del 20 de noviembre de 2014, dictada por el Tribunal de Juicio del Primer Circuito Judicial de la Zona Sur, que es contra la que se planteó la presente impugnación, fue producto de lo dispuesto por este Tribunal de Apelación, con una integración diferente, en la resolución 2014-032, de las 14:57 horas del 28 de enero de 2014. En esa oportunidad se declaró con lugar el recurso de apelación planteado por la Procuraduría General de la República, y aunque se indicó que se anulaba parcialmente el fallo, lo cierto es que lo que se ordenó fue el reenvío únicamente para que el Tribunal de Juicio "...se pronuncie con relación a la restitución y restauración del bosque afectado en la zona protectora, previa audiencia al propietario del inmueble.

En lo demás, se confirma el fallo apelado". Aspecto que, como también se indicó en el Considerando I de la resolución 2014-032 antes citada, fue el exclusivamente peticionado por el señor Procurador. Desde esta perspectiva, lo primero que debe aclararse, es que ya desde ese momento quedó en firme no solo la sentencia absolutoria dictada a favor de [Nombre8] y [Nombre1] , sino también la declaratoria sin lugar de la acción civil resarcitoria incoada por la Procuraduría General de la República, y por ende, al acoger el a quo en la sentencia N°883- 2014 la acción civil resarcitoria tal decisión deviene en ilegítima, por tratarse de un aspecto que ya había sido resuelto previamente en forma definitiva. Lo dispuesto incluso resultaba absolutamente innecesario, ya que el pronunciamiento en relación con la restitución y restauración, objeto del reenvío, no se deriva de la acción civil, sino que es una consecuencia que surge en el presente asunto del principio de irreductibilidad del bosque, que establece la necesaria reparación de los daños causados al ambiente.

Por otra parte, como bien lo señala el impugnante, la audiencia que se debía otorgar al propietario registral, no tenía por objeto convertirlo en imputado ni en demandado civil, sino darle la oportunidad de manifestar lo que estimara pertinente en defensa de sus intereses, máxime que las labores de restitución y restauración de la zona afectada, deben ser realizadas en el terreno de su propiedad. En tal sentido, si bien en principio adecuadamente al ser las 11:01 horas del 5 de mayo de 2014, al señor [Nombre4] , en condición de propietario del inmueble, se le puso en conocimiento de la audiencia programada para las trece horas treinta minutos del seis de noviembre de dos mil catorce, es posteriormente en razón de un error atribuible a la licenciada [Nombre10] , jueza tramitadora del Tribunal, que ese mismo día mediante oficio N° 90-2014, se solicitó indicando que se trataba de un imputado, un defensor público para el señor [Nombre14] , pese a que él no tenía esa condición (ver página 476 del expediente citado).

A partir de ese momento, en forma absolutamente irregular, se tuvo en el expediente como encartado a quien únicamente era el propietario registral, situación que incorrectamente se hizo constar en esos mismos términos en las actas de las audiencias realizadas el 14 y el 20 de noviembre de 2014 (ver páginas 587, 588, 503 y 504 del expediente electrónico), e incluso así se consignó en la constancia de lectura de la parte dispositiva. De igual modo, también lleva razón el recurrente en cuanto cuestiona la decisión del Tribunal de ordenar al señor [Nombre4] , cédula CED3, proceder al desarraigo de los cultivos, que en este momento estén ocupando el área del bosque afectado en una extensión de dos hectáreas propiamente en la Finca La [Dirección3] del [Dirección2] Biolley, Buenos Aires de Puntarenas 4 kilómetros al este de la escuela del lugar, como lo es el cultivo de Café y Banano, en un plazo de seis meses a partir de la firmeza de la sentencia.

