BACKGROUND:

  1. 1The petitioner instituted a possessory title proceeding so that the following property would be registered in his name in the Public Property Registry: “...Pastureland located at [Dirección1], Liberia, in the province of Guanacaste.

Boundaries: NORTH: [Dirección2], [Dirección3] lines thirty meters wide, Star Brigde Sociedad Anónima, [Nombre2]; SOUTH: [Nombre3]; EAST: [Nombre4]; WEST: [Nombre2], [Nombre5], [Nombre6]. According to cadastral plan (plano catastrado) number G- one million two hundred fifty-seven thousand five hundred thirty-four - two thousand eight, dated May twenty-seven, two thousand eight, in the name of [Nombre1], it has an area of eighteen thousand seventy-five square meters and one square decimeter...”. (folios 16, 24, and reverse of 159).

  1. 2The Procuraduría General de la República entered an appearance in the proceeding (folios 34 to 38); the Instituto de Desarrollo Agrario, now the Instituto de Desarrollo Rural, also appeared (folio 55), without opposing the petition.-
  2. 3Judge Rodrigo Valverde Umaña of the Agrarian Court of the First Judicial Circuit of Guanacaste, Liberia, ruled as follows in judgment number 65-S-2013, issued at eleven a.m. on March four, two thousand thirteen: “THEREFORE: This POSSESSORY TITLE PROCEEDING is APPROVED. The PUBLIC PROPERTY REGISTRY shall register, free of encumbrances but subject to the restrictions contained in Articles 1 and 9 of the Law on Possessory Title Proceedings (sic); Article 4 of the General Law on Public Roads; Articles 33 and 34 of Ley Forestal 7575 of February 13, 1996; and Article 1 of the Law of Rights (sic), without prejudice to third parties with superior rights,

in the name of [Nombre1], of legal age, married once, resident of Liberia, [Dirección4], , , (sic), the real property described as follows: Pastureland located in La Zanjita, [Dirección5], Liberia, in the province of Guanacaste. Boundaries: NORTH: [Dirección6], along fifteen meters and seventy centimeters of lines thirty meters wide, Star Brigde S.A. (sic), [Nombre2]; SOUTH: [Nombre3]; EAST: [Nombre4]; WEST: [Nombre2], [Nombre5], [Nombre6]. According to cadastral plan number G- one million two hundred fifty-seven thousand five hundred thirty-four - two thousand eight, dated May twenty-seven, two thousand eight, in the name of [Nombre1], it has an area of eighteen thousand seventy-five square meters and one square decimeter. An unnamed creek crosses it from east to west. Acts of possession (actos posesorios) have been exercised over the property in compliance with its permitted land use (uso conforme del suelo).

In view of the condition of the roads running in front of the property registered through this proceeding, it shall be subject to the reservations established by the General Law on Public Roads, insofar as the minimum width of highways is twenty meters and that of local roads is fourteen meters. The title applicant must also refrain from cutting down or removing trees within the protection area (área de protección) of the unnamed creek, its channel and its surface or temporary watercourses being in the public domain (dominio público). The surface water and groundwater existing on the property are likewise in the public domain and do not form part of the property” (front and reverse of folio 159).-

  1. 4Attorney Lydiana Rodríguez Paniagua, in her capacity as Deputy Attorney General, filed an appeal, expressly stating the reasons for challenging the Court’s position (folios 160 to 164).

5. The statutory requirements were not observed in the conduct of the proceeding, and the judgment contains errors or omissions capable of rendering it null and void.

Drafted by Judge ALPÍZAR RODRÍGUEZ; and, CONSIDERING:

I.In view of the manner in which this matter will be decided, no ruling is made regarding the facts deemed proven. Instead, the following fact relevant to deciding the appeal is deemed proven: 1) According to the plan forming the basis of the proceeding, P-one million two hundred fifty-seven thousand five hundred thirty-four-two thousand eight, the land for which title is sought

includes an area—whose measurements have not been specified—located within the two hundred meters surrounding [Dirección7], administered by the ASADA of La Zanjita, Los Lagos y Buenos Aires de Bagaces (see official communications SUB-G-AIC-UEN-AMB-2011-700 of April 29, 2011, from the Departamento de Cuencas Hidrográficas of the ICAA, and SUB-G-AID-UEN-AMB-2011-1525 of August 23, 2011, from the Area Funcional de Cuencas Hidrográficas of the ICCA: folios 92 and 98, 100 to 105, 112, 115).-

II. The following facts relevant to deciding the appeal at this level are deemed unproven: 1) That the competent department

of the Instituto Costarricense de Acueductos y Alcantarillados (ICAA) specified the area to be excluded from the land described in plan one million two hundred fifty-seven thousand five hundred thirty-four-two thousand eight, based on the protection area surrounding well No. 1 administered by the ASADA of La Zanjita, Los Lagos y Buenos Aires de Bagaces. 2) That the ASADA of La Zanjita, Los Lagos y Buenos Aires de Bagaces has a specific technical study determining the corresponding protection zone (zona de protección) for that well. 3) That Mr. [Nombre7] held the legal representation of the aforementioned ASADA in September two thousand eleven.-

III. In the challenged judgment 65-S-2013 of March 4, 2013

(folio 158), the possessory title proceeding was approved and registration was ordered for the property described in plan P-1257534-2008, subject to the restrictions established by the Water Law and the Law on Public Roads. The Procuraduría General de la República, abbreviated PGR, appeals and seeks annulment of the judgment on the following grounds: 1) It argues that it was not notified of the opinion of the surveying professional (official communication AZLB 05-2012) who was to prepare a plan of the protected area for the ASADA of La Zanjita, Los Lagos y Buenos Aires (Article 24 of that entity’s Organic Law). 2) It alleges that the ICCA issued technical opinions (SUB-G-AIC-UEN-AMB-2011-700 and SUB-G-AID-UEN-AMB-2011-1525) stating that the land described in the referenced plan encompasses the 200-meter statutory protection area established by Article 31 of the Water Law due to the presence of well No. 1, administered by the ASADA of La Zanjita, Los Lagos y Buenos Aires de Bagaces, affecting a total of 12.56 hectares.

