The matter was heard before the Agrarian Court of the Second Judicial Circuit of the Atlantic Zone, Guápiles.-* * * WHEREAS:*

  1. 1The plaintiff filed an ordinary action valued at two million colones, requesting verbatim that the judgment declare the following: "That this ordinary agrarian action be granted, and: a) That a right-of-way easement (servidumbre de paso) on foot, horseback, and by truck be deemed established over the property registered in the Heredia Registry District under real-property folio 140614-000, owned by the defendant herein, for the benefit of my unregistered parcel described in cadastral survey plan H-732985-2001. b) That said easement shall be eight meters wide and shall have the length determined by the expert in his report, although it was initially set at approximately 1500 meters. c) That said easement shall run from south to north, that is, from Río Colpachi to Río Tambor. It shall be ordered that the easement be recorded in the Registro Público de la Propiedad in the registry entry of the defendant’s servient estate (finca sirviente). d) That the defendant herein be ordered to refrain in the future from closing or obstructing access to the road at issue in this proceeding, or from interfering in any way with the use and enjoyment of that road (easement) by the undersigned and his workers, with the legal warning that he may be charged with the offense of disobedience to authority. e) That the defendant be ordered, with the amount to be determined subsequently (en abstracto), to pay the damages caused to the undersigned by the closure, with a chain and padlock, of the gate providing access to the passageway (easement) leading to my property. f) That the defendant bear all procedural costs" (see complaint appearing at folios 17 through 19).Subsequently, in his pleading joining the necessary parties (integración de litis), filed on June 14, 2010, the following claims for relief were asserted: "a) That the land currently registered in the Heredia Registry District under real-property folio [Placa1], owned by the defendant herein, is encumbered by a right-of-way easement on foot, horseback, and by truck for the benefit of the estate undergoing registration, described in cadastral survey plan H-732985-2001, dated September 3, 2001, and owned by the plaintiff herein. That the agreed width of said easement is 4 linear meters, but in practice it has been 6 meters wide, with a length of approximately 1500 meters. The easement crosses the servient estate from north to south, that is, from río [Nombre3] to río Colpachí. b) That said right-of-way easement was established in public deed number 48, at 11:00 a.m. on April 4, 1994, before Notary Licenciada Rita María Herrera Durán, with the defendant herein appearing as owner of the servient estate and the aforementioned [Nombre4] as owner of the dominant estate (fundo dominante). c) That the easement established by that instrument was for passage on foot, horseback, and by truck.That the passageway was 4 meters wide, but in practice operated with a width of 6 to 7 meters, which is the width of the easement at issue that must be declared in the judgment. d) That the dominant estate was sold to me by the aforementioned [Nombre4] , and the undersigned is the current owner of the estate for whose benefit the easement at issue in this proceeding had been established. e) That señor [Nombre2] bear all procedural costs. f) That an order be sent to the Registro Público de la Propiedad directing that the established easement be recorded in the registration entry of the servient land owned by the defendant, registered in the Heredia Registry District under real-property folio CED6, for the benefit of the servient estate owned by me and undergoing registration. g) That, with respect to the State and Japdeva (sic), neither the undersigned nor those parties be ordered to pay costs, because they were sued pursuant to an order of the Court" (see pleading at folios 99 through 104). At folios 299 through 300, the plaintiff assessed non-pecuniary damages (daño moral) at two million colones and consequential damages (perjuicios) at one million eight hundred thousand colones. *
  2. 2The defendants separately denied the complaint filed against them; señor Jiménez Vargas raised the defenses (excepciones) of statute of limitations (prescripción), failure to join all indispensable defendants (litisconsorcio pasivo necesario incompleto), lack of a legal right, lack of interest, lack of cause, and lack of standing, both active and passive; the respondent Junta raised the defenses of lack of a legal right and lack of standing in both forms, which were also raised by the State together with failure to join all indispensable defendants (see answers at folios 69 through 78, 156 through 162, and 218 through 225). *
  3. 3The defense of failure to join all indispensable defendants raised by co-defendant [Nombre2] was partially sustained by an interlocutory ruling, while the statute-of-limitations defense was reserved for determination in the judgment on the merits. The failure to join all indispensable defendants alleged by the Deputy State Attorney was denied by a reasoned ruling (see rulings appearing at folios 94 and 234). *
  4. 4Co-defendant [Nombre2], in turn, filed a counterclaim (reconvención) against the plaintiff, seeking a judgment declaring the following: "... That the property registered in the Heredia Registry District under number CED6 is not subject to any restriction or easement benefiting the property of the counterclaim defendant described in survey plan number H-732985-2001. That the property owned by the counterclaim defendant and described in survey plan H-732985-2001 does not adjoin my property and is not a landlocked estate (fundo enclavado), because it has an easement providing access to a public road through another area and not through my property. That the property owned by the counterclaim defendant and described in survey plan H-732985-2001 is located within the inalienable zone of [Dirección1]. That the document identified as deed number CED7, executed before Notary Rita Herrera Durán, does not describe the imposition of any easement over the property registered in the Heredia Registry District under number CED8 for the benefit of the property described in survey plan number H-732985-2001, because it does not state the property number upon which the alleged easement is imposed.That the document identified as deed number CED7, executed before Notary Rita Herrera Duran, is already time-barred because it was not recorded in the Registro Público de la Propiedad and because the acts necessary to validate and protect the alleged right contained therein were not performed, since more than 16 years have elapsed from the date of the instrument to the filing of this proceeding. That, once the judgment becomes final, the counterclaim defendant be ordered to refrain from entering my property, either personally or through his laborers or other persons traveling toward his property. And that he further refrain from entering or passing through my property on foot, horseback, or by vehicle or with animals. That the counterclaim defendant be ordered to pay me for the use of my property and the permission I have given him to cross it throughout the duration of this proceeding, from the filing of the complaint until the judgment becomes final.The amount shall be assessed by an expert, whose appointment I request be deferred until the judgment-enforcement stage (fase de ejecución de sentencia), if necessary" (see counterclaim at folios 78 through 83). *
  5. 5The counterclaim defendant merely denied the counterclaim filed against him, without raising any defenses in support of his opposition (see pleading at folios 90 through 93). *
  6. 6Attorney Bernardo Solano Solano, judge of the Agrarian Court (Juzgado Agrario) of the Second Judicial Circuit of the Atlantic Zone, in judgment number 106-2012, issued at fifteen hours eleven minutes on the twenty-fourth of July of two thousand twelve, ruled: “POR TANTO: The defenses (excepciones) of statute of limitations, lack of legal right, lack of current interest, lack of cause of action, and lack of active and passive standing raised by the co-defendants are denied. THE CLAIM filed by [Nombre1] against [Nombre2], the State, and the Junta de Administración Portuaria y de Desarrollo Económico de la Vertiente Atlántica (JAPDEVA) IS DECLARED PARTIALLY GRANTED, with anything not expressly stated herein deemed denied, and anything not granted in the manner requested by the plaintiff deemed modified: a) The property registered in the Heredia Registry District, located in Colpachi, [Dirección2], tenth canton of Sarapiquí, described in survey plan H-33279-1992, with real-property folio registration number [Placa2] , owned by Mr. [Nombre2], is encumbered by a right-of-way easement (servidumbre de paso), for passage on foot, horseback, and by truck, benefiting the dominant estate (fundo dominante) included in cadastral plan H-732985-2001, dated the third of September of two thousand one, corresponding to the unregistered parcel possessed by the plaintiff, [Nombre1]. b) Said right-of-way easement was created by agreement through public deed number forty-eight, executed before notary public Rita María Herrera Duran on the fourth of April of nineteen ninety-four, with the following description and characteristics: length: approximately one thousand five hundred linear meters; width: four linear meters; purpose: to provide access to the dominant estate; servient estate (fundo sirviente): property owned by Mr. [Nombre2], measuring approximately one hundred twelve hectares; dominant estate: unregistered property occupied by [Nombre4] , and currently by [Nombre1], having an area of eighty-eight hectares; direction: the route crosses the servient estate from north to south, specifically from the [Nombre3] River to the Colpachí River; assessed value: one thousand colones for tax purposes. c) In order to give public notice of said real-property encumbrance (carga real), the Registro Nacional, Propiedad Inmobiliaria, shall record it in the registration entry for the servient property, for which purpose a certified enforceable copy of the judgment (formal ejecutoria) shall be issued to that entity once this ruling becomes final. d) Mr. [Nombre2] is ordered to refrain in the future from closing or obstructing access to the path in dispute, or from interfering in any way with Mr. [Nombre1]’s or his workers’ use and enjoyment of that easement, with notice that failure to comply may constitute the offense of Disobedience of Authority.The claims seeking to widen the voluntarily agreed easement and seeking a general award of compensation for the alleged non-pecuniary harm and damages are denied. This ruling is issued without prejudice to any rights the State may have over areas of the property described in plan H-732985-2001, as far as * property rights or definitive possession are concerned. Regarding the COUNTERCLAIM (CONTRADEMANDA) filed by Mr. [Nombre2] against Mr. [Nombre1], IT IS DENIED IN ALL RESPECTS. Both the claim and the counterclaim are resolved without a special award of costs” (see ruling at folios 327 through 345). *
  7. 7The plaintiff and counterclaim defendant, co-defendant and counterclaimant* [Nombre2], and co-defendant the State, represented by the Procuraduría General de la República, filed appeals (recursos de apelación), expressly stating the grounds on which they relied to challenge the trial court’s reasoning (see briefs at folios 346 through 379). *
  8. 8The statutory requirements have not been observed in the conduct of the proceedings, and errors or omissions capable of rendering the judgment null and void are present. Judge Rojas Madrigal drafts the opinion, and, *

* * CONSIDERANDO:*

I.In view of the manner in which the matter is resolved, no ruling is made regarding the facts found proven and not proven in the appealed decision. *

II.The Juzgado Agrario del Segundo Circuito Judicial de la Zona Atlántica, Guápiles, in judgment number 106-2012, issued at fifteen hours and eleven minutes on the twenty-fourth of July of two thousand twelve, denied the defenses of statute of limitations, lack of legal right, lack of current interest, lack of cause of action, and lack of active and passive standing; instead, it partially granted the claim. The counterclaim* was denied in all respects. Both the claim and the counterclaim were resolved without a special award of costs. *

III.The plaintiff filed an appeal, arguing as follows: He disagrees with the decision not to award costs in these proceedings because, given the defendant’s refusal to recognize his right, he was compelled to file the claim, and an award of costs is therefore warranted. He adds that the evidence presented establishes that agricultural activity, specifically cattle ranching, was conducted on the estate; that activity had to cease, causing him damages, and a general award thereof is therefore warranted, with the amount to be determined during enforcement of the judgment (ejecución de sentencia). *

IV.For his part, the Public Defender representing co-defendant and counterclaimant (codemandado reconventor)* Luis Alberto Jiménez Vargas filed an appeal seeking annulment (recurso de apelación con nulidad), arguing as follows: Ground for annulment (motivo de nulidad): In the proceedings, the State and JAPDEVA were ordered to be joined as defendants because the court below (a quo) considered that, as the registered owners of the land on which the plaintiff’s property is located, they could be prejudiced if they were not joined in the proceedings. However, in the same judgment, the court below found that cadastral plan (plano catastrado) H-732985-2001 also overlaps plans H-747544-1988, H-747545-1988 and H-893924-1990, which correspond to registered properties numbers 4-130557-000, 4-134654-000 and 193176-000; consequently, the registered owners of those properties are indispensable co-parties on the defendant side (litisconsorcio pasivo necesario), because the outcome of the proceedings could prejudice them, as the plaintiff is asserting rights of possession and ownership over their properties.

As to the arguments on the merits, he stated: ONE: DISAGREEMENT REGARDING THE FACTS FOUND PROVEN AND NOT PROVEN: With respect to the facts found proven, the court below made an improper and incorrect assessment of the evidence and, as a result, deemed proven fact number four established. However, the evidence submitted to the case file does not show that the plaintiff established that the content of the document referenced in public deed number forty-eight of the notarial record of Notary Public Rita María Herrera Duran constituted a right-of-way easement (servidumbre de paso) encumbering the property registered in the Heredia Registry District, described in plan H-33279-1992, under real-property folio registration number [Placa1], because neither the plan number nor the property number was stated and, furthermore, no encumbrance was ever registered against the property duly recorded in the name of the party he represents.

The same applies to fact five, because the witnesses’ testimony does not correspond to the actual circumstances of his client’s property, as may be demonstrated by a detailed review of the video recording of the judicial inspection (reconocimiento judicial). On the day of the inspection, neither the plaintiff nor his attorneys wished to continue along the route and instead sent an employee to point out the easement; however, he was wholly unable to identify the correct route, because the places reached were the neighboring owners’ properties and never the plaintiff’s property. Moreover, upon reaching an area of scrubland beside a river, the plaintiff’s employee could not establish whether they had already left the defendant’s property; nor was it indicated where the plaintiff’s property began or whether they had crossed the property of any other neighboring owner. The court below therefore cannot deem the accounts given by the plaintiff’s witnesses established.

He adds that, at the outset, the plaintiff’s employee and guide during the inspection took them to another area entirely removed and distant from the river area visited and told them that it was the easement. Furthermore, in his testimony upon examination as a party (prueba confesional), the plaintiff acknowledged that the easement he claims is the one that is completely cleared—that is, the first location to which the plaintiff’s employee or driver took them—but that route never reaches the plaintiff’s property, much less the property of neighboring owner [Nombre5]. This may be deemed established through the judicial inspection itself, during which, it bears noting, the clearing recently performed on the internal road of the defendant’s property was apparent. As to fact six, if the agrarian judge deemed it established that the plaintiff and his predecessors removed timber, he should instead have ordered certified copies of the pertinent records to be prepared for proceedings against him, because those lands are located within State-protected areas and within [Dirección1].

He continues by stating that fact seven cannot be deemed established because the witnesses he identifies are accommodating witnesses with a direct interest in the outcome of these proceedings, as they stated that they also wish to obtain access through the defendant’s property; their testimony therefore cannot be considered credible. Fact eight is likewise unfounded, because what the purported witnesses recount is one thing and the circumstances observed during the judicial inspection are another. The proceeding conducted by the agrarian judge clearly shows that it was not even possible to locate the purported access point from the plaintiff’s property to the purported easement, nor were any traces of it found in front of his property. He adds that the court below erred in deeming fact eleven proven, because the evidence must be considered as a whole, and the judicial inspection and the plaintiff’s testimony upon examination as a party make clear that even the plaintiff himself neither knows nor has traveled along the purported easement for more than ten years.

Under oath, he stated that the easement he claims is the one that is cleared, while the judicial inspection shows that the partially cleared road reaches the end of co-defendant [Nombre2]’s property, at its boundary with another neighbor and not with the plaintiff. Moreover, that boundary is located far from the plaintiff’s property, and from the cleared area there is no access to the plaintiff’s property showing evidence or traces of a road or easement. Accordingly, in this case the judicial inspection must be given greater weight when considered together with the plaintiff’s testimony upon examination as a party, rather than the witness testimony, because those witnesses are accommodating and never identified with certainty where the easement begins or described its route and characteristics. Referring to the facts found not proven, he stated that it is incorrect to assert that co-defendant [Nombre2] failed to establish that the purported easement had not been used for more than ten years, because the inspection itself shows that the easement does not exist.

This is compounded by the fact that, in his testimony upon examination as a party, the plaintiff acknowledged having declared under oath in adverse-possession proceedings (proceso de información posesoria) that he had possessed his property for ten years and that, throughout that ten-year period, access had been through the easement depicted in plan 4-732985-01 in [Dirección3]. This clearly shows that he has not used the purported easement claimed in these proceedings for more than ten years. Nor can fact two be deemed established, because the very instrument referring to the purported creation of an easement states neither the plan nor the real-property folio of the property on which the easement encumbrance (gravamen) was imposed. In this respect, the court below disregarded article 455 of the Código Civil, in conjunction with paragraph 1 of article 459 thereof and article 267. On the contrary, the plaintiff did not establish that the document at issue encumbered the property described in plan H-33279-1992, under real-property folio registration number [Placa1].

The court below improperly assessed the evidence when it deemed established that the easement encumbers the property duly registered in the co-defendant’s name, because, in his testimony upon examination as a party, the plaintiff stated under oath that the easement he claimed was the one traversed by the judge and that it was cleared, yet the purported easement that was traversed and was cleared does not end at [Dirección4], but rather at the property of another neighboring owner who is not the plaintiff. Consequently, the claim described by the plaintiff in his sworn testimony does not correspond to the purported easement described in the public deed at issue. The court below likewise erred in assuming that the cited document describing a purported easement encumbers the property duly registered in the Registro Público in the name of co-defendant [Nombre2], because neither the plan of the affected property nor the property number is stated, and there is no evidence in the case file establishing this.

Nor is there any witness testimony establishing it. Finally, regarding the witness statements, the court below credited witness [Nombre6] ; however, that testimony was not assessed in light of the evidence obtained during the judicial inspection, which demonstrates that the testimony was false, as there is no trace or indication whatsoever of any easement running from the plaintiff’s own property toward his client’s property; moreover, that witness has a direct interest in the proceedings. The same applies to the testimony of [Nombre5] and [Nombre7], because the former does not establish the existence of the easement, as he knows neither its width nor its length and neither describes nor establishes that the plaintiff used it. Rather, that witness testifies about the easement access that the party he represents sold to him through another area of the property, not the area at issue in this litigation.