Debe hacerse notar que en este caso, lo que apreció el Tribunal de Apelación fue la omisión del Tribunal de juicio, en la sentencia 575-2013, de pronunciarse sobre la restitución y restauración del bosque que fue afectado, e incluso sobre la necesidad de poner en conocimiento al propietario registral de que se iba a discutir esa situación para que ejerciera sus derechos en defensa de sus intereses, pero ello no significaba necesariamente que este último fuera por esa sola condición el obligado a la restitución y restauración del bosque. Debe tenerse presente que la sumaria se tramitó contra [Nombre8] y [Nombre1] , a favor de quienes se dictó una sentencia absolutoria en aplicación del principio in dubio pro reo, argumentando que ellos no son los dueños de la finca en donde sucedieron los hechos, y que si bien es cierto se produjo un daño ambiental importante, no existió certeza de que los imputados participaran en los hechos investigados y produjeran la afectación a los recursos naturales (ver página 422 del expediente electrónico).

Desde esta perspectiva, si bien es cierto hubo una omisión en el pronunciamiento del Tribunal en esa oportunidad en cuanto a la restitución, que resultaba ser un aspecto necesario en razón del daño ambiental comprobado, lo cierto es que en este asunto se da la particularidad de que no se pudo demostrar, acorde con la requisitoria fiscal, quién o quiénes realizaron ese daño o sea quién fue el infractor, por ende, tampoco es posible señalar a una persona en particular como la obligada a repararlo. Frente a esa situación, no es posible individualizar a una persona como la obligada a proceder con la restitución, ni siquiera al señor [Nombre4] en su condición de propietario del inmueble, ya que él aunque no puede sacar provecho de los daños causados, no está obligado a restituir, puesto que no se establecido su vinculación en la comisión del ilícito. Desde esta perspectiva, lo que subsiste es la obligación del Estado costarricense de garantizar y defender el derecho al medio ambiente conforme lo dispuesto en el artículo 50 de la Constitución Política.

Así las cosas, lo procedente en este caso es declarar con lugar el recurso de apelación interpuesto, y disponer la ineficacia de la sentencia dictada por el Tribunal Penal del Primer Circuito Judicial de la Zona Sur, sede Pérez Zeledón, número 883-2014, de las 15:40 horas del 20 de noviembre de 2014.

III.Por razones de economía procesal, se estima procedente el resolver el fondo del asunto. Ahora bien, corresponde puntualizar que existe el deber ineludible de restituir a su estado original el área de protección que resultó afectada, como bien lo señaló la licenciada [Nombre15] , representante de la Procuraduría General de la República, durante la audiencia oral realizada en esta sede el 24 de marzo del año en curso, lo que tampoco se ve afectado por lo indicado en esa misma oportunidad por el señor [Nombre4] , quien señaló que no estaba de acuerdo en que se arrancara lo plantado, al estimar que el impacto ambiental iba a ser más grave. Debe tenerse presente que como ya lo indicó esta Cámara de Apelación, con una integración parcialmente diferente, "en Costa Rica el régimen de propiedad sobre bienes inmuebles tiene una serie de restricciones que devienen, justamente, de la regulación que ha hecho la Constitución Política, en su artículo 50, del Derecho Fundamental a un Ambiente Sano y Ecológicamente Equilibrado.

En tutela de ese Derecho Fundamental, el Estado costarricense ha impuesto restricciones al derecho de propiedad, así como a algunos de aquellos derechos derivados o relacionados con el mismo. Como consecuencia de lo anterior se aprecia, por ejemplo, la exclusión absoluta de ejercicio de aquel derecho patrimonial para particulares, que se hace respecto del denominado patrimonio natural del Estado, es decir, los bosques y terrenos forestales de las reservas nacionales, de las áreas declaradas inalienables, de las fincas inscritas a nombre de dicho Estado y de las pertenecientes a las municipalidades, instituciones autónomas y demás organismos de la Administración Pública; inmuebles para los cuales la propia ley declara su condición de inalienables e inembargables, e incluso estipula que se trata de bienes sobre los cuales los particulares, incluso cuando los posean, no podrán consolidar derecho alguno, verbigracia por vía de usucapión o prescripción positiva (así se infiere de la lectura sistemática de los artículos 50 de la Constitución Política, y de los numerales 13 y 14 de la Ley Forestal).

