Attorney Roberto Soto Vega, identity card CED6-, bar registration number eight thousand forty-three, acts as special judicial attorney-in-fact for the plaintiff; and attorney Randall Emilio Ramírez Calero, identity card CED7- -, bar registration number eighteen thousand seven hundred forty-three, acts in that capacity for co-defendant Corporación Bella Vista del Golfo Sociedad Anónima. The proceeding is being heard by the Agrarian and Civil Court of Puntarenas, sitting as an Agrarian Court.- * Judge Vargas Vásquez writes the opinion; and, * WHEREAS:*

I.The facts deemed proven in the ruling issued at 8:30 a.m. on April 5, 2013, are adopted because they are consistent with the evidence in the record, and the report issued by the Delegación Policial de Paquera on March 13, 2013, at folio 32, is added as evidence supporting the second fact. In the same regard, the following is added at this level of review: 3º Interest 001 in property 59511-000 belongs to [Nombre2] (registry certification at folio 3), and interest 002 belongs to Corporación Bella Vista del Golfo Sociedad Anónima (registry certification at folios 3 and 5). 4º Certificate of Origin N° 095359 G stated that the timber would be extracted from [Dirección1] and authorized timber extraction from 5 hectares, totaling 780 cubic meters, out of a total plantation area of 15 hectares planted with melina trees (folios 78 and 79 and 107 to 115).-*

II.In this proceeding, when filing the complaint, Mr. [Nombre1] requested, as a precautionary measure, the suspension of the forestry activities being conducted in the disputed area; the issuance of an order to the Colegio de Ingenieros Agrónomos prohibiting the registration of forest-supervision contracts (contratos de regencia forestal) for the disputed area; and that the order be communicated to the Ministerio de Ambiente y Energía—hereinafter MINAE—and coordinated with the administrative police for the purpose of conducting judicial inspections (reconocimientos judiciales) at the site (folios 15 and 23). The Court conducted such an inspection of the property, as recorded in the minutes of 9:00 a.m. on April 5, 2013 (folio 41). Subsequently, in a ruling issued at 11:30 a.m. on April 5, 2013, it granted the precautionary measure requested by the plaintiff, ruling as follows: it ordered the suspension of forestry activities on the disputed property, including those conducted by the defendants, and ordered that this decision be communicated, through the Fuerza Pública de Paquera, to the persons working on the felling and extraction of melina trees, with a warning that failure to comply would result in the “institution of proceedings” for the offense of disobedience to authority; it further ordered that official communications be sent to the Ministerio de Ambiente y Energía, directing it to suspend all activities aimed at extracting timber, and to the Colegio de Ingenieros Agrónomos, directing it not to register forest-supervision contracts in favor of the defendants (folio 46).-*

III. The defendants filed an appeal against that ruling in a pleading submitted to the Court on April 10, 2013 (folio 91).*

They argue that the ruling is inconsistent with the factual circumstances insofar as it refers to possible environmental damage, because the April 8, 2013, decision issued by the Sistema Nacional de Áreas de Conservación—hereinafter SINAC—of MINAE, number ACT-OSRLP-194-2013, identified as the “Inspection Report concerning the dispute over the harvesting of a melina plantation and reopening of a road, Campiñas de Paquera sector,” which was requested by the Court, establishes that: a) the road was rehabilitated with the Municipality’s approval; b) the environmental damage caused by its rehabilitation was minimal and could be accepted by the State as necessary; c) there is an agreement between the business operator and the Public Administration, specifically the Área de Conservación Tempisque of MINAE, to restore the stream channels once the rains begin so as not to interfere with normal stormwater flow; d) the Secretaría Técnica Nacional Ambiental—hereinafter SETENA—determined that only a municipal permit was required to rehabilitate that road; any plantations located in “protective zones” (zonas protectoras) were encouraged by the State; e) no environmental damage was caused to the properties adjoining the road; f) forest plantations do not require a felling permit (permiso de corta), because the extraction of that timber is covered by Forest Plantation Certificate of Origin N° 005-2013, whose current forestry manager (regente forestal) is engineer Fernando Rojas Conejo, who, with the endorsement of the Colegio de Ingenieros Agrónomos, certified that the timber originated from the property owned by Corporación Bella Vista del Golfo Sociedad Anónima, pursuant to Colegio de Ingenieros Agrónomos Forest Supervision Form N° 001496G and Certificate of Origin for the Transportation of Timber from a Forest Plantation N° 095359G.

The appellant adds that the Área de Conservación Tempisque of MINAE did not consider it necessary to file any complaint, because all actions had been lawful and carried out in compliance with and respect for the national laws and municipal ordinances applicable to such cases. As relevant facts, the appellant states that the plaintiff did not prove that he holds any right to the 20 hectares of melina that he claims belong to him at the northeastern end of the property; the appellant further states that, within the 145 hectares of [Nombre1]’s property, only one sector at the southern end contains trees of that species, which were reported to the Fondo Nacional de Financiamiento Forestal—hereinafter FONAFIFO—to obtain Pago de Servicios Ambientales, whereas the northern end contains only scrubland (charral) or regenerating natural forest, as verified by the forestry manager. The appellant reproduces portions of the challenged ruling concerning the requirements for precautionary measures, objects to them on the grounds stated above, and asserts that the party it represents is the only party that has demonstrated a property right (derecho real) in the claimed property, whereas the plaintiff relies “solely on his own word” and on a report commissioned from an associate surveyor whose academic qualifications are lower than those of a surveying engineer with a master’s degree in valuation, the latter being the qualifications of engineer [Nombre5] , whose study is relied upon.

The appellant states that there is no melina in the overlapping area (área de traslape), and that other forestry managers attest that the felled timber was located within the property of the party it represents and not within the plaintiff’s property. It asserts that the expert retained by Mr. [Nombre1] erroneously stated that the portions of land allegedly overlapping belong to him and encompass 17.256 square meters; that assertion should not be considered credible, because an expert may determine only that “overlapping areas may exist” and has no authority to determine ownership of those areas, as that issue must be decided by the court. The appellant questions why, even assuming that fact to be true, the extraction of timber from 200.000 square meters of a melina plantation should be halted when only 8.5% (17.256 square meters) of the total is subject to potential overlap. It states that no environmental damage exists, as shown by report ACT-OSRLP-194-2013, much less any damage in forested areas; and that the party it represents has never worked in the area belonging to [Nombre1] that is subject to Pago de Servicios Ambientales, because it has always conducted its operations on land belonging to Bella Vista del Golfo Sociedad Anónima, the sole owner of a 20-hectare melina plantation that is 20 years old. 2° The appellant requests that the precautionary measures granted in the challenged ruling be vacated and, in the alternative, asks that Viento del Oeste Sociedad Anónima, represented by [Nombre3], be admitted as the holder of the ownership right to 10 hectares of melina plantation purchased for 60.000 United States dollars on December 8, 2011, under a contract executed for that purpose between Viento del Oeste Sociedad Anónima and co-owner [Nombre2] , as shown by case file EXPN2 of the Fiscalía de Cóbano de Puntarenas; that the timber be delivered to this company because it is a third-party purchaser in good faith (tercera adquirente de buena fe); and that it be allowed to continue extracting the remaining timber until the purchased 10 hectares have been delivered to it in full.

The appellant adds that, should any form of financial security be required to cover the possible pecuniary loss suffered by any injured party, Viento del Oeste Sociedad Anónima is willing to provide security in rem (garantía real) by means of a mortgage, in whatever amount is deemed appropriate, in favor of the Court or whomever the Court deems appropriate, so that it may continue extracting timber while preserving the “agrarian nature” (agrariedad) of the activity, thereby minimizing the social or economic harm to companies that are not parties to the dispute and whose rights are secured by valid and effective contracts. It likewise proposes delimiting the disputed area by using the expert study commissioned by the plaintiff, solely with respect to that end of the property and for those purposes, so that work would cease in that area while permitting continued extraction of the timber lawfully purchased and of timber from the remainder of the property owned by Corporación Bella Vista del Golfo Sociedad Anónima and [Nombre2] (folios 59 to 67).-*

IV.In a ruling issued at 7:15 a.m. on April 15, 2013, the Court denied the request to modify the precautionary measure and admitted the appeal filed by the defendants for consideration by this Court (folio 101). *

In addition, it ordered that the transport permits (guías de transporte) be requested from the forest manager (regente forestal) and that the value of the felled timber be stated so that, before its delivery to Viento del Oeste Sociedad Anónima—since it has a contract with Corporación Bella Vista del Golfo Sociedad Anónima—the proceeds from the valuation of the felled trees may be deposited to the order of the Court. Subsequently, the representative of the defendant and of Viento del Oeste Sociedad Anónima requested that security be ordered in the amount of 2.730.108 colones. The foregoing was based on the appraisal (avalúo) of the timber felled at the site, conducted by engineer [Nombre6], in the amount of 4.041.244 colones, of which 25,741 cubic meters have a value of 1.311.136 colones, corresponding to timber harvested outside the disputed area, that is, outside the area where the survey plats overlap; therefore, the amount located within the area of possible and potential overlap is 2.730.108 colones, which, it concluded, is the amount to be secured.

On that basis, it requested, as an alternative precautionary measure (medida cautelar alterna), that Viento del Oeste Sociedad Anónima be allowed to provide, as payment for such timber, first-priority mortgage security (garantía hipotecaria de primer grado) in favor of the Court over property registration CED8, sequence 002, an encumbrance to which the registered owner, Corporación Bella Vista del Golfo Sociedad Anónima, consents (folios 104 to 106). *

V.In a ruling issued at 7:15 a.m. on May 6, 2013, the Court granted * the plaintiff a hearing (audiencia) regarding the application filed by the defendant and ordered the latter to clarify whether it was withdrawing the appeal (recurso de apelación) filed against the ruling issued at 11:30 a.m. on April 5, 2013 (folio 117). This ruling was served on the parties on May 10 (folios 118 and 119). Within the allotted period, the plaintiff objected to the expert appraisal (peritaje) submitted by the defendant, stating that it “does not reflect the actual values or the volume existing on the property” (folio 136); it therefore requested that, if any counter-security measure (medida contracautelar) were admitted, an expert be appointed and the defendant be required to pay for that evidence so as to determine the current commercial price, value, and volume of the felled product and of that existing in the log and skid yards.

It added that the subject matter of the dispute (objeto de la litis) encompasses and comprises the entire property because the forest product was removed from its principal’s property and not from the defendant’s. It stated that the countermeasure was inadmissible but that, if admitted, an expert should be appointed and the amount determined should be deposited into the Court’s account, or a security interest (garantía real) should be furnished over the profits from the sale of the timber for the prevailing party (folio 136).-*

VI.In a ruling issued at 1:40 p.m. on May 15, 2013, the Court stated that, when issuing the precautionary measure, it had deemed it prudent to immobilize the timber at the site where it was located in view of the potential environmental harm and that it later asked the defendant to have the forest manager assess the value of that timber so that such value could be secured before the resource was released. Based on those grounds—and without mentioning or analyzing the arguments submitted by the plaintiff within the allotted period—it authorized [Nombre3] to furnish first-priority mortgage security in favor of the Court over its principal’s property registered in the Puntarenas Registry District, registration [Placa1], in the amount of 4.041.244 colones, authorizing it to dispose of the timber once the corresponding security had been recorded and lifting the restrictions ordered before MINAE, the Colegio de Ingenieros Agrónomos, and the Policía Administrativa (folios 133 and 134). That ruling was served on the plaintiff on May 17 (folio 135) and on the defendant on May 15 (folio 137).-*

VII.In a filing bearing no issuance date and stamped as received by fax by the Juzgado Civil de Puntarenas on March 21, 2013 (folio 138), the original of which was filed on May 23 (folio 146), the plaintiff requested clarification and supplementation (aclaración y adición) of the ruling issued at 1:40 p.m. on May 15 of that year. In its application, it challenges the Court’s failure to clarify or supplement the following: how is a mortgage created in favor of a judicial body to secure the outcome of the proceedings?; who appears on behalf of the Court?; how would the enforcement of a potential mortgage in favor of a judicial office be carried out?; must the property to be mortgaged under a typical precautionary measure be subject to a notice of pendency?; and how was the ruling entered when it had objected, within the statutory period, to the decision made in the ruling issued at 7:15 a.m. on May 6, 2013?

