Objection deniedExcepción rechazada

The Court denied the jurisdictional objection because the dispute concerns private contracts, property rights, and cultivated agrarian land rather than a challenge to any administrative act.

SummaryResumen

The Agrarian Court rejects Banco Nacional’s objection to subject-matter jurisdiction and keeps the proceeding within the agrarian courts. The claimant seeks annulment of a private sale of real property and, consequently, of the mortgage granted to the bank, alleging that the power of attorney used for the transfer was invalid. The Court distinguishes this dispute from cases challenging the legality of an administrative act: the controversy concerns property rights, financial consequences, and the validity of contracts between private parties. A public institution’s participation as mortgage creditor does not transform the case into an administrative-law dispute. Moreover, the property is agrarian land cultivated almost entirely with hearts of palm, reinforcing the specialized agrarian character of the matter. The decision also reviews precedent concerning agrarian administrative acts and reaffirms that jurisdiction depends primarily on the agrarian nature of the subject matter rather than on whether a public or private entity appears as a party.

Key excerptExtracto clave

VI.- In light of the foregoing, in this ordinary agrarian proceeding filed by [Name1], represented by the agrarian public defender’s office, the dispute is purely patrimonial and concerns property rights. The claimant asserts rights over the real property registered in Limón under parcel number [Plate1] and therefore seeks annulment of the deed through which [Name2] sold it to Hacienda El Coyol de Palmito Sociedad Anónima, alleging that the power of attorney used to make that transfer was invalid. In other words, she seeks annulment of a purely private contract. She further requests that, as a consequence, the mortgage in favor of Banco Nacional be declared void. The record also shows that the land at issue is agrarian property cultivated almost entirely with hearts of palm. As can be seen, the annulment of an administrative act is not under discussion, and therefore the matter cannot be characterized as administrative-law litigation. This is a dispute between private parties involving the grant of a security interest in favor of Banco Nacional, but that does not deprive the matter of its agrarian character.- THEREFORE: The objection to subject-matter jurisdiction raised by co-defendant Banco Nacional de Costa Rica is rejected.VI.- En relación a lo expuesto, tenemos que en el presente proceso ordinario agrario, interpuesto por [Nombre1] , representada por la defensa pública agraria, la discusión es puramente de carácter patrimonial y de derechos reales.

Heard before the Agrarian Court of the Second Judicial Circuit of the Zona Atlántica.* This Court hears the objection for lack of subject-matter jurisdiction (excepción de incompetencia por razón de la materia) raised by the co-defendant Banco Nacional de Costa Rica. * Drafted by Judge ULATE CHACÓN, and, * WHEREAS:*

I.The objection for lack of subject-matter jurisdiction (excepción de falta de competencia material) was timely filed by the representative * of Banco Nacional, [Nombre3] (folios 52-53), on 15 de noviembre del 2012, given that the parties were served notice on 20 de noviembre del 2012. He argues that the matter must be heard in the Contentious-Administrative jurisdiction (jurisdicción Contencioso-Administrativa), since, pursuant to Article 1 of the Code of Contentious-Administrative Procedure (Código Procesal Contencioso Administrativo), that jurisdiction is responsible for protecting individuals’ legal positions, and for ensuring or restoring the legality of any conduct by the Public Administration subject to Administrative Law, as is the case with the party he represents, Banco Nacional. *

II.Before ruling on jurisdiction (competencia) in this specific case, it is important to mention the judicial precedents (criterios jurisprudenciales) that have existed regarding the conflict between agrarian and contentious-administrative matters. In Voto No. 91 de las 10 horas del 15 de febrero de 1994, reiterated in No. 102 de las 9:50 horas del 10 de marzo de 1999, the Court stated as follows: VI.- For some time, our case law has been defining the boundaries of agrarian matters. The fundamental aspect that has prevailed in doing so is the criterion of agrarian activity (actividad agraria), which is the minimum common denominator of the institutions of Agrarian Law (Institutos del Derecho Agrario). Nevertheless, there are still aspects that have not been clearly defined, one of which concerns precisely those cases or proceedings in which a public entity of the State is a party (as the Instituto de Desarrollo Agrario might be) and matters related to agrarian legislation or to one of the institutions of our discipline are disputed; the issue arises not so much when the State’s property regime (régimen patrimonial del Estado) is at issue (through civil treasury proceedings (vía civil de hacienda)), but primarily when the annulment of acts or provisions of the Public Administration is sought.

Initially, the First Chamber of the Supreme Court of Justice held, in judgments No. 117 de las quince horas del seis de setiembre de mil novecientos ochenta y cinco and No. 175 de las dieciséis horas cuarenta y cinco minutos del tres de diciembre de mil novecientos ochenta y seis, that jurisdiction to hear and decide cases brought against the Instituto de Desarrollo Agrario lay with the Contentious-Administrative Jurisdiction (Jurisdicción Contencioso-Administrativa). Subsequently, in decisions No. 114 de las quince horas treinta minutos del diez de junio de mil novecientos ochenta y ocho and No. 149 de las quince horas cincuenta y cinco minutos del trece de julio de mil novecientos ochenta y ocho, it was held that such cases had to be heard within the Agrarian Jurisdiction (Jurisdicción Agraria), stating as follows: “Indeed, the Agrarian Jurisdiction is mandatory and must be exercised by courts specialized in the subject matter, regardless of the parties appearing in the proceedings, pursuant to articles 5 and 15 of the Law under discussion.

Consequently, in determining which court has jurisdiction to hear a case, whether the Administration is the plaintiff or defendant is of secondary importance, since the proceedings must always be governed by the principles applicable to agrarian procedure, such as orality, immediacy or direct examination of evidence (inmediatéz o inmediación de la prueba), which provide the basis for article 48 ibídem. Thus, the mere fact that an administrative act is challenged or its annulment sought does not mean that the case must be brought before the contentious-administrative jurisdiction, because the controlling factor is the agrarian subject matter, not the status of a party as a public entity. Therefore, if the case falls within those contemplated by articles 1 and 2 of the Law of Jurisdiction and the doctrine underlying it, jurisdiction to hear it lies with the Agrarian Courts.” (emphasis* not in the original).

However, none of the aforementioned decisions drew a clear distinction between contentious proceedings properly belonging to civil treasury proceedings and full-jurisdiction contentious proceedings (procesos Contenciosos de Plena Jurisdicción) or proceedings for the annulment of acts issued by the Public Administration. In judgment No. 183 de las quince horas cinco minutos del treinta y uno de octubre de mil novecientos noventa, the First Chamber established, for the first time, a distinction between those types of proceedings. Regarding full-jurisdiction “AGRARIAN” contentious proceedings (proceso Contencioso “AGRARIO” de Plena Jurisdicción), it stated as follows: “I.- Agrarian contentious proceedings are proceedings established by the Ley Reguladora de la Jurisdicción Contencioso Administrativa, No 3667 del 6 de setiembre de 1968, over which the agrarian jurisdiction has authority when the subject matter in dispute pertains to Agrarian Law.

Specifically, this applies when the case concerns the application of current agrarian legislation, or arises from the various activities carried out by an agrarian enterprise (empresa agraria) (the primary activity of production and the related activities of processing, industrialization, or marketing of agricultural products), or when agrarian contracts (contratos agrarios), ownership, possession, or any of the legal institutions of the discipline are at issue. It is a proceeding that does not lose the nature with which it was conceived, but whose adjudication was entrusted by the legislature to the Agrarian Judge because of the specialized rules that must be applied and interpreted. This is provided for in ela article 79 of the Ley de Jurisdicción Agraria. That Law, logically, because it dates from mil novecientos ochenta y dos, is subsequent to the law governing contentious-administrative matters.

In this regard, regardless of whether a public entity participates in the proceedings, the specialized nature of agrarian matters draws contentious-administrative matters into its jurisdiction—as has also occurred with matters previously treated as civil, commercial, criminal, and others, with the sole exception provided for by law, namely labor matters—because the fact that an entity is administrative in nature does not mean that it is subject solely and exclusively to that jurisdiction, as indeed occurs in matters in which the State is a party before other specialized jurisdictions, such as labor or traffic jurisdictions. Agrarian contentious proceedings have solid legal roots in both laws, with the already prescribed procedure being understood to apply, but necessarily adapted to the principles specific to Agrarian Procedural Law (Derecho Procesal Agrario), such as oral proceedings (verbalidad), which permit evidentiary proceedings to be conducted expeditiously and promptly and allow the inherent principles of immediacy and concentration (concentración) to operate more efficiently.

In these proceedings, however, the Judge must also take a more active role, moving the case forward without having to await a party’s application; the Judge may order evidence whose inclusion in the proceeding is deemed important for approaching the discovery of substantive truth, rather than merely formal truth; the rules are to be interpreted very broadly, without strict adherence to the rules of ordinary law; and it is also important to incorporate into agrarian contentious proceedings the principle of free access to justice (principio de gratuidad de la justicia), in its dual sense that no payment is required for any judicial act and no security for costs (afianzamiento de costas) is required.”

Those decisions clarify that when the legality of acts and provisions of the Public Administration subject to Administrative Law is disputed, the procedure prescribed by the Ley Reguladora de lo Contencioso Administrativo must be applied, together with the principles specific to agrarian procedural law. They likewise establish that: “With respect to proceedings heard before the contentious-administrative jurisdiction whose designation places them within civil treasury proceedings, because they are essentially ordinary proceedings (juicios ordinarios), and given that the Ley de Jurisdicción Agraria has provided a specific procedure for such cases, the proper course is to pursue ordinary agrarian proceedings (ordinario agrario) within this jurisdiction, rather than the procedure under the Ley Reguladora de la Jurisdicción Contencioso Administrativa.” “In addition to the foregoing, agrarian contentious proceedings shall concern only matters arising from acts of the Public Administration to which Administrative Law applies, which is not the case in civil treasury proceedings, whose subject matter concerns the property regime or the liability of the State and public institutions, or their status under Private Law, even though, logically, rules of Public Law may be involved.” VII.-In decision No. 148 de las quince horas del once de setiembre de mil novecientos noventa y uno, the First Chamber of the Supreme Court of Justice changed its position with respect * * to contentious-administrative annulment proceedings (Proceso Contencioso-Administrativo de anulación), conferring jurisdiction upon the Contentious-Administrative Jurisdiction.

In that decision, the majority held as follows: “The majority of the Chamber considers that jurisdiction to hear the present ordinary contentious-administrative proceeding lies with the Juzgado Segundo de lo Contencioso Administrativo y Civil de Hacienda, where it was filed and has remained pending, because it is a full-jurisdiction contentious-administrative proceeding, in which a declaration is sought, ‘on the basis of the Ley Reguladora de la Jurisdicción Contenciosa Administrativa...,’ among other things, that: decrees numbers 16306-G and 16307-G del dieciséis de mayo de mil novecientos ochenta y cinco are null and void because they incorporated into the Reserva Indígena de Talamanca* new privately owned areas without establishing the corresponding compensation; and that, because the aforementioned Decrees are null and void, Decreto No. 16323-G del veinte de diciembre de mil novecientos ochenta y cinco, which ordered the repeal of Decreto No. 16410-G del seis de junio de mil novecientos ochenta y cinco (which had ordered the expropriation of certain lands for the Reserva Indígena), lacks a legal basis and must likewise be annulled.

In addition to the aforementioned annulments, a declaration is also sought that the State and the Comisión Nacional de Asuntos Indígenas compensate* the plaintiff for the value of the lands and timber, interest, and damages; it later states: ‘V.- If we analyze the answer to the complaint (contestación a la demanda), we will also note that the arguments advanced in opposition to the claim fall within the field of Administrative Law. Certainly, matters concerning the nullity of the challenged decrees or their legality, as well as the public interest manifested by the actions of the State in creating the Reservas Indígenas and embodied in administrative laws and administrative decrees, and matters concerning possible expropriations, are matters of concern to Public Law and, specifically, Administrative Law. There is only an indirect relationship with Agrarian Law insofar as the plaintiff company is said to be an agroforestry enterprise, but this does not preclude its interests concerning the annulment of the challenged Executive Decrees and the alleged liability of the defendant public entities from having to be adjudicated in the contentious-administrative forum, where they properly belong.’” On this occasion, the minority dissenting opinion (Voto salvado de minoría) of the President of the Chamber, Lic. Edgar Cervantes, maintained the criterion or guidelines of the case law set forth in the preceding recital (considerando).

Other subsequent decisions have sought to maintain this new criterion. Thus, Judgment No. 202 de las catorce horas quince minutos del once de diciembre de mil novecientos noventa y uno stated as follows: “In the case under consideration (subjúdice), the claims of the Institute (IDA) do not seek the annulment of any administrative act, but rather of the conveyances made * between the defendants after the expropriation and cancellation of several properties. In cases such as the present one, this Chamber has repeatedly held that agrarian jurisdiction and authority are mandatory, that they must be exercised by courts specialized in the subject matter, and that the fact that the State or a public institution appears as a party does not preclude this.” And in decision No.

87 at thirteen hours and twenty minutes on treinta de junio de mil novecientos noventa y dos, stated as follows: “Through these proceedings, among other things, the plaintiff seeks a declaration of nullity of an administrative act issued by the Instituto de Desarrollo Agrario, by which he was ordered to vacate a strip of land seventy centimeters wide and eleven point forty meters long, situated along one of the boundaries of a lot he owns in Cariari de Guápiles, Limón, on which there is a dwelling and a commercial building. What is at issue is a small strip of land on which, moreover, no agricultural activity is conducted; hence, this is not a matter of an agrarian nature, but rather an administrative-litigation matter, since it involves a challenge to an administrative act. * Accordingly, jurisdiction over this matter must be declared to lie with the Juzgado Cuarto de lo Contencioso Administrativo y Civil de Hacienda.” VIII.- As * * we can see, conflicting theories have arisen within the Sala Primera de la Corte itself, which is ultimately responsible for resolving these jurisdictional disputes (conflictos de competencia).

This has prompted debate at the national level (See the Case Commentaries by Cesar Hines C. in Revista Ivstitia No. 64, page 12, and by Alvaro Meza Lázarus in Revista Ivstitia No. 68, page 18). Dr Rafael González Ballar, commenting on the judgment concerning agrarian administrative litigation (contencioso agrario), states as follows:* “From the passage transcribed, we can draw several important observations:* a-) first, it clearly defines a hybrid subtype of proceeding called ‘agrarian administrative litigation,’ b-) purportedly derived from the Ley Reguladora de la Jurisdicción Contencioso Administrativa (it is No. 3667 of 12 de marzo de 1966, and not as erroneously stated), c-) which then assumes the inherent nature of the statute from which it ostensibly originated (‘it is a proceeding established in the Ley Reguladora de la Jurisdicción Contencioso Administrativa... which does not lose the nature in which it was conceived...,’ the judgment states); ch) it must be subject to the principles and rules of agrarian procedural law (derecho procesal Agrario).

This is why, d) jurisdiction over it lies with the agrarian courts, fundamentally because of e-) the specialized nature of the rules applied and interpreted there. This, of course, applies f-) when the subject matter in dispute falls within Agrarian Law (Derecho Agrario). Therefore, g-) it is irrelevant whether a public entity participates in the ‘proceeding’ as a litigant... With respect to the foregoing enumeration, it must be made clear that our Ley Reguladora de la Jurisdicción Contencioso Administrativa neither expressly nor implicitly establishes a special procedure such as the one described. Except for the special judicial proceedings * established for tax matters, removal of directors, and preparatory and final acts in public procurement (contratación administrativa) (art. 82, 87 y 89), the procedure provided therein is single, unequivocal, and uniform. Thus, it cannot be asserted, as the judgment does, that the aforementioned ‘agrarian administrative litigation’ proceeding derives from our Ley Reguladora.

That proceeding, as is evident, is the result of the judgment itself and, in that sense, is of purely jurisprudential origin” (See GONZÁLEZ BALLAR* RAFAEL). “Integration for Agrarian Administrative-Litigation Proceedings.” In Derecho Agrario Costarricense, edited by [Nombre4], 1992, pp. 346-347. In our country, unlike the Venezuelan Agrarian Jurisdiction (Jurisdicción Agraria Venezolana), annulment proceedings in administrative litigation (proceso Contencioso de anulación) are not expressly contemplated as part of the Agricultural Cooperative (Cooperativa Agraria). Indeed, in Venezuela, the Ley Orgánica de Tribunales y Procedimientos Agrarios draws a clear distinction between full-jurisdiction Agrarian Administrative-Litigation Proceedings (Proceso Contencioso-Agrario en plena jurisdicción) and Agrarian Administrative-Litigation Annulment Proceedings (Contencioso Agrario de Anulación). With respect to the former, the scholarship states as follows: “If disputes between agricultural producers and agrarian administrative bodies constitute autonomous causes of action distinct from all other agrarian causes of action, which justifies speaking of the category of full-jurisdiction agrarian administrative litigation, the fact that the procedure through which such claims are pursued applies special rules that confer privileges upon those bodies also supports the proposition that such a category exists within agrarian matters.

Indeed, given their nature as true claims or prayers for relief (pretensiones), the applicable procedure is the same agrarian procedure, which is the labor procedure, unless the Ley Orgánica de * Tribunales y Procedimientos Agrarios and other special statutes establish special procedures for adjudicating the cause of action...” With respect to the latter, the scholarship states: “... pursuant to the provisions of article 2 of the Ley Orgánica * de Tribunales y Procedimientos Agrarios, agrarian matters also encompass actions for nullity (acciones de nulidad) against administrative acts issued by agrarian administrative bodies...” Thus, the Juzgado Superior Agrario de Caracas assumes the status of a Special Administrative-Litigation Court... Jurisdiction over this special administrative litigation is vested, at first instance, in the Juzgado Superior Agrario, seated in Caracas, and, at second instance, in the Corte Primera de lo Contencioso Administrativo, pursuant to article 28 of the Ley Orgánica de Tribunales y Procedimientos Agrarios.

In processing and deciding such proceedings, the aforementioned Court must apply, depending on whether the actions seek the nullity of acts having general or individual effects, the procedure prescribed for such actions in Sections Two, Three, and Four of Chapter II, Title V of the Ley Orgánica de la Corte Suprema de Justicia. In such proceedings, the Juzgado Superior Agrario may also exercise the authority and powers conferred upon it by the Ley Orgánica de Tribunales y Procedimientos Agrarios in all agrarian proceedings, namely those provided for in the articles...” (See DUQUE CORREDOR ROMAN) Derecho Procesal Agrario. Ed. Jurídica Venezolana, Caracas 1986, pp. 304, 309 y 311). (Emphasis added). Thus, in the Venezuelan Agrarian Jurisdiction as well, it takes the form of a hybrid proceeding in which the prescribed procedure must be followed, while the principles inherent to agrarian proceedings may also be applied.- IX.- As stated in the first recital (considerando), the ordinary complaint (demanda ordinaria) seeks recovery of damages arising from investments in cacao cultivation, which failed because the seed was not of good quality; the banking entities sued herein, which form part of the Sistema Bancario Nacional, and other State institutions participated as creditors in financing those activities.

