  1. 1The petitioners brought a possessory information proceeding so that the following property may be registered in their names in equal shares with the Registro Público de la Propiedad: “Land consisting of pasture, brushland, and forest, with a house, located in Miramar, [Dirección1]: , : Osa, Provincia de Puntarenas, which, according to attached cadastral plan No. P-1141577-2007, has a total area of

at fourteen hours on January twenty-nine, two thousand thirteen, ruled:³ twenty-four hectares, four thousand two hundred seventy-nine square meters and ten square decimeters, whose current and true boundaries are: North: Other property belonging to both petitioners and [Nombre4]; South: Quebrada Sábalo, with property belonging to the petitioners in between. East: [Dirección2], with sixty-three meters and forty-four linear centimeters of frontage thereon, and property belonging to the petitioners, and in part with a creek in between. possessory information is approved, without prejudice to third parties having superior rights, and the Registrar of the Registro de la Propiedad is ordered to register, for the first time, in the names of [Nombre2], identity card CED6 - -, married, farmer, resident of Hatillo de Aguirre, and [Nombre1], identity card CED7 - -, divorced once, farmer, resident of Hatillo de Aguirre, the property described in the plan registered with the Catastro Nacional under number P-1141577-2007, described as follows: Land consisting of pasture, brushland, and forest, with a house, located in Miramar, [Dirección3]: , [Dirección4]: Osa, Provincia de Puntarenas, which, according to attached cadastral plan No. P-1141577-2007, has a total area of twenty-four hectares, four thousand two hundred seventy-nine square meters and ten square decimeters, whose current and true boundaries are: North: Other property belonging to both petitioners and [Nombre4]; South: Quebrada Sábalo, with property belonging to the petitioners in between.

East: Calle [Dirección5], with sixty-three meters and forty-four linear centimeters of frontage thereon, and property belonging to the petitioners, and in part with a creek in between. West: Calle [Dirección5], with one hundred fifty-two meters and forty-four linear centimeters of frontage thereon, [Nombre5], and in which she refutes the trial court’s position (folio part with a creek in between. The property that is the subject of these proceedings is valued at five million colones. RESERVATIONS AND RESTRICTIONS: In addition to those described in Articles 16, 17, and 19 of the Ley de Informaciones Posesoria and the provisions of Ley de Aguas Nº 276 del 27 de agosto de 1942. The property whose registration arises from this possessory information is subject to preserving the area adjacent to the creek as a protection area (área de protección), pursuant to Article 33(b) of Ley Forestal Nº7575, and cutting or removing trees is prohibited.

Likewise, the channel and waters of that watercourse are in the public domain (dominio público). The surface water and groundwater on the property are in the public domain of the State and do not form part of the property. The public streets adjoining the parcel to be titled along [Dirección6] are public streets and have a right-of-way (derecho de vía) fourteen meters wide.” (emphasis in the original text at folio 132)

CONSIDERING

I. This Tribunal agrees with the list of facts found proven, as it faithfully reflects what occurred in the case file

II. In challenged judgment Nº 13-2013, issued at 14 hours on January 29,

December 2013 (folios 130 to 132), the possessory information was approved and registration was ordered for the property described in plan P-1141577-2007, subject to the limitations established by the Ley de Caminos Públicos, Ley de Aguas, and Ley Forestal. The Procuraduría General de la República (PGR) appeals (folios 158 to 164) on the ground that the land to be titled is forested in nature (mountain forest). It contends that, because such lands are located within national reserves, they have formed part of the State Natural Heritage (Patrimonio Natural del Estado) since Ley Forestal 4465 de 1969 (Article 33), as amended by Ley Forestal 7174 de 1990 (Articles 32 and 33), and that Ley 7575 (Articles 13 and 14) maintains their public-domain status (carácter demanial). It argues that the Law permits properties outside protected wilderness areas (áreas silvestres protegidas) to be titled if the petitioning party proves lawful rights arising from ten years of possession (legítimos derechos de posesión decenal), together with the other conditions required for that purpose, such as having protected the resource and having the property duly demarcated.