It stated that it reserved the right to file an appeal against the aforementioned ruling once the application for supplementation and clarification had been decided. The Tribunal finds that although the fax requesting clarification and supplementation bears a receipt date of March 21, 2013 (folio 138), it was actually filed on May 21, since the original was filed on May 23 (folio 138), in addition to the fact that it refers to a ruling issued on May 15; it therefore could not have been filed in March, as the Court apparently recorded by mistake. Accordingly, that request for clarification and supplementation was filed within the statutory period, although it was not decided, as will be analyzed below.-*

VIII.The plaintiff filed an appeal with a concomitant claim of nullity (recurso de apelación con nulidad concomitante) against the ruling issued at 1:40 p.m. on May 15, 2013 (folio 140). Regarding the grounds for nullity, it argued: 1º When the Court ruled, the period granted in the order issued at 7:15 a.m. on May 6, concerning the request submitted by the co-defendant, had not yet expired; consequently, the matter was decided without considering its position, in addition to the fact that it had objected to that request. 2º The ruling states that, in a ruling issued at 7:15 a.m. on April 15, the Court ordered the defendant to obtain an appraisal and deposit the value into the judicial office’s account; however, that ruling was never served on it, nor was it informed of the defendant’s request, leaving it without an opportunity to defend itself. In addition, it claimed prejudice because, in its view, essential elements for granting precautionary measures were absent, such as a prima facie showing of entitlement (apariencia de buen derecho), since, as it demonstrated, all of the forest product was felled within the plaintiff’s property and not within the area alleged to overlap.

It argues that the measure is unlawful because there has been no change in circumstances warranting the Court’s alteration of its position and authorization of forest extraction through the improper use of a mortgage in favor of a judicial authority, as though the judicial office were a legal person, in addition to the fact that the ruling contains ambiguous language and creates an unenforceable mortgage in favor of a property against which a notice of the lawsuit has been recorded.-*

IX.The Juzgado Civil y Agrario de Puntarenas, acting in its agrarian jurisdiction, without ruling on the plaintiff’s request for clarification and supplementation, issued a ruling at 7:15 a.m. on May 27, 2013, admitting with devolutive effect (efecto devolutivo) the appeal with a concomitant claim of nullity filed by that party against the ruling issued at 1:40 p.m. on the 15th day of the aforementioned month and year (folio 147). *

X.The analysis of the proceedings shows that, in this case, the court of origin issued two rulings related to the provisional measure (medida cautelar) sought by the plaintiff, against which appeals were admitted with non-suspensive effect (efecto devolutivo) before this Tribunal. The first, as noted, was issued at 11 hours 30 minutes on 5 de abril de 2013 and granted the provisional measure requested by the plaintiff, ordering the suspension of all forestry activities conducted on the property (folio 46). In the second, issued at 13 hours 40 minutes on 15 de mayo of that year, the aforementioned Court authorized Mr. [Nombre3] to dispose of the forest products after providing a mortgage bond (garantía hipotecaria) in favor of the Court (folio 133). Both rulings were appealed; the appeal lodged by the defendant against the first ruling was admitted with non-suspensive effect, but the second ruling was issued without the case file having been forwarded to the Tribunal.

Clarification and supplementation (aclaración y adición) of the latter ruling—issued at 13 hours 40 minutes on 15 de mayo of the current year—were requested; furthermore, co-defendant Corporación Bella Vista del Golfo Sociedad Anónima filed an appeal together with a motion for annulment (nulidad concomitante). The Court admitted the appeal without addressing the aforementioned request for clarification and supplementation. In light of the foregoing, the Tribunal finds that although, in principle, the appeal filed against the initial ruling of 11 hours 30 minutes on 5 de abril de 2013 should be heard first, in this case priority must be given to analyzing the motion for annulment filed against the ruling issued at 13 hours 40 minutes on 15 de mayo, in order to determine whether procedural irregularities must be corrected before ruling on the alleged errors. In this regard, the representative of Mr. [Nombre1] stated, as grounds for annulment of the ruling in question, that the defendant had been ordered to obtain an expert appraisal (peritaje) and deposit the assessed value into the Court’s account; nevertheless, that ruling was never served on him, nor was he informed of the defendant’s request, leaving him without an opportunity to defend himself.

Indeed, in the appealed ruling of 13 hours 40 minutes on 15 de mayo, the Court stated: “When the provisional measures were issued at eleven hours and thirty minutes on cinco de abril de dos mil trece, based on the information available to the judicial authority, it was deemed prudent to immobilize* the timber at the location where it was found, since consideration was even given to the possible environmental damage caused; subsequently, in the ruling of seven hours and fifteen minutes on quince de abril de dos mil trece, the judicial authority reconsidered the measure and asked the affected party to have the forest manager (regente forestal) conduct an economic valuation of that timber and, as a condition for its release, to deposit the stated amount with the Court...” (folio 133). Review of the case file shows that, in its ruling of 7 hours 15 minutes on 15 de abril de 2013, the Court admitted the appeal filed by the defendant against the ruling of 11 hours 30 minutes on 5 de abril, as corrected in the order of 7 hours on 23 de abril de 2013, because it had stated an incorrect date for the appealed ruling (folio 101).

In the same ruling, it denied the defendant’s request to modify the provisional measure that had been issued—and appealed—ordered the forest manager to prepare the timber transport permits (guías de transporte) and state the value of the cut timber, so that the corresponding security could be provided before the timber was delivered to Sociedad Viento del Oeste Sociedad Anónima (folio 99). Contrary to the defendant’s assertion as grounds for annulment, that ruling of 7 hours on 23 de abril de 2013 was served on that party and on the defendant on 23 de abril (folios 102 and 103); accordingly, it could not claim to have been unaware of it, particularly since it subsequently entered an appearance in the proceedings (Article 196 of the Código Procesal Civil, applied supplementarily). As an additional ground for annulment, it argues that when the Court ruled, the period granted in the order of 7 hours 15 minutes on 6 de mayo—concerning the co-defendant’s request to provide security—had not yet expired; consequently, the ruling was issued without considering its position on the matter, despite the fact that it had opposed that request.

Analysis of the processing of the case file shows that the plaintiff is correct, since the Court issued the ruling of 13 hours 40 minutes on 15 de mayo de 2013 before the three-day period granted to the plaintiff regarding the defendant’s request to provide counter-security (contragarantía) had expired. This violated the principle of due process (debido proceso) and, with it, the adversarial principle (principio del contradictorio) and the right of defense (derecho de defensa), leaving the plaintiff without an opportunity to defend itself, particularly since it exercised its right within the allotted period by opposing the request for counter-security and the report on the value of the timber submitted by the defendant, and by further arguing that the disputed area (área en litis) consists of the entire plantation sector and not merely a portion thereof, because, it stated, the plantation was established on its principal’s property, not in the overlapping area.

The Tribunal therefore finds that the rights of that party were impaired because, when ruling, the Court did not analyze those matters and confined itself to ruling on the defendant’s request for counter-security (contracautela) based on a report submitted by that party. The Tribunal accordingly agrees with this second ground for annulment raised by the plaintiff.-*

XI.The Tribunal deems it necessary to note that there are other procedural irregularities that must be corrected pursuant to the powers granted by Article 26 of the Ley de Jurisdicción Agraria. First, it must be noted that although the Court admitted with non-suspensive effect the appeal filed by the defendant against the ruling of 11 hours 30 minutes on 5 de abril de 2013 (folio 46), which ordered the suspension of the activities conducted by the defendant in the disputed area, it continued processing the provisional measure without forwarding a copy of the case file to the Tribunal so that it could rule on the appeal already admitted. It subsequently issued a second ruling, likewise appealed, at 13 hours 40 minutes on 15 de mayo de 2013 (folio 133), modifying the substance of the first decision by authorizing “...Mr. Gabriel Raúl Hernández, in compliance with the legal formalities, to provide a first-ranking mortgage bond in favor of the Court over his principal’s property registered in the Puntarenas registry district, real-property folio 59511-002, for the net amount of four million forty-one thousand two hundred forty-four colones, according to the report submitted by Forest Manager Engineer Fernando Rojas Conejo...” and ordering that the restrictions imposed in the originally appealed ruling of 11 hours 30 minutes on 5 de abril de 2013 be set aside.

The procedural approach used by the Court is incorrect; however, the Tribunal does not find that it renders the proceedings void merely because the required legal formalities were not observed, but rather because this second ruling left the plaintiff without an opportunity to defend itself—as it correctly states in its accompanying motion for annulment—by modifying the original ruling on the basis of a report from the forest manager retained by the defendant, the findings of which were challenged by the plaintiff, who requested that the report be prepared by an expert appointed by the Court. The Court did not consider that objection, nor did it consider the objection raised by the representative of Mr. [Nombre1] concerning the timber included by that forest manager in his report, which the representative considered incomplete because it did not include the timber that, according to him, was planted entirely on Mr. [Nombre1]’s property rather than in the overlapping portion of the properties.

More serious still is the fact that the ruling of 13 hours 40 minutes on 15 de mayo de 2013—the second ruling appealed—authorized [Nombre3] to dispose of the timber without specifying the capacity in which he was authorized to do so. In principle, he appears to have been authorized in his personal capacity, although he is not participating in the proceedings in that capacity; alternatively, he may have been authorized as the representative of defendant Corporación Bella Vista del Golfo Sociedad Anónima, or as the representative of Viento del Oeste Sociedad Anónima, which, although it is likewise not a party to the proceedings, was identified by the Court as the purchaser of the timber in the order of 7 hours 15 minutes on 15 de abril de 2013 (folio 99), and as the party requesting the provision of security in the order of 7 hours 15 minutes on 6 de mayo of that year (folio 117). Finally, the Tribunal notes that, contrary to Article 161 of the Código Procesal Civil, applied supplementarily, the Court failed to rule on the plaintiff’s request for clarification and supplementation of the ruling of 13 hours 40 minutes on 15 de mayo de 2013 and proceeded to admit the appeal, thereby violating that provision and the principle of procedural preclusion (preclusión procesal), since the ruling deciding that request supplements the principal ruling, and the time for appealing the latter begins to run only after the former becomes final, whether the request is granted or denied.

Consequently, the Tribunal finds that the ruling of 13 hours 40 minutes on 15 de mayo de 2013 must be annulled because it was issued prematurely, without considering the plaintiff’s objections to the defendant’s request for counter-security, and because it failed to specify the capacity in which [Nombre3] was authorized to dispose of the forest resource. As unnecessary, the Tribunal declines to rule on the alleged errors raised in the appeal filed by the plaintiff against the ruling of 13 hours cuarenta minutos on 13 de mayo de 2013.-*

X.With regard to the appeal filed by the defendant against the ruling issued at 11:30 a.m. on April 5, 2013, it must be noted that, in order to determine whether the interim measure (medida cautelar) requested by the plaintiff is warranted, it is necessary to ascertain whether the application satisfies the required legal prerequisites. It must be shown that there is a well-founded fear that, before judgment is rendered, the defendant will cause serious or difficult-to-remedy harm to the plaintiff’s right. In this regard, the Constitutional Chamber of the Supreme Court of Justice, in decision 3929 issued at 3:24 p.m. on July 18, 1995, stated: “Before addressing this point, it is essential to emphasize that ‘interim measures’ are not in themselves unconstitutional and that they are legally viable insofar as they satisfy the substantive prerequisites necessary for their adoption, namely: a current interest in the application; the possibility that the principal claim will be granted; the serious, irreparable, or difficult-to-remedy nature of the harm sought to be avoided; a favorable position of the public interest; judicial oversight and means of challenge; and the temporary nature of the measure.

