Ordinary proceedings (proceso de conocimiento) conducted before the Tribunal Contencioso Administrativo by ASOCIACIÓN ADMINISTRADORA DEL ACUEDUCTO DE PUENTE SALAS DE SAN PEDRO DE BARBA, represented by its president, vested with the powers of a general agent with unlimited authority as to amount (apoderado generalísimo sin límite de suma), Nombre229442, whose personal particulars are unknown; against PARAÍSO TROPICAL INC. SOCIEDAD ANÓNIMA, represented by its president, vested with the powers of a general agent with unlimited authority as to amount, Nombre229905, agricultural engineer and resident of Heredia, who was also sued in his personal capacity. The Instituto Costarricense de Acueductos y Alcantarillados appears as an active supporting party (coadyuvante activo). Attorney Luis Antonio Álvarez Chaves, a resident of Heredia, also appears as special litigation counsel (apoderado especial judicial) for the plaintiff, and, most recently, Doctor of Laws Olman Arguedas Salazar appears for the defendant. The natural persons are of legal age and, subject to the exceptions noted, married, attorneys, and residents of San José.

RESULTS 1. Based on the facts alleged and the statutory provisions cited, the plaintiff instituted ordinary proceedings seeking a judgment declaring: “ (…) the complaint well-founded, declaring that ASOCIACIÓN ADMINISTRADORA DEL ACUEDUCTO DE PUENTE SALAS DE SAN PEDRO DE BARBA and INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ACLACANTARILLADOS are the owners of the land that it has possessed for more than veinticinco años, described in the cadastral survey (levantamiento catastral) prepared by surveying engineer Nombre229906 as follows: Land containing two potable-water tanks and a storage building, located at Dirección12277 (San Isidro), in the Second Canton (Barva) of the Province of Heredia, bounded to the southwest by Dirección336 for 11,38 metros, and to the northwest, northeast, and southeast by the remainder of Dirección24783, with an area of doscientos veintinueve metros cuadrados, forming part of the property recorded under real-property folio registration (matrícula de folio real) Placa43110 in the Heredia Registry District, by reason of the public-domain structures (construcciones con carácter demanial) devoted to public service that have been developed thereon, and that authorization be granted to register it in the cadastre. 2.

(…) that defendant Nombre229905, in his personal capacity and as representative of the defendant company, refrain from any and all actions detrimental to the property right arising from a judgment sustaining these proceedings, with notice that otherwise he may be prosecuted for the offense of disobedience of authority. 3. that the defendants be ordered to pay the damages and losses caused. 4. that the defendants be ordered to pay the attorney’s fees and litigation costs of this action. ALTERNATIVE CLAIM 1. (…) well-founded. 2. (…) order the defendant. 3. (…) order the defendants to pay the damages and losses caused. 4. (…) order the defendants to pay the attorney’s fees and litigation costs of this action." 2. The defendant answered, raising the defenses of lack of a legal right and lack of both standing to sue and standing to be sued; as well as the preliminary defenses (defensas previas) that the acts were not subject to review in this jurisdiction and lack of jurisdiction, the latter having been decided by interlocutory ruling.

3. The preliminary hearing was held at 14 horas del 29 de setiembre and at 14 horas 7 minutos del 10 de octubre, both in 2011. During the first, the preliminary defense raised by the respondent that the acts were not subject to challenge was decided. On both occasions, the parties were heard.

4. The Tribunal Contencioso Administrativo y Civil de Hacienda, composed of Judges Ricardo A. Madrigal Jiménez, Grace Loaiza Sánchez, and Francisco Muñoz Chacón, ruled in judgment no. 033-2012 at 11 horas del 29 de marzo de 2012: “The defense of lack of a legal right is sustained as to the plaintiff’s principal and secondary claims of acquisitive prescription (prescripción positiva) or a co-ownership regime (régimen de copropiedad), and the proceedings are dismissed as to those claims. The defense of lack of a legal right is rejected as to defendant Nombre229905, who is ordered, in his personal capacity and as president of the aforementioned company, not to disturb by self-help measures (vía de hecho) the plaintiff’s possession. Instituto Costarricense de Acueductos y Alcantarillados shall take note of the matters stated in recital IX (considerando IX). The claim for compensation asserted by the defendant against its opposing party in the answer to the complaint is rejected as legally unfounded. In view of the manner in which the matter is decided, no special award of costs is made.” 5. Mr. Nombre229905 filed an appeal on points of law (recurso de casación), expressly stating the grounds on which he relies to challenge the Tribunal’s position.

6. The statutory requirements have been observed in the proceedings before this Chamber.

Justice Solís Zelaya drafts the opinion

CONSIDERING

I.According to the facts established by the adjudicators, which were not challenged, in 1974, the Junta de Desarrollo de la Comunidad de Puente Salas de San Pedro de Barva de Heredia, with the support of the civil forces, built a water-storage tank on the La Amada property to meet the community’s need for that resource. Authorization was obtained from Mr. Guillermo Rohormoser, then the owner of the estate. The structure was erected at the technically appropriate location because of its elevation and access to the population. Don Guillermo agreed to convey the area on which it was built; however, the legal transaction was never finalized. Paraíso Tropical INC Sociedad Anónima (hereinafter Paraíso Tropical) owns the property recorded in the Registro Público under real-property folio registration number Placa43110 in the Heredia Registry District, which forms part of the former La Amada property and is the site of the aforementioned rural aqueduct works.

In late 1994 or early 1995, its legal representative, Mr. Nombre229905, authorized the construction of a second tank for the benefit of the aqueduct, which at that time was administered by a Community Committee. The community and the government contributed to this project. In consideration of the cooperation concerning the land on which it was built, Mr. Nombre229905 and Paraíso Tropical were provided with four water-service connections. This new tank was built at the technically suitable location, not only because it was next to the first tank, but also because of the elevation and its direct connection to the water system already installed. On 28 de octubre de 1999, Instituto Costarricense de Acueductos y Alcantarillados (hereinafter AyA) entered into a rural-aqueduct administration agreement with Asociación de Desarrollo Comunal de Puente Salas. On an undetermined date, but before 2002, Asociación Administradora del Acueducto de Puente Salas de San Pedro de Barva (hereinafter Asociación or ASADA) was formed by the same community group that had previously constituted the water committee forming part of the community’s Asociación de Desarrollo.

On 20 de junio de 2002, AyA entered into an agreement with ASADA for administration of the local aqueduct. Before 2010, Asociación, don Nombre229905, and Nombre229907 engaged in coordinated activities for the benefit of the aforementioned aqueduct. Recently, homeless persons and drug addicts in the area have left waste such as condoms and clothing in the tanks; they have also broken covers and cut padlocks, and they cook at the site. ASADA requested authorization from Mr. Nombre229905 and Nombre229907 to install protective fencing around the tanks, but no agreement was reached. Despite this, it decided to carry out the work. When installation of the protective fencing was underway, don Nombre229905 prevented it. Nevertheless, pursuant to the interim relief (medida cautelar) granted, its construction was ordered.

II.On 27 de agosto de 2010, the then representative of Asociación instituted ordinary proceedings against Paraíso Tropical, represented by Mr. Nombre229905, and against him in his personal capacity. She seeks a judgment declaring—as revised at the preliminary hearing held on 29 de setiembre de 2011, see the corresponding recording at 15:13:30—principally, that ASADA is the registered owner of the land it has possessed for more than 25 años, described in the cadastral survey prepared by surveying engineer Nombre229906, with an area of 229 metros cuadrados, forming part of the property described under real-property folio registration number Placa43110 in the Heredia Registry District, by reason of the public-domain structures erected thereon. She further requests authorization to register that land in the cadastre and subdivide it (segregar). In the alternative, she seeks, first, a declaration establishing a co-ownership regime in favor of her principal and in relation to the defendant company over the land it has possessed for more than 25 años, described in the cadastral survey prepared by surveying engineer Nombre229906, with an area of 229 metros cuadrados, forming part of the property recorded under real-property folio registration Placa43110 in the Heredia Registry District, by reason of the public-domain structures erected thereon.

She likewise requests authorization to register that land in the cadastre and subdivide it. Second, she asks that codefendant Nombre229905, in his personal capacity and as representative of the defendant company, be ordered to refrain from any and all actions detrimental to the property right arising from a judgment sustaining the complaint, with notice that otherwise he may be prosecuted for the offense of disobedience of authority. Lastly, with respect to both the principal and alternative relief sought, she requests that the codefendants be ordered to pay the costs of the proceedings. Don Nombre229905, acting in both capacities, admitted some facts and denied others. He raised the defense of lack of a legal right. The Tribunal sustained it with respect to the principal and alternative claims of acquisitive prescription and a co-ownership regime. It consequently dismissed the complaint as to those claims.

It denied the defense with respect to codefendant Nombre229905. It ordered him, in his personal capacity and as president of the codefendant company, to refrain from disturbing by self-help measures the plaintiff’s possession. It also rejected as legally unfounded the claim for compensation asserted by the defendant in the answer to the complaint. In view of the manner in which it decided the proceedings, it made no special award of costs. Both parties, being dissatisfied, filed separate appeals on points of law. The appeal filed by plaintiff ASADA was summarily dismissed in decision number 1219 at 9 horas 30 minutos del 19 de setiembre de 2013. The defendant alleges violations of procedural and substantive rules.

III. DOCUMENTS SUBMITTED WITH THE APPEAL

The appellant in cassation (casacionista) submitted with its appeal:

  • 1)a registry certification of the legal standing of the company Paraíso Tropical;
  • 2)a registry certification of the microfilm of volume 414, entry 15255, corresponding to the deed of segregation and purchase of a lot forming part of the property registered in the Heredia district, real-property folio registration no. Placa43112, by the company Paraíso Tropical;
  • 3)a copy of opinion no. C-061-2008 of the Procuraduría General de la República dated 4 de marzo de 2008;
  • 4)a copy of legal opinion no. OJ-121-2001 of the Procuraduría General de la República dated 3 de setiembre de 2001;
  • 5)a copy of opinion no. C-023-98 of the Procuraduría General de la República dated 13 de febrero de 1998;
  • 6)five photographs of the entrance to the property where the water tanks and the fence that was built are located;
  • 7)the closing arguments presented at the oral trial hearing. Pursuant to the provisions of section 145 of the Código Procesal Contencioso Administrativo (CPCA), at this stage a party may submit only documentary evidence that the appellant swears it did not previously know about and that relates to facts arising after the challenged judgment or to newly discovered facts. The aforementioned evidence does not fall within those circumstances. It does not concern facts arising after the challenged judgment or newly discovered facts. On the contrary, all the documents concern factual circumstances that occurred before the challenged decision, including the photographs submitted. They show the construction of the fence around the water tanks, an event that occurred before the judgment was issued. Moreover, other photographs appearing at folios 45 to 49 confirm that factual circumstance; accordingly, this item of evidence is also immaterial or futile to the resolution of this dispute (lite). Consequently, the documents submitted must be rejected. Furthermore, at folio 446, the appellant in cassation states: “5- If the Sala Primera deems it necessary, we offer the testimony of Ms. Nombre229908, administrator of the Asada, so that she may address the books that the Asada made available to Mr. Nombre229905 within the period granted to Mr. Nombre229905 at the preliminary hearing for their submission in the proceeding, an administrative record not submitted by the ASADA that did not include books belonging to other Associations. / 6- If the Sala Primera deems it necessary, we request that, as evidence for a better determination of the matter (prueba para mejor resolver), it ask AyA to certify whether it has initiated expropriation proceedings concerning the land of Paraíso Tropical Inc. S.A., since when [sic], and the current status thereof, together with the relevant documentary evidence, of course.” Both items of evidence requested for a better determination of the matter are irrelevant to the resolution of this proceeding; therefore, they must be dispensed with—section 148 of the CPCA.

APPEAL FOR VIOLATION OF PROCEDURAL RULES

IV.In view of the manner in which the matter will be decided, this Chamber first examines the following grounds of error. In the fourth objection, identified as I.B.2, folio 405, the appellant in cassation argues that the challenged judgment left both him and his principal without a defense because it awarded the plaintiff relief that had not been requested in the complaint. Among her claims for relief, he asserts, she did not request recognition of a right of possession over the area of land where the tanks are located, measuring approximately 229 square meters. Nevertheless, he emphasizes, the judges unexpectedly recognized and even deemed proven—without identifying any evidence—possession over that “area of the property.” Because this was not requested, he states, they committed the defect of ultra petita; that is, they granted more than was sought. He concludes that the defects of inequality in the proceedings, violation of due process, and absolute nullity of the rules governing judgments and procedure are present.

In the sixth objection, designated I.C.2., folio 406, the appellant states that the plaintiff’s principal claim was for a declaration of acquisitive prescription (usucapión) over the land where two AyA tanks administered by her are located, by virtue of the passage of time. However, he notes, the judgment granted her relief that had not been requested: possession and, moreover, an order that such possession not be disturbed. He insists that the plaintiff ASADA did not seek recognition of a right of possession over the land. Nor, he adds, does the judgment contain any analysis establishing such possession; instead, it treats it as a proven fact without explanation. He reproduces, insofar as relevant, the statements made in recital (considerando) I of the challenged decision. The judges, he emphasizes, did not analyze the issue of possession but instead deemed it proven without explaining why, despite compelling reasons for concluding that the ASADA does not have possession: 1) its relationship with the tanks and the land exists because the Ley Constitutiva del AyA, Decreto Ejecutivo no. 32529-MINAE, and the Delegation Agreement between it and that entity so permit.

This, he notes, does not include any possession of the land on which the tanks forming part of the AyA aqueduct are located, which constitutes public-domain property (bienes demaniales). Nor does it authorize the ASADA to acquire property by acquisitive prescription; on the contrary, he clarifies, section 21, subsections 10 and 13, of the aforementioned Decree require it to expropriate when necessary; 2) because, if anyone could possess the land, it would be AyA, as owner of the tanks; nevertheless, he alleges, as a matter of Public Law, it is barred from acquiring by positive prescription (prescripción positiva) land registered in the names of third parties. Furthermore, he partially reproduces the contents of section VIII of the challenged judgment. He does not know, he states, how the Court reached the stated conclusion. In this regard, he comments, no evidence was submitted in the proceeding concerning the relationship between any prior associations or committees and the ASADA; nor was it stated whether there were any intervening gaps or how the rights—if any—were transferred from one to another.

Still less, he recounts, is there any indication of the factual or evidentiary basis upon which the judges established the Association’s possession of land registered in the name of a third party. The plaintiff, he specifies, administers the aqueduct because the delegation agreement between it and AyA authorizes it to do so, and the aqueduct is public-domain property. This, he continues, constitutes a failure to state the grounds for the judgment and inconsistency (incongruencia), resulting in the absolute nullity of the decision. Furthermore, he states, the judgment fails to set forth clearly and precisely the facts deemed proven because its analysis of acquisitive prescription is incomplete. It did not address each of its elements, as provided in sections 853 to 864 of the Código Civil: a) proof of title, good faith, possession as owner, continuously, openly, and peacefully, for a period of 10 years or more.

Such an analysis, he reasons, belongs to the civil jurisdiction, not the administrative litigation jurisdiction (jurisdicción contencioso administrativa). The judgment states that the ASADA could acquire property by acquisitive prescription only when acting in its Private Law capacity; for that reason, he maintains, the timely objection to subject-matter jurisdiction should have been upheld. He reiterates that the ASADA’s relationship with the tanks and the property is determined by the agreement executed between it and AyA, appearing at folios 19 to 25 of the record of the precautionary measure (medida cautelar). He reproduces the claim for relief as reformulated at the preliminary hearing. For the foregoing reasons, he states, and because the subject-matter jurisdiction defense was rejected, the judgment’s analysis should have proceeded step by step through each of the elements determining whether acquisitive prescription exists, or it should have declared that an ASADA’s positive prescription is not a matter within the jurisdiction of the administrative litigation courts.

The Court found that the claimant had possession, which must be respected, and ordered co-defendant Nombre229905 to refrain from disturbing it through self-help measures (vías de hecho); this, he comments, despite the fact that the plaintiff had not requested such relief and possession had not been proven, constituting ultra petita and violating the right of defense, thereby rendering the ruling null and void. He notes that the reasons why the judges established the existence of possession—an issue not raised in the claims—were neither demonstrated nor proven; nor did they identify the type of possession or its limits and scope. It should be noted, he states, that the plaintiff’s claim sought to have the co-defendant, in his personal capacity, refrain from disturbing the ownership right that would arise from a judgment granting her claims, which, he adds, refer only to an ownership or co-ownership right.

The plaintiff, he continues, never requested a declaration of her right of possession or an order requiring the defendant, in his personal capacity, to refrain from disturbing it. This is, he insists, a clear case of ultra petita, because the plaintiff was granted relief that she had not requested. He states that there was mere tolerance (mera tolerancia), granted for the maintenance of the first tank and construction of the second, both belonging to AyA, on the defendant company’s property. This, he alleges, entails their routine maintenance; therefore, any change obviously had to be discussed with the company that owned the property. In this regard, he notes, the Association’s minutes may be consulted, as they demonstrate the terms of the agreement. For that reason, he states, it is unsurprising that the defendant company objected to the construction of a fence around the tanks, for which, as shown by the witnesses’ testimony—particularly that of Mr.

Nombre229909—the co-defendant does not have a key and whose anchors are located inside the property. The reason why the company objected is clear, he states. In this case, he alleges, there has been a de facto expropriation without compensation. There is no justification whatsoever, he concludes, for the fence to remain because, each day since it was imposed through the precautionary measure, the co-defendant’s property right has been violated.

V.Because of the close connection between both objections, they will be analyzed jointly. Following a detailed examination, it may be inferred that the appellant in cassation raises two different issues: 1) the challenged judgment incurs the defect of ultra petita—by having granted more than was requested—because, he asserts, it unexpectedly recognized the claimant’s possession of the area where the water tanks are built, which Mr. Nombre229905—in his dual capacity—must respect, refraining from disturbing it through self-help measures (vías de hecho); and 2) the Contentious-Administrative Jurisdiction lacks subject-matter jurisdiction to hear this proceeding, because the analysis of the adverse possession (usucapión) alleged by the claimant falls within the Civil Jurisdiction. In the first scenario, if the alleged conduct occurred, it would constitute the procedural defect of inconsistency with the pleadings (incongruencia).

In this regard, as noted in recital (considerando) II of this judgment, the claimant ASADA seeks a judgment declaring (in accordance with the reformulation made at the preliminary hearing), as its principal claim, that it is the registered owner of the land it has possessed for more than 25 years, described by means of a cadastral survey (levantamiento catastral) prepared by surveying engineer Nombre229906, with an area of 229 square meters, which forms part of the property described under real-property folio registration number Placa43110 in the province of Heredia, by reason of the public-domain structures (construcciones con carácter demanial) erected thereon. It therefore requests authorization to survey and subdivide that land. In the alternative, it requests, first, that a co-ownership regime (régimen de copropiedad) be declared in its favor and in relation to the defendant company over the land it has possessed for more than 25 years, described by means of the cadastral survey prepared by surveying engineer Nombre229906, with an area of 229 square meters, which forms part of the property registered under real-property folio Placa43110 in the province of Heredia, by reason of the public-domain structures erected thereon; it also requests authorization to survey and subdivide that land.

