SummaryResumen

The Agrarian Court holds that the ordinary proceeding seeking agrarian adverse possession of land that may belong to JAPDEVA and lies within an ecologically important area—specifically, the Barra del Colorado Wildlife Refuge—falls within the agrarian jurisdiction. The participation of JAPDEVA, the Attorney General’s Office, or another public entity does not by itself convert the controversy into an administrative-law case. Jurisdiction instead depends on the substantive nature of the dispute: the court must examine the requirements of agrarian prescription and the property’s connection to productive activities or natural-resource conservation. Relying on constitutional case law concerning Articles 49 and 153 of the Constitution, the Court explains that specialized jurisdictions may review the legality of certain administrative acts. Because agrarian legislation specifically governs the controversy and prevails over general jurisdictional rules, the Court rejects the trial judge’s decision to decline jurisdiction and declares that the case must remain before the agrarian courts.

IV.- Furthermore, and for the sake of completeness, it must be stated that agrarian adverse possession is claimed in this ordinary proceeding, making this a dispute in which the elements of the doctrine of agrarian prescription must be analyzed. The State is indeed participating in this proceeding because it is known that the properties are located in an area of ecological importance, namely the Barra del Colorado Wildlife Refuge, precisely to safeguard any rights that may belong to the State. It must also be emphasized that this Court has previously heard ordinary proceedings identical to this one (see Decision No. 721 at 2:07 p.m. on October 31, 2003), which were affirmed by the First Chamber of Cassation (No. 952 at 4:20 p.m. on December 7, 2005). For that reason, the Organic Law of the Judiciary reserved jurisdiction over all agrarian matters to the agrarian courts, including those in which the Agrarian Development Institute, the Atlantic Coast Port Authority and Economic Development Board, or the Attorney General’s Office participates in defense of its interests. This is expressly provided in Article 22 of the Agrarian Jurisdiction Law, which, as a special law governing the subject matter, must prevail over any other general law. V.- In light of the foregoing, the proper course is to reject the declination of jurisdiction declared by the lower court.

Heard before the Juzgado Agrario del Segundo Circuito Judicial de la Zona Atlántica, Guápiles.- Judge Alvarado Paniagua authors the decision; and, WHEREAS (CONSIDERANDO):

I.By decision issued at fifteen hours and thirteen minutes on catorce de noviembre del dos mil trece, the Judge of the Juzgado Agrario del Segundo Circuito Judicial de la Zona Atlántica disqualified himself (se inhibió) from continuing to hear this matter and referred the proceeding to the Tribunal so that jurisdiction (competencia) could be determined, upon finding that this matter is not agrarian but rather contentious-administrative in nature (Contencioso Administrativa), because it involves property that may belong to the State.- (See decision at folios 817 and 818).-

II.In a case similar to the one now before us, this Tribunal recently favored keeping this type of proceeding within the Agrarian Jurisdiction (Jurisdicción agraria), as part of its specialized jurisdiction. “II. Before ruling on jurisdiction in this specific case, it is important to mention the judicial precedents that have existed regarding the conflict between agrarian and administrative litigation jurisdiction (jurisdicción contencioso-administrativa). The Tribunal, in Voto N° 91 of 10:00 hours on 15 de febrero de 1994, reiterated in N° 102 of 9:50 hours on 10 de marzo de 1999, stated as follows: ‘VI.- For some time, our case law has been defining the contours of agrarian matters (materia agraria). The fundamental consideration that has prevailed for this purpose is the criterion of agrarian activity (actividad agraria), which is the lowest common denominator of the legal institutions of Agrarian Law (Institutos del Derecho Agrario).

Nevertheless, certain aspects have yet to be clearly defined, and one of them concerns precisely those cases or proceedings in which a public entity of the State is a party (as the Instituto de Desarrollo Agrario might be) and matters relating to agrarian legislation or to one of the legal institutions of our field are at issue; the problem arises not so much when the State’s property regime (régimen patrimonial del Estado) is at issue (through civil proceedings involving the Treasury (vía civil de hacienda)), but primarily when annulment of acts or provisions of the Public Administration (Administración Pública) is sought. Initially, the Sala Primera de la Corte Suprema de Justicia held, in judgments N° 117 of fifteen hours on seis de setiembre de mil novecientos ochenta y cinco, and N° 175 of sixteen hours and forty-five minutes on tres de diciembre de mil novecientos ochenta y seis, that the Administrative Litigation Jurisdiction had jurisdiction to hear and decide matters brought against the Instituto de Desarrollo Agrario.

