Also participating in the proceeding, on behalf of the plaintiff entity, was its general judicial attorney-in-fact (apoderada general judicial), Licda. Nombre139304, divorced, identity card number CED28225, resident of Guachipelín de Escazú (f. 202-203 and 266); and, representing the defendants, their special judicial attorney-in-fact (apoderada especial judicial), Licda. Rita María Herrera Durán, attorney, resident of Ciudad Quesada, identity card number CED109888 (f. 267). The aforementioned natural persons are of legal age and, except as noted, married.- RESULTS:
Judge Hess Araya drafts the decision, with the affirmative votes of Judge Fernández Brenes and Judge Garita Navarro; and, RECITALS:
In view of the manner in which this matter is resolved, this panel deems the judicial inspection proposed by the IDA unnecessary and therefore rejects it; the case-management judge had deferred ruling on its admissibility until this stage. Notwithstanding the foregoing, it must be emphasized that, in our view, that request should have been decided one way or the other by that judge. This is because the plaintiff had offered that evidence in its complaint (see f. 22), such that, pursuant to section 90.3 of the CPCA, the proposal should have been decided at the preliminary hearing.-
As likewise stated in the Results section, by order issued at 10:30 on 5 de mayo del 2014, this Court resolved—as evidence to assist in adjudication—to require the Director of the Área de Conservación Arenal Huetar Norte of SINAC to certify whether the property at issue in this litigation lies wholly or partially within the State’s Natural Heritage and, if the property is classified as forested, to indicate the percentage of its total area covered by forest. This was because a technical opinion concerning those matters was deemed indispensable, as they are fundamental to the proper determination of the matter under review (sub examine). In response to that order, official letter SINAC-ACAHN-OTAT-012-14 dated 22 de mayo del 2014 was received; after a highly thorough examination of the matters requested by this Chamber, it states the following two conclusions: “The area described in plan A-949288-2004 lies entirely within the Refugio Nacional de Vida Silvestre Mixto Maquenque (RNVSMM). The area overlapping State-owned land is eight hundred twenty-six thousand four hundred forty-one square meters and forty-seven square decimeters, 82ha6441.47m2. / The area where property A-413879-001 and 002 is located consists of natural forest (bosque natural) and lies within the RNVSMM.” Accordingly, the document received is admitted and added to the body of evidence (comuna probatoria).-
The following relevant facts are deemed proven:
1. By resolution adopted under article 45 of the minutes of Session No. 037-05 of 26 de setiembre del 2005, the IDA Board of Directors authorized the segregation and conveyance to the codefendants herein of the land corresponding to cadastral plan A-949288-2004, parcel 8-B-01 of the Proyecto de Titulación Llanuras de San Carlos y Sarapiquí, with an area of 826.441,47 square meters (fact 8 of the complaint, undisputed; f. 40-41 and 57).- 2. The conveyance to the beneficiaries of the aforementioned resolution was carried out through deed number 35-82 of volume 82 of the protocol of Notary Hubert Rojas Araya, executed at 15:00 on 20 de octubre de 2005. As expressly stated, the foregoing was done subject to “The Reservations indicated in the Ley de Aguas, the Ley General de Caminos Públicos, and the Ley Forestal,” and conditioned upon compliance with “All regulations protecting the environment and natural resources” (fact 9 of the complaint, undisputed; f. 34-37).- 3.
The registration created property number 413879-000 in the province of Alajuela, located in the Pital district of the canton of San Carlos, with interest 001 corresponding to Nombre139302 and interest 002 to Nombre139303 (fact 10 of the complaint, undisputed; f. 33 and 77-80).- 4. On 5 de agosto del 2008, the Instituto Geográfico Nacional (IGN), at the request of the Contraloría General de la República, prepared a “Study to Support Oversight Work on Land Titling in the Coto Brus, Río Aranjuez Watershed, San Carlos and Sarapiquí Plains, Santa Cruz Highlands, and Northern Zone 041 Projects of the Instituto de Desarrollo Agrario,” official letter DEGEO-096-08. Said study states—to the extent relevant—that on the property belonging to the co-defendants “there are areas of pasture and crops scattered throughout the entire property, as well as small patches of secondary forest and a larger area of primary forest, which can be seen to be gradually displaced by crops and pasture” (f. 82-155; in particular, f. 121).- 5.
On 27 de agosto del 2008, the División de Fiscalización Operativa y Evaluativa of the Contraloría General de la República issued and notified the IDA of report DFOE-PGAA-20-2008, containing the “results of the study of lands in national reserves on properties belonging to the State Natural Heritage (Patrimonio Natural del Estado),” including the property of the defendants herein, using the information contained in the IGN study mentioned in the preceding proven fact. Said report ordered that autonomous entity, among other actions, to “Carry out the administrative procedures and legal actions that may be appropriate before the corresponding authorities, so that proceedings may be initiated to recover the lands titled by the IDA that belong to the Patrimonio Natural del Estado and correspond to the 15 cases detailed (sic) in this document” (f. 179-191).- 6. By resolution adopted by the IDA Board of Directors in article 17 of ordinary session 016-2010 of 3 de mayo del 2010, as amended in article 10 of ordinary session 015-2011 of 25 de abril del 2011, it was ordered—to the extent relevant—to “Declare the (sic) administrative acts that gave rise to the property titles cited in the recitals of this resolution detrimental to the public interest (lesivos a los intereses públicos), because they were granted to the detriment of the State’s natural heritage.” The referenced recitals expressly mention the award made in favor of the defendants herein.
The declaration of detriment to the public interest (declaratoria de lesividad) was preceded, as stated, by the opinion of the Dirección de Asuntos Jurídicos, contained in official letter DAJ-323 (f. 157-170).- 7. The property awarded to the co-defendants, described in registered survey plan (plano catastrado) Placa26497, lies entirely within the Refugio Nacional de Vida Silvestre Mixto Maquenque. The area overlapping State lands is 826.441,47 square meters. Likewise, the area where property registration (finca matrícula) Placa26500 is located consists of natural forest and lies within the RNVSMM (f. 303-311).-
None of significance to the judgment.-
The IDA representative states, in summary, that by executive decree number 27726-MINAE-MAG of 30 de marzo de 1999, an area of 223.000 hectares was transferred to the IDA for the creation of the land-titling program (programa de titulación) known as “Llanuras de San Carlos y Sarapiquí,” resulting in the registration of the property in the province of Heredia (sic), real-property folio number Placa26501. The co-defendants applied to that Institute for title to parcel 8-B-01, described in cadastral plan (plano catastral) number A-949288-2004, with an area of 82 hectares 6441,47 square meters, located in Veracruz de Pital de San Carlos, province of Alajuela. He adds that, for the titling process, the interested parties did not submit a certification establishing whether or not said parcel was within the State’s natural heritage. Nor did they submit a study confirming appropriate land use (estudio de uso conforme de suelos).
Notwithstanding the foregoing, by resolution of the Board of Directors of the entity he represents, adopted in article 45 of session number 037-05 of 26 de setiembre del 2005, the subdivision (segregación) and transfer in favor of the defendants herein were authorized. The foregoing was formalized in public deed (escritura pública) number 35-82, executed before notary Hubert Rojas Araya on the following 20 de octubre, which was submitted for registration in the Registro Público, thereby creating, in favor of the defendants, the property in the province of Alajuela, real-property folio number 413879, subregistrations Placa2200 , in the names of Nombre139302 and Nombre139303 , respectively. He notes that, at the request of the Contraloría General de la República, the Instituto Geográfico Nacional, through official letter DEGEO-096-08 of 5 de agosto del 2008, determined that at the parcel’s location there were areas of crops and pasture scattered throughout the property, as well as small patches of secondary forest and a larger area of primary forest, which was gradually being displaced by crops and pasture.
Accordingly, in report DFOE-PGAA-20-2008 of 27 de agosto del 2008, the oversight body ordered the IDA to carry out the legally appropriate procedures to recover the titled lands belonging to the State’s natural heritage. By virtue of the foregoing, the Institute’s Board of Directors, by resolution adopted in article 17 of ordinary session number 016-2010 of 4 de mayo de 2010, declared detrimental to the public interest the administrative act ordering the subdivision, transfer, and registration in the Registro Público of the property at issue in these proceedings in favor of the defendants. As to the merits of the claim, he states that both law number 7599, concerning Titulación en Reservas Nacionales, and the regulations promulgated by the IDA on that same subject were declared unconstitutional by judgments number 8560-2001 and 2063-2007 of the Sala Constitucional. Consequently, the act challenged herein is absolutely void (absolutamente nulo), because it was processed pursuant to the aforementioned provisions.
In addition, the titling process for the parcel at issue herein failed to comply with mandatory regulatory requirements, thereby invalidating the resulting administrative act. The public interest is likewise affected because, as a result of those failures, the transfer of a property forming part of the State’s natural heritage was authorized. By virtue of the foregoing, he emphasizes that the ground for nullity (causal de nulidad) of the titling of the parcel at issue in these proceedings lies in the failure to comply with requirements established by law or regulation for the issuance of the administrative act, as well as in the failure to observe prohibitory rules, which in this case are articles 13, 14, and 15 of the Ley Forestal.-
VI.In response to the plaintiff’s arguments, the defendants state, in summary, that they had acquired possession of the disputed property from those who had previously possessed it since 1963. They deny having failed to comply with essential steps of the proceeding conducted before the IDA, which were never brought to their attention or requested of them. They contend that the administrative record does not show that their property lies within any State-protected area. They maintain that they acquired rights in good faith through possession exercised openly, peacefully, continuously, and as owners since before the award. They object that these proceedings seek only to annul their title without recognizing the damages and losses being caused to them, which they claim because, they assert, they have made many improvements to the property. They request that the claim be dismissed in its entirety and that the plaintiff institution be ordered to pay both categories of costs (ambas costas). Otherwise, they reiterate their request that “payment of all damages, losses, improvements, and other items be ordered.”-
Before undertaking the substantive analysis of the specific case, this Tribunal deems it necessary to examine compliance with the various prerequisites imposed by the legal system for bringing an action for annulment of a favorable administrative act (proceso de lesividad), since the absence of any one of these elements would make an examination of the merits unnecessary. Generally, such an action constitutes a judicial mechanism whereby the Administration seeks to set aside one of its own acts that produces favorable effects for an administered party (administrado). From that standpoint, in this type of dispute, the action is subjective in nature, insofar as it seeks the annulment of conduct that grants a right or, more generally, a benefit to a person. This action is codified in article 34 of the Código Procesal Contencioso Administrativo, a provision establishing the prerequisites and procedural rules governing this mechanism, as follows:
“ARTICLE 34.- 1) When the Administration itself, as the author of an act declaring rights (acto declarativo de derechos), seeks to bring an action for its annulment before the Jurisdicción Contencioso–Administrativa, the highest hierarchical authority must first declare it detrimental to public, economic, or other interests. The maximum period for doing so shall be one year, counted from the day following the date on which it was issued, except where the act contains defects rendering it absolutely void (vicios de nulidad absoluta), in which case such a declaration may be made for as long as its effects continue. In the latter circumstance, the one-year period shall run from the cessation of its effects, and the judgment declaring its nullity shall do so solely for purposes of its annulment and future inapplicability.
Likewise, the cited procedural rule must be read together with section 173 of the Ley General de la Administración Pública (LGAP)—amended by article 200 subsection 6) of the CPCA—which provides, to the extent relevant, as follows:
“Article 173.- 1) When the absolute nullity of an act declaring rights is obvious and manifest, it may be declared by the Administration through administrative proceedings, without the need to resort to the contentious-administrative action for annulment of a favorable administrative act provided for in the Código Procesal Contencioso–Administrativo, following a favorable opinion from the Procuraduría General de la República; such opinion is mandatory and binding. When the absolute nullity concerns administrative acts directly related to the budgetary process or public procurement (contratación administrativa), the Contraloría General de la República shall issue the opinion. In both cases, the respective opinions must expressly address whether the alleged nullity is absolute, obvious, and manifest.
The second aspect concerns standing to be sued (legitimación pasiva), which is held by the recipient of the effects of the administrative conduct declared injurious.- b) Objective element, given that a declaration that an act is injurious constitutes a mechanism for the legal removal of administrative acts—acts declaring rights—that are substantively inconsistent with the legal system, that is, acts affected by some degree of invalidity, whether absolute or relative, in any of its forms, pursuant to articles 128, 158, 165, and related provisions of the LGAP.- c) With respect to the procedural framework, the respective Public Administration must issue a reasoned declaration that the act is injurious, whether because it harms economic, fiscal, or other interests arising from the public interest; this must be established through internal actions by the Administration that cannot be postponed before filing the action.
It should be clarified that this does not require a hearing for the recipient who benefited from the injurious act, since that recipient may present defense arguments during the judicial proceedings. When the act originates from the Central Administration (Ministry), the complaint may be filed only by the Procuraduría General de la República (article 16 of Law number 8508), upon the prior request of the highest-ranking authority and following an internal declaration that the act is injurious, detailing the reasons for that determination. In the case of decentralized public administrations, the declaration must be issued by the highest body in the administrative hierarchy. Finally, the claim for annulment (pretensión anulatoria) may not be brought by way of counterclaim.- d) Finally, as to the temporal dimension, the procedural rules currently in force establish a one-year period calculated from the issuance of the act (not from its communication) within which to declare it injurious to the public interest; following that declaration (and not from the expiration of that first year), a one-year period is, in principle, granted for filing the contentious-administrative action, as a mandatory limitation period (plazo fatal de caducidad), except in cases involving acts affected by absolute nullity, in which case the declaration that the act is injurious may be made for as long as its effects continue, with the aforementioned one-year period running from the definitive cessation of those effects.
Under that scenario, any judgment granting relief shall order nullity solely for the future inapplicability of the act, constituting an express exception to the regime governing the retroactive effect of absolute nullities established by ordinal 171 of the LGAP. Nevertheless, the procedural legal system expressly establishes two exceptions to this one-year temporal requirement: i.- with respect to the protection of the public domain (dominio público), where an action seeking a declaration that an act is injurious is not subject to any time limit because of the general rule that such property is not subject to prescription (imprescriptibilidad), as expressly follows from ordinal 34.2 of the CPCA (and, in the case of property incorporated into the State’s natural heritage (patrimonio natural del Estado), expressly from article 14 of the Ley Forestal); and ii.- in tax matters, where article 41.2 of the Code governing this jurisdiction provides that the maximum period for initiating proceedings shall be the same as that established by the legal system as the limitation period for the respective substantive right at issue.
Specifically, if the temporal requirement for declaring an act injurious is not satisfied, the parties—and even the judge handling or deciding the case ex officio—may determine that the action is time-barred under article 39 ibídem.- In summary, if a Public Administration seeks to initiate contentious-administrative proceedings for a declaration that an act is injurious, it must satisfy the conditions set forth above; otherwise, the judicial body must declare the complaint inadmissible without examining the substantive arguments raised in the proceedings, because it must be recalled that the absence of a proper declaration that an act is injurious has an essentially procedural effect and does not affect the merits of the issues disputed in the proceedings.-
VIII.REVIEW OF COMPLIANCE WITH THE REQUIREMENTS FOR A DECLARATION THAT AN ACT IS INJURIOUS IN THE CASE UNDER REVIEW (SUB EXAMINE). Having made the foregoing clarifications, it is appropriate to examine compliance with the requirements enumerated above in the specific case submitted to this Chamber for consideration and decision. Beginning with the subjective requirements for a declaration that an act is injurious, the action was properly filed by the Administration that issued the act, with the respective beneficiaries named as defendants. As to the objective requirement, it is established that the challenged conduct—which in this case consists of: a) the resolution adopted by the Junta Directiva under article 45 of the minutes of session N° 037-05 of 26 de setiembre del 2005 (see proven fact 1); and b) the legal acts implementing the foregoing—namely, the public deed of conveyance (proven fact 2) and the entry recording it in the Registro Público (proven fact 3)—was indeed favorable to the interests of the co-defendant private parties, because the first authorized the segregation (segregación) and conveyance to them of the property at issue, which was effected through the latter acts.
