APPEAL FILED BY: Nombre103162 AND Nombre103163 AGAINST: MUNICIPALIDAD DE HEREDIA N° 144-2012 SECCIÓN TERCERA DEL TRIBUNAL CONTENCIOSO ADMINISTRATIVO. Segundo Circuito Judicial de San José, Anexo A, Goicoechea, at fourteen hours and forty minutes on veintisiete de abril del dos mil doce.

This Tribunal, acting as the nonhierarchical superior authority (jerarca impropio), hears the appeal filed by Nombre103162, identity card number CED79099, and Nombre103163, identity card number CED79100, against the decision issued at 15:40 hours on 14 de enero del 2011 by the Alcalde Municipal de Heredia.

CONSIDERING

I.Proven facts. The following facts of significance to the resolution of this matter are deemed proven:

  • 1)Nombre103162 and Nombre103163 each own a one-half interest in the property recorded under real-property folio registration Placa17238 in the province of Heredia (folios 14 and 15).
  • 2)By a decision issued at 12:00 hours on 21 de enero del 2009, the Órgano Director del Procedimiento de la Municipalidad de Heredia commenced administrative proceedings (actuaciones administrativas) to determine whether illegal structures existed within the protection zone (zona de protección) along the bank of Río Quebrada Seca, on the property of Nombre103162 and Nombre103163. The charges brought were as follows: “Maintaining a structure or part thereof without any legal authorization on property number 04-084458, which they own, because said structure encroaches upon the protection area (área de protección) along the bank of the Quebrada Seca river.” The private oral hearing (audiencia oral y privada) was scheduled for 27 de febrero del 09 (folios 16 to 20).
  • 3)On 27 de febrero del 2009, the private oral hearing was held with the participation of Nombre103162 and Nombre103163 (folios 21 to 23).
  • 4)By official letter N° MH-13-QS-PAO-2009, undated, the body directing the administrative proceeding submitted the corresponding final report. It issued the following recommendations: “(...) 1- The parties subject to these proceedings, Nombre103163 and Nombre103162, shall demolish the perimeter wall located within the protection zone of the Quebrada Seca river, erected on property number 04-94458-001 and 002 owned by them, for the purpose of bringing the physical conditions into conformity with the legal requirements of the laws currently in force, in order to uphold the fundamental right of residents generally to a healthy and ecologically balanced environment, which includes addressing the imminent danger to the lives and property of municipal residents living near the Quebrada Seca watershed. 2- In this case, given the acknowledged protective function performed by the wall that was built, it is recommended that a reasonable period be granted so that the parties subject to these proceedings may build another wall (outside the river protection zone). Once the reasonable period granted by the Administration has elapsed, if the regulated parties (administrados) refuse to comply with the demolition order within the period granted for that purpose, the Municipalidad de Heredia shall undertake substitute enforcement (ejecución sustitutiva) by demolishing the structures located within the protection zone of the Quebrada Seca river on the property owned by the parties subject to these proceedings, for the purpose of bringing the physical conditions into conformity with the legal requirements of the laws currently in force. 3- We must emphasize that the recommended demolition applies to the perimeter wall located within the protection zone, but not to the private bridge, which is the only means of access available to the parties subject to these proceedings to reach their property; otherwise, the property would become unusable and lose its market value, thereby making the imposed restrictions tantamount to expropriation.” (folios 27 to 40).
  • 5)By decision N°AMH-0041-10, issued at 15:40 hours on 14 de enero del 2011, the Alcalde Municipal de Heredia issued the final administrative act (acto final) in the proceeding. He deemed it proven that, within the protection area of Río Quebrada Seca located on the property of Nombre103162 and Nombre103163, there is a perimeter wall built without construction permits. The Por Tanto of the cited decision provided as follows: “1. The parties subject to these proceedings (sic), Nombre103163 and Nombre103162, shall demolish the perimeter wall extending along the 55.27 m of the western boundary of their property number 04-94458-001 and 002, which adjoins Quebrada Seca; this is for the purpose of bringing the physical conditions into conformity with the legal requirements of the laws currently in force, in order to uphold the fundamental right of residents generally to a healthy and ecologically balanced environment, which includes addressing the imminent danger to the lives and property of municipal residents living near the Quebrada Seca watershed. 2. In this case, given the acknowledged protective function performed by the wall that was built, a reasonable period of two months is granted so that the parties subject to these proceedings (sic) may build another wall or security mechanism (outside the river protection zone). Once the granted period has elapsed, if the regulated parties refuse to comply with the demolition order within the period granted for that purpose, the Municipalidad de Heredia shall undertake substitute enforcement by demolishing the structures located within the protection zone of the Quebrada Seca river on the property owned by the parties subject to these proceedings (sic), for the purpose of bringing the physical conditions into conformity with the legal requirements of the laws currently in force. 3. The ordered demolition applies solely to the perimeter wall located within the protection zone and not to the private bridge, which is the only means of access available to the parties subject to these proceedings (sic) to reach their property; otherwise, the property would become unusable and lose its market value, thereby making the imposed restrictions tantamount to expropriation. 4. This decision may be challenged by a motion for reconsideration with a subsidiary appeal (recursos de revocatoria con apelación en subsidio), in accordance with the deadlines and terms established in Article 162 of the Código Municipal.” (folios 42 to 53).
  • 6)On 7 de febrero del 2010, Nombre103162 and Nombre103163 filed a motion for reconsideration with a subsidiary appeal against the decision identified in the preceding fact (folios 55 to 61).
  • 7)By decision N°AMH-0192-2011, issued at 9:30 hours on 22 de febrero del 2011, the Alcalde Municipal denied the motion for reconsideration and referred the appeal to this Tribunal (folios 62 to 65).

