Judge [Nombre3] DRAFTS the opinion; and, CONSIDERING (CONSIDERANDO):
I.The list of proven facts (hechos demostrados) is approved because it is supported by the evidence contained in the case file, but the fact identified by the letter h) is deleted as unnecessary.
II.Unproven fact (hecho indemostrado) a) is corrected so that, after "liability," it reads "plaintiff" instead of "defendant."
III.The complaint was dismissed in the judgment. To that end, the judge reasoned: "When we speak of a warranty (garantía), we mean that the purchased property must guarantee compliance with the quality standards and technical requirements established, for reasons of health, the environment, and safety, by the applicable laws, regulations, and rules issued by the public administration, as provided in section 43 of the Ley de Promoción de la Competencia y Defensa Efectiva del Consumidor; that is, it is the obligation imposed upon a contracting party to ensure the peaceful enjoyment, both in fact and in law, of the property transferred to the other party. Likewise, when speaking of latent defects (vicios ocultos), this means an internal defect in an item that was unknown to the buyer at the time of sale because it could not be detected through ordinary visual inspection. Based on the merits of the record (mérito de los autos), as regards the warranty, the defendant always responded responsibly by providing the appropriate attention and service.
Nor can latent defects be established, even though the expert appointed in the proceedings refers to them when defining the concept and expresses his opinion, as shown at folio 502. This Court does not share that opinion and, consequently, departs from his technical assessment, because the damage sustained by the excavator, as a new item of movable property, could not have been determined in advance, nor could there have been knowledge of the deficiencies it would later develop; this claim is therefore rejected. Regarding item d), namely, an order requiring the defendant company to reimburse the legal expenses and costs incurred in financing the excavator through Banco Popular, as well as the installments paid on the loan granted, it must be borne in mind that what is at issue in this proceeding concerns matters related to the purchase of the excavator, including the warranty and mechanical defects, and not the plaintiff’s credit relationship with that Bank.
The payment of expenses, costs, and installments involves matters that, based on the evidence and the merits of the record, are not adjudicated in this proceeding; this claim is therefore rejected. With respect to item e), namely, an order requiring the defendant company to pay the damages and losses (daños y perjuicios) caused, the plaintiff, in the initial pleading, quantifies non-pecuniary damages (daño moral) at five million colones because the equipment-rental agreement was canceled, in addition to the harm caused with respect to the aforementioned Bank and the plaintiff’s credit references; and quantifies consequential losses, specifically lost profits (lucro cesante), at fifteen million colones with no céntimos. Non-pecuniary damage is damage that causes some impairment to a person’s complete psychological, emotional, or affective well-being, or to the person’s reputation, good name, self-esteem, or the esteem in which others hold that person.
(...) First, it was not proven in the record that an excavator-rental agreement existed between the plaintiff and a third party. Nor was it established that the plaintiff suffered any impairment to his psychological, emotional, or affective well-being. Consequently, because the foregoing claim was not proven, that amount could not be awarded. As to the loss claimed, namely lost profits, this is the pecuniary damage (daño patrimonial) resulting from the loss of an economic benefit or legitimate profit as a consequence of a harmful event. It represents what a person failed to earn because of the occurrence of the damage; in other words, there must be a definite prospect of obtaining a benefit in order to claim compensation, which is awarded whenever the corresponding evidence establishes the lost profits and their direct relationship to the damage (artículo 1045 and following provisions of the Código Civil).- As with the preceding claim, the party merely asserted it but failed to prove through the corresponding evidence that he sustained that economic loss as a consequence of the legal situation described; that claim must therefore also be rejected."
IV.Both parties appeal. The plaintiff states his disagreement as follows: “The court below determines in Item V of its reasoning: ‘the central issue to be decided is whether the aforementioned warranty on the excavator covered the mechanical failures caused by the possible lack of maintenance that the representative of the defendant company alleges was attributable to the plaintiff,’ an issue that the court below assesses incorrectly, since the principal issue concerns the dispute over whether the excavator equipment had manufacturing defects or hidden defects (vicios ocultos); that is, it concerns the seller’s obligation—in this case, Esco, now called HARSCO INFRAESTRUCTURA COSTA RICA S.A.—to deliver the item sold in a condition fit to perform the function for which it is normally intended. In other words, the seller must deliver the item in good condition, without flaws or defects that render it unsuitable or materially impair its normal use, a circumstance that was demonstrated in the proceedings and with which the seller failed to comply; merely providing warranty service repeatedly did not resolve the problem.
It is here that the court below confuses the issues and errs in its assessments, since, as stated, the warranty is not a recurring condition to be provided again and again without resolving the principal problem, and although the seller did provide warranty service, it did not effectively repair the equipment. The court below states that the hidden defects were not proven, despite the expert examination (pericia), which did in fact establish them, and states that it departs from the technical opinion ‘because the damage exhibited by that excavator, as a new item of movable property, could not have been identified, nor could there have been knowledge of the deficiencies that it would subsequently exhibit...’; but is this not precisely the reason given by the court below that conclusively establishes the hidden defect? REGARDING PROOF OF THE FACTS. THIRD: There is no dispute regarding the first fact alleged in the complaint, since the defendant admits it as true.
Undisputed fact. The second fact alleged in the complaint is deemed undisputed because the defendant admits it as true and in accordance with the evidence in the record. The third fact alleged in the complaint is deemed undisputed because the defendant admits it as true. The fourth fact alleged in the complaint is deemed undisputed because the defendant admits it as true. The fifth fact alleged in the complaint is partially admitted by the defendant. The defendant states that the breakdown was reported on 07 de junio 2007 and that the equipment was returned repaired on 22 de junio del mismo año. This assertion is false and is intended to mislead the Court; in support of it, the defendant states that page 9 of the case file establishes this circumstance. Page 9 does indeed contain a memorandum signed by the Commercial Manager, Mr. [Nombre2], whose second paragraph states verbatim: ‘Mini excavator 325—Serial # 234114019: This machine was reported to us as damaged on 7 de junio del presente año.
Our service department likewise visited the site on 8 de junio and found that the swing valve had a structural failure. ESCO proceeded to inform the manufacturer of this situation. The manufacturer’s technical department immediately recommended that we replace the entire valve bank under warranty and adjust the relief valves of the swing motors. As of today, we already have the part in our spare-parts warehouse and could begin the repair immediately in order to deliver the machine el próximo viernes 22 de junio. At this time, we are waiting for the customer’s approval to begin the repair, since he has told us that he does not want it repaired.’ (Boldface not in the original.) Note, Your Honor, that the memorandum DOES NOT state that the machine was returned repaired on 22 de junio, but rather that the replacement part was available and that they could begin the repair with a view to delivering it on 22 de junio.