Likewise, as its second alternative claim, it asks that co-defendant Nombre229905, in his personal capacity and as representative of the defendant company, be ordered to refrain from taking any action detrimental to the property right arising from a ruling granting the claims in this proceeding, with the warning that, should he fail to comply, he may be prosecuted for the offense of disobedience of authority. In recital VIII of the challenged decision, after stating the reasons for which it deemed the adverse possession alleged by the claimant unfounded, because one of the requirements for granting it was absent—valid title transferring ownership (justo título traslativo de dominio)—which resulted in the rejection both of the principal claim—that the claimant be declared the owner—and of the first alternative claim—that co-ownership be established—the Court stated the following: “Lastly, a claim is made against Mr.

Nombre229905, in his personal capacity and as representative of the defendant corporation, that he refrain from disturbing the claimant’s property right. It is evident that the association lacks the property right, in the terms already stated; but it does [sic] possess at least one of its attributes, namely the right of possession, which, as indicated, it has exercised for many years under a claim of ownership [sic], publicly, peacefully, and continuously, a fact known to Mr. Nombre229905 in his dual capacity. It is clear that, because the corporation Paraíso Tropical Inc S. A. holds the property right over the parcel underlying the dispute, it may claim that attribute (possession) for itself whenever it sees fit, but [sic] self-help measures are not the lawful mechanism for doing so. Because that right was allowed to become established over time, the appropriate recovery-of-possession proceeding (proceso reivindicativo) may be heard through an action, with the corresponding recognition of any improvements that may have been made.

Under those circumstances, and with respect to the right of possession, it is [sic] consistent with law to grant the asserted claim, which is hereby granted subject to the clarification indicated, pursuant to article one hundred twenty-two of the Contentious-Administrative Procedural Code.” (Emphasis added). In accordance with the foregoing, the operative portion, insofar as relevant, ruled: “The defense of lack of legal entitlement (falta de derecho) is granted with respect to the principal and secondary [sic] claims for acquisitive prescription (prescripción positiva) or a co-ownership regime asserted by the claimant, and the proceeding is dismissed as to those matters. The defense of lack of legal entitlement is rejected with regard to defendant Nombre229905, and he [sic], in his personal capacity and as president of the aforementioned corporation, is ordered not to disturb through self-help measures the possession held by the claimant. […]” (Emphasis not in the original).

From the quoted passages, it may be inferred with unmistakable clarity that the adjudicators did not, in fact, grant the second alternative claim. It could not be granted after both the principal claim and the first alternative claim had been rejected, because, it bears repeating, what was requested therein was: “That defendant Nombre229905, in his personal capacity and as representative of the defendant Corporation, be ordered to refrain from taking any action detrimental to the property right arising from the declaration, with the warning that, should he fail to comply, he may be prosecuted for the offense of disobedience of authority.” (Emphasis added). Indeed, they stated: “It is evident that the association lacks the property right, in the terms already stated […].” What was granted, by contrast, has the character of a ruling issued sua sponte (pronunciamiento oficioso), pursuant to provision 122 of the CPCA, as was expressly cited.

VI.Along these lines, as this Chamber has repeatedly stated, the CPCA introduced a paradigm shift in contentious-administrative justice (justicia contencioso administrativa). Its principal objective was to bring it fully into conformity with section 49 of the Political Constitution: “The Contentious-Administrative Jurisdiction is hereby established as a function of the Judiciary for the purpose of safeguarding the lawfulness of the administrative function of the State, its institutions, and every other public-law entity./ Misuse of powers (desviación de poder) shall constitute grounds for challenging administrative acts./ The Law shall protect, at a minimum, the subjective rights and legitimate interests of persons subject to the Administration.” (Emphasis added). It incorporates oral proceedings as a means or mechanism for administering justice and, with them, their inherent principles, such as adversarial proceedings, immediacy, and concentration of evidence.

The new contentious-administrative regime adopts a mixed system, combining written and oral proceedings and introducing oral proceedings conducted through hearings. Likewise, it provides for plenary review of administrative conduct, eliminating areas immune from judicial review. It expressly provides for the protection of the various legal situations of persons that may be affected by any conduct of the Public Administration governed by Administrative Law. In this regard, Article 1 provides, insofar as relevant: “1) The purpose of the Contentious-Administrative Jurisdiction, established in article 49 of the Political Constitution, is to protect the legal situations of every person, ensure or restore the lawfulness of any conduct of the Public Administration governed by Administrative law [sic], and hear and resolve the various aspects of the legal-administrative relationship./ 2) Grounds of unlawfulness encompass any violation, by act or omission, of the legal system, including misuse of powers. …” (Emphasis added).

The new proceeding places the person at its center. It provides the tools necessary to achieve the humanization and democratization of the judiciary. The constitutional principles of justice, due process, and effective judicial protection stand as guides throughout every procedural stage. In short, it seeks to fulfill the values inherent in a democratic state governed by the rule of law. Following this line of thought, one of the principal changes introduced by the CPCA is contained in provision 122 and concerns the possibility—or, more precisely, the obligation—of adjudicators to issue a series of rulings sua sponte. Nevertheless, in providing that: “When the judgment declares the claim well-founded, in whole or in part, it shall, as appropriate, make, among others, the following rulings: […]”, that provision makes such authority contingent upon the claim asserted by the claimant or counterclaimant being declared well-founded in whole or in part. In this regard, reference may be made, among others, to judgments nos. 900 of 10 hours 50 minutes on 27 de agosto de 2009 and 1357 of 14 hours 9 minutes on 4 de noviembre de 2010.

VII.Following this line of reasoning, if the Court does not grant the relief sought, in whole or in part, it is precluded from issuing rulings under the aforementioned provision 122 of the CPCA. If it does so, it would inexorably incur the defect of incongruence (incongruencia). Regarding the principle of congruence (principio de congruencia) in proceedings governed by the CPCA, this Chamber stated, inter alia, in judgment 288 at 10 hours 20 minutes on 20 de marzo de 2009, insofar as relevant: “III.- Regarding the defect of incongruence under the new contentious-administrative procedural legislation, this Chamber recently stated: “VIII. Furthermore, the appellant in cassation alleges a violation of provision 155 of the Code of Civil Procedure. In this regard, it must be noted that section 220 of the Contentious-Administrative Procedure Code, contrary to the appellant’s assertion, does not authorize the application of those rules.

Instead, that provision states: ‘For matters not expressly provided for in this Code, the principles of Public and procedural Law in general shall apply.’ That is, in the case at bar (sub júdice), the procedural principle of congruence of judgments may be invoked, but not a violation of article 155 of the Code of Civil Procedure. As this Chamber has repeatedly held, incongruence occurs when there is an evident contradiction between the litigants’ claims and the ruling contained in the operative part of the judgment, not between the reasoning of the judgment and the ruling contained in its operative part. Under the new contentious-administrative procedural legislation, this premise has been qualified. This is because, by virtue of the powers granted to the adjudicator, the claims asserted in the complaint may be modified both at the preliminary hearing and at trial (articles 90 subsection 1 b) and 95 ibídem); moreover, pursuant to provision 122 ejúsdem, a series of rulings may be issued sua sponte (de oficio).

Consequently, the foregoing must be borne in mind when analyzing such error. …” (no. 000819-A-2008, at 10 hours 45 minutes on 4 de diciembre de 2008). Thus, incongruence as a ground for cassation (causal de casación) occurs when the adjudicator, in ruling, decides matters not requested (extra petita), grants more than was requested (ultra petita), or omits a decision, in whole or in part, regarding the claims or defenses. To determine whether this defect exists as a ground for cassation, the operative part of the judgment must necessarily be compared with the claims asserted in the complaint and on the other occasions provided for by law, or with the defenses raised by the defendant, in order to establish whether there is in fact an evident discrepancy between the former and the latter. …” In this regard, reference may also be made, inter alia, to judgments nos. 85 at 15 hours 35 minutes on 24 de enero de 2001, 127 at 8 hours 30 minutes on 22 de febrero de 2008, and 1357 at 14 hours 9 minutes on 4 de noviembre de 2010.

VIII.As noted, the Court denied the principal and alternative relief requested by the plaintiff ASADA. That is, it neither declared the plaintiff to be the owner of the property nor established a co-ownership regime (régimen de copropiedad) between it and the co-defendant company; therefore, the second alternative request was likewise unavailable because it was contingent upon judgment being entered in favor of the plaintiff, as the plaintiff had requested that co-defendant Nombre229905, in his personal capacity and as representative of the co-defendant company, be ordered to refrain from any and all actions detrimental to the property right arising from a judgment granting the complaint. Consequently, on pain of incurring the defect of incongruence, it could not issue a sua sponte ruling under provision 122 of the CPCA, as it did. As stated, this action by the Court constitutes the alleged error of ultra petita incongruence because there was an “excessive ruling,” which left the defendant without an opportunity to defend itself –provision 137 subsection b) of the CPCA-.

IX.In view of the foregoing, the appeal must be granted on this issue for violation of procedural rules. Consequently, the challenged judgment must be partially vacated insofar as it ordered co-defendant Nombre229905 –in his dual capacity- not to disturb, through self-help measures (vía de hecho), the plaintiff Association’s possession. Pursuant to the principles of procedural economy and expeditiousness, the case file will not be remanded to the trial court because doing so is unnecessary. In this regard, see, inter alia, judgments of this Chamber nos. 900 at 10 hours 50 minutes on 27 de agosto de 2009 and 1357 at 14 hours 9 minutes on 4 de noviembre de 2010.

X.The second issue raised by the appellant in cassation, as indicated, is that, in its view, the contentious-administrative jurisdiction lacks subject-matter jurisdiction to hear the adverse possession (usucapión) claim asserted by the plaintiff because, it contends, the matter falls within the civil jurisdiction. This Chamber has had occasion to determine which judicial bodies have jurisdiction over proceedings in which an Aqueduct Administration Association is a party. In this regard, resolution no. 1152-C-S1-2012 at 10 hours 15 minutes on 13 de setiembre stated, insofar as relevant: “II.- Law number 2726 of 14 de abril de 1961, the Constitutive Law of the Costa Rican Institute of Aqueducts and Sewers, provides in its first section that AyA is the autonomous institution responsible for directing, setting policies, establishing and enforcing standards, and promoting nationwide the planning, financing, and development of all matters related to the water supply.

Subsection g) of the second section of the aforementioned Law establishes that it is responsible for directly administering and operating aqueduct and sewer systems throughout the country. The legislature further provided that the institution is authorized to enter into agreements with local bodies for the administration of such services or to administer them through joint administrative boards composed of the Institute and the respective communities. For its part, Regulation 32529 of 2 de febrero de 2005, entitled Regulations for Associations Administering Community Aqueduct and Sewer Systems, establishes that AyA may delegate the administration, operation, maintenance, and development of community aqueduct and/or sewer systems to associations known as ASADAS (article three). The purpose of such entities shall be the construction, administration, operation, maintenance, and development of the aqueduct and sewer systems delegated by AyA, as well as the conservation and rational use of the water needed to supply the communities (article 16 of the aforementioned regulation).

Regarding the property regime governing assets allocated to the aqueduct system, section 18 of the aforementioned Law 2726 states that all properties and facilities belonging to State bodies and allocated to services related to the collection, treatment, and distribution of drinking water constitute national patrimony. Regulation 32529 likewise provides that all movable and immovable property used by ASADAS in the administration, operation, maintenance, and development of aqueduct and sewer systems is deemed to be in the public domain (dominio público) and may not be disposed of (article 18 and 21 subsection 10); and that, upon termination of the delegation agreement or dissolution of the ASADAS (section 21 subsection 13), such property shall be delivered to AyA, which [sic] shall inventory, record, and register it in its name, assuming ownership thereof for allocation to that public service (article 22 subsection 11).

Consequently, the claims of the representative of […] involve an evident State interest because they concern real property allocated to water collection, a public-domain asset under the responsibility of AyA and indirectly administered by the defendant Association herein; accordingly, this matter must be heard before the contentious-administrative jurisdiction. It must therefore be referred to the Contentious-Administrative and Civil Treasury Procedure Court of the Second Judicial Circuit of San José, as ordered in the appealed decision.” To the same effect, see resolution no. 887-C-S1-2012 at 11 hours 20 minutes on 26 de julio de 2012. As in those precedents, the claims asserted in this litigation by the plaintiff ASADA—seeking to be declared the owner of the property forming part of the aqueduct or to have a co-ownership regime established in its favor with the co-defendant company—plainly involve a State interest because of the public-domain nature of the property used for water collection, which is under the responsibility of AyA and whose administration was delegated to the plaintiff ASADA. Therefore, the Contentious-Administrative jurisdiction has jurisdiction to hear the requested relief. Accordingly, the lack of subject-matter jurisdiction alleged by the defendant is not established.

XI.Without prejudice to the foregoing, in view of the manner in which the judges resolved this dispute (litis), the following consideration must be made. In its complaint, the plaintiff Association, insofar as relevant, states at folios 7, 8 and 9: “In this regard, ASADA de Puente de Salas [sic] is granted powers and duties to carry out administrative acts with respect to the ‘assets intended for the provision of the services of the systems they administer [sic],’ all under the principle of sound administration of public services, which has been fulfilled, in coordination with AyA, in the best possible manner to date, with a view to adequately meeting the needs of the users, particularly [sic] taking into consideration the importance of good drinking-water service for sustaining life and maintaining health; this is precisely the basis of our concern and what has led us to bring the present action, since we seek to prevent [sic] the defendant herein from continuing to interfere with the right held by my client over the structure in question, thereby allowing it to continue maintaining the tank and also preventing contamination of the water contained therein. / From this perspective, it must be considered that the subject matter of the present action, namely, the aforementioned water tank [sic], is public-domain property (bien de dominio público) that was built with public funds, is maintained with public funds, and is clearly intended for use in providing a public service; therefore, both ASADA de Puente Salas and AyA have standing (legitimación) to defend the public interests at stake in this situation. / It is likewise evident that the State has a right over the aforementioned water tank, since acts of possession (actos de posesión) have been exercised over that asset for more than 40 years, even before the defendant company acquired it; this is abundantly clear because no private party could feasibly exercise possessory acts (actos posesorios) over an asset whose structure has such a specific and distinctly public purpose.

It is therefore absurd, in the view of this representation, for the defendant herein to now prevent my client from carrying out the possessory acts that have been exercised over the asset for so many years. […] In this regard, we first have the fact that Instituto Costarricense de Acueductos y Alcantarillados built on the property (fundo) of the defendant company a structure that serves as a water tank and forms part of the infrastructure of the aqueduct that supplies drinking water to every household in the community of Puente Salas. That construction was completed more than 30 years ago openly and with the full knowledge, and even the consent, of the former owner; possessory acts have been exercised over those structures publicly, peacefully, and continuously and, we reiterate, with the consent of those who, at the relevant time, held a real right (derecho real) over the property to which this structure is appurtenant. / It is also essential to consider that the structure was built to serve an entire aqueduct whose operation would be radically affected if this tank were unavailable, since without it, major changes would have to be made to the aqueduct itself.

It should be noted that possession of the asset is more than evident in this case because, as stated, the construction itself has a specific purpose: to provide a public service to the community of Puente de Salas [sic]. Since the structure itself is a public-domain asset (bien demanial), it is impossible to leave it in the defendant’s hands in exchange for its monetary value under the first option established by the aforementioned Article 509. […]” (emphasis added). It reiterated this same argument in the appeal on points of law (recurso de casación), which was summarily dismissed. Nevertheless, for the reasons stated below, it is relevant to transcribe the pertinent portions of what was asserted therein: “According to the facts set forth at the relevant time, for approximately 30 years Instituto Costarricense de Acueductos y Alcantarillados, and subsequently ASADA de Puente Salas, have maintained exclusive possession and enjoyment of a system of tanks built in the sector popularly known as La Amada de Puente Salas de Barva, which is located within the boundaries of the property registered under real-property folio number […] Years later—as recorded among the facts found proven in the [sic] challenged Voto—when ASADA needed to perform maintenance work on the tanks in question, at around the year 2010, its officials went to the property where the tanks are located and encountered the reluctance [sic] of the legal representative of PARAÍSO TROPICAL INC. S.A. to allow any work to be carried out without his consent, on the grounds that the company he represented was the lawful owner of the property.

Faced with that situation, and aware of the rights that the works performed on the land and the passage of time conferred upon ASADA to dispose of this asset, we proceeded to file a complaint in which, among other things, the Court was asked to declare co-ownership (copropiedad) in favor of that association, pursuant to Article 509 of the Civil Code (Código Civil). […] what has led us to bring the present action is to prevent [sic] the defendant herein and the company he represents from continuing to interfere with the right held by my client over the structure in question, thereby allowing it to continue maintaining the tank and also preventing contamination of the water contained therein. / From this perspective, it must be considered that the subject matter of the present action, namely, the water tanks in question, consists of public-domain assets that were built with public funds, are maintained with public funds, and are used for an eminently public purpose; therefore, both ASADA de Puente Salas and ICAA have standing to defend the public interests at stake in this situation. […] Accordingly, it is evident that my client has a right over the aforementioned water tanks, since acts of possession have been exercised over those assets for more than 30 years.

This is abundantly clear because no private party could feasibly exercise possessory acts over an asset whose structure has such a specific and distinctly public purpose, and therefore, in the view of this representation, it is absurd. […] It should be noted that accepting that the tanks belong to the defendant company because they are located within its property [sic] would result in unjust enrichment (enriquecimiento sin causa) to the detriment of the public domain (demanio público). […] because Mr. Nombre229905, if he held rights over the property, would in the present case be enriching his estate with a structure of such magnitude located within his property, to the detriment of the public treasury and, consequently, of the community itself, whose health is linked to the proper operation and use of this tank. […] in analyzing the matter at issue on the basis of these two premises, it is essential to consider that the tanks built and administered by my client serve an entire aqueduct whose operation would be radically affected if they were unavailable, since otherwise major changes would have to be made to the aqueduct itself.

It should be noted that, in the matter at issue, possession of the asset is more than evident because, as stated, the construction itself has a specific purpose: to provide a public service to the community of Puente de Salas [sic]. Since the structure itself is a public-domain asset, it is impossible to leave it in the defendant’s hands in exchange for its monetary value under the first option established by the aforementioned Article 509. […]” In light of the foregoing, it is evident that the plaintiff ASADA seeks recognition of property rights over infrastructure forming part of the Puente Salas de San Pedro de Barva de Heredia aqueduct; this is legally untenable for the reasons set forth below. As indicated, Law no. 2726 of 14 de abril de 1961, Ley Constitutiva del Instituto Costarricense de Acueductos y Alcantarillados, provides that all properties and facilities belonging to State bodies and intended for services involving the collection, treatment, and distribution of drinking water constitute national patrimony (patrimonio nacional).

Furthermore, Executive Decree no. 32529 of 2 de febrero de 2005, Reglamento de las Asociaciones Administradoras de Sistemas de Acueductos y Alcantarillados Comunales, provides that all movable and immovable property used by ASADAS in the administration, operation, maintenance, and development of aqueduct and sewerage systems is deemed to be in the public domain. It may therefore not be disposed of, and if the delegation agreement (convenio de delegación) is terminated or the Association is dissolved, such property must be delivered to AyA, which shall inventory, register, and record it in its own name, assuming title to it so that it may be devoted to that public service. In other words, in light of the provisions of those bodies of law—and as also follows from the judges’ reasoning in section VI of the challenged decision—the tanks forming part of the Puente Salas aqueduct are public-domain assets under the responsibility of AyA, which delegated their administration to the plaintiff ASADA—an aspect, moreover, accepted by both parties.