TWO: DISAGREEMENT WITH THE RULING ON THE ASSERTED STATUTE OF LIMITATIONS (PRESCRIPCIÓN): The document through which the plaintiff claims the purported easement is subject to the ten-year limitation period (prescripción decenal), and the document recording the purported existence of the easement is therefore already time-barred, because more than ten years have elapsed and it was not submitted to the Registro Público de la Propiedad to register the purported real right (derecho real) contained therein. THREE: DISAGREEMENT WITH THE DISMISSAL OF THE DEFENSES RAISED AGAINST THE COMPLAINT DUE TO IMPROPER ASSESSMENT OF THE EVIDENCE: The facts, evidence and applicable law were improperly assessed when the defenses raised by this representation were dismissed. The plaintiff lacks standing (legitimación) to seek the creation of an easement or recognition of a purported easement that, according to him, exists for the benefit of the property described in his plan, because the State, the Junta de Administración Portuaria de la Vertiente Atlántica and the defendant established that the petitioner (promovente)* claims possession of inalienable real property located within the border zone, which also forms part of the property duly registered in the name of JAPDEVA and is subject to the Refugio de Vida Silvestre Maquenque.

This negates the plaintiff’s standing in these proceedings, because he seeks the creation or confirmation of a purported easement for the benefit of land that he does not own; as public-domain property (bienes de dominio público), it is not susceptible to possession by private parties. Consistent with this are articles 370, 371 and following of the Código Civil, which provide that easements may not be imposed for the benefit of or as a burden upon a person, but only for the benefit of or as a burden upon a parcel of land, and may not be separated from it. By ruling in that manner, the court is alienating public-domain property and thereby violating the Ley de la Administración Financiera de la República, article 97 of which establishes a series of requirements that must be met in cases involving the alienation of public-domain real property. FOUR: DISAGREEMENT WITH REGISTRATION OF THE EASEMENT: The imposition and registration of any type of encumbrance is improper because the plaintiff never established that the purported deed created an easement over the property registered in the co-defendant’s name, as there is no evidence establishing this.

Furthermore, that document is time-barred because it is more than ten years old and was never registered in the Registro Público de la Propiedad. FIVE: DISAGREEMENT WITH THE DISMISSAL OF THE COUNTERCLAIM (CONTRADEMANDA): The evidence was improperly assessed because, in ruling on the counterclaim, the court below did not consider the judicial inspection or the testimony upon examination as parties given by both parties. That evidence shows that the property duly registered in the co-defendant’s name was not encumbered by any easement and establishes that there are no traces or indications within that property of any easement originating from the plaintiff’s property.

On the contrary, the co-defendant (codemandado) demonstrates that no easement encumbrance (gravamen de servidumbre) has been or is recorded on the property registry record (folio real) for his property at the plaintiff’s (actor) request, and the plaintiff fails to demonstrate that, with respect to the property identified by that registry record, his client (patrocinado) undertook to impose any easement. The court below (a quo) does not cite any legal provisions as grounds for denying the claims asserted in the counterclaim (contrademanda), nor does it analyze the evidence submitted. *

V.Licenciado Víctor Bulgarelli Céspedes, Agrarian Attorney (Procurador Agrario), representing the Procuraduría General de la República, filed an appeal (recurso de apelación), setting forth the following: 1.- The plaintiff asserted that he held title to and possessed the unregistered land described in survey plan H-723985-2001, the possessory rights (derechos de posesión) to which he acquired from [Nombre4], and maintained that he had protected and preserved the forest. In response, the State pointed out that possessory rights cannot be acquired over public-domain property (demanio público), because 54% of the land described lies within the northern border zone, which has been declared unavailable for private appropriation (indenunciable) since 1988 and has also been designated a National Wildlife Refuge (Refugio Nacional de Vida Silvestre). The Maquenque Mixed Wildlife Refuge (Refugio Mixto de Vida Silvestre Maquenque), which encompasses 46% of the area shown on plan H-732985-2001, likewise forms part of the State Natural Heritage (Patrimonio Natural del Estado).

That defense is consistent with constitutional judgment 9305-12, which rejected a private party’s claim concerning land located within the Refugio Nacional de Fauna Silvestre Corredor Fronterizo Norte. Nevertheless, the challenged ruling recognized the encumbrance (gravamen) upon the dominant estate (fundo dominante), stating that it was without prejudice to any rights that might ultimately belong to the State; therefore, the challenged ruling is inconsistent, contradictory, and unclear. 2.- The plaintiff’s standing (legitimación activa) is also challenged. To seek judicial recognition of a limited real right (derecho real limitado) and a right-of-way easement (servidumbre de paso) agreed upon by contract, a person must have the status of owner or proprietor of the dominant estate pursuant to sections 372, 381 subsections 3 and 4, 856, and 860 of the Código Civil; the same requirement must be met to demand the imposition of a right-of-way obligation (obligación de paso).

In judgment 222-1998, cited by the court below (a quo), the Tribunal Agrario adopts this position by stating that the holder of the easement is, above all, the current owner, a view also reflected by the Sala Primera. Thus, the challenged ruling acknowledges that easements are granted for the benefit of properties over which ownership rights are exercised; nevertheless, no evidence was admitted in the proceedings establishing that the plaintiff had possessed the unregistered land for ten years as owner before the legislation placing it within the public domain took effect. The dedication of the border strip to the public domain (afectación a dominio público) since the nineteenth century makes it impossible to establish acquisitive prescription (usucapión) through testimonial evidence. It is therefore improper to recognize a right-of-way easement for access to the State Natural Heritage when the plaintiff failed to establish an enabling title (título habilitante), whether consisting of legitimate prior ownership or a concession or use permit issued by the agency responsible for administering the public-domain property.

Furthermore, the plaintiff admitted that timber had been extracted from the purported dominant estate over which he claimed title and lawful possession, a fact deemed proven in the judgment. However, the record contains no forest-harvesting permits (permisos de aprovechamiento forestal) authorizing the cutting; consequently, the exercise of possession protective of natural resources in protected wilderness areas (áreas silvestres protegidas) was likewise not established, and the allegations in the complaint concerning protection and preservation of the forest must be rejected. 3.- The judgment deemed it proven that the property to which the plaintiff claims title and of which he claims to be the lawful agricultural possessor is the property described in plan H-732985-2001, and that he obtained the possessory rights to the property by purchasing them from Mr. [Nombre4] on 28 de noviembre del 2000, whereby private possession of three estates measuring 31, 88, and 119 hectares was transferred to him.

This violates several legal provisions governing the public domain because, under the principle of first registration (principio de inmatriculación), public-domain status is perfected through its declaration and dedication by statute, without any need for the lower-ranking act of registry inscription. A direct violation of the cited legislation is therefore also alleged insofar as the judgment classifies only the land registered in the name of JAPDEVA as public-domain property, even though that status is likewise shared by the Refugio Nacional de Vida Silvestre Corredor Fronterizo, which encompasses 54% of the area shown on plan H-732985-2001, and by the Refugio Mixto de Vida Silvestre Maquenque, which encompasses the remaining 46%. This follows from the failure to establish ten years of possession as owner before the dedication to the public domain; therefore, citing judgments concerning the existence of easements in protected wilderness areas serves no purpose, because those judgments concern different circumstances in which the parties held title to the property.

Moreover, the State was not a party to the private agreement of 28 de noviembre del 2000, and therefore it does not apply to the State. The legislation protecting State public-domain property and the case law interpreting it deny such contracts any legal force to create legitimate exclusive rights; accordingly, the cause and subject matter of such transactions will always be vitiated by nullity. 4.- He adds that recognizing an easement in favor of unregistered land, along a route that does not match the route purportedly agreed upon, undermines legal certainty and the rules of science and technical knowledge, and violates substantive law through erroneous assessment of the evidence. During the judicial inspection (reconocimiento), the direction taken by the easement upon reaching the Tambor channel (caño Tambor) was unclear, because the bridge was not found and the land described in plan H-732985-2001 was not even traversed; the person who guided the inspection stated that he did not know how to proceed.

Moreover, there is no south-to-north connection between the properties, because the land described in plan H-732985-2001 lies west of plan H-33279-1992; they are not contiguous but are separated by one kilometer, within which lie the JAPDEVA property and the border strip. The course of the [Nombre3] channel shown on the map sheets demonstrates that, although cadastral plans H-732985-2001 and H-33279-1992 adjoin that tributary to the south and north, respectively, they do so laterally and not one above the other; both are located immediately below horizontal geographic coordinate 302, and their boundaries with the [Nombre3] channel lie along different sections of its course. The channel does not serve as a connection between the properties; therefore, from a technical standpoint, the request to recognize the establishment of a right-of-way easement approximately 1500 meters long, running from south to north from the Colpachí River to the [Nombre3] River for the benefit of the unregistered land described in cadastral plan H-732985-2001, is likewise inadmissible.

