APPEAL filed in the present proceedings brought against [Name 001], [...], for the offenses of LAND-USE CHANGE (CAMBIO DE USO DE SUELO) AND ENCROACHMENT UPON A PROTECTION ZONE (INVASIÓN A ZONA DE PROTECCIÓN), to the detriment of NATURAL RESOURCES. Judges Edwin Salinas Durán and Jorge Luis Arce Víquez, and Judge Kathya Jiménez Fernández, participated in deciding the appeal. Attorneys Margot Avellán Ruiz, counsel for the Procuraduría General de la República, and Deybell Kerr Stevenson, representing the Ministerio Público, appeared before this Court, and BACKGROUND:
1. By oral judgment number 08-2014, issued at 13:13 on 11 de febrero de 2014, the Tribunal Penal de Heredia, Sarapiquí seat, ruled: “POR TANTO: In accordance with the foregoing and pursuant to Articles 39 and 41 of the Constitución Política, 08 of the Convención Americana Sobre Derechos Humanos, 14 of the Pacto Internacional de Derechos Civiles y Políticos, 01, 22, 30, 31, 45, and 103 of the Código Penal, 01, 02, 06, 09, 75, 111 to 116, 180 to 184, 265 to 270, and 324 to 366 of the Código Procesal Penal, 01, 02, 03, 33 subsection a), 57, 58 subsection a), and 61 subsection c) of the Ley Forestal, 1045 of the Código Civil, and 01, 16 subsections a) and b), and 38 of Executive Decree Number 36562-JP of the Presidencia de la República and the Ministerio de Justicia, this Court ACQUITS [Name 001] of all punishment and liability for the offenses of LAND-USE CHANGE AND ENCROACHMENT UPON A PROTECTION AREA (INVASIÓN DE ÁREA DE PROTECCIÓN) that have been attributed to him to the detriment of NATURAL RESOURCES. The compensatory civil action (Acción Civil Resarcitoria) brought by THE STATE against civil defendant [Name 001] is DENIED in all respects. 2. Attorney Margot Avellán Ruiz, counsel for the Procuraduría General de la República, filed an appeal of the criminal judgment against the foregoing ruling.
3. After conducting the corresponding deliberations in accordance with Article 465 of the Código Procesal Penal, the Court considered the issues raised in the appeal.
4. The applicable legal requirements have been observed throughout the proceedings.
Appellate Judge Salinas Durán drafts the opinion, and
CONSIDERING:
I.Attorney Margot Avellán Ruiz, counsel for the Procuraduría General de la República, after extensively recounting the facts attributed to the accused, challenges the award of costs imposed on the party she represents with respect to the civil action and private prosecution brought by the State. In her first claim, she alleges the “insufficient reasoning of the judgment regarding the award of costs arising from the compensatory civil action and the private prosecution brought by the State, in direct violation of Article 142 of the Código Procesal Penal.” She explains that the trial judge found that the State lacked a plausible reason to litigate because it sued only one member of the Board of Directors of Collin Street Bakery, whom it selected arbitrarily, while taking no action against the company or the other directors; this was sufficient to support the award because the claim was arbitrary and frivolous.
Apart from that consideration, the trial judge provided no further analysis. He did not even consider the obligation of the party she represents to take action where environmental harm (daño ambiental) had actually been caused, as reported by the Ministerio de Ambiente y Energía, requiring it to seek compensation through the respective criminal and civil actions. Citing legal scholarship, she refers to the trial judge’s obligation to state the reasons for the ruling regarding costs, since, in her view, it is insufficient to rely solely on the fact that action was not taken against the proper party while ignoring that environmental harm did in fact occur, regardless of who caused it, and that the State was obligated to seek compensation. It is insufficient to state that the State acted in bad faith without even analyzing how that bad faith was established and demonstrated, or considering that the grounds supporting the action were legitimate.
A review of the case file is sufficient to determine that the State’s obligation was justified by the environmental harm caused and, moreover, that the action had been admitted for adjudication at trial. She reiterates that the decision lacks adequate reasoning and that the trial judge failed to address the grounds for the action showing that there was indeed a plausible reason to litigate and that the State therefore had standing to bring the action. In her second claim, she alleges the “failure to observe or apply substantive law, specifically Articles 267 of the Código Procesal Penal and 222 of the Código Procesal Civil.” She repeats that the Trial Court ordered the State to pay costs on the ground that it lacked a plausible reason to litigate because it brought an action against a person who was neither criminally nor civilly liable, rendering the action frivolous, arbitrary, and brought in bad faith.
In making that finding, the judge disregarded the fact that, when the action was filed, the facts revealed the commission of an environmental offense and the causation of harm of considerable magnitude, to the point that the prosecuting authority issued an indictment, which required the State’s representatives to take action against the alleged responsible party. Any doubt concerning the accused’s participation did not mean that the action was arbitrary, frivolous, or brought in bad faith, because the Procuraduría did not act on a whim or for personal reasons, but pursuant to a legal mandate requiring it to take action against those allegedly responsible. In ordering the State to pay costs, the judge failed to consider that the State did have a plausible reason to litigate, particularly because the environmental harm was evident and because the amount claimed was based on the amounts determined by the Ministerio de Ambiente y Energía and was therefore not arbitrary.
Citing various legal provisions, she reiterates the obligation of the Procuraduría General de la República to litigate in protection of various legally protected interests (bienes jurídicos), and, under that standard, its plausible reason to litigate. Based on the foregoing claims, she requests that the appeal be granted and that the judgment be partially reversed, exempting the State from payment of costs. Position of the Ministerio Público. Attorney Deybell Kerr Stevenson, prosecutor for the Ministerio Público, states that the party she represents did not undertake the civil claims and therefore requests that they be resolved as appropriate in light of the claims raised.
Having analyzed the two claims raised by the appellant Procuradora, which, because they are related, are decided jointly, and in light of the oral ruling of the court below, contained in a digital versatile disc (DVD) recording the judgment in its entirety, it can be determined that the trial judge delivered an extensive explanation lasting 1:55:34 hours. However, regarding the costs of the civil action for damages (demanda civil resarcitoria) and the private criminal complaint (querella) filed by the State, the judge justified the award of costs on the ground that there was no plausible reason to litigate, because pursuing the action brought against the accused was arbitrary, reckless, and uncompromising, considering that there were other natural and legal persons who could have been sued (sequence beginning at 1:47:25). Nevertheless, as the appellant argues, that reasoning is insufficient to support the award of costs, since the Court failed to analyze the State’s reasons for filing its action.
Those reasons establish that the Procuraduría General de la República, representing the State, was legally obligated to bring the corresponding actions, even though it was determined that the accused, [Nombre 001], was not personally responsible for the alleged offense. Consequently, although the action was not granted, it was not an “arbitrary, reckless, or uncompromising” exercise, as the judgment stated, because it was indeed established that environmental damage had been caused by the company of which the accused is a member. A “plausible reason to litigate is one that has merit; that is, it was reasonable to decide to file a private criminal complaint, bring the civil action, or oppose that action. This must be assessed on a case-by-case basis” (LLOBET RODRÍGUEZ. J. (2012). Código Procesal Penal. Editorial Jurídica Continental, San José, p. 267). In the same vein, this Appeals Chamber, formerly the Tribunal de Casación Penal, held in a matter similar to the present one that: “The claimant’s good faith or plausible reason may exist even where the civil claim is dismissed, as occurred in the present case.
The action pursued by the Ministerio Público in filing the accusation; the complaint filed (...) and other evidence specific to the case reasonably support the inference that environmental damage may have occurred and that, based on such evidence, the civil claim brought by the Procuraduría General de la República did provide it with a plausible reason to litigate. The evidence cited provides a reasonable basis for the judicial activity undertaken by the civil claimant, such that a plausible reason to litigate exists, as required by article 267 of the c.p.p. The central issue decided in the case was not so obvious as to render the civil action brought by the State an abusive or careless exercise of a judicial remedy” (voto 330-2004, de las 09:15 horas del 15 de abril de 2004, jueces Cruz Castro, Arce Víquez y Llobet Rodríguez). That precedent applies here because a comprehensive review of the judgment shows that the Ministerio Público pursued the case against the accused, [Nombre 001], because he held a general power of attorney without limitation as to amount (apoderado generalísimo sin limitación de suma) for Collin Street Bakery Incorporated, known as Corsicana.
In that capacity, he was accused of having caused, through intermediaries, a land-use change (cambio de uso del suelo) from land designated for protection to plantation land for growing pineapples (see accusation at folios 341 a 350). Moreover, that accusation was supported by extensive reports from officials of the Ministerio de Ambiente, Energía y Telecomunicaciones (MINAET) of the Sistema de Áreas de Conservación, which confirmed the change in land use and the environmental damage caused by that activity, primarily within the protection area of the spring (naciente). Under this reasoning, the civil action and the private criminal complaint brought by the Procuraduría General de la República were not “arbitrary, reckless, and uncompromising,” as the judge stated, since don Domingo was not sued at random or selected without any justified reason; rather, there were indeed grounds for finding that he may have borne some responsibility for the environmental damage caused.
Furthermore, as the appellant correctly argues, the State has a legal obligation not only to protect the environment but also to pursue criminal and civil claims against those considered potentially responsible for damaging it. In other words, regardless of the determination that the accused was not liable, the State’s action was justified, which is sufficient grounds to establish that it did have a plausible reason to litigate. In light of the foregoing, the appeal must be granted and, consequently, the judgment is partially reversed, exempting the State from payment of the procedural costs and attorney’s fees arising from the civil action and the private criminal complaint. In all other respects, the judgment remains undisturbed because it was not appealed.

2. Que contra el anterior pronunciamiento, la licenciada Margot Avellán Ruiz, procuradora de la Procuraduría General de la República, presentó recurso de apelación de sentencia penal.
3. Que verificada la deliberación respectiva de conformidad con lo dispuesto por el artículo 465 del Código Procesal Penal, el Tribunal se planteó las cuestiones formuladas en la impugnación.
4. Que en los procedimientos se han observado las prescripciones legales pertinentes.
Redacta el juez de apelación Salinas Durán, y
CONSIDERANDO:
I.La licenciada Margot Avellán Ruiz, procuradora de la Procuraduría General de la República, luego de una amplia referencia a los hechos que se le endilgaron al acusado, protesta la condena en costas que, en cuanto a la acción civil y querella planteada por el Estado, se impuso a su representado. En un primer reclamo expone la "insuficiente fundamentación de la sentencia en cuanto a la condenatoria en costas con motivo de la acción civil resarcitoria y la querella incoada por el Estado, en abierta transgresión del numeral 142 del Código Procesal Penal". Explica que el Juzgador consideró que el Estado no tuvo razón plausible para litigar, pues demandó solo a uno de los miembros de la Junta Directiva de la sociedad Collin Street Bakery, a quien eligió en forma arbitraria, pues no accionó contra la empresa ni los restantes directores, lo que era suficiente para la condena, pues la demanda fue arbitraria y temeraria.
Aparte de esa consideración no hay mayor abordaje del Juzgador. que ni siquiera apreció la obligación que tiene su representada para accionar en tanto hubo una efectiva causación de un daño ambiental, conforme fue denunciado por el Ministerio de Ambiente y Energía, y que exige gestionar el resarcimiento a través de las respectivas acciones penales y civiles. Con citas de doctrina refiere de la obligación del Juzgador de fundamentar su fallo en cuanto a las costas ya que, en su criterio, es insuficiente basarse solo en que no se accionó contra quien correspondía, ignorando que en efecto hubo un daño ambiental, independientemente de quien lo cometió, y la obligación estatal de buscar un resarcimiento. Es insuficiente indicar que hubo mala fe del Estado, sin siquiera analizar cómo es que se comprueba y se pone en evidencia esa mala fe, ni tampoco analizar que la causa que amparaba la acción era legítima.
Basta revisar el daño ambiental causado, pero además había sido admitida para ser conocida en juicio. Reitera que la resolución carece de una fundamentación adecuada, y el Juzgador omitió referirse a los fundamentos de la acción que determinan que sí había una razón plausible para litigar, por lo que el Estado estaba legitimado para accionar. En el segundo reclamo señala la " inobservancia o falta de aplicación de la Ley Sustantiva, concretamente los artículos 267 del Código Procesal Penal y el 222 del Código Procesal Civil". Repite que el Tribunal de Juicio condenó al Estado al pago de las costas considerando que no tuvo razón plausible para litigar, por cuanto accionó contra un sujeto que no era responsable ni penal ni civilmente, por lo que la acción resultó temeraria, arbitraria y de mala fe. Partiendo de esa afirmación el Juez ignoró que cuando se presentó la acción los hechos revelaban la comisión de un ilícito ambiental y al causación de un daño de considerables proporciones, al tanto que se generó una acusación por parte del ente fiscal, lo que obligaba a la representación estatal a accionar contra el presunto responsable.
Si hubo duda en cuanto a la participación del imputado ello no implicó que la acción fuera arbitraria, temeraria o de mala fe, porque la Procuraduría no actuó por capricho o por consideraciones personales, si no atendiendo a un mandato legal que la obliga a accionar contra los presuntos responsables. El Juez al condenar al Estado omitió valorar que si había razón plausible para litigar por parte de éste, máxime que el daño ambiental era evidente, pero además que la suma reclamada obedeció a las sumas que determinó el Ministerio de Ambiente y Energía, por lo que no resultaron antojadizas. Con cita de diversas normas legales, reitera la obligación que asiste a la Procuraduría General de la República para litigar en protección de varios bienes jurídicos, y bajo ese parámetro su razón plausible para litigar. Con los anteriores reclamos solicita se acoja el recurso y se revoque parcialmente al sentencia, eximiendo al Estado al pago de las costas.
Posición del Ministerio Público. La licenciada Deybell Kerr Stevenson , fiscal del Ministerio Público, refiere que los reclamos civiles no los asumió su representado, por lo que solicita se resuelva conforme corresponda virtud de los reclamos planteados.
II.El reclamo es atendible . Analizados los dos reclamos de la Procuradora apelante, que por su conexidad se resuelven conjuntamente, y al tenor de lo que resolvió el Tribunal a quo en forma oral, archivo en disco versátil digital (DVD) que contiene la sentencia en forma integral, se logra determinar que el Juzgador de mérito, realizó una amplia disertación con duración de 1:55:34 horas, pero en lo que respecta a las costas de la demanda civil resarcitoria y la querella incoada por el Estado, justificó la condena en que no hubo razón plausible para litigar, porque el ejercicio de la demanda presentada contra el acusado fue arbitraria, temeraria y a ultranza, estimando que hubo otras personas, físicas y jurídicas, a quienes se pudo demandar (secuencia a partir de la 1:47:25). Sin embargo, tal y como lo reclama la impugnante, esa fundamentación es insuficiente para sustentar la condena en costas, desde que, en efecto, el Tribunal soslayó analizar las motivaciones que tuvo el Estado para presentar su demanda y que, sustentan que la Procuraduría General de la República, en representación de El Estado, pese a que se determinara que el acusado [Nombre 001] no era responsable en lo personal del delito acusado, sí estuvo en la obligación legal de presentar las acciones correspondientes, lo que determina que la demanda, aunque no fuera acogida, no fue un ejercicio "arbitrario, temerario o a ultranza" como lo señaló la sentencia, desde que, ciertamente, se acreditó que sí hubo un daño ambiental causado por la empresa de la cual el acusado forma parte.
La "razón plausible para litigar es aquella que es atendible, es decir es razonable que se haya decidido querellar o presentar la acción civil o bien oponerse a la procedencia de dicha acción. Ello debe ser valorado caso por caso" (LLOBET RODRÍGUEZ. J. (2012). Código Procesal Penal. Editorial Jurídica Continental, San José, p. 267). En ese mismo sentido, esta Cámara de Apelación, antes como Tribunal de Casación Penal, en un asunto similar al presente resolvió que: "La buena fe o la razón plausible del actor puede darse aún en el caso que se declare sin lugar la pretensión civil, como ocurre en el presente caso. La acción ejercida por el Ministerio Público, planteando la acusación; la denuncia interpuesta (...) y otros elementos de juicio específicos del caso, permiten inferir, razonablemente, que se pudo producir un daño medio ambiental y que con base en tales elementos de juicio, la pretensión civil de la Procuraduría General de la República sí le brindaba una razón plausible para litigar.
Los elementos de juicio citados le dan un sustento razonable a la actividad judicial desplegada por el actor civil, de tal forma que existe una razón plausible para litigar, según lo exige el artículo 267 del c.p.p. El punto medular que resolvió la causa no reviste tal obviedad que convierta la acción civil planteada por el Estado en un ejercicio abusivo o desaprensivo de una acción judicial " (voto 330-2004, de las 09:15 horas del 15 de abril de 2004, jueces Cruz Castro, Arce Víquez y Llobet Rodríguez). Precedente que es aplicable en la especie, porque al tenor del análisis integral del fallo, se advierte que el Ministerio Público siguió la causa contra el imputado [Nombre 001] a partir de que éste era el apoderado generalísimo sin limitación de suma de la empresa Collin Street Bakery Incorporated, conocida como Corsicana, y como tal lo acusó de que propició por intermedias personas el uso del cambio de suelo de naturaleza para la protección convirtiéndola en terreno de plantación para el cultivo de piñas (ver acusación de folios 341 a 350), pero además esa acusación se sustento en sendos informes de los funcionarios del Ministerio de Ambiente, Energía y Telecomunicaciones (MINAET) del Sistema de Áreas de Conservación, que corroboraron la variación del uso del suelo y el daño ambiental que esa actividad produjo, principalmente sobre el área de protección de la naciente.
Bajo esa inteligencia, la acción civil y la querella promovida por la Procuraduría General de la República no fue "arbitraria, temeraria y a ultranza" como lo señaló el Juzgador, puesto que no se demandó a don Domingo al azar, o se le escogió sin razón justificada alguna, sino porque, en efecto, habían bases para estimar alguna responsabilidad de su parte en el daño ambiental causado. Pero además, como bien lo argumenta la recurrente, existe una obligación legal del Estado no solo de proteger el medio ambiente sino de gestionar los reclamos, penales y civiles, para quienes se consideren potenciales causantes de daños al mismo. Es decir, la acción del Estado, independientemente de que se resolviera que el acusado no tenía responsabilidad, estuvo justificada, motivación suficiente para que se acredite que si tuvo razón plausible para litigar. Por lo expuesto, procede acoger el recurso incoado y, por consiguiente, se revoca parcialmente la sentencia, exonerando al Estado del pago de las costas procesales y personales de la acción civil y de la querella. En todo lo demás, permanece incólume la sentencia por no haber sido objeto de recurso.
POR TANTO:
Se declara con lugar el recurso de apelación interpuesto por la Procuraduría General de la República. En consecuencia, se revoca parcialmente la sentencia, y se exonera al Estado del pago de las costas, procesales y personales, de la acción civil y la querella. En lo demás permanece incólume el fallo.
