  1. 1The petitioner instituted possessory title proceedings seeking registration in his name, in the Registro Público de la Propiedad, of the property described as follows: "...Land consisting of scrubland (tacotales), secondary forest (bosque secundario), and agricultural land, with a dwelling house, located in La Fortuna de Pilas, [Dirección1], that is, Buenos Aires, the third canton, that is, Buenos Aires in the province of Puntarenas, currently bounded on the north by [Nombre2], on the south by a public road with frontage thereon of six hundred eighty-four meters and sixty-four linear centimeters and a width of fourteen meters, on the east by [Nombre1], and on the west by [Nombre3] , measuring twenty hectares, three thousand eight hundred nineteen square meters and seventy-seven square decimeters, according to cadastral plan (plano catastrado) number P-seven hundred seventeen thousand four hundred ninety-two thousand one." (pages 13, 93 reverse, and 94). *

  3. 3Judge Juan Carlos Castillo López, of the Juzgado Agrario del Primer Circuito Judicial de la Zona Sur, Pérez Zeledón, by judgment number 05-S-2013 issued at fifteen twenty-one hours on ten January two thousand thirteen, ruled: "THEREFORE (POR TANTO): Pursuant to Articles 1, 4, 6, 15, 16, and 19 of the Ley de Informaciones Posesorias and Articles 853, 856, and 860 of the Código Civil, these possessory title proceedings are approved. The Registro Público de la Propiedad is ordered to register in the name of [Nombre1] , who is of legal age, married once, a farmer, identity card number CED4- - , and a resident of La Fortuna de Pilas de Buenos Aires de Puntarenas, [Dirección2], without prejudice to third parties with superior rights, the property described as follows: Land consisting of scrubland, secondary forest, and agricultural land, with a dwelling house, located in La Fortuna de Pilas, [Dirección1], that is, Buenos Aires, the third canton, that is, Buenos Aires in the province of Puntarenas, currently bounded on the north by [Nombre2], on the south by [Dirección3] with frontage thereon of [Dirección4] and a width of fourteen meters, on the east by [Nombre1], and on the west by [Nombre3] , measuring twenty hectares, three thousand eight hundred nineteen square meters and seventy-seven square decimeters, according to cadastral plan number P- seven hundred seventeen thousand four hundred ninety-two thousand one.These proceedings were valued at five million colones and the property at five million colones. The property remains subject to the limitations and restrictions of the Ley Forestal. The cutting or removal of trees is prohibited. It is also subject to Articles 1, 19, 20, 33, and 34 of the Ley de Aguas. The surface water and groundwater existing on the property are also in the public domain (dominio público) and do not form part of the property. The titleholder (titulante) shall follow the recommendations issued by the INTA to maintain forest cover (cobertura boscosa) and may increase crop yields through the application of fertilizers following an analysis of soil fertility. Notice is hereby given that this judgment may be appealed by filing an appeal with this same court within five days.If any party intends to appeal this decision, that party must also submit the appeal in electronic format. Due to the introduction of oral proceedings in agrarian matters, any party wishing the appellate court to grant an oral hearing must state that request in the same appellate brief or, alternatively, provide an email address at which notice may be served."   4. 4Attorney Lydiana Rodríguez Paniagua, in her capacity as Deputy Attorney, filed an appeal expressly stating the grounds on which she challenges the position adopted by the lower court. (pages 102 to 108). *

5. In the conduct of the proceeding, the statutory requirements have been observed, and the judgment contains no apparent errors or omissions capable of rendering it null and void. * Judge Alvarado [Nombre4] drafts the opinion; and, * CONSIDERING:*

I.This Tribunal adopts the statement of facts found proven in the judgment under appeal, as it faithfully reflects the evidence contained in the record.- *

II.Deputy Attorney Lydiana Rodríguez Paniagua appeals the judgment issued at fifteen twenty-one hours on ten January two thousand thirteen, arguing that the evidence received establishes that the property for which title is sought is forest. She maintains that forestlands and forests within national reserves have been subject to the public domain and have constituted the State’s natural heritage (patrimonio natural del Estado), at least since Ley Forestal 4465 of 1969, and that their public-domain status (carácter demanial) is maintained under Articles 13 and 14 of Ley 7575; in support of her position, she cites constitutional decisions and opinions of the Procuraduría General de la República appearing on pages 102 to 108.-*

III.The grounds of appeal presented by the appellant are not accepted, for the following reasons: The soil study prepared by the Instituto Nacional de Innovación y Transferencia de Tecnología Agropecuaria (INTA) shows that the property described in cadastral plan number P-717490-2001 consists mostly of land planted with rice, taro, corn, and plantain, and also contains secondary forest; see pages 16 and 17. The plan appearing on page 1 describes it as scrubland.- As may be seen from the technical soil study, the land contains secondary forest and crops; it is therefore not land predominantly covered by virgin or primary forest. Rather, it reflects an interest in protecting the resource by allowing that forest to regenerate. For this reason, and given the regenerative nature of the property’s forest resource, the theory that the ten-year period of possession of forestland must be calculated from before it became subject to the public domain under the Ley Forestal of 1969 does not apply, nor does any other theory concerning calculation of the ten-year period and subjection to the public domain.

Such theories do not apply to this specific case because, as noted, the property consists largely of secondary forest or scrubland and crops, which means that the land was regenerated in part by its possessor. The Comisión Nacional de Certificación Forestal de Costa Rica defines secondary forest as “... land with woody vegetation of a secondary successional nature that develops after the original vegetation has been removed by human activities or natural phenomena; with a minimum area of 0,5 ha and a density of no fewer than 500 trees per ha of all species, with dbh (dap) of no less than 5 cm”* (CNCF 1999, Comisión Nacional de Certificación Forestal. 1999. Standards and Procedures for Sustainable Forest Management and Forest Certification in Costa Rica. San José,. Costa Rica. 54 p.) The concept of scrubland is "dense brush." Based on these definitions and the INTA technical study appearing on pages 16 and 17, most of the property is under cultivation, while 28.7 % consists of secondary forest or scrubland.