In this regard, the Chamber, in judgment number 7190-94 issued at fifteen hours and twenty-four minutes on December sixth, nineteen ninety-four, held that: ‘...According to the most authoritative legal scholarship, protective* or interim measures arise in proceedings from the need to ensure effective judicial protection and may therefore be conceptualized as “a set of procedural powers vested in the judge—whether exercising judicial or administrative adjudicatory authority—to rule before the final decision, for the specific purpose of preserving the actual conditions essential for issuing and enforcing the final act.” Legal scholarship recognizes instrumentality and provisionality as two fundamental characteristics of interim measures, and their principal defining elements require that they be: a) lawful and legally possible; b) provisional, since they expire upon issuance of the final act; c) supported by grounds, that is, based on an actual factual foundation relating to the specific case; d) modifiable, in the sense that they may be expanded or reduced to adapt them to new needs; e) ancillary, since they are justified within principal proceedings; f) preventive in nature, because their purpose is to avoid harm to the interests and rights represented in the principal proceedings; g) protective in effect, as they seek to maintain a factual or legal state during the course of the proceedings, preventing situations that could impair the effectiveness of the judgment or final act; h) homogeneous and not identical in nature to the substantive right protected, so that they constitute effective preventive measures and not anticipatory enforcement acts....’” It follows from the foregoing holding of the aforementioned Chamber, which is binding, that in order for interim measures to be warranted, it is necessary to ascertain the current interest in the application; the possibility that the principal claim will be granted; the serious, irreparable, or difficult-to-remedy nature of the harm sought to be avoided; a favorable position of the public interest; judicial oversight and means of challenge; and the temporary nature of the measure.

Likewise, it must be determined that the requested measure does not amount to anticipatory enforcement of the relief sought. In this regard, it is important to take into account that, in the complaint, that party requested a declaration that it is the sole owner of property registration CED9, depicted on survey plan P-052511-1962; that it has exercised possession (posesión) of that property since 1962 publicly, peacefully, continuously, and as owner, tacking on the possession of the prior transferor possessors; and therefore requested the partial cancellation of registered survey plan P-0011421-1974 and property registration CED10 in the area where it overlaps the first-mentioned parcel; that the timber-harvesting activity carried out by the defendant was conducted in bad faith, and therefore requested that the defendant be ordered to pay damages, be evicted, cease the acts of interference, and pay costs (folios 13 and 14).

In the alternative, it requested that the overlapping area be divided equally, demarcated, and that the appropriate amendments be made in the Cadastre and the Registry, and that the defendant be ordered to pay damages and costs (folio 14). As an interim measure, it requested an order suspending the forestry activities being carried out on the property, issuance of an order to the Colegio de Ingenieros Agrónomos not to register forestry-supervision agreements (contratos de regencia forestal) for the disputed area, notification of that order to the Ministerio de Ambiente y Energía—hereinafter MINAE—and coordination with the administrative police to conduct judicial inspections (reconocimientos judiciales) at the site (folios 15 and 23). The document issued by the Delegación Policial de Paquera on March 13, 2013, states that there is a “large quantity of recently cut pieces of timber lying on the ground, which is located within the property of Mr. [Nombre7] () …” * (folio 32), without specifying how many trees were meant by that reference to a large quantity of trees; however, the record of the judicial inspection conducted by the Court at 9:00 a.m. on April 5, 2013, recorded that an area of approximately three hectares had been logged, as well as “four tree trunks (sic) of the melina species, seven varas long and approximately fourteen inches in diameter” (folio 41), and “five groups of melina logs, approximately fifty stacks ready to be loaded onto a truck” (folio 42).

The private report signed by [Nombre8], who identifies himself as an Associate Surveyor, states that the felled timber is located within property 15816-000 and includes an overlay of the plans involved (folios 33 to 36). That document was not disclosed to the defendant; however, because the defendant subsequently entered an appearance in the proceedings, it is considered that the defendant was not deprived of the opportunity to defend itself. The documentary evidence submitted to the case file shows that property 15816-000 is registered in the plaintiff’s name (registry certification at folio 7); interest 001 in property 59511-000 belongs to [Nombre2] (registry certification at folio 3), and interest 002 belongs to Corporación Bella Vista del Golfo Sociedad Anónima (registry certification at folio 5). In a ruling issued at 11:30 a.m. on April 5, 2013, the Court granted the interim measure requested by the plaintiff, ordered the suspension of forestry activities on the disputed property, including those carried out by the defendant, and ordered that this decision be communicated, through the Fuerza Pública de Paquera, to the persons engaged in felling and extracting melina trees, with a warning that failure to comply would result in the “initiation of criminal proceedings” for the offense of disobeying authority; it further ordered that official communications be issued to the Ministerio de Ambiente y Energía so that it would order the suspension of all activity aimed at extracting timber, and to the Colegio de Ingenieros Agrónomos so that it would not register forestry-supervision agreements in favor of the defendant (folio 46).

The Tribunal finds that there is a prima facie showing of a valid claim (apariencia de buen derecho) in this case because, based on an assessment of plausibility in light of the evidence submitted thus far, it may be inferred that the felled timber comes from the disputed area claimed in the complaint; likewise, there is a risk arising from delay (peligro de demora), because the possible duration of these proceedings may adversely affect the relief sought by the plaintiff if that resource is ultimately disposed of without any oversight, while the timber at issue may lose its economic value if it is not removed promptly. In its appeal, the defendant refers to report SINAC* N°ACT-OSRLP-194-2013, identified as the “inspection report concerning a dispute over the harvesting of* a melina plantation and the reopening of a road, Campiñas de Paquera sector,” which was requested by the Court, arguing, among other things, that the environmental damage referred to by the court below was not significant and that there is an agreement between the business operator and the public administration—specifically, the Área de Conservación Tempisque of MINAE*—to restore the stream channels once the rains begin so as not to interfere with the normal flow of stormwater.

It added that SETENA stated that only a municipal permit is required for the rehabilitation of the specific road and that forest plantations do not require a felling permit, because the timber is being extracted under Certificado de Origen de Plantación Forestal N° 005-2013, whose current forestry supervisor (regente forestal) is engineer Fernando Rojas Conejo, who, with the endorsement of the Colegio de Ingenieros Agrónomos, certified that the timber originated from the property owned by Corporación Bella Vista del Golfo Sociedad Anónima, pursuant to Formulario de Regencia Forestal del Colegio de Ingenieros Agrónomos N° 001496G and Certificado de Origen para el Transporte de Madera proveniente de una plantación forestal N° 095359G. The appellant relies on the certified document identified as ³Graphic Report on Melina Plantations in La Campiña de Río Grande Paquera´ (folio 28) and Formulario de Regencia Forestal N° 001496G of forestry supervisor Fernando Rojas Conejo (folio 69).

Likewise, document ACT-OSRLP-194-2013 of the Subregión* Lepanto* Paquera of the Área de Conservación Tempisque, dated April 8, 2013, entitled “Inspection Report* Concerning a Dispute over the Harvesting of a Melina Plantation and the Reopening of a Road, Campiñas de Paquera Sector´, stated that the work to reopen the road was carried out with the minimum impact necessary to restore a roadway that had been unused for many years and did not represent a significant environmental impact because no trees were removed and no significant earthworks (movimientos de tierra) were performed. The document further states that the road in question was restored in order to extract melina timber from a forest plantation established 15 or 20 years ago, and that such harvesting does not represent a significant environmental impact, as the activities were strictly necessary in order to harvest and extract that timber pursuant to the aforementioned Certificado de Origen de Plantación N° 005-2013 (folios 71 to 76).

The cited evidence shows that the trees were extracted from a plantation and that, consequently, no permit is required under section 28 of the Ley Forestal. This provision states: “Exception from the felling-permit requirement. Forest plantations, including agroforestry systems and individually planted trees and their products, shall not require permits for felling, transportation, processing, or export. However, in cases where, prior to the effective date of this law, a forestry agreement was entered into with the State in order to receive Certificados de Abono Forestal or an income-tax deduction, felling shall be carried out in accordance with the management plan (plan de manejo) approved by the Administración Forestal del Estado.”

In this regard, the Sala Constitucional de la Corte Suprema de Justicia, in decision [Telf1] issued at 14:30 on April 10, 2013, held: “…requiring a logging permit (permiso de corta) or even another less burdensome measure could only have the effect of discouraging investment in forest plantations, increasing the price of timber and, consequently, making irrational forest exploitation more profitable, even when conducted outside the legal framework.” More broadly, in decision 12716-2012 issued at 16:01 on September 12, 2012, that Chamber stated: 2The Chamber adopts as its own the opinion provided in this case by the Procuraduría General de la República, to the effect that, as a constitutional principle conditioning State action in environmental protection, the principle of objective environmental protection (principio de la objetivación de la tutela ambiental), or the principle of adherence to science and technology (principio de la vinculación a la ciencia y a la técnica), is recognized: “it translates into the need to substantiate decisions in this area through technical studies, both with respect to individual acts and provisions of a general nature—whether statutory or regulatory—from which arises the requirement of ‘adherence to science and technology,’ thereby conditioning the discretion of the Administration in this area.” (decision No. 17126-2006).

“The ‘environmental principle’ of ‘adherence to science and technology,’ which governs environmental matters, insofar as administrative decisions that may affect the environment require technical support, and, as such, limit and condition the Administration’s discretion in its actions.” (decision No. 14293-2005, reiterated in 11562-2006). “The starting point is the principle that environmental rules must have a technical basis, because their application must proceed from limits that determine the conditions governing the use and exploitation of natural resources.” (Voto No. [Telf2]). It is also related to the principle of reasonableness (principio de razonabilidad) as a standard of constitutionality (parámetro de constitucionalidad): “The principle of reasonableness, in relation to the fundamental right to the environment, requires that rules issued concerning this subject matter be duly supported by serious technical studies, even if no other legal provision expressly so requires.” (Voto No. [Telf3], emphasis added).

“Thus, the application of this environmental principle is directly linked to a standard of constitutionality applicable to conduct—both administrative conduct and that of private parties—and to the rules governing the subject matter, namely reasonableness—as developed in the case law of our Tribunal Constitucional—because its purpose is to promote the sustainability of the [sic] use of natural resources and the elements comprising the environment through their ‘proper use’; and by virtue of which it is clear that environmental protection must be directed toward the proper and intelligent use of those elements and their natural, sociocultural, technological, and political relationships, thereby safeguarding the heritage to which present and future generations are entitled; insofar as the production and use of technology must promote not only economic gains (freedom of enterprise), but above all the favorable development and evolution of the environment and natural resources in relation to human beings, that is, without causing them harm or injury, as our Tribunal Constitucional has held throughout its extensive case law, including from its earliest decisions, as in the above-cited judgments number 3705-93 and number 2006-17126.” (Voto No. [Telf4]).

From the foregoing it follows that, if what exists in the disputed area (área en litis) is a plantation, no MINAE permit is required for its exploitation; accordingly, the suspension order issued by the Court is deemed improper. Moreover, in this case, the extraction did not entail a significant environmental impact. The Court therefore disagrees with the first-instance judge’s reference to potential environmental damage, including the suspension of extraction permits, because no such permits are required for a melina plantation. Certificate of Origin No. 095359 G stated that the timber would be extracted from property [Dirección2] and 002 (folio 78), authorizing timber extraction from 5 hectares, with a volume of 780 cubic meters, out of a total of 15 hectares planted with *melina arborea* (folios 78 and 79 and 107 to 115). The document at folio 80 is written in a language other than Spanish, and the proposing party did not submit the required translation.

