APPEAL OF JUDGMENT (RECURSO DE APELACIÓN DE SENTENCIA) filed in the present proceedings against [Nombre1], identity card CED1, son of [Nombre2] and [Nombre3], for the offense of VIOLATION OF THE FISHERIES LAW, to the detriment of NATURAL RESOURCES. Judges [Nombre4] and [Nombre5], and Judge Jorge Luis Morales García, participated in deciding the appeal. Attorney [Nombre6], acting as public defender (defensora pública) for the accused (encartado), [Nombre1], and Attorney [Nombre7], acting as Criminal State Attorney (Procurador Penal), appeared in the appeal proceedings.

FINDINGS:

  1. 1By judgment number 425-P-2013, issued at thirteen hours and thirty-five minutes on the thirtieth of September, two thousand thirteen, the Criminal Court of the First Judicial Circuit of Puntarenas ruled: “THEREFORE: Pursuant to the foregoing; Articles 39 and 41 of the Political Constitution; Articles 16, 42, 110, 184, 267, and 360 through 367 of CPC 1; Articles 45, 69, 71 THROUGH 74, AND 150 OF THE Fisheries Law; and Articles 16 and 42 of Decree No. 36562-JP on the Schedule of Attorneys’ Fees, [Nombre8] is hereby found responsible for the offense of UNLAWFUL VIOLATION OF THE FISHERIES LAW, to the detriment of Natural Resources, and for said offense is ordered to pay five base salaries, corresponding to the sum of ONE MILLION FIVE HUNDRED EIGHTY-ONE THOUSAND COLONES, in accordance with the salary decree in effect for 2011. The accused is ordered to pay the costs of the proceedings (costas del proceso).Once this judgment becomes final, the customary official communications shall be sent to the Instituto Nacional de Criminología and the Registro Judicial. 2).- The definitive forfeiture (comiso definitivo), in favor of the Costa Rican State, of the proceeds from the sale of the seized marine product, set at the sum of TWO HUNDRED NINETY THOUSAND SEVEN HUNDRED COLONES, is hereby ordered. 4).- The civil action for damages (acción civil resarcitoria) brought by the COSTA RICAN STATE, represented by Criminal State Attorney Attorney [Nombre9], against the civil defendant (demandado civil), [Nombre10], is hereby granted, with the amount of the award to be determined in subsequent proceedings (condena en abstracto). The accused is ordered to pay personal costs (costas personales), the amount of which shall be determined in subsequent proceedings. Let notice be given. [Nombre11]. Trial Judge.”
  2. 2Attorney [Nombre6], acting as public defender for the accused, [Nombre1], and Attorney [Nombre7], acting as Criminal State Attorney, appeared in the appeal proceedings challenging the foregoing decision.
  3. 3After the corresponding deliberation was conducted in accordance with Article 465 of the Code of Criminal Procedure, the Court proceeded to hear the appeal.
  4. 4The relevant statutory requirements have been observed throughout the proceedings.

Judgment drafted by Appeals Judge [Nombre12]; and,

CONSIDERING:

I.Attorney [Nombre6], public defender for defendant (imputado) [Nombre1], appeals judgment number 425-P-2013, issued by the Criminal Court of the First Judicial Circuit of Puntarenas at 13:35 on September 30, 2013, basing the appeal on Articles 437, 438, 439, 458, 459 through 462, 465, and 466 of the Code of Criminal Procedure, according to the brief appearing at pages 222 through 226.

II.In the first ground of appeal, she alleges: “Failure to state the grounds for the judgment, in relation to the mistake of law (error de prohibición) alleged at trial.” She bases this claim legally on Article 142 of the Code of Criminal Procedure. She argues that the defense alleged a mistake of law that the Trial Court did not analyze, referring to that issue only “superficially” in the judgment without stating the reasons why that defense argument was not credible. She further states that the court below began by crediting the prosecution witnesses’ testimony that the necessary information was provided in the area so that fishers would know which species were protected; however, she challenges the fact that no report was ever provided concerning publicity of the prohibition for which her client was convicted. She also asserts that the judgment fails to satisfy the duty to state reasons, insofar as it proceeds from the premise that the defendant has been a fisher for several years, a circumstance that does not mean that he was required to know every species subject to a closed season and the applicable periods.