The defendant’s representative falsely states that the machine was returned to me repaired on 22 de junio del 2007. As for the company mentioned by the defendant’s representative, I am unaware of what company he is referring to, and logically, if my machine was at the defendant’s repair shops, the defendant knew that my company was not operating. In this regard, the witness [Nombre4] states: ‘...Shortly after the first time, it failed again in exactly the same place. They then attempted to repair the part after exhausting repairs using new parts. But because of the stress at that location, the repair did not work; afterward, they installed an entirely new bank, but it was not the one for that machine, because they installed one from a 328, which is larger. I know this because I worked many hours with such a machine. At that point, [Nombre1]’s machine began to have more serious problems, because the machine was slower and had overheating problems and less power and speed; that bank reduces the resistance of the parts and is very difficult to calibrate.’ ‘When the valve bank was replaced, [Nombre5] was contacted; in fact, he was the one who informed us that it came from a 328.
On the second occasion, the machine remained under repair at the shops for almost two calendar months.’ In this regard, see page 6, which is ESCO Work Order number 25732 concerning the equipment at issue in these proceedings, in which the ESCO technician clearly establishes that, after the valve bank was replaced, temperatures began to rise and the manufacturer therefore had to be consulted. It likewise states that the pressure valves were adjusted to see whether the speed would improve and the temperature could be lowered, but the temperature did not fall and the speed did not improve. It is therefore established with complete certainty that the testimony of the witness [Nombre4] is consistent with the machine’s actual condition and with what ESCO’s technicians stated at the time. The testimony given under examination (prueba confesional) by the defendant’s representative, Mr. [Nombre2], which constitutes conclusive evidence, is of the utmost importance.
He answers questions 1, 2, 4 affirmatively, and in answering question 4 states: ‘If the valve bank was replaced, I assume it was one for a 325 or one that would work with a 325, but I do not know whether it was from a 328.’ The defendant’s witness, Mr. [Nombre5], states: ‘I was the agent who sold Mr. [Nombre1] an excavator, a Bobcat-brand mini excavator; I do not remember the model.’ ‘The equipment was new; within a matter of months, the breakdown was reported, and it was within the warranty period. The valve bank issue was reported first. Initially, the company did manage to resolve it, perhaps not immediately, but within weeks, which was a reasonable period; however, the problem recurred. It was later determined that replacing one component of the valve bank was insufficient to correct the failure and that the entire valve bank had to be replaced, for which the waiting period exceeded one month.’ Regarding the expert examination conducted by Mr.
Jorge Chacón Salazar, his report is clear, concise, and categorical in finding that the equipment had hidden defects and that it did not fulfill the purpose for which I acquired it. The expert is likewise conclusive in the supplemental expert reports requested by the defendant, and these findings were fully confirmed during the judicial inspection (reconocimiento judicial) of the equipment, also requested by the defendant, establishing that the equipment unquestionably exhibited the defects alleged in these proceedings. The documentary evidence, the testimony presented by both parties, and the expert examination conclusively establish the fact identified as fact five in the complaint. Proven fact. The sixth fact alleged in the complaint is undisputed; the defendant admits it in full. It is untrue that the warranty was not used; the record shows that it was indeed used, but the defendant cannot repeatedly seek to apply the warranty again and again when it has been shown that the defects were present at the time of manufacture.
The seventh fact alleged in the complaint is partially admitted by the defendant. The defendant’s representative states that the machine did in fact experience overheating problems and that proper maintenance repairs were performed. Changing the coolant is not a repair. The company’s representative states that the damage to the stick cylinder was never reported to our company. Once again, the company’s representative is untruthful, since the witness they offered, Mr. [Nombre5], states in his testimony: ‘I remember that after the bank was replaced, damage to the stick cylinder was reported. I am not the person who prepares the work orders, because the technicians in the service shop do that. I believe I reported that damage to the service shop; I do not know whether it was repaired.’ Proven fact. The eighth fact alleged in the complaint is partially admitted by the defendant. This fact is established by the documentary evidence, consisting of Work Order number 26153.
The defendant likewise admits it as true, subject to modifications, arguing in opposition that the machine was being operated in aquatic environments and that the owner was therefore required to maintain graphite lubrication on that ring gear. The defendant’s representative merely makes a simple assertion, since he offers no evidence whatsoever in that regard; on the contrary, the expert responsible for the expert examination states that this situation was caused by damage to the oil seal and not by any failure on my part to perform proper maintenance on the turntable. Proven fact. The ninth fact alleged in the complaint is disputed. Taller Reysa merely performed a technical appraisal (avalúo técnico) of the machine and did not carry out any repairs on the equipment. The tenth fact alleged in the complaint is disputed. The defendant’s representative again insists on the dates 7 de junio al 22 de junio del dos mil siete, a matter already addressed in connection with fact five, as to which the defendant is incorrect.
The testimony of witnesses for both parties has established that the equipment remained at Esco’s shops for approximately 60, and it was likewise in defective condition while in the field. Proven fact. The eleventh fact alleged in the complaint is disputed. The defendant rejects it as unsupported by evidence. The expert evidence was clear regarding the condition of the equipment purchased. Evidence does exist. Proven fact. The twelfth fact alleged in the complaint is undisputed; the defendant admits it fully. It bears repeating that it is untrue that the warranty was not used. Proven fact. The thirteenth fact alleged in the complaint is disputed. The defendant rejects it. It has already been established through the testimonial evidence, which may be considered together with the arguments presented regarding fact five of the complaint, as well as through the documentary and expert evidence; the evidence is abundant and conclusive.
Despite the various repairs, the equipment continued to experience problems. Proven fact. The fourteenth fact alleged in the complaint is disputed. The witness [Nombre6], offered by the plaintiff, states: ‘Yes, I entered into a contract with [Nombre1], because I had a contract with Estándar and needed equipment, and we were relying on the machine that [Nombre1] had purchased; however, it had many failures and remained out of service for many days. It caused environmental damage because it leaked oil, so my contract was canceled. I can say that my contract was canceled because the machine did not work, resulting in a loss of two hundred thousand colones per day.’”
“I know that the machine would break down because a valve body would burst, causing a fairly substantial oil spill; because of those breakdowns, I was forced to terminate the contract with [Nombre1].” Proven fact (hecho probado). Regarding the fifteenth allegation of the complaint, disputed fact (hecho controvertido). The defendant denies it. In the proceedings before us, the defendant, by reason of latent defects (vicios ocultos) and warranty (garantía), is liable as warrantor pursuant to Articles 1034, 1035, 1036, 1037, and 1038 of the Código Civil and therefore cannot evade liability. The allegations made in the complaint have been expressly proven. Furthermore, this Court is fully aware that the equipment at issue in these proceedings was attached by Banco Popular, sucursal Guápiles, through enforcement of a security interest (ejecución prendaria), expediente número 10-000018- 0930- CI, as evidenced at folios 506, 507, 509, 510, and 511 of this case file. Proven fact.” (sic).