This implies that the original forest was converted into pastureland or its vegetation was removed, subsequently giving rise to secondary forest and scrubland, while the remainder of the property is under cultivation. Declaring this property to be public-domain property (bien demanial) would therefore discourage this type of forest-regeneration activity, since possessors would prefer to keep their land as pastureland so that it remains within their estate and they do not run the risk of having it declared State property. Silvicultural activity and the regeneration of secondary forests and scrublands are necessary activities for capturing atmospheric carbon and are therefore environmental measures against global warming. Because these activities benefit the environment, it would be inconsistent to penalize possessors who engage in this type of forest-regeneration activity by denying them the ability to obtain title to their property. Accordingly, the judgment under appeal must be affirmed. *

IV.The judicial inspection conducted on 22 May 2012 (page 72 and recording) clearly indicates that the land is undergoing natural regeneration and consists of scrubland. In addition to all the foregoing, it was proven that the property has been possessed for more than ten years, as shown by the testimony of [Nombre5] , * * [Nombre6], and [Nombre7] , who attest to possession for more than ten years and to the use of the property as scrubland and woodland. *

V. NOTE BY JUDGE [Nombre8]

Although it is true that the Ley de Tierras y Colonización of 1961 and the Ley Forestal of 1969 established that forest-covered lands without private occupation were part of the national reserves, such designation as public property has changed in accordance with the evolution of Human Rights, specifically with the incorporation of third-generation rights, which include the human right to a healthy and ecologically balanced environment. The Ley Forestal of 1996 amended Article 7 of the Ley de Informaciones Posesorias to permit acquisition by adverse possession (usucapión) of forest-covered lands, provided that ecological possession (posesión ecológica) was demonstrated through conservation of the forest resource for more than ten years, with the benefit of transferred possession (posesión trasmitida) being available (see judgment of the Sala Constitucional No. 4587-97). The Tribunal Agrario held that such possession had to be personal in nature, but the Sala declared that criterion unconstitutional.

Regarding the interpretation of Article 7 of the Ley de Informaciones Posesorias and the State Natural Heritage (Patrimonio Natural del Estado), the Tribunal has stated in repeated rulings: “The Ley de Informaciones Posesorias, in its Article 7, as well as the Leyes Forestales, have sought to protect forest resources from human activity by subjecting them to various forms of forest management (manejo forestal). Although titling of such areas has been permitted, and once declared conservation areas they become part of the State Forest Heritage (Patrimonio Forestal del Estado), compliance with other, more stringent requirements is demanded. This leads us directly to the concept of ecological possession and the principle of the ecological function of forest property (función ecológica de la propiedad forestal). In repeated judgments, both the Sala Primera de Casación and the Tribunal Superior Agrario itself have established the principles that must govern the resolution of these types of agricultural-environmental situations.

Our country has pioneered the development of the legal concepts of agricultural possession (posesión agraria) and ecological possession. Case law itself has recognized and developed these legal concepts, as well as the life cycle of agricultural possession and, recently, of ecological possession (within the broader principle of the ecological function of forest property). That same case law has sought to distinguish commercial property and possession (propiedad y posesión empresarial), in which an activity directed toward forest cultivation is carried out, from property or possession in which merely extractive or solely conservation activity is conducted. In the latter cases, this would constitute forest property or possession (propiedad o posesión forestal) without an enterprise. It is precisely in these cases that the Ley Forestal establishes an entire legal regime for the protection of forest resources, sometimes mandatorily subjecting the owner to the forest regime (régimen forestal) and, in other cases, doing so voluntarily.

Thus, in forest possession, de facto control (poder de hecho) is exercised over land suitable for forestry (bien de vocación forestal) or land used primarily to protect forest resources, without any intent to exploit them, or else devoted merely to the extraction of timber species through management plans (planes de manejo) intended to achieve the natural regeneration of the forest. In neither case would there be the development of a plant or animal biological cycle, nor would humans assume any risk. That is why the law does not protect—and, on the contrary, suppresses—possession through which the forest resources of protected areas are destroyed. It also precludes the possibility of acquiring possessory rights (derechos de posesión) over lands in national reserves when harmful action against forest resources has been carried out. Today, some agricultural-law scholars maintain that Forest Law (Derecho forestal) exists as an organic and comprehensive system with its own distinctive features, within which the legal concepts of forest property and possession occupy an important place.

In Costa Rica, forest property, as well as forest possession as a property right (derecho real) derived from it or conceived independently, began to take shape with the Código Fiscal of 1885, which establishes an entire chapter concerning forests whose provisions are aimed at their conservation. Subsequently, the Ley de Terrenos Baldíos No. 13 of 6 de enero de 1939 incorporated those principles. The Ley de Tierras y Colonización then expanded the national reserves for the protection of such resources in its Article 7.- VII. Special legislation concerning the protection of forest property and possession has developed in three stages in our country. The first stage of forest property is framed by Ley No. 4465 of 35 de noviembre de 1969. The second began with more effectively conceived legislation through Ley No. 7032 of 7 de abril de 1986, which was subsequently declared unconstitutional. The final stage began with the enactment of Ley Forestal No. 7174 of 28 de junio de 1990, recently amended by Ley No. 7575 of 13 de febrero de 1996 (published in Supplement 21 of La Gaceta No. 72 of martes 16 de abril de 1996).

These laws contain various forest-property regimes and restrict private parties’ use and exploitation of resources. Ownership of land with forest cover (cobertura boscosa) cannot be acquired unless protection of the forest resource is demonstrated. Its constitutional basis is found in the second paragraph of Article 45 of the Constitution. The legal concept of forest property and possession is protected through restrictions in the public interest (limitaciones de interés social). This property is not the same as civil or agricultural property; it is property intended for conservation, and therefore the possessory acts (actos posesorios) performed on it must serve that purpose.- VIII. Forest possession has been governed by the legal regime established in the aforementioned Leyes Forestales. It applies to a specific type of property: forest-covered lands or lands suitable for forestry (terrenos de aptitud forestal).