Subsequently, in decisions N° 114 of fifteen hours and thirty minutes on diez de junio de mil novecientos ochenta y ocho and N° 149 of fifteen hours and fifty-five minutes on trece de julio de mil novecientos ochenta y ocho, it was held that such matters should be heard within the Agrarian Jurisdiction, with the following explanation: “Indeed, the Agrarian Jurisdiction may not be extended or waived (improrrogable) and must be exercised by tribunals specializing in the subject matter, regardless of the persons or entities appearing as parties to the proceedings, pursuant to Articles 5 and 15 of the Law under discussion. Consequently, in determining which court has jurisdiction to hear a matter, whether the Administration is the plaintiff or defendant is of secondary importance, because the proceeding must always be governed by the principles applicable to agrarian proceedings (proceso agrario), such as orality, immediacy, and direct judicial examination of evidence (inmediación de la prueba), which form the basis of Article 48 ibídem.

Thus, the mere fact that an administrative act (acto administrativo) is challenged or its annulment is sought does not mean that the matter must be brought before the Administrative Litigation Jurisdiction, because the agrarian subject matter, rather than the entity’s public nature, is controlling. Accordingly, if the case is among those specified in Articles 1 and 2 of the Jurisdictional Law and in the doctrine underlying it, jurisdiction to hear it lies with the Agrarian Tribunals.” (underlining not in the original). However, none of the aforementioned decisions drew a clear distinction between litigation proceedings (procesos Contenciosos) belonging to civil proceedings involving the Treasury and full-jurisdiction litigation proceedings (procesos Contenciosos de Plena Jurisdicción) or proceedings for the annulment of acts issued by the Public Administration. In judgment N° 183 of fifteen hours and five minutes on treinta y uno de octubre de mil novecientos noventa, the Sala Primera drew a distinction between those types of proceedings for the first time.

Regarding full-jurisdiction “AGRARIAN” litigation proceedings (proceso Contencioso “AGRARIO” de Plena Jurisdicción), it states as follows: “I.- Agrarian litigation (contencioso agrario) is a proceeding established in the Ley Reguladora de la Jurisdicción Contencioso Administrativa, N° 3667 of 6 de setiembre de 1968, jurisdiction over which lies with the Agrarian Jurisdiction when the matter in dispute falls within Agrarian Law. Specifically, this is so when the application of current agrarian legislation is involved, when the matter arises from the various activities carried out by an agrarian enterprise (empresa agraria) (the primary activity of production and the related activities of processing, industrialization, or marketing of agricultural products), or when agrarian contracts (contratos agrarios), ownership, possession, or any of the legal institutions of the field are at issue. It is a proceeding that does not lose the nature with which it was conceived, but jurisdiction over it was entrusted by the legislature to the Agrarian Judge because of the specialized nature of the rules to be applied and interpreted.

This is provided for in Article 79 of the Ley de Jurisdicción Agraria. This Law, logically, because it dates from mil novecientos ochenta y dos, postdates the administrative litigation law. In this regard, regardless of the participation of a public entity in the proceeding, the specialized nature of agrarian matters draws administrative litigation matters into its jurisdiction—as has also occurred with matters otherwise heard as civil, commercial, criminal, and other cases, with the sole exception provided for by law, namely labor matters—because the involvement of an administrative entity does not mean that it is solely and exclusively subject to that jurisdiction, as indeed occurs in matters in which the State is a party before other specialized jurisdictions, such as the labor or traffic jurisdictions. Agrarian litigation has solid legal foundations in both laws, and the already established procedure is understood to apply, but it must necessarily be adapted to the principles of Agrarian Procedural Law (Derecho Procesal Agrario), such as oral proceedings (verbalidad), through which evidentiary proceedings may be expeditious and prompt and the inherent principles of immediacy and concentration will operate more efficiently.

In these proceedings, however, the Judge must also assume a more dynamic role, advancing the proceedings without having to await a party’s application; the Judge may order evidence whose introduction at trial is deemed important for coming closer to ascertaining substantive truth rather than merely formal truth; the rules are to be interpreted broadly, without strict adherence to the rules of ordinary law; and the incorporation of the principle of free access to justice (principio de gratuidad de la justicia) into agrarian litigation is also important, in its twofold sense that no payment is required for any judicial act and no security for costs (afianzamiento de costas) is required.” That criterion is reiterated in Judgments N° 81 of thirteen hours on treinta y uno de mayo de mil novecientos noventa y uno, and N° 82 of thirteen hours and fifty-five minutes on treinta y uno de mayo de mil novecientos noventa y uno.

