  1. 1The petitioner instituted possessory information proceedings so that the property described as follows would be registered in his name in the Registro Público de la Propiedad: "... Mountain and pasture land located in Santiago de río Claro del [Dirección1] , Province of Puntarenas, which, according to cadastral plan no. P-8591152-03, has an area of forty hectares, seven thousand seven hundred fifty-eight square meters and sixty-one square decimeters, whose CURRENT BOUNDARIES ARE: North: [Nombre4] ; South: [Nombre5] and [Dirección2]; East: [Nombre6], [Nombre7] and [Nombre5] ; West: Quebrada Aguas Claras." (folios 18, 54, 55, 56, and reverse of 163). *
  2. 2The Procuraduría General de la República entered an appearance in the proceeding under the terms set forth at folios 34 through 38; the Instituto de Desarrollo Agrario, in turn, did so at folio 39.*
  3. 3Judge Marisel Zamora Arias of the Juzgado Agrario del Segundo Circuito Judicial de la Zona Sur, Corredores, by judgment number 5-2013 issued at three p.m. on January ninth, two thousand thirteen, ruled: “THEREFORE: In accordance with the foregoing and the cited legal provisions, the possessory information proceedings ARE APPROVED. Subject to the encumbrances (afectaciones) referred to in Article 17 of the Ley de Informaciones Posesorias and without prejudice to third parties with superior rights, the Registrar of the Registro de la Propiedad is ordered to register, for the first time, in the name of [Nombre1] , of legal age, married twice, Costa Rican, farmer, bearer of identity card CED4, - , resident of Bambel 3, from [Dirección3] toward Golfito, the land DESCRIBED AS FOLLOWS: Mountain and pasture land located in Santiago de río Claro del [Dirección4] Guaycara, Cantón [Dirección5] de Golfito, Province of Puntarenas, which, according to cadastral plan no. P-8591152-03, has an area of forty hectares, seven thousand seven hundred fifty-eight square meters and sixty-one square decimeters, whose CURRENT BOUNDARIES ARE: North: [Nombre4] ; South: [Nombre5] and [Dirección6] wide; East: [Nombre6], [Nombre7] and [Nombre5] ; West: Quebrada Aguas Claras.Plan 859152-03 RESTRICTIONS AND LIMITATIONS: 1- In addition to those contained in Article 19 of the Ley de Informaciones Posesorias, the property to be titled shall be subject to the reservations concerning rights-of-way (derechos de vía) for public roads established by Articles 4 of the Ley General de [Dirección7], , Posesorias. 2- The area adjacent to watercourses, pursuant to Article 33(b) of Ley Forestal nº 7575, and the cutting or removal of trees is prohibited. 3 Likewise, the channel and waters of that watercourse are in the public domain (Ley de Aguas, Articles 1(IV) and 3(III). 3- The surface water and groundwater existing on the property are in the State public domain and do not form part of the property. A certified copy of this judgment shall serve to register the aforementioned property in the Registro de la Propiedad" (front and reverse of folio 163).- *
  4. 4Attorney Lydiana [Nombre2] Paniagua, in her capacity as Deputy Attorney General, filed an appeal, expressly stating the reasons for which she challenges the trial court’s position (folios 171 through 174). *

5. The statutory requirements were not observed in the conduct of the proceeding, and the decision contains errors or omissions capable of rendering it null and void. * Judge [Nombre8]* RODRIGUEZ drafts the decision; and, * CONSIDERING:*

I. Given the manner in which the matter will be resolved, no ruling is made concerning the facts deemed proven. *

II.In the challenged judgment 5-2013 of January 9, 2013 (folio 162), the possessory information proceeding was approved and registration of the property described in plan P-859152-03 was ordered, subject to the limitations established by the Ley de Aguas and the Ley de Caminos Públicos. The Procuraduría General de la República (PGR) appeals and requests that the decision be declared null and void, considering it premature because the proceeding had not reached the judgment stage. It argues that essential procedures and requirements for approval remained outstanding and that, in its response during the final hearing—held on October 30, 2012—it therefore requested compliance with those outstanding requirements, but its request was not addressed. It claims that the omitted step was to request a report from the Instituto Costarricense de Acueductos y Alcantarillados (ICAA) to determine whether the spring (naciente) located on the land adjoining the property to be registered on the [Dirección8] () supplied water to any community and whether it should be reserved for that purpose, since, if so, the 200 or 300 meters contiguous to that spring should have been excluded from the plan insofar as that area fell within the land to be titled.