V.In the judgment under review, the judge found that “the excavator continues to exhibit practically the same mechanical problems, as further confirmed by the admission given by the attorney-in-fact of the defendant company, appearing at folio 481, where he states, in general terms, that the plaintiff purchased the excavator from the company he represents; that after only two months it was experiencing operating problems; that the valve bank was replaced; and that five months later it had problems with the bearing of its turntable. This was also established by the work orders appearing at folios 5,6 and 7, which describe the aforementioned defects, and was reaffirmed by the expert evidence (prueba pericial) provided by the appraiser appointed in the proceedings, appearing at folios 345, 502 and 547, thereby creating a vicious circle of repairs and warranties in which the plaintiff remains trapped.” Nevertheless, he dismissed the claim because he considered that “the defects exhibited by said excavator, as a new movable asset (bien mueble), could not have been identified, nor could there have been knowledge of the deficiencies that it would subsequently exhibit.” That assessment is mistaken, because a defect is considered latent precisely when the defect in the item is not evident.
Regarding this issue, the First Chamber of the Supreme Court of Justice, in judgment No. 227, issued at fourteen hours fifteen minutes on the twentieth of December of nineteen ninety-one, stated: “Latent defects (vicios ocultos) are understood to be those non-apparent defects in the item sold, existing prior to the contract, that render the item unsuitable for its intended uses and which, had the buyer known of them, would have caused the buyer not to make the purchase or to pay a lower price for it, it being understood that the seller is not liable either for apparent defects or those that are readily visible, or even for latent defects whenever the buyer was in a position to discover them, as occurs when, due to the buyer’s status as an expert, considering the buyer’s trade or profession, the buyer must be presumed to have been able to discover them easily. This warranty obligation (obligación de garantía) for defects in the item is based on the seller’s duty to provide the buyer not only with ownership of the item, but also with its beneficial possession.
It is also based on the duty imposed by good faith upon every contracting party to inform the other party of any material facts or circumstances that might lead that party to withdraw from the contract. To give rise to liability, these defects must be: a) latent or non-apparent; b) unknown to the buyer; c) detrimental to the item’s inherent usefulness; and ch) existing prior to the sale. It is not necessary for the seller to have known of such defects, nor for them to be permanent or irreparable. On this issue and insofar as relevant, this Chamber has held that the warranty against latent or redhibitory defects (vicios ocultos o redhibitorios) ‘is a natural effect of the contract of sale. It concerns the seller’s obligation to deliver the item sold in a condition suitable for performing the function for which it is normally intended; that is, the seller must deliver the item in good condition, without defects that render it unsuitable for, or materially impair, its normal use.
(...) The possibility of the seller’s ordinary contractual liability always remains, because the seller is obligated to deliver the item in such a manner that it fully performs its normal function; such liability may give rise to compensation for damages (daños y perjuicios), depending on the nature of the breach. If the seller delivers the item with a defect that renders it unsuitable for its normal function or diminishes its quality, the seller commits a breach of contract, pursuant to Articles 692, 693, 701, 702, 704, and 764 of the Civil Code, the last of which provides that “payment shall be made in all respects in accordance with the terms of the obligation.” An obligation implicit in a sale is to deliver the item as the buyer expects to receive it, in accordance with the agreement (Article 764 and Article 1022 ibidem).’ (Judgment of this Chamber No. 320, issued at 14:20 hours on 9 November 1990).” The operating problems exhibited by the excavator at issue in this litigation fall within the concept of latent defects because they are non-apparent defects.
The overheating problems, as well as the lack of power and speed, became evident through use of the equipment; they impede its proper operation, were unknown to the buyer, and, moreover, existed before the sale to the plaintiff, since the expert report established that they were manufacturing defects. The repairs performed by the seller were insufficient to eliminate those problems, and the buyer cannot be compelled to accept repairs indefinitely, because if the buyer purchased new equipment, it is reasonable to expect it to operate properly. Accordingly, the plaintiff’s claim is well-founded; therefore, the judgment must be reversed insofar as it rejected the existence of latent defects, and that claim must instead be granted, ordering the defendant to refund the price paid for the backhoe excavator.
VI.The other issue raised in the plaintiff’s appeal is the rejection of damages. In that regard, the court below (a quo) held: “The record did not establish, first, the existence of an excavator lease agreement between the plaintiff and a third party; nor was it established that the plaintiff suffered any impairment of his psychological, emotional, or affective well-being. Consequently, because the foregoing item was not proven, that amount could not be awarded. With respect to the consequential loss (perjuicio) claimed, namely lost profits (lucro cesante), this consists of the pecuniary loss caused by the loss of an economic benefit or legitimate gain as a consequence of a harmful event; it represents what was not earned because of the occurrence of the harm. In other words, there must be a definite prospect of obtaining a benefit before compensation may be claimed, and such compensation is awarded whenever the lost profits and their direct relationship to the harm can be established through the corresponding evidence (Article 1045 et seq. of the Civil Code).- As with the preceding item, the party merely alleged it, but did not establish through the corresponding evidence that he suffered such economic loss as a consequence of the legal circumstances described; therefore, this item must likewise be rejected.” The rejection of non-pecuniary damages (daño moral) will not be examined because it was not raised as a ground of appeal (agravio).
As to the consequential losses, the plaintiff seeks to prove the existence of a lease agreement (contrato de arrendamiento), valued at fifteen million colones—the amount claimed for consequential losses—between the plaintiff and Mr. [Nombre7], the plaintiff’s father. However, such evidence is not suitable for proving that legal transaction, because Article 351 of the Code of Civil Procedure prohibits proving by that type of evidence a legal agreement exceeding ten percent of the minimum amount required for an appeal on points of law (recurso de casación), and when the proceedings commenced, that minimum amount was two million colones; ten percent of that sum is two hundred thousand colones. Therefore, the existence of a contract exceeding that amount, such as the one at issue here, could not be established through testimonial evidence (prueba testimonial). Because the existence of the lease agreement was not proven, neither was the existence of the consequential losses allegedly arising from the plaintiff’s inability to perform the obligation he had undertaken, given the problems exhibited by the machine covered by that agreement.
VII.The judge rejected items a), b), g), h), and i) of the prayer for relief (petitoria) because “compelling the defendant company to cease the judicial repercussions against him and requiring the defendant company to compensate him for the consequences of the legal actions against him bear no relation to the facts of these proceedings; and, with respect to requesting certification from Banco Popular of the details of expenses and monthly payments, and requesting that the defendant certify the payments made by him, these are among the evidentiary materials requested in the proceedings and have no bearing on the relief sought in this matter.” On appeal, the plaintiff merely states: “this court is fully aware that the equipment at issue in these proceedings was attached (embargado) by Banco Popular, (...).” That assertion does not constitute a ground of appeal, because the plaintiff does not state why he believes the judge ruled incorrectly.
VIII.The defendant also appeals. It sets forth its disagreement in the following terms: “When the complaint was answered, the statute-of-limitations defense (excepción de prescripción) was raised, not as a preliminary defense (excepción previa), but as a defense on the merits (excepción de fondo). The defendant is not a counterclaimant and therefore does not request a declaration of the right to invoke the statute of limitations as affirmative relief, but instead raises it as a defense or non-preliminary defense (Art. 306 of the Code of Civil Procedure, in relation to the requirements for judgments under Art. 155, subsection 3, paragraph d, and subsection 4, paragraph ch). The plaintiff bases his claim on the alleged existence of latent defects, which are subject to the limitations period established in Article 450 of the Commercial Code. Since the defense was raised and the factual findings in the judgment establish that more than three months elapsed between delivery of the machinery and the filing of the proceedings (see proven facts a and h), the claim must be declared extinguished by operation of the statute of limitations.
I therefore request that the judgment under appeal be reversed and that the statute-of-limitations defense be granted, as I expressly request. II. The defense of lack of legal entitlement based on an unperformed contract (excepción de falta de derecho como contrato no cumplido) was likewise raised. Although the principle of iura novit curia applies, as it does to the preceding claim, the judgment disregards this defense for ‘lack of supporting grounds.’ The reciprocal obligations (prestaciones sinalagmáticas) under the contract include the warranty obligation, which the defendant even extended. By unexpectedly ceasing to make use of the warranty, the plaintiff became the first party in breach and therefore is not in a contractual position permitting it to bring this action. The judgment subsequently revisits, in different words, the defense raised, which should have been granted rather than rejected.
I therefore request that the judgment be reversed and that the defenses of lack of legal entitlement—understood as the defense of unperformed contract (excepción de contrato no cumplido)—be granted, and, as a consequence, that the waiver of costs be revoked and the plaintiff instead be ordered to pay them, as I expressly request.”
IX.The statute-of-limitations defense was rejected by ruling No. 322 of this Court and Section, issued at ten hours twenty minutes on the thirtieth of September of two thousand nine, which is now final. The issue is therefore procedurally foreclosed (precluido) and has been definitively decided (Article 303 of the Code of Civil Procedure); consequently, the defendant’s attempt to reopen the issue is futile.
X.The judgment rejected the theory that the plaintiff had failed to comply by “unexpectedly departing from the use covered by the warranty.” In this regard, it stated: “The defendant alleges that the defects observed in the excavator resulted from misuse by the plaintiff, since the equipment was operated in an environment not recommended by the manufacturer; however, the defendant failed to establish in the record, through the corresponding evidence, that the failures observed were attributable to the plaintiff, because the expert examination (peritaje) conducted on the excavator in the record, as well as the inspection (reconocimiento) performed on it and appearing at folios 345, 502 and 547, determined that it did not have problems involving obstruction by sediment or running-water supplies. It was solely through testimonial evidence (prueba testimonial) that the defendant attempted to prove the plaintiff’s misuse of the excavator, as recorded at folio 565, where one of the witnesses offered stated verbatim: ‘...the machine was being used for channeling work, including in muddy conditions or partially submerged in water, which was not the purpose for which the machines were sold...’; nevertheless, it must be borne in mind that this is not the proper means of evidence (medio probatorio) for proving this point and, without calling into question the integrity of the witnesses examined in these proceedings, because they were offered by that same party, they remain witnesses favorable to the facts the defendant seeks to prove.” (sic). The judge’s reasoning is not challenged by the appellant, which is sufficient reason to dismiss its objection.
POR TANTO:
The judgment is reversed insofar as it denied the claim for latent defects (vicios ocultos), and that claim is instead granted in the manner stated herein. Esco de Costa Rica S.A, now Harsco Infraestructura, Costa Rica, Sociedad Anónima, is ordered to reimburse [Nombre1] for the price paid for the excavator at issue in this matter.

FAX n°2221-1786 ____________________________________________________ N° 343 TRIBUNAL SEGUNDO CIVIL, SECCIÓN SEGUNDA.- San José, a las once horas treinta minutos del veintiocho de octubre de dos mil catorce.- Proceso ORDINARIO establecido en el JUZGADO CIVIL DE MAYOR CUANTÍA DEL SEGUNDO CIRCUITO JUDICIAL DE LA ZONA ATLÁNTICA, POCOCÍ; bajo el expediente 07-000374-0930-CI, por [Nombre1] , mayor, divorciado, comerciante, cédula CED1, vecino de San José; contra ESCO COSTA RICA, SOCIEDAD ANÓNIMA; hoy HARSCO INFRAESTRUCTURA COSTA RICA, SOCIEDAD ANÓNIMA; representada por su apoderado generalísimo sin límite de suma [Nombre2] , mayor, casado, ingeniero civil, cédula CED2, vecino de Alajuela. Intervienen los licenciados Leonardo Crespo Valerio y Horacio Mejías Portuguez, en calidad de apoderados especiales judiciales, de la sociedad demandada.-
RESULTANDO:
REDACTA la Jueza [Nombre3] ; y,
CONSIDERANDO:
I.Se aprueba la lista de hechos demostrados porque tienen apoyo en los elementos de prueba que constan en el expediente, mas se elimina el identificado con la letra h), por innecesario.
III.En sentencia, se rechazó la demanda. A ese efecto, estimó el señor juez "cuando hablamos de garantía nos referimos a que el bien comprado debe de garantizar el cumplimiento de los estándares de calidad y los requerimientos técnicos que, por razones de salud, medio ambiente y seguridad establezcan las leyes, los reglamentos y las normas respectivas, dictadas por la administración pública, tal y como lo estipula el numeral 43 de la Ley de Promoción de la Competencia y Defensa Efectiva del Consumidor, es decir es la obligación establecida a cargo de un contratante de asegurar el goce pacífico, de hecho y de derecho de la cosa trasmitida a la otra parte. Asimismo cuando se habla de vicios ocultos, tenemos que es un defecto interno de una cosa que en el momento de su compraventa no se conocía por el comprador por no poder distinguirse a simple vista. De acuerdo al mérito de los autos tenemos que en cuanto a la garantía la parte demandada siempre respondió de manera responsable al brindar la correspondiente atención y servicio, tampoco se puede establecer vicios ocultos, aún cuando el perito nombrado en autos hace mención a éstos cuando realiza un definición del concepto y externa su criterio según consta a folio 502, este Juzgador no comparte y por consiguiente, se separa de su criterio técnico, puesto que los daños presentados por dicha excavadora, al ser un bien mueble nuevo, no se podían determinar y a su vez tener conocimiento sobre las deficiencias que posteriormente presentara, de ahí a que se rechace tal extremo.