Those decisions clarify that when the legality of acts and provisions of the Public Administration subject to Administrative Law is at issue, the procedure established by the Ley Reguladora de lo Contencioso Administrativo must be applied, together with the principles specific to agrarian procedural law. They likewise establish that “With respect to proceedings heard in the Administrative Litigation Jurisdiction whose designation places them within civil proceedings involving the Treasury, because they are substantively ordinary proceedings (juicios ordinarios), and given that the Ley de Jurisdicción Agraria has provided a specific procedure for such cases, the proper course is to pursue ordinary agrarian proceedings (ordinario agrario) within this jurisdiction, rather than the procedure under the Ley Reguladora de la Jurisdicción Contencioso Administrativa.” “In addition to the foregoing, agrarian litigation will address only matters arising from acts of the Public Administration to which Administrative Law applies.

This is not the case in civil proceedings involving the Treasury, where the subject matter concerns the property regime or liability of the State and public institutions, or their Private Law capacity, even when, logically, rules of Public Law are involved.” VII.- In decision N° 148 of fifteen hours on once de setiembre de mil novecientos noventa y uno, the Sala Primera de la Corte Suprema de Justicia changed its position concerning administrative litigation annulment proceedings (Proceso Contencioso-Administrativo de anulación), granting jurisdiction to the Administrative Litigation Jurisdiction. In that decision, the majority held as follows: “The majority of the Sala considers that jurisdiction to hear this ordinary administrative litigation proceeding lies with the Juzgado Segundo de lo Contencioso Administrativo y Civil de Hacienda, where it was filed and has remained pending, because it is a full-jurisdiction administrative litigation proceeding in which a declaration is sought: ‘on the basis of the Ley Reguladora de la Jurisdicción Contenciosa Administrativa...,’ among other things, that decrees numbers 16306-G and 16307-G of dieciséis de mayo de mil novecientos ochenta y cinco are null and void because they incorporated new privately owned areas into the Reserva Indígena de Talamanca without establishing the corresponding compensation; that, because the aforementioned Decrees are null and void, Decreto N° 16323-G of veinte de diciembre de mil novecientos ochenta y cinco, which ordered the repeal of Decreto N° 16410-G of seis de junio de mil novecientos ochenta y cinco (which had ordered the expropriation of certain lands for the Reserva Indígena), lacks legal basis and must also be annulled.

In addition to the aforementioned claims for annulment, the plaintiff also seeks a declaration that the State and the Comisión Nacional de Asuntos Indígenas compensate it for the value of the lands, timber, interest, and damages; it is later stated: ‘V.- If we analyze the answer to the complaint (contestación a la demanda), we will also observe that the arguments made in opposition to the relief sought fall within the field of Administrative Law. Certainly, matters relating to the nullity or legality of the challenged decrees, as well as the public interest reflected in the State’s actions in establishing the Reservas Indígenas and embodied in administrative laws and administrative decrees, and matters relating to potential expropriations, fall within Public Law and, specifically, Administrative Law. There is only an indirect relationship with Agrarian Law insofar as the plaintiff company is an allegedly agroforestry enterprise, but this does not prevent its claims concerning the nullity of the challenged Executive Decrees and the alleged liability of the defendant public entities from having to be decided in the proper forum, namely administrative litigation proceedings.’” On that occasion, the dissenting minority opinion (Voto salvado de minoría) of the President of the Sala, Lic. Edgar Cervantes, maintained the criterion or lines of precedent set forth in the preceding recital (considerando).

Other subsequent decisions have sought to maintain this new criterion. Thus, Judgment No. 202 of fourteen hours and fifteen minutes on once de diciembre de mil novecientos noventa y uno stated as follows: “In the case at hand, the claims of the Instituto (IDA) do not seek the annulment of any administrative act, but rather of the transfers made between the defendants after the expropriation and cancellation of several properties. In cases such as this one, this Sala has repeatedly ruled that agrarian jurisdiction and competence may not be extended or waived, that they must be exercised by tribunals specializing in the subject matter, and that the fact that the State or a public institution appears as a party does not preclude this. And in decision No.