It emphasizes that public-domain property must be excluded from properties to be titled, according to the case law of the Tribunal Agrario. In this regard, it cites decision 128-10, which ordered the judgment set aside in a case involving the same circumstances alleged here (folios 173 through 174). *

III.Article 26 of the Ley de Jurisdicción Agraria provides, insofar as relevant: "When appropriate, the courts may, on their own initiative, declare proceedings null and void and order procedural steps to be repeated in order to correct irregularities that could affect the validity of the proceeding." Likewise, Article 502 of the Código de Trabajo, applicable by referral from Article 60 of the Ley de Jurisdicción Agraria, provides that once the case record reaches the Tribunal on appeal, the Tribunal shall first review the proceedings. If it finds that any formality capable of causing actual denial of a defense has been omitted, it shall declare the proceedings or rulings null and void to the extent necessary to restore the normal course of the litigation. Under these provisions, this Tribunal has consistently held that a declaration of nullity is appropriate only when absolutely indispensable to prevent denial of a defense or to restore the normal course of the proceeding following a violation of essential procedural requirements. *

IV.In this case, the PGR advised the trial court on several occasions of the need to request a report on the status of the spring existing on land adjoining the property to the north (sic), in view of the provisions of Section 4 of the Código de Minería, Section 33 of the Ley Forestal, and Sections 31 and 32 of the Ley de Aguas (see folios 94, 114, 143, and 151). Although it duly substantiated its request, the court below denied the requested relief on every occasion. Accordingly, the PGR is correct in its claim because the fact that the spring rises on adjoining land does not relieve the applicant for title of the duty to demonstrate that the plan depicting the land to be titled does not include public-domain areas (zonas demaniales) or affect public or State interests relating to environmental protection. Furthermore, water resources suitable for human consumption are assets serving the community, and the legislature therefore expressly created a special protective regime for them. *

V.In this regard, a restrictive criterion such as that adopted by the court below in the decisions of 23 de noviembre de 2011, 30 de abril del 2012, and 6 de noviembre de 2012 (folios 97, 119 and 146), which denied the PGR’s request on the ground that it was improper to request the report from ICAA because the spring (naciente) was located on adjoining land, cannot be applied. The trial judge must bear in mind that, in every proceeding involving environmental assets (bienes ambientales), the principles underlying Environmental Law must be observed, such as the precautionary and preventive principles, as well as the social and environmental function that must be fulfilled on every parcel of land by its possessor or owner. In addition to disregarding those principles, the criterion adopted by the court below fails to consider that, from a natural and logical standpoint, ecosystems and spring protection zones (zonas de protección de nacientes) are not limited by divisions or boundaries established by human beings.

“In addition to the foregoing, the adjudicator must consider what was agreed upon at the XVI Ibero-American Judicial Summit, held in Buenos Aires, Argentina, on 25, 26 and 27 de abril de 2012, where the Buenos Aires Declaration 2012 was signed. In the segment concerning information and transparency, and public participation in environmental matters, the following was declared: ‘INFORMATION AND TRANSPARENCY IN ENVIRONMENTAL MATTERS.* It is important that the judge and the parties have access to truthful, effective, reliable, and suitable environmental information so that effective judgments may be rendered in environmental matters. It is important that judges ensure that citizens and society have access to the environmental information they need or request, including information held by judicial bodies. It is important that judges take into account how significant their contribution, as public officials, may be to environmental education and to raising public awareness regarding environmental protection.

It is important that judicial bodies use suitable and efficient means to convey relevant environmental information to everyone, to inform society about their actions in environmental matters, and to clarify for the public environmental issues decided in judicial proceedings. It is important that judges have broad access to all environmental information held by the parties, third parties, and public bodies, in accordance with each legal system and Principle 10 of the Rio Declaration. PUBLIC PARTICIPATION IN ENVIRONMENTAL MATTERS. It is important that, whenever possible, judicial bodies adopt environmental-management policies and encourage measures for the rational and sustainable use of their resources. It is important that judicial bodies consider their social and environmental responsibilities in their strategic planning, including: (a) adopting such environmental-protection measures as may be possible or necessary; (b) requiring judges and officials to exercise environmental responsibility in the performance of their duties; and (c) giving preference to practices that combat the waste of natural resources, promote sustainability, and prevent environmental harm.

It is important that each country’s procedural mechanisms ensure broad participation by citizens and society in judicial actions relating to the environment. It is important that the judge hearing the case or the competent court, whenever deemed necessary or appropriate, hold public hearings to clarify issues relevant to the adjudication of environmental actions, at which society’s views may be heard and technical statements from specialists may be obtained concerning matters relevant to rendering judgment. It is important that, while respecting impartiality and independence, judges share the experience accumulated through their daily handling of environmental proceedings and problems, maintaining institutional contacts and cooperating with public bodies, social stakeholders, economic or professional associations, nongovernmental organizations, and the scientific and academic community, in order to improve the administration of justice, ensure the efficient application of environmental legislation, and disseminate environmental-education and environmental-protection initiatives....’” From the foregoing, this Court considers that the person responsible for deciding matters in judicial proceedings and the parties must have access to truthful, effective, reliable, and suitable environmental information so that effective judgments may be rendered in environmental matters.

In possessory-title proceedings (informaciones posesorias), it is evident from Articles 45 and 50 of the Political Constitution that the adjudicator must ensure that the title eligible for registration in the Public Registry provides information aimed at generating the greatest well-being for all inhabitants of the country, promoting agricultural and agro-environmental production; encouraging the conservation and preservation of a healthy and ecologically balanced environment; and preventing harm that could affect future generations. Moreover, the cited declaration establishes the importance of judges ensuring that citizens and society have access to the environmental information they need or request, including information held by judicial bodies. When possessory-title proceedings are processed, the decision to be entered in the corresponding registry must provide the general public with accurate and transparent information.

Accordingly, it is important that everything concerning water resources, and potentially sources of drinking-water supply for communities, be clear and precise. The supply of drinking water is a right to which all men and women must have access. This issue has been addressed by the Constitutional Chamber of the Supreme Court of Justice as follows: ‘« III.- Fundamental right to drinking water. This Court has recognized in its case law that the rights to health and life are fundamental human rights that depend—to a large extent—on access to drinking water, and that the competent bodies have the inescapable responsibility to ensure that society as a whole does not suffer any impairment of those rights....” (voto* Nº18633 de 21 de diciembre de 2007) (voto 725 de 15 de junio de 2012 del Tribunal Agrario).*

VI.Furthermore, in Voto cited by the PGR, N°128-F-10 of 19 de* febrero del 2010, this Court, in a case involving circumstances similar to those alleged in this matter, ruled: “II.- The Deputy Attorney General ... disagrees with the first-instance judgment because a report was not requested from the Instituto Costarricense de Acueductos y Alcantarillados; had it been requested, the area adjoining the spring (naciente) would have had to be excluded, even though the spring is located on neighboring land. III.- The appellant is correct in her claims of error, because the a quo should have verified that situation before issuing the judgment, particularly since the submitted surveys (planos), namely numbers ..., show that they adjoin one another, that title registration (titulación) is sought for both parcels depicted in those surveys, and that the area is extremely rugged. The a quo should therefore have verified that situation both during the judicial inspection (reconocimiento judicial) and by forwarding the application to the Instituto Costarricense de Acueductos y Alcantarillados, in order to determine whether the spring can supply water to a population, as provided in Article 7 of the Ley de Tierras y Colonización.” VII.- Consequently, because omissions affecting due process (debido proceso) have been identified and cannot be remedied at this level, as they fall within the functional jurisdiction of the first-instance judge and out of respect for the parties’ due process rights, the appropriate course is to declare the challenged judgment prematurely null and void.

The a quo shall correct the proceedings as indicated. The first-instance court shall also take note of the following matters so that it may adopt the appropriate measures in this case or in future matters: a) These proceedings were instituted in 2009, and the certification submitted by the Sistema Nacional de Áreas de Conservación del Ministerio de Ambiente y Energía, appearing at folio 2, was issued in julio del 2003, that is, more than five years earlier. For reasons of due process and in view of the changes that may occur in the designation of Protected Wildlife Areas (Áreas Silvestres Protegidas), submitted certifications must be recent in relation to the date on which the proceedings were commenced. This is necessary to prevent land located within such areas of special environmental interest—many categories of which are also public-domain areas—from being registered due to the applicant’s lack of knowledge or the courts’ neglect of their duties to protect the environment.

In this regard, section 6.3.6. of the Manual de Procedimientos para la Resolución de Visados y Certificaciones de Planos del SINAC, approved by the Consejo Nacional de Áreas de Conservación, Secretaría Ejecutiva, on 9 de junio del 2009, through resolución R-SINAC-037-2009, published in La Gaceta 134 of 13 de julio del 2009, provides: “6.3.6 Validity. 6.3.6.1. Every approval (visado) and certification granted by the Área de Conservación shall remain valid for a maximum of three calendar months from the date of issuance.” b) The base survey (plano base) for the proceedings is N° P-859152-2003, appearing at folio 55, and not the one originally submitted, an error that was timely identified by the PGR and that the Court subsequently deemed corrected. Nevertheless, without actually verifying which survey was correct, official communication 146-A-12 was then issued to the Municipalidad de Golfito (folio 118), citing and enclosing a copy of N°P-871089-2003 (which was not the base survey); on that basis, the Municipalidad conducted the field inspection and submitted the report contained in official communication MGPS-O-1636-2012 (folio 124).

Although the location and depiction of the parcels in both surveys are very similar, the first-instance court must request reports based on the current base survey and must not use surveys other than those it will subsequently rely upon when ruling on the relief sought. c) According to the base survey, there is an unnamed stream (quebrada) along a portion of the southern boundary; however, neither the title applicant (titulante) mentions it when describing the boundaries, nor does the Court refer to it in the challenged judgment. Likewise, when describing the boundaries in the Por tanto, the a quo also fails to mention Quebrada Aguas Claras, which adjoins the property to the northwest. If these proceedings are found to be proper, those omissions must be remedied because streams and rivers constitute natural boundaries (colindancias naturales). For greater accuracy, the judge may state that the property adjoins those natural features, with such features lying between it and the natural or legal person whose land is situated beyond them. d) In connection with the foregoing, the PGR argues in its interlocutory objections that the spring giving rise to the request for the report to be provided by the ICCA is located on land adjoining the property to the north, but on appeal it states that the spring emerges on land to the west.

Since there are two watercourses, one at [Dirección9] and the other at [Dirección10], it is unclear on which parcel the referenced spring is located. Likewise, although the judge must be precise in the information recorded in court minutes, particularly regarding bearings and boundaries, the minutes of the judicial inspection conducted on 26 de julio del 2011 merely state that “there is a stream that crosses the property, but it is a spring that does not originate on the applicant’s property, but rather on a property farther uphill” (emphasis not in the original). The description of the spring’s location is wholly imprecise; accordingly, the a quo and the title applicant must clarify its location and specify the adjoining parcel from which it emerges. *

POR TANTO:* The first-instance judgment N°5-2013 of 9 de enero de 2013 is vacated. Intervienen en el proceso la PROCURADURÍA GENERAL DE LA REPÚBLICA, representada por Lydiana [Nombre2] Paniagua, de calidades desconocidas en autos, en su condición de procuradora adjunta; y el INSTITUTO DE DESARROLLO AGRARIO, cédula jurídica número CED2 - - - , representado por Carmelina [Nombre3] Hidalgo , mayor, divorciada, abogada, vecina de Guachipelín, Escazú, cédula de identidad CED3 - - , en su condición de apoderada general judicial. Actúa como defensor público del promovente el licenciado, Gustavo Aguilar Chinchilla, de calidades desconocidas en autos. Tramitado ante el Juzgado Agrario del Segundo Circuito Judicial de la Zona Sur, Corredores.- * RESULTANDO:*