The owner or possessor of such property has an obligation to conserve forest resources and may exploit them economically only subject to the restrictions or limitations imposed by law. Legal disputes arising from the exercise of forest possession must be resolved by applying that special legal regime and the principles of Forest Law. The Ley Forestal establishes as an essential function and priority of the State the duty to safeguard the protection, conservation, exploitation, industrialization, administration, and promotion of the country’s forest resources, in accordance with the principle of rational use of renewable natural resources. (Article 1). All lands suitable for forestry and all forests in the country, whether state-owned or privately owned, are subject to the purposes of the law. The forest regime is the body of provisions—including legal, economic, and technical provisions—established by the law, its regulations, and other rules governing the conservation, renewal, exploitation, and development of the country’s forests and lands suitable for forestry.

Accordingly, acquiring forest property by adverse possession requires the exercise of forest possession. Before its amendment, Article 7 of the Ley de Informaciones posesorias, as amended by the Ley Forestal, provided: "Article 7.- When the property referred to in the possessory-information proceeding (información) is located within an area declared a national park, biological reserve, forest reserve, or protected zone, the applicant for title (titulante) must demonstrate that ten-year possession (posesión decenal) was exercised beginning at least ten years before the effective date of the respective law or decree creating the relevant wildlife area (área silvestre). Properties outside those areas that contain forests may be titled only if the petitioner demonstrates possession for ten years or more and protection of that natural resource, it being understood that the property must be duly demarcated by fences or cleared boundary lines (carriles)." In other words, de facto control under forest possession applies to the natural resource consisting of "forests" or "lands suitable for forestry," and possessory acts must be directed toward their protection and conservation.

Such lands may be acquired or registered in favor of those possessors only if that is demonstrated. Otherwise, they would become part of the State Natural Heritage (Article 13 of the new Ley Forestal), immune from attachment and inalienable (inembargable e inalienable), and possession thereof would create no right in favor of private parties (Article 14 of the new Ley Forestal).- IX. Before Article 7 of the Ley de Informaciones Posesorias was amended by the new Ley Forestal, the Tribunal Agrario had interpreted it as requiring personal possession exercised beginning ten years before the creation of the forest reserve or protected area (See, to that effect, Votos No. 169 at 9 horas 40 minutos on 22 de marzo de 1991 and No. 251 at 14 horas on 17 de abril de 1991)...". However, that interpretation of Article 7 of the Ley Forestal was challenged as "unconstitutional" by the applicant for title herein, and the Sala Constitucional, in Voto No. 4587-97 (published in Boletín Judicial No. 188 dated 1 de octubre de 1997), declared, insofar as relevant, as follows: "The action is partially granted and, consequently, the interpretation of Article 7 of the Ley de informaciones Posesorias No. 139 of 14 de julio de 1941, the text of which corresponds to the amendment introduced by Ley Forestal No. 7174 of 28 de junio de 1990, is declared unconstitutional insofar as, under that interpretation, titling lands located within national parks, biological reserves, forest reserves, or protected zones requires personal possession beginning ten years before the effective date of the law or decree creating the protected wildlife area and, in such cases, possession transferred by prior possessors does not benefit the applicant.

This judgment is declaratory and has retroactive effect, without prejudice to rights acquired in good faith...". Thus, current possessors may benefit from transferred possession...X. Ley Forestal No. 7575 also retained the restrictions in the Ley de Informaciones Posesorias governing the titling of lands located within protected areas. In that regard, the current provision states: "Article 7.-When the property referred to in the possessory-information proceeding is located within a protected wildlife area, regardless of its management category (categoría de manejo), the applicant for title must demonstrate that the applicant holds the legal rights to ten-year possession exercised beginning at least ten years before the effective date of the law or decree creating that wildlife area."(Emphasis added). In other words, the legislature intended those areas to have remained protected and conserved throughout that entire period, including before the creation of the Reserves and protected areas...".

(Ruling at 14:50 horas on 20 de febrero de 1998 in response to Voto No. 113). V.- In more recent cases, the Tribunal has rejected the arguments now reiterated by the appellant regarding the alleged retroactive interpretation or application of Article 7 of the Ley Forestal. In a case similar to the one before us, it stated: V.- Regarding the appellant’s contention that the lower-court judge erred in applying Article 7 of the Ley de Informaciones Posesorias, which the appellant considers to have been declared unconstitutional and therefore maintains that the proceeding must be analyzed in light of Article 1 of that Law, this Tribunal finds the contention unfounded because the cited Article 7 was not declared unconstitutional; rather, what was declared unconstitutional was the interpretation previously applied by the Tribunal under which possession exercised by prior transferors was not counted.

Thus, because Section 7 of the Ley de Informaciones Posesorias remains in force, the petitioner must prove ten years of possession predating the declaration of the protected wildlife area (área silvestre protegida), as stated by the Sala Constitucional in ruling No. 4587-97 (published in Boletín Judicial No. 188 dated 1 de octubre de 1997). It is important to mention that the law would not be applied retroactively either, as the appellant claims, because the ten-year period of possession required for adverse possession (usucapión) is established in the Código Civil, and the challenged provision merely highlights certain elements inherent in adverse possession that are also defined in the general legislation, namely: the object of possession and the conditions under which possession must be exercised to qualify for adverse possession. In this regard, it is important to note what the Sala Constitucional stated on the matter in the cited ruling* “…The first paragraph of Article 7 of the challenged Ley de Informaciones Posesorias, the text of which predates the latest amendment by Ley Forestal No.7575 of 13 de febrero de 1996, governs the titling (titulación) of real property located within an area declared to be a national park, biological reserve, forest reserve, or protected zone.

