TRIBUNAL DE APELACIÓN DE SENTENCIA DEL TERCER CIRCUITO JUDICIAL DE ALAJUELA, SECTION [Dirección1]. San Ramón, at nine fifty-five a.m. on the thirty-first day of October, two thousand thirteen.

APPEAL OF JUDGMENT (RECURSO DE APELACIÓN DE SENTENCIA) filed in the present proceedings against [Nombre [Nombre1]], a Costa Rican national, [...], for the offense of ILLEGAL TRANSPORTATION OF TIMBER (TRANSPORTE ILEGAL DE MADERA), to the detriment of LOS RECURSOS NATURALES. Judges Víctor Julio Vargas Villalobos, Martín Alfonso Rodríguez Miranda, and [Nombre2] participated in deciding the appeal. Attorney [Nombre3] and attorney [Nombre4], both representing the Ministerio Público, entered appearances in the appeal proceedings.

PROCEDURAL BACKGROUND (RESULTANDO):

  1. 1By judgment number 121-2013, issued at fifteen hours and eight minutes on the fourth day of April, two thousand thirteen, the Tribunal de Juicio de San Carlos ruled: “THEREFORE (POR TANTO): In accordance with the foregoing, the laws cited, and Articles 28, 29, 39, 41 and 50 of the Constitución Política; 1, 2, 4, 11 and 45 of the Código Penal; 1 through 9, 360 through 365, 366 and 429 of the Código Procesal Penal; and 1, 3, 26 through 28, 31 and 56, in relation to 63, of the Ley Forestal, this Court hereby rules: [Nombre [Nombre1]] IS ACQUITTED OF ALL PENALTIES AND LIABILITY for the offense of ILLEGAL TRANSPORTATION OF TIMBER with which the prosecuting authority charged him, to the detriment of LOS RECURSOS NATURALES. The property seized (bienes decomisados) in these proceedings shall be returned to whoever proves to be its lawful owner. Once this judgment becomes final, notice is hereby given that, pursuant to law 6106, three months after that circumstance, said property may pass into the possession of the State.This matter is resolved without any special award of costs. The costs of the proceedings shall be borne by the State. The parties are informed that this judgment is issued orally and that only the operative portion of the ruling (parte dispositiva del fallo) will remain in the case file. If the parties require a copy of the judgment, they must provide the corresponding device. The parties are hereby notified. MSc. [Nombre5]. Judge.”
  2. 2Attorney [Nombre3] filed an appeal against the foregoing ruling.
  3. 3Following the corresponding deliberation, in accordance with Article 465 bis of the Código Procesal Penal, the Court proceeded to hear the appeal.
  4. 4The relevant legal requirements have been observed throughout the proceedings.

Judgment drafted by Appellate Judge [Nombre6]; and, GROUNDS (CONSIDERANDO):

I.In a filing submitted on 19 de abril de 2013, attorney [Nombre3], a prosecutor with the Ministerio Público, appealed the acquittal entered by the Tribunal de Juicio del Segundo Circuito Judicial de Alajuela in judgment number 121-2013, issued at 15: 08 hrs on 4 de abril de 2013. As the sole ground for appeal, he alleges that the judgment lacked reasoning (fundamentación), challenges the assessment of the evidence and the failure to determine the facts, and alleges violations of the rules of sound judicial discretion (sana crítica) and the principle of derivation (principio de derivación). He bases this ground on Article 41 of the Constitución Política and Articles 142 and 363, subsections b) and c), of the Código Procesal Penal. The appellant states that these defects arose because, at trial, he requested that the defendant be convicted of the offense of illegal transportation of timber, defined in sections 56 and 63(a) of the Ley Forestal, since the adversarial proceedings (contradictorio) established that timber had in fact been transported from a plantation within a forestry system without the defendant having the permits required to do so.

The Tribunal de Juicio acquitted the accused after finding that no environmental damage (daño ambiental) had occurred and, therefore, that the legally protected interest (bien jurídico) had not been violated, rendering the alleged conduct outside the statutory definition of the offense (atípica). The prosecutor states in his appeal that he disagrees with the Court’s position because, under the rules of sound judicial discretion and the principle of legality (principio de legalidad), the offense of illegal transportation of timber does not require proof of environmental damage. Rather, the offense is established when the driver of a truck carrying logs does so without holding the State’s forestry authorizations, regardless of whether that conduct causes environmental damage. The prosecutor notes that, by finding that the conduct was not unlawful (antijurídica) because no environmental damage existed, the Court overlooked the fact that environmental law protects not only against the occurrence of environmental damage but also regulates the manner and means by which timber is transported.