II.Unproven facts.- The following matters of significance to the resolution of this case are deemed unproven: 1) That the front wall of the property owned by Nombre103162 and Nombre103163 has a construction permit (the record). 2) That subjecting the appellants’ property to urban-environmental regulations would affect 50% of it (the record). 3) That there is a technical study recommending that Río Quebrada Seca be placed in a culvert (entubamiento) (the record).

III.Grounds of appeal (agravios) raised by the appellants.- Nombre103162 and Nombre103163 appeal the decision of the Alcalde de Heredia on the following grounds of disagreement: they state that fifteen years ago they decided to build a wall to protect against the waters of Quebrada Seca. They argue that the Municipalidad’s decision ordering the wall demolished affects their property right for several reasons: they would lose almost 50% of the total land area of the property because it would be a portion of land of which they could make no use whatsoever; they would lose protection for their physical safety and property because they would be unable to enclose it with a structure; if they observe the ten-meter protection requirement, they would effectively surrender that strip of land to anyone wishing to travel through the area without being able to restrict passage through it; if they remove the wall, the soil would continue to be washed away; the topography of the land is not suitable for building a new wall; the house did receive a construction permit at the time, and part of it would have to be removed; without protection, the waters would flow freely and flood the property, placing their lives and property at risk, with the property being their only escape route in the event of flooding; there is no study determining that the 53-meter frontage of their property causes the overflows; the river channel has sufficient capacity, as shown by the fact that during heavy rains it is the bridges that cause the overflows, and therefore removing the wall would not solve the problem.

They allege that the retaining wall (muro de contención) has prevented erosion and the movement of material through the streambed. They assert that conducting a study could have determined the feasibility of placing the stream in a culvert and thus preventing harm to the affected persons.

IV.Merits.- After reviewing the record and the appeal filed, this Tribunal finds that the challenged administrative act (acto impugnado) must be affirmed.- Article 33 of the Ley Forestal constitutes a statutory restriction on private property, as required by Article 45 of the Constitución Política, which provides that, for reasons of public necessity, the Asamblea Legislativa may, by a vote of two-thirds of its entire membership, impose restrictions upon property in the public interest. Thus, insofar as relevant here, the aforementioned Article 33 provides: “Protection areas. The following are declared protection areas: ... b) A strip of fifteen meters in rural areas and ten meters in urban areas, measured horizontally on both sides along the banks of rivers, streams, or creeks, if the terrain is flat, and fifty horizontal meters if the terrain is steep.” (emphasis added). Regarding restrictions on private property, the Sala Constitucional stated the following in decision N°4205-96, issued at 14:33 hours on 20 de agosto de 1996:

“(...) A conception of private property rights as absolute and virtually unlimited became the fundamental basis upon which the Western system was established, with the complete inviolability of the property right being enshrined as a central principle of the legal system, since that right entailed complete dominion over the property in an absolute, general, independent, full, universal, unlimited, and exclusive manner. However, that concept has evolved to the point of advocating the protection of property based on social harmony and on a social conception of land ownership. The legal basis underlying the protection of property was thus modified: from being a right exclusive to the individual, it came to entail an obligation promoting the harmonious coexistence of society. The idea of the ‘social function’ of property emerged, under which every individual has an obligation to fulfill certain communal duties directly related to the position that the individual occupies and the interests of the social group that the individual represents. The substance of this ‘property-as-function’ consists in the owner having the power to use the asset under their ownership to satisfy their own needs, while also having the duty to place it at the service of social needs when such conduct is essential.

With this new concept, the legislature’s powers to determine the content of the right to property (derecho de propiedad) are broadened through the limits and obligations of social interest that it may establish, thereby putting an end to the exclusive, sacred, and inviolable character formerly attributed to that right. This position has previously been recognized by this Court; thus, in amparo judgment number 5097-93, it stated: “I.) The inviolability of private property is a constitutional guarantee enshrined in Article 45 of the Constitución Política. Contrary to how it was conceived in earlier times, this right is not static in nature; rather, in keeping with the demands of our time, it must be regarded as flexible and dynamic, meaning that it confers upon its holders, both internally and externally, powers, duties, and limitations. The owner’s power over the property is determined by the function that the property fulfills.

The subject matter of the right to property has undergone significant transformations. Today, protection extends not only to the rights of owners, but also to various general or social interests that coexist with those rights. Objective law defines the content of subjective rights. Each object of rights entails a particular form of appropriation. Thus, for example, the powers of ownership relating to agricultural land are very different from those corresponding to property located in a densely used urban area.” Likewise, together with this principle—the social function of property (función social de la propiedad)—the principle of social solidarity (solidaridad social) is incorporated; as this Constitutional Court previously stated, “IV.- [...], with which our Constitución Política is imbued, permits a burden borne by all for the benefit of all, or even by a few for the benefit of many, provided that the natural use of the real property is not affected to the point of destroying its value as a means of production or its market value; that is, so that it ceases to exist as a productive asset.” (Judgment number 2345-96, issued at nueve horas veinticuatro minutos on diecisiete de mayo del año en curso.)

It should be noted that, in nearly all legal systems, the concept of private property rights as unlimited and absolute has disappeared, and the most important legal orders are increasingly embracing a conception of property closely linked to society’s general needs; as this Chamber previously stated in the aforementioned judgment number 2345-96: “In developing the concept of ‘deprivation of a primary attribute of ownership’ that prevents the enjoyment of property, we may say that a limitation is a method for defining the content or exercise of the right to property, which qualifies and affects the right itself.”

VI. Article 45 of the Constitución Política enshrines the right to property in our constitutional legal system

The first paragraph describes it as “inviolable” and establishes the State’s obligation to compensate the owner in advance when it must take the property for reasons of “legally established public interest.” The second paragraph provides for the possibility of imposing limitations in the social interest (limitaciones de interés social) on property through a law approved by a qualified vote—a vote of two-thirds of all members of the Asamblea Legislativa. It is therefore clear that the State’s obligation to pay compensation is constitutionally provided for solely and exclusively in cases of expropriation (expropiación), and does not apply to limitations in the social interest established through a law approved by a qualified vote, under the terms previously set forth by this Constitutional Court in amparo judgment number 5097-93: “II.) Costa Rican legislation provides that private property may be limited in the social interest through zoning plans (planes reguladores), and Urban Planning Law (Derecho Urbanístico) may, in turn, develop those limitations.

The right to property is therefore framed within certain reasonable limits and within the duties arising from it. Precisely for that reason, no compensation is required for reasonable urban-planning limits and duties [...]_ It is clarified that limitations or restrictions on property are general in nature and have the virtue of providing individuals with the instruments needed to mitigate the effects of their fellow citizens’ harmful activities. It should be noted that their principal purpose or objective is the rational use of property, thereby benefiting neighbors or, more generally, society as a whole. In this regard, the Corte Plena, when it exercised constitutional-review functions, stated at its extraordinary session of dieciséis de junio de mil novecientos ochenta y tres: ‘The limitations—or limits—that may be imposed on property (apart from neighbor relations and other duties or burdens addressed by the Código Civil and special laws) are those of “social interest” authorized by the second paragraph of Article 45 of the Constitución and intended to protect interests of that kind for the benefit of society as a whole or of some of its communities; [...]’”

VII.Certain limitations on property have always existed as rules incorporated into the Código Civil, such as those concerning possession and transfer of real property—Article 272—which prevent partition in cases of co-ownership; those concerning sidewalk height—Article 303; those establishing protection against potential harm to third parties caused by the poor condition of buildings or trees—Article 311; and, in particular, the entirety of Title V, entitled Cargas o Limitaciones a la Propiedad Impuestas por Ley, which establishes, among other things, prohibitions against constructing wells, sewers, aqueducts, etc., near a party wall—Article 404; prohibitions against opening a window or skylight in a dividing wall at a distance of less than two and a half meters—Article 406; and prohibitions against windows overlooking rooms, patios, or enclosures on neighboring property—Article 407. Other examples include public safety and health requirements, as embodied in laws that allow authorities to require owners to repair, remodel, or demolish buildings that are at risk of collapse or are unsanitary, provisions principally contained in the Código Civil and the Ley General de Salud.

Along the same lines, mention must also be made of laws concerning the protection of forests, natural beauty, cultural heritage, and monuments, which likewise entail limitations on property, such as the Ley Forestal, No. 7174 of veintiocho de junio de mil novecientos noventa, Ley de la Conservación de la Vida Silvestre No. 7317, of veintiuno de octubre de mil novecientos noventa y dos, and Ley de Patrimonio Histórico, Arquitectónico y Cultural No. 4, of octubre de mil novecientos noventa y cinco. (...)”

In this specific case, the appellants do not dispute that the wall is located on their property within the protection zone (zona de protección) of the Quebrada Seca river, nor have they succeeded in proving that the Municipalidad granted them a building permit to erect it. They invoke security reasons for keeping it in that location, but have failed to establish the existence of the purported study recommending the possibility of channeling the watershed (cuenca) through pipes, as proposed by the appellants. It is important to recall that the protection area was regulated to prevent property owners from cutting down or reducing forest cover (cobertura boscosa), for the purpose of preventing flooding, while also seeking to prevent contamination of water resources caused by stormwater runoff (aguas de escorrentía). The Municipalidad de Heredia therefore acted properly in initiating proceedings to determine whether illegal structures existed in the protection zones of the Quebrada Seca river and in strictly enforcing environmental legislation, a function inherently entrusted to local governments as the governing authorities for urban-planning and environmental oversight at the local level, pursuant to Articles 169 and 50 of the Constitución Política.

