DECISION No. 836-F-12 TRIBUNAL AGRARIO. SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ.- At sixteen hours and fifty-five minutes on veintinueve de junio de dos mil doce.

POSSESSORY INFORMATION proceedings instituted by PATTSAN CORPORATION INTERNATIONAL PCI SOCIEDAD ANÓNIMA, corporate identification number CED1, represented by [Nombre1] , of legal age, married once, secretary, a United States national, holder of passport number CED2 issued by her country, and [Nombre2] , of legal age, married once, businessman, a British citizen, holder of passport number CED3 issued by his country, both residents of Estados Unidos de América, Miami, Florida, Ford Lauderdale.- The following participated: attorney Lourdes Fernández Mora, of legal age, separated, attorney-at-law, resident of Heredia, identification number CED4 -, as special judicial representative (apoderada especial judicial) of the applicant; M.Sc. Susana Fallas Cubero, of legal age, attorney-at-law, resident of San José, identification number CED5, representative of the Procuraduría General de la República; and attorney Carmelina Vargas Hidalgo, of legal age, divorced once, attorney-at-law, identification number CED6, as representative of the Instituto de Desarrollo Agrario. The proceeding was heard by the Juzgado Civil de Mayor Cuantía del Tercer Circuito Judicial de Alajuela con sede en San Ramón, Agrario por Ministerio de Ley.-

WHEREAS:

  1. 1The applicant instituted possessory information proceedings for the purpose of having the following property registered in its name in the Registro Público de la Propiedad: “Land for pasture with a dwelling house, located in Alto Palomo, [Dirección1], Valverde Vega, province of Alajuela. Boundaries: NORTH Orlando Barrantes González, SOUTH Orlando Barrantes González, [Dirección2] and WEST Orlando Barrantes González. According to cadastral survey plan (plano catastrado) number A-setecientos treinta y cuatro mil ciento ochenta y tres-dos mil uno, in the name of [Nombre3], dated siete de setiembre de dos mil uno, it has an area of diez mil doscientos cincuenta y cinco metros con noventa y nueve decímetros cuadrados” (folios 7 to 12, 189).-
  2. 2The Procuraduría General de la República and the Instituto de Desarrollo Agrario appeared in the proceeding under the terms set forth at folios 42 to 44, 192 to 195, and folios 67 to 68, respectively.-
  3. 3Attorney Tatiana Rodríguez Herrera, Judge of the Juzgado Civil de Mayor Cuantía del Tercer Circuito Judicial de Alajuela con sede en San Ramón, Agrario por Ministerio de Ley, in a judgment rendered at fifteen hours and fifty-one minutes on veinte de octubre de dos mil once, ruled: “THEREFORE: In accordance with the foregoing and the cited provisions of law, the present possessory information proceedings instituted by PATTSAN CORPORATION INTERNATIONAL PCI SOCIEDAD ANÓNIMA, corporate identification number CED1, concerning the land described in cadastral survey plan A-734183-2001, ARE DENIED.” (reverse of folio 199).-
  4. 5The applicant filed an appeal (recurso de apelación), expressly stating the reasons for challenging the trial court’s position (folios 200 to 209).-
  5. 6In the conduct of the proceeding, the statutory requirements were observed, and no errors or omissions capable of rendering the decision null and void are evident.

CONSIDERING:

I.The established facts are adopted because they are supported by the evidence in the record. The following fact of the same nature is added: 5) The possession exercised by the applicant and its predecessors in possession consisted of using the property for construction and as a green area (witness testimony at folios 73, 75, 88; initial pleading at reverse of folio 18; soil study at folio 172).

II. Only the second fact found not to have been proven in the decision is adopted

III.The applicant appeals the judgment rendered at fifteen hours and fifty-one minutes on veinte de octubre de dos mil once, on the following grounds:

  • 1)It argues that the judge treated as an unproven fact the identity of the person who possessed the property before [Nombre5], a finding with which it disagrees because the witness testimony does refer to that matter, citing the statements made by witnesses [Nombre6] and [Nombre7].
  • 2)Regarding the possession exercised, it states that the land complies with the protection requirements applicable to forest and water resources, since the ultimate purpose pursued in these cases is the conservation of the environment and watersheds, and in this case neither the land-use report, the judicial inspection (reconocimiento judicial), nor the report by [Nombre8] and [Nombre8] indicates under any circumstances that human activity has endangered those areas.
  • 3)It analyzes the chain of transfers relating to the property for which title is sought and states that it is established by the witness testimony appearing at folios 73, 75 and 88; it further argues that the finding that the transfer documents are inconsistent is erroneous, because the deed by which Mr. [Nombre5] acquired the property, the subsequent deed by which [Nombre9] acquired it, and the later transfer to the applicant company are reliable public instruments executed by two different notaries in the performance of their duties, clearly establishing public, peaceful, and notorious possession for more than 10 years, a period exceeding the statutory term and reflected in those deeds. It adds that the possessory acts (actos de posesión) of the different acquirers were exercised for ten years before the enactment of the law, thereby satisfying the first paragraph of Article 7 of the Ley de Informaciones Posesorias, and that the applicants’ good faith and the consistency of the witnesses’ statements were fully established, thus complying with section 11 of the aforementioned Law.

IV.The first ground of appeal is well founded, because the witness testimony is clear and, since it must be assessed as a whole, is consistent and reveals no contradiction regarding the chain of transferors. That testimony indicates that Mr. [Nombre5] possessed the property by virtue of a transfer from [Nombre3], and that after him came “the Americans,” to whom he transferred possession of the land, as they were identified by witnesses [Nombre7] at folio 75, [Nombre10] at folio 88, and [Nombre6] at folio 73.

V.Regarding the second ground of appeal, this Court considers that Article 7 of the Ley de Informaciones Posesorias requires the exercise of possession consistent with the environmental function performed by protected wild areas (áreas silvestres protegidas), which must be directed toward protecting and conserving the natural resources existing on the land. Those areas, which are important for safeguarding ecosystem balance, have a special purpose that must be protected by the possessors and owners exercising possession over those properties. Protecting flora, fauna, soil, and water resources inevitably entails acts and omissions intended and capable of conserving those resources, thereby limiting the conduct that their possessors and lawful owners may undertake within those lands. They must likewise take the actions necessary for their property to perform the environmental function assigned to it by special legislation.

Consequently, the possessory acts required of these possessors go beyond those that might be required on land having a different purpose and neither intended nor designated to conserve the environment and its ecosystems. These owners and possessors have a duty to safeguard the existing resources or to promote the creation of the resources needed in those areas to fulfill the purposes for which protected wild areas—and, in this case, a protective zone (zona protectora)—were established. The requirements governing the exercise of the requisite possession extend beyond those applicable to property intended for other purposes, such as urban property, among others. The property sought to be registered lies within Zona Protectora Río Toro. This management category (categoría de manejo) was established by Article 32(b) of the Ley Orgánica del Ambiente. That provision does not specifically define it, just as it does not define any of the other categories.

Regarding this statutory gap, it should be noted that Ley Forestal number 4465 of 25 de noviembre de 1969, now repealed, defined a protective zone in Article 83 as follows: “....those areas of forests or forest lands which, established by provisions of law or by decree of the Executive Branch, are designated to protect soils, maintain and regulate the hydrological regime, or act as regulators of the climate or environment.” Subsequently, Ley Forestal 7174 defined it in the same terms quoted above, whereas the current Ley Forestal, number 7575 of 13 de febrero de 1996, refers neither to this management category nor to any of the other categories previously mentioned. An explanation for the absence of a definition of this and the other categories may be found in the statement of the Procuraduría General de la República in opinion (323-C2004): “It is likely that the new Ley Forestal omitted a conceptualization of the management categories by mistake, because, as may be seen in the Minutes of Ordinary Session No. 80 held by the Comisión de Asuntos Agropecuarios y Recursos Naturales at 14:31 hours on 23 de enero de 1996 (Case File No. 11.003, Volume X, folios 3492 and 3493), the definitions were deleted from the proposed statutory text because they had already been included in another bill then under consideration (Ley Ambiental), which ultimately was not enacted as law of the Republic.

In any event, a technical delineation similar to that in Ley No. 7174 appears in Article 35 of the Ley Orgánica del Ambiente, which includes among the objectives of protected wild areas that of ‘protecting and improving aquifer areas and watersheds in order to reduce and prevent the adverse impact that may be caused by their improper management.’” (...) This body further indicates that protective zones embody the public environmental purpose, common to all protected wild areas, of comprehensive ecosystem conservation and protection. This Court further considers that, pursuant to Article 35(e) of the Ley Orgánica del Ambiente, protective zones, as a management category to which a protected wild area may be subject, may be understood to have the specific public environmental purpose of conserving and protecting forest resources in order to conserve and protect soil and water.