En cuanto al punto d) sea obligar a la sociedad demandada a restituirle los gastos y costos legales ocasionados por el financiamiento de la excavadora con el Banco Popular así como las cuotas pagadas por concepto de crédito otorgado, debe de tener presente que en este proceso lo que se discute es en cuanto a aspectos relacionados con la compra de la excavadora en cuanto a garantía, desperfectos mecánicos y no sobre sus relaciones crediticias con el Banco indicado; el pago de gastos, costos y cuotas son aspectos que de acuerdo a las probanzas y al mérito de los autos, no se conocen en este proceso, de ahí a que se rechace tal extremo. Con relación al punto e) sea obligar a la sociedad demandada al pago de los daños y perjuicios ocasionados, tenemos que en el escrito inicial, la parte actora liquida como daño moral la suma de cinco millones de colones al ser cancelado el contrato de alquiler de equipo además del daño ocasionado ante el Banco citado y sus referencias crediticias y como perjuicios, sea lucro cesante la suma de quince millones de colones sin céntimos; tenemos que daño mora l es aquél que causa algún deterioro a la persona en su íntegra armonía psíquica, emocional, afectiva o bien en su reputación o en su buena fama, su autoestima o su heteroestima.
(...) En autos no se demostró en primer lugar que existiera por parte del actor con un tercero, un contrato de alquiler de la excavadora, tampoco se determina que sufriera algún deterioro en su armonía psíquica, emocional o afectiva, por consiguiente, al no demostrarse el extremo citado, no se podría otorgar dicho monto. En cuanto al perjuicio invocado, sea el lucro cesante, tenemos que es el daño patrimonial que se produce por la pérdida de una utilidad económica o de una ganancia legítima como consecuencia de un evento dañoso, representa aquello que se ha dejado de ganar ante el acontecimiento del daño, es decir tiene que existir una perspectiva cierta de beneficio para poder exigir una indemnización, la cuál se concede siempre que pueda comprobarse mediante la probanza correspondiente, el lucro cesante y su relación directa con el daño (artículo 1045 y siguientes del Código Civil).- Al igual que el extremo anterior, la parte únicamente se ha limitado a indicarlo, sin embargo, no demuestra mediante la respectiva probanza que haya sufrido dicho perjuicio económico como consecuencia de la situación jurídica expuesta, de ahí a que también proceda a rechazarse tal extremo.".
IV.Apelan ambas partes. El actor, expone su disconformidad de la siguiente forma: "Determina el A-quo en el Item V de su fundamentación: "el punto medular a definir es que si la garantía mencionada sobre la citada excavadora cubría los desperfectos mecánicos producidos por las posibles faltas de mantenimiento que alega el representante de la sociedad demandada por parte del actor", aspecto en que equivoca su apreciación el A-quo, ya que el principal aspecto versa sobre el contradictorio de que el equipo de excavadora tenia desperfectos de fabrica o vicios ocultos, es decir, se refiere a la obligación del vendedor, en este caso, Esco, hoy día denominada, HARSCO INFRAESTRUCTURA COSTA RICA S.A., de entregar la cosa vendida y que ésta sea apta para cumplir con la función para la que normalmente está destinada, es decir, que debe entregar la cosa en buen estado, sin vicios o defectos que hagan impropio, o afecten notablemente su uso normal, situación que quedó demostrada en el proceso y que no cumplió el vendedor y no por ello, dar una garantía, una y otra vez, sin que se resolviera el problema.Y es aquí, donde el A-quo, confunde y equivoca sus apreciaciones, ya que tal como se dijo la garantía no es una condición reiterativa, brindándola una y otra vez, sin resolver el problema principal y si bien es cierto, la empresa vendedora, brindo la garantía, no así resolvió el problema de la reparación efectiva del equipo.
Indica el A-quo que los vicios ocultos no se demostraron, a pesar de la pericia realizada, misma que efectivamente, los determina, manifestando el A-quo que se separa del criterio técnico, "puesto que los daños presentados por dicha excavadora, al ser un bien mueble nuevo, no se podían determinar y a su vez tener conocimiento sobre las deficiencias que posteriormente presentara...", pero, no es precisamente esta razón que da el A-quo, para determinar con toda certeza el vicio oculto.SOBRE LA DEMOSTRACION DE LOS HECHOS.TERCERO: Del hecho primero de la demanda, no existe contención, ya que la demanda lo acepta como cierto. Hecho no controvertido. Del hecho segundo de la demanda, se tiene como no controvertido, al aceptarlo como cierto la demandada, y conforme a la prueba que existe en autos. Del hecho tercero de la demanda se tiene como no controvertido al aceptarlo como cierto la demandada.
Del hecho cuarto de la demanda se tiene como no controvertido al aceptarlo como cierto la demandada. Del hecho quinto de la demanda es aceptado parcialmente por la demandada. La demandada indica que la avería se reporta el día 07 de junio 2007 y que el mismo se entrega reparado el día 22 de junio del mismo año. Este argumento es falso y pretende confundir a su autoridad, para ello la demandada señala que al folio 9 del expediente se determina esta situación. Al folio 9 efectivamente se aporta una nota suscrita por el Gerente Comercial, Señor [Nombre2] , en la cual en el punto dos se indica textualmente: " Mini excavadora 325- Serie # 234114019: Esta máquina se nos reporto con un daño el 7 de junio del presente año. Igualmente se realizo visita al sitio por parte de nuestro departamento de servicio el 8 de junio y se encontró que la válvula de giro tenía una falla estructural. De parte de ESCO se procedió a informar al fabricante sobre esta situación.
Inmediatamente, el departamento técnico de la casa fabricante nos recomendó cambiar por garantía todo el banco de válvulas y realizar un ajuste en las válvulas de alivio de los motores de giro. Al día de hoy la pieza ya la tenemos en nuestro almacén de repuestos y podríamos empezar la reparación inmediatamente con el fin de entregar la maquina el próximo viernes 22 de junio. En este momento estamos a la espera de que el cliente nos dé el visto bueno para iniciar con la reparación ya que nos ha expresado que no quiere que se repare". ( La negrita no es del original). Note Señor Juez que la nota NO indica que la maquina se entrego reparada el día 22 de junio, sino, que cuentan con el repuesto y que podrían empezar la reparación con el fin de entregarla el día 22 de junio. Es falso el dicho del representante de la demandada al señalar que la maquina se me entrego reparada el día 22 de junio del 2007.