Nevertheless, the remaining evidence shows that the harvested melina plantation forms part of the disputed area; therefore, since the rights over that sector will be determined in the judgment, until that decision is rendered, Corporación Bella Vista del Golfo Sociedad Anónima must be authorized to dispose of those trees (folio 69). Before doing so, the Court must appoint an expert in accordance with the Poder Judicial’s roster of forestry engineers to determine precisely the number of trees cut, their location in relation to the property plans of the parties involved, their species and condition, whether they can be utilized under current conditions, and their estimated market value. Once that information is available, the Court shall place those assets at the disposal of the defendant, acting as court-appointed custodian (depositaria judicial), so that it may auction them through the Bolsa de Productos Forestales, by analogous application of Article 65 of the Ley Forestal concerning the seizure (decomiso) of forest products.

The foregoing must be documented, and the procedure for transporting the timber must conform to that established in Article 31 of the Ley Forestal. If those products cannot be sold at public auction, any person may utilize them after depositing with the Court the value assigned by the expert appraisal. In addition, based on an inspection of the disputed area and the documentation contained in this case file, the appointed expert must state the date on which those tree species will be ready for harvesting, as well as their quantity and geographic location. For that purpose, within eight days the defendant must deposit into the Court’s account the amount set by the Court for the appointed expert’s fees and travel expenses, with the warning that failure to comply will be deemed a lack of interest in utilizing the felled trees for sale, in which case the Court must appoint a court custodian for them.

The costs of storing the trees, while they cannot be offered for sale or properly utilized with prior authorization from the Court, shall be borne by the plaintiff. If the defendant does not agree to act as court-appointed custodian of the felled trees—in the circumstances described—the Court may appoint another suitable natural or legal person to proceed accordingly. All of the foregoing must be verified on-site by the Court, which must in turn appoint the expert, administer the oath to that expert, and proceed as directed once this decision becomes final, with due expedition given the urgency of the measure to ensure better use of the forest resource and in light of the prevailing climatic conditions in the area. This is because the appraisal of the felled trees provided by the supervising forestry engineer [Nombre6] is not that of a judicial expert selected from the roster in a manner that guarantees objectivity for the parties involved; moreover, the plaintiff objected to the appraisal and the other information he provided.

The foregoing is based on Article 242 of the Código Procesal Civil, applied on a supplementary basis pursuant to sections 6, 26, and 79 of the Ley de Jurisdicción Agraria, and sections 27, 28, 31, 56, and 65 of the Ley Forestal.-*

XI.Likewise, after analyzing the processing of the case file, the Tribunal finds that the Court must comply with institutional circulars and guidelines, specifically Circular Nº 82-95 of 19 de octubre de 1995, Article LXVIII, issued by Corte Plena, in order to prevent procedural irregularities that could affect the proceedings, including listing the name of [Nombre2] as a co-defendant on the cover of the case file, verifying that her right to due process (debido proceso), like that of the other parties, is respected, and ensuring that the index of proceedings reflects the actual processing of the case file. In addition, it must rule on the applications filed in these proceedings by Gabriel Raúl Hernández on behalf of Viento del Oeste Sociedad Anónima, which to date does not appear as a party or intervenor (folio 57); nevertheless, Mr. Hernández has repeatedly filed joint applications as the representative of that company and of co-defendant Corporación Bella Vista del Golfo Sociedad Anónima (folios 59 and 104).

It is further clarified that the document at folio 132, bearing three signatures at the bottom and dated 15 de mayo de 2013, but lacking a receipt stamp, has not been considered in issuing this decision because the signatures are not authenticated, the persons who purportedly signed it and who are attorneys did not affix their seals, and it was not filed by any of them, since it does not even contain proof of receipt. The receipt stamp on the document at folio 129 pertains solely to that document, as it refers to the filing of three folios on 13 de mayo (folio 129). Finally, the Court must notify the Guardia Civil de Paquera and the regional office of MINAE, which it had informed of the contents of the vacated decision (folios 43 to 45), that this ruling has been issued.-*

POR TANTO:* The decision issued at eleven hours thirty minutes on cinco de abril de dos mil trece is reversed. In its place, the interim measure (medida cautelar) requested by the plaintiff is denied under the terms proposed by that party, and this appellate court hereby orders as follows: Until judgment is issued or the circumstances under which this interim measure is ordered change, co-defendant Corporación Bella Vista del Golfo Sociedad Anónima is authorized to dispose of the felled trees located in the disputed area; before doing so, the Court shall appoint an expert from the Poder Judicial’s roster of forestry engineers to determine precisely the number of felled trees, their location in relation to the survey plans of the properties belonging to the parties involved, their species, their condition, whether they may be utilized in their present condition, and their estimated market value.

Once this information has been obtained, the Court shall place those assets at the disposal of the defendant as court-appointed custodian (depositaria judicial), so that it may list them on the Bolsa de Productos Forestales. The foregoing must be documented, and the procedure for transporting the timber (trasegar la madera) must conform to that established in article 31 of the Ley Forestal. If those products cannot be sold at public auction, any person may utilize them after depositing with the Court the value assigned by the expert appraisal. Based on the judicial inspection (reconocimiento judicial) conducted in the area in dispute, accompanied by the agrarian judge, the parties in attendance, and the documentation contained in this case file, the appointed expert must also indicate the date on which the remaining tree species will be ready for harvesting (aprovechamiento), in view of their current condition and the proceedings conducted before MINAE, as well as the number of those plantation trees, in accordance with the applicable technical procedure.

Within the eight-day period granted by the Court, the defendant must deposit into the Court’s account the amount set for the appointed expert’s fees and travel expenses, with the warning that, in the event of noncompliance, it shall be deemed uninterested in harvesting the felled trees for sale, in which case the Court must appoint another natural or legal person as their court-appointed custodian to proceed as indicated. If the trees cannot be sold or duly utilized with the Court’s prior authorization, the costs of their custody shall be borne by the plaintiff. If the defendant does not agree to serve as court-appointed custodian of the felled trees—in the circumstances described—the Court may appoint another suitable natural or legal person to proceed accordingly. The Court must verify all of the foregoing on site and must, in turn, appoint the expert, arrange for the expert to be sworn in, and proceed as indicated once this decision becomes final, acting with due dispatch in view of the urgency of the measure, so as to ensure better utilization of the forest resource and account for the climatic conditions prevailing in the area.

The decision issued at thirteen hours forty minutes on quince de mayo de dos mil trece is annulled. The Court must comply with institutional circulars and guidelines, specifically Circular Nº 82-95 of 19 de octubre de 1995, Article LXVIII, issued by Corte Plena, in order to prevent procedural irregularities that could affect the proceedings, including listing the name of [Nombre2] as a co-defendant on the cover of the case file, verifying that her right to due process, like that of the other parties, is respected, and ensuring that the index of proceedings reflects the actual processing of the case file. In addition, the Court must rule on the applications filed in these proceedings by [Nombre3] on behalf of Viento del Oeste Sociedad Anónima, which to date does not appear as a party or intervenor. With regard to the document added at folio ciento treinta y dos, the Court must issue the appropriate ruling concerning its inclusion in the case file without a date of receipt and, if necessary, order the corresponding disciplinary investigation.

SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ.- A las trece horas y treinta y cinco minutos del diecinueve de julio de dos mil trece.- * PROCESO ORDINARIO establecido por [Nombre1] , mayor, casado, ingeniero agrónomo, vecino de palmares, cédula de identidad CED1 - - ; contra CORPORACIÓN BELLA VISTA DEL GOLFO SOCIEDAD ANÓNIMA, cédula jurídica CED2 - - , representada por su presidente [Nombre3] , de único apellido en razón de su nacionalidad estadounidense, mayor, soltero, ingeniero, pasaporte CED3 ; y su vicepresidente [Nombre4] , pasaporte CED4 , ambos en calidad de apoderados generalísimos sin límite de suma, en la condición de Presidente y Vicepresidente, respectivamente, pudiendo actuar conjunta o separadamente; y [Nombre2] , mayor, cédula de identidad CED5- , vecina de Betania* de San Pedro.

Actúan como apoderados especiales judiciales, de la parte actora el letrado Roberto Soto Vega, cédula de identidad CED6- , colegiado ocho mil cuarenta y tres; y de la codemandada Corporación Bella Vista del Golfo Sociedad Anónima, el licenciado Randall Emilio Ramírez Calero, cédula de identidad CED7- - , colegiado dieciocho mil setecientos cuarenta y tres. El proceso se tramita en el Juzgado Agrario y Civil de Puntarenas, actuando como Agrario.- * Redacta la jueza Vargas Vásquez; y, * CONSIDERANDO:*

I.Se prohíjan los hechos tenidos por acreditados en la resolución de las 8 horas 30 minutos del 5 de abril de 2013, al ser acordes con las probanzas constantes en autos, agregándose como prueba al segundo hecho el informe emitido por la Delegación Policial de Paquera, del 13 de marzo de 2013, de folio 32. De tal naturaleza, se adiciona en esta Instancia lo siguiente: 3º El derecho 001 de la finca 59511-000 le pertenece a [Nombre2] (certificación registral de folio 3) y el 002 de Corporación Bella Vista del Golfo Sociedad Anónima (certificación registral de folios 3 y 5). 4º En el Certificado de Origen N° 095359 G se señaló, la madera sería extraída de la [Dirección1] , y en el que se autoriza la extracción de la madera en 5 hectáreas, con un volumen de 780 metros cúbicos, de un total de 15 hectáreas de plantación de melina arbórea (folios 78 y 79 y 107 a 115).-*

II.En este proceso, al plantear la demanda, el señor [Nombre1] , pidió como medida cautelar la suspensión de las actividades forestales que se están realizando en el área en litis, la emisión de una orden al Colegio de Ingenieros Agrónomos para que no se inscribiesen contratos de regencia forestal en el área en litis, y que esa orden se comunicase al Ministerio de Ambiente y Energía -en adelante MINAE- y la coordinación con la policía administrativa para la realización de reconocimientos judiciales en el sitio (folio 15 y 23). El Juzgado realizó tal un reconocimiento del inmueble según consta en acta de las 9 horas del 5 de abril de 2013 (folio 41). Luego, en resolución de las 11 horas 30 minutos del 5 de abril de 2013, acogió la medida cautelar solicitada por la parte demandante, declarando lo siguiente: ordenó suspender las actividades forestales en el inmueble en litis, incluyendo la realizada por la parte demandada y comunicar tal decisión a las personas que se encontrasen laborando en la tala y extracción de árboles de melina, por medio de la Fuerza Pública de Paquera, con apercibimiento, en caso de incumplimiento, de “abrir causa” por el delito de desobediencia a la autoridad; expedir oficios al Ministerio de Ambiente y Energía para que ordenase la suspensión de toda actividad tendiente a la extracción de madera y al Colegio de Ingenieros Agrónomos para que no inscribiese contratos de regencia forestal a favor de la parte demandada (folio 46).-*

III.La parte demandada interpuso recurso de apelación contra dicho pronunciamiento en memorial presentado a estrados el 10 de abril de 2013 (folio 91).*

Argumenta, la resolución dista de la realidad fáctica en cuanto se refiere al posible daño ambiental ocurrido, pues del pronunciamiento del ocho de abril de 2013, emitido por el Sistema Nacional de Áreas de Conservación -en adelante SINAC- del MINAE, número ACT-OSRLP-194-2013, identificado como “Informe de inspección por conflicto de aprovechamiento de plantación de melina y reapertura de camino, sector Campiñas de Paquera” solicitado por el Juzgado, se desprende: a) el camino se rehabilitó con el visto bueno de la Municipalidad; b) en su rehabilitación el daño ambiental fue mínimo y asumible por el Estado como necesario; c) existe un compromiso entre el empresario y la Administración Pública, concretamente, el Área de Conservación Tempisque del MINAE, de rehabilitar los causes de la quebrada, una vez comiencen las lluvias, para no afectar el recorrido pluvial normal; d) la Secretaría Técnica Nacional Ambiental -en adelante SETENA- se pronunció acerca de que únicamente era necesario un permiso municipal para la rehabilitación de ese camino; las posibles plantaciones en “zonas protectoras” fueron incentivadas por el Estado; e) no se realizaron daños ambientales en las fincas aledañas al camino; f) las plantaciones forestales no necesitan permiso de corta, pues para la extracción de esa madera se cuenta con el Certificado de Origen de Plantación Forestal N° 005-2013, cuyo regente forestal actual es el ingeniero Fernando Rojas Conejo, quien, con el aval del Colegio de Ingenieros Agrónomos, certificó que el origen de la madera proviene de la finca propiedad de Corporación Bella Vista del Golfo Sociedad Anónima, según Formulario de Regencia Forestal del Colegio de Ingenieros Agrónomos N° 001496G y Certificado de Origen para el Transporte de Madera, proveniente de una plantación forestal N° 095359G.