  1. 1El promovente interpuso diligencias de información posesoria con el fin que se inscriba a su nombre en el Registro Público de la Propiedad la finca que se describe así:" ... Terreno de montaña y potrero, ubicado en Santiago de río Claro del [Dirección1] de la Provincia de Puntarenas, que según el plano catastrado no. P-8591152-03 posee una extensión de cuarenta hectáreas siete mil setecientos cincuenta y ocho metros con sesenta y un decímetros cuadrados, cuyos LINDEROS ACTUALES SON: Norte: [Nombre4] , Sur: [Nombre5] y [Dirección2] Este: [Nombre6] , [Nombre7] y [Nombre5] , Oeste: Quebrada Aguas Claras. ".(folios18, 54, 55, 56, 163 vuelto ). *
  2. 2La Procuraduría General de la República se apersonó al proceso en los términos que constan en los folios 34 a 38; a su vez el Instituto de Desarrollo Agrario lo hizo en el folio 39.*
  3. 3La jueza Marisel Zamora Arias, del Juzgado Agrario del Segundo Circuito Judicial de la Zona Sur, Corredores, mediante sentencia número 5-2013 de las quince horas del nueve de enero de dos mil trece, resolvió: “POR TANTO: De conformidad con lo expuesto, y normas legales citadas; SE APRUEBAN las diligencias de información posesoria. Con las afectaciones a que se refiere el artículo 17 de la Ley de Informaciones Posesorias y sin perjuicio de terceros de mejor derecho, se ordena al Señor Registrador del Registro de la Propiedad inscribir, por primera vez, a nombre de [Nombre1] , mayor, casado dos veces, costarricense, agricultor, portador de la cédula de identidad CED4, - , vecino de Bambel 3, del [Dirección3] rumbo a Golfito, el terreno que se DESCRIBE ASÍ: Terreno de montaña y potrero, ubicado en Santiago de río Claro del [Dirección4] Guaycara del Cantón [Dirección5] de Golfito de la Provincia de Puntarenas, que según el plano catastrado no. P-8591152-03 posee una extensión de cuarenta hectáreas siete mil setecientos cincuenta y ocho metros con sesenta y un decímetros cuadrados, cuyos LINDEROS ACTUALES SON: Norte: [Nombre4] , Sur: [Nombre5] y [Dirección6] de ancho Este: [Nombre6] , [Nombre7] y [Nombre5] , Oeste: Quebrada Aguas Claras.Plano 859152-03 RESTRICCIONES Y LIMITACIONES: 1- Además de las contenidas en el artículo 19 de la Ley de Informaciones Posesorias, el inmueble a titular queda afecto a las reservas en cuanto a derechos de vía de las calles públicas que disponen los artículos 4 de la Ley General de [Dirección7] , , Posesorias. 2- Que el área contigua a las corrientes, según el artículo 33, inciso b) de la Ley Forestal nº 7575 y queda prohibida la corta o eliminación de arboles. 3 Asimismo el cause y las aguas de esa corriente son de dominio público (Ley de Aguas, artículos 1, inciso IV, y 3 inciso III. 3- Las aguas superficiales y subterráneas existentes en el inmueble son de domino publico estatal y no forman parte de la finca.. Sirva la certificación de esta sentencia para inscribir en el Registro de la Propiedad la finca relacionada" (folios 163 frente y vuelto).- *
  4. 4La Licenciada Lydiana [Nombre2] Paniagua, en su condición de Procuradora Adjunta, formuló recurso de apelación con indicación expresa de las razones por las cuales refuta la tesis del Juzgado de instancia(,f olio 171 a 174). *

5. En la substanciación del proceso no se han observado las prescripciones legales, y se nota la existencia de errores u omisiones en el fallo capaces de producir su nulidad. * Redacta la jueza [Nombre8]* RODRIGUEZ , y; * CONSIDERANDO:*

I. Por la forma en que se resolverá se omite pronunciamiento acerca de los hechos tenidos por demostrados. *

II.En la sentencia impugnada 5-2013 del 9 de enero de 2013 (folio 162), se aprobó la información posesoria y se ordenó inscribir el inmueble descrito en el plano P-859152-03, con las limitaciones que establece la Ley de Aguas y la Ley de Caminos Públicos. La Procuraduría General de la República (PGR) apela y solicita la nulidad del fallo, por considerarlo prematuro, al no estar el proceso en la fase procesal de sentencia. Alega, existían trámites y requisitos esenciales para su aprobación, y en la contestación de la audiencia final -realizada el 30 de octubre del 2012- se solicitó por ello el cumplimiento de lo faltante, lo cual no fue atendido. Lo que reclama se omitió fue requerir un informe al Instituto Costarricense de Acueductos y Alcantarillados (ICAA), para que se constatara si la naciente ubicada en el terreno colindante por el [Dirección8] () del inmueble a inscribir, surtía de agua a algunapoblación y si convenía reservarla para tal fin, ya que de ser así, se debió haber excluido del plano los 200 o 300 metros continuos a ese manantial en la porción que comprenda el terreno a titular. Resalta, los bienes de dominio público deben excluirse de los inmuebles a titular, según jurisprudencia del Tribunal Agrario. Cita al respecto el voto 128-10, que ordenó se anulara la sentencia en un caso con un supuesto igual al reclamado fo(lios 173 a 174). *

III.El artículo 26 de la Ley de Jurisdicción Agraria, en lo que interesa dispone: "Cuando sea del caso, los tribunales podrán, por iniciativa propia, declarar nulidades y disponer la reposición de trámites, a fin de corregir irregularidades que pudieran afectar la validez del proceso". Asimismo, el artículo 502 del Código de Trabajo, aplicado por remisión del artículo 60 de la Ley de Jurisdicción Agraria, señala que llegados los autos en apelación, el Tribunal revisará, en primer término, los procedimientos. Si encontrare que se ha omitido alguna formalidad, capaz de causar efectiva indefensión, decretará la nulidad de actuaciones o de resoluciones, hasta donde sea necesario para orientar el curso normal del juicio. Al amparo de dichas regulaciones, se ha mantenido el criterio en esta Sede que la declaratoria de nulidad procede cuando sea absolutamente indispensable su pronunciamiento, para evitar indefensión o para orientar el curso normal del procedimiento, por violación a formas esenciales en el trámite. *

IV.En este caso, la PGR en varias oportunidades, hizo ver al Juzgado de instancia la necesidad de que se requiriese el informe sobre la condición de la naciente existente en un terreno colindante por el norte (sic), dado lo dispuesto en el numeral 4 del Código de Minería, 33 de la Ley Forestal y 31 y 32 de la Ley de Aguas (ver folios 94, 114, 143 y 151). Pese a que fundamentó debidamente su petición, la a quo le denegó en todas las ocasiones lo pedido. Por ende, lleva razón la PGR en su reclamo, dado que efectivamente, el hecho de brotar la naciente en un terreno colindante, no exime a la parte titulante de su deber de demostrar que el plano que grafica el terreno a titular, no comprende zonas demaniales ni tampoco afecta intereses públicos o estatales relacionados con la tutela del ambiente. Además, el recurso hídrico apto para consumo humano es un bien al servicio de la comunidad, y por ello de manera expresa la persona legisladora creó un régimen especial para su protección. *

V.Al respecto, no puede aplicarse un criterio restrictivo como el sostenido por la a quo en las resoluciones del 23 de noviembre de 2011, del 30 de abril del 2012 y 6 de noviembre de 2012 (folios 97, 119 y 146), que rechazaron la petición de la PGR, con base en que era improcedente requerir el informe al ICAA por estar la naciente en un terreno colindante. La juzgadora de instancia debe tener presente que en todo proceso en el cual estén de por medio bienes ambientales, deben respetar los principios que inspiran el Derecho Ambiental, tales como el precautorio y el preventivo, así como la función social y ambiental que debe cumplirse en todo terreno por quien lo posea o sea su dueño. El criterio sostenido por la a quo, además de irrespetar dichos principios, no considera que desde el punto de vista natural y lógico, los ecosistemas y zonas de protección de nacientes no se limitan por las divisiones o linderos establecidos por los humanos.

"Abonado a lo anterior, debe considerar la persona juzgadora, lo acordado en la XVI Cumbre Judicial Iberoamericana, realizada en Buenos Aires, Argentina, los días 25, 26 y 27 de abril de 2012, donde se suscribió la Declaración de Buenos Aires 2012. En el segmento relativo a la información y transparencia, y la participación pública en materia de medio ambiente, se declaró lo siguiente: " INFORMACIÓN Y TRANSPARENCIA EN MATERIA DE MEDIO AMBIENTE .* Es importante que el juez y las partes tengan acceso a una información ambiental verdadera, eficaz, real e idónea para que se dicten sentencias y efectivas en materia ambiental. Es importante que los jueces velen para que la ciudadanía y la sociedad tengan acceso a la información ambiental que precisen o soliciten, incluyendo la información en poder de los órganos jurisdiccionales. Es importante que los jueces tengan en cuenta cuán significativa puede ser su contribución, como agentes públicos, a la educación ambiental y a la sensibilización de la opinión pública en materia de protección del medio ambiente.

Es importante que los órganos jurisdiccionales utilicen medios idóneos y eficientes para transmitir a todos la información ambiental relevante, para informar a la sociedad sobre su actuación en materia de medio ambiente y para esclarecer al público cuestiones ambientales decididas en el ámbito judicial. Es importante que los jueces tengan un amplio acceso a toda la información ambiental que obre en poder de las partes, de terceros y de órganos públicos, de acuerdo con lo establecido en cada ordenamiento jurídico y el Principio 10 de la Declaración de Río. PARTICIPACIÓN PÚBLICA EN MATERIA DE MEDIO AMBIENTE .Es importante que, siempre que sea posible, los órganos jurisdiccionales adopten políticas de gestión ambiental e incentiven medidas para un uso racional y sostenible de sus recursos. Es importante que los órganos jurisdiccionales consideren sus responsabilidades socioambientales en sus planificaciones estratégicas, incluyendo: (a) la adopción de las medidas de protección del medio ambiente que sean posibles o necesarias; (b) la exigencia de una responsabilidad ambiental a los jueces y funcionarios en el desempeño de sus obligaciones; y (c) la preferencia de prácticas que combatan el desperdicio de recursos naturales, incentiven la sostenibilidad y eviten daños al medio ambiente.

Es importante que los mecanismos procesales de cada país aseguren una amplia participación de la ciudadanía y de la sociedad en acciones judiciales que guarden relación con el medio ambiente. Es importante que el juez de la causa o tribunal competente, siempre que lo estime necesario o conveniente, realice audiencias públicas para esclarecer cuestiones relevantes para el juicio de acciones ambientales, en las que conozca la opinión de la sociedad y recabe declaraciones técnicas de especialistas sobre aspectos relevantes a la hora de dictar sentencia. Es importante que, respetando su imparcialidad e independencia, el juez comparta la experiencia acumulada en el trato cotidiano con procesos y problemas ambientales, manteniendo contactos institucionales y cooperando con órganos públicos, agentes sociales, asociaciones económicas o profesionales, organizaciones no gubernamentales y la comunidad científica y académica, en beneficio de la mejora de la prestación jurisdiccional, de la aplicación eficiente de la legislación ambiental y de la divulgación de iniciativas de educación ambiental y de protección del medio ambiente..."..

De lo anterior estima este Tribunal, la persona encargada de resolver los asuntos en sede judicial y las partes, deben tener acceso a una información ambiental verdadera, eficaz, real e idónea para que se dicten sentencias efectivas en materia ambiental. En el caso de las informaciones posesorias, es evidente, a partir de los numerales 45 y 50 de la Constitución Política, se impone a quien juzga velar porque el título inscribible en el Registro Público, suministre información tendiente a generar el mayor bienestar a todos los habitantes del país, estimulando la producción agraria y agroambiental; incentivando que se conserve y preserve un ambiente sano y ecológicamente equilibrado; evitando daños que puedan afectar a las futuras generaciones. Además, la declaración en cita, establece la importancia que los jueces y las juezas velen para que la ciudadanía y la sociedad tengan acceso a la información ambiental que precisen o soliciten, incluyendo la información en poder de los órganos jurisdiccionales.

Cuando se tramitan las diligencias de información posesoria, la decisión que se inscribirá en el registro correspondiente, deberá suministrar a la ciudadanía en general información precisa y transparente. Por lo anterior, es relevante que todo lo que concierne al recurso hídrico, y eventualmente a fuentes de abastecimiento de agua potable para las comunidades, sea diáfana y precisa. El suministro de agua potable es un derecho al que todos los hombres y mujeres deben tener acceso. Este tema ha sido abordado por la Sala Constitucional de la Corte Suprema de Justicia de la siguiente manera: ´ « III . - Derecho fundamental al agua potable. Este Tribunal ha reconocido en su jurisprudencia que el derecho a la salud y a la vida son derechos fundamentales del ser humano que dependen -en gran parte-del acceso al agua potable, y que los órganos competentes tienen la responsabilidad, ineludible, de velar para que la sociedad como un todo no los vea mermados..." (voto* Nº18633 de 21 de diciembre de 2007) (voto 725 de 15 de junio de 2012 del Tribunal Agrario).*

VI.Además, efectivamente, en el voto citado por la PGR, N°128-F-10 del 19 de* febrero del 2010, este Tribunal, en un caso con un supuesto similar al reclamado en este asunto, resolvió: "II.- La Procuradura adjunta, ... se encuentra inconforme con la sentencia de primera instancia, toda vez que no se requirió el informe al Instituto Costarricense de Acueductos y Alcantarillados, ya que de ser así debería excluirse el área contiguo al manantial, aunque la naciente se ubique en terreno colindante. III.- Lleva razón la recurrente en sus agravios, toda vez que el a-quo debió verificar dicha situación previo al dictado de la sentencia, máxime si de los Planos presentados, a saber los números ..., se desprende que son colindantes entre sí, además de pretenderse la titulación de ambos terrenos graficados en dichos planos, y que se trata de una zona muy quebrada. Por ello el a-quo debió verificar esa situación, tanto en el reconocimiento judicial, como remitir la solicitud al Instituto Costarricense de Acueductos y Alcantarillados, a fin de determinar si el naciente puede o no surtir de agua a una población, conforme lo dispone el artículo 7º de la Ley de Tierras y Colonización".

VII.- En consecuencia, al haberse constatado omisiones que afectan el debido proceso, que no pueden subsanarse en esta Sede, por ser propias de la competencia funcional del juez de primera instancia y por respeto al debido proceso de las partes, lo procedente declarar la nulidad, por anticipada, de la sentencia impugnada. Proceda el a- quo a corregir el procedimiento de acuerdo a lo indicado. Tome nota además el Juzgado de instancia de los siguientes aspectos, para que tome las previsiones pertinentes en este caso o en asuntos furturos: a) Este proceso se planteó en el 2009, y la certificación que se presenta del Sistema Nacional de Áreas de Conservación del Ministerio de Ambiente y Energía, visible a folio 2, fue emitida en julio del 2003, es decir, más de cinco años antes. Por debido proceso y en vista de las variaciones que se pueden dar en materia de declaratoria de Áreas Silvestres Protegidas, las certificaciones que se presenten deben ser de reciente data, en relación con la fecha de inicio del proceso, para evitar que por desconocimiento de la parte promovente, o descuido de los tribunales en lo que respecta a sus deberes de tutela del ambiente, se apruebe la inscripción de terrenos comprendidos dentro de esas zonas de especial interés ambiental, que enmuchas de sus categorías, son además áreas de dominio público.

Al respecto, el punto 6.3.6. del Manual de Procedimientos para la Resolución de Visados y Certificaciones de Planos del SINAC, aprobado por el Consejo Nacional de Áreas de Conservación, Secretaría Ejecutiva, el 9 de junio del 2009, en resolución R-SINAC-037-2009, publicado en La Gaceta 134 del 13 de julio del 2009, establece: "6.3.6 De la vigencia. 6.3.6.1. Todo visado y certificación otorgado por el Área de Conservación tendrá una vigencia máxima de tres meses calendario a partir de la fecha de emisión". b) El plano base del proceso es el N° P-859152-2003, visible a folio 55, y no el que originalmente se presentó, error que fue señalado por la PGR oportunamente y que el Juzgado tuvo por corregido posteriormente. Pero luego, sin constatar efectivamente cuál era el plano correcto, se emite el oficio 146-A-12 a la Municipalidad de Golfito (folio 118), citándose y remitiéndose copia del N°P-871089-2003 (que no era el plano base), y con fundamento en tal la Municipalidad hace la inspección de campo y remite el informe que consta en el oficio MGPS-O-1636-2012 (folio 124).

Aunque en la ubicación y graficación de los terrenos ambos planos son muy similares, debe el Juzgado de instancia pedir los informes con base en el plano base vigente, y no utilizar planos que no son los que luego usará para resolver lo pedido en sentencia. c) Según el plano base, existe una quebrada sin nombre en un sector de la colindancia sur, pero ni el titulante la cita al describir los linderos, ni tampoco el Juzgado se refiere a ella en la sentencia impugnada. De igual forma, también omite la a quo referirse a la Quebrada Aguas Claras, colindante por el noroeste, al describir las colindancias en el por tanto. Dichas omisiones deben ser subsanadas en caso de resultar procedente estas diligencias, por ser las quebradas y ríos, colindancias naturales. Para mayor exactitud, puede la persona juzgadora indicar que la colindancia es con tales, en medio de la persona física o jurídica cuyo terreno esté luego de tales accidentes naturales. d) En relación con lo anterior, la PGR alega en sus reclamos interlocutorios, que la naciente que origina la petición del informe a brindar por el ICCA se ubica en un terreno colindante por el norte, pero en la apelación cita que brota en un terreno por el oeste.

Al existir dos corrientes de agua, una por el [Dirección9] y otra por el [Dirección10], no queda claro en cual terreno es que existe la naciente referida. De igual forma, pese a que la persona juzgadora debe ser precisa en la información que consigne en sus actas, especialmente en relación con rumbos y linderos, en la del reconocimiento judicial llevado a cabo el 26 de julio del 2011, solo se indica que "hay una quebrada que pasa por la finca pero es un naciente, que no nace en la finca del promovente sino en una finca más arriba" (lo resaltado no es del original)". La forma como se describe la ubicación de la naciente es absolutamente imprecisa, por lo que deberá la a quo, y la parte titulante, aclarar su localización y especificar en qué finca colindante es que emana. *

POR TANTO:* Se anula la sentencia de primera instancia N°5-2013 del 9 de enero de 2013. Proceda el Juzgado de instancia a corregir los procedimientos y tome nota de lo indicado en el último considerando.* * * * * * * * * * * [Nombre9] [Nombre8] [Nombre2] – JUEZ/A DECISOR/A [Nombre10] [Nombre3] - JUEZ/A DECISOR/A [Nombre11] – JUEZ/A DECISOR/A *