This is because illegal transportation irreversibly impairs the powers of the forestry authority and facilitates illegal smuggling, unlawful removal, and the trafficking of timber products or timber goods without State oversight, and these actions are wholly unrelated to environmental damage as such. The Court never specified what constituted environmental damage. The judgment stated that no environmental damage had occurred, but did not set out the substantive reasons forming the legal basis for finding that such damage did not exist. The judgment did not identify any judicial or technical definition of environmental damage supporting the acquittal. He requests that the judgment be vacated and the case remanded for new proceedings.

II- The ground is denied. After examining digital files numbers c00011304041507332.vgz and c0001130404160000.vgz, in which oral judgment number 121-2013 issued by the Tribunal de Juicio del Segundo Circuito Judicial de Alajuela is recorded, the entire contents of which have been examined by this Tribunal de Apelación, those of us participating in the issuance of this ruling consider that the judgment contains sufficient reasoning (fundamentación) to establish its legal validity. The acquittal (absolutoria) of the accused was based on several reasons, the full contents of which can be found beginning at the 15:27:25-hour timestamp. Let us examine the reasoning provided by the Tribunal de Juicio in that judgment: “The Ministerio Público alleged the conduct of transporting timber without the respective permits. In the Tribunal’s view, the charging document (acusación) is imprecise regarding the alleged facts because it states that the accused did not have the respective permits without explaining what those permits consisted of, leaving that determination to the Tribunal for purposes of deciding what must be understood by ‘respective permits’; given that the charging document must be clear, precise, and detailed so that the accused has the opportunity to exercise the right of defense, it states that the accused was not carrying the transport permits issued by the forestry authority.

Based on the assessment of the documentary and testimonial evidence, and pursuant to section 39 of the Constitución Política, to establish guilt we must examine the three elements of the offense, namely, whether the act is statutorily defined (típico), unlawful (antijurídico), and culpable (culpable). The Tribunal considers that, in analyzing whether the conduct is statutorily defined, as stated by the prosecutor in the charging document and pursuant to section 56 of the Ley Forestal, which provides that logs, squared timber, or sawn timber originating from a forest or plantation may not be transported without the respective documentation. That section, in turn, refers to article 63 subsection A) of the same law, which provides: A term of imprisonment of one month to one year shall be imposed on anyone who: a) Violates the provisions of article 56 of this law. The conduct alleged by the Ministerio Público is that the timber originated from a plantation.

The prosecuting authority did not clarify in the charging document whether that plantation was a forest plantation or an agroforestry plantation, even though that distinction has different implications under the Ley Forestal because the type of permit required depends on the type of plantation. The charging document omitted those matters, and it would have to be assumed that the prosecuting authority intended to allege that the timber originated from a forest plantation. Article 31 of the Ley Forestal states that, to remove logs, squared timber, or sawn timber originating from forest plantations from a property for transport to any location within the national territory, a certificate of origin issued by the forestry manager (regente forestal) or the Consejo Regional Ambiental for the area is required. Under that provision, what was required to transport the timber was its certificate of origin.

According to the allegation, the accused was required to present the certificate of origin for that timber, whereas the charging document states that he did not have the transport permits. If we proceed from the premise that a forest plantation requires a certificate of origin rather than transport permits, as stated in the charging document. Moreover, the timber’s origin was determined through an interview of the accused conducted by the police authorities, specifically officer [Nombre [Nombre7]], without giving him any warning in his capacity as an accused person; it was on the basis of that improperly obtained information that [[Nombre8] ], a MINAE technician, conducted the inspection to determine the location from which the timber was being removed. Furthermore, article 28 of the Ley Forestal establishes exceptions under which permits are not required, and that provision conflicts with article 56 of the same Law, which provides otherwise.