This is pursuant to Article 7, subsection c), of the Land and Colonization Law, Article 2 of the Regulations to Ley Forestal, and Articles 32 and 33 of the Water Law. It contends that the petitioner should not be permitted to register the land because doing so would incorporate into it the strip within a 200-meter radius of the well, which is in the public domain. Because such property is dedicated to a public purpose, it cannot be subject to possession (referring to decisions 480-90, 1055-92, and others, without identifying the issuing court). It emphasizes that the Sala Constitucional, in decisions 1923-2004 and 18051-2006, noted the dedication to the public domain (afectación al dominio público) or public-domain reservation (reserva demanial) established in Article 31 of Water Law No. 276 of August 27, 1942. Regarding Article 7 of the Land and Colonization Law, which retains a provision originating in earlier laws, it cites the Sala Primera as having held that water-related reservations entail a prohibition against possessing land for registration in the Public Registry through this type of proceeding (decision 51-1995).

It also cites decisions of this Court in which, it says, the exclusion of public-domain areas was ordered pursuant to the aforementioned Article 7 (decisions 595-2004 and 1025-2005). It further emphasizes that the General Potable Water Law, No. 1634 of September 18, 1953, provides in Article 2 that all lands deemed indispensable for constructing or locating potable-water supply systems are in the public domain. It explains that determining which areas fall within this category is currently the responsibility of the Instituto Costarricense de Acueductos y Alcantarillados (ICAA) (Article 2 of Law 2726 and Sala Constitucional decisions 1923-2004 and 18051-2006). The Constitutive Law of the ICCA, No. 2726, also recognizes in Article 18 as national patrimony (patrimonio nacional) the lands of State agencies used to provide services for the collection, treatment, and distribution of potable water and for the disposal of wastewater and stormwater.

It states that this property was declared to be in the public domain, inalienable (inalienable) and not subject to acquisitive prescription (imprescriptible), in Sala Constitucional decisions [Telf1], 10466-2000, and 38219-2002. Article 11 of the Regulations governing Community Water and Sewer System Administrative Associations, No. 32529 of February 2, 2005, provides that the property to be registered by the ASADA is dedicated to the public domain.

It also cites Article 4 of the Mining Code and Article 50 of the Organic Law of the Environment, which tacitly amended provisions that distinguished between privately and publicly owned water, emphasizing that all groundwater is reserved to the State. It concludes its arguments by citing decision 388-09 of this Court, which it says requires the removal from the base plan of public-domain lands surrounding an area where a well supplies water to the community of San Isidro de Cóbano. Based on the foregoing, it seeks annulment of the judgment because the perimeter prescribed by law was not excluded, which amounts to incorporating public-domain areas into the property, and requests instead that the proceedings be brought into compliance (readecuación de los procedimientos) (folios 1 60 to 169).

IV.Article 26 of the Agrarian Jurisdiction Law provides, insofar as relevant: “When appropriate, the courts may, on their own initiative, declare nullities (nulidades) and order proceedings repeated in order to correct irregularities that could affect the validity of the proceeding.” Likewise, Article 502 of the Labor Code, applicable by reference under Article 60 of the Agrarian Jurisdiction Law, provides that once the case record reaches the Court on appeal, the Court shall first review the proceedings. If it finds that any formality capable of causing an actual denial of the right of defense (indefensión) has been omitted, it shall declare the proceedings or rulings null and void to the extent necessary to restore the normal course of the litigation. Pursuant to those provisions, this Court has consistently held that a declaration of nullity is appropriate when such a ruling is absolutely indispensable to prevent a denial of the right of defense or to restore the normal course of the proceeding because essential procedural requirements were violated.

V.The appeal filed by the PGR actually contains two grounds for annulment (nulidad). The first is inadmissible. In the aforementioned official letter AZLB 05-2012, signed by Mr. [Nombre7], who states that he is the President of this ASADA (folio 153), there is no offer to provide a “technical opinion by a surveying professional who was going to prepare a plan of the protected area for the ASADA of La Zanjita, Los Lagos y Buenos Aires.” That official letter refers to the hiring of a surveying professional to prepare the plan of the protection area (área de protección) of [Dirección8], but this is not documentary evidence that must be submitted to the record, nor was its submission left pending such that the PGR would have to be afforded a hearing concerning it, as the PGR claims. What had to be determined in the record, as will be explained, was whether the base plan for these proceedings included public-domain areas (áreas demaniales) located within the protection zone (zona de protección) of the aforementioned [Dirección9], which can be determined even if no plan of that zone exists.

As to the second ground for annulment, which entails vacating the judgment so that the proceedings may be corrected—because it permits registration of a public-domain area surrounding a well intended to supply drinking water to a community—the PGR is partially correct. This is because, according to the information in the record, clear and effective evidence does not establish the dimensions of the protection area of the well in question. Regarding the public-domain status (carácter demanial) of that area and the scope of its protection, when wells supply drinking water to communities, it is unnecessary to reiterate the legal basis provided by the PGR in its appeal, summarized in the preceding recital (considerando). Solely to clarify what occurred in this case, it must be explained that, with respect to protecting drinking-water sources—specifically wells—the law affords different protection to those used for private supply and those that operate or are intended to supply water to a community.

In the latter situation, the legal system provides greater protection. In this regard, water resources suitable for human consumption are assets serving the community, and therefore the legislature expressly created a special regime for their protection. Section 31 of the Ley de Aguas

does, indeed, declare “as a reserved domain in favor of the Nation: a) The lands surrounding collection sites or drinking-water intakes, within a perimeter having a radius of no less than two hundred meters” (underlining not in the original). Articles 2 and 3 of the Ley General de Agua Potable also recognize as public domain all lands deemed indispensable for constructing or locating any part or parts of drinking-water supply systems, as well as for ensuring their sanitary and physical protection and the necessary flow. Section 4 of the Código de Minería and section 50 of the Ley Orgánica del Ambiente establish that groundwater (aguas subterráneas) is in the public domain. This includes water obtained from wells. The ICAA is currently responsible for selecting and locating water intended for water-supply service, determining the type of treatment to be used, and determining the type of drinking-water system to be built.

