JUDICIAL BRANCH CRIMINAL JUDGMENT APPEALS COURT Decision: 2013-2799 Case File: 08-200425-0486-PE (9) CRIMINAL JUDGMENT APPEALS COURT. Second Judicial Circuit of San José. Goicoechea, at thirteen hours and forty-eight minutes on the twenty-second of November, two thousand thirteen.
APPEAL (RECURSO DE APELACIÓN) filed in these proceedings against Nombre01, born in […], for the offense of VIOLATION OF THE LEY FORESTAL, in the form of ILLEGAL LOGGING (TALA ILEGAL) and ILLEGAL HARVESTING OF FOREST RESOURCES (APROVECHAMIENTO ILEGAL DE RECURSOS FORESTALES), to the detriment of NATURAL RESOURCES. Judges Edwin Salinas Durán and Jorge Luis Arce Víquez, and Judge Sandra Zúñiga Morales, participated in deciding the appeals. Counsel Alejandro Ureña Garita, public defender for the defendant, and counsel Margot Avellán Ruiz, representing the Procuraduría General de la República, appeared before this Court, and BACKGROUND:
I.By judgment Nº 09-S-2013, issued at 13:00 hours on January 30, 2013, the Tribunal Penal del Segundo Circuito Judicial de la Zona Atlántica ruled: “THEREFORE: For the reasons stated, under the rules of rational sound judgment (sana crítica racional), Articles 39 and 41 of the Constitución Política; Articles 1, 30, 31, 45, 50, 51, 69, and 71, all of the Código Penal; Articles 9, 75 through 80, 111 through 124, 265, 360 through 365, 366, 367, and 3680, all of the Código Procesal Penal; and Articles 61(a) and 66 of the Ley Forestal, in deciding this matter, the Court finds Nombre01 criminally responsible as the perpetrator of the offense of ILLEGAL HARVESTING OF FOREST PRODUCTS (APROVECHAMIENTO ILEGAL DE PRODUCTOS FORESTALES), committed to the detriment of NATURAL RESOURCES, and in that capacity imposes a sentence of ONE MONTH OF IMPRISONMENT, to be served in the manner and place determined by the applicable prison regulations.
The sentence is commuted to thirty daily fines at the rate of six thousand colones per day, for a total of one hundred eighty thousand colones. That fine must be paid to the Patronato Nacional de Bienes de Adaptació n Social, account number 34870 at the Banco Nacional de Costa Rica, within fifteen days after this judgment becomes final. If the fine is not paid and the thirty-day term of imprisonment must be enforced, the benefit of a suspended sentence (ejecución condicional de la pena) is granted for a three-year probationary period, with the warning that if he commits a new intentional offense punishable by more than six months of imprisonment, the benefit granted herein shall be revoked. The pertinent information shall be communicated to the Registro Judicial, Juez ejecución de la Pena and Adaptación Social for action within their respective authority. The civil action for damages (acción civil resarcitoria) brought by the State is granted, and the convicted defendant Nombre01 is ordered to pay the costs, interest, damages, and losses caused by his unlawful conduct; the amount of this award remains undetermined, and the interested plaintiff must resort to the appropriate proceeding for its enforcement.
Likewise, applying the principle of in dubio pro reo, he is acquitted of the offense of ILLEGAL LOGGING with which he was charged to the detriment of natural resources. As to the defendant Nombre02, he is acquitted of all punishment and liability for the offenses of ILLEGAL HARVESTING OF FOREST PRODUCTS AND ILLEGAL LOGGING that had been attributed to him to the detriment of NATURAL RESOURCES; as to him, the civil action for damages is denied, and the civil plaintiff is exempted from costs because the Court finds that the plaintiff had plausible grounds to litigate. NOTICE SHALL BE GIVEN BY READING. Nombre03. TRIAL JUDGE” (sic).
II.Counsel Alejandro Ureña Garita, public defender for the defendant Nombre01, filed an appeal against the foregoing decision.
III.After conducting the corresponding deliberation pursuant to Article 466 of the Código Procesal Penal (as amended by Laws Nº 8837 and Nº 9021 and following the numbering stated in the Correction of Errors adopted by resolution of the legislative directorate published in La Gaceta Nº 51 of March 12, 2012), the Court considered the issues raised in the challenge.
Appeals Judge Salinas Durán authors the opinion, and
CONSIDERING:
I.In the first section of his appeal, counsel Alejandro Ureña Garita, public defender for the defendant Nombre01, asserts “disagreement with the determination of the facts or accusation, which does not encompass all the elements required for the illegal harvesting of forest resources.” He maintains that both the accusation filed by the Ministerio Público and the private prosecution (querella) and civil action filed by the Procuraduría General de la República lack an adequate account of how the events occurred, because the defendant was accused of logging and sawing timber without a permit from the forestry administration or an environmental impact study (estudio de impacto ambiental) from SETENA. Examination of the core of the accusation shows that it refers to forest harvesting (aprovechamiento forestal), which points to other provisions of the Ley Forestal, because it is not possible to determine that there was no logging but that there was forest harvesting.