Regarding the procedural requirements for the action, it is established that the declaration that the act is injurious did indeed originate from the hierarchical superior of the Administration that issued the act, which sub lite is the Junta Directiva of the IDA (see proven fact 6). Furthermore, the declaration that the act is injurious was preceded by the necessary technical and legal opinions supporting it—which, in this case, derive both from reports DEGEO-096-08 of the IGN (proven fact 4) and DFOE-PGAA-20-2008 of the CGR (proven fact 5), as well as from the opinion of the IDA’s legal advisory office (cited in the declaration that the act is injurious)—and is contained in a duly reasoned decision, a certified copy of which was submitted as part of the administrative record (the aforementioned proven fact 6). The action was not brought by way of counterclaim. Finally, regarding the temporal requirements, it bears repeating that the usual parameters governing declarations that an act is injurious do not apply in this case, because this is an action to protect property forming part of the State’s natural domain, which is not subject to prescription, pursuant to numeral 34.2 of the CPCA.
Accordingly, the Court finds that all legal requirements for allowing the action seeking a declaration that an act is injurious have been satisfied in this case, and all that remains is to examine the corresponding substantive arguments.-
In accordance with the aforementioned articles 13 and 14 of the Ley Forestal, the State’s natural heritage consists, among other things, of the forests and forest lands (terrenos forestales) within national reserves, areas declared inalienable, properties registered in its name, and properties belonging to municipalities, autonomous institutions, and other Public Administration bodies, except for real property securing credit transactions with the Sistema Bancario Nacional that becomes part of its assets. The cited provisions also state that nongovernmental organizations that acquire real property containing forests or suited for forestry, using funds from donations or the public treasury obtained on behalf of the State, must convey that property into the State’s name. The forest lands and forests constituting the State’s natural heritage are immune from attachment (inembargables) and inalienable; their possession by private parties shall create no right in their favor, and the State’s action to recover possession (acción reivindicatoria) of such lands is not subject to prescription, while their use and exploitation are subject to the Administration’s police power (poder de policía).
For its part, numeral 15 of the same Law provides that the Public Administration may not exchange, transfer, alienate in any manner, deliver, or lease rural lands that it owns or administers unless they have first been classified by the Ministerio del Ambiente y Energía. It also states that if those lands are covered by forest, they shall automatically be incorporated into the Patrimonio Natural del Estado, and a restriction shall be created that must be recorded in the Registro Público. Regarding this matter, it has been stated:
“Pursuant to section 13 of the Ley Forestal, ‘The State Natural Heritage (patrimonio natural del Estado) shall consist of the forests and forest lands (terrenos forestales) of national reserves, areas declared inalienable, properties registered in its name, and properties belonging to municipalities, autonomous institutions, and other Public Administration bodies, except for real property securing credit transactions with the National Banking System that becomes part of its assets....’ Thus, the provision establishes three categories of property comprising that heritage: a) forests and forest lands of national reserves; b) forests and forest lands of areas declared inalienable; and c) forests and forest lands of properties registered in its name and of properties belonging to municipalities, autonomous institutions, and other Public Administration bodies, except for real property securing credit transactions with the National Banking System that becomes part of its assets. (...). In this regard, section 13 ibid. clearly establishes that property covered by forest and belonging to the State, a municipality, an autonomous institution, or another Public Administration body forms part of the State Natural Heritage, without the Legislature requiring that the property fall within any of the specified protection categories.
(...)
Therefore, the criterion for determining whether real property forms part of the State Natural Heritage cannot be limited to whether a private party holds registered title; rather, the property’s history must be investigated in order to establish whether it was within the ownership of the State or any of its institutions and whether it is covered by forest (...)
Likewise, the contention that the Court failed to consider that the land had been in the possession of private parties does not constitute a cognizable claim before this Chamber, because the Ley Forestal is clear that such property is inalienable property (bienes inalienables), possession of which by private parties shall create no rights in their favor, and that the State’s action for recovery of title (acción reinvindicatoria) is not subject to a statute of limitations.” (First Chamber of the Supreme Court of Justice, N° 1070-F-S1-2010 at 9:40 on 3 de setiembre del 2010.)
X.Having stated the foregoing, it must be noted that, upon assessing the evidence in the record, this collegiate body finds that the real property at issue in these proceedings is indeed located entirely within the Refugio Nacional de Vida Silvestre Mixto Maquenque. The area overlapping State lands is 826.441,47 square meters. Furthermore, the area where property registration Placa26500 is located consists of natural forest and lies within the RNVSMM (proven fact 7) and, pursuant to the provisions cited supra, constitutes State Natural Heritage on the basis of the technical assessment obtained, without the need for an administrative act declaring it as such; by virtue of that status, it merits the protection afforded by the legal system to this type of property. Accordingly, it is appropriate to declare that the real property titled in favor of the defendants by the Board of Directors of the former Instituto de Desarrollo Agrario, through the Board resolution adopted under article 45 of the minutes of session N° 037-05 of 26 de setiembre del 2005, constitutes State Natural Heritage, as well as public-domain property (bien de dominio público) that is exempt from attachment, not subject to acquisition by prescription, inalienable, and outside private commerce.-
XI.In light of the foregoing, the defendants’ argument that they had acquired possession of the disputed property from those who had previously possessed it since 1963 is irrelevant (except with respect to costs, as discussed infra). They deny having failed to comply with essential procedural requirements in the proceeding conducted before the IDA, of which they were never informed and which were never requested of them. They contend that the administrative record does not show that their property lies within any State-protected area. They believe they acquired rights in good faith through possession exercised publicly, peacefully, continuously, and as owners since before the award decision. Indeed, none of the foregoing negates the error committed by the IDA—and not by them—in awarding real property that could not lawfully be transferred to them. Their good faith does not cure the fact that the plaintiff entity should have verified that the property’s conditions would not result in a violation of the legal system’s protection of the forest heritage (patrimonio forestal), an issue that necessarily requires the claim to be granted.-
XII.Having established—with merely declaratory effect—that the real property titled by the IDA in favor of co-defendants Nombre139302 and Nombre139303 constitutes State Natural Heritage under the applicable law, that fact alone renders absolutely null and void (nulidad absoluta) all formal administrative conduct and actions through which the transfer of that property to the co-defendants was permitted. This is because, as public-domain property, it was outside private commerce, and the law prohibited transferring title to it or creating rights in rem (derechos reales) over it. By its very nature, it could not be subject to private appropriation, nor could the existence of possessory rights over it be asserted. The claim must therefore be granted and, as requested, the resolution adopted under article 45 of the minutes of session N° 037-05 of 26 de setiembre del 2005, pursuant to which the IDA Board of Directors authorized the subdivision and transfer to the co-defendants herein of the land corresponding to cadastral plan Placa26497, parcel 8-B-01 of the Titulación Llanuras de San Carlos y Sarapiquí project, with an area of 826.441,47 square meters, must be declared null and void.