It is also responsible for the recommendations to be issued from a public-health standpoint, including the design, construction, operation, and maintenance of drinking-water systems. In this regard, the founding law of the ICAA, Nº 2726 of 14 de abril de 1961, as amended, provides in Article 2, subsection f), that the ICAA is responsible for exploiting, using, administering, or supervising all public-domain waters indispensable for the proper fulfillment of that law’s provisions. The public-domain status of the protection zones surrounding wells that supply drinking water to communities means that they may not be registered in the names of private persons, nor may private ownership or possessory rights be acquired over them. Article 11 of the Metodologías Hidrogeológicas para la Evaluación del Recurso Hídrico, Acuerdo 60 - A of 12/06/2012 of the Ministerio de Ambiente, Energía y Telecomunicaciones, recognizes that well-protection zones are a basic tool for protecting aquifers and establishes the tool for defining the well’s capture zone (zona de captura). Activities that, depending on vulnerability, threat, and hazard, do not contaminate aquifers may be permitted in that zone.

VI. In addition to the foregoing, concerning the clear and

sufficient information that judges must verify when hearing matters related to the protection of environmental assets (bienes ambientales), in order to guarantee due process and the fundamental right to a healthy and ecologically balanced environment, the following must be borne in mind. At the XVI Cumbre Judicial Iberoamericana, held in Buenos Aires, Argentina, on 25, 26 y 27 de abril de 2012, the Declaración de Buenos Aires 2012 was signed, emphasizing that “...the person responsible for adjudicating matters in court and the parties must have access to truthful, effective, accurate, and suitable environmental information so that effective judgments may be issued in environmental matters. In the case of proceedings to establish possessory title (informaciones posesorias), it is evident from sections 45 and 50 of the Constitución Política that judges are required to ensure that the title eligible for registration in the Registro Público provides information aimed at generating the greatest well-being for all inhabitants of the country, fostering agricultural and agro-environmental production; encouraging the conservation and preservation of a healthy and ecologically balanced environment; and preventing harm that could affect future generations.

Furthermore, the aforementioned declaration establishes the importance of judges ensuring that citizens and society have access to the environmental information they need or request, including information held by judicial bodies. When proceedings to establish possessory title are processed, the decision to be entered in the corresponding registry must provide the general public with precise and transparent information. Accordingly, everything concerning water resources and, potentially, sources supplying drinking water to communities must be clear and precise. The supply of drinking water is a right to which all men and women must have access. The Sala Constitucional de la Corte Suprema de Justicia has addressed this issue as follows: ‘« III . - Fundamental right to drinking water. This Court has recognized in its case law that the rights to health and life are fundamental human rights that depend—to a large extent—on access to drinking water, and that the competent bodies have an inescapable responsibility to ensure that society as a whole is not deprived of them...” (vote Nº18633 of 21 de diciembre de 2007) (vote 725 of 15 de junio de 2012 of the Tribunal Agrario).

VII.In this case, the record shows that there is a disused well on the land for which title is sought, but that well is not at issue in the appeal filed, nor is it the basis for annulment of the judgment (see folios 116 and 128). The well

to which the appellant refers is outside the property at issue in these proceedings, and that entity is correct that the Court should have verified, through suitable evidence, that the public-domain areas surrounding it would not be affected. That well is known as Nº 1, administered by the ASADA de La Zanjita, Los Lagos y Buenos Aires de Bagaces. This is the well addressed in official letter SUB-G-AIC-UEN-AMB-2011-700 of 29 de abril de 2011, issued by the Departamento de Cuencas Hidrográficas del ICAA (folios 92 and 98, 100 to 105). That report informed the trial court that, according to the ICCA’s records, the land for which title is sought lies within the 200 meters of legal protection established in section 31 of the Ley de Aguas in relation to the second well cited. It also states that the land has high water-resource fragility (fragilidad hídrica) and therefore recommends, pursuant to the cited legislation and the Ley Forestal, that the waters and their recharge and protection zones be rigorously respected and protected.

The report does not specify the affected area, but it contains a sketch showing that it constitutes a considerable portion of the land (folio 96). In responding to the hearing concerning that report, the PGR requested that the ICAA be asked to clarify whether the area adjacent to well 1 had to be excluded (folio 108). Accordingly, the Court issued official letter 310-JAL-2011 of 9 de junio del 2011 (folio 109). In response, the Área Funcional de Cuencas Hidrográficas del ICCA stated in official letter SUB-G-AID-UEN-AMB-2011-1525 of 23 de agosto del 2011 that, normally, in the case of wells, the calculation of the area to be excluded pursuant to section 31 of the Ley de Aguas is made through studies specific to each case, which determine the protection or safeguard zone (zona de resguardo), potentially ranging from 20 meters to an area greater than 200 meters, depending on the resulting vulnerability.

It further stated that, in the absence of specific studies, the calculation uses a radius of 200 meters, equivalent to an area of 12,56 hectares. Otherwise, the ASADA administering the well would be responsible for commissioning the specific technical study to determine the corresponding protection zone (folio 112). Based on those reports, the PGR requested in its pleading filed on 21 de setiembre del 2011 that the title-seeking party be ordered to exclude the 200 meters adjacent to the well in proportion to the affected area and to submit a new plan (folios 117 and 121). The applicant opposed that request and asked that a judicial inspection (reconocimiento judicial) be conducted to verify the existence of the well (folio 123). On that occasion, the party misunderstood that the PGR’s request for a new plan was not based on the existence of a well on the land, but on its proximity to Pozo [Dirección10], administered by the ASADA.

The Court likewise became confused and, without properly discerning what proceeding was required, ordered that the judicial inspection be conducted. It took place on 22 de febrero del 2012 (folio 128), and recorded the existence of an old well on the land for which title is sought, which the applicant states is disused. Still confused as to the well on which the PGR based its request that a new plan excluding the public-domain areas be required, the Court denied its request in an order of 15 de marzo del 2012 (folio 132). In a pleading of 22 de marzo de 2012, the PGR clarified the situation for the Court, specifying that its objection concerned the well administered by the aforementioned ASADA and requesting that the order be vacated (folios 134 to 149). Before ruling on that appeal, the Court ordered that an official letter be sent to the aforementioned ASADA so that it would conduct the specific study to determine the protection zone, in an order of 8 de mayo del 2012 (folio 151).