He states that the Trial Court did not establish that logging occurred. He considers that, under Article 3 of the Ley Forestal, establishing harvesting requires not only identifying the conduct performed but also the potential or actual result produced. This entails a series of actions (cutting, removal of standing trees, or use of fallen trees) and a specific advantage, gain, utility, or benefit for the person performing the action or for the third party represented by that person, without that benefit necessarily being economic, since it may be sought for other reasons, such as landscaping, construction work at the site, or use of the timber for artistic purposes. From that perspective, the prosecution’s charging instrument alleges only the first normative aspect—that is, harvesting—based on the cutting of several trees within a protected area (área de protección), but overlooks the fact that forest harvesting also requires specifying the utility obtained by the perpetrator or the person represented by the perpetrator.
He notes that the benefit, advantage, gain, or utility generated for the defendants by that activity was never stated. Citing constitutional case law, he emphasizes the need for a precise and detailed account of the alleged criminal act. He contends that his client was convicted of an unlawful act that he did not commit and that it was not possible to determine what benefit he obtained. In the second section, he alleges “disagreement with the assessment of the evidence and lack of reasoning.” He states that the Court convicted his client because the witness Nombre04 was able to identify him at trial and said that he was one of the persons at the scene. The Trial Court, however, did not take into account that the witness contradicted himself. He said that he had prepared reports that were in the case file; that some trees were within the reserve area; that he thought one of the persons was in the courtroom; that the man said they could do it because they were the owners and had purchased the property from doña Nombre05; that he had prepared the report; that he had not personally seen Nombre01 sawing timber; that the sawmill was in the pasture; and that the person accompanying Nombre01 was sweating, but Nombre01 was not.
If analyzed independently, all of this would indicate whether or not there is a probability that his client bears responsibility. This is because there is no report signed by the witness, and it cannot be determined from his testimony which trees required a permit and which did not. The witness’s identification of his client as one of the persons who was at the site cannot be regarded as certain because it is unknown whether he had seen him before or whether someone told him who he was. It was not a lineup identification (reconocimiento en rueda de personas). No other witness placed the defendants at the scene. There was no certainty that his client owned the property, since doña Nombre06 stated that she had sold it to two persons, one of whom later sold it to Nombre07, and it is therefore unknown whether the latter was the person at the site. In his view, Nombre08’s testimony left doubts and is insufficient to establish that forest harvesting occurred, especially because the logging of trees was not established, as some trees required a permit and others did not.
No one testified to seeing anyone sawing; they merely heard the sound of a saw, and when they arrived everything was normal. It cannot be asserted that his client was doing the sawing. He states that Nombre09 participated in the first visit and made no seizure because the felled trees did not require one, and señora Nombre10 said that they did not even get out of the car, making it impossible for them to see who was sawing. In his view, the evidence was not assessed in its entirety and the decision lacked reasoning, while the principles of immediacy (inmediación) and the presumption of innocence (inocencia), or in dubio pro reo, were not applied. In the third section, he alleges a “lack of reasoning regarding the payment of costs.” He states that the Trial Court did not explain the award of costs because his client did not engage in dilatory tactics, and his opposition to the alleged facts was based on the position that he had not committed them.
The Court did not assess whether there were plausible grounds to litigate, and merely ruling on costs is insufficient; the reasons for ordering their payment must also be stated. Position of the Procuraduría General de la República. Counsel Margot Avellán Ruiz responded within the period granted, stating that the facts alleged in the accusation and private prosecution conform to forestry law because it was clear that the defendant, together with another person, harvested forest resources derived from logging and sawing, since they used a chainsaw to fell 53 trees, 49 of which were within a protected area. The Court validly established the conduct, and although it could not be established that the defendant was the person who felled the trees, he did harvest those resources, which he possessed in the form of processed wooden planks and slabs. It is clear that the fallen trees were harvested.
The witnesses stated that the defendant represented himself as the owner of the property and as having the right to cut the trees. The harvesting of the timber was valued at ¢5.397.027,00f for the environmental damage, which established that the defendant intended to harvest the trees, as well as to carry out land-use change (cambio del uso del suelo). The evidence was properly assessed. The witness Nombre11 emphatically identified the defendant as one of the two persons at the scene, and although there may have been some confusion, this was because more than five years had passed. He and the witness Nombre10 were unequivocal in stating that they heard chainsaws, placed the defendant at the scene, and heard him identify himself as the owner of the property and as having the right to cut the trees, which is consistent with the contents of the case file. If he was the owner and was at the site, it was evident that he was, at a minimum, an indirect perpetrator (autor mediato).
With respect to costs, the general rule is that costs are borne by the losing party; therefore, it is the exception—exemption from costs—that must be supported by reasons, rather than an award of costs, which follows expressly from the procedural rule. She requests that the defense appeal be denied.
II.The appeal is without merit. In his arguments, the appellant raises three specific claims. In the first, he proceeds from the premise that, pursuant to Article 3 of the Ley Forestal, in relation to section 61 of the same legislation, in order for forest exploitation (aprovechamiento forestal) to be established, it is necessary to prove not only the conduct carried out by the accused, but also the benefit obtained by him or by the person he represents, even if it is not an economic benefit, which he considers was not proven. However, as noted by the representative of the Procuraduría General de la República and accepted in the judgment on the merits, the conduct of the defendant Nombre01—although he cannot be charged as the direct perpetrator of the felling (tala) of the 53 trees, 49 of which were in the forest area, because there were no witnesses who observed him cutting them—clearly showed that he, as charged, was the person who would benefit from the product of the fallen trees, which had already been sawn into planks, not only because of the economic value of the lumber thus sawn, but also because of the resulting land-use change (cambio de uso del suelo) on that property.
This circumstance is apparent from the very moment when the defendant Nombre01 voluntarily presented himself to the forest inspectors as the owner of the property and, as such, as having the authority to dispose of the trees located on the land, even without official authorization, which was understood to include both the standing and fallen trees. It is clear that, if the accused was on the farm when the forest inspectors, alerted by the sound of the chainsaw, arrived at the site, and there were several felled trees there, some of which had already been sawn into planks, as well as slabs or scraps of wood, sawdust produced by the cutting, and the tools necessary to saw the wood, and, as stated, he voluntarily told the forest officials that he was the owner and did not require authorization to dispose of those trees, it is self-evident, as the Court concluded, that he knew about and consented to the felling and would consequently benefit from those forest resources.
Contrary to the appellant’s view, it was the accused who, openly declaring himself to be the owner and to have control over his property, would obtain both the economic benefit from disposing of the lumber and the benefit from the use of land that was no longer forest but pasture or cropland. From this perspective, that conduct does fall within the conduct contemplated in section 61 of the Ley Forestal, which provides: “A prison sentence of one month to three years shall be imposed upon anyone who: a) Exploits one or more forest products on private property without authorization from the State Forestry Administration, or upon anyone who, despite having authorization, fails to comply with its terms...”; because, pursuant to Article 3 of the cited Law, exploitation is defined as: “a) Timber exploitation (Aprovechamiento maderable): The act of cutting or removing standing timber trees or using fallen trees, carried out on private land and not included under Article 1 of this Law, which generates or may generate any profit, benefit, advantage, utility, or gain for the person carrying it out or for the person represented thereby.” This is so because it was proven that the accused Nombre01 was regarded as the owner of the property, was present at the site when the forest inspectors arrived, and that the 59 felled and processed trees were there.
It was evident that they were working on those resources at that time because they appeared sweaty, had a saw and a frame saw (tools used in sawmill work), as well as gallons of gasoline and, in particular, the planks from the felled trees, which appeared fresh and were stacked or piled along the edge; in accordance with the rules of sound judicial assessment (sana crítica), this indicated that they were working on them. Furthermore, it was established that 49 trees came from the forest area, all of which means that the accused’s conduct does constitute forest exploitation. Although he was not held responsible for the felling, despite the Procuraduría General de la República’s contention that he could be deemed an indirect perpetrator (autoría mediata), insofar as he could have used a third party to carry it out, he was clearly the person for whom that felling could, at the very least, generate “some profit, benefit, advantage, utility, or gain,” since it was likewise established that the lumber had considerable economic value, more than two million colones.
This was in addition to the change in the farm’s future use, whether as pasture or for cultivation. Consequently, this claim cannot succeed because the advantage or benefit is described in both the charging document and the private complaint (querella), namely, the lumber’s value of several million colones. The second issue raised by the defense concerns its client’s presence at the location where the felling occurred, which, in the appellant’s view, was based solely on the testimony of Nombre04, which he considers contradictory. He is nevertheless incorrect, because far from lacking adequate reasoning, the judgment establishes, as previously stated, both that the defendant Nombre01 was at the site when the forest inspectors arrived and that he stated he was the owner of the property and was entitled to cut the trees by virtue of that status. Despite the passage of years, that witness was able to identify the accused as one of the two people at the site.
Although the witness Nombre08 was unable to make that specific identification, this does not rule out the defendant’s presence on that occasion, because she agreed with the details recounted by Nombre08 and that there were indeed two people at the site, precisely the two people who were charged. All of this is supported by the documentary evidence and the remaining testimony corroborating the actions of the forest inspectors, as also stated by Nombre12 and Nombre13. In other words, the fact that only one witness was able to recognize the accused Nombre01 does not create doubt; rather, it means that only that witness, unlike the others, was able to make the identification. The witness Nombre10 clearly stated that “there were only two people; I could not say whether they are present here” (folio 168), and the witness Nombre10 stated: “If I saw the defendants here, I would not recognize them” (folio 169).
Thus, rather than ruling out the accused’s presence and thereby undermining the witness Nombre08, these statements merely indicate that the witnesses were unable to recall the physical characteristics of the two people who were at that location on that day. There is no doubt, however, that they were the two people against whom the case was brought, as established by the complaint appearing at folios 1 to 16, in which the witness Nombre10 himself reported the accused Nombre01. Nor does the testimony of the witness Nombre05 create any doubt as to whether Nombre01 was the owner, merely because she recalled having sold the property to other people, who in turn sold it to others. What matters, and what the judgment established, is that when the forest inspectors arrived at the farm where the felling was confirmed, it was the accused Nombre01 who assumed that role and, as such, asserted his authority to dispose of that property.
In other words, the fact that the witness Nombre14 had not sold the property to Nombre01 did not establish that he was not the owner, because that witness did not even know who ultimately acquired the land after she sold it. It was also ruled out that an individual named Nombre07 could have been at the site, when it is more than evident that the complaint and the testimony presented established that the person at the site was the accused Nombre01, who identified himself as the owner to the forest inspectors, even if the witness Nombre14 may previously have sold the property to another person who subsequently sold it to Nombre07. Therefore, the existence of different owners does not undermine the fact that it was the accused Nombre01, and not someone else, who presented himself as such, and that he was the person who benefited from the forest resources derived from the felling at issue. Consequently, this argument cannot succeed either.
Lastly, the appellant claims that, in granting the civil claim for damages (acción civil resarcitoria), the Trial Court should have stated the grounds for the award of costs imposed on the civil defendant and that, because it failed to do so, the award lacked adequate reasoning. This argument, however, disregards the applicable procedural provision, which states: “ARTICLE 267.- Assessment of costs. Costs shall be borne by the unsuccessful party, but the court may exempt that party, in whole or in part, when there is a plausible reason for litigating. When several parties are ordered to pay costs, the court shall determine each party’s proportional share, without prejudice to any joint and several liability established by law” (boldface added). This means, from the outset, that costs shall always be borne by the unsuccessful party and, consequently, under the procedural rule, it is an exemption from their payment, whether total or partial, that requires a reasoned explanation from the Court, since it constitutes an exception to the statutory obligation to order the unsuccessful party to pay costs.
It is therefore clear that Article 267 of the Código Procesal Penal establishes, as a general rule, that costs shall be borne by the unsuccessful party, but the court may exempt that party, in whole or in part, when there is a plausible reason for litigating. Legal scholarship states that: “...The imposition of costs upon the unsuccessful party is limited by the court’s authority—not its duty—to exempt that party, in whole or in part, from their payment when there was a plausible reason for litigating. Such a reason exists when objectively or subjectively reasonable circumstances were sufficient to lead the party to believe that litigation was necessary... ultimately, liability for the payment of costs is not purely objective by virtue of the adverse outcome alone, but also has a subjective aspect that permits an assessment of the unsuccessful party’s fault...” (Nombre15. (1986). Código Procesal Penal de la Provincia de Córdoba, Córdoba, pp. 541 and 542).
In this particular case, the facts themselves show that the Procuraduría General de la República had justified subjective and objective grounds for bringing the civil action against the offender, because its claim was based not only on its legal duty as the State’s representative, but also on the environmental damage caused by the accused to natural resources, in whose protection the State has an interest. This justified the award of costs against the civil defendant, and there is no reason to conclude that he should have been exempted from payment, either partially or entirely, such that the Trial Court would have been required to issue a ruling of that kind. Therefore, under the cited rule, because the Court granted the claim, the award of costs was the direct consequence of that ruling and required no further reasoning of the kind sought by the defense. Consequently, the claims presented cannot be granted.
POR TANTO:
The appeal filed is denied. Notice shall be given.

PODER JUDICIAL TRIBUNAL DE APELACIÓN DE SENTENCIA PENAL Resolución: 2013-2799 TRIBUNAL DE APELACIÓN DE SENTENCIA PENAL. Segundo Circuito Judicial de San José. Goicoechea, a las trece horas cuarenta y ocho minutos del veintidós de noviembre de dos mil trece.
RECURSO DE APELACIÓN interpuesto en la presente causa seguida contra Nombre01 , nacido en […], por el delito de INFRACCIÓN A LA LEY FORESTAL, en su modalidad de TALA ILEGAL y APROVECHAMIENTO ILEGAL DE RECURSOS FORESTALES en perjuicio de LOS RECURSOS NATURALES. Intervienen en la decisión de los recursos, los jueces Edwin Salinas Durán, Jorge Luis Arce Víquez, y la jueza Sandra Zúñiga Morales. Se apersonaron en esta sede, el licenciado Alejandro Ureña Garita, defensor público del imputado, y la licenciada Margot Avellán Ruiz, en representación de la Procuraduría General de la República, y
RESULTANDO:
I.Que mediante sentencia Nº 09-S-2013, de las 13:00 horas del 30 de enero de 2013, el Tribunal Penal del Segundo Circuito Judicial de la Zona Atlántica, resolvió: "POR TANTO: Razones dichas, reglas de la sana crítica racional, artículos 39 y 41 de la Constitución Política, 1, 30, 31, 45, 50, 51, 69, 71, todos del Código Penal, 9, 75 a 80, 111 a 124, 265, 360 a 365, 366, 367, 3680 todos del Código Procesal Penal, 61 inciso a) y 66 de la Ley Forestal, al resolver el presente asunto, Declara a Nombre01 autor responsable de un delito de APROVECHAMIENTO ILEGAL DE PRODUCTOS FORESTALES, cometido en perjuicio de LOS RECURSOS NATURALES, y en tal carácter se le impone como sanción UN MES DE PRISIÓN, que descontará en la forma y lugar que determinen los respectivos reglamentos penitenciarios. Se conmuta la pena a treinta días multa a razón de seis mil colones el dìa, para un total de ciento ochenta mil colones.