V.Finally, we cannot fail to note that the Ley Forestal clearly provides that no compensation is payable for illegal structures erected as a result of encroachment upon the protection zone (Article 58). It must be recalled, however, that a limitation on the right to property cannot reach such a degree or intensity that it makes normal disposition of the property impossible, thereby depriving the attributes of ownership of all substance, because in such a case it becomes a taking of the property requiring fair compensation. In this regard, it is appropriate to reproduce what the Sala Constitucional stated in the cited decision:

“(...) VIII. Notwithstanding the statements made in the preceding recitals (considerandos), it must be noted that the natural boundary of legitimate limitations that may be imposed on private property lies in the degree to which the property is affected; that is, when the restriction on the right to property becomes a true expropriation, with the resulting obligation to pay compensation, because the right to property is completely extinguished, or when the restriction does not affect the community as a whole. The Corte Plena so stated in relation to limitations imposed on property when they exceed that boundary, at its extraordinary session of dieciséis de junio de mil novecientos ochenta y tres: ‘[...] that is, “limitations,” as Article 45 calls them, but not dispossession of private property or deprivation of a primary attribute of ownership, because preventing enjoyment of the property is equivalent, at least in this case, to a form of expropriation without the prior-compensation requirement mandated by the political charter’;

and as this Court stated in the aforementioned judgments number 5097-93 and 2345-96:

“IV.) In the Chamber’s view, the reasonable limits that the State may impose on private property, according to its nature, are constitutionally permissible provided they do not deprive it of its substance. When that occurs, the measure ceases to be a reasonable limitation and becomes a deprivation of the right itself.” (Judgment number 5097-93); “That is, the attributes of property may be limited provided that the owner retains the possibility of making normal use of the property, excluding, of course, the portion or function affected by the limitation imposed by the State.

Outside these parameters, if social welfare requires sacrifices solely from one person or a few persons, compensation must be paid, as it must when the sacrifice imposed on the owner is of such a nature that it causes the complete loss of the property. Thus, a limitation on property withstands constitutional scrutiny when its effect on the essential attributes of property—those that permit the natural use of the thing within the current socioeconomic reality—does not eliminate the nature of the property or make its use impossible because the State imposes authorization or approval requirements so complex that they effectively make it impossible to derive benefit from the property.” (judgment number 2345-96); (...)”

VI.Accordingly, the appeal must be denied and the challenged act affirmed, thereby exhausting the available administrative remedies (vía administrativa).

POR TANTO

The decision issued at 15:40 on 14 de enero del 2011 by the Alcalde Municipal de Heredia is affirmed. The available administrative remedies are exhausted.

RECURSO DE APELACIÓN INTERPONE: Nombre103162 Y Nombre103163 CONTRA: MUNICIPALIDAD DE HEREDIA N° 144-2012 SECCIÓN TERCERA DEL TRIBUNAL CONTENCIOSO ADMINISTRATIVO. Segundo Circuito Judicial de San José, Anexo A, Goicoechea, a las catorce horas cuarenta minutos del veintisiete de abril del dos mil doce.

Conoce este Tribunal, como jerarca impropio, del recurso apelación interpuesto por Nombre103162 , cédula de identidad número CED79099 y Nombre103163 , cédula de identidad número CED79100; contra la resolución de las 15:40 horas del 14 de enero del 2011, dictada por el Alcalde Municipal de Heredia.

Redacta el Juez González Segura.

CONSIDERANDO

I.Hechos probados. De importancia para la resolución de este asunto, se tienen como probados los siguientes hechos:

  • 1)Los señores Nombre103162 y Nombre103163 son dueños, cada uno, de un medio sobre la finca folio real matrícula Placa17238 de la provincia de Heredia (folios 14 y 15).
  • 2)Mediante resolución de las 12:00 horas del 21 de enero del 2009, el Órgano Director del Procedimiento de la Municipalidad de Heredia, inició las actuaciones administrativas para determinar la existencia de construcciones ilegales en la zona de protección al margen del Río Quebrada Seca, en la propiedad de los señores Nombre103162 y Nombre103163 . Los cargos formulados fueron los siguientes: "La tenencia de una construcción o parte de ella sin ningún respaldo legal, en la finca número 04-084458, de su propiedad, por encontrarse dicha obra invadiendo el área de protección de la rivera del río Quebrada Seca." La audiencia oral y privada fue señalada para el 27 de febrero del 09 (folios 16 a 20).
  • 3)El 27 de febrero del 2009, se realizó la audiencia oral y privada con la participación de los señores Nombre103162 y Nombre103163 (folios 21 a 23).
  • 4)Por oficio N° MH-13-QS-PAO-2009, sin fecha, el órgano director del procedimiento administrativo rindió el informe final correspondiente. Emitió las siguientes recomendaciones: "(...) 1- Procedan los expedientados Nombre103163 y Nombre103162 , a la demolición de la tapia perimetral ubicada dentro de la zona de protección del río Quebrada Seca, levantadas en la finca de su propiedad número 04-94458-001 y 002, con la finalidad de ajustar la realidad física a las prescripciones legales del ordenamiento jurídico vigente, en razón de hacer valer el derecho fundamental a un ambiente sano y ecológicamente equilibrado de los administrados en general, lo cual incluye el peligro inminente de la vida y el patrimonio de los munícipes que viven en los alrededores de la cuenca hidrográfica Quebrada Seca. 2- En este caso, con motivo que se es consciente en la función de protección que desempeña la tapia construida, se recomienda dar un plazo prudencial para que los expedientados puedan construir otra tapia (fuera de la zona de protección del río), luego de cumplido el plazo prudencial otorgado por la Administración, en caso de renuencia por parte del administrado de cumplir con la orden de demolición en el plazo concedido al efecto, procederá la Municipalidad de Heredia a la ejecución sustitutiva de la demolición de las construcciones ubicadas dentro de la zona de protección del río Quebrada Seca en la finca propiedad de los expedientados, con la finalidad de ajustar la realidad física a las prescripciones legales del ordenamiento jurídico vigente. 3- Debemos ser enfáticos en cuanto a que la demolición recomendada, es para ser aplicada sobre la tapia perimetral ubicada dentro de la zona de protección, no así en cuanto al puente privado, el cual es el único acceso que tienen los expedientados a su propiedad, de lo contrario la finca sería inutilizable y perdería su valor de mercado, convirtiendo a las limitaciones impuestas en expropiatorias." (folios 27 a 40).
  • 5)Mediante resolución N°AMH-0041-10 de las 15:40 horas del 14 de enero del 2011, el Alcalde Municipal de Heredia dictó el acto final del procedimiento. Tuvo por probado que dentro del área de protección del Río Quebrada Seca, ubicada en el inmueble de los señores Nombre103162 y Nombre103163, existe una tapia perimetral construida sin permisos de construcción. El Por Tanto de la citada resolución dispuso así: "1. Procedan los expedientados (sic) Nombre103163 y Nombre103162 , a la demolición de la tapia perimetral que se extiende a lo largo de los 55.27 m lineales que componen el lindero oeste de su propiedad número 04-94458-001 y 002, el cual colinda con la Quebrada Seca; lo anterior con la finalidad de ajustar la realidad física a las prescripciones legales del ordenamiento jurídico vigente, en razón de hacer valer el derecho fundamental a un ambiente sano y ecológicamente equilibrado de los administrados en general, lo cual incluye el peligro inminente de la vida y el patrimonio de los munícipes que viven en los alrededores de la cuenca hidrográfica Quebrada Seca. 2. En este caso, con motivo que es consciente en la función de protección que desempeña la tapia construida, se concede un plazo prudencial de dos meses para que los expedientados (sic) puedan construir otra tapia o mecanismo de seguridad (fuera de la zona de protección del río) luego de cumplido el plazo otorgado, en caso de renuencia por parte de los administrados de cumplir con la orden de demolición dentro del plazo concedido al efecto, procederá la Municipalidad de Heredia a la ejecución sustitutiva de la demolición de las construcciones ubicadas dentro de la zona de protección del río Quebrada Seca en la finca propiedad de los expedientados (sic), con la finalidad de ajustar a la realidad física a las prescripciones legales del ordenamiento jurídico vigente. 3. La demolición ordenada procede únicamente sobre la tapia perimetral ubicada dentro de la zona de protección, no así en cuanto al puente privado, el cual es el único acceso que tienen los expedientados (sic) a su propiedad, de lo contrario la finca sería inutilizable y perdería su valor de mercado, convirtiendo a las limitaciones impuestas en expropiatorias. 4. La presente resolución posee los recursos de revocatoria con apelación en subsidio, conforme a los plazos y términos dispuestos en el artículo 162 del Código Municipal." (folios 42 a 53).
  • 6)El 7 de febrero del 2010, los señores Nombre103162 y Nombre103163 presentaron recurso de revocatoria con apelación en subsidio contra la decisión indicada en el hecho anterior (folios 55 a 61).
  • 7)Por resolución N°AMH-0192-2011, de las 9:30 horas del 22 de febrero del 2011, el Alcalde Municipal rechazó el recurso de revocatoria y elevó la apelación ante este Tribunal (folios 62 a 65).

II.Hechos no probados.- De importancia para la resolución de este asunto, se tiene como no acreditado lo siguiente: 1) Que la tapia frontal de la finca propiedad de los señores Nombre103162 y Nombre103163 cuente con permiso de construcción (los autos). 2) La afectación del 50% de la propiedad de los recurrentes, de someterse a la normativa urbano ambiental (los autos). 3) Que exista estudio técnico que recomiende entubamiento del Río Quebrada Seca (los autos).