Consequently, they are not subject to acquisitive prescription (imprescriptibles), are inalienable, are not subject to attachment (inembargables), and may not be claimed by denunciation (indenunciables), because they are outside the stream of commerce among private persons, as was likewise determined—according to the Court’s own reasoning in recital V (considerando V) of the challenged judgment. Consequently, the plaintiff ASADA could not seek a declaration of any right over them, much less ownership or co-ownership; particularly since, as acknowledged in the appeal on points of law itself, “The act authorizing my client to exercise rights over the aqueduct arose from the ‘Convenio de Delegación de Administración del Acueducto y Alcantarillado Sanitario de Puente Salas de San Pedro de Barva de Heredia,’ a copy of which is included in the court record (expediente judicial), under which ICAA delegated the administration of the aqueduct, including the water tanks that are the subject matter of the present action.” In other words, the plaintiff Association has no right to the relief sought—whether principal or alternative—and its complaint therefore could not succeed.

XII.In the seventh ground of grievance (agravio)—identified by the appellant as I.C.3., folio 410—he states: since the principal and ancillary claims (pretensiones principal y accesoria) were not granted in the judgment, the precautionary measure (medida cautelar) ordered by the Court could not remain in effect, nor could the plaintiff be exempted from the payment of costs (costas). He states that, with support from legal scholarship, he requested that the judgment expressly address the measure. This, he notes, is because every precautionary measure is not only provisional but also linked, because it is ancillary, to the claim asserted in the complaint. He reproduces the Court’s statements in recital XI (considerando XI) concerning the precautionary measure. He points out that an “exhausted” act, as described therein, could arise if, for example, the cleaning of the tank had been ordered, since that is performed through a single, irreversible act.

However, he observes, the construction of the fence, which in practice “segregates” and “expropriates” the company as the lawful owner of the land, is, so to speak, an “act with continuing effects,” which harms the co-defendant with each passing day. The judgment itself, he states, acknowledges that the anchors are located within the perimeter fenced by the ASADA. He adds that the testimony of Mr. Nombre229909 established at trial that the company he represents does not have a key. This constitutes a de facto expropriation (expropiación de hecho), he asserts, aggravated by the fact that maintaining it benefits only the plaintiff, whose principal and subsidiary claims (pretensiones principal y subsidiaria) were denied. It has been argued in the proceedings, he remarks, that the measure adopted was disproportionate. Indeed, he contends, the testimony of the plumber, Mr. Nombre229910, established that the incidents described as endangering the integrity of the tanks were sporadic and isolated rather than commonplace.

He states that this would also be evident even if it had to be inferred without that testimony, because no problems have arisen in the past between the first and second tanks. He notes that the judgment acknowledged that there have been no arrests, despite the police presence at the site. Consequently, he states, it was not shown that the allegedly harmful incidents were commonplace; rather, they were sporadic and not even as harmful as the plaintiff portrays them. By using a slogan calculated to stir people’s consciences—water contamination—the plaintiff seeks to have the ordered precautionary measure—the fence—remain in effect even though it has no legal justification. He reports that it has also been argued that, if the ASADA wished to provide greater protection for the tanks, it could have coordinated with the local police—who responded when called—hired a night watchman, or installed an alarm or special locks on the lids, among other measures that would not have effectively “segregated” or “expropriated” the lawful owner of the land, as occurred with the ordered precautionary measure.

He insists that the measure is ancillary to the complaint. He reiterates that, in this litigation, the principal and ancillary claims were denied, and therefore an express ruling was required. A request was made to vacate it. He states that this issue was the subject of a motion for supplementation and clarification (gestión de adición y aclaración), in which ruling no. 33-2010- BIS of 8 horas del 4 de mayo de 2012 erroneously stated that construction of the fence forms part of the right of possession (derecho de posesión) exercised by the ASADA, even though this issue was not raised in the claim for relief. Furthermore, he reports, the landowner’s mere tolerance did not extend to the construction of the fence. For that purpose, he explains, it was necessary to purchase or expropriate the land. The ASADA, he explains, did not request a declaration regarding its possession or the scope thereof over the land.

Moreover, he argues, the judgment does not analyze the type, scope, or limits of possession; instead, it treats possession as an established fact. Although it is true, he continues, that AyA was ordered to initiate expropriation proceedings (trámites expropiatorios), it is also true that the ASADA’s current situation lends itself to injustice. This is because, he states, if AyA does not initiate the expropriation process, the defendant company will have to continue enduring dispossession without compensation; alternatively, as the judges themselves stated, it will be forced to commence other judicial proceedings to vindicate its right, with the resulting expenditure of financial resources, delays, and emotional distress (daño moral). AyA’s lack of interest in paying for the land is evident, he asserts, because the judgment dates from marzo de 2012 and nothing has been discussed or served regarding any expropriation.

It is legally unacceptable, he asserts, to maintain a de facto expropriation when less burdensome means, which the defendant company finds acceptable, are available to secure the tanks. Because the principal and subsidiary claims were dismissed, he reasons, the plaintiff should have been ordered to pay costs. He concludes that the warning issued personally against Mr. Nombre229905 to respect the ASADA’s possession was not requested by the plaintiff and was not analyzed in the judgment, but was instead taken as established. In the eighth ground of grievance, designated by the appellant in cassation (casacionista) as I.D.1., folio 413, he alleges a failure to state reasons (falta de motivación) for maintaining the precautionary measure, even though the principal and subsidiary claims were dismissed. He contends that, as supported by legal scholarship, he expressly requested that the judgment address the measure.

This, he states, is because every precautionary measure is not only ancillary and provisional but also intimately and inextricably linked to the principal claim. Thus, he argues, if that claim does not succeed, the precautionary measure cannot remain in effect either, because its fate follows that of the claim, unless it lapses beforehand for any of the legally prescribed reasons. He contends that the challenged judgment failed to observe this rule, despite the request made in the motion for supplementation and clarification. He transcribes recital XI of the challenged ruling. It states that “it is unnecessary to adopt any measure in that regard”; nevertheless, he maintains, an express ruling was requested. An “exhausted” act, he notes, could arise if, for instance, the cleaning of the tank had been ordered, because that is performed through a single, irreversible act. However, he adds, the construction of the fence, which in practice “segregates” and “expropriates” the co-defendant company as the lawful owner of the property, is, so to speak, an “act with continuing effects,” which harms the defendant with each passing day.

The judgment itself, he remarks, acknowledged that the anchors are located within the perimeter fenced by the ASADA. He adds that the testimony of Mr. Nombre229909 established at trial that the co-defendant does not have the key. This, he argues, constitutes an expropriation without compensation, aggravated by the fact that maintaining it benefits only the plaintiff, despite the denial of her principal and subsidiary claims. For this reason, he believes that not only is the order to refrain (orden de abstención) improper, but the precautionary measure should not remain in effect either. He argues that this has no relation to that order to refrain, which was requested in different terms. He states that, in the ruling on the motion for supplementation and clarification, the Court stated without providing reasons that “the precautionary measure is instrumental in nature and, insofar as relevant to this case, was limited solely to preventing the acts of interference that the applicant herein was committing against the possession exercised by the ASADA”; this, in his view, is inconsistent because, even if possession existed, it clearly did not include the construction of a fence enclosing an unpaid-for area surrounding the tank. He concludes that a precautionary measure should not remain in effect under the circumstances described.

XIII.Given the relationship between the two objections, they will be analyzed jointly. Despite their confusing wording, this Chamber infers that the appellant alleges in both challenges that the contested judgment is affected by the procedural defect (vicio procesal) of failure to state reasons—artículo 137 inciso d) del CPCA—because, in the appellant’s view, the agreed precautionary measure remains in effect without any justification even though the claims asserted in the complaint were dismissed. Accordingly, they will be analyzed on that basis. Regarding this ground for cassation (causal de casación), this Chamber has stated: “V. […] Failure to state reasons, as an objection subject to review through the extraordinary appeal in cassation (recurso extraordinario de casación) under the cited provision of the CPCA, must not be understood as a mechanism for challenging the legal grounds of the judgment.

It arises when the grounds for the decision are omitted, either because they do not exist or because their development is so extremely confusing or contradictory that it is impossible to clearly ascertain the reasoning that led to the decision adopted in the operative portion (acápite dispositivo) of the judgment, thereby violating the parties’ procedural rights, specifically the right to due process (debido proceso). The issue is not whether the adjudicator ruled on every claim incorporated into the proceedings, but rather whether the judgment sets forth the grounds on which the corresponding decision was adopted. Likewise, it must be borne in mind that this is a procedural ground, which means that it concerns possible failures to comply with the procedural provisions governing the course of the proceedings (iter procesal) or the judgment, as well as the legal relationship connecting the parties and the judge within judicial proceedings and from which rights and obligations arise.

Accordingly, this ground must not be confused with a mechanism for debating the application of the law or the adjudicator’s assessment of the evidence in the recitals of the ruling, for which the applicable Code establishes independent grounds (artículo 138 íbid), since otherwise the specific ground for cassation would be distorted.” Judgment number 32311 of 9 horas 50 minutos del 31 de marzo de 2011. To the same effect, see, among others, judgments numbers 814 of 9 horas 5 minutos del 5 de julio and 1285 of 9 horas 20 minutos del 11 de octubre, both from 2012.

XIV.In section XI of the challenged judgment, the judges stated the following regarding the precautionary measure (medida cautelar): “As can be seen in the case file, specifically the precautionary-measure record (legajo de medida cautelar), it is possible to verify how [sic], by virtue of a precautionary measure ordered by this court, a series of actions have been taken to ensure the proper operation of the rural water supply system (acueducto) at issue. These actions have, in fact, already been completed, and no determination concerning them is necessary.” (Underlining supplied). Subsequently, in recital III (considerando III) of resolution no. 33-2012-BIS issued at 8 hours on 4 de mayo de 2012, in response to the motion for supplementation and clarification (gestión de adición y aclaración) filed by the defendant, they stated, insofar as relevant: “The Court was clear in stating that said property is dedicated to a public service (servicio público) vested with the general interest (interés general), such that it even directed the Instituto Costarricense de Acueductos y Alcantarillados to exercise the powers guaranteed to it by the legal system under its enabling statute and Article forty-five of the Constitution, without prejudice to the plaintiff company’s [sic] right to apply directly to the Courts of Justice and exercise the constitutional and statutory rights available to it against said public entity.

What is not permissible is to allow an essential public service to be subject to the decisions of a private individual, which is precisely what the movant seeks. Within that framework, it was clearly established that it is not possible to place the movants in possession of the tank area, given the particular nature of the property. Thus, far from there being an unresolved issue or any ambiguity, what the interested parties seek is to reverse the decision rendered, which, as is well known, is impermissible. It should be noted in this regard that, although the precautionary measure is instrumental in nature, in this case it was limited solely to preventing the acts of interference that the movant herein was committing against the possession exercised by the ASADA; therefore, if he sought to terminate that real right (derecho real), he was required to bring ordinary proceedings or plenary proceedings (proceso ordinario o de conocimiento) in protection of his right, since that issue was not part of the dispute (litis); this was the reason no specific ruling was issued.

It was clearly indicated that, in his answer to the complaint and at trial, Mr. Nombre229905 sought to assert specific claims on his own behalf without filing the corresponding action; this was contrary to the applicable procedural framework and prevented a ruling on those claims. Accordingly, this is not a dispossession (despojo) of part of the property, but rather a matter of directing the interested party toward the lawful channel and away from the self-help measures he employed at the time. Thus, even though [sic] the defendants consider the existence of a fence to be an ongoing act carried out under a precautionary measure, it actually allows the exercise of the right of possession that their opposing party had been enjoying. As such, this is neither contrary to Article forty-five of the Constitution nor does it create the possibility of indefinite possession; rather, as indicated, it allows the interested parties to pursue relief through the mechanisms established by the legal system, without prejudice to the powers of the Instituto Costarricense de Acueductos y Alcantarillados to exercise the authority it possesses, as already stated, or to the rights available to the defendants should the public entity fail to act.

It should be noted that the [sic] application now under consideration reiterates some of the claims previously addressed in recital II and rejected in the operative part (dispositivo), which likewise require neither clarification nor supplementation. As there is nothing to clarify or supplement, the motion must be denied.” (Underlining supplied). In those rulings, even if some of the considerations expressed may not be shared, the judges provided the reasons why they deemed it appropriate to maintain the fence constructed around the water tanks of the Acueducto de Puente Salas de San Pedro de Barva de Heredia. Therefore, the challenged judgment does not suffer from the alleged procedural error; accordingly, the objection raised on that issue must be rejected.

XV.On the other hand, in recital XII of the challenged decision, concerning the costs of the proceedings (costas del proceso), the Court stated: “Regarding costs, the Court considers that we are [sic] dealing with one of the exceptions under Article one hundred ninety-three of the Código Procesal Contencioso Administrativo, since it is possible to verify how [sic] one of the plaintiff’s claims has been granted, which shows that there was no bad faith and that this was not a frivolous action (demanda temeraria). On the contrary, everything appears to indicate that the parties acted in good faith and had sufficient grounds to litigate; therefore, the proceedings are resolved without any specific award of costs.” (Underlining supplied). As explained in the preceding sections, contrary to the judges’ statement, none of the claims asserted by the plaintiff was granted. What occurred, it bears repeating, was that, pursuant to Article 122 of the CPCA, they issued a ruling sua sponte (pronunciamiento oficioso), which this Chamber annulled for lack of congruence (incongruencia). Consequently, because the complaint was rejected in its entirety and this Chamber does not consider that the plaintiff ASADA had sufficient grounds to litigate, the decision on this issue must be reversed and the ASADA ordered to pay costs (Article 193 ibid.).

XVI.Because of the substantial public interest involved in these proceedings, given the possibility of contamination of the Acueducto de Puente Salas de San Pedro de Barva de Heredia and, consequently, the risk posed not only to public health but also to the supreme value of life, the following must be stated. Under Article 19 of the CPCA, the Court or the judges may, at the request of a party, order appropriate and necessary precautionary measures to provisionally protect and safeguard the subject matter of the proceedings and the effectiveness of the judgment. Likewise, Articles 21 and 22 ibid. provide: “Article 21.- A precautionary measure shall be appropriate when the implementation or continuation of the conduct subject to the proceedings causes serious actual or potential harm or loss to the alleged situation, provided that the claim is neither frivolous nor manifestly lacking in seriousness.

Article 22.- In granting or denying any precautionary measure, the respective court or judge shall give particular consideration to the principle of proportionality (principio de proporcionalidad), weighing the potential harm to the public interest, the harm and loss caused to third parties by the measure, and its instrumental and provisional nature, so that neither the entity’s substantive operations nor the legal position of third parties is seriously affected. / The court or judge shall also take into account the financial possibilities and provisions that the Public Administration must make to implement the precautionary measure.” In light of those provisions, there can be no doubt, as the Court correctly indicated in resolution no. 33-2012 BIS issued at 8 hours on 4 de mayo de 2012, that the precautionary measure is instrumental in relation to the principal proceedings. Therefore, if the complaint is rejected, the measure must be lifted.

Nevertheless, the precautionary measure ordered in these proceedings has a sui generis or special character. Construction of a fence around the water tanks was ordered to protect the water resource (recurso hídrico) from the risk of contamination. This is apparent from the oral considerations expressed by the Court of Appeals when it issued resolution no. 571-2010 at 16 hours 22 minutes on 27 de octubre de 2010. In this regard, at 16:23:06 of the corresponding recording log, it stated that the justification offered by the plaintiff for maintaining the ordered precautionary measure was as follows: “[…] The purpose is to protect the provision of a public service of great importance to public health. There is a danger posed by the entry of third parties who are carrying out activities that place the provision of that service at serious risk and threaten the destruction [sic] and contamination of the water-tank structure.

There was an urgent need to grant the precautionary measure because of the right to health, and the plaintiff [sic] is not being prevented from traveling across his property; rather, it refers solely to the area already occupied by the land [sic]. There is a likelihood of success on the merits (apariencia de buen derecho). There is a risk from delay (peligro en la mora) and an appropriate balancing of the interests at stake.” Subsequently, at 16:29:51, when analyzing the alleged denial of the right to a defense (indefensión) asserted by the defendant because the company owning the property on which the water tanks are located had not been joined, the judges stated: “The Court considers that, because the present case concerns a precautionary measure, the proceedings are more informal. What prevails is the need to resolve the urgent situation. Above all, the interests of the public service and the prevention of harm to society prevail over any personal interest. [… 16:31:39] It has been alleged that the plaintiff’s [sic] freedom of movement across his property is being violated.

This has not been established. It has merely been established that a structure already located there, which already prevents passage through that part of the land, is being enclosed. A protective perimeter is simply being created. […]” Moreover, this was also how the defendant itself understood the matter. In this regard, at folio 411, it states: “We have maintained throughout the proceedings that the precautionary measure was disproportionate; indeed, the testimony of the plumber Mr. Nombre229910 made clear that the events described as endangering the integrity of the tanks were SPORADIC and ISOLATED, not commonplace. That conclusion would also be reasonable even if it had to be inferred without that testimony, because no problems have occurred in the past between the first tank and the second. The judgment itself acknowledges that there have been no arrests despite the presence of the police at the site.

Consequently, the allegedly harmful events were not shown to be commonplace but rather sporadic, nor were they as harmful as the plaintiff portrays them; through a slogan that affects people’s consciences (water contamination), the plaintiff seeks to have the precautionary measure ordering the fence maintained, even though it has no legal justification.” Subsequently, at folio 440, it states: “The judgment takes it as established that there is a danger to the integrity of the water in the water supply system because, on two occasions (which is what was established through the police reports), individuals were found in the area. However, the plumber himself answered that this was an isolated occurrence and not something that happened continuously. This point is important because it is that terrible idea that the water might become contaminated that gives rise to the series of errors in the judgment, such as the order directing Mr.

Nombre229905 not to disturb the Asada’s ‘possession’ (which does not exist), without even considering in the judgment the other means available to the Asada to secure the tank without subdividing (segregar), dispossessing the defendant company as a matter of fact, and failing to compensate it. / Accordingly, maintaining the precautionary measure and ordering that the Asada’s possession be maintained (without limits) are, in the defendants’ view, the product of the mistaken belief that there is an imminent danger to the water. It is likewise disproportionate because there are alternative means of protection that do not violate Article 45 of the Constitution, to which the defendant is entitled.”

XVII.Along these lines, it must be noted, as the Tribunal properly analyzed in recital V of the challenged judgment, that water, by virtue of being an indispensable resource for life, is public-domain property (bien demanial). This is expressly provided in the first and second sections of Ley no. 276 of 27 de agosto de 1942, Ley de Aguas. Likewise, the Sala Constitucional has held that access to drinking water is a human right. In this regard, in ruling no. 2011011366, issued at 9 hours 25 minutes on 26 de agosto de 2011, it stated: “IV.- On the Fundamental Right to Drinking Water. This Tribunal has recognized in its case law that there is a fundamental right to the supply of drinking water and that this right derives from the fundamental rights to health, life, a healthy environment, food, and adequate housing, among others, as has also been recognized in international human-rights instruments applicable in Costa Rica: thus, it is expressly set forth in the Convention on the Elimination of All Forms of Discrimination against Women (art. 14) and the Convention on the Rights of the Child (art. 24); it is also articulated in the International Conference on Population and Development held in El Cairo (principle 2), and declared in numerous other instruments of International Humanitarian Law.