87 at thirteen hours twenty minutes on treinta de junio de mil novecientos noventa y dos, the following was stated: “Through these proceedings, among other things, the plaintiff seeks a declaration of nullity (nulidad) of an administrative act (acto administrativo) issued by the Instituto de Desarrollo Agrario, ordering him to vacate a strip of land [Dirección1] hundredths (sic) wide by [Dirección2] forty meters long, located along one of the boundaries (colindancias) of a lot that he possesses in Cariari de Guápiles, Limón, on which there is a dwelling and a commercial building. What is at issue is a small strip of land on which, moreover, no agricultural activity (actividad agraria) is conducted; therefore, this is not a matter of an agricultural nature, but rather a contentious-administrative matter (asunto contencioso administrativo), because it concerns the challenge (impugnación) of an administrative act. Accordingly, it is appropriate to declare that jurisdiction (conocimiento) over this matter lies with the Juzgado Cuarto de lo Contencioso Administrativo y Civil de Hacienda.”

VIII.As we can see, conflicting positions have arisen within the Sala Primera de la Corte itself, which is ultimately responsible for resolving these conflicts of jurisdiction (conflictos de competencia). This has prompted a nationwide debate (See the Case Comments by Cesar Hines C. in Revista Ivstitia N° 64, page 12, and by Álvaro Meza Lázarus in Revista Ivstitia N° 68, page 18). Dr Rafael González Ballar, commenting on the judgment concerning agricultural litigation (contencioso agrario), states as follows: “From the passage transcribed above, we may draw several important observations: a-) first, a hybrid subtype of proceeding known as ‘agricultural contentious-administrative proceedings’ is clearly defined,” b-) derived from the Regulatory Law of the Contentious-Administrative Jurisdiction (Ley Reguladora de la Jurisdicción Contencioso Administrativa) (it is number 3667 of 12 de marzo de 1966, and not as erroneously indicated), c-) which then assumes the inherent nature of the law from which it ostensibly originated (‘it is a proceeding established in the Ley Reguladora de la Jurisdicción Contencioso Administrativa... which does not lose the nature in which it was conceived...,’ the judgment states); ch) it must be governed by the principles and rules of agricultural procedural law (derecho procesal Agrario).

It is therefore, d) subject to the jurisdiction of the agricultural courts (jurisdicción agraria), fundamentally because of e-) the specialized nature of the rules applied and interpreted therein. This is so, of course, f-) when the subject matter in dispute falls within Agricultural Law (Derecho Agrario). Thus, g-) it is irrelevant whether a public entity participates in the ‘proceeding’ as a party (sujeto procesal)... Based on the foregoing enumeration, it must be made clear that our Ley Reguladora de la Jurisdicción Contencioso Administrativa does not expressly or implicitly establish a special procedure such as the one described. With the exception of the special judicial procedures established for tax matters, removal of directors, and preparatory and final acts of administrative contracting (contratación administrativa) (art. 82, 87 y 89), the procedure established therein is single, unequivocal, and uniform.

Therefore, it cannot be asserted, as the judgment does, that the aforementioned ‘agricultural contentious-administrative’ proceeding derives from our Regulatory Law. It is, obviously, the result of the judgment itself and, in that sense, is of purely case-law origin (origen netamente jurisprudencial)” (See GONZÁLEZ BALLAR RAFAEL). In Derecho Agrario Costarricense, edited by [Nombre3], 1992, p. 346-347. In our country, unlike the Venezuelan Agricultural Jurisdiction (Jurisdicción Agraria Venezolana), annulment proceedings (proceso Contencioso de anulación) are not expressly contemplated as part of the Agricultural Cooperative (Cooperativa Agraria). Indeed, in Venezuela, the Organic Law on Agricultural Courts and Procedures (Ley Orgánica de Tribunales y Procedimientos Agrarios) makes a clear distinction between Agricultural Contentious-Administrative Proceedings under Full Jurisdiction (Proceso Contencioso-Agrario en plena jurisdicción) and Agricultural Annulment Proceedings (Contencioso Agrario de Anulación).

