Appeal filed in the present proceedings against [Nombre1], a Nicaraguan national, identity document number 155806915831, born on November 20, 1978, son of [Nombre2] and [Nombre3]; and against [Nombre4], a Nicaraguan national, identity document number 155801008302, born on January 20, 1955, son of [Nombre5] and [Nombre6], for the offense of ILLEGAL TIMBER HARVESTING, to the detriment of NATURAL RESOURCES. Judges Gerardo Rubén Alfaro Vargas, [Nombre7], and Rodrigo Obando Santamaría participated in deciding the appeal. Licenciada [Nombre8], representative of the Office of the Attorney General of the Republic (Procuraduría General de la República), and licenciada [Nombre9], public defender for the accused, entered appearances before this Court.
BACKGROUND
2-. Licenciada [Nombre8], representative of the Office of the Attorney General of the Republic, filed a motion for reconsideration (recurso de revocatoria), with an appeal in the alternative (apelación subsidiaria), against the foregoing ruling—which forms part of the decision approving the agreement; the motion for reconsideration was denied.
Drafted by Judge [Nombre14]; and,
WHEREAS
I.The appellant objects to the ruling that declared the approval of the defendants’ reparation plan effective and ordered suspension of the proceedings with probation (suspensión del proceso a prueba), insofar as that decision did not have the approval of the victim, a status held in this case by the Procuraduría General de la República, thereby violating Article 20 of its Organic Law. She argues that the Ministerio Público cannot be deemed able to substitute its will for that of the Procuraduría in a matter in which that entity had already entered an appearance by the time of the decision. Regarding the admissibility of the appeal. It is first necessary to decide whether the ruling against which the appeal was filed is subject to that procedural remedy. In a matter of a similar nature, this Chamber stated in voto 147-13: “Article 458 of the Code of Criminal Procedure provides: ‘All judgments and dismissals (sobreseimientos) issued at the trial stage that resolve criminal, civil, incidental, and other matters determined by law may be appealed.’ In principle, a literal interpretation of that provision excludes the possibility of challenging the decision of the lower court (Tribunal a quo), because what is being appealed is an interlocutory order (auto), not a judgment or dismissal, and it does not terminate the proceedings; it would therefore be necessary to await the expiration of the one-year period and the issuance of the corresponding dismissal in order to verify the legality of the agreement.
The cited provision embodies the principle that appeals are available only when expressly provided by law (principio de taxatividad impugnaticia), regarding which the Constitutional Chamber of the Court ruled in a constitutional consultation submitted by the Third Chamber. It stated that the rules governing the objective admissibility of appeals are not unconstitutional provided they are interpreted as allowing other circumstances in light of the right of access to prompt justice. Although that Court’s decision was issued when the only means of challenging criminal judgments was an appeal in cassation (recurso de casación), the issue addressed was the same. The Constitutional Court stated: ‘In this regard, it has been held concerning an appeal in cassation that it must not be regulated, interpreted, or applied according to formalistic criteria—those that make procedural formalities ends in themselves rather than instruments for the better administration of justice—because doing so violates the right to effective judicial protection (tutela judicial efectiva) enshrined in Article 41 of the Constitution.
Furthermore, Article 8.2(h) of the American Convention on Human Rights is absolutely clear and unconditional in recognizing, as a fundamental right of every human being charged with a criminal offense, the right to appeal the judgment to a higher court, which—as stated above—also extends to the victim as a party to the criminal proceedings, who generally has the right to appeal rulings dismissing the criminal case or ordering a final dismissal (sobreseimiento definitivo), under the terms established in Articles 71(c), 282 paragraph 3, 315, and 340 of the Code of Criminal Procedure. That right is unconditional because the Convention does not make it dependent on its implementation through domestic legislation or on any other suspensive or supplementary condition; but it is also unconditional with respect to the domestic legal system when that system provides the institutional and procedural organization (body and procedures) necessary for the exercise of the right to appeal or, stated differently, when that system does not lack the institutional and procedural means necessary for the right to be exercised.