That article provides that the applicant for title must prove that the ten-year period of possession was exercised at least ten years before the effective date of the law or decree that created the wildlife area. The challenged provision governs the titling of real property that has been dedicated to the public domain (dominio público) through its designation as a protected wildlife area, irrespective of its specific classification. It must now be determined whether, under the circumstances contemplated by the challenged provision and in light of the doctrinal and jurisprudential criteria governing the doctrines of adverse possession and the possession required for adverse possession, as discussed above, the challenged provision governs a special type of possession required to acquire ownership of real property, imposing specific requirements that may infringe the right to property or the principle against retroactive application of the law to the detriment of vested rights or settled legal situations, as protected by the Constitution.

First, it must be noted that the challenged article does not modify—whether by increasing or decreasing—the ten-year period of possession required for adverse possession, established in Article 860 of the Código Civil for cases generally in which ownership of real property is sought through acquisitive prescription (prescripción positiva). The extension of the period alleged by the claimant to infringe the right to property does not occur because, given the nature of the property for which title is sought (public property), the period of possession qualifying for adverse possession must elapse before the property is dedicated to the public domain. In other words, designation as a protected wildlife area prevents possession occurring after that dedication from being counted and precludes satisfaction of the requirements for adverse possession if the right has not been acquired by that time—that is, if the ten years of possession qualifying for adverse possession under the conditions established by law have not elapsed.

The foregoing is merely the natural result of applying the concepts concerning the object of possession and the requirement that possession be exercised in the capacity of an owner, both of which are necessary for possession ad usucapionem. It should be recalled that property dedicated to the public domain, regardless of its particular classification, cannot be acquired through adverse possession unless the conditions necessary to acquire the right were satisfied before that dedication occurred. Accordingly, although the challenged provision appears to govern a specific case of adverse possession, it does not create a regime with requirements different from those established in the Código Civil for cases generally. Likewise, the alleged retroactive effect of the provision does not occur, because the ten-year period of possession required for adverse possession is established in the Código Civil, and the challenged provision merely highlights certain elements inherent in adverse possession that are also defined in the general legislation, namely: the object of possession and the conditions under which possession must be exercised to qualify for adverse possession.

In other words, the provision does not establish any different principle—or more stringent requirement—with respect to the application of the general rules of adverse possession. It merely specifies how those rules must be applied, which is consistent with the logical result arising from the public-domain status (condición de bien demanial) of the property for which title is sought. Therefore, the amendment to Article 7 of the Ley de Informaciones Posesorias, whose text is challenged, is not considered to have introduced a different regime concerning the requirements for adverse possession that could have worsened the situation of persons exercising posesi* on ad usucapionem* over land that was declared to be in the public interest. (Tribunal Agrario, No. 173 at 16:29 hours on 31 de marzo del 2003). Accordingly, a possessor seeking to acquire through adverse possession land covered by forest that formed part of the national reserves must prove ten years of possession (original or transferred) and must have preserved the forest resource.".-* POR TANTO:* The judgment is affirmed.

SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ.- A las diez horas y treinta y cinco minutos del treinta y uno de mayo de dos mil trece.- * PROCESO DE INFORMACIÓN POSESORIA, promovido por [Nombre1] , mayor, casado, agricultor, vecino de Puntarenas, cédula de identidad CED1 - - . Intervienen en el proceso, la PROCURADURÍA GENERAL DE LA REPÚBLICA, representada por Lydiana Rodríguez Paniagua, de calidades desconocidas en autos, en su condición de procuradora adjunta; y el INSTITUTO DE DESARROLLO AGRARIO, cédula jurídica CED2 - - , representado por Carmelina Vargas Hidalgo, mayor, divorciada, abogada, vecina de Guachipelín, Escazú, cédula de identidad CED3 - - , en su condición de apoderada general judicial. Actúa como abogada directora del promovente, la letrada Kattia Portilla Fallas, colegiado diecisiete mil setecientos seis. Tramitado ante el Juzgado Agrario del Primer Circuito Judicial de la Zona Sur, Pérez Zeledón. * RESULTANDO:*