With respect to the former, legal scholarship states as follows: “If disputes between agricultural producers and agricultural administrative bodies constitute autonomous actions distinct from other agricultural actions, thereby justifying reference to the category of agricultural contentious-administrative proceedings under full jurisdiction, the fact that special rules constituting privileges for those bodies are applied in the procedure through which such claims are pursued also supports the proposition that this category exists within agricultural matters. Indeed, given their nature as true claims or causes of action (demandas o pretensiones), the applicable procedure is the same agricultural procedure, which is the labor procedure, unless the Ley Orgánica de Tribunales y Procedimientos Agrarios and other special laws establish special procedures for adjudicating the action...” With respect to the latter, legal scholarship states: “... pursuant to the provisions of article 2 of the Ley Orgánica de Tribunales y Procedimientos Agrarios, agricultural matters also encompass actions for nullity (acciones de nulidad) against administrative acts issued by agricultural administrative bodies...” In this manner, the Juzgado Superior Agrario de Caracas acquires the status of a Special Contentious-Administrative Court (Tribunal Especial de lo Contencioso Administrativo)...

Jurisdiction over these special contentious-administrative proceedings is assigned, at first instance, to the Juzgado Superior Agrario, seated in Caracas, and, at second instance, to the Corte Primera de lo Contencioso Administrativo, in accordance with article 28 of the Ley Orgánica de Tribunales y Procedimientos Agrarios. However, in conducting and deciding such proceedings, that Court must apply, depending on whether the actions seek nullity of acts having general or individual effects, the procedure prescribed for such actions in Secciones Segunda, Tercera y Cuarta del Capítulo II, Título V of the Organic Law of the Supreme Court of Justice (Ley Orgánica de la Corte Suprema de Justicia). In those proceedings, the Juzgado Superior Agrario may also exercise the authority and powers granted to it by the Ley Orgánica de Tribunales y Procedimientos Agrarios in all agricultural proceedings, namely those provided for in the articles...” (See DUQUE CORREDOR ROMAN) Derecho Procesal Agrario.

Ed. Jurídica Venezolana, Caracas 1986, p. 304, 309 y 311). (Emphasis by underlining is not in the original.) Thus, in the Venezuelan Agricultural Jurisdiction as well, this takes the form of a hybrid proceeding in which the prescribed procedure must be followed, while the principles specific to agricultural proceedings may also be applied.

IX.As stated in the first recital (considerando primero), the ordinary action (demanda ordinaria) seeks recovery of damages (daños y perjuicios) arising from investments in cacao cultivation that failed because the seed was not of good quality; the banking entities sued herein, which form part of the Sistema Bancario Nacional, and other State institutions participated as creditors in financing those activities. This is unquestionably a civil proceeding involving the Public Treasury (proceso civil de hacienda), which must be conducted in accordance with articles 38 et seq. of the Ley de Jurisdicción Agraria. The situation would be different if the nullity of administrative acts issued by the defendant public entities were at issue, in which case the matter would have to be heard in the contentious-administrative jurisdiction (jurisdicción contencioso-administrativa).”

III.In other matters, the Tribunal has invoked, as a jurisprudential framework, the principles stated by the Sala Constitucional concerning the authority of other jurisdictions to hear claims against the State: “III.- Clearly, the issue is whether other ‘jurisdictions,’ apart from the contentious-administrative jurisdiction (jurisdicción contencioso-administrativa), would have authority to adjudicate the nullity of acts and contracts originating from the Public Administration. In a recent judgment, the Sala Constitucional resolved that issue as follows: ‘VII.- If the provision granted the status of a subjective right (derecho subjetivo) to the possibility of challenging unlawful acts “of the administrative function of the State, its institutions, and every other public-law entity” (art. 49 prf.1), the second characteristic of this right follows: it may be exercised before any court of the Republic to which the law has delegated those powers.

Accordingly, this Sala finds that the legislature’s decision to create specialized jurisdictions in which the legality of acts of the Public Administration may be adjudicated, such as the agrarian jurisdiction (jurisdicción agraria), does not violate the constitutional order.’” (Emphasis added). Sala Constitucional, N° 2023 at 15 hours 57 minutes on 3 de agosto de 1993. IV.- In more recent judgments, the Tribunal Agrario has maintained the position that, even when a State entity is sued, if agrarian matters are involved, the case must remain within the Agrarian Jurisdiction: “In this case, the dispute concerning the conflict of jurisdiction (conflicto de competencia) between the agrarian and contentious-administrative jurisdictions arises again. Certainly, the position of the Sala Primera de la Corte Suprema de Justicia has been reiterated in its latest judgments, to the effect that if an administrative act (acto administrativo) is challenged on grounds of nullity, jurisdiction lies with the Jurisdicción Contencioso Administrativa (among others, Voto N° 758-C-2002 at 9:30 hours on 4 de octubre del 2002).