If it lacked them, the appeal obviously could not be pursued without them, in which case the State’s international obligation to respect and guarantee the right, arising from Article 1.1 of the Convention, would translate into an obligation to create them pursuant to Article 2° (judgment Nº 282-90). VI.- Regarding Articles 422 paragraph 1 and 444 of the Code of Procedure. In accordance with the foregoing recitals (considerandos), it is appropriate to analyze whether the provisions under review conform to the Law of the Constitution. In this regard, the Third Chamber of the Corte Suprema de Justicia states that those provisions reflect the principle of objective appealability (principio de impugnabilidad objetiva), from which arises the line of precedent holding that a ruling granting suspension of the proceedings with probation is wholly unreviewable by cassation, because that order does not terminate the case, while the affected parties retain the possibility of challenging the ruling ordering final dismissal after the period for which the alternative resolution (salida alternativa) was granted has been completed.
Thus, for example, in judgment Nº0045-99 at 09:35 hrs. on 15 de enero 1999, that Judicial Body held: “In this case, it is observed that the Court declared the appeal inadmissible, asserting that the challenged decision was not subject to appeal in cassation... In response to that order, the complainant filed a motion in which she again requested that the appeal be processed... However, the Court, construing that filing as a motion for reconsideration (recurso de revocatoria), denied it on the ground that it was untimely. The challenged ruling consists of an order granting a request to suspend the proceedings with probation for a period of two years... It is clear that, although that order was issued by the Trial Court, by its nature it is neither a judgment nor a dismissal, the only two circumstances in which, under the principle of objective appealability, an appeal in cassation may be filed (Article 444 of the Code of Criminal Procedure).
Under these considerations, the complaint now raised is unfounded because the decision against which the applicant directed her objection was not subject to appeal in cassation. It should be noted here that the dismissal judgment ordered upon expiration of the period corresponding to the probationary period imposed by the Trial Court may eventually be challenged through cassation (Articles 30(j) and 444 ejusdem). Consequently, the complaint is denied.” On this occasion, however, that Body requests that the Constitutional Chamber rule on the aforementioned provisions because, if an appeal in cassation were available, the alleged defects could not be adjudicated until the period of suspension of the proceedings with probation had expired and the corresponding final dismissal had been issued, all to the detriment of the principles of expedition and free access to justice. That argument unquestionably leads this Chamber to determine that those provisions do not violate the Law of the Constitution, provided they are interpreted, in light of Article 41 of the Political Constitution and International Human Rights Law, as also allowing the victim to file an appeal in cassation against an order suspending the proceedings with probation.
This is because accepting an interpretation contrary to that set forth in this decision would unjustifiably require the appellant—in this case, the victim—to await expiration of the period for which the alternative measure was adopted before raising the claims she deems appropriate in defense of her rights, thereby violating her right to prompt justice and the principle of expedition, when she could have requested review earlier, at the appropriate time. It should be noted that the Consulting Body is correct when it states regarding the defendant that: “it would be unacceptable if, after that period had elapsed and the accused had complied with all the conditions imposed, the cassation court were to determine that—from the outset—the ruling ordering application of the alternative mechanism (instituto alternativo) contained procedural or substantive defects that rendered it improper (with all the harm this would entail for the parties), when this could have been determined without awaiting the passage of that period.” These reasons compel this Constitutional Court to interpret Articles 422 paragraph 1 and 444 of the Code of Procedure in the foregoing manner, so as to allow the victim to file an appeal in cassation against the order suspending the proceedings with probation, all in strict accordance with the Law of the Constitution’ (emphasis added, voto [Telf1]).
The position of the Constitutional Chamber (binding pursuant to Article 13 of the Law of Constitutional Jurisdiction), although referring to proceedings in which suspension of the proceedings with probation was applied, clearly shares elements with the conciliation procedure (procedimiento de conciliación), insofar as the agreements are subject to a time limit. In this Chamber’s view, an appeal may be filed against a Trial Court ruling approving a conciliation agreement (acuerdo conciliatorio); in addition to the principles of prompt justice and expedition cited in the constitutional precedent, the principle of reasonableness must be added, because deeming an appeal such as the one filed inadmissible would require the parties to await expiration of the period before challenging any defects that the conciliation agreement might contain. In this respect, in addition to the cited constitutional principles, a systematic analysis of the provisions of the Code of Criminal Procedure establishes the formal admissibility of the appeal.
The provisions governing defective procedural activity (actividad procesal defectuosa) (Articles 175 to 179) state that anyone who becomes aware of a procedural defect must object to it immediately and seek its cure (saneamiento), because with the passage of time the act could be validated and produce legal effects. Where rulings are concerned, their defects are challenged through the corresponding appeal; in this case, if the ruling approving the conciliation contains any such defect, it makes no sense to require the party to await expiration of the period before raising it, with the resulting harm to the parties, who may even have invested time and money in carrying out those plans. In other words, the agreement produced effects even though one of the parties considers it contrary to the legal system.” It is important to emphasize that the foregoing observations, although made in proceedings reviewing the admissibility of an appeal against a judgment (recurso de apelación de sentencia) challenging a ruling that approved a conciliation agreement, apply to this case, particularly in view of the citation to Constitutional Chamber precedent N° [Telf1], which expressly addressed the issue in relation to suspension of the proceedings with probation.
This Chamber therefore proceeds to hear the appeal filed. The objection is sustained. In the present matter, the Liberia prosecutor’s office received the police complaint on siete de mayo de dos mil catorce (folios 1 to 3), and because it involved an environmental offense (delito ambiental), on that same day the Procuraduría General de la República was recognized as a party by a ruling issued at quince horas dieciocho minutos (folio 25), which was served at trece horas cincuenta y cuatro minutos on nueve de mayo de dos mil catorce (folio 26). The in flagrante delicto procedure (procedimiento de flagrancia) was followed, and therefore, by a ruling issued at trece horas cuarenta y nueve minutos on doce de mayo del año en curso, the Court scheduled the initial hearing (audiencia inicial) for siete horas treinta minutos on veintidós de mayo de este año (folio 27). The Procuraduría General de la República entered an appearance through a submission transmitted by fax on trece de mayo de dos mil catorce (folio 32), which was received by the in flagrante delicto court (tribunal de flagrancia) several days later (19 de mayo); in that filing, the State’s representative entered an appearance and designated fax numbers [Telf2], [Telf3], and [Telf4] as the means for receiving service of notices.
The initial hearing (audiencia inicial) was held without the presence of the State representative (she had not entered an appearance when it was scheduled, nor was she subsequently notified); however, during the hearing, communication was maintained with her secretary (folio 36 verso), who stated that she should be informed of whatever was decided. An alternative resolution to trial (solución alterna al juicio) was negotiated, regarding which it was expressly ordered: “ONCE THE PROCURADURÍA GENERAL DE LA REPÚBLICA ACCEPTS THIS ALTERNATIVE MEASURE, IT MUST BE REGISTERED WITH THE OFFICE OF ALTERNATIVE MEASURES” (sic, folio 36 verso). Subsequently, by means of an official letter dated twenty-six May of the present year, the matter was brought to the attention of the Procuraduría for its approval; this was not notified to the State body. It is noted at folio 39 that the judicial technician sent, by email, the minutes of the hearing at which the accused agreed to the alternative measure of suspension of proceedings with probation (suspensión del proceso a prueba); however, this was not the means designated by the party for receiving notices, and therefore it is not true that the Procuraduría was notified of the agreement.
Thus, concluding that the entity knew of the agreement—and, even more so, that its silence could be construed as its affirmative response—grossly violates the victim’s right to participate and to indicate whether or not it agrees with the proposed reparation plan (plan de reparación). Consequently, the appeal filed (recurso interpuesto) is granted, the challenged ruling (resolución protestada) is vacated, and the proceedings are ordered remanded to the office of origin so that it may proceed in accordance with law.

Recurso de apelación interpuesto en la presente causa seguida contra [Nombre1] , nacionalidad nicaragüense, documento de identidad número 155806915831, nació el 20 de noviembre de 1978, hijo de [Nombre2] y [Nombre3] ; y contra [Nombre4] , nacionalidad nicaragüense, documento de identidad 155801008302, nació el 20 de enero de 1955, hijo de [Nombre5] y [Nombre6] , por el delito de APROVECHAMIENTO ILEGAL DE MADERA en perjuicio de LOS RECURSOS NATURALES. Intervienen en la decisión del recurso, los jueces Gerardo Rubén Alfaro Vargas, [Nombre7] y Rodrigo Obando Santamaría. Se apersonó en esta sede, la licenciada [Nombre8] representante de la Procuraduría General de la República y la licenciada [Nombre9] defensora pública de los imputados.
RESULTANDO
2-. Contra el anterior pronunciamiento (el cual integra la resolución que homologó el acuerdo) la licenciada [Nombre8] , representante de la Procuraduría General de la República, interpuso recurso de revocatoria con apelación subsidiaria; la revocatoria fue declarada sin lugar.
Redacta el juez [Nombre14] ; y,
CONSIDERANDO
I.La impugnante se muestra inconforme con la resolución que declaró eficaz la homologación del plan reparador de los imputados y ordenó la suspensión del proceso a prueba, en tanto dicho pronunciamiento no contó con la aprobación de la víctima, calidad que ostenta en este caso la Procuraduría General de la República, violentándose el artículo 20 de su Ley orgánica. Aduce que no puede considerarse que el Ministerio Público pueda sustituir la voluntad de la Procuraduría en un asunto en el que incluso para el momento de la decisión ya estaba apersonada dicha entidad. Sobre la admisibilidad del recurso. Se impone en primer lugar decidir si la resolución contra la que se planteó el recurso admite dicho remedio procesal. En un asunto de naturaleza semejante, esta Cámara en el voto 147-13, indicó: "El artículo 458 del Código Procesal Penal dispone: "Son apelables todas las sentencias y los sobreseimientos dictados en la fase de juicio y que resuelven los aspectos penales, civiles, incidentales y demás que la ley determina.".
En principio, la interpretación literal de la norma referida excluye la posibilidad de impugnar el pronunciamiento del Tribunal a quo, pues lo que se recurre es un auto, no una sentencia o sobreseimiento, y no se pone fin al procedimiento por lo que habría que esperar el término de un año y el dictado del sobreseimiento respectivo para verificar la legalidad del convenio. En la norma citada se manifiesta el principio de taxatividad impugnaticia, respecto del cual la Sala Constitucional de la Corte se pronunció en una consulta de constitucionalidad que le hiciera la Sala Tercera. Indicó que las normas que regulan la admisibilidad objetiva de las impugnaciones no son inconstitucionales en el tanto se interpreten admitiendo otros supuestos en atención al acceso a una justicia pronta. A pesar de que el fallo de ese Tribunal se dictó cuando el único medio de impugnación de las sentencias penales era el recurso de casación, el tema al que se aludió es el mismo.
Indicó el Tribunal Constitucional: "En este sentido, se ha señalado sobre el recurso de casación que no debe ser regulado, interpretado, o aplicado con criterio formalistas –los que hacen de los ritos procesales fines en sí mismos y no instrumentos para la mejor realización de la justicia-, pues de lo contrario se viola la tutela judicial efectiva, consagrada por el artículo 41 constitucional. Además, el artículo 8.2 inciso h) de la Convención Americana sobre Derechos Humanos es absolutamente claro e incondicionado en cuanto reconoce como derecho fundamental de todo ser humano, imputado en una causa penal por delito, el de recurrir el fallo para ante un superior, lo cual –como se dijo con anterioridad– también se extiende a la víctima como sujeto del proceso penal, quien disfruta, en términos generales, de la posibilidad de recurrir aquellas resoluciones en que se desestima la causa penal o se dicta el sobreseimiento definitivo, en los términos en que se encuentra previsto por los artículos 71 inciso c), 282 párrafo 3º, 315 y 340 del Código Procesal Penal.
Ese derecho es incondicionado, en cuanto que la Convención no lo subordina a su desarrollo por la legislación interna ni a ninguna otra condición suspensiva o complementaria; pero también resulta incondicionado respecto del ordenamiento interno cuando este provea la organización institucional y procesal (órgano y procedimientos) necesarios para el ejercicio de ese derecho de recurrir, o, dicho de otra manera, cuando ese ordenamiento no carezca de los medios institucionales y procesales necesarios para que el derecho se ejerza; si no los tuviera, obviamente el recurso no podría ejercerse sin ellos, en cuyo caso la obligación internacional del Estado de respetar y garantizar el derecho, que resulta del artículo 1.1 de la Convención, se traduciría en la de crearlos conforme con el artículo 2° (sentencia Nº 282-90). VI.- Sobre los artículos 422 párrafo 1º y 444 del Código Procesal. De conformidad con lo expuesto en los considerandos anteriores, procede analizar si las normas consultadas se adecuan o no al Derecho de la Constitución.
Sobre el particular, la Sala Tercera de la Corte Suprema de Justicia manifiesta que tales disposiciones obedecen al principio de impugnabilidad objetiva, del cual se desprende la línea jurisprudencial en el sentido de que la resolución que acoja la suspensión del proceso a prueba carece por completo de recurso de casación, en cuanto dicho auto no le pone término a la causa, en tanto queda abierta la posibilidad de las partes afectadas de cuestionar la resolución en que se ordena el sobreseimiento definitivo, luego de ser cumplido el término por el que se acordó la salida alternativa. Así, por ejemplo, en sentencia Nº0045-99 de las 09:35 hrs. de 15 de enero 1999, ese Organo Jurisdiccional consideró: 'En la especie, se observa que el Tribunal declaró inadmisible la impugnación, aduciendo que la decisión recurrida carecía de recurso de casación... Ante ese proveído, la quejosa presentó una gestión mediante la que de nuevo solicitaba se tramitara el recurso...Sin embargo el Tribunal, interpretando aquella diligencia como un recurso de revocatoria, lo declaró sin lugar, aduciendo que la misma era extemporánea.
Ahora bien la resolución impugnada consiste en un auto que acoge una solicitud de suspensión del proceso a prueba por un período de dos años... Es claro que aunque tal proveído fue dictado por el Tribunal de Juicio, no se trata -por su naturaleza- ni de una sentencia ni de un sobreseimiento, únicos dos supuestos en los que de acuerdo al principio de impugnabilidad objetiva, es posible interponer el recurso de casación (artículo 444 del Código Procesal Penal). Bajo estas consideraciones, el reclamo que ahora se formula es improcedente, pues el fallo contra el que dirigía la inconformidad de la gestionante, carece de recurso de casación. Es preciso anotar aquí, que la sentencia de sobreseimiento ordenada al vencimiento del plazo correspondiente al período de prueba dictada por el tribunal de juicio eventualmente puede ser impugnada en vía de casación (artículos 30 inciso j) y 444 ejúsdem).
En consecuencia se declara sin lugar el reclamo'. Sin embargo en esta oportunidad ese Órgano solicita que la Sala Constitucional se pronuncie en relación con las normas aludidas, en el tanto, de ser procedente el recurso de casación, no se podrían declarar los vicios reclamados mientras no se venza el término de la suspensión del proceso a prueba, ni se haya dictado el sobreseimiento definitivo correspondiente, todo ello en detrimento de los principios de celeridad y libre acceso a la justicia. Tal argumentación, sin duda conduce a esta Sala a determinar que dichas normas no violan el Derecho de la Constitución, siempre que se interpreten, a la luz del artículo 41 de la Constitución Política y del Derecho Internacional de los Derechos Humanos, en el sentido de que también procede el recurso de casación a favor de la víctima contra el auto que ordene la suspensión del procedimiento a prueba.
Lo anterior por cuanto, de admitirse una interpretación contraria a la que se expone en este pronunciamiento, en forma injustificada se obliga al recurrente –en este caso la víctima– a esperar el vencimiento del plazo por el cual se adoptó la medida alternativa a efecto de plantear los reclamos que estime pertinentes en defensa de sus derechos, vulnerándose en consecuencia su derecho a la justicia pronta y el principio de celeridad, cuando pudo requerir su revisión anticipadamente, en el momento oportuno. Nótese que lleva razón el Órgano Consultante cuando afirma respecto del imputado que: “resultaría inaceptable que luego de transcurrido ese término, y que el acusado haya cumplido con todas las condiciones impuestas, en sede de casación se llegue a determinar que –desde un inicio– la resolución que ordenó la aplicación del instituto alternativa incorporaba vicios de forma o fondo que la hacían improcedente (con todos los perjuicios que ello implicaría a las partes), siendo que ello pudo haberse definido sin necesidad de esperar el transcurso del referido plazo”.
Tales motivos obligan a este Tribunal Constitucional a interpretar los artículos 422 párrafo 1º y 444 del Código Procesal de la manera referida, a fin de admitir el recurso de casación por parte de la víctima contra el auto en que se ordena la suspensión del procedimiento a prueba, todo ello en estricto apego al Derecho de la Constitución" (destacado se suple, voto [Telf1]). La posición de la Sala Constitucional (vinculante según el artículo 13 de la Ley de la Jurisdicción Constitucional), aunque se refiere a un procedimiento en el que se aplicó la suspensión del proceso a prueba, es evidente que comparte elementos con el procedimiento de conciliación, en el tanto los acuerdos estén sujetos a plazo. En criterio de esta Cámara, es admisible el recurso de apelación contra la resolución del Tribunal de Juicio que homologa una conciliación; pues además del principio de justicia pronta y celeridad referidos en la jurisprudencia constitucional, debe agregarse el de razonabilidad, en tanto estimar inadmisible un recurso como el interpuesto, es obligar a las partes a esperar el cumplimiento del plazo para reclamar los vicios que pudiera contener el acuerdo conciliatorio.
Al respecto, amén de los principios constitucionales citados, el análisis sistemático de las normas del Código Procesal Penal determina la admisibilidad formal del recurso. En los numerales que regulan la actividad procesal defectuosa (artículos 175 a 179) se dispone que quien conozca un vicio del procedimiento deberá protestarlo de inmediato y procurar su saneamiento, pues con el transcurso del tiempo el acto podría convalidarse y surtir efectos jurídicos. Entratándose de resoluciones, sus defectos se atacan a través del recurso correspondiente; en este caso, si la resolución que homologó la conciliación contiene alguno, no tiene sentido obligar a la parte a esperar el vencimiento del plazo, para reclamarlo, con el consecuente perjuicio para las partes, pues incluso pueden haber invertido tiempo y dinero en el cumplimiento de tales planes. Es decir, el acuerdo pese a que una de las partes estima contraría el ordenamiento jurídico, surtió efectos".
Es importante resaltar que las reflexiones transcritas, a pesar de que se dieron en un procedimiento en el que se revisó la admisibilidad de un recurso de apelación de sentencia contra la resolución que homologó un acuerdo conciliatorio, son aplicables a este caso, sobre todo teniendo en cuenta la cita del antecedente de la Sala Constitucional N° [Telf1], que de manera expresa se pronunció sobre el tema en relación con la suspensión del proceso a prueba. En consecuencia entra a conocer esta Cámara el recurso planteado. Con lugar el reproche. En el presente asunto la fiscalía de Liberia recibió la denuncia policial el siete de mayo de dos mil catorce (folios 1 a 3) y por tratarse de un delito ambiental, ese mismo día se tuvo como parte a la Procuraduría General de la República por resolución de las quince horas dieciocho minutos (folio 25), lo cual fue notificado a las trece horas cincuenta y cuatro minutos de nueve de mayo de dos mil catorce (folio 26).
Se siguió el procedimiento de flagrancia, por lo que el tribunal mediante resolución de las trece horas cuarenta y nueve minutos de doce de mayo del año en curso, señaló las siete horas treinta minutos de veintidós de mayo de este año para llevar a cabo la audiencia inicial (folio 27). La Procuraduría General de la República se apersonó mediante memorial trasmitido vía fax el trece de mayo de dos mil catorce (folio 32), el cual fue recibido por el tribunal de flagrancia días después (19 de mayo); en ese escrito la representación estatal se apersonó y señaló como medio para atender notificaciones los números de fax [Telf2], [Telf3] y [Telf4]. La audiencia inicial se llevó a cabo sin la presencia de la represente estatal (no estaba apersonada para el momento en que se señaló, ni se le comunicó posteriormente); sin embargo en el transcurso de esta se mantuvo comunicación con su secretaria (folio 36 vto), quien manifestó que debía comunicarse lo que se resolviera.
Se negoció una solución alterna al juicio, de la cual expresamente se dispuso: "UNA VES QUE LA PROCURADURÍA GENERAL DE LA REPÚBLICA ACEPTE ESTA MEDIDA ALTERNA DEBE DE INSCRIBIRSE A LA OFICINA DE MEDIDAS ALTERNAS" (sic, folio 36 vto). Con posterioridad, mediante oficio fechado veintiséis de mayo del año presente se puso en conocimiento de la Procuraduría para su aprobación; lo cual no fue notificado al órgano estatal. Se observa a folio 39 que el técnico judicial remitió a un correo electrónico el acta de la audiencia en la que los imputados se sometieron a la medida alterna de suspensión del proceso a prueba, sin embargo no se trata del medio dispuesto por la parte para recibir notificaciones, por lo que no es cierto que la Procuraduría fuera comunicada sobre el acuerdo. De tal manera que estimar que dicha entidad conoció del acuerdo y aún más que su silencio puede entenderse como respuesta positiva del mismo, violenta de manera grosera el derecho de la víctima de participar y de mostrarse conforme o no con el plan de reparación propuesto. En consecuencia se declara con lugar el recurso interpuesto, se anula la resolución protestada y se ordena remitir las diligencias a la oficina de origen para que proceda conforme a derecho.
