Appeal of a criminal judgment (recurso de apelación de sentencia penal) filed in the present proceeding against [Nombre1], of legal age, living in a domestic partnership, resident of […], and [Nombre2], of legal age, living in a domestic partnership, resident of […], for the offense of Violation of the Ley Forestal, to the detriment of Natural Resources. Judges [Nombre3], Rosibel López Madrigal, and [Nombre4] participated in deciding the appeal. Attorneys [Nombre5], acting as representative of the Procuraduría General de la República, and [Nombre6], representative of the Ministerio Público, entered appearances on appeal.

Findings:

1. By judgment No. 575-2013, issued at seven hours and fifteen minutes on veintisiete de setiembre de dos mil trece, the Tribunal de Juicio de la zona sur sede Pérez Zeledón ruled: “THEREFORE (POR TANTO): In accordance with the foregoing; Articles 39 and 41 of the Constitución Política; Article 8, subsections 1 and 2, of the Convención Americana de Derechos Humanos; Articles 1, 6, 8, 9, 142, 265, 266, 267, and 360 through 366 of the Código Procesal Penal; Articles 1, 11, 18, 19, 20, 30, and 45 of the Código Penal; Articles 58, subsection b), and 61, subsection c), of the Ley Forestal; and Article 90 of the Ley de Conservación de Vida Silvestre, this Court hereby rules: [Nombre2] AND [Nombre1] are acquitted of all punishment and liability, pursuant to the PRINCIPLE OF IN DUBIO PRO REO (PRINCIPIO INDUBIO PRO REO), for the offenses of harvesting forest resources (aprovechamiento de los recursos forestales) in protected areas (áreas de protección), land-use change (cambio de uso del suelo), and destruction of products in a protected area. 2. Attorneys [Nombre5] and [Nombre6], respectively, filed appeals against the foregoing ruling.

3. Following the corresponding deliberation pursuant to Article 466 of the Código Procesal Penal, as amended by Ley 8837, published on nueve de diciembre de dos mil once (Creation of the Appeal from a Judgment), the Court considered the issues raised in the appeals.

4. The pertinent legal requirements have been observed in the proceedings.

Drafted by Judge [Nombre8]; and Whereas (Considerando):

I- The appeal satisfies the admissibility requirements (requisitos de admisibilidad) established in Articles 459, 460, and 461 of the Código Procesal Penal; accordingly, the Court proceeds to consider the grounds thereof.

II- APPEAL FILED BY THE PROCURADURÍA GENERAL DE LA REPÚBLICA. In his sole ground for appeal, the representative of the Procuraduría General de la República, acting as civil plaintiff and private prosecutor (querellante), Licenciado [Nombre9] , alleges failure to apply the Principle of Forest Irreducibility (Principio de Irreductibilidad del bosque) because the trial judge failed to provide reasons regarding restoration of matters to their original condition pursuant to Article 140 of the Code of Criminal Procedure. He states that the judgment fails to address the principle of forest irreducibility, because obtaining restoration of matters to their original or pristine condition is an imperative with extended effect, independently of the legal status of the accused. He contends that the environmental damage assessment (valoración del daño ambiental) performed by Mr. [Nombre10] demonstrated that the logged area is forest.

Trees of the mayo, Targuá, anonillo, guaba, fruta dorada, and oak species, as well as other unidentified species, were cut down. Likewise, two hectares of forest on an average slope of 20% were logged, and the timber was harvested. He believes that Article 140 of the Code of Criminal Procedure should have been applied and matters restored to their original condition. In support, he cites case law from the former Tribunal de Casación del Segundo Circuito Judicial de San José. He argues that the land use (uso del suelo) was changed, affecting a third-generation right to a healthy and balanced environment. Forested areas were converted into agricultural tracts by planting avocado trees within the previously logged forest and in a protection zone (zona de protección). He attributes that conduct to the accused [Nombre2]. As a ground of prejudice, he alleges that the State, as victim, was unable to obtain compensation and/or remediation for the environmental damage caused by the illegal logging of the trees, which occurred even within a protected zone (zona protectora).

He adds that the accused were caught in flagrante delicto while encroaching upon a protection zone and a primary forest, harvesting timber trees, and changing the land use. He requests that the appeal be granted with suspensive effect due to insufficient reasoning and failure to apply Article 140 of the Code of Criminal Procedure; that the challenged judgment be declared null and void; and that the matter be remanded to the respective court for proper proceedings, so that the appropriate determination may be made concerning the Principle of Forest Irreducibility; that an order be issued regarding forest regeneration and prohibiting exploitation activities in all affected and impacted areas; or, alternatively, on the basis of insufficient reasoning concerning flagrante delicto. The claim is granted. Before ruling on the merits of the appeal, it follows from the Procurador’s prayer for relief that the subject of this appeal is the failure to apply the “principle of irreducibility,” that is, the Tribunal’s failure to order the measures necessary to restore the protection zone to the condition in which it existed before the charged acts.

Accordingly, this Chamber will rule solely on that aspect of the judgment. Indeed, as the Procurador states, the judgment finds it proven that, within the property at issue in these proceedings, located in Puna de Biolley de Buenos Aires, two hectares of forest were logged and avocado trees were planted specifically within a protected zone because it lies along the bank of a spring (naciente de agua); consequently, it is apparent—and indeed follows from the testimonial and documentary evidence received (e.g., E; [Nombre10] and Informe del Minaet ACLA-PILA-133)—that a land-use change (cambio de uso del suelo) occurred on the property under investigation. Therefore, irrespective of the defendants’ criminal liability, the Trial Court was required to rule on restoring matters to the condition in which they existed before the acts. In this case, that meant ordering corrective measures to regenerate the logged forest and remove everything that had caused the land-use change within a protected zone.