Multa que deberá cancelar a favor del Patronato Nacional de Bienes de Adaptació n Social, cuenta número 34870 del Banco Nacional de Costa Rica, dentro del plazo de quince días contados a partir de la firmeza de este fallo. En caso de no pago de multa, y que hubiera que hacer efectiva la prisión de treinta días, se concede el beneficio de ejecución condicional de la pena, por un plazo de tres años de prueba bajo apercibimiento de que si incurre en nuevo delito doloso sancionado con pena superior a seis meses, le será revocado el beneficio aquí concedido., Comuníquese lo pertinente al Registro Judicial, Juez ejecución de la Pena y Adaptación Social para lo de su cargo. Se acoge la acción civil resarcitoria incoada por el Estado, se condena al sentenciado Nombre01 al pago de las costas, intereses, daños y perjuicios ocasionados con su actuar ilícito, condena que se hace en abstracto, debiendo ocurrir el actor interesado a la correspondiente vía para su ejecución.
Asimismo, en aplicación del principio in dubio pro reo, se le absuelve por el delito de TALA ILEGAL que se le atribuyó en daño de los recursos naturales. En cuanto al imputado Nombre02 , se le absuelve de toda pena y responsabilidad por el delito de APROVECHAMIENTO ILEGAL DE PRODUCTOS FORESTALES Y TALA ILEGAL, que se le venia atribuyendo en perjuicio de los RECURSOS NATURALES; en cuanto a éste, se declara sin lugar la acción civil resarcitoria eximiendo al actor civil de costas, por considerar que tuvo razón plausible para litigar. POR LECTURA NOTIFÍQUESE. Nombre03. JUEZ DE JUICIO" (sic).
II.Que contra el anterior pronunciamiento, el licenciado Alejandro Ureña Garita, defensor público del imputado Nombre01, presentó recurso de apelación.
III.Que verificada la deliberación respectiva de conformidad con lo dispuesto por el artículo 466 del Código Procesal Penal ( reformado por leyes Nº 8837 y Nº 9021 y siguiendo la numeración indicada en la Fe de Erratas adoptada mediante acuerdo del directorio legislativo publicado en La Gaceta Nº 51 del 12 de marzo de 2012), el Tribunal se planteó las cuestiones formuladas en la impugnación.
Redacta el juez de apelación Salinas Durán, y
CONSIDERANDO:
I.El licenciado Alejandro Ureña Garita, defensor público del imputado Nombre01, presenta como apartado primero de su recurso de apelación "inconformidad con la determinación de los hechos o imputación que no abarca todos los elementos que requiere el aprovechamiento ilegal de recursos forestal". Sostiene que tanto la acusación del Ministerio Público como la querella y la acción civil de la Procuraduría General de la República carecen de una debida relación de cómo se dieron los hechos, porque se acusó que el imputado realizó una tala y aserró madera sin contar con permiso de la administraciónòn forestal o un estudio de impacto ambiental de Setena. Al observar el núcleo de la imputación se hace referencia al aprovechamiento forestal, lo que remite a otras normas de la Ley Forestal, porque no es posible determinar que no hubo tala pero sí aprovechamiento forestal. Refiere que el Juzgador no acreditó la tala.
Estima que de acuerdo al artículo 3 de la Ley Forestal para la configuración del aprovechamiento se requiere no solo indicar la conducta realizada sino el eventual o efectivo resultado generado. Lo que implica una serie de acciones (corta, eliminación de árboles en pie o utilización de los caídos) y una determinada ventaja, ganancia, utilidad o beneficio para quien realiza la acción o al tercero que representa, sin que ese beneficio sea necesariamente económico porque puede ser por otras razones como paisajista, construcción de obras en el sitio, o uso de la madera con fines artísticos. Desde esa óptica, el requerimiento fiscal solo acusa el primer aspecto normativo, sea el aprovechamiento, por haber cortado varios árboles dentro de un área de protección, pero deja de lado que el aprovechamiento forestal requiere además puntualizar cuál es la utilidad que tiene para el sujeto activo o para quien lo represente.
Señala que nunca se indicó cuál fue el provecho, ventaja, ganancia o utilidad que dicha actividad generó a los acusados. Con cita de jurisprudencia constitucional hace hincapié en la necesidad de una relación precisa y circunstanciada del hecho punible atribuido. Considera que se condenó a su representado por un hecho ilícito que no realizó y que no se pudo determinar cuál fue el beneficio que obtuvo. En el apartado segundo reclama "inconformidad con la valoración de la prueba y falta de fundamentación". Indica que a partir de que el testigo Nombre04 pudo reconocer en juicio a su representado, el Tribunal lo condenó, pues aquel refirió que era uno de los que se encontraba en el lugar. Sin embargo, el Juzgador no valoró que el testigo entró en contradicciones. Dijo que había hecho informes que estaban en el expediente, que algunos árboles estaban en el área de reserva, que le parecía que una de las personas estaba en la sala, que el señor dijo que podían hacerlo porque eran los propietarios y le habían comprado a doña Nombre05, que él hizo el informe, que no le constaba haber visto a Nombre01 aserrando madera, que el aserradero estaba en el potrero, que el que acompañaba a Nombre01 estaba sudado pero Nombre01 no, todo lo cual analizado de forma independiente indicaría si existe o no la probabilidad de que se su representado tenga responsabilidad.
Esto porque no hay ningún informe suscrito por el testigo, de su declaración no se puede desprender cuáles árboles requerían permiso y cuáles no. El que señalara a su representado como una de las personas que estaba en el sitio no se puede afirmar con seguridad, porque no se sabe si antes lo había visto o o alguien le dijo que era él. No fue un reconocimiento en rueda de personas. Ningún otro testigo ubicó a los imputados en el lugar. No hubo certeza de que su representado sea el dueño de la propiedad, pues doña Nombre06 indicó que le había vendido a dos personas, y una de éstas luego vendió a Nombre07, por lo que no se sabe si éste era la persona que estaba en sitio. Desde su punto de vista, la declaración de Nombre08 dejó dudas y no es suficiente para acreditar que se dio el aprovechamiento forestal, máxime que no se acreditó la tala de árboles, porque unos árboles requerían permiso y otros no. Nadie declaró que vio a alguna persona aserrando, solo escucharon el ruido de una sierra, y cuando llegaron todo era normal.
No se puede asegurar que su representado estuviera aserrando. Señala que Nombre09 estuvo en la primera visita y no hizo ningún decomiso porque los árboles cortados no lo requerían. y la señora Nombre10 dijo que ni siquiera se bajaron del carro, por lo que era imposible que vieran quién estaba aserrando. En su criterio, no se hizo una valoración completa y hubo falta de fundamentación, dejándose de aplicar los principios de inmediación e inocencia o in dubio pro reo. En el apartado tercero reprocha "falta de fundamentación en cuanto al pago de las costas ". Refiere que el Juzgador no explicó la condena en costas, porque su representado no realizó maniobras dilatorias, y su oposición a los hechos acusados lo fue bajo la tesis de que no cometió los mismos. No se valoró si hubo o no razón plausible para litigar, y no basta solo pronunciarse sobre las costas sino externar las razones por las cuales se condenó a su pago.
Posición de la Procuraduría General de la República. La licenciada Margot Avellán Ruiz, contestó la audiencia conferida, señalando que los hechos acusados y querellados se ajustan a la normativa forestal, porque resultó claro que el imputado junto con otro sujeto aprovecharon recursos forestales provenientes de una tala y aserrío, porque utilizando una motosierra talaron 53 árboles, 49 de los cuales estaban en un área protegida. El Tribunal acreditó válidamente la conducta, y aunque no se pudo establecer que el imputado fuera el autor de la tala, sí aprovechó esos recursos, que tenia en tablones de madera ya procesados y costillas de madera. Es claro que hubo un aprovechamiento de los árboles caídos. Los testigos refieren que el imputado se manifestó como propietario del inmueble y con derecho a cortar los árboles. El aprovechamiento de la madera fue valorado en ¢5.397.027,00f por el daño ambiental lo que verificó que era la voluntad del acusado el aprovechamiento de los árboles, pero además por el cambio del uso del suelo.
La prueba fue debidamente valorada. El testigo Nombre11 fue enfático en señalar al acusado como una de las dos personas que estaban en el lugar, y aunque pudieran haber algunas confusiones esto se debe a que pasaron más de cinco año. Éste junto con la testigo Nombre10 fueron contundentes en que escucharon las motosierras y que ubicaron al acusado en el lugar y se identificó como dueño de la propiedad y con derecho a cortar los árboles, lo que es coincidente con lo que arroja el expediente. Si era el dueño y estaba en el sitio, era evidente que, al menos, era un autor mediato. En cuanto a las costas la regla general es que las costas corren a cargo de la parte vencida, por lo que la excepción es el deber de fundamentar la exención de las mismas, pero no la condena, que dimana expresamente de la norma procesal. Solicita rechazar el recurso del la defensa.
II.El recurso no resulta atendible. El recurrente en su planteamiento propone tres reclamos puntuales, en el primero, la propuesta parte de estimar que conforme el artículo 3 de la Ley Forestal, relacionado con el numeral 61 de la misma normativa, se requiere para que se pueda configurar el aprovechamiento forestal, no solo acreditar la conducta realizada por el acusado sino la utilidad que tiene para éste o para quien lo representa, aunque no sea un fin económico, lo que considera no se acreditó. Sin embargo, tal y como lo señala la representación de la Procuraduría General de la República, y lo acogió la sentencia de mérito, la conducta del imputado Nombre01, aun y cuando no se le pueda endilgar que sea el autor directo de la tala de los 53 árboles, 49 de los cuáles estaban en el área de bosque, pues no hubo testigos que lo observaran talando, si resultó evidente que era él, como se acusó, quien iba a aprovechar el producto de los árboles caídos, que ya estaban aserrados en tablones, no solo por el valor económico de la madera así aserrada, sino por el cambio producido en el uso del suelo de esa propiedad, circunstancia que se desprende, desde el mismo momento en que el propio imputado Nombre01 de forma espontánea se presentó ante los inspectores forestales como el dueño del inmueble y como tal, con la potestad de disponer, aun sin permiso oficial, de los árboles sitos en el fundo, lo que se entiende, eran tanto los que estaban en pie como caídos.
Es claro que si el encartado estaba en la finca cuando los inspectores forestales, alertados por el ruido de la motosierra, se presentan al sitio, y allí hay una serie de árboles cortados, algunos de los cuales ya están aserrados en tablones, al igual que están las costillas o retazos de madera, el aserrín que produce la corta, como también la herramienta necesaria para aserrar la madera, y como se repite, éste le manifiesta espontáneamente a los funcionarios forestales que es el propietario y no ocupa de permiso para disponer de esos árboles, resulta de perogrullo. como lo concluyó el Tribunal, que tenía conocimiento de esa tala como que la consintió, y en consecuencia aprovecharía esos recursos forestales, pues distinto a como lo percibe el recurrente, era el acusado quien, declarándose de viva voz propietario y con disposición sobre su fundo, tanto obtendría el beneficio económico al disponer de la madera, como por el uso del suelo, no ya de bosque, sino del potrero o para su cultivo.
Desde esta perspectiva, esa conducta sí incumbe a la prevista en el numeral 61 de la Ley Forestal que señala: "Se impondrá prisión de un mes a tres años a quien: a) Aproveche uno o varios productos forestales en propiedad privada, sin el permiso de la Administración Forestal del Estado, o a quien, aunque cuente con el permiso, no se ajuste a lo autorizado...", pues, al tenor del artículo 3 de la Ley de cita, el aprovechamiento se define como: "a) Aprovechamiento maderable: Acción de corta, eliminación de árboles maderables en pie o utilización de árboles caídos, realizada en terrenos privados, no incluida en el artículo 1 de esta ley, que genere o pueda generar algún provecho, beneficio, ventaja, utilidad o ganancia para la persona que la realiza o para quien esta representa". Esto es así, porque, si se acreditó que al acusado Nombre01 se le tuvo como propietario del inmueble, estuvo presente en el sitio cuando llegaron los inspectores forestales, y allí estaban los 59 árboles cortados y procesados, siendo evidente que trabajaban en ese momento sobre esos recursos, pues se notaban sudorosos, tenían una sierra y un marco (herramientas propias para el trabajo de aserradero), también galones de gasolina y especialmente los tablones de la corta de árboles, que se observaban frescos y estaban acomodados o apiñados a la orilla, lo que acorde con las reglas de la sana crítica, denotaba que trabajaban en ellos.
Además, resultó que 49 árboles procedían del área de bosque, todo lo cual implica que la conducta del acusado sí incumbe al aprovechamiento forestal, pues aun y cuando no se le responsabilice de la tala, pese a que como lo sostiene la Procuraduría General de la República, sí podría estimarse su autoría mediata, en tanto pudo utilizar a un tercero para que efectuara la tala, era a él a quien, evidentemente, esa tala, cuando menos, podía generar "algún provecho, beneficio, ventaja, utilidad o ganancia", puesto que igualmente se acreditó que esa madera tenía un valor económico considerable, más de dos millones de colones. Amén, de la variación para el uso futuro de la finca, fuera como potrero o para cultivo. Consecuencia de lo anterior, ese reclamo no puede prosperar, porque la ventaja o utilidad sí está descrita en la acusación y en la querella, y es el valor millonario de la madera. El segundo tema que propone la defensa, es la discusión acerca de la presencia de su patrocinado en el lugar donde ocurrió la tala que, a criterio del recurrente, se fundó únicamente en el testimonio de Nombre04, que estima fue contradictorio.
No obstante, no lleva razón, pues la sentencia lejos de carecer de una fundamentación adecuada, más bien logra establecer, tal y como antes se refirió, tanto que el imputado Nombre01 estaba en el sitio cuando llegaron los inspectores forestales, como que manifestó ser el propietario del inmueble y tener derecho a talar, virtud de esa condición. Pese al paso de los años, ese testigo pudo identificar al acusado como una de las dos personas que estaba en el sitio, y si bien, la testigo Nombre08 no pudo realizar ese señalamiento puntual, ello no descarta la presencia del imputado en aquella oportunidad, pues ésta coincidió en los detalles narrados por Nombre08 y en que, ciertamente, hubo dos personas en el sitio, precisamente las dos personas que fueron acusadas. Todo lo cual se respalda en la prueba documental y con la restante testimonial que apoyó la actuación de los inspectores forestales, tal y como lo señalaron también Nombre12 y Nombre13.