  1. 1El promovente interpuso proceso de información posesoria con el fin que se inscriba a su nombre en el Registro Público de la Propiedad la finca que describe así: "...Terreno de tacotales, bosque secundario y agricultura con una casa de habitación, el cual se encuentra ubicado en La Fortuna de Pilas, [Dirección1] , sea Buenos Aires del cantón tercero, sea Buenos Aires de la provincia de Puntarenas, colinda actualmente al norte con [Nombre2] , al sur con calle pública con un frene a la misma de seiscientos ochenta y cuatro metros con sesenta y cuatro centímetros lineales y ancho de catorce metros, al Este con [Nombre1] y al Oeste con [Nombre3] , con una medida de veinte hectáreas tres mil ochocientos diecinueve metros con setenta y siete decímetros cuadrados, según plano catastrado número P-setecientos diecisiete mil cuatrocientos noventa- dos mil uno."(folios 13, 93 vuelto y 94). *
  2. 2La Procuraduría General de la República se apersonó al proceso en los términos que corren de folio 41 a 42, asimismo lo hizo el Instituto de Desarrollo Agrario a folio 39, sin manifestar ambos su oposición a las presentes diligencias. *
  3. 3El juez Juan Carlos Castillo López, del Juzgado Agrario del Primer Circuito Judicial de la Zona Sur, Pérez Zeledón, mediante sentencia número 05-S-2013 de las quince horas veintiun minutos del diez de enero de dos mil trece, resolvió: "POR TANTO: De conformidad con los artículos 1, 4, 6, 15, 16 y 19 de la Ley de Informaciones Posesorias y 853, 856 y 860 del Código Civil se aprueban las presentes diligencias de Información Posesoria. Se ordena al Registro Público de la propiedad inscribir a nombre de [Nombre1] , quien es mayor, casado una vez, agricultor, cédula de identidad número CED4- - , vecino de La Fortuna de Pilas de Buenos Aires de Puntarenas, [Dirección2] , sin perjuicio de terceros de mejor derecho la finca que se describe así: Terreno de tacotales, bosque secundario y agricultura con una casa de habitación, el cual se encuentra ubicado en La Fortuna de Pilas, [Dirección1] , sea Buenos Aires del cantón tercero, sea Buenos Aires de la provincia de Puntarenas, colinda actualmente al norte con [Nombre2] , al sur con [Dirección3] con un frene a la misma de [Dirección4] y ancho de catorce metros, al Este con [Nombre1] y al Oeste con [Nombre3] , con una medida de veinte hectáreas tres mil ochocientos diecinueve metros con setenta y siete decímetros cuadrados, según plano catastrado número P- setecientos diecisiete mil cuatrocientos noventa- dos mil uno.Se estimó las presentes diligencias en la suma de cinco millones de colones y el inmueble en la suma de cinco millones de colones. Los colindantes no se opusieron y el edicto fue publicado en el Boletín Judicial respectivo. Queda afecto a limitaciones y restricciones de la Ley Forestal. Queda* prohibida la corta o eliminación de árboles. También queda afectado a la Ley de Aguas artículos 1, 19, 20, 33 y 34. También las aguas superficiales y subterráneas existentes en el inmueble son de dominio público y no forman parte de la finca. Deberá el titulante seguir las recomendaciones dadas por el INTA de mantener la cobertura boscosa y que podría aumentar los rendimientos de sus cultivos con la aplicación de fertilizantes, previo análisis de fertilidad del suelo. Se advierte que esta sentencia admite recurso de apelación la cual deberá interponerse ante este mismo órgano jurisdiccional en un plazo de cinco días.Si alguna de las partes va a presentar recurso de apelación contra esta resolución deberá remitir además aportar el recurso de apelación en formato electrónico. Por motivo de la inserción de la oralidad en materia agraria, si es el deseo de la parte que el Tribunal de alzada les confiera una audiencia oral, lo hagan saber en el mismo escrito de apelación, o en su defecto señalar un correo electrónico en donde se les pueda notificar." (lo destacado es del texto original a folios 93 vuelto a 94). *
  4. 4La licenciada Lydiana Rodríguez Paniagua, en su condición de Procuradora Adjunta, formuló recurso de apelación con indicación expresa de las razones por las cuales refuta la tesis del Juzgado de instancia. (folios 102 a 108). *

5. En la substanciación del proceso se ha observado las prescripciones legales, y no se notan la existencia de errores u omisiones en el fallo capaces de producir su nulidad. * Redacta la jueza Alvarado [Nombre4], y; * CONSIDERANDO:*

I.Este Tribunal prohija la relación de hechos tenidos por demostrados en el fallo recurrido al ser fiel reflejo de las probanzas constantes en autos.- *

II.La Procuradora adjunta Licenciada Lydiana Rodríguez Paniagua, apela la sentencia de las quince horas veintiun minutos del diez de enero del dos mil trece, argumentando que de la prueba recibida consta que la naturaleza del bien inmueble a titular es bosque. Considera los terrenos forestales y bosques de las reservas nacionales están afectos a dominio público, patrimonio natural del Estado, al menos desde la Ley Forestal 4465 de 1969 y su carácter demanial se mantiene en la Ley 7575 artículos 13 y14; y como fundamento de su criterio cita votos constitucionales y dictamenes de la Procuraduría General de la República visibles a folios 102 a a108.-*

III.No se comparten los agravios expuestos por la apelante por las siguientes razones: Del estudio de suelos elaborado por el Instituto Nacional de Innovación y Transferencia de Tecnología Agropecuaria (INTA), se desprende que el inmueble descrito en el plano catastrado número P-717490-2001, es terreno en su mayor parte con cultivos de arroz, nampí, maíz, plátano, y es bosque secundario; ver folios 16 y 17. Del plano visible a folio 1 se describe como terreno de tacotal.- Como se observa, del estudio técnico de suelos, el terreno tiene bosque secundario, y cultivos, no se trata entonces de un terreno en el que predomine el bosque virgen o primario, si no que predomina el interés por cuidar el recurso al dejar dicho bosque se esté regenerando. Por tal motivo, y dada esa naturaleza regenerativa del recurso forestal del inmueble, no es de aplicación la tesis de que el conteo el plazo decenal de posesión de terrenos boscosos los es antes de la afectación de dominio público según Ley Forestal de 1969, o cualquier otra tesis referida al conteo del plazo decenal y la afectación de dominio público, ello no es de aplicación a este caso concreto, pues nótese se trata de un inmueble compuesto en su gran mayoría por bosque secundario o tacotal y cultivos, lo que implica ese terreno fue regenerado en parte, por su poseedor- La Comisión Nacional de Certificación Forestal de Costa Rica define el bosque secundario como “... aquella tierra con vegetación leñosa de carácter sucesional secundaria que se desarrolla una vez que la vegetación original fue eliminada por actividades humanas o fenómenos naturales; con una superficie mínima de 0,5 ha y una densidad no menor a 500 árboles por ha de todas las especies, con dap no menor a 5 cm”* (CNCF 1999, Comisión Nacional de Certificación Forestal. 1999.