Nevertheless, this case must be analyzed very carefully because of the implications that would arise if the matter were referred to the Jurisdicción Contencioso Administrativa, since the purpose pursued by special agrarian legislation would be lost. Indeed, this ordinary agrarian proceeding (ordinario agrario) is brought by [Nombre4], who raises substantive issues that are eminently agrarian. As may be seen, the fundamental issue in the ordinary proceeding is not only the nullity of an agrarian administrative act (acto administrativo agrario); the plaintiff also requests that she retain ownership of an agrarian holding (fundo agrario) and, in the alternative, that she be compensated for the value of the property, the interest, and the improvements she has made since 1991, claims that are proprietary-agrarian in nature (naturaleza real-agraria). Furthermore, it must be considered that the Land Allocation Contract (contrato de Asignación de Tierras) is a contract establishing an agrarian enterprise (empresa agraria), through which the Agrarian Entity (Instituto de Desarrollo Agrario) awards an agrarian holding to a producer or peasant who lacks land, subject to the conditions, restrictions, and limitations established by the Law itself.

The purpose of the agrarian contract (contrato agrario) is to fulfill the social function of property (función social de la propiedad), and it seeks to achieve an equitable distribution of land so that persons with limited financial resources may have access to it. Logically, the resolution issued by the Instituto’s Junta Directiva creates an administrative act whose purpose, grounds, and content are substantively linked to the specific purposes of the Ley de Tierras y Colonización; therefore, review of the administrative act and its revocation or nullity cannot be considered from a purely administrative perspective. In this case, it would be necessary to analyze not only the procedure itself used by the Instituto to grant the award, but, fundamentally, whether the substantive grounds could affect the plaintiff’s real rights (derechos reales). Because this is an agrarian administrative act (acto agrario administrativo) with property-related consequences, and because it gives rise to highly important institutions of Costa Rican Agrarian Law, such as the agrarian enterprise, agrarian possession (posesión agraria), the social function of property, and special agrarian succession (Sucesión especial agraria), it is clear that the matter must be decided by a judge specializing in agrarian matters rather than by a contentious-administrative judge.

V. An agrarian administrative act encompasses legally relevant interests arising from the exercise of the administrative function and the regulation of agriculture by a public agrarian entity. If a distinction is drawn among the rules governing agrarian administrative acts, some will be specifically agrarian and others will be general administrative rules. The specifically agrarian rules are those containing provisions concerning the grounds, content, cause, and purpose of the agrarian administrative act. Their core revolves around the concept of agrarian character (agrariedad), since their defining feature is the development of a biological cycle in agrarian activity to fulfill the economic, social, and environmental functions of the institutions of Agrarian Law. It has therefore been stated that ‘The agrarian administrative act differs from other administrative acts because of its specific purpose, which is to fulfill the social function of the agrarian enterprise.

Analysis of the purpose of the agrarian administrative act is one of the stages offering the greatest range of possibilities: the act will be defective if its purpose does not conform to the purposes of agrarian law, including the welfare of peasant families, the country’s food security, and the full realization of justice in relationships immediately connected with agriculture.’ VI. There is, however, another more compelling reason for concluding that this matter must be heard by the Agrarian Jurisdiction. First, the general grant of jurisdiction under article 2 subsection h) provides that all disputes arising from acts and contracts to which an agrarian entrepreneur (empresario agrario) is a party must be heard by the Agrarian Jurisdiction.

This case concerns an agrarian administrative act that resulted in the revocation of a parcel (revocatoria de parcela). VII. Finally, it should be noted that the Ley General de Administración Pública itself excludes the Ley de Tierras y Colonización from its scope of application with respect to administrative procedure (procedimiento administrativo) (See Voto del Tribunal Superior Agrario N° 561 at 15:00 hours on 28 de julio de 1993.). Consequently, analysis of this matter must fall to the Tribunales Agrarios rather than the contentious-administrative jurisdiction because, pursuant to article 22 of the Ley de Jurisdicción Agraria, the Instituto de Desarrollo Agrario is a party to all agrarian proceedings in which its interests may be affected. (See the judgments of this Tribunal, N° 801-C-05 at 11:14 hours on 7 de octubre del 2005 and N° 379-C-07 at 11:05 hours on 10 de mayo del 2007). III.- The new Código Procesal Contencioso Administrativo governs the jurisdiction of that court system as follows: “ARTICLE 1.-