In official letter A Z L B 05-2012, signed by Mr. [Nombre7], who states that he is the President of this ASADA, he indicates that, under Ley (sic) 3545-S-MINAE, Article 21, the well’s safeguard perimeter is a circumference of 30 meters and that this is the measurement adopted for the well in question, and that a surveying professional was being hired to prepare the plan of the protected area (folio 53). That official letter does not clarify what is meant by the provision it cites (whether it is a regulation, circular, or another internal provision of MINAE), and no regulation containing that information can be found in the Costa Rican Legal Information System. The law bearing the referenced number is the law granting a BNCR moratorium to persons affected by the Irazú Volcano emergency, dated August 21, 1965. Therefore, there is no certainty, nor is it possible from that information to determine clearly what Mr. [Nombre7] means by his statement that the protection perimeter of the well in question is 30 meters.

Likewise, no reference is made to the existence of a technical study supporting that figure. Nor is documentation of that person’s legal authority (personería) provided to establish that he is the legal representative of the ASADA cited in September two thousand eleven, with sufficient authority to act on its behalf, which the Court should have ordered him to provide before recognizing that organization as having entered an appearance (apersonada). Despite those omissions, the Court deemed the statements made on behalf of the ASADA to have been submitted, in orders dated October 2, 2012, and November 29, 2012 (folios 154 and 157), and granted the PGR an opportunity to respond (audiencia) thereto; the PGR was notified of them on October 6 and November 30 thereafter, respectively, but that entity did not respond. The challenged judgment was subsequently issued. From the foregoing, it is evident that it is necessary to determine, through reliable and clear evidence issued by the legally competent entity (the appropriate Department of the ICAA or MINAE), the specific protection area surrounding the referenced [Dirección11].

It is clarified that the ASADA’s administration of the well does not grant it authority to determine the legally applicable measurement. That information is required by the Court and the petitioning party (parte promovente) in order to determine clearly which area must be excluded from the survey plan depicting the land for which title is sought before the proceeding may continue. Furthermore, if information from the ASADA is required, the identity of its legal representative must also appear in the record. Likewise, if necessary, that organization must be asked to clarify what it means in its official letter A Z L B 05-2012 by the information stated as “Law (sic) 3545-S-MINAE, Article 21,” as a matter of due process (debido proceso), given that the petitioning party and the PGR have the right to verify the sources of information supplied in connection with any objections they may raise, and the Court likewise has a duty to verify the authenticity of those sources and the scope of the information they contain.

Consequently, the appealed judgment must be annulled because it was issued prematurely, without clear and precise information from the competent administrative authority determining the measurement of the protection area of the cited [Dirección9]. Before this matter is decided, it must be clearly verified whether it is necessary to exclude any portion of the land for which title is sought that falls within that well-protection area, which, as explained, is public-domain property (bien demanial). Likewise, if reports are requested from the ASADA that administers the well, the identity of the person holding its legal representation must appear in the record.

VIII.Consequently, because omissions affecting due process have been established and cannot be remedied before this Court (Sede), as they fall within the functional jurisdiction of the trial judge and out of respect for the parties’ due process rights, the proper course is to declare the challenged judgment null and void as premature. The trial judge shall correct the proceedings in accordance with the preceding recital (considerando).

THEREFORE (POR TANTO):

Trial-court judgment sixty-five-S-two thousand thirteen, dated March four, two thousand thirteen, is annulled. VOTO N° 375-F-13 TRIBUNAL AGRARIO. SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ.- A las ocho horas y cuarenta y tres minutos del veinticuatro de abril de dos mil trece.- PROCESO DE INFORMACIÓN POSESORIA promovido por [Nombre1] , mayor, casado una vez, guarda civil, vecino de Liberia, cédula de identidad número CED1 - - . Intervienen en el proceso la PROCURADURÍA GENERAL DE LA REPÚBLICA, representada por Lydiana Rodríguez Paniagua, de calidades desconocidas en autos , en su condición de procuradora adjunta ; y el INSTITUTO DE DESARROLLO AGRARIO , actual INSTITUTO DE DESARROLLO RURAL, cédula jurídica número CED2 - - - , representado por Carmelina Vargas Hidalgo, mayor, divorciada, abogada, vecina de Guachipelín, Escazú, cédula de identidad número CED3 - - , colegiada número cinco mil setenta y dos, en su condición de apoderada general judicial . Actúa como abogado director del promovente el letrado José Humberto Alvarado Angulo, colegiado número quince ciento cincuenta y cuatro. El proceso se tramita en el Juzgado Agrario del Primer Circuito Judicial de Guanacaste, con sede en Liberia.

RESULTANDO:

  1. 1El promovente interpuso proceso de información posesoria con el fin de que se inscriba a su nombre en el Registro Público de la Propiedad la finca que se describe así:"...Terreno de potrero, situado en la [Dirección1], Liberia, de la provincia de Guanacaste.

linderos Norte: [Dirección2] , [Dirección3] lineas con un ancho de treinta metros, Star Brigde Sociedad Anónima, [Nombre2] SUR: [Nombre3] , ESTE: [Nombre4] OESTE: [Nombre2] , [Nombre5] , [Nombre6] . Según el plano catastrado numero G- un millón doscientos cincuenta y siete quinientos treinta cuatro - dos mil ocho, fechado el veintisiete de mayo del dos mil ocho a nombre de [Nombre1] , mide de extensión dieciocho mil setenta y cinco metros con un decímetro cuadrado...".(folios16, 24 y 159 vuelto).