Likewise, it has repeatedly found that, within our Inter-American Human Rights System, the country is particularly bound in this regard by the provisions of article 11.1 of the Additional Protocol to the American Convention on Human Rights in the Area of Economic, Social and Cultural Rights (‘Protocolo de San Salvador’ of 1988), which provides: ‘Article 11. Right to a healthy environment 1. Everyone shall have the right to live in a healthy environment and to have access to basic public services.’ In addition, the UN Committee on Economic, Social and Cultural Rights recently reiterated that access to water is a human right that, in addition to being essential for leading a healthy life, is a prerequisite for the realization of all other human rights. Following from the foregoing, it should be noted that the aforementioned regulatory framework gives rise to a series of fundamental rights linked to the State’s obligation to provide basic public services.

These rights entail, on the one hand, that persons may not be unlawfully deprived of such services; however, in the case of drinking water, it cannot be maintained that every individual holds an enforceable right requiring the State to provide the public drinking-water service immediately and wherever requested. Rather, as provided in the Protocolo de San Salvador itself, rights of this kind require States to adopt measures, as stipulated in article one of that Protocol: ‘The States Parties to this Additional Protocol to the American Convention on Human Rights undertake to adopt the necessary measures, both domestically and through cooperation among States, especially economic and technical cooperation, to the extent allowed by their available resources and taking into account their degree of development, for the purpose of progressively achieving, in accordance with domestic legislation, the full observance of the rights recognized in this Protocol.’ Nor may this be interpreted to mean that the fundamental right to public services is not specifically enforceable; on the contrary, when the State may reasonably be required to provide them, the rightsholders may demand them, and public administrations—or, where applicable, private parties providing such services in their stead—may not hide behind alleged resource shortages, which have historically served as the public sector’s excuse for failing to fulfill its duties.” In this same regard, reference may be made, among others, to that Chamber’s decisions nos. 2003-04654, issued at 15 hours 44 minutes on 27 de mayo de 2003, and 2011-003579, issued at 13 hours 6 minutes on 18 de marzo de 2011.

XVIII.In this regard, the challenged judgment found it established that: “14) In recent months, condoms and clothing have been found in the tanks, covers have been broken, padlocks have been cut, and people have been cooking, among other activities that endanger the aqueduct, carried out by vagrants and drug addicts from the area (see the testimony of Mr. Nombre229911 given at the oral and public trial, folios 18, 55 al 63 y 89, 91 al 94 of the preliminary injunction (medida cautelar) case file). 15) If the tanks were contaminated, the entire aqueduct would be affected because the community is supplied from there (see the testimony of Mr. Nombre229911 given at the oral and public trial).” As noted, the defendant acknowledged that these acts of vandalism had occurred, although it claims that they were not usual but sporadic—on only two occasions—and not so harmful. Nevertheless, it bears repeating that the supply of drinking water is a human right, which in turn derives from the fundamental rights to health, life, a healthy environment, and food; consequently, the guiding principles of Environmental Law (Derecho Ambiental) also apply to this litigation.

One of them, which is constitutional in origin because it underlies Articles 46 and 50 of the Constitution (Carta Magna), is known as the “precautionary” principle (principio precautorio), the principle of “prudent avoidance” (evitación prudente), or “indubio pro natura.” According to legal scholarship, this field involves not only known risks but also potential scientific uncertainty regarding the scope of certain harm. This principle therefore requires that, whenever a reasonable doubt arises concerning the dangerousness of any activity with environmental or human-health repercussions, the activity be avoided or appropriate measures be taken to prevent such potential harm, though not yet scientifically proven, from occurring. It has two prerequisites: a lack of scientific certainty and a threat of harm. It is expressly embodied in the United Nations Conference on Environment and Development, or Rio Declaration: “Principle 15.- In order to protect the environment, States shall widely apply the precautionary approach according to their capabilities.

Where there is a danger of serious and irreversible harm, the lack of absolute scientific certainty shall not be used as a reason for postponing cost-effective measures to prevent environmental degradation.” For its part, the Ley de Biodiversidad, number 7788 of 30 de abril de 1998, provides: “ARTICLE 7.- Definitions. […] Biodiversity: the variability among living organisms from any source, whether found in terrestrial, aerial, marine, or aquatic ecosystems or in other ecological complexes. It includes diversity within each species, as well as among species and the ecosystems of which they form part. / For purposes of this law, the term biodiversity shall be understood to include intangible elements, such as traditional knowledge, innovation, and practices, whether individual or collective, having actual or potential value associated with biochemical and genetic resources, whether or not protected by intellectual-property systems or sui generis registration systems. […] ARTICLE 11.- Criteria for applying this law.

The criteria for applying this law are: 1.- Preventive criterion: It is recognized that anticipating, preventing, and addressing the causes of biodiversity loss or threats to it are of vital importance. 2.- Precautionary criterion or indubio pro natura: Where there is a danger or threat of serious or imminent harm to elements of biodiversity and the knowledge associated with them, the absence of scientific certainty shall not be used as a reason for postponing the adoption of effective protective measures. 3.- Environmental public-interest criterion: The use of the elements of biodiversity must safeguard future generations’ development options, food security, ecosystem conservation, the protection of human health, and improvement of citizens’ quality of life. […]” In this regard, the Constitutional Chamber (Sala Constitucional), in decision 1250-99 at 11 horas 24 minutos on 19 de febrero de 1999, stated: “[...] Prevention seeks to anticipate negative effects and ensure the protection, conservation, and proper management of resources.

Consequently, the guiding principle of prevention is based on the need to take and adopt all precautionary measures to prevent or contain possible harm to the environment or human health. Accordingly, where there is a risk of serious or irreversible harm—or any doubt in that regard—a precautionary measure must be adopted, including the postponement of the activity concerned. This is because, in environmental matters, ex post facto enforcement is ineffective: once biologically and socially harmful consequences have occurred, punishment may have moral significance but will scarcely compensate for the harm caused to the environment.” (Underlining not in the original). See also, among others, decisions nos. 9773-00 at 9 horas 44 minutos on 3 de noviembre de 2000 and 1711-01 at 16 horas 32 minutos on 27 de febrero de 2001 from that judicial body. Subsequently, in decision 3480-03 at 14 horas 2 minutos on 2 de mayo de 2003, it further clarified that concept: “Properly understood, the precautionary principle concerns adopting measures not because the facts creating a risk are unknown, but because there is no certainty that those facts will actually produce harmful effects on the environment.” (Underlining supplied).

Likewise, in decision 6322-2003 at 14 horas 14 minutos on 3 de julio de 2003, it stated: “[...] 4.- Precautionary principle: […] The term prevention derives from the Latin ‘praeventio,’ which refers to the act and effect of preventing and to preparations and measures taken in advance to avoid a risk or carry something out. Prevention seeks to anticipate negative effects and ensure the protection, conservation, and proper management of resources. Consequently, the guiding principle of prevention is based on the need to take and adopt all precautionary measures to prevent or contain possible harm to the environment or human health. Accordingly, where there is a risk of serious or irreversible harm—or any doubt in that regard—a precautionary measure must be adopted, including the postponement of the activity concerned. This is because, in environmental matters, ex post facto enforcement is ineffective: once biologically and socially harmful consequences have occurred, punishment may have moral significance but will scarcely compensate for the harm caused to the environment.” To the same effect, see that Chamber’s vote no. 2008-17618 at 11 horas 51 minutos on 5 de diciembre de 2008 and this Chamber’s judgment no. 1261 at 11 horas on 10 de diciembre de 2009.

In these proceedings, it bears repeating, the latent risk of contamination of the tanks and thus of the drinking water was established, arising from the actions of unscrupulous individuals who go to the place where the tanks are located. Accordingly, there is a situation that may place public health at greater risk; this was not rebutted by the defendant, which, as stated, acknowledges the situation but attempts to minimize it by alleging that it was sporadic and not so harmful. However, in light of the foregoing, this Chamber cannot and must not disregard that circumstance. Consequently, pursuant to the precedents cited, the precautionary principle, Articles 1, 2, 4, 29 of the American Convention on Human Rights; 11.1 of the Protocol of San Salvador; 21, 45 y 50 of the Political Constitution; and as a protective measure to prevent any irreversible harm to the tanks of the Acueducto de Puente Salas de San Pedro de Barva de Heredia and therefore to the water resource, this Chamber considers it essential to retain the fence built around the drinking-water tanks.

This decision is also supported, as indicated, by the fact that the movable and immovable property used by the ASADAS to administer, operate, maintain, and develop water-supply and sewerage systems is in the public domain (dominio público); therefore, the water tanks have that status (which, it bears repeating, is accepted by both parties). The fence at issue in these proceedings also has that status. As stated, its construction around the tanks of the Acueducto de Puente Salas de San Pedro de Barva de Heredia was undertaken to safeguard their integrity and thus protect the water resource. Ergo, it is property permanently dedicated to a service of general utility—Article 261 of the Civil Code—and is therefore not subject to prescription, alienation, attachment, or private appropriation.

XIX.Pursuant to the foregoing and to safeguard the significant public interest at stake in these proceedings—it bears repeating, the rights to public health and life—this Chamber shall order the active Administration (Administración activa), specifically AyA through the person holding its Executive Presidency, to cease its failure to act (conducta omisiva). It must therefore take all appropriate actions to guarantee the protection of the Acueducto de Puente Salas de San Pedro de Barva de Heredia. To that end, within the non-extendable period of six months from service of this judgment, it must: A) determine which option is most appropriate for its protection: 1) establish a compulsory aqueduct easement (servidumbre forzosa de acueducto), in accordance with provisions 99 and following of Law no. 276 of 27 de agosto de 1941, Ley de Aguas; or 2) acquire the property and, if necessary, process the required expropriation (expropiación)—provision 5, subsections c) and e), of its Ley Constitutiva, no. 2726 of 14 de abril de 1961—; and B) initiate the corresponding proceedings to provide a definitive solution to the problem at that Aqueduct.

XX.In view of the foregoing, the appeal filed on procedural grounds must be partially granted. Consequently, because it is incongruent, the challenged judgment shall be annulled only insofar as it rejected the defense of lack of legal entitlement (defensa de falta de derecho) and ordered co-defendant Nombre229905, personally and as president of the co-defendant company, not to interfere through direct action (vía de hecho) with the possession held by the plaintiff Association. The judgment shall likewise be reversed insofar as it required the plaintiff to pay costs (costas). The protective fence constructed around the water tanks of the Acueducto de Puente Salas de San Pedro de Barva de Heredia shall remain in place. AyA, specifically the person holding its Executive Presidency, shall be ordered, within the non-extendable period of six months from service of this judgment, to: A) determine which option is most appropriate for its protection: 1) establish a compulsory aqueduct easement, in accordance with provisions 99 and following of Law no. 276 of 27 de agosto de 1941, Ley de Aguas; or 2) acquire the property, for which purpose, if necessary, the required expropriation must be pursued—provision 5, subsections c) and e), of its Ley Constitutiva, no. 2726 of 14 de abril de 1961—; and B) initiate the corresponding proceedings to provide a definitive solution to the problem at that Aqueduct.

In all other respects, the decision shall remain undisturbed. Because it is unnecessary in view of the manner in which these proceedings are ultimately resolved, no ruling shall be made on the defendant’s remaining objections.

POR TANTO

The documentary evidence (prueba documental) offered before this court is rejected. The evidence offered to assist the court in reaching a decision (prueba para mejor resolver) is dispensed with. The appeal (recurso) filed is partially granted on procedural grounds. Due to inconsistency, the challenged judgment is annulled insofar as it rejected the defense of lack of legal entitlement (falta de derecho) and ordered co-defendant (codemandado) Nombre229905, in his personal capacity and as president of the co-defendant company, not to disturb, through de facto means (vía de hecho), the possession (posesión) of the plaintiff Association. The exemption from payment of costs (costas) is reversed, and those costs are imposed on the Asociación Administradora del Acueducto de Puente Salas de San Pedro de Barva de Heredia. The construction of the protective fencing around the water tanks of the aforementioned Acueducto shall continue.

The Instituto Costarricense de Acueductos y Alcantarillados, specifically whoever holds its Executive Presidency, is ordered, within the non-extendable period of six months from notification of this judgment, to: A) determine which option is most appropriate for protecting it: 1) establish a compulsory aqueduct easement (servidumbre forzosa de acueducto), in accordance with provisions 99 et seq. of Law No. 276 of August 27, 1941, Ley de Aguas; or 2) acquire the property, for which purpose, if necessary, the corresponding expropriation (expropiación) shall be pursued—provision 5, subsections c) and e), of its founding Law No. 2726 of April 14, 1961—; B) commence the corresponding proceeding to provide a definitive solution to the problem affecting said Acueducto. In all other respects, the ruling remains undisturbed. As unnecessary, in view of the manner in which this proceeding was ultimately decided, no ruling is issued regarding the remaining objections raised by the defendant party.

Proceso de conocimiento tramitado en el Tribunal Contencioso Administrativo por ASOCIACIÓN ADMINISTRADORA DEL ACUEDUCTO DE PUENTE SALAS DE SAN PEDRO DE BARBA, representado por su presidente con facultades de apoderado generalísimo sin límite de suma Nombre229442 , de calidades ignoradas; contra PARAÍSO TROPICAL INC. SOCIEDAD ANÓNIMA, representado por su presidente con facultades de apoderado generalísimo sin límite de suma, Nombre229905 , ingeniero agrónomo, vecino de Heredia; también demandado en su carácter personal. Se tiene como coadyuvante activo al Instituto Costarricense de Acueductos y Alcantarillados. Figura además como apoderado especial judicial de la parte actora, el licenciado Luis Antonio Álvarez Chaves, vecino de Heredia y por la demandada, últimamente, el doctor en derecho, Olman Arguedas Salazar. Las personas físicas con mayores de edad y con las salvedades hechas casados, abogados y vecinos de San José.

RESULTANDO

1. Con base en los hechos que expuso y disposiciones legales que citó, la parte actora estableció proceso de conocimiento, a fin de que en sentencia se declare: “ (…) con lugar la demanda, declarándose que la ASOCIACIÓN ADMINISTRADORA DEL ACUEDUCTO DE PUENTE SALAS DE SAN PEDRO DE BARBA y el INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ACLACANTARILLADOS son propietarios del terreno que ha poseído durante más de veinticinco años descrito mediante levantamiento catastral del ingeniero topógrafo Nombre229906 así: Terreno con dos tanques para agua potable y bodega, ubicado en el Dirección12277 (San Isidro), del Cantón Segundo (Barva) de la Provincia de Heredia, linderos al suroeste con Dirección336 con 11,38 metros, al Noroeste, noreste y sureste con resto de la Dirección24783 , con un área de doscientos veintinueve metros cuadrados que es parte del inmueble inscrito con la matrícula de folio real Placa43110 del Partido de Heredia, en razón de las construcciones con carácter demanial destinadas a servicio público que en el mismo se han desarrollado, y que se autorice a catastrar. 2.

(…) al demandado Nombre229905 en su carácter personal y como representante de la sociedad demandada que se abstenga de realizar todo tipo de actuaciones en perjuicio del derecho de propiedad que se derive de la declaratoria con lugar del presente proceso, bajo el apercibimiento de que en caso contrario puede ser procesado por el delito de desobediencia a la autoridad. 3. condene a los demandados al pago de los daños y perjuicios ocasionados. 4. condene a los demandados al pago de las costas personales y procesales de esta acción. PRETENSIÓN SUBSIDIARIA 1. (…) con lugar. 2. (…) ordene al demandado. 3. (…) condene a los demandados al pago de los daños y perjuicios ocasionados. 4. (…) condene a los demandados al pago de las costas personales y procesales de esta acción." 2. La parte demandada contestó oponiendo las excepciones de falta de derecho y de legitimación tanto activa como pasiva; así como las defensas previas de actos no susceptibles de ser conocidos en esta jurisdicción y falta de competencia, está última resuelta interlocutoriamente.

3. La audiencia preliminar se llevó a cabo a las 14 horas del 29 de setiembre y a las 14 horas 7 minutos del 10 de octubre, ambas del 2011. Durante la primera se resolvió la defensa previa de actos no susceptibles de impugnación interpuesta por la accionada. En ambas oportunidades las partes hicieron uso de la palabra.

4. El Tribunal Contencioso Administrativo y Civil de Hacienda, integrado por los Jueces Ricardo A. Madrigal Jiménez, Grace Loaiza Sánchez y Francisco Muñoz Chacón; en sentencia no. 033-2012 de las 11 horas del 29 de marzo de 2012, resolvió: “Se acoge la excepción de falta de derecho para las pretensiones principal y secundarias de prescripción positiva o régimen de copropiedad, pretendidas por la actora y sin lugar el proceso en cuanto a dichos extremos. Se rechaza la excepción de falta de derecho en cuanto al demandado Nombre229905 , ordenándose a él en su condición personal y como presidente de la señalada sociedad, que no deberá perturbar por vía de hecho la posesión que presenta la actora. Tome nota el Instituto Costarricense de Acueductos y Alcantarillados lo señalado en el considerando IX. Se rechaza por improcedente la pretensión indemnizatoria planteada por la demandada frente a su contraparte en el escrito de contestación de la demanda. Por la forma en la cual se resuelve se emite sin especial condenatoria en costas.” 5. El señor Nombre229905 formula recurso de casación indicando expresamente las razones en que se apoya para refutar la tesis del Tribunal.

6. En los procedimientos ante esta Sala se han observado las prescripciones de ley.

CONSIDERANDO

I.De conformidad con lo acreditado por las personas juzgadoras, lo cual no fue cuestionado, en el año 1974, la Junta de Desarrollo de la Comunidad de Puente Salas de San Pedro de Barva de Heredia, con apoyo de las fuerzas civiles, construyó un tanque de almacenamiento de agua en la finca La Amada para suplir las necesidades de ese líquido a la comunidad. Se contó con la autorización del señor Guillermo Rohormoser, a la sazón propietario de la heredad. La obra se levantó donde técnicamente resultaba procedente, por las condiciones de altura y acceso a la población. Don Guillermo estuvo anuente a ceder el área donde se edificó; empero, no se finiquitó el acto jurídico. La empresa Paraíso Tropical INC Sociedad Anónima (en lo sucesivo Paraíso Tropical) es la propietaria del inmueble inscrito en el Registro Público, matrícula de folio real número Placa43110 del partido de Heredia, que es parte de la antigua finca La Amada y donde se ubican las obras del acueducto rural referido.

A finales de 1994 o inicios de 1995, su representante legal, el señor Nombre229905 , autorizó la construcción de un segundo tanque en beneficio del acueducto, que para aquel momento era administrado por un Comité de la Comunidad. En dicha obra hubo esfuerzo comunitario y gubernamental. En virtud de la colaboración en cuanto al terreno en el cual se construyó, se le facilitó al señor Nombre229905 , así como a Paraíso Tropical, cuatro servicios de agua. Este nuevo tanque se levantó en el lugar que técnicamente resultaba idóneo, no solo por estar junto al primero, sino por razones de altura y conexión directa con el sistema de aguas ya instalado. El 28 de octubre de 1999, el Instituto Costarricense de Acueductos y Alcantarillados (en adelante AyA) suscribió un acuerdo de administración de acueducto rural con la Asociación de Desarrollo Comunal de Puente Salas. Sin poderse precisar fecha exacta, pero antes del año 2002, se constituyó la Asociación Administradora del Acueducto de Puente Salas de San Pedro de Barva (en lo sucesivo, Asociación o ASADA), a partir del mismo grupo comunitario que, en su momento, conformó el comité de agua que era parte de la Asociación de Desarrollo de la comunidad.