Otherwise, the consequences of the unlawful act would be perpetuated to the detriment of every citizen’s right to a healthy and balanced environment, as provided in section 50 of the Political Constitution. Restitution may even be ordered by the court on its own motion, under the interpretation given to Articles 361(d) of the Code of Criminal Procedure and 103 of the Criminal Code. National case law has ruled accordingly, stating: “In the appeal on points of substantive law, the appellant alleges the erroneous application of Articles 50 of the Political Constitution, 99(h) of the Ley del Ambiente, 96 and 103(1) of the Criminal Code, 122 and 123 of the rules on civil liability currently in force from the Criminal Code of 1941, and 140 of the Code of Criminal Procedure. He asserts that not even the State itself sought restoration for the damage caused, because it was established that no environmental damage exists, and therefore Article 50 of the Political Constitution was inapplicable.

As for Article 99 of the Ley Orgánica del Ambiente, he considers it a provision imposing administrative penalties that are inapplicable in criminal proceedings. He also challenges the application of Article 103 of the Criminal Code because it requires a request for restitution, which the Procuraduría General de la República did not submit. Furthermore, he maintains that the defendant’s acquittal established that no offense existed and that the demolition of the works therefore cannot be ordered. He adds that the application of Articles 122 and 123 of the Criminal Code of 1941 requires the filing of a civil action for damages (acción civil resarcitoria), which the Procuraduría General de la República did not file. Finally, he maintains that Article 140 of the Code of Criminal Procedure is likewise inapplicable because it concerns a preventive measure imposed before judgment is entered. The claims are denied.

The matter at issue has already been addressed in decisions of this Chamber, including Judgments No. 193-02, at 9:00 hours, 8 de marzo del 2002, and No. 450-03, at 8:48 hours, 22 de mayo del 2003. The latter decision held as follows: ‘Irrespective of the principal or ancillary penalty prescribed by each criminal provision for the unlawful conduct, commission of an offense entails a series of civil consequences, as established by Articles 103 of the Criminal Code and 123 and 124 of the Rules on Civil Liability Currently in Force from the Criminal Code of 1941, including restitution of the physical object of the offense (objeto material del delito). Specifically, one of the effects of a criminal judgment is to order restoration of the injured party to the full exercise of the infringed right, which is in the nature of a fundamental right by virtue of its regulation under Article 41 of the Political Constitution, which provides that “By resorting to the laws, everyone shall obtain redress for injuries or damage suffered to their person, property, or moral interests…” (Judgment 346-98, 9:30 hrs, 03-04-98, Sala Tercera de la Corte Suprema de Justicia); this includes, among other matters, restitution of the physical object of the offense (Judgment 511-2000, 9:20 hrs., 19-5-00, Sala Tercera de la Corte Suprema de Justicia).

The first two paragraphs of Article 123 of the Rules on Civil Liability Currently in Force from the Criminal Code of 1941 establish that: “The convicted person shall restore to the injured party, with compensation for all deterioration or impairment, the thing that was the object of the punishable act; if unable to do so, that person shall be required to pay its value according to an expert appraisal as of the date of the offense. If such an appraisal cannot be conducted because the thing has been destroyed or has disappeared, the judges shall determine its respective value based on the evidence in the proceedings. Restitution shall be ordered even when the thing is in the possession of a third party, without prejudice to the rights conferred upon that party by civil law.”; all of which may be ordered by the court on its own motion because the provisions of Articles 103, 123, and 124 cited above are mandatory, and no civil action for damages need have been filed, as case law has correctly established in holding that “…the claim for losses and damages arising from the offense must be brought through a civil action for damages, because the procedural rules make it subject to that requirement; however, that same requirement does not apply to restitution of the physical object of the offense.

This is so, as this same Chamber has previously interpreted, because restitution does not constitute a form of compensation in the strict sense.” (Judgment Nº 52-F, 10:35 hrs., 31 enero 1990, Sala Tercera de la Corte Suprema de Justicia, reiterated in Voto # 604-F-91, at 9:25 hours, 7 de noviembre de 1.991, and Judgment 511-2000, 9:20 hrs., 19-5-2000). The right to the environment, classified as a third-generation human right, has been recognized in Costa Rica as a fundamental right, since Article 50 of the Political Constitution provides that: “Every person has the right to a healthy and ecologically balanced environment.” It grants private individuals and the State the right and duty to guarantee and defend that right on behalf of all inhabitants; therefore, commission of the offense makes the community the victim or injured party and, from that perspective, gives it the right to remediation of the damage caused.

In the case of the offense of violating the Ley de Uso y Conservación de Suelos ( No. 7779 de 309 abril de 1998), Article 52 of that law establishes that: “Anyone who contaminates or degrades soil resources, regardless of the existence of negligence or intent or the degree of participation, shall be liable to provide compensation, in the appropriate judicial forum, and to repair the damage caused to the environment.” This constitutes a specific provision requiring the offender to compensate for losses and damages or repair the damage caused. From a procedural perspective, Articles 140 and 466 of the Code of Criminal Procedure require the Judge to restore matters to their condition before the offense, which the challenged judgment failed to do, as the Procuraduría correctly notes in its application. Because the judgment established both the defendant’s commission of the act and the injury to the environment caused by opening a road through the forest to the river, it is appropriate to order restoration of the affected area to its condition before the act, so that the offender does not benefit from the unlawful conduct and the environment altered by that conduct is restored in furtherance of protecting the community’s interests.

This Tribunal has similarly ruled as follows: “As for the condition imposed, this court of cassation finds it reasonable and proportionate to the acts giving rise to the criminal conviction. It should be noted that § 28 of the Political Constitution establishes that the law may not intervene in private actions that cause no harm, from which it follows that the limit of the State’s response is determined by the magnitude or seriousness of the injury or danger caused. In the present case, where the damage consists of changing forest land use in order to devote the land to agriculture, the State’s response is limited to repairing the damage, which in any event will not be completed during the three-year suspended sentence because a forest is the product of years and years of the birth, development, and death of many plant and animal organisms. Nevertheless, removing the crops and every element that has replaced the forest, as well as reestablishing plant species to the extent appropriate to regenerate what was destroyed, constitutes the beginning of remediation, which will be achieved over a number of years.