It was not proven at trial that he knew his conduct was unlawful, and even if information concerning the closed season existed, the court failed to consider that he lives in a remote area. She therefore maintains that the accused transported the product without knowing that it was protected, which should result in his acquittal or, alternatively, the judgment against him should be vacated. The argument cannot succeed. Upon review of the judgment issued in these proceedings, the theory advanced by defense counsel must be rejected. On the one hand, errors in the statement of reasons are alleged, but none are found, since the trial judge analyzed the defense objection concisely in Considerando IV, entitled legal characterization (tipicidad) (cf. folios 213 to 216). It is important to note that, although defense counsel’s assertions that the defendant was unaware of the closed season applicable to the aquatic product transported in October 2011 should have been analyzed under culpability (culpabilidad), the court below addressed that circumstance under legal characterization, specifically as it pertained to his knowledge for purposes of criminal intent (dolo).

In this regard, the judgment stated: “The denial that the defendant acted with criminal intent has been one of the principal arguments presented by counsel for the accused. Counsel for [Nombre13] based the defense strategy on the absence of the cognitive element required to establish criminal intent. Specifically, it was argued that Captain [Nombre14] was transporting Camarón Carabalí without actual knowledge that fishing it was illegal and, moreover, that he did not know that it was subject to a closed season. This Trial Court does not accept that proposition, which it finds inconsistent with the body of evidence in the record and contrary to the rules of logic and rational experience. First, it must be noted that it has been established that the accused, [Nombre14], has been a fisher for many years. He also holds a CED2 authorizing him to fish for Camarón blanco, which specifies the characteristics of the authorized net, and he also holds a CED3, which necessarily entails knowledge of the laws governing fishing.

The witnesses heard at trial were unequivocal regarding the talks and means of communication used to alert fishers about the closed season. Given that the defendant, [Nombre14], has been a fisher for many years and holds documents authorizing him to engage in this occupation, under the rules of sound judicial discretion (sana crítica), logic, and experience, he knows when a closed season is in effect and that Incopesca prohibits fishing for certain marine species in order to prevent environmental damage. Finally, the volitional element of criminal intent has likewise been established because, despite knowing that fishing was not permitted at the location where they were and the undisputed fact that they had no permit whatsoever to conduct any fishing activity there, the fact remains that the defendant, [Nombre14], proceeded to transport Camarón Carabalí during the closed season. For the reasons stated, the proven conduct is deemed to constitute the offense of illegal transportation of aquatic flora and fauna products, established and punishable under Article 150 of the Fisheries and Aquaculture Law, thereby ruling out the alleged mistake of fact (error de hecho), which must correctly be understood as a mistake as to the elements of the offense (error de tipo) provided for in the first paragraph of Article 34 of the Criminal Code, as invoked by defense counsel [Nombre15]” (verbatim transcription, Considerando IV.

Legal characterization, folios 215 to 216). The assessment in this section of the judgment is understandable, since defense counsel’s closing argument was unclear and even expressly asserted that the criminal intent with which her client had acted had not been established and that he should therefore be acquitted. That was the specific basis on which she concluded her closing argument, stating that there was an unavoidable mistake of law (error de prohibición invencible) “because the essential element of criminal intent required to complete the offense was absent.” In the digital file e:\11-203995-0431-pe-e2 juicio\c0002130925140000.vgz, the aforementioned argument can be heard beginning at minute 14.28.37, as follows: “... if we proceed to analyze the theory of the offense (teoría del delito) ... for an act to be declared culpable or criminal, it must constitute conduct that satisfies the elements of the offense, is unlawful, and is culpable ...” Referring to the latter point, she further asserted: “... that the person who performs it, or is said to have performed it, must possess the required criminal intent, that is, the intent to engage in conduct that satisfies the elements of the offense, is unlawful, and is culpable. ...

Could we say in this case that my client acted with criminal intent ....” Similarly, at minute 14.40.37 of the same file, counsel stated: “... it is very easy to come here and state that a person violated the law, but we must prove the criminal intent, that it actually existed, and the defense does not have to prove this criminal intent; it must be proven by—the burden of proof rests with—the Public Prosecution Service and, in this case, the Office of the Attorney General of the Republic ... where, as I repeat, are any minutes, any document, anything signed, that would actually inform me that sufficient instructions had been provided in the Isla Venado area for people to know that this species could not be fished, that this species was subject to a closed season, or that it could not be transported either? We have no evidence of any of that, and we cannot require knowledge when we have not proven that sufficient information was actually provided to the people ....” In other words, at this procedural stage the defense challenges the trial judge’s reasoning as erroneous because she failed to assess the alleged mistake of law.