Estándares y procedimientos para el manejo sostenible y la certificación forestal en Costa Rica. San José,. Costa Rica. 54 p.) El concepto de Tacotal es "matorral espeso". Partiendo de estas definiciónes y del estudio técnico del INTA visible a folios 16 y 17, la mayor parte es de cultivos y un 28.7 % es bosque secundario o tacotal, lo que implica que el bosque original fue convertido en potreros o su vegetación fue eliminada, para luego dar lugar a un bosque secundario y tacotales, y el resto del inmueble son cultivos, por lo que declarar este inmeble como bien demanial sería no incentivar ese tipo de actividad regeneradora de bosque, pues los poseedores preferirían mantener sus terrenos de naturaleza de potreros para tenernos bajo su patrimonio y no correr el riesgo le sean declarados estatales. La actividad silvícola y la regeneradora de bosques secundarios y tacotales son actividades necesarias para la captación de carbono en la atmósfera y por ende medidas ambientales contra el calentamiento global, actividades beneficiosas para el medio ambiente por lo que sería incoherente castigar a los poseedores que tienen ese tipo de actividad regeneradora de bosques denegándoles la obtención de su título de propiedad. Por lo expuesto deberá confirmarse el fallo recurrido. *

IV.En el reconocimiento judicial practicado el 22 de mayo del 2012 (folio 72 y registo de grabación) se indica con claridad que se trata de terrenos en regeneración natural y tacotal Aunado a todo lo anterior se demostró que el mismo ha sido poseído por más de diez años, según se desprende de los testimonios de [Nombre5] , * * [Nombre6] y [Nombre7] , quienes afirman una posesión de más de diez años, y la dedicación del inmueble a tacotal y montaña. *

V. NOTA DEL JUEZ [Nombre8]

Si bien es cierto, la Ley de Tierras y Colonización de 1961 y la Ley Forestal de 1969, establecían que los terrenos cubiertos de bosque, sin ocupación privada eran parte de las reservas nacionales, dicha afectación al dominio público ha venido cambiando conforme la evolución de los Derechos Humanos, y específicamente con la incorporación de los de tercera generación, en los cuales se incluye el derecho humano a un ambiente sano y ecológicamente equilibrado. La Ley Forestal de 1996 reformó, el artículo 7 de la Ley de Informaciones Posesorias, para permitir la usucapión, en terrenos cubiertos de bosque, pero demostrando una posesión ecológica, a través de la conservación del recurso forestal, durante más de diez años, pudiéndose aprovechar la posesión trasmitida (ver sentencia de la Sala Constitucional No. 4587-97). El Tribunal Agrario sostuvo el criterio de que dicha posesión debía ser de carácter personal, pero la Sala declaró que el mismo era inconstitucional.

Sobre al tema de la interpretación del artículo 7 de la Ley de Informaciones Posesorias, y el Patrimonio Natural del Estado el Tribunal en reiteradas resoluciones ha expresado: “La Ley de Informaciones Posesorias, en su artículo 7, así como las Leyes Forestales han procurado proteger los recursos forestales de la acción humana, sometiéndolos a diversas formas de manejo forestal. Aunque se ha permitido la titulación de dichas áreas, que ya declaradas como áreas de conservación pasan a formar parte del Patrimonio Forestal del Estado, se exige el cumplimiento de otros requisitos más calificados. Eso nos conduce, directamente al concepto de posesión ecológica, y al criterio de la función ecológica de la propiedad forestal. En reiteradas sentencias, tanto de la Sala Primera de Casación, como del mismo Tribunal Superior Agrario, se han establecido los principios que deben regir para resolver éste tipo de situaciones agro-ambientales.

Nuestro país ha sido pionero en la construcción de los institutos de la posesión agraria y la posesión ecológica. La misma jurisprudencia ha reconocido y desarrollado estos institutos, así como el ciclo de vida de la posesión agraria y, recientemente de la posesión ecológica (dentro del más amplio criterio de la función ecológica de la propiedad forestal). La misma Jurisprudencia ha querido distinguir la propiedad y posesión empresarial donde se ejercita una actividad dirigida al cultivo del bosque, de aquella donde simplemente se realiza una actividad extractiva o bien, meramente conservativa. En estos últimos casos se estaría en presencia de una propiedad o posesi* ón forestal (sin empresa). Precisamente es en estos casos donde la Ley Forestal viene a establecer todo un régimen jurídico para la protección de los recursos forestales, sometiendo algunas veces al propietario en forma obligatoria al régimen forestal y en otros casos en forma voluntaria.

De esa forma, en la posesión forestal el poder de hecho se ejerce sobre un bien de vocación forestal o en su mayor parte destinado a proteger los recursos forestales, sin miras a su explotación o bien, dedic* ándolo a la simple extracción de especies maderables, a través de planes de manejo para lograr la regeneración natural del bosque. En uno y otro caso no existiría el desarrollo de un ciclo biológico vegetal o animal, ni asumiría el hombre ningún riesgo. Es por eso que la ley no tutela, al contrario reprime, la posesión a través de la cual se destruyan los recursos forestales de áreas protegidas. Además niega la posibilidad de adquirir derechos de posesión sobre tierras de las reservas nacionales cuando se ha ejercido una acción dañina en contra de los recursos forestales. Hoy, parte de la doctrina agrarista afirma la existencia de un Derecho forestal, con particularidades de sistema orgánico y completo, donde ocupan un lugar importante los institutos de la propiedad y posesión forestal.

En Costa Rica la propiedad forestal, y también la posesión forestal como derecho real derivado de aquella, o bien concebido en forma independiente, se comienza a perfilar desde el Código Fiscal de 1885, que establece todo un capítulo en cuanto a bosques cuyas regulaciones tienden a su conservación. Posteriormente la Ley de Terrenos Baldíos No. 13 del 6 de enero de 1939 incorpora dichos principios. Luego la Ley de Tierras y Colonización en su artículo 7 amplía las reservas nacionales para la protección de tales recursos.- VII. La legislación especial en cuanto a la tutela de la propiedad y posesi* ón* forestales tiene tres etapas en nuestro país. La primera etapa de la propiedad forestal se enmarca con la Ley No. 4465 del 35 de noviembre de 1969. La segunda se abre a través de una normativa mejor concebida a través de la Ley No. 7032 del 7 de abril de 1986, la cual fue posteriormente declarada inconstitucional.