VI.- Section 26 of the Ley de Jurisdicción Agraria provides that courts may, on their own initiative, declare proceedings void (declarar nulidades) and order procedural steps repeated (reposición de trámites) in order to correct irregularities that could affect the validity of the proceedings. In addition, regarding appeals, and as further support, section 60 of the cited statute states that the procedure shall be governed, as applicable, by the provisions of the Código de Trabajo. Article 502 of the cited code provides that, upon receipt of the case file by the Court, it shall first review the proceedings; and if it finds that any formality capable of causing actual denial of the right to be heard (indefensión) has been omitted, it shall declare the appropriate proceedings or rulings void, to the extent necessary to restore the case to its normal course. *

VII.The Court finds that the appealed judgment suffers from certain defects, because it fails to comply with the requirements of our legal system, leaving the parties unable to defend themselves, in violation of the right of defense and due process. The mission of administering justice must not be carried out to the detriment of the form—and also the substance—of judgments, which guarantee due process and the possibility of legal representation. The defect giving rise to nullity (vicio de nulidad) lies in the fact that, as codefendant [Nombre2] rightly argues, the proceedings did not order the compulsory joinder of defendants (litis consorcio pasivo necesario) comprising the owners of properties [Dirección5], [Dirección6], and [Dirección7]; this is because, as indicated by the cadastral report submitted as evidence in the record, the land possessed by the plaintiff apparently may overlap with several registered properties.

It should be noted that, in these proceedings, the plaintiff seeks recognition of an easement (servidumbre) in favor of the unregistered property he possesses, depicted in cadastral plan H-732985-2001, which would encumber the property of codefendant [Nombre2], registered in the Heredia Registry District under registration number [Placa1] and described in cadastral plan number H-0033279-1992. However, according to a report issued by the Catastro Nacional, the property corresponding to plan H-732985-2001 may overlap with cadastral plans numbers H-747544-1988, H-893924-1990, H-747545-1988, and H-1-1977, which correspond respectively to registered properties [Placa3], [Placa4], [Placa5], and [Placa6]. It also overlaps with plans H-267079-1995 and H-715294-1987, which, as of the date on which that report was issued, had not generated title (see cadastral report at pages 201–202). Property registration number [Placa3] is owned by Sociedad Conservación Ambiental RAMA Sociedad Anónima; property registration number [Placa4] is registered in the name of [Nombre8]; property [Placa6] is owned by the Junta de Administración Portuaria y de Desarrollo Económico de la Vertiente Atlántica (JAPDEVA); and property registration number [Placa5] was formerly owned by Sociedad Conservación Ambiental RAMA Sociedad Anónima (see registry reports* at pages 132 and 209–215).

However, a search conducted in the Registro Nacional, Sección Bienes Inmuebles, established that the last-mentioned property is currently registered in the name of Sociedad Gogo* Roemy San Carlos Sociedad Anónima (see electronic search of the Registro Nacional, Sección Bienes Inmuebles, dated 26 de febrero del 2013). For his part, codefendant [Nombre2] clearly stated in his answer to the complaint that the owners of those properties had to be joined in the proceedings, when he raised the defense of compulsory joinder of defendants (see filing at page 77); however, in ruling on that defense by order issued at siete horas con ocho minutos del dos de junio del dos mil diez, the a quo ordered joinder only as to the State and JAPDEVA, rejecting joinder as to the other persons who held title to the other registered properties. The a quo reasoned that, if a judgment were entered in favor of the plaintiff, the only parcel that would be encumbered would be his own (the defendant’s), because it is the servient estate (fundo sirviente) upon which the burden would be imposed, rather than the dominant estate (fundo dominante), which is the status of the plaintiff’s parcel in these proceedings; thus, the latter would not suffer an encumbrance but would instead receive a benefit (see order at pages 94–96).

The a quo’s reasoning in rejecting joinder of the owners of the other registered properties is not legally sound because, since an easement is a real property right (derecho real sobre inmuebles), its creation necessarily requires the consent of both parties—the owner of the servient estate and the owner of the dominant estate—and, if it is accepted, both properties must bear the corresponding notation. On this subject, Manuel Albaladejo* has stated: “To create them, one must have the legal capacity to dispose, by means of the act in question, of the property upon which they are established, and the grantor must hold the powers over the encumbered property that the particular easement (sic) confers” (Albaladejo*, Manuel. Derecho Civil III. Derecho de Bienes, Volumen segundo, octava edición, José María Bosch* Editor, S.A, 1994, p. 129). Based on the foregoing, because there is no certainty in this case regarding the possible overlap between the plaintiff’s property and the registered properties cited above, the a quo should have ordered the compulsory joinder of their owners as defendants in order to prevent any direct impairment of their interests and rights, and they should be served with notice of these proceedings so that they may appear and assert their rights if they deem it appropriate.

The foregoing violates due process; accordingly, this Court considers it proper to annul the appealed judgment and, furthermore, partially reverses the order issued at siete horas ocho minutos del dos de junio del dos mil diez, solely insofar as it rejected the defense of compulsory joinder of the owners of properties 130557-000, 134654-000, and 193176-000. In its place, plaintiff and counterclaim defendant (actor-reconvenido) [Nombre1] is ordered, within eight days, to effect the compulsory joinder of Sociedad Conservación Ambiental RAMA Sociedad Anónima, Sociedad Gogo* Roemy San Carlos Sociedad Anónima, and [Nombre8], and that filing must comply with all statutory requirements, with notice that failure to do so will result in termination of the proceedings. In view of the manner in which this matter is resolved, no ruling is made on the substantive grounds of appeal asserted by the appellants. *

Tramitado ante el Juzgado Agrario del Segundo Circuito Judicial de la Zona Atlántica, Guápiles.-* * * RESULTANDO:*