In the present case, the accused’s criminal intent (dolo) must also be proven, meaning that the defendant knew he was required to carry that certificate of origin. The Tribunal determines that, pursuant to sections 28 and 56 of the aforementioned Ley Forestal, there is doubt as to whether the defendant fully knew that he needed the CED1 to transport that timber. Regarding unlawfulness, the Tribunal considers that substantive unlawfulness (antijuridicidad material) does not exist because, under article 1 of the Ley Forestal, the purpose is to protect natural forests. The protective purpose of the Ley Forestal is the protection of natural forests, and because the timber in question was removed from a plantation, no such harm occurred. Moreover, it was necessary to prove that logging (tala) was taking place, and that was not proven. The prohibition against logging seeks to protect natural resources, whereas this matter concerns a plantation; therefore, there was no violation of that statutory purpose.” (This concludes the transcription of that portion of the judgment).

As may be determined from an analysis of that reasoning, the ground on which this Tribunal de Apelación agrees with the court below (ad quo), and which requires that the accused’s acquittal be upheld, concerns the introduction into the proceedings of unlawfully obtained evidence (prueba ilícita) that was decisive in establishing criminal liability. The location of the area from which the timber was being removed was obtained through the interview that police officer [Nombre [Nombre7]] conducted with the accused, [Nombre [Nombre1]], without advising him of his right to refrain from testifying by virtue of his status as an accused person; it was on the basis of the information he provided that MINAE official [Nombre [Nombre9]] conducted the inspection to locate the place from which the timber was being removed. This issue is fundamental in the present matter because, if the allegation concerned the transportation of timber originating from a forest or plantation, the latter element was obtained through improper police action insofar as the accused was questioned despite having the right to refrain from testifying.

The unlawfully obtained statement renders the remaining actions taken, such as the inspection of the property or scene of the events, null and void. Consequently, there was no admissible evidence (prueba lícita) capable of establishing a fundamental objective element of the statutory offense (tipo penal), namely, the timber’s origin. This point was adequately addressed by the judicial authority, making the acquittal appropriate in this instance because, irrespective of certain conceptual errors in the reasoning underlying the ruling, those errors do not affect the validity of the decision. Having noted that circumstance, this Tribunal de Apelación concludes that the proper course is to affirm the acquittal entered, as it is entirely acceptable, given that several issues were not adequately addressed; for example, the judge stated that the charging document filed by the Ministerio Público was poorly structured because the prosecutor had not specified which documents the accused was required to carry in order to transport the timber, as well as other similar matters.

Nevertheless, despite those deficiencies in the reasoning, we consider that it is not appropriate to remand the matter for new proceedings because the introduction of tainted evidence (prueba espuria) into the proceedings constitutes a procedural defect that prevents a determination of the accused’s criminal liability for the offense of unlawful transportation of timber alleged against him by the Ministerio Público, since there is no independent evidence that could produce a different outcome. The position we now adopt is consistent with that established by this same Tribunal de Apelación de Sentencia in ruling 065-2013 at 09:19 hours, on February 8, 2013, which stated: “It cannot be maintained that merely because the accused has been informed of his rights, the administrative police are authorized to interview him, since, under article 98 of the Código Procesal Penal, that police authority is reserved for the judicial police, always in the presence of defense counsel and in strict compliance with the constitutional guarantees and procedural rights afforded to the accused.

In the present case, it was through an interview that the administrative police obtained a confession from the accused himself, and it was he who provided the corresponding evidence. Such police conduct violates our legal system regarding the rights of the accused, upon whom article 36 of the Constitución Política, International Human Rights Conventions, and procedural law confer the unrestricted right to refrain from testifying in criminal matters and to be assisted by defense counsel should he choose to do so.” Based on the foregoing arguments, the appeal from the judgment filed by attorney [Nombre3], in his capacity as prosecutor for the Ministerio Público, against acquittal number 121-2013 of the Tribunal de Juicio del Segundo Circuito Judicial de Alajuela, issued at 15: 08 hrs, on April 4, 2013, is denied.

POR TANTO:

The appeal from the judgment filed by attorney [Nombre3], in his capacity as prosecutor for the Ministerio Público, against acquittal number 121-2013 of the Tribunal de Juicio del Segundo Circuito Judicial de Alajuela, issued at 15: 08 hrs, on April 4, 2013, is denied.

RECURSO DE APELACIÓN DE SENTENCIA interpuesto en la presente causa seguida contra [Nombre [Nombre1]], costarricense, [...], por el delito de TRANSPORTE ILEGAL DE MADERA en perjuicio de LOS RECURSOS NATURALES. Intervienen en la decisión del recurso, los Jueces Víctor Julio Vargas Villalobos, Martín Alfonso Rodríguez Miranda y [Nombre2] . Se apersonaron en Apelación de Sentencia, el licenciado [Nombre3] y la licenciada [Nombre4] , ambos en representación del Ministerio Público.