  • 1)The Jurisdicción Contencioso-Administrativa, established in article 49 of the Constitución Política, has the purpose of protecting every person’s legal situations, guaranteeing or restoring the legality of any conduct by the Public Administration subject to Administrative Law, and hearing and deciding the various aspects of the legal-administrative relationship (relación jurídico-administrativa).
  • 2)The grounds of illegality include any violation of the legal system, whether by act or omission, including misuse of authority (desviación de poder).
  • 3)For purposes of this Law, Public Administration shall mean: a) The Central Administration. b) The Poderes Legislativo, Judicial and the Tribunal Supremo de Elecciones, when they perform administrative functions. c) The decentralized, institutional, and territorial Administration, and all other public-law entities. ARTICLE 2.- The Jurisdicción Contencioso-Administrativa y Civil de Hacienda shall also hear the following: ...c) Ordinary proceedings that the Ley orgánica del Poder Judicial and other laws assign exclusively to the civil treasury courts, which shall be conducted in accordance with this Law,...f) Ordinary proceedings in which a public enterprise is involved.” The jurisdiction of the Jurisdicción Contencioso-Administrativa y Civil de Hacienda shall extend to hearing and deciding preliminary issues (cuestiones prejudiciales) (article 4), and its jurisdiction may not be extended by the parties (improrrogable) (article 5). Nevertheless, that jurisdiction is not exclusive to the contentious-administrative courts because, according to the cited constitutional case law, those provisions cannot be regarded as preventing the legality of the administrative function from being guaranteed by other jurisdictions, such as the agrarian and labor jurisdictions. In this regard, in a binding decision issued precisely in connection with its analysis of article 49 of the Constitución Política, the Sala Constitucional de la Corte Suprema de Justicia stated the following in voto 3905 at 15 hours 7 minutes on 3 de agosto de 2004: “First, the nature of article 49 of the Constitución Política must be defined. This provision forms part of a concept—in its modern sense—introduced into Costa Rican political law by the Constitution of 1949: judicial review of public acts (fiscalización judicial de los actos públicos). The concept was strengthened by the amendment introduced through law #3124 of 25 de junio de 1963, which also made it possible to challenge discretionary acts of the Administration, which were not contemplated in the original wording of article 49 limiting the contentious-administrative jurisdiction to review of the ‘exercise of regulated powers.’ The purpose of the constituent legislature was to establish within Costa Rican constitutional law a new and genuine subjective right in favor of citizens, guaranteeing their defense against abuses of authority by public officials. III.- Indeed, the provision at issue must be interpreted in harmony with the rules contained in articles 11 and 129, which embody the principle of legality (principio de legalidad). On the one hand, far from establishing a jurisdiction in the judicial sense, these provisions define the limits of action of public authorities; they embody the principle of public officials’ liability for their acts, which arose from the libertarian movements of the 18th century, as well as the principle of the universal applicability of laws. On the other hand, they establish the need to create, by legislative act, at least one jurisdiction in which disputes arising from State activity may be adjudicated. This is the aspect implicated by the consultation before us. IV.- If, as explained, the ratio legis of the constituent assembly was to provide individuals involved in disputes with the Public Administration with a specialized means of defense, the organizational structure established by the ordinary legislature for that purpose is constitutionally irrelevant. It is sufficient to emphasize the placement of the provision at issue within the dogmatic section of the Constitution and, in particular, as part of the catalog of individual rights set forth in Title V, Sole Chapter. The number of courts, their composition, and their territorial or subject-matter jurisdiction, for example, are matters of secondary importance that are plainly and expressly delegated to the legislature under article 152 of the Constitution, which provides: ‘Article 152: Judicial power is exercised by the Corte Suprema de Justicia and by the other courts established by law.’ It is therefore clear that the function of article 49 responds to the need to provide individuals with an effective remedy against unlawful administrative acts.”

And the unlawful nature of the acts is emphasized, since, in contrast to the ordinary jurisdiction (jurisdicción común), of which the contentious-administrative jurisdiction (jurisdicción contencioso-administrativa) forms part, the constituent assembly also contemplated constitutional jurisdiction (jurisdicción constitucional), which was exercised by the Full Court (Corte Plena) until 1989, when it was assigned to this specialized Chamber of the Corte Suprema de Justicia. The hierarchy of normative sources (fuentes normativas) also determines the jurisdiction of constitutional or ordinary courts. V.- The foregoing in the preceding sections is corroborated by the provisions of Article 153, which forms part of Title XI, Sole Chapter, located in the organic section of the Constitution dealing with the Judicial Branch. This clause grants the legislature full discretion to organize the courts through which the Judiciary performs its function.