El 20 de junio de 2002, AyA suscribió un acuerdo de administración del acueducto de la localidad con la ASADA. Antes del año 2010, existió una actividad coordinada entre la Asociación, don Nombre229905 y Nombre229907 en beneficio del referido acueducto. Recientemente, indigentes y drogadictos de la zona han dejado en los tanques desechos como preservativos y ropa; además, han roto tapas y cortado candados; asimismo, cocinan en el lugar. La ASADA le solicitó al señor Nombre229905 y a Nombre229907 autorización para colocar una malla de protección alrededor de los tanques, pero no se llegó a un acuerdo. A pesar de ello, decidió realizar la obra. Cuando se procedía a colocar la malla de protección, don Nombre229905 lo impidió. No obstante, en virtud de la medida cautelar interpuesta, se ordenó su construcción.

II.El 27 de agosto de 2010, la representante en ese momento de la Asociación formuló proceso de conocimiento en contra de Paraíso Tropical, representada por el señor Nombre229905 y en contra de él en su condición personal. Solicita se declare en sentencia –según ajuste efectuado en la audiencia preliminar celebrada el 29 de setiembre de 2011, véase la respectiva acta de grabación a las 15:13:30-, en forma principal, que la ASADA es propietaria registral del terreno que ha poseído por más de 25 años, descrito mediante levantamiento catastral del ingeniero topógrafo Nombre229906 , con un área de 229 metros cuadrados, que es parte del inmueble descrito en la matrícula folio real número Placa43110 del partido de Heredia, en razón de las construcciones con carácter demanial efectuadas. Además, pide se le autorice catastrar y segregar ese terreno. En forma subsidiaria, pretende, en primer lugar, se declare un régimen de copropiedad a favor de su poderdante y en relación con la compañía demandada, sobre el terreno que ha poseído por más de 25 años, descrito mediante levantamiento catastral del ingeniero topógrafo Nombre229906 , con un área de 229 metros cuadrados, que es parte del inmueble inscrito bajo la matricula folio real Placa43110 del partido de Heredia, en razón de las construcciones con carácter demanial efectuadas.

De igual manera, solicita se le autorice a catastrar y segregar ese terreno. En segundo término, requiere se ordene al codemandado Nombre229905 , en su carácter personal y como representante de la empresa demandada, abstenerse de realizar todo tipo de actuaciones en perjuicio del derecho de propiedad que se derive de la declaratoria con lugar de la demanda, bajo apercibimiento de que, en caso contrario, puede ser procesado por el delito de desobediencia a la autoridad. Por último, para el ruego principal y subsidiario, pide se condene a los codemandados al pago de las costas del proceso. Don Nombre229905, en su doble condición, aceptó unos hechos y rechazó otros. Opuso la defensa de falta de derecho. El Tribunal la acogió tocante a las pretensiones principal y subsidiaria de prescripción positiva y régimen de copropiedad. Por consiguiente, declaró sin lugar la demanda en cuanto a dichos extremos.

La denegó toncante al codemandado Nombre229905 . Le ordenó, en su condición personal y como presidente de la sociedad codemandada, abstenerse de perturbar, por la vía de hecho, la posesión que presenta la actora. Además, rechazó, por improcedente, la pretensión indemnizatoria planteada por la parte demandada en el escrito de contestación de la demanda. En virtud de la forma cómo decidió el proceso, resolvió sin especial condenatoria en costas. Inconformes ambas partes formularon sendos recursos de casación. El de la ASADA actora fue rechazado de plano en resolución número 1219 de las 9 horas 30 minutos del 19 de setiembre de 2013. La parte demandada alega violación de normas procesales y sustantivas.

III. DOCUMENTOS PRESENTADOS CON EL RECURSO

El casacionista aportó con su recurso:

  • 1)certificación registral de personería jurídica de la empresa Paraíso Tropical;
  • 2)certificación registral del microfilm del tomo 414, asiento 15255, la cual corresponde a la escritura de segregación y compra de un lote parte de la finca inscrita al partido de Heredia, matrícula de folio real no. Placa43112 por parte de la sociedad Paraíso Tropical;
  • 3)copia del dictamen de la Procuraduría General de la República no. C-061-2008 del 4 de marzo de 2008;
  • 4)copia de la opinión jurídica de la Procuraduría General de la República no. OJ-121-2001 del 3 de setiembre de 2001;
  • 5)copia del dictamen de la Procuraduría General de la República no. C-023-98 del 13 de febrero de 1998;
  • 6)cinco fotografías de la entrada de la propiedad donde se ubican los tanques de agua y la malla construida;
  • 7)alegato de conclusiones expuestas en la audiencia del juicio oral. De conformidad con lo preceptuado por el canon 145 del Código Procesal Contencioso Administrativo (CPCA), en esta instancia solo se podrá aportar prueba documental que la parte recurrente jure no haber conocido con anterioridad, relacionada con hechos nuevos o posteriores a la sentencia recurrida. La probanza antes referida no se enmarca en esos supuestos. No alude a hechos nuevos o posteriores a la sentencia recurrida. Por el contrario, todos los documentos se refieren a situaciones fácticas sucedidas con anterioridad al fallo cuestionado, incluyendo las fotografías aportadas. Con ellas se demuestra la construcción de la malla alrededor de los tanques de agua, hecho sucedido antes del dictado de la sentencia. Por demás, a folios 45 a 49 constan otras fotografías en donde se comprueba esa situación fáctica; por ende, este elemento de convicción también resulta inocuo o fútil para la solución de esta lite. Consecuentemente, se impone el rechazo de los documentos aportados. Por otro lado, a folio 446 el casacionista indica: “5- Si lo considera necesario la Sala Primera, ofrecemos el testimonio de la señora Nombre229908 , administradora de la Asada para que se refiera a los libros que la Asada puso en conocimiento del señor Nombre229905 en el plazo otorgado en la audiencia preliminar al señor Nombre229905, para traer al proceso, expediente administrativo no aportado por la ASADA y que no incluía Libros de otras Asociaciones. / 6- Si lo considera necesario la Sala Primera, solicite como prueba para mejor resolver, al AyA certificar si ha iniciado procedimiento de expropiación sobre el terreno de Paraíso Tropical Inc. S.A., desde cuando [sic], y estado actual del mismo, con la prueba documental pertinente, por supuesto.” Ambos elementos de convicción, solicitados para mejor resolver, resultan intrascendentes para la solución de este proceso; ergo, deberá prescindirse de ellos –artículo 148 del CPCA-.

RECURSO POR QUEBRANTO DE NORMAS PROCESALES

IV.Por la forma como se resolverá, esta Sala analiza, en primer término, los siguientes agravios. En la cuarta objeción, identificada como I.B.2, folio 405, arguye el casacionista, la sentencia cuestionada le irrogó indefensión tanto a él como a su representada porque le concedió a la actora algo no solicitado en la demanda. Dentro de sus pretensiones, asevera, no pidió el reconocimiento de un derecho de posesión sobre el área de terreno donde se ubican los tanques, con una medida aproximada de 229 metros cuadrados. No obstante, resalta, de manera sorpresiva, las personas juzgadoras, le reconocieron y hasta tuvieron por demostrado –sin indicar pruebas- una posesión sobre esa “área del inmueble”. Por no solicitarse, comenta, incurrieron en el vicio de ultra petita; es decir, reconocieron más de lo pedido. Concluye, se dan los vicios de desigualdad en el proceso, violación del debido proceso, nulidad absoluta de las reglas de la sentencia y procesales.

En el sexto reparo, marcado como I.C.2., folio 406, dice el recurrente que la pretensión principal de la actora fue que se declarara la usucapión sobre el terreno donde se ubican dos tanques de AyA que ella administra, en virtud del paso del tiempo. Sin embargo, apunta, la sentencia le concedió algo no solicitado: la posesión y, además, ordenó su no perturbación. Insiste, la ASADA actora no pretendió se le reconociera derecho de posesión sobre el terreno. Tampoco, agrega, se encuentra en la sentencia un análisis para demostrarla, sino que se tiene por un hecho acreditado sin explicación. Reproduce, en lo de su interés, lo indicado en el considerando I del fallo cuestionado. Las personas juzgadoras, enfatiza, no analizaron el tema de la posesión, sino que lo dieron por demostrado sin explicar el porqué, a pesar de existir razones de peso para señalar que no existe posesión por parte de la ASADA: 1) ella se relacionó con los tanques y el terreno porque así lo permiten la Ley Constitutiva del AyA; el Decreto Ejecutivo no. 32529-MINAE y el Convenio de Delegación entre ella y dicho ente.

Esto, apunta, no incluye posesión alguna sobre los terrenos donde se ubican los tanques parte del acueducto de AyA, que son bienes demaniales. Tampoco le faculta a usucapir; por el contrario, aclara, el precepto 21 incisos 10 y 13 del susodicho Decreto le conminan a expropiar en caso de ser necesario; 2) porque si alguien pudiera poseer, sería AyA, como dueño de los tanques; no obstante, alega, tiene vedado, por principio de Derecho Público, adquirir por prescripción positiva terrenos inscritos a nombre de terceros. Por otro lado, transcribe, parcialmente, lo consignado en el apartado VIII de la sentencia combatida. No sabe, afirma, cómo el Tribunal arribó a la conclusión expuesta. Al respecto, comenta, no se aportó al proceso prueba alguna de la relación entre posibles asociaciones anteriores o comités con la ASADA, ni se dijo si hubo lapsos en descubierto, ni cómo se transmitieron los derechos –si los había- entre una y otra.

Menos aún, relata, se indica con qué elementos de juicio y probatorios acreditaron las personas juzgadoras la posesión de la Asociación sobre un terreno inscrito a nombre de un tercero. La actora, precisa, administra el acueducto porque así la faculta el convenio de delegación entre ella y AyA, el cual es un bien demanial. Ello, prosigue, constituye una falta de fundamento de la sentencia e incongruencia, lo que acarrea la nulidad absoluta de la resolución. Además, manifiesta, el fallo padece de falta de determinación clara y precisa de los hechos tenidos por acreditados, porque el análisis efectuado de la usucapión no es completo. No abarcó cada uno de sus elementos, según lo previsto en los preceptos 853 a 864 del Código Civil: a) probar el título de dominio, buena fe, posesión en calidad de propietario, en forma continua, pública y pacífica, por espacio de 10 años o más. Este análisis, razona, es propio de la jurisdicción civil, no de la contencioso administrativa.

La sentencia indica que la ASADA solo podría usucapir en su faceta de Derecho Privado; motivo por el cual, sostiene, la incompetencia alegada oportunamente debió prosperar. Reitera, la relación de la ASADA con los tanques y la propiedad viene determinada por el convenio suscrito entre ella y AyA, visible a folios 19 a 25 del expediente de la medida cautelar. Reproduce la pretensión, conforme se reformuló en la audiencia preliminar. Por lo anterior, comenta, y debido al rechazo de la defensa de incompetencia en razón de la materia, el análisis de la sentencia debió ir paso a paso, por cada uno de los elementos que confirman si existe o no usucapión, o declarar que la prescripción positiva de una ASADA no es materia de conocimiento de los tribunales contencioso administrativos. El Tribunal acreditó que existe posesión de la accionante, la cual debe ser respetada, ordenándole al codemandado Nombre229905 abstenerse de perturbarla por la vías de hecho; lo anterior, comenta, pese a no haber sido solicitado por la parte actora y sin que se haya demostrado, lo cual constituye ultra petita, con quebranto del derecho de defensa, acarreando la nulidad de lo resuelto.

No quedaron demostradas ni acreditadas, anota, las razones por las que las personas juzgadoras establecieron la existencia de una posesión –aspecto no solicitado-; tampoco señalaron de qué tipo o con cuáles límites y alcances. Nótese, afirma, que la pretensión de la actora era para que el codemandado, en lo personal, se abstuviera de perturbar el derecho de propiedad que se derivaría de la sentencia favorable a sus pretensiones, las cuales, agrega, solo se refieren al derecho de propiedad o copropiedad. La demandante, prosigue, nunca solicitó se declarara su derecho de posesión, ordenándosele al demandado, en lo personal, se abstuviera de perturbarla. Se está, insiste, ante un claro caso de ultra petita, pues se le concedió a la parte actora un aspecto no solicitado. Dice, existe mera tolerancia, ofrecida para el mantenimiento del primer tanque y la construcción del segundo, ambos del AyA, en la propiedad de la sociedad demandada.

Esto, alega, implica su mantenimiento normal, por lo que, obviamente, cualquier cambio debía ser consultado con la empresa propietaria. En este sentido, apunta, pueden consultarse las actas de la Asociación, con las cuales se demuestran los términos del acuerdo. Por eso, manifiesta, no es de extrañar que la sociedad demandada se opusiera a la construcción de una malla alrededor de los tanques, sobre la cual, como consta en la declaración de los testigos, especialmente, el señor Nombre229909, la codemandada no cuenta con llave y sus anclajes están dentro. Resulta clara la razón, comenta, del porqué la sociedad se opuso. En la especia, alega, se está ante una expropiación de hecho, sin pago. No existe justificación alguna, concluye, para que la malla permanezca, pues cada día, desde su imposición a través de la medida cautelar, se viola el derecho de propiedad de la codemandada.

V.Por la estrecha vinculación entre ambas objeciones serán analizadas conjuntamente. Luego de su estudio pormenorizado, se colige que el casacionista aduce dos temas diferentes: 1) la sentencia cuestionada incurre en el vicio de ultra petita –al haberse otorgado más de lo pedido-, pues, según afirma, de manera sorpresiva le reconoció una posesión a la accionante sobre el área donde se encuentran edificados los tanques de agua; la cual debe respetar el señor Nombre229905 –en su doble condición-, absteniéndose de perturbarla por las vías de hecho y 2) la jurisdicción contencioso administrativa es incompetente, por razón de la materia, para conocer este proceso, ya que el análisis de la usucapión alegada por la parte actora es propio de la jurisdicción civil. En el primer supuesto, de darse lo recriminado, configuraría el vicio procesal de incongruencia. Al respecto, conforme se apuntó en el considerando II de esta sentencia, la ASADA actora pretende en sentencia se declare (acorde con la reformulación efectuada en la audiencia preliminar), en forma principal, que es propietaria registral del terreno que ha poseído por más de 25 años, descrito mediante levantamiento catastral del ingeniero topógrafo Nombre229906 , con un área de 229 metros cuadrados, que es parte del inmueble descrito en matricula de folio real número Placa43110 del partido de Heredia, en razón de las construcciones con carácter demanial efectuadas.

Por lo tanto, solicita se le autorice catastrar y segregar ese terreno. De manera subsidiaria, requiere, en primer lugar, se declare un régimen de copropiedad a su favor y en relación con la empresa demandada, sobre el terreno que ha poseído por más de 25 años, descrito mediante levantamiento catastral del ingeniero topógrafo Nombre229906 , con un área de 229 metros cuadrados, que es parte del inmueble inscrito bajo la matricula folio real Placa43110 del partido de Heredia, en razón de las construcciones con carácter demanial efectuadas; también, que se le autorice a catastrar y segregar ese terreno. De igual manera, como pretensión subsidiaria segunda, pide se le ordene al codemandado Nombre229905 , en su carácter personal y como representante de la empresa demandada, se abstenga de realizar todo tipo de actuaciones en perjuicio del derecho de propiedad que se derive de la declaratoria con lugar de este proceso, bajo apercibimiento de que, en caso contrario, puede ser procesado por el delito de desobediencia a la autoridad.

El Tribunal, en el considerando VIII de la resolución cuestionada, luego de brindar las razones por las cuales estimó improcedente la usucapión alegada por la parte actora, en virtud de que no le asistía uno de los requisitos para su acogimiento: el justo título traslativo de dominio, lo que motivó el rechazo tanto de la pretensión principal –que se declarara a la actora propietaria- como de la subsidiaria primera –que se estableciera una copropiedad-, indicó lo siguiente: “Por último se establece una pretensión con respecto al señor Nombre229905 , en su condición personal y como representante de la sociedad demandada, de abstenerse de perturbar el derecho de propiedad de la actora. Es evidente que la asociación carece del derecho de propiedad, en los términos ya dichos; más si [sic] presenta al menos uno de los atributos, a saber el derecho de posesión que como se indicó ha ejercido desde hace muchos años a título de dueño [sic], en una forma pública, pacifica, e ininterrumpida, hecho que es de conocimiento del señor Nombre229905 en su doble condición.

Es claro que en virtud de presentar la sociedad Paraíso Tropical Inc S. A. el derecho de propiedad sobre la finca base del conflicto puede requerir ese atributo (posesión) para sí en el momento que lo tenga a bien, más [sic] no es la vía de hecho el mecanismo legal para tal efecto. Al haberse permitido que ese derecho se consolidara por el tiempo, es por vía de acción que se puede conocer el proceso reivindicativo que ocupa, con el correspondiente reconocimiento de las mejoras que pudieran haberse dado. En dichas condiciones y sobre el derecho de posesión si [sic] resulta ajustado a derecho acceder a la pretensión invocada, declarándose con lugar con la aclaración indicada de conformidad con el artículo ciento veintidós del Código Procesal Contencioso Administrativo.” (Lo subrayado es suplido). Acorde con lo anterior, en la parte dispositiva, en lo de interés, se resolvió: “Se acoge la excepción de falta de derecho para las pretensiones principal y secundarias [sic] de prescripción positiva o régimen de copropiedad, pretendidas por la actora y sin lugar el proceso en cuanto a dichos extremos.

Se rechaza la excepción de falta de derecho en cuando al demandado Nombre229905 , ordenándose al [sic] él en su condición personal y como presidente de la señalada sociedad, que no deberá perturbar por vía de hecho la posesión que presenta la actora. […]”. (Lo subrayado no es del original). De lo transcrito, se colige con meridiana claridad que las personas juzgadoras, en realidad, no acogieron la pretensión subsidiaria segunda. No procedía su otorgamiento al haberse rechazado tanto la pretensión principal como la subsidiaria primera, ya que en ella, se insiste, lo solicitado fue: “Que se ordene al demandado Nombre229905 en su carácter personal y como representante de la Sociedad demandada que se abstenga de realizar todo tipo de actuaciones en perjuicio del derecho de propiedad que se derive en la declaratoria, bajo el apercibimiento de que en caso contrario puede ser procesado por el delito de desobediencia a la autoridad.” (Lo subrayado es suplido).

Tanto es así que indicaron: “Es evidente que la asociación carece del derecho de propiedad, en los términos ya dichos […]”. Lo concedido, por el contrario, reviste la característica de un pronunciamiento oficioso, al amparo del precepto 122 del CPCA, como de manera expresa se citó.

VI.En este orden de ideas, según lo ha indicado insistentemente esta Sala, el CPCA introdujo un cambio paradigmático en la justicia contencioso administrativa. Su principal objetivo fue ceñirla plenamente a lo dispuesto en el numeral 49 de la Constitución Política: “Establécese la jurisdicción contencioso-administrativa como atribución del Poder Judicial con el objeto de garantizar la legalidad de la función administrativa del Estado, de sus instituciones y de toda otra entidad de derecho público./ La desviación de poder será motivo de impugnación de los actos administrativos./ La Ley protegerá, al menos, los derechos subjetivos y los intereses legítimos de los administrados.” (Lo subrayado es suplido). Incorpora la oralidad como medio o mecanismo para administrar justicia y, con ello, los principios que le son consustanciales como el de contradicción, inmediatez y concentración de la prueba.