It must be clear that the protection of forest soil enshrined in §§ 2, 6, 10.c, 19 and 38.f of the Ley Forestal, 52 of the Ley de Uso, Manejo y Conservación de Suelos, 53, 54 and 55 of the Ley Orgánica del Ambiente, and 53 and 54 of the Ley de Biodiversidad does not end or become suspended when the forest is diminished by human acts (arson, illegal logging, etc.) or natural events (floods, earthquakes, fires, etc.); on the contrary, in such situations, the State is required to act more aggressively to restore and conserve the forest. To believe that the duty to protect forest soil and other forest components ends as a result of any of the aforementioned events would amount to promoting unlawful activities harmful to the environment in order to replace the ecosystem with agricultural or other forms of exploitation, in which case there would be no genuine protection; that is, the area occupied by forests cannot be reduced through such means (principle of forest irreducibility (principio de irreductibilidad del bosque)).

Thus, anyone who damages the forest through logging or fires for the purpose of changing the designated use of the land, or anyone who seeks to benefit from natural disasters that damage forest soil, must understand that there is no possible way to change the designated use of the land and that the State will do whatever is necessary to restore the forest. In other words, in the case at bar, agricultural activity must cease at the location where the forest is to be regenerated, whether this is done by the convicted person in compliance with the condition under which the benefit of a suspended sentence (beneficio de ejecución condicional de la pena) is granted to him almost as an incentive, or through State action; the officials responsible for enforcement shall ensure the effectiveness of the judgment on the merits (fallo de mérito). There is no disproportionality or abuse in the condition imposed by the trial judge.

The trial judge’s resolution in this manner reaffirms the normative force of the Constitución Política, which in §§ 50 and 74 guarantees all humanity, as an inalienable right, the right to a healthy and ecologically balanced environment. Furthermore, the judicial ruling in this case is consistent with the legislative provision adopted in § 52 of the Ley de Uso, Manejo y Conservación de Suelos, N° 7779 de 30 de abril de 1.998…” (Judgment [Telf1], de 11:54 hrs. del 5 de mayo del 2003, drafted by Judge [Nombre11]. This criterion was reiterated in judgment 2003-396). With respect to the case before us, the judgment did not provide for restoration to the prior condition (restitución de las cosas al estado anterior), as required by the cited legislation. Nevertheless, because the decision arose from an abbreviated proceeding (procedimiento abreviado), and because restoration is a direct consequence of the commission of the offense and does not require a civil action, the proper course is to grant the appeal in cassation (recurso de casación) filed and rule in these proceedings by ordering that the affected forest area be restored to the condition existing before the events.

Because this involved the construction of a trail or road in the mountains, which violated several provisions, it does not have the same characteristics as cases involving the erection of infrastructure, in which ordering demolition constitutes a solution; therefore, destruction of the road does not appear feasible. Likewise, ordering the payment of damages (daños y perjuicios) is not appropriate, since that would still allow the road to be used in exchange for payment, to the offender’s benefit. Accordingly, restoration in this case must be directed toward conserving the forest area, and for that purpose the road is ordered closed, its use in any possible manner is prohibited, and restoration of the forest is ordered through the planting of species appropriate for that purpose, compliance with which may be monitored by the administrative or enforcement authorities.” In the case under review, it was established that a protection area (área de protección) had been encroached upon through the construction of a series of works that must be demolished or destroyed in order to maintain the balance of nature.

The commission of a criminal offense is not required for the courts, even on their own motion (de oficio), to order restoration to the condition existing before the alteration. It should be noted that Article 103 of the Código Penal requires only a punishable act (hecho punible), the scope of which is limited to a criminal wrong (injusto penal). The existence of the criminal wrong was established in this case because the act of ordering the construction of the structures whose demolition is now ordered violated the Ley Forestal. Moreover, there was no provision authorizing those actions, and the conduct was therefore also unlawful (antijurídica). The judge was consequently obligated to order the demolition or destruction of the series of works identified in the judgment, since they had been constructed within a protection area. Accordingly, the objection raised cannot be sustained.” (cf.

The failure to rule on that issue constitutes a defect in the statement of reasons (vicio de fundamentación) for the judgment, resulting in the partial nullity of the decision on that point and the corresponding remand (reenvío) for further proceedings. It should be noted that, before ordering the remand, and because the property in question apparently belongs not to the defendants but to a third party, the court hearing the case on remand must grant the property owner an opportunity to be heard so that the owner may appear at trial and assert their rights, as required by the Constitutional Principle of Due Process (Principio Constitucional del Debido Proceso).

III- APPEAL FILED BY THE MINISTERIO PÚBLICO. In his sole ground for appeal (motivo de apelación), the Assistant Prosecutor of Buenos Aires, Licenciado [Nombre6], challenges the legal reasoning, specifically alleging that the Trial Court partially failed to provide legal grounds. He argues that, in rendering a judgment of acquittal (sentencia absolutoria) in favor of the accused (imputado), [Nombre1], the Trial Court stated that it had reasonable doubt as to whether the defendant knew that the owner of the property did not have the corresponding permits to saw the timber. He asserts that the Trial Judge indicated that the accused may have acted under a mistake, believing that Mr. Á had those permits. He adds that the Trial Court relied on the testimony of the witness [Nombre12], who stated that Mr. Á, the owner of the property, told the defendant that there was no problem and that everything had been taken care of.

The appellant maintains that, because the accused [Nombre1] was a local resident who had lived in that community for a long time, he knew that it was a forested area. He had worked for many years extracting timber and knew how sensitive that activity was; therefore, he should have asked the owner for the permits or verified with Minaet, which was located near the property, whether the permits had been obtained. In summary, the Prosecutor considers that, if the defendant acted under a mistake, it was an avoidable mistake because he had doubts about the unlawfulness (antijuridicidad) of his conduct, as shown by the fact that he asked whether the permits existed. The appellant alleges that the Trial Court did not analyze whether that mistake of law (error de prohibición) was avoidable or unavoidable, thereby leaving the judgment without legal grounds. He requests that the judgment be vacated solely with respect to the first alleged act and insofar as it concerns the accused [Nombre1], and that the corresponding remand (reenvío) be ordered.