  1. 2La Procuraduría General de la República se apersonó al proceso (folios 34 a 38); y el Instituto de Desarrollo Agrario, actual Instituto de Desarrollo Rural también lo hizo (folio 55), sin oponerse.-
  2. 3El juez Rodrigo Valverde Umaña, del Juzgado Agrario del Primer Circuito Judicial de Guanacaste, Liberia, mediante sentencia número 65-S-2013, de las once horas del cuatro de marzo del dos mil trece, resolvió: ³POR TANTO: Se APRUEBA esta INFORMACIÓN POSESORIA. Proceda el REGISTRO PUBLICO DE LA PROPIEDAD a inscribir, libre de gravámenes pero soportando las limitaciones contenidas en los articulo 1 y 9 de la Ley de informaciones (sic) posesorias (sic) ; 4 de la Ley General de Caminos Públicos; 33 y 34 de la Ley Forestal 7575 del 13 de febrero de 1996; 1 de la Ley de Derecho (sic) sin perjuicio de terceros de mejor

derecho, a nombre de [Nombre1] , mayor casado una vez, vecino de Liberia, [Dirección4] , , ,(sic) el inmueble que se describe así: Terreno de potrero, situado en la Zanjita, [Dirección5] Liberia, de la provincia de Guanacaste. Linderos Norte: Con [Dirección6] , con quince metros con setenta centímetros lineas con un ancho de treinta metros, Star Brigde S.A.(sic), [Nombre2] , SUR: [Nombre3] , ESTE: [Nombre4] , OESTE: [Nombre2] , [Nombre5] , [Nombre6] . Según el plano catastrado numero G- un millón doscientos cincuenta y siete quinientos treinta cuatro- dos mil ocho, fechado el veintisiete de mayo del dos mil ocho a nombre de [Nombre1] , mide de extensión dieciocho mil setenta y cinco metros con un decímetro cuadrado. Lo cruza una Quebrada sin nombre que va de este a oeste. En el inmueble se han ejercido los actos posesorios, cumpliendo con el uso conforme del suelo. En vista de la situación de los caminos que corren frente a la finca inscrita mediante esta información, ésta quedará afectada por las reservas que indica la Ley General de Caminos Públicos, en cuanto a que el ancho mínimo de las carreteras es de veinte metros y de los caminos vecinales de catorce metros.

Asimismo debe la parte titulante evitar la corta o eliminación de árboles en el área de protección de la quebrada sin nombre, siendo su cauce y las corrientes de agua superficiales o temporales de dominio público.También las aguas superficiales y subterráneas existentes en el inmueble son de dominio público y no forman parte de la finca" (folios 159 frente y vuelto).-

  1. 4La Licenciada Lydiana Rodríguez Paniagua , en su condición de Procuradora Adjunta , formuló recurso de apelación con indicación expresa de las razones por las cuales refuta la tesis del Juzgado (folio 160 a 164).

5. En la substanciación del proceso no se han observado las prescripciones legales, y se nota la existencia de errores u omisiones en el fallo capaces de producir su nulidad.

Redacta la jueza ALPÍZAR RODRÍGUEZ , y; CONSIDERANDO:

I.Por la forma en que se resolverá se omite pronunciamiento acerca de los hechos tenidos por demostrados. En su lugar, de interés para resolver el recurso, se tiene por probado lo siguiente: 1) El terreno a

titular, según el plano base del proceso, P-un millón doscientos cincuenta y siete mil quinientos treinta y cuatro-dos mil ocho, comprende un área -no precisada en medida- ubicada en los doscientos metros circundantes al [Dirección7] administrado por la ASADA de La Zanjita, Los Lagos y Buenos Aires de Bagaces ( ver oficios SUB-G-AIC-UEN-AMB-2011-700 del 29 de abril de 2011, del Departamento de Cuencas Hidrográficas del ICAA y SUB-G-AID-UEN-AMB-2011-1525 del 23 de agosto del 2011 del Area Funcional de Cuencas Hidrográficas del ICCA: folios 92 y 98, 100 a 105, 112, 115).-

II.Como hechos no probados de interés para resolver el recurso en esta instancia, téngase los siguientes: 1) El Departamento competente

del Instituto Costarricense de Acueductos y Alcantarillados (ICAA), haya especificado el área a excluir del terreno descrito en el plano un millón doscientos cincuenta y siete mil quinientos treinta y cuatro-dos mil ocho, en función del área de protección circundante al pozo Nº1 administrado por la ASADA de La Zanjita, Los Lagos y Buenos Aires de Bagaces. 2) La ASADA de La Zanjita, Los Lagos y Buenos Aires de Bagaces cuente con un estudio técnico específico para determinar la zona de protección correspondiente de dicho pozo. 3) El señor [Nombre7] , ostentaba la representación legal de la ASADA citada en setiembre del dos mil once.-

III. En la sentencia impugnada 65-S-2013 del 4 de marzo de 2013

(folio 158), se aprobó la información posesoria y se ordenó inscribir el inmueble descrito en el plano P-1257534-2008, con las limitaciones que establece la Ley de Aguas y la Ley de Caminos Públicos. La Procuraduría General de la República por sus siglas PGR, apela y solicita la nulidad del fallo, con base en los siguientes motivos: 1) Reclama, no se le puso en conocimiento el criterio del profesional en topografía (oficio AZLB 05-2012) que iba a confeccionar un plano del área resguardada para la ASADA de La Zanjita, Los Lagos y Buenos Aires (artículo 24 de la Ley Orgánica de dicho ente). 2) Aduce, se emitieron criterios técnicos por el ICCA (SUB-G-AIC-UEN-AMB-2011-700 y SUB-G-AID-UEN-AMB-2011-1525), en los que se indican que el terreno descrito en el plano referido abarca los 200 metros de área de protección legal que establece el artículo 31 de la Ley de Aguas, por existir el pozo Nº1 administrado por la ASADA de La Zanjita, Los Lagos y Buenos Aires de Bagaces, afectando un total de 12,56 hectáreas.

Ello de conformidad con lo establecido en el artículo 7 inciso c) de la Ley de Tierras y Colonización, 2 del Reglamento a la Ley Forestal y 32 y 33 de la Ley de Aguas. Considera, no se debe permitir al promovente inscribir el terreno, porque equivale a incorporar al mismo la franja de 200 metros de radio del pozo, que es de dominio público. Estos bienes, por estar destinados a un fin público, no pueden ser objeto de posesión (remite a votos 480-90, 1055-92 y otros pero no indica el tribunal emisor). Resalta que la Sala Constitucional, en votos 1923-2004 y 18051-2006, señala la afectación al dominio público o reserva demanial establecida en el numeral 31 de la Ley de Aguas Nº276 del 27 de agosto de 1942. Y en cuanto al numeral 7 de la Ley de Tierras y Colonización, que mantiene una disposición que provenía de leyes anteriores, cita que la Sala Primera ha indicado que las reservas en materia de aguas conllevan la prohibición de poseer los terrenos para inscribirlos en el Registro Público mediante este tipo de procesos (voto 51-1995).

