APPEAL OF JUDGMENT (RECURSO DE APELACIÓN DE SENTENCIA) filed in these proceedings brought against [Nombre1], a United States citizen, of legal age, CED1, and [Nombre2], of legal age, CED2, for the offense of unlawful occupation (USURPACIÓN), to the detriment of [Nombre3]. Judges [Nombre4], Ligia Arias Alegría, and María Gabriela Rodríguez Morales participate in deciding the appeal. Appearing in the appeal are Ms. [Nombre3], administrator of the Refugio de Fauna Silvestre and legal representative of [Nombre5].; attorney [Nombre6], legal representative of Ms. [Nombre3]; attorney [Nombre7], representative of the Ministerio Público; and attorney [Nombre8], Criminal State Attorney (Procurador Penal).

BACKGROUND (RESULTANDO):

  1. 1By Judgment No. 47-2012, issued at ten a.m. on June twenty-first, two thousand twelve, the Tribunal de Juicio de Aguirre y Parrita ruled: “POR TANTO: In view of the foregoing, Articles 31 and 41 of the Constitución Política; Articles 1 through 15, 111 through 115, 130, 142, 265 through 267, and 341 through 366 of the Código Procesal Penal; and Articles 1, 2, 4, 11, 30, 31, 45, and 225 of the Código Penal, the Court rules as follows: [Nombre1] AND E are ACQUITTED of all punishment and liability for the offense of unlawful occupation that has been charged against them to the detriment of [Nombre3]. The procedural costs (costas del proceso) shall be borne by the State. The civil action for damages (Acción Civil Resarcitoria) brought by Ms. [Nombre3] against defendants [Nombre2] and [Nombre1] is denied, with no special award of costs. It is not appropriate for the Court to rule on the defense attorneys’ allegation of a false accusation (Denuncia Calumniosa); that matter shall be for the Prosecutor’s Office to address or, otherwise, for the defendants or their attorneys to pursue on their own initiative. Any precautionary measures (medidas cautelares) ordered against the defendants, if any, shall cease immediately. Once this judgment becomes final, remove this matter from the docket and archive the case file. Notice shall be given by reading” (sic).
  2. 2Ms. [Nombre3], administrator of the Refugio de Fauna Silvestre and legal representative of [Nombre5]., filed an appeal against the foregoing decision.
  3. 3After the corresponding deliberation was conducted in accordance with Article 465 of the Código Procesal Penal, the Court proceeded to hear the appeal.
  4. 4The relevant legal requirements have been observed in the proceedings.

Appellate Judge [Nombre9] drafts the decision; and, CONSIDERING (CONSIDERANDO):

I.By a filing submitted on July 27, 2012, Ms. [Nombre3], in her personal capacity, as administrator of the Refugio de Fauna Silvestre Portalón and legal representative of [Nombre5]. and [Nombre10]., filed an Appeal of Judgment against Decision No. 47-TJPAP-12, issued by the Tribunal de Juicio de Puntarenas, Aguirre y Parrita seat, at ten a.m. on June twenty-first, two thousand twelve.

II.Pursuant to Article 463 of the Código Procesal Penal, the parties were summoned to a hearing (vista), which was held at 13:30 on April 16, 2013, with Judges Ligia Arias Alegría, María Gabriela Rodríguez Morales, and [Nombre4] participating. No evidence was taken and the arguments on appeal were not expanded during that hearing. Ms. [Nombre3] stated: “Attorneys [Nombre11] and [Nombre12] manipulate matters to suit themselves; both are lying. There are two survey plans (planos) in the evidentiary file that they did not want to obtain. It is not true that the road existed; according to the Aguirre cantonal road-network plan and the 1980 plan, both show that the road does not exist. The municipal minutes refer to another road belonging to another gentleman, on another part of the property, and not the road that they unlawfully opened. The refuge is solely for conservation.”

III.In accordance with the ruling in judgment 2013-088 of 13:28 hours on 18 de febrero del 2013, issued by this same Criminal Judgment Appeals Court, the appeal filed against judgment number 47-TJPAP-12 of 10:00 hours on 21 de junio del 2012 of the Puntarenas Trial Court, Aguirre and Parrita seat, shall be reviewed and decided with respect to the first paragraph of the statement of facts in the charging document of the Public Prosecutor’s Office in case 03-200405-457-PE. First, the appellant recounts the “procedural history,” stating that this case began because of the illegal opening of a road between junio y julio del 2003, as a result of which, in mayo de 2005, through a third party, an electrical power line was installed at the site and land—not belonging to the donors—was donated to the Instituto Costarricense de Electricidad. She subsequently refers to the settlement agreement (acuerdo conciliatorio) reached in cases 05-200699-457-PE and 05-201400-457-PE, as well as evidence gathered in both cases which, in her view, confirms the existence of acts of interference affecting Refugio Portalón, perpetuated for more than 9 years.

In what may be regarded as the first ground of appeal, the appellant states that the trial judge made an unduly lenient assessment of the admitted evidence, which could conclusively establish that the defendants “by mutual agreement, with full control over the act, violently and through threats, clandestinely, without the legally required permits, and abusing a position of trust, opened a road in a Protected Wilderness Area because it is a Wildlife Refuge” (sic, folio 2073), thereby committing the offense of unlawful occupation (usurpación). She additionally states that, during a trial that had previously been annulled, evidence had been collected to prove the facts, but at this new trial it was not offered by the Public Prosecutor’s Office, even though the representative of the aggrieved corporation had requested that the prosecuting authority do so. Had this evidence been introduced into the adversarial proceedings and assessed by the trial judge, the outcome would have been different.

She requests that the challenged judgment and the trial preceding it be annulled and that the case be remanded for new proceedings. In what is understood to be a second ground of appeal, entitled “analysis of the documentary evidence admitted in these proceedings,” the appellant reviews the documentary evidence that, she states, was admitted in the proceedings: 1. The visual inspection report at folios 21 to 23, from which she transcribes several excerpts and challenges E’s statements contained therein, noting that the positive administrative silence (silencio positivo) mentioned by that defendant does not operate under administrative law in the case of permits or applications that fail to satisfy the fundamental requirements. 2. She states that official communication ACOPAC-OSRAP-452 dated 30 de junio de 2003 establishes that a road was built on the left bank of the “Fría” stream, affecting the forest and the protected zone (zona de protección).

It also contains a statement by [Nombre13], an MINAE official, who said that previously there had only been a trail for horseback travel. 3. She asserts that the report of the Consejo Municipal de Aguirre of 11 de julio de 2003, as well as the minutes at folio 14, establish that [Nombre1] built the road without permission from the Municipalidad de Aguirre. They further establish that there is no public road in Refugio de Vida Silvestre Portalón, nor has that entity formally declared one. 4. The municipal certification at folios 60 and 61 describes the requirements that [Nombre14]. and [Nombre1]. failed to satisfy, which resulted in the denial of permits to build the road. 5. According to the certification appearing at folio 40, it is established that the Municipalidad de Aguirre denied the application submitted by [Nombre15] to build a public road in the name of [Nombre14]. in Refugio Portalón. 6.