However, review of the trial recording confirms that counsel’s argument centered on the defendant having acted without criminal intent. The trial judge addressed this circumstance in determining whether the investigated person’s unlawful act satisfied the elements of the offense. It is now necessary to emphasize the distinction between a mistake as to the elements of the offense, as analyzed by the Trial Court (cf. folio 216), and a mistake of law. The latter was defined by the Third Chamber in decision 2013-00543, issued at eleven thirty-eight in the morning on the seventeenth of May, as follows: “Regarding mistake, this Chamber has previously stated: ‘[…] In accordance with the wording of Articles 34 and 35 of the Criminal Code (which employs the now-outdated terminology of mistake of fact and mistake of law), a mistake of law entails a flawed interpretation of the act or of the rule itself, leading the perpetrator to believe falsely that the circumstances justifying his conduct satisfying the elements of the offense exist in the particular case—that is, that the legal system authorizes the action defined by the offense (indirect mistake of law [error de prohibición indirecto])—or that the act he performs is not punishable, in which case the mistake concerns not the circumstances but the prohibition itself (direct mistake of law [error de prohibición directo]).

By contrast, in a mistake as to the elements of the offense, the individual mistakenly assumes that one of the descriptive elements of the offense is absent. This Chamber’s case law has established that such a mistake requires a false understanding on the part of the actor, who erroneously believes that his conduct does not constitute an offense: “... Article 34 of the Criminal Code addresses only issues of legal characterization, such that a person acting under a mistake as to the elements of the offense actually acts without criminal intent; therefore, if the mistake was avoidable, that person would be punished for negligent conduct (conducta culposa), provided that it is defined as an offense in parallel with the intentional offense (Article 34 of the Criminal Code).” From everything stated above, it can readily be inferred that a mistake regarding the circumstances contemplated by the objective elements of the offense (tipo objetivo), which must be known at the level of its subjective elements (tipo subjetivo), is a phenomenon that negates criminal intent when, although the objective elements of the offense are present, knowledge of the elements required by those objective elements either does not exist or is false.

As Article 34 states, the mistake (false knowledge or ignorance) of fact must concern “... any of the requirements necessary for the offense to exist according to its definition ....” In cases involving a mistake as to the elements of the offense, the purpose contemplated by the offense disappears—that is, the intent to carry out its objective elements—and, where that volition is absent, there is no criminal intent and the conduct therefore does not satisfy the elements of the offense ... a mistake as to the elements of the offense (one concerning its objective elements) may be one of fact or law; likewise, a mistake of law may arise from false knowledge or ignorance of the fact giving rise to a situation that we believe to be justified, or of the rule prohibiting the conduct. Accordingly, legal scholarship prefers to refer to a mistake as to the elements of the offense (analyzed under legal characterization) and a mistake of law (analyzed under culpability) ...

When Article 35 of the Criminal Code states that an unavoidable mistake must concern the situation or “act” being performed not being subject to punishment, it means directly that the perpetrator must falsely believe that the act is not punishable, which may occur when: a) The perpetrator acts without knowing that what he is doing falls within the prohibitive scope of the Rule; b) the perpetrator believes that the Legal System grants him permission to act; c) the perpetrator believes that he falls within the scope of a justification (causa de justificación) when he actually does not. These three situations are included in the statutory formula devised by the Code, and there thus appears to be no difficulty in including here the elements of direct and indirect mistake of law. Under this terminology, which is fully compatible with our Code, direct mistake concerns knowledge of the prohibitive Rule (for example, the rule “You shall not take land from another citizen,” which precedes the offense of unlawful occupation), while indirect mistake means the false supposition that permission exists when the law does not grant it, as well as issues of putative justification ....’ Third Chamber of the Supreme Court of Justice, decision N° 446-F-92, issued at 15:25 hours on 25 de setiembre de 1992.

Similarly, it has been stated that ‘... Traditionally, in Criminal Law as in other branches of Law, mistake of fact and mistake of Law are discussed as categories that are different in principle, although some believed they should receive the same treatment. In modern legal scholarship, however, that distinction is replaced by the distinction between mistake as to the elements of the offense and mistake of law ...’ (Decision n° 695, issued at fifteen hours and ten minutes on veintinueve de junio del 2007, Third Chamber of the Supreme Court of Justice).”

It may clearly be inferred from that precedent that the analysis conducted by the court below (a quo) regarding the challenged decision was erroneously oriented; however, that circumstance does not mean that this ground of appeal should be upheld. Despite the shortcomings in defense counsel’s objection on that occasion (when presenting her closing arguments), from a technical standpoint, the proper analysis by the court below should have focused on determining whether there was a direct mistake of law (error de prohibición directo), insofar as counsel questioned the absence of documents proving that the accused had been informed of the closed season (veda) applicable to the products for which he was convicted, namely, the transportation of aquatic products (5 sacks of carabalí shrimp weighing approximately 152 to 153 kilograms). Nevertheless, the trial judge’s erroneous assessment does not render her judgment ineffective, because defense counsel seeks to require a document to prove that circumstance, which is improper under our system of freedom of evidence (libertad probatoria).

It can be determined that, for this purpose, the Judicial Authority based its analysis on all the evidence and concluded that, because the accused had been a fisherman for several years and held CED4 and CED3, he was required to know the closed-season periods. This Court of Appeal fully agrees with that conclusion, applying the rules of reasoned sound judgment (sana crítica racional) (cf. Considerando IV. Legal characterization of the offense (Tipicidad), pages 215-216). Accordingly, it is concluded that the ground of appeal concerning the existence of a mistake of law (because the defendant allegedly did not know of the transportation prohibition) amounts to a subjective argument against the decision that is unsupported by any evidence. Moreover, it cannot even be established that the defendant referred to this issue, because he did not testify at trial and thereby confirm what defense counsel alleges (cf.

Considerando segundo: summary of evidence (sumario de pruebas), p. 207). Consequently, his challenge must be denied. The second ground of appeal alleges: “Failure to state reasons regarding the civil judgment.” Counsel objects that the challenged judgment contains only a cursory reference to the private prosecution (querella) and civil action, as reflected in Considerando VII, while omitting the reasons for issuing the civil judgment, thereby violating due process (debido proceso). She therefore requests that her client be “acquitted” of civil liability because there are no procedural grounds for maintaining the judgment imposed. This ground is upheld. Article 142 of the Code of Criminal Procedure provides: “Judgments and orders shall contain clear and precise reasoning. They shall set forth the factual and legal grounds on which the decisions are based, as well as the weight assigned to the evidence.

A mere recitation of the evidence or mention of the parties’ requests shall under no circumstances substitute for a statement of reasons. The reasoning shall be insufficient when forms, dogmatic assertions, routine phrases, a mere description of the facts, or the mere mention of evidentiary items are used. There is no adequate statement of reasons when the rules of reasoned sound judgment have not been observed with respect to evidence or evidentiary items of decisive value. Orders and judgments lacking a statement of reasons shall be ineffective.” Thus, every decision must provide its reasoning so that it may be understood by the parties to the proceedings and thereby safeguard fundamental rights and guarantees. In this case, from a civil standpoint, the court below failed to fulfill its duty to state the reasons for that aspect of the decision, and the alleged defect is therefore established.

It can be seen in Considerando VIII, referring to the private prosecution and civil action for damages (acción civil resarcitoria), that the challenged judgment merely stated: “Likewise, from the civil perspective, the civil action for damages brought by the Procuraduría General de la República against [Nombre16] must be upheld. Pursuant to Articles ,150 of the Fisheries and Aquaculture Law and sections 632, 1045 and 1163 of the Civil Code, the defendant is ordered, with the amount to be determined in subsequent proceedings (en abstracto), to pay costs” (cf. page 219). This confirms the complete omission of the factual and legal reasons on which the civil claim brought against civil defendant [Nombre14] was granted. This prejudices the person held liable because he does not know the trial judge’s reasoning and is therefore unable to challenge it before this Chamber. Accordingly, this ground must be upheld, and the judgment is declared ineffective insofar as it granted the civil action. The matter is remanded for a newly constituted panel to issue the appropriate ruling on this issue.

POR TANTO

The appeal filed by attorney [Nombre6], public defender for [Nombre1], is hereby partially granted. The judgment under appeal is vacated solely with respect to the civil award; in all other respects, it remains undisturbed. The case is remanded for new proceedings on that issue. RECURSO DE APELACIÓN DE SENTENCIA interpuesto en la presente causa seguida contra [Nombre1] , cédula de identidad CED1, hijo de [Nombre2] y [Nombre3] , por el delito de INFRACCIÓN A LA LEY DE PESCA en perjuicio de LOS RECURSOS NATURALES . Intervienen en la decisión del recurso, las juezas [Nombre4] , [Nombre5] y el juez Jorge Luis Morales García. Se apersonan en Apelación de Sentencia, la licenciada [Nombre6] , en condición de defensora pública del encartado [Nombre1] , el licenciado [Nombre7] , en calidad de Procurador Penal.