También cita votos de este Tribunal, en los cuáles, dice, se ha dispuesto la exclusión de áreas de dominio público con base en el artículo 7 referido (votos 595-2004 y 1025-2005). También resalta que la Ley General de Agua Potable, Nº1634 de 18 de setiembre de 1953, en su numeral 2, establece que son de dominio público todas las tierras que se consideren indispensables para construir o situar sistemas de abastecimiento de aguas potables. Definir cuáles son esas áreas, explica, corresponde actualmente al Instituto Costarricense de Acueductos y Alcantarillados (ICAA) (artículo 2 de la Ley 2726 y votos de la Sala Constitucional 1923-2004 y 18051-2006). También la Ley Constitutiva del ICCA, Nº2726, en su numeral 18, reconoce como patrimonio nacional los terrenos de los organismos del Estado destinados a prestar servicios de captación, tratamiento y distribución de agua potable y evacuación de las servidas y pluviales.

Esos bienes, indica, fueron declarados de dominio público, inalienables e imprescriptibles, en votos [Telf1], 10466-2000 y 38219-2002 de la Sala Constitucional. El Reglamento de las Asociaciones Administradoras de Sistemas de Acueductos y Alcantarillados Comunales, Nº32529 de 2 de febrero de 2005, en su numeral 11, establece que los bienes que debe registrar la ASADA quedan afectados al dominio público.

Cita también el numeral 4 del Código de Minería y el 50 de la Ley Orgánica del Ambiente, que reformaron tácitamente disposiciones que diferenciaban entre agua de dominio privado y público, enfatizando que todas las aguas subterráneas se reservan para el Estado. Termina sus alegatos citando el voto 388-09 de este Tribunal, en el cual indica se debe eliminar del plano base los terrenos demaniales que circundan un área donde existe un pozo que abastece de agua a la comunidad de San Isidro de Cóbano. Con base en lo anterior, solicita la nulidad de la sentencia, al no haberse excluido el perímetro señalado por Ley, lo cual equivale a incorporar al mismo áreas de dominio público, y en su lugar se ordene la readecuación de los procedimientos (folios 1 60 a 169).

IV.El artículo 26 de la Ley de Jurisdicción Agraria, en lo que interesa dispone: "Cuando sea del caso, los tribunales podrán, por iniciativa propia, declarar nulidades y disponer la reposición de trámites, a fin de corregir irregularidades que pudieran afectar la validez del proceso". Asimismo, el artículo 502 del Código de Trabajo, aplicado por remisión del artículo 60 de la Ley de Jurisdicción Agraria, señala que llegados los autos en apelación, el Tribunal revisará, en primer término, los procedimientos. Si encontrare que se ha omitido alguna formalidad, capaz de causar efectiva indefensión, decretará la nulidad de actuaciones o de resoluciones, hasta donde sea necesario para orientar el curso normal del juicio. Al amparo de dichas regulaciones, se ha mantenido el criterio en esta Sede que la declaratoria de nulidad procede cuando sea absolutamente indispensable su pronunciamiento, para evitar indefensión o para orientar el curso normal del procedimiento, por violación a formas esenciales en el trámite.

V.El recurso interpuesto por la PGR contiene en realidad dos motivos de nulidad. El primero de ellos resulta improcedente. En el referido oficio oficio AZLB 05-2012, suscrito suscrito por el señor [Nombre7] , afirmando ser el Presidente de esta ASADA (folio 153), no se ofrece aportar un "criterio técnico de un profesional en topografía que iba a confeccionar un plano del área resguardada para la ASADA de La

Zanjita, Los Lagos y Buenos Aires". En ese oficio se hace referencia a que se contratará a un profesional en topografía que establezca el plano del área de protección del [Dirección8] , pero no es una documental que tenga que aportarse a los autos, ni tampoco que haya quedado pendiente sea aportada, como para tener que dar audiencia de ella a la PGR, que es lo que tal reclama. Lo que debía determinarse en autos, conforme se explicará, era si el plano base de este proceso incluía o no áreas demaniales comprendidas dentro de la zona de protección del [Dirección9] referido, lo cual se pude determinar aunque no exista un plano de tal zona. En cuanto al segundo motivo de nulidad, que implica que la sentencia debe anularse para que se corrijan los procedimientos -dado que en ella se permite inscribir un área demanial que circunda un pozo destinado a abastecimiento de agua potable de una comunidad-, lleva parcialmente razón la PGR.

Esto por cuanto, de acuerdo con la información constante en autos, no se tiene claridad, con base en prueba clara y eficaz, de cuál es la medida del área de protección del pozo en cuestión. En relación con el carácter demanial de esa área y la amplitud de su tutela, cuando se trata de pozos que abastecen de agua potable a comunidades, resulta innecesario reiterar el fundamento legal que ofrece la PGR en su recurso, resumido en el considerando anterior. Tan solo, para efectos de aclarar lo sucedido en este caso, es necesario explicar que debe diferenciarse, en materia de protección de fuentes de agua potable -específicamente pozos-, que la ley tutela en forma diferente aquellos que sirven para abastecimiento privado de los que funcionan o deben destinarse a dotar de agua a una comunidad. En este segundo supuesto, la tutela que brinda el ordenamiento jurídico es mayor. Al respecto, el recurso hídrico apto para consumo humano es un bien al servicio de la comunidad, y por ello de manera expresa la persona legisladora creó un régimen especial para su protección.

El numeral 31 de la Ley de Aguas, efectivamente, declara "como reserva de dominio a favor de la Nación: a) Las tierras que circunden los sitios de captación o tomas surtidoras de agua potable, en un perímetro no menor de doscientos metros de radio" (el subrayado no es del original). Los artículos 2 y 3 de la Ley General de Agua Potable, también reconocen como de dominio público todas aquellas tierras que se consideren indispensables para construir o para situar cualquiera parte o partes de los sistemas de abastecimiento de aguas potables, así como para asegurar la protección sanitaria y física, y caudal necesario de las mismas. Los numerales 4 del Código de Minería y 50 de la Ley Orgánica del Ambiente establecen que las aguas subterráneas son de dominio público. Dentro de tales están comprendidas las aguas que provengan de pozos. Corresponde actualmente al ICAA seleccionar y localizar las aguas destinadas al servicio de cañería, tipo de tratamiento de las mismas y tipo de sistema de agua potable a construir.