Likewise, the certification at folio 59 demonstrates that the procedures undertaken by [Nombre14]. and engineer [Nombre15] are incomplete. 7. The municipal notice at folios 15 to 17 demonstrates that [Nombre15] was notified of the denial of his application. 8. According to the copy of the municipal minutes at folio 123 and the document containing a list of residents’ signatures at folios 146 to 153, the road opened in 1978 leads toward the community of Monterrey, which is located in a completely different direction from the properties of [Nombre14]. 9. The certification of cantonal routes in Aguirre, appearing at folios 559 to 561, does not include the road opened by the defendants toward the properties of [Nombre14].; it includes only the route known as Portalón-Mata de Café, which crosses Refugio Portalón toward Monterrey, a town abandoned by its inhabitants many years ago. 10. According to a report issued by [Nombre3] (contained in expediente 05-200699-457-PE), [Dirección1] road derives its name from properties located on the eastern side of the [Dirección2] river, not the western side as the defendants claim, and it is the same road as Portalón-Monterrey. 11.

The appeal then analyzes the expert report (peritaje) of engineer [Nombre13] (folios 528 to 539), with the appellant emphasizing the respects in which the expert disagrees with the expert report submitted by the defendants, as well as the conclusions reached by engineer [Nombre16], to the effect that the road built by the accused is not the same road known as Pasito-Portalón and that the plans submitted as defense evidence contain false information, all of which was duly reported to the trial prosecutor. As a third ground of appeal, entitled “analysis of the expert reports submitted by the defendants,” the appellant assesses that evidence. As her first criticism, she states that the two expert reports fail to assess the existence of the declaration designating the property at issue in these proceedings as a wildlife refuge, despite the presence at its entrance of a [Placa1] indicating such designation.

She then specifically challenges each expert report, stating: 1. Regarding the expert assessment by surveyor A, she first alleges that the visit to the administrator of Refugio Portalón recorded in his report did not occur. She then compares it with the report prepared by [Nombre13] (previously mentioned), emphasizing the contradictions between them. Finally, she criticizes the expert’s failure to analyze documentation material to determining that the road opened by the defendants and the road that actually existed in the area are different. 2. The report of [Nombre17] (folios 266 to 268). The appellant asserts that this document sharply conflicts with other assessments conducted by officials of the Ministerio de Ambiente y Energía and the Organismo de Investigación Judicial and, moreover, is based on E’s statement that permits had been obtained from the Municipalidad de Aguirre to perform the work, which is false.

She requests that “those expert assessments and reports be disregarded because they do not conform to the truth and are inconsistent with the MINAE reports and the expert assessments of Poder Judicial experts, which state precisely the opposite...” (folio 2109). In the section entitled “regarding the defendants’ testimonial evidence,” understood as the fourth ground of appeal, the appellant individually analyzes the defense testimony received at trial, asserting that [Nombre18], [Nombre3], [Nombre19], and [Nombre13] lied under oath to favor the defendants because those witnesses know the area very well and could not possibly have confused the directions of the roads at issue—the road leading to Monterrey and the road leading toward the properties of [Nombre14].—which are located in different places. She requests that “the statements made by the defendants’ witnesses in the courtroom be rejected as spurious and that proceedings be brought against them for perjury and for failing to tell the truth under oath” (sic, folio 2116).

Similarly, in the fifth ground of appeal, the appellant analyzes the testimonial evidence “of Refugio de Fauna Silvestre Portalón,” alleging that: 1. At trial, Mr. [Nombre13], an official of the Ministerio de Ambiente y Energía, changed the account he had maintained throughout the proceedings and in the various documents contained in the case file, such as official communication ACOPAC-OSRAP-452 of 30 de junio del 2003, a statement contained in expediente 05-201400-457-PE, and report ASOPAC-OSRAP 388-05 of 25 de mayo de 2005 appearing in expediente 05-200699-457-PE. 2. At trial, [Nombre1] provided an account substantially different from what he himself stated in report ACOPAC-OSRAP 1227-05, as well as from the statements of other officials from Setena and the Ministerio de Ambiente y Energía. Specifically, she emphasizes that the witness minimizes the consequences of what occurred, even though his report describes extensive damage in the area.

She requests “...that the evidence presented, and the new evidence produced at the trial that was annulled in this same case, insofar as applicable, may be used by the Appeals Court to confront MINAE witnesses [Nombre13] and [Nombre1], so that the reason for the discrepancy between their reports and their courtroom testimony concerning the reported facts may be clarified.” (sic, folio 2120). In what is understood to be a sixth ground of challenge, entitled “regarding the judge’s analysis in the judgment of the statutory elements of the offense (tipo penal) pursuant to artículo 225 del Código Penal,” Ms. [Nombre3] states that, according to the judgment, the trial judge found that the alleged conduct did not satisfy the elements required to constitute the offense of unlawful occupation. After transcribing artículo 225 del Código Penal, she states that—in this specific case—there was “violence against property” (folio 2121), because private property was violated and the land that its owners had set aside for the conservation of natural resources was destroyed through the destruction of trees, pollution, and harm to the quebrada Fría watershed.

There was violence against persons because, on 14 de junio de 2003, E slapped her, breaking her prescription glasses, and also emotionally assaulted her with words and obscene gestures, causing her to become unable to carry out her daily activities because of fear. She was likewise physically and verbally assaulted, intimidated, and threatened by [Nombre18], a partner of [Nombre1] and attorney-in-fact (apoderado) for [Nombre14]. She also considers that there was deception because the defendants fraudulently opened a road without permits from the Ministerio de Ambiente y Energía. [Nombre1] ordered the preparation of plans containing false information—with respect to the property boundaries (colindancias)—in order to deceive the Catastro Nacional authorities, open a road on property that did not belong to them, and conceal their unlawful act. She bases the abuse of trust (abuso de confianza) on the defendants’ opening of the road despite knowing that they lacked permits from the Ministerio de Ambiente y Energía, the administration of Refugio de Fauna Silvestre Portalón, and the Municipalidad.

Finally, she states that there was clandestinity (clandestinidad) because the road began to be opened from the defendants’ property, across an area that did belong to them and toward Refugio Portalón, in an effort to prevent the latter’s representatives from learning of the work until it was nearly completed. She requests that “the challenged judgment and the trial supporting it be declared null, ineffective, and nonexistent, and that the case be remanded for new proceedings.” (sic, folio 2124). VI.

As a sixth ground of the appeal, the appellant states, in the section entitled “on the procedure for opening roads or carrying out any work in a protected wildlife area (área silvestre protegida),” that, at the location where the road referred to by the defendants as Portalón-Carmona was opened, the respective permits could be granted only by the National System of Conservation Areas (Sistema Nacional de Áreas de Conservación), through the Central Pacific Conservation Area (Área de Conservación Pacífico Central), and the accused did not have such permits. Likewise, even assuming hypothetically that such permits could have been granted by the Municipalidad de Aguirre, the defendants did not comply with the municipal requirements for obtaining them; therefore, they acted with knowledge of the illegality they were committing. As a seventh ground, the appellant states that the judgment does not faithfully transcribe her participation at trial, nor does it include the portion of [Nombre20]’s testimony in which he stated that, when he worked in the area, he slept at [Nombre2]’s residence.