Ahora bien con respecto a la empresa que menciona el representante de la demandada, desconozco la referencia que hace de la misma, y lógicamente si mi máquina se encontraba en los talleres de la demandada, era de su conocimiento que mi empresa no estaba laborando. En este sentido el testigo [Nombre4] , manifiesta: "...Después de la primera al tiempito después vuelve a fallar exactamente en el mismo lugar. De ahí intentaron reparar la pieza después de agotar la reparación con piezas nuevas. Pero por la tensión en ese lugar la reparación no funciona después de ello le ponen el banco todo nuevo pero no era el de esa máquina pues le pusieron de un 328 que es más grande, lo se pues trabaje muchas horas con una máquina así. Ya ahí empezó la máquina de [Nombre1] a tener problemas más serios pues la maquina era más lenta, problemas de calentamiento, menos fuerza y velocidad, ese banco le quita resistencia a las piezas, eso es muy difícil de calibrar".
"Al cambio de Banco de Válvulas se comunico con [Nombre5] de hecho el fue el que nos reporto que era de un 328, en la segunda ocasión, la máquina estuvo en reparación en los talleres casi dos meses calendario" En este sentido ver folio 6, el cual corresponde a la Orden de Trabajo número 25732 de ESCO, referente al equipo en cuestión del presente proceso y en la que se determina claramente por parte del técnico de ESCO que posterior al cambio del banco de válvulas, se comienzan a levantar las temperaturas, por lo que se debe consultar al fabricante. Así mismo señala que se ajustaron las válvulas de presión para ver si mejoraba la velocidad y tratar de bajar la temperatura, pero no bajó y no mejoró la velocidad. Se determina con toda certeza en este sentido que el testimonio del testigo [Nombre4] es coincidente con la realidad del estado de la maquina y lo señalado por los técnicos de ESCO en su momento.De suma importancia determinar la prueba confesional al representante de la demandada, Señor [Nombre2] , lo cual es plena prueba.
A las preguntas 1, 2, 4, responde afirmativamente, a la respuesta de la pregunta 4, indica: "Si se le cambió el banco de válvulas asumo que el de 325 o uno que le funcionara al 325 pero no sé si fue un 328" El testigo de la parte demandada, Señor [Nombre5] , manifiesta: "Yo fui el agente que vendí una Excavadora a don [Nombre1], una mini excavadora marca Bobcat, no recuerdo el modelo". "El equipo era nuevo, en cuestión de meses se reporto la avería y estaba dentro del período de garantía. Se reportó primero lo del banco de válvulas, primeramente la empresa si logró resolver, tal vez no en forma inmediata pero sí en semanas dentro de un período razonable, pero el problema fue reincidente posteriormente se determinó que para resolver dicho fallo no bastaba con cambiar un componente del Banco de válvulas sino se determino cambiar por completo el banco de válvulas y para ello el tiempo de espera se prolongó más de un mes" En cuanto a la experticia realizada por el Señor Jorge Chacón Salazar, este es claro, conciso y categórico al rendir la misma que el equipo presentaba vicios ocultos y que la finalidad para la cual fue adquirida por mi parte no se llegó a cumplir, así también es concluyente el perito en las ampliaciones del peritaje que solicita la parte demandada y se vienen a confirmar de manera absoluta en el reconocimiento judicial del equipo, también solicitada por la parte demandada, en el sentido que el equipo presento de manera absoluta los vicios reclamados en el presente proceso.
La prueba documental, testimonial de ambas partes, y la pericia demuestra de manera absoluta el hecho denunciado como cinco en la demanda. Hecho probado. Del hecho sexto de la demanda, es un hecho no controvertido, la demandada lo acepta de manera absoluta. No es cierto que no se empleara la garantía, en autos consta que efectivamente se utilizó, pero, no puede la parte demandada, pretender de manera reiterativa aplicar la garantía una y otra vez, cuando se ha demostrado que los daños eran de fábrica. Del hecho sétimo de la demanda, la demandada lo acepta parcialmente. Indica el representante de la parte demandada que efectivamente la máquina presentó problemas de calentamiento y se da una debida reparación de mantenimiento. Cambiar el refrigerante no es una reparación. Indica el representante de la empresa que el daño en el pistón del stick nunca fue reportado a nuestra empresa. Una vez más el representante de la empresa vuelve a faltar a la verdad, ya que el testigo ofrecido por ellos, el Señor [Nombre5] en su declaración señala: "Recuerdo que después del cambio del Banco se reportó daño en el Pistón de stick, yo no soy el que hace las ordenes de trabajo pues lo hacen los técnicos en el taller de servicio, me parece que reporté ese daño al taller de servicio, no sé si fue reparado".
Hecho probado. Del hecho octavo de la demanda, la parte demandada lo acepta parcialmente. Se demuestra este hecho con la prueba documental y que consiste en la Orden de trabajo número 26153, así mismo la parte demandada lo acepta como cierto con modificaciones, alegando su oposición en el sentido que la maquina se encontraba en ambiente acuosos y por lo tanto el propietario debía mantener el engrase grafitado sobre dicha corona. Se limita únicamente a realizar el representante de la parte actora un simple comentario, ya que no aporta prueba alguna en ese sentido y por el contrario el perito a cargo de la pericia, señala que dicha situación obedecía a un daño en el retenedor de aceite y no a la omisión de mi parte de tener el mantenimiento adecuado en la tornamesa. Hecho probado. Del hecho noveno de la demanda, hecho controvertido. Lo realizado por el Taller Reysa se limitó a un simple avalúo técnico de la maquina, sin entrar a realizar reparación alguna al equipo.
Del hecho décimo de la demanda, hecho controvertido. Insiste nuevamente el representante de la parte demandada en las fechas del 7 de junio al 22 de junio del dos mil siete, situación ya demostrada en el hecho cinco y que no lleva razón el demandado. Se ha demostrado con el testimonio de los testigos de ambas partes que el equipo estuvo en los talleres de Esco por cerca de 60, así mismo se encontraba con desperfectos en el campo. Hecho probado.Del hecho décimo primero de la demanda, hecho controvertido. La parte demandada lo rechaza por ser ayuno de prueba. La prueba pericial fue clara en cuanto al estado del equipo adquirido. Si existe prueba. Hecho probado. Del hecho décimo segundo de la demanda, hecho no controvertido, la parte demandada lo acepta plenamente. Se insiste no es cierto que no se utilizará la garantía. Hecho probado.Del hecho décimo tercero de la demanda, hecho controvertido.
La parte demandada lo rechaza. Ya se ha demostrado por parte de la prueba testimonial, lo cual puede ser referido a los alegatos planteados en el hecho cinco de la demanda, así también a la prueba documental y pericial, la prueba es abundante y terminante. El equipo a pesar de las diferentes reparaciones continúo presentado problemas. Hecho probado. Del hecho décimo cuarto de la demanda, hecho controvertido. El testigo [Nombre6] , ofrecido por la parte actora, indica: "Si, yo hice un contrato con [Nombre1], pues yo tenía un contrato con la Estándar y necesitaba equipo y contábamos con la máquina que había adquirido [Nombre1], pero tuvo muchos desperfectos y estuvo muchos días parada, provoco daño ambiental pues regaba aceite, por lo que me cancelaron el contrato. Puedo decir que me cancelaron el contrato pues la maquina no funciono, con una pérdida de doscientos mil colones diarios". "Sé que la maquina se varaba pues había un cuerpo de válvulas que se reventaba, haciendo un derrame de aceite bastante considerable, debido a esos varonazos me vi obligado a rescindir el contrato con [Nombre1]" Hecho probado.
Del hecho décimo quinto de la demanda, hecho controvertido. La demandada lo rechaza. En el proceso que nos ocupa la demandada en razón de los vicios ocultos y garantía es garante de conformidad con los artículos 1034, 1035, 1036, 1037 y 1038 del Código Civil, por lo que no puede evadir responsabilidad, se ha demostrado de manera explícita los hechos demandados, aunado a ello es de pleno conocimiento de este despacho que el equipo sujeto del presente proceso fue embargado por el Banco Popular, sucursal Guápiles, mediante ejecución prendaria, expediente número 10-000018- 0930- CI, así consta a los folios 506, 507, 509, 510 y 511 del este expediente. Hecho probado." (sic).
V.En la sentencia que se examina, el juez estableció " la excavadora prácticamente presenta los mismos problemas mecánicos y así reafirmado mediante la confesión rendida por el apoderado de la sociedad demandada, visible a folio 481 en donde señala a grandes rasgos que el actor le compro la excavadora a su representada, que ya a los dos meses presentaba problemas de funcionamiento que se realizó el cambio en el banco de válvulas y que cinco meses después presentaba problemas en el rol de su tornamesa, acreditado además mediante las ordenes de trabajo visible a folios 5,6 y 7 en donde se describen los daños descritos y reafirmado mediante la prueba pericial rendida por el valuador nombrado en autos visible a folio 345, 502 y 547, generando con ello un circulo vicioso de reparaciones y de garantías en donde queda atrapado el actor." sin embargo rechazó el reclamo porque estimó que "los daños presentados por dicha excavadora, al ser un bien mueble nuevo, no de podían determinar y a su vez tener conocimiento sobre las deficiencias que posteriormente presentara".
Tal apreciación resulta equivocada, pues precisamente un vicio es oculto, cuando el defecto en la cosa no es evidente. Sobre el tema, la Sala Primera de la Corte Suprema de Justicia, en sentencia Nº 227 de las catorce horas quince minutos del veinte de diciembre de mil novecientos noventa y uno, expresó, "Los vicios ocultos se conceptúan como aquellos defectos no manifiestos de la cosa vendida, anteriores al contrato, que hacen impropia dicha cosa para los usos a que estaba destinada, que de haberlos conocido el comprador no hubiera hecho la adquisición o hubiera pagado menos precio por ella, en la inteligencia de que el vendedor no responde ni de defectos manifiestos o que están a la vista, ni aún de aquellos ocultos, siempre que el comprador haya estado en aptitud de conocerlos, lo que ocurre cuando por su condición de experto, considerando su oficio o su profesión, por ser él un perito que por razón de su oficio o profesión, deba suponerse que pudo fácilmente descubrirlos.
Esta obligación de garantía por los vicios de la cosa, tiene como fundamento el deber del vendedor de procurar al comprador no sólo la propiedad de la cosa, sino una posesión útil de la misma. Se funda también en el deber que impone la buena fe a todo contratante de informar al otro de aquellos hechos o circunstancias importantes que pudieran determinarlo a desistir del contrato. Para producir responsabilidad, estos vicios deben ser: a) ocultos o no manifiestos; b) ignorados del comprador; c) perjudiciales a la utilidad propia de la cosa y ch) anteriores a la venta. No es necesario que el vendedor haya conocido de tales vicios, ni tampoco que estos sean perpetuos o irremediables. Sobre el tema y en lo que interesa, esta Sala ha señalado que la garantía por vicios ocultos o redhibitorios "es un efecto natural del contrato de compraventa. Se refiere a la obligación del vendedor de entregar la cosa vendida y que ésta sea apta para cumplir con la función para la que normalmente está destinada, es decir que debe entregar la cosa en buen estado, sin vicios o defectos que hagan impropio, o afecten notablemente su uso normal.(...) siempre queda la posibilidad de la responsabilidad contractual común del vendedor, quien tiene la obligación de entregar la cosa en forma tal que cumpla su función normal a cabalidad; responsabilidad que podría derivar en una indemnización por daños y perjuicios, según la naturaleza del incumplimiento.
Si el vendedor entrega la cosa con algún vicio o defecto que la haga impropia para su función normal o la desmejore, incurre en un incumplimiento contractual, de conformidad con los artículos 692, 693, 701, 702, 704, y 764 del Código Civil, éste último en cuanto dispone que "el pago se hará bajo todos los respectos conforme al tenor de la obligación". Es una obligación implícita en la compraventa el entregar la cosa tal y como el comprador espera recibirla, de conformidad con lo acordado (artículo 764 y 1022 ibídem)". (Sentencia de esta Sala N° 320 de las 14:20 horas del 9 de noviembre de 1990). Los problemas de funcionamiento presentados por la excavadora objeto del litigio, calzan en el concepto de vicios ocultos, puesto que se trata de defectos no manifiestos. Los problemas de calentamiento, así como poca fuerza y velocidad se hicieron palpables con el uso del aparato, constituyen un impedimento para el buen funcionamiento del bien, eran desconocidos por el comprador, y además, existían desde antes de que se realizara la venta a favor del actora, desde que, con el estudio pericial se acreditó que se trata de problemas de fabricación.
Las reparaciones efectuadas por la vendedora no fueron suficientes para eliminar esos inconvenientes y no se puede obligar al comprador a aceptar las reparaciones en forma perpetua, pues si éste compró un aparato nuevo, es de esperar que el mismo funcione apropiadamente. De acuerdo con lo anterior, el reclamo del actor, sí es procedente, de manera que se debe revocar la sentencia en cuanto rechazó la existencia de vicios ocultos, para en su lugar acceder a esa pretensión, condenando a la parte accionada al reintegro del precio pagado por la retroexcavadora.