RESULTANDO:

  1. 1Que mediante sentencia número 121-2013 de las quince horas ocho minutos del cuatro de abril de dos mil trece, el Tribunal de Juicio de San Carlos, resolvió: " POR TANTO: De conformidad con lo expuesto, leyes citadas y artículos 28, 29, 39, 41 y 50 de la Constitucional Política; 1, 2, 4, 11, 45 del Código Penal; 1 a 9, 360 a 365, 366, 429 del Código Procesal Penal, 1, 3, 26 a 28, 31, 56 en relación con el 63 de la Ley Forestal; este Tribunal resuelve: ABSOLVER DE TODA PENA Y RESPONSABILIDAD a [Nombre [Nombre1]] por el delito de TRANSPORTE ILEGAL DE MADERA, que se le atribuyó por parte del ente fiscal en perjuicio de LOS RECURSOS NATURALES. Se ordena la devolución de los bienes decomisados en ese proceso , a quien demuestre ser su legítimo propietario. Una vez adquirida la firmeza de esta sentencia, se advierte que pasados tres meses después de esa circunstancias deacuerdo a la ley 6106, dichos bienes podrían quedar en manos del Estado. Redacta el Juez de Apelación de Sentencia [Nombre6] ; y,

CONSIDERANDO:

I.En escrito presentado en fecha 19 de abril de 2013 el licenciado [Nombre3] , fiscal del Ministerio Público, presentó recurso de apelación en contra de la sentencia absolutoria del Tribunal de Juicio del Segundo Circuito Judicial de Alajuela número 121-2013 de las 15: 08 hrs, del 4 de abril de 2013. Como único motivo de apelación reprocha falta de fundamentación de la sentencia, inconformidad con la valoración de la prueba y no determinación del hecho, violación a las reglas de la sana crítica y al principio de derivación. Fundamenta el motivo en los artículos 41 de la Constitución Política y 142 y 363 incisos b) y c) del Código Procesal Penal. Refiere el recurrente que los vicios se presentan en tanto en juicio solicitó la condenatoria del imputado por el delito de transporte ilegal de madera tipificado en los numerales 56 y 63 inciso a) de la Ley Forestal al haberse demostrado en el contradictorio que efectivamente existió un transporte de madera de una plantación de un sistema forestal, sin que el imputado tuviera los permisos para hacerlo.

El Tribunal de Juicio absolvió al encartado al estimar que no había existido daño ambiental y por tanto violación al bien jurídico, resultando la conducta acusada atípica. Refiere el fiscal en su recurso que no comparte la tesis del Tribunal, pues de conformidad a las reglas de la sana crítica y amparados al principio de legalidad el tipo penal de transporte ilegal de madera no requiere de la comprobación del daño ambiental, pues el delito se configura cuando el conductor de un camión que lleva madera en trozas, lo hace sin contar con las autorizaciones forestales del Estado, independientemente de que esa acción cause o no daño ambiental. Señala el fiscal que el Tribunal al considerar que al no existir daño ambiental la acción no resultaba antijurídica, olvida que en materia ambiental la ley no sólo protege la no producción de daño ambiental, sino que también se tutela la forma y mecanismo de transporte de madera, ya que el transporte ilegal daña irreversiblemente las potestades de la autoridad forestal y dinamiza el contrabando ilegal, la sustracción irregular y el trasiego de productos maderables o bienes maderables sin control del Estado y estas acciones en nada se relacionan con el daño ambiental propiamente dicho.

El Tribunal nunca especificó cuál era el daño ambiental, en la sentencia se indicó que no había daño ambiental, pero no definió las razones sustantivas en las cuales se fundamentaba la base jurídica para acreditar la inexistencia de ese daño ambiental. No se indicó en la sentencia el concepto jurisprudencial o técnico de daño ambiental para sustentar la absolutoria. Solicita anular la sentencia y ordenar el reenvío para una nueva sustanciación.