In the final section, constituting the eighth ground and entitled “explanatory hypothesis of the factual circumstances surrounding the defendants’ conduct,” the appellant states that—in her opinion—the defendants’ actions were not due to their mistakenly confusing one road with another, but rather constituted an intentional criminal plan. She considers it improbable that both the defendant [Nombre2] and the witnesses heard at trial could have been mistaken, given that they are all residents of the area. She even asserts that [Nombre1]’s testimony at trial shows that he knew that the road to Monterrey runs in the direction opposite to that of the illegally opened road. In view of the manner in which this appeal is resolved, the stated grounds of appeal are considered together. THE APPEAL IS DENIED. This Chamber for Appeals of Judgments (Cámara de Apelación de Sentencia) has examined in detail the appeal filed by the appellant, the challenged judgment, and the charging instrument (pieza acusatoria), and has determined that the claim must be dismissed for the reasons explained below.

As may be observed, the appeal filed by Ms. [Nombre3], in her capacity as civil plaintiff (actora civil) in these proceedings—which is the status granting her standing to do so—is directed solely at challenging the criminal aspects of the contested decision, objecting only to the acquittal (absolutoria) entered by the Trial Court in favor of the accused, without raising any challenge concerning the civil aspects or referring to the manner in which that acquittal affected her monetary claims. In this regard, Article 116 of the Code of Criminal Procedure (Código Procesal Penal) provides that “the civil plaintiff may appeal decisions only insofar as they concern the action brought by her.” It is clear and undeniable from this provision that the civil plaintiff may exercise the right to appeal a decision she considers adverse to her interests, and it has even been accepted that she may challenge those criminal aspects she considers necessary, insofar as they are also detrimental to the pursuit of her civil action (acción civil).

Therefore, when appeals filed by the civil plaintiff are unrelated to her action, they are inadmissible. Both this Criminal Judgment Appeals Court (Tribunal de Apelación de Sentencia Penal)—acting as a Criminal Cassation Court (Tribunal de Casación Penal)—and the Third Chamber of the Supreme Court of Justice (Sala Tercera de la Corte Suprema de Justicia) have ruled to the same effect. Thus, the former stated in decision 2008-263, at 13:00 hours on 12 de junio de 2008: “For the reasons set forth below, and because she lacks any interest whatsoever, the challenge brought by the civil plaintiff is denied... pursuant to Article 424 of the Procedural Code (which, as a general rule governing appeals, establishes the requirement that the appellant demonstrate the existence of prejudice), the appellant would lack any standing to bring her claim, because technically she does not demonstrate (or even mention) that the criminal acquittal caused her any legally cognizable harm with respect to her property interests, which are themselves private and personal in nature.

In this regard, under the prior criminal procedural legislation (which was not modified on this point by the current Code), the case law of the Third Chamber has held that an appeal by a civil plaintiff, whenever necessary to obtain satisfaction of her interest, may modify the criminal aspect of the decision even if the Public Prosecutor’s Office did not appeal (cf. decision Nº 727-F-96, at 10:25 hours on 22 de noviembre de 1996). These cassation judges share that view. It must be emphasized, however, that the appeal under consideration is directed solely at challenging the criminal acquittal of the accused, without linking that disagreement to the need to obtain, through annulment of the decision, the possible satisfaction of her monetary interest. To the same effect, the following additional decisions of the Third Chamber of the Supreme Court of Justice may also be consulted: N° 144- F-94, at 10:05 hours on 13 de mayo de 1994; and N° 260-F-93, at 16:07 hours on 7 de junio de 1993....” For its part, in decision [Telf1], at 10:06 hours on 21 de octubre de 2011, the Third Chamber of the Supreme Court of Justice stated: “I. […] It is important to note that Article 116 of the Code of Criminal Procedure provides, insofar as relevant, that: ‘...the civil plaintiff may appeal decisions only insofar as they concern the action brought by her....’ These circumstances clearly include all elements that may be understood as the cause of harm for which compensation is due, and not merely those arising from the commission of an offense.

In this regard, while the Code of Criminal Procedure of 1973 (Código de Procedimientos Penales) remained in force, the Constitutional Chamber (Sala Constitucional) stated: ‘...The restriction imposed by Article 450 of the Code of Criminal Procedure of 1973 on the civil plaintiff’s right to appeal dismissal or acquittal judgments (sentencias de sobreseimiento o absolutorias), by making such action dependent upon that of the Public Prosecutor’s Office, is declared null and void; accordingly, the provision shall read as follows: The civil plaintiff may appeal decisions only insofar as they concern the action brought by her. This judgment shall have declaratory and retroactive effect as of primero de julio de mil novecientos setenta y cinco, the date on which the Code of Criminal Procedure of 1973 entered into force; consequently, any civil plaintiff whose right to appeal dismissal or acquittal judgments was denied through application of the provision now declared unconstitutional may once again file the corresponding appeal within the period specified therein for that purpose...’ (Constitutional Chamber, Voto 5751-93, at 2:39 hours on 9 de noviembre de 1993).

Notwithstanding the foregoing, this does not mean that the civil plaintiff may assume the function of the Public Prosecutor’s Office with respect to the prosecution of the criminal action (acción penal), as that function is legally assigned by Article 16 of the Code of Criminal Procedure, which expressly provides that: ‘...when it is public, its prosecution shall be the responsibility of the Public Prosecutor’s Office, without prejudice to the participation granted by this Code to the victim or to citizens....’ Following this reasoning, it may be observed that the claim raised by the representative of the ‘Civil’ Civil Defense of the Victim (Defensa Civil de la Víctima) is limited solely to challenging matters intrinsic to the criminal decision, without any indication that the Judges overlooked any basis giving rise to civil liability other than the criminal action resulting in the acquittal endorsed by the prosecuting authority, which did not file a cassation appeal in that regard.

Under this approach, although it is true that the civil plaintiff must be recognized as having the power to appeal despite the entry of an acquittal, that power cannot override the functions of the body charged with prosecuting the criminal action; rather, that power is contemplated for cases in which some form of non-contractual liability (responsabilidad extracontractual) remains that is distinct from any liability arising from a criminal act.” The case under review presents a situation similar to those addressed in both decisions, in which the Public Prosecutor’s Office decided, in its closing arguments, to request an acquittal and therefore did not appeal the decision granting its request. Moreover, in the appeal filed, the civil plaintiff does not even mention any disagreement with the ruling on the civil action she brought, an aspect that has by now become final because it was not challenged.

For the foregoing reasons, the challenge must be denied. Nevertheless, having conducted a comprehensive review of the challenged judgment, it is appropriate to note that, although the contested decision contains a defect consisting of inadequate analytical reasoning (falta de fundamentación intelectiva), because the trial judge (Juez a quo) does not analyze the documentary evidence, merely listing it without assessing it, comparing it with the testimonial evidence, or providing any reasoning concerning it, this defect would not be sufficient in the present case to set aside the decision on appeal. This is because the acquittal entered by the Trial Court is based not only on the absence of evidence supporting the alleged facts, but also on the failure of the alleged factual circumstances to constitute an offense (atipicidad del cuadro fáctico imputado), and this Chamber of Judges finds the latter determination to be correct.