However, according to the PGR, titling is possible only if acquisitive prescription (usucapión) was completed before the lands became part of the State Natural Heritage. It maintains that the witnesses’ testimony did not establish ten years of possession sufficient for acquisitive prescription by the petitioning party. In support, it cites decisions [Telf1], 15753-2005, [Telf2], and 783-2003 of the Sala Constitucional, as well as other judicial precedents and opinions issued by the PGR itself (opinions C-321-2003 and C-146-2008), which essentially concern: i) the survival of repealed law to govern legal situations that arose under it, with respect to protecting the public forest-domain right established by prior legislation against retroactive applications detrimental to it, and binding case law of the Sala Constitucional establishing the need to prove ten years of possession sufficient for acquisitive prescription; ii) the prohibition against private parties exercising possession as owners (posesión con ánimo de dueños) over public-domain property, because the inalienability of such property precludes its transfer and private possession; iii) the inadmissibility of acquisitive prescription and titling against the public domain; iv) the principle of inalienability, because such property is withdrawn from private commerce; v) property not capable of being acquired through possession; and vi) the non-prescriptibility of such property as a direct consequence of the principle of inalienability, because, since it cannot be subject to possession or private ownership, it is legally impossible to acquire it by prescription.

All these arguments seek to establish that, because forests are public-domain property, they cannot be possessed by private parties or acquired by prescription. Because the petitioners seek title to public-domain property, namely the State Natural Heritage and public roads, it requests that these proceedings be denied pursuant to Article 11 of the Ley de Informaciones Posesorias and Articles 13 and 14 of the Ley Forestal.

III.The appellant attorney’s claim is not well-founded. With respect to the objection that the witnesses’ testimony did not establish the petitioning party’s ten years of possession, it should be emphasized that [Nombre6], [Nombre7], and [Nombre8] (folios 91 to 95) confirmed that the petitioner had possessed the property

subject to titling for approximately seven years, but that the first witness had known the property for more than forty-five years, the second for thirty-seven years, and the third for thirty years, in the order cited. Therefore, contrary to the appellant’s assertion, the testimony received does provide grounds for finding that the petitioner’s ten years of possession was duly established. In addition, the initial pleading states that [Nombre1] purchased it from [Nombre3] in March 2005, and that [Nombre3] transferred to him more than ten years of possession. [Nombre1] then donated a one-half interest to his son, [Nombre2], on September 24, 2007. Regarding the Procuraduría’s opposition to titling forested areas, it must be borne in mind that persons have the right to register land with such forest cover (cobertura boscosa), whether inside or outside protected wilderness areas, provided that they meet all the statutory requirements imposed by the various applicable bodies of law (see, in this regard, decision 51 of May 26, 1995, issued by the Sala Primera de la Corte Suprema de Justicia).

In view of the appellant’s arguments, it is important to clarify that the State Natural Heritage is “composed of the forests and forest lands of national reserves, areas declared inalienable, properties registered in its name, and those belonging to municipalities, autonomous institutions, and other agencies of the Administración Pública, except for properties securing credit transactions with the Sistema Bancario Nacional that become part of its assets” (Article 13 of the Ley Forestal). Such forest lands and forests are indeed exempt from attachment and inalienable (Article 14 of that Law). Possession thereof by private parties grants them no rights whatsoever, and the State’s action to recover such lands (acción reivindicatoria) is not subject to prescription. Consequently, they cannot be registered in the Registro Público through possessory information (Article 33). Article 7 of the Ley de Informaciones Posesorias, in turn, permits the titling of forested areas, requiring as specific conditions—additional to the general conditions of the Ley de Informaciones Posesorias—proof of lawful rights arising from ten years of possession, protection of the natural resource, and that the property be duly demarcated and enclosed by fences or cleared boundary paths.

Accordingly, it must be concluded that the cited Article 7 addresses two different situations: a) The possibility of titling lands located within protected wilderness areas. In such cases, the provision permits titling provided that and when the property right (derecho de propiedad) was consolidated at least ten years before the designation of the protected wildlife area (área silvestre protegida), since such lands form part of the public domain (dominio público). b) The possibility of obtaining title (titular) to land located outside protected wildlife areas and containing forests. In this situation, the provision requires only that the petitioner prove that he or she “holds the legal rights arising from ten-year possession (posesión decenal), exercised for at least ten years, and has protected that natural resource, with the understanding that the property must be duly demarcated and enclosed by fences or cleared boundary lines.” Unlike the requirements applicable to protected wildlife areas, it does not specify that possession must have begun ten years before the designation of the State Forest Heritage (patrimonio forestal del Estado), first established by the repealed Ley Forestal N°4465.