Es decir, el que solo uno de los testigos haya tenido la capacidad de reconocer al encartado Nombre01, no propicia una duda, sino más bien, que fue solo ese testigo, a diferencia de los otros, quien pudo hacer esa identificación, en tanto la testigo Nombre10 fue clara en que "solo eran dos personas, no sabría decir si están aquí presentes " (folio 168), y el testigo Nombre10 dijo: "Si viera a los imputados aquí, no los reconocería " (folio 169), manifestaciones que, entonces, más que descartar la presencia del acusado y, por ello, desmerecer al testigo Nombre08, solo advierten de una incapacidad de los deponentes para recordar las características físicas de las dos personas que estaban en aquel lugar aquel día, pero que, sin duda, eran las dos personas contra quienes se siguió la causa y así lo acreditó la denuncia de folio 1 a 16, donde el propio testigo Nombre10 denunció al acusado Nombre01.
Tampoco la declaración de la testigo Nombre05 propicia alguna duda de que Nombre01 no fuera el propietario, en virtud de que según recordó vendió a otras personas y éstas a su vez vendieron a otras. Lo que interesa, y acreditó el fallo, es que a la llegada de los inspectores forestales a la finca donde se verificó la tala, fue el acusado Nombre01 quien asumió ese rol, y como tal, advirtió de su potestad para disponer de ese inmueble. Es decir, el que la testigo Nombre14 no le hubiese vendido a Nombre01 no desacreditó que éste no fuera el propietario, pues dicha testigo ni siquiera conoció en manos de quien quedó ese terreno luego de que ella lo vendió, y se descartó que fuera un sujeto de nombre Nombre07 quien pudiera estar en ese sitio, cuando es más que evidente que la denuncia y los testimonios evacuados establecieron que era el aquí acusado Nombre01 quien estuvo en el sitio y se presentó como propietario ante los inspectores forestales, aun y cuando, anteriormente, la testigo Nombre14 pudiera haberle vendido a otra persona que luego le vendió a Nombre07.
Por ende, diferentes propietarios no hacen mella en que fue el acusado Nombre01, y no otra persona, quien se presentó como tal, y fue éste quien aprovechó los recursos forestales que dimanan de la tala en cuestión. Consecuentemente, tampoco este argumento puede prosperar. Por último, reclama el recurrente, que el Tribunal de Juicio, al acoger la acción civil resarcitoria, debió fundamentar la condena en costas que impuso al demandado civil, por lo que al no hacerlo, esa condena resultó infundamentada. Sin embargo, tal argumento, parte de desconocer la disposición normativa procesal, que señala: "ARTICULO 267.- Fijación de las costas. Las costas estarán a cargo de la parte vencida, pero el tribunal podrá eximirla, total o parcialmente, cuando haya razón plausible para litigar. Cuando sean varios los condenados al pago de costas, el tribunal fijará la parte proporcional que corresponda a cada uno, sin perjuicio de la solidaridad que establezca la ley" (la negrita se suple) que implica, de inicio, que siempre será la parte vencida la que corra con las costas, y en consecuencia, al tenor de la norma procesal, es la exención al pago de las mismas, total o parcial, lo que requiere una fundamentación razonada de parte del Tribunal, desde que es una excepción a la obligación normativa de condena al vencido.
En ese sentido, entonces, es claro que el artículo 267 del Código Procesal Penal establece por regla que las costas serán para la parte vencida, pero el tribunal podrá eximirla, total o parcialmente, cuando hubiera razón plausible para litigar. Señala la doctrina que: "...La imposición de las costas a la parte vencida tiene su límite en la facultad -no el deber- del tribunal de eximirla total o parcialmente de su cargo cuando se hubiera tenido razón plausible para litigar. Existe esta razón si para inducir a la parte al litigio han mediado circunstancias objetivas o subjetivas razonablemente suficientes para fundar su creencia en la necesidad de hacerlo ... en definitiva, la responsabilidad por el pago de las costas no es puramente objetiva por el mero vencimiento, sino que tiene un reflejo subjetivo, que abre el camino a un juicio sobre la culpa del vencido..." (Nombre15. (1986). Código Procesal Penal de la Provincia de Córdoba, Córdoba, pág. 541 Y 542).
En el caso particular, de los propios hechos se desprende que la Procuraduría General de la República tuvo razones subjetivas y objetivas justificadas para interponer la demanda civil contra el infractor, pues su petición tiene sustento no solo en su obligación legal como representante del Estado, sino por el daño ambiental causado por el acusado en perjuicio de los recursos naturales, en cuya protección hay un interés estatal, lo que justificó la condena en costas al demandado civil, sin que exista ninguna razón para estimar que debió eximírsele de ese pago, ni parcial ni total, de modo que evidenciara que debió el Tribunal de Juicio emitir un pronunciamiento de esa especie. Por ende, conforme a la norma de cita, si el Tribunal acogió la demanda, la condena en costas fue la consecuencia directa de ese pronunciamiento y no ocupó de mayor razonamiento como gestiona la defensa. En consecuencia los reclamos presentados no pueden acogerse.
POR TANTO:
Se declara sin lugar el recurso de apelación presentado. Notifíquese.