First, it should be recalled that, because a conciliation (conciliación) between the Procuraduría General de la República and the defendants was accepted with respect to matters related to environmental offenses, the trial that resulted in the challenged judgment concerned only the following facts alleged by the prosecuting authority: 1) On an unspecified date, but within the period from día dos de mayo to día veintisiete de junio del año dos mil tres, the defendants [Nombre2] and [Nombre1] ordered the construction of a gravel road (camino de lastre), through third parties of unknown identity whom they had hired for that purpose and who followed their orders, on the property identified by cadastral plan (plano catastrado) #358799-79, property number 21127-000, located in the Refugio de Vida Silvestre Portalón, Aguirre de Puntarenas, owned by Primera Compañía Unida de Desarrollo and represented by S, exercising acts of possession (actos de posesión) as though they owned the real property, permanently constructing a gravel road parallel to the property’s western boundary in order to travel continuously across that parcel, thereby dispossessing its lawful possessor of her possessory right.” (folios 388 and 389, tomo I), which are the same facts read by the prosecution at the opening of the trial.

As the trial judge noted, this account does not contain a clear, precise, and detailed description of the act attributed to the accused [Nombre2] and [Nombre1] that would allow their conduct to fall within the criminal offense of usurpation (usurpación), as provided in Article 225 of the Criminal Code (Código Penal); therefore, those alleged facts cannot support a conviction. Under the cited provision, there are three forms of usurpation: that committed through dispossession, invasion, or expulsion; that committed through alteration of boundary markers or boundaries; and that committed through disturbance of the possession or holding of real property. In the case under review, the offense most closely resembling the conduct alleged would be the one contemplated in the first subsection.

However, for the alleged facts to constitute this criminal offense, it is not enough to describe the operative conduct (verbo típico)—dispossessing, invading, remaining on the property, or expelling the occupants—because those actions must be carried out by specific means (violence, threats, deception, abuse of trust, or concealment), which constitute objective elements of the offense (elementos objetivos del tipo penal). Accordingly, those means must also be described—not merely mentioned—in the charging instrument (acusación), which did not occur in this case, where neither the statement of facts nor the remainder of the charging instrument contains any description indicating that any of these circumstances existed in the actions of the defendants (encartados). This deficiency in the charging instrument is what the trial judge considered in finding that the alleged facts did not constitute a criminal offense (eran atípicos) and that the defendants therefore had to be acquitted.

That conclusion was correct, because the noted lack of specificity, without explaining whether the conduct involved violence, deception, abuse of trust, or concealment, prevents the proper exercise of the right of defense (derecho de defensa), since the accused (imputados) had no opportunity to learn in advance the specific conduct for which punishment was sought. It is therefore essential that the prosecuting authority clearly describe the conduct carried out by the accused, including all the elements contemplated in the statutory definition of the offense (tipo penal), so that the court may determine whether it falls within a punitive provision (norma sancionatoria) and, moreover, so that the person charged may understand without impediment why punishment is being sought. The charging instrument, as formulated, does not satisfy the minimum requirements for attribution of the offense (requisitos mínimos de imputación), and at this stage of the proceedings this defect cannot be cured; the judgment of acquittal (sentencia absolutoria) entered in their favor must therefore be affirmed.

V.In what is construed as a fifth ground for challenge, entitled “Regarding the Representative of the Ministerio Público,” the appellant criticizes the conduct of the prosecutor who attended the trial, who—she claims—constantly sent and received text messages on her cell phone; did not allow the representative of the aggrieved company to tell her important details about the investigation and the evidence; did not offer relevant evidence despite the appellant’s request that she do so; and, much less, did she inform her of her intention to agree to conciliation (conciliación) in the other cases or that she was going to request a “dismissal” (sobreseimiento) in favor of the accused. Thus—in her view—the victim was left unprotected and without representation by the Ministerio Público. Finally, she alleges that, despite having informed the prosecutor of a potential ground for recusal (recusación) of the Trial Judge (because his son owed a debt to the attorney representing the civil action), the representative of the Ministerio Público disregarded the matter.

On the grounds of a violation of the victim’s fundamental procedural rights, she requests “that the challenged judgment and the trial on which it is based be declared null, nonexistent, and ineffective, and that the case be remanded and reheard.” (sic, folio 2127). THE GROUND IS DENIED. Although the appellant’s complaint could be considered a violation of her rights as a victim, in this case it is insufficient to vacate the judgment she is appealing. First, because her arguments did not even offer any evidence capable of establishing the existence of the alleged circumstances; the matter was not timely brought to the attention of the Trial Court; and, therefore, this Panel of Judges cannot verify the existence of any defect in the proceedings. The same applies to the potential ground for disqualification (inhibitoria) of the Trial Judge, which was raised incidentally in this section of the appeal.

These Judges find it particularly striking that, despite asserting the existence of a situation as serious as that described, the representative of the aggrieved company did not raise it during the trial or at the pretrial hearings, although she could have done so. It should be noted that, according to the hearing records contained in the principal case file, on 04 and 11 de junio de 2012, attorney [Nombre6] was present at the hearings during which the application of conciliation was discussed; the potential ground for disqualification directly concerned him because he was allegedly a creditor of a son of the Judge who presided over those hearings and the trial. Nevertheless, no objection regarding the matter was raised at those hearings or thereafter. In the appeal now under consideration, the appellant merely mentions the existence of that debt, but provides no details about it and does not substantiate it. Accordingly, this Court of Appeal likewise cannot verify the existence of any defect related to this complaint, and the ground must therefore be denied.

THEREFORE (POR TANTO):

The appeal filed by [Nombre3] is denied. NOTICE SHALL BE GIVEN.

RECURSO DE APELACIÓN DE SENTENCIA interpuesto en la presente causa seguida contra [Nombre1], estadounidense, mayor de edad, CED1 y [Nombre2], mayor de edad, CED2 por el delito de USURPACIÓN, en perjuicio de [Nombre3]. Intervienen en la decisión del recurso, las juezas [Nombre4] , Ligia Arias Alegría y María Gabriela Rodríguez Morales. Se apersonan en apelación, la señora [Nombre3], administradora del Refugio de Fauna Silvestre y representante legal de [Nombre5]., el licenciado [Nombre6] , representante legal de la señora [Nombre3], la licenciada [Nombre7] , representante del Ministerio Público y el licenciado [Nombre8] , Procurador Penal.

RESULTANDO:

  1. 1Que mediante sentencia número 47-2012 de las diez horas del veintiuno de junio de dos mil doce, el Tribunal de Juicio de Aguirre y Parrita, resolvió: "POR TANTO: En virtud de lo expuesto, artículos 31 y 41 de la Constitución Política, 1 a 15, 111 a 115, 130, 142, 265 a 267, 341 a 366 del Código Procesal Penal, 1, 2, 4, 11, 30, 31, 45 y 225 del Código Penal, el Tribunal resuelve: ABSOLVER de toda pena y responsabilidad a [Nombre1] Y E del delito de USURPACIÓN que se le ha venido atribuyendo en perjuicio de [Nombre3] . Son las costas del proceso a cargo del Estado. Se declara sin lugar la Acción Civil Resarcitoria incoada por la señora [Nombre3] en contra de los acusados [Nombre2] y [Nombre1] sin especial condenatoria en costas. No procede que el Tribunal se pronuncie sobre la acusación que hacen los defensores sobre Denuncia Calumniosa, eso le tocará a la Fiscalía o si no, como una gestión propia de los señores acusados o defensores de los mismos. Cése de inmediato las medidas cautelares dictadas contra los acusados si las hubiera. Firme esta sentencia sáquese este asunto del libro de entradas y archívese el expediente. Mediante lectura notifíquese" (sic).
  2. 2Que contra el anterior pronunciamiento, la señora [Nombre3], administradora del Refugio de Fauna Silvestre y representante legal de [Nombre5]., interpuso recurso de apelación.
  3. 3Que verificada la deliberación respectiva de conformidad con lo dispuesto por el artículo 465 del Código Procesal Penal, el Tribunal procedió a conocer del recurso.
  4. 4Que en los procedimientos se han observado las prescripciones legales pertinentes.