  1. 1La parte actora plantea demanda ordinaria estimada en la suma de dos millones de colones, solicitando literalmente que en sentencia se declare lo siguiente: "Con lugar esta demanda ordinaria agraria, y: a) Se tiene por constituida servidumbre de paso a pie, caballo y en camión en contra de la finca inscrita al Partido de Heredia folio real 140614-000, propiedad del aquí demandado, y a favor de mi terreno sin inscribir que describe el plano catastrado H-732985-2001. b) Que dicha servidumbre tendrá un ancho de ocho metros y una longitud que será la que determine el señor perito en su informe, aunque inicialmente se fijo en 1500 metros aproximadamente. c) Que dicha servidumbre correrá de sur a norte, o sea del Río Colpachi al Río Tambor. Servidumbre que se ordenara inscribir en el Registro Público de la Propiedad en el asiento registral de la finca sirviente del aquí demandado. d) Se ordenara al aquí demandado, de abstenerse en el futuro de cerrar u obstaculizar el acceso al camino que interesa en este proceso o de perturbar en forma alguna el uso y disfrute de ese camino (servidumbre) al suscrito y sus trabajadores, bajo apercibimiento legal de ser acusado por el delito de desobediencia a la Autoridad. e) Que se condene al demandado, en abstracto, al pago de daños y perjuicios ocasionados al suscrito, por el cierre que se hizo con cadena y candado del portón que da acceso al paso (servidumbre) hacia mi finca. f) Son ambas costas del proceso a cargo del demandado" (ver escrito de demanda visibles a folios 17 al 19).Posteriormente, en su escrito de integración de litis presentado el 14 de junio de 2010, se plantearon las siguientes pretensiones: "a) Que sobre le terreno inscrito actualmente al Partido de Heredia, matrícula de folio real [Placa1], propiedad del aquí demandado, pesa una servidumbre de paso a pie, a caballo y camión, y a favor del fundo en proceso de inscripción, que describe el plano catastrado H-732985-2001, de fecha 3 de setiembre de 2001, propiedad del aquí demandante. Que dicha servidumbre tiene un ancho pactado de 4 metros lineales pero en la realidad lo ha sido de 6 metros, con 1500 metros aproximadamente de longitud. Servidumbre que atraviesa el fundo sirviente en un rumbo norte sur, o sea, del río [Nombre3] al río Colpachí. b) Que dicha servidumbre de paso se constituyó en escritura pública número 48, a las 11 horas del 4 de abril de 1994, en la notaría de la Licenciada Rita María Herrera Durán, compareciendo el aquí demandado en su carácter de titular del terreno sirviente, y el citado señor [Nombre4] como titular del fundo dominante. c) Que la servidumbre que se constituyó en ese acto fue de paso, a pie, a caballo, y en camión.Que el paso lo era de 4 metros de ancho, pero en la realidad operó con un ancho de 6 a 7 metros, medida que debe quedar declarada en sentencia el ancho de la servidumbre que interesa, d) Que el fundo dominante me fue vendido por el citado [Nombre4] , siendo el suscrito, el titular actual del fundo a favor del cual se había constituido la servidumbre que interesa en este proceso. e) Que ambas costas del proceso a cargo del señor [Nombre2] . f) Que se remitirá mandamiento al Registro Público de la Propiedad, ordenándose la inscripción de la servidumbre constituida, en el asiento de inscripción del terreno sirviente propiedad del demandado. inscrito al Partido de Heredia. matrícula folio real CED6, y a favor del fundo sirviente de mi propiedad en proceso de inscripción. g) Que la demanda para el Estado y Japdeva (sic) no se condene en costas ni al suscrito, ni a estas partes por cuanto fueron demandadas por disposición del Despacho" (ver escrito a folios 99 al 104). A folios 299 al 300, el actor estimó el daño moral en la suma de dos millones de colones y los perjuicios en la suma de un millón ochocientos mil colones. *
  2. 2Los demandados en forma separada contestaron negativamente la demanda incoada en su contra; el señor Jiménez Vargas interpuso las excepciones de prescripción, litisconsorcio pasivo necesario incompleto, falta de derecho, falta de interés, falta de causa y falta de legitimación activa y pasiva; la Junta accionada formuló las defensas de falta de derecho y falta de legitimación en su doble modalidad, las cuales, también fueron entabladas por el Estado junto con la de litisconsorcio pasivo necesario incompleto (ver escritos de contestación a folios 69 al 78, 156 al 162 y 218 al 225). *
  3. 3La defensa de litisconsorcio pasivo necesario incompleto esgrimida por el codemandado [Nombre2] fue acogida en forma parcial interlocutoriamente, al tiempo que la excepción de prescripción fue reservada para ser conocida en sentencia de fondo. En cuanto al litisconsorcio pasivo necesario incompleto aducido por la Procuradora Adjunta, fue rechazado por resolución fundada (ver resoluciones que rolan a folios 94 y 234). *
  4. 4Por su parte, el codemandado [Nombre2] planteó reconvención en contra del actor para que en sentencia se declare lo siguiente: "... Que sobre la finca inscrita en el Partido de Heredia con el número CED6, no existe ninguna limitación o servidumbre a favor de la finca del actor reconvenido descrita en el plano numero H-732985-2001. Que la finca propiedad del actor reconvenido descrita en el plano H-732985-2001, no es colindante con mi finca y no es un fundo enclavado pues tiene una servidumbre de salida a calle pública por otro sector y no por mi finca. Que la finca propiedad del actor reconvenido descrita en el plano H-732985-2001 se encuentra ubicada dentro de la zona inalienable de la [Dirección1] . Que el documento identificado como escritura número CED7 otorgada ante la notaría Rita Herrera Durán, no describe ninguna imposición de servidumbre sobre la finca inscrita en el partido de Heredia con el número CED8, a favor de la finca descrita en el plano número H-732985-2001, pues no indica el número de finca a la cual se impone la supuesta servidumbre.Que el documento identificado como escritura número CED7 otorgada ante la notaria Rita Herrera Duran, ya está prescrito por no haberse inscrito en el Registro Público de la Propiedad, y por no haberse ejecutado actos necesarios para convalidar y tutelar el supuesto derecho que contenía, ello pues has pasado más de 16 años desde la fecha del escrito a la interposición de este proceso. Que se le ordene al actor reconvenido que una vez firme la sentencia, se abstenga de ingresar a mi propiedad, ya sea en forma personal o por medio de sus peones u otras personas que vayan hacía su propiedad. Y además que se abstenga de ingresar a pie, a caballo, o en vehículo y con animales por mi finca. Que se ordene al reconvenido a pagarme el uso y permiso que le he dado de pasar sobre mi finca durante todo el tiempo que dure este proceso, desde la interposición de la demanda hasta que quede en firme la sentencia. Monto que valorará un perito del cual solicito se deje su nombramiento para la fase de ejecución de sentencia en caso que sea necesario" (ver escrito de contrademanda a folios 78 al 83). *
  5. 5El actor reconvenido se limitó a responder negativamente la contrademanda dirigida en su contra, sin oponer excepciones en pos de su resistencia (ver escrito a folios 90 al 93). *
  6. 6El licenciado Bernardo Solano Solano, juez del Juzgado Agrario del Segundo Circuito Judicial de la Zona Atlántica en sentencia número 106-2012 de las quince horas once minutos del veinticuatro de julio del dos mil doce, resolvió: “POR TANTO: Se deniegan las excepciones de prescripción, falta de derecho, falta de interés actual, falta de causa y falta de legitimación activa y pasiva opuestas por los codemandados. Se declara PARCIALMENTE CON LUGAR LA DEMANDA interpuesta por [Nombre1] contra [Nombre2] , El Estado y la Junta de Administración Portuaria y de Desarrollo Económico de la Vertiente Atlántica (JAPDEVA), entendiéndose por denegado lo que expresamente no se indique, y por modificado lo que no se otorgue en la forma pedida por el actor: a) Sobre la finca inscrita en el Partido de Heredia, situada en la localidad de Colpachi, del [Dirección2] , cantón décimo Sarapiquí, descrita en el plano H-33279-1992, con matrícula de folio real [Placa2] , propiedad del señor [Nombre2] , pesa una servidumbre de paso, a pie, a caballo y camión, a favor del fundo dominante comprendido en el plano catastrado H-732985-2001, fechado tres de setiembre de dos mil uno, que corresponde al predio sin inscribir en posesión del actor [Nombre1] . b) Dicha servidumbre de paso se constituyó de modo convencional mediante escritura pública número cuarenta y ocho, suscrita ante los oficios de la fedataria* pública Rita María Herrera Duran, en fecha cuatro de abril de mil novecientos noventa y cuatro, con la siguiente descripción y características: longitud: mil quinientos metros lineales, aproximadamente; ancho: cuatro metros lineales; fin: darle acceso al fundo dominante; fundo sirviente: Finca propiedad del señor [Nombre2] con una medida aproximada de ciento doce hectáreas; fundo dominante: finca sin inscribir ocupada por [Nombre4] , hoy día por [Nombre1] , con una cabida de ochenta y ocho hectáreas; rumbo: la ruta atraviesa el fundo sirviente con rumbo de norte a sur, concretamente del río [Nombre3] al río Colpachí; estimación: mil colones para efectos fiscales. c) A fin de publicitar dicha carga real, deberá el Registro Nacional, Propiedad Inmobiliaria, inscribirla registralmente en el asiento de inscripción del terreno sirviente, para lo cual se librará formal ejecutoria ante dicha entidad, una vez el presente fallo adquiera firmeza. d) Se ordena al señor [Nombre2] abstenerse en lo futuro de cerrar u obstaculizar el acceso a la senda en conflicto, o perturbar en alguna forma el uso y disfrute de esa servidumbre al señor [Nombre1] o sus trabajadores, bajo apercibimiento de incurrir en el delito de Desobediencia a la Autoridad.Se deniegan las pretensiones de ampliar el ancho de la servidumbre pactada voluntariamente, así como conceder en abstracto el pago de daño moral y perjuicios alegados. Lo aquí resuelto se decide sin perjuicio de los eventuales derechos del Estado sobre áreas de la finca descrita en el plano H-732985-2001, en lo que * ha derechos de propiedad o posesión definitiva respecta. Referente a la CONTRADEMANDA planteada por el señor [Nombre2] en contra del señor [Nombre1] , SE DECLARA SIN LUGAR EN TODOS SUS EXTREMOS PETITORIOS. Tanto la demanda como la reconvención, se resuelven sin especial condenatoria en costas" (ver resolución a folios 327 al 345). *
  7. 7La parte actora reconvenida, el codemandado reconventor* [Nombre2] y el codemandado El Estado mediante representación ejercida por la Procuraduría General de la República interpusieron recurso de apelación con indicación expresa de las razones en que se apoyaron para refutar la tesis del juzgado de instancia (ver escritos a folios 346 al 379). *
  8. 8En la substanciación del proceso no se han observado las prescripciones legales y se observa la existencia de errores u omisiones capaces de producir la nulidad del fallo. Redacta la Jueza Rojas Madrigal, y, *

* * CONSIDERANDO:*

I.Por la forma en la que se resuelve, se omite pronunciamiento sobre los hechos probados y no probados de la resolución recurrida. *

II.El Juzgado Agrario del Segundo Circuito Judicial de la Zona Atlántica, Guápiles en sentencia número 106-2012 dictada a las quince horas y once minutos del veinticuatro de julio del dos mil doce denegó las excepciones de prescripción, falta de derecho, falta de interés actual, falta de causa y falta de legitimación activa y pasiva; en su lugar declaró parcialmente con lugar la demanda. En cuanto a la contrademanda* se declaró sin lugar en todos sus extremos. Tanto la demanda como reconvención se resuelve sin especial condenatoria en costas. *

III.La parte actora presentó recurso de apelación aduciendo lo siguiente: Se encuentra disconforme con la exoneración en costas en el presente proceso, debido a que ante la negatoria del demandado de reconocer su derecho se vio obligado a presentar la demanda, por lo que procede la condenatoria en costas. Agrega, de la prueba evacuada se desprende la actividad agraria en el fundo, concretamente de ganadería, actividad que tuvo que cesar lo que le generó daños, por lo que es procedente la condenatoria en abstracto de los mismos para liquidar en ejecución de sentencia. *

IV.Por su parte, el Defensor Público del codemandado reconventor* Luis Alberto Jiménez Vargas interpuso recurso de apelación con nulidad, argumentando lo siguiente: Motivo de nulidad: En el proceso se ordenó traer como demandados al Estado y a JAPDEVA por considerar el a quo que al ser dueños registrales de los terrenos en donde se ubica la finca del actor, se les podría generar perjuicio en caso de no ser traídos al proceso. Sin embargo, en la misma sentencia el a quo constató que el plano catastrado H-732985-2001 también se sobrepone a los planos H-747544-1988, H-747545-1988 y H-893924-1990, los cuales, corresponden a las fincas inscritas números 4-130557-000, 4-134654-000 y 193176-000, por lo cual existe litisconsorcio pasivo necesario con los dueños registrales de dichas fincas, pues el resultado del proceso les puede causar perjuicio al estar alegando el actor derechos de posesión y propiedad sobre sus fincas.

En cuanto a los agravios de fondo, expuso: UNO: INCONFORMIDAD EN CUANTO A LOS HECHOS PROBADOS Y NO PROBADOS: Respecto a los hechos probados; el a quo incurre en una inadecuada e incorrecta valoración de la prueba y ello viene a tener por demostrado el hecho probado número cuatro, sin embargo de las probanzas aportadas al expediente el actor no demuestra que el contenido del documento referido en la escritura pública número cuarenta y ocho del protocolo de la Notaria Pública Rita María Herrera Duran, sea la constitución de una servidumbre de paso constituyéndose ésta en afectación sobre la finca inscrita en el Partido de Heredia, descrita en el plano H-33279-1992, con matrícula de folio real [Placa1], pues no se indicó el número de plano, ni el número de finca y además nunca se inscribió ninguna afectación sobre la finca debidamente inscrita a nombre de mi representado. Lo mismo sucede en el hecho cinco, debido a que la declaración de los testigos no coincide con la realidad de la finca de su patrocinado, pudiendo demostrarse con el estudio detallado del video del reconocimiento judicial.

El día del reconocimiento el actor ni sus abogados quisieron continuar el recorrido y en su lugar, enviaron a un empleado para que señalara la servidumbre, sin embargo, no supo indicar de modo alguno, cuál era el trayecto correcto, debido a que los lugares donde se llegó eran las fincas de los colindantes y nunca a la finca del actor. Además, al llegar a un sector de charrales frente a un río, el empleado del actor no pudo demostrar si ya se había salido de la finca del demandado, tampoco se indicó en donde iniciaba la finca del actor, ni si habían pasado la finca de algún otro colindante. Por ello, el a quo no puede tener por acreditada las versiones de los testigos del actor. Agrega, al inicio el empleado del actor y guía del reconocimiento, los llevó a otro sector completamente alejado y distante del sector del río visitado y les dijo que esa era la servidumbre. A parte de ello, el actor en la prueba confesional reconoce que la servidumbre que reclama es la que está totalmente limpia, o sea el primer lugar donde los llevó el empleado o chofer del actor, pero dicho recorrido en ningún momento llega ni a la finca del actor y mucho menos a la finca del colindante [Nombre5] , ello se puede tener por acreditado en el mismo reconocimiento judicial en donde valga decir se observaba que la limpieza que se le hizo al camino interno de la finca del demandado era reciente.

En cuanto al hecho sexto, si el juez agrario tuvo por acreditado que el actor y sus antecesores sacaron madera, más bien debió testimoniar piezas en contra del mismo pues dichos terrenos se encuentran en áreas protegidas del Estado y dentro de la [Dirección1] . Continua manifestando que no se puede tener por demostrado el hecho sétimo, en virtud de que los testigos que describe son complacientes, al tener un interés directo en las resultas de este proceso por manifestar que quieren también salir por la finca del demandado, por ende su declaración no puede merecer credibilidad. En lo que respecta al hecho ocho tampoco procede, ya que una cosa es lo que refieren los supuestos testigos y otra la realidad encontrada en el reconocimiento judicial, pues de dicha diligencia realizada por el juez agrario se desprende con claridad que ni siquiera se pudo ubicar el supuesto punto de acceso de la finca del actor hacia la supuesta servidumbre, ni rastros de la misma frente a su finca.

Agrega, no es correcto lo manifestado por el a quo al tener por probado el hecho once, pues la prueba se debe analizar en conjunto y del reconocimiento judicial y la prueba confesional recibida al actor, es claro que ni él actor mismo conoce y no ha transitado por la supuesta servidumbre en más de diez años, pues él declaró bajo la fe de juramento que la servidumbre que reclama es la que está limpia y en el reconocimiento judicial se demuestra que el camino que está medio limpio llega al final de la finca del codemandado [Nombre2] en la colindancia con otro vecino y no con el actor, además dicha colindancia está ubicada en un lugar alejado a la finca del actor, siendo que de la zona limpia no hay acceso con evidencias o rastros de camino o servidumbre hacia la finca del actor. Por ello el reconocimiento es el que en este caso tiene preponderancia al ser analizado en concordancia con la prueba confesional del actor y no los testimonios de los testigos, pues estos son complacientes y nunca detallaron con certeza en donde inicia la servidumbre, su trayecto y descripción.

Refiriéndose a los hechos no probados; expuso no es correcto afirmar que el codemandado [Nombre2] no demostró la no utilización de la supuesta servidumbre en más de diez años, pues del mismo reconocimiento se desprende que la servidumbre no existe. Ello aunado a que en la prueba confesional el actor reconoció haber declarado bajo la fe de juramento en un proceso de información posesoria la posesión decenal de su finca y que el acceso decenalmente lo ha sido por la servidumbre que describe el plano 4-732985-01 en el [Dirección3] , con lo cual se desprende con claridad que la supuesta servidumbre que reclama en este proceso no la utiliza en más de diez años. Tampoco se puede tener por acreditado el hecho dos, ya que del mismo escrito en el que se hace referencia a una supuesta constitución de una servidumbre, no se indica el plano ni el folio real de la finca sobre la cual se impone el gravamen de la servidumbre.

Al respecto inobserva el a quo el contenido del artículo 455 del Código Civil, en relación con el numeral 459 ibídem, inciso 1 y con el 267. Por el contrario, el actor no demostró que el documento cuestionado haya afectado a la finca descrita en el plano H-33279-1992, con matrícula de folio real [Placa1]. El a quo incurre en una indebida valoración de la prueba al tener por acreditado que las servidumbre afecta a la finca debidamente inscrita a nombre del codemandado, debido a que en la prueba confesional el actor declaro bajo la fe de juramento que la servidumbre que él reclamaba es la recorrida por el juez y que se encontraba limpia y esa supuesta servidumbre que se recorrió y que estaba limpia no termina en el [Dirección4] , sino en la finca de otro colindante que no es el actor. Por ende no hay identidad en lo reclamado por el actor según su declaración bajo la fe de juramento y la supuesta servidumbre que se describe en la escritura pública cuestionada.

También se equivoca el a quo al suponer que el citado documento en el que se describe una supuesta servidumbre afecta a la finca debidamente inscrita en el Registro Público a nombre del codemandado [Nombre2] , pues no se indica el plano del inmueble afectado ni el número de finca y no hay prueba en el expediente que lo demuestre. Igualmente no hay prueba testimonial que así lo acredite. Finalmente, en relación con las declaraciones testimoniales, el a quo le da credibilidad al testigo [Nombre6] , sin embargo dicho testimonio no fue analizado al tenor de la evidencia obtenida en el reconocimiento judicial, pues en el mismo se desprende la falsedad del testimonio al no existir ningún tipo de rastro o indicio de la existencia de alguna servidumbre que salga de la propia finca del actor en dirección a la finca de su patrocinado; además de tener éste interés directo en el proceso. Igual ocurre con el testimonio de [Nombre5] y [Nombre7] , en virtud de que el primero de ellos no demuestra la existencia de la servidumbre pues no sabe ni el ancho ni el largo y no describe ni demuestra que el actor haya hecho uso de la misma.

Más bien dicho testigo declara sobre el acceso de servidumbre que su representado le vendió pero por otro sector de la finca y no el que está en litis. DOS: INCONFORMIDAD CON LO RESUELTO EN TORNO A LA PRESCRIPCIÓN ALEGADA: El documento mediante el cual el actor reclama la supuesta servidumbre está afectado por la prescripción decenal, por lo que el documento en el cual se consigna la supuesta existencia de la servidumbre ya está prescrito, pues han pasado más de diez años y no fue presentado ante el Registro Público de la Propiedad para inscribir el supuesto derecho real que contiene. TRES: INCONFORMIDAD POR RECHAZO DE LAS EXCEPCIONES OPUESTAS A LA DEMANDA POR INDEBIDA VALORACIÓN DE LA PRUEBA: Existe una inadecuada valoración de los hechos, de las pruebas y del derecho a aplicar al rechazar las excepciones interpuestas por esta representación. El actor no tiene legitimación para venir a demandar la constitución de una servidumbre o el reconocimiento de una supuesta servidumbre que según él existe a favor de la finca descrita en su plano, pues se demostró tanto por el Estado como por la Junta de Administración Portuaria de la Vertiente Atlántica y por la parte demandada que el promovente* alega posesión de un inmueble inalienable que está inmerso en la zona fronteriza y forma parte además de la finca debidamente inscrita a nombre de JAPDEVA y se encuentra afectado por el Refugio de Vida Silvestre Maquenque, hecho que viene a desvirtuar la legitimación del actor en este proceso, pues pide se constituya o ratifique una supuesta servidumbre a favor de un terreno del cual él no es el dueño, por lo cual al tratarse de bienes de dominio público es un inmueble que no es susceptible de posesión por parte de particulares.

Conforme a ello, están los artículos 370, 371 y siguientes del Código Civil, los cuales, señalan que las servidumbres no pueden imponerse en favor ni a cargo de una persona, sino solamente en favor de un fundo o a cargo de él y no pueden separarse del mismo. Al resolver de esa forma está enajenando un bien de dominio público y quebranta con ello lo dispuesto en la Ley de la Administración Financiera de la República que establece en su artículo 97 una serie de requisitos a cumplir en casos de enajenación de bienes inmuebles de dominio público. CUATRO: INCONFORMIDAD POR INSCRIPCIÓN REGISTRAL DE LA SERVIDUMBRE: No procede la imposición e inscripción de ningún tipo de gravamenes, debido a que el actor nunca demostró que la supuesta escritura sea una constitución de servidumbre sobre la finca inscrita a nombre del codemandado, pues no hay prueba que lo demuestre. Además dicho documento está prescrito al tener el citado documento más de diez años sin haberse inscrito en el Registro Público de la Propiedad.

CINCO: INCONFORMIDAD POR RECHAZO DE LA CONTRADEMANDA: Se realiza una incorrecta valoración de la prueba, debido a que el a quo no analiza para efectos de resolver la contrademanda, el reconocimiento judicial ni la declaración confesional de ambas partes, pues de la misma se desprende que la finca debidamente inscrita a nombre del codemandado no fue gravada con ninguna servidumbre y se demuestra que dentro de la citada finca no existen rastros o indicios de que exista servidumbre alguna que provenga de la finca del actor. Por el contrario, el codemandado demuestra que sobre el folio real de su finca no existe y no se ha representado ninguna inscripción de gravamen de servidumbre por parte del actor y el actor no logra demostrar que sobre la finca de folio real su patrocinado se haya obligado a imponer alguna servidumbre. El a quo no fundamenta con base en normas legales la razón del por qué deniega las pretensiones de la contrademanda, no analiza la prueba aportada. *

V.El licenciado Víctor Bulgarelli Céspedes, Procurador Agrario en representación de la Procuraduría General de la República presentó recurso de apelación exponiendo lo siguiente: 1.- El actor afirmó ser titular y poseedor del terreno sin inscribir descrito en el plano H-723985-2001, cuyos derechos de posesión adquirió de [Nombre4] y sostuvo haber protegido y mantenido el bosque, a lo cual, el Estado hizo ver la imposibilidad de adquirir derechos de posesión sobre el demanio público, pues el terreno descrito está en un 54% dentro de la zona fronteriza norte, declarada indenunciable desde 1988 y además declarada Refugio Nacional de Vida Silvestre. La condición de Patrominio Natural del Estado también la comparte el Refugio Mixto de Vida Silvestre Maquenque comprendiendo en un 46% el área del plano H-732985-2001. Esa defensa es coincidente con la sentencia constitucional 9305-12, la cual denegó el agravio de un particular sobre un terreno ubicado dentro del Refugio Nacional de Fauna Silvestre Corredor Fronterizo Norte, sin embargo la resolución recurrida reconoció el gravamen sobre el fundo dominante indicando que era sin perjuicio de los derechos eventuales que puedan corresponder al Estado; por lo que la resolución recurrida es incongruente, contradictoria y confusa. 2.- Se cuestiona también la legitimación activa del actor, al señalar que para requerir judicialmente el reconocimiento de un derecho real limitado y una servidumbre de paso acordada por convenio, se exige ostentar la condición de dueño o propietario del fundo dominante conforme a los numerales 372, 381 inciso 3 y 4, 856 y 860 del Código Civil, igual requisito debe observarse para exigir la imposición de la obligación de paso.

El Tribunal Agrario en sentencia 222-1998, que cita el a quo, participa de esa condición al señalar que el titular de la servidumbre es sobre todo el actual dueño, tesis que refleja la Sala Primera; por lo que la resolución recurrida reconoce que el régimen de servidumbres se otorgan a favor de predios respecto a los cuales se ejerce el derecho de propiedad, pero pese a ello, en el proceso no se recibió ninguna prueba que acredite que el actor ha poseído decenalmente el terreno sin inscribir y a título de dueño con anterioridad a la normativa que lo afecta al dominio público. La efectación a dominio público de la franja fronteriza desde el siglo XIX imposibilita la demostración de la usucapión con la prueba testimonial. Por ello, resulta improcedente reconocer servidumbe de paso para ingresar al Patrimonio Natural del Estado cuando el actor no demostró un título habilitante, sea de propiedad legítima y previa, o concesión o permiso de uso del órgano encargado de su administración para la ocupación del bien de dominio público.

Además, el actor reconoció la extracción de madera en el supuesto fundo dominante sobre el que alegó ser titular y legítimo poseedor, aspecto que se tuvo por probado en la sentencia, sin embargo, no consta en el expediente los permisos de aprovechamiento forestal para la corta, por lo que tampoco se acreditó el ejercicio de la posesión protectora de los recursos naturales en las áreas silvestres protegidas, debiéndose rechazar lo afirmado en la demanda sobre la protección y mantenimiento del bosque. 3.- Se tuvo por probado en la sentencia que la finca sobre la cual el actor alega ser titular y legítimo poseedor agrario es la descrita en el plano H-732985-2001 y que derivó los derechos posesorios del inmueble por compra al señor [Nombre4] el 28 de noviembre del 2000, transmitiéndosele la posesión particular de tres fundos con cabidas de 31, 88 y 119 hectáreas. Lo anterior, infringe diversas disposiciones jurídicas que afectan al dominio público, debido a que de acuerdo con el principio de inmatriculación se consolida con la declaratoria y afectación por ley sin necesidad del acto de inscripción registral de jerarquía inferior, por lo que igualmente se acusa violación directa de dicha normativa reseñada, en tanto la sentencia califica como dominio público únicamente los terrenos inscritos a nombre de JAPDEVA, siendo que igualmente comparten ese atributo el Refugio Nacional de Vida Silvestre Corredor Fronterizo, comprendido por la superficie del plano H-732985-2001 en un 54% y por el Refugio Mixto de Vida Silvestre Maquenque en el 46% restante.

Ello, debido a la ausencia de demostración de la posesión decenal a título de dueño y previa a la afectación demanial, por lo que a nada conduce la cita de las sentencias sobre la existencia de servidumbres en áreas silvestres protegidas, pues refiere a supuestos diversos donde las partes ostentaban título de propiedad. Además, el Estado no fue parte del convenio particular del 28 de noviembre del 2000, por lo que no le resulta aplicable. La normativa que tutela el demanio estatal y la jurispruedencia que la informa, deniega a ese tipo de contratos valor para derivar derechos privativos legítimos, por lo que la causa y contenido de tales negocios estarán siempre viciados de nulidad. 4.- Agrega, que atenta contra la seguridad jurídica y las reglas de la ciencia y de la técnica, reconocer una servidumbre a favor de un terreno sin inscribir, describiendo un trazo que no es el coincidente con el supuestamente convenido, quebrantando la ley sustantiva por error en la valoración de la prueba.

En la diligencia del reconocimiento no se tuvo claridad del rumbo que tomaba la servidumbre cuando llegaba al caño Tambor, ya que no se encontró el puente ni siquiera se recorrió el terreno descrito por el plano H-732985-2001, la persona que guió el reconocimiento manifestó no saber avanzar, aunado a ello no hay conexión de sur a norte entre los terrenos, pues el terreno descrito por el plano H-732985-2001 está al oeste del plano H-33279-1992, no son contiguos sino que entre ellos hay un kilometro de distancia, área donde se encuentra la propiedad de JAPDEVA y la franja fronteriza. El trazado del caño [Nombre3] en las hojas cartográficas muestran que, aunque los planos catastrados H-732985-2001 y H-33279-1992 colindan con ese afluente al sur y norte, lo hacen en ubicación lateral y no uno encima del otro, ambos están ubicados justo por debajo de la coordenada geográfica horizontal 302, la colindancia con el caño [Nombre3] es en distintos sectores de su cauce.

No opera como conexión entre los terrenos, por lo que técnicamentre tampoco es de recibo la petición de reconocerse la constitución de una servidumbre de paso de aproximadamente 1500 metros de longitud y que correrá de sur a norte del río Colpachí al río [Nombre3] a favor del terreno sin inscribir descrito en el plano catastrado H-732985-2001. VI.- El ordinal 26 de la Ley de Jurisdicción Agraria establece, los tribunales por iniciativa propia podrán declarar nulidades y disponer la reposición de trámites, con la finalidad de corregir irregularidades que pudieran afectar la válidez del proceso. En otro orden, en materia recursiva, y a mayor abundamiento de razones, el numeral 60 del cuerpo legal en cita, señala el trámite se regirá en lo pertinente por las disposiciones del Código de Trabajo. El artículo 502 del código citado, expone, recibidos los autos en el Tribunal, éste revisará en primer término los procedimientos; y si encontrare que se ha omitido alguna formalidad capaz de causar efectiva indefensión, decretará la nulidad de actuaciones o de resoluciones que proceda y hasta donde sea necesario para orientar el curso normal del juicio. *

VII.Encuentra el Tribunal que el fallo recurrido adolece de ciertos vicios, pues no cumple con lo preceptuado en nuestro ordenamiento jurídico, dejando a las partes en estado de indefensión, por violación al derecho de defensa y el debido proceso. La misión de administrar justicia no debe ir en detrimento de las formas -y también la sustancia- de las sentencias, que garantizan el debido proceso y la posibilidad de defensa técnica. El vicio de nulidad detectado radica en que, como bien lo alega el codemandado [Nombre2] , dentro del procedimiento no se ordenó la integración de la litis consorcio pasivo necesario contra los titulares de las fincas [Dirección5], [Dirección6], [Dirección7]; ello debido a que según se desprende del informe catastral aportado como prueba a los autos, el terreno poseído por el actor aparentemente presenta un posible traslape con varias fincas inscritas. Obsérvese, en este proceso, el actor reclama el reconocimiento de una servidumbre a favor del inmueble sin inscribir que posee graficado mediante el plano catastrado H-732985-2001, misma que pesará contra la finca del codemandado [Nombre2] , inscrita en el Partido de Heredia, matrícula [Placa1] y descrita mediante el plano catastrado número H-0033279-1992.

Sin embargo, según se determinó mediante informe emitido por el Catastro Nacional, la propiedad que corresponde al plano H-732985-2001 presenta un posible traslape con los planos catastrados números H-747544-1988, H-893924-1990, H-747545-1988 y H-1-1977; los cuales, corresponden a las fincas inscritas matrículas [Placa3], [Placa4], [Placa5] y [Placa6] respectivamente. Además, traslapa con los planos H-267079-1995 y H-715294-1987, los cuales, a la fecha de emisión del citado informe, no habían generado título (ver informe catastral a folios 201 al 202). La finca matrícula [Placa3] se encuentra a nombre de la Sociedad Conservación Ambiental RAMA Sociedad Anónima; la finca matrícula [Placa4] se encuentra inscrita a nombre de [Nombre8] , la finca [Placa6] está a nombre de la Junta de Administración Portuaria y de Desarrollo Económico de la Vertiente Atlántica (JAPDEVA) y la finca matrícula [Placa5] anteriormente se encontraba a nombre de Sociedad Conservación Ambiental RAMA Sociedad Anónima (ver informes registrales* a folios 132 y 209 al 215); sin embargo, ante consulta realizada en el Registro Nacional, Sección Bienes Inmuebles, se determinó que el último inmueble citado actualmente se encuentra inscrita a nombre de la Sociedad Gogo* Roemy San Carlos Sociedad Anónima (ver consulta electrónica del Registro Nacional, Sección Bienes Inmuebles, de fecha 26 de febrero del 2013).

Por su parte, el codemandado [Nombre2] señaló claramente en el escrito de contestación de demanda la necesidad de realizar la integración de litis contra los titulares de dichos inmuebles al oponer la excepción de litis consorcio pasivo necesario (ver escrito a folio 77); pero el a quo al resolver dicha excepción mediante resolución de las siete horas con ocho minutos del dos de junio del dos mil diez ordenó únicamente la integración de litis consorcio contra el Estado y JAPDEVA, rechazando la integración contra las demás personas que tenían la titularidad de las demás fincas inscritas al argumentar que de llegarse a dictar una sentencia en favor de la parte actora, el único fundo que se estaría gravando sería el suyo (demandado), pues, es el fundo sirviente al que se le impone la carga, y no al servido que es la condición que tiene el fundo del actor en este proceso, por lo que no se le estaría causando un gravamen, sino un beneficio (ver resolución a folios 94 al 96).

El argumento del a quo al rechazar la integración de litis contra los titulares de las demás fincas inscritas no es procedente, debido a que al ser una servidumbre un derecho real sobre inmuebles, para su constitución se requiere necesariamente el consentimiento de ambas partes, tanto del dueño del fundo sirviente como del fundo dominante y en caso de aceptarse la misma, ambos inmuebles deben soportar la respectiva anotación. Sobre el tema, Manuel Albaladejo* ha expuesto: “Para constituirlas es preciso tener capacidad para disponer por el acto de que se trate del bien sobre el que se establecen, y que correspondan al constituyente las facultades que la servidumbre que sea (sic) otorga sobre la cosa gravada´(Albaladejo*, Manuel. Derecho Civil III. Derecho de Bienes, Volumen segundo, octava edición, José María Bosch* Editor, S.A, 1994, pág. 129). Con fundamento en lo expuesto, en este caso, al no existir certeza sobre el posible traslape del inmueble del actor con las fincas inscritas citadas anteriormente, el a quo debió ordenar la integración de litis consorcio pasivo necesario contra ellos, a efectos de evitar cualquier tipo de afectación directa a sus intereses y derechos, debiendo concedersele traslado del presente proceso, para que puedan apersonarse al mismo y hacer valer sus derechos, si a bien lo tienen.

Lo anterior resulta lesivo al debido proceso, por lo que esta Sede estima que procede la nulidad del fallo recurrido y además, se revoca parcialmente la resolución de las siete horas ocho minutos del dos de junio del dos mil diez, únicamente en cuanto rechazó la excepción de litis consorcio pasivo necesario de los titulares de los inmuebles 130557-000, 134654-000 y 193176-000. En su lugar, se ordena al actor-reconvenido [Nombre1] para que, dentro del plazo de ocho días, proceda a integrar la litis consorcio pasivo necesario respecto a la Sociedad Conservación Ambiental RAMA Sociedad Anónima, Sociedad Gogo* Roemy San Carlos Sociedad Anónima y [Nombre8] , debiendo cumplir dicho escrito con todos los requisitos de ley, bajo apercibimiento de dar por terminado el proceso. Por la forma en la que se resuelve, se omite pronunciamiento en cuanto a los agravios de fondo expuestos por los recurrentes. *

* * POR TANTO:* Se anula la sentencia número 106-2012 de las quince horas y once minutos del veinticuatro de julio del dos mil doce y se revoca parcialmente la resolución de las siete horas ocho minutos del dos de junio del dos mil diez, únicamente en cuanto rechazó la excepción de litis consorcio pasivo necesario de los titulares de los inmuebles ciento treinta mil quinientos cincuenta y [Dirección8] cero cero, ciento treinta y cuatro mil seiscientos cincuenta y cuatro- cero cero* cero y ciento noventa y tres mil ciento setenta y seis- cero cero* cero. En su lugar, se ordena al actor-reconvenido [Nombre1] para que, dentro del plazo de ocho días, proceda a integrar la litis consorcio pasivo necesario respecto a la Sociedad Conservación Ambiental RAMA Sociedad Anónima, Sociedad Gogo* Roemy San Carlos Sociedad Anónima y [Nombre8] , debiendo cumplir dicho escrito con todos los requisitos de ley, bajo apercibimiento de dar por terminado el proceso.