Agrega el recurrente, el Área de Conservación Tempisque del MINAE no consideró necesario interponer denuncia alguna, pues se ha actuado a derecho y con apego y respeto a las leyes nacionales y ordenanzas municipales previstas para estos casos. Cita, como hechos de interés que la parte demandante no probó que ostente algún derecho sobre las 20 hectáreas de melina que alega son suyas en el extremo noreste del inmueble; y agrega, dentro de las 145 hectáreas de la finca de [Nombre1] , sólo hay un sector en el extremo sur con árboles de esa especie, reportados al Fondo Nacional de Financiamiento Forestal -en adelante FONAFIFO- para lograr el pago de servicios ambientales, no así en el extremo norte, sector en el que sólo tiene charral o bosque natural en regeneración, lo cual fue constatado por el regente forestal. El recurrente transcribe algunas partes de la resolución recurrida vinculadas con los presupuestos de las medidas cautelares, objetándolas con los argumentos citados y señala, su representada es la única que ha demostrado tener derecho real sobre la propiedad alegada, mientras que el demandante se basa “en su decir de boca” y en un informe contratado a un topógrafo asociado, con un grado académico inferior al de un ingeniero topógrafo, con maestría en valuación, siendo este último el estudio con el que cuenta el ingeniero [Nombre5] .

Señaló, no existe melina en el área de traslape, y hay otros regentes forestales quienes dan fe de que la madera cortada está dentro de la finca de su representado, y no en la del demandante. Indica, el perito contratado por el señor [Nombre1] afirmó, erróneamente, que las porciones de tierra en supuesto traslape son propiedad de éste y abarca 17.256 metros cuadrados, lo cual no debe merecer credibilidad, pues lo que puede determinar un perito es que “eventualmente existen áreas en traslape”, sin tener potestad para determinar la propiedad de estas áreas, pues es el tribunal quien puede decidir sobre ello. Se cuestiona el porqué aún en la eventualidad de que ese hecho sea cierto, debe detenerse la extracción de 200.000 metros cuadrados de madera de melina de plantación, si sólo un 8.5% (17.256 metros cuadrados) del total está en un eventual traslape. Menciona, no hay daño al ambiente, conforme se desprende del informe ACT-OSRLP-194-2013, y menos aún en zonas boscosas; y en la zona sometida a pago de servicios ambientales, propiedad de [Nombre1] , su representada nunca ha trabajado, pues siempre ha desarrollado sus labores en el terreno de Bella Vista del Golfo Sociedad Anónima, exclusiva dueña de una plantación de 20 hectáreas de melina, de 20 años de antigüedad. 2° El recurrente pide se dejen sin efecto las medidas cautelares otorgadas en la resolución recurrida y pide de manera subsidiaria admitir a Viento del Oeste Sociedad Anónima, representada por [Nombre3] , como detentador del derecho de propiedad de 10 hectáreas de plantación de melina, compradas por 60.000 dólares de los Estados Unidos de Norteamérica, desde el 8 de diciembre de 2011, en un contrato que para ese efecto fue confeccionado entre Viento del Oeste Sociedad Anónima y la copropietaria [Nombre2] , conforme se desprende del expediente EXPN2 de la Fiscalía de Cóbano de Puntarenas; se entregue la madera a esta empresa, al ser tercera adquirente de buena fe y se le permita continuar extrayendo la madera restante, hasta habérsele satisfecho con la entrega de las 10 hectáreas compradas.

Agrega el recurrente, de ser necesario algún tipo de garantía de índole patrimonial para respaldar el posible daño pecuniario de cualquier perjudicado, la empresa Viento del Oeste Sociedad Anónima está dispuesta a dar garantía real por medio de hipoteca, en la cantidad que se estime pertinente, a favor del Juzgado o de quien éste estime necesario, para poder continuar con la extracción y seguir resguardando la “agrariedad”, logrando con ello provocar el menor daño social o económico a empresas ajenas al litigio y que tienen sus derechos asegurados por medio de contratos válidos y efectivos. Así mismo, propone delimitar el área en conflicto utilizando el estudio pericial ordenado por el demandante, sólo en ese extremo y para tales efectos; de tal forma que no se continúe laborando en esa área y poder continuar extrayendo la madera legítimamente comprada y del resto de la finca propiedad de Corporación Bella Vista del Golfo Sociedad Anónima y [Nombre2] (folios 59 a 67).-*

IV.El Juzgado, en resolución de las 7 horas 15 minutos del 15 de abril de 2013, rechazó la solicitud de modificación de la medida cautelar; admitió para ante este Tribunal el recurso de apelación interpuesto por la parte demandada (folio 101). *

Además, ordenó pedir las guías de transporte al regente forestal e indicar el valor de la madera cortada, para que, previa entrega de ésta a Viento del Oeste Sociedad Anónima -al tener ésta un contrato con Corporación Bella Vista del Golfo Sociedad Anónima- deposite el dinero resultante de la valoración de los árboles cortados a la orden del Juzgado. Posteriormente, el representante de la demandada y de Viento del Oeste Sociedad Anónima, solicitaron se ordenara garantía por la suma de 2.730.108 colones. Lo anterior, con base en el avalúo de la madera talada en el sitio, hecho por el ingeniero [Nombre6] , en la suma de 4.041.244 colones, de la cual, 25,741 metros cúbicos poseen un valor de 1.311.136 colones, que corresponde a madera aprovechada fuera del área en litigio, es decir, fuera de la zona de traslape de planos, por lo que el monto que se encuentra en el área de posibles y eventuales traslapes es de 2.730.108 colones, siendo éste, concluye, el monto a garantizar. Con base en ello, pidió como medida cautelar alterna se admita que Viento del Oeste Sociedad Anónima entregue como pago de tal madera una garantía hipotecaria de primer grado, a favor del Juzgado, sobre la finca matrícula CED8, secuencia 002, gravamen que consiente la titular registral, Corporación Bella Vista del Golfo Sociedad Anónima (folios 104 a 106). *

V.El Juzgado, en resolución de las 7 horas 15 minutos del 6 de mayo de 2013, confirió audiencia a * la parte demandante de la gestión realizada por la parte demandada y previno a ésta aclarar si estaba desistiendo del recurso de apelación incoado contra la resolución de las 11 horas 30 minutos del 5 de abril de 2013 (folio 117). Este pronunciamiento fue comunicado a las partes el 10 de mayo (folios 118 y 119). Dentro del plazo conferido, la parte demandante se opuso al peritaje aportado por la demandada, indicando que "no refleja los valores reales ni el volumen existente en la finca" (folio 136) por lo que solicitó, de ser admitida alguna medida contracautelar, se nombre una persona experta y que sea cancelada esa prueba por la accionada, para que determine el precio, valor y volumen actual y comercial del producto cortado y el existente en patios de acopio y de arrastre. Agregó, el objeto de la litis abarca y comprende la totalidad de la finca, pues la extracción del producto forestal se realizó dentro de la propiedad de su representada y no en la de la demandada. Indicó que la contramedida es improcedente, pero que de admitirse, debía designarse una persona experta y que el monto que se determine se deposite en la cuenta del Juzgado o se rinda una garantía real sobre las utilidades de la comercialización de la madera para la parte gananciosa (folio 136).-*

VI.En resolución de las 13 horas 40 minutos del 15 de mayo de 2013, el Juzgado señaló que al momento de emitir la medida cautelar consideró prudente inmovilizar la madera en el sitio que se encontraba, ante el posible daño ambiental y luego, pidió a la parte demandada valorar el precio de esa madera, por parte del regente forestal, a fin de garantizar el mismo, previa entrega del recurso; argumentos con base en los cuales -y sin mencionar ni analizar los alegatos expuestos por la parte demandante, dentro del plazo conferido- autorizó a [Nombre3] a rendir garantía hipotecaria de primer grado a favor del Juzgado sobre la finca de su representada inscrita en el Partido de Puntarenas, matrícula [Placa1] por la suma de 4.041.244 colones, quedando autorizado a disponer de la madera una vez conste la respectiva garantía, dejándose sin efecto las restricciones ordenadas ante el MINAE, el Colegio de Ingenieros Agrónomos y la Policía Administrativa (folios 133 y 134). Ese pronunciamiento fue comunicado a la parte demandante el 17 de mayo (folio 135) y a la demandada el 15 de mayo (folio 137).-*

VII.La parte demandante, en memorial sin fecha de emisión y con sello de recibido de fax del Juzgado Civil de Puntarenas el 21 de marzo de 2013 (folio 138), cuyo original fue presentado el 23 de mayo (folio 146), pidió aclaración y adición de la resolución de las 13 horas 40 minutos del 15 de mayo del citado año. En su gestión, cuestiona que el Juzgado no aclaró ni adicionó lo siguiente: ¿cómo se constituye una hipoteca a favor de un órgano judicial para garantizar los resultados del proceso?; ¿quién comparece en representación del Juzgado?; ¿cómo se materializa la ejecución de una eventual hipoteca a favor de un despacho judicial?; ¿si la finca ha hipotecar por medida cautelar típica debe estar anotada?; y ¿cómo se adopta la resolución si se opuso dentro del plazo legal a la decisión tomada en el pronunciamiento de las 7 horas 15 minutos del 6 de mayo de 2013?. Dijo reservarse el derecho de interponer recurso de apelación contra la aludida resolución, una vez se resuelva sobre la gestión de adición y aclaración.

Estima el Tribunal que aunque el fax donde se pidió la aclaración y adición tiene fecha de recibido 21 de marzo de 2013 (folio 138), en realidad se presentó el 21 de mayo puesto que su original se presentó el 23 de mayo (folio 138), aunado al hecho de que está refiriéndose a una resolución que se emitió el 15 de mayo, de manera tal que no podría tratarse de marzo, como por error se estima lo consignó el Juzgado. De ahí, tal aclaración y adición se presentó dentro del plazo legal, sin que la misma fuera resuelta, como se analizará de seguido.-*

VIII.La parte demandante interpuso recurso de apelación con nulidad concomitante contra la resolución de las 13 horas 40 minutos del 15 de mayo de 2013 (folio 140). En relación con los motivos de nulidad alegó: 1º El Juzgado al resolver, tenía pendiente aún el término concedido en auto de las 7 horas 15 minutos del 6 de mayo, que se refería a la solicitud realizada por la codemandada, de manera tal que se decidió sin considerar su posición al respecto, aunado al hecho de que formuló oposición a tal gestión. 2º La resolución hace alusión que el 15 de abril en resolución de las 7 horas 15 minutos, ordenó al demandado realizar un peritaje y depositar el valor en la cuenta del Despacho; no obstante, ese pronunciamiento nunca le fue notificado y tampoco se puso en conocimiento la solicitud de la demandada, dejándole en estado de indefensión. Aunado a ello, se mostró agraviado porque en su criterio están ausentes elementos esenciales para la adopción de medidas cautelares como la apariencia de buen derecho, pues tal y como acreditó, la totalidad del producto forestal cortado se hizo en el área de la finca de la parte demandante, no en la que se reclama como traslapada.

Argumenta, la medida es ilegal porque no ha mediado cambio de circunstancias para que el Juzgado varíe su criterio y autorice la extracción forestal mediante el uso indebido del instituto de la hipoteca a favor de una autoridad judicial, como si el Despacho fuera un sujeto de derecho, aunado al hecho de que la resolución contiene términos oscuros y constituye una hipoteca inejecutable a favor de una finca con una demanda anotada.-*

IX.El Juzgado Civil y Agrario de Puntarenas, actuando como Agrario, sin pronunciarse sobre la solicitud de aclaración y adición planteada por la parte demandante, emitió resolución de las 7 horas 15 minutos del 27 de mayo de 2013, en la que admitió en efecto devolutivo el recurso de apelación con nulidad concomitante interpuesto por dicha parte contra el pronunciamiento de las 13 horas 40 minutos del día 15 del citado mes y año (folio 147). *

X.Del análisis del proceso se desprende que en este caso existen dos resoluciones emitidas por el Juzgado de origen en relación contra las cuales se admitió recurso de apelación, en efecto devolutivo, para ante este Tribunal, vinculadas con la medida cautelar gestionada por la parte demandante. La primera de ellas, como se señaló, fue emitida a las 11 horas 30 minutos del 5 de abril de 2013 y en ella se acogió la medida cautelar solicitada por la parte demandante, disponiéndose la suspensión de todas las actividades forestales desarrolladas en el inmueble (folio 46). En la segunda, dictada a las 13 horas 40 minutos del 15 de mayo del citado año, el Despacho citado autorizó al señor [Nombre3] para que dispusiera del producto forestal previa rendición de garantía hipotecaria a favor del Juzgado (folio 133). Contra ambas se interpuso recurso de apelación; admitiéndose el opuesto por la parte demandada contra la primera en efecto devolutivo, pero sin proceder al envío del expediente al Tribunal, se emitió la segunda resolución.

Contra esta última -de las 13 horas 40 minutos del 15 de mayo del año en curso- se pidió aclaración y adición; y además, la codemandada Corporación Bella Vista del Golfo Sociedad Anónima interpuso recurso de apelación con nulidad concomitante. El Juzgado admitió la apelación sin referirse a la aclaración y adición citada. Conforme a lo expuesto, considera el Tribunal que aunque en principio debe conocerse primero sobre la apelación formulada contra la resolución inicial de las 11 horas 30 minutos del 5 de abril de 2013, en este caso debe analizarse prioritariamente la gestión de nulidad planteada contra la dictada a las 13 horas 40 minutos del 15 de mayo, a fin de valorar si es preciso corregir irregularidades procesales antes de emitir criterio sobre los agravios expuestos. En tal orden de ideas, el representante del señor [Nombre1] , como motivo de nulidad de la resolución en referencia indicó, se había ordenado al demandado realizar un peritaje y depositar el valor en la cuenta del Despacho; no obstante, ese pronunciamiento nunca le fue notificado y tampoco se puso en conocimiento la solicitud de la demandada, dejándole en estado de indefensión.

En efecto, en la resolución de las 13 horas 40 minutos del 15 de mayo -apelada- el Juzgado indicó: "Al momento que se dictaron las medidas cautelares, de las once horas con treinta minutos del cinco de abril de dos mil trece, con los elementos que la Autoridad judicial tuvo a mano, consideró prudente inmobilizar* la madera en el sitio que se encontraba; ya que incluso se consideró el posible daño ambiental ocasionado; luego en la resolución de las siete horas quince minutos del quince de abril de dos mil trece, la Autoridad judicial, reconsidera la medida y pide a la parte afectada hacer una valoración económica de dicha madera por parte del regente forestal, y que para entregarle esta madera, debía depositar a la orden del Juzgado la suma indicada..." (folio 133). Del estudio del expediente se deduce que en resolución de las 7 horas 15 minutos del 15 de abril de 2013, el Juzgado admitió el recurso de apelación interpuesto por la parte demandada contra la resolución de las 11 horas 30 minutos del 5 de abril, según corrección que hizo en auto de las 7 horas del 23 de abril de 2013, pues había puesto una fecha de resolución apelada incorrecta (folio 101).

En ese mismo pronunciamiento rechazó la gestión de la demandada de variar la medida cautelar emitida -y apelada- ordenó al regente forestal las guías de transporte de la madera e indicar el valor de la madera cortada, para que, previo a la entrega de ésta a Sociedad Viento del Oeste Sociedad Anónima, se rindiera la garantía respectiva (folio 99). Ese pronunciamiento de las 7 horas del 23 de abril de 2013, contrario a lo señalado por la parte demandada como motivo de nulidad, le fue notificado a ésta y a la demandada el 23 de abril (folios 102 y 103); por lo que no podría alegar desconocimiento del mismo, aunado al hecho de que se apersonó posteriormente al proceso (artículo 196 del Código Procesal Civil, aplicado supletoriamente). Alega como otro motivo de nulidad que el Juzgado, al resolver, tenía pendiente aún el término concedido en auto de las 7 horas 15 minutos del 6 de mayo, que se refería a la solicitud realizada por la codemandada de rendir garantía, de manera tal que se emitió sin considerar su posición al respecto, aunado al hecho de que formuló oposición a tal gestión.

Analizada la tramitación dada el expediente se evidencia que lleva razón la demandante, pues el Juzgado dictó la resolución de las 13 horas 40 minutos del 15 de mayo de 2013, sin haberse vencido aún el plazo de tres días conferido a la demandante de la gestión formulada por la parte demandada de rendir una contragarantía. Lo anterior vulneró principio del debido proceso y con él, el contradictorio y el derecho de defensa, dejando a la parte demandante en estado de indefensión, máxime si ejerció su derecho dentro del plazo conferido, oponiéndose a la solicitud de contragarantía, al informe del valor del precio de la madera aportado por la parte demandada y además, argumentando que el área en litis está constituida por todo el sector de la plantación y no sólo a una parte, pues señaló, ésta se sembró en la finca de su representada, no en el área traslapada. De ahí, considera el Tribunal, se dio una afectación al derecho de dicha parte, pues al resolver, el Juzgado no analizó tales extremos, limitándose a pronunciarse sobre la solicitud de contracautela expuesta por la parte demandada basada en un informe aportado por ésta, por lo que se comparte este segundo motivo de nulidad expuesto por la parte demandante.-*

XI.Estima el Tribunal necesario señalar, existen otras irregularidades procesales que deben ser corregidas, conforme a las facultades otorgadas por el artículo 26 de la Ley de Jurisdicción Agraria. En primer orden debe señalarse que el Juzgado, pese a haber admitido en efecto devolutivo el recurso de apelación incoado por la parte demandada contra la resolución de las 11 horas 30 minutos del 5 de abril de 2013 (folio 46), en la que dispuso la suspensión de las actividades realizadas en el área en litis por la parte demandada, siguió con la tramitación de la medida cautelar sin enviar copia del expediente al Tribunal para que se pronunciara sobre la apelación ya admitida. Luego, emitió una segunda resolución, igualmente apelada, de las 13 horas 40 minutos del 15 de mayo de 2013 (folio 133), en la que varió el contenido de la primera decisión al autorizar "...al señor Gabriel Raúl Hernández, para con las formalidades de ley, rinda garantía hipotecaria en primer grado, a favor del Despacho, sobre la finca de su representada inscrita en el partido de Puntarenas, folio real 59511-002, por la suma de cuatro millones cuarenta y un mil doscientos cuarenta y cuatro colones netos, esto según informe rendido por Regente Forestal Ingeniero Fernando Rojas Conejo..." y dispuso dejar sin efecto las restricciones ordenadas en la resolución originalmente apelada de las 11 horas 30 minutos del 5 de abril de 2013.

La técnica procesal utilizada por el Juzgado es incorrecta; sin embargo, el Tribunal no considera que la misma produce nulidad de lo tramitado por haberse omitido cumplir con las formalidades de ley, sino porque en este segundo pronunciamiento se deja en estado de indefensión a la parte demandante -como bien lo apunta en la gestión de nulidad concomitante- porque varió lo resuelto inicialmente con base en un informe del regente forestal contratado por la accionada cuyo resultado fue objetado por la demandante, quien pidió el informe lo rindiera un perito nombrado por el Juzgado. Esa objeción no fue considerada por el Despacho, como tampoco lo fue la objeción del representante del señor [Nombre1] a la madera que consideró ese regente en su informe, al estimar que es parcializada al no comprender la que dice se sembró en su totalidad en la finca de éste, no en la parte traslapada de los fundos.

Más grave aún es el hecho de que en la resolución de las 13 horas 40 minutos del 15 de mayo de 2013 -segunda apelada- se autoriza a [Nombre3] a disponer de la madera, sin especificarse en que carácter, pues en principio pareciera lo es en su condición personal, aunque no actúa como tal en el proceso; en representación de la demandada Corporación Bella Vista del Golfo Sociedad Anónima; o bien, en representación de Viento del Oeste Sociedad Anónima, la cual aunque tampoco es parte del proceso, las menciona el Juzgado en autos de las 7 horas 15 minutos del 15 de abril de 2013 como adquirente de la madera (folio 99) y en auto de las 7 horas 15 minutos del 6 de mayo de ese año como gestionante del otorgamiento de la garantía (folio 117). Finalmente, observa el Tribunal que el Juzgado, contrariando lo dispuesto en el artículo 161 del Código Procesal Civil, aplicado supletoriamente, omitió pronunciamiento sobre la solicitud de aclaración y adición planteada por la parte demandante contra la resolución de las 13 horas 40 minutos del 15 de mayo de 2013, y procedió a admitir el recurso de apelación, violando así tal norma y el principio de preclusión procesal, pues la resolución que admite esa gestión viene a integrar la principal, cuyo recurso de apelación se contabilizará después de la firmeza de ésta, ya sea que se acoja o se deniegue.

En consecuencia, estima el Tribunal deberá anularse la resolución de las 13 horas 40 minutos del 15 de mayo de 2013, al haberse emitido de manera anticipada sin considerar las objeciones expuestas por la parte demandante a la petición de contracautela hecha por la demandada, y no especificar en qué carácter autorizaba a [Nombre3] a disponer del recurso forestal. Por innecesario se omite pronunciamiento sobre los agravios expuestos en el recurso de apelación incoado por la parte demandante contra la resolución de las 13 horas cuarenta minutos del 13 de mayo de 2013.-*

X.En relación con el recurso de apelación interpuesto por la parte demandada contra la resolución de las 11 horas 30 minutos del 5 de abril de 2013, debe señalarse que para determinar la procedencia de la medida cautelar solicitada por la parte demandante, es preciso verificar si la gestión cumple con los presupuestos legales requeridos. Es preciso acreditar que exista fundado temor de que la parte demandada, antes de la sentencia, le cause al derecho de la demandante, una lesión grave o de difícil reparación. Al respecto, la Sala Constitucional de la Corte Suprema de Justicia, en voto 3929 de las 15 horas 24 minutos del 18 de julio de 1995, señaló: "De previo a desarrollar este punto, resulta imprescindible destacar que las "medidas cautelares" en sí mismas no son inconstitucionales y que éstas resultan jurídicamente viables, en la medida que cumplan con los presupuestos de fondo necesarios para su adopción, a saber: el interés actual de la petición; la posibilidad de acogimiento de la pretensión principal; el carácter grave, irreparable o difícil de reparar del daño que se pretende evitar; una posición favorable del interés público; control judicial y medios de impugnación; y la temporalidad de la medida.