Redacta la jueza de apelación de sentencia [Nombre9] ; y,

CONSIDERANDO:

I.Por escrito presentado el 27 de julio del 2012, l a señora [Nombre3], en su condición personal, como administradora del Refugio de Fauna Silvestre Portalón, y representante legal de [Nombre5]. e [Nombre10]., interpuso Recurso de Apelación de Sentencia contra la resolución dictada por el Tribunal de Juicio de Puntarenas , sede Aguirre y Parrita, número 47- TJPAP-12 de diez horas del veintiuno de junio del dos mil doce.

II.En atención a lo dispuesto en el numeral 463 del Código Procesal Penal, se convocó a vista a las partes, misma que se celebró a las 13:30 horas del 16 de abril de 2013, con la participación de los jueces Ligia Arias Alegría, María Gabriela Rodríguez Morales y [Nombre4] . Durante dicha vista no se evacuó prueba ni se ampliaron los argumentos del recurso. La señora [Nombre3], expuso: "los licenciados [Nombre11] y [Nombre12] manipulan las cosas a su modo, ambos mienten. Hay dos planos en el legajo de prueba que no se querían recabar. No es cierto que el camino existía, según el plano de la red vial cantonal de Aguirre y el plano de 1980, en ambos se ve que el camino no existe. Las actas municipales se refieren a otro camino de otro señor, de otra parte de la finca y no el que ellos ilegalmente abrieron. El refugio es solo para conservación" .

III.Conforme lo resuelto en el voto 2013-088 de 13:28 horas del 18 de febrero del 2013, dictado por este mismo Tribunal de Apelación de Sentencia Penal, se procederá a la revisión y resolución del recurso interpuesto contra la sentencia número 47-TJPAP-12 de 10:00 horas del 21 de junio del 2012 del Tribunal de Juicio de Puntarenas, sede Aguirre y Parrita, en lo que se refiere al párrafo primero de la relación de hechos de la pieza acusatoria del Ministerio Público, de la causa 03-200405-457-PE. En primera instancia la apelante hace un recuento de los "antecedentes históricos del proceso" , indicando que esta causa inicia debido a la apertura ilegal de un camino, ello entre junio y julio del 2003, a raíz de lo cual en mayo de 2005 mediante un tercero se logra la colocación de un tendido eléctrico en el sitio y la donación de un terreno -ajeno a los donantes- a favor del Instituto Costarricense de Electricidad.

Posteriormente hace referencia al acuerdo conciliatorio al que se arribó en las causas 05-200699-457-PE y 05-201400-457-PE, así como pruebas recabadas en ambas causas, que en su criterio confirman la existencia de actos perturbatorios hacia el Refugio Portalón, perpetuados por más de 9 años. En lo que se puede considerar un primer motivo de impugnación, la recurrente indica que el Juez a quo realizó una laxa valoración de la prueba admitida, con la cual se podía acreditar fehacientemente que los acusados "de común acuerdo, con pleno dominio del hecho, de manera violenta y con amenazas, clandestinamente, sin contar con los permisos de ley, abusando de la confianza abrieron un camino en un Area Silvestre Protegida por ser Refugio de Fauna Silvestre" (sic, folio 2073) configurándose así el delito de usurpación. Adicionalmente señala que durante un debate anulado previamente, se había recabado prueba para acreditar los hechos, pero en este nuevo juicio no fue ofrecida por el Ministerio Público a pesar de así solicitárselo la representante de la sociedad ofendida al ente fiscal.

Si estas pruebas se hubiesen incorporado al contradictorio y valorados por el Juez de Juicio, el resultado sería diferente. Solicita se anule el fallo recurrido, el debate que lo precedió y se ordene el reenvío de la causa para nueva sustanciación. En lo que se entiende como un segundo motivo de apelación denominado "análisis de la prueba documental admitida en este proceso", quien recurre hace un recuento de la prueba documental -que indica- fue admitida en el proceso: 1. Informe de inspección ocular de folios 21 a 23, del cual transcribe varios extractos y cuestiona las manifestaciones de E contenidas en el mismo, señalando que el silencio positivo al cual hace mención dicho encartado, en derecho administrativo no opera tratándose de permisos o solicitudes que no cumplan con los requisitos fundamentales. 2. Del oficio ACOPAC-OSRAP-452 de fecha 30 de junio de 2003, indica, se constata la construcción de un camino en la margen izquierda de la quebrada "Fría", con afectación del bosque y la zona de protección.

Además contiene una manifestación de [Nombre13], funcionario del MINAE, quien dijo que antes sólo había un trillo para transitar en caballo. 3. Con el Informe del Consejo Municipal de Aguirre de 11 de julio de 2003, así como el acta de folio 14, afirma, se puede acreditar que [Nombre1] construyó el camino sin permiso de la Municipalidad de Aguirre. Además que en el Refugio de Vida Silvestre Portalón no existe calle pública, ni dicho ente la ha declarado formalmente. 4. En la constancia municipal de folios 60 y 61, se describen los requisitos que no se cumplieron por parte de [Nombre14]. y [Nombre1]., lo que generó la denegatoria de permisos para construir el camino. 5. Según la constancia que rola a folio 40, se acredita que la Municipalidad de Aguirre denegó la solicitud, gestionada por [Nombre15], para la construcción de un camino público a nombre de [Nombre14]. en el Refugio Portalón. 6.

Asimismo, con la certificación de folio 59 se evidencia que los trámites realizados por [Nombre14]. y el ingeniero [Nombre15] se encuentran incompletos. 7. La notificación municipal de folios 15 a 17, demuestra que se comunicó a [Nombre15] la denegatoria de su gestión. 8. Según la copia del acta municipal de folio 123 y el documento que contiene una lista de firmas de vecinos de folios 146 a 153, el camino abierto en 1978 es hacia la comunidad de Monterrey, la cual se encuentra en una dirección totalmente diferente a las fincas de [Nombre14]. 9. En la certificación de rutas cantonales en Aguirre, visible de folios 559 a 561, no se contempla el camino abierto por los encartados hacia las fincas de [Nombre14]., sólo el denominado Portalón-Mata de Café, que cruza el Refugio Portalón con dirección hacia Monterrey, pueblo abandonado por sus habitantes hace muchos años. 10. De un informe emitido por [Nombre3] (contenido en el expediente 05-200699-457-PE) la calle [Dirección1] deriva su nombre de unas fincas localizadas al lado este del río [Dirección2], no del lado oeste como afirman los imputados, que es la misma calle Portalón-Monterrey. 11.

Luego, se analiza en el recurso el peritaje del ingeniero [Nombre13] (folios 528 a 539), destacando la recurrente los aspectos en los que el perito disiente del peritaje presentado por los acusados, asimismo las conclusiones a las que arriba el ingeniero [Nombre16], en el sentido de que el camino que construyeron los acriminados no es el mismo denominado Pasito-Portalón y que los planos aportados como prueba de descargo contienen información falsa, todo lo cual fue debidamente informado a la fiscal de juicio. Como un tercer motivo del recurso, denominado "análisis de los peritajes aportados por los acusados" , se hace una valoración de dichas probanzas por parte de la impugnante. Como primer crítica menciona que los dos peritajes omiten valorar la existencia de la declaratoria de refugio de fauna silvestre de la finca objeto de este proceso, a pesar de existir en la entrada al mismo un [Placa1] que así lo indica.

Luego, en específico cuestiona cada uno de los peritajes indicando: 1. Sobre la pericia del topógrafo A, primero alega que no es cierta la visita a la administradora del Refugio Portalón, como lo consigna en su informe. Posteriormente confronta éste con el rendido por [Nombre13] (ya mencionado), destacando las contradicciones entre ambos. Finalmente, acusa la omisión del perito de analizar documentación importante para determinar que el camino abierto por los encartados y el que realmente existía en la zona, son diferentes. 2. Informe de [Nombre17] (folios 266 a 268). Afirma la recurrente que este documento contrasta radicalmente con otras valoraciones realizadas por funcionarios del Ministerio de Ambiente y Energía y el Organismo de Investigación Judicial, además parte de que E informó que se contaba con permisos de la Municipalidad de Aguirre para realizar los trabajos, lo cual es falso.

Solicita, se "descarten dichas pericias e informes, por no ajustarse a la verdad ni ser coherentes con los informes de MINAE y las pericias de expertos del Poder Judicial que dicen totalmente lo contrario..." (folio 2109). En el apartado denominado "sobre la prueba testimonial de los acusados" entendido como el cuarto motivo de apelación, el recurrente hace un análisis individual de los testimonios de descargo recibidos en el debate, afirmando que [Nombre18], [Nombre3], [Nombre19] y [Nombre13], mintieron bajo fe de juramento para favorecer a los acusados, esto por cuanto dichos deponentes conocen muy bien la zona y no es posible que hayan confundido las direcciones de los caminos en cuestión, tanto el que va a Monterrey como el que va hacia las fincas de [Nombre14]., ambos ubicados en lugares diferentes. Solicita, se "desestime la declaración de los testigos de los acusados en Sala de Juicio por espurea y que se les siga causa por falso testimonio y por faltar a la verdad bajo la fe del juramento" (sic, folio 2116).

De igual forma en el quinto motivo del recurso, la apelante hace un análisis de la prueba testimonial "del Refugio de Fauna Silvestre Portalón" , acusando que: 1. El señor [Nombre13], funcionario del Ministerio de Ambiente y Energía, en el debate varió la versión que venía sosteniendo a lo largo del proceso y en los diferentes documentos que constan en el expediente, como por ejemplo el oficio ACOPAC-OSRAP-452 de 30 de junio del 2003, una declaración que consta en el expediente 05-201400-457-PE, el informe ASOPAC-OSRAP 388-05 de 25 de mayo de 2005 visible en el expediente 05-200699-457-PE. 2. [Nombre1], en el debate hizo una narración sustancialmente diferente a lo sostenido en el informe ACOPAC-OSRAP 1227-05 realizado por él mismo, así como por lo indicado por otros funcionarios del Setena y del Ministerio de Ambiente y Energía. En específico destaca que el testigo minimiza el resultado de lo sucedido, aunque en su informe reporta la existencia de grandes daños en la zona.

Solicita "...que la prueba que ha sido expuesta, y la prueba nueva que se generó en el debate que fue anulado sobre esta misma causa, en lo correspondiente, pueda ser usada por el Tribunal de Apelación para que se confronte a los testigos [Nombre13] y [Nombre1] del MINAE, para que se aclaraen la razon de la diferencia en sus informes y su declaración en la Sala de Juicio sobre los hechos denunciados". (sic, folio 2120). En lo que se entiende como un sexto motivo de inconformidad, denominado "sobre el análisis del tipo penal que hace el Juez en la sentencia de conformidad con el artículo 225 del Código Penal", señala la señora [Nombre3] que según lo establecido en la sentencia, el Juez a quo consideró que la conducta acusada no se ajusta a los presupuestos requeridos para la configuración del delito de usurpación. Luego de transcribir el artículo 225 del Código Penal, indica que -en el caso concreto- existe "violencia sobre las cosas" (folio 2121) al haberse violentado la propiedad privada, destruyéndose el fundo que sus dueños dispusieron para la conservación de recursos naturales, al causar destrucción de árboles, contaminación y afectación a la cuenca de quebrada Fría.

Violencia sobre las personas, puesto que E el día 14 de junio de 2003, la abofeteó, quebrándole sus lentes ópticos, además la agrede emocionalmente con palabras, gestos obscenos, provocando que ya no pueda realizar sus actividades cotidianas por temor. Igualmente fue agredida físicamente y de palabra, siendo intimidada y amenazada por [Nombre18], socio de [Nombre1] y apoderado de [Nombre14]. Considera también que existe engaño, pues los acusados abrieron un camino de forma fraudulenta sin permisos del Ministerio de Ambiente y Energía. [Nombre1] ordenó la realización de planos que contenían datos falsos -en cuanto a las colindancias- para engañar a las autoridades del Catastro Nacional, poder abrir un camino en un inmueble que no les pertenece y además encubrir su ilícito. El abuso de confianza lo afinca en la apertura del camino por parte de los imputados, a sabiendas de que no contaban con permisos del Ministerio de Ambiente y Energía, de la administración del Refugio de Fauna Silvestre Portalón ni la Municipalidad.

Por último, indica que hay clandestinidad pues el camino se comenzó a abrir desde la propiedad de los imputados, por una área que sí les correspondía y hacia el Refugio Portalón, procurando que los personeros de este último se enteraran hasta casi terminado el trabajo. Solicita se declare "nulo, ineficaz e inexistente el fallo recurrido, el debate que lo sustenta y se disponga el reenvio y la nueva sustanciación de la causa." (sic, folio 2124). VI. Como un sexto motivo del recurso expone la impugnante en el apartado denominado "sobre el procedimiento para abrir caminos o realizar cualquier trabajo en un área silvestre protegida", que en el lugar donde se abrió el camino denominado por los imputados como Portalón-Carmona, los permisos respectivos sólo los podía otorgar el Sistema Nacional de Áreas de Conservación, por medio del Área de Conservación Pacífico Central, con los cuales no contaban los encartados.

Asimismo, considerando hipotéticamente que tales permisos los pudiera conceder la Municipalidad de Aguirre, los acusados no cumplieron con los requisitos municipales para obtenerlos; por lo tanto, éstos actuaron con conocimiento de la ilegalidad que cometían. En un sétimo motivo expone la recurrente que en la sentencia no se transcribe fielmente su intervención en el debate, ni tampoco consigna parte del testimonio de [Nombre20] en cuanto dijo que cuando hacía trabajos en la zona, dormía en la vivienda de [Nombre2]. Como último apartado y octavo motivo denominado "hipótesis explicativa del cuadro fáctico del actuar de los acusados" quien recurre expone que -según su opinión- la acción de los imputados no obedece a un error de los acusados confundiendo un camino por otro, sino que se trata de un plan delictivo doloso. Considera improbable que tanto el imputado [Nombre2], como los testigos que se recibieron en el debate se hayan confundido, si todos son residentes de la zona.

Incluso afirma que de la declaración [Nombre1], en el debate, se deduce que conoce que el camino a Monterrey va en una dirección opuesta al abierto ilegalmente. Por la forma en que se resuelve este recurso, los motivos de apelación indicados se conocen en conjunto. SE DECLARA SIN LUGAR EL RECURSO. Esta Cámara de Apelación de Sentencia, ha estudiado en detalle el recurso de apelación formulado por la impugnante, la sentencia recurrida y la pieza acusatoria determinándose que el reclamo debe ser desestimado por lo que a continuación se explica. Como se puede observar, el recurso que interpone la señora [Nombre3], en su calidad de actora civil en este proceso -que es la condición que la legitima para ello- se dirige únicamente a cuestionar los aspectos penales del fallo impugnado, reclamando solamente la absolutoria dictada por el Tribunal de Juicio a favor de los encartados pero sin hacer algún cuestionamiento en cuanto a los aspectos de índole civil, ni tampoco hacer referencia a la forma en que dicha absolutoria le afectó en sus pretensiones pecuniarias.

Al respecto establece el artículo 116 del Código Procesal Penal, que "el actor civil podrá recurrir contra las resoluciones únicamente en lo concerniente a la acción por él intepuesta". De dicha norma resulta claro e innegable que el actor civil puede ejercer el derecho a recurrir el fallo que considere adverso a sus intereses, e incluso se ha aceptado que pueda cuestionar los aspectos de índole penal que considere necesarios, en el tanto le sean también perjudiciales en el ejercicio de su acción civil. Por ello, cuando los recursos del actor civil no se relacionen a su acción, los mismos no resultas procedentes. En este mismo sentido, ha resuelto tanto este Tribunal de Apelación de Sentencia Penal -ejerciendo funciones como Tribunal de Casación Penal- como la Sala Tercera de la Corte Suprema de Justicia. Así, el primero, en el fallo 2008-263 de 13:00 horas del 12 de junio de 2008, expuso: "Por las razones que de seguido se expondrán, al carecer de todo interés, se declara sin lugar la impugnación que plantea la actora civil... conforme a lo dispuesto por el artículo 424 del Código Procesal (que como una regla general en materia de recursos, establece la necesidad de que el impugnante acredite la existencia de un agravio), la impugnante no tendría ninguna legitimidad en su reclamo, pues técnicamente no demuestra (ni menciona siquiera) que esa absolutoria penal le haya generado alguna afectación jurídicamente tutelable en cuanto a sus intereses patrimoniales, mismos que incluso son de carácter particular y privado.

En este sentido se tiene que, a la luz de la anterior legislación procesal penal (que en este punto no vino a ser modificada por el Código actual), la jurisprudencia de la Sala Tercera ha señalado que el recurso de actor civil, siempre que sea necesario para procurar la satisfacción de su interés, puede modificar el aspecto penal del fallo, aún si no recurrió el Ministerio Público (cfr. voto Nº 727-F-96 de las 10:25 horas del 22 de noviembre de 1996). Tal criterio es compartido por estos jueces de casación. Sin embargo, se debe insistir en que el recurso que se conoce sólo se dirige a cuestionar la absolutoria penal de la encartada, sin vincular tal inconformidad con la necesidad de procurar (a través de su nulidad) la eventual satisfacción de su interés pecuniario. En igual sentido, también de la Sala Tercera de la Corte Suprema de justicia, pueden consultarse estos otros pronunciamientos: N° 144- F-94 de las 10:05 horas del 13 de mayo de 1994; y N° 260-F-93 de las 16:07 horas del 7 de junio de 1993...”.

Por su parte, en el voto [Telf1] de 10:06 horas del 21 de octubre de 2011, la Sala Tercera de la Corte Suprema de Justicia, señaló: “I. […] Es importante hacer ver que el artículo 116 del Código Procesal Penal, en lo que interesa, señala que: "...el actor civil podrá recurrir contra las resoluciones únicamente en lo concerniete a la acción por él interpuesta...". Evidentemente, se incluye dentro de tales presupuestos, todos aquellos elementos que puedan ser comprendidos como la causa generadora de un daño que deba ser indemnizado, no solamente lo derivado de la comisión de un delito. En este sentido, la Sala Constitucional, aún encontrándose en vigencia el Código de Procedimientos Penales, indicó: "...Se declara nula la limitación del derecho a recurrir que impone el artículo 450 del Código de Procedimientos Penales al actor civil para hacerlo en relación con las sentencias de sobreseimiento o absolutorias condicionando su actuación a la del Ministerio Público, de tal forma que la norma se leerá así: El actor civil podrá recurrir de las resoluciones sólo en lo concerniente a la acción por él interpuesta.

Esta sentencia tiene efecto declativo y retroactivo al primero de julio de mil novecientos setenta y cinco, fecha en que entró en vigencia el Código de Procedimientos Penales; en consecuencia todo actor civil al que se le haya desconocido su derecho de recurrir de sentencias de sobreseimiento o absolutorias, en aplicación de la norma ahora declarada inconstitucional, podrá interponer nuevamente el recurso que corresponda, dentro del plazo otorgado al efecto en él señalado..." (Sala Constitucional, Voto 5751-93, de las 2:39 horas, del 9 de noviembre de 1993). No obstante lo anterior, esto no implica que el actor civil pueda sustituir la función del Ministerio Público, en lo referente al ejercicio de la acción penal, conforme la misma se encuentra legalmente delegada en el artículo 16 del Código Procesal Penal, al señalar propiamente que: "... cuando sea pública, su ejercicio corresponderá al Ministerio Público, sin perjuicio de la participación que este Código concede a la víctima o a los ciudadanos...".

En este orden de ideas, se observa que el reclamo planteado por la representante de Civil" la Defensa Civil de la Víctima, únicamente se limita a cuestionar los aspectos propios de la decisión penal, sin que se desprenda que los Jueces hayan obviado cualquier tipo de dispositivo generador de responsabilidad civil distinto de la acción penal cuya absolutoria fue avalada por el ente fiscal, quien no presentó recurso de casación al respecto. Bajo esta línea, si bien es cierto cabe aceptar que el actor civil tiene la facultad de recurrir, a pesar de que se haya dictado una sentencia absolutoria, dicha potestad no puede sobreponerse a las funciones propias del órgano que se encuentra a cargo de la presecución de la acción penal, sino que dicha facultad se prevé para aquellos casos en que subsista algún tipo de responsabilidad extracontractual distinta a la que pueda derivar de una acción delictiva.”.

El caso bajo estudio se trata de una situación similar a la expuesta en ambos fallos, en donde el Ministerio Público decidió, en conclusiones, solicitar una sentencia absolutoria, por ende no recurrió el fallo que acogió su pretensión, pero además, en el recurso interpuesto la actora civil ni siquiera hace mención a alguna inconformidad en relación a lo resuelto en cuanto a la acción civil ejercida por ella, aspecto que para este momento ya ha adquirido firmeza por no haber sido cuestionado. Por lo expuesto, lo que impera es declarar sin lugar la impugnación. Ahora bien, habiéndose realizado el análisis de la sentencia recurrida en forma integral, es oportuno indicar que a pesar de constatarse en el fallo impugnado un vicio por falta de fundamentación intelectiva, pues en el mismo el Juez a quo no analiza la prueba documental, limitándose enumerarla pero sin valorarla ni confrontarla con la prueba testimonial ni especificar razonamiento alguno sobre ella; en el caso que nos ocupa este defecto no sería suficiente para anular la decisión venida en alzada.