The claim is denied. It is true that the judgment does not arrive at the acquittal of the accused [Nombre1] using the technical legal language whose absence the appellant finds objectionable. This Chamber agrees with the Prosecutor that the decision does not analyze mistake of law—that is, the belief that the conduct does not fall within the prohibitory scope of the rule—but instead concludes, in a rather unsophisticated manner, that, based on the evidence received, there is reasonable doubt as to whether the defendant knew that the owner of the property did not have the corresponding permits for sawing the timber. In legal terms, the foregoing is equivalent to saying that the Trial Court had doubts as to whether the accused was aware of the unlawfulness of his conduct. However, what this Chamber must assess, so as not to order nullities (nulidades) in the absence of prejudice, is whether the evidence received supports the Trial Court’s conclusion or whether it violated the rules of sound judicial reasoning (sana crítica).

The issue of avoidable and unavoidable mistake of law is not easy to resolve. Each specific case must be examined, and it must be determined, based on the circumstances of the act and the accused’s personality and educational background, whether the mistake could nevertheless have been avoided. In this regard, [Nombre13] states: “A mistake of law may be avoidable or unavoidable. An unavoidable mistake of law cannot be attributed blamefully to the perpetrator, since a person who is not in a position to recognize the wrongfulness of the act does not demonstrate any blameworthy attitude toward the Law by violating it.... By contrast, an avoidable mistake of law raises the question of to what extent and on what basis blameworthiness (culpabilidad) may be attributed. In this regard, the following must be stated in principle: the legal system requires a person not only to avoid what clearly appears wrongful to that person; that person must also endeavor always to act in accordance with the Law....

The standard for determining whether a mistake of law was avoidable must be the same as that applied in negligence (imprudencia) with respect to the perpetrator’s duty of inquiry. The starting point must be that knowledge of the circumstances of the act that provide indications of its wrongfulness should give the perpetrator occasion to verify the act’s relationship to the legal order. The strength of the impetus to examine unlawfulness arising from knowledge of the elements of the offense (tipo) undoubtedly varies according to the class of offense. When the act constitutes not merely a violation of law but, at the same time, an intolerable violation of the moral order, the mistake of law will be avoidable..... If the perpetrator has doubts regarding the validity of a known provision, the perpetrator may not simply follow the interpretation that is most favorable, but must seek expert advice.

Only information regarding the Law obtained from a reliable source will excuse the perpetrator” ([Nombre14]. Derecho Penal. Parte General. Tomo 1. Barcelona. Bosch. 1991. Pp 628-630). In the present case, according to the account given by the witness [Nombre12], the defendant was contacted by Á, the owner of the property, who proposed that he help remove timber from a tree. The accused told him that the problem was that he did not have a chainsaw and that the activity was dangerous; according to the judgment, the witness meant that there was a risk that Minaet officials might arrive. The owner of the property assured him that everything was in order, that he had the permits, and that, if Minaet officials arrived, he should call him. In this Chamber’s view, given the personality and education of the accused [Nombre1]—a farmer with little schooling—living in a rural area, although he knew of the prohibitory rule against sawing timber without permits, he resolved his doubt as to whether permits existed as a person with his characteristics would, by asking the owner of the property whether he had the permits, to which the owner responded affirmatively.

This Tribunal considers the owner to have been a reliable source in light of the accused’s educational circumstances and personality, and the law cannot require a person in his position to go to Minaet to determine whether the information provided by the property owner was true. Much less could it require him to challenge the person who was giving him work—so scarce these days—by demanding that he show him the permits. Therefore, although the Trial Court did not specifically analyze whether the mistake was avoidable, its conclusions concerning the doubt as to the accused’s lack of awareness of the unlawfulness arising from the absence of permits are consistent with the evidence received and conform to the rules of correct human understanding. For the foregoing reasons, this ground is denied.

Por tanto:

The appeal filed by the Procuraduría General de la República is granted. The judgment is partially vacated, and the case is remanded so that the Tribunal de Juicio hearing the case on remand may rule on the restitution and restoration of the forest affected within the protected zone (zona protectora), after first granting the property owner an opportunity to be heard. In all other respects, the appealed judgment is affirmed. The appeal filed by the Ministerio Público is denied. NOTICE SHALL BE GIVEN.

Res: 2014-032 Tribunal de Apelación de la Sentencia Penal de Cartago, sección primera. A las catorce horas cincuenta y siete minutos del veintiocho de enero de dos mil catorce.

Recurso de apelación de sentencia penal interpuesto en la presente causa seguida contra [Nombre1], mayor, convive en unión libre, vecino de […] y [Nombre2] , mayor, convive en unión libre, vecino de […] por el delito de Infracción a la Ley Forestal, en perjuicio de Los Recursos Naturales. Intervienen en la decisión del recurso, los jueces [Nombre3] , Rosibel López Madrigal y [Nombre4] . Se apersonaron en apelación, los licenciados [Nombre5] en calidad de representante de la Procuraduría General de la República y [Nombre6] representante del Ministerio Público.

Resultando:

1. Que mediante sentencia No. 575-2013 de las siete horas quince minutos del veintisiete de setiembre de dos mil trece, el Tribunal de Juicio de la zona sur sede Pérez Zeledón, resolvió: "POR TANTO: De conformidad con lo expuesto, artículos 39 y 41 de la Constitución Política, 8 inciso 1 y 2 de la Convención Americana de Derechos Humanos, 1, 6, 8, 9, 142, 265, 266, 267, 360 a 366 del Código Procesal Penal; 1, 11, 18, 19, 20, 30, 45 del Código Penal, artículos 58 inciso b), 61 inciso c) de la Ley Forestal, artículo 90 de la Ley de Conservación de Vida Silvestre, este Tribunal resuelve: absolver de toda pena y responsabilidad a [Nombre2] Y [Nombre1], en aplicación del PRINCIPIO INDUBIO PRO REO, por los delitos de aprovechamiento de los recursos forestales en áreas de protección, cambio de uso del suelo, destrucción de productos en área de protección. Se declara sin lugar la acción civil resarcitoria incoada por el Procurador de la República. Son los gastos del proceso a cargo del Estado. Se resuelve este asunto sin especial condenatoria en costas.Notifíquese. [Nombre7] . Jueza. " (sic)

2. Que contra el anterior pronunciamiento, los licenciados [Nombre5] y [Nombre6] interpusieron respectivamente los recursos de apelación.

3. Que verificada la deliberación respectiva de conformidad con lo dispuesto por el artículo 466 del Código Procesal Penal, reformado por Ley 8837 publicada el nueve de diciembre de dos mil once (Creación de Recurso de Apelación de la Sentencia), el Tribunal se planteó las cuestiones formuladas en los recursos.

4 . Que en los procedimientos se han observado las prescripciones legales pertinentes.

Redacta el Juez [Nombre8] , y;

Considerando:

I- El recurso de apelación reúne los requisitos de admisibilidad definidos en los artículos 459, 460 y 461 del Código Procesal Penal, por lo que se entra a conocer de sus motivos.

II- RECURSO DE APELACIÓN PRESENTADO POR LA PROCURADURÍA GENERAL DE LA REPÚBLICA. En su único motivo de apelación, el representante de la Procuraduría General de la República, en su calidad de actor civil y querellante, Licenciado [Nombre9] , alega inaplicación del Principio de Irreductibilidad del bosque por omisión de fundamentación del juzgador respecto a pronunciarse sobre el efecto devolutivo de las cosas a su estado original a tenor del artículo 140 del Código Procesal Penal. Indica que la sentencia es omisa en cuanto al principio de irreductibilidad del bosque por constituir un imperativo de efecto extensivo el obtener la devolución de las cosas a su estadio originario o primigenio, lo que es independiente de la situación jurídica de los encartados. Aduce que con la valoración del daño ambiental realizada por el señor [Nombre10] se demostró que el área talada es bosque. Que se cortaron árboles de las especies mayo, Targuá, anonillo, guaba, fruta dorada, robles y otras especies desconocidas.

Así mismo que fueron taladas dos hectáreas de bosque en una pendiente promedio del 20%, y fueron aprovechados. Estima que debió aplicarse el artículo 140 del Código Procesal Penal y volver las cosas al estado original. Cita en su apoyo jurisprudencia del antiguo Tribunal de Casación del Segundo Circuito Judicial de San José. Arguye que se cambió el uso del suelo lo que afecta un Derecho de Tercera Generación, al ambiente sano y equilibrado. Se transformaron áreas boscosas en extenciones agrícolas al sembrar árboles de aguacate dentro del bosque previamente talado y en zona de protección. Atribuye esa conducta al encartado [Nombre2]. Acusa como agravio el hecho de que el Estado como víctima no pudo obtener una indemnización y/o reparación del daño ocasionado al ambiente a raíz de la tala ilegal de los árboles, ocurrida incluso dentro de una zona protectora. Agrega que los encartados fueron sorprendidos en flagrancia, invadiendo zona de protección, un bosque primario, aprovecharon árboles maderables y cambiaron el uso del suelo.

Solicita se acoja el recurso con efecto suspensivo por fundamentación omisa e inaplicación del artículo 140 del Código Procesal Penal, declarándose nula la sentencia recurrida y se devuelva al juzgado respectivo para su debida sustanciación, para que se resuelva lo procedente con relación al Principio de Irreductibilidad del bosque; se pronuncie en relación con ordenar la regeneración del bosque y la no intervención mediante actividades de explotación de todas las áreas afectadas e impactadas o bien por la falta de fundamentación por flagrancia. Con lugar el reclamo. De previo a resolver el fondo del recurso, de la petitoria del señor Procurador se desprende que el objeto del presente recurso resulta ser la falta de aplicación del "principio de irreductibilidad" del bosque, es decir el ordenar por parte del Tribunal las medidas concernientes para volver la zona de protección al estado en que se encontraba antes de los hechos acusados.

Por ende, esta Cámara se pronunciara únicamente sobre ese punto del fallo. Efectivamente como lo indica el señor Procurador la sentencia tiene por demostrado que dentro de la propiedad objeto del proceso, situada en Puna de Biolley de Buenos Aires se talaron dos hectáreas de bosque y que se sembraron árboles de aguacate precisamente en una zona protectora por estar al márgen de una naciente de agua con lo cual resulta y de hecho se desprende de la prueba testimonial y documental recibida (vgr. E; [Nombre10] y el Informe del Minaet ACLA-PILA-133), que se produjo un cambio de uso del suelo en la finca objeto de ésta investigación. Por ende, independientemente de la responsabilidad penal de los imputados, resultaba obligatorio que el Tribunal de Juicio se pronunciara sobre la restitución de las cosas al estado en que se encontraban antes de los hechos. En este caso, el ordenar las medidas correctivas para regenerar el bosque talado y destruir todo aquello que haya generado el cambio en el uso del suelo dentro de una zona protectora.

De lo contrario, se estarían perpetrando las consecuencias del hecho ilícito en perjuicio del derecho de todo ciudadano a un ambiente sano y equilibrado conforme lo dispone el numeral 50 de la Constitución Política. La restitución procede incluso de oficio, según la lectura que se le ha dado a los artículos 361 inciso d) del Código Procesal Penal y 103 del Código Penal. En ese sentido se ha pronunciado la jurisprudencia nacional indicando: "En la casación por el fondo se invoca errónea aplicación de los artículos 50 de la Constitución Política, 99 inciso h) de la Ley del Ambiente, 96, 103 inciso 1) del Código Penal, 122, 123 de las reglas vigentes de responsabilidad civil del Código Penal de 1941 y 140 del Código Procesal Penal. Afirma que ni el propio Estado solicitó la restitución del daño causado, pues se acreditó que no existe un daño ambiental, con lo cual no resultaba aplicable el artículo 50 de la Constitución Política.

En cuanto al artículo 99 de la Ley Orgánica del Ambiente, estima que se trata de una norma con sanciones administrativas, no aplicables en sede penal. También reprocha la aplicación del artículo 103 del Código Penal, pues tal requiere una solicitud de restitución, que no fue planteada por la Procuraduría General de la República. Además, estima que al absolverse al imputado quedó demostrada la inexistencia de un delito y por ello no es posible ordenar el derribo de las obras. Agrega que la aplicación de los artículos 122 y 123 del Código Penal de 1941 exigen la presentación de la acción civil resarcitoria, la cual no fue presentada por la Procuraduría General de la República. Finalmente, estima que el artículo 140 del Código Procesal Penal tampoco resulta aplicable, pues se trata de una medida preventiva, antes del dictado de la sentencia. Sin lugar los reclamos. El tema en cuestión ya ha sido objeto de pronunciamientos por esta Cámara, entre otros en las sentencias No. 193-02, de las 9:00 horas, del 8 de marzo del 2002 y No. 450-03, de las 8:48 horas, del 22 de mayo del 2003.