II- El motivo no se acoge. Luego de examinar los archivos digitales números c00011304041507332.vgz y c0001130404160000.vgz en que se encuentra registrada la sentencia oral número 121-2013 dictada por el Tribunal de Juicio del Segundo Circuito Judicial de Alajuela, cuyo contenido íntegro se ha examinado por parte de este Tribunal de Apelación consideramos quienes concurrimos al dictado del presente fallo, que la sentencia presenta una fundamentación suficiente que legitima su validez jurídica. La absolutoria del imputado estuvo determinada por varias razones cuyo contenido integro lo podemos ubicar a partir del contador de las 15:27:25 horas. Veamos la fundamentación dada por el Tribunal de Juicio en esa sentencia: “El Ministerio Público atribuyó la conducta de transporte de madera sin los respectivos permisos. La acusación a criterio del Tribunal contiene una imprecisión sobre los hechos acusados, pues se indica que el imputado no contaba con los permisos respectivos sin explicar en qué consisten esos permisos, dejando al Tribunal esa valoración a efecto de determinar que se debe entender por permisos respectivos y siendo que la acusación debe ser clara precisa y circunstanciada con el fin de darle la posibilidad al imputado de poder ejercer el derecho de defensa, la acusación dice que el imputado no portaba las guías de transporte que otorga la autoridad forestal.

De la valoración de la prueba documental y la testimonial y de conformidad al numeral 39 de la Constitución Política para establecer la culpabilidad, debemos relacionar las tres etapas del delito, es decir que estemos ante un hecho típico, antijurídico y culpable. El Tribunal considera que para analizar la tipicidad, tal y como lo señala el fiscal en la acusación y según lo que establece el numeral 56 de la Ley Forestal que indica no se podrá movilizar madera en trozas, escuadrada ni aserrada proveniente de bosque ni de plantación, si no se cuenta con la documentación respectiva. El citado numeral remite a su vez al artículo 63 inciso A) de la misma ley que establece: Se impondrá prisión de un mes a un año a quien: a) Contravenga lo dispuesto en el artículo 56 de esta ley. La conducta acusada por el Ministerio Público es que la madera provenía de una plantación. El órgano fiscal no aclaró en la acusación si esa plantación era forestal o agroforestal, pues esa circunstancia tiene connotaciones diferentes de acuerdo a la Ley Forestal, pues dependiendo del tipo de plantación así será el tipo de permiso requerido.

La acusación fue omisa sobre esos aspectos y tendría que suponerse que el ente fiscal quiso acusar que provenía de una plantación forestal. El artículo 31 de la Ley Forestal señala que para sacar de la finca hacia cualquier parte del territorio nacional, madera en trozas, escuadrada o aserrada, proveniente de plantaciones forestales, se requerirá un certificado de origen expedido por el regente forestal o el Consejo Regional Ambiental de la zona. De conformidad con el citado numeral lo que se exigía para transportar esa madera, era el certificado de origen de esa madera. De acuerdo a lo que se acusó, lo que debía presentar el imputado era el certificado de origen de esa madera, mientras que la acusación indica que no tenía las guías de transporte. Si partimos que en una plantación forestal lo que se requiere es el certificado de origen y no las guías de transporte, tal y como se indica en la acusación.

Además la determinación del origen de la madera se dio por medio de la entrevista que se le realizó al imputado por las autoridades de policía, propiamente por el oficial [Nombre [Nombre7]], sin realizarle ningún tipo de prevención en su calidad de imputado y con esa información obtenida en forma espuria, es que el funcionario [[Nombre8] ] técnico del Minae realizó la inspección para determinar el lugar de donde se estaba sacando esa madera. Además el artículo 28 de la Ley Forestal establece unas excepciones en las cuales no se requiere permisos y dicho numeral se contrapone con el artículo 56 de la misma Ley que establece lo contrario. También en el presente caso se debe comprobar el dolo del imputado, es decir que el encartado conociera que debía llevar ese certificado de origen. El Tribunal llega a determinar que de conformidad con el numeral 28 y 56 de la citada ley Forestal, existe duda si el encartado tenía pleno conocimiento de que para transportar esa madera necesitara el CED1 .

Sobre la antijuridicidad el Tribunal considera que no existe la antijuridicidad material, pues de acuerdo con el artículo 1 de la Ley Forestal, lo que se busca es proteger los bosques naturales. El objetivo de protección de la Ley Forestal es la protección de los bosques naturales y siendo que la citada madera se extrajo de una plantación esa afectación no se dio. Pero además era necesario que se demostrara que se estaba dando una tala y ese aspecto no se demostró. La tala lo que busca es la protección de los recursos naturales y acá se trata de una plantación y por tanto no se dio una violación a ese fin de la ley”. (hasta aquí la transcripción de ese extremo de la sentencia). Tal y como se logra extraer del análisis de esa fundamentación, la razón que ésta Cámara de Apelaciones comparte con el ad quo y que exige mantener la absolutoria del imputado es la referida a la incorporación al proceso de prueba ilícita que resultaba determinante para establecer la responsabilidad penal, pues la ubicación del área en donde se estaba extrayendo la madera se obtuvo por la entrevista que le realizó el oficial de policía [Nombre [Nombre7]] al acusado [Nombre [Nombre1]], sin advertirle de su derecho de abstenerse de declarar en virtud de su condición de imputado y con la información brindada por él, es que el funcionario del MINAE [Nombre [Nombre9]] realiza la inspección para ubicar el lugar de donde se estaba extrayendo esa madera.

Este tema es fundamental en la especie, pues si lo que se acusaba era transporte de madera proveniente de bosque o plantación, éste último elemento se obtuvo de una acción indebida de la policía, en el tanto se interrogo al imputado teniendo el derecho de abstenerse. Esta declaración ilegal obtenida, genera nulidad del resto de las actuaciones desarrolladas, como era inspección en el terreno o lugar de los hechos. Ante ello, no era posible contar con prueba lícita que permitiera acreditar un elemento objetivo fundamental del tipo penal, cual era la procedencia de la madera. Este punto fue adecuadamente desarrollado por la autoridad jurisdiccional, lo cual hace que el fallo absolutorio resulte adecuado en esta ocasión, en la medida que, con independencia de algunos errores conceptuales en torno a la fundamentación del fallo, lo cierto es que los mismos no afectan la validez de lo resuelto.

Advertida esa circunstancia concluye éste Tribunal de Apelaciones que lo procedente es confirmar la absolutoria dictada por resulta del todo aceptable, en virtud de que se tratan diversos temas que no se desarrollan adecuadamente como, por ejemplo, refiere la juez que la acusación formulada por el Ministerio Público se encontraba mal estructurada, pues no se había indicado por parte del fiscal cuáles eran los documentos que el imputado debía portar para transportar la madera y otros aspectos semejantes. Ahora no obstante esas falencias en la fundamentación, consideramos que no resulta procedente ordenar el reenvío para una nueva sustanciación, pues al existir incorporación de prueba espuria al proceso, ese vicio del procedimiento impide poder determinar la responsabilidad penal del imputado en ese delito de transporte ilegal de madera que le venía atribuyendo el Ministerio Público, pues no existe prueba independiente que pueda provocar una solución distinta.

El criterio que ahora sostenemos es coincidente con el establecido por éste mismo Tribunal de Apelación de Sentencia en el voto 065-2013 de las 09:19 horas, del 8 de febrero de 2013 en donde se indicó: “ No puede pretenderse que en razón de que el imputado sea informado de sus derechos, que la policía administrativa se encuentre legitimada para entrevistarlo, puesto que esta facultad policial, conforme con el artículo 98 del Código Procesal Penal está reservada a la policía judicial, siempre en presencia de un defensor y en estricto apego a las garantías constitucionales y derechos procesales que le asisten al imputado. En el presente caso fue a través de una entrevista, que la policía administrativa obtuvo del propio imputado una confesión y fue él quien aportó la evidencia correspondiente. Tal actuar policial contraviene nuestro ordenamiento jurídico en materia de derechos del imputado, a quien el artículo 36 de la Constitución Política, Convenios Internacionales de Derechos Humanos y normativa procesal, conceden irrestrictamente el derecho de abstenerse de declarar en materia penal y de ser asistido por un defensor en caso de hacerlo”.

Con fundamento en los argumentos expuestos, se rechaza el recurso de apelación de sentencia, interpuesto por licenciado [Nombre3] en su calidad de fiscal del Ministerio Público, en contra de la sentencia absolutoria del Tribunal de Juicio del Segundo Circuito Judicial de Alajuela número 121-2013 de las 15: 08 hrs, del 4 de abril de 2013.

POR TANTO:

Se rechaza el recurso de apelación de sentencia, interpuesto por licenciado [Nombre3] en su calidad de fiscal del Ministerio Público, en contra de la sentencia absolutoria del Tribunal de Juicio del Segundo Circuito Judicial de Alajuela número 121-2013 de las 15: 08 hrs, del 4 de abril de 2013.