VI.In these possessory title proceedings (diligencias de información posesoria), in addition to the statutory requirements, the exercise of possession (posesión) in a manner consistent with the environmental purpose of the property for which title is sought must also be established. In this regard, the witnesses presented to establish possession, [Nombre7], [Nombre10] and [Nombre6], agreed in stating that the acts of possession consisted of clearing undergrowth (chapear) and fencing, and they attested to the existence and maintenance of a green area. (folios 73, 75 and 88). The soil study (estudio de suelos) merely states that the land has been used in accordance with its soil-use capacity (uso conforme de suelos) for the activity conducted there, namely, maintaining a green area of pasture and scrubland (charral). That activity does not, in fact, damage the soil resource or contaminate or degrade it.

The observations section of that study states that the property appears to be used for recreation. The soil study is mandatory among the requirements for title proceedings (diligencias de titulación), as established by Article 58 of the Reglamento a la Ley de Uso, Manejo y Conservación de Suelos, number 29375 of August 8, 2000, which reads: “Article 58.—In any possessory title proceeding filed before the IDA or the Courts of Justice for the purpose of registration in the Public Property Registry, the interested party, in addition to the requirements imposed by the generally applicable regulations, must demonstrate, through an adequate soil study, that possession has been exercised in compliance with the soil use appropriate to the activity conducted, in accordance with the approved methodology, and that such activity has been carried out using best management practices and the best available technology, in compliance with Articles 3, 6, 12, 13, 19, 26, 27, 41, 43 and 64 of Ley Nº 7779 and this Regulation.” The study merely states the foregoing with respect to the soil resource.

However, this Court finds that, although possession has been exercised in accordance with practices for conserving the soil resource, this is insufficient to establish ecological possession (posesión ecológica) consistent with the purposes of the protected wildlife area (área silvestre protegida), under the protective-zone management category (categoría de manejo de zona protectora), in which the property to be titled is located. That technical study does not address the specific issue of the need for the requisite forest cover (cobertura forestal), and it should have considered the environmental variable (variable ambiental) when issuing its opinion, or at least mentioned it. The study shows that, when it was conducted, the property was used as pasture and scrubland, and the existence of the small watercourse (yurro) at [Dirección3] of the property was verified; it also states that the property is located in a montane rain forest life zone.

The submitted survey plan (folio 13), prepared in 2001, describes the land as pasture, and the filing initiating these proceedings (folio 18) declared under oath that the acts of possession consisted of surveillance, clearing undergrowth, and maintenance of the dwelling. This Court concludes that, even if ten years of possession predating the creation of the protective zone is established, such possession was not exercised in accordance with the requirements of Article Seven of the Ley de Informaciones Posesorias concerning the obligation to promote the existence of forest cover in that protective zone, because the property was maintained as pasture and scrubland without any justification being established for that circumstance. This Court agrees with the appealed decision, which must therefore be affirmed. (See, to the same effect, the decision issued at 11:33 a.m. on May 25, 2010, voto 480-F-10, Tribunal Agrario). In view of the foregoing, it is unnecessary to address the final ground for appeal raised in the appeal.

THEREFORE (POR TANTO):

The appealed decision is affirmed.

VOTO Nº836-F-12 TRIBUNAL AGRARIO. SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ.- A las dieciséis horas y cincuenta y cinco minutos del veintinueve de junio de dos mil doce.

INFORMACIÓN POSESORIA promovida por PATTSAN CORPORATION INTERNATIONAL PCI SOCIEDAD ANÓNIMA, cédula jurídica CED1, representada por [Nombre1] , mayor, casada una vez, secretaria, de nacionalidad estadounidense, pasaporte de su país número CED2, y [Nombre2] , mayor, casado una vez, empresario, ciudadano británico, pasaporte de su país número CED3, ambos vecinos de Estados Unidos de América, Miami, Florida, Ford Lauderdale.- Intervienen, la licenciada Lourdes Fernández Mora, mayor, separada, abogada, vecina de Heredia, cédula CED4 - , como apoderada especial judicial de la promovente; la M.Sc. Susana Fallas Cubero, mayor, abogada, vecina de San José, cédula de identidad CED5 ; representante de la Procuradur ía General de la República y la licenciada Carmelina Vargas Hidalgo, mayor, divorciada una vez, Abogada, cédula de identidad CED6 , como Apoderada del Instituto de Desarrollo Agrario. El proceso es tramitado en el Juzgado Civil de Mayor Cuantía del Tercer Circuito Judicial de Alajuela con sede en San Ramón, Agrario por Ministerio de Ley.-

RESULTANDO:

  1. 1La parte promovente plantea proceso de información posesoria con el fin de que se inscriba a su nombre en el Registro Público de la Propiedad la finca que describe así: “Terreno para la pastos con una casa de habitación, situado Alto Palomo, [Dirección1] , Valverde Vega, de la provincia de Alajuela. Linderos: NORTE Orlando Barrantes González, SUR Orlando Barrantes González, [Dirección2] y OESTE Orlando Barrantes González. Según plano catastrado número A-setecientos treinta y cuatro mil ciento ochenta y tres-dos mil uno, a nombre de [Nombre3] , fechado siete de setiembre de dos mil uno, mide de extensión diez mil doscientos cincuenta y cinco metros con noventa y nueve decímetros cuadrados” (folio s 7 a 12, 189 ).-
  2. 2La Procuraduría General de la República, y el Instituto de Desarrollo Agrario se apersonaron al proceso en los términos que corren a folios 42 a 44, 192 a 195, y a folio 67 a 68 respectivamente.-
  3. 3La licenciada Tatiana Rodríguez Herrera, Jueza del Juzgado Civil de Mayor Cuantía del Tercer Circuito Judicial de Alajuela con sede en San Ramón, Agrario por Ministerio de Ley, en sentencia de las quince horas y cincuenta y uno minutos del veinte de octubre de dos mil once, resolvió: "POR TANTO: De acuerdo a lo expuesto y citas de ley, SE IMPRUEBAN las presentes diligencias de información posesoria promovidas por PATTSAN CORPORATION INTERNATIONAL PCI SOCIEDAD ANÓNIMA, cédula jurídica CED1, respecto al terreno descrito en el plano catastrado A-734183-2001.", (folio 199 vuelto).-
  4. 5La parte promovente formuló recurso de apelación con indicación expresa de las razones por las cuales refuta la tesis del juzgado de instancia (folios 200 a 209).-
  5. 6En la substanciación del proceso se han observado las prescripciones legales y no se nota la existencia de errores u omisiones capaces de producir la nulidad del fallo.

Redacta la jueza [Nombre4]

CONSIDERANDO:

I.Se prohíjan los hechos probados por tener sustento en los elementos probatorios constantes en autos. De la misma naturaleza se agrega: 5) La posesión ejercida por el promovente y sus anteriores poseedores ha consistido en destinar el inmueble a la construcción y zona verde (declaraciones testimoniales a folios 73, 75, 88, escrito inicial a folio 18 vuelto, estudio de suelos a folio 172)

II. Se prohíja únicamente el segundo hecho no probado de la resolución

III.La promovente presenta recurso de apelación contra la sentencia de las quince horas y cincuenta y uno minutos del veinte de octubre de dos mil once, con base a los siguientes motivos:

  • 1)Alega, la juzgadora tiene como un hecho no probado, que no se demostró, quien poseyó antes de [Nombre5] , lo cual discrepa, por cuanto la prueba testimonial si hace mención de ello, indicando lo expuesto por los testigos [Nombre6] y [Nombre7] .
  • 2)En cuanto a la posesión ejercida, manifiesta el terreno cumple con la protección del recurso forestal e hídrico, ya que el fin último que se persigue en éstos casos es la conservación del ambiente y las cuencas hidrográficas y en éste caso, tanto el informe de uso de suelo, como el reconocimiento judicial y el informe del [Nombre8] y [Nombre8], no consta bajo ninguna circunstancia que la acción del hombre haya puesto en peligro dichas áreas.
  • 3)Hace un análisis de la cadena de transmisión, de la finca a titular, e indica esta acreditada con la prueba testimonial que rola a folios 73, 75 y 88, siendo errónea la apreciación de que no hay congruencia en los documentos de traspaso, por cuanto la escritura donde adquiere el señor [Nombre5], luego donde adquiere [Nombre9] y posteriormente, le transmiten a la sociedad promovente son documentos públicos fehacientes otorgados por dos notarios diferentes en el desempeño de sus funciones, donde consta claramente la posesión, pública, pacífica y notoria por más de 10 años, plazo que supera el de ley y se deja ver en dichas escrituras. Agrega que los actos de posesión de los diferentes adquirentes han sido ejercidos por diez años anterior a la creación de la ley, cumpliendo ello con o que establece el primer párrafo del artículo 7 de la Ley de Informaciones Posesorias, quedando plenamente demostrada la buena fe de los proponentes y la coherencia en las manifestaciones de los testigos, cumpliendo con lo establecido con el numeral 11 de la Ley supra citada.

IV.Lleva razón en cuanto al primer agravio, por cuanto la prueba testimonial, es clara y siendo que debe ser valorada en conjunto, guardando coherencia sin que se aprecie contradicción alguna en cuanto a la cadena de transmitentes. La misma indica que el señor [Nombre5] fue poseedor del bien, por transmisión que le hiciera [Nombre3] y posterior a él se encuentran "los americanos", a los cuales transmitió la posesión del terreno, como los identificaron los testigos [Nombre7] a folio 75, [Nombre10] a folio 88 y [Nombre6] a folio 73.

V.En cuanto al segundo agravio. Considera esta Instancia que el artículo sétimo de la Ley de Informaciones Posesorias, exige el ejercicio de una posesión acorde con la función ambiental que cumplen las áreas silvestres protegidas, el cual debe estar encaminado a la protección y conservación de los recursos naturales existentes en los terrenos. Esas zona de importancia para el resguardo del equilibrio ecosistémico, tienen una finalidad especial, que debe ser resguardada por los poseedores y propietarios que ejercen posesión sobre esos fundos. La protección de los recursos de flora, fauna, suelo y recurso hídrico, conducen inevitablemente al despliegue de conductas de acción y omisión que pretendan y logren la conservación de los recursos, que limitan a sus poseedores y dueños legítimos las conductas que puedan desplegar dentro de esos terrenos. Igualmente, deberán ejecutar aquellas acciones necesarias para que su fundo cumpla la función ambiental encomendada por legislación especial.

Es por ello, que los actos de posesión exigidos a estos poseedores, van más allá, de los que podrían ser requeridos en un terreno cuya finalidad sea diversa y que no pretenda o tenga como función la conservación del ambiente y sus ecosistemas. Es deber de estos propietarios y poseedores, el resguardo de los recursos existentes, o bien procurar la generación de los recursos que en esas zonas sean necesarios para cumplir con los fines de creación de las áreas silvestres protegidas, y en este caso de una zona protectora. Las exigencias en el ejercicio de la posesión requerida, trasciende las que se exigiera en una propiedad destinada a otros fines, tales como la propiedad urbana, entre otras. La propiedad que pretende inscribirse esta inmersa en la Zona Protectora Río Toro. Esta categoría de manejo se encuentra creada en el inciso b) del artículo 32 de la Ley Orgánica del Ambiente. Dicha norma no la define en forma específica, al igual que a ninguna de las otras categorías.

Sobre esta laguna legal, debe mencionarse que la Ley Forestal número 4465 del 25 de noviembre de 1969, ya derogada, definió a la zona protectora en el artículo 83 como sigue: “....aquellas áreas de bosques o terrenos forestales que, establecidas por disposiciones de la ley o por decreto del Poder Ejecutivo, sean destinadas a proteger los suelos, mantener y regular el régimen hidrológico, o actúen como agentes reguladores del clima o medio ambiente. “Posteriormente, la Ley Forestal 7174 la definió en los mismos términos citados, mientras que la Ley Forestal vigente número 7575 del 13 de febrero de 1996 , no hace referencia, ni a esta categoría de manejo, ni a ninguna otra de las anteriormente citadas. Sobre el motivo de la ausencia de una definición para esta categoría y las demás, es posible encontrarla en lo enunciado por la Procuraduría General de la República, cuando indica en el dictamen (323-C2004): “Es probable que en la nueva Ley Forestal no se incluyera una conceptualización de las categorías de manejo por error, ya que, como puede verse en el Acta de la Sesión Ordinaria No. 80 celebrada por la Comisión de Asuntos Agropecuarios y Recursos Naturales, a las 14:31 horas del 23 de enero de 1996 (Expediente No. 11.003, Tomo X, folios 3492 y 3493), de la propuesta de texto legal se eliminaron las definiciones porque ya estaban incluidas en otro proyecto que se estaba tramitando en ese momento (Ley Ambiental), que en última instancia no llegó a ser ley de la República.

De todas formas, una delimitación técnica parecida a la de la Ley No. 7174 la encontramos presente en el artículo 35 de la Ley Orgánica del Ambiente, que estipula entre los objetivos de las áreas silvestres protegidas el de “proteger y mejorar las zonas acuíferas y las cuencas hidrográficas, para reducir y evitar el impacto negativo que puede ocasionar su mal manejo”.”(...) Sigue indicando este órgano que las zonas protectoras contienen el fin público ambiental de todas las áreas silvestres protegidas de conservación y protección integral de los ecosistemas. Estima además esta Instancia, que en aplicación del numeral 35 inciso e) de la Ley Orgánica del Ambiente, es posible sostener que las zonas protectoras, como categoría de manejo a que puede estar sometida un área silvestre protegida, tienen como fin público ambiental específico, la conservación y protección de los recursos forestales con el objetivo de conservar y proteger el suelo y el agua.

VI.En estas diligencias de información posesoria, deben acreditarse además de los requisitos del Ley, el ejercicio de la posesión acorde con el fin ambiental que contiene el fundo que pretende ser titulado. Al respecto, los testigos aportados para la acreditación de la posesión [Nombre7] , [Nombre10] y [Nombre6] , fueron contestes en manifestar que los actos de posesión han sido chapear y cercar, acreditaron la existencia de zona verde y mantenimiento . (folio 73, 75 y 88). El estudio de suelos se limita a indicar que se ha ejercido el uso conforme de suelos para la actividad que realiza, es decir, la actividad de tener una zona verde de pasto y charral. Efectivamente esa actividad, no lesiona el recurso suelo, ni contamina o desmejora. Y se indica en la sección de observaciones de dicho estudio, que parece ser utilizado para el esparcimiento. El estudio de suelos se hace obligatorio dentro de los requisitos de las diligencias de titulación, por establecerlo el artículo 58 del Reglamento a la Ley de Uso, Manejo y Conservación de Suelos, número 29375 del 8 de agosto del 2000, que reza: "Artículo 58. -En toda información posesoria o que se presente ante el IDA o ante los Tribunales de Justicia, con el fin de inscribir en el Registro Público de la Propiedad, el interesado, además de los requisitos que exige la normativa común, deberá de demostrar, con un estudio adecuado de suelos, que ha ejercido la posesión cumpliendo con el uso conforme del suelo para la actividad que realiza de acuerdo con la metodología aprobada, y ejecutándolas con las mejores prácticas de su manejo, según la mejor tecnología disponible en cumplimiento con lo dispuesto en los artículos 3, 6, 12, 13, 19, 26, 27, 41, 43 y 64 de la Ley Nº 7779 y este Reglamento.".

El estudio se limita a indicar lo citado con respecto al recurso suelo. Sin embargo, estima esta Sede, que si bien se ha ejercido la posesión conforme a prácticas de conservación del recurso suelo, este no es suficiente para acreditar una posesión ecológica acorde con los fines del área silvestre protegida, bajo la categoría de manejo de zona protectora, en que esta inmersa la propiedad a titular. Dicho estudio técnico no se introduce con ese tema particular de la necesidad de la cobertura forestal necesaria, y debió considerar la variable ambiental al momento de emitir su criterio, o al menos ser nombrado. Del estudio se extrae, que en el momento de hacer el estudio, el fundo estaba dedicado a pasto y charral y se constató la existencia del yurro en el [Dirección3] del inmueble , además de mencionar que el inmueble esta ubicado en una zona de vida de bosque pluvial montano. El plano aportado (folio 13) levantado en el año 2001, describe que el terreno es de pasto, y en el escrito de las diligencias (folio 18) se declaró bajo juramento, que los actos posesorios han consistido en vigilancia, chapeo y mantenimiento de la casa de habitación.

Concluye esta Sede, que aunque se acredite una posesión decenal anterior a la creación de la zona protectora, ésta no ha sido ejercida acorde con las exigencias del numeral sétimo de la Ley de Informaciones Posesorias en relación con su obligación de promover la existencia de cobertura forestal, en esa zona protectora y tenerlo como zona de pastos y charrales sin acreditar la justificación de ese hecho. Coincide esta Sede, con la resolución apelada , por lo que deberá proceder a confirmarse. (En este mismo sentido véase la resolución de las 11 horas 33 minutos del 25 de mayo de 2010, voto 480-F-10, Tribunal Agrario). Por lo expuesto, se hace innecesario, entrar a resolver el último agravio expuesto en el recurso.

POR TANTO:
