  1. 1The plaintiff filed an ordinary action, valued at five million colones, seeking a judgment declaring: " a) In view of all the foregoing, I respectfully request that this Honorable Court grant this ordinary agrarian proceeding for recovery of property (reivindicación), restoration of possession (restitución de la posesión), and establishment of a right-of-way easement (servidumbre de paso) in all respects. b) That it be acknowledged and declared in the judgment that acquisitive prescription (prescripción positiva) of the use of the right-of-way easement encumbering the servient estate (fundo sirviente) owned by the defendant herein has fully accrued in favor of my dominant estate (fundo dominante). This is because the facts proven herein conclusively demonstrate * the mere use and enjoyment of that easement through the passage of time and the simple acquiescence of those who have been owners or possessors of the servient property over time. c) That the application for atypical precautionary measures (medidas cautelares atípicas) requested herein be granted as promptly as possible.This is so that I do not suffer harm greater than that which I already face as a result of the arbitrary and unlawful decision to close the right-of-way easement that my estate has enjoyed for so many years. d) That, once my right to continue enjoying the right of possession and use of the aforementioned right-of-way easement has been restored, Mr. [Nombre2] be ordered to refrain from interfering with the rights granted through the precautionary measure until the matter is resolved by a judgment on the merits. He shall be advised that otherwise he will be prosecuted for the offense of disobedience of authority. e) Once acquisitive prescription in favor of my property has been recognized, I respectfully request that your authority order the right-of-way easement recognized herein to be recorded in the Real Property Section of the Registro Nacional. f) I further request that Mr. [Nombre2] be ordered to pay the damages and losses (daños y perjuicios) caused to me by his unlawful and bad-faith conduct.He should likewise be ordered to pay the attorney’s fees and litigation costs (costas personales y procesales) of this proceeding, all of which shall be assessed at the appropriate procedural stage." The plaintiff likewise joined Familia Cuatro Eme Ltda, [Nombre5] , [Nombre6] and [Nombre3] as parties to the action (integra litis), requesting: " a) In view of all the foregoing, I respectfully request that this Honorable Court grant this ordinary agrarian proceeding for recovery of property, restoration of possession, and establishment of a right-of-way easement in all respects. b) That it be acknowledged and declared in the judgment that acquisitive prescription of the use of the right-of-way easement encumbering the servient estate owned by the defendant herein has fully accrued in favor of my dominant estate. This is because the facts proven herein conclusively demonstrate the mere use and enjoyment * of that easement through the passage of time and the simple acquiescence of those who have been owners or possessors of the servient property over time. c) That, by virtue of the precautionary measure restoring my right to continue enjoying the right of possession and use of the aforementioned right-of-way easement, the defendants, particularly Mr. [Nombre2] in his personal capacity and in his capacity as general attorney-in-fact with full powers (apoderado generalísimo) of the entity he represents, be ordered to refrain from interfering with the rights granted through the precautionary measure until the matter is resolved by a judgment on the merits, as ordered by the Tribunal Agrario.They shall be advised that otherwise they will be prosecuted for the offense of disobedience of authority. d) Once acquisitive prescripti* on in favor of my property has been recognized, I respectfully request that your authority order the right-of-way easement recognized herein in favor of the dominant estate and against all servient estates to be recorded in the Real Property Section of the Registro Nacional. e) I further request that only Mr. [Nombre2] , in his personal capacity and in his capacity as general attorney-in-fact with full powers and without limitation as to amount of the entity "Familia cuatro emes Ltda," be ordered to pay the damages and losses caused to me by his unlawful and bad-faith conduct, because, as I have already indicated, the other co-defendants, specifically [Nombre3] , [Nombre4] and [Nombre5] , have never opposed my property’s right of way. In the event that those persons do not accept my claims and oppose this Ordinary Proceeding, I request that they be ordered to pay the attorney’s fees and litigation costs of this proceeding, all of which shall be assessed at the appropriate procedural stage."   2. 2The defendants, having been duly served, opposed the action brought against them: defendant [Nombre2] , in his personal capacity, raised the defenses (excepciones) of failure to join necessary defendants (litis consorcio pasivo necesaria), lack of a legal right (falta de derecho), lack of standing of the plaintiff and defendants (falta de legitimación activa y pasiva), and lack of interest (falta de interés); [Nombre5] and [Nombre4] raised the defenses of lack of a legal right, lack of standing of the plaintiff and defendants, and lack of interest; defendant entity Familia Cuatro Eme Ltda. raised the defenses of lack of standing of the plaintiff and defendants, lack of interest, absence of prescription (falta de prescripción), expiration (caducidad), and failure to join necessary parties (litis consorcio necesario). (folios 135 to 136, 288 to 289, 299 to 300, respectively). *
  3. 3Co-defendants [Nombre5] and [Nombre4] filed a counterclaim (contrademanda) and requested: "1.- That my property be declared unrelated to the plaintiff’s claims; 2.- That the counterclaim defendant be ordered to pay the damages and losses caused to me. 3.- That the defendant be ordered to pay compensation for the emotional distress (daño moral) caused, as it has affected my emotional state by taking advantage of the fact that I am an older adult, which has clearly affected my physical health. The questioning of my integrity has seriously affected my self-esteem, for which I am receiving treatment from specialists in the field. All of this must be remedied. 4.- That the defendant be ordered to pay the attorney’s fees I have incurred as a result of the filing of this proceeding. 5.- That the amounts awarded against the defendant as damages, losses, and costs be indexe* d and adjusted to present value, taking into account the serious international and national financial situation we are experiencing and, in particular, the devaluation system affecting our currency." Drafted by [Nombre7] Bolaños Céspedes, and; * * * CONSIDERING*

I.Established facts (hechos probados) one, two, and three from the trial court judgment are adopted. The following established facts of the same nature are added: 4. The plaintiff acquired that property through a gift of bare ownership (nuda propiedad) from her partner [Nombre2], by deed number one hundred thirty-nine executed at 9:30 hrs on 9 de marzo del 2005 (deed at folio 60). Mr. [Nombre2], in turn, had also acquired it through a gift of bare ownership from [Nombre8], by deed executed at nine o’clock on 31 de agosto del 2004. (folio 61). 5. Mr. [Nombre2] died on 16 de agosto del 2008. (folio 129). 6. For many years—more than twenty—the plaintiff’s land has had use of a passage across land belonging to the current defendants. The reasons were, on the one hand, the difficult topography of the land originally belonging to Ms. [Nombre8] and now to the plaintiff (judicial inspection (reconocimiento) at folio 38 and testimonial evidence (prueba testimonial) from folio 392 onward; judicial inspection as court-ordered supplemental evidence (prueba para mejor proveer), appearing in the associated documents on the virtual desktop), which clearly showed that the plaintiff’s property lacked adequate access because of the rugged terrain; and, on the other hand, an oral family agreement to provide an outlet for the coffee production of Ms. [Nombre8] and Mr. [Nombre2].

(examination of party evidence (prueba confesional) of [Nombre9] (folio 392), testimony of [Nombre10], [Nombre11] (393 onward), statement of Mr. [Nombre2] (folio 77)). 7. It was Mr. [Nombre2] who restricted Mr. [Nombre2]’s right of passage (derecho de paso), which gave rise to a possessory proceeding (interdicto) brought by the former against the latter (folio* 3); that proceeding was stayed after [Nombre2]’s death was verified. 8. Ms. [Nombre1] and Mr. [Nombre2] jointly carried on the agricultural business activity of coffee cultivation. (testimonial evidence at folios 393 onward). 9. The existing passage providing access to the plaintiff’s farm has the characteristics of the lanes found on coffee farms to connect the different areas of the farm. It appears to be old, judging by the trees surrounding it. (judicial inspection as court-ordered supplemental evidence, appearing on the virtual desktop under associated documents). 10.

The right-of-way easement (servidumbre de paso) has a linear length of three hundred fifty-eight meters and a minimum width of three meters, widening to six meters at the entrance, running in the direction of [Dirección1], until it reaches the level portion of the plaintiff’s property adjoining the Río Cocora. (judicial inspection as supplemental evidence for adjudication (prueba para mejor resolver), appearing in the associated documents folder on the virtual desktop). *

II.Unproven facts (hechos no probados) numbers one and three are adopted. Unproven fact two is not adopted because there is evidence of an agreement that gave rise to the right-of-way easement in favor of the plaintiff’s property. *

III.The plaintiff appeals the trial court judgment on the following grounds: 1. She notes that, in the first item of the proven facts, the judgment finds it established that Mr. [Nombre2], who was her domestic partner and the former owner of the property recorded under real-property folio registration [Placa1] (dominant estate (fundo dominante)), had used the access or right-of-way easement (servidumbre de paso) at issue herein to bring supplies into and remove the coffee production from his property. She states that this was fully established through all the confession and testimonial evidence. 2. She asserts that, for 30 years, that easement has existed for a fundamental reason: it is the only topographically reasonable means of entering the property that she now owns. Although it is true that part of the front boundary of her property abuts a public road, it is also true that, for topographical reasons, it is physically impossible to enter the property from that frontage in order to carry out the agricultural activity, and it is likewise impossible to remove the produce, which is the ultimate purpose of the agricultural activity conducted on the property.

The judge was able to verify all of this during the judicial inspection conducted in the proceeding. Access to the property by means of that easement is not a whim, nor was it a whim that the previous owners accessed it by means of that easement for more than fifty years. 3. For a better understanding of the issue, she recounts certain historical aspects concerning the actual circumstances of the property. Mr. [Nombre12], who was the owner of the parent property from which the related properties originated, did the following at a certain point in his life: a) he carried out an initial severance (segregación) and donated the resulting parcel to his daughter, Ms. [Nombre8], in 1979, that is, 33 years ago; moreover, he carried out another severance and donated the resulting parcel to another of his children, Mr. [Nombre13], the brother of Ms. [Nombre8]. b) Long before carrying out these severances, the right-of-way easement at issue herein already existed; that is, Mr. [Nombre14] had created it in order to remove all of the coffee production from the parent property through it and, of course, to remove the production from the portion that he donated to his daughter [Nombre8], because it was, as it remains today, the only reasonable means of doing so. c) Mr. [Nombre14] was, so to speak, a kind of great paterfamilias who donated the properties concerned herein to his children and, naturally, reached a family agreement with them under which his son [Nombre13] would allow his sister [Nombre8]’s property (the dominant estate now owned by the plaintiff) to use the preexisting right-of-way easement, because otherwise she could not conduct the agricultural activity, given the topographical conditions characterizing the property’s frontage on the public road, since access from that public-road frontage was, and remains today, physically impossible due to its extremely steep slope.

For those reasons, they have emphasized that they have exercised the right of passage to use the aforementioned easement for more than 50 years. d) (sic) Several years ago, Mr. [Nombre13] decided to carry out a series of severances in order to donate a parcel to each of his children, and those severances naturally resulted in new property registrations with the Public Property Registry and the corresponding newly registered cadastral plans (planos catastrados), which use the easement. This resulted in another family agreement between Mr. [Nombre13] and his children, because otherwise they would have no means of reaching the public road, as was explained to the trial judge. By that same action, he ratified the family agreement that his father had made with his sister, Ms. [Nombre8], so that she could continue conducting agricultural activity on her small property, which, she reiterates, she had received as a donation from the father of both siblings, Mr. [Nombre14].

All of the foregoing is confirmed by the fact that, for more than thirty years, Mr. [Nombre2] used the right-of-way easement at issue herein without any opposition from any owner of the servient estate (fundo sirviente), either against Ms. [Nombre8] or against Mr. [Nombre2]. There were never any difficulties with [Nombre13], and the use and possession of the aforementioned right-of-way easement occurred publicly, peacefully, openly, in good faith, and under a claim of ownership, as they explained in the amended complaint. In that regard, the testimony of [Nombre2] is crucial because, although she was called by the defendant and is the defendant’s sister and the granddaughter of Mr. [Nombre14], she confirms aspects of the position maintained by the plaintiff. Thus, she states that her aunt, Ms. [Nombre8], always had permission to travel along the access road because her father granted her permission, as his daughter, so that she could conduct the agricultural enterprise together with her husband, Mr. [Nombre2].

She states that, in order to prove that Ms. [Nombre8] did in fact acquire the property in 1979 (33 years ago), they are submitting certified copies of several notarial instruments relating to the property’s chain of title, which she requests be admitted as evidence to assist the court in reaching its decision (prueba para mejor proveer). Through that evidence, they seek to establish the following: a) that, by means of a deed dated 11 de octubre de 1984, executed before Notary Public Norma Arguello Pérez, Ms. [Nombre8] transferred bare ownership (nuda propiedad) to her sister, Ms. [Nombre15]. This was done because of family matters. Through the foregoing, she seeks to establish conclusively that, even before 1984, Ms. [Nombre8] was the registered owner of the property now owned by the plaintiff. b) That, by means of the deed dated 22 de agosto de 1995, executed before Notary Isabel Montero Mora, Ms. [Nombre15] returned bare ownership to Ms. [Nombre8]. c) By means of a deed dated 31 de agosto del año 2004, Ms. [Nombre8] transferred bare ownership to Mr. [Nombre2].

This chain of title is intended to show that the family relationship was never severed and that the permission granted by Mr. [Nombre13] to use the roadway laid out across the property then registered in his name remains in effect to this day. 4. Various registry certifications for the new properties, as well as their corresponding duly registered cadastral plans, were submitted to the trial judge. Those properties came into legal existence as a result of the severance of various lots carried out by Mr. [Nombre13], the father of the defendant herein. Those six new properties came into existence as landlocked estates (fundos enclavados), and the only way for each of them to access the public road is precisely by using the same right-of-way easement at issue in this dispute. This is done pursuant to a family agreement, which is the same situation as that of her property. She states that the right of passage exercised by her property pursuant to the family agreement has neither harmed nor benefited the defendant because, at no time during or outside this agricultural proceeding has the defendant expressed any dissatisfaction on the ground that he had suffered any inconvenience.

Instead, it was established that Mr. [Nombre2], the former husband of the defendant’s aunt and, later, after he was widowed, was always the person who, for more than thirty years, maintained the easement by spreading gravel and maintaining the drainage so that it remained in good usable condition. This shows that, purely on a whim, the defendant is denying her what his family has respected pursuant to a decades-old family agreement. That family agreement, which has been established, has been undermined from the moment the defendant, Mr. [Nombre2], unilaterally decided to block passage to the plaintiff’s estate, thereby making it impossible to continue the agricultural activity because she would have no means of doing so, as she would have no possible access to her property. The trial court judgment did not consider this aspect of the existing family agreement or the consequences that the defendant’s whimsical decision to terminate that family agreement would have for her agricultural activity. 5.

She identifies as an error the failure to consider the expert report (informe pericial) prepared by Surveying Engineer César Sánchez Calvo, which established the existence of the right-of-way easement, the estates affected, and their owners, and included a sketch thereof. Likewise, an analysis of the aforementioned certifications and plans shows that the easement at issue herein is registered against each of the properties and depicted on each of the duly registered cadastral plans. It follows that the easement at issue herein is a right-of-way easement legally constituted (constituida a derecho), rather than one existing merely in fact. The [Nombre2] family formalized the right-of-way easement at issue herein in each of its plans and for each of its properties, but excluded the plaintiff’s estate despite knowing that, for many years, that property, in its capacity as the dominant estate, had made normal use of the right-of-way easement, including with the corresponding permission granted to them, also many years ago, by their father, Mr. [Nombre13], as has been fully established by the evidence presented herein.

Finally, she states that the trial court judgment did not analyze the preexisting legal situation, namely, that the right-of-way easement at issue herein not only existed pursuant to a mere family agreement but was also already recorded in the Registry and the cadastre. Based on all of the foregoing, they request that the judgment be reversed and that their complaint be granted.

IV.For the purpose of resolving the present matter, it is important to review the legal regulation and case law developed concerning the legal institution of agricultural easements (servidumbres agrarias). The general rules governing easements (servidumbres) are found in our Civil Code, which, like the Code itself, are quite old. Specific aspects concerning easements have been incorporated through special legislation, such as the Ley de Aguas or the Código de Minería. A more modern development of this legal institution and its various aspects can be found in national case law, particularly that of the First Chamber of the Court and the Tribunal Agrario. Easements have been the subject of numerous rulings by our courts of justice, indicating that they remain a highly relevant legal institution for regulating rights in rem (derechos reales), social coexistence, and the country’s productive system.

Conceptually, an easement is a right in rem over property belonging to another (derecho real sobre cosa ajena), which arose to guarantee the social and economic function of the immovable properties that require it. The legal scholarship underlying the existing legislation views it as an encumbrance (carga) imposed upon an immovable property, which must be accepted in furtherance of those economic and social purposes. Judicial decisions concerning easements consistently reiterate the principles governing them. Thus, they establish the principle that all immovable properties are presumed to be unencumbered (article 376). They likewise establish that easements are imposed for the benefit of or as an encumbrance upon an estate (fundo) and are inseparable from it (articles 370, 371). This means that, if the immovable property is divided, the easement remains attached to the divided estates in the corresponding proportion, regardless of who owns them (article 372).

Easements are classified in several ways. Thus, a distinction is made between voluntary easements (servidumbres voluntarias) and compulsory easements (servidumbres forzosas). As to the former, when they are both continuous and apparent (continuas y aparentes), they may be created by agreement, by testamentary disposition, or merely through use by one party and acquiescence by the other. Discontinuous easements (servidumbres discontinuas) of every kind and continuous non-apparent easements (servidumbres continuas no aparentes) may be created only by agreement or by testamentary disposition. Possession, even from time immemorial, is insufficient to establish them. Compulsory easements are not regulated within the relevant chapter but outside it; article 395 establishes them in the case of properties that are landlocked estates (fundos enclavados) or lack sufficient access—legal scholarship refers to them as statutory easements (servidumbres legales).

Their legal regime entails payment by the party requiring the easement to the owner of the servient estate (predio sirviente). The rules governing the termination of easements (extinción de las servidumbres) are set forth in article 381. Easements are terminated: 1. By termination of the right held by the person who created the easement. 2. Upon arrival of the specified date or fulfillment of the condition, if it was created for a specified period or subject to a condition. 3. By merger (confusión), meaning the complete and irrevocable consolidation of both estates in the hands of a single owner. 4. By release or waiver by the owner of the dominant estate (predio dominante). 5. By nonuse for the period required for prescription. 6. When the estates reach such a condition that the easement cannot be used; however, the easement shall revive once the impediment ceases to exist, provided this occurs before the prescriptive period expires.

The definitions of apparent or non-apparent easements and continuous or discontinuous easements are doctrinal rather than statutory. In historical Roman law, the best-known original easements were iter, actus, via, and aqueductus. Today, other easements have become necessary and gained prominence, without diminishing the importance of the former, such as view easements (servidumbres de vista) or so-called ecological easements (servidumbres ecológicas). In the case before us, the plaintiff brings a claim described as recovery of title (reivindicación), restoration of possession (restitución de la posesión), and creation of a right-of-way easement (servidumbre de paso) in all respects, on the ground that acquisitive prescription (prescripción positiva) has more than accrued in favor of its dominant estate through use of the right-of-way easement encumbering the servient estate owned by the defendant herein.

During the proceedings, the plaintiff has also asserted that there was an agreement dating back to the defendants’ father, who granted access to all his children; this is also the central basis of its argument on appeal from the trial court’s judgment. Significant debates concerning these three issues exist in legal scholarship and case law. *

1. Rules governing the acquisition of easements (servidumbres). Continuity or discontinuity of a right-of-way easement (servidumbre de paso). First, we have the debate concerning the acquisition of easements, especially in the case of apparent and discontinuous easements (servidumbres aparentes y discontinuas). In this regard, Article 379 of the Civil Code provides as follows: Discontinuous easements of every kind and non-apparent continuous easements may be created only by agreement or by last will. Possession, even from time immemorial, is insufficient to establish them. Under that provision, therefore, possession does not by itself create an easement. The provisions of the Civil Code do not establish which easements are discontinuous, but the prevailing view in legal scholarship is that right-of-way easements are discontinuous. Based on that view, the possibility of acquiring a right-of-way easement by adverse possession (usucapión) solely by demonstrating possession has been denied.

The Spanish author José Manuel Busto Lago traces that tradition back to its Roman origins, revealing the source of that prohibition and criticizing that view. In this regard, it is important to quote several comments from his analysis: “It is precisely in relation to the acquisition of easements by adverse possession that the distinction between continuous and discontinuous easements historically finds its origin and rationale. The Lex Scribonia of the last century of the Republic (dated between 60 and 50 B.C.) excluded the possibility of adverse possession, which had been recognized under the ancient ius civile, with respect to the four original (rural) easements then in existence (iter, actus, via, aquaeductus), on the ground that, as res incorporales, they were incapable of possession and, consequently, could not be acquired by adverse possession. This reason was compounded by the classical concept of possession, which, as absolute and unlimited de facto dominion over a thing, was incompatible with the partial dominion over another person’s property that is intrinsic to any easement.

Under Justinian law, this absolute concept of possession disappeared, giving way to the need to protect factual situations, including those relating to res incorporales and, among them, appurtenant easements (servidumbres prediales). Thus, the possibility of acquiring easements through longa possessio or diuturnus usus was recognized. Faced with this regime, which appears contradictory from a historical and diachronic perspective and is reflected in the conflict among the various laws compiled in the Corpus Iuris Civilis that refer, more or less directly, to the possibility of acquiring easements by adverse possession, the glossators and commentators asked whether easements were capable of being acquired by adverse possession. They failed to realize that the contradictions they found in the received texts of Roman law were merely the result of historical developments in the regulation of the institution and that, consequently, what was required was simply a conciliatory exegetical explanation of the different texts referring to the possession and acquisition of easements.

To answer whether easements could be acquired by adverse possession, they invoked the law of the Digest that excludes this possibility with respect to rural easements, since ‘non habeant certam continuamque possessionem: nemo enim tam perpetuo, tam continenter ire potest ut, nullo momento possessio eius interpellari videatur’ (D.8.1, 14 princ.). The exclusion of adverse possession for rural easements was thus justified on the understanding that they were incapable of continuous possession because it was deemed impossible to pass uninterruptedly through another person’s land. However, the cited text of the Digest does not authorize any distinction between rural and urban easements for purposes of adverse possession, insofar as it expressly states that the same rules apply to urban easements: ‘idem et in servitutibus praediorum urbanorum observatur’ D.8,1,14 in fine. The assertion that continuous possession of rural easements is impossible is erroneous, because for possession to be considered continuous, the possessor need not continuously exercise the right over the property (in the preceding example, the possessor need not pass uninterruptedly through another person’s property); it is sufficient that acts exercising possession be performed whenever necessary in accordance with the nature of the right possessed and the intended use of the property (emphasis added) (e.g., a right-of-way easement will be possessed in a manner that may be characterized as continuous whenever passage occurs as often as necessary in accordance with the objective intended use of the dominant estate (fundo dominante).

In other words, the intermittent nature of the acts through which possession is exercised, when performed as necessary in accordance with the very nature of the right possessed, does not prevent possession from being continuous; therefore, there is no contradiction whatsoever in recognizing continuous possession of a discontinuous easement.” (Busto Lago José Manuel, “La Usucapión de la titularidad de la servidumbre predial de paso,” Editorial Edersa, 2000, Madrid). This panel of the Court endorses the view of the distinguished Spanish professor, because it considers that characterizing a right-of-way easement as discontinuous and therefore incapable of acquisition by adverse possession is inconsistent, first, with the modern constitutional doctrine of the social function of property (función social de la propiedad), derived from Article 45 of the Constitution, which permitted restrictions on property rights in the social interest and entrusted their development to ordinary legislation adopted by a qualified majority.

The social function was subsequently developed extensively in our legal system through statutes establishing restrictions on property, such as the Ley de Tierras y Colonización (No. 2825 de octubre de 1961), in Articles 141 to 144; later through the forestry laws, the most recent version of which is No. 7575 de 1996; and through the Ley de Biodiversidad, which incorporated the environmental function into that economic and social function and expressly provides as follows in Article 8: Environmental function of real property (Función ambiental de la propiedad inmueble): As part of their economic and social function, real properties must fulfill an environmental function.” There can be no doubt that the social and economic function of property includes the restriction requiring rights of passage to be granted between neighboring properties, which contributes to the country’s social peace and is an indispensable requirement for production in our agricultural regions.

Updating the concept of an easement from a constitutional perspective requires us to reconsider that purely doctrinal view that characterizes a right-of-way easement as discontinuous and thereby precludes acquiring the easement by adverse possession, because, applying the rules of logic to agricultural easements (servidumbres agrarias), passage will be used according to the needs of cultivation—to remove harvests or bring inputs, materials, or labor to the workplace. Repeated use for those activities would imply the existence of a tacit agreement (convenio tácito) between the parties, unless the particular circumstances of the case demonstrate mere tolerance, which has other characteristics, such as being a unilateral act, probably involving a shorter period of use, together with the absence of other factors such as trust or familiarity between the parties.

II.The concept of agreement under the law, custom as a source of law for agricultural right-of-way easements, and the requirements of possession. Irrespective of the foregoing analysis, national law does recognize an agreement as a means of acquiring a discontinuous and apparent easement, both in the case of continuous and apparent easements and in that of discontinuous easements (Articles 378 and 379 of the Civil Code). As to the meaning of agreement, the renowned jurist Guillermo Cabanellas defines it as: “the concurrence of wills, expressed in a convention, compact, contract, treaty, or arrangement. A synonym for any of these words, which imply agreement, owing to the flexibility and widespread use given to the term agreement, notwithstanding the technical distinctions specified in each reference...” (Cabanellas Guillermo, Diccionario Enciclopédico de Derecho Usual, Volume 2, Editorial Heliasta.

Argentina, p. 365). As Guillermo Cabanellas rightly states, an agreement is a flexible legal institution, in which the essential element is the expression of consent—what he calls a concurrence of wills. In Costa Rican rural life, agreement is an extremely important source of law, normally expressed—by custom—orally. In this regard, it is important to distinguish a tolerated act (acto tolerado) from an agreement. Tolerance is typically a unilateral act expressing the intention of the person granting it to permit conduct or certain acts, subject to the condition that permission may be revoked at any time without any claim by its beneficiary. In an agreement, even an oral one, there is a clear expression of the parties’ consent. Proving that consent will be a matter of evidence. Evidently, although the law provides that possession, even from time immemorial, is insufficient to create easements that it calls discontinuous and apparent, such as a right of way, it is legally correct to state that, in the evidentiary assessment of a tacit agreement, the existence of peaceful, public, uninterrupted possession under a claim of ownership (a título de dueño) of a right of way constitutes highly significant evidence.

Failure to accept the foregoing would render the institution of possession—so extensively regulated in our legal system—ineffective. The requirements imposed on the right of possession for it to be recognized as such are those set forth in Article 856 of the Civil Code: possession as owner must be continuous, public, and peaceful. In the case of a right of way, those requirements would make it necessary for the person using the passage to regard himself or herself as the owner of that right and for the use to be continuous, without this meaning permanent exercise of passage, since that would be contrary to logic—as we stated above. What would actually be required is consistent use, a contrario sensu, to what the law itself establishes regarding loss through nonuse, as well as public and peaceful use. In Agrarian Law (Derecho Agrario), continuity is heightened by the easement’s productive purpose, insofar as its economic and social function requires it to be useful for carrying out agricultural activity.

Finally, it must be recalled that our law follows the system of transferring property by mere consent (nudo consenso); the easement need not be recorded in order to operate by operation of law between the parties who established it by tacit agreement (Article 480 of the Civil Code). The recording requirement applies with respect to third parties and is important when they acquire rights over real properties, especially through subdivision (fraccionamiento). In the present case, the easement has functioned as a right among family members. The property was originally a single parcel and was later divided among the different children and their spouses. The access lane is the typical right of way established on coffee farms to connect the different sections of the farm. The property currently belongs to different persons, but the lane continues to fulfill the economic and social function of providing access and egress for coffee production.

III. The evolutionary and systematic interpretation of the preliminary title of the Civil Code

If, at the constitutional level, the right to property has been modernized in keeping with the development of the social rule-of-law state established by our 1949 Political Constitution, then, at the statutory level, institutions of private law, such as easements (servidumbres), have likewise been modernized through the incorporation of the preliminary title of the Civil Code, which requires statutory provisions to be interpreted in relation to their context, historical and legislative background, and the social reality of the time in which they are to be applied, with primary consideration given to their spirit and purpose (Article 10 of the Civil Code). Likewise, Article 11 establishes that equity must be weighed when applying legal rules. In agrarian proceedings (procesos agrarios), there is an express provision in the Ley de Jurisdicción Agraria, Article 54, requiring the adjudicator to base the judgment on equity or law, with proper grounds.

The criteria for interpreting legal rules therefore require us, in easement cases, to apply those rules according to evolving criteria and in accordance with equity, which is nothing other than justice applied to the particular case. IV. Easement by “destination of the owner” (servidumbre por destino de padre de familia): This easement derives from Article 380 of the Civil Code, which provides, insofar as relevant: “The existence of an apparent sign of a continuous easement between two parcels, established by the owner of both, is sufficient for the easement to continue, actively or passively, unless, when ownership of the parcels is separated, the deed conveying either of them expressly provides otherwise.” The determining factor in this type of easement is that the property being divided belongs to the same owner. It should be noted that the provision refers to an “apparent sign of an easement”; it does not refer in any way to whether that sign is continuous or discontinuous.

We would understand the apparent nature of the easement as referring to the existence of outward signs demonstrating the use of that easement in accordance with the intended use of the properties and the fulfillment of their economic and social function. The provision does not exclude rights-of-way (servidumbres de paso); on the contrary, it appears to have been conceived for precisely such cases. In a right-of-way, its apparent nature would have to relate to the existence of a road or path in a condition sufficient to serve the intended use of agrarian holdings (fundos agrarios), which originally may have required agricultural products to be transported on foot, on horseback, or by cart, but which today requires the passage of machinery or vehicles. As for continuity, we understand it as continuity inherent in possession (posesión), as explained above, deriving from the doctrine of Article 859 of the Civil Code; that is, possession that is public, uninterrupted, and exercised as owner for the conduct of agricultural activity.

V. Case law of the Tribunal Agrario on the issue: furthermore, the Tribunal Agrario has ruled on these matters as follows: VI.- More than ten years ago, this Tribunal explained in a judgment the different means of resolving a case such as this one, stating in this regard: “...One of the essential aspects concerning easements relates to their content and manner of creation, an issue that is essential to deciding the merits of this matter. When a holding becomes landlocked (enclave) and therefore has no access, or insufficient access, to a public road, the legal system provides several possible solutions, depending on the factual circumstances that caused it to become landlocked. The first possible solution regarding a landlocked parcel (predio enclavado) is to provide sufficient access to a road through the creation of a voluntary easement (servidumbre voluntaria). Regarding voluntary easements, [Nombre16] states: ‘Easements are established: 1.

By the will of the interested parties, through a legal transaction (negocio jurídico) mortis causa or inter vivos (...) To create them, a person must have the legal capacity to dispose, through the act in question, of the property on which they are established, and the grantor must hold the powers over the encumbered property that correspond to the easement being granted. It is therefore unquestionable that an easement may be created by the full owner (or, if there are several owners, by all acting unanimously); as for a bare owner or an owner whose title is limited by another right (such as an existing prior easement over the property), that person may create it if the easement does not prejudice that right or if it is otherwise preserved; and a person who, without being the owner, holds a right over the property conferring the powers that the easement will grant to the owner of the dominant estate (dueño dominante) may also create it (subject to the same restrictions noted above for an owner with limited title) for the duration of that person’s right.’ This possibility of creating an easement voluntarily, whether mortis causa or inter vivos, is regulated by the Civil Code through Articles 378 and 379, the former of which states: ‘Easements that are both continuous and apparent may be created by agreement, by last will, or merely through use by one party and acquiescence by the other’; while the latter provides: ‘Discontinuous easements of every kind and continuous non-apparent easements may be created only by agreement or by last will.

Possession, even from time immemorial, is insufficient to establish them.’ Another means of resolving the problem of a landlocked holding is the circumstance contemplated in Article 380 of the Civil Code, which states: ‘The existence of an apparent sign of a continuous easement between two parcels, established by the owner of both, is sufficient for the easement to continue, actively or passively, unless, when ownership of the two parcels is separated, the deed conveying either of them expressly provides otherwise.’ This institution is known as an easement by ‘destination of the owner,’ which ‘means that, if there is an apparent sign of an easement between two properties established by the owner of both, it shall be deemed, if one is conveyed, to constitute title giving rise to the easement’ ([Nombre16], Manuel. Derecho Civil, Tomo III, Vol. II, Editorial Bosch, 8a. edición, 1994, pág. 141).

Consequently, where an easement exists, it is evident that the plaintiff is entitled to exercise the powers conferred by law for its use. Indeed, Article 374 of the Civil Code provides: ‘A person entitled to an easement is likewise entitled to the means necessary to exercise it and may undertake all work essential for that purpose, but at that person’s own expense unless otherwise stipulated....’ An easement by destination of the owner must satisfy a series of requirements, aptly explained by [Nombre16], quoting [Nombre17], insofar as relevant: ‘The easement is created ex lege (...) upon satisfaction of the requirements established independently by law, regardless, therefore, of whether its signs were not removed through inadvertence or were retained so that the easement would arise; the same applies where the deed contains no declaration contrary to the easement. The sign must be capable of use (...) it is immaterial whether the easement created is necessary.

(...) The law states that the apparent sign of an easement must have been “established by the owner of both” (....) But the term “established” should not be interpreted narrowly; accordingly, we understand that a sign placed by another person and retained by the owner is also valid. What matters is that it exist when the property is conveyed. (...) The easement does not arise if, when ownership of the two properties is separated, the deed conveying either of them provides otherwise (...) It follows that, if only one is conveyed, the contrary intention must be stated in the deed conveying that property, and if both are conveyed simultaneously, it may be stated in the deed conveying either of them. (...) “Deed” means the corresponding public instrument.’ ([Nombre16], Manuel, Derecho Civil, Tomo III, Vol. II, Editorial Bosch, 8ª. edición, 1994, pág.141-143). It is clear that, under this circumstance, compensation (indemnización) is not applicable because the easement existed and had been used for those purposes from the time the theoretically landlocked holding came into existence, although it actually had access established by the former owner.

It therefore follows that no compensation is payable, because the access was acquired as a matter of law, that is, ipso iure, without the need for a judicial declaration. The third possibility for providing access to a landlocked holding is a compulsory easement (servidumbre forzosa). In this regard, Article 395 of the Civil Code states: ‘The owner of a parcel landlocked among other holdings, without access or without sufficient access to a public road, is entitled to demand passage through neighboring parcels for the productive use of the owner’s own parcel, upon payment of the value of the necessary land and compensation for any other damage.’ Regarding this type of compulsory easement, [Nombre16] states: ‘By order of an authority (judicial or administrative), that is, by an award decreed by that authority in favor of the right holder. This occurs in the case of compulsory appurtenant easements (servidumbres prediales forzosas) (...) when, upon a request for their creation by the person entitled thereto, they are granted by the competent authority’ ([Nombre16], Manuel, Derecho Civil, tomo III, Vol. II, Editorial Bosch, 8a. edición, 1994, pág. 141-143).

This method of creation is distinctive in that the easement is established by judicial declaration, and compensation must be paid for the value of the necessary land and any other damage. Finally, the problem of a landlocked parcel may be resolved through the institution of the right of passage (derecho de paso), regulated by Article 400 of the Civil Code, which provides: ‘If any portion of a parcel is sold or exchanged, or if any portion is awarded to one of its co-owners, and that portion becomes landlocked, a right of passage shall be deemed granted in its favor without any compensation.’ This article is distinctive in that the holding becomes landlocked as a result of an act of disposition by the owner of the parcel, whereby part of the property is transferred and one of the portions is left landlocked. Consequently, for reasons of social and economic interest requiring every holding to have access to a road, it is understood as a matter of law that the person holds a right of passage so as to obtain such access, without being required to pay any compensation for it.

In summary, the foregoing arguments establish four different solutions to the problem of a landlocked holding...” (Tribunal Agrario, No. 635 de las 13:45 horas del 24 de setiembre de 1999, emphasis added). In addition, in a case similar to the one now before us, the Tribunal Agrario, in Voto No. 113-F-13 del 27 de febrero del 2009, also stated the following:

IX.Our Civil Code, in Article 380, provided as follows: “The existence of an apparent sign of a continuous easement (servidumbre continua) between two properties, established by the owner of both, shall suffice for the easement (servidumbre) to remain in effect, actively or passively, unless, when ownership of the properties is separated, the instrument conveying either of them states otherwise.” As in the French Code, this provision appears after Articles 378 and 379 of the Code, which govern the creation of continuous and apparent easements (servidumbres continuas y aparentes), as well as discontinuous easements (servidumbres discontinuas) and continuous non-apparent easements (servidumbres continuas no aparentes), as general rules. Consequently, the rule in Article 380 is an exception to the foregoing rules. The literal content of that provision establishes the following requirements: 1.- The existence of an apparent sign of an easement between two properties. 2.- That those properties belong to the same owner. 3.- That the apparent sign remain in effect, actively or passively. 4.- That there be no provision to the contrary at the time either property is conveyed.

If the complete opening phrase, which refers to “[t]he existence of an apparent sign of a continuous easement between two properties...,” is read in light of its historical development, it must be interpreted to mean that the apparent sign is continuous both before and after the property is conveyed. In other words, there is an intention to preserve it, since it may be extinguished either by removing the existing apparent sign or by expressly providing for its elimination in the deed. This must be the correct interpretation, and it must therefore apply where the apparent sign relates to a right-of-way easement (servidumbre de paso). Indeed, Italian legal scholarship, referring to its origins, links this easement to the virtues of the Roman peasant “sui iuris,” who, placed at the head of a rural estate, organizes and directs the forces of nature ([Nombre18], [Nombre19] famiglia, [Nombre20].

DI, II, 1958, 597, cited by [Nombre21] et al., op. cit., page 263). Accordingly, this type of easement may be created by destination of the family owner (destino de padre de familia) in the case of right-of-way easements, which are discontinuous and apparent. This has been recognized by the case law of the First Chamber of Cassation of the Supreme Court of Justice in Judgment No. 380-F-00 at 16:45 on 19 de mayo del 2000, which, in addressing a specific case similar to the one before us, stated as follows: “V.- With respect to the first issue, which turns on whether Article 380 of the Civil Code applies and whether there is a duty to pay compensation if the matter involves the creation of a compulsory right-of-way easement (servidumbre forzosa de paso), the following must be noted. That provision states: ‘The existence of an apparent sign of a continuous easement between two properties, established by the owner of both, shall suffice for the easement to remain in effect, actively or passively, unless, when ownership of the two properties is separated, the instrument conveying either of them states otherwise.’ (Emphasis not in the original).

According to the literal wording of that article, one indispensable requirement for this method of creating an easement is that both estates belong to a single owner. Based on the proceedings and the certified documents submitted with the appeal, this Chamber agrees with the appellant in cassation that this requirement is absent in the case at bar... Furthermore, this Chamber considers the existence of apparent signs of an easement at the time the land was subdivided into parcels to be questionable... That delineation of continuous lines denoting the existence of the easement does not cross that property.... Lastly, as this Chamber has repeatedly held, compensation for the value of the land and for any other damage is an inherent element of a compulsory easement. In this regard, among many others, Judgments Nos. 80 at 14:30 hrs. on 19 de julio de 1995; 17 at 14:30 hrs. on 20 de enero; and 129 at 14:10 hrs. on 26 de marzo, both from 1999, may be consulted.

Our legal system, like others, including those of Argentina, Italy, and Spain, provides an exception to that rule. This occurs when the landlocked condition of the estate results from a legal transaction (negocio jurídico). In such cases, an easement must be created in favor of the property rendered landlocked by virtue of the transaction, without any compensation. Article 400 of the Civil Code so provides. In this case, as noted above, that is not the situation, because the estates never belonged to the same owner. It follows from the foregoing that the case at bar does not involve an easement by destination of the family owner, but rather a compulsory right-of-way easement, because the estate is landlocked. The factual and legal grounds set out above suffice to reach that conclusion. It is therefore unnecessary to address the other arguments advanced for that purpose. Moreover, because the exception governed by the Civil Code does not apply, all defendant owners whose properties will be affected by that encumbrance (gravamen) are entitled to compensation for the value of the land necessary to create it, as well as for any other damage (Articles 395 and 400 ibid.).” (End of quotation; underlining not in the original).

It follows from that decision that Costa Rican case law accepts the creation of a right-of-way easement by destination of the family owner when two requirements are necessarily met, namely: 1) that the properties belonged to the same owner; and 2) the delineation of continuous lines as apparent signs denoting the existence of the easement. A portion of our legal scholarship reaches the same conclusion, stating: “An easement by destination of the family owner does not continue; rather, it ‘is created’ when one of the properties affected by that situation is conveyed. Article 531 of the Spanish Civil Code contains the same inaccuracy. It has been established that the expression ‘two properties’ may apply where the owner of a single property imposed an encumbrance on one of its portions for the benefit of another before its division...” ([Nombre22] , (commentary), in: [Nombre23] , Alberto, Tratado de los Bienes, Juricentro, 1981, p. 112).

Another author emphasizes the following: “If we review our legislation, we see that Article 380 states that the easement will continue when the estate is divided or when one of the original owner’s estates is transferred to another holder; what actually occurs is the transformation of a mere service between portions or estates belonging to the same holder, because the previously discussed principle ‘nemini sua servit’ applies. It is important to bear in mind that, in this situation, the service already existed and continues upon the segregation (segregación) of the estate or the transfer of ownership of one estate to another holder” ([Nombre24], Roxana. Estudio de la Jurisprudencia judicial y administrativa respecto de las servidumbres. Universidad de Costa Rica, 1985, p. 98). Notwithstanding the foregoing, some still advocate a restrictive application of the doctrine, limited to cases involving continuous and apparent easements (BRENES CORDOBA, op. cit., p. 112, CHINCHILLA, José.

However, that interpretation is inconsistent with the economic and social needs of productive agricultural property, as discussed below.

X.The agricultural case law of the First Chamber of Cassation of the Supreme Court of Justice has established the relationship between agricultural easements (servidumbres agrarias) and the productive purpose of estates, the agricultural enterprise (empresa agraria), and the purpose assigned to productive estates by a prudent family owner (buen padre de familia). In this regard, it stated: “A fundamental element within the structure of an agricultural enterprise is its organization. Both tangible and intangible assets (instrumenta fundi) participate in it. The rights acquired by the holder of the estate (iura fundi), as a consequence of engaging in agriculture and in view of their necessity or usefulness for agricultural production, constitute a valuable instrument within its organizational structure. The ‘iura fundi’ are ordinarily identified with the praedial servitudes (servidumbres prediales) of Roman law, which were formerly classified as res mancipi.

They are the so-called ‘rights’ of the estate and form part of the agricultural establishment (hacienda agraria), viewed as an estate-organization. An estate’s ‘need for water’ for cultivation, or its need for access to a public road for external communications, creates rights in favor of the landlocked estate. The utility of one estate is used by another estate. But these rights do not always coincide with the praedial servitude rights governed by the Civil Code. The typical servitudes of Roman law (iter, via, actus, aquae ductus) were, as stated, classified as res mancipi. Together with slaves, livestock, installations, and farming implements, they formed the instrumentum fundi, that is, the organization of the agricultural establishment. This construction was possible because a servitude was conceived as a ius fundi, which was exercised through material dominion (mancipium) over those portions of the servient estate (fundo sirviente) intended to improve the use of the dominant estate (fundo dominante).

This ancient conception of the agricultural easement was tied to the public-law conception of rural property as sovereign dominion and was superseded under the new private-law conception of Roman property. In modern law, an easement cannot be conceived as an appurtenance. Some of its characteristic elements, such as dedication to a particular purpose (destinación), nevertheless remain and assume significant importance. The act creating an easement reflects the dominant holder’s intention to dedicate it to the organization of the holder’s estate, thereby obtaining an economic benefit from the other estate. The ‘destination by a prudent family owner’ is essential to explaining the economic and social function involved in the creation of an easement. This function is linked to a deliberate choice by the holder of the dominant estate, who sought to obtain some utility from another estate in order to dedicate it to the service of the holder’s own estate.” (No. 80 at 14:30 on 19 de julio de 1995).

V.Having made these legal assessments, it is appropriate to analyze the factual circumstances and evaluate the evidence (prueba) according to the criteria of equity and/or law required by the rules of agrarian law (ius agraria) ( artículo 54 de la Ley de Jurisdicción Agraria). In the present matter, it has been proven that the plaintiff is the owner of a property recorded in the Public Registry under real-property folio registration [Placa2] of the Alajuela Registry District. ( proven fact 1 ) She acquired that property by donation of the bare ownership (nuda propiedad) from her partner [Nombre2], through deed number one hundred thirty-nine executed at 9:30 hrs del 9 de marzo del 2005 ( deed at folio 61). Mr. [Nombre2], in turn, had also acquired it by donation of the bare ownership from [Nombre8], through a deed executed at nueve horas del 31 de agosto del 2004. ( 61). The case file contains a record that Mr. [Nombre2] died on 16 de agosto del 2008.

( folio 129 ). For many years—more than twenty—the land now belonging to the plaintiff has benefited from passage over the lands of the current defendants. One reason has been the difficult topographical conditions of the land formerly belonging to Ms. [Nombre8] and now belonging to the plaintiff, as demonstrated by the judicial inspections (reconocimientos judiciales) and testimonial evidence (prueba testimonial). Indeed, folio 38 contains the judicial inspection report stating as follows: “It is observed that the land—with the exception of the area where the house and warehouse are located—is otherwise very rugged and slopes toward the north and west, and during the judicial inspection it is not observed that there is access from the northern part of the plaintiff’s property toward [Dirección2]; this is because, as the plaintiff tells us, her land is very rugged and does not allow her to remove her produce through her own property.

The plaintiff’s land is planted with coffee, which is in production...” (folio 38 ). The witness [Nombre11] states, insofar as relevant: “Mr. [Nombre2] had no other means of entering his property; the only one was the access at issue...” (folio 395). The other reason was the existing family agreement allowing Ms. [Nombre8] and Mr. [Nombre2] to use the existing right-of-way easement (servidumbre de paso). It should be recalled that Ms. [Nombre8] was the sister of Mr. [Nombre13], father of the defendant [Nombre2], who also acts as representative of Sociedad Cuatro Eme Limitada. The witness [Nombre2], sister of Mr. [Nombre2], states in this regard: “I knew [Nombre2], and Mr. [Nombre2] used the access at issue; he used it because my father gave him permission. We have always lived here; this belonged to my grandfather long ago, and my grandfather left it to my aunt, who was [Nombre2]’s wife...

My father built the access at issue and gave [Nombre2] permission to pass through. Mr. [Nombre2] later had that permission withdrawn because he was aggressive and an alcoholic; I clarify that permission was never denied to him....” “My father gave [Nombre2] permission to pass through there, and that was approximately eight years ago. I do not remember when my aunt [Nombre8], [Nombre2]’s wife, died. My aunt and [Nombre2] used the access at issue to haul the coffee...” (folio 396). For the purpose of clarifying certain aspects of the complaint, this Court conducted a judicial inspection of the property, during which it found that the plaintiff’s property does not in fact have an adequate outlet for the coffee production generated on her farm, because the access it has to the public road, [Dirección3], presents serious difficulty due to the degree of the land’s incline relative to the road, reaching as much as forty-five degrees in some places ( see proven facts ).

It also found that the access lane to the plaintiff’s property is very old and bears apparent signs of that age, such as some itabo plants planted along the sides of the passage that even extend into her property in the same direction as the remainder of the passage. The purpose of that lane is to connect different sections of the property, which formerly constituted a single unit and which now, although retaining its productive use for coffee cultivation, is owned by different natural or legal persons. The foregoing is stated not to establish the existence of a possible landlocked property (enclave) and, consequently, the need for a compulsory easement (servidumbre forzosa), since that is not what was requested, but rather to understand why the family agreement was needed to provide an outlet for the coffee production of Ms. [Nombre8] and Mr. [Nombre2]. That agreement is not in writing, but it is evident from the testimonial evidence received.

In the examination of [Nombre9] as a party (prueba confesional), one of the neighbors whose property borders the easement and who is a co-defendant for that reason, he responds to the questions as follows: “Since what date have you owned the property on which your residence is located? Answer: For seven years. Second: When you acquired your property on the date you indicate, did the passage currently at issue already exist?* Answer: Yes. Third: Did you know Mr. [Nombre2]? Answer: Yes. Fourth: On the date you acquired your property, was Mr. [Nombre2] already using the passage at issue?* Answer: Yes. Fifth: Do you know [Nombre1]? Answer: Yes, I know her by sight. Sixth: Have you (sic) seen [Nombre1] use the passage at issue? Answer: Yes, I see vehicles pass through to her property to deliver fertilizer and collect the coffee...” Moreover, the witness [Nombre10], who works for [Nombre1], states: “I knew [Nombre2]; I knew him for about twenty years.