Tendrá además la responsabilidad por las recomendaciones que se deban impartir desde el punto de vista sanitario comprendido el diseño, construcción, operación y mantenimiento de los sistemas de agua potable. Al respecto, la ley constitutiva del ICAA, Nº 2726 del 14 de abril de 1961 y sus reformas, establece en su artículo 2, inciso f), que corresponde al ICAA el aprovechar, utilizar, gobernar o vigilar, todas las aguas de dominio público indispensables para el debido cumplimiento de las disposiciones de esa ley. La demanialidad de las zonas de protección que rodean pozos que abastecen de agua potable a comunidades, implica que no pueden ser inscritas a nombre de personas particulares ni se pueden adquirir sobre ellas derechos de dominio o posesión privados. En el artículo 11 de las Metodologías Hidrogeológicas para la Evaluación del Recurso Hídrico, Acuerdo 60 - A del 12/06/2012 del Ministerio de Ambiente, Energía y Telecomunicaciones, se reconoce que las zonas de protección de pozos son una herramienta básica de protección de los acuíferos y se establece la herramienta para definir la zona de captura del pozo. En dicha zona se pueden permitir las actividades que dependiendo de la vulnerabilidad, amenaza y peligro no causen contaminación de los acuíferos.

VI. Aunado a lo anterior, en relación con la información clara y

suficiente que debe verificar las personas juzgadoras cuando conocen asuntos relacionados con la tutela de bienes ambientales, en garantía del debido proceso y del derecho fundamental a un ambiente sano y ecológicamente equilibrado, debe tenerse presente lo siguiente. En la XVI Cumbre Judicial Iberoamericana, realizada en Buenos Aires, Argentina, los días 25, 26 y 27 de abril de 2012, se suscribió la Declaración de Buenos Aires 2012, la cual resalta que"...la persona encargada de resolver los asuntos en sede judicial y las partes, deben tener acceso a una información ambiental verdadera, eficaz, real e idónea para que se dicten sentencias efectivas en materia ambiental. En el caso de las informaciones posesorias, es evidente, a partir de los numerales 45 y 50 de la Constitución Política, se impone a quien juzga velar porque el título inscribible en el Registro Público, suministre información tendiente a generar el mayor bienestar a todos los habitantes del país, estimulando la producción agraria y agroambiental; incentivando que se conserve y preserve un ambiente sano y ecológicamente equilibrado; evitando daños que puedan afectar a las futuras generaciones.

Además, la declaración en cita, establece la importancia que los jueces y las juezas velen para que la ciudadanía y la sociedad tengan acceso a la información ambiental que precisen o soliciten, incluyendo la información en poder de los órganos jurisdiccionales. Cuando se tramitan las diligencias de información posesoria, la decisión que se inscribirá en el registro correspondiente, deberá suministrar a la ciudadanía en general información precisa y transparente. Por lo anterior, es relevante que todo lo que concierne al recurso hídrico, y eventualmente a fuentes de abastecimiento de agua potable para las comunidades, sea diáfana y precisa. El suministro de agua potable es un derecho al que todos los hombres y mujeres deben tener acceso. Este tema ha sido abordado por la Sala Constitucional de la Corte Suprema de Justicia de la siguiente manera: ´ « III . - Derecho fundamental al agua potable.

Este Tribunal ha reconocido en su jurisprudencia que el derecho a la salud y a la vida son derechos fundamentales del ser humano que dependen -en gran parte-del acceso al agua potable, y que los órganos competentes tienen la responsabilidad, ineludible, de velar para que la sociedad como un todo no los vea mermados..." (voto Nº18633 de 21 de diciembre de 2007) (voto 725 de 15 de junio de 2012 del Tribunal Agrario).

VII.En este caso, consta existe un pozo en desuso en el terreno a titular, el cual no es objeto de análisis en el recurso planteado ni tampoco es el que motiva la nulidad de la sentencia (ver folios 116 y 128). El pozo

al cual se refiere la recurrente está fuera del inmueble objeto de este proceso, y con respecto a tal lleva razón dicho ente en que debió el Juzgado verificar, con prueba idónea, que no se afectasen las áreas demaniales que lo circundan. Dicho pozo es el denominado Nº 1, administrado por la ASADA de La Zanjita, Los Lagos y Buenos Aires de Bagaces. Es a este pozo que se refiere el oficio SUB-G-AIC-UEN-AMB-2011-700 del 29 de abril de 2011, emitido por el Departamento de Cuencas Hidrográficas del ICAA (folios 92 y 98, 100 a 105). En ese informe, se hace saber al Juzgado de instancia, que de acuerdo con los registros del ICCA, el terreno a titular se encuentra dentro de los 200 metros de protección legal establecidos en el numeral 31 de la Ley de Aguas, en relación con el segundo pozo citado. Además, se indica que de acuerdo el terreno presenta una alta fragilidad hídrica, por lo que se recomienda, al amparo de la legislación citada y la ley Forestal, respetar y proteger rigurosamente las aguas, sus zonas de recarga y protección.

El informe no especifica el área afectada, pero si contiene un croquis en el cual se evidencia es sector considerable del terreno (folio 96). La PGR, al contestar la audiencia sobre dicho informe, solicitó se pidiese al ICAA aclarase si era necesario excluir el área contiguo al pozo 1 (folio 108). El Juzgado emitió, en función de ello, el oficio 310-JAL-2011 del 9 de junio del 2011 (folio 109). En respuesta a ello, el Área Funcional de Cuencas Hidrográficas del ICCA, contestó en oficio SUB-G-AID-UEN-AMB-2011-1525 del 23 de agosto del 2011, que normalmente, en el caso de los pozos, el cálculo del área a excluir en función del numeral 31 de la Ley de Aguas, se realiza a través de estudios específicos para cada caso, en los que se determina la zona de protección o de resguardo, que podría considerar desde los 20 metros hasta un área mayor a los 200 metros, en función de la vulnerabilidad resultante.