VI.El otro extremo que aborda la apelación del actor, es el rechazo de los daños y perjuicios. Al respecto, el a quo, consideró "En autos no se demostró en primer lugar que existiera por parte del actor con un tercero, un contrato de alquiler de la excavadora, tampoco se determina que sufriera algún deterioro en su armonía psíquica, emocional o afectiva, por consiguiente, al no demostrarse el extremo citado, no se podría otorgar dicho monto. En cuanto al perjuicio invocado, sea el lucro cesante, tenemos que es el daño patrimonial que se produce por la pérdida de una utilidad económica o de una ganancia legítima como consecuencia de un evento dañoso, representa aquello que se ha dejado de ganar ante el acontecimiento del daño, es decir tiene que existir una perspectiva cierta de beneficio para poder exigir una indemnización, la cuál se concede siempre que pueda comprobarse mediante la probanza correspondiente, el lucro cesante y su relación directa con el daño (artículo 1045 y siguientes del Código Civil).- Al igual que el extremo anterior, la parte únicamente se ha limitado a indicarlo, sin embargo, no demuestra mediante la respectiva probanza que haya sufrido dicho perjuicio económico como consecuencia de la situación jurídica expuesta, de ahí a que también proceda a rechazarse tal extremo.".
El rechazo del daño moral no se examinará porque no fue objeto de agravios. En cuanto a los perjuicios, pretende demostrar la existencia de un contrato de arrendamiento estimado en quince millones de colones (monto reclamado por el rubro de perjuicios) entre el actor y el señor [Nombre7] , padre del actor. Sin embargo, dicha prueba no es útil para acreditar ese negocio jurídico, toda vez que el artículo 351 procesal civil establece la prohibición de demostrar una convención jurídica superior al diez por ciento de la cuantía mínima del recurso de casación, con ese tipo de prueba, y para la fecha en que se inició el proceso, dicho monto se encontraba en dos millones de colones, el diez por ciento de esa suma es doscientos mil colones, ergo, no se podía acreditar la existencia de un contrato superior a ese monto, como el que nos ocupa, por medio de prueba testimonial. Si no se logró demostrar la existencia del contrato de arrendamiento, no se acreditó tampoco la existencia de los perjuicios derivados de la supuesta imposibilidad del actor de cumplir con la prestación a la que se obligó, dados los problemas que exhibía la máquina objeto de tal convenio.
VII.El juez rechazó los extremos a), b), g), h) e i) de la petitoria porque "obligar a la sociedad demandada a cesar las repercusiones judiciales en su contra; a que la sociedad demandada le indemnice las consecuencias de las acciones judiciales en su contra; no tienen relación con los hechos de este proceso y en cuanto a solicitar certificar al Banco Popular el detalle de gastos, pagos mensuales y solicitarle a la parte demandada certificar los pagos realizados por su persona, es parte de las probanzas solicitadas dentro del proceso y que no tiene que ver con la pretensión de este asunto ". Al apelar, el actor se limita a afirmar "es de pleno conocimiento de este despacho que el equipo sujeto del presente proceso fue embargado por el Banco Popular,(...)". Esa aseveración no constituye un agravio, porque el actor no expone las razones por las que estima que el juez resolvió de forma incorrecta.
VIII.La parte demandada también apela. Expone su disconformidad en los siguientes términos: "Al contestarse la demanda, se interpuso la excepción de prescripción, no como excepción previa sino como excepción de fondo. La demandada no es reconventora, por lo que no pide se declare la acción de prescripción como derecho sino como defensa o excepción no - previa (art. 306 del Código Procesal Civil en relación a los requisitos de la sentencia art. 155 inciso 3, aparte d y inciso 4, aparte ch). La actora funda su reclamo alegando la existencia de vicios ocultos, los que tienen el plazo de prescripción establecido en el artículo 450 del Código de Comercio. Al haberse interpuesto la excepción y por determinado el cuadro fáctico de la sentencia que operaron más de tres meses desde la entrega de la maquinaria y el planteamiento del proceso, (ver hechos probados a y h) lo que corresponde es declarar la pretensión como extinta por prescripción, por lo que solicito se revoque la sentencia recurrida para declarar con lugar la excepción de prescripción, lo que expresamente solicito.II.
Igualmente se interpuso la excepción de falta de derecho como contrato no cumplido. Pese a que rije al igual que con el reclamo anterior el principio de lura Novit Curia, se desdeña en sentencia por "falta de fundamentación". Dentro de las prestaciones sinalagmáticas del contrato realizado, se encuentra la obligación de garantía, la cual incluso fue extendida por parte de la demandada. Al apartarse inopinadamente del uso de la garantía, resulta la actora la primera incumpliente, razón por la cual no se encuentra en una situación de inoponibilidad contractual para el planteamiento de la acción. Posteriormente la sentencia retoma con otras palabras la excepción opuesta, la que debió acogerse y no rechazarse. Por tal motivo solicito se revoque la sentencia para en su lugar acoger las excepciones de falta de derecho - entendida como la excepción de contrato no cumplido y como su derivación la revocatoria de la exención en costas para en su lugar imponerlas a cargo de la actora, lo que expresamente solicito.".
IX.La excepción de prescripción fue rechazada por resolución de este Tribunal y Sección, N° 322 de las diez horas veinte minutos del treinta de setiembre de dos mil nueve, la que a la fecha se encuentra firme. Se trata entonces de un punto precluido, resuelto en forma definitiva (artículo 303 procesal civil), en consecuencia resulta estéril el intento de la parte accionada de retomar su discusión.
X.En la sentencia se descartó la tesis del incumplimiento de actor por apartarse "inopinadamente del uso de la garantía". Al respecto, se aseveró " Alega la parte demandada que los desperfectos presentados en la excavadora son producto del mal uso por parte del actor, ya que el bien estuvo funcionamiento en un medio no recomendado por el fabricante, sin embargo, en autos no logró acreditar mediante la probanza correspondiente que las fallas presentadas sean responsabilidad del actor puesto que mediante el peritaje practicado en autos en la excavadora así como el reconocimiento practicado sobre la misma y visible a folios 345, 502 y 547 se determina que no presentaba problemas de obstrucción por sedimentos o abastecimientos de agua corriente. Fue únicamente por medio de la prueba testimonial que la parte demandada trata de probar la mala utilización por parte del actor de la excavadora,según consta a folio 565, cuando uno de los testigos ofrecidos Señala literalmente: "... la máquina estaba siendo utilizada para trabajos de canalización inclusive en condiciones de lodo o sumergidas parcialmente al agua que no era la finalidad para la que se vendieron las máquinas..."; no obstante, debe de tener presente que no es el medio probatorio correcto para demostrar este extremo, además de que sin poner en duda la honorabilidad de los testigos examinados dentro de este proceso, al ser ofrecidos por la misma no dejan de ser testigos complacientes de los hechos que pretende demostrar la parte demandada." (sic). Ese razonamiento del juez no es impugnado por el apelante, razón suficiente para eliminar su protesta.
POR TANTO:
Se revoca la sentencia en cuanto rechazó el reclamo por vicios ocultos, para en su lugar acogerlo en la forma que se dirá. Se condena a Esco de Costa Rica S.A, hoy Harsco Infraestructura, Costa Rica, Sociedad Anónima a reintegrarle a [Nombre1] el precio pagado por la excavadora objeto de este asunto.