Sobre el particular, la Sala por sentencia número 7190-94 de las quince horas con veinticuatro minutos del seis de diciembre de mil novecientos noventa y cuatro, estableció que: "...Las medidas asegurativas* o cautelares, según la más calificada doctrina, surgen en el proceso como una necesidad que permita garantizar una tutela jurisdiccional efectiva y por ello se pueden conceptualizar como "un conjunto de potestades procesales del juez -sea justicia jurisdiccional o administrativa- para resolver antes del fallo, con el específico fin de conservar las condiciones reales indispensables para la emisión y ejecución del acto final". La doctrina entiende que la instrumentalidad y la provisionalidad son dos características fundamentales de las medidas cautelares y que sus principales elementos configurativos, exigen que deban ser: a) lícitas y jurídicamente posibles; b) provisionales, puesto que se extinguen con el dictado del acto final; c) fundamentadas, es decir, tener un sustento fáctico real con relación al caso particular; d) modificables, en el sentido que son susceptibles de aumentarse o disminuirse para adaptarlas a nuevas necesidades; e) accesorias, puesto que se justifican dentro de un proceso principal; f) de naturaleza preventiva, ya que tienen como objeto evitar inconveniencias a los intereses y derechos representados en el proceso principal; g) de efectos asegurativos, al pretender mantener un estado de hecho o de derecho durante el desarrollo del proceso, previniendo situaciones que puedan perjudicar la efectividad de la sentencia o acto final; h) ser homogéneas y no responder a características de identidad respecto del derecho sustantivo tutelado, con el fin de que sean medidas preventivas efectivas y no actos anticipados de ejecución…".

De lo expuesto por la citada Sala, con carácter vinculante, se desprende que para la procedencia de las medidas cautelares es preciso verificar el interés actual de la petición; la posibilidad de acogimiento de la pretensión principal; el carácter grave, irreparable o difícil de reparar del daño que se pretende evitar; una posición favorable del interés público; control judicial y medios de impugnación; y la temporalidad de la medida. De la misma forma, debe determinarse que la medida solicitada no corresponda a actos anticipados de ejecución conforme a lo pretendido. Al respecto, es importante tomar en consideración que en la demanda, dicha parte solicitó se declarara es la única propietaria de la finca matrícula CED9, graficada en el plano P-052511-1962; que ha ejercido posesión en dicho inmueble desde el año 1962 en forma pública, pacífica, ininterrumpida, a título de dueño, sumando la posesión de los anteriores poseedores transmitentes, por lo que pidió, se cancelase parcialmente el plano catastrado P-0011421-1974 y la finca matrícula CED10 en el área en que traslapa con el primer fundo citado; que la actividad de extracción de la madera realizada por la demandada ha sido de mala fe, por lo que pide se le condene al pago de los daños y los perjuicios, se disponga su desalojo, el cese de los actos perturbatorios y el pago de las costas (folios 13 y 14).

En forma subsidiaria pidió se dividiera por partes iguales el área de traslape, se demarcara y se hicieran las modificaciones de rigor al Catastro y al Registro, se impusiera a la parte demandada el pago de los daños, los perjuicios y las costas (folio 14). Solicitó como medida cautelar se ordene la suspensión de las actividades forestales que se están realizando en el inmueble, la emisión de una orden al Colegio de Ingenieros Agrónomos para que no se inscriban contratos de regencia forestal en el área en litis y que esa orden sea comunicada al Ministerio de Ambiente y Energía -en adelante MINAE- y la coordinación con la policía administrativa para la realización de reconocimientos judiciales en el sitio (folio 15 y 23). En el documento emitido por la Delegación Policial de Paquera, el 13 de marzo de 2013, se indica hay "gran cantidad de piezas de madera recién cortada y tirada al suelo, lo cual se encuentra dentro de la propiedad del señor [Nombre7] () …” * (folio 32), sin especificarse a cuántos árboles se refería cuando se hizo referencia a esa gran cantidad de árboles; sin embargo, en el acta del reconocimiento judicial realizado por el Juzgado a las 9 horas del 5 de abril de 2013, se hizo constar que existe un área de aproximadamente tres hectáreas taladas, “cuatro troncos de arboles (sic) de las especies de melina de un largo de siete varas y un diámetro de aproximadamente catorce pulgadas” (folio 41) y “cinco grupos de trozas de melina como aproximadamente cincuenta esquivas listas para ser cargas en un camión” (folio 42).

El informe privado rubricado por [Nombre8] , quien dice ser Topógrafo Asociado, señala que la madera talada se encuentra ubicada dentro de la finca 15816-000 y aporta un montaje de los planos involucrados (folios 33 a 36). Ese documento no fue puesto en conocimiento de la parte demandada; sin embargo, al haberse ésta apersona al proceso con posterioridad se estima, no se le causó indefensión. De la documental aportada al expediente se desprende que la finca 15816-000 está inscrita a nombre del demandante (certificación registral de folio 7); el derecho 001 de la finca 59511-000 le pertenece a [Nombre2] (certificación registral de folio 3) y el 002 de Corporación Bella Vista del Golfo Sociedad Anónima (certificación registral de folio 5). El Juzgado, en resolución de las 11 horas 30 minutos del 5 de abril de 2013 acogió la medida cautelar solicitada por la parte demandante, ordenó suspender las actividades forestales en el inmueble en litis, incluyendo la realizada por la parte demandada y comunicar tal decisión a las personas que se encuentran laborando en la tala y extracción de árboles de melina por medio de la Fuerza Pública de Paquera, bajo apercibimiento en caso de incumplimiento de “abrir causa" por el delito de desobediencia a la autoridad; expedir oficios al Ministerio de Ambiente y Energía para que ordene la suspensión de toda actividad tendiente a la extracción de madera y al Colegio de Ingenieros Agrónomos para que no inscriba contratos de regencia forestal a favor de la parte demandada (folio 46).

Estima el Tribunal que existe apariencia de buen derecho en este caso, puesto que, conforme a un juicio de verosimilitud basado en la prueba hasta ahora aportada, se deduce, la madera talada corresponde al área en litis reclamada en la demanda; de igual forma, hay peligro de demora puesto que con la posible duración de este proceso se puede generar a la demandante un efecto gravoso en lo pretendido si eventualmente se dispone de ese recurso sin control alguno, y a la madera vinculada, de perder su valor económico si no se extrae de manera oportuna. En su apelación, la parte demandada remite al informe emitido por el SINAC* N°ACT-OSRLP-194-2013 identificado como “informe de inspección por conflicto de aprovechamiento de* plantación de melina y reapertura de camino, sector Campiñas de Paquera” solicitado por el Juzgado, argumentando entre otras cosas, que el daño ambiental al que hace alusión el a quo no fue significativo y existe un compromiso entre el empresario y la administración pública, concretamente, el Área de Conservación Tempisque del MINAE* de rehabilitar los causes de la quebrada, una vez comiencen las lluvias para no afectar el recorrido pluvial normal.

Agregó, la SETENA se pronunció acerca de que únicamente es necesario un permiso municipal para la rehabilitación del camino en específico y las plantaciones forestales no necesitan permiso de corta, pues para la extracción de esa madera se cuenta con el Certificado de Origen de Plantación Forestal N° 005-2013, cuyo regente forestal actual es el ingeniero Fernando Rojas Conejo, quien con el aval del Colegio de Ingenieros Agrónomos certificó que el origen de la madera proviene de la finca propiedad de Corporación Bella Vista del Golfo Sociedad Anónima, según Formulario de Regencia Forestal del Colegio de Ingenieros Agrónomos N° 001496G y Certificado de Origen para el Transporte de Madera proveniente de una plantación forestal N° 095359G. Se basa el recurrente en el documento certificado identificado como ³Informe gráfico sobre plantaciones de melina en La Campiña de Río Grande Paquera´(folio 28) y el Formulario de Regencia Forestal N° 001496G del regente forestal Fernando Rojas Conejo (folio 69).

De igual forma, en el documento ACT-OSRLP-194-2013 de la Subregión* Lepanto* Paquera del Área de Conservación Tempisque fechado 8 de abril de 2013 , denominado “Informe de* inspección por conflicto aprovechamiento de plantación de Melina y reapertura de camino, sector Campiñas de Paquera´,en el que se indicó, las labores para reabrir el camino fueron realizados con el mínimo impacto necesario que amerita poder habilitar una vía en desuso por muchos años y no representan un impacto ambiental significativo pues no se eliminaron árboles ni se realizaron movimientos de tierra significativos. Se adiciona en el referido documento que la vía en referencia se rehabilitó para extraer madera de melina proveniente de una plantación forestal establecida hace 15 o 20 años y que dicho aprovechamiento no representa un significativo impacto ambiental para el medio, siendo las estrictamente necesarias para poder aprovechar y extraer dicha madera conforme al Certificado de Origen de Plantación N° 005-2013 citado (folios 71 a 76).

De las probanzas citadas se extrae, se trata de árboles extraídos de una plantación, por ende, no requiere de permiso para ello de acuerdo a lo dispuesto por el numeral 28 de la Ley Forestal. Esta norma dispone: “Excepción de permiso de corta. Las plantaciones forestales, incluidos los sistemas agroforestales y los árboles plantados individualmente y sus productos, no requerirán permiso de corta, transporte, industrialización ni exportación. Sin embargo, en los casos en que antes de la vigencia de esta ley exista un contrato forestal, firmado con el Estado para recibir Certificados de Abono Forestal o deducción del impuesto sobre la renta, la corta deberá realizarse conforme a lo establecido en el plan de manejo aprobado por la Administración Forestal del Estado". Al respecto, la Sala Constitucional de la Corte Suprema de Justicia en voto [Telf1] de las 14 horas 30 minutos del 10 de abril de 2013, dispuso: “…exigir permiso de corta o, incluso, otra medida menos gravosa, solo podría traer como consecuencia desincentivar la inversión en plantaciones forestales, encarecer la madera y, en consecuencia, hacer más lucrativa la explotación irracional, incluso al margen del ordenamiento jurídico, del bosque.” De manera más amplia, en el voto 12716-2012 de las 16 horas 1 minuto del 12 de setiembre de 2012, dicha Sala señaló: 2La Sala hace propias opinión que sobre el caso ha brindado la Procuraduría General de la República, en el sentido de que, como principio constitucional que condiciona la actuación del Estado en la protección del ambiente, se reconoce, el principio de la objetivación de la tutela ambiental o principio de la vinculación a la ciencia y a la técnica: “se traduce en la necesidad de acreditar con estudios técnicos la toma de decisiones en esta materia, tanto en relación con actos como de las disposiciones de carácter general -tanto legales como reglamentarias-, de donde se deriva la exigencia de la "vinculación a la ciencia y a la técnica", con lo cual, se condiciona la discrecionalidad de la Administración en esta materia.” ( resolución No. 17126-2006).

“principio ambiental” de la vinculación a la ciencia y a la técnica" que rige la materia ambiental, en tanto las decisiones administrativas que pueden tener incidencia en el ambiente requieren de un sustento técnico que las respalde, y en tal condición, limitan y condicionan la discrecionalidad de la Administración en su actuación.” (voto No. 14293-2005 reiterado por el 11562-2006). “Se parte del principio de que las normas ambientales deben tener un sustento técnico, pues su aplicación tiene que partir de límites que determinen las condiciones en las cuáles debe sujetarse el uso y aprovechamiento de los recursos naturales.” (Voto No. [Telf2]). A su vez, se relaciona con el principio de razonabilidad como parámetro de constitucionalidad: “El principio de razonabilidad, en relación con el derecho fundamental al ambiente, obliga a que las normas que se dicten con respecto a esta materia estén debidamente motivadas en estudios técnicos serios, aún cuando no existiera otra normativa legal que así lo estableciera expresamente.” (Voto No. [Telf3], el destacado es nuestro).

“Así, la aplicación de este principio ambiental está directamente vinculada con un parámetro de constitucionalidad de la conducta -administrativa y de los particulares- y de la normativa que rige la materia, como lo es la razonabilidad -según desarrollo de la jurisprudencia de nuestro Tribunal Constitucional- en tanto su finalidad es tender a la sostenibilidad del el [sic] uso de los recursos naturales y de los elementos que conforman el ambiente , a través de su " uso adecuado "; y en virtud de los cuales queda claro que la protección al ambiente debe encaminarse a la utilización adecuada e inteligente de sus elementos y en sus relaciones naturales, socioculturales, tecnológicos y de orden político, para con ello salvaguardar el patrimonio al que tienen derecho las generaciones presentes y futuras; en tanto a través de la producción y uso de la tecnología es que debe de promoverse que se obtengan, no sólo ganancias económicas (libertad de empresa) sino sobre todo un desarrollo y evolución favorable del medio ambiente y los recursos naturales con el ser humano, esto es, sin que se cause a éstos daño o perjuicio, como lo ha considerado nuestro Tribunal Constitucional, en su amplia jurisprudencia, inclusive desde sus orígenes, así en las sentencias supra citadas número 3705-93 y número 2006-17126.” (Voto No. [Telf4]).´De lo anterior se deduce, si lo existente en el área en litis es una plantación, no es preciso para su explotación permiso del MINAE para tal efecto, de ahí se estime improcedente la orden de suspensión declarada por el Juzgado.

Aunado a ello, en este caso, la extracción no implicó una afectación ambiental significativa. De ahí, no comparte el Tribunal lo expuesto por el juez de primera instancia al hacer referencia a un daño ambiental eventual; e inclusive a la suspensión de permisos para extracción, pues al tratarse de plantación de melina, tales permisos son innecesarios. En el Certificado de Origen N° 095359 G se señaló, la madera sería extraída de la finca [Dirección2] y 002 (folio 78), en el que se autoriza la extracción de la madera en 5 hectáreas con un volumen de 780 metros cúbicos, de un total de 15 hectáreas de plantación de melina arborea* (folios 78 y 79 y 107 a 115). En relación con el documento de folio 80, el mismo está redactado con un idioma diferente al español y la parte proponente no presentó la traducción requerida. Sin embargo, de las demás probanzas se deduce, la plantación de melina cortada forma parte del área en litis, de manera tal que al ser en sentencia donde se definan los derechos sobre ese sector, hasta tanto no se produzca esa decisión, deberá autorizarse a Corporación Bella Vista del Golfo Sociedad Anónima para que disponga de esos árboles (folio 69), previo a lo cual, deberá el Juzgado designar una persona experta conforme al rol de ingenieros forestales del Poder Judicial, para que determine con exactitud la cantidad de árboles cortados, su ubicación en relación con los planos de las fincas de las partes involucradas, las especies de éstos, el estado de los mismos y si es posible su aprovechamiento en las condiciones actuales, y el valor estimado de mercado.

Una vez se tengan esos datos, el Juzgado pondrá en disposición dichos bienes de la parte demandada como depositaria judicial para que ésta los subaste en la Bolsa de Productos Forestales, en aplicación analógica del artículo 65 de la Ley Forestal, referente al decomiso de productos forestales. Lo anterior deberá quedar documentado y el procedimiento para trasegar la madera deberá corresponder al establecido en el artículo 31 de la Ley Forestal. Si tales productos no logran ser vendidos en subasta pública, podrá aprovecharlos cualquier persona, previo depósito en el Juzgado del valor asignado pericialmente. Además, la persona experta que se designe deberá, con base en el reconocimiento que realice del área en litis y la documentación que consta en este expediente, indicar la fecha en que esas especies arbóreas estén listas para ser aprovechadas, la cantidad y ubicación geográfica de éstas.

Para tal efecto, la parte demandada deberá depositar en la cuenta del Juzgado en el plazo de ocho días, el monto que el Juzgado fije por honorarios y gastos de traslado de la persona experta que designe, con el apercibimiento de que en caso de incumplimiento se tendrá por no interesada en el aprovechamiento para la venta de los árboles cortados, en cuyo caso el Juzgado deberá designar a una persona depositaria judicial de los mismos. Los costos del depósito de los árboles, mientras no puedan ser colocados a la venta o sean debidamente aprovechados, previa autorización del Juzgado, correrán por cuenta de la parte demandante. En caso de que la parte demandada no acepte ser depositaria judicial de los árboles cortados -en los supuestos citados- el Juzgado podrá designar a otra persona física o jurídica idónea para que proceda conforme. Todo lo anterior deberá ser verificado en el sitio por el Juzgado, el que a su vez deberá proceder a designar la persona experta, gestionar su juramentación y proceder conforme se señala, una vez firme esta resolución, con la celeridad debida considerando la urgencia de la medida para un mejor aprovechamiento del recurso forestal y de las condiciones climáticas imperantes en la zona.

Lo anterior, debido a que la valoración de los árboles cortados dada por el ingeniero forestal regente [Nombre6] no responde a la de una persona experta judicial conforme al rol que garantice objetividad a las partes involucradas; y la parte demandante se opuso a la valoración dada por éste y demás datos aportados. Lo anterior, con fundamento en el artículo 242 del Código Procesal Civil, aplicado supletoriamente conforme a los numerales 6, 26 y 79 de la Ley de Jurisdicción Agraria, y 27, 28, 31, 56 y 65 de la Ley Forestal.-*

XI.Así mismo, luego de analizar la tramitación dada al expediente, estima el Tribunal, debe el Juzgado cumplir con las circulares y lineamientos instituciones, concretamente la Nº 82-95 de 19 de octubre de 1995, Artículo LXVIII emitida por Corte Plena, para evitar irregularidades procesales que puedan afectar la tramitación, entre ellos, citar en la carátula del expediente el nombre de la señora [Nombre2] como codemandada y verificar que se respete a dicha parte como al resto el debido proceso; y que el índice de actuaciones responda a la tramitación real del expediente. Además, deberá pronunciarse sobre las gestiones hechas en este proceso por el señor Gabriel Raúl Hernández en representación de Viento del Oeste Sociedad Anónima, la cual no figura hasta el momento como parte o como interviniente (folio 57); no obstante, el señor Hernández reiteradamente ha gestionado en forma conjunta como representante de ésta y de la codemandada Corporación Bella Vista del Golfo Sociedad Anónima (folios 59 y 104).

Se aclara además que el documento de folio 132 en el que aparecen tres firmas al pie, fechado 15 de mayo de 2013, pero sin sello de recibido, no se considera para la emisión de esta resolución debido a que las firmas no aparecen autenticadas, las personas que supuestamente lo suscriben y son abogados no impregnaron su sello y no fue presentado por ninguna de éstas ya que ni siquiera tiene constancia de recibido. El sello de recibido del documento de folio 129 corresponde sólo a ese documento pues menciona la presentación de tres folios el 13 de mayo (folio 129). Finalmente, deberá comunicar a la Guardia Civil de Paquera y a la oficina regional del MINAE a las que informó sobre el contenido de la resolución revocada (folios 43 a 45), sobre la emisión de este pronunciamiento.-*

POR TANTO:* Se revoca la resolución de las once horas treinta minutos del cinco de abril de dos mil trece. En su lugar, se rechaza la medida cautelar solicitada por la parte demandante en las condiciones planteadas por ésta, disponiéndose en esta Instancia lo siguiente: Hasta tanto no se emita sentencia o cambien las circunstancias en que se dicta esta medida cautelar, se autoriza a la codemandada Corporación Bella Vista del Golfo Sociedad Anónima para que disponga de los árboles cortados ubicados en el área en conflicto; previo a ello, el Juzgado designará una persona experta conforme al rol de ingenieros forestales del Poder Judicial, para que determine con exactitud la cantidad de árboles cortados, su ubicación en relación con los planos de las fincas de las partes involucradas, las especies de éstos, su estado, si es posible su aprovechamiento en las condiciones actuales y el valor estimado de mercado.

Una vez se tengan esos datos, el Juzgado pondrá en disposición dichos bienes de la parte demandada como depositaria judicial para que ésta los coloque en la Bolsa de Productos Forestales. Lo anterior deberá quedar documentado, y el procedimiento para trasegar la madera ha de corresponder al establecido en el artículo 31 de la Ley Forestal. Si tales productos no logran ser vendidos en subasta pública, podrá aprovecharlos cualquier persona, previo depósito en el Juzgado del valor asignado pericialmente. La persona experta que se designe deberá además, con base en el reconocimiento judicial que realice del área en litis con el acompañamiento del juez o jueza agraria, las partes que asistan y la documentación que consta en este expediente, indicar la fecha en que las demás especies arbóreas estén listas para ser aprovechadas conforme a su estado actual y lo tramitado ante el MINAE y la cantidad de esos árboles de plantación conforme al procedimiento técnico respectivo.

La parte demandada deberá depositar en la cuenta del Juzgado en el plazo de ocho días que éste le conferirá, el monto que fije por honorarios y gastos de traslado de la persona experta que designe, con el apercibimiento de que en caso de incumplimiento se tendrá por no interesada en el aprovechamiento para la venta de los árboles cortados, en cuyo caso el Juzgado deberá designar a otra persona física o jurídica como depositaria judicial de los mismos para que proceda conforme se señala. Los costos del depósito de los árboles, si no se logra sean vendidos o debidamente aprovechados, previa autorización del Juzgado, correrán por cuenta de la parte demandante. En caso de que la parte demandada no acepte ser depositaria judicial de los árboles cortados -en los supuestos citados- el Juzgado podrá designar a otra persona física o jurídica idónea para que proceda conforme. Todo lo anterior deberá ser verificado en el sitio por el Juzgado, el que a su vez deberá proceder a designar la persona experta, gestionar su juramentación y proceder conforme se señala, una vez firme esta resolución, con la celeridad debida considerando la urgencia de la medida para un mejor aprovechamiento del recurso forestal y de las condiciones climáticas imperantes en la zona.

Se anula la resolución de las trece horas cuarenta minutos del quince de mayo de dos mil trece. Debe el Juzgado cumplir con las circulares y lineamientos instituciones, concretamente la Nº 82-95 de 19 de octubre de 1995, Artículo LXVIII emitida por Corte Plena, para evitar irregularidades procesales que puedan afectar la tramitación, entre ellos, citar en la carátula del expediente el nombre de la señora [Nombre2] como codemandada y verificar que se respete a dicha parte como al resto el debido proceso; y que el índice de actuaciones responda a la tramitación real del expediente. Además, ha de pronunciarse el Juzgado sobre las gestiones hechas en este proceso por el señor [Nombre3] en representación de Viento del Oeste Sociedad Anónima, la cual no figura hasta el momento como parte o como interviniente. En relación con el documento agregado a folio ciento treinta y dos, debe el Juzgado resolver lo correspondiente a que aparezca agregado al expediente sin fecha de recibido y de ser necesario disponer la investigación disciplinaria respectiva.