The text reads: “Article 153: In addition to the functions assigned to it by this Constitution, the Judicial Branch shall have jurisdiction over civil, criminal, commercial, labor, and contentious-administrative cases, as well as any others established by law, regardless of their nature and the status of the persons involved; it shall render final decisions in such cases and enforce the judgments it issues, with the assistance of law enforcement if necessary.” This provision resolves the issue raised by the Procuraduría regarding the constitutional status of the contentious-administrative jurisdiction, insofar as the Constitution did not intend to confer upon a special category of courts—the contentious-administrative courts—singular protection above that afforded to the others. Rather, as stated, it created a constitutional right (derecho constitucional) that may be exercised before various courts of the Republic.

VI.- It does follow from the foregoing, however, that there is a constitutional prohibition against eliminating that jurisdiction altogether or reducing its authority to the point of rendering the right it protects ineffectual. In this regard, it is indeed necessary and mandatory for the legislature to provide the country with that judicial mechanism. But it could in no way be maintained that, for the ultimate purpose of creating a constitutional right, the Constitution granted superior status to this type of court and thereby vested exclusive jurisdiction over this specific subject matter in those courts. VII.- If the provision conferred the status of a subjective right (derecho subjetivo) upon the ability to challenge unlawful acts “of the administrative function of the State, its institutions, and any other public-law entity” (art. 49 prf.1°), the second characteristic of this right follows: it may be exercised before any court of the Republic to which the law has delegated those powers.

Accordingly, this Chamber considers that the legislature’s decision to create specialized jurisdictions in which the legality of acts of the Public Administration may be adjudicated, such as the agrarian jurisdiction (jurisdicción agraria), does not violate the constitutional order. POR TANTO: The Optional Constitutional Consultation (Consulta Facultativa de Constitucionalidad) is answered to the effect that the legislative creation of an agrarian jurisdiction vested with subject-matter jurisdiction (competencia material) to review the legality of certain acts of the Public Administration does not violate Article 49 of the Constitution.” That decision is binding pursuant to Article 13 of the Ley de Jurisdicción Constitucional, both as to its recitals (considerandos) and its operative provisions (parte dispositiva). It provides the basis for resolving any doubt regarding the subject-matter jurisdiction of the Jurisdicción Agraria to hear and decide proceedings in which the legality of administrative acts (actos administrativos) must be guaranteed.

The specialized nature of the subject matter lies precisely in the attempt to prove the elements of agrarian adverse possession (usucapión agraria) over land that, it is alleged, may belong to the Junta de Administración Portuaria y de Desarrollo Económico de la Vertiénte Atlántica, which is related to activities involving the productive use or conservation of natural resources pursuant to Article 1 of the Ley de la Jurisdicción Agraria.

IV.Moreover, and for the sake of completeness, it should be noted that this ordinary proceeding seeks agrarian adverse possession (usucapión agraria), and thus involves a dispute requiring analysis of the elements of the doctrine of agrarian prescription (prescripción agraria). The State is indeed a party to this proceeding because it is known that the properties are located in an area of ecological importance, namely Refugio de Vida Silvestre Barra del Colorado, precisely to safeguard any rights that may belong to the State. Furthermore, it must be emphasized that this Tribunal has previously heard ordinary proceedings identical to this one (See Voto No. 721 de las 14:07 horas del 31 de octubre del 2003), which were affirmed by the Sala Primera de Casación (No. 952 de las 16:20 horas del 7 de diciembre del 2005). For that reason, the Ley Orgánica del Poder Judicial reserved jurisdiction over all agrarian matters to the agrarian courts, including those in which the Instituto de Desarrollo Agrario, Junta de Administración Portuaria y de Desarrollo Económico de la Vertiente Atlántica, or Procuraduría General de la República participates in defense of its interests, as expressly provided in artículo 22 de la Ley de Jurisdicción Agraria, which, as a special law governing the subject matter, must prevail over any other general law.

V.In view of the foregoing, the proper course is to reject the declination of jurisdiction (inhibitoria) ordered by the court below.

POR TANTO:

The declination of jurisdiction ordered by the court below is rejected, and this matter is declared to be agrarian in nature.- [Nombre6] [Nombre7] - DECIDING JUDGE RUTH ALPIZAR RODRÍGUEZ - DECIDING JUDGE LUIS ALONSO MADRIGAL PACHECO - DECIDING JUDGE

CONSIDERANDO:
