Res: 2014-100 Court of Appeal for Criminal Judgments of Cartago, First Section. At ten hours and three minutes on the seventeenth of March, two thousand fourteen.

Appeal against a criminal judgment filed in the present proceeding brought against [[Nombre1] ], [...], for the offense of Violation of the Ley Forestal, to the detriment of Natural Resources. Judges [Nombre2], Jorge Arturo Rojas Fonseca, and Jaime Robleto Gutiérrez participated in deciding the appeal. Attorney [Nombre3] appeared on appeal as private defense counsel for the accused, as did Attorney [Nombre4] in her capacity as representative of the Procuraduría General de la República.

Result:

1. By judgment No. 88-2013, issued at sixteen hours and thirty-five minutes on the fourteenth of November, two thousand thirteen, the Trial Court of Cartago, Turrialba seat, ruled: "THEREFORE: In accordance with the foregoing and the cited provisions, Articles 39 and 41 of the Political Constitution, Article 8, subsection 1, of the American Convention on Human Rights, Article 10 of the American Declaration of Human Rights, Article 9, subsection 2, of the Covenant on Civil and Political Rights, Articles 1 4 5 6 9 341 through 359 and 361 through 367 of the Criminal Code; Articles 58, subsection a), and 61, subsections a and c, of Ley Nº 7575; Articles 122, 124, 126, 135, and 137 of the 1941 Criminal Code; and Articles 1045 and 1048 of the Civil Code, the Court rules: [Nombre [Nombre5]] is acquitted of all punishment and liability for the offenses of unlawful harvesting of forest products (aprovechamiento ilegal de productos forestales) on private property and land-use change (cambio de uso de suelo), to the detriment of NATURAL RESOURCES, with which he had been charged. [[Nombre1] ] is found criminally responsible as the perpetrator of the offense of ENCROACHMENT INTO A PROTECTION AREA (INVASION DE AREA DE PROTECCIÓN), to the detriment of NATURAL RESOURCES. As punishment, he is sentenced to THREE MONTHS’ IMPRISONMENT, to be served at the place and in the manner prescribed by prison regulations, with credit for any pretrial detention already served. Once the judgment becomes final, it shall be entered in the Judicial Registry of Offenders, and the customary certified copies shall be sent to the Sentence Enforcement Court, Instituto Nacional de Criminología, and Centro de Información Penitenciaria. Based on the requirements of Article 59 of the Criminal Code, he is granted the benefit of suspended execution of sentence (ejecución de la pena) for three years, during which period he may not be convicted of an intentional offense carrying a sentence exceeding six months; otherwise, the benefit shall be revoked and he shall serve the sentence imposed. Furthermore, he is ordered NOT to disturb the area within a two-kilometer radius of the Turrialba Volcano crater. Regarding the civil action for damages (Acción Civil resarcitoria) brought by the State, civil defendant [[Nombre1] ] is ordered to pay TWENTY-TWO MILLION NINE HUNDRED TWO THOUSAND SIX HUNDRED SIXTEEN COLONES in damages, plus statutory interest. That liquidated and enforceable sum shall, upon mere notice, be deposited by the civil defendant into this Court’s checking account within fifteen days after this judgment becomes final; otherwise, it shall be enforced through ordinary civil proceedings. Notice shall be given by reading. WILSON FLORES FALLAS. TRIAL JUDGE." (sic)

2. Attorney [Nombre6] [Nombre7] filed an appeal against the foregoing decision.

3. After the corresponding deliberation was conducted in accordance with Article 466 of the Code of Criminal Procedure, as amended by Ley 8837, published on the ninth of December, two thousand eleven (Creation of the Appeal against a Judgment), the Court considered the issues raised in the appeal.

4. The relevant legal requirements have been observed in the proceedings.

Drafted by Judge [Nombre8], and;

Considering:

I.By a brief filed on 6 December 2013, Attorney [Nombre3], in his capacity as private defense counsel for the accused, [[Nombre1] ], filed an appeal against the judgment of the Turrialba Criminal Trial Court, judgment number 88-2013, issued at sixteen hours and thirty-five minutes on the fourteenth of November of the year two thousand thirteen, concerning the offense of Encroachment into a protection area and other offenses causing harm to Natural Resources. The appellant bases his challenge on Articles 437, 439, 452, 458, 459, 460, 463, 465, and 466, in relation to provisions 1, 2, 9, 142, 180, 181, and 183, all of the Code of Criminal Procedure; Articles 30, 31, 34, and 45 of the Criminal Code; and Article 58, subsection a, of Ley Forestal 7575. The appeal was filed within the statutory period. By virtue of applying the principles of informality, breadth, accessibility, and flexibility inherent in an appeal against a criminal judgment, the challenge at issue is deemed to satisfy the basic and minimum requirements necessary to permit consideration and resolution of the objections raised by the appellant as part of a comprehensive review of the challenged judgment, as established by Article 8.2h of the American Convention on Human Rights and Articles 458, 459, 460, and 462 of the Code of Criminal Procedure. He sets out his objections as follows.

Drafted by Appellate Judge [Nombre8], and;

II.First ground (procedural): Disregard for and violation of due process. He begins his claim by stating that a factual account was found proven and his client was convicted as the perpetrator of the offense of encroachment into a protection area even though there was no evidence identifying him as the person who performed the act, since he was not seen using machinery for that purpose or paying third parties to perform such work. They merely stated that the property belonged to the defendant and that a tractor was clearing the road. He argues that the statements gathered at the scene were unlawful because the accused was never advised of his constitutional rights to have an attorney and not to testify against himself. Likewise, the witness who operated the tractor was a suspect witness, and the judge himself warned him during trial that he could refrain from testifying, but by the time the warnings were given, the witness had already testified; despite this, the judge unlawfully used the testimony to convict the accused.