La última opera con la promulgación de la Ley Forestal No. 7174 del 28 de junio de 1990, reformada recientemente, por Ley No. 7575 del 13 de febrero de 1996 (publicada en el alcance 21 de La Gaceta No. 72 del martes 16 de abril de 1996). En ellas, se contienen diversos regímenes de propiedad forestal, y limita el uso y aprovechamiento de los recursos por los particulares. No es posible adquirir la titularidad sobre terrenos con cobertura boscosa si no se demuestra haber protegido el recurso forestal. Su fundamento constitucional se encuentra en el párrafo segundo del artículo 45 de la Constitución. A través de limitaciones de interés social se protege el instituto de la propiedad y la posesión forestal. Esta no es igual a la civil, ni a la agraria, se trata de una propiedad para conservar, y por tanto los actos posesorios que en ella se realicen deben tener esa finalidad.- VIII. La posesión forestal ha tenido su régimen jurídico en las Leyes Forestales mencionadas.

Recae sobre un bien específico: los terrenos cubiertos de bosques o de aptitud forestal. El propietario o poseedor de tales bienes tiene la obligación de conservar los recursos forestales y no los puede aprovechar económicamente sino bajo las restricciones o limitaciones impuestas por la ley. Para la solución jurídica de conflictos que nazcan del ejercicio de la posesión forestal, se debe aplicar ese régimen jurídico especial y los principios del Derecho forestal. La Ley Forestal establece como función esencial y prioridad del Estado, velar por la protección, la conservación, el aprovechamiento, la industrialización, la administración y el fomento de los recursos forestales del país, de acuerdo con el principio de uso racional de los recursos naturales renovables. (Artículo 1). Todos los terrenos de aptitud forestal y los bosques del país, ya sea estatales o que estén reducidos a dominio particular, quedan sometidos a los fines de la ley.

El régimen forestal es el conjunto de disposiciones, entre otras, de carácter jurídico, económico y técnico, establecidas por la ley, su reglamento y demás normas, que regulen la conservación, la renovación, el aprovechamiento y el desarrollo de los bosques y terrenos de aptitud forestal del país. Por ello, para adquirir la propiedad forestal por usucapión, se requiere el ejercicio de la posesión forestal. El artículo 7 de la Ley de Informaciones posesorias, reformado por la Ley Forestal, establecía, antes de su reforma: "Artículo 7.- Cuando el inmueble a que se refiere la información esté comprendido dentro de una zona declarada parque nacional, reserva biológico, reserva forestal o zona protectora, el titulante tendrá que demostrar haber ejercido la posesión decenal con por lo menos diez años de antelación a la fecha de vigencia de la respectiva ley o decreto en que se creó la respectiva área silvestre.

Las fincas que estén fuera de esas áreas y que tengan bosques, solo podrán ser tituladas si el promovente demuestra haberlas poseído por diez años o más y haber protegido dicho recurso natural, en el entendido de que el inmueble tendrá que estar debidamente deslindado con cercas o carriles." En otros términos, el poder de hecho en la posesión forestal recae sobre el recurso natural "bosques" o "terrenos de aptitud forestal", y los actos posesorios deben ir encaminados a su protección y conservación. Sólo si se demuestra eso podría adquirirse o inscribirse terrenos a favor de dichos poseedores. De lo contrario, quedarían formando parte del patrimonio natural del estado (artículo 13 de la nueva Ley Forestal), con carácter inembargable e inalienable, y su posesión no causará ningún derecho a favor de los particulares (artículo 14 de la nueva Ley Forestal).- IX. El Tribunal Agrario, había interpretado el artículo 7 de la Ley de Informaciones Posesorias, antes de ser reformado por la nueva Ley Forestal, en el sentido de exigir una posesi* ón personal, ejercida con diez años de antelación a la creación de la reserva forestal o área protegida (Véase en tal sentido los Votos No. 169 de las 9 horas 40 minutos del 22 de marzo de 1991 y No. 251 de las 14 horas del 17 de abril de 1991)...".

Sin embargo, esa interpretación del artículo 7 de la Ley Forestal, fue cuestionada de "inconstitucional", por la aquí titulante, y la Sala Constitucional, en Voto No. 4587-97 (publicado en el Boletín Judicial No. 188 de fecha 1 de octubre de 1997) declaró, en lo que interesa, lo siguiente: "Se declara parcialmente con lugar la acción y, en consecuencia, que es inconstitucional la interpretación del artículo 7 de la Ley de informaciones Posesorias No. 139 del 14 de julio de 1941, cuyo texto corresponde a la reforma producida por la Ley Forestal No. 7174 del 28 de junio de 1990, de acuerdo con la cual para titular terrenos comprendidos en parques nacionales, reservas biológicas, reservas forestales o zonas protectoras, se requiere posesión personal con diez años de antelación a la fecha de vigencia de la ley o decreto que crea el área silvestre protegida, y que no favorece en estos casos la posesión transmitida por anteriores poseedores.

Esta sentencia es declarativa y sus efectos retroactivos, sin perjuicio de derechos adquiridos de buena fe...". De manera tal que los poseedores actuales pueden aprovechar la posesión trasmitida...X. La Ley Forestal No. 7575, también mantuvo las restricciones en la Ley de Informaciones Posesorias, para poder titular terrenos comprendidos en áreas protegidas. Al respecto dispone el actual numeral: "Artículo 7.-Cuando el inmueble al que se refiera la información esté comprendido dentro de un área silvestre protegida, cualquiera que sea su categoría de manejo, el titulante deberá demostrar ser titular de los derechos legales sobre la posesión decenal, ejercida por lo menos con diez años de antelación a la fecha de vigencia de la ley o decreto en que se creó esa área silvestre."(La negrita es nuestra). Es decir, la intención del legislador es que esas áreas se hayan mantenido protegidas, conservadas durante todo este tipo, incluso antes de la creación de las Reservas y áreas protegidas...".