RESULTANDO:

  1. 1Que mediante sentencia número 425-P-2013, de las trece horas treinta y cinco minutos del treinta de setiembre de dos mil trece, el Tribunal Penal del Primer Circuito Judicial de Puntarenas, resolvió: " POR TANTO: De conformidad con lo expuesto, artículos 39, 41, de la Constitución Política, 16, 42, 110, 184, 267, 360 a 367, del CPC 1, 45, 69, 71 A 74, 150 DE LA Ley de Pesca, artículos 16 y 42 del decreto Nº 36562- JP del Arancel de honorarios de Abogados se declara a [Nombre8] responsable del delito de INFRACCIÓN ILEGAL A LA LEY DE PESCA en perjuicio de los Recursos Naturales, y por tal delincuencia se le imponen la cancelación de cinco salarios base que corresponden a la suma de UN MILLÓN QUINIENTOS OCHENTA Y UN MIL COLONES de acuerdo al decreto de salarios vigente para el año 2011. Se condena al encartado al pago de las costas del proceso Firme esta sentencia se remitirán los oficios de estilo ante el Instituto Nacional de Criminología y al Registro Judicial. 2).- Se ordena el comiso definitivo a favor del Estado Costarricense de la venta del producto marino incautado fijado en la suma de DOSCIENTOS NOVENTA MIL SETECIENTOS COLONES . 4).- Se declara con lugar la acción civil resarcitoria promovida por el ESTADO COSTARRICENSE representada por el señor Procurador Penal, Lic. [Nombre9] en contra del demandado civil [Nombre10] la cual se condena en abstracto. Se condena al imputado a las costas personales las cuales se fijan en abstracto. Notifíquese. [Nombre11] . Jueza de Juicio ".
  2. 2Que contra el anterior pronunciamiento, se apersona n en Apelación de Sentencia, la licenciada [Nombre6] , en condición de defensora pública del encartado [Nombre1] , el licenciado [Nombre7] , en calidad de Procurador Penal.
  3. 3Que verificada la deliberación respectiva de conformidad con lo dispuesto por el artículo 465 del Código Procesal Penal, el Tribunal procedió a conocer del recurso.
  4. 4Que en los procedimientos se han observado las prescripciones legales pertinentes.

Redacta la jueza de Apelación de Sentencia [Nombre12] ; y,

CONSIDERANDO:

I.La licenciada [Nombre6] , defensora pública del imputado [Nombre1] , interpone recurso de apelación de la sentencia número 425-P-2013 dictada por el Tribunal Penal del Primer Circuito Judicial de Puntarenas, a las 13:35 horas del 30 de setiembre de 2013 fundamento el recurso en los artículos 437, 438, 439, 458, 459 a 462, 465 y 466 del Código Procesal Penal según escrito de folios 222 a 226.

II.En el primer motivo de apelación alega: "Falta de fundamentación de la sentencia, en relación al error de prohibición alegado en debate". Sustenta jurídicamente este reclamo en el numeral 142 del Código Procesal Penal. Argumenta que la defensa alegó un error de prohibición el cual el Tribunal no analiza, refiri éndose en sentencia "superficialmente" a dicho aspecto sin dar las razones por las que no merece crédito tal argumento defensivo. Expone además que el a quo partió en darle credibilidad a los testigos de cargo al exponer que en la zona se impartía la información necesaria a fin de que los pescadores conocieran las especies protegidas, sin embargo, cuestiona que nunca se suministró informe referente a la propaganda de la prohibición por la que se le condena a su patrocinado. Aduce por otro lado, que la sentencia incumple el deber de fundamentación, en el tanto se parte de la premisa de que el encartado es pescador de varios años, situación que no conlleva a que deba de conocer todas las especies en veda y plazos, no demostrándose en juicio que conociera el carácter ilícito de su actuar y en todo caso si la información de veda existió, no se valoró que vive en una zona alejada, por ello estima que el acriminado transportó el producto sin conocer la protección que recaía, conllevando este aspecto a su absolutoria o bien subsidiariamente debe de anularse la sentencia en su contra.

El alegato no puede prosperar. Revisado el fallo dictado en el presente proceso debe de descartarse la tesis de la defensa técnica. Por un lado, se cuestiona errores de fundamentación que no se verifican en el tanto, la Jueza de sentencia analiza la objeción defensiva en forma concisa en el considerando IV denominado tipicidad (cfr. folios 213 a 216). Es importante rescatar que si bien es cierto, las consideraciones esbozadas por la abogada defensora referente a un desconocimiento del encartado de la veda del producto acuático transportado en el mes de octubre de 2011 correspondería ser analizado dentro de la culpabilidad, el a quo se ocupó de esa circunstancia en la tipicidad, específicamente en lo que atañe al conocimiento del dolo de su parte. En este sentido se señaló: "Ha sido la negación de un actuar doloso del encartado uno de los principales argumentos expuestos por los señora defensora del justiciable [Nombre13] ha cimentado la estrategia defensiva en la ausencia del elemento cognitivo requerido para la configuración del dolo específicamente, sobre el particular se ha aducido que el capitán [Nombre14] transportaba el Camarón Carabalí sin tener un conocimiento efectivo acerca de que era ilegal su pesca, y además de que no sabía que estaban en veda.

Este tribunal no comparte esta propuesta la que estima se encuentra alejada del repertorio probatorio existente en autos y además resulta contraria a las reglas de lógica y experiencia racional. En primer término ha de señalarse que se ha tenido por acreditado que el Justiciable [Nombre14] , es pescador hace muchos años, además poss ee una CED2 que lo acredita para pescar Camarón blanco, en las cuáles se encuentran las características de la malla otorgada, además cuenta con un CED3 , que importa necesariamente un conocimiento sobre las leyes que rijen la pesca. Han sido contundentes los testigos recibidos en debate acerca de las charlas, medios de Comunicación utilizados para alertar a los pescadores sobre la época de veda. Siendo que el señor imputado [Nombre14] es pescador hace muchos años, y posee documentos que lo acreditan para ejercer este Oficio de acuerdo a las reglas de la sana crítica , la lógica y la experiencia, conoce cuando se está en período de veda, y la prohibición por parte de Incopesca para pescar ciertas especies marinas,con la finalidad de no generar un daño ambiental.

Finalmente el elemento volitivo del dolo igualmente se encuentra acreditado pues a pesar del conocimiento de que en el sitio en que se encontraban no se permitía la pesca, así como el hecho incontrovertido de que no se contaba con permiso alguno para la ejecución de faena de pesca alguna en tal lugar, es lo cierto que el encartado [Nombre14] procedió a transportar Camarón Carabalí , en época de veda.Por los argumentos expuestos se estima la conducta demostrada tipifica el delito de transporte de ilegal de productos de flora y fauna acuáticosprevisto y sancionado en el artículo 150 d ela Ley de Pesca y Acuicultura , descartándose en consecuencia la existencia del alegado error de hecho que correctamente ha de entenderse como un error de tipo previsto en el párrafo primero del artículo 34 del Código Penal que fuere invocado por la defensora [Nombre15] " (transcripción literal, considerando IV.

Tipicidad, folios 215 a 216). La valoración en este acápite en sentencia es entendible al determinarse que la defensa técnica en sus conclusiones fue confusa sobre su alegato e incluso refirió expresamente que no se constataba el dolo con el que había actuado su representado y por ello debía absolverse. Esa fue la razón concreta con la que finalizó (su alegato conclusivo) señalando que se estaba en presencia de un error de prohibición invencible "al no completarse el tipo penal con el elemento esencial del dolo". Del archivo digital e:\11-203995-0431-pe-e2 juicio\c0002130925140000.vgz, se puede escuchar la intervención aludida a partir del minuto 14.28.37 en el siguiente sentido: "... si nos vamos a analizar la teoría del delito ...para que un acto sea declarado culpable o delito tiene que ser una conducta típica antijurídica y culpable ..." Refiriéndose a este último punto adujo además " ... que la persona que la realiza o la dice realizar tenga el dolo requerido, es decir, su intención de realizar conducta típica antijurídica y culpable. ...

Podríamos en este caso decir que mi representado ha actuado con el dolo ....". En igual sentido, al minuto: 14.40.37 del mismo archivo la profesional expuso: " ... es muy fácil venir a indicar que una persona incumple la ley, pero debemos demostrar el dolo, que efectivamente existió y este dolo no lo tiene que demostrar la defensa, este dolo lo tiene que, la carga de la prueba la tiene el Ministerio Público y en este caso la Procuraduría General de la República ... a dónde están como repito, alguna acta, algún documento, algo firmado, que efectivamente me haga saber que en la zona de Isla Venado se había dado la instrucción suficiente para saber que esta especie no se podía pescar o esta especie estaba en veda o tampoco se podía transportar, de eso no nos consta tampoco nada y no podemos exigir conocimiento cuando no hemos demostrado que efectivamente se ha dado la información suficiente a las personas ...".

Es decir, la defensa cuestiona a esta altura procesal el razonamiento de la juzgadora como equivocado por no valoración del error de prohibición que alegó, sin embargo, verificada la grabación del debate, se constata que su alegato giró en torno a la actuación del encartado sin dolo. Esta circunstancia fue abordada por la Juzgadora de sentencia para determinar la tipicidad de la acción ilícita del investigado. Ahora, debe rescatarse la diferencia del error de tipo (como fue analizado por el Tribunal (cfr. folio 216) del error de prohibición. Este último, se ha definido por la Sala Tercera en resolución 2013-00543 de las once horas y treinta y ocho minutos del diecisiete de mayo como: "En cuanto al error esta Sala ya ha indicado lo siguiente: “[… ]De conformidad con la redacción que incorporan los artículos 34 y 35 del Código Penal (donde se utiliza la nomenclatura en el Código Penal -ya superada- de error de hecho y de derecho), el error de prohibición supone una defectuosa interpretación del hecho o de la norma en sí misma, lo que lleva al sujeto activo a creer falsamente que en la especie se dan las circunstancias que justificarían su conducta típica, es decir, que existe una autorización del ordenamiento jurídico para realizar la acción prevista por el tipo penal (error de prohibición indirecto), o que el hecho que realiza no está sujeto a pena, en cuyo caso el error no recae sobre las circunstancias sino sobre la prohibición misma (error de prohibición directo).

Por el contrario, en el error de tipo el individuo supone equívocamente, la ausencia de configuración de uno de los elementos descriptivos del tipo penal. La jurisprudencia de esta Sala ha establecido que para que se dé un error de tipo se requiere de esa falsa representación de parte del sujeto actuante, quien de manera errónea cree que su conducta no es configurativa de delito: “…el artículo 34 del Código Penal consigna, solamente, problemas de tipicidad, de manera que quien se encuentre en un supuesto de error de tipo, en realidad actúa sin dolo, por lo que si su error es vencible se le castigaría por la conducta culposa si ésta se encuentra descrita paralelamente a la tipicidad dolosa (artículo 34 C .P.)." De todo lo dicho anteriormente, se puede fácilmente colegir que el error sobre las circunstancias previstas en el tipo objetivo (y que tienen que conocerse a nivel de tipo subjetivo) es un fenómeno que determina la ausencia de dolo cuando, habiendo una tipicidad objetiva no existe o es falso el conocimiento de los elementos requeridos por el tipo objetivo.

Como lo dice el artículo 34: el error (falso conocimiento o ignorancia) de hecho debe recaer sobre "...algunas de las exigencias necesarias para que el delito exista según su descripción..." En los casos de error de tipo desaparece la finalidad típica, es decir, la voluntad de realizar el tipo objetivo y al no haber ese querer no hay dolo y por ende la conducta es atípica ... el error de tipo (aquél que recae sobre los elementos del tipo objetivo) puede ser de hecho o de derecho, lo mismo, un error de prohibición puede provenir de un falso conocimiento o ignorancia del hecho que genera una situación que creemos justificada o sobre la norma que prohíbe la conducta. Por ello, la doctrina prefiere referirse al error de tipo (ubicado su análisis en la tipicidad) y el error de prohibición (ubicado su análisis en la culpabilidad) ... Cuando el Código Penal dice en el artículo 35 que el error invencible debe recaer sobre la situación o "hecho" que se realiza no está sujeta a pena, quiere significar directamente que el sujeto debe creer falsamente que el hecho no está sujeto a pena, lo que puede suceder cuando: a) El sujeto actúa sin saber que lo que realiza se encuentra dentro del ámbito prohibitivo de la Norma; b) el sujeto que actúa considera que el Ordenamiento Jurídico le concede un permiso para su actuación; c) El sujeto que actúa piensa que está dentro del ámbito de una causa de justificación cuando en realidad no lo está.

Estos tres supuestos están incluidos en la fórmula legal concebida por el Código, por lo que no parece haber problema alguno para incluir aquí los elementos del error de prohibición directo e indirecto. En esta nomenclatura, plenamente compatible con nuestro Código, el error directo recae sobre el conocimiento de la Norma prohibitiva (el "No quitarás el terreno a otro ciudadano", norma penal antepuesta al tipo penal de usurpación, por ejemplo), mientras que el error indirecto, viene a significar la falsa suposición de la existencia de un permiso que la ley no otorga, y los problemas de justificación putativa .. .” Sala Tercera de la Corte Suprema de Justicia, voto N° 446-F-92, de las 15:25 horas del 25 de setiembre de 1992. En el mismo sentido se ha dicho que “… Tradicionalmente, en Derecho Penal como en otras ramas del Derecho, se habla de error de hecho y error de Derecho como categorías en principios diferentes, aunque para algunos debían tener igual tratamiento.

Sin embargo, en doctrina moderna se sustituye esa distinción por la de error de tipo y error de prohibición…” (Voto n° 695 de las quince horas y diez minutos del veintinueve de junio del 2007, Sala Tercera dela Corte Suprema de Justicia)". Claramente se puede inferir de dicho antecedente, la errónea inclinación en cuanto al análisis realizado por el a quo sobre lo que se recurre, pero esa circunstancia no conlleva a que deba prosperar este motivo de apelación. A pesar de las falencias de la objeción de la defensora en aquella oportunidad (al emitir sus conclusiones), desde el punto de vista técnico, el análisis correcto por el a quo debía de enforcarse a determinar la existencia o no de un error de prohibición directo, en el tanto la profesional cuestionó la inexistencia de documentos que acreditaran le habían informado al encartado de la veda de productos por la que condenó, es decir, por el transporte de productos acuáticos (5 sacos de camarones carabalí con peso aproximado de 152 a 153 kilogramos).