El nuevo régimen contencioso administrativo opta por un sistema mixto, combinando la escritura con la oralidad, introduciendo el proceso oral por audiencias. De igual manera, dispone un control plenario de la conducta administrativa, eliminando las áreas inmunes de su control jurisdiccional. De forma expresa preceptúa la protección de las diversas situaciones jurídicas de la persona que pudieran ser afectadas por cualquier conducta de la Administración Pública sujeta al Derecho Administrativo. En este sentido, en el artículo 1, en lo de interés, dispone: “1) La Jurisdicción Contencioso-Administrativa, establecida en el artículo 49 de la Constitución Política, tiene por objeto tutelar las situaciones jurídicas de toda persona, garantizar o restablecer la legalidad de cualquier conducta de la Administración Pública sujeta al Derecho administrativo [sic], así como conocer y resolver los diversos aspectos de la relación jurídico-administrativa./ 2) Los motivos de ilegalidad comprenden cualquier infracción, por acción u omisión, al ordenamiento jurídico, incluso la desviación de poder. …” (Lo subrayado es suplido).

El acento del nuevo proceso está en la persona. Se brindan las herramientas necesarias para lograr la humanización y democratización judiciales. Los postulados constitucionales de justicia, debido proceso y tutela judicial efectiva, se yerguen como guías en todos las etapas procedimentales. En suma, se persigue la satisfacción de los valores ínsitos en un Estado democrático de derecho. Dentro de esta línea de pensamiento, una de las principales variaciones introducidas por el CPCA es la contenida en el canon 122, en torno a la posibilidad, o más bien, obligación de los juzgadores de efectuar una serie de pronunciamientos de manera oficiosa. No obstante, dicha norma, al preceptuar: “Cuando la sentencia declare procedente la pretensión, total o parcialmente, deberá hacer, según corresponda, entre otros, los siguientes pronunciamientos: […]”, supedita tal facultad a la hipótesis de que se declare procedente la pretensión esgrimida por la parte actora o reconventora en forma total o parcial. Al respecto, pueden consultarse, entre otras, las sentencias nos. 900 de las 10 horas 50 minutos del 27 de agosto de 2009 y 1357 de las 14 horas 9 minutos del 4 de noviembre de 2010.

VII.Siguiendo esta línea argumentativa, si el Tribunal no acoge parcial o totalmente la pretensión formulada, se encuentra imposibilitado de efectuar pronunciamientos al amparo de lo dispuesto en el susodicho cardinal 122 del CPCA. Si lo hace, incurriría, inexorablemente, en el vicio de incongruencia. Tocante al principio de congruencia en procesos regidos por el CPCA, esta Sala, entre otros, en el fallo 288 de las 10 horas 20 minutos del 20 de marzo de 2009, en lo de interés, señaló: “ III.- En relación al vicio de incongruencia en la nueva legislación procesal contencioso administrativa, ha dicho recientemente esta Sala: “VIII . Por otro lado, la casacionista alega quebrantado el numeral 155 del Código Procesal Civil. Al respecto, debe indicarse que el ordinal 220 del Código Procesal Contencioso Administrativo, distinto a lo afirmado por la recurrente, no autoriza la aplicación de esa normativa.

Por el contrario, ese canon dispone: “Para lo no previsto expresamente en este Código, se aplicarán los principios del Derecho Público y procesal, en general” Es decir, en el sub júdice, resulta posible alegar el principio procesal de congruencia de las sentencias, mas no la violación del artículo 155 del Código Procesal Civil. La incongruencia, conforme lo ha reiterado esta Sala, se produce cuando existe una evidente contradicción entre las pretensiones de los litigantes y lo resuelto en la parte dispositiva de la sentencia; no entre las consideraciones de la sentencia y lo resuelto en la parte dispositiva. Con la nueva legislación procesal contenciosa administrativa, tal premisa ha sido relativizada. Ello por cuanto, en virtud de los poderes otorgados al juzgador, las pretensiones aducidas en la demanda pueden sufrir variaciones tanto en la audiencia preliminar, cuanto en la de juicio (artículos 90 inciso 1 b) y 95 ibídem); además, de conformidad con el canon 122 ejúsdem, se dan una serie de pronunciamientos de carácter oficioso.

En consecuencia, al analizarse dicho yerro, debe tenerse presente lo indicado. …” (no. 000819-A-2008, de las 10 horas 45 minutos del 4 de diciembre de 2008). La incongruencia como causal de casación, entonces, ocurre cuando el juzgador al proveer, decide sobre cuestiones no pedidas (extra petita), o sobre más de lo pedido (ultra petita), u omite la decisión en todo o en parte, acerca de las pretensiones o de las excepciones. Para determinar la existencia de este vicio como causal de casación ha de confrontarse, necesariamente, la parte resolutiva de la sentencia con las pretensiones aducidas en la demanda y en las demás oportunidades que la ley contempla, o las excepciones propuestas por el demandado, a fin de determinar si en realidad existe entre estos dos extremos evidente desajuste de aquella frente a estas. …”. En este sentido, pueden consultarse, además y entre otras, las sentencias nos. 85 de las 15 horas 35 minutos del 24 de enero de 2001, 127 de las 8 horas 30 minutos del 22 de febrero de 2008 y 1357 de las 14 horas 9 minutos del 4 de noviembre de 2010.

VIII.Como se apuntó, el Tribunal denegó los ruegos principal y subsidiario planteados por la ASADA actora. Es decir, no la declaró propietaria del inmueble, ni estableció un régimen de copropiedad entre ella y la empresa codemandada; por ende, tampoco procedía el subsidiario segundo, que se sujetaba a declarar con lugar la demanda, pues se solicitó se ordenara al codemandado Nombre229905 , en su carácter personal y como representante de la empresa codemandada, abstenerse de realizar todo tipo de actuaciones en perjuicio del derecho de propiedad derivarado de la declaratoria con lugar de la demanda. Consecuentemente, no podía, so pena de incurrir en el vicio de incongruencia, emitir un pronunciamiento oficioso al amparo del precepto 122 del CPCA como lo hizo. Este proceder del Tribunal, según se indicó, configura el yerro alegado de incongruencia por ultra petita, al existir un “exceso de pronunciamiento”, lo cual colocó a la parte demandada en estado de indefensión –canon 137 inciso b) del CPCA-.

IX.En mérito de lo expuesto, en cuanto a este aspecto, se impone acoger el recurso formulado por quebranto de normas procesales. En consecuencia, deberá anularse parcialmente el fallo cuestionado en cuanto le ordenó al codemandado Nombre229905 –en su doble condición- no perturbar, por vía de hecho, la posesión que presenta la Asociación actora. En aplicación de los principios de economía y celeridad procesales, al resultar innecesario, no se reenviará el expediente al Tribunal sentenciador. En relación, véanse, entre otras, las sentencias de esta Sala nos. 900 de las 10 horas 50 minutos del 27 de agosto de 2009 y 1357 de las 14 horas 9 minutos del 4 de noviembre de 2010.

X.El segundo tema argüido por el casacionista, como se indicó, consiste en que, a su entender, la jurisdicción contencioso administrativa es incompetente -por razón de la materia- para conocer la usucapión alegada por la parte actora, ya que, afirma, su análisis es propio de la civil. Esta Sala ha tenido la oportunidad de definir cuáles son los órganos judiciales competentes para conocer los procesos en donde figure como parte una Asociación Administradora de Acueducto. En este sentido, en la resolución no. 1152-C-S1-2012 de las 10 horas 15 minutos del 13 de setiembre, en lo de interés, se indicó: “II.- Dispone la Ley número 2726 del 14 de abril de 1961, Ley Constitutiva del Instituto Costarricense de Acueductos y Alcantarillados, en su ordinal primero, que AyA es la institución autónoma encargada de dirigir, fijar políticas, establecer y aplicar normas, así como promover en el territorio nacional el planeamiento, financiamiento y desarrollo, de todo lo relacionado con el suministro de agua.

El inciso g) del ordinal segundo de la Ley supracitada, establece que es responsable de administrar y operar directamente los sistemas de acueductos y alcantarillados en todo el país. A su vez, dispuso el legislador, que la institución se encuentra facultada para convenir con organismos locales la administración de tales servicios o administrarlos a través de juntas administradoras de integración mixta entre el Instituto y las respectivas comunidades. Por su parte, el Reglamento 32529 del 2 de febrero de 2005, denominado Reglamento de las Asociaciones Administradoras de Sistemas de Acueducto y Alcantarillados Comunales, establece que AyA podrá delegar la administración, operación, mantenimiento y desarrollo de los sistemas de acueductos y/o alcantarillados comunales a favor de asociaciones denominadas ASADAS (artículo tercero). Tales entidades tendrán como fin la construcción, administración, operación, mantenimiento y desarrollo de los sistemas de acueductos y alcantarillados delegados por AyA, así como la conservación y aprovechamiento racional de las aguas necesarias para el suministro a las poblaciones (artículo 16 del reglamento indicado).

En torno al régimen patrimonial regulatorio de los bienes destinados al sistema de acueducto, expresa el numeral 18 de la Ley 2726 supracitada, que todas las propiedades e instalaciones de los organismos del Estado destinados a la prestación de servicios relativos a la captación, tratamiento y distribución de aguas potables son patrimonio nacional. Asimismo, expresa el Reglamento 32529, que todos los bienes muebles e inmuebles utilizados por las ASADAS en la administración, operación, mantenimiento y desarrollo de los sistemas de acueductos y alcantarillados se consideran de domino público, no se podrá disponer de ellos (artículo 18 y 21 inciso 10), y en caso de rescisión del convenio de delegación o de disolución de las ASADAS (numeral 21 inciso 13), se entregarán a AyA, la cual [sic] los inventariará, registrará e inscribirá a su nombre, asumiendo su titularidad para destinarlos a ese servicio público (artículo 22 inciso 11); en consecuencia las pretensiones del representante de […] tienen un evidente interés estatal, al corresponder a un bien inmueble destinado a la captación de agua, bien de dominio público a cargo de AyA, e indirectamente administrado por la Asociación aquí demandada, por lo que se dispone que este asunto deba ventilarse ante la jurisdicción contencioso administrativa.

Por lo que deberá remitirse al Tribunal Procesal Contencioso Administrativo y Civil de Hacienda del Segundo Circuito Judicial de San José conforme se ordenó en la resolución apelada.” En este mismo sentido, puede consultarse la resolución no. 887-C-S1-2012 de las 11 horas 20 minutos del 26 de julio de 2012. Al igual que en dichos precedentes, las pretensiones deducidas en esta lite por la ASADA actora, de que se le declare propietaria del inmueble que forma parte del acueducto o se establezca un régimen de copropiedad a su favor con la empresa codemandada, evidentemente, revisten un interés estatal, por la naturaleza demanial del bien involucrado para la captación de agua, el cual está a cargo de AyA y cuya administración le fue delegada a la ASADA actora. Ergo, la jurisdicción competente para conocer los ruegos interpuestos es la Contencioso Administrativa. Por ende, no se configura la incompetencia por razón de la materia alegada por la parte demandada.

XI.Sin perjuicio de lo expuesto, en virtud de la forma cómo las personas juzgadoras resolvieron esta lite, es menester efectuar la siguiente consideración. En su demanda, la Asociación actora, en lo de interés, folios 7, 8 y 9 indica: “En este sentido se le dota de poderes y deberes a la ASADA de Puente de Salas [sic] para llevar a cabo actos de administración sobre los “bienes destinados a la prestación de los servicios de los sistemas que administran [sic]”, todo bajo el principio de una sana administración de los servicios públicos, lo cual se ha logrado cumplir, en coordinación con el AyA, de la mejor forma hasta el día de hoy, esto en aras de satisfacer adecuadamente las necesidades de los administrados, más [sic] tomando en consideración la importancia que conlleva un buen servicio de agua potable para el desarrollo de la vida y para el mantenimiento de la salud, mismo motivo en el que radica nuestra preocupación, la que nos trae a la interposición del presente asunto, toda vez que pretendemos el evitar [sic], que el aquí accionado deje de perturbar el derecho que mantiene mi representada sobre la estructura en mención, para de esta forma continuar con el mantenimiento del tanque, evitando además que se llegue a dar la contaminación de las aguas que se encuentran en el mismo. / Desde esta perspectiva es necesaria la consideración de que el objeto del presente asunto, sea el tanque de agua mencionada [sic], es un bien de dominio público el cual fue construido con fondos públicos, se le da mantenimiento con fondos públicos y es más que evidente que su uso está destinado a un servicio público, razón por la cual tanto la ASADA de Puente Salas, así como el AyA se encuentran legitimados para llevar a cabo la defensa de los intereses públicos que están en juego en esta situación. / Asimismo es evidente que existe un derecho del Estado sobre el tanque de agua mencionado, toda vez que sobre dicho bien se han ejercido hace más de 40 años, actos de posesión, incluso antes de que la sociedad demandada adquiriera dicho bien; lo cual es más que evidente, dado que no es viable para ningún particular el llevar a cabo actos posesorios sobre un bien que tiene en su estructura un destino tan específico y además de carácter particularmente público, por lo que es absurdo para esta representación que el aquí accionado venga en este momento a impedir a mi representada el llevar a cabo los actos posesorios que desde hace tantos años se ejercen sobre el bien. […] En este sentido, tenemos primero el hecho de que el Instituto Costarricense de Acueductos y Alcantarillados construyó sobre el fundo de la sociedad demandada una estructura que sirve de tanque de agua y que forma parte de la infraestructura del acueducto que conduce agua potable a cada uno de los hogares de la comunidad de Puente Salas, construcción que se llevó a cabo desde hace más de 30 años a vista y paciencia e incluso con el consentimiento del antiguo propietario, construcciones sobre las que se han ejercido actos posesorios de forma pública, pacífica y continua, y repetimos, consentidas además por los que en su momento han sido titulares de algún derecho real sobre el fundo al cual esta estructura le es accesoria. / Es también indispensable considerar que la estructura construida se da en función de todo un acueducto que vería afectado radicalmente su funcionamiento de no contar con este tanque, toda vez que sin el mismo había que hacer cambios de una gran evergadura en el acueducto mismo.

Véase que en este caso la posesión del bien es más que evidente , dado que como se indicó, la construcción en si [sic] misma mantiene un destino específico, el cual es dotar de un servicio público a la comunicad de Puente de Salas [sic] y al ser la estructura en sí un bien demanial, se hace imposible dejar en manos del accionado esta estructura a cambio de su valor pecuniario de acuerdo a la primera opción que establece el Artículo 509 mencionado. […]” (lo subrayado es suplido). Este mismo alegato lo reiteró en el recurso de casación que le fue rechazado de plano. No obstante, por lo que se dirá, es relevante transcribir, en lo conducente, lo ahí señalado: “ De acuerdo a los hechos desarrollados en su momento, se tiene que desde hace aproximadamente 30 años, el Instituto Costarricense de Acueductos y Alcantarillados y posteriormente la ASADA de Puente Salas, han mantenido bajo su posesión y disfrute exclusivo un sistema de tanques construidos en el sector que popularmente se le llama La Amada de Puente Salas de Barva, el cual se ubica dentro de los linderos del inmueble inscrito matrícula de folio real […] Años después, -tal y como consta en los hechos probados en el [sic] Voto impugnado-, ante la necesidad de la ASADA de realizar obras de mantenimiento de los tanques en mención –esto alrededor del año 2010-, se trasladan funcionarios de esta al inmueble donde se ubican los tanques, y se encuentran con una [sic] renuencia del representante legal de la sociedad PARAÍSO TROPICAL INC. S.A., a que se lleven a cobo obras sin su consentimiento, bajo la consideración de que su representada era la legítima propietaria del inmueble.

Ante esa situación, y conociendo los derechos que las obras realizadas al terreno, y el tiempo transcurrido, daban a la ASADA, para disponer de este bien, es que procedimos a entablar una demanda en la cual, entre otras cosas, se solicita al Tribunal, se declarara la copropiedad a favor de dicha asociación, con fundamento en el Artículo 509 del Código Civil. […] lo que nos trae a la interposición del presente asunto, es el evitar, [sic] que el aquí accionado y su representada, dejen de perturbar el derecho que mantiene mi representada sobre la estructura en mención, para de esta forma continuar con el mantenimiento del tanque, evitando además que se llegue a dar la contaminación de las aguas que se encuentran en el mismo. / Desde esta perspectiva es necesaria la consideración de que el objeto del presente asunto, sea los tanques de agua en mención, corresponden a bienes de dominio público que han sido construidos con fondos públicos, a los que se les da mantenimiento con fondos públicos y que mantienen un uso eminentemente público, razón por la cual tanto la ASADA de Puente Salas, así como el ICAA se encuentran legitimados para llevar a cabo la defensa de los intereses públicos que están en juego en esta situación. […] De tal forma, es evidente que existe un derecho a favor de mi representada, sobre los tanques de agua mencionados, toda vez que sobre dicho bien se han ejercido hace más de 30 años, actos de posesión, lo cual es más que evidente, dado que no es viable para ningún particular el llevar a cabo actos posesorios sobre un bien, que tiene en su estructura un destino tan específico y además de carácter particularmente público , por lo que es absurdo para esta representación. […] Véase que el aceptar el hecho de que los tanques son propiedad de la sociedad demandada, por cuanto se encuentran dentro de la propiedad de este [sic], conllevaría un enriquecimiento sin causa en perjuicio del demanio público. […] puesto que el señor Nombre229905 , de tener derecho sobre el fundo, estaría en el presente caso enriqueciendo su patrimonio con una estructura de tal magnitud dentro de su propiedad, en perjuicio del erario público, y por consiguiente de la misma colectividad, cuya salud se encuentra ligada al buen funcionamiento y uso de este tanque. […] analizando el asunto de marras a partir de estos dos supuestos, es indispensable considerar que los tanques construidos y administrados por mi representada, se dan en función de todo un acueducto que vería afectado radicalmente su funcionamiento de no contar con ellos, ya que en caso contrario, habría que hacer cambios de una gran envergadura en el acueducto mismo.

Véase que en el asunto de marras, la posesión del bien es más que evidente, dado que como se indicó, la construcción en sí misma mantiene un destino específico, el cual es dotar de un servicio público a la comunicad de Puente de Salas [sic] y al ser la estructura en sí un bien demanial, se hace imposible dejar en manos del accionado esta estructura a cambio de su valor pecuniario de acuerdo a la primera opción que establece el Artículo 509 mencionado. […]”. A la luz de lo anterior, es evidente que lo pretendido por la ASADA actora es que se le reconozcan derechos de propiedad sobre una infraestructura que forma parte del acueducto de Puente Salas de San Pedro de Barva de Heredia; lo cual resulta improcedente, por lo que de seguido se expone. Como se indicó, la Ley no. 2726 del 14 de abril de 1961, Ley Constitutiva del Instituto Costarricense de Acueductos y Alcantarillados, dispone que todas las propiedades e instalaciones de los organismos del Estado, destinados a la prestación de servicios relativos a captación, tratamiento y distribución de aguas potables son patrimonio nacional.

Además, el Decreto Ejecutivo no. 32529 del 2 de febrero de 2005, Reglamento de las Asociaciones Administradoras de Sistemas de Acueductos y Alcantarillados Comunales, señala que todos los bienes muebles e inmuebles utilizados por las ASADAS en la administración, operación, mantenimiento y desarrollo de los sistemas de acueductos y alcantarillados se consideran de dominio público, razón por la que no se podrá disponer de ellos y, en caso de rescisión del convenio de delegación o de disolución de la Asociación deberán entregarse a AyA, quien los inventariará, registrará e inscribirá a su nombre, asumiendo su titularidad para destinarlos a ese servicio público. Es decir, a la luz de lo preceptuado en esos cuerpos normativos –y como también se deriva de lo considerado por las personas juzgadoras en el apartado VI de la resolución cuestionada-, los tanques que forman parte del acueducto de Puente Salas son de dominio público a cargo de AyA, quien delegó su administración en la ASADA actora –aspecto, por demás, aceptado por ambas partes-; en consecuencia, resultan imprescriptibles, inalienables, inembargables e indenunciables, al encontrarse fuera del comercio de los seres humanos, lo cual así fue –según el propio razonamiento del Tribunal efectuado en el considerando V de la sentencia impugnada-.

Consecuentemente, la ASADA actora no podía pretender se le declarara derecho alguno sobre ellos, menos una propiedad o copropiedad; máxime que, como se reconoce en el propio recurso de casación “En sí, el acto que faculta a mi representada a ejercer derechos sobre el acueducto se dio a partir del “Convenio de Delegación de Administración del Acueducto y Alcantarillado Sanitario de Puente Salas de San Pedro de Barva de Heredia”, copia que al efecto se encuentra agregado al expediente judicial, en el cual ICAA, delegó la administración del acueducto, dentro del cual se encuentran los tanques de agua que son objeto del presente asunto.” En otras palabras, a la Asociación actora no le asiste derecho en sus pretensiones –principal y subsidiarias-, motivo por el que su demanda no podía prosperar.

XII.En el sétimo agravio –identificado por el recurrente como I.C.3., folio 410- indica: en virtud de que las pretensiones principal y accesoria no fueron concedidas en la sentencia, no podía mantenerse la medida cautelar decretada por el Tribunal ni eximirse del pago de las costas a la actora. Dice, solicitó, con respaldo en la doctrina, se hiciera referencia expresa a ella en la sentencia. Esto, apunta, tiene su razón de ser en el hecho de que toda cautelar no solo es provisional, sino que está ligada, pues es accesoria, a la pretensión de la demanda. Reproduce lo expuesto por el Tribunal en el considerando XI tocante a la medida cautelar. Señala que un acto “agotado”, como ahí se indica, podría ser si se hubiere ordenado, por ejemplo, la limpieza del tanque, ya que ello se realiza en un solo acto, siendo irreversible. Sin embargo, anota, la construcción de la malla, que “segrega” y “expropia” de hecho a la empresa como legítima propietaria del terreno, es, si se quiere, un “acto de efecto continuado”, que daña a la codemandada cada día que pasa.

La propia sentencia, manifiesta, reconoce que los anclajes se encuentran dentro del perímetro cercado por la ASADA. Además, agrega, quedó demostrado en el juicio, por el testimonio del señor Nombre229909 , que su representada no tiene llave. Se trata de una expropiación de hecho, asevera, con el agravante de que su mantenimiento solo favorece a la actora, cuyas pretensiones principal y subsidiaria fueron denegadas. Se ha sostenido en el proceso, comenta, que la medida adoptada fue desproporcionada. Incluso, alega, con el testimonio del fontanero, don Nombre229910 , se demostró que los hechos indicados como peligrosos a la integridad de los tanques fueron esporádicos y puntuales, no siendo la generalidad. Esto también, señala, se determina si hubiera que deducirlo sin ese testimonio, pues, entre el primer y segundo tanques no se han presentado problemas en el pasado. La sentencia, apunta, reconoció que no ha habido arrestos, pese a la presencia policial en el lugar.

En consecuencia, indica, no se demostró que los hechos, supuestamente dañosos, fueran usuales, sino esporádicos y ni tan dañinos como lo hace ver la actora, quien, con un lema que afecta conciencias –contaminación del agua-, pretende conseguir se mantenga la medida cautelar que se ordenó –la malla- que no tiene justificación jurídica. También se ha sostenido, informa, que la ASADA, si quería resguardar más los tanques, pudo coordinar con la policía de la zona –acudieron cuando se les llamó-, contratar un guarda de noche, poner una alarma o candados especiales en las tapas, entre otras medidas, que no hubieran “segregado” o “expropiado” de hecho a la legítima dueña del terreno, como sucedió con la cautelar ordenada. Insiste en su naturaleza accesoria a la demanda. En esta lite, reitera, se denegaron la pretensión principal y accesoria, por lo que se requería pronunciamiento expreso. Se solicitó se dejara sin efecto.

Este punto, indica, fue objeto de una gestión de adición y aclaración, en la cual, mediante resolución no. 33-2010- BIS de las 8 horas del 4 de mayo de 2012, erróneamente se indicó que la construcción de la malla es parte del derecho de posesión ejercido por la ASADA, pues es un tema no solicitado en la pretensión. Además, informa, la mera tolerancia de la dueña del terreno no abarcaba la construcción de la malla. Para ello, expone, se requería comprar o expropiar. La ASADA, explica, no solicitó se declarara su posesión y sus alcances sobre el terreno. Es más, arguye, la sentencia no hace un análisis sobre el tipo de posesión, alcances o límites; sino que lo da como un hecho demostrado. Si bien es cierto, prosigue, se conminó a AyA para que iniciara los trámites expropiatorios, también lo es que la situación actual de la ASADA se presta para la injusticia. Esto por cuanto, dice, si AyA no inicia las gestiones de expropiación, la sociedad demandada deberá seguir soportando el despojo y sin paga; o, en su defecto, como lo indicaron las mismas personas juzgadora, se verá obligada a iniciar otros procesos judiciales para reivindicar su derecho, con el consecuente gasto de recursos económicos, dilaciones y daño moral.

Se nota, afirma, la falta de interés de AyA en pagar el terreno, pues la sentencia es de marzo de 2012 y nada se ha hablado o notificado sobre expropiación alguna. Resulta jurídicamente inaceptable, asevera, que se mantenga una expropiación de hecho, habiendo maneras menos gravosas y admitidas por la sociedad demandada para darle seguridad a los tanques. Debido a que la pretensión principal y la subsidiaria fueron declaradas sin lugar, razona, debió condenarse en costas a la actora. La advertencia dada en contra del señor Nombre229905 en lo personal para respetar la posesión de la ASADA, concluye, no fue pedida por la demandante, tampoco fue analizada en la sentencia, sino que se dio por hecho. En la octava recriminación, marcada por el casacionista como I.D.1., folio 413, alega falta de motivación respecto del mantenimiento de la medida cautelar, pese a que la pretensión principal y subsidiaria fueron declaradas sin lugar.

Alega, solicitó de manea expresa, tal y como lo respalda la doctrina, que en la sentencia debía hacerse referencia a ella. Esto, indica, tiene su razón de ser en el hecho de que toda medida cautelar, no solamente es accesoria y provisional, sino que está íntima e indefectiblemente ligada a la pretensión principal. De esta manera, arguye, de no prosperar, tampoco podría sostenerse la medida cautelar, la cual seguirá la suerte de la pretensión; si no desaparece antes, por cualquiera de los motivos que así lo prevén. Esta regla, alega, no fue respetada por la sentencia cuestionada; pese a haberse solicitado en el recurso de adición y aclaración. Transcribe el considerando XI de la resolución impugnada. Se afirma “no siendo necesario adoptar media alguna sobre ello”; empero, sostiene, se solicitó de manera expresa el pronunciamiento. Un acto “agotado”, apunta, podría ser si se hubiese ordenado, verbigracia, la limpieza del tanque, pues se realiza en un solo acto, siendo irreversible.

Empero, añade, la construcción de la malla, que “segrega” y “expropia” de hecho a la sociedad codemandada, como legítima dueña del fundo, es, si se quiere, un “acto de efecto continuado”, que daña a la demandada cada día que pasa. La propia sentencia, comenta, reconoció que los anclajes se encuentran dentro del perímetro cercado por la ASADA. Además, agrega, quedó demostrado en el juicio, por el testimonio del señor Nombre229909 , que la codemandada no tiene la llave. Se trata, arguye, de una expropiación sin pago, con el agravante de que su mantenimiento solo favorece a la actora, a pesar de que sus pretensiones –principal y subsidiaria- fueron denegadas. Por esto, considera, no solo resulta improcedente la orden de abstención; sino también la subsistencia de la media cautelar. Nada tiene que ver con esa orden de abstención, arguye, que fue solicitada en otros términos. En la resolución de la adición y aclaración, dice, el Tribunal señaló, de manera no motivada, que “la medida cautelar presenta un carácter instrumental, en lo que al caso corresponde solo se limitó a evitar los actos perturbatorios que el aquí gestionante estaba realizando a la posesión ejercida por la Asada.”; lo que, estima, resulta incongruente, pues si hubiera habido posesión, es claro que no incluía la construcción de una malla que segrega un área no pagada en los alrededores del tanque. No se debe mantener, concluye, una medida cautelar en las condiciones señaladas.

XIII.Dada la relación entre ambas objeciones, se analizarán de manera conjunta. Pese a su confusa redacción, esta Sala colige que lo alegado por el recurrente en las dos censuras es que la sentencia impugnada incurre en el vicio procesal de falta de motivación –artículo 137 inciso d) del CPCA-, pues, en criterio del recurrente, sin justificación alguna se mantiene la medida cautelar acordada pese a que las pretensiones deducidas en la demanda fueron declaradas sin lugar. En consecuencia, así serán analizadas. Esta Sala, en torno a dicha causal de casación, ha indicado: “ V. […] la falta de motivación, como reproche susceptible de ser revisado mediante el recurso extraordinario de casación, en los términos del canon señalado del CPCA, no debe entenderse como un mecanismo para cuestionar los fundamentos jurídicos de la sentencia. Surge cuando la motivación del fallo es omisa, ya sea porque no exista, o bien, por cuanto su desarrollo resulta en extremo confuso o contradictorio, de forma tal que se impida tener claridad en cuanto a los razonamientos que derivaron en la decisión adoptada en el acápite dispositivo de la sentencia, lo que vulneraría los derechos procesales de las partes, en concreto, el del debido proceso.

No se trata de determinar si el juzgador se pronunció sobre todas las pretensiones incorporadas al proceso, sino por el contrario, que el fallo cuente con los fundamentos sobre los cuales se adoptó la decisión correspondiente. De igual manera, debe tenerse presente, se trata de un motivo de índole procesal, lo cual implica que es atinente a eventuales incumplimientos de las disposiciones adjetivas que regulan el iter procesal o la sentencia, así como la relación jurídica que vincula a las partes y al juez en el marco de un proceso judicial, y de la cual derivan derechos y obligaciones. Así las cosas, no debe confundirse esta causal con un mecanismo para entrar a discutir la aplicación del Derecho o la valoración de la prueba realizada por el juzgador en los considerandos de la resolución, para lo cual el Código de rito establece causales autónomas (artículo 138 íbid), ya que de lo contrario se desnaturalizaría el motivo casacional específico.” Sentencia número 32311 de las 9 horas 50 minutos del 31 de marzo de 2011. En igual sentido, pueden consultarse, entre otros, los fallos números 814 de las 9 horas 5 minutos del 5 de julio y 1285 de las 9 horas 20 minutos del 11 de octubre, ambos del año 2012.

XIV.En el apartado XI de la sentencia cuestionada, las personas juzgadoras, en torno a la medida cautelar, señalaron: “Según es visible en el expediente, legajo de medida cautelar, es posible constatar como [sic] en virtud de una medida cautelar ordenada por este despacho se han adoptado una serie de actos para asegurar el buen funcionamiento del acueducto rural que nos ocupa. Se trata en efecto de actos que ya se agotaron, no siendo necesario adoptar determinación alguna en cuanto a ellos. ” (Lo subrayado es suplido). Luego, en el considerando III de la resolución no. 33-2012-BIS de las 8 horas del 4 de mayo de 2012, emitida en virtud de la gestión de adición y aclaración formulada por la parte demandada, en lo de interés, manifestaron: “ El Tribunal fue claro en señalar que dicho inmueble está afecto a un servicio público, revestido del interés general, de suerte que incluso se llegó a conminar al Instituto Costarricense de Acueductos y Alcantarillados para que procediera al ejercicio de las facultades que el ordenamiento jurídico le garantiza al amparo de su ley constitutiva y del canon cuarenta y cinco constitucional, todo sin perjuicio de estar a salvo las facultades de la sociedad actora [sic] de concurrir directamente a los Tribunales de Justicia y ejercer los derechos constitucionales y legales que le asisten frente a dicho ente público.

Lo que sí no resulta viable, es permitir que un servicio público esencial se encuentre supeditado a las determinaciones de un particular que es exactamente lo pretendido por el gestionante. En dicho marco, se estableció con claridad que poner en posesión del área de los tanques a los gestionantes no resulta posible, por el carácter que presenta el inmueble en particular. De manera que lejos de no haberse resuelto un aspecto o existir alguna oscuridad lo que los interesados pretenden es revertir lo resuelto, que como es conocido no procede. Cabe advertir sobre el particular que si bien la medida cautelar presenta un carácter instrumental, en lo que al caso corresponde únicamente se limitó a evitar los actos perturbatorios que el aquí gestionante estaba realizando a la posesión ejercida por la ASADA, de suerte que en caso de pretender romper con ese derecho real debía concurrir al proceso ordinario o de conocimiento en beneficio de su derecho, toda vez que ese aspecto no era parte de la litis; siendo ese el motivo por el cual se omitió pronunciamiento en concreto.

Claramente se indicó que el señor Nombre229905 pretendió deducir en la contestación de la demanda y en el juicio pretensiones en concreto para sí, sin plantear la correspondiente acción; lo que resultaba contrario al marco adjetivo correspondiente impidiendo que se resolviera. Motivo por el cual no se trata de un despojo de parte del bien, sino de orientar al interesado hacia el cause legal, alejándolo de los mecanismos de hecho que en su momento utilizó. De manera que aún cuando [sic] los demandados consideran que la existencia de una malla corresponde a un acto continuado al amparo de una medida cautelar, en realidad es permitir el ejercicio del derecho de posesión que venía disfrutando su contraparte, lo que como tal no es contrario al artículo cuarenta y cinco constitucional o genere la posibilidad de una posesión indefinida, sino que como se ha indicado es permitir a los interesados para que accionen conforme con los mecanismos que el ordenamiento consagra, sin perjuicio de las facultades del Instituto Costarricense de Acueductos y Alcantarillados de ejercer las facultades que presenta como ya se indicó y las que acreditan los demandados en el supuesto que se presente inercia del ente público.

Cabe indicar que la [sic] solicitud ahora conocida se reiteran algunas de las pretensiones que en su momento fueron consideradas en el considerando II y rechazadas en el dispositivo, las que tampoco requieren aclaración o adición alguna. Al no existir nada que aclarar o adicionar, se impone el rechazo de la gestión.” (Lo subrayado es suplido). En dichos pronunciamientos, aun cuando pueda no compartirse algunas consideraciones externadas, las personas juzgadoras brindaron las razones por las cuales estimaron pertinente mantener la construcción de la malla alrededor de los tanques de agua del Acueducto de Puente Salas de San Pedro de Barva de Heredia. Ergo, no padece la sentencia cuestionada el yerro procesal endilgado; razón por la que, en cuanto a ese tema, se impone el rechazo de la objeción interpuesta.

XV.Por otro lado, en el considerando XII del fallo combatido, tocante a las costas del proceso, el Tribunal señaló: “En lo que refiere a las costas, considera el Tribunal que si [sic] estamos en presencia de una de las excepciones del artículo ciento noventa y tres del Código Procesal Contencioso Administrativo, en virtud de ser posible constatar como [sic] una de las pretensiones de la actora ha sido aceptada, lo que evidencia que no existía mala fe o estar en presencia de una demanda temeraria. Por el contrario todo parece indicar que las partes actuaron de buena fe y tenían motivos suficientes para litigar, por lo que se resuelve el proceso sin especial condenatoria en costas.” (Lo subrayado es suplido). Como fue expuesto en los apartados precedentes, distinto a lo señalado por las personas juzgadoras, ninguna de las pretensiones aducidas por la parte actora fue acogida. Lo que aconteció, se insiste, fue que, con respaldo en el artículo 122 del CPCA, efectuaron un pronunciamiento oficioso, el cual, por incongruente esta Sala anuló. En consecuencia, al haberse rechazado la demanda en todos sus extremos y no considerar esta Cámara que le asista suficiente motivo para litigar a la ASADA actora, procede revocar lo resuelto en cuanto a este extremo para imponerle el pago de las costas (artículo 193 íbid).

XVI.Debido al elevado interés público que existe en este proceso, en virtud de la posibilidad de contaminación del acueducto de Puente Salas de San Pedro de Barva de Heredia y, por ende, ponerse en riesgo no solo la salud pública, sino también el valor supremo de la vida; es menester indicar lo siguiente. De conformidad con el artículo 19 del CPCA, el Tribunal o las personas juzgadoras, pueden ordenar, a instancia de parte, las medidas cautelares adecuadas y necesarias a efecto de proteger y garantizar, de manera provisional, el objeto del proceso y la efectividad de la sentencia. Asimismo, los preceptos 21 y 22 íbid disponen: “Artículo 21.- La media cautelar será procedente cuando la ejecución o permanencia de la conducta sometida a proceso, produzca graves daños o perjuicios, actuales o potenciales, de la situación aducida, y siempre que la pretensión no sea temeraria o, en forma palmaria, carente de seriedad.

Artículo 22.- Para otorgar o denegar alguna medida cautelar, el tribunal o el juez respectivo deberá considerar, especialmente, el principio de proporcionalidad, ponderando la eventual lesión al interés público, los daños y los perjuicios provocados con la medida a terceros, así como los caracteres de instrumentalidad y provisionalidad, de modo que no se afecte la gestión sustantiva de la entidad, ni se afecte en forma grave la situación jurídica de terceros. / También deberá tomar en cuenta las posibilidades y previsiones financieras que la Administración Pública deberá efectuar para la ejecución de la medida cautelar.” A la luz de dichos preceptos, no cabe duda, como bien lo indicó el Tribunal en la resolución no. 33-2012 BIS de las 8 horas del 4 de mayo de 2012, la medida cautelar presenta un carácter instrumental respecto del proceso principal. Por ende, si la demanda es rechazada, la medida deberá levantarse.

No obstante, en este proceso, la cautelar dispuesta presenta una connotación sui géneris o especial. El ordenarse la construcción de una malla alrededor de los tanques de agua lo fue para proteger el recurso hídrico en riesgo de contaminación. Así se desprende de las consideraciones orales efectuadas por el Tribunal de Apelaciones cuando emitió la resolución no. 571-2010 de las 16 horas 22 minutos del 27 de octubre de 2010. Al respecto, a las 16:23:06 de la respectiva acta de grabación, indicó que la justificación brindada por la parte actora para mantener la medida cautelar acordada era la siguiente: “[…] Se trata de proteger la prestación de un servicio público de gran importancia para la salud pública. Que existe un peligro por la entrada de terceras personas que están llevando a cabo actividades que ponen en grave riesgo la prestación de ese servicio y que amenazan con destrucción [sic] y contaminación de la estructura de los tanques de agua.

Que hay una urgencia en que se admitiera la medida cautelar, por el derecho a la salud y que al actor [sic] no se le está impidiendo el tránsito por su propiedad; sino que, simplemente, se refiere al área ocupada ya por los terrenos [sic]. Que hay una apariencia de buen derecho. Que hay un peligro en la mora y una adecuada consideración de la ponderación de los intereses en juego.” Luego, a las 16:29:51, las personas juzgadoras, cuando analizaron la supuesta indefensión alegada por la parte demandada, por no haber sido llamada la empresa dueña de la propiedad en donde se ubican los tanques de agua, afirmaron: “El Tribunal estima que en el presente caso, por tratarse de una medida cautelar, el trámite es más informal. Lo que priva es la necesidad de resolver la urgencia de la situación. Hay, sobre todo, el interés del servicio público y de un daño a la sociedad, que priva por sobre cualquier interés personal. [… 16:31:39] Se ha alegado que se viola la libertad de tránsito del actor [sic] a través de su propiedad.