Se indicó además, que ante la ausencia de estudios específicos, se toma el cálculo con un radio de 200 metros, equivalente a un área de 12,56 hectáreas. Caso contrario, correspondería a la ASADA administradora del pozo, contratar el estudio técnico específico para determinar la zona de protección correspondiente (folio 112). La PGR, con base en dichos informes, solicito en su memorial presentado el 21 de setiembre del 2011, que se ordenase a la parte titulante, excluir los 200 metros contiguos al pozo en proporción al área que se encontrase afectada, y presentar un nuevo plano (folios 117 y 121). La parte promovente se opuso a dicha solicitud y pidió se practicase un reconocimiento judicial para verificar la existencia del pozo (folio 123). La parte confundió, en esa oportunidad, que la petición de la PGR de un nuevo plano, no se debía a la existencia de un pozo en el terreno, sino a su cercanía con el Pozo [Dirección10] administrado por la ASADA.

El Juzgado igualmente se confunde, y sin discernir bien lo que debía tramitar, ordena se realice el reconocimiento judicial, el cual se llevó a cabo el 22 de febrero del 2012 (folio 128), en el cual se consigna la existencia de un pozo viejo en el terreno a titular, el cual, afirma el promovente, está en desuso. Siempre manteniendo una confusión en relación al pozo en que basaba la PGR su reclamo de que se previniese un nuevo plano que excluyese las áreas demaniales, el Juzgado rechaza su petición en resolución del 15 de marzo del 2012 (folio 132). La PGR, en memorial del 22 de marzo de 2012, aclara la situación al Juzgado, especificando que su reclamo se refiere al pozo administrado por la ASADA referida y pide se revoque dicha resolución (folios 134 a 149). El Juzgado, previo a resolver ese recurso, ordena remitir oficio a la ASADA referida, para que realice el estudio específico a fin de determinar la zona de protección, en resolución del 8 de mayo del 2012 (folio 151).

En oficio A Z L B 05-2012, suscrito por el señor [Nombre7] , afirmando ser el Presidente de esta ASADA, indica que según la Ley (sic) 3545-S-MINAE, artículo 21, el perímetro de resguardo del pozo es de 30 metros de circunferencia y es la medida que se ha tomado para el pozo en cuestión y que se estaba contratando un profesional en topografía para confeccionar el plano del área resguardada (folio 53). No se aclara a que se refiere ese oficio con la norma que cita (si es un reglamento, circular u otra disposición interna del MINAE), y en el Sistema Costarricense de Información Jurídica, no se encuentra ninguna normativa con ese dato. La Ley que existe con el número referido es la que Concede Moratoria BNCR a Afectados por Emergencia del Volcán Irazú, del 21 de agosto de 1965. Por ende, no se tiene certeza ni es posible con esa información, tener claridad a qué se refiere el señor [Nombre7], con la referencia que da sobre el dato de que el perímetro de protección del pozo en cuestión es de 30 metros.

De igual forma, no se hace referencia a la existencia de un estudio técnico que fundamente ese dato. Tampoco se aporta la personería de esa persona, que le acredite como representante legal de la ASADA citada en setiembre del dos mil once, con facultades suficientes para actuar a su nombre, lo cual debió el Juzgado prevenir antes de tener por apersonada a dicha organización. Pese a esas omisiones, el Juzgado tuvo por hechas las manifestaciones a nombre de la ASADA, en resoluciones del 2 de octubre de 2012 y 29 de noviembre del 2012 (folios 154 y 157), y de ello dio audiencia a la PGR, a quien le fueron notificadas respectivamente los dìas 6 octubre y 30 de noviembre siguientes, respectivamente, sin que ese ente se pronunciase. Posterior a ello se dictó la sentencia impugnada. De lo relatado, es evidente es necesario se determine con prueba fehaciente y clara, emitida por la entidad legalmente competente (el Departamento del ICAA o del MINAE que corresponda), cuál es el área de protección específica que rodea el [Dirección11] referido.

El que la ASADA lo administre, se aclara, no le da facultades para determinar la medida que legalmente corresponda. Esa información la requiere el Juzgado y la parte promovente, para poder tener claridad sobre cuál es el área que se debe excluir en el plano que grafique el terreno a titular, previo a continuar con el proceso. Además, en caso de requerirse información de la ASADA, debe también constar en autos quien es su representante legal. También, de resultar necesario, debe pedirse a dicha organización que aclare a qué se refiere en su oficio A Z L B 05-2012, con el dato que se consigna como "Ley (sic) 3545-S-MINAE, artículo 21", por debido proceso, dado que la parte promovente y la PGR tiene derecho a verificar las fuentes de información que se suministran en relación con los cuestionamientos que hagan, e igualmente es deber del Juzgado verificar la autenticidad de dichas fuentes y los alcances de los datos que contienen.

Por consiguiente, debe anularse la sentencia recurrida, al haber sido dictada en forma anticipada, sin contar con información clara y precisa, emitida por la autoridad administrativa competente, que determine cuál es la medida del área de protección del [Dirección9] citado. Debe, antes de resolverse este asunto, verificarse en forma clara, si es necesario excluir alguna zona del terreno a titular, que quede comprendida dentro de esa área de protección del pozo, la cual, conforme a lo explicado, es de carácter demanial. También, en caso de requerirse informes a la ASADA que administra dicho pozo, debe constar en autos quien ostenta su representación legal.

VIII.En consecuencia, al haberse constatado omisiones que afectan el debido proceso, que no pueden subsanarse en esta Sede, por ser propias de la competencia funcional del juez de primera instancia y por respeto al debido proceso de las partes, lo procedente es declarar la nulidad, por anticipada, de la sentencia impugnada. Proceda el juez de primera instancia a corregir el procedimiento de acuerdo a lo indicado en el considerando anterior.

POR TANTO:

Se anula la sentencia de primera instancia sesenta y cinco-S-dos mil trece del cuatro de marzo de dos mil trece. Proceda el Juzgado de instancia a corregir los procedimientos , para lo cual deberá ordenar lo necesario con el fin de verificar si en el plano del terreno a titular se incluyan áreas de dominio público.- 2%" +, %%1 [Nombre8] - JUEZ/A [Nombre9] 4 % #&6& #4+ %' #% CED4 CED5 [Nombre10] - [Nombre11] JUEZ/A [Nombre9] [Nombre12] - JUEZ/A [Nombre9]
