FIRST SECTION. SECOND JUDICIAL CIRCUIT OF SAN JOSÉ. ANNEX A. Goicoechea, at fifteen hours on once de noviembre del dos mil catorce.
Ordinary proceedings involving an oral and public trial, brought by Nombre40322, of legal age, divorced from his first marriage, attorney and notary public, holder of identity card number CED32031 and resident of San José, Dirección407; María Isabel González Angulo, Attorney-at-Law, whose personal details do not appear in the case file, appears as counsel for the plaintiff, against Instituto Nacional de Desarrollo Rural (INDER, formerly IDA), represented by its special litigation attorneys-in-fact (apoderados especiales judiciales), Roderico Contreras Angulo, of legal age, married, attorney and notary public, holder of identity card number CED32032 and resident of Santa Ana, and Diana Cristina Moraga Vásquez, of legal age, attorney, holder of identity card number CED32033 and resident of San Francisco de Dos Ríos, San José. The State appears as an interested third party, represented by Deputy State Attorney Heilyn Sáenz Calderón, of legal age, attorney, holder of identity card number CED17241 and resident of San José.
BACKGROUND (RESULTANDO) 1- In his statement of claim (escrito de demanda), the plaintiff asserted the following claims for relief (pretensiones), transcribed verbatim: “FIRST: That the administrative act (acto administrativo) issued by IDA in the aforementioned Article 42 be declared null and void for violating my rights. SECOND: That this ACTION FOR ANNULMENT OF AN ADMINISTRATIVE ACT AND ITS ENFORCEMENT be granted. THIRD: That my possession be recognized as lawful because I have possessed the property since Enero de 1985, which predates the time when IDA claims to have acquired it in 1988. FOURTH: Pursuant to Article 509 of the Civil Code, that I be compensated for the improvements made to the property over so many years, based on Article 509 of the [sic] Civil Code. FIFTH: That I be exempted from paying any costs (costas) in this action because the entire action has proceeded under the principle of good faith (principio de buena fe). [sic] SIXTH: That IDA be ordered to pay the litigation costs (costas procesales) of this action because, from the outset, it acted without standing or legal entitlement.” 2- In pleadings received by this Court on 5 de febrero and 20 de noviembre, both in 2013, the representatives of Instituto Nacional de Desarrollo Rural (INDER, formerly IDA) answered the complaint and opposed it.
They also raised the defenses (excepciones) of lack of legal entitlement and lack of active and passive standing (falta de legitimación activa y pasiva). They further requested that the plaintiff be ordered to pay both categories of costs in these proceedings.
3- At the preliminary hearing (audiencia preliminar) held on 27 de mayo del 2013, the plaintiff withdrew his claim against the State. The State’s representative also requested that the State remain as an interested third party, and the case-management judge (juez tramitador) granted that request.
4- In its capacity as an interested third party, the State responded to the claimant’s complaint and opposed it. It also raised the defense of lack of legal entitlement.
5- At the preliminary hearing held on 28 de febrero del 2014, claim number one was amended to specify that the challenged administrative act is Article 42 of ordinary session number 043-2011, held on 29 de noviembre del 2011 by the Board of Directors of IDA (now INDER).
6- On 24 de octubre del 2014, the oral and public trial was held.
7- The statutory time limits and requirements have been observed throughout the proceedings, and no defects or omissions capable of causing nullity or denying the parties an adequate defense are apparent. Following deliberation, this judgment is issued unanimously within the period established in numeral 111, subsection 1, of the Código Procesal Contencioso Administrativo, and is set forth in writing by reporting Judge González Vílchez, with the affirmative votes of Judges Bolaños Salazar and Espinoza Salas.
GROUNDS (CONSIDERANDO) I- INADMISSIBILITY OF THE PLEADING FILED ON 5 DE NOVIEMBRE DEL 2014: On 5 de noviembre del 2014, the plaintiff filed a series of arguments (see pages 273 through 277 of the judicial case file), which this Court will not consider in rendering this judgment. This is because that pleading was filed after the conclusion of the oral and public trial (held on 24 de octubre del 2014) and therefore did not form part of the adversarial proceedings (contradictorio). The plaintiff is also reminded that the parties’ opportunity to present arguments ends with the oral and public trial, and that filing pleadings during the deliberation and judgment-drafting stage is wholly improper and out of order. During this procedural stage, evidence for clarification of the record (prueba para mejor resolver) may be submitted only when requested by the Court or sought by one of the parties. It is evident, however, that the pleading filed on 5 de noviembre del 2014 neither requests nor submits such evidence. Therefore, the filing of the aforementioned pleading is inadmissible.
II- ESTABLISHED FACTS (HECHOS PROBADOS): The following are deemed established:
Regarding the actions you are pursuing before the Executive Presidency of the Instituto de Desarrollo Agrario, we will not address them and hope they prove successful; however, I hereby inform you that, in accordance with our institutional responsibility, we will continue processing the administrative eviction (desalojo administrativo), the report on which we will submit for consideration by the directors of the Board of Directors of the Instituto de Desarrollo Agrario, as occurs in all such cases. (...)" (see folios 101 and 102 of administrative expediente N°1);
III- UNPROVEN FACT (HECHO NO PROBADO): The following is deemed not to have been established: 1) The plaintiff did not establish in court that he had been declared eligible to acquire plots from the IDA (INDER) in the Asentamiento de Río Celeste, or in any other settlement, or that the Board of Directors of the defendant institution had awarded him plot number 40 of the Asentamiento de Río Celeste, or that the plaintiff had entered into a land-allocation agreement (contrato de asignación de tierras) with the IDA (INDER) (the case file).
IV- PLAINTIFF’S ARGUMENTS: In these proceedings, the plaintiff primarily seeks the nullification of ordinary session number 043-2011, held on 29 de noviembre del 2011 by the Board of Directors of the IDA (INDER), through which, the plaintiff asserts, eviction proceedings (procedimiento de desalojo) concerning plot 40 of the Asentamiento Río Celeste were initiated against him at the request of the Oficina Subregional de Guatuso, upon the recommendation of the Dirección de Asesoría Jurídica de la Región Huetar Norte, because an unlawful occupancy not recognized by the IDA (INDER), of Dirección4949, had allegedly been established against him. He alleges that this decision by the defendant institution failed to specify the available remedies (recursos), the body that would decide them, the time limit, and the authority before which they were to be filed, which, in the claimant’s view, contravenes the legal mandate of Article 245 of the Ley General de la Administración Pública.
He asserts that this decision, as a final administrative act (acto final), was never served on him by the Secretaría General or the Board of Directors of the IDA, as the institution’s decision-making and highest governing body. He contends that this failure of service left him without a defense because he was not informed of the content of the decision and was unable to challenge that act within the prescribed time and manner, thereby violating Article 239 of the LGAP, since service was effected by the directing body (órgano director), the Regional Huetar Norte, by means of a decision issued at catorce horas con cuarenta minutos del veintiuno de febrero del dos mil doce, which is affected by the same defect of absolute nullity (nulidad absoluta) as the final administrative act because it did not specify the available remedies, the body that would decide them, the time limit, or the authority before which they were to be filed, which, in his view, violates Article 245 of the LGAP.
He adds that he was never informed of the recommendation contained in official letter number DRHN-ALJ-0255-2011, signed by Lic. Manrique Jiménez Castro, Asesor Jurídico Regional, and Ingeniero Armando Montero Arce, Director Regional a.i. of the Dirección Regional Huetar Norte, an opinion that provided the substantive basis for the challenged decision of the Board of Directors of the IDA (INDER). He maintains that the decision of the Board of Directors of the defendant institution is defective for lack of reasons (falta de motivación) and therefore contravenes Article 136, subsection 1, paragraph a), and subsection 2, and Article 214, subsection 2, of the LGAP, because that final administrative act neither states reasons for, supports, explains, nor justifies what was ordered therein, as it imposes on him obligations to vacate property that he has possessed since 1985, thereby, in his view, restricting, extinguishing, and denying vested rights (derechos subjetivos).
He notes that he submitted several written filings to the Subregional de Guatuso detailing the basis for his possession of part of plot 40. Nevertheless, he asserts that, with respect to both the filing submitted on 25 de marzo del 2008 and the one filed on 1 de julio del 2011, the Administration never scheduled the oral and private hearing (audiencia oral y privada) required by Article 317 of the LGAP, leaving him, in his view, without a defense because the evidence offered was not taken and he was unable to prove, explain, detail, and substantiate his acts and rights; consequently, absolute nullity exists. He objects that the challenged decision of the Board of Directors was signed only by Lic. Walter Ulate Calderón, as Secretario General de la Junta Directiva del IDA; in the claimant’s view, this leaves him without a defense because he does not know which members of the collegial body were present or absent during the vote or whether the legally required quorum (quórum de ley) was met, since he considers that the terse phrase “decision unanimously approved” does not allow him to ascertain the internal and personal competence of the persons comprising the Board of Directors and its advisers, or any possible grounds for abstention (abstención), recusal (recusación), disqualification (impedimentos), and other factual circumstances that would render the act null and give rise to liability.
He asserts that the final portion of the challenged decision states that the property must be vacated so that it may be transferred to MINAET because it constitutes State Natural Heritage (Patrimonio Natural del Estado), which, in his view, renders the act, its enforcement, and the entire administrative proceeding absolutely null, since it is uncertain which of the two institutions has standing to act in the interests involved in that eviction. The plaintiff further argues that in 1970 he acquired a property located in Río Celeste de Guatuso, measuring 144 hectares and adjoining properties belonging to private parties. He adds that in 84-85 he learned that the IDA was carrying out the subdivision (parcelación) that would be called Río Celeste, which included, through direct purchase, the former property of Nombre40324, and that it was agricultural land whose adjoining landowners were also private parties.
He asserts that the IDA constructed an access road to his property in order to obtain the beams it urgently required; this forced him to erect fences within his property, both to prevent livestock from escaping and to protect the newly constructed road over which the IDA transported all the beams that the institution needed, which were unavailable on the lands purchased from Nombre40324 but of which he had a sufficient quantity on his own pastures, forestlands, and surrounding areas. The plaintiff contends that, in view of the foregoing and based on the documents, plans, testimony, and statements submitted, it has been established that both the lands on which he had settled and those acquired by the IDA from Nombre40324 were privately owned lands, some titled and others untitled (terrenos privados titulados y otros sin titular), devoted to agriculture and livestock farming and bordered by privately owned properties.
He emphasizes that those lands did not belong to the State and that no areas designated as or forming part of national parks or reserves existed there in 85-86. He asserts that, according to the certification issued by the Registro Público, plot number 40, which the IDA claims belongs to it, was not registered as such in the Registro Público until 1988, and its survey plan was not prepared until 1986; therefore, when the IDA constructed the road and entered into the agreement with him, those lands apparently were in the possession of Nombre40324 but had not yet been registered. Accordingly, he began possessing that portion of land for protective purposes because the road passed along a portion of the río Samen, which was his natural boundary, and he therefore had to take protective measures to prevent his livestock from leaving his property or being stolen. He maintains that he has occupied the land openly, undisturbed, peacefully, and under a claim of ownership (a título de dueño) from 1985 to the present, and that he has cared for and protected its water sources and managed the land in the best possible manner.
He reiterates that at that time he took possession in order to protect his property, which had been titled in 1973, and that the portion of land he began possessing in 84 was not registered in anyone’s name, much less in the IDA’s name; it was unregistered land, and he therefore considers his possession to be a right that the IDA has violated by accusing him of unlawful occupancy. He asserts that he is in partial possession of the portion of land that the IDA calls plot 40. He reiterates that he has possessed that land from 1985 to the present and that it was registered in the IDA’s name three years after he began caring for, protecting, and restoring the property. He states that the act issued by the IDA was allegedly at the request of MINAET and that this situation resulted in a criminal complaint from which he was acquitted of all punishment and liability, because neither MINAET nor the IDA ever proved the alleged acts, nor were they able to prove that his possession was unlawful or that the land he has possessed since 1985 constitutes State Natural Heritage.
He maintains that all the evidence submitted establishes that his possession has been in good faith (buena fe) and that, on this basis, he constructed buildings and made numerous improvements to preserve the land; he therefore requests the application of Article 509 of the Código Civil. For all these reasons, the plaintiff requests that the present action be granted in its entirety.
V- ARGUMENTS OF INDER (FORMERLY IDA): INDER argues in its defense that the agreement challenged by the claimant, issued by the INDER Board of Directors, is lawful. The respondent institution states that it was demonstrated that the claimant is illegally occupying parcel number 40 of the Asentamiento Campesino Río Celeste, which corresponds to the property registered under record number Placa7396 in the name of INDER, and that this was what the challenged agreement of the Board of Directors resolved. That agreement was based on a memorandum prepared by the Legal Counsel’s Office of the Dirección Región Huetar Norte, which determined that the occupation was illegal and that the land constitutes the State’s Natural Heritage (Patrimonio Natural del Estado), which must be transferred to MINAET pursuant to the recommendations of the Contraloría General de la República. It maintains that it is not true that the INDER Board of Directors initiated an administrative eviction proceeding (procedimiento administrativo de desalojo) through that agreement; rather, the agreement ordered the eviction.
It notes that the challenged agreement does not identify the remedies (recursos) that may be filed against it. Nevertheless, a decision was issued to notify him of the Board of Directors’ determination, and notice thereof was given on 21 de febrero del 2012 to Bufete Montero, as he himself had requested. The respondent’s representative states that the claimant acknowledges having been notified of the Board of Directors’ agreement but alleges denial of the right to a defense (indefensión) because notice was given by the directing body of the proceeding (órgano director del procedimiento) for the Región Huetar Norte rather than by the Secretaría General or the INDER Board of Directors. However, the representative asserts that notice was sent to the fax number provided by the claimant himself and therefore considers that notice was effectively given. The representative states that memorandum DRHN-ALJ-0255-2011 is the report prepared by the Legal Counsel’s Office of the Dirección de la Región Huetar Norte, which recommended that the Board of Directors grant the request to evict the claimant for illegally occupying Dirección4951.
The Board of Directors adopted the challenged agreement on the basis of that report; the respondent therefore considers that the report is not a final act (acto final) that was required to be served on the claimant and that, for this reason, the claimant was not denied the right to a defense. It contends that the challenged agreement is indeed reasoned and justified because the claimant’s illegal occupation of the parcel has been established, and such occupation is not recognized by IDA. It adds that the land in question is registered in the name of IDA and must also be vacated because, owing to its characteristics, it must be transferred to MINAET as an asset forming part of the State’s Natural Heritage. It rejects the claimant’s assertions that he has been in lawful possession (posesión legal) of the property since 1985 and that his individual rights (derechos subjetivos) are being extinguished, because the only possession recognized by IDA is possession arising from compliance with all requirements established in the Ley de Tierras y Colonización and the Reglamento de Selección de Beneficiarios.
It argues that applicants for land must begin the process by submitting an application to IDA, which may be filed at any office in the country together with all requirements prescribed by the Ley de Tierras y Colonización and the Reglamento de Selección de Beneficiarios. It explains that the IDA Board of Directors will declare an applicant who meets all requirements to be a beneficiary of the land-allocation programs and, subsequently, once a property becomes available for an applicant who has been declared a beneficiary, the same Board of Directors will declare that person an allottee (adjudicatario) through another specific agreement. It notes that an applicant for land may lawfully enter an IDA property only after being declared an allottee and that, from that time onward, the allottee also signs a provisional land-allocation agreement (contrato provisional de asignación de tierras) with INDER, setting out the duties and obligations of each party.
It states that entry onto an IDA parcel by any other means is considered illegal. The respondent therefore considers that, had the claimant submitted to this court the two agreements issued by the IDA Board of Directors, as well as the provisional land-allocation agreement, and were he then evicted, it could indeed be considered that his individual rights were being extinguished, restricted, or denied. It states that it is highly unlikely that the claimant’s alleged verbal agreement with senior IDA officials permitting him to enter parcel 40 ever occurred. Nevertheless, it considers that, even if it had occurred, it would constitute an absolutely null act (acto absolutamente nulo), since the law does not establish such a procedure for allocating IDA assets to beneficiaries. It states that in the pleadings filed by the claimant on 25 de noviembre del 2008 and 1 de julio de 2011, in which the claimant addressed the first and second formal demands (intimaciones) issued to him by IDA, he did in fact offer documentary and testimonial evidence in his defense, as well as sworn statements from members of the community.
It maintains that the administrative records (expedientes administrativos) show that IDA assessed and ruled on the allegations submitted by the claimant in the two aforementioned pleadings. It states that IDA did not take the testimonial evidence offered because the only valid evidence for demonstrating that the claimant’s possession was lawful was the appropriate documentary evidence, namely the agreements of the IDA Board of Directors declaring the claimant a beneficiary and an allottee, as well as the provisional land-allocation agreement. It reiterates that the claimant was never denied the right to a defense, since he responded to the two formal demands issued to him, presented his allegations, and offered evidence. Nevertheless, IDA conducted the relevant assessment of both responses and replied that the only appropriate evidence capable of supporting lawful possession within the property registered in the Registro Nacional in the name of IDA would be the agreements issued by the Board of Directors evidencing compliance with the procedures and requirements established by the Ley de Tierras y Colonización and the Reglamento Autónomo para la Asignación de Solicitantes de Tierras.

It maintains that the claimant never underwent the beneficiary-selection assessment to determine whether he met the requirements for a private party (administrado) to be declared a beneficiary, nor did he submit the provisional land-allocation agreement. The respondent institution therefore asserts that the claimant is an illegal occupant because he does not possess a single document issued by IDA supporting the possession he exercises. The respondent considers that an oral and private hearing (audiencia oral y privada) is contemplated for the ordinary administrative proceedings (procedimientos administrativos ordinarios) governed by the LGAP. It notes that, in this case, an administrative proceeding was not formally initiated, since the claimant was merely informed through two formal demands that he was occupying property owned by IDA and was requested to submit any appropriate evidence he might have to justify his possession.
Therefore, because he failed to submit the appropriate evidence, IDA was required to continue the administrative eviction process. It maintains that the claimant cannot claim that the failure to take the evidence offered denied him the right to a defense, since IDA did assess the evidence submitted and concluded that it was not appropriate to justify the possession he exercises. It objects that the claimant was duly notified of the challenged Board of Directors’ agreement and that, if he considered it necessary to learn the details concerning the members of that Board who were present and absent, as well as how each member voted, he could have requested that information because he was always free to review the administrative record. It considers that the administrative records establish that the claimant had unrestricted access to the record, that he even challenged everything he considered pertinent, and that IDA notified him of all relevant matters. For the foregoing reasons, the respondent institution requests that this action be dismissed in its entirety.
VI- ARGUMENTS OF THE STATE IN ITS CAPACITY AS AN INTERESTED THIRD PARTY: The State, in its capacity as an interested third party (tercero interesado), states that parcel number 40 of the Asentamiento Río Celeste is registered in the Registro Público in the name of INDER and that, for this reason, that institution initiated an administrative eviction proceeding concerning the parcel against the claimant. It maintains that memorandum number DRHN-ALJ-0255-2011 states that parcel 40 of the Asentamiento Río Celeste is considered a reserve due to the presence of water networks (redes hídricas) and forested topography (topografía boscosa). Counsel for the State states that the case law has consistently held that the State’s Natural Heritage does not require a formal declaration; rather, it is sufficient for property to possess the characteristics inherent to that classification for the State to be obligated to provide the required protection.
It considers that parcel 40 forms part of the State’s Natural Heritage and must therefore be transferred to MINAET, as the INDER Board of Directors properly decided in the agreement challenged by the claimant. It points out that the claimant did not demonstrate that he held any right authorizing him to occupy parcel number 40, which is registered in the name of INDER. For those reasons, it requests that this Tribunal dismiss in their entirety any claims to unauthorized rights or rights that would affect the special legal regime governing the State’s Natural Heritage, because it would be improper for the judgment to recognize any rights of private parties over assets titled in the name of IDA that constitute public-domain property (bienes demaniales).
VII- SUBJECT MATTER OF THE PROCEEDING: Based on the written and oral arguments presented by the parties participating in this proceeding, this judicial body determines that the subject matter of this case is limited to establishing whether the right to a defense (derecho de defensa) and due process (debido proceso) were violated in the administrative eviction proceeding conducted by INDER against the claimant, as well as determining whether the claimant’s possession of parcel number 40 of the Asentamiento Río Celeste is lawful or unlawful. This will determine whether the agreement adopted by the IDA Board of Directors in article number 42 of ordinary session 043-2011, held on 29 de noviembre del 2011, is lawful.
VIII- ARTICLE NO. 42 OF ORDINARY SESSION 043-2011 OF 29 DE NOVIEMBRE DEL 2011 IS AN ACT IN ACCORDANCE WITH LAW. ABSENCE OF DUE-PROCESS VIOLATIONS. THE PLAINTIFF’S UNLAWFUL POSSESSION OF PARCEL 40: This Court finds that Article number 42 of ordinary session 043-2011 of the Board of Directors of INDER (IDA), held on 29 de noviembre del 2011, as well as all acts comprising the administrative eviction proceeding (procedimiento de desalojo administrativo) of the plaintiff from parcel number 40 of Asentamiento Río Celeste, were issued in accordance with law and without violating the plaintiff’s right of defense (derecho de defensa) or due process (debido proceso). Furthermore, this Court finds that the plaintiff’s occupation of the indicated parcel is entirely unlawful. The foregoing findings are based on the following reasons: 1) It is a proven fact that property registration Placa7395, in the Province of Alajuela, located at Dirección4792 , , canton 15, Guatuso, is owned by Instituto de Desarrollo Agrario and corresponds to parcel number 40 of Asentamiento Río Celeste.
Indeed, the plaintiff has never rebutted this fact, since he has acknowledged, both in the administrative forum (sede administrativa) and in these judicial proceedings, that the land belongs to INDER (IDA). The plaintiff alleges, however, that he took possession (posesión) of that property before the defendant institution acquired it beginning in 1988, and that it previously belonged, apparently, to Mr. Nombre40324; the plaintiff even contradicts himself in his arguments by also stating that the land was not registered in anyone’s name before INDER acquired it. Nevertheless, it should be noted that the plaintiff again acknowledges that the land was acquired by INDER and that he occupied it. For this Court, this means that the plaintiff entered the land in question knowing from the outset that it belonged to INDER. As will be explained, this establishes that the plaintiff did not act in good faith (buena fe) when occupying the property owned by the defendant institution.
Moreover, the plaintiff has not demonstrated that he occupied the property before INDER acquired it, who its former owner was, or whether it had no registered owner; none of those allegations has any evidentiary support. This panel also finds those facts irrelevant because what matters in this case is that the plaintiff occupied property registered in INDER’s name and, from the beginning of his occupation, was fully aware that it did not belong to him and was subject to the land-titling programs that constitute one of the public and well-known purposes carried out by the defendant institution. Accordingly, this Court clearly and manifestly finds that the plaintiff’s occupation of Dirección4949 is and has been openly unlawful from the outset; 2) It has also been established that on 26 de setiembre del 2008, by official letter number OSG-0867-2008, Mr. Carlos González Rodríguez, Head of the Guatuso Subregional Office of IDA, informed Engineer Alexander León Campos, Head of the Bagaces Miravalles Subregion of the Ministerio del Ambiente y Energía, of the following matters relevant to the issuance of this judgment:
“In response to the matters stated in official letter ACAT-SBM-OB-087-08 concerning (sic) the request for the administrative eviction of Mr. Nombre40322 from the invaded area of Asentamiento Río Celeste, (...) I hereby report the following: After the case has been reviewed by the Legal Advisor, the corresponding formal demands (intimaciones) will be issued in accordance with the administrative procedure, for the purpose of persuading the occupant to vacate that area; otherwise, the eviction proceeding will be initiated.” It should be noted that the cited official letter proves that MINAET detected that the plaintiff had invaded an area of Asentamiento Río Celeste and therefore requested that the Head of the Guatuso Subregional Office of IDA (INDER) review the situation. Specifically, that office reported that it would issue the corresponding formal demands for the plaintiff to vacate the land or would carry out the administrative eviction.
This Court is satisfied that INDER was unaware of the plaintiff’s occupation of the land in question until it was alerted by MINAET. Nevertheless, the fact that the defendant institution was unaware for several years that the plaintiff was occupying property belonging to it does not legalize or legitimize his possession of that land, since it bears recalling that the parcel forms part of an INDER (IDA) settlement—that is, it was acquired to fulfill public purposes involving the parceling and allocation of land—and is also part of the State’s natural heritage (patrimonio natural del Estado), as will be examined in greater detail throughout this judgment. All of this means that the land in question is public property outside the stream of commerce (fuera del comercio), as provided in section 262 of the Código Civil. INDER’s (IDA) action to protect this parcel is therefore not subject to limitation and cannot be waived (imprescriptible e irrenunciable), and may be brought at any time, as occurred in this matter when, following a communication from MINAET, the defendant institution commenced the administrative eviction proceeding; 3) Specifically, it has been proven that on 12 de noviembre de 2008, through official letter OSG-1000-2008, the Guatuso Subregional Office issued the plaintiff an initial formal demand, which stated the following insofar as relevant to this decision:
“In accordance with the field inspection conducted on 12 de febrero del año 2008, this office verified that you are unlawfully occupying parcel number 40 of Asentamiento Campesino Río Celeste, which is owned by Instituto de Desarrollo Agrario.” In the same document, the plaintiff was also ordered to refrain from introducing any type of improvement to the property and was granted five business days to appear before IDA’s Legal Advisory Office with Lic. Manrique Jiménez Castro, submit all evidence in his defense (prueba de descargo), and exercise his right of defense. He was also instructed to provide an address for service of notices (notificaciones), with the warning that, should he fail to comply, decisions would be deemed served on him within twenty-four hours. Regarding this first formal demand issued by the defendant institution, this Court highlights the following relevant points: First: It should be noted that, through a field inspection conducted on 12 de febrero del 2008, the Guatuso Subregional Office itself was able to verify the same matter reported by MINAET officials from that area: namely, that the plaintiff was occupying a parcel owned by INDER.
This means that the plaintiff’s illegitimate occupation was verified not only by MINAET but also by INDER’s own officials; Second: The plaintiff was given five days to submit his evidence in defense directly to INDER’s Legal Advisory Office and to provide a means for receiving notices. It is evident that, through this course of action, INDER respected the plaintiff’s right of defense. Consistent with this, it is deemed proven that on 25 de noviembre del 2008, the plaintiff submitted to Lic. Manrique Jiménez Castro, Legal Advisor for IDA’s Región Huetar Norte, a written response to the formal demand issued through official letter OSG-1000-2008, stating the following insofar as relevant to the issuance of this judgment:
“(...) In view of this situation, which I had presented to you as a problem that placed me at a disadvantage, I was offered the opportunity to retain full ownership of this small IDA section, 4 or 6 hectares known as parcel 40, (...) This area, which was (sic) delivered to me as part of this exchange or agreement that has remained in effect to date, was for my unrestricted disposition and use and comprises approximately 4 to 6 hectares in total, by my estimate, since no survey was conducted and no document was signed at the time. No paper was signed; (sic) it was a gentlemen’s agreement (...) The facilities are the same ones currently located on the area or lot transferred to me by IDA in 1986, which from that time and under those circumstances became known as MAGIL FOREST LODGE. (...) I have maintained the small area delivered to me with the (sic) best care that could be provided, both with respect to the road area and the natural area delivered to me. (...) with only the formal transfer of this small parcel number forty in my favor remaining to be completed (...)”
In this written submission, the plaintiff also provided evidence in his defense and supplied a fax number and an email address for service of notices. It can thus be seen that, from the beginning of the eviction proceeding, the plaintiff acknowledged the following facts: a) That parcel 40 belonged to IDA (INDER), and that he knew this when he occupied that portion of land; b) That he entered the parcel pursuant to an alleged “agreement” or “exchange” that was not documented in writing; c) That he conducted tourism activities, rather than agricultural activity (actividad agraria), on the property; d) That the land includes a “natural” area. These facts, acknowledged by the plaintiff himself from the outset, produce the following legal effects: First: Because the plaintiff knew when he entered the parcel that it did not belong to him, and retained that knowledge throughout the administrative eviction proceeding and even in these judicial proceedings, he meets the definition of a possessor in bad faith (poseedor de mala fe) under Article 285 of the Código Civil, which provides:
“ARTICLE 285.- In all cases in which the law requires possession in good faith, a possessor in good faith is one who, upon taking possession, believed that he had the right to possess. If there was sufficient reason for him to doubt that he held such a right, he shall not be considered a possessor in good faith; however, if possession was in good faith at its inception, it does not lose that character merely because the possessor subsequently doubts the legitimacy of his right. Possession ceases to be in good faith when the possessor becomes certain that he is possessing improperly, and it also ceases upon service of a complaint in which another person claims the right to possess.” Specifically, in this case the plaintiff was always certain or aware that his possession was improper. Therefore, even from the perspective of Civil Law, the plaintiff is a bad-faith possessor (poseedor de mala fe), and from the perspective of Administrative Law, an illegal occupant (ocupante ilegal) of public-domain property (bien de dominio público).
Under either scenario, the plaintiff has no subjective right (derecho subjetivo) or legitimate interest (interés legítimo) in parcel 40. Consequently, the claimant cannot be granted compensation for improvements (mejoras) made to that property, nor is article 509 of the Código Civil applicable, as it governs accession rights (derechos de accesión) concerning structures built on land belonging to another, which is not the situation in this case. Furthermore, it must be made clear to the plaintiff that bad-faith possession (posesión de mala fe) does not give rise to compensation rights (derechos indemnizatorios), much less when the property is public-domain property; Second: He entered that property through an alleged unwritten “deal” or “barter,” which is an illegal means of acquiring a parcel from INDER. This Tribunal agrees with the arguments made by INDER on this matter because acquiring a parcel belonging to the defendant institution through barter in exchange for a favor, an oral agreement, or even, assuming that such an agreement existed in writing, would be a completely illegal means of acquiring a parcel intended for agricultural activity.
This is because the Ley de Tierras y Colonización and the Reglamento Autónomo para la Adquisición de Tierras establish the regulatory framework (marco normativo) governing the requirements and procedure for awarding land belonging to INDER, which provides that the following steps must be followed: a. Apply for an award of land (adjudicación de tierras); b. A declaration by the Junta Directiva del INDER that the applicant meets the requirements to be a beneficiary of the land-allocation programs; c. A declaration by the Junta Directiva del INDER awarding a parcel; and d. Execution of the provisional land-allocation agreement (contrato provisional de asignación de tierras). Specifically, the plaintiff did not prove before this court that he had been declared eligible to acquire parcels from IDA (INDER) in the Asentamiento de Río Celeste, or in any other settlement, that the Junta Directiva of the defendant institution had awarded him parcel number 40 of the Asentamiento de Río Celeste, or that he had entered into a land-allocation agreement with IDA (INDER).
INDER is therefore correct in stating that all the reasons alleged by the plaintiff as grounds for entering and occupying parcel number 40—protection of his former farm, protective measures to prevent his cattle from leaving his former property, and an oral agreement with IDA—are illegal, because compliance with the requirements and procedures set forth above was the only means by which the plaintiff could have legitimately acquired and occupied that parcel; the other grounds are entirely illegal; Third: The plaintiff acknowledges that during those years he conducted tourism activities on parcel 40. This is also manifestly illegal, because the property in question was originally acquired by INDER for agricultural activities; subsequently, the presence of forest cover (cobertura boscosa) and water sources (fuentes hídricas) was established, making it part of the State’s natural heritage (patrimonio natural del Estado).
The designated uses of the property were violated by the plaintiff’s illegal possession, which was aggravated by his carrying out activities for which that land was not intended; Fourth: Finally, the claimant acknowledges that there are areas of “nature” on that property, thereby admitting the same fact stated by the witnesses Nombre40323, Manrique Jiménez Castro, and Kender Gerardo Aguilar Jiménez during the oral and public trial held before this Tribunal on 24 de octubre del 2014: that parcel 40 has forest cover. This is sufficient evidence for this Tribunal to accept the State’s position that the parcel forms part of the State’s natural heritage. The claimant’s response to the first formal notice (intimación) was properly processed and decided by INDER. This is because it has been proven that on 28 de noviembre del 2008, through official letter number DRHN-ALJ-387-2008, Lic. Manrique Jiménez Castro, Legal Adviser for Región Huetar Norte del IDA, asked Engineer Carlos González Rodríguez, Head of Oficina Subregional de Guatuso, to assess and issue a recommendation regarding the plaintiff’s statements in the filing submitted on 25 de noviembre del 2008.
It is likewise a proven fact that on 18 de diciembre del 2008, through official letter OSG-1128-2008, the Head of Oficina Subregional de Guatuso advised Lic. Manrique Jiménez Castro, Legal Adviser for Región Huetar Norte del IDA, regarding the claimant’s case, that no case file, document, or record existed showing that the plaintiff’s occupation of parcel 40 had been legally recognized by IDA. He also recommended that the plaintiff be given a period within which to submit documents establishing him as the lawful possessor (poseedor legal) of parcel 40, failing which the legally prescribed action should be taken in cases of illegal occupation not recognized by IDA. Specifically, following the recommendation of Oficina Subregional de Guatuso, on 30 de enero del 2009, through official letter DRHN-ALJ-0021-2009, Lic. Manrique Jiménez Castro sent the plaintiff a copy of official letter OSG-1128-2008 and granted him a period of one calendar month to comply with the request made in that letter, failing which administrative eviction proceedings (proceso administrativo de desalojo) would be initiated against him as established by Ley 2825 and its amendments.
The aforementioned official letter was served on the plaintiff on 31 de enero del 2009. It should be noted that INDER gave the plaintiff an additional period within which to submit the only competent evidence (prueba idónea) capable of proving that his occupation of parcel 40 was lawful. Specifically, on 27 de febrero del 2009, the plaintiff submitted a filing to Dirección Huetar Norte del IDA addressing the decision and recommendation issued by the Head of Oficina Subregional de Guatuso in official letter OSG-1128-2008. He also submitted defense evidence (prueba de descargo), none of which included any document proving the alleged “gentlemen’s agreement” under which he occupied parcel 40. It should be noted that in this filing the plaintiff resubmitted the same evidence offered with his response to the first formal notice, consisting of sworn statements (declaraciones juradas), documents referring to the installation of electricity on the property, among other items.
Nevertheless, he did not submit even a single document proving the so-called “deal” or “gentlemen’s agreement,” much less documents establishing that he was an IDA beneficiary, an agreement awarding the parcel to him, or the provisional land-acquisition agreement (contrato provisional de adquisición de tierras). These were the only documents and competent evidence that the plaintiff could have submitted to prove the legality of his occupation of parcel 40. Specifically for this reason, on 4 de mayo de 2009, through official letter DRHN-ALJ-0118-2009, Lic. Manrique Jiménez Castro, Legal Adviser for Dirección Regional Huetar Norte, informed the plaintiff as follows:
“With the usual respect and consideration, I hereby inform you that we have received and reviewed your filing dated 24 de febrero de 2009, which refers to official letter OSG-1000-2008 from Oficina Suregional de Guatuso. In this regard, I must inform you that the arguments presented in that filing cannot be accepted, because the official letter to which you refer is not subject to appeal (recurso de apelación). It must be borne in mind that you exercised your right of defense (derecho de defensa) after you were (sic) formally notified regarding your alleged illegal occupation of the property at issue. Accordingly, Oficina Subregional will continue with due process (debido proceso) and will submit the corresponding recommendation to the Junta Directiva, which is the body responsible for deciding whether to authorize the eviction sought by Oficina Subregional. For the corresponding purposes, you will be notified in due course of the Junta Directiva’s decision, which you have the right to appeal.” This official letter was served on the plaintiff on 5 de mayo del 2009.
It should be noted that, through the transcribed document, the plaintiff was informed of the procedure that would be followed, which would consist of preparing a recommendation for the Junta Directiva del INDER so that this collegial body (órgano colegiado) could determine whether the eviction was appropriate, and he was also informed that the resulting decision would be served on him in due course. Indeed, it has been established that on 15 de mayo del 2009, the plaintiff submitted a filing to Dirección Huetar Norte del IDA containing a series of statements regarding the contents of official letter DRHN-ALJ-0118-2009. Accordingly, it is evident to this Tribunal that, beginning with the first formal notice issued to the plaintiff, INDER gave him several opportunities to exercise his right of defense, and it is clear that the plaintiff responded to each hearing (audiencia) afforded to him by the defendant institution, with every opportunity to submit his arguments and defense evidence.
Unfortunately, it bears repeating, the plaintiff never submitted the competent documents—decisions of the Junta Directiva declaring him a beneficiary and awarding him parcel 40, together with the corresponding provisional land-allocation agreement—but instead submitted documentary and testimonial evidence (prueba documental y testimonial) that was entirely irrelevant and lacked probative fitness. Specifically, because of the absence of competent documents proving that the plaintiff lawfully occupied parcel 40, on 22 de mayo del 2009, through official letter number DRHN-ALJ-0134-2009, Lic. Manrique Jiménez Castro, Legal Adviser for Dirección Regional Huetar Norte, informed Engineer Carlos González Rodríguez, Head of Oficina Subregional de Guatuso, that the plaintiff had not submitted, within the granted period of one calendar month, the requested documents establishing him as the lawful occupant of parcel 40, and therefore recommended initiating administrative eviction procedures (trámites administrativos de desalojo); 4) The events described and analyzed above date from 2008 and 2009, and although the plaintiff had already been formally ordered to prove his right to parcel 40, had defended himself, and the Legal Adviser for Dirección Regional Huetar Norte had even recommended that Oficina Subregional de Guatuso initiate procedures to evict the plaintiff from parcel 40, on 24 de junio de 2011, through official letter number OSG-508-2010, Oficina Subregional de Guatuso again issued a second formal notice to the plaintiff, stating, insofar as relevant to this decision, as follows:
“Pursuant to the field inspection (inspección de campo) conducted on 22 de junio de 2011, this office verified that you are illegally occupying parcel number 40 of Asentamiento Campesino (sic) Rio Celeste, which is owned by Instituto de Desarrollo Agrario” It should be noted that, once again, in 2011, INDER conducted a new field inspection of parcel 40 and again verified the claimant’s illegal occupation (ocupación ilegal) thereof. Likewise, in that same document, the plaintiff was ordered, for a second time, to refrain from introducing any type of improvement on that property, and was granted a period of five business days to appear before the IDA Legal Advisory Office and meet with Lic. Manrique Jiménez Castro, as well as to submit all evidence in rebuttal (prueba de descargo) and exercise his right of defense (derecho de defensa). He was also instructed to designate a place for service of notices, with the warning that, in the event of noncompliance, the decisions would be deemed served upon him within twenty-four hours.
This second formal demand (intimación) was served on the claimant on 24 de junio del 2011. Subsequently, on 1 de julio del 2011, the claimant filed a written submission with the IDA Regional Directorate in which he referred to the second formal demand issued in official letter number OSG-508-2010, reaffirmed his written submission of 25 de noviembre del 2008, set forth his arguments, and submitted documentary and testimonial evidence. It should be observed that the claimant had another opportunity to demonstrate, through the appropriate documentation identified above, his right to occupy parcel 40. However, he again repeated the same arguments and submitted the same evidence that he had presented in response to the first formal demand issued to him in 2008. For that reason, on 5 de julio del 2011, through official letter number OSG-533-2011, signed by Kender Aguilar Jiménez, Agrarian Specialist for Guatuso, and Carlos González Rodríguez, Head of the Guatuso Subregional Office, both officials of the IDA Guatuso Subregional Office, they requested that Lic. Manrique Jiménez Castro, Legal Advisor for the IDA Huetar Norte Region, process the eviction (desalojo) of the claimant from parcel 40 of the Río Celeste Peasant Settlement, because they considered him to be occupying that parcel illegally.
Copies of the formal demands issued to the claimant by the IDA Subregional Office were also attached: the first formal demand of 12 de noviembre del 2008, official letter OSG-1000-2008, and the second, official letter OSG-508-2011 of junio del 2011. It bears repeating that it is evident in this case that the claimant had several opportunities to demonstrate his right to parcel 40. Nevertheless, in responding to all the hearings granted to him by INDER, he presented the same arguments and evidence, which were even the same evidentiary materials submitted in these judicial proceedings. The plaintiff’s allegation that his right of defense and due process (debido proceso) were violated in this case is therefore unfounded, because two formal demands were issued to him over the course of several years, he responded to the hearings granted by the respondent institution, and he submitted evidence in rebuttal.
In view of the foregoing, on 19 de julio del 2011, through official letter number DRHN-ALJ-187-2011, Lic. Manrique Jiménez Castro, Legal Advisor to the IDA Huetar Norte Regional Directorate, informed the claimant, insofar as relevant to the issuance of this judgment, as follows:
“I hereby respond to your letter sent to this Legal Advisory Office concerning the second formal demand issued to you by the Guatuso Subregional Office, official letter OSG-508-2011, served by fax at 14 hours 09 minutes on 24 de junio del 2011, which you formally reaffirm and confirm. Regarding the written submission filed by you, we must state, as we have indicated on other occasions, that you are occupying parcel number 40 of the Río Celeste settlement, which has an area of 7 ha 4482.36 m2 and is owned by the Instituto de Desarrollo Agrario. According to the Agrarian Oversight Report (Informe de Fiscalización Agraria) of the Guatuso Subregional Office, official letter OSG-512-2009 of 19 de agosto del 2009, parcel 40 of the Río Celeste settlement is designated by IDA as a reserve and forms part of Parque Nacional Volcán Tenorio; that reserve must become jurisdictionally incorporated within the boundaries of the Park.
Regarding your assertions concerning the right granted to you by IDA over that parcel, we again state that unless it is demonstrated through the appropriate mechanism, such as an award (adjudicación) made by means of a final resolution of the Board of Directors, any other means or method is absolutely null and void. We will not address the steps you are taking before the Executive Presidency of the Instituto de Desarrollo Agrario, and we hope they produce positive results; however, I hereby inform you that, in accordance with our institutional responsibilities, we will continue processing the eviction, the report on which we will submit for consideration by the directors of the Board of Directors of the Instituto de Desarrollo Agrario, as occurs in all such cases.(...)” From what is stated in this official letter, this Court draws the following conclusions: First: The claimant had the opportunity to defend his position before the Legal Advisory Office of the Huetar Norte Regional Directorate itself.
He was also informed again that he was occupying parcel number 40 illegally and was repeatedly advised that he had not demonstrated that he had acquired that parcel through the appropriate means, namely an award made by resolution of the INDER Board of Directors, and that other forms of acquisition were unlawful; Second: The plaintiff was informed that parcel 40 is a nature reserve (reserva natural) and forms part of Parque Nacional Volcán Tenorio. He was also clearly informed that the land would be transferred to that Park. The claimant never submitted evidence to the contrary on this issue; it is therefore an established fact that the land forms part of the State Natural Heritage (Patrimonio Natural del Estado); Third: The procedure for the eviction that INDER intended to pursue was again explained to him, and he was clearly informed that a report would be forwarded to the INDER Board of Directors so that this collegial body could make the decision.
This final point demonstrates to this Court that the plaintiff was always fully aware of the eviction proceedings being conducted against him. They were never a surprise to the claimant; on the contrary, he was always informed that an administrative eviction (desalojo administrativo) was being pursued against him and what its consequences would be. He was also informed that the decision concerning his eviction would be made by the Board of Directors of the respondent institution, and it is evident that he could have challenged the final act (acto final) of that collegial body without the Board of Directors’ resolution itself needing to state that he had the right to challenge that final eviction decision; 5) As a result of the formal demands and the entire procedure conducted over several years by the INDER Guatuso Subregional Office and the Legal Advisory Office of the Huetar Norte Regional Directorate, on 26 de octubre del 2011, through official letter number DRHN-ALJ-0255-2011, signed by Lic. Manrique Jiménez Castro, Legal Advisor, and Ing. Armando Montero Arce, Director, both officials of the IDA Huetar Norte Regional Directorate, an analysis and recommendation regarding the request to evict the claimant for illegally occupying parcel 40 of the Río Celeste Peasant Settlement was forwarded to the IDA Board of Directors. Insofar as relevant to the issuance of this decision, it stated:
“An analysis of administrative case file DES-425-2011-OSG-ALJ, corresponding to Parcel 40 of the Río Celeste Settlement, establishes that the occupation of the aforementioned parcel by Mr. Nombre40322, (...), is absolutely illegal, a conclusion reached on the basis of the following background: As may be seen from the administrative case file for parcel 40 of the Río Celeste settlement, (...), there is no background information confirming the version of events described and recounted by Doctor Nombre40322 as the basis for his entry onto the parcel 40 in question. It may be observed that the case file begins with actions by the Ministerio del Ambiente y Energía, specifically the park rangers of Parque Nacional Volcán Tenorio, assigned to Área de Conservación Arenal Tempisque, who, in response to a complaint submitted by Sociedad Civil concerning irregularities involving the unlawful harvesting of forest products (aprovechamiento ilegítimo de productos forestales), filed a criminal complaint with the Fiscalía Auxiliar del Ministerio Público in Guatuso against Mr.
Nombre40322, (...) who was unlawfully exploiting parcel 40 of the Río Celeste settlement, designated by IDA as a forest reserve area (área de reserva forestal), according to the statements of MINAE officials, who maintain that it was decided to transfer that property to MINAE and incorporate it into Parque Nacional Volcán Tenorio because it constitutes State Natural Heritage. This is confirmed by the Subregional Office, which indicates that the aforementioned parcel is indeed awaiting transfer to MINAET. MINAET now requests that IDA initiate administrative eviction proceedings because the property is registered in the name of the Instituto de Desarrollo Agrario; at the same time, however, it filed a criminal complaint with the Prosecutor’s Office concerning Mr. Nombre40322’s violation of Ley Forestal, and that case has not yet been resolved by the courts. It appears that only after the first formal demand did the name Nombre40322 begin to become known at the Subregional Office, along with the accounts of exchanges, gentlemen’s agreements, assistance, and so forth, at least as recounted by the officials who have worked there the longest.
Everyone knows Mr. Nombre40322 as the doctor, attorney, notary, and businessman who owned Finca MAGUIL and the well-known Hotel de Montaña that was actually hidden in the mountains of Río Celeste. However, the matter of parcel 40 of the Río Celeste settlement did not become known until Doctor Nombre40322 lost his farm for unknown reasons and then moved, along with his entire hotel, to parcel 40 of the Río Celeste settlement. According to the Subregional Office, it has never been disputed that Doctor Nombre40322 distinguished himself as a helpful person and supported the Río Celeste settlement through countless projects. Nevertheless, regarding the arrangement he allegedly made at that time with IDA officials for the donation of timber to build bridges, which purportedly resulted in an offer or agreement to grant him the reserve area—that is, parcel 40 of the Río Celeste settlement—as a gesture of gratitude for his valuable contribution to the settlement’s development, this may indeed have occurred, since we cannot doubt Mr.
Nombre40322’s word either. However, because no documents exist—as Doctor Nombre40322 states, no measurements were taken and no paperwork was prepared because it was a gentlemen’s agreement—it may unfortunately have been a great gentlemen’s agreement, but under the present circumstances, although we deeply regret the uncertainty currently endured by Doctor Nombre40322, what might once have been regarded as a great act of cooperation cannot now even be considered unless it can be demonstrated through appropriate documents. In fact, this forest parcel is in the process of being transferred to MINAET in accordance with the recommendation contained in the opinion of the Contraloría General de la República. Furthermore, Ley Forestal 7575 requires us to transfer reserve areas or forested areas (áreas con bosque) to the jurisdiction of MINAET. Accordingly, and in conclusion, had Doctor Nombre40322 possessed the corresponding resolution of the Board of Directors granting him authority to occupy parcel 40 of the Río Celeste settlement, the circumstances would be different.
Therefore, unless and until the contrary is demonstrated, the recommendation is to recommend the administrative eviction.” This adjudicative body fully concurs with the analysis, decision, and recommendation contained in the transcribed official letter, for the following reasons: First: It confirms that the claimant has been illegally occupying parcel 40. This is so for three reasons. First, as previously explained, he failed to demonstrate through appropriate documents that the “exchange” or “gentlemen’s agreement” that the claimant allegedly entered into with INDER (formerly IDA) actually took place. Second, this report clearly establishes that the claimant invaded the land in question after losing his former property for unknown reasons. This is fully consistent with the claimant’s account of what occurred when he entered parcel 40. Third, it is established that MINAET alerted INDER to the claimant’s illegal occupation because that land constituted the Natural Heritage of the State (Patrimonio Natural del Estado).
This Court fully concurs with the State’s position that neither MINAET nor INDER was required to issue a declaration that parcel 40 of Asentamiento Río Celeste is part of the Natural Heritage of the State, because the case law of this Court, affirmed by the First Chamber of the Supreme Court of Justice, has held:
“The Public Administration may not exchange, transfer, alienate in any manner, convey, or lease rural land owned or administered by it unless it has first been classified by MINAET; therefore, if such land is covered by forest, it is automatically incorporated into the Natural Heritage of the State (Article 15). Based on all the foregoing, this Court reaches the following conclusions relevant to the specific case. First: Because the environment constitutes the Common Heritage of all inhabitants of the Nation, the Natural Heritage of the State is a species within that genus (Articles 50, second paragraph; 89; and 121, subsection 14, first paragraph, of the Political Constitution; Article 2(a) of the Organic Law of the Environment; Article 1 of the Biodiversity Law; and Article 13 of the Ley Forestal). Second: All land located within protected wild areas (áreas silvestres protegidas), areas declared inalienable—such as the maritime-terrestrial zone (zona marítimo terrestre) (Article 73 of Ley 6043)—land suitable for forestry (terrenos de aptitud forestal), and properties registered in the name of the State, Municipalities, Autonomous Institutions, and other entities of the Decentralized Public Administration are immediately subject by operation of law (afectación legal inmediata) to the Natural Heritage of the State.
Third: The Natural Heritage of the State does not require an express declaration because, pursuant to Articles 13 and 14 of the Ley Forestal and the rulings of the Constitutional Chamber in judgments 1992-03789 and 1997-04587, forested areas, land suitable for forestry, mangroves, and wetlands located within inalienable areas, such as the maritime-terrestrial zone, become immediately subject to this Heritage without any action by the Administration.” (see judgment number 175-2011-VI, issued by the Sixth Section of the Contentious-Administrative Court at eleven twenty on dieciocho de agosto 2011, affirmed by decision number 01675-F-S1-2012 of the First Chamber of the Supreme Court of Justice at eight fifty-five on trece de diciembre del dos mil doce) Specifically, in this case MINAET stated that parcel 40 of Asentamiento Río Celeste, owned by IDA (INDER), is part of the Natural Heritage of the State, and, as the cited case law has held, forested areas become immediately subject to the Natural Heritage of the State without requiring a declaration by the Public Administration.
Nevertheless, the record in this case shows that MINAET had established that this parcel formed part of Parque Nacional Volcán Tenorio. Furthermore, as stated above, the witnesses who testified at the oral and public trial held before this Court clearly indicated that parcel 40 of Asentamiento Río Celeste has forest cover (cobertura boscosa). This adjudicative body therefore has no doubt that the land is part of the Natural Heritage of the State and could not be occupied in any manner by the claimant because it is public-domain property (bien de dominio público), which is not subject to attachment (inembargable), adverse possession (imprescriptible), or alienation (inalienable). Likewise, the compensation sought by the claimant for alleged improvements made to the land in question is unwarranted because private possession of public property confers no rights whatsoever upon the possessor; Second: The transcribed official letter also shows that MINAET filed a criminal complaint against the claimant.
However, the criminal proceedings in which the claimant was found not guilty have no effect on these contentious-administrative proceedings (proceso contencioso administrativo), because criminal proceedings seek to determine whether offenses were committed, whereas these proceedings seek the annulment of administrative actions (conductas administrativas). Accordingly, under the principle of separation of proceedings (principio de separación de vías), the decision rendered in the criminal jurisdiction has no bearing on this contentious-administrative jurisdiction; Third: It should be noted that the transcribed report is a recommendation made by Dirección Regional Huetar Norte to the Board of Directors of INDER. This document is therefore not a final act (acto final), but rather a preparatory and internal act (acto preparatorio e interno), and the respondent institution was consequently under no obligation to serve it upon the claimant.
The claimant’s arguments alleging a violation of due process (debido proceso) due to the failure to serve this official letter are therefore unfounded. Irrespective of whether the cited official letter was served, it is clear to this Court that its decision contains nothing new beyond what the claimant had already known for several years, when Dirección4947 and Dirección Regional Huetar Norte of INDER conducted the administrative eviction proceedings (desalojo administrativo) against him; 6) Lastly, as the final result of the entire administrative eviction proceeding pursued against the claimant by Oficina Subregional de Guatuso and Dirección Regional Huetar Norte of INDER, the Board of Directors of IDA adopted a resolution under Article number 42 of ordinary session 043-2011, held on 29 de noviembre del 2011, which stated verbatim as follows:
“To accept the recommendation contained in official letter Nombre40325, signed by Lic. Manrique Jiménez Castro, Regional Legal Adviser, and Ing. Armando Montero Arce, Acting Regional Director of Región Huetar Norte, and, based thereon, it is resolved: To approve the eviction requested by Oficina Subregional de Guatuso, because the illegal occupation, not recognized by Instituto de Desarrollo Agrario, by Mr. Nombre40322, (...), or by any other person illegally occupying Parcel 40 of Asentamiento Río Celeste, located in Distrito San Rafael, Cantón Guatuso, Provincia Alajuela, has been established. The land is registered in the name of Instituto de Desarrollo Agrario in the Public Registry, Alajuela division, Real Property Folio System, Registration: Placa7396, without having been segregated from the parent property, and has an area of 7 ha, 4961.93 square meters, as described in cadastral plan Placa7397. The property must be vacated immediately so that it may be transferred to Ministerio del Ambiente Energía y Telecomunicaciones MINAET, because it constitutes part of the Natural Heritage of the State. RESOLUTION APPROVED UNANIMOUSLY.”.
The transcribed resolution is entirely lawful, for the following reasons: First: It has indeed been established that the cited resolution was served on the claimant by means of a notice order issued by the Legal Advisory Office of Región Huetar Norte, in its capacity as the body directing the proceedings (órgano director del procedimiento), at fourteen hours and forty minutes on the twenty-first of February two thousand twelve, using the fax number designated by the claimant as the means for receiving notices on 21 de febrero del 2012. This manner of serving the resolution of the Board of Directors does not in any way violate the claimant’s right to due process (debido proceso) or right of defense (derecho de defensa), since what matters is that the resolution was served through the means designated by the claimant himself for receiving notices. Nor was due process violated because notice was given by the Legal Advisory Office of Región Huetar Norte rather than by the General Secretariat of the Board of Directors, since the result would have been the same even if the latter had given notice.
It bears repeating that what matters is that the cited resolution was served on the claimant through the means designated by him for receiving notices, and the body responsible for giving notice is immaterial; Second: The claimant’s contention that the resolution should have informed him of the composition of the Board of Directors and the result of the vote is entirely irrelevant. It should be noted that the cited resolution was adopted and approved “UNANIMOUSLY,” and it is therefore logical that there were no abstentions, recusals, or disqualifications and that the legally required quorum was present. Moreover, the record shows that the claimant did not appeal this resolution through administrative channels (sede administrativa), although it was duly served on him. Accordingly, this Court agrees with INDER that the claimant could have requested information concerning the composition of the Board of Directors, since he was at all times aware of and had access to the administrative record (expediente administrativo); Third: The resolution adopted by the INDER Board of Directors is reasoned, legally supported, and adequately substantiated by official letter number DRHN-ALJ-0255-2011, which is a technical report analyzing the entire eviction proceeding (procedimiento de desalojo) conducted against the claimant over several years.
Likewise, there was no violation of due process, since official letter number DRHN-ALJ-0255-2011 sets out facts, arguments, and evidence with which the claimant was thoroughly familiar, having actively participated throughout the proceedings conducted by the Oficina Subregional de Guatuso and the Dirección Regional Huetar Norte of INDER to examine the claimant’s occupation of plot 40 in Asentamiento Río Celeste; Fourth: The fact that the transcribed resolution did not specify the remedies available, the body before which they could be pursued, or the deadline for challenging that act is not sufficient to invalidate the entire administrative eviction proceeding (procedimiento de desalojo administrativo) conducted by the respondent institution, as that would amount to seeking nullity for nullity’s sake. Furthermore, it is evident to this Court from the very arguments advanced in these proceedings by the claimant himself that he was always aware that he could appeal the resolution through administrative channels.
More generally, the claimant alleges violations of the provisions governing ordinary administrative proceedings (procedimiento administrativo ordinario) established in the Ley General de la Administración Pública. This Court finds, however, that the administrative eviction proceeding conducted by INDER against the claimant is not a full ordinary administrative proceeding, but rather a proceeding involving mere verification (procedimiento de mera constatación), since the only issue that must ultimately be determined is whether a person occupying a plot owned by INDER is doing so lawfully or unlawfully. Moreover, as explained throughout this judgment, the claimant’s right of defense and due process were respected at all times; indeed, over the course of several years, the claimant had the opportunity to demonstrate that his occupation of plot 40 in Asentamiento Río Celeste was lawful. Nevertheless, as analyzed in this decision, the claimant occupied that plot unlawfully under Civil Law—as a bad-faith possessor (poseedor de mala fe)—under the Ley de Tierras y Colonización and the Reglamento Autónomo para la Adquisición de Tierras—due to failure to comply with the procedure and requirements for acquiring land belonging to INDER—and under environmental regulations, because the land forms part of the Patrimonio Natural del Estado. For all the reasons stated above, the present action is dismissed in its entirety.
IX- REGARDING THE DEFENSES RAISED: INDER and El Estado raised the substantive defenses (excepciones de fondo) decided below: a) Lack of standing to sue and be sued (falta de legitimación activa y pasiva): The claimant has standing to sue INDER because he was the subject of an administrative eviction proceeding concerning plot 40 in Asentamiento Río Celeste, which is owned by that institution. INDER likewise has standing to be sued because it is the Public Administration responsible for processing and determining the claimant’s administrative eviction. Accordingly, the defense of lack of standing to sue and be sued raised by INDER is rejected; b) Lack of a legal right (falta de derecho): The claimant indeed has no right to occupy plot number 40 because it is owned by INDER and forms part of the Patrimonio Natural del Estado. The claimant also has no right to recognition of improvements (mejoras) allegedly constructed on the land in question or to any form of compensation, because, as a bad-faith possessor and unlawful occupant of public-domain property (bienes de dominio público), he cannot claim recognition of any right to compensation arising from his illegitimate possession and occupation.
Lastly, the claimant’s right to due process was not violated. For all these reasons, the challenged resolution issued by the INDER Board of Directors is entirely valid, and the claimant has no right to seek its absolute nullity (nulidad absoluta). Consequently, the defense of lack of a legal right raised by INDER and El Estado, in its capacity as an interested third party (tercero interesado), is upheld.
X- REGARDING ATTORNEY’S FEES AND LITIGATION COSTS (COSTAS PERSONALES Y PROCESALES): Pursuant to Article 193 of the Código Procesal Contencioso Administrativo, and because this adjudicative body finds no valid grounds for an exemption from costs, the claimant is ordered to pay the attorney’s fees and litigation costs of these proceedings.
POR TANTO
The filing submitted by the claimant on 5 de noviembre del 2014 is declared inadmissible. The defense of lack of standing to sue and be sued raised by INDER is rejected. The defense of lack of a legal right raised by INDER and El Estado, in its capacity as an interested third party, is upheld. The present action is dismissed in its entirety. The claimant is ordered to pay the attorney’s fees and litigation costs of these proceedings.

SECCIÓN PRIMERA. SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ. ANEXO A. Goicoechea, a las quince horas del once de noviembre del dos mil catorce.
Proceso de conocimiento de juicio oral y público, interpuesto por Nombre40322 , mayor, divorciado de sus primeras nupcias, abogado y notario público, portador de la cédula de identidad número CED32031 y vecino de San José, Dirección407 , interviene como abogada del actor la Licenciada, María Isabel González Angulo , cuyas calidades no constan en el expediente, contra el Instituto Nacional de Desarrollo Rural (INDER, antiguo IDA), representado por sus apoderados especiales judiciales, Roderico Contreras Angulo, mayor, casado, abogado y notario público, portador de la cédula de identidad número CED32032 y vecino de Santa Ana y Diana Cristina Moraga Vásquez , mayor, abogada, portadora de la cédula de identidad número CED32033 y vecina de San Francisco de Dos Ríos, San José. Interviene como tercero interesado, el Estado , representado por la Procuradora Adjunta, Heilyn Sáenz Calderón, mayor, abogada, portadora de la cédula de identidad número CED17241 y vecina de San José.
RESULTANDO
1- En su escrito de demanda, la parte actora formuló las siguientes pretensiones, que se transcriben de forma textual: "PRIMERO: Se declare la nulidad del acto administrativo emitido por el IDA en el artículo 42 mencionado como violatorio de mis derechos. SEGUNDO: Se acoja el presente PROCESO DE NULIDAD DE ACTO ADMINISTRATIVO Y SU EJECUCIÓN. TERCERO: Se reconozca mi posesión como legal por cuanto el tiempo que tengo de poseer es desde Enero de 1985, es previo al que dice el IDA tiene de haber adquirido en 1988. CUARTO: En razón de lo establecido por el Código Civil artículo 509, se me cancele las mejoras hechas a la propiedad por tantos años, fundamentado en el artículo 509 del (sic) Condigo Civil. QUINTO: Se me exima de cualquier pago de costas en la presente acción por cuanto toda la acción se ha dado bajo el principio de buena fe. (sic) SEXTO: SE condene al IDA al pago de costas procesales de esta demanda por cuanto desde un principio actuó sin tener legitimación ni derecho." 2- Por escritos recibidos en este despacho el 5 de febrero y 20 de noviembre, ambas fechas del año 2013, la representación del Instituto Nacional de Desarrollo Rural (INDER, antiguo IDA), contestó la demanda, oponiéndose a la misma. Así como interpuso las excepciones de falta de derecho y falta de legitimación activa y pasiva. También, requirió que el actor sea condenado a ambas costas de este proceso.
3- En la audiencia preliminar realizada el 27 de mayo del 2013, el actor desistió de su demanda en contra del Estado. Asimismo, la representación estatal solicitó mantener al Estado como tercero interesado, solicitud que fue resuelta en esos términos por el juez tramitador.
4- En su calidad de tercero interesado, el Estado se pronunció con respecto a la demanda del accionante, oponiéndose a la misma. Asimismo, interpuso la excepción de falta de derecho.
5- En la audiencia preliminar efectuada el 28 de febrero del 2014, se ajustó la pretensión número uno, a efectos de se indicara que el acto administrativo impugnado es el artículo 42 de la sesión ordinaria número 043-2011, celebrada el 29 de noviembre del 2011, por la Junta Directiva del IDA (actualmente el INDER).
6- El 24 de octubre del 2014, se llevó a cabo el juicio oral y público.
7- En los procedimientos se han observado los términos y prescripciones de ley, y no se notan vicios u omisiones susceptibles de producir nulidad o indefensión a las partes. Se emite este fallo dentro del plazo indicado en el numeral 111, inciso 1, del Código Procesal Contencioso Administrativo, previa deliberación, por unanimidad, y de manera escrita por el juez ponente González Vílchez, con el voto afirmativo de los jueces Bolaños Salazar y Espinoza Salas.
CONSIDERANDO
I- IMPROCEDENCIA DEL ESCRITO PRESENTADO EL 5 DE NOVIEMBRE DEL 2014: El actor presentó el 5 de noviembre del 2014 (ver folios del 273 al 277 del expediente judicial), una serie de alegatos, los cuales no serán tomados en cuenta por este Tribunal, en el dictado de la presente sentencia. Esto debido a que ese escrito fue presentado una vez concluido el juicio oral y público (realizado el 24 de octubre del 2014), por lo que no formó parte del contradictorio. Además, se le recuerda a la parte actora, que con el juicio oral y público, concluye la posibilidad de las partes de expresar argumentos, y que es completamente improcedente y fuera de lugar, presentar escritos durante la fase de deliberación y redacción de la sentencia, únicamente, en esta fase procesal se puede presentar prueba para mejor resolver, cuando así es requerida por el Tribunal, o bien solicitada por alguna de las partes. No obstante, es evidente, que el escrito interpuesto el 5 de noviembre del 2014, no solicita ni aporta prueba para mejor resolver. Por lo tanto, es improcedente la presentación del escrito indicado.
II- HECHOS PROBADOS: Se tienen por demostrados los siguientes:
III- HECHO NO PROBADO: Se tiene por no demostrado el siguiente: 1) El actor no demostró en sede judicial que haya sido declarado beneficiario para adquirir parcelas del IDA (INDER) en el Asentamiento de Río Celeste, o en cualquier otro, así como que la Junta Directiva de la institución demandada le haya adjudicado la parcela número 40 del Asentamiento de Río Celeste y que el demandante haya suscrito con el IDA (INDER), un contrato de asignación de tierras (los autos).
IV- ARGUMENTOS DEL ACTOR: El actor viene solicitando en este proceso, principalmente, la nulidad de la sesión ordinaria número 043-2011, celebrada el 29 de noviembre del 2011, por parte de la Junta Directiva del IDA (INDER), mediante la cual, afirma el demandante, se inició un procedimiento de desalojo de la parcela 40 del Asentamiento Río Celeste, solicitado por la Oficina Subregional de Guatuso por recomendación de la Dirección de Asesoría Jurídica de la Región Huetar Norte, en su contra, debido a que, supuestamente, se le tuvo por comprobado una ocupación ilegal no reconocida por el IDA (INDER), de la Dirección4949 . Acusa que ese acuerdo de la institución demandada, omitió indicar cuales son los recursos procedentes, el órgano que los resolverá, el plazo y ante quién interponerlo, lo cual en criterio del accionante, transgrede el mandato legal del artículo 245 de la Ley General de la Administración Pública.
Asevera que dicho acuerdo, como acto final, nunca se le notificó por parte de la Secretaría General o la Junta Directiva del IDA como órgano decisor y jerarca de la institución. Estima que esa falta de notificación lo dejó en indefensión al no ponerle en conocimiento el contenido del acuerdo, así como no poder recurrir en tiempo y forma ese acto, violentando con ello el artículo 239 de la LGAP, ya que quien lo notificó fue el órgano director la Regional Huetar Norte, mediante resolución de las catorce horas con cuarenta minutos del veintiuno de febrero del dos mil doce, la cual adolece del mismo vicio de nulidad absoluta del acto final, debido a que no indicó los recursos procedentes, el órgano que los resolverá, el plazo y ante quien interponerlo, lo cual en su criterio viola el artículo 245 de la LGAP. Agrega que nunca se le puso en conocimiento la recomendación contenida en el oficio número DRHN-ALJ-0255-2011, suscrito por el Lic. Manrique Jiménez Castro, Asesor Jurídico Regional y el Ingeniero, Armando Montero Arce, Director Regional a.i. de la Dirección Regional Huetar Norte, dictamen que sirvió de fundamento sustancial para dictar el acuerdo impugnado de la Junta Directiva del IDA (INDER).
Sostiene que el acuerdo de la Junta Directiva de la Institución demandada, contiene un vicio de falta de motivación, por lo que contradice los artículos 136 inciso 1, literal a), e inciso 2 y 214 inciso 2 de la LGAP, debido a que ese acto final no motiva, no sustenta, no razona, no justifica lo ahí ordenado, ya que le impone obligaciones de desalojar una propiedad que está poseyendo desde 1985, donde estima que lo limitan, suprimen, y deniegan derechos subjetivos. Acota que ante la Subregional de Guatuso presentó varios escritos en los que se detallaba la razón de su posesión de parte de la parcela 40. No obstante, asevera que tanto en el escrito presentado el 25 de marzo del 2008, como el interpuesto el 1 de julio del 2011, nunca la Administración señaló la audiencia oral y privada que ordena el artículo 317 de la LGAP, dejándolo en su criterio en indefensión a no evacuarse la prueba ofrecida y no poder comprobar, explicar, detallar, fundamentar sus actos y derechos, por lo que existe una nulidad absoluta.
Reprocha que el acuerdo de la Junta Directiva que impugna, únicamente fue firmado por el Lic. Walter Ulate Calderón como Secretario General de la Junta Directiva del IDA, esto en criterio del accionante lo deja en indefensión, al no conocer los miembros colegiados presentes y ausentes en la votación y la conformación o no del quórum de ley, ya que considera que la lacónica frase "acuerdo aprobado por unanimidad" , no le da acceso a conocer sobre la competencia interna y subjetiva de las personas que conforman la Junta Directiva y sus asesores y sus posibles causales de abstención, recusación, impedimentos, y demás supuestos de hecho que causarían nulidad del acto y responsabilidades. Afirma que en la parte final del acuerdo impugnado se indica que el predio debe ser desalojado para ser trasladado al MINAET por constituir Patrimonio Natural del Estado, lo cual en su criterio lo torna absolutamente nulo el acto, su ejecución y todo el procedimiento administrativo, ya que no se sabe con certeza cuál de las dos instituciones está legitimada para actuar por los intereses en dicho desalojo.
Por otra parte, argumenta el demandante que en el año 1970 adquirió una propiedad ubicada en Río Celeste de Guatuso, con una cabida de 144 hectáreas que colindaba con sujetos privados. Añade que en los años 84-85, se enteró que el IDA, estaba realizando la parcelación que se llamaría Río Celeste, la cual incluyó por compra directa, la antigua finca de Nombre40324 , y que es terreno para agricultura, cuyos colindantes eran también sujetos privados. Afirma que el IDA hizo un acceso hasta su finca, para la obtención de las vigas que le eran indispensables, esto lo obligó a levantar dentro de su finca cercas para evitar no sólo la salida de ganado sino también para proteger el camino recién construido por el cual el IDA sacó todas esas vigas que esa institución necesitaba, las cuales carecía las tierras compradas a Nombre40324 y de las cuales él si tenía suficiente cantidad en sus propios repastos, bosques y áreas aledañas.
Estima el actor que tomando en cuenta lo anteriormente indicado, y con la presentación de documentos, planos, testimonios y declaraciones queda demostrado que tanto las tierras en las cuales él estaba asentado, así como las que el IDA adquirió del señor Nombre40324 , eran terrenos privados titulados y otros sin titular dedicados a la agricultura y la ganadería, cuyos colindantes eran propietarios privados. Enfatiza que esos terrenos no eran del Estado y que tampoco existían áreas destinadas o que formaran parte de parques o reservas nacionales en los años 85-86. Afirma que de conformidad con la certificación emitida por el Registro Público la parcela número 40 que el IDA señala que es de su propiedad, fue inscrita como tal en el Registro Público hasta 1988 y su plano se confeccionó hasta 1986, por lo que al momento que se hizo el camino por parte del IDA y el convenio con esa institución, esas tierras al parecer estaban en posesión del señor Nombre40324 , pero aún no habían sido inscritas, por lo que él comenzó a poseer esa porción de terreno por defensa, ya que el camino pasaba por una parte del río Samen que era su lindero natural por lo que tuvo que tomar medidas de protección para evitar que el ganado que tenía se saliera de su finca o fuera robado.
Sostiene que ha sido ocupante en forma pública, quieta, pacífica y a título de dueño desde 1985 y hasta la fecha, así como ha cuidado y protegido el terreno en sus fuentes hídricas, y le ha dado el mejor manejo de la misma. Reitera que en ese momento la posesión la realizó por y para protección de su finca titulada en el año de 1973, pero además esa porción de terreno que empezó a poseer a partir del año 84, no estaba inscrita a nombre de nadie y menos del IDA, era un terreno sin inscribir, por lo que estima que su posesión es un derecho que ha venido a violentar el IDA al acusarlo de ocupación ilegal. Afirma que es poseedor parcial de la porción de terreno que el IDA llama parcela 40. Reitera que tiene la posesión de ese terreno desde el año 1985 hasta hoy, y que la inscripción a nombre del IDA se efectuó tres años después que él iniciara el cuido, protección y rehabilitación de esa propiedad.
Manifiesta que el acto emitido por el IDA fue supuestamente a petición del MINAET, y esa situación generó una denuncia penal de la cual fue absuelto de toda pena y responsabilidad, por cuanto nunca se demostró por parte del MINAET ni del IDA los hechos denunciados, así como no pudieron probar que su posesión fuera ilegal, ni que ese terreno que posee desde 1985 sea Patrimonio Natural del Estado. Sostiene que con todas las prueba aportadas se comprueba que su posesión ha sido de buena fe y por ello realizó edificaciones y muchas mejoras para la conservación de ese terreno, por ello solicita la aplicación del artículo 509 del Código Civil. Por todas esas razones solicita el actor que se declare con lugar en todos sus extremos la presente demanda.
V- ARGUMENTOS DEL INDER (ANTIGUO IDA): El INDER alega en su defensa que el acuerdo impugnado por el accionante emitido por la Junta Directiva del INDER, es conforme a derecho. Indica la institución demandada que se demostró que el actor mantiene una ocupación ilegal de la parcela número 40 del Asentamiento Campesino Río Celeste, la cual corresponde a la finca inscrita con matrícula número Placa7396, a nombre del INDER, y esto fue lo que se resolvió en el acuerdo cuestionado de la Junta Directiva, el cual se sustentó en un oficio elaborado por la Asesoría Jurídica de la Dirección Región Huetar Norte, que determinó la ocupación ilegal y que ese terreno constituye Patrimonio Natural del Estado, el cual debe ser trasladado al MINAET, según recomendaciones de la Contraloría General de la República. Sostiene que no es cierto que en ese acuerdo de la Junta Directiva del INDER, se haya iniciado un procedimiento administrativo de desalojo, sino más bien, con el mismo lo que se hizo fue acordar el desalojo.
Señala que en el acuerdo cuestionado, no se indican los recursos que pueden interponerse para atacarlo, no obstante, se dictó una resolución para notificarle lo resuelto por la Junta Directiva, la cual se le comunico el 21 de febrero del 2012, al Bufete Montero, tal y como lo había solicitado él mismo. Manifiesta el representante de la demandada, que el actor reconoce que se le notificó el acuerdo de la Junta Directiva, pero alega indefensión porque la notificación la realizó el órgano director del procedimiento de la Región Huetar Norte y no la Secretaría General o la Junta Directiva del INDER. Sin embargo afirma que la notificación se le hizo por medio del número de fax que él mismo indicó, por ello estima que la notificación si se realizó de manera efectiva. Afirma que el oficio DRHN-ALJ-0255-2011, corresponde al informe preparado por la Asesoría Jurídica de la Dirección de la Región Huetar Norte, mediante el cual se recomendó a la Junta Directiva acoger la solicitud de desalojo del actor por ocupar ilegalmente la Dirección4951 , con base en ese informe la Junta Directiva tomó el acuerdo cuestionado, por ello estima la demandada no corresponde a un acto final que deba ser notificado al actor, y por esa razón no se causó indefensión al demandante.
Plantea que el acuerdo impugnado si esta motivado y justificado, ya que se encuentra demostrada ocupación ilegal de la parcela por parte del actor, la cual no es reconocida por el IDA. Acota que el referido terreno está inscrito a nombre del IDA y que además debe ser desalojado porque por sus características debe ser traspasado al MINAET al ser un bien que es parte del Patrimonio Natural del Estado. Rechaza las afirmaciones realizadas por el actor, al señalar que está en posesión legal del predio desde 1985, y que se le están suprimiendo sus derechos subjetivos, debido a que la única posesión reconocida por el IDA es aquella que se origina con el cumplimiento de todos los requisitos establecidos en la Ley de Tierras y Colonización y en el Reglamento de Selección de Beneficiarios. Argumenta que los solicitantes de tierra, tienen que iniciar sus gestiones a través de una solicitud que hagan ante el IDA, cuyo trámite puede iniciarse en cualquier oficina del país, presentando todos los requisitos que exige la Ley de Tierras y Colonización y el Reglamento de Selección de Beneficiarios.
Explica que el solicitante que cumpla con todos los requisitos, la Junta Directiva del IDA lo declarará beneficiario de los programas de dotación de tierras, posteriormente, cuando ya se tenga disponible un predio para ese solicitante declarado beneficiario, la misma Junta Directiva, por medio de otro acuerdo específico, lo declarará adjudicatario. Señala que es a partir de la declaración de adjudicatario que el solicitante de tierra puede ingresar legalmente a un predio del IDA, y también, a partir de ese momento es que el adjudicatario firma con el INDER un contrato provisional de asignación de tierras, en el cual se establecen los deberes y obligaciones de cada una de las partes. Señala que de cualquier otra forma que se haya ingresado a una parcela del IDA, se considera que es ilegal. Por ello estima la demandada, que si el actor hubiese presentado ante este despacho judicial, los dos acuerdos emitidos por la Junta Directiva del IDA, así como el contrato provisional de asignación de tierras, y luego se le desalojara, entonces si podría considerarse que se le está suprimiendo, limitando o denegando derechos subjetivos.
Afirma que el argumento del actor de que llegó a un acuerdo verbal con altos funcionarios del IDA, para ingresar a la parcela 40, es sumamente difícil que haya sucedido, no obstante, considera que en el caso de si fuere así, se estaría en presencia de un acto absolutamente nulo, pues la ley no tiene establecido ese procedimiento para adjudicar bienes del IDA a los beneficiarios. Indica que los escritos presentados por el accionante el 25 de noviembre del 2008 y el 1 de julio de 2011, en los cuales el demandante se refirió a la primera y segunda intimación que le hizo el IDA, efectivamente, ofreció prueba documental y testimonial de descargo, así como declaraciones juradas de personas de la comunidad. Sostiene que consta en los expedientes administrativos que el IDA le valoró y resolvió al actor los alegatos presentados en los dos escritos indicados anteriormente. Afirma que el IDA no entró a evacuar las pruebas testimoniales ofrecidas, debido a que la única prueba válida para demostrar que la posesión del actor es legal, es la prueba documental idónea, que serían los acuerdos de la Junta Directiva del IDA, mediante los cuales se hubiesen nombrado al demandante beneficiario y adjudicatario, así como el contrato provisional de asignación de tierras.
Reitera que al actor nunca se le dejó en estado de indefensión, ya que éste respondió las dos intimaciones que se le hicieron, realizó sus alegatos y ofreció prueba, no obstante, para ambos descargos el IDA hizo la valoración pertinente y le respondió indicándole que la única prueba idónea que puede sustentar una posesión legal dentro del inmueble inscrito en el Registro Nacional a nombre del IDA, serían los acuerdos emitidos por la Junta Directiva en los cuales conste el cumplimiento de los procedimientos y requisitos que establece la Ley de Tierras y Colonización y el Reglamento Autónomo para la Asignación de Solicitantes de Tierras. Enfatiza que el motivo por el cual se continuó con el trámite de desalojo, fue porque la prueba presentada no es la idónea para justificar o sustentar la posesión dentro del inmueble en cuestión. Sostiene que el actor nunca se sometió al estudio de selección de beneficiarios para ver si cumplía o no los requisitos exigidos para que un administrado sea declarado beneficiario, así como tampoco, presentó el contrato provisional de asignación de tierras.
Por ello, afirma la institución demandada que el actor es un ocupante ilegal, ya que no cuenta con un solo documento emitido por el IDA que ampare la posesión que detenta. Estima la accionada, que la audiencia oral y privada está prevista para los procedimientos administrativos ordinarios regulados en la LGAP. Señala que en este caso no se inició propiamente un procedimiento administrativo, ya que únicamente se le hizo saber al actor, por medio de dos intimaciones, que se encuentra ocupando un inmueble que es propiedad del IDA y si tenía alguna prueba idónea para justificar su posesión, para que la presentara. Por lo tanto, al no presentar la prueba idónea el IDA estaba en la obligación de continuar con el trámite de desalojo administrativo. Sostiene que el actor no puede pretender que al no evacuarse la prueba ofrecida se le haya dejado en estado de indefensión, ya que el IDA sí valoró la prueba aportada, la cual consideró que no era la idónea para justificar la posesión que detenta.
Reprocha que el actor fue debidamente notificado del acuerdo de la Junta Directiva impugnado, por ello si consideraba necesario conocer los detalles de los miembros de dicha Junta, presentes y ausentes, así como la forma en que cada uno votó, pudo haber gestionado esa información, ya que siempre tuvo la libertad de conocer el expediente administrativo. Estima que consta en los expedientes administrativos, que el actor tuvo libre acceso al expediente, incluso, impugnó todo lo que consideró pertinente y el IDA le notificó todo lo correspondiente. Por las razones expuestas solicita la institución demandada que se rechace en todos sus extremos esta demanda.
VI- ARGUMENTOS DEL ESTADO EN SU CALIDAD DE TERCERO INTERESADO: El Estado en su calidad de tercero interesado afirma que la parcela número 40 del Asentamiento Río Celeste está inscrita en el Registro Público a nombre del INDER, y por ello dicha institución inició un procedimiento de desalojo administrativo sobre dicha parcela contra el actor. Sostiene que en el oficio número DRHN-ALJ-0255-2011, señala que la parcela 40 del Asentamiento Río Celeste se considera reserva por la presencia de redes hídricas y topografía boscosa. Manifiesta la representación estatal, que la jurisprudencia es reiterada en el sentido de que el patrimonio natural del Estado no requiere una declaratoria, sino que basta cumplir con las características propias de esa naturaleza para que el Estado tenga la obligación de brindar la protección debida. Estima que la parcela 40 es patrimonio natural del Estado y por lo tanto debe ser trasladada al MINAET, como adecuadamente lo acordó la Junta Directiva del INDER, en el acuerdo que el actor viene impugnando.
Apunta que el demandante no demostró tener algún derecho que lo faculte a ocupar la parcela número 40 inscrita a nombre del INDER. Por esas razones solicita a este Tribunal que se desestimen en todos sus extremos cualquier solicitud de derechos no autorizados o que afecten el régimen especial del patrimonio natural del Estado, al no ser procedente reconocer en sentencia ningún derecho a particulares sobre bienes titulados a nombre del IDA y que constituyen bienes demaniales.
VII- OBJETO DEL PROCESO: De conformidad con los argumentos, escritos y orales, expuestos por las partes intervinientes en este proceso, este órgano jurisdiccional determina que el objeto del presente asunto se suscribe a establecer si en el procedimiento de desalojo administrativo, tramitado por el INDER contra el actor, se violó o no el derecho de defensa y el debido proceso, así como analizar si la posesión del actor sobre la parcela número 40 del Asentamiento Río Celeste, es legal o ilegal. Con ello se verá si el acuerdo tomado por la Junta Directiva del IDA, en el artículo número 42 de la sesión ordinaria 043-2011, celebrada el 29 de noviembre del 2011, se ajusta o no a derecho.
VIII- EL ARTÍCULO N° 42 DE LA SESIÓN ORDINARIA 043-2011 DEL 29 DE NOVIEMBRE DEL 2011, ES UN ACTO CONFORME A DERECHO. INEXISTENCIA DE VIOLACIONES AL DEBIDO PROCESO. POSESIÓN ILEGAL DEL ACTOR DE LA PARCELA 40: Este Tribunal considera que el artículo número 42 de la sesión ordinaria 043-2011 de la Junta Directiva del INDER (IDA), celebrada el 29 de noviembre del 2011, así como todos los actos que constituyeron el procedimiento de desalojo administrativo del actor de la parcela número 40 del Asentamiento Río Celeste, se emitieron conforme a derecho y sin violar el derecho de defensa del demandante, así como el debido proceso. Además, estima este Tribunal que la ocupación del demandante de la indicada parcela es completamente ilegal. Las afirmaciones anteriores se sustentan en las siguientes razones: 1) Es un hecho probado que el inmueble matrícula Placa7395, del Partido de Alajuela, situado en el Dirección4792 , , cantón 15, Guatuso, es propiedad del Instituto de Desarrollo Agrario, el cual corresponde con la parcela número 40 del Asentamiento Río Celeste.
Precisamente, este hecho no ha sido desvirtuado por el actor en ningún momento, ya que ha venido aceptando, tanto en sede administrativa como en esta instancia jurisdiccional, que ese terreno le pertenece al INDER (IDA). Ahora bien, el demandante alega que él entró en posesión de ese inmueble antes de que la institución demandada lo adquiriera a partir de 1988, y que antes le pertenecía, aparentemente, al señor Nombre40324 , incluso, llega a contra decirse el accionante en sus argumentos al indicar que tampoco estaba inscrito ese terreno a nombre de alguna persona antes de que el INDER lo adquiriera. Sin embargo, nótese, que el actor acepta, nuevamente, que ese terreno fue adquirido por el INDER, y que él lo ocupó. Esto significa para este Tribunal que el actor ingresó al terreno en cuestión, conociendo desde un inicio que le pertenecía al INDER. Esto, como se explicará, es un elemento que determina que no existió buena fe por parte del actor al ocupar el inmueble propiedad de la institución demandada.
Por otra parte, el demandante no demuestra que ocupara ese inmueble antes de la adquisición que el INDER hizo de éste, así como quién era su dueño anterior, o si no tenía propietario inscrito, todos esos alegatos no tienen ningún sustento probatorio. Además, considera este órgano colegiado que son irrelevantes esos hechos, debido a que lo importante en este caso es que el actor ocupó un inmueble inscrito registralmente a nombre del INDER, y que desde un inicio de la ocupación del demandante, éste tenía pleno conocimiento de que era una propiedad que no le pertenecía, y que la misma estaba sujeta a los programas de titulación de tierras que son uno de los fines públicos y notorios que cumple la institución demandada. Por ello, este Tribunal constata de manera evidente y manifiesta que la ocupación del actor de la Dirección4949 , es y ha sido, abiertamente ilegal desde un inicio; 2) Ahora bien, se tiene por acreditado que el 26 de setiembre del 2008, por oficio número OSG-0867-2008, el señor Carlos González Rodríguez, Jefe de la Oficina Subregional de Guatuso del IDA, le informó al Ingeniero Alexander León Campos, Jefe Subregión Bagaces Miravalles del Ministerio del Ambiente y Energía, en lo penitente para el dictado de esta sentencia lo siguiente:
"En atención a lo indicado en el oficio ACAT-SBM-OB-087-08, en relación (sic) la solicitud de desahucio administrativo del área invadida del asentamiento Río Celeste por el señor Nombre40322 , (...) me permito indicar lo siguiente: Analizado el caso por el Asesor Legal se procederá a efectuar las intimaciones correspondientes según lo establecido en el procedimiento administrativo, con el propósito de persuadir al ocupante para que desocupe dicha área, caso contrario se iniciará el proceso de desalojo." Nótese, que el oficio citado, prueba que el MINAET, detectó que el actor invadía un área del Asentamiento Río Celeste, y por ello le solicitó al Jefe de la Oficina Subregional de Guatuso del IDA (INDER), que analizara esa situación. Precisamente, la indicada oficina informó que realizaría las intimaciones correspondientes a efectos de que el demandante desocupara ese terreno o realizaría el desalojo administrativo.
Este Tribunal tiene claro que el INDER no tuvo conocimiento de la ocupación que hiciera el accionante del terreno en cuestión hasta que fue alertado por el MINAET. No obstante, el hecho de que la institución demandada no supiera que por varios años el actor ocupó un inmueble de su propiedad, esto no legaliza o legitima su posesión sobre ese terreno, ya que cabe recordar que ese predio es parte de un Asentamiento del INDER (IDA), es decir, fue adquirido para cumplir fines públicos (parcelación y asignación de tierras), así como es patrimonio natural del Estado, como se analizará con más detenimiento a lo largo de esta sentencia. Todo ello significa que el terreno en cuestión es un bien público el cual está fuera del comercio, como lo dispone el numeral 262 del Código Civil, por lo que la acción del INDER (IDA), para proteger esta parcela es imprescriptible e irrenunciable y puede ser ejercida en cualquier momento, como precisamente sucedió en este asunto, que debido a una comunicación del MINAET, la institución demandada, emprendió el procedimiento de desalojo administrativo; 3) Justamente, está probado que el 12 de noviembre de 2008, por oficio OSG-1000-2008, se le realizó al actor una primera intimación por parte de la Oficina Subregional de Guatuso, en la cual se le indicó en lo pertinente para esta resolución lo siguiente:
"De conformidad a inspección de campo realizada el día 12 de febrero del año 2008, esta oficina comprobó que usted se encuentra ocupando en forma ilegal la parcela número 40 del Asentamiento Campesino Río Celeste, el cual es propiedad del Instituto de Desarrollo Agrario." Asimismo en este mismo documento se le previno al demandante que se abstuviera de introducir cualquier tipo de mejora en ese inmueble y se le confirió el plazo de cinco días hábiles para que se presentara a la Asesoría Legal del IDA con el Lic. Manrique Jiménez Castro, así como para presentar toda la prueba de descargo y hacer uso de su derecho de defensa. También, se le indicó señalar un lugar para oír notificaciones bajo el apercibimiento de que en caso de incumplimiento las resoluciones se le tendrían por notificadas en el transcurso de veinticuatro horas. Ahora bien, de esta primera intimación realizada por la institución accionada, este órgano jurisdiccional destaca los siguientes aspectos de interés: Primero: Nótese, que por una inspección de campo realizada el 12 de febrero del 2008, la propia Oficina Subregional de Guatuso, pudo constatar lo mismo que se le informó por parte de los funcionarios del MINAET de esa misma zona, de que el actor se encontraba ocupando una parcela propiedad del INDER.
Esto significa, que la ocupación ilegitima del demandante no sólo fue constatada por el MINAET, sino por los propios funcionarios del INDER; Segundo: Se le otorgó cinco días al demandante para que presentara su prueba de descargo, directamente, ante la Asesoría Legal del INDER, así como señalara medio para atender notificaciones. Es evidente que con este proceder del INDER, se le respetó al accionante su derecho de defensa. En ese mismo sentido, se tiene como un hecho probado que el 25 de noviembre del 2008, el actor presentó ante el Lic. Manrique Jiménez Castro, Asesor Legal de la Región Huetar Norte del IDA, un escrito mediante el cual contestó la intimación que se le efectuó en el oficio OSG-1000-2008, manifestando en lo relevante para el dictado de esta sentencia lo siguiente:
"(...) Ante esta situación que yo les planteara como un problema que me quedaba en mi contra se me ofreció que esta pequeña sección del IDA 4 o 6 hectáreas conocida como parcela 40 quedara bajo mi dominio pleno,(...) Esta área que me (sic) fué entregada como parte de este trueque o trato que se ha mantenido hasta la fecha lo era para mi mejor disposición y uso, y es de aproximadamente de 4 a 6 hectáreas en total, que yo calculo pues no se hizo en ese momento ni levantamiento del plano ni firma alguna. No se firmó ningún papel, (sic) fué un trato de caballeros (...) Las instalaciones son las mismas que existen actualmente sobre el área o lote cedido a mi persona desde 1986 por el IDA, que fueron conocidas a partir de esos momentos y circunstancias como MAGIL FOREST LODGE. (...) he mantenido la pequeña área que me fuera entregada en la (sic) mejor de los cuidos que se le podía dar tanto en área de caminos como al sector de naturaleza que me fuera entregada. (...) faltando solo el formalizar el traspaso de esta pequeña parcela número cuarenta a mi favor (...)"
Asimismo en este escrito, el actor aportó prueba de descargo, así como señaló para notificaciones un número de fax y un correo electrónico. Véase que desde que comenzó el procedimiento de desalojo, el actor acepta los siguientes hechos: a) Que la parcela 40 era propiedad del IDA (INDER), y que conocía de esa situación al momento de ocupar esa porción de terreno; b) Que ingresó a ese predio por un supuesto, "trato" o "trueque", que no consta por escrito; c) Que realizó sobre ese inmueble actividades turísticas, no propiamente actividad agraria; d) Que ese terreno tiene un sector de "naturaleza". Todos estos hechos aceptados por el propio actor desde un principio, producen los siguientes efectos jurídicos: Primero: El actor al conocer desde que ingresó a la parcela que ésta no era de su propiedad, así como tener ese conocimiento a lo largo de todo el procedimiento de desalojo administrativo, incluso en esta instancia jurisdiccional, cumple la condición de poseedor de mala fe, en los términos que indica el artículo 285 del Código Civil, que dispone:
"ARTÍCULO 285.- En todos los casos en que la ley exige posesión de buena fe, se considera poseedor de buena fe al que en el acto de la toma de posesión creía tener el derecho de poseer. Si había motivo suficiente para que dudara corresponderle tal derecho, no se le debe considerar como poseedor de buena fe; pero si la posesión fuere de buena fe en su principio, no pierde ese carácter por el solo hecho de que el poseedor dude posteriormente de la legitimidad de su derecho. Cesa de ser de buena fe la posesión en el momento de adquirir la certidumbre de que se posee indebidamente, y cesa también desde la notificación de la demanda en que otro reclame el derecho de poseer." Precisamente, en este caso el actor siempre tuvo certidumbre o certeza de que su posesión era indebida. Por ello desde la propia óptica del Derecho Civil el actor es un poseedor de mala fe, y desde la perspectiva del Derecho Administrativo, un ocupante ilegal de un bien de dominio público.
En ambos escenarios el demandante no tiene ningún derecho subjetivo ni interés legítimo sobre la parcela 40. Lo anterior tiene la consecuencia que al accionante tampoco se le pueden reconocer mejoras efectuadas en esa propiedad, así como es improcedente la aplicación del artículo 509 del Código Civil, el cual está dispuesto para los casos de derechos de accesión respecto a inmuebles construidos en terreno ajeno, que no es el supuesto de este caso. Además, al actor le debe quedar claro que la posesión de mala fe no da derechos indemnizatorios, mucho menos cuando la propiedad es un bien de dominio público; Segundo: El ingresó a ese predio por un supuesto, "trato" o "trueque", no escrito, es una manera ilegal de adquirir una parcela del INDER. Justamente, este Tribunal concuerda con los argumentos expuestos por el INDER en este tema, debido a que la adquisición de una parcela perteneciente a la institución demandada, por medio de un trueque por un favor, convenio oral, inclusive, en el supuesto que ese acuerdo existiera por escrito, sería una forma completamente ilegal de adquirir una parcela destinada a la actividad agrícola, esto debido a que la Ley de Tierras y Colonización y el Reglamento Autónomo para la Adquisición de Tierras, establecen el marco normativo que regula los requisitos y el procedimiento para adjudicar tierras pertenecientes al INDER, el cual dispone que se deben seguir los siguientes pasos: a. Solicitar la adjudicación de tierras; b. Declaratoria de la Junta Directiva del INDER de cumplir los requisitos para ser beneficiario de los programas de asignación de tierras; c. Declaratoria de la Junta Directiva del INDER, de adjudicación de una parcela y d. Firma del contrato provisional de asignación de tierras.
Precisamente, el actor no demostró en esta sede judicial que haya sido declarado beneficiario para adquirir parcelas del IDA (INDER) en el Asentamiento de Río Celeste, o en cualquier otro, así como que la Junta Directiva de la institución demandada le haya adjudicado la parcela número 40 del Asentamiento de Río Celeste y que haya suscrito con el IDA (INDER), un contrato de asignación de tierras. Por ello, tiene razón el INDER al señalar que cualquiera de las razones que el actor alega como causa de su ingreso y ocupación de la parcela número 40 (defensa de su antigua finca, medidas de protección para evitar que su ganado se saliera de su antigua propiedad, acuerdo verbal con el IDA), son ilegales, ya que sólo cumpliendo los requisitos y procedimientos indicados anteriormente, es la única forma que el actor pudo haber adquirido y ocupado esa parcela de manera legítima, las otras razones son completamente ilegales; Tercero: El demandante acepta que durante estos años realizó sobre la parcela 40 actividades turísticas, esto también es una ilegalidad evidente, ya que el predio en cuestión originalmente fue adquirido por el INDER para realizar actividades agrarias, posteriormente, se determinó la presencia de cobertura boscosa y fuentes hídricas, que lo constituyen en patrimonio natural del Estado.
Estos destinos del predio fueron violentados con la posesión ilegal del actor, agravada, por realizar actividades para las cuales no estaba destinado ese terreno; Cuarto: Por último, el accionante acepta que en ese inmueble existen sectores de "naturaleza", con lo cual viene reconociendo lo mismo que en el juicio oral y público realizado ante este Tribunal el 24 de octubre del 2014, señalaron los testigos Nombre40323 , Manrique Jiménez Castro y Kender Gerardo Aguilar Jiménez, al declarar que la parcela 40 tiene cobertura boscosa. Esto es prueba suficiente para que este Tribunal acepte la tesis del Estado, de que esa parcela constituye patrimonio natural del Estado. Ahora bien, la contestación del accionante a la primera intimación fue adecuadamente tramitada y resuelta por el INDER. Lo anterior debido a que se tiene por demostrado que el 28 de noviembre del 2008, por oficio número DRHN-ALJ-387-2008, el Lic. Manrique Jiménez Castro, Asesor Legal de la Región Huetar Norte del IDA, le solicitó al Ingeniero Carlos González Rodríguez, Jefe de la Oficina Subregional de Guatuso, valorar y dar una recomendación respecto a lo dicho por el actor en el escrito presentado el 25 de noviembre del 2008.
A su vez, es una hecho probado que el 18 de diciembre del 2008, por oficio OSG-1128-2008, el Jefe de la Oficina Subregional de Guatuso recomendó al Lic. Manrique Jiménez Castro, Asesor Legal de la Región Huetar Norte del IDA, respecto al caso del accionante, que no existe expediente, documento o legajo que demuestre que la ocupación del demandante de la parcela 40 este legalmente reconocida por el IDA. Asimismo, recomendó que se le diera un plazo al actor para que presentara los documentos que lo acreditan como poseedor legal de la parcela 40, de lo contrario, se procediera conforme a derecho corresponde para los casos de ocupación ilegal no reconocida por el IDA. Precisamente, siguiendo la recomendación de la Oficina Subregional de Guatuso, el 30 de enero del 2009, mediante oficio DRHN-ALJ-0021-2009, el Lic. Manrique Jiménez Castro, le remitió copia del oficio OSG-1128-2008, al actor, así como le otorgó el plazo de un mes calendario al demandante a efecto de que éste cumpliera con lo solicitado en dicho oficio, de lo contrario, se le iniciaría el proceso administrativo de desalojo como lo establece la Ley 2825 y sus reformas.
El oficio indicado se le notificó al actor el 31 de enero del 2009. Nótese, que el INDER le dio al actor un nuevo plazo para que presentara la única prueba idónea para demostrar que la ocupación de la parcela 40, era legítima. Justamente, el 27 de febrero del 2009, el actor presentó escrito ante la Dirección Huetar Norte del IDA, mediante el cual se refirió a lo resuelto y recomendado en el oficio OSG-1128-2008, por parte del Jefe de la Oficina Subregional de Guatuso. Asimismo, aportó prueba de descargo, dentro de las cuales no presentó documento que comprobara el supuesto acuerdo de "caballeros" por el cual ocupó la parcela 40. Véase que el actor en este escrito, volvió a presentar la misma prueba que ofreció con su escrito de contestación de la primera intimación, que fueron declaraciones juradas, documentación que hace referencia a la instalación de electricidad en el terreno, entre otras.
No obstante, no presentó ni siquiera algún documento que probara el llamado "trato" o "pacto de caballeros", y mucho menos los documentos que lo acreditaran como beneficiario del IDA, un acuerdo de adjudicación de la parcela a su favor, o el contrato provisional de adquisición de tierras, únicos documentos y pruebas idóneas que el demandante podía aportar para demostrar la legalidad de su ocupación de la parcela 40. Precisamente, por lo anterior es que el 4 de mayo de 2009, por oficio DRHN-ALJ-0118-2009, el Lic. Manrique Jiménez Castro, Asesor Legal de Dirección Regional Huetar Norte, le indicó al actor lo siguiente:
"Con el respecto y la consideración de siempre, le manifiesto que hemos recibido y analizado su escrito, de fecha 24 de febrero de 2009, el cual hace referencia al oficio OSG-1000-2008, de la Oficina Suregional de Guatuso, al respecto debo manifestarle que las consideraciones aportadas en dicho memorial, no son de recibo, toda vez que el oficio al que usted hace referencia, carece de recurso de apelación, debe tenerse presente que usted hizo uso del derecho de defensa, una vez que se le (sic) intimo por la supuesta ocupación ilegal que realiza del predio de marras. Así las cosas la Oficina Subregional continuará con el debido proceso y presentará la recomendación correspondiente a la Junta Directiva, siendo ésta, la que le corresponde resolver si autoriza o no el desalojo promovido por la Oficina Subregional. Para los efectos correspondientes, en su momento se le notificará sobre la resolución de la Junta Directiva, cuya resolución cuenta con el derecho de apelación, a su favor." Este oficio le fue notificado a la parte actora el 5 de mayo del 2009.
Ahora bien, nótese que con el documento trascrito, al actor se le informó del procedimiento que se iba a seguir, el que consistiría en elaborar una recomendación a la Junta Directiva del INDER, para que este órgano colegiado determinara si el desalojo era o no procedente, así como se le indicó que ese acuerdo se le notificaría en su momento. Incluso, se tiene por acreditado que el 15 de mayo del 2009, el actor presentó ante la Dirección Huetar Norte del IDA, un escrito mediante el cual realiza una serie de manifestaciones respecto a lo indicado en el oficio DRHN-ALJ-0118-2009. Por lo anterior, es evidente para este Tribunal, que desde la primera intimación que se le realizó al actor, el INDER le dio varias oportunidades para ejercer su derecho de defensa, y es claro que el demandante contestó cada audiencia que se le dio por parte de la institución demandada, teniendo todas las posibilidades de presentar sus alegatos y las pruebas de descargo.
Lamentablemente, el demandante nunca, se insiste, presentó los documentos idóneos (acuerdos de la Junta Directiva, declarándolo beneficiario y otorgándole la parcela 40 con su respectivo contrato provisional de asignación de tierras), sino que presentó prueba documental y testimonial completamente impertinente y carente de idoneidad. Justamente, debido a la falta de documentos idóneos que probaran que el actor ocupaba legítimamente la parcela 40, fue que el 22 de mayo del 2009, por oficio número DRHN-ALJ-0134-2009, el Lic. Manrique Jiménez Castro, Asesor Legal de la Dirección Regional Huetar Norte, le indicó al Ingeniero Carlos González Rodríguez, Jefe de la Oficina Subregional de Guatuso, que el actor no presentó los documentos que se le requirieron en el plazo otorgado de un mes calendario que lo acreditaran como ocupante legal de la parcela 40, por lo que le recomendó iniciar los trámites administrativos de desalojo; 4) Los hechos descritos y analizados anteriormente datan del año 2008 y 2009, y pese a que ya se había intimado al actor de que probara su derecho en la parcela 40, éste se había defendido, e incluso, la Asesor Legal de la Dirección Regional Huetar Norte le recomendó a la Oficina Subregional de Guatuso, iniciar los trámites de desalojo del actor de la parcela 40, nuevamente el 24 de junio de 2011, por oficio número OSG-508-2010, se le realizó al actor una segunda intimación por parte de la Oficina Subregional de Guatuso, en la cual se le indicó en lo pertinente para esta resolución lo siguiente:
"De conformidad a inspección de campo realizada, el día 22 de junio de 2011 ésta oficina comprobó que usted se encuentra ocupando en forma ilegal la parcela número 40 del Asentamiento Campesino (sic) Rio Celeste, la cual es propiedad del Instituto de Desarrollo Agrario" Nótese, que nuevamente el INDER realizó en el año 2011, una nueva inspección de campo a la parcela 40, y volvió a constatar la ocupación ilegal de la misma por parte del accionante. Asimismo, en este mismo documento se le previno, una segunda vez, al demandante que se abstuviera de introducir cualquier tipo de mejora en ese inmueble y se le confirió el plazo de cinco días hábiles para que se presentara a la Asesoría Legal del IDA con el Lic. Manrique Jiménez Castro, así como para que aportara toda la prueba de descargo y hacer uso de su derecho de defensa. También, se le indicó señalar un lugar para oír notificaciones bajo el apercibimiento de que en caso de incumplimiento las resoluciones se le tendrían por notificadas en el transcurso de veinticuatro horas.
Esta segunda intimación se le notificó al actor el 24 de junio del 2011. Ahora bien, el 1 de julio del 2011, el actor presentó escrito ante la Dirección Regional del IDA, mediante el cual hizo referencia a la segunda intimación realizada en el oficio número OSG-508-2010, ratificando el escrito del 25 de noviembre del 2008, así como expuso sus argumentos y presentó prueba documental y testimonial. Véase que el actor tuvo una nueva oportunidad de demostrar por medio de la documentación idónea que se ha señalado líneas atrás, su derecho de ocupación de la parcela 40. Sin embargo, volvió a repetir los mismos argumentos y las mismas pruebas que había presentado en la primera intimación que se le realizó en el año 2008. Por esa razón el 5 de julio del 2011, mediante oficio número OSG-533-2011, suscrito por los señores Kender Aguilar Jiménez, Agrarista de Guatuso y Carlos González Rodríguez, Jefe Subregional de Guatuso, ambos funcionarios de la Oficina Subregional de Guatuso del IDA, solicitaron al Lic. Manrique Jiménez Castro, Asesor Legal de la Región Huetar Norte del IDA, tramitar el desalojo de la parcela 40 del Asentamiento Campesino de Río Celeste, contra el actor, por estimar que éste se encuentra ocupando dicha parcela de manera ilegal.
Asimismo, se adjuntaron copias de las intimaciones realizadas al accionante por parte de la Oficina Subregional del IDA; la primera intimación del 12 de noviembre del 2008, oficio OSG-1000-2008, y la segunda, oficio OSG-508-2011 de junio del 2011. Ahora bien, se insiste, que es evidente en este caso que el accionante tuvo varias oportunidades para demostrar su derecho sobre la parcela 40. No obstante, en todas las audiencias que el INDER le confirió al actor, éste las contestó presentando los mismos argumentos y pruebas, que incluso, fueron las mismas probanzas presentadas en esta instancia jurisdiccional. Por ello es improcedente el alegato del demandante de que en este caso se le violó su derecho de defensa y el debido proceso, ya que se le hicieron dos intimaciones en varios años, contestó las audiencias conferidas por la institución demandada, así como presentó la prueba de descargo.
Debido a lo anterior, el 19 de julio del 2011, por oficio número DRHN-ALJ-187-2011, el Lic. Manrique Jiménez Castro, Asesor Jurídico de la Dirección Regional Huetar Norte del IDA, le indicó al actor, en lo relevante para el dictado de esta sentencia, lo siguiente:
"Atento contesto su nota enviada a este despacho jurídico, en relación con la segunda intimación que le realizará la Oficina Subregional de Guatuso, oficio OSG-508-2011 notificada vía Fax a las 14 horas 09 minutos del 24 de junio del 2011. La cual de forma atenta usted ratifica y confirma. Sobre el escrito presentado por su persona, manifestarle como en otras ocasiones lo hemos indicado, que usted está ocupando la parcela número 40 del asentamiento Río Celeste, tiene un área de 7 ha 4482.36 m2 y es propiedad del Instituto de Desarrollo Agrario. De acuerdo al Informe de Fiscalización Agraria, de la Oficina Subregional de Guatuso, oficio OSG-512-2009, del 19 de agosto del 2009, la parcela 40 del asentamiento Río Celeste, esta nombrada por el IDA, como reserva y forma parte del Parque Nacional Volcán Tenorio, dicha reserva debe pasar a formar parte jurisdiccional dentro de los límites del Parque.
En relación con sus manifestaciones sobre el derecho que el IDA le otorgo sobre esa parcela, nuevamente le manifestamos que mientras no se demuestre, mediante el mecanismo idóneo como la adjudicación por medio de Acuerdo en firme de la Junta Directiva, cualquier otro medio o método es absolutamente nulo. Sobre las gestiones que usted está realizando ante la Presidencia Ejecutiva del Instituto de Desarrollo Agrario, no nos vamos a referir y esperamos que le resulten positivas, sin embargo le comunico que de acuerdo a nuestra responsabilidad institucional, continuaremos con el trámite de desalojo, cuyo informe presentaremos al conocimiento de los señores directores de la Junta Directiva del Instituto de Desarrollo Agrario, como ocurre en todos estos casos.(...)" De lo dicho en este oficio, este órgano jurisdiccional extrae las siguientes consideraciones: Primera: El actor tuvo la oportunidad de defender su posición ante la misma Asesoría Jurídica de la Dirección Regional Huetar Norte.
Asimismo, se le informa nuevamente que está ocupando la parcela número 40 de manera ilegal, así como se le indicó de forma reiterada, que no demostró que esa parcela la haya adquirido por los medios idóneos, como lo es la adjudicación de la misma por medio de acuerdo de la Junta Directiva del INDER, y que otras formas de adquisición son ilegales; Segunda: Le indicaron al demandante que la parcela 40 es reserva natural y que forma parte del Parque Nacional Volcán Tenorio. Además, se la indicó claramente que ese terreno se trasladaría a ese Parque. Respecto a este tema, el actor no presentó nunca prueba en contrario, por lo que es un hecho que ese terreno es Patrimonio Natural del Estado; Tercera: Nuevamente se le explicó cual es el trámite de desalojo que el INDER iba a continuar, así como se le indicó claramente, que se remitiría un informe a la Junta Directiva del INDER, para que ese órgano colegiado tomara la decisión.
Ahora bien, este último punto le comprueba a este Tribunal que el demandante siempre tuvo claro el procedimiento de desalojo que se le estaba tramitando, nunca fue un procedimiento sorpresivo para el actor, todo lo contrario, siempre estuvo informado de que se le seguía un desalojo administrativo y cuales eran las consecuencias de éste. Además, se le informó que la decisión de su desalojo sería tomada por la Junta Directiva de la institución demandada, y es evidente que pudo recurrir el acto final de ese órgano colegiado, sin necesidad de que se le indicará en el mismo acuerdo de la Junta Directiva que tenía derecho a impugnar ese acto final de desalojo; 5) Producto de las intimaciones, y de todo el trámite que durante varios años realizó la Oficina Subregional de Guatuso y la Asesoría Jurídica de la Dirección Regional Huetar Norte del INDER, fue que el 26 de octubre del 2011, por oficio número DRHN-ALJ-0255-2011, suscrito por el Lic. Manrique Jiménez Castro, Asesor Legal, y el Ing. Armando Montero Arce, Director, ambos funcionarios de la Dirección Regional Huetar Norte del IDA, le remitieron a la Junta Directiva del IDA, un análisis y recomendación respecto a la solicitud de desalojo del actor por ocupación ilegal de la parcela 40 del Asentamiento Campesino Río Celeste. En lo pertinente para el dictado de esta resolución, se señaló:
"Del análisis del expediente administrativo DES-425-2011-OSG-ALJ, correspondiente a la Parcela 40 del Asentamiento Río Celeste, se tiene que la ocupación que está realizando el señor: Nombre40322 , (...), de la citada parcela, es absolutamente ilegal, conclusión a la que se llega por los siguientes antecedentes: Como se puede apreciar en el expediente administrativo de la parcela 40 del asentamiento Río Celeste, (...), no existen antecedentes que confirmen la versión de los acontecimientos descritos y narrados por el Doctor Nombre40322 , que dan lugar a su ingreso a la parcela 40 de marras. Se puede observar que dicho expediente inicia con acciones del Ministerio del Ambiente y Energía, propiamente de los guardaparques del Parque Nacional Volcán Tenorio, adscritos al Área de Conservación Arenal Tempisque, quienes ante la denuncia presentada por la Sociedad Civil, por las anomalías de aprovechamiento ilegitimo de productos forestales, plantean una denuncia penal, ante la Fiscalía Auxiliar del Ministerio Público en Guatuso, contra el señor Nombre40322 , (...) quien explota irregularmente la parcela 40 del asentamiento Río Celeste, denominada como área de reserva forestal por el IDA, según manifestación de los funcionarios del MINAE, quienes aducen que ese predio, se resolvió trasladar al MINAE y agregarlo al Parque Nacional Volcán Tenorio, por constituir Patrimonio Natural del Estado.
Lo que confirma la oficina subregional, indicando que efectivamente la citada parcela está pendiente del traslado al MINAET. Ahora bien el MINAET solicita al IDA iniciar las gestiones de desalojo administrativo, toda vez que el predio está inscrito a nombre del Instituto de Desarrollo Agrario, pero paralelamente plantean la demanda penal ante la fiscalía, por la infracción a la Ley Forestal por parte del señor Nombre40322 , cuya causa aún no se ha resuelto en los estrados judiciales. A partir de la primera intimación es que el nombre de Nombre40322 , parece que empieza a conocerse en la Oficina Subregional y también los relatos de los trueques, pactos de caballeros, ayudas, etc., por lo menos así lo relatan los funcionarios de más años de trabajar allí. Ahora bien, todos conocen al señor Nombre40322 , como el doctor, abogado y notario, el empresario que era dueño de la Finca MAGUIL, y del conocido Hotel de Montaña que se escondía realmente en las montañas de Río Celeste.
Sin embargo el asunto de la parcela 40 del asentamiento Río Celeste, empieza a conocerse hasta que el Doctor Nombre40322 , pierde su finca por motivos que se desconocen y entonces se traslada con todo y su hotel a la parcela 40 del asentamiento Río Celeste. De lo dicho por la oficina subregional, nunca se ha dudado que el doctor Nombre40322 , se ha destacado como persona colaboradora y que ha apoyado con un sin número de proyectos al asentamiento Río Celeste, sin embargo, sobre la negociación que realizará con personeros del IDA en aquel entonces para la donación de madera para la construcción de puentes, que resultará con la oferta o trato de otorgarle el área de reserva o sea la parcela 40 del asentamiento Río Celeste, como forma de agradecimiento por su valioso aporte en el desarrollo de dicho asentamiento, es un asunto que pudo haberse dado, pues tampoco podemos dudar de la palabra del señor Nombre40322, sin embargo al no existir documentos como dice el doctor Nombre40322 , no se midió, ni se realizó ningún papel, porque fue un pacto de caballeros, bueno lamentablemente pudo haber sido un gran pacto de caballeros, sin embargo hoy ante esta situación, nos apena mucho la incertidumbre que padece en este tiempo el doctor Nombre40322 , sin embargo lo que ayer pudo haber sido considerado como un gran acto de cooperación, hoy sino se puede demostrar con documentos idóneos no se puede ni siquiera considerar, de hecho, esta parcela de bosque está en proceso para ser traspasada al MINAET, de acuerdo a la recomendación de la Contraloría General de la República en su dictamen, por otra parte la Ley Forestal 7575, nos obliga a trasladar las áreas de reserva o con bosque al dominio del MINAET, así las cosas y para concluir, si el doctor Nombre40322 , hubiese tenido en sus manos el respectivo acuerdo de Junta Directiva, que le otorgó la potestad para ocupar la parcela 40 del asentamiento Río Celeste, estaríamos en otra circunstancia, por lo tanto y hasta que no se demuestre lo contrario, la recomendación es recomendar el desalojo administrativo." Lo analizado, resuelto y recomendado en el oficio transcrito, este órgano jurisdiccional lo comparte plenamente, por las siguientes razones: Primera: Confirma que el demandante viene ocupando la parcela 40 de manera ilegal.
Esto por tres razones, la primera, se debe a que no demostró con documentos idóneos, como se ha explicado anteriormente, que el "trueque" o "pacto de caballeros" que el demandante, supuestamente, realizó con el INDER (antiguo IDA), efectivamente se haya realizado. En segundo lugar, se determina claramente en este informe que el actor invadió el terreno en cuestión, debido a que por razones desconocidas perdió su antigua finca. Esto concuerda plenamente con lo que el demandante ha venido narrando de lo sucedido en el momento que ingreso a la parcela 40. En tercer lugar, queda acreditado que fue el MINAET, el que alertó al INDER de la ocupación ilegal del actor, ya que ese terreno constituía Patrimonio Natural del Estado. Ahora bien, este Tribunal comparte plenamente la tesis del Estado de que no se necesita por parte del MINAET o el INDER de una declaratoria de que la parcela 40 del Asentamiento Río Celeste, es Patrimonio Natural del Estado, ya que la jurisprudencia de este Tribunal, confirmada por la Sala Primera de la Corte Suprema de Justicia, ha indicado:
"La Administración Pública no puede permutar, ceder, enajenar de ninguna manera, entregar o dar en arrendamiento, terrenos rurales de su propiedad o bajo su administración, sin que antes se hayan clasificado por el MINAET, por lo que, si estuvieran cubiertos de bosque, automáticamente quedarían incorporados al Patrimonio Natural del Estado (artículo 15). Con base en todo lo expuesto, este Tribunal llega a las siguientes conclusiones relevantes en el caso concreto. Primero: Al constituirse el medio ambiente como Patrimonio Común de todos los habitantes de la Nación, el Patrimonio Natural del Estado constituye una especie de ese género (artículos 50 párrafo segundo, 89, 121 inciso 14 párrafo primero de la Constitución Política, 2 inciso a) de la Ley Orgánica del Ambiente, 1 de la Ley de Biodiversidad y 13 de la Ley Forestal). Segundo: Existe una afectación legal inmediata al Patrimonio Natural del Estado, de todos aquellos terrenos comprendidos en las áreas silvestres protegidas, en las áreas declaradas inalienables –como la zona marítimo terrestre (artículo 73 de la Ley 6043)-, en los terrenos de aptitud forestal y en las fincas inscritas a nombre del Estado, de las Municipalidades, Instituciones Autónomas y demás entidades de la Administración Pública Descentralizada.
Tercero. El Patrimonio Natural del Estado no requiere de una declaratoria expresa dado que, conforme a lo establecido en los artículos 13 y 14 de la Ley Forestal, así como lo resuelto por la Sala Constitucional en sentencias 1992-03789 y 1997-04587, las zonas boscosas, los terrenos con aptitud forestal, los manglares y los humedales comprendidos dentro de las áreas inalienables, como la zona marítimo terrestre, quedan afectadas de forma inmediata a este Patrimonio, sin concurrencia de la Administración." (ver sentencia número 175-2011-VI, dictada por la Sección Sexta del Tribunal Contencioso Administrativo a las once horas con veinte minutos del dieciocho de agosto 2011, confirmada por voto número 01675-F-S1-2012 de la Sala Primera de la Corte Suprema de Justicia, a las ocho horas con cincuenta y cinco minutos del trece de diciembre del dos mil doce) Justamente, en este caso el MINAET señaló que la parcela 40 del Asentamiento Río Celeste, propiedad del IDA (INDER), es Patrimonio Natural del Estado, y tal como lo ha dicho la jurisprudencia citada, las zonas boscosas quedan inmediatamente afectadas al Patrimonio Natural del Estado, sin que sea necesaria una declaratoria de la Administración Pública.
No obstante, en este caso consta que el MINAET si había acreditado que esa parcela constituía parte del Parque Nacional Volcán Tenorio. Además, como se indicó líneas atrás, los testigos que declararon en el juicio oral y público realizado ante este Tribunal, indicaron claramente que la parcela 40 del Asentamiento Río Celeste, tiene cobertura boscosa. Por ello para este órgano jurisdiccional no existe duda que ese terreno es Patrimonio Natural del Estado, y no podía ser ocupado de ninguna forma por el demandante, al ser un bien de dominio público, el cual tiene las condiciones de ser inembargable, imprescriptible e inalienable. Asimismo, tampoco procede la indemnización pretendida por el accionante por supuestas mejoras realizadas al terreno en cuestión, ya que sobre bienes públicos la posesión por particulares no dará derecho alguno a su favor; Segunda: Del oficio transcrito también se aprecia que por parte del MINAET, existió una denuncia penal en contra del actor.
Ahora bien, el proceso penal en el cual el accionante resultó inocente, no tiene ningún efecto en este proceso contencioso administrativo, ya que en materia penal se trata de determinar la comisión de delitos y en este se solicita la nulidad de conductas administrativas. Por ello, bajo el principio de separación de vías, los resuelto en sede penal no tiene ninguna implicación en esta instancia contencioso administrativa; Tercera: Nótese que el informe transcrito es una recomendación que realiza la Dirección Regional Huetar Norte a la Junta Directiva del INDER, por ello este documento no es un acto final, sino preparatorio e interno, por lo que la institución demandada no tenía la obligación de notificárselo al accionante. Por esa razón son improcedentes las argumentaciones del demandante en cuanto a violación del debido proceso por no notificarle este oficio. Ahora bien, independientemente de la notificación del citado oficio, es claro para este Tribunal que lo resuelto en éste, no contiene nada nuevo de lo que ya el actor tenía conocimiento desde hace varios años, cuando la Dirección4947 y la Dirección Regional Huetar Norte del INDER, tramitaron el desalojo administrativo en contra del actor; 6) Por último, y como producto final de todo el procedimiento de desalojo administrativo seguido contra el actor por parte de la Oficina Subregional de Guatuso y la Dirección Regional Huetar Norte del INDER, se tomó el acuerdo por parte de la Junta Directiva del IDA, en el artículo número 42 de la sesión ordinaria 043-2011, celebrada el 29 de noviembre del 2011, mediante la cual se acordó textualmente lo siguiente:
"Acoger la recomendación contenida en el oficio Nombre40325, suscrito por el Lic. Manrique Jiménez Castro, Asesor Jurídico Regional y el Ing. Armando Montero Arce, Director Regional a.i Región Huetar Norte y con fundamento en ella, se acuerda: Acoger el desalojo solicitado por la Oficina Subregional de Guatuso, por estar demostrada la ocupación ilegal no reconocida por el Instituto de Desarrollo Agrario, por parte del señor Nombre40322 , (...), o cualquier otra persona que se encuentre ocupando ilegalmente la Parcela 40 del Asentamiento Río Celeste, sito en el Distrito San Rafael, Cantón Guatuso de la Provincia Alajuela. Que es terreno inscrito a nombre del Instituto de Desarrollo Agrario, en el Registro Público, partido Alajuela, Sistema Folio Real Matrícula: Placa7396, sin segregar de la finca madre, tienen un área de 7 ha, 4961.93 metros cuadrados, descrito en el plano catastrado Placa7397. El predio debe ser desalojado inmediatamente para ser trasladado al Ministerio del Ambiente Energía y Telecomunicaciones MINAET, por constituir Patrimonio Natural del Estado. ACUERDO APROBADO POR UNANIMIDAD.".
El acuerdo transcrito es completamente legal, por los siguientes motivos: Primero: Efectivamente, se tiene por demostrado que el acuerdo citado le fue notificado al actor mediante resolución para notificar emitida por la Asesoría Jurídica de la Región Huetar Norte, en su condición de órgano director del procedimiento, a las catorce horas cuarenta minutos del veintiuno de febrero del dos mil doce, por medio del número de fax señalado por el actor como medio para recibir notificaciones el 21 de febrero del 2012. Ahora bien, esta manera de notificar ese acuerdo de la Junta Directiva, no viola de ninguna forma el debido proceso y el derecho de defensa del actor, ya que lo importante es que se le notificó esa resolución al medio que el mismo actor señaló para recibir notificaciones. Tampoco se viola el debido proceso por el hecho de que la notificación la hiciera la Asesoría Jurídica de la Región Huetar Norte, y no la Secretaría General de la Junta Directiva, debido que aunque hubiese sido esta última, el resultado sería el mismo.
Se insiste, que lo importante es que se le notificó al accionante el citado acuerdo en el medio señalado por él mismo para recibir notificaciones, no siendo importante cual órgano fue el encargado de efectuar la notificación; Segundo: Es completamente irrelevante el alegato del actor, de que se le debió informar en ese acuerdo la integración de los miembros de la Junta Directiva, así como el resultado de la votación. Véase que el acuerdo citado fue tomado y aprobado por "UNANIMIDAD", por lo que es lógico que no existieron abstenciones, recusaciones ni impedimentos, y sí se presentó el quórum de ley. Además, consta que el demandante no recurrió este acuerdo en sede administrativa, pese a que le fue debidamente notificado. Por ello, este Tribunal está de acuerdo con lo indicado por el INDER, en el sentido que la información sobre la integración de la Junta Directiva, pudo haber sido solicitada por el actor, ya que éste siempre tuvo conocimiento y acceso al expediente administrativo; Tercero: El acuerdo tomado por el Junta Directiva del INDER, si está razonado, fundamentado y adecuadamente motivado, en el oficio número DRHN-ALJ-0255-2011, el cual es un informe técnico que analiza todo el procedimiento de desalojo que se le siguió al accionante por varios años.
Asimismo, no existe ninguna violación al debido proceso, ya que el contenido del oficio número DRHN-ALJ-0255-2011, señala hechos, argumentos y pruebas, ampliamente conocidas por el actor, el cual participó activamente en toda la tramitación que la Oficina Subregional de Guatuso y la Dirección Regional Huetar Norte del INDER, realizó para analizar la ocupación que el demandante venía realizando sobre la parcela 40 del Asentamiento Río Celeste; Cuarto: El hecho de que el acuerdo transcrito, no indicará los recursos, el órgano y el plazo para impugnar dicho acto, no tiene la fuerza suficiente para anular todo el procedimiento de desalojo administrativo realizado por la institución demandada, ya que sería solicitar una nulidad por la nulidad misma, así como es evidente para este Tribunal que conforme a los mismos argumentos expuestos en este proceso por el propio actor, éste siempre tuvo claro que podía recurrir en sede administrativa ese acuerdo.
Ahora bien, en general, el demandante alega violación de normas que regulan el procedimiento administrativo ordinario establecido en la Ley General de la Administración Pública. Sin embargo, estima este Tribunal que el procedimiento de desalojo administrativo tramitado por el INDER contra el actor, no es un procedimiento administrativo ordinario pleno, sino un procedimiento de mera constatación, ya que en el fondo lo único que tiene que determinarse es si el ocupante de una parcela propiedad del INDER, esta siendo o no ocupada de manera legal o ilegal. Además, como se explicó a lo largo de esta sentencia, al actor se le respecto en todo momento su derecho de defensa y el debido proceso, incluso por varios años el accionante tuvo la oportunidad de demostrar que la ocupación de la parcela 40 del Asentamiento Río Celeste, era legal. No obstante, como ha quedado analizado en esta resolución, esa parcela fue ocupada de manera ilegal por el demandante desde la perspectiva del Derecho Civil (poseedor de mala fe), de la Ley de Tierras y Colonización y el Reglamento Autónomo para la Adquisición de Tierras (incumplimiento del procedimiento y requisitos para la adquisición de tierras pertenecientes al INDER), y de la normativa ambiental, al constituir ese terreno Patrimonio Natural del Estado. Por todas las razones expuestas se declara en todos sus extremos sin lugar la presente demanda.
IX- SOBRE LAS EXCEPCIONES INTERPUESTAS: El INDER y el Estado, interpusieron las excepciones de fondo, que a continuación se resuelven: a) Falta de legitimación activa y pasiva: El actor cuenta con legitimación activa para demandar al INDER, ya que fue objeto de un procedimiento de desalojo administrativo de la parcela 40 del Asentamiento Río Celeste, propiedad de esa institución. Asimismo, el INDER cuenta con legitimación pasiva, al ser la Administración Pública, encargada de tramitar y determinar el desalojo administrativo del actor. Por lo tanto, se rechaza la excepción de falta de legitimación activa y pasiva interpuesta por el INDER; b) Falta de derecho: Efectivamente, el demandante no tiene derecho a ocupar la parcela número 40 al ser ésta propiedad del INDER y constituir Patrimonio Natural del Estado. También, el actor carece de derecho a efectos de que se le reconozcan mejoras, supuestamente construidas en el terreno en cuestión, así como cualquier tipo de indemnización, ya que al ser poseedor de mala fe y ocupante ilegal de bienes de dominio público no puede pretender el reconocimiento de ningún derecho indemnizatorio derivado de su posesión y ocupación ilegítima.
Por último, al accionante no se le violó el debido proceso. Por todo ello, el acuerdo impugnado emitido por la Junta Directiva del INDER es completamente válido y el accionante no tiene derecho de pretender su nulidad absoluta. En consecuencia, se declara con lugar la excepción de falta de derecho, interpuesta por el INDER y el Estado, en su calidad de tercero interesado.
X- SOBRE LAS COSTAS PERSONALES Y PROCESALES: De conformidad con lo establecido en el artículo 193 del Código Procesal Contencioso Administrativo, y al no apreciar este órgano jurisdiccional razones válidas para la exoneración en costas, se condena al actor al pago de las costas procesales y personales de este proceso.
POR TANTO
Se declara improcedente el escrito presentado por el accionante el 5 de noviembre del 2014. Se rechaza la excepción de falta de legitimación activa y pasiva interpuesta por el INDER. Se declara con lugar la excepción de falta de derecho, interpuesta por el INDER y el Estado, en su calidad de tercero interesado. Se declara sin lugar en todos sus extremos la presente demanda. Se condena al actor al pago de las costas procesales y personales de este proceso.