Esto no se ha constatado. Se constata, simplemente, que se está rodeando una estructura que ya está ahí y que ya le impide el tránsito por esa parte del terreno. Simplemente se está creando un perímetro de protección. […]”. Además, así fue entendido por la propia parte demandada. Al respecto, a folio 411, afirma: “Hemos sostenido en el proceso que la medida cautelar fue desproporcionada, incluso, en el testimonio del señor fontanero Nombre229910 , quedó claro que los hechos que se indicaron como peligrosos a la integridad de los tanques, eran ESPORÁDICOS y PUNTUALES, no la generalidad. Eso también resulta razonable si hubiera que deducirlo sin ese testimonio, pues entre el primer tanque y el segundo, no se han presentado problemas en el pasado. La misma sentencia reconoce que no ha habido arrestos, pese a la presencia de la policía en el lugar. En consecuencia, los hechos supuestamente dañosos no se demostró que fueran usuales, sino esporádicos, ni tan dañosos como lo hace ver la actora, quien con un lema que afecta conciencias (contaminación del agua) pretende conseguir que se mantenga la medida cautelar que ordenó la malla que no tiene justificación jurídica.” Luego, a folio 440 manifiesta: “ La sentencia da por hecho que hay un peligro a la integridad del agua del acueducto, por cuanto en dos ocasiones (eso es lo que se demostró a través de las actas policiales), se encontraron personas en la zona.

Sin embargo el mismo fontanero contestó que esto era algo puntual y no algo que ocurriera de continuo. Este punto es importante porque es esa idea terrible de que el agua se puede contaminar la que incide en la serie de yerros de la sentencia, como la orden al señor Nombre229905 de no perturbar la “posesión” de la Asada (que no existe), ni siquiera considerar en sentencia los demás medios al alcance de la Asada para dar seguridad al tanque sin segregar y despojar de hecho y sin paga a la sociedad demandada. / Así las cosas, mantener la medida cautelar y ordenar mantener la posesión (sin límites) a la Asada, son desde la manera de entender de los demandados producto de la errada creencia de un peligro inminente para el agua. Asimismo es desproporcionado porque hay medios alternos de protección, no violatorios del artículo 45 constitucional a que tiene derecho la demandada.”

XVII.En esta línea de pensamiento, debe indicarse, como bien lo analizó el Tribunal en el considerando V de la sentencia impugnada, el agua, en virtud de representar un recurso indispensable para la vida, es un bien demanial. Así está expresamente dispuesto en los cánones primero y segundo de la Ley no. 276 del 27 de agosto de 1942, Ley de Aguas. De igual manera, la Sala Constitucional ha señalado que el acceso al agua potable es un derecho humano. En este sentido, en el fallo no. 2011011366 de las 9 horas 25 minutos del 26 de agosto de 2011, indicó: “IV.- Sobre el Derecho Fundamental al Agua Potable. Este Tribunal ha reconocido en su jurisprudencia que existe un derecho fundamental al suministro de agua potable y que el mismo se deriva de los derechos fundamentales a la salud, la vida, al medio ambiente sano, a la alimentación y la vivienda digna, entre otros, tal como ha sido reconocido también en instrumentos internacionales sobre Derechos Humanos aplicables en Costa Rica: así, figura explícitamente en la Convención sobre la Eliminación de todas las formas de discriminación contra la mujer (art. 14) y la Convención sobre los Derechos del Niño (art. 24); además, se enuncia en la Conferencia Internacional sobre Población y el Desarrollo de El Cairo (principio 2), y se declara en otros numerosos del Derecho Internacional Humanitario.

Asimismo, ha considerado en reiteradas ocasiones que en nuestro Sistema Interamericano de Derechos Humanos, el país se encuentra particularmente obligado en esta materia por lo dispuesto en el artículo 11.1 del Protocolo Adicional a la Convención Americana sobre Derechos Humanos en Materia de Derechos Económicos, Sociales y Culturales ("Protocolo de San Salvador" de 1988), el cual dispone que: “Artículo 11. Derecho a un medio ambiente sano 1. Toda persona tiene derecho a vivir en un medio ambiente sano y a contar con servicios públicos básicos”. Además, recientemente, el Comité de Derechos Económicos, Culturales y Sociales de la ONU reiteró que disponer de agua es un derecho humano que, además de ser imprescindible para llevar una vida saludable, es un requisito para la realización de todos los demás derechos humanos. Siguiendo con lo anterior, conviene señalar que del marco normativo mencionado se deriva una serie de derechos fundamentales ligados a la obligación del Estado de brindar los servicios públicos básicos, que implican, por una parte, que no puede privarse ilegítimamente de ellos a las personas, pero que, como en el caso del agua potable, no puede sostenerse la titularidad de un derecho exigible por cualquier individuo para que el Estado le suministre el servicio público de agua potable, en forma inmediata y dondequiera que sea, sino que, en la forma prevista en el mismo Protocolo de San Salvador, esta clase de derechos obligan a los Estados a adoptar medidas, conforme lo dispone el artículo primero del mismo Protocolo: “Los Estados Partes en el presente Protocolo Adicional a la Convención Americana sobre Derechos Humanos se comprometen a adoptar las medidas necesarias tanto de orden interno como mediante la cooperación entre los Estados, especialmente económica y técnica, hasta el máximo de los recursos disponibles y tomando en cuenta su grado de desarrollo, a fin de lograr progresivamente, y de conformidad con la legislación interna, la plena efectividad de los derechos que se reconocen en el presente Protocolo”.

De esto tampoco puede interpretarse que ese derecho fundamental a los servicios públicos no tenga exigibilidad concreta; por el contrario, cuando razonablemente el Estado deba brindarlos, los titulares del derecho pueden exigirlo y no pueden las administraciones públicas o, en su caso, los particulares que los presten en su lugar, escudarse en presuntas carencias de recursos, que ha sido la secular excusa pública para justificar el incumplimiento de sus cometidos.” En este mismo sentido, pueden consultarse, entre otros, los votos de dicha Cámara nos. 2003-04654 de las 15 horas 44 minutos del 27 de mayo de 2003 y 2011-003579 de las 13 horas 6 minutos del 18 de marzo de 2011.

XVIII.En este orden de ideas, en la sentencia impugnada se tuvo por acreditado que: “14) Que en los últimos meses se han encontrado en los tanques preservativos, ropa, rompimiento de tapas, candados cortados, gente cocinando, entre otras actividades que ponen en peligro el acueducto, realizado por vagabundos y drogadictos de la zona (ver declaración del señor Nombre229911 rendida en el juicio oral y público, folios 18, 55 al 63 y 89, 91 al 94 del expediente de la medida cautelar). 15) En caso de contaminarse los tanques, se produciría una afectación a la totalidad del acueducto al ser a partir de allí que se suple la comunidad (ver declaración del señor Nombre229911 rendida en el juicio oral y público).” Según se apuntó, la parte demandada reconoció la existencia de esos actos vandálicos; aunque afirma, no fueron usuales, sino esporádicos –solo en dos ocasiones-, ni tan dañinos. No obstante, se insiste, el suministro de agua potable es un derecho humano, el cual deriva, a su vez, de los derechos fundamentales a la salud, la vida, al ambiente sano y a la alimentación; en consecuencia, a esta lite también le resultan aplicables los principios rectores del Derecho Ambiental.

Uno de ellos, de linaje constitucional, pues subyace en los numerales 46 y 50 de la Carta Magna, es el denominado “precautorio” o de “evitación prudente” o “indubio pro natura”. De conformidad con la doctrina, en esta materia no solo existen riesgos ciertos, sino también puede existir incertidumbre científica respecto del alcance de algunos daños. Este postulado, entonces, exige que, cuando una duda razonable surja en relación con la peligrosidad de cualquier actividad de repercusiones ambientales o a la salud humana, se evite, o se tomen las medidas pertinentes para que ese eventual daño, científicamente no comprobado todavía, no llegue a producirse. Dos son sus presupuestos: falta de certidumbre científica y la amenaza de daño. De manera explícita se encuentra recogido en la Conferencia de las Naciones Unidas sobre el Medio Ambiente y el Desarrollo, o Declaración de Río: “ Principio 15.- Con el fin de proteger el medio ambiente, los Estados deberán aplicar ampliamente el criterio de precaución conforme a sus capacidades.

Cuando haya peligro de daño grave e irreversible, la falta de certeza científica absoluta no deberá utilizarse como razón para postergar la adopción de medidas eficaces en función de los costos para impedir la degradación del medio ambiente”. Por su parte, la Ley de Biodiversidad, número 7788 del 30 de abril de 1998, dispone: “ARTÍCULO 7.- Definiciones. […] Biodiversidad: variabilidad de organismos vivos de cualquier fuente, ya sea que se encuentren en ecosistemas terrestres, aéreos, marinos, acuáticos o en otros complejos ecológicos. Comprende la diversidad dentro de cada especie, así como entre las especies y los ecosistemas de los que forma parte. / Para los efectos de esta ley, se entenderán como comprendidos en el término biodiversidad, los elementos intangibles, como son: el conocimiento, la innovación y la práctica tradicional, individual o colectiva, con valor real o potencial asociado a recursos bioquímicos y genéricos, protegidos o no por los sistemas de propiedad intelectual o sistemas sui generis de registro. […] ARTÍCULO 11.- Criterios para aplicar esta ley.

Son criterios para aplicar esta ley: 1.- Criterio preventivo: Se reconoce que es de vital importancia anticipar, prevenir y atacar las causas de la pérdida de biodiversidad o sus amenazas. 2.- Criterios precautorio o indubio pro natura: Cuando exista peligro o amenaza de daños graves o inminentes a los elementos de la biodiversidad y al conocimiento asociado con estos, la ausencia de certeza científica no deberá utilizarse como razón para postergar la adopción de medidas eficaces de protección. 3.- Criterio de interés público ambiental: El uso de los elementos de la biodiversidad deberá garantizar las opciones de desarrollo de las futuras generaciones, la seguridad alimentaria, la conservación de los ecosistemas, la protección de la salud humana y el mejoramiento de la calidad de vida de los ciudadanos. […]” En este sentido, la Sala Constitucional, en el fallo 1250-99 de las 11 horas 24 minutos del 19 de febrero de 1999, señaló: “[...] La prevención pretende anticiparse a los efectos negativos, y asegurar la protección, conservación y adecuada gestión de los recursos.

Consecuentemente, el principio rector de prevención se fundamenta en la necesidad de tomar y asumir todas las medidas precautorias para evitar contener la posible afectación del ambiente o la salud de las personas. De esta forma, en caso de que exista un riesgo de daño grave o irreversible –o una duda al respecto-, se debe adoptar una medida de precaución e inclusive posponer la actividad de que se trate. Lo anterior debido a que en materia ambiental la coacción a posteriori resulta ineficaz, por cuanto de haberse producido ya las consecuencias biológicas socialmente nocivas, la represión podrá tener una trascendencia moral, pero difícilmente compensará los daños ocasionados en el ambiente”. (Lo subrayado no es del original). También, pueden consultarse, entre otros, los fallos de ese órgano jurisdiccional nos. 9773-00 de las 9 horas 44 minutos del 3 de noviembre de 2000 y 1711-01 de las 16 horas 32 minutos del 27 de febrero de 2001.

Luego, en el fallo 3480-03 de las 14 horas 2 minutos del 2 de mayo de 2003, precisó aún más dicho concepto: “Bien entendido el principio precautorio, el mismo se refiere a la adopción de medidas no ante el desconocimiento de hechos generadores de riesgo, sino ante la carencia de certeza respecto de que tales hechos efectivamente producirán efectos nocivos en el ambiente.” (Lo subrayado es suplido). De igual manera, en el fallo 6322-2003 de las 14 horas 14 minutos del 3 de julio de 2003, indicó: “[...] 4.- Principio precautorio : […] El término prevención deriva del latín ‘praeventio’, que alude a la acción y efecto de prevenir, a aquellas preparaciones y disposiciones que se hacen anticipadamente para evitar un riesgo o ejecutar una cosa. La prevención pretende anticiparse a los efectos negativos, y asegurar la protección, conservación y adecuada gestión de los recursos. Consecuentemente, el principio rector de prevención se fundamenta en la necesidad de tomar y asumir todas las medidas precautorias para evitar o contener la posible afectación del ambiente o la salud de las personas.

De esta forma, en caso de que exista un riesgo de daño grave o irreversible -o una duda al respecto-, se debe adoptar una medida de precaución e inclusive posponer la actividad de que se trate. Lo anterior debido a que en materia ambiental la coacción a posteriori resulta ineficaz, por cuanto de haberse producido ya las consecuencias biológicas y socialmente nocivas, la represión podrá tener una trascendencia moral, pero difícilmente compensará los daños ocasionados al ambiente.” En igual sentido, pueden consultarse, de esa Cámara, el voto no. 2008-17618 de las 11 horas 51 minutos del 5 de diciembre de 2008 y, de esta Sala la sentencia no. 1261 de las 11 horas del 10 de diciembre de 2009. En este proceso, se insiste, se acreditó el riesgo latente de contaminación de los tanques y, por ende, del agua potable, en virtud de actuaciones de personas inescrupulosas quienes acuden al lugar donde se ubican.

Por ende, existe una situación que puede poner en mayor riesgo la salud pública; lo cual no fue desvirtuado por la parte demandada, quien, como se indicó, la acepta, pero tratando de minimizarla aduciendo que fue esporádica y no tan dañina. Empero, a la luz de lo antes expuesto, esta Sala no puede ni debe soslayar esa circunstancia. Consecuentemente, al amparo de los precedentes indicados, del principio precautorio, de los artículos 1, 2, 4, 29 de la Convención Americana de Derechos Humanos; 11.1 del Protocolo de San Salvador; 21, 45 y 50 de la Constitución Política; y como tutela para evitar cualquier daño irreversible a los tanques del Acueducto de Puente Salas de San Pedro de Barva de Heredia y, por ende, al recurso hídrico, se estima esencial por esta Sala mantener la malla construida alrededor de los tanques de agua potable. Decisión que, además, encuentra sustento, como se indicó, porque los bienes muebles e inmuebles utilizados por las ASADAS para administrar, operar, mantener y desarrollar los sistemas de acueductos y alcantarillados son de dominio público; por ende, los tanques de agua revisten esa característica (lo cual, se repite, es aceptado por ambas partes).

La malla objeto de este proceso también ostenta esa cualidad. Su edificación, alrededor de los tanques del Acueducto de Puente Salas de San Pedro de Barva de Heredia, como se indicó, se originó para resguardar su integridad y, por tanto, proteger el recurso hídrico. Ergo, se trata de un bien destinado, de modo permanente, a un servicio de utilidad general –artículo 261 del Código Civil-; por ende, imprescriptible, inalienable, inembargable e indenunciable.

XIX.Al amparo de lo expuesto y en resguardo del marcado interés público que está de por medio en este proceso –se insiste, el derecho a la salud pública y a la vida-, esta Cámara le ordenará a la Administración activa, concretamente, a AyA en la figura de quien ostente su Presidencia Ejecutiva, cesar en la conducta omisiva. Por ende, deberá realizar todas las acciones pertinentes a efecto de garantizar la protección del Acueducto de Puente Salas de San Pedro de Barva de Heredia. Para lo cual, dentro del plazo improrrogable de seis meses a partir de la notificación de esta sentencia, deberá: A) determinar cuál opción resulta más conveniente para protegerlo: 1) constituir una servidumbre forzosa de acueducto, acorde con los preceptos 99 y siguientes de la Ley no. 276 del 27 de agosto de 1941, Ley de Aguas o 2) adquirir la propiedad, para lo cual, en caso necesario, tramitar la expropiación necesaria -precepto 5 incisos c) y e) de su Ley Constitutiva, no. 2726 del 14 de abril de 1961-; y B) iniciar el trámite respectivo para darle una solución definitiva al problema en dicho Acueducto.

XX.En mérito de lo expuesto, procede acoger parcialmente el recurso formulado por razones procesales. En consecuencia, por incongruente, se anulará la sentencia impugnada, solo en cuanto rechazó la defensa de falta de derecho y le ordenó al codemandado Nombre229905 , en su condición personal y como presidente de la empresa codemandada, no perturbar, por la vía de hecho, la posesión que presenta la Asociación actora. De igual manera, se revocará el fallo para imponerle el reconocimiento de las costas a la parte accionante. Se mantendrá la construcción de la malla de protección alrededor de los tanques de agua del Acueducto de Puente Salas de San Pedro de Barva de Heredia. Se le ordenará a AyA, en concreto, a quien ostente su Presidencia Ejecutiva que, dentro del plazo improrrogable de seis meses a partir de la notificación de esta sentencia: A) determine cuál opción resulta más conveniente para su protección: 1) constituir una servidumbre forzosa de acueducto, acorde con los preceptos 99 y siguientes de la Ley no. 276 del 27 de agosto de 1941, Ley de Aguas o 2) adquirir la propiedad, para lo cual, en caso necesario, deberá gestionarse la expropiación necesaria -precepto 5 incisos c) y e) de su Ley Constitutiva, no. 2726 del 14 de abril de 1961- y B) inicie el trámite respectivo para darle una solución definitiva al problema en dicho Acueducto.

En lo demás, se mantendrá incólume lo resuelto. Al resultar innecesario, en virtud de la forma como en definitiva se resuelve este proceso, se omitirá pronunciamiento en cuanto a los demás reparos argüidos por la parte demandada.

POR TANTO

Se rechaza la prueba documental ofrecida ante esta instancia. Se prescinde de la ofrecida para mejor resolver. Se acoge parcialmente el recurso interpuesto por razones procesales. Por incongruente, se anula la sentencia impugnada en cuanto rechazó la defensa de falta de derecho y le ordenó al codemandado Nombre229905 , en su condición personal y como presidente de la empresa codemandada, no perturbar, por la vía de hecho, la posesión de la Asociación actora. Se revoca la exoneración del pago de las costas, para imponérselas a la Asociación Administradora del Acueducto de Puente Salas de San Pedro de Barva de Heredia. Se ordena mantener la construcción de la malla de protección alrededor de los tanques de agua del indicado Acueducto. Se le ordena al Instituto Costarricense de Acueductos y Alcantarillados, en concreto, a quien ostente su Presidencia Ejecutiva que, dentro del plazo improrrogable de seis meses a partir de la notificación de esta sentencia: A) determine cuál opción resulta más conveniente para protegerlo: 1) constituir una servidumbre forzosa de acueducto, acorde con los preceptos 99 y siguientes de la Ley no. 276 del 27 de agosto de 1941, Ley de Aguas o 2) adquirir la propiedad, para lo cual, en caso necesario, se gestionará la expropiación respectiva -precepto 5 incisos c) y e) de su Ley constitutiva, no. 2726 del 14 de abril de 1961-; B) inicie el trámite respectivo para darle una solución definitiva al problema en dicho acueducto.

En lo demás, se mantiene incólume lo resuelto. Por innecesario, en virtud de la forma como en definitiva se resolvió este proceso, se omite pronunciamiento en cuanto a los demás reparos argüidos por la parte demandada.