(Resolución de las 14:50 horas del 20 de febrero de 1998 que responde al Voto No. 113). V.- En casos más recientes, el Tribunal ha rechazado los alegatos que ahora reitera el apelante, sobre la supuesta interpretación o aplicación retroactiva del artículo 7 de la Ley Forestal. En un caso similar al que nos ocupa se dijo: V.- En cuanto a lo alegado por el recurrente respecto a que el juzgador de instancia comete un error al aplicar el artículo 7 de la Ley de Informaciones Posesorias, el cual considera fue declarado inconstitucional por lo que debe analizarse las diligencias a la luz de lo dispuesto por el artículo 1 de dicha Ley, considera este Tribunal no lleva razón pues el artículo 7 citado no fue declarado inconstitucional, sino lo fue la interpretación que venía haciendo el Tribunal en cuanto no se contabilizaba la posesión ejercida por los anteriores transmitentes. De ahí, al estar vigente el ordinal 7 de la Ley de Informaciones Posesorias, debe el promovente demostrar una posesión decenal antes de la declaratoria del área silvestre protegida según lo indicó la Sala Constitucional en el voto No. 4587-97 (publicado en el Boletín Judicial No. 188 de fecha 1 de octubre de 1997).

Es importante mencionar que tampoco se estaría aplicando retroactivamente la ley como lo indica el recurrente, porque el plazo de diez años de posesión para usucapir se encuentra establecido en el Código Civil y la disposición cuestionada simplemente destaca ciertos elementos propios de la usucapión que también están definidos en la normativa general, como son: el objeto de la posesión y las condiciones en que ésta se debe ejercer para ser apta para la usucapión. En ese sentido es importante señalar lo dicho por la Sala Constitucional al respecto en el voto citado* “…El artículo 7 párrafo primero de la Ley de Informaciones Posesorias impugnado, cuyo texto es anterior a la última reforma por Ley Forestal No.7575 de 13 de febrero de 1996, regula el caso de la titulación de bienes inmuebles comprendidos dentro de un área declarada parque nacional, reserva biológica, reserva forestal o zona protectora.

Señala ese artículo que el titulante tendrá que demostrar haber ejercido la posesión decenal con por lo menos diez años de antelación a la fecha de vigencia de la ley o el decreto que creó el área silvestre. La disposición cuestionada regula el caso de titulación de un bien inmueble que ha sido afectado al dominio público con la declaratoria de área silvestre protegida, cualquiera que sea su especificidad. Corresponde ahora determinar si de acuerdo con la hipótesis que contempla la norma impugnada, a la luz de los criterios doctrinarios y jurisprudenciales que informan los institutos de la usucapión y de la posesión necesaria para usucapir, expuestos anteriormente, la norma cuestionada regula un tipo especial de posesión necesaria para adquirir la propiedad sobre los bienes inmuebles, que impone requisitos específicos que pueden infringir el derecho de propiedad o el principio de irretroactividad de la ley en perjuicio de derechos adquiridos o situaciones jurídicas consolidadas, regulados en la Constitución.

En primer término, debe señalarse que el artículo cuestionado no modifica -aumenta o disminuye- el plazo de diez años de posesión necesario para usucapir, fijado en el artículo 860 del Código Civil para la generalidad de los casos en que se pretende adquirir la propiedad de los bienes inmuebles por prescripción positiva. La ampliación del plazo que alega el accionante como infractor del derecho a la propiedad no se produce, porque dada la naturaleza del bien que se pretende titular (cosa pública), el plazo de posesión apta para la usucapión debe transcurrir antes de que se produzca la afectación del bien al dominio público. Es decir, la declaratoria de área silvestre protegida evita que cuente la posesión posterior a la afectación, e impide concretar los requisitos de la usucapión si a ese momento no se ha adquirido el derecho, o sea, no han transcurrido los diez años de posesión apta para usucapir con las condiciones que establece la ley.

Lo anterior es únicamente el resultado natural de aplicar los conceptos sobre el objeto de la posesión y su condición de ejercicio en calidad de titular, necesarios para la posesión ad usucapionem. Recuérdese que los bienes afectados al dominio público, tengan las especificaciones que tengan, no son susceptibles de adquisición por usucapión, si antes de producirse la afectación no se dieron las condiciones necesarias para la adquisición del derecho. En ese sentido, la disposición cuestionada, a pesar de que en apariencia regula un caso específico de usucapión, no crea un régimen con requisitos diferentes a los establecidos en el Código Civil para la generalidad de los casos. En ese sentido, tampoco se produce el alegado efecto retroactivo de la norma, porque el plazo de diez años de posesión para usucapir se encuentra establecido en el Código Civil y la disposición cuestionada simplemente destaca ciertos elementos propios de la usucapión que también están definidos en la normativa general, como son: el objeto de la posesión y las condiciones en que ésta se debe ejercer para ser apta para la usucapión.

Es decir, la norma no viene a establecer ningún principio diferente -o requisito más riguroso- en relación con la aplicación de las reglas generales de la usucapión. Simplemente especifica la forma en que deben aplicarse esas reglas, lo que coincide con un resultado lógico dada la condición de bien demanial del objeto a titular. De ahí que no se considere que la reforma al artículo 7 de la Ley de Informaciones Posesorias, cuyo texto se impugna, haya introducido un régimen diferente en relación con los requisitos de la usucapión, que haya podido agravar la situación de personas que se encontraban ejerciendo posesi* ón ad usucapionem* en terrenos que fueron declarados de interés público. (Tribunal Agrario, No. 173 de las 16:29 horas del 31 de marzo del 2003). De manera que el poseedor que pretenda adquirir por usucapión un terreno cubierto de bosque, que formaba parte de las reservas nacionales, deberá demostrar la posesión decenal (originaria o trasmitida), y haber conservado el recurso forestal.".-* POR TANTO:* Se confirma la sentencia.