I helped Mr. [Nombre2] harvest coffee. I live in Cirrí. What I know about the dispute is that Mr. [Nombre2] has always wanted to close the entrance; it is the entrance that [Nombre2] always used. Mr. [Nombre2] had uzed* ( sic ) the road for about twenty years; he hauled out the coffee and brought in the fertilizer and lime—he took everything through there. I was always helping him and working for Mr. [Nombre2]. [Nombre2] took care of the road; sometimes he brought cartloads of gravel to repair it, and I helped him spread the gravel along this road. I have worked for [Nombre1] for four years; my duties are applying materials: lime and fertilizer, and harvesting the coffee. Mr. [Nombre2] and now Ms. [Nombre1] use the road, because I always understood it to be an entrance to the property. [Nombre2] did have problems over using the access at issue; on one occasion Mr. [Nombre2] even installed a gate that Mr. [Nombre2] had to remove, and that was about fifteen years ago.” ( folio 396 ).

Finally, testimony was received from [Nombre11] , who states: “I knew [Nombre2] when he was alive, about fifteen years ago, when we came to harvest coffee on Mr. [Nombre2]’s farm; our father brought us. Mr. [Nombre2] transported people from San Jeróimo, and they would work on the farms harvesting coffee. I know about the dispute; what is at issue is the right of passage (derecho de paso) for the property that belonged to [Nombre2] and now belongs to [Nombre1]. Mr. [Nombre2] took people to his property through that passage and hauled the coffee out through there. He used the passage for maintenance, hauling out the coffee, and harvesting it; I was always there during harvest season. Mr. [Nombre2]’s farm was always operated through that access. It had several sections—there are three—the witness identifies those points as (b), (c), and ( d). At point ( b), the coffee from the rear of the property was harvested, and at point 8 d), that from the upper part of the farm.

The coffee from points (b) and (c) was hauled out along the road, and the coffee from point (d) was hauled out by the public road. All according to the sketch appearing at folio 37....” Finally, the Court has before it, as documentary evidence (prueba documental) at folios 76, 77, the statement of Mr. [Nombre2], in which he files a complaint* against [Nombre2] and states as follows: “The events occurred on ocho de enero del año en curso, in the afternoon, on the easement located about two hundred meters from my house, which is private and belongs to our family. Nevertheless, for many years we have allowed him to pass through our easement, but on the aforementioned date and time, at this easement, which has a padlocked gate and chains, he broke a post, damage that I value at one hundred thousand colones. What I request is that the defendant no longer enter the easement and, much less, cause damage.*” ( folio 77) .

From all the evidence received, it is clear to the Court that both Mr. [Nombre2] and Ms. [Nombre1] used the easement for many years—approximately twenty years, according to the witnesses. That fact is expressly acknowledged even by the defendant [Nombre2]. The Court also finds that the passage granted was not a tolerated act or an act of mere tolerance (acto de mera tolerancia), since the defendant [Nombre2]’s own sister * * recounts that there was an agreement with her father, Mr. [Nombre13], who was also [Nombre2]’s father, under which Mr. [Nombre2] had permission to use the easement. Although the witnesses speak of the existence of permission, their testimony clearly shows that this so-called permission constituted genuine possession under claim of ownership (posesión a título de dueño), exercised publicly, peacefully, and continuously in favor of [Nombre2] and [Nombre8], since he entered with carts to bring in fertilizer, perform maintenance, and haul out the coffee, repaired the road, etc., and was subject to no restrictions.

That situation was not precarious possession (posesión precaria), because it continued for many years and allowed [Nombre1] to enjoy the same right while she lived with [Nombre2]. It was Mr. [Nombre2] who restricted Mr. [Nombre2]’s right of passage, which gave rise to a possessory injunction proceeding (interdicto) brought by the former against the latter, of which there is a record in the form of a ruling appearing at folio 3; that proceeding was stayed until the interested party demonstrated in the record that probate proceedings (sucesorio) for Mr. [Nombre2] had been opened, his death having been verified. This possessory injunction proceeding dates from 2008, coinciding with the criminal complaint for property damage (denuncia por daños) filed by [Nombre2] against [Nombre25] , based on the allegation that a post at a gate had been broken. Neither proceeding was resolved because of Mr. [Nombre2]’s death, and it was Ms. [Nombre1] who brought the present ordinary proceeding (proceso ordinario) to resolve the matter, as donee of the bare ownership.

On this point, it is important to clarify that although Ms. [Nombre1] owned the bare ownership, Mr. [Nombre2]’s death automatically extinguished, as to him, the exercise of the other incidents of ownership (usos del dominio), such as use and habitation (uso y habitación). Moreover, it has been proven that Ms. [Nombre1] and Mr. [Nombre2] were the persons conducting the agricultural business activity (actividad empresarial agraria) of coffee cultivation, and therefore Ms. [Nombre1] was and remains legally entitled (legitimada) to assert the claim concerning the easement. It was also established as a proven fact in the first-instance judgment, which this Court adopts, that the right-of-way easement crosses the following properties in the Alajuela Registry District: real-property folio No. 227971-000, described in survey plan (plano) A-806424-2002; real-property folio 326445-000, described in plano A-612047-1985;* real-property folio 131837-000, described in plano A-653611-1986; real-property folio 315487-000, described in plano A-653608-1986;* and real-property folio 315486-000, described in plano A-653610-1986, all owned by Sociedad Cuatro Eme Limitada; as well as the property of [Nombre3], real-property folio No. 355485-000, described in plano A-653609-1986, which borders to the north and west the property under real-property folio 227972, owned by [Nombre4] and [Nombre5] and described in plano A--0717941-1987.

( proven fact two of the first-instance judgment.) The linear extent of the easement has likewise been proven to be three hundred fifty-eight meters up to the entrance of the plaintiff’s property, with a width of six meters at the entrance and thereafter a minimum width of three meters from the midpoint of the road, in the direction of [Dirección1], until reaching the level portion of the plaintiff’s property bordering Río Cocora. *

VI.Having analyzed both the applicable legal framework and the evidence received, insofar as they concern the subject matter of the appeal, this Court concludes that the plaintiff is partially correct in her appeal, since it is evident that, by agreement, the claimant enjoyed a right-of-way easement (servidumbre de paso) over the defendants’ land. That easement was agreed upon by the defendant’s father, named [Nombre13] , who was the person who formally transferred title to his sister [Nombre8] , married to Mr. [Nombre2] . Possession of the easement under that agreement continued for many years, until friction arose between the son of [Nombre13] , the defendant [Nombre2] , and disputes occurred over that easement, even resulting in accusations of property damage and a possessory injunction proceeding (interdicto), which did not conclude because of the death of [Nombre2] . The easement has been used continuously, as befits a right-of-way easement, first by [Nombre8] and [Nombre2] and later by [Nombre2] and [Nombre1] .

It is an agricultural easement (servidumbre agraria), whose social function is to allow access to and departure from the farm, now owned by [Nombre1] , thereby permitting production activities. The plaintiff’s petition is granted because, although the easement was never registered, this does not affect the obligation between the parties who agreed to it. Accordingly, the proper course is to partially reverse the trial court judgment insofar as it sustained the defenses of lack of a legal right (falta de derecho), lack of standing to sue and be sued (falta de legitimación activa y pasiva), and lack of interest (falta de interés) raised by the defendant [Nombre2] in his personal capacity and as representative * of Familia Cuatro Eme Limitada. The judgment is upheld insofar as it dismisses the complaint in its entirety against [Nombre4] and [Nombre5] , because it has not been shown that those defendants interfered with or obstructed the plaintiff’s right-of-way easement.

Instead, the defenses of lack of a legal right, lack of standing to sue and be sued, and lack of interest raised by the defendant [Nombre2] in his personal capacity and as representative of Familia Cuatro Eme Limitada are rejected, and the complaint is granted as follows: a) The existing right-of-way easement between the plaintiff [Nombre1] and the defendants [Nombre2], in his personal capacity and as representative of Familia Cuatro Eme Limitada, shall be restored. b) Registration of the right-of-way easement is ordered, with property 201507 of the Alajuela Registry District, coffee-growing land located at [Dirección4] , , , province of Alajuela, registered in the name of [Nombre1] , as the dominant estate (fundo dominante), and encumbering the following properties of the Alajuela Registry District: real-property folio No. 227971-000, described in survey plan A-806424-2002; real-property folio 326445-000, described in survey plan A-612047-1985; real-property folio 131837-000, described in survey plan A- 653611-1986;* real-property folio 315487-000, described in survey plan A-653608-1986;* and real-property folio 315486-000, described in survey plan A-653610-1986, all belonging to Cuatro Eme Limitada; as well as the property of [Nombre3], real-property folio No. 355485-000, described in survey plan A-653609-1986, which borders to the north and west on property real-property folio 227972, owned by [Nombre4] and [Nombre5] and described in survey plan A--0717941-1987; this shall be carried out during enforcement of the judgment (ejecución de sentencia).

Actúa como apoderado especial judicial de la parte actora el letrado Alban Sing Villalobos , cédula de identidad número CED7 - - , colegiado número nueve mil cuatrocientos once; como abogado director del co-demandado [Nombre2] , el licenciado Máximo [Nombre2] Vega, colegiado número seis mil novecientos cuarenta y seis; y de los demandados [Nombre5] y [Nombre4] , la Defensora Pública Agraria Wesley Valenciano Solano, de calidades desconocidas en autos. Tramitado ante el Juzgado Agrario del Tercer Circuito Judicial de Alajuela, San Ramón. * * * RESULTANDO:*

  1. 1La parte actora planteó demanda ordinaria, estimada en la suma de cinco millones de colones, para que en sentencia se declare: " a) Por todo lo antes expuesto, solicito con el debido respeto a este Honorable Tribunal de Justicia, acoger el presente proceso ordinario agrario de reivindicación y restitución de la posesión y constitución de servidumbre de paso en todos sus extremos. b) se me reconozca y declare en sentencia que ha operado sobradamente y a favor de mi fundo dominante la prescripción positiva del uso de la servidumbre de paso que pesa sobre el fundo sirviente propiedad del aquí demandado. Lo anterior en virtud de que los hechos aquí probados, demuestran fehacientemente * el simple uso y aprovechamiento por el paso del tiempo de esa servidumbre y la mera paciencia de quienes han o hayan sido propietarios o poseedores del inmueble sirviente a través del tiempo. c) Se acoja y declare con lugar, en la mayor brevedad posible la solicitud de medidas cautelares atípicas aquí solicitadas.Lo anterior con el fin de que no se me ocasione mayores daños de los que ya enfrento,con motivo de la arbitraria e ilegal decisión de cerrar la servidumbre de paso que por tantos años ha disfrutado mí fundo. d) que una vez restituido mi derecho a continuar disfrutando del Derecho de Posesión y uso de la mencionada Servidumbre de paso, se le prevenga al señor [Nombre2] , abstenerse de perturbar los derechos otorgados mediante la medida cautelar, hasta tanto no se resuelva la situación mediante el dictado de sentencia de fondo. Bajo apercibimiento de que en caso contrario, será juzgado por el delito de desobediencia ala autoridad. e) Una vez reconocida la prescripción positiva a favor de mi propiedad, solicito respetuosamente que su autoridad ordene la inscripción en el Registro Nacional, Sección Inmuebles la servidumbre de paso aquí reconocida. f) Solicito además se condene al señor [Nombre2] , al pago de daños y perjuicios que con su actuar ilegal y de mala fe me ha ocasionado.Asimismo se condene a las costas personales y procesales de este proceso, todos los cuales serán liquidados en el momento procesal oportuno." (folio 15 a 16). Asimismo integra litis contra Familia Cuatro Eme Ltda, [Nombre5] , [Nombre6] y [Nombre3] , solicitando: " a) Por todo lo antes expuesto, solicito con el debido respeto a este Honorable Tribunal de Justicia, acoger el presente proceso ordinario agrario de reivindicación y restitución de la posesión y constitución de servidumbre de paso en todos sus extremos. b) se me reconozca y declare en sentencia que ha operado sobradamente y a favor de mi fundo dominante la prescripción positiva del uso de la servidumbre de paso que pesa sobre el fundo sirviente propiedad del aquí demandado. Lo anterior en virtud de que los hechos aquí probados, demuestran fehacientemente el simple uso y aprovechamiento * por el paso del tiempo de esa servidumbre y la mera paciencia de quienes han o hayan sido propietarios o poseedores del inmueble sirviente a través del tiempo. c) Que en virtud de la medida cautelar que restituye mi derecho a continuar disfrutando del Derecho de posesión y uso de la mencionada servidumbre de paso, se le prevenga a los demandados en especial al señor [Nombre2] a título personal y en su condición de apoderado generalísimo de su representada, que se abstengan de perturbar los derechos otorgados mediante la medida cautelar, hasta tanto no se resuelva la situación mediante el dictado de sentencia de fondo, tal y como lo ordenó el Tribunal Agrario.Bajo apercibimiento de que en caso contrario, serán juzgados por el delito de desobediencia a la autoridad. d) una vez reconocida la prescripci* ón positiva a favor de mi propiedad, solicito respetuosamente que su autoridad ordene la inscripción en el Registro Nacional, sección Inmuebles la servidumbre de paso aquí reconocida a favor del fundo dominante y en contra de todos los fundos sirvientes. e) Solicito además se condene únicamente al señor [Nombre2] , a título personal y en su condición de apoderado generalísimo sin límite de suma de la entidad "Familia cuatro emes Ltda" al pago de daños y perjuicios que con su actuar ilegal y de mala fe me ha ocasionado, puesto que como ya lo indique los otros co-demandados específicamente los señores [Nombre3] , [Nombre4] y [Nombre5] , nunca se han opuesto al derecho de paso que tiene mi propiedad. Si en el eventual caso de que esas personas no acepten mis pretensiones y se opongan al presente proceso Ordinario, solicito se les condene a las costas personales y procesales de este proceso, todos los cuales serán liquidados en el momento procesal oportuno." (folios 240 a 241). *
  2. 2Los demandados debidamente notificados, se opusieron a la acción formulada en su contra: el demandado [Nombre2] en su calidad personal interpuso las excepciones de litis consorcio pasivo necesaria, falta de derecho, falta de legitimación activa y pasiva, falta de interés; [Nombre5] y [Nombre4] interpusieron las excepciones de falta de derecho, falta de legitimación activa y pasiva, falta de interés; la entidad demandada Familia Cuatro Eme Ltda. interpuso las excepciones de falta de legitimación activa y pasiva, falta de interés, falta de prescripción, caducidad y litis consorcio necesario. (folios 135 a 136, 288 a 289, 299 a 300, respectivamente). *
  3. 3Los co-demandados [Nombre5] y [Nombre4] interpusieron contrademanda y solicitaron: "1.- Que mi propiedad no tiene relación con las pretensiones de la actora, 2.- Se imponga al contrademandado el pago de los daños y perjuicios que me ha ocasionado. 3.- Se condene al demandado al pago del daño moral generado pues me ha afectado en mi estado emocional aprovechándose soy una persona adulta mayor, lo cual evidentemente ha incidido en mi estado de salud física. El cuestionamiento de mi honorabilidad ha afectado mi autoestima seriamente, lo cual está siendo tratado por especialistas en el ramo. Todo ello debe ser reparado. 4.- Se condene al demandado al pago de las costas personales que me ha ocasionado con la interposición de este proceso. 5.- Se disponga la indexaci* ón de las sumas por las cuales se condene al demandado como daños, perjuicios y costas, trayéndolas al valor presente, considerando la grave situación financiera internacional y nacional por la que estamos atravesando y especialmente el sistema de devaluación de nuestra moneda." (fs. 290 a 291) 4.- La jueza Tatiana Rodríguez Herrera, del Juzgado Agrario del Tercer Circuito Judicial de Alajuela, San Ramón, en sentencia número 059-2012 de las once horas veintiocho minutos del veintiuno de setiembre de dos mildoce, resolvió: “POR TANTO: En razón de lo expuesto se ACOGEN las EXCEPCIONES de FALTA DE DERECHO, FALTA DE LEGITIMACIÓN ACTIVA, FALTA DE LEGITIMACIÓN PASIVA y FALTA DE INTERÉS interpuestas por los demandados [Nombre2] , [Nombre4] , [Nombre5] y FAMILIA CUATRO EMES LTDA; se DENIEGAN las EXCEPCIONES de PRESCRIPCI* ÓN y CADUCIDAD interpuestas por FAMILIA CUATRO EMES LTDA.Se declara SIN LUGAR en todos sus extremos la demanda interpuesta por [Nombre1] contra [Nombre2] , [Nombre3] , [Nombre4] , [Nombre5] Y FAMILIA CUATRO EMES LTDA, son las costas personales y procesales de la demanda a cargo de la parte actora. Se deja sin efecto la medida cautelar que se dictó en este proceso a través de la resolución No. 23-2008. EN CUANTO A LA CONTRADEMANDA interpuesta por [Nombre4] y [Nombre5] se ACOGE la EXCEPCIÓN DE FALTA DE DERECHO, se declara SIN LUGAR en todos sus extremos la CONTRADEMANDA interpuesta por [Nombre4] y [Nombre5] y en contra de [Nombre1] ; se resuelve sin especial condenatoria en costas lo concerniente a la contrademanda." (ver documentos asociados del escritorio virtual de San Ramón, archivo 1070133 del 21/09/2012) *
  4. 5La parte actora interpuso recurso de apelación con indicación expresa de las razones en que se apoyaron para refutar la tesis del juzgado de instancia. (ver escritos en el escritorio virtual de San Ramón, archivo 1074131 del 01/10/2012). *
  5. 6En la substanciación del proceso se han observado las prescripciones legales, y no se observa la existencia de errores u omisiones capaces de producir la nulidad del fallo.-*

Redacta el [Nombre7] Bolaños Céspedes, y; * * * CONSIDERANDO*

I.Se prohijan los hechos probados uno, dos y tres de la sentencia de primera instancia. Del mismo linaje se agregan los siguientes hechos probados: 4. Esa propiedad la adquirió la actora por donación de la nuda propiedad, por parte de su compñero [Nombre2] , mediante escritura número ciento treinta y nueve de las 9:30 hrs del 9 de marzo del 2005 ( escritura de folio 60). Don [Nombre2] , a su vez la había adquirido también por donación de la nuda propiedad de [Nombre8] , mediante escritura de las nueve horas del 31 de agosto del 2004. ( folio 61). 5. Don [Nombre2] falleció el 16 de agosto del 2008. ( folio 129 ). 6. Desde hace mucho años, más de veinte, ha existido para el terreno de la actora, el uso del paso por terrenos de los ahora demandados. La razón ha sido, por una parte la situación de dificultad topográfica del terreno originalmente de doña [Nombre8] y ahora de la actora, (reconocimiento de folio 38 y testimonial de folio 392 en adelante, reconocimiento como prueba para mejor proveer, visible en documentos asociados del escritorio virtual ) con una evidencia de falta de salida suficiente del inmueble de la actora, por lo quebrado del terreno, y un convenio familiar verbal para darle salida a la producción de café de doña [Nombre8] y don [Nombre2].

( prueba confesional de [Nombre9] ( folio 392) , testimonios de [Nombre10] , [Nombre11] ( 393 en adelante, declaración de don [Nombre2] ( folio 77) 7. Fue don [Nombre2] , quien vino a restringir el derecho de paso de don [Nombre2], lo cual dio origen a un interdicto del primero contra el segundo ( folio* 3) , el cual se suspende al haberse comprobado la defunción de [Nombre2]. 8. Doña [Nombre1] y don [Nombre2] realizaban en conjunto la actividad empresarial agraria de cultivo de café. ( prueba testimonial de folios 393 en adelante ) 9. El paso existente para acceder a la finca de la actora, tiene las características de los callejones que existen en las fincas cafetaleras para comunicar las diferentes áreas de la finca. Se observa antiguo por los árboles que lo rodean. ( reconocimiento judicial como prueba para mejor proveer, visible en escritorio virtual, documentos asociados ). 10. La servidumbre de paso tiene una extensión lineal de trescientos cincuenta y ocho metros y un ancho mínimo de tres metros, con seis metros en la entrada, con dirección [Dirección1] , hasta llegar a la parte llana de la propiedad de la actora colindante con el Río Cocora.( reconocimiento judicial como prueba para mejor resolver, visible en la carpeta del documentos asociados, en el escritorio virtual ) *

II.Se prohijan los hechos no probado número uno y tres. No se prohija el hecho probado dos, por existir prueba de la existencia de un convenio que hizo surgir la servidumbre de paso a favor de la propiedad de la actora. *

III.La actora apela de la sentencia de primera instancia con fundamento en los siguientes aspectos: 1. Señala que en la sentencia en el punto primero de los hechos probados la resolución tiene como demostrado que el señor [Nombre2] , quien fuera su compañero sentimental y anterior dueño de la finca, matrícula de folio real [Placa1] ( fundo dominante) había utilizado el acceso o servidumbre de paso aquí en conflicto, para ingresar y sacar la producción de café de su inmueble. Indica que esto quedó demostrado plenamente a través de toda la prueba confesional y testimonial. 2. Afirma que esa servidumbre por 30 años ha tenido una razón fundamentalde ser y es que es el único medio topográfico razonable para ingresar a la finca ahora de su propiedad. Si bien es cierto su finca tienen en el frente una colindancia en parte con vía pública, también es cierto que por razones de tipo topográfico, es materialmente imposible ingresar por ese frente a la finca para llevar a cabo la actividad agraria y se torna imposible también la extracción para la producción que es el fin último de la actividad agraria que lleva a cabo en la finca.

Todo ello pudo ser constatado por la jueza en la inspección ocular, dentro del proceso. El acceso a la finca por esa servidumbre no obedece a un capricho , como tampoco es un capricho que los dueños anteriores hubieran acceso por esa servidumbre por más de cincuenta años. 3. para una mejor comprensión del problema relata algunos aspectos de tipo histórico sobre la situación real del inmueble. El señor [Nombre12] , quien fuera el propietario de la finca madre y de la cual se han originado las fincas relacionadas, hizo en determinado momento de su vida lo siguiente: a) realizó una primera segregación y ésta se la donó a su hija la señora [Nombre8] , en el año 1979, es decir hace 33 años y por ora parte hizo otra segregaci* ón y se la donó a otro de sus hijos el señor [Nombre13] , hermano de doña [Nombre8]. b) Mucho tiempo antes de realizar estas segregaciones ya la servidumbre de paso que aquí tenemos en conflicto existía, es decir don [Nombre14] la había creado, para extraer a través de ella toda la produccion de café de la finca madre y por supuesto para poder extraer del sector que donó a su hija [Nombre8] , la producción de esa parcela, porque era al igual que hoy día, el único medio razonable para hacerlo. c) El señor [Nombre14] , fue para decirlo de alguna manera, una especie de gran pater familia, quien le donó a sus hijos las fincas aquí relacionadas y desde luego con ellos estableció un convenio familiar, en el sentido de que su hijo [Nombre13] , le permitiría a la finca de su hermana [Nombre8] ( finca dominante hoy de su propiedad ) servirse de la servidumbre de paso que ya existía, porque de otra manera no podría explotar la actividad agraria, dada la situación topográfica que caracteriza el frente a calle pública que tiene la finca de doña [Nombre8] , pues por ese frente a la vía púbica era y es hoy día, materialmente imposible el acceso, dada su tremenda inclinación.

Por esas razones han hecho incapié* en que desde hace más de 50 años han ejercido el derecho de paso para el uso de la mencionada servidumbre. d) (sic) El señor [Nombre13] hace varios años decidió hacer una serie de segregaciones para darle una donación de una parcela a cada uno de sus hijos y estas segregaciones por supuesto generaron la aparición de nuevas inscripciones de fincas en el Registro Público de la Propiedad y sus correspondientes nuevos planos debidamente catastrados, que usan la servidumbre, lo que genera otro convenio familiar entre el señor [Nombre13] y sus hijos, porque de lo contrario no tendrían posibilidad de salir a la calle pública lo cual fue explicado a la jueza de instancia. Con esa misma acción, refrendó el convenio familiar que había establecido su señor padre, con su hermana, la señora [Nombre8] , para que ella pudiera seguir explotando la actividad agraria en su pequeña finca, que reitera había recibido en donación por parte del padre de ambos, don [Nombre14] .

Todo lo anterior se confirma por el hecho de que durante más de treinta años, el señor [Nombre2] hizo uso de la servidumbre de paso, aquí en conflicto, sin que hubiera de parte de alguno de los propietarios del fundo sirviente, algún tipo de oposici* ón, ni a la señora [Nombre8] ni a don [Nombre2] . Jamas hubo inconvenientes con [Nombre13] y el uso y posesi* ón de la mencionada servidumbre de paso se ha llevado de manera pública, pacífica, notoria de buena fe y a título de dueño, lo cual explicaron en la ampliación de la demanda. En ese sentido la testigo [Nombre2] es trascendental porque siendo ofrecida por la parte demandada y siendo hermana del demandado y nieta de don [Nombre14], confirma aspectos de la tesis sostenida por esa parte actora. Así afirma que su tía la señora [Nombre8] siempre tuvo permiso para transitar por el camino de paso, porque su padre le dio permiso, como hija, para que pudiera llevar a cabo la actividad empresarial agraria en compañía de su esposo el señor [Nombre2] .

Indica que a efectos de probar que efectivamente fue en el año 1979 ( hace 33 años ) que la señora [Nombre8] adquirió la finca es que están adjuntando copias certificadas de varios actos notariales que tienen que ver con la historia registral de la propiedad de la finca, la cuales solicita se consideren como prueba para mejor proveer. Con esa prueba quieren demostrar lo siguiente: a) que mediante escritura del 11 de octubre de 1984, otorgada ante la notaria pública Norma Arguello Pérez, la señora [Nombre8] , traspasa la nuda propiedad a favor de su hermana * la señora [Nombre15] . Lo anterior con motivo de asuntos familiares. Con lo anterior pretende dejar plenamente demostrado que la señora [Nombre8] , ya desde antes del año 1984 era la propietaria registral de la finca ahora de propiedad de la actora. b) Que mediante la escritura del ía 22 de agosto de 1995, ante la Notaria Isabel Montero Mora, la señora [Nombre15] le devuelve la nuda propiedad a la señora [Nombre8] . c) Mediante escritura de fecha 31 de agosto del año 2004, la señora [Nombre8] le traspasa la nuda propiedad al señor [Nombre2] .

Con esa historia registral se pretende demostrar que nunca se ha dejado de tener un vínculo de tipo familiar y que el permiso otorgado por el señor [Nombre13] , para el uso del paso por el camino trazado sobre la finca inscrita en aquel momento a su nombre, aún se mantiene hasta nuestros días. 4. Se le aportó a la jueza de primera instancia diferentes certificaciones registrales de las nuevas fincas, así como sus correspondientes planos debidamente catastrados, que nacieron a la vida jurídica con motivo de la segregaci* ón de diferentes lotes que llevara a cabo el señor [Nombre13] padre del aquí demandado. Esas seis nuevas fincas nacen siendo fundos enclavados y la única manera para cada uno de ellos, de tener acceso a la vía pública, es precisamente utilizando la misma servidumbre de paso que tenemos en este conflicto. Eso se realiza por convenio familiar, que es la misma situación de su finca.

Manfiesta que el derecho de paso que ha ejercido su propiedad, con fundamento en el convenio familiar no ha perjudicado ni beneficiado al accionado, porque en ningún momento dentro de este proceso agrario, ni fuera de él, el demandado ha mostrado alguna inconformidad, porque se le hubiese causado alguna molestia. Más bien ha quedado demostrado que el señor [Nombre2] , ex esposo de la tía del aquí demandado y más tarde cuando enviudó, durante más de treinta años, siempre fue él, quien le diera mantenimiento con riego de lastre y desagues a la servidumbre para que se mantuvieraen buenas condiciones de uso, lo que demuestra que por puro capricho el demandado le niega lo que por convenio familiar de décadas su familia ha respetado. Ese convenio familiar que ha sido demostrado, no ha tenido menoscabo alguno, desde el momento en que de manera unilateral el accionado señor [Nombre2] , ha tomado la decisión de cerrar el paso para el fundo de la actora,, ocasionando con ésto la imposibilidad de continuar con la actividad agraria, porque no tendría medio alguno para hacerlo, porque no tendría acceso posible a su predio.

La sentencia de primera instancia no consideró este aspecto del convenio de tipo familiar existente, ni las consecuencias que provocaría a su actividad agraria, el capricho del demandado de dar por concluido el convenio familiar. 5. Señala como agravio que no se tomara en cuenta el Informe pericial elñaborado por el Ingeniero Topógrafo César Sánchez Calvo, en el cual queda demostrada la existencia de la servidumbre de paso, cuales eran los fundos afectados, los propietarios, se aportó un croquis de ello . Asimismo del análisis de las certificaciones y planos mencionados se desprende que la servidumbre aquí en conflicto se encuentra registralmente inscrita, en cada una de las fincas, así como en cada uno de los planos debidamente catastrados. De ello se concluye que la servidumbre aquí en conflicto es una servidumbre * * de paso constituida a derecho y no simplemente de hecho. La familia [Nombre2] legalizó la servidumbre de paso que aquí nos ocupa, en cada uno de sus planos y en cada una de sus propiedades, pero excluyeron el fundo de la actora, a sabiendas de que desde hace muchísimos años dicha finca, en su condición de fundo dominante, ha venido haciendo uso normal de la servidumbre de paso, incluso con el correspondiente permiso que les otorgó, también desde hace muchísimo años, el padre de ellos señor [Nombre13] , lo que ha quedado plenamente demostrado con la prueba aquí evacuada- Manifiesta finalmente que la sentencia de primera instancia no entró a analizar la situación jurídica ya existente, que es decir, que la servidumbre de paso aquí en conflicto no solamente existía por simple convenio de tipo familiar, sino que además ya registral y catastralmente existía. Por todo lo anterior solicitan la revocatoria de la sentencia. y su acoja su demanda. *

IV.Con el propósito de resolver el presente asunto es importante hacer un recuento de la regulación jurídica y la jurisprudencia desarrollada sobre el instituto de las servidumbres agrarias. Es en nuestro Código Civil donde encontramos la normativa general sobre servidumbres, la cual es bastante antigua, como es el mismo código. Por vía de legislación especial, como la Ley de Aguas o el Código de Minería, se han incorporado aspectos puntuales sobre el tema de servidumbres. Es en la jurisprudencia Patria, de la Sala Primera de la Corte y del Tribunal Agrario, donde encontramos un desarrollo más moderno de éste instituto y de sus distintos aspectos. La servidumbre es motivo de abundantes pronunciamientos de parte de nuestros tribunales de Justicia, lo que nos indica, se trata de un instituto muy vigente para la regulación de los derechos reales, la convivencia social y el régimen productivo del país.

La servidumbre es desde el punto de vista conceptual un derecho real sobre cosa ajena, que ha surgido para garantizar la función social y económica de los inmuebles que la requieren. La doctrina que inspira la legislación existente, la ve como una una carga impuesta a un inmueble, que debe admitirse por esos fines económicos y sociales. Los pronunciamientos jurisprudenciales sobre el tema de las servidumbres son reiterativos en la enunciación de los principios que las informan. Así se establece el principio de que todos los inmuebles se presumen libres ( artículo 376 ). Igualmente que las servidumbres se imponen a favor de un fundo o cargo de él y son inseparables de él ( artículos 370, 371 ). Ello signfica que en caso de división del inmueble, la servidumbre se mantiene en los fundos divididos en la proporción que le corresponda e independientemente de quien sea su propietario. ( artículo* 372).

Las servidumbres se clasifican de varias maneras. Así se habla de servidumbres voluntarias y forzosas. En cuanto a las primeras, cuando son continuas y aparentes a la vez, pueden constituirse por convenio, por última voluntad o por simple uso del uno y paciencia del otro. Las servidumbres discontinuas de toda clase y las continuas no aparentes, sólo pueden constituirse por convenio o por última voluntad. La posesión, aun la inmemorial, no basta para establecerlas. Las forzozas no se encuentran reguladas dentro del capítulo respectivo, sino fuera de él, el artículo 395 las establece , cuando se trata de bienes que son fundos* encalavados o sin salida suficiente -se dice en la doctrina que son servidumbres legales- . Su régimen implica el reconocimiento de un pago por parte de quien la requiere a favor del predio sirviente. En cuanto al régimen de extinción de las servidumbres, está contemplado en el artículo 381.

Las servidumbres se extinguen:1.-Por la resolución del derecho del que ha constituido la servidumbre 2.- Por la llegada del día o el cumplimiento de la condici* ón, si fue constituida por determinado tiempo o bajo condición 3. - Por la confusión, o sea la reunión perfecta e irrevocable de ambos predios en manos de un solo dueño. 4.- Por remisión o renuncia del dueño del predio dominante. 5.- Por el no uso durante el tiempo necesario para prescribir. 6.- Por venir los predios a tal estado que no puede usarse de la servidumbre; pero ésta revivirá desde que deje de existir la imposibilidad, con tal que esto suceda antes de vencerse el término de la prescripci* ón. La definición de lo que son servidumbres aparentes o no aparentes y continuas o discontinuas, es de carácter doctrinario, no legal . En el Derecho romano histórico las servidumbres originarias más conocidas eran iter, actus, via, aqueductus.

Actualmente otras servidumbres, se han hecho necesarias y han cobrado relevancia, sin que se demeriten las anteriores, como las servidumbres de vista, o las llamadas ecológicas. En el caso que nos ocupa estamos ante un reclamo que la parte actora denomina reivindicación y restitución de la posesión y constitución de una servidumbre de paso en todos sus extremos, por haber operado sobradamente y a favor de su fundo dominante la prescripción positiva del uso de la servidumbre de paso que pesa sobre el fundo sirviente propiedad del aquí demandado. En el desarrollo del proceso ha señalado también, que ha existido un convenio que viene desde el papá de los demandados, quien les dio paso a todos sus hijos, lo que también es el núcleo central de su argumentación en la apelación del fallo de primera instancia. En relación con estos tres temas, existe importantes debates en la doctrina y en la jurisprudencia. *

1. Regímen de adquisición de las servidumbres. Continuidad o discontinuidad de la servidumbre de paso. En primer lugar tenemos el debate sobre la adquisición de las servidumbres, especialmente el caso de las servidumbres aparentes y discontinuas. Al respecto el Código Civil establece en su artículo 379 lo siguiente: Las servidumbres discontinuas de toda clase y las continuas no aparentes, sólo pueden constituirse por convenio o por última voluntad. La posesión, aun la inmemorial, no basta para establecerlas. De conformidad con esa norma entonces, el hecho de la posesión no es constitutivo por si mismo de la servidumbre. Las normas del Código Civil no establecen cuáles son servidumbres discontinuas, pero es criterio dominante en la doctrina que las servidumbres de paso son discontinuas. Con ese criterio, se ha negado la posibilidad de usucapir la servidumbre de paso por la única demostración de posesión .

El autor español , José Manuel Busto Lago, hace un análisis hasta los orígenes romanos de esa tradición, develando el origen de esa imposibilidad y criticando tal criterio. Al respecto es importante citar algunos comentarios de su análisis: " Ha sido precisamente en relación con la adquisición de las servidumbres por usucapión en donde encuentra históricamente su origen y su razón de ser la distincion entre servidumbre continuas y discontinuas. La Ley Scribonia del último siglo de la República ( fecha entre los años 60 y 50 A.C.) excluyó la posibilidad de usucapión, admitida en el antiguo ius* civile, respecto de las cuatro servidumbres ( rústicas) originarias entonces existentes ( iter, actus,via, aquaeductus) por considerar que como res incorporales no eran susceptibles de posesi* ón y en consecuencia, tampoco de usucapi* ón. A esta razón se sumaba el concepto clásico de posesión que, como soberanía de hecho absoluta e ilimitada sobre la cosa, resultaba inconciliable con el señorío parcial sobre una cosa ajena intrínseco a cualquier servidumbre.

En el Derecho Justinianeo desaparece este concepto absoluto de posesión, abriéndose paso la necesidad de tutelar las situaciones de hecho, incluso aquellas relativas a las res incorporales y entre éstas las servidumbres prediales. Es así como se admite la posibilidad de la adquisici* ón de las servidumbres a través de una longa possessio o diuturnus* usus. Ante este régimen que se presenta como contradictorio en la perspectiva histórica y diacrónica y que se refleja en el contraste existente en las diversas leyes recogidas en el Corpus Iuris* Civilis que aluden, de forma más o menos directa, a la posibilidad de adquirir por usucapión las servidumbres, los glosadores y los comentaristas se preguntaron si las servidumbres eran o no susceptibles de usucapión y, sin darse cuenta de que las contradicciones que encontraban en los textos del Derecho romano recibido eran fruto de una mera evolución histórica en la regulación de la instituciòn y que, en consecuencia, precisaban de una simple explicación exegética conciliadora de los distintos textos que aludían a la posesi* ón y la adquisici* ón de las servidumbres.

Para dar respuesta a la posesibilidad de adquirir por usucapión las servidumbres invocaban la Ley del Digesto en la que se excluye esta posibilidad respecto a las servidumbres rústicas, puesto que " non habeant* certam* continuamque* poseessionem,:* nemo* enim* tam perpetuo, tan continenter* ire* potest* ut, nullo* momernto* posessio* eius* interpellari* videatur ( D.8.1, 14 princ". De esta forma se justifica la exclusi* ón de la usucapión de las servidumbres rústicas, en la inteligencia de que no son susceptibles de posesión continua al considerar imposible que se pase de forma ininterrumpida a través del fundo ajeno. Sin embargo, el texto del Digesto citado no autoriza distinción alguna entre servidumbres rústicas y urbanas a efectos de la usucapión, en tanto en cuanto, admite expresamente el mismo régimen siguen las servidumbres urbanas " idem et in servituibus* praediorum* urbanorum* observatur " D.8,1,14 in fine.

La afirmación conforme a la cual no es posible la posesión continua de las servidumbres rústicas es errónea, puesto que para que la posesión pueda reputarse continua no es necesario que el poseedor esté continuamente ejercitando el derecho sobre la cosa ( en el ejemplo anterior, no es necesario que el poseedor pase ininterrumpidamente a través del predio ajeno ), sino que es suficiente que los actos de ejercicio de la posesión se realicen siempre que sea necesario de acuerdo con la naturaleza del derecho poseído y el destino de la cosa ( el resaltado es nuestro ) ( v.g, la servidumbre de paso se poseerá de un modo que puede calificarse como continuo siempre que se realice el paso tantas veces como sea necesario de acuerdo con el destino objetivo del fundo dominante. En otras palabras la intermitencia de los actos a través de los cuales se ejercita la posesión, realizándolo cuando sea necesario de acuerdo con la naturaleza misma del derecho poseído no impide que la posesión tenga carácter continuo, de forma que no hay contradicción alguna en admitir la posesión continua de una servidumbre discontinua.

" ( Busto Lago José Manuel, " La Usucapi* ón de la titularidad de la servidumbre predial de paso " Editorial Edersa, 2000, Madrid ). Esta integraci* ón del Tribunal suscribe el criterio del ilustre profesor español, pues estima que la apreciaci* ón de la servidumbre de paso como, discontinua y por tanto no susceptible de usucapión por posesión , no es congruente, en primer término con la moderna doctrina constitucional de la función social de la propiedad, derivada del artículo 45 constitucional, que admitió las limitaciones por interés social del derecho de propiedad, y remitió a la legislación ordinaria, con votación calificada, el desarrollo de las mismas. La función social es luego ampliamente desarrollada en nuestro ordenamiento, en leyes que establecían limitaciones a la propiedad, como la Ley de Tierras y Colonización ( No. 2825 de octubre de 1961 ), en sus artículos 141 a 144, más tarde en las leyes forestales, cuya más moderna versión es la No. 7575 de 1996, y la Ley de Biodiversidad, que incorporó la función ambiental a dicha función económica y social y que expresamente en su artículo 8 dispone lo siguiente: Función ambiental de la propiedad inmueble:* Como parte de la función económica y social, las propiedades inmuebles deben cumplir con una función ambiental ." Es indudable, que como parte de la función social y económica de la propiedad, se encuentra la limitación de otorgarse derechos de paso entre predios vecinos, que es parte de la paz social del país y requisito indispensable de la producción en nuestras zonas agrarias.

La actualización de la servidumbre desde el punto de vista constitucional, exige que revisemos ese criterio puramente doctrinario, de concebir la servidumbre de paso como discontinua y con ello negar la usucapión de la posesión de la servidumbre, pues aplicando las reglas de la lógica en el caso de las servidumbres agrarias, lo que sucede es que el uso del paso, se dará en función de las necesidades del cultivo, para extraer cosechas, llevar insumos, materiales o mano de obra al trabajo. Un uso reiterado de esas actividades, supondrían la existencia de una convenio tácito entre las partes, salvo que de la casuística del caso que demostrada la mera tolerancia, la cual se reviste de otras características, como son un acto unilateral, y probablemente un tiempo menor de uso, sumado a la ausencia de otros factores, como confianza o familiaridad entre las partes. II El concepto de convenio en la legislación, la costumbre como fuente de derecho en las servidumbres agrarias de paso y los requisitos de la posesión.

Independientemente de lo expresado en el análisis anterior, la normativa nacional, si reconoce como medio de adquisici* ón de una servidumbre discontinua y aparente, el convenio, tanto en el caso de servidumbres continuas y aparentes como discontinuas ( artículos 378,379 del Código Civil. En cuanto a la acepción de convenio, éste es definido por el célebre jurista Guillermo Cabanellas como: " el concierto de voluntades, expresado en convención, pacto, contrato tratado o ajuste. Sinónimo de cualquiera de estos vocablos que implican acuerdo, por la elasticidad y uso generalizado que a convenio se le da; no obstante las diferenciaciones técnicas que en cada remisión se concretan..." ( Cabanellas Guillermo Diccionario Enciclopédico de Derecho Usual, Tomo 2, Editorial Heliasta. Argentina ,* pag. 365 ). Como bien lo dice don GuillermoCabanellas el convenio es un instituto elástico, donde lo fundamental es que se exprese el consentimiento, lo que él llama concierto de voluntades.En la realidad rural costarricense el convenio es una fuente importantísima de Derecho, normalmente expresado - por costumbre - en forma verbal.

Es importante al respecto diferenciar el acto tolerado al convenio. La tolerancia es típicamente un acto unilateral que expresa una intención de quien otorga la tolerancia, de permitir una conducta o ciertos actos, sujetos a la condici* ón de que en cualquier momento puede ser revocada, sin reclamo alguno de quien es beneficiario de la misma. En el convenio aunque sea verbal, hay una expresion* clara de consentimiento de las partes. Será un aspecto de prueba la demostración de ese consentimiento. Evidentemente, si bien la normativa señala que la posesión, aún la inmemorial, no basta para constituir servidumbres que llama discontinuas y aparentes, como la de paso, es jurídicamente correcto afirmar que en la valoración probatoria de un convenio tácito, la existencia de una posesión pacífica, pública, ininterrumpida a título de dueño, de un paso, constituye un elemento probatorio de gran importancia.

No, aceptar lo anterior, sería hacer nugatorio, el instituto de la posesión, tan prolijamente regulado en nuestro oredenamiento jurídico. Los requisitos que se le impone al derecho de posesión, para ser reconocido como tal, son los contemplados en el artículo 856 del Código Civil, a saber: la calidad de propietario en forma continua, pública y pacífica. En el caso de un paso, esos requisitos, harían necesario que quien use el paso se considere dueño del derecho al mismo , el que sea un uso continuo, sin que ello signifique un ejercicio permamente del paso, pues ello sería contrario a la lógica, - como ya dijimos antes - ; lo que en realidad sería exigido sería un uso constante, a contrario sensu , de lo que la misma ley establece, como pérdida por no uso y luego que sea pública y pacífica. En Derecho Agrario la continuidad se agrava en el sentido del destino productivo de la servidumbre, por cuanto su función económica social, obliga a que sea de utilidad para el desarrollo de la actividad agraria.

Hay que recordar finalmente que nuestro derecho adhiere el sistema de transmisión de bienes por nudo consenso, no existiendo la obligación de que la servidumbre se encuentre inscrita para que opere de pleno derecho entre las partes que la han convenido por convenio tácito. ( artículo 480 del Código Civil ). La obligaci* ón de inscripción es para efectos de terceros y es importante cuando éstos adquieren derechos sobre los inmuebles, sobre todo por fraccionamiento. En el presente caso, la servidumbre ha funcionado como un derecho entre familiares, se trata de una finca que en su origen fue un solo inmueble, y que luego se repartió entre los diferentes hijos y sus cónyuges. El callejón de acceso es el típico derecho de paso que se establece en las fincas de café para comunicar las diferentes secciones de la finca. Actualmente dicho inmueble pertenece a diferentes personas, pero el callejón continúa teniendo la función económica y social de servir como entrada y salida para la producción de café.

III. La intrerpretación evolutiva y sistemática del titulo preliminar del Código Civil. Si a nivel constitucional existe una actualizacion del derecho de propiedad, que corresponde con el desarrollo del estado social de Derecho, que instituye nuestra Constitución Polìtica* de 1949, a nivel legal los institutos propios del Derecho privado, como las servidumbres se remozan, con la incorporación del título preliminar del Código Civil que obliga a una interpretación normativa en relación con el contexto, los antecedentes históricos y legislativos y la realidad social del tiempo en que han de ser aplicadas, atendiendo fundamentalmente al espíritu y finalidad de ellas ( artículo 10 del Código Civil ). Igualmente el artículo 11 establece que la equidad habrá de ponderarse en la aplicaci* ón de las normas. En el caso de los procesos agrarios existe norma expresa en la Ley de Jurisdicción Agraria, el artículo 54, que obliga a la persona juzgadora a fundar su sentencia en la equidad o el derecho, debidamente fundamentados.

Los criterios de interpretación de las normas nos obligan por tanto, en el caso de las servidumbres a aplicar las normas bajo criterios evolutivos, y ajustándolos a la equidad, que no es otra cosa que la justicia aplicada al caso concreto. IV. La servidumbre " por destino de padre de familia " : Esta servidumbre deviene del artículo 380 del Código Civil, que en lo de interés establece: " La existencia de un signo aparente de servidumbre continua entre dos predios, establecido por el propietario de ambos, basta para que la servidumbre continúe activa o pasivamente, a no ser que al tiempo de separarse la propiedad de los predios, se exprese lo contrario en el título de enajenación de cualquier de ellos. " En este tipo de servidumbre lo determinante es que el fundo que se divide pertenece al mismo propietario. Obsérvese que la norma habla de " signo aparente de servidumbre ", no se refiere en ningún modo al tema de continuidad o discontinuidad de ese signo.

Entenderíamos la apariencia de la servidumbre como la remisión a la existencia de signos externos que califiquen el uso de esa servidumbre según el destino de los inmuebles y el cumplimiento de la función económica y social. La norma no hace una exclusión de las servidumbre de paso, al contrario pareciera haber sido pensada, para esos esos casos. En la servidumbre de paso, la apariencia, tendría que tener que ver con la existencia del camino o sendero en condiciones suficientes para servir al destino de fundos* agrarios, que originalmente pudo exigir el traslado de productos agrarios, a pie , a caballo o carreta y que en la época actual va a exigir el paso de maquinaria, o vehículos, En cuanto a la continuidad, la entendemos como la propia de la posesi* ón, que es la explicada anteriormente, como proveniente de la doctrina del artículo 859 del Código Civil, es decir aquella es pública, ininterrumpida, y a título de dueño, para el desarrollo de la actividad agraria.

V. La jurisprudencia del Tribunal Agrario sobre el tema: a mayor abundamiento el Tribunal Agrario se ha pronunciado sobre estos temas de la siguiente forma: VI.- Este Tribunal, desde hace más de diez años, explicó en una resolución las diferentes formas de dar solución a un caso como el presente, al respecto señaló: "...Uno de los aspectos esenciales en relación con las servidumbres, es lo relacionado a su contenido y a su modo de constitución, siendo este tema esencial para la resolución del fondo de este asunto. Cuando un fundo, quede en una situaci* ón de enclave, y por ende no tenga salida o salida bastante a calle pública, el ordenamiento jurídico ha configurado varias soluciones posibles, dependiendo de las situaciones fácticas, por las cuales se originó el enclave. La primera solución posible en relación a un predio enclavado, es que la salida suficiente a calle se le otorgue por medio de la constitución de una servidumbre, voluntaria.

Sobre las servidumbres voluntarias, [Nombre16] * señala: "Las servidumbres se establecen: 1. Por voluntad de los interesados, mediante negocio jurídico mortis causa o intervivos (...) Para constituirlas es preciso tener capacidad para disponer por el acto de que se trate del bien sobre el que se establecen, y que correspondan al constituyente las facultades que la servidumbre que sea otorgada sobre la cosa gravada. Por eso es indudable que puede constituirlo el dueño pleno(o si aquella es de varios, obrando todos por unanimidad); en cuanto al propietario nudo o con dominio limitado por algún otro derecho (así, por servidumbre anterior existente sobre la cosa, o si, de cualquier modo los deja a salvo, y en cuanto a quién, sin ser propietario, tiene sobre la cosa un derecho que le atribuye las facultades que la servidumbre conferirá al dueño dominante, puede también constituir ésta (como las mismas sortapisas señaladas antes para el dueño con dominio limitado) para el tiempo que dure su derecho".

Esta posibilidad de constituir servidumbre por voluntad, ya sea mortis causa o intervivos, se encuentra regulada en el Código Civil, en la relación de los artículos 378 y 379, por cuanto el primero señala: "Las servidumbres que son continuas y aparentes a la vez, pueden constituirse por convenio, por última voluntad o por el simple uso del uno y paciencia del otro", y en el segundo artículo indica: "Las servidumbres discontinuas de toda clase y las continuas no aparentes, solo pueden constituirse por convenio o por última voluntad. La posesión aún la inmemorial, no basta para establecerlas." Otro de los modos por los cuales se puede dar solución al problema del fundo enclavado, es el supuesto indicado en el artículo 380 del Código Civil el cual señala: "La existencia de un signo aparente de servidumbre continúa entre dos predios, establecido por el propietario de ambos, basta para que la servidumbre continúe activa o pasivamente, a no ser que al tiempo de separarse la propiedad de los dos predios, se exprese lo contrario en el título de la enajenaci* ón de cualquiera de ellos".

Esta figura es la denominada servidumbre por "destino de padre de familia" que "consiste en que si existe un signo aparente de servidumbre entre dos fincas establecido por el propietario de ambas, se considerar á, si se enajenare una, como título para que la servidumbre surja" ([Nombre16]*, Manuel. Derecho Civil, Tomo III, Vol. II, Editorial Bosch, 8a. edición, 1994, pág. 141). En consecuencia, al existir una servidumbre, es evidente que el actor tiene derecho a hacer uso de las facultades que la Ley le confiere para su ejercicio. En efecto, el artículo 374 del Código Civil dispone: "El que tiene derecho a una servidumbre, lo tiene igualmente a los medios necesarios para ejercerla, y puede hacer todas las obras indispensables para ese objeto, pero a su costa, si no se ha estipulado lo contrario...". La servidumbre por destino de padre de familia, debe cumplir una serie de requisitos, que de buena forma expone [Nombre16] citando a [Nombre17] , en lo que interesa: "La creación de la servidumbre se produce ex lege (...) por la concurrencia de los requisitos que la ley marca con independencia, pues, de que los signos de la misma no se hayan suprimido por inadvertencia o para que, mantenidos, surgiere aquella; y los mismo que diga que si es que la escritura no contenía declaración contra la servidumbre.

El signo debe ser viable (...) no importa que la servidumbre que se crea sea precisa. (...) el signo aparente de servidumbre dice la ley que haya sido "establecido por el propietario de ambas" (....) Pero el término "establecer" no debe interpretarse estrechamente, así que entendemos vale también el signo puesto por otro, y conservado por el propietario. Lo que importa es que exista al producirse la enajenaci* ón de la finca. (...) La servidumbre no surge si al tiempo de separarse la propiedad de las dos fincas se expresa lo contrario en el título de enajenación de cualquiera de ellas (...) De donde se sigue que si se enajena sólo será en el título de enajenación de ésta donde deberá hacerse constar la voluntad contraria, y si se enajenan las dos simult* áneamente, podrá hacerse constar en el de cualquiera de ellas. (...) Por título se entiende la escritura correspondiente." ([Nombre16], Manuel, Derecho Civil, Tomo III, Vol. II, Editorial Bosch, 8ª. edición, 1994, pág.141-143).

Es claro que bajo este supuesto no corresponde la indemnización, por cuanto la servidumbre existía y ha sido utilizada para dichos efectos desde que se originó el fundo que quedó teóricamente enclavado, pero que en la realidad tenía salida constituida por el antiguo dueño. De aquí que se derive la consecuencia * de la no indemnización pues la salida fue adquirida de pleno derecho sea ipso* iure, sin necesidad de declaratoria judicial. La tercera posibilidad para darle salida al fundo enclavado, es la servidumbre constituida de forma forzosa, el Código Civil al respecto señala en su artículo 395: "El propietario de un predio enclavado entre otros fundos, sin salida o sin salida bastante a la vía pública, tiene derecho de exigir paso por los predios vecinos para la explotación del suyo, pagando el valor del terreno necesario y de todo otro perjuicio". sobre este tipo de servidumbre forzosa [Nombre16] señala: "Por disposición de la autoridad (judicial o administrativa) es decir, por adjudicación que ésta decreta a favor del titular.

Lo que ocurre en el caso de las prediales forzosas (...) cuando pedida su constitución por quien tiene derecho a la misma, es otorgada por la autoridad competente" ([Nombre16]*, Manuel, Derecho Civil, tomo III, Vol. II, Editorial Bosch, 8a. edición, 1994, pág. 141-143). Esta forma de constitución, tiene como particularidad el hecho de que se constituye por medio de declaratoria judicial y debe indemnizarse el valor del terreno necesario y todo otro perjuicio. Finalmente, el problema de un predio enclavado, puede ser solucionado por medio del instituto del derecho de paso regulado en el artículo 400 del Código Civil, el cual indica: "Si se vende o permuta alguna parte de un predio, o si se adjudica cualquiera de los que lo poseían en común, y esa parte queda enclavada, se considerará concedido a su favor el derecho de paso sin indemnizaci* ón alguna". Este artículo presenta la particularidad de que el fundo queda enclavado a raíz de un acto dispositivo del titular del predio, de modo tal de que transmite parte del inmueble dejando una de las partes enclavada, en consecuencia por razones de interés social y económica de que todo el fundo tenga salida a calle, se entiende que todo fundo tenga salida a calle, se entiende que de pleno derecho el sujeto tenga derecho de paso, para así tener salida a calle, sin que se le pueda obligar a pagar indemnización alguna por ello.

En síntesis, de las anteriores argumentaciones se han podido establecer cuatro diversas soluciones frente a un problema de fundo enclavado..." (Tribunal Agrario, No. 635 de las 13:45 horas del 24 de setiembre de 1999, lo subrayado no es del original.).Además, en un caso similar al que ahora nos ocupa, el Tribunal Agrario, en el Voto No. 113-F-13 del 27 de febrero del 2009, también se ha señalado lo siguiente: *

IX.Nuestro Código Civil, en su artículo 380 dispuso lo siguiente: "La existencia de un signo aparente de servidumbre continua entre dos predios, establecido por el propietario de ambos, basta para que la servidumbre continúe activa o pasivamente, a no ser que al tiempo de separarse la propiedad de los predios, se exprese lo contrario en el título de la enajenación de cualquiera de ellos". Como en el código francés, dicha norma está ubicada con posterioridad a los artículos 378 y 379 del Código que regula la constitución de las servidumbres continuas y aparentes, así como las discontinuas y las continuas no aparentes, como reglas generales. En consecuencia la regulación del 380 es una excepción a las reglas anteriores. Del contenido literal de dicha disposición se desprende los siguientes requisitos: 1.- La existencia de un signo aparente de servidumbre entre dos predios. 2.- Que dichos predios pertenezcan al mismo propietario. 3.- Que ese signo aparente continúe activa o pasivamente. 4.- Que no exista una disposici* ón en contrario al momento de la enajenación de cualquiera de ellos.

Si se lee la expresión inicial completa donde habla de: "La existencia de un signo aparente de servidumbre continua entre dos predios...", de acuerdo a su formaci* ón* histórica, debe interpretarse en el sentido de que ese signo aparente es continuo, antes y despu* és de la enajenaci* ón del predio. Es decir, que hay voluntad de mantenerlo, pues una de las formas de extinguirlo es eliminando el signo aparente existente, o bien, estableciendo expresamente en la escritura su desaparición. Esta interpretación debe ser la correcta, y así debe aplicarse para el caso en donde el signo aparente está referido a una servidumbre de paso. En efecto, la doctrina italiana, refiriéndose a sus orígenes vincula esta servidumbre, evocando las virtudes del campesino romano "sui iuris", que puesto a la cabeza de una hacienda rural, organiza y dirige las fuerzas de la naturaleza ([Nombre18], [Nombre19] famiglia, [Nombre20].

DI, II, 1958, 597, citado por [Nombre21] y otros, op. cit., página 263). Por lo que resulta admisible la constitución de este tipo de servidumbres por destino de padre de familia para las servidumbres de paso, como discontinuas y aparentes que son. Así lo ha reconocido la jurisprudencia de la Sala Primera de Casación de la Corte Suprema de Justicia en la sentencia No. 380-F-00 de las 16:45 minutos del 19 de mayo del 2000, en la cual se señaló a propósito de un caso concreto, similar al que nos ocupa, lo siguiente: "V.- Tocante al primer aspecto, el cual desemboca en la aplicaci* ón o no del artículo 380 del Código Civil y el deber de indemnizar, en caso de estarse ante la constitución de una servidumbre forzosa de paso, es menester apuntar lo siguiente. Dicha norma preceptúa: “La existencia de un signo aparente de servidumbre continua entre dos predios, establecido por el propietario de ambos, basta para que la servidumbre continúe activa o pasivamente, a no ser que al tiempo de separarse la propiedad de los dos predios, se exprese lo contrario en el título de la enajenación de cualquiera de ellos.” (Lo resaltado no es del original).

De conformidad con el tenor literal de ese artículo, uno de los requisitos indispensables para la procedencia de esta modalidad de constituci* ón de servidumbre, es que los dos fundos pertenezcan a un solo propietario. De conformidad con la sustanciación, y las certificaciones aportadas con el recurso, se coincide con el casacionista cuando echa de menos tal requisito en el sub-júdice...Por otro lado, considera esta Sala, es cuestionable la existencia de signos aparentes de servidumbre al momento de hacerse la parcelación de tierras...Sea dicho trazo de líneas continuas que denotan la existencia de la servidumbre, no pasa por ese inmueble.... Por último, conforme lo ha resuelto reiteradamente esta Sala, la indemnización del valor del terreno y cualquier otro perjuicio, es un elemento inherente a la servidumbre forzosa. En relación, pueden consultarse, entre muchas otras, las sentencias números 80 de las 14:30 hrs. del 19 de julio de 1995; 17 de las 14:30 hrs. del 20 de enero; y, 129 de las 14:10 hrs. del 26 de marzo, ambas de 1999.

Nuestro ordenamiento jurídico, al igual que otros, como el argentino, italiano y español, presenta una excepción a esa regla. Esta es, cuando el enclavamiento del fundo es producto de un negocio jurídico. En tales casos, se deberá constituir la servidumbre a favor del predio que en virtud del negocio haya quedado enclavado, sin indemnización alguna. Así lo dispone el artículo 400 del Código Civil. En la especie, según lo apuntado anteriormente, éste no es el caso, pues los fundos no pertenecieron nunca al mismo propietario. Corolario de lo expuesto, en el sub-júdice no se está ante una servidumbre por destino de padre de familia, sino de una forzosa de paso, por tratarse de un fundo enclavado. Bastan las razones de hecho y de derecho expuestas para arribar a la conclusión dicha. Por ende, resulta innecesario reparar en otras alegaciones esgrimidas con esa finalidad. Además, al no configurarse el supuesto de excepción regulado en el Código Civil, procede reconocer, a favor de todos los propietarios demandados, cuyas fincas se verán afectadas por ese gravamen, el pago de la indemnización del valor del terreno necesario para constituirlo, así como de todo otro perjuicio (artículos 395 y 400 ibídem)."(hasta aquí la cita, lo subrayado no es del original).

De dicha resolución se desprende, que la jurisprudencia patria acepta la constitución de una servidumbre de paso, por destino de padre de familia, cuando se cumplan ineludiblemente con dos requisitos, a saber, 1) que los inmuebles pertenecían a un mismo propietario;* y, 2) El trazo de líneas continuas, como signos aparentes que denoten la existencia de la servidumbre. A esa misma conclusión llega parte de nuestra doctrina al señalar: "La servidumbre por destino del padre de familia, no continúa, sino que "se constituye" al enajenar uno de los predios afectados por esa situación. Igual impropiedad tiene el artículo 531 del Código civil de España. Se ha establecido que la expresión "dos predios" se puede aplicar al caso de que el propietario de un solo predio haya constituido gravamen sobre una de sus porciones en provecho de otra, antes de su división..."([Nombre22] , (comentarios), en: [Nombre23] , Alberto, Tratado de los Bienes, Juricentro, 1981, p. 112).

Otra autora subraya lo siguiente. "Si revisamos nuestra legislaci* ón, vemos que el artículo 380, reza que la servidumbre continuará al hacerse la división del fundo, o a trasmitirse uno de los fundos del propietario originario, a otro titular; en realidad lo que sucede es una transformación de un simple servicio entre partes o fundos de un mismo titular, porque opera el principio "nemini* sua* servit" ya visto. Es importante tomar en cuenta que en esta situación, ya existía el servicio y éste continúa con la segregación del fundo, o con la transmisión de propiedad de un fundo a otro titular" ([Nombre24] , Roxana. Estudio de la Jurisprudencia judicial y administrativa respecto de las servidumbres. Universidad de Costa Rica, 1985, p. 98). Pese a lo anterior, existen aún quienes sostienen la aplicación restrictiva del instituto, solo para casos de servidumbres continuas y aparentes (BRENES CORDOBA, op. cit., p. 112, CHINCHILLA, José.

Precisiones conceptuales sobre la regulación de la servidumbre por destino del padre de familia. En. Revista Jurídica Vox* Iuris, UIA, Año 2, No. 1, 2005, p. 16-19). Sin embargo, dicha interpretación, no va acorde con la necesidad económica y social, de los bienes agrarios productivos, como se verá a continuación. X.- La jurisprudencia agraria de la Sala Primera de Casación, de la Corte Suprema de Justicia, ha establecido la vinculación que tienen las servidumbres agrarias con el destino productivo de los fundos, la empresa agraria, y el destino que le da a los fundos productivos el buen padre de familia. Al respecto se indicó: "Un elemento fundamental, dentro de la estructura de la empresa agraria, es su organización. En ella participan bienes no solo materiales sino también inmateriales (instrumenta fundi). Los derechos adquiridos por el titular del fundo (iura* fundi), como consecuencia del ejercicio de la agricultura y en vista a su necesidad o utilidad a los fines de la producción agraria, constituyen un valioso instrumento en su estructura organizativa.

Normalmente los "iura* fundi" se identifican con las servidumbres prediales del Derecho romano, más antiguamente calificadas como res mancipi. Son los llamados "derechos" del fundo y forman parte de la hacienda agraria vista como fundo-organización. La "exigencia de agua" de un fundo para las necesidades de cultivo o de acceso sobre la vía pública, para las comunicaciones a su exterior, crean derechos a favor del fundo enclavado. La utilidad de un fundo es utilizada por otro fundo. pero estos derechos no siempre coinciden con los derechos de servidumbre predial disciplinados por el Código Civil. Las servidumbres típicas del Derecho romano (iter, via, actus,aquae* ductus) eran, como se ha dicho, configuradas como res mancipi. Unidas a los exclavos, al ganado, a las instalaciones y a los aperos de labranza formaban los instrumentum* fundi, es decir la organización haciendal. Esta construcción era posible por cuanto la servidumbre se concebía como un ius* fundi, el cual se realizaba a través de un dominio material (mancipium) sobre las partes del fundo sirviente destinadas a la mejor utilización del fundo dominante.

Esta antigua concepción de la servidumbre agraria estaba ligada a la concepción publicística de la propiedad rústica como dominio soberano y fue superada en el ámbito de la nueva concepción privatista de la propiedad romana. En el derecho moderno la servidumbre no puede ser concebida como pertenencia. Algunos de sus elementos característicos, como el de destinación, todavía permanecen y asumen aspectos relevantes. En el acto de constitución de la servidumbre existe la intención, de parte del titular dominante, de destinarla a la organización de su fundo, logrando una utilidad económica del otro fundo. El destino de "buen padre de familia" es esencial para explicar la función económico-social en la constitución de la servidumbre. Esta función se liga a una elección completa del titular del fundo dominante quien ha querido obtener alguna utilidad de otro fundo para poderlo destinar al servicio propio." (No. 80 de las 14:30 horas del 19 de julio de 1995).*

V.Realizadas estas valoraciones jurídicas corresponde analizar el cuadro fáctico y apreciar con los criterios de equidad y/o derecho que exige la normativa ius agraria, la prueba ( artículo 54 de la Ley de Jurisdicción Agraria). En el presente asunto, se encuentra probado la actora, es propietaria de una finca inscrita en el Registro Público matrícula de folio real [Placa2] del Partido de Alajuela. ( hecho probado 1 ) Esa propiedad la adquirió por donación de la nuda propiedad, por parte de su compñero [Nombre2] , mediante escritura número ciento treinta y nueve de las 9:30 hrs del 9 de marzo del 2005 ( escritura de folio 61). Don [Nombre2] , a su vez la había adquirido también por donación de la nuda propiedad de [Nombre8] , mediante escritura de las nueve horas del 31 de agosto del 2004. ( 61). Existe constancia en el expediente de que don [Nombre2] falleció el 16 de agosto del 2008. ( folio 129 ).

Desde hace mucho años, más de veinte, ha existido para el terreno de la actora, el uso del paso por terrenos de los ahora demandados. La razón ha sido, por una parte la situación de dificultad topográfica del terreno originalmente de doña [Nombre8] y ahora de la actora, como se ha demostrado con los reconocimientos judiciales y la prueba testimonial. En efecto, a folio 38, consta el reconocimiento judicial donde se indica lo siguiente: " Se observa que el terreno - con excepción - de donde está la casa y la bodega - el resto es muy quebrado en declive hacia el norte y oeste y en el reconocimiento judicial no se observa que exista un acceso de la parte norte de la finca de la actora hacia la [Dirección2] , esto porque nos dice la actora su terreno es muy quebrado y no permite que pueda sacar sus productos por entre su finca. El terreno de la actora está sembrado con café el cual está en producción...

" (folio 38 ). El testigo [Nombre11] , señala en lo de interés: " Don [Nombre2] no tenía ningún otro medio para ingresar a su finca, el único era el acceso en litigio .." (folio 395). La otra razón ha sido el convenio familiar existente para que doña [Nombre8] y don [Nombre2] usaran la servidumbre de paso existente. Recuérdese que doña [Nombre8] era hermana de don [Nombre13] , padre del demandado [Nombre2] , quien actúa además como representante de la Sociedad Cuatro Eme Limitada. La testigo [Nombre2] hermana de don [Nombre2] , señala al respecto : " Yo conocí a [Nombre2] y don [Nombre2] utilizaba el acceso en litigio, él lo usaba porque mi papá le dio el permiso, nosotros siempre hemos vivido aquí, esto era de mi abuelito tiempo atrás y mi abuelito se lo heredó a mi tía que era la esposa de [Nombre2] ...Mi papá hizo el acceso en litigio y le dio un permiso a [Nombre2] para que pasara, a don [Nombre2] luego se le quitó el permiso porque él era agresivo y alcohólico , aclaro nunca se le negó el permiso ...." Mi papá le dio permiso a [Nombre2] para que pasara por allí y de esto hace como ocho años, aproximadamente.

No recuerdo cuando murió mi tía [Nombre8] la esposa de [Nombre2] . Mi tía y [Nombre2] utilizaban el acceso en litis para jalar el café..." (folio 396). Con el propósito de aclarar algunos aspectos de la demanda, este Tribunal realizó un reconocimiento judicial en el inmueble, en el cual constató que efectivamente la propiedad de la actora no tiene salida suficiente para la producción de café que se genera en su finca, pues el acceso que tiene a vía pública, [Dirección3] , presenta una grave difcultad por el grado de inclinación del terreno en relación con la calle, en algunas partes hasta de cuarenta y cinco grados ( ver hechos probados ). Asimismo constató que el callejón de acceso a la finca de la actora es muy antiguo, con signos aparentes de esa antiguedad, como algunos itabos sembrados a los lados del paso y que incluso se introducen dentro de la finca de la misma y en la misma dirección que el resto del paso.

Ese callejón tiene el propósito de ir comunicando diferentes secciones de la finca, que anteriormente era una unidad, y que ahora aunque mantiene su vocación productiva de café, está en propiedad de diferentes personas físicas o jurídicas. Se señala lo anterior, no para acreditar la existencia de un eventual enclave y ante ello la necesidad de una servidumbre forzoza, pues no es eso lo pedido, sino para comprender por qué de la necesidad del convenio familiar para darle salida a la producción de café de doña [Nombre8] y don [Nombre2]. Ese convenio no es escrito, pero si es evidente de la prueba testimonial recibida. En la prueba confesional de [Nombre9] , uno de los vecinos que tiene a la orilla de su propiedad la servidumbre y es codemandado por esa razón, señala a las preguntas : " Desde que fecha es propietario del inmueble en donde se ubica su casa de habitación? Responde: Hace siete años.

Segunda: Desde que usted adquirió su propiedad en la fecha que indica, ya existía el paso aquí en conflicto ?* Respuesta : Si. Tercera. Conoció a Don [Nombre2] ?. Respuesta: Si. Cuarta: Para la fecha que adquirió su propiedad don [Nombre2] ya hacía uso del paso en conflicto ?* Respuesta : Si. Quinta: Usted conoce a [Nombre1] ? Respuesta: Si, la conozco de vista. Sexta: Usted a (sic) visto a [Nombre1] utilizar el paso en conflicto. Respuesta: Si, yo veo que pasan carros para la finca de ella a dejar abono y a traer el café ..." Por otra parte el testigo [Nombre10] , quien trabaja para [Nombre1] indica " Yo conocí a [Nombre2] , lo conocí desde hace unos veinte años, yo le ayudaba a recolectar café a don [Nombre2]. Yo vivo en Cirrí. Yo del conflicto se que don [Nombre2] siempre ha querido cerrar la entrada, es la entrada que siempre ha utilizado [Nombre2] . Don [Nombre2] tenía de uzar* ( sic ) el camino como veinte años, sacaba el café, el abono la cal, todo lo metía por allí.

Yo siempre estuve ayudándole a él y trabajando para don [Nombre2]. [Nombre2] se preocupaba por el camino, algunas veces traía carretas de lastre para arreglar el camino , yo le ayudaba a extender el lastre por este camino. Yo trabajo para [Nombre1] desde hace cuatro años, mis tareas son riego de ingredientes: cal, abono, recolectar el café, Don [Nombre2] y ahora doña [Nombre1] utilizan el camino y esto porque siempre supe que era una entrada de la finca . [Nombre2] si tuvo problemas por usar el acceso en litigio, incluso una vez don [Nombre2] puso un portón que don [Nombre2] tuvo que quitar, de esto hace como unos quince años. " ( folio 396 ). Finalmente se recibe el testimonio de [Nombre11] , quien declara: " Yo conocí a [Nombre2] cuanto estaba vivo, hace como quince años cuando veníamos a recolectar café a la finca de don [Nombre2], nos traía nuestro papá. Don [Nombre2] transportaba gente de San Jeróimo y se ponen a trabajar en las fincas recolectando el café.

Yo conozco el conflicto, lo que se viene a ver es el derecho de paso de la finca que era de [Nombre2] y ahora de [Nombre1], don [Nombre2] llevaba a la gente a la propiedad de él por ese paso y sacaba el café por allí. El utilizaba el paso para mantenimiento, sacar el café y recolectarlo, yo siempre estuve en la época de recolección. La finca de don [Nombre2] siempre se desarrolló por ese acceso, se tenía varias medidas, son tres, el testigo ubica dichos puntos como (b), (c) y ( d). En el punto ( b) se recolectaba lo del fondo de la propiedad y lo del punto 8 d) lo de la parte superior de la finca, El café de los puntos (b) y (c) se sacaban por el camino y el café del punto (d) se sacaba por la calle pública. Todo del croquis que corre a folio 37..." . Finalmente el Tribunal tiene a la vista como prueba documental a folios 76, 77, la declaración de don [Nombre2] donde denuncia * a [Nombre2] , y en esa denuncia indica lo siguiente: " Los hechos se dieron el ocho de enero del año en curso, en horas de la tarde, en la servidumbre que está a unos doscientos metros de mi casa, la cual es privada de nuestra familia, sin embargo le hemos permitido a él por muchos años que pase por nuestra servidumbre, pero el día y hora antes dicha, esta servidumbre que tiene un portón con candado y las cadenas, quebró un poste, daño que valoro en la suma de cien mil colones.

Lo que solicito es que el demandado no vuelva a entrar más a la servidumbre y mucho menos a ocasionar daños .* " ( folio 77) . De toda la prueba recibida es claro para el Tribunal que tanto don [Nombre2] , como doña [Nombre1], han hecho uso de la servidumbre, durante muchos años aproximadamente veinte años según los testigos. El reconocimiento de ese hecho es expreso incluso por el demandado [Nombre2] . También valora el Tribunal que el paso otorgado no es un acto tolerado o de mera tolerancia, pues la misma hermana * * del demandado [Nombre2] , relata que había un convenio entre su padre don [Nombre13] , padre a su vez de [Nombre2], por medio del cual el señor [Nombre2] tenía permiso de usar la servidumbre. A pesar que de que los testigos hablan de la existencia de permiso, evidentemente, con la declaración de los testigos, el llamado permiso era una verdadera posesión a título de dueño, en forma pública, pacífica e ininterrumpida, a favor de [Nombre2] y [Nombre8] , pues éste, accesaba con carretas, para llevar abono, dar mantenimiento y sacar el café, arregabla el camino, etc. y no contaba con restricciones.

Esa situación no fue precaria pues se dio por muchos años y permitió a [Nombre1] disfrutar del mismo derecho, cuando convivió con [Nombre2] . Fue don [Nombre2] , quien vino a restringir el derecho de paso de don [Nombre2], lo cual dio origen a un interdicto del primero contra el segundo, del cual tenemos constancia por la existencia de una resolución visible a folio 3, el cual se suspende hasta tanto no se demuestre en autos por la parte interesada que se haya abierto el sucesorio de don [Nombre2] al haberse comprobado su defunción. Este interdicto es del año 2008, coincidente con la denuncia por daños que presentó [Nombre2] , contra [Nombre25] , por la acusación de daños por rotura de un poste en un portón. Ninguno de esos procesos se saldó por la defunción de don [Nombre2] y fue doña [Nombre1] quien plantea el presente proceso ordinario para resolver la cuestión, como donataria de la nuda propiedad.

Sobre este aspecto es importante aclarar que si bien doña [Nombre1] era propietaria de la nuda propiedad, la muerte de don [Nombre2] , elimina automáticamente para él el ejercicio de los otros usos del dominio como el uso y habitación. Por otra parte, se ha probado que eran, doña [Nombre1] y don [Nombre2] los que realizaban la actividad empresarial agraria de cultivo de café, por lo que doña [Nombre1] estaba y está también legitimada en el reclamo de la servidumbre. Se ha acreditado también como un hecho probado de la sentencia de primera instancia que este Tribunal prohija, que la servidumbre de paso atraviesa las propiedades del partido de Alajuela, folio real No. 227971-000, descrita en el plazo A-806424-2002, folio real 326445-000 descrita en el plano A-612047-1985;* folio real 131837-000, descrita en el plano A-653611-1986; folio real 315487-000 descrita en el plano A-653608-1986;* folio real 315486-000 descrita en el plano A-653610-1986 todas de la sociedad Cuatro Eme Limitada y también la propiedad de [Nombre3] finca folio real No. 355485-000 y descrita en el plano A-653609-1986 y colinda al norte y oeste con la propiedad folio real 227972 propiedad de [Nombre4] y [Nombre5] y descrita en el plano A--0717941-1987.

( hecho probado dos de la sentencia de primera instancia.) Asimismo se tiene por probado la extensión lineal de la servidumbre que corresponde a trescientos cincuenta y ocho metros hasta la entrada de la finca de la actora y un ancho, de seis metros en la entrada y luego tres metros como mínimo a partir de la mitad del camino, con dirección [Dirección1] , hasta llegar a la parte llana de la propiedad de la actora colindante con el Río Cocora. *

VI.Analizado tanto el marco jurídico aplicable, como la prueba recibida, en lo que ha sido objeto de apelación, concluye este Tribunal que la actora lleva razón parcialmente en cuanto a su apelación, pues resulta evidente, que la accionante disfrutaba por convenio de una servidumbre de paso, por los terrenos de los demandados. Esa servidumbre, fue acordada por el padre del demandado, de nombre [Nombre13] , quien fue el que registralmente traspasó a su hermana [Nombre8] , casada con don [Nombre2] . La posesión de la servidumbre por ese convenio se mantuvo muchos años, hasta que se produjeron roces entre el hijo de [Nombre13] , el demandado [Nombre2] , y enfrentamientos por esa servidumbre, que incluso originaron acusaciones por daños y un interdicto el cual no concluyó por la muerte de [Nombre2] . La servidumbre ha sido de uso constante, en el sentido que corresponde a una servidumbre de paso, por parte, primero de [Nombre8] y [Nombre2] y luego por [Nombre2] y [Nombre1] .

Se trata de una servidumbre agraria, cuya función social es permitir el ingreso y salida para la finca, ahora de [Nombre1] , permitiendo las actividades de producción. En relación con la petición de la actora se acoge pues aunque nunca se inscribió, ello no afecta la obligación entre las partes, que la convinieron. Por ello lo procedente será revocar parcialmente la sentencia de primera instancia en cuanto acogió las excepciones de falta de derecho y falta de legitimaci* ón activa y pasiva, así como falta de interés interpuestas por el demandado [Nombre2] en su condición personal y como representante * de Familia Cuatro Eme Limitada. Se mantiene la sentencia en cuanto declara sin lugar en todos sus extremos la demanda contra [Nombre4] y [Nombre5] , pues no ha demostrado que dichos demandados hayan interferido u obstaculizado la servidumbre de paso de la actora. En su lugar se rechazan las excepciones falta de derecho y falta de legitimación activa y pasiva, así como falta de interés interpuestas por el demandado [Nombre2] en su condición personal y como representante de Familia Cuatro Eme Limitada y se acoge de la siguiente forma la demanda: a) Se dispone la restitución de la servidumbre de paso existente entre la actora [Nombre1] y los demandados [Nombre2] en su condición personal y como representante de la Familia Cuatro Eme Limitada. b) Se ordena la inscripción de la servidumbre de paso como fundo dominante de la propiedad 201507 del Partido de Alajuela , terreno de café, ubicado en [Dirección4] , , , provincia de Alajuela, a nombre de [Nombre1] , contra los fundos propiedades del partido de Alajuela, folio real No. 227971-000, descrita en el plazo A-806424-2002, folio real 326445-000 descrita en el plano A-612047-1985; folio real 131837-000, descrita en el plano A- 653611-1986;* folio real 315487-000 descrita en el plano A-653608-1986;* folio real 315486-000 descrita en el plano A-653610-1986 todas de la sociedad Cuatro Eme Limitada y también la propiedad de [Nombre3] finca folio real No. 355485-000 y descrita en el plano A-653609-1986 y colinda al norte y oeste con la propiedad folio real 227972 propiedad de [Nombre4] y [Nombre5] y descrita en el plano A--0717941-1987, lo cual se realizará en ejecución de sentencia.

Tiene una extensión lineal de trescientos cincuenta y ocho metros y un ancho mínimo de tres metros, con seis metros en la entrada, con dirección [Dirección1] , hasta llegar a la parte llana de la propiedad de la actora colindante con el [Dirección5] . c) Se condena a [Nombre2] en lo personal y a la Sociedad Familia Cuatro Eme Limitada al pago de los daños u perjuicios y ambas costas del proceso las que se liquidarán en ejecución de sentencia. En lo demás se confirma la sentencia. *

* * POR TANTO* Se revoca parcialmente la sentencia de primera instancia en cuanto acogió las excepciones de falta de derecho y falta de legitimación activa y pasiva, así como falta de interés interpuestas por el demandado [Nombre2] en su condición personal y como representante de Familia Cuatro Eme Limitada. Se mantiene la sentencia en cuanto declara sin lugar en todos sus extremos la demanda contra [Nombre4] y [Nombre5] , pues no ha demostrado que dichos demandados hayan interferido u obstaculizado la servidumbre de paso de la actora. En su lugar se rechazan las excepciones falta de derecho y falta de legitimación activa y pasiva, así como falta de interés interpuestas por el demandado [Nombre2] en su condición personal y como representante de Familia Cuatro Eme Limitada y se acoge de la siguiente forma la demanda: a) Se dispone la restitución de la servidumbre de paso existente entre la actora [Nombre1] y los demandados [Nombre2] en su condición personal y como representante de la Familia Cuatro Eme Limitada. b) Se ordena la inscripción de la servidumbre de paso como fundo dominante de la propiedad 201507 del Partido de Alajuela , terreno de café, ubicado en [Dirección6] , , , provincia de Alajuela y contra los fundos propiedades del partido de Alajuela, folio real No. 227971-000, descrita en el plazo A-806424-2002, folio real 326445-000 descrita en el plano A-612047-1985; folio real 131837-000, descrita en el plano A- 653611-1986; folio real 315487-000 descrita en el plano A-653608-1986; folio real 315486-000 descrita en el plano A-653610-1986 todas de la sociedad Cuatro Eme Limitada y también la propiedad de [Nombre3] finca folio real No. 355485-000 y descrita en el plano A-653609-1986 y colinda al norte y oeste con la propiedad folio real 227972 propiedad de [Nombre4] y [Nombre5] y descrita en el plano A--0717941-1987, lo cual se realizará en ejecución de sentencia , tiene una extensión lineal de trescientos cincuenta y ocho metros y un ancho mínimo de tres metros, con seis metros en la entrada, con dirección [Dirección1] , hasta llegar a la parte llana de la propiedad de la actora colindante con el [Dirección5] . c) Se condena a [Nombre2] en lo personal y a la Sociedad Familia Cuatro Eme Limitada al pago de los daños y perjuicios y ambas costas del proceso las que se liquidarán en ejecución de sentencia.