En el último fallo se dispuso sobre el particular: "Independientemente de la pena principal o accesoria que establece cada tipo penal para la conducta delictiva, la comisión del delito conlleva una serie de consecuencias civiles, tal como lo establecen los artículos 103 del Código Penal, 123 y 124 de las Reglas Vigentes sobre Responsabilidad Civil del Código Penal de 1941, entre ellas la restitución del objeto material del delito. Precisamente, uno de los alcances de la sentencia penal es ordenar la restitución al ofendido en el ejercicio pleno de su derecho lesionado, que tiene la naturaleza de un derecho fundamental por su regulación en el artículo 41 de la Constitución Política que establece que "Ocurriendo a las leyes, todos han encontrar reparación para las injurias o daños que hayan recibido en su persona, propiedad o intereses morales…" (Sentencia 346-98 de 9:30 hrs del 03-04-98 Sala Tercera de la Corte Suprema de Justicia), lo cual comprende entre otros aspectos la restitución del objeto material del delito (Sentencia 511-2000 de las 9:20 hrs. del 19-5-00 de la Sala Tercera de la Corte Suprema de Justicia).

El artículo 123 de las Reglas Vigentes Sobre Responsabilidad Civil del Código Penal de 1941, en sus dos primeros párrafos establece que: "Deberá el condenado restituir al ofendido, con abono de todo deterioro o menoscabo, la cosa objeto del hecho punible, y si no pudiere hacerlo, estará obligado a satisfacer su valor conforme a estimación pericial referida a la fecha de la infracción. Si tal estimación no fuese posible hacerla por haber sido destruida o haber desaparecido la cosa, los jueces fijarán el valor respectivo, ateniéndose a los datos del juicio. La restitución se ordenará aun cuando la cosa se hallare en poder de un tercero, dejando a salvo los derechos que la ley civil confiere a este."; todo lo cual puede ordenarse de oficio por ser imperativa la regulación del artículo 103, 123 y 124 antes citados, y no requiere que se haya instaurado la acción civil resarcitoria, como bien lo ha establecido la jurisprudencia en el sentido que “... el reclamo de los daños y perjuicios provenientes del delito debe hacerse por medio de la acción civil resarcitoria, porque así lo condiciona la normativa procesal; sin embargo esa misma condición no existe cuando se trata de la restitución del objeto material del delito.

Ello es así, conforme lo ha interpretado anteriormente esta misma Sala, porque la restitución no constituye una forma de indemnización en sentido estricto." (Sentencia Nº 52-F 10:35 hrs. 31 enero 1990 de la Sala Tercera de la Corte Suprema de Justicia, reiterado en Voto # 604-F-91, de 9:25 horas del 7 de noviembre de 1.991 y en Sentencia 511-2000 de 9:20 hrs del 19-5-2000). El derecho al medio ambiente, calificado como un derecho humano de la tercera generación, ha sido reconocido en Costa Rica como un derecho fundamental, pues el artículo 50 de la Constitución Política cuando dispone que: "Toda persona tiene derecho a un ambiente sano y ecológicamente equilibrado." y le otorga a los particulares y al Estado el derecho y el deber de garantizar y defender ese derecho en nombre de todos los habitantes, por lo que la comisión del delito convierte a la colectividad en víctima u ofendida con el hecho y desde esa perspectiva adquiere el derecho a la reparación del daño causado.

Tratándose de un delito de Infracción a la Ley de Uso y Conservación de Suelos ( No. 7779 de 309 abril de 1998) el artículo 52 de dicha ley establece que: "Quien contamine o deteriore el recurso suelo, independientemente de la existencia de culpa o dolo o del grado de participación, será responsable de indemnizar, en la vía judicial que corresponda, y de reparar los daños causados al ambiente.", de donde se deriva una regulación específica que obliga al infractor a indemnizar los daños y perjuicios o a reparar los daños causados. Desde la perspectiva procesal, el artículo 140 y 466 del Código Procesal Penal obligan al Juez a disponer la restitución de las cosas al estado anterior al delito, lo cual omite el fallo recurrido como bien lo apunta la Procuraduría en su gestión, por lo que establecido en la sentencia la autoría del hecho por parte del imputado y la lesión al medio ambiente por la apertura de un camino en el bosque hasta el río, es procedente ordenar la restitución del área afectada al estado anterior al hecho, a fin de que el infractor no derive provecho de la ilicitud realizada y se logre restaurar el medio ambiente alterado con su acción en pro de la tutela de los intereses de la colectividad.

En sentido similar ha resuelto este Tribunal lo siguiente: "En cuanto a la condición impuesta en sí, esta corte de casación la encuentra racional y proporcionada a los hechos generadores de la condena penal. Obsérvese que el § 28 de la Constitución Política establece la imposibilidad de intervención legal ante acciones privadas que no causen daño, de donde deriva que el límite de la reacción estatal viene marcado por la magnitud o gravedad de la lesión o peligro causados. En el presente caso, en que el daño es el cambio del uso del suelo del bosque para dedicarlo a agricultura, la reacción estatal tiene su límite en la reparación del daño, que de todas formas no se completará en los tres años de ejecución condicional de la pena, puesto que el bosque es producto de años y años de nacimiento, desarrollo y muerte de muchos seres vegetales y animales; sin embargo, la exclusión de los cultivos y de todo elemento con que se ha sustituido el bosque, así como el restablecimiento de especies vegetales en la medida adecuada para regenerar lo destruido, son un principio para la reparación que en algunos años se alcanzará.

Debe quedar claro que la protección del suelo de los bosques consagrada en los §§ 2, 6, 10.c, 19 y 38.f de la Ley Forestal, 52 de la Ley de Uso, Manejo y Conservación de Suelos, 53, 54 y 55 de la Ley Orgánica del Ambiente, 53 y 54 de la Ley de Biodiversidad, no termina o se suspende cuando por actos de seres humanos (incendios provocados, talas ilegales, etc.) o por hechos de la naturaleza (inundaciones, terremotos, incendios, etc.) el bosque viene a menos; antes por el contrario, ante esas situaciones se impone al Estado mayor agresividad en la recuperación y conservación del bosque. Pensar que el deber de protección del suelo forestal y de otros elementos del bosque termina por cualquiera de los hechos indicados, se traduciría en la promoción de actividades ilícitas lesivas del medio ambiente, para sustituir la ecología por explotaciones agrícolas o de otra naturaleza, con lo que no habría protección verdadera; es decir, el espacio ocupado por los bosques es irreductible por esas vías (principio de irreductibilidad del bosque).

De este modo, cualquiera que lesione el bosque con tala o incendios con el propósito de cambiar el destino del terreno, o cualquiera que pretenda obtener provecho de desastres naturales que dañen el suelo forestal, debe comprender que no hay forma posible de cambiar el destino del suelo, y que el Estado hará cuanto sea para recuperar el bosque. Esto es, en el caso de autos deben desaparecer la actividad agrícola del lugar donde corresponde regenerar el bosque, ya sea que lo haga el condenado en cumplimiento de la cláusula por la que se le otorga casi como incentivo el beneficio de ejecución condicional de la pena, ya sea por la acción del Estado; los funcionarios responsables de la ejecución verán por la eficacia del fallo de mérito. No hay desproporción o abuso en la condición impuesta por el juzgador. Esta forma de resolver por parte del juez de juicio, reafirma el valor normativo de la Constitución Política, que en sus §§ 50 y 74 garantizan a la humanidad entera, con carácter de irrenunciable, el derecho a un ambiente sano y ecológicamente equilibrado.

Amén de lo anterior, la disposición judicial en este caso guarda identidad con la disposición legislativa adoptada en § 52 de la Ley de Uso, Manejo y Conservación de Suelos, N° 7779 de 30 de abril de 1.998…" (Sentencia [Telf1], de 11:54 hrs. del 5 de mayo del 2003 con redacción del Juez [Nombre11] . Este criterio fue reiterado en sentencia 2003-396). Referido al caso que nos ocupa, la sentencia no contempló la restitución de las cosas al estado anterior como ordena la normativa citada, no obstante, por provenir el fallo de un procedimiento abreviado y por ser la restitución una consecuencia directa de la comisión del delito y no requerir acción civil, lo propio es acoger el recurso de casación planteado y resolver en esta sede disponiendo la restitución del área de bosque afectada a su estado anterior a los hechos. Por tratarse de la construcción de una trocha o camino en la montaña, que implicó infracción a varias normas, no presenta las mismas características que en casos de levantamiento de una infraestructura en que ordenar la demolición constituye una solución, por ello no se observa viable la destrucción del camino; de igual forma no resulta atinente imponer el pago de los daños y perjuicios, toda vez que ello siempre permitiría el uso del camino a cambio del pago con provecho al infractor, por lo que la restitución en este caso debe orientarse hacia la conservación del área de bosque y en atención a ello se dispone el cierre del camino y se prohíbe el uso en cualquiera de las formas posibles y se ordena la restitución del bosque mediante la siembra de especies propias para tal fin, cuyo cumplimiento podrá vigilarse por las autoridades administrativas o de ejecución".

En el caso en estudio quedó demostrado que se invadió un área de protección, mediante la construcción de una serie de obras, que deben ser derribadas o destruidas en aras de mantener el equilibrio de la naturaleza. No se requiere la comisión de un hecho delictivo para que los tribunales, aún de oficio, decreten la restitución de las cosas al estado anterior a su modificación. Nótese que el propio artículo 103 del Código Penal únicamente exige un hecho punible, cuyos alcances se limitan a un injusto penal. En esta causa se acreditó la existencia del injusto, pues la acción de ordenar las construcciones, cuyo derribo ahora se acuerda, resultaban violatorias de la Ley Forestal. Además, no había una norma que autorizara dichas acciones, con lo cual la acción también resultaba antijurídica. De tal forma que era obligación del juzgador ordenar el derribo o destrucción de la serie de obras que se mencionan en el fallo, pues estas fueron construidas en un área de protección.

Consecuentemente, no es atendible el reproche formulado.” (cfr. Voto 450-2003 de las 11:48 horas del 22 de mayo de 2003. Tribunal de Casación Penal de San José) El criterio externado por la cita jurisprudencial es plenamente aplicable al presente proceso, en el que en igual forma se sustituyó el bosque por cultivos de aguacate en una zona protectora, razón por la cual el Tribunal de Juicio debió pronunciarse sobre la restitución del bosque y la eliminación de los cultivos de aguacate independientemente del hecho de que los imputados fueran absueltos. Ahora bien, la omisión de pronunciamiento en ese aspecto constituye un vicio de fundamentación de la sentencia que genera su nulidad parcial del fallo en ese punto y el reenvío respectivo para su nueva sustanciación. Debe indicarse que de previo a realizar el reenvío, y dado que en apariencia la finca en cuestión no pertenece a los imputados sino a un tercero, debe el Tribunal de reenvío otorgar audiencia al propietario de la finca para que pueda apersonarse al juicio a hacer valer sus derechos conforme lo manda el Principio Constitucional del Debido Proceso.

III- RECURSO INTERPUESTO POR EL MINISTERIO PÚBLICO. En su único motivo de apelación, el Fiscal Auxiliar de Buenos Aires, Licenciado [Nombre6] , alega inconformidad con la fundamentación jurídica, concretamente por incurrir el Tribunal en ausencia parcial de la fundamentación jurídica. Arguye que el Tribunal al dictar sentencia absolutoria en favor del imputado [Nombre1] dijo que mantenía una duda razonable referente a que el encartado tuviera conocimiento que el dueño de la finca no poseía los permisos correspondientes para aserrar la madera. Aduce que la Juzgadora indicó que el imputado pudo haber incurrido en un error pensando en que el señor Á tenía esos permisos. Agrega que el Tribunal se fundamentó en el dicho del testigo [Nombre12], quien dijo que el señor Á dueño de la propiedad le dijo al encartado que no había problema, que todo estaba arreglado. El recurrente estima que por ser el imputado [Nombre1] vecino del lugar, viviendo en esa comunidad desde hacía tiempo conocía que era zona boscosa.

Que trabajó muchos años sacando madera y sabía lo delicado que era esa actividad, por lo que debió pedir los permisos al dueño o bien verificar en el Minaet que se encontraba cerca de la finca, si se tenían los permisos. En síntesis, el señor Fiscal considera que el encartado de haber incurrido en un error era vencible pues dudó sobre la antijuridicidad de su acción, tan es así que consultó sobre el hecho de si existían los permisos. Alega el recurrente que el Tribunal no analizó si ese error de prohibición era vencible o invencible dejando ayuna la sentencia de fundamentación jurídica. Solicita se anule la sentencia únicamente en cuanto al hecho primero de la acusación y en lo que toca al imputado [Nombre1], ordenando el reenvío correspondiente. Sin lugar el reclamo. Ciertamente la sentencia no concluye en la absolutoria del imputado [Nombre1], utilizando un lenguaje técnico-jurídico como el que extraña el recurrente.

Comparte ésta Cámara con el señor Fiscal, que el fallo no analiza el error de prohibición (creencia de que su conducta no resulta cubierta por el ámbito prohibitivo de la norma), sino que en forma muy artesanal, estima que de acuerdo a la prueba recibida, existe una duda razonable sobre el hecho de que el encartado tuviera conocimiento de que el dueño de la finca no poseía los permisos correspondientes para el aserrío de la madera. Lo anterior en términos jurídicos equivale a decir que el Tribunal tiene dudas sobre el conocimiento de la antijuridicidad de su acción de parte del endilgado. Ahora bien, lo que debe valorarse por parte de ésta Cámara para no decretar nulidades sin la existencia de un agravio, es si los elementos probatorios recibidos respaldan la conclusión del Tribunal, o bien si violentó las reglas de la sana crítica. El tema del error de prohibición vencible y el invencible no es un asunto fácil de zanjar.

Deberá examinarse cada caso en concreto y con base en las circunstancias del hecho, personalidad, formación académica del imputado, determinar si pese al error, este podía ser evitado. Al respecto [Nombre13] nos indica: " El error de prohibición puede ser vencible o invencible. El error de prohibición invencible no puede reprocharse al autor, pues quien no se encuentra en situación de advertir lo injusto del hecho no demuestra ninguna actitud censurable hacia el Derecho cuando lo vulnera....Por el contrario, en el error de prohibición vencible se suscita la cuestión de en qué medida y con qué fundamento puede formularse un reproche de culpabilidad. Sobre esto debe, en principio decirse: el ordenamiento jurídico exige no sólo al hombre que evite lo que ante sus ojos aparezca claramente como injusto; además debe esforzarse en actuar siempre en consonancia con el Derecho...El baremo para decidir la evitabilidad del error de prohibición ha de ser el mismo que se maneja en la imprudencia en relación al deber de examen del autor.

Debe partirse de la consideración de que el conocimiento de las circunstancias del hecho que proporcionan indicios sobre lo injusto debería constituir para el autor ocasión de comprobar la relación del hecho con el orden jurídico. Sin duda la intensidad de la incitación al examen de la antijuridicidad que emana del conocimiento del tipo varía según la clase de delito. Cuando el hecho no constituya únicamente una infracción al derecho, sino al mismo tiempo una vulneración insoportable del orden moral, el error de prohibición será evitable..... Si el autor duda acerca de la vigencia de un precepto por él conocido, no le es lícito limitarse a seguir la concepción que le resulte más favorable, sino que debe procurarse el consejo del experto. Unicamente le disculpara la información que sobre el Derecho obtenga de una fuente fiable" ([Nombre14] . Derecho Penal. Parte General. Tomo 1. Barcelona.

Bosch. 1991. Pp 628-630). En el presente caso, de acuerdo a la versión del testigo [Nombre12], el encartado fue contactado por el dueño de la finca Á, quien le propuso que le ayudara a sacar una madera de un árbol, siendo que el imputado le dijo que el problema era que no tenía motosierra y que era peligrosa la actividad, a lo cual según la sentencia, el deponente se refería a que era arriesgado que llegaran los funcionarios del Minaet. Siendo que el dueño de la finca le aseguró que todo estaba en regla, que tenía los permisos, que cualquier cosa si llegaban los del Minaet, lo llamara. Para ésta Cámara la personalidad y educación del encartado [Nombre1] ( agricultor, de baja escolaridad) en una zona rural, si bien conocía la existencia de la norma prohibitiva ( aserrar madera sin permisos), su duda sobre la existencia de permisos la resuelve conforme lo haría una persona de sus características preguntándole al dueño de la finca si tenía los permisos, a lo cual éste le responde afirmativamente.

Estima éste Tribunal que se trata de una fuente fiable para las condiciones educativas y personalidad del imputado, sin que el derecho pueda exigir a una persona de esta condición el acudir al Minaet a averiguar si era cierta la información dada por el dueño de la finca. Mucho menos cuestionar a quien le estaba dando trabajo- tan escazo en estos días- exigiéndole que le mostrara los permisos. Por ello, si bien el Tribunal no analizó el punto de la vencibilidad del error en forma específica, se estima que sus conclusiones en cuanto a la duda sobre la falta de conocimiento de la antijuridicidad de parte del acusado sobre la existencia de los permisos, resulta acorde con la prueba recibida y ajustada a las reglas del correcto entendimiento humano. Por lo expuesto, se declara sin lugar el motivo.

Por tanto:

Se declara con lugar el recurso de apelación presentado por la Procuraduría General de la República. Se anula parcialmente el fallo y se ordena el reenvío a efectos de que el Tribunal de Juicio de reenvío se pronuncie con relación a la restitución y restauración del bosque afectado en la zona protectora, previa audiencia al propietario del inmueble. En lo demás, se confirma el fallo apelado. Se declara sin lugar el recurso de apelación interpuesto por el Ministerio Público. NOTIFÍQUESE.