By reason of its connection thereto, public deed number 35-82, executed before notary Hubert Rojas Araya at 15:00 on 20 de octubre de 2005, must likewise be annulled and, as requested, the Archivo Nacional shall be ordered to enter a notation of nullity in the margin of the original instrument. Finally, the registration entry for the property in the Alajuela registry district, real folio registration Placa26499, including, of course, subregistrations Placa2200, must be annulled.-
As part of their answer to the complaint, the defendants request that, should the complaint be granted, “payment of all damages, losses, improvements, and other items be ordered.” Because this request was not submitted as part of a counterclaim (contrademanda) filed in accordance with law, it is inadmissible, and no ruling on the matter is required. This is without prejudice to the interested parties filing the corresponding claim in administrative proceedings and, potentially, judicial proceedings, should they deem it appropriate.-
The defendants raised the preliminary defenses (defensas previas) of expiration (caducidad) and limitation (prescripción), as well as the objections (excepciones) of lack of standing to sue and be sued, lack of a current interest, and failure to state a legal entitlement. As noted above, the first two were rejected by an interlocutory ruling at the preliminary hearing. The objection based on lack of standing must be denied in both forms. Standing on the merits (legitimación ad causam) exists insofar as the parties are connected to a particular substantive legal relationship, such that there must be identity between the claimant and the holder of the claimed subjective right or interest (active standing), and between the defendant and the party obligated to provide the requested relief (passive standing). Thus, active standing exists where the claim may effectively be granted with respect to the plaintiff, and passive standing exists where that ruling may be effective with respect to the defendant.
In this case, and based on the facts and legal arguments already explained, the IDA is the party required to declare that its own rights-conferring act is adverse to the public interest (lesividad) and to seek its annulment, while the defendants are the parties against whom—given the aforementioned factual and legal circumstances—that right may be exercised, as holders of the property right whose invalidation is sought. A current interest, in turn, is the need for protection experienced by a particular person that leads that person to request the intervention of the competent judicial body so that it may resolve the legal dispute to which that person is a party. In this case, the ruling issued herein is indispensable to achieving the annulment sought by the plaintiff entity; there is therefore no doubt that its interest in obtaining that result remains current, and the proposed defense must be denied.
Finally, the objection based on failure to state a legal entitlement is rejected because the claim brought by the IDA has sufficient legal support insofar as it seeks to ensure the protection of the State Natural Heritage pursuant to the statutory provisions cited supra.-
Because the grounds on which the precautionary measure (medida cautelar) ordered by resolution Nº 563-2012 at 16:00 on 4 de setiembre del 2012 was originally imposed remain in effect (see recital 2 supra), it is ordered that the measure remain in force until enforcement of the provisions of this ruling has been completed.-
Article 193 of the CPCA establishes that procedural costs and attorney’s fees (costas procesales y personales) are imposed on the losing party solely by virtue of being the losing party, a determination that must be made even sua sponte, pursuant to that same provision in conjunction with section 119.2 ibid. Exemption from such an award is permissible only: a) when, in the Court’s judgment, there was sufficient cause to litigate; b) when judgment is entered on the basis of evidence of which the opposing party was unaware; or c) when there is an excessive claim (plus petitio), that is, when the difference between the relief claimed and that ultimately obtained is fifteen percent (15%) or more, unless the grounds of the complaint are expressly deemed provisional or their determination depends on judicial discretion or expert opinion (section 194 ibid.). In this case, the Court finds that the co-defendants had sufficient cause to litigate because they received the property from the plaintiff entity under an act protected by the presumption of legality and which appeared to constitute the lawful exercise of that entity’s statutory powers. In this regard, their participation in the proceedings was unavoidable in order to reverse the effects of the act ultimately declared inconsistent with the legal system. Accordingly, this matter is resolved without any special award of costs.-
POR TANTO:
The judicial inspection (reconocimiento judicial) proposed by the claimant entity is denied. As evidence to assist the court in reaching its decision (prueba para mejor resolver), official letter SINAC-ACAHN-OTAT-012-14 dated May twenty-two, two thousand fourteen, is admitted. The defenses (excepciones) of lack of standing, lack of a current interest, and lack of a legal right are denied. The claim (demanda) filed by the Instituto de Desarrollo Agrario, now Instituto de Desarrollo Rural, against Nombre139302 and Nombre139303 is declared WELL-FOUNDED. Consequently, the resolution adopted under Article forty-five of the minutes of session number zero thirty-seven - zero five, dated September twenty-six, two thousand five, is declared absolutely null and void; by that resolution, the Board of Directors of the claimant entity authorized the subdivision and transfer (segregación y traspaso) to the co-defendants herein of the land corresponding to cadastral plan (plano catastral) A - nine hundred forty-nine thousand two hundred eighty-eight - two thousand four, parcel eight - B - zero one of the Titulación Llanuras de San Carlos y Sarapiquí project, with an area of eight hundred twenty-six thousand four hundred forty-one square meters and forty-seven square decimeters; the foregoing due to infringement of the regulations protecting the natural heritage of the State (patrimonio natural del Estado).
By reason of connection (conexidad), public deed (escritura pública) number thirty-five - eighty-two from volume eighty-two of the notarial protocol of Hubert Rojas Araya, executed at fifteen hundred hours on October twenty, two thousand five, is annulled. The Archivo Nacional is ordered to enter a notation of this declaration in the margin of the original instrument (matriz). The registration entry (asiento registral) for the property registered in the Province of Alajuela under real-property folio number Placa26496 – is annulled, including subregistrations (submatrículas) Placa6510 . Once this judgment becomes final, the corresponding writs (mandamientos) shall be issued to the Archivo Nacional and the Registro Público. The precautionary measure (medida cautelar) ordered by judgment number 563-2012 at sixteen hundred hours on September four, two thousand twelve, shall remain in effect until enforcement of the provisions of this judgment has been completed. Intervinieron también en el proceso, en representación del ente actor, su apoderada general judicial Licda. Nombre139304 , divorciada, con cédula de identidad número CED28225, vecina de Guachipelín de Escazú (f. 202-203 y 266); y representando a los accionados, su apoderada especial judicial Licda. Rita María Herrera Durán, abogada, vecina de Ciudad Quesada, con cédula de identidad número CED109888 (f. 267). Las personas físicas citadas son mayores y, con la salvedad hecha, casadas.-
RESULTANDO:
Redacta el juez Hess Araya, con el voto afirmativo de la jueza Fernández Brenes y del juez Garita Navarro; y,
CONSIDERANDO:
Por la forma en que se resuelve este asunto, este órgano colegiado estima innecesario y consecuentemente rechaza el reconocimiento judicial que propuso el IDA y que el juzgador de trámite dispuso relegar para esta etapa en cuanto a su admisión. No obstante lo anterior, no se puede dejar de lado destacar que, en nuestro criterio, esta gestión debió haber sido resuelta, en un sentido u otro, por dicho juez. Ello por cuanto ese ofrecimiento de prueba había sido hecho por la accionante desde el escrito de demanda (véase f. 22), de manera que conforme al numeral 90.3 del CPCA, debió ser en la audiencia preliminar que se dispusiera acerca de esa propuesta.-
Según se indicó igualmente en la parte de resultandos, por auto de las 10:30 horas del 5 de mayo del 2014, este Tribunal acordó –con carácter de prueba para mejor resolver– requerir al (la) Director(a) de la Área de Conservación Arenal Huetar Norte del SINAC, certificar si la propiedad que interesa a esta litis se encuentra total o parcialmente comprendida dentro del patrimonio natural del Estado y, en caso de que la propiedad clasifique como boscosa, indicar en qué porcentaje de su área total. Lo anterior por cuanto se consideró indispensable contar con criterio técnico relativo a los aspectos indicados, los cuales son fundamentales para la correcta decisión del sub examine . En respuesta a lo ordenado, se recibió oficio SINAC-ACAHN-OTAT-012-14 del 22 de mayo del 2014, el cual –luego de un estudio muy concienzudo de los aspectos requeridos por esta Cámara– fórmula las siguientes dos conclusiones: “El área descrita en el plano A-949288-2004 se encuentra totalmente dentro del Refugio Nacional de Vida Silvestre Mixto Maquenque (RNVSMM).
El área que traslapa los terrenos del Estado es de ochocientos veintiséis mil cuatrocientos cuarenta y un metros con cuarenta y siete decímetros cuadrados, 82ha6441.47m2. / El área donde se ubica la finca A-413879-001 y 002 es bosque natural y se encuentra en el RNVSMM.” En consecuencia, se admite el documento recibido y se agrega a la comuna probatoria.-
Como tales se tiene los siguientes de relevancia:
1. Que por acuerdo tomado en el artículo 45 del acta de la sesión N° 037-05 del 26 de setiembre del 2005, la Junta Directiva del IDA autorizó segregar y traspasar a los aquí codemandados, el terreno correspondiente al plano catastral A-949288-2004, parcela 8-B-01 del proyecto de Titulación Llanuras de San Carlos y Sarapiquí, con una extensión de 826.441,47 metros cuadrados (hecho 8 de la demanda, no controvertido; f. 40-41 y 57).- 2. Que el traspaso a favor de los beneficiarios del acuerdo recién citado se realizó mediante escritura número 35-82 del tomo 82 del protocolo del notario Hubert Rojas Araya, otorgada a las 15:00 horas del 20 de octubre de 2005. Lo anterior se hizo, según se indicó expresamente, con “Las Reservas indicadas en la Ley de Aguas la Ley General de Caminos Públicos y la Ley Forestal” y condicionado a lo dispuesto en “Toda aquella normativa de protección al medio ambiente de los recursos naturales” (hecho 9 de la demanda, no controvertido; f. 34-37).- 3.
Que la inscripción dio lugar a la finca número 413879-000 de la provincia de Alajuela, situada en el distrito Pital del cantón de San Carlos, correspondiendo el derecho 001 a Nombre139302 y el 002 a Nombre139303 (hecho 10 de la demanda, no controvertido; f. 33 y 77-80).- 4. Que el 5 de agosto del 2008, el Instituto Geográfico Nacional (IGN), a solicitud de la Contraloría General de la República, preparó un “Estudio para apoyar trabajo de fiscalización sobre titulación de tierras en los proyectos Coto Brus, cuenca del Río Aranjuez, llanuras de San Carlos y Sarapiquí, tierras altas de Santa Cruz y Zona Norte 041 del Instituto de Desarrollo Agrario”, oficio DEGEO-096-08. En dicho estudio se consigna –en cuanto interesa– que en el inmueble perteneciente a los codemandados “existen áreas con pasto y cultivos segregados por toda la finca, así como, también hay pequeñas manchas de bosque secundario y un área más extensa de bosque primario, el cual se observa que poco a poco está siendo suplantado por los cultivos y el pasto” (f. 82-155; en particular, f. 121).- 5.
Que el 27 de agosto del 2008, la División de Fiscalización Operativa y Evaluativa de la Contraloría General de la República emitió y puso en conocimiento del IDA el informe DFOE-PGAA-20-2008, que contiene los “resultados del estudio de tierras en reservas nacionales en terrenos pertenecientes al Patrimonio Natural del Estado”, incluyendo la propiedad de los aquí accionados, haciendo uso de la información contenida en el estudio del IGN que se menciona en el hecho probado anterior. Dicho informe ordenó a aquella entidad autónoma, entre otras acciones, “Realizar los procedimientos administrativos y las acciones que en derecho procedan ante las instancias correspondientes, a efecto de que se inicie un proceso de recuperación de las tierras tituladas por el IDA que pertenecen al Patrimonio Natural del Estado, y que corresponden a los 15 casos que se detallan (sic) en este documento” (f. 179-191).- 6.
Que por acuerdo tomado por la Junta Directiva del IDA en el artículo 17 de la sesión ordinaria 016-2010 del 3 de mayo del 2010 y modificado en el artículo 10 de la sesión ordinaria 015-2011 del 25 de abril del 2011, se dispuso –en cuanto interesa– “Declarar la (sic) lesivo a los intereses públicos los actos administrativos que dieron origen a los títulos de propiedad citados en la parte considerativa del presente acuerdo, por ser los mismos otorgados en detrimento del patrimonio natural del Estado”. Los referidos considerandos hacen referencia expresa de la adjudicación realizada a favor de los aquí accionados. La declaratoria de lesividad fue precedida, según se indica, por el criterio de la Dirección de Asuntos Jurídicos, contenido en oficio DAJ-323 (f. 157-170).- 7. Que el inmueble adjudicado a los coaccionados, descrito en el plano catastrado Placa26497, se encuentra totalmente dentro del Refugio Nacional de Vida Silvestre Mixto Maquenque.
El área que traslapa los terrenos del Estado es de 826.441,47 metros cuadrados. Asimismo, el área donde se ubica la finca matrícula Placa26500 corresponde a bosque natural y se encuentra en el RNVSMM (f. 303-311).-
Ninguno de importancia para el fallo.-
Manifiesta el personero del IDA, resumidamente, que mediante decreto ejecutivo número 27726-MINAE-MAG del 30 de marzo de 1999, se traspasó al IDA un área de 223.000 hectáreas para la creación del programa de titulación denominado “Llanuras de San Carlos y Sarapiquí”, que generó la inscripción de la finca del partido de Heredia (sic), folio real número Placa26501. Que los codemandados gestionaron ante ese Instituto la titulación de la parcela 8-B-01 descrita en el plano catastral número A-949288-2004, con un área de 82 hectáreas 6441,47 metros cuadrados, situada en Veracruz de Pital de San Carlos, provincia de Alajuela. Agrega que, para el trámite de la titulación, los interesados no presentaron certificación donde se estableciera si dicho predio se encontraba o no dentro del patrimonio natural del Estado. Tampoco presentaron un estudio de uso conforme de suelos. Pese lo anterior, mediante acuerdo de Junta Directiva de su representada tomado en el artículo 45 de la sesión número 037-05 del 26 de setiembre del 2005, se autorizó la segregación y traspaso a favor de los aquí demandados.
Lo anterior se plasmó en escritura pública número 35-82, otorgada ante el notario Hubert Rojas Araya el 20 de octubre siguiente, que fue presentada para su inscripción en el Registro Público, dando lugar a la creación a favor de los demandados de la finca del partido de Alajuela, folio real número 413879, submatrículas Placa2200 , a nombre de Nombre139302 y Nombre139303 , respectivamente. Advierte, que a instancia de la Contraloría General de la República, el Instituto Geográfico Nacional, mediante oficio DEGEO-096-08 del 5 de agosto del 2008, determinó que en la ubicación de la parcela se observa áreas de cultivos y pastos segregados por toda la finca, así como también hay pequeñas manchas de bosque secundario y un área más extensa de bosque primario, el cual poco a poco está siendo suplantado por los cultivos y el pasto. Fue así como en el informe DFOE-PGAA-20-2008 del 27 de agosto del 2008, el órgano contralor ordenó al IDA realizar los procedimientos que en derecho procedan a efectos de recuperar las tierras tituladas, que pertenecen al patrimonio natural del Estado.
En virtud de lo anterior, la Junta Directiva del Instituto, mediante acuerdo tomado en el artículo 17 de la sesión ordinaria número 016-2010 del 4 de mayo de 2010, declaró lesivo a los intereses públicos el acto administrativo que ordenó la segregación, traspaso e inscripción en el Registro Público del inmueble objeto de este proceso, a favor de los demandados. En cuanto al fondo de la demanda, manifiesta que tanto la ley número 7599, sobre Titulación en Reservas Nacionales, como el Reglamento promulgado sobre esa misma materia por el IDA fueron declarados inconstitucionales mediante sentencias número 8560-2001 y 2063-2007 de la Sala Constitucional. En consecuencia, el acto que aquí se impugna resulta absolutamente nulo al haber sido tramitado con fundamento en las referidas disposiciones. Además, en el proceso de titulación de la parcela que es aquí de interés se incumplió con requerimientos normativos necesarios, lo cual vicia el consecuente acto administrativo.
Se afecta igualmente el interés público, ya que a raíz de los indicados incumplimientos, se autorizó el traspaso de un inmueble que es parte del patrimonio natural del Estado. En virtud de lo anterior, subraya que la causal de nulidad de la titulación del predio objeto de este proceso reside en el incumplimiento de requisitos establecidos en la ley o en el reglamento para el dictado del acto administrativo, así como en la inobservancia de normas prohibitivas, que en este caso se trata de los artículos 13, 14 y 15 de la Ley Forestal.-
VI.Por su parte, a los argumentos del actor, responden los demandados, en síntesis, que ellos habían adquirido la posesión del inmueble en disputa de quienes la habían detentado previamente desde el año 1963. Niegan haber incumplido con trámites esenciales del procedimiento realizado ante el IDA, los cuales nunca fueron hechos de su conocimiento ni se les solicitó. Consideran que del expediente administrativo no se desprende que su propiedad se encuentre dentro de área estatal protegida alguna. Consideran haber adquirido derechos de buena fe, por medio de una posesión ejercida de forma pública, pacífica, ininterrumpida y a título de dueños desde antes del acto de adjudicación. Reprochan que en este proceso únicamente se pretenda anular su título, pero no así reconocer los daños y perjuicios que se les está ocasionando, los cuales reclaman, pues aducen que han introducido muchas mejoras en el inmueble. Solicita declarar sin lugar la demanda en todos sus extremos y condenar en ambas costas a la institución actora. En caso contrario, reiteran, peticionan que “se ordene el pago de todos los daños, perjuicios, mejoras, y otros”.-
De previo al análisis sustantivo del caso concreto, estima necesario este Tribunal examinar el cumplimiento de los diversos presupuestos que impone el ordenamiento jurídico para la interposición de un proceso de lesividad, siendo que la ausencia de uno de estos elementos haría innecesario el examen de fondo. De manera general, la lesividad se constituye en un mecanismo jurisdiccional en virtud del cual la Administración pretende la supresión de un acto propio que genera efectos favorables a un administrado. Desde ese plano, en este tipo de contiendas, la lesividad es de corte subjetivo, en tanto pretende la anulación de una conducta que concede un derecho o, en general, un beneficio a una persona. La lesividad se encuentra positivizada en el artículo 34 del Código Procesal Contencioso Administrativo, norma que fija los elementos previos y regulaciones procesales de esta figura, al indicar lo siguiente:
“ARTÍCULO 34.- 1) Cuando la propia Administración, autora de algún acto declarativo de derechos, pretenda demandar su anulación ante la Jurisdicción Contencioso–Administrativa, previamente el superior jerárquico supremo deberá declararlo lesivo a los intereses públicos, económicos o de cualquier otra naturaleza. El plazo máximo para ello será de un año, contado a partir del día siguiente a aquel en que haya sido dictado, salvo si el acto contiene vicios de nulidad absoluta, en cuyo caso, dicha declaratoria podrá hacerse mientras perduren sus efectos. En este último supuesto, el plazo de un año correrá a partir de que cesen sus efectos y la sentencia que declare la nulidad lo hará, únicamente, para fines de su anulación e inaplicabilidad futura.
Asimismo la norma procesal citada debe complementarse con el numeral 173 de la Ley General de la Administración Pública (LGAP) –reformado por el artículo 200 inciso 6) del CPCA– que dispone en lo relevante lo que sigue:
“Artículo 173.- 1) Cuando la nulidad absoluta de un acto declaratorio de derechos sea evidente y manifiesta, podrá ser declarada por la Administración en la vía administrativa, sin necesidad de recurrir al contencioso–administrativo de lesividad, previsto en el Código Procesal Contencioso–Administrativo, previo dictamen favorable de la Procuraduría General de la República; este dictamen es obligatorio y vinculante. Cuando la nulidad absoluta verse sobre actos administrativos directamente relacionados con el proceso presupuestario o la contratación administrativa, la Contraloría General de la República deberá rendir el dictamen. En ambos casos, los dictámenes respectivos deberán pronunciarse expresamente sobre el carácter absoluto, evidente y manifiesto de la nulidad invocada.
La segunda vertiente es la atinente a la legitimación pasiva, que ostenta el receptor de los efectos de la conducta administrativa que se declara lesiva.- b) Elemento objetivo, atendiendo a que la lesividad se constituye en un mecanismo de eliminación jurídica de actos administrativos –declarativos de derechos– que sean sustancialmente disconformes con el ordenamiento jurídico, sea, los actos que padezcan de algún nivel de invalidez, sea absoluta o relativa, en cualquiera de sus tipologías, conforme a lo dispuesto en los artículos 128, 158, 165 y concordantes de la LGAP.- c) En lo que respecta al orden procedimental, se impone que la Administración Pública respectiva declare la lesividad del acto de manera fundada, sea por lesión a intereses económicos, fiscales o de otra índole que se desprendan del interés público; lo que debe ser establecido dentro de un marco de acciones internas de la Administración que son impostergables para formular la acción.
Se aclara que para ello no se requiere de audiencia al destinatario beneficiario del acto lesivo, ya que será dentro del proceso judicial que podrá formular sus alegatos de defensa. Ahora bien, cuando el acto emane de la Administración Central (Ministerio), la demanda solo podrá ser incoada por la Procuraduría General de la República (artículo 16 de la Ley número 8508), previo pedimento del jerarca máximo supremo y previa declaratoria interna de lesividad, con detalle de los motivos de ese criterio. Si es el caso de las administraciones públicas descentralizadas, deberá declararla el órgano superior supremo de la jerarquía administrativa. Finalmente, la pretensión anulatoria no puede ser planteada por vía de contrademanda.- d) Finalmente, en cuanto a la dimensión temporal, la normativa procesal vigente establece un plazo de un año contado a partir de la emisión del acto (no de su comunicación) para declararlo lesivo a los intereses públicos y, luego de esa declaratoria (y no a partir del vencimiento de ese primer año) se otorga, en principio, un plazo de un año para plantear la acción contenciosa administrativa a modo de plazo fatal de caducidad, salvo en casos de actos con nulidad absoluta, en cuyo caso, la declaratoria de lesividad puede realizarse en tanto perduren sus efectos, corriendo el año aludido desde el cese definitivo de dichos efectos.
En esa hipótesis, la eventual sentencia estimatoria dispondrá la nulidad únicamente para la inaplicabilidad futura del acto, constituyéndose en una excepción expresa al régimen de retroactividad de las nulidades absolutas establecido por el ordinal 171 de la LGAP. Sin embargo, el ordenamiento procesal establece de manera expresa dos excepciones a este aspecto temporal de un año: i.- en relación con la tutela del dominio público, en los que la acción de lesividad no está sujeta a plazo por la aplicación de la cláusula general de imprescriptibilidad de ese tipo de bienes, según se deriva de manera expresa en el ordinal 34.2 del CPCA (y, tratándose de bienes incorporados al patrimonio natural del Estado, de manera expresa en el artículo 14 de la Ley Forestal); y, ii.- en la materia tributaria, en la cual el artículo 41.2 del Código de esta jurisdicción señala que el plazo máximo para incoar el proceso será el mismo que disponga el ordenamiento jurídico como plazo de prescripción para el respectivo derecho de fondo que se discute.
Precisamente, si no se cumple el aspecto temporal de la lesividad, las partes –e incluso de oficio el juez tramitador o decisor– pueden determinar la existencia de una caducidad de la acción en los términos del artículo 39 ibídem .- En síntesis, si una Administración Pública pretende interponer un proceso contencioso administrativo de lesividad, deberá cumplir las condiciones expuestas anteriormente; y si no es así, lo procedente por parte del órgano jurisdiccional será declarar la inadmisibilidad de la demanda, sin entrar a analizar los alegatos de fondo del proceso, ya que se debe recordar que la falta de una adecuada declaratoria de lesividad tiene un efecto eminentemente procesal y no de fondo de las cuestiones debatidas dentro del proceso.-
Hechas las precisiones anteriores, procede ingresar en el examen del cumplimiento de los requisitos arriba enumerados en el caso concreto sometido a conocimiento y resolución de esta Cámara. Comenzando con lo relativo a los presupuestos subjetivos de la lesividad, se tiene que la acción ha sido correctamente planteada por la Administración emisora del acto, figurando como accionados sus respectivos beneficiarios. En lo que toca al presupuesto objetivo, se constata que las conductas impugnadas –que en este caso son: a) el acuerdo de la Junta Directiva tomado en el artículo 45 del acta de la sesión N° 037-05 del 26 de setiembre del 2005 (ver hecho probado 1); y, b) los actos jurídicos de ejecución del anterior –a saber, la escritura pública de traspaso (hecho probado 2) y su asiento de inscripción en el Registro Público (hecho probado 3)– efectivamente son de carácter favorable a los intereses de los administrados codemandados, pues en el primero se autorizó la segregación y traspaso a ellos del bien que es objeto de disputa, lo cual se materializó por medio de los segundos.
Con respecto a los presupuestos procesales de la acción, se verifica que la declaratoria de lesividad efectivamente proviene del superior jerárquico de la Administración emisora del acto, que en el sub lite es la Junta Directiva del IDA (ver hecho probado 6). Además, la declaratoria de lesividad estuvo precedida por los necesarios criterios técnico–jurídicos que la sustentan –que, en este caso, provienen tanto de los informes DEGEO-096-08 del IGN (hecho probado 4) y DFOE-PGAA-20-2008 de la CGR (hecho probado 5) como del dictamen de la asesoría legal del IDA (citado en la declaratoria de lesividad)– y está contenida en una resolución debidamente fundada, de la cual se aporta copia certificada, como parte del expediente administrativo (el ya citado hecho probado 6). La acción no fue planteada por vía de contrademanda. Finalmente, en lo relativo a los presupuestos temporales, cabe reiterar que en este caso no aplican los parámetros usuales de la lesividad, por encontrarnos ante una acción de tutela de bienes que integran el dominio natural del Estado, que es imprescriptible, conforme al numeral 34.2 del CPCA.
Así las cosas, estima el Tribunal que en la especie se satisface todos los requerimientos legales para la procedencia de la demanda de lesividad, de manera que lo que resta es examinar los alegatos de fondo correspondientes.-
De conformidad con los ya citados artículos 13 y 14 de la Ley Forestal, el patrimonio natural del Estado está constituido, entre otros, por los bosques y terrenos forestales de las reservas nacionales, de las áreas declaradas inalienables, de las fincas inscritas a su nombre y de las pertenecientes a municipalidades, instituciones autónomas y demás organismos de la Administración Pública, excepto inmuebles que garanticen operaciones crediticias con el Sistema Bancario Nacional e ingresen a formar parte de su patrimonio. Señalan las normas citadas también que las organizaciones no gubernamentales que adquieran bienes inmuebles con bosque o de aptitud forestal, con fondos provenientes de donaciones o del erario, que se hayan obtenido a nombre del Estado, deberán traspasarlos a nombre de éste. Los terrenos forestales y bosques que constituyen el patrimonio natural del Estado son inembargables e inalienables; su posesión por los particulares no causará derecho alguno a su favor y la acción reivindicatoria del Estado por estos terrenos es imprescriptible y su uso y aprovechamiento está sujeto al poder de policía de la Administración.
Por su parte, el numeral 15 de la misma Ley indica que la Administración Pública no podrá permutar, ceder, enajenar, de ninguna manera, entregar ni dar en arrendamiento, terrenos rurales de su propiedad o bajo su administración, sin que antes hayan sido clasificados por el Ministerio del Ambiente y Energía. También señala que si esos terrenos están cubiertos de bosque, automáticamente quedarán incorporados al Patrimonio Natural del Estado y se constituirá una limitación que deberá inscribirse en el Registro Público. Sobre este tema, se ha indicado:
“Conforme al numeral 13 de la Ley Forestal ‘El patrimonio natural del Estado estará constituido por los bosques y terrenos forestales de las reservas nacionales, de las áreas declaradas inalienables, de las fincas inscritas a su nombre y de las pertenecientes a municipalidades, instituciones autónomas y demás organismos de la Administración Pública, excepto inmuebles que garanticen operaciones crediticias con el Sistema Bancario Nacional e ingresen a formar parte de su patrimonio...’ De esta forma, son tres posibilidades las que brinda la norma, respecto a los bienes que integran dicho patrimonio: a) bosques y terrenos forestales de las reservas nacionales; b) bosques y terrenos forestales de las áreas declaradas inalienables, y c) bosques y terrenos forestales de las fincas inscritas a su nombre y de las pertenecientes a municipalidades, instituciones autónomas y demás organismos de la Administración Pública, excepto inmuebles que garanticen operaciones crediticias con el Sistema Bancario Nacional e ingresen a formar parte de su patrimonio.
(...). En este sentido, el mandato 13 ibídem es claro al determinar, que una propiedad cubierta de bosque, y que pertenezca al Estado, una municipalidad, institución autónoma u otro organismo de la Administración Pública, forma parte del patrimonio natural del Estado, sin requerir el Legislador, que la propiedad debiera formar parte de alguna de las categorías de protección indicadas.
(...)
Por lo tanto, el criterio para determinar si el inmueble forma parte del patrimonio natural del Estado no se puede limitar a que un particular ostente la titularidad registral, sino que se debe investigar los antecedentes de la finca, con el afán de precisar, si estuvo dentro del dominio del Estado o alguna de sus instituciones; y, si está cubierta de bosque (...)
En igual sentido, lo indicado respecto a que el Tribunal no consideró que el terreno ha estado en posesión de particulares, no resulta un reclamo antendible ante esta Sala, por ser la Ley Forestal clara, en el sentido de que se trata de bienes inalienables, cuya posesión por particulares no causará derecho alguno a su favor, siendo imprescriptible la acción reinvindicatoria del Estado.” (Sala Primera de la Corte Suprema de Justicia, N° 1070-F-S1-2010 de las 9:40 horas del 3 de setiembre del 2010.)
X.Expuesto lo anterior, debe indicarse que, valorada la prueba que consta en autos, este órgano colegiado aprecia que, en efecto, el inmueble objeto de este proceso se encuentra totalmente dentro del Refugio Nacional de Vida Silvestre Mixto Maquenque. El área que traslapa los terrenos del Estado es de 826.441,47 metros cuadrados. Asimismo, el área donde se ubica la finca matrícula Placa26500 corresponde a bosque natural y se encuentra en el RNVSMM (hecho probado 7) y, de conformidad con la normativa citada supra, constituye patrimonio natural del Estado, sobre la base del criterio técnico recabado, sin necesidad de acto administrativo que así lo declare y que por tal condición merece la tutela que el ordenamiento jurídico dota a este tipo de bienes. Por ello, procede declarar que el inmueble que la Junta Directiva del entonces Instituto de Desarrollo Agrario tituló a favor de los demandados mediante acuerdo de la Junta Directiva tomado en el artículo 45 del acta de la sesión N° 037-05 del 26 de setiembre del 2005, constituye patrimonio natural del Estado, así como un bien de dominio público que resulta inembargable, imprescriptible, inalienable y está fuera del comercio de las personas.-
XI.A la luz de lo expresado, resulta irrelevante (excepto en lo relativo a costas, como se verá infra) el alegato de los accionados referente a que ellos habían adquirido la posesión del inmueble en disputa de quienes la habían detentado previamente desde el año 1963. Niegan haber incumplido con trámites esenciales del procedimiento realizado ante el IDA, los cuales nunca fueron hechos de su conocimiento ni se les solicitó. Consideran que del expediente administrativo no se desprende que su propiedad se encuentre dentro de área estatal protegida alguna. Estiman haber adquirido derechos de buena fe, por medio de una posesión ejercida de forma pública, pacífica, ininterrumpida y a título de dueños desde antes del acto de adjudicación. En efecto, todo lo anterior no desdice del error incurrido por el IDA –y no ellos– en la adjudicación de un inmueble que no les podía ser traspasado. La buena fe exhibida por ellos no convalida el hecho de que el ente actor debía haber corroborado que las condiciones del inmueble no dieran lugar a una violación del ordenamiento en cuanto tutela el patrimonio forestal, cuestión que indefectiblemente hace necesario estimar la demanda.-
XII.Establecido –lo cual se hace con efecto meramente declarativo– que el inmueble titulado por el IDA en favor de los coaccionados Nombre139302 y Nombre139303 constituye patrimonio natural del Estado, conforme a la normativa vigente, ese solo hecho vicia de nulidad absoluta todas las conductas administrativas formales y actuaciones mediante las cuales se permitió el traspaso de esa propiedad a los codemandados. Ello toda vez que al tratarse de un bien de dominio público, estaba fuera del comercio del ser humano y existía prohibición legal para enajenar su dominio o constituir derechos reales sobre él. Por su misma naturaleza, no podía ser objeto de apropiación privada ni alegar la existencia de derechos de posesión sobre él. Así pues, procede acoger la demanda y, conforme se peticiona, se deberá declarar nulo el acuerdo tomado en el artículo 45 del acta de la sesión N° 037-05 del 26 de setiembre del 2005, por virtud del cual la Junta Directiva del IDA autorizó segregar y traspasar a los aquí codemandados, el terreno correspondiente al plano catastral Placa26497, parcela 8-B-01 del proyecto de Titulación Llanuras de San Carlos y Sarapiquí, con una extensión de 826.441,47 metros cuadrados.
Por conexidad, se debe anular también la escritura pública número 35-82, otorgada ante el notario Hubert Rojas Araya a las 15:00 horas del 20 de octubre de 2005 y, conforme se solicita, se ordenará al Archivo Nacional anotar la razón de nulidad al margen de la matriz. Finalmente, cabe anular el asiento registral de inscripción de la finca del partido de Alajuela, folio real matrícula Placa26499, incluyendo desde luego las submatrículas Placa2200 .-
Como parte de la contestación de la demanda, los accionados solicitan que, de acogerse aquélla, “se ordene el pago de todos los daños, perjuicios, mejoras, y otros”. Dado que dicha petitoria no fue formulada como parte de una contrademanda interpuesta con arreglo a derecho, ella resulta improcedente, sin necesidad de pronunciamiento alguno al respecto. Lo anterior sin perjuicio de que los interesados, de considerarlo pertinente, formulen en sede administrativa y eventualmente judicial el respectivo reclamo.-
Los accionados opusieron las defensas previas de caducidad y prescripción, así como las excepciones de falta de legitimación activa y pasiva, falta de interés actual y falta de derecho. Como se reseñó arriba, las dos primeras fueron rechazadas interlocutoriamente en la audiencia preliminar. La excepción de falta de legitimación debe denegarse, en sus dos modalidades. En efecto, la legitimación ad causam se conforma en tanto exista una vinculación de las partes en una determinada situación jurídico material, de modo que requiere la identidad entre quien demanda y el titular del derecho o interés subjetivo reclamado (activa) y entre el demandado y el obligado a la prestación requerida (pasiva). Así, se dice, hay legitimación activa cuando existe la posibilidad de acoger eficazmente la pretensión con respecto a la parte actora y pasiva cuando ese pronunciamiento pueda ser eficaz en relación con el demandado.
En este caso y por los hechos y argumentos de ley ya explicados, el IDA es la parte que está llamada a declarar la lesividad y a peticionar la nulidad de su propio acto declaratorio de derechos, mientras que los accionados son aquella parte respecto de la que –dado el mencionado cuadro fáctico y jurídico– dicho derecho puede ser ejercitado, como titulares del derecho de propiedad que se persigue invalidar. Por su parte, el interés actual es la necesidad de tutela en que se encuentra una persona en concreto y que lo determina a solicitar la intervención del respectivo órgano jurisdiccional, con la finalidad de que resuelva el conflicto jurídico en el cual es parte. En este caso, el pronunciamiento que aquí se vierte es indispensable para lograr el efecto anulatorio perseguido por el ente accionante, de manera que no hay duda de que su interés a ese efecto se mantiene actual, por lo que la defensa propuesta debe ser denegada.
Finalmente, se rechaza la excepción de falta de derecho, en la medida en que el reclamo planteado por el IDA cuenta con sustento jurídico suficiente, en la medida en que busca asegurar la tutela del patrimonio natural del Estado, con arreglo a las disposiciones legales citadas supra.-
Por considerar que se mantienen las razones por las cuales fue impuesta en su momento la medida cautelar ordenada por resolución Nº 563-2012 de las 16:00 horas del 4 de setiembre del 2012 (véase el resultando 2 supra), se dispone dejarla en vigencia, hasta que se complete la ejecución de lo dispuesto en este pronunciamiento.-
El artículo 193 del CPCA establece que las costas procesales y personales son impuestas al vencido por el solo hecho de serlo, pronunciamiento que debe hacerse incluso de oficio, al tenor de lo dispuesto en esa misma norma, en concordancia con el numeral 119.2 ibídem. La dispensa de esta condena solo es viable: a) cuando hubiere, a juicio del Tribunal, motivo suficiente para litigar; b) cuando la sentencia se dicte en virtud de pruebas que desconociera la parte contraria; o bien, c) cuando se incurra en plus petitio, esto es, cuando la diferencia entre lo reclamado y lo obtenido en definitiva sea de un quince por ciento (15%) o más, a no ser que las bases de la demanda sean expresamente consideradas provisionales o su determinación dependa del arbitrio judicial o dictamen de peritos (ordinal 194 ibídem ). En la especie, estima el Tribunal que los codemandados han ostentado motivo suficiente para litigar, en la medida en que en su oportunidad recibieron la propiedad del ente demandante, por acto que estaba amparado por la presunción de legitimidad y que aparentemente respondía al ejercicio conforme a derecho de sus competencias legales.
En este sentido, su intervención en el proceso resultaba inevitable a los efectos de revertir los efectos del acto que en definitiva ha sido declarado disconforme con el ordenamiento. Por ende, se resuelve este asunto sin especial condenatoria en costas.-
POR TANTO:
Se rechaza el reconocimiento judicial propuesto por la entidad actora. Con carácter de prueba para mejor resolver, se admite el oficio SINAC-ACAHN-OTAT-012-14 del veintidós de mayo del dos mil catorce. Se deniega las excepciones de falta de legitimación, falta de interés actual y falta de derecho. Se declara PROCEDENTE la demanda interpuesta por el Instituto de Desarrollo Agrario, hoy Instituto de Desarrollo Rural, contra Nombre139302 y Nombre139303 . En consecuencia, se declara absolutamente nulo el acuerdo tomado en el artículo cuarenta y cinco del acta de la sesión número cero treinta y siete - cero cinco del veintiséis de setiembre del dos mil cinco, por virtud del cual la Junta Directiva del ente actor autorizó segregar y traspasar a los aquí codemandados el terreno correspondiente al plano catastral A - novecientos cuarenta y nueve mil doscientos ochenta y ocho - dos mil cuatro, parcela ocho - B - cero uno del proyecto de Titulación Llanuras de San Carlos y Sarapiquí, con una extensión de ochocientos veintiséis mil cuatrocientos cuarenta y un metros con cuarenta y siete decímetros cuadrados; lo anterior por infracción de la normativa que protege el patrimonio natural del Estado.
Por conexidad, se anula la escritura pública número treinta y cinco - ochenta y dos del tomo ochenta y dos del protocolo del notario Hubert Rojas Araya, otorgada a las quince horas del veinte de octubre del dos mil cinco. Se ordena al Archivo Nacional anotar esta declaratoria al margen de la matriz. Se anula el asiento registral de inscripción de la finca del partido de Alajuela, folio real matrícula Placa26496 – , incluyendo las submatrículas Placa6510 . Una vez firme esta resolución, expídase los correspondientes mandamientos al Archivo Nacional y al Registro Público. Se mantiene la vigencia de la medida cautelar ordenada por resolución número 563-2012 de las dieciséis horas del cuatro de setiembre del dos mil doce, hasta que se complete la ejecución de lo dispuesto en este pronunciamiento.