This is understandable, since otherwise what the legislature permitted in this regard would be self-contradictory. In other words, if its intention had been to prohibit the titling (titulación) of those forested areas after the enactment of the 1969 Ley Forestal (which contains the first designation of the State Forest Heritage), the proper course would have been not to include or permit that second situation. But, as analyzed, the legislature has maintained a different position. Consequently, contrary to the position maintained by the Procuraduría General de la República, it must be concluded that Article Seven of the Ley de Informaciones Posesorias (as amended upon enactment of the current Ley Forestal 7575) expressly authorized the titling of forested real property through this type of proceeding.

IV.Regarding the application and interpretation of the aforementioned Article 7 of the Ley de Informaciones Posesorias, this Court has emphasized: “The constitutionality of that provision and of the interpretation once given to it by this Court was challenged on constitutional grounds, resulting in the issuance of Sala Constitucional decision 4587-97, specifically cited by the appellant. In that decision, the Sala upheld the constitutionality of the provision, leaving it in force. Under those circumstances, the appropriate course in this case is to affirm the ruling of the trial judge, because the petitioner established compliance with the requirements set forth in that article, namely: ten-year possession, protection of the natural resource, and demarcation of the property by means of fences or cleared boundary lines” (Voto 573-F-09). Likewise, the Sala Constitucional again rejected the constitutional review referral (consulta de inconstitucionalidad) concerning Article Seven of the Ley de Informaciones Posesorias submitted by this Court in expediente EXPN1, and that provision and its effects therefore remain in force.

V. In accordance with the foregoing, the appealed judgment must be affirmed as to the matters challenged on appeal

POR TANTO

As to the matters challenged on appeal, the judgment is affirmed.

RESULTANDO:

horas del veintinueve de enero de dosmil trece, resolvió:³ veinticuatro hectáreas cuatro mil doscientos setenta y nueve metros con diez decímetros cuadrados, cuyos linderos actuales y verdaderos son: Norte: Con otra propiedad de ambos promoventes y [Nombre4] , Sur: Quebrada Sábalo y en medio propiedad de los promoventes. Este: [Dirección2] con un frente lineal a ella de sesenta y tres con cuarenta y cuatro centímetros lineales y con propiedad de los promoventes, y en parte con quebrada en medio. Oeste: [Dirección2] con un frente lineal a ella de ciento cincuenta y dos metros con cuarenta y cuatro centímetros lineales, con [Nombre5] y en parte con quebrada en medio." (folio 37, 130 vuelto)

Oeste: Calle [Dirección5] con un frente lineal a ella de ciento cincuenta y dos metros con cuarenta y cuatro centímetros lineales, con [Nombre5] y en cuales refutala tesis del Juzgado de instancia (folio parte con quebrada en medio. El inmueble objeto de estas diligencias se estima en la suma de cinco millones de colones. RESERVAS Y RESTRICCIONES : Además de las descritas en los artículos 16, 17 y 19 de la Ley de Informaciones Posesoria y las disposiciones de la Ley de Aguas Nº 276 del 27 de agosto de 1942. La finca a cuya inscripción registral da origen a la presente información, esta sujeta a respetar, el área contigua a la quebrada como área de protección, según el artículo 33 inciso b), de la Ley Forestal Nº7575 y queda prohibida la corta o eliminación de árboles.

Asimismo el cause y las aguas de esa corriente son de dominio público. Las aguas superficiales y subterráneas en el inmueble, son de dominio público estatal y no forman parte de la finca. Las calles públicas que colindan por los [Dirección6] con el predio a titular es calle publica y tiene un derecho de vía de catorce metros de ancho." (lo destacado es del texto original a folio 132)

  1. 4La licenciada Lydiana Rodríguez Paniagua, en su condición de Procuradora Adjunta, formuló recurso de apelación con indicación expresa de las razones por las s 158 a 164).
  2. 5En la substanciación del proceso se han observado las prescripciones legales, y no se nota la existencia de errores u omisiones en el fallo capaces de producir su nulidad.

Redacta el juez Darcia Carranza y,

CONSIDERANDO

I. Este Tribunal comparte el elenco de hechos tenidos por probados al ser fiel reflejo de lo acaecido en autos

II. En la sentencia impugnada Nº 13-2013 de las 14 horas del 29 de enero de

diciembre del 2013 (folios 130 a 132), se aprobó la información posesoria y se ordenó inscribir el inmueble descrito en el plano P-1141577-2007, con las limitaciones que establece la Ley de Caminos Públicos, Ley de Aguas y Ley Forestal. La Procuraduría General de la República (PGR) apela (folios 158 a 164) con base en ser el terreno a titular de naturaleza boscosa (montaña). Considera que esos terrenos, por ubicarse en reservas nacionales, forman parte del Patrimonio Natural del Estado, desde la Ley Forestal 4465 de 1969 (artículo 33), reformada por la Ley Forestal 7174 de 1990 (artículos 32 y 33) y su carácter demanial lo mantiene la Ley 7575 (artículos 13 y 14). Argumenta, la Ley permite titular inmuebles fuera de las áreas silvestres protegidas si la parte promovente demuestra sus legítimos derechos de posesión decenal, con las demás condiciones exigidas al efecto, como haber protegido el recurso y tener el inmueble debidamente deslindado.

Pero para la PGR solo es posible titular si la usucapión se consolidó antes de que los terrenos formasen parte del Patrimonio Natural del Estado. Sostiene, con la declaración de los testigos, no se demostró la posesión decenal apta para usucapir en cabeza de la parte promovente. Cita en su apoyo los votos [Telf1], 15753-2005, [Telf2], 783-2003 de la Sala Constitucional, también otros precedentes jurisprudenciales y pronunciamientos emitidos por la misma PGR (dictámenes C-321-2003 y C-146-2008), que en lo medular se refieren a: i) la supervivencia del derecho derogado para regular las situaciones jurídicas que nacieron a su abrigo, en lo que respecta a la protección del derecho de dominio público forestal establecido por la legislación anterior contra aplicaciones retroactivas en su perjuicio y jurisprudencia vinculante de la Sala Constitucional que establece la necesidad de demostrar una posesión decenal apta para usucapir. ii) el impedimento de los particulares de ejercer la posesión con ánimo de dueños sobre los bienes de dominio público, dado que la inalienabilidad de tales imposibilita su traspaso y posesión privada. iii) la improcedencia de la usucapión y titulación contra el dominio público. iv) el principio de la inalienabilidad, por cuanto esos bienes se substraen del comercio de los hombres. v) los bienes no susceptibles de adquirirse por posesión. vi) la imprescriptibilidad de tales bienes como consecuencia directa del principio de inalienabilidad, pues al no ser objeto de posesión ni de dominio privado, existe imposibilidad jurídica para usucapirlos.

Todos esos alegatos giran en torno a argumentar que al ser los bosques bienes de dominio público, no son susceptibles de ser poseídos por particulares ni adquiridos por usucapión. Al pretenderse titular bienes de dominio público, como lo es el patrimonio natural del Estado y las vías públicas, solicita la improbación de estas diligencias, conforme a los artículos 11 de la Ley de Informaciones Posesorias, 13 y 14 de la Ley Forestal.

III.Lo reclamado por la procuradora recurrente no es de recibo. Con respecto a lo objetado en cuanto a que con la declaración de los testigos no se demostró la posesión decenal de la parte promovente, debe resaltarse que [Nombre6] , [Nombre7] y [Nombre8] (folios 91 a 95), confirmaron que la finca

objeto de titulación la poseía el promovente desde hace unos siete años, pero que conocen la finca desde hace más de cuarenta y cinco años el primero, treinta y siete años el segundo y treinta años el tercero según el orden citado. Por ende, de la testimonial evacuada, contrario a lo que afirma la recurrente, si se desprenden elementos para tener por debidamente demostrada la posesión decenal del promovente. Además, en el escrito inicial, se afirma que fue comprada por [Nombre1] en marzo de 2005, a [Nombre3] , quien le transmitió más de diez años de posesión. Luego [Nombre1] le donó un derecho a la mitad a a su hijo [Nombre2] en fecha 24 de setiembre de 2007. En relación con la oposición de la Procuraduría para titular zonas boscosas, debe tenerse presente que las personas gozan del derecho de inscribir terrenos con dicha cobertura, dentro o fuera de áreas silvestres protegidas, siempre y cuando cumplan todos los requisitos legales exigidos en los diversos cuerpos normativos aplicables (consúltese al respecto el voto 51 del 26 de mayo de 1995 de la Sala Primera de la Corte Suprema de Justicia).

Dado lo argumentado por la parte recurrente, es importante aclarar que el Patrimonio natural del Estado esta "constituido por los bosques y terrenos forestales de las reservas nacionales, de las áreas declaradas inalienables, de las fincas inscritas a su nombre y de las pertenecientes a municipalidades, instituciones autónomas y demás organismos de la Administración Pública, excepto inmuebles que garanticen operaciones crediticias con el Sistema Bancario Nacional e ingresen a formar parte de su patrimonio " (artículo 13 de la Ley Forestal). Dichos terrenos forestales y bosques son efectivamente inembargables e inalienables (artículo 14 de dicha Ley). Su posesión por los particulares no les otorga derecho alguno y la acción reivindicatoria del Estado por estos terrenos es imprescriptible. En consecuencia, no son susceptibles de inscripción en el Registro Público mediante información posesoria (artículo 33).

Por su parte, el artículo 7 de la Ley de Informaciones Posesorias, permite la titulación de zonas boscosas, exigiendo como requisitos específicos (adicionales a los generales de la Ley de Informaciones Posesorias) demostrar los derechos legales de posesión decenal, haber protegido el recurso natural y que el inmueble esté debidamente deslindado y con cercas o carriles limpios. De esta forma, debe concluirse que el artículo 7 citado, contempla dos situaciones diferentes: a) La posibilidad de titular terrenos comprendidos dentro de áreas silvestres protegidas. En estos casos, la norma permite se titule siempre y cuando se haya consolidado el derecho de propiedad al menos diez años antes de la declaratoria de área silvestre protegida, pues tales forman parte del dominio público. b) La posibilidad de titular terrenos fuera de áreas silvestres protegidas y que tengan bosques. En este supuesto, la norma exige únicamente que el promovente demuestre "ser el titular de los derechos legales de posesión decenal, ejercida por lo menos durante diez años y haber protegido ese recurso natural,en el entendido de que el inmueble tendrá que estar debidamente deslindado y con cercas o carriles limpios".

No se especifica, como sucede con las áreas silvestres protegidas, que la posesión deba ser anterior a diez años antes de la declaratoria de patrimonio forestal del Estado, realizada por vez primera en la derogada Ley Forestal N°4465. Ello es entendible, pues si no sería un contrasentido lo permitido por el legislador al respecto. Es decir, si su intención hubiese sido no permitir la titulación de esas zonas boscosas luego de promulgarse la Ley Forestal de 1969 (que contiene la primera declaratoria de patrimonio forestal del Estado), lo correcto hubiese sido no incluir o no permitir ese segundo supuesto. Pero como se analizó, el legislador ha mantenido una posición diferente. Por consiguiente, debe concluirse, a diferencia de la posición que mantiene la Procuraduría General de la República que el artículo sétimo de la Ley de Informaciones Posesorias (modificado al emitirse la vigente Ley Forestal 7575), autorizó en forma expresa la titulación de bienes inmuebles boscosos mediante este tipo de proceso.

IV.Sobre la aplicación e interpretación del citado numeral 7 de la Ley de Informaciones Posesorias este Tribunal ha destacado: "La constitucionalidad de dicha norma y de la interpretación dada en algún momento por este Tribunal fue cuestionada de constitucionalidad, gestión que generó la emisión del voto de la Sala Constitucional 4587-97, precisamente citado por la recurrente. En dicho voto la Sala declaró la constitucionalidad de la norma, manteniendo su vigencia. Ante tal situación, lo procedente en este caso es confirmar lo resuelto por el Juzgador, al haber acreditado el promovente el cumplimiento de los requisitos que dispone ese artículo, a saber: la posesión decenal, protección del recurso natural y delimitación del inmueble mediante cercas o carriles limpios" (Voto 573-F-09). De igual forma, la Sala Constitucional rechazó nuevamente la consulta de inconstitucionalidad contra el artículo sétimo de la Ley de Informaciones Posesorias realizada por este Tribunal, en el expediente EXPN1, quedando

vigente tal norma y sus efectos.

V. De conformidad con lo expuesto, procede confirmar la sentencia recurrida en lo que fue objeto de apelación

POR TANTO

En lo que ha sido objeto de apelación, se confirma la sentencia.