III.Agravios de los apelantes.- Los señores Nombre103162 y Nombre103163 , apelan la decisión del Alcalde de Heredia, con base en los siguientes motivos de inconformidad: señalan que hace quince años decidieron hacer una tapia para protección de las aguas de la Quebrada Seca. Argumentan que la decisión de la Municipalidad del derribo de la tapia afecta su derecho de propiedad por varias razones: del total de la propiedad perderían casi el 50% del terreno, al ser una porción de tierra de la cual no pueden disponer de ninguna manera; perderían la protección a su integridad y los bienes al no poder cerrar con construcción; si respetan los diez metros de protección le entregarían esa franja de terreno a todo el que quiera circular por esa zona sin poder restringir el paso por ella; si eliminan la tapia seguirían sufriendo lavado del terreno; por la topografía del terreno no se presta para construir una nueva tapia; la casa si obtuvo permiso de construcción en su momento y habría que quitar parte de ella; al estar sin protección las aguas correrían libremente e inundarían la propiedad, poniendo en riesgo su vida y su patrimonio, siendo ése su única vía de escape en caso de inundación; no existe estudio que determine que los 53 metros de frente de su propiedad sea la que produzca los desbordamientos; la cuenca es suficiente y prueba de ello es que en abundantes lluvias son los puentes los que causan desbordamientos, por lo que quitar la tapia no resuelve el problema.

Alega que el muro de contención ha impedido la erosión y el traslado de material por el cauce de la quebrada. Afirma que la realización de un estudio podría haber determinado la viabilidad de entubar la quebrada y así evitar perjuicio a las personas afectadas.

IV.Sobre el fondo.- Luego de revisar los autos y el recurso interpuesto, estima este Tribunal que el acto impugnado debe ser confirmado.- El artículo 33 de la Ley Forestal constituye una limitación legal a la propiedad privada, conforme lo exige el artículo 45 de la Constitución Política, que dispone que por motivos de necesidad pública podrá la Asamblea Legislativa mediante el voto de dos tercios de la totalidad de sus miembros, imponer a la propiedad limitaciones de interés social. Así el numeral 33 referido señala, en lo que aquí interesa: "Áreas de protección. Se declaran áreas de protección las siguientes: ... b) Una franja de quince metros en zona rural y diez metros en zona urbana, medidas horizontalmente a ambos lados, en las riberas de los ríos, quebradas o arroyos, si el terreno es plano, y de cincuenta metros horizontales, si el terreno es quebrado." (la negrita es suplida). Sobre el tema de las limitaciones a la propiedad privada, la Sala Constitucional en la resolución N°4205-96, de las 14:33 horas del 20 de agosto de 1996, dijo lo siguiente:

"(...) Una concepción del derecho de propiedad privada en términos absolutos y prácticamente ilimitados, pasó a constituir el punto de apoyo básico sobre el cual se estableció el sistema occidental, consagrándose como centro básico del ordenamiento jurídico la completa intangibilidad del derecho de propiedad, por cuanto la misma implicaba el completo señorío sobre el bien, de manera absoluta, general, independiente, plena, universal, ilimitada y exclusiva. Sin embargo, tal concepto ha evolucionado, hasta llegar a proponerse la defensa de una propiedad basada en la armonía social, y por un sentido social de la propiedad de la tierra. Se modifica así la base jurídica sobre la que descansa la protección de la propiedad y de ser un derecho exclusivo para el individuo, pasa a corresponderle una obligación en favor de la armónica convivencia de la sociedad. Surgió la idea de la "función social" de la propiedad, en la que todo individuo tiene la obligación de cumplir ciertas obligaciones comunales, en razón directa del lugar que ocupa y de los intereses del grupo social que lo representa. El contenido de esta "propiedad-función", consiste en que el propietario tiene el poder de emplear el bien objeto del dominio en la satisfacción de sus propias necesidades, pero correspondiéndole el deber de ponerla también al servicio de las necesidades sociales cuando tal comportamiento sea imprescindible.

Con este nuevo concepto se ensanchan las atribuciones del legislador para determinar el contenido del derecho de propiedad, lo que se logra por medio de los límites y obligaciones de interés social que pueda crear, poniendo fin a su sentido exclusivo, sagrado e inviolable. Esta tesis ha sido reconocida por este Tribunal con anterioridad; así, en sentencia de amparo número 5097-93, indicó: "I.) La inviolabilidad de la propiedad privada es una garantía de rango constitucional recogida por el canon 45 de la Carta Política. Este derecho contrariamente a como se le concebía en otros tiempos, no es de naturaleza estática, sino que conforme a las exigencias de nuestro tiempo se le ha de considerar elástico y dinámico, esto es, que atribuye a sus titulares, tanto interna como externamente las facultades, deberes y limitaciones. El poder del propietario sobre la propiedad está determinado por la función que ésta cumpla.

El objeto del derecho de propiedad ha sufrido transformaciones importantes. Actualmente, no sólo es tutelable el derecho de los propietarios, sino también diversos intereses generales o sociales que coexisten con aquél. El derecho objetivo enmarca del contenido de los derechos subjetivos. Cada objeto de derecho implica una peculiar forma de apropiación. Así por ejemplo las facultades del dominio relativas a un fundo agrícola son muy distintas de las correspondientes a una finca ubicada en el sector urbano de intensa utilización".

Asimimo, se integra, junto con este principio -de la función social de la propiedad- el de solidaridad social, del cual, como indicó este Tribunal Constitucional con anterioridad, "IV.- [...], está imbuida nuestra Constitución Política, permite el gravamen soportado por todos en favor de todos, o inclusive de unos pocos en favor de muchos, con el requisito de que el uso natural del bien inmueble no sea afectado al límite de su valor como medio de producción, o de su valor en el mercado, esto es, que desaparezca como identidad productible". (Sentencia número 2345-96, de las nueve horas veinticuatro minutos del diecisiete de mayo del año en curso.)

Cabe señalar que en casi todas las legislaciones ha desaparecido el concepto de derecho de propiedad privada concebido en forma ilimitada y absoluta, y en los más importantes órdenes se impone cada vez con más fuerza, una concepción de la propiedad estrechamente ligada a las exigencias generales de la sociedad; tal y como lo señaló con anterioridad esta Sala en la citada sentencia número 2345-96: "Desarrollando el concepto de "privación de un atributo primario del dominio" que impide el goce de los bienes, podemos decir que la limitación es un método para definir el contenido del o el ejercicio del derecho de propiedad, que califica y afecta el derecho en sí mismo".

VI. El artículo 45 de la Constitución Política consagra, en nuestro orden jurídico-constitucional, el derecho de propiedad

En el párrafo primero señala su carácter de "inviolable" y establece la obligación por parte del Estado de indemnizar al propietario previamente, cuando deba suprimirla por razones de "interés público legalmente comprobado". En el párrafo segundo establece la posibilidad de establecer limitaciones de interés social a la propiedad, mediante ley aprobada por votación calificada -votación de los dos tercios de la totalidad de los miembros de la Asamblea Legislativa-. De lo anterior, queda claro que la obligación de indemnizar por parte del Estado, está constitucionalmente prevista única y exclusivamente cuando se trata de expropiar y no rige para las limitaciones de interés social que se establezcan mediante ley aprobada por votación calificada, en los términos que ya señaló con anterioridad este Tribunal Constitucional en sentencia de amparo número 5097-93 "II.) La legislación costarricense establece la posibilidad de que mediante planes reguladores, por interés social la propiedad privada pueda ser limitada y el Derecho Urbanístico puede a su vez, desarrollarlas.

El derecho de propiedad se enmarca entonces, dentro de ciertos límites razonables, dentro de los deberes que de él se derivan. Precisamente por ello, no es necesaria la indemnización de los límites y deberes urbanísticos que resulten razonables [...]_ Se aclara, que las limitaciones o restricciones a la propiedad son de carácter general, y tienen la virtud de dotar al individuo de los instrumentos necesarios para paliar los efectos de la actividad perjudicial de sus congéneres. Cabe señalar que tienen como finalidad u objetivo principal el uso racional de la propiedad, con lo que se benefician los vecinos o, en general, toda la sociedad. En este sentido la Corte Plena, cuando ejerció funciones de contralor de constitucionalidad, en sesión extraordinaria del dieciséis de junio de mil novecientos ochenta y tres, señaló: "Las limitaciones -o límites- que es posible imponer a la propiedad (aparte de las relaciones de vecindad y a otros deberes o cargas de que se ocupan el Código Civil y leyes especiales), son las de "interés social" que autoriza el párrafo segundo del artículo 45 de la Constitución y que están dirigidas a proteger intereses de ese género, en beneficio de la sociedad entera o de algunas de sus comunidades; [...]"

VII.Ciertas limitaciones a la propiedad han existido siempre como reglas incorporadas al Código Civil, como por ejemplo las que se refrieren a la posesión y transmisión de inmuebles -artículo 272-, en virtud de las que se impide la división en caso de copropiedad; las referidas a la altura de las aceras -artículo 303-; las que establecen la protección por los posibles daños causados a terceros por el mal estado de las edificaciones o árboles -artículo 311-; y en especial todo el título V llamado de las Cargas o Limitaciones a la Propiedad Impuestas por Ley, en el que se fijan, entre otras, las prohibiciones de construir cerca de pared medianera, pozos, cloacas, acueductos, etc., -artículo 404-, las que prohíben abrir ventana o claraboya en pared divisoria, a menos de dos metros y medio por lo menos -artículo 406-, o que den vista a habitaciones, patios o corrales del predio vecino -artículo 407-.

Otros ejemplos de lo anterior lo constituyen las exigencias de seguridad y salubridad públicas, las recogidas en la ley que permitan a la autoridad imponer al propietario reparaciones, remodelaciones o demoliciones de edificaciones que amenacen ruina o resulten insalubres, disposiciones recogidas principalmente en el Código Civil y en la Ley General de Salud. En este orden de ideas, también deben citarse las leyes referentes a la protección de bosques, bellezas naturales, patrimonio cultural y monumentos, que también implican limitaciones la propiedad, como la Ley Forestal, No. 7174 de veintiocho de junio de mil novecientos noventa, Ley de la Conservación de la Vida Silvestre No. 7317, del veintiuno de octubre de mil novecientos noventa y dos, y Ley de Patrimonio Histórico, Arquitectónico y Cultural No. 4, de octubre de mil novecientos noventa y cinco. (...)"

En el caso concreto, los recurrentes no controvierten el hecho de que la tapia se ubica en su propiedad dentro de la zona de protección del río Quebrada Seca, como tampoco han logrado acreditar que la Municipalidad les haya otorgado permiso de construcción para levantar dicha obra. Lo que aducen son razones de seguridad para mantenerla en ese lugar, sin que hayan logrado acreditar la existencia del aparente estudio que recomienda la posibilidad de entubar la cuenca, tal y como lo proponen los apelantes. Es importante recordar que el área de protección fue regulada con el objetivo de impedir a los dueños de los inmuebles talar o disminuir la cobertura boscosa, con el propósito de evitar inundaciones, al tiempo que también se pretende evitar la contaminación de los recursos hídricos como consecuencia de la caída de las aguas de escorrentía. De manera que bien hizo la Municipalidad de Heredia en levantar un procedimiento para determinar la existencia de construcciones ilegales en las zonas de protección del río Quebrada Seca y hacer cumplir la legislación ambiental en su rigor, labor que es de suyo inherente a los gobiernos locales como entes rectores del control urbanístico y ambiental a nivel local, conforme a los artículos 169 y 50 de la Constitución Política.

V.Finalmente, no podemos dejar de señalar que la Ley Forestal claramente dispone que no procede la indemnización de las construcciones ilegales que se hayan levantado como consecuencia de la invasión de la zona de protección (artículo 58). Sin embargo, debe recordarse que la limitación al derecho de propiedad no puede llegar a ser de tal magnitud o intensidad que torne imposible disponer normalmente del inmueble, vaciando de contenido los atributos del dominio, pues en tal caso, se convierte en una privación del bien que exige su justa indemnización. Al respecto, conviene transcribir lo dicho por la Sala Constitucional en el voto de cita, en el siguiente sentido:

"(...) VIII. No obstante lo señalado en los considerandos anteriores, debe advertirse que las limitaciones legítimas que puedan imponerse a la propiedad privada encuentran su frontera natural en el grado de afectación a la propiedad; esto es, cuando la restricción al derecho de propiedad se convierte en una verdadera expropiación con la consecuente obligación de indemnizar, porque se hace desaparecer completamente el derecho de propiedad, o cuando no se afecte a la generalidad de la colectividad. Así lo señaló la Corte Plena en relación con las limitaciones a imponer a la propiedad cuando traspasan el límite señalado, en sesión extraordinaria del dieciséis de junio de mil novecientos ochenta y tres: "[...] es decir "limitaciones" como las llama el artículo 45, pero no despojo de la propiedad privada ni privación de un atributo primario del dominio, porque impedir el goce de los bienes equivale, al menos en este caso, a una forma de expropiación sin el requisito de previa indemnización que ordena la carta política";

y como lo indicó este Tribunal en las citadas sentencias número 5097-93 y 2345-96; en que señaló:

"IV.) Para la Sala los límites razonables que el Estado puede imponer a la propiedad privada, de acuerdo con su naturaleza, son constitucionalmente posibles en tanto no vacíen su contenido. Cuando ello ocurre deja de ser ya una limitación razonable para convertirse en una privación del derecho mismo".

(Sentencia número 5097-93); "Es decir, pueden limitarse los atributos de la propiedad, en tanto el propietario reserve para sí la posibilidad de explotar normalmente el bien, excluida claro está, la parte o la función afectada por la limitación impuesta por el Estado.

Fuera de estos parámetros, si el bienestar social exige sacrificios de uno o de algunos únicamente, debe ser indemnizado, lo mismo que ocurre cuando el sacrificio que se impone al propietario es de tal identidad, que lo hace perder en su totalidad el bien. Así, la limitación a la propiedad resiste el análisis constitucional, cuando la afectación a los atributos esenciales de la propiedad que son aquellos que permiten el uso natural de la cosa dentro de la realidad socio-económica actual, no hace desaparecer la naturaleza del bien o haga imposible el uso de la cosa, porque el Estado imponga requisitos de autorización o de aprobación tan complejos que impliquen de hecho, la imposibilidad de usufructuar el bien". (sentencia número 2345-96); (...)"

VI.Así las cosas, procede rechazar el recurso de apelación interpuesto y confirmar el acto impugnado, dando por agotada la vía administrativa.

POR TANTO

Se confirma la resolución de las 15:40 horas del 14 de enero del 2011, dictada por el Alcalde Municipal de Heredia. Se da por agotada la vía administrativa.