Con distinta intensidad, pero también derivadas del derecho fundamental que tutela el artículo 50 de la Ley Fundamental de la República de Costa Rica, se pueden tener como otro ejemplo las limitaciones que se imponen al régimen de la propiedad privada en terrenos con cobertura boscosa, para el cual son bien conocidas, entre otras: (1.) las prohibiciones para el cambio en el uso de suelos, (2.-) la obligatoria solicitud y concesión de permisos para cortar el bosque, y la restricción de esa acción mediante criterios de proporcionalidad, (3.-) la necesaria conformación de planes de manejo, de obligatoria aprobación previa por la Administración Forestal del Estado, si lo que se pretende un particular es aprovechar un bosque ubicado en una propiedad inmueble (artículo 19 de la Ley Forestal). Para sumar más ejemplos de limitación al derecho de propiedad sobre inmuebles se tiene, justamente, la declaratoria de áreas de protección junto a nacientes, en las riberas de los ríos, quebradas y arroyos, así como también de los lagos y embalses naturales y artificiales, así como en las áreas de recarga y en los acuíferos de los manantiales (artículo 33 de la Ley Forestal).

Para esas zonas, aún cuando estén ubicadas en terrenos de dominio particular, existen prohibiciones de aprovechamiento, de tala o eliminación de árboles y, en lo que resulta relevante para la adecuada resolución de este tema, también existe una prohibición de invadir (ergo, de construir) tanto en zonas de conservación, como en las zonas de protección indicadas (art 58 de la Ley Forestal). De esta prohibición legal puede derivarse, con certeza, que nadie podría esgrimir legítimamente un derecho con el fin de aprovechar los recursos forestales, o para invadir esos espacios ubicados en una zona de protección. Para el caso concreto en estudio, quiere decir entonces que ningún tercero podría verse afectado en sus derechos legítimos mediante una orden de derribo dictada en virtud del delito juzgado en autos, por la razón de que, irrefutablemente, en aquellas zona de protección, dada la prohibición aludida, no existe ninguna posibilidad de reivindicación de derechos o de una expectativa de derechos legítimos, que pudiese evitar el derribo del inmueble a que se ha hecho mención." (Cfr. resolución número 2014-292, de las 11:00 horas del 10 de julio de 2014).

Con fundamento en esas mismas consideraciones, no puede ningún tercero alegar un derecho legítimo para impedir u obstaculizar que dichas áreas sean restauradas, en razón del régimen de restricción legal del derecho de propiedad. Ahora bien, tomando en consideración lo expuesto, y partiendo de que el propietario del inmueble, señor [Nombre4] , ya tiene conocimiento de que se debe restaurar el bosque afectado, aún y cuando no tiene la obligación de restituir, sí está obligado a permitir el ingreso al inmueble para tales efectos, sin que con ello se puedan afectar otros extremos legítimos de su derecho de propiedad. Así las cosas, aunque en el presente asunto no se pudo determinar quién fue el infractor y por ello quién es el obligado directo a cumplir con la restitución y restauración del bosque afectado en la zona protectora, partiendo del deber que tiene el Estado costarricense de dar tutela efectiva del Derecho Fundamental a un Ambiente Sano y Ecológicamente equilibrado, tal restauración en la zona afectada, que debe proceder en todos los casos en que se da un daño ambiental, queda a cargo del departamento competente del Ministerio de Ambiente, Energía y Telecomunicaciones (MINAET), que en su ejecución deberá velar por no afectar otros extremos legítimos del derecho de propiedad de [Nombre4] .

POR TANTO:

Se declara con lugar el recurso de apelación de sentencia presentado por el licenciado [Nombre3] , en su condición de representante del señor [Nombre4] . Se dispone la ineficacia de la sentencia dictada por el Tribunal Penal del Primer Circuito Judicial de la Zona Sur, sede Pérez Zeledón, número 883-2014, de las 15:40 horas del 20 de noviembre de 2014. Resolviendo el fondo del asunto, se ordena la restitución y restauración del bosque afectado en la zona protectora por parte del Estado, lo que queda a cargo del departamento competente del Ministerio de Ambiente, Energía y Telecomunicaciones (MINAET), que en su ejecución deberá velar por no afectar otros extremos legítimos del derecho de propiedad de [Nombre4] . Notifíquese.