Lo anterior es así porque la absolutoria dictada por el Tribunal de Juicio no sólo se basa en la ausencia probatoria de los hechos acusados, sino que también radica en la atipicidad del cuadro fáctico imputado, siendo que esta última apreciación, esta Cámara de Juezas la encuentra correcta. Primero, en este asunto se debe recordar que en virtud de haber sido aceptada una conciliación entre la Procuraduría General de la República y los imputados, en relación con los aspectos vinculados a delitos de orden ambiental, el juicio que dio pie a la sentencia impugnada, únicamente versó sobre los siguientes hechos acusados por el ente fiscal: 1) En fecha exacta no precisada, pero sí comprendida desde el día dos de mayo hasta el día veintisiete de junio del año dos mil tres, los acusados [Nombre2] y [Nombre1] ordenaron la realización de un camino de lastre, por intermedio de terceras personas de calidades desconocidas, contratadas por ellos para tal efecto y que seguían sus órdenes, en la finca con plano catastrado #358799-79, número de finca 21127-000, ubicada en el Refugio de Vida Silvestre Portalón, Aguirre de Puntarenas, propiedad de Primera Compañía Unida de Desarrollo y representada por S, ejerciendo actos de posesión como si fueran dueños del inmueble, construyendo un camino de lastre de forma permanente, paralelo al lindero oeste de la propiedad, con el fin de desplazarse ininterrumpidamente por ese predio, despojando así del derecho de posesión a su legítima poseedora." (folios 388 y 389, tomo I), que son los mismos leídos por la representación fiscal en la apertura del debate.

Tal como lo señaló el Juzgador de instancia, dicha narración no contiene una descripción clara, precisa ni circunstanciada del hecho que se está imputando a los encartados [Nombre2] y [Nombre1], que permita encuadrar los mismos dentro de la figura penal de usurpación, tal como está prevista en el artículo 225 del Código Penal, por ello, con dicho cuadro fáctico no es posible arribar a una sentencia condenatoria. Según el numeral indicado, existen tres tipos de usurpación: la que se produce por despojo, invasión o expulsión; la que se produce por alteración de términos o límites y aquella producida por turbación de la posesión o tenencia de un inmueble. En el caso bajo análisis la figura más cercana a la acusada sería la contemplada en el primer inciso. Sin embargo, para que los hechos que se acusen resulten típicos de esta delincuencia no basta con describir el verbo típico (despojar, invadir, mantenerse en el inmueble o expulsar a los ocupantes), pues dichas acciones deben producirse por modos específicos (violencia, amenazas, engaño, abuso de confianza o clandestinidad) mismos que configuran elementos objetivos del tipo penal, por ello éstos también deben describirse -no solo mencionarse- en la acusación que se formule, lo cual no ocurrió en este caso, donde ni en la relación de hechos ni en el resto de la acusación se puede apreciar que se haya realizado una descripción de la existencia de alguna de estas circunstancias en la acción de los encartados.

Esta deficiencia en la acusación es la que el Juez sentenciador consideró al señalar que los hechos acusados eran atípicos y por ende procedía absolver a los encartados. Conclusión acertada, pues la imprecisión señalada sin explicar si se produjo por violencia, engaño, abuso de confianza o clandestinidad, impide el ejercicio adecuado del derecho de defensa, pues los imputados no tuvieron la oportunidad de conocer con antelación cuál es la conducta específica por la que se pretende su sanción. Por ello, es indispensable que el órgano acusador describa claramente la conducta que realizó el imputado, incluyendo todos los elementos contemplados en el tipo penal, para que de esta forma el juzgador pueda valorar si ésta se subsume en una norma sancionatoria, pero además, que la persona acusada pueda conocer sin ningún obstáculo por qué se le pretende castigar. La acusación, como fue formulada, no cumple con los requisitos mínimos de imputación, y a esta altura del proceso es un defecto imposible de subsanar, por lo que se impone confirmar la sentencia absolutoria dictada en su favor.

V.En el que se interpreta como un quinto motivo de impugnación, titulado "sobre la representante del Ministerio Público" , la recurrente critica la actuación de la fiscal que asistió al debate, quien -afirma- permaneció constantemente enviando y recibiendo mensajes de texto con su teléfono celular; no le permitió a la representante de la sociedad ofendida que le comentara los detalles importantes de la investigación y la prueba; no ofreció pruebas relevantes a pesar de así solicitárselo la recurrente; mucho menos le comunicó su intención de acceder a la conciliación en las otras causas ni que iba a solicitar un "sobreseimiento" a favor de los encartados. De esta forma -en su criterio- la víctima quedó desprotegida y sin representación por parte del Ministerio Público. Finalmente, alega que a pesar de haberle comunicado a la fiscal una eventual causa de recusación contra el Juez de Juicio (pues el hijo de éste mantenía una deuda con el abogado representante de la acción civil) la representante del Ministerio Público hizo caso omiso.

Por violación a los derechos procesales fundamentales de la víctima, solicita "se declare nulo, inexistente, e ineficaz el fallo recurrido, el debate que lo sustenta y se disponga el reenvio y la nueva sustanciación de la causa." (sic, folio 2127). SE DECLARA SIN LUGAR EL MOTIVO. Si bien es cierto, el reclamo realizado por la recurrente podría considerarse una violación a sus derechos como víctima, en este caso no es suficiente para anular la sentencia que viene apelando. Primero, porque en sus alegatos ni siquiera se ofreció alguna prueba capaz de acreditar la existencia de los mismos, no fue una situación que se pusiera en conocimiento del Tribunal de Juicio oportunamente, y por lo tanto no es posible para este Colegio de Juezas corroborar la existencia de algún vicio en el proceso. Igual sucede con la eventual causal de inhibitoria para el Juez de Juicio, alegada en forma transversal en este aparte del recurso; llamando poderosamente la atención a estas Juzgadoras que a pesar de que proclama la existencia de una situación de tal gravedad como la expuesta, no se alegara por parte de la representante de la sociedad ofendida durante el debate ni en las audiencias previas a éste, pudiendo hacerlo.

Nótese que según las actas de audiencia que constan en el legajo principal, los días 04 y 11 de junio de 2012, se encontraba presente en las audiencias en las que se discutió la aplicación de una conciliación, el licenciado [Nombre6] , a quien le concernía directamente la eventual causa de inhibitoria, pues en principio es el acreedor de un hijo del Juez que dirigió las mismas y el debate; sin embargo, no se hace en dichas audiencias, ni posteriormente, ningún reclamo al respecto. En el recurso que ahora se conoce, simplemente se limita la apelante a mencionar la existencia de dicha deuda, pero no da ningún detalle de la misma, ni la acredita. De esta forma, tampoco es posible para este Tribunal de Apelación constatar la existencia de algún vicio relacionado con este reclamo, debiendo declararse el mismo sin lugar.

POR TANTO:

Se declara sin lugar el recurso de apelación interpuesto por [Nombre3]. NOTIFÍQUESE.