Sin embargo, la errónea valoración de la Juzgadora de instancia no convierte su fallo en ineficaz, al pretender la defensa técnica un documento para probar esa circunstancia, lo cual de acuerdo a nuestro sistema de libertad probatoria es improcedente. Se puede determinar que la Autoridad Jurisdiccional partió en su análisis de todos los medios probatorios para tal efecto, llegando a la conclusión que el sindicado por su condición de pescador de varios años, ostentar CED4 y CED3 requería un conocimiento de los períodos de veda, aspecto del cual este Tribunal de Apelación comparte en un todo aplicando las reglas de la sana crítica racional (cfr. Considerando IV. Tipicidad, folios 215-216). Por ello, se concluye que el motivo de apelación atinente a la existencia del error de prohibición (por no tener conocimiento el imputado de la prohibición de transporte) se convierte en un alegato subjetivo en contra de la decisión que no se deriva de medio probatorio alguno, aunado a que, ni tan siquiera se puede advertir se escuchara referencia sobre ese extremo por el imputado al no declarar en juicio y de esa manera ratificara lo que la defensa técnica aduce (cfr.

Considerando segundo: sumario de pruebas, pág. 207), de manera que, debe declararse sin lugar su impugnación. En el segundo motivo de apelación se recurre por: "Falta de fundamentación en cuanto a la condenatoria civil". Objeta que el fallo recurrido contiene una escueta referencia a la acción civil y querella según lo que se aprecia del considerando VII omitiéndose dar las razones por las que se emite el fallo civil, lo cual produce una violación al debido proceso. Ante ello, pide se "absuelva" civilmente a su representado al no existir razones procesales para mantener la condena impuesta. El motivo se declara con lugar. Señala el artículo 142 del Código Procesal Penal que: "Las sentencias y los autos contendrán una fundamentación clara y precisa. En ella se expresarán los razonamientos de hecho y de derecho en que se basan las decisiones, así como la indicación del valor otorgado a los medios de prueba.

La simple relación de las pruebas o la mención de los requerimientos de las partes no reemplazará, en ningún caso, la fundamentación. Será insuficiente cuando se utilicen formularios, afirmaciones dogmáticas, frases rutinarias, la simple descripción de los hechos o la sola mención de los elementos de prueba. No existe fundamentación cuando se hayan inobservado las reglas de la sana crítica, con respecto a medios o elementos probatorios de valor decisivo. Los autos y las sentencias sin fundamentación serán ineficaces." De esta manera, toda resolución debe de razonarse para efectos de comprensión por los sujetos procesales y con ello garantízarse derechos y garantías fundamentales. En este caso, se incumple desde el punto de vista civil con el deber de fundamentar el a quo ese extremo y consecuentemente se verifica el vicio acotado. Se puede observar en el considerando VIII, aludido a la querella y acción civil resarcitoria que en la sentencia recurrida únicamente se señaló: "Desde la perspectiva civil igualmente se ha de declarar con lugar la acción civil resarcitoria promovida por la Procuraduría General de la República en contra de [Nombre16] .

Con fundamento en lo artículos ,150 de la Ley de Pesca y Acuicultura así como los ordinales 632, 1045 y 1163 del Código Civil, se condena en abstracto al pago de las costas" (cfr. folio 219) constatándose la omisión por completo de especificar las razones de hecho y derecho bajo las cuales se otorgó la pretensión civil incoada en contra del demandado civil [Nombre14] , ante ello, se le causa un perjuicio al condenado al no conocer el razonamiento de la Juzgadora y poder controlarlo eventualmente ante esta Cámara. Por ello el motivo debe declararse con lugar, se ordena la ineficacia del fallo en cuanto al otorgamiento de la acción civil. Se dispone el reenvío para que con nueva integración se resuelva lo correspondiente sobre este extremo.

POR TANTO

Se declara parcialmente con lugar el recurso de apelación interpuesto por la licenciada [Nombre6] , defensora pública de [Nombre1] . Se anula la sentencia recurrida únicamente en cuanto a la condenatoria civil, en lo demás permanece incólume. Se ordena el reenvío para una nueva sustanciación sobre dicho extremo.