He claims that both the manner in which the evidence was obtained and its assessment were unlawful. On that basis, he requests that the accused be acquitted of all punishment and liability. Second ground: Disagreement with the determination of the facts. The appellant expresses dissatisfaction with the judgment because it was established that the property belongs to the accused and is duly recorded in the Public Property Registry as private property. He states that reference is made to a two-kilometer area around the cone of Turrialba Volcano in which nothing may be done, but that although it is a National Park, there are no signs, boundary markers, or dividing fences establishing that the accused knew how far the prohibited area extended or where his property ended. SINAC officials themselves used cutting-edge technology to determine the locations (GPS), but there was nothing at the site that would have enabled the accused to possess the criminal intent (dolo) to act against natural resources.

In his view, there can be no "encroachment" if the accused did not know the boundaries; he therefore alleges the existence of a mistake of fact (error de tipo). He requests that the accused be acquitted of all punishment and liability. Third ground: Disagreement with the assessment of the evidence and violation of the rules of sound critical judgment (sana crítica). He states that the judge found his client solely and criminally responsible as the perpetrator of the offense of encroachment into a protected area, while disregarding the fact that the land or property is privately owned and belongs to his client, since everything is recorded with the Property Registry and Cadastre. He argues that the offense requires intent and that such knowledge cannot be presumed in connection with these unlawful acts. The property had been used as a dairy farm, and the road had existed for many years; all the accused did was clear an existing path or track that led to that dairy farm, which had been closed because of volcanic ash, although the activity had taken place before the accused became the property’s owner.

He states that the accused was not convicted of land-use change because no such change occurred, nor did the alleged encroachment occur, since he did not alter the boundaries of the National Park and merely cleared the existing road. He requests acquittal for the alleged offense of encroachment into the National Park. Fourth ground: (substantive) Disagreement with the application of the substantive rule governing criminal liability. The appellant maintains that the judge applied the legal provisions incorrectly because Article 58 of Ley Forestal 7575 cannot apply, as that law does not provide for any signage concerning National Parks. Likewise, the Law of the Instituto Costarricense de Turismo could not apply in this case for the same reason, namely, that the former law did not designate it as a National Park. The accused submitted certifications of possessory acts (actos posesorios) concerning the property because it belongs to him; accordingly, the cited standard provisions cannot apply.

He requests his client’s acquittal because he never encroached upon National Park areas, as the lands are privately owned and their status as public-domain property (grado de demanialidad) was not indicated. Fifth ground: Disagreement with the award of damages. The appellant challenges the order requiring payment of twenty-two million nine hundred two thousand six hundred sixteen colones, plus statutory interest, for environmental damage, which he rejects because, he reiterates, there was no encroachment into the National Park. Moreover, the judge himself acquitted the accused of all punishment and liability for the offenses of land-use change and unlawful forest harvesting (aprovechamiento forestal), yet no amount was quantified in relation to the sole offense of which he was convicted, bearing in mind that the expert appraisal covered the combined amount for the three charged offenses. He requests that the judgment be reversed in all respects, that the accused be acquitted of all punishment and criminal liability, and that he be relieved of paying those civil awards.

III.Regarding the oral hearing: Based on the request of attorney [Nombre7], an oral hearing was scheduled and held at nueve horas cuarenta y cinco minutos on cinco de marzo de dos mil catorce, in the presence of the Appellate Judgment Judges, attorneys [Nombre9]., Jaime Robleto Gutiérrez, and [Nombre10]., who presided. The appellant, the defendant, the representative of the Office of the Attorney General for Criminal Matters, and the Public Prosecutor’s Office appeals prosecutor appeared. At the proceeding, after the presenter concluded his arguments, both the Office of the Attorney General and the Public Prosecutor’s Office agreed with him, each requesting the defendant’s acquittal. The fourth ground of appeal is granted. Elements not taken into account by the appellant are added. Acquittal. In the fourth substantive ground, appellate counsel argues that the legislation applied in this case is erroneous, since the trial judge relied on ley 7575, Article 58, and the Law of the Costa Rican Tourism Institute, although those laws do not contemplate the circumstances under which his client was found guilty of encroachment upon a protected area (invasión de área protegida), because the cited laws do not address Volcán Turrialba or the two-kilometer radius around the volcano’s crater that his client allegedly encroached upon.

The appellant is indeed correct, because the judgment under review contains an error in adjudication (vicio iniudicando), since the legislation used by the trial judge to find him criminally responsible as a principal for encroachment upon a protected area is incorrect. As may be seen from the appealed ruling, the Trial Court Judge applied Article 58 of ley 7575 and, although it was not included in the “Por tanto,” the reasoning of the judgment mentions the Law of the Costa Rican Tourism Institute. The application of those provisions is erroneous in the case sub litem because, as expressly noted at the oral hearing by both the representative of the Public Prosecutor’s Office and the Attorney for the Republic, the provisions properly applicable to this particular case are Article 7 of the Land and Colonization Law and Articles 32(c) and 37 of the Organic Law of the Environment. In this case, the Trial Court chose to acquit the defendant of all punishment and criminal liability for the offenses of unlawful harvesting of forest products on private property (Aprovechamiento ilegal de productos forestales en propiedad privada) and land-use change (cambio de uso del suelo), to the detriment of Natural Resources.

Upon reviewing the reasoning supporting the acquittal, this Court of Appeal finds that the court below deemed it established that the property was indeed privately owned by the defendant and that the proven facts consisted of the accused having hired someone to clear a road leading to the center of his property, a path or track that had existed for a very long time (at the hearing, the appellant said sesenta o setenta años, and no party argued otherwise). The trial judge deemed it established—and therefore acquitted him—that the defendant neither changed the land use nor harvested natural resources on private property, reasoning as follows insofar as relevant: “Now then, in the case under review, it is the view of the undersigned author of this verdict that the factual theory set forth in the prosecution’s charging document has not been proven with respect to the offense of unlawful harvesting of forest products on private property, because there is no description of facts that would support finding that such an offense occurred.

Furthermore, regarding the legal classification of land-use change, it is important at this point to highlight the serious and essential inconsistencies between that classification and the various contradictory factual descriptions that might be deemed proven, which likewise warrant rejecting that classification. Pursuant to Article 61(c), in relation to Article 19 of ley 7575, the required act is a change of use....the land is not covered by forest as an objective element of the offense, since the documentary evidence, particularly the documentary evidence offered by the defense—photocopies of deeds at folios 101 to 111 and the photographic sequence at folios 112 and 113—shows that the area is not a forest. It must also be added that, according to the testimonial evidence offered by the defense, for many years before the current owner acquired it, the land had been used for dairy farming.... and that the witnesses acknowledged its existence for a long time....” (see folios 159 and 160 of the expediente).

Several premises therefore arise from the foregoing. First, as shown by the documentary evidence at folio 110, the defendant [[Nombre1]] is the representative, in the capacity of general attorney-in-fact without limitation as to amount (apoderado generalísimo sin limite de suma), of the company “Altos Montes del Volcán Turrialba,” which in turn owns the properties in the Partido de Cartago recorded under real-property folio numbers noventa y un mil seiscientos veinte, sequences cero cero uno, cero cero dos, cero cero tres, and cero cero cuatro; and noventa y nueve mil ciento sesenta y siete, sequences cero cero uno, cero cero dos, cero cero tres, and cero cero cuatro, whose descriptions appear in the deeds at folios 101 et seq. Those properties are precisely the ones located within Parque Nacional Volcán Turrialba and, likewise, those that have been used for agricultural activity for many years, specifically an old dairy farm that operated at the site and is depicted in the photographs at folios 112 to 114 of the record.

The condition of the property, its former economic activity, and its location were established by all the evidence presented at trial. It is precisely the property at issue in this case and, as the challenged ruling itself acknowledges, it had long contained the road or path that the defendant instructed third parties to clear. The situation in the case sub litem must be clarified because the defect identified does not concern how it was conclusively established that the accused, and no one else, ordered the preexisting path to be cleared. It was also established that the work was performed within the protective radius of dos kilómetros from the crater of Volcán Turrialba; however, the proven circumstances were assessed under erroneous laws, as noted above. In order to attribute any criminal conduct to the accused for clearing the path within his estate—that is, private property—Articles 1 and 7 of the Land and Colonization Law should have been considered in conjunction with Articles 32(c) and 37 of the Organic Law of the Environment.

Insofar as relevant, the first cited Law provides: “CHAPTER I GENERAL PROVISIONS Purposes; System of Possession of Rural Real Property Article 1.- The purpose of this Law is: 1.- To establish that land ownership must be promoted for the gradual increase of its productivity and the fair distribution of its output, thereby improving the social condition of farmers and making them conscious participants in the Nation’s socioeconomic development; 2.- To contribute to the flourishing of republican virtues, both private and public, by linking citizens to a sound system of land possession; 3.- To contribute to a fairer distribution of wealth; 4.- To contribute to the proper conservation and use of the Nation’s renewable natural-resource reserves; 5.- To prevent national lands from becoming concentrated in the hands of those who use them for speculation or exploitation to the detriment of the Nation’s interests.

Lands held by such interests must revert to the State in the manner prescribed by the Constitution and the law; 6.- To establish that land must not be used for the exploitation of agricultural workers. The State, by every means at its disposal, shall encourage the formation of agricultural cooperatives in order to combine the dignity of small-scale ownership with the efficiency of large enterprises; and 7.- To recognize, in accordance with the foregoing, the existence and legitimacy of private property (emphasis not in the original).” The quoted provisions establish that the legislature determined that, although the State has and must have an interest in conserving and protecting land and natural resources, it must also protect and recognize the legitimacy of private property belonging to natural or legal persons. Continuing with the legislative analysis required to resolve this appeal, Article 7(e) of the cited Law must be considered, as it specifically addresses Volcán Turrialba, unlike the other legislation erroneously applied in the judgment.

It provides: “CHAPTER II State Agricultural Property Article 7.- Until the State, on its own initiative or at the direction of the Ministry of Agriculture or the Institute of Lands and Colonization, and for reasons of national interest, determines which lands must remain under its ownership, the following shall be deemed inalienable and incapable of acquisition through a claim or possession, except where they are privately held under legitimate title: e) An area with a radius of dos kilómetros centered on the crater or principal summit around the volcanoes Barba, Poás, Arenal, Cerro Chato, Tenorio, Santa María, and Rincón de la Vieja; an area dos kilómetros wide on either side of the ridge formed by the various peaks of Miravalles; the area on the volcanoes Irazú and Turrialba extending from an altitude of 3.000 metros toward the summit; the highland moors of the Cordillera de Talamanca extending from an altitude of 3.000 metros toward the summit; an area with a radius of tres kilómetros centered on the summit of [Dirección1]; the savannas surrounding Cerro [Dirección2] above an altitude of 3.000 metros; and an area dos kilómetros wide on either side of the Cordillera between Cerros Zurquí and Hondura.

In due course, the Institute shall create other forest reserves that shall also serve as sanctuaries or refuges for wildlife and in which hunting in any form shall be prohibited. If it is necessary for that purpose to establish easements (servidumbres) over privately owned properties, the Institute shall compensate their owners equitably (emphasis not in the original).” As may be seen from the cited provision, the Land and Colonization Law is the legislation that should have been applied to this particular case, since it specifically establishes for protection purposes the dos kilómetros radius centered on the crater and expressly includes Volcán Turrialba. This provision consistently reflects the legislature’s intent to protect private property because, even if the asset and the specified dos kilómetros radius lie within a National Park, namely Parque Nacional Volcán Turrialba, that restriction does not operate against the interests of a third party who privately owns the land under legitimate title, as in the case sub litem, where it was established that the defendant holds legitimate title to the land in question and, therefore, that his conduct was not unlawful.

Now, the absence of statutory elements (atipicidad) in the conduct carried out by the accused is demonstrated even more forcefully by the provisions contained in Article 32(c) and Article 37 of the Ley Orgánica del Ambiente, which, insofar as relevant, provide: “CHAPTER VII PROTECTED WILDLIFE AREAS (AREAS SILVESTRES PROTEGIDAS) ARTICLE 32.—Classification of protected wildlife areas. The Executive Branch, through the Ministry of Environment and Energy, may establish protected wildlife areas under any of the management categories (categorías de manejo) that may be established and those listed below: a) Forest reserves. b) Protective zones. c) National parks. d) Biological reserves. e) National wildlife refuges. f) Wetlands. g) Natural monuments. Those management categories and any created in the future shall be administered by the Ministry of Environment and Energy, except for those established in Article 33 of this Law.

Municipalities must assist in preserving these areas. ARTICLE 37.—Powers of the Executive Branch. When establishing protected wildlife areas, regardless of their management category, the Executive Branch, through the Ministry of Environment and Energy, is empowered to include within their boundaries any privately owned properties or portions thereof necessary to fulfill the objectives set forth in this Law and to implement them in accordance with the applicable management plan (plan de manejo), or to create statutory easements (servidumbres legales) for ecological protection and compliance with this Law. In the case of national parks, biological reserves, or state-owned national wildlife refuges, the land shall be acquired through purchase, expropriation, or both procedures, subject to prior compensation. In the case of forest reserves, protective zones, mixed wildlife refuges, and wetlands, the parcels or portions thereof may also be purchased or expropriated unless, at the owner’s request, they are voluntarily placed under the forest regime (régimen forestal).

Such placement shall be recorded in the Public Property Registry as an encumbrance on the real property, which shall remain in effect for the period established in the management plan. Privately owned properties affected pursuant to this Article because they are located within national parks, biological reserves, wildlife refuges, forest reserves, or protective zones shall become part of state-protected areas only once they have been paid for or legally expropriated, except when they are voluntarily placed under the Forest Regime. In the case of forest reserves, protective zones, and wildlife refuges, when payment or expropriation has not yet occurred, and until it does, the areas shall be subject to an environmental planning plan (plan de ordenamiento ambiental) that includes an environmental impact assessment (evaluación de impacto ambiental, EIA), and subsequently to a plan for the management, recovery, and replenishment of resources.” (This paragraph was amended by Article 72, subsection c), of Ley Forestal No.7575 of February 13, 1996, which was in turn amended by Article 114 of Law N° 7788 of April 30, 1998.) The Executive Branch is authorized, through the Ministry of Environment and Energy, to carry out the expropriations contemplated in this Article in accordance with the provisions of Expropriations Law No. 7495 of May 3, 1995 (emphasis not in the original).

From the foregoing quotation, it is established beyond doubt that the defendant committed no offense, because although the property at issue in this litigation is located within a National Park, as prescribed by the Article under discussion, it is likewise privately owned property acquired under legitimate title. Accordingly, the defendant in question cannot be criminally prosecuted unless, as Article 37 of this Law clearly states, it is shown that either of the following two circumstances occurred: a) a compulsory purchase, that is, an expropriation, subject to prior payment or compensation to the property owner; or b) the owner voluntarily placed the property located within a National Park under the forest regime. Once those conditions have been met, if a person carries out activities on property that no longer belongs to that person because it was sold to the State or placed under the forest regime, that person might potentially face charges for the offense that the Prosecution seeks to prove.

In the present case, however, the Public Prosecutor’s Office never submitted sufficient and necessary evidence showing that the defendant [[Nombre1] ] cleared the road or trail on State-owned property acquired by the means described above. As both the Prosecution and the State Attorney stated at the oral hearing (vista oral), because the Public Prosecutor’s Office failed to prove those circumstances, it cannot be determined that the defendant [[Nombre1] ] committed any offense. As of the date of trial, and according to the evidence considered by the Trial Judge, the properties at issue in the proceeding remained his private property, and there was no indication that the property had been expropriated or voluntarily transferred to the State. The absence of statutory elements therefore requires the defendant’s acquittal. Consequently, as requested by the defense, the appeal must be granted, the judgment vacated insofar as it imposed both criminal and civil liability, and the defendant acquitted of all punishment and liability for the alleged act.

Therefore:

The appeal is granted on the merits. The judgment is vacated as to both the criminal and civil convictions, and the accused, [[Nombre1] ], is instead acquitted of all punishment and liability for the alleged act. Res: 2014-100 Tribunal de Apelación de la Sentencia Penal de Cartago, sección primera. A las diez horas tres minutos del diecisiete de marzo de dos mil catorce.

Recurso de apelación de sentencia penal interpuesto en la presente causa seguida contra [[Nombre1] ], [...], por el delito de Infracción a la Ley Forestal , en perjuicio de Recursos Naturales. Intervienen en la decisión del recurso, los jueces [Nombre2] , Jorge Arturo Rojas Fonseca y Jaime Robleto Gutiérrez. Se apersonaron en apelación, el licenciado [Nombre3] en calidad de defensor particular del encausado, así como la licenciada [Nombre4] en su condición de representante de la Procuraduría General de la República.

Resultando:

1. Que mediante sentencia No. 88-2013 de las dieciséis horas treinta y cinco minutos del catorce de noviembre de dos mil trece, el Tribunal de Juicio de Cartago sede Turrialba, resolvió: "POR TANTO: De conformidad con lo expuesto y normas citadas, arículos 39 y 41 de la Constitución Política, 8 inciso 1 de la Convención americana de Derechos Humanos, 10 de la declaración Americana de los Derechos Humanos, 9 inciso 2 del Pacto de Derechos Civiles y Políticos, 1 4 5 6 9 341 a 359 361 a 367 del Código Penal. Artículos 58 inciso a), 61 incisos a y c de la Ley Nº 7575, 122, 124, 126, 135, 137 del Código Penal de 1941; 1045 y 1048 del Código Civil. El Tribunal resuelve: Se absuelve de toda pena y responsabilidad al [Nombre [Nombre5]] de los delitos de aprovechamiento ilegal de productos forestales en propiedad privada y cambio de uso de suelo en perjuicio de los RECURSOS NATURALES que se le venían acusando. Se declara autor responsable a [[Nombre1] ] del delito de INVASION DE AREA DE PROTECCIÓN en prejuicio de los RECURSOS NATURALES. Como sanción se le impone la pena TRES MESES DE PRISIÓN , la cual deberá descontar en el lugar y forma que indiquen los reglamentos penitenciarios previo al obono a la prisión preventiva que hubiere sufrido. Firme la sentencia, inscribase en el Registro Judicial de Delincuentes, envíesén los testimonios de estilo al Juzgado de Ejecución de la Pena, Instituto Nacional de Criminología y Centro de Información Penitenciaria. Con base en los requisitos del artículo 59 del Código Penal, se le concede el beneficio de ejecución de la pena por tres años, donde durante dicho período no podrá ser condenando por delito doloso superior a seis meses, de lo contrario se será revocado el beneficio e irá a descontar la penal impuesta. Además, se le impone NO perturbar la zona cubierta por el radio de dos kilómetros del cráter del volcán Turrialba. En cuanto a la Acción Civil resarcitoria incoada por el Estado. Se condena al demandado civil [[Nombre1] ] a pagar por daños la suma de VEINTIDÓS MILLONES NOVECIENTOS DOS MIL SEISCIENTOS DIECISEIS COLONES mas los intereses legales. Dicha suma liquida y exigible deberá ser depositada por el demandado civil en la cuenta corriente de este Tribunal, por mero apercibimiento entre los quince dias de la firmeza del este fallo, caso contrario deberá ser ejecutada en la vía civil ordinaria. Mediante lectura notifiquese. WILSON FLORES FALLAS. JUEZ DE JUICIO." (sic)

2. Que contra el anterior pronunciamiento, el licenciado [Nombre6] [Nombre7] interpuso el recurso de apelación.

3. Que verificada la deliberación respectiva de conformidad con lo dispuesto por el artículo 466 del Código Procesal Penal, reformado por Ley 8837 publicada el nueve de diciembre de dos mil once (Creación de Recurso de Apelación de la Sentencia), el Tribunal se planteó las cuestiones formuladas en el recurso.

4 . Que en los procedimientos se han observado las prescripciones legales pertinentes.

Redacta el Juez [Nombre8] , y;

Considerando:

I.Mediante escrito presentado en fecha 6 de diciembre de 2013, el licenciado [Nombre3] en su condición de defensor particular del encartado [[Nombre1] ], interpone un recurso de apelación de sentencia en contra del fallo del Tribunal Penal de Juicio de Turrialba, sentencia número 88-2013 de las dieciséis horas treinta y cinco minutos del catorce de noviembre del año dos mil trece por el delito de Invasión a un área de protección y otros en daño de los Recursos Naturales. El recurrente sustenta su impugnación en los artículos 437, 439, 452, 458, 459, 460, 463, 465, 466 en relación con los guarismos 1, 2, 9, 142, 180, 181, 183 todos del Código Procesal Penal, artículos 30, 31, 34, 45 del Código Penal y 58 inciso a de la Ley Forestal 7575. Siendo que dicho recurso se presentó en tiempo conforme al plazo de ley. En virtud de la aplicación de los principios de informalidad, amplitud, accesibilidad y flexibilidad propios del recurso de apelación de sentencia penal, se estima que la impugnación de marras reúne los presupuestos básicos y mínimos que se requieren para que la misma posibilite el conocimiento y decisión de los reparos planteados por el recurrente en orden al examen integral de la sentencia impugnada, tal y como lo establece el artículo 8.2h de la Convención Americana sobre Derechos Humanos, y los artículos 458, 459, 460 y 462 del Código Procesal Penal, cuyas inconformidades expone de la siguiente forma.

Redacta el Juez de Apelación [Nombre8] y ;

II.Primer motivo(forma): I rrespeto y quebranto al debido proceso. Inicia su reclamo indicando que se tuvo un cuadro fáctico demostrado y se condenó a su representado como autor del delito de invasión de área de protección sin que hubiera prueba que señalara al mismo como el que ejecutó la acción pues no se le vio utilizando maquinaria para ello, ni pagando a terceros para tal trabajo. Se concretaron a indicar que la finca es del justiciable y que había un tractor haciendo una limpieza del camino. Que las versiones que se recogieron en el lugar de los hechos son ilegales pues el imputado nunca fue puesto de sus derechos constitucionales a tener un abogado, a no declarar contra sí mismo. De igual forma el deponente que manejó el tractor, era testigo sospecho y el propio juzgador en el debate le hizo las advertencias de que podía abstenerse de declarar pero que cuando se las hizo ya el señor declarante había depuesto y pese a eso en forma ilegítima el Juzgador uso la declaración para condenar al acusado.

Reclama que el medio de obtención de la prueba y su valoración fue ilícita. Solicita que en base a eso se absuelva al acusado de toda pena y responsabilidad. Segundo motivo: Inconformidad con la determinación de los hechos. El apelante informa su descontento con la sentencia pues se demostró que la finca es del acusado y se encuentra debidamente inscrita en el Registro Público de la propiedad como finca privada. Que se habla de dos kilómetros donde no se puede hacer nada con relación al cono del Volcán Turrialba, pero que si bien es un Parque Nacional, no se establecen avisos, mojones, cercas divisorias para poder establecer que el imputado sabía hasta donde no podía estar, o hasta donde llegaba su finca. Que los propios funcionarios del Sinac usaron tecnología de punta para establecer las ubicaciones (GPS) pero que en el sitio no hay forma de que el imputado tuviera el dolo para actuar en contra de los recursos naturales.

No se puede hablar en su criterio de una "invasión" si el imputado no sabía cuales eran los límites y por ende refiere la existencia de un error de tipo. Solicita que se absuelva al imputado de toda pena y responsabilidad. Tercer motivo: Inconformidad con la valoración de la prueba, violación a las reglas de la sana crítica. Dice que el Juzgador declara autor único y responsable a su cliente de un delito de invasión de un área protegida dejando de lado que el terreno o la finca es de propiedad privada, que es de su cliente, pues todo está inscrito ante el Registro de la Propiedad y catastro. Que el delito es doloso y no se puede presumir en estos ilícitos tal conocimiento. Que la finca era de una lechería y el camino es de muchos años atrás, que lo que hizo el encartado fue limpiar un sendero o trocha que ya existía y que llevaba a la citada lechería que fue cerrada por efectos de la ceniza volcánica pero que la actividad se daba antes de que el imputado fuera dueño de la finca.

Que no condena al acusado por cambio de uso del suelo pues no se dio, ni ese ni la invasión que le atribuyeron pues no alteró límites del Parque Nacional, sólo limpió el camino ya existente. Solicita se le absuelva por el supuesto delito de invasión del Parque Nacional. Cuarto motivo: (fondo) Disconformidad con la aplicación de la norma de fondo sobre la responsabilidad penal. Determina el recurrente que el Juzgador utilizó las normas en forma errónea, pues no se puede dar la aplicación de la Ley Forestal 7575 en su artículo 58, ya que esa no contempla ninguna señalización sobre los Parques Nacionales. De igual forma no podría usarse en la especie la Ley del Instituto Costarricense de Turismo por la misma razón de no ser señalado por la anterior ley como un Parque Nacional. Que el imputado aportó certificaciones de actos posesorios en la finca pues es de su propiedad y por ende no se pueden aplicar las normas de estilo indicadas.

Solicita la absolutoria de su cliente pues nunca invadió zonas de Parque Nacional pues son terrenos privados y el grado de demanialidad no estuvo señalado. Quinto motivo: Disconformidad con la condena de daños y perjuicios. El recurrente presenta su reclamo en cuanto a la condenatoria al pago de veintidós millones novecientos dos mil seiscientos dieciséis colones más los intereses legales por concepto de daño ambiental, situación que rechaza pues recalca que no hubo ninguna invasión al Parque Nacional. Amén de lo anterior el mismo Juzgador absolvió al acusado de toda pena y responsabilidad por los delitos de cambio de uso del suelo y de aprovechamiento forestal, siendo que no se cuantifica nada con relación al único delito que resultó condenado, tomando en cuenta que el peritaje era por la suma de los tres delitos acusados. Solicita se revoque la sentencia en todos sus extremos, se absuelva de toda pena y responsabilidad penal al acusado y se le exonere de pago de tales extremos civiles.

III.Sobre la audiencia oral: Con fundamento en la petición del licenciado [Nombre7] , se programó una audiencia oral que se llevó a cabo al ser las nueve horas cuarenta y cinco minutos del cinco de marzo de dos mil catorce con la presencia de los Jueces de Apelación de Sentencia, Licenciados [Nombre9] . , Jaime Robleto Gutiérrez y quien presidió [Nombre10] . Se presentó el recurrente, el imputado, así como el representante de la Procuraduría Penal y el Fiscal de impugnaciones del Ministerio Público. En la diligencia el exponente luego de concluir con los alegatos, tanto la Procuraduría y la Fiscalía le dieron la razón solicitando ambos la absolutoria del acusado. Se declara con lugar el cuarto motivo de apelación interpuesto. Se agregan elementos no tomados en cuenta por el recurrente. Absolutoria. El abogado apelante plantea en el cuarto motivo de fondo, pues considera que la legislación aplicada en la especie es errónea, ya que el Juez de instancia echó mano de la ley 7575 en su artículo 58 y de la Ley del Instituto Costarricense de Turismo, siendo que en dichas normativas no se plantea la hipótesis por la cual fue encontrado culpable su defendido de invasión de área protegida, por cuanto las leyes de cita no incluyen para su tratamiento lo relativo al Volcán Turrialba, ni lo referente a los dos kilómetros de radio del cráter del volcán que supuestamente invadió su defendido.

Efectivamente lleva razón el impugnante por cuanto en la sentencia sometida a análisis se detecta un vicio iniudicando , pues la normativa utilizada por el Juez de instancia para encontrar autor responsable de un delito de invasión de área protegida es incorrecta. Como se observa del fallo apelado, el Juez del Tribunal utilizó el artículo 58 de la ley 7575 y aunque no se incluya en el "Por tanto ", dentro de la fundamentación de la misma incluye la mención a la ley del Instituto Costarricense de Turismo. La aplicación de dichas normas es errática en el caso sub litem, pues tal y como lo hicieron notar expresamente en la audiencia oral tanto el representante del Ministerio Público, como el Procurador de la República, la utilización correcta de normas en el caso concreto lo son el artículo 7 de la Ley de Tierras y Colonización, y el numeral 32 inciso c y 37 de la Ley Orgánica del Ambiente.

Veamos que en el caso concreto el Tribunal de Juicio opta por absolver de toda pena y responsabilidad penal al acusado de los delitos de Aprovechamiento ilegal de productos forestales en propiedad privada y de cambio de uso del suelo en perjuicio de los Recursos Naturales. Al observar la fundamentación de la absolutoria, ésta Cámara de Apelación encuentra que el a quo tuvo por acreditado que precisamente la finca es propiedad privada del acusado y que los hechos demostrados radican en que el endilgado contrató a alguien para que limpiara un camino que llegaba hasta el centro de su propiedad, sendero o trecho que existía de mucho tiempo atrás (el recurrente en la audiencia habló de sesenta o setenta años y ninguna parte presentó alegato contrario a ello). El juzgador de instancia tuvo por acreditado ( y por eso absuelve) que el acusado no cambió el uso del suelo y tampoco hizo aprovechamiento de recursos naturales en propiedad privada, razonando de la siguiente forma en lo que interesa: " Ahora bien, en el caso bajo estudio, es el criterio del suscriptor de este veredicto que no se ha demostrado la hipótesis fáctica contendida en la pieza acusatoria fiscal con respecto al delito de aprovechamiento ilegal de productos forestales en propiedad privada, esto porque no existe una descripción de hechos que permitan considerar la existencia de tal delincuencia.

Además, en lo relativo a la calificación legal de cambio de suelo, interesa destacar en este momento las serias y esenciales inconsistencias existente entre la calificación y las diversos y contradictorias descripciones fácticas que se podrían tener por probadas que también permiten desechar dicha calificación esto de conformidad con el artículo 61 inciso c) con relación al artículo 19 de la ley 7575 se requiere como acción el cambio de uso....los terrenos no están cubiertos de bosque como parte de los elementos objetivos del tipo, pues de la prueba documental particular de la prueba documental ofrecida por la defensa, fotocopias de escrituras de folio 101 a 111, secuencia fotográfica de folio 112 y 113, se refleja que la zona no es un bosque , a lo anterior hay que agregar que conforme a la prueba testimonial ofrecida por la defensa los terrenos se han dedicado durante muchos años antes del actual propietario a labores de ganado de leche.... y que los testigos han reconocido la existencia desde hace mucho tiempo ..." (ver folios 159 y 160 del expediente).

De lo transcrito se establece entonces varias premisas, en primer lugar y observando los documentos probatorios de folio 110, que el imputado [[Nombre1] ] es el representante con carácter de apoderado generalísimo sin limite de suma de la sociedad "Altos Montes del Volcán Turrialba", sociedad que es dueña a su vez de los inmuebles del Partido de Cartago, inscritos bajo los folios reales números noventa y un mil seiscientos veinte secuencias cero cero uno, cero cero dos, cero cero tres y cero cero cuatro, noventa y nueve mil ciento sesenta y siete secuencias cero cero uno, cero cero dos , cero cero tres y cero cero cuatro, cuyas descripciones se indican en las escrituras de folios 101 y siguientes. Precisamente dichos inmuebles son los que están dentro del Parque Nacional Volcán Turrialba y son de igual forma los que desde hace muchos años son usados para la actividad agrícola, propiamente una antigua lechería que existía en el sitio y que dan cuenta las fotografías de folios 112 a 114 de los autos.

Las condiciones de dicha finca, su antigua actividad económica, y su ubicación queda demostrado por toda la prueba que se utilizó en el juicio y es precisamente la propiedad que es objeto de este asunto y que ya desde mucho tiempo atrás y así lo reconoce el fallo impugnado, tenía el camino o sendero que el imputado mandó a limpiar a través de terceras personas. La situación en el caso sub litem,hay que aclararla pues el vicio detectado no se refiere al modo en que se demostró en forma fehaciente que fue el encartado y no otra persona quien mandó a limpiar el sendero ya existente. Además que el trabajo se hizo dentro del radio de protección que de dos kilómetros de distancia del cráter del Volcán Turrialba, pero las situaciones demostradas se hicieron al amparo de la utilización de leyes erróneas como se mencionó para poderle atribuir alguna conducta delictiva al encartado por la realización de la limpieza del sendero dentro de su fundo o sea propiedad privada, debía observarse los numerales del 1, 7 de la Ley de Tierras y Colonización en concordancia con los numerales 32 inciso c) y 37 de la Ley Orgánica del Ambiente.

En lo que interesa la primer Ley de cita indica: " CAPITULO I DISPOSICIONES GENERALES Finalidades, Régimen de Posesión de la Propiedad Rural Inmueble Artículo 1º.- La presente ley tiene por objeto: 1.- Determinar que la propiedad de la tierra se debe promover para el aumento gradual de su productividad y para una justa distribución de su producto, elevando la condición social del campesino y haciéndolo partícipe consciente del desarrollo económico-social de la Nación; 2.- Contribuir al florecimiento de las virtudes republicanas,privadas y públicas, vinculando al ciudadano a un régimen sano de posesión de la tierra; 3.- Contribuir a una más justa distribución de la riqueza;4.- Contribuir a la conservación y uso adecuados de las reservas derecursos naturales renovables de la Nación; 5.- Evitar la concentración de tierras nacionales en manos de quienes las utilicen para especulación o explotación en perjuicio de los intereses de la Nación.

Las tierras en manos de esos intereses deben volver al Estado en la forma que determinan la Constitución y la ley; 6.-Determinar que la tierra no debe utilizarse para la explotación del trabajador agrícola. El Estado, por todos los medios a su alcance, estimulará la formación de cooperativas agrícolas para combinar la dignidad de la pequeña propiedad con la eficiencia de la gran empresa; y 7.- Reconocer, de conformidad con lo anteriormente expuesto, la existencia y legitimidad de la propiedad privada (el resaltado no es del original). Se establece de conformidad con los conceptos transcritos, que el legislador estableció que a pesar de que el Estado tenga y deba tener interés en la conservación y protección de las tierras y de los recursos naturales, también la protección, reconocimiento y legitimidad de la propiedad privada de las personas físicas o jurídicas. Siguiendo con el estudio legislativo que nos compete para la resolución de este recurso, se debe observar el numeral 7 inciso e) de la citada ley, donde se establece propiamente lo relativo al Volcán Turrialba y no como erraticamente en sentencia se utilizó otra normativa, veamos: " CAPITULO II Propiedad Agrícola del Estado Artículo 7º. -Mientras el Estado, por voluntad propia o por indicación del Ministerio de Agricultura o del Instituto de Tierras y Colonización, atendiendo razones de conveniencia nacional, no determine los terrenos que deben mantenerse bajo su dominio, se considerarán inalienables y no susceptibles de adquirirse por denuncio o posesión, salvo los que estuvieren bajo el domino privado, con título legítimo, los siguientes: e) Una zona de dos kilómetros de radio, con centro en el cráter, o cima principal alrededor de los volcanes Barba, Poás, Arenal, Cerro Chato, Tenorio, Santa María y Rincón de la Vieja; de dos kilómetros de ancho a uno y otro lados de la fila constituida por los varios picos del Miravalles; la zona en los volcanes Irazú y Turrialba a partir de los 3.000 metros de altitud y hacia la cima; los páramos de la Cordillera de Talamanca a partir de los 3.000 metros de altitud y hacia la cima; una zona de tres kilómetros de radio con centro en la cima del [Dirección1] ; las sabanas alrededor del Cerro [Dirección2] arriba de los 3.000 metros de altitud; una zona de dos kilómetros de ancho a uno y otro lados de la Cordillera entre los Cerros Zurquí y Hondura.

Oportunamente creará el Instituto otras reservas forestales que servirán, además, de santuario o refugio de la vida animal silvestre y en los cuales será prohibida la cacería en cualquiera de sus forma. Si para ese uso fuere necesario establecer servidumbres sobre predios de particulares, el Instituto compensará a éstos equitativamente (el resaltado no es del original). Como se observa del numeral de cita, la Ley de Tierras y Colonización es la normativa que debió aplicarse al caso concreto, pues precisamente es la que establece los dos kilómetros de radio con centro en el cráter para su protección y además en forma expresa incluye al Volcán Turrialba, lo que sucede es que se sigue en forma coherente en este artículo el espíritu del legislador de proteger la propiedad privada, pues aunque el bien y dicha distancia de dos kilómetros de radio estén dentro de un Parque Nacional, como lo es el del Volcán Turrialba, no opera contra los intereses de un tercero que la tenga bajo dominio privado y con título legítimo, como ocurre en el sub litem, donde quedó demostrado que el imputado tiene el título legítimo de propiedad sobre el terreno en cuestión y por ende, no hay ilicitud alguna en su conducta.

Ahora bien, la atipicidad de lo efectuado por el endilgado se demuestra aún con más fuerza con las disposiciones que se encuentran en los artículos 32 inciso c) y 37 de la Ley Orgánica del Ambiente, normas que en lo que interesan rezan: " CAPITULO VII AREAS SILVESTRES PROTEGIDAS ARTICULO 32.- Clasificación de las áreas silvestres protegidas El Poder Ejecutivo, por medio del Ministerio del Ambiente y Energía, podrá establecer áreas silvestres protegidas, en cualquiera de las categorías de manejo que se establezcan y en las que se señalan a continuación: a) Reservas forestales. b) Zonas protectoras.c) Parques nacionales .d) Reservas biológicas.e) Refugios nacionales de vida silvestre.f) Humedales.g) Monumentos naturales.Esas categorías de manejo y las que se creen en el futuro, serán administradas por el Ministerio del Ambiente y Energía, salvo las establecidas en el artículo 33 de esta ley.

Las municipalidades deben colaborar en la preservación de estas áreas.ARTICULO 37.- Facultades del Poder Ejecutivo Al establecer áreas silvestres protegidas, cualquiera sea su categoría de manejo,el Poder Ejecutivo, por medio del Ministerio del Ambiente y Energía, queda facultado para incluir, dentro de sus límites, las fincas o partes de fincas particulares necesarias para cumplir con los objetivos señalados en esta ley y para instrumentarlos de acuerdo con el respectivo plan de manejo o crear las servidumbres legales para la protección ecológica y el cumplimiento de la presente ley. Cuando se trate de parques nacionales, reservas biológicas o refugios nacionales de vida silvestre estatales, los terrenos serán adquiridos por compra, expropiación o ambos procedimientos, previa indemnización. En los casos de reservas forestales, zonas protectoras, refugios de vida silvestre mixtos y humedales, los predios o sus partes también podrán comprarse o expropiarse, salvo que, por requerimiento del propietario, se sometan voluntariamente al régimen forestal.

Esa sujeción será inscrita en el Registro Público de la Propiedad, como una afectación al inmueble, que se mantendrá durante el tiempo establecido en el plan de manejo. Las fincas particulares afectadas según lo dispuesto por este artículo, por encontrarse en parques nacionales, reservas biológicas, refugios de vida silvestre, reservas forestales y zonas protectoras, quedarán comprendidas dentro de las áreas protegidas estatales solo a partir del momento en que se hayan pagado o expropiado legalmente, salvo cuando en forma voluntaria se sometan al Régimen Forestal. Tratándose de reservas forestales, zonas protectoras y refugios de vida silvestre y en caso de que el pago o la expropiación no se haya efectuado y mientras se efectúa, las áreas quedarán sometidas a un plan de ordenamiento ambiental que incluye la evaluación de impacto ambiental y posteriormente, al plan de manejo, recuperación y reposición de los recursos." (Así reformado este párrafo por el artículo 72, inciso c), de la Ley Forestal No.7575 del 13 de febrero de 1996, que a su vez ha sido reformado por el 114 de la Ley N° 7788 de 30 de abril de 1998) Se faculta al Poder Ejecutivo para que, por medio del Ministerio del Ambiente y Energía, realice las expropiaciones, contempladas en este artículo, de conformidad con lo establecido en la Ley de expropiaciones No. 7495, del 3 de mayo de 1995 (el resaltado no es del original).

De lo ut retro citado, se establece sin lugar a dudas que el imputado no cometió delito alguno, por cuanto si bien la propiedad objeto de esta litis está dentro de un Parque Nacional, tal y como lo preceptúa el artículo de comentario, de igual forma es una propiedad privada adquirida con un título legítimo, por lo cual no puede ser objeto de persecución penal el encartado de marras, salvo que se demostrara como lo informa claramente el artículo 37 de esta ley, que se han dado dos supuestos a saber; a) que se haya dado la compra forzosa o sea la expropiación, eso si previo pago o indemnización al titular del inmueble y b) que en forma voluntaria el dueño de la finca que está dentro de un Parque Nacional se someta al régimen forestal. Cumplidos los supuestos dichos, si una persona realiza actividades dentro de la finca que ya no le pertenece por vendersela al Estado o por haberse sometido a un régimen forestal, pues eventualmente podría enfrentar cargos por el delito que la Fiscalía procure probar, pero en el caso de marras, el Ministerio Público nunca aportó la prueba suficiente y necesaria que hiciera notar que el imputado [[Nombre1] ] ejerció la acción de limpieza del camino o sendero sobre una propiedad del Estado, adquirida por los medios que se han señalado.

Como lo expusieron tanto la Fiscalía como el Procurador en la vista oral, al no haberse demostrado por el Ministerio Público tales alcances, no puede determinarse delito alguno cometido por el encartado [[Nombre1] ], pues hasta la fecha del debate y de acuerdo a las probanzas utilizadas por el Juez de Juicio, las fincas objeto del proceso aún son propiedad privada de éste y no hay noticia alguna de expropiación o entrega voluntaria de la Finca al Estado, de ahí la falta de tipicidad lo que deviene en la absolutoria del imputado. En consecuencia, conforme lo solicita la defensa, debe declararse con lugar el recurso, anular el fallo en los extremos de la condenatoria tanto penal como civil y en su lugar absolver al imputado de toda pena y responsabilidad por el hecho atribuido.

Por tanto:

Se declara con lugar el recurso por el fondo. Se anula el fallo en los extremos de la condenatoria tanto penal como civil y en su lugar se absuelve al imputado [[Nombre1] ] de toda pena y responsabilidad por el hecho atribuido.