This is undoubtedly a civil proceeding involving the public treasury (proceso civil de hacienda), which must be conducted in accordance with articles 38 and following of the Ley de Jurisdicción Agraria. * The situation would be different if the nullity of administrative acts issued by the defendant public entities were at issue, in which case the matter would indeed have to be adjudicated in the administrative-litigation jurisdiction (jurisdicción contencioso-administrativa)..´(END OF QUOTATION). III.- In other matters, the Tribunal has invoked, as its jurisprudential framework, * the guidance provided by the Sala Constitucional concerning the authority of other jurisdictions to hear claims against the State: “III.- Clearly, the issue is whether other ‘jurisdictions,’ apart from the administrative-litigation jurisdiction, would have authority to adjudicate the nullity of acts and contracts issued or entered into by the Public Administration (Administración Pública). * In a recent decision, the Sala Constitucional resolved that issue by stating as follows:* * ‘VII.- If the provision conferred the status of a subjective right (derecho subjetivo) upon the possibility of challenging unlawful acts “of the administrative function of the State, its institutions, and every other public-law entity” (art. 49 prf.1), the second characteristic of that right follows: it may be exercised before any court of the Republic to which the law has delegated those powers.

Accordingly, this Sala considers that the legislature’s decision to create specialized jurisdictions in which the legality of acts of the Public Administration may be adjudicated, such as the agrarian jurisdiction, does not violate the constitutional order.’ (Emphasis added). Sala Constitucional, No. 2023 at 15 hours 57 minutes on 3 de agosto de 1993. *

IV.In more recent rulings, the Agrarian Court has maintained the position that, even when a State Entity is sued, if agrarian matters are involved, the case must remain within the Agrarian Jurisdiction: “In this case, the dispute concerning the conflict of jurisdiction between the agrarian and administrative-litigation jurisdictions arises once again. The position of the First Chamber of the Supreme Court of Justice has indeed been reiterated in the most recent rulings, to the effect that if an administrative act (acto administrativo) is challenged on grounds of nullity, jurisdiction lies with the Administrative Litigation Jurisdiction (among others, Voto No. 758-C-2002 de las 9:30 horas del 4 de octubre del 2002). However, this case must be analyzed very carefully because of the consequences that would arise if the matter were referred to the Administrative Litigation Jurisdiction, since the purpose pursued by special agrarian legislation would be defeated.

Indeed, this ordinary agrarian proceeding (ordinario agrario) was brought by [Nombre5] , based on substantive issues that are eminently agrarian. As may be seen, the fundamental point at issue in the ordinary proceeding is not only the nullity of an agrarian administrative act, but the plaintiff also requests that she retain ownership of an agrarian property (fundo agrario) and, alternatively, that she be compensated for the value of the property, the interest, and the improvements she has made since 1991, claims that concern agrarian rights in rem (derechos real-agrarios). Furthermore, it must be considered that the Land Allocation Agreement (contrato de Asignación de Tierras) is an agreement establishing an agrarian enterprise (empresa agraria), through which the Agrarian Entity (Instituto de Desarrollo Agrario) allocates an agrarian property to a producer or farmer who lacks land, subject to the conditions, restrictions, and limitations established by the Law itself.

The purpose of the agrarian agreement is to fulfill the social function of property (función social de la propiedad), and it seeks to achieve an equitable distribution of land so that persons of limited economic means may have access to it. Logically, the resolution issued by the Institute’s Board of Directors gives rise to an administrative act whose purpose, grounds, and content are substantially connected with the purposes of the Ley de Tierras y Colonización; therefore, review, revocation, or annulment of the administrative act cannot be considered from a purely administrative perspective. In this case, it would be necessary to analyze not only the procedure itself used by the Institute to grant the allocation, but, fundamentally, whether the substantive grounds may affect the plaintiff’s rights in rem (derechos reales). Because this is an agrarian administrative act (acto agrario administrativo) with proprietary consequences, since it gives rise to highly important institutions of Costa Rican Agrarian Law, such as the agrarian enterprise, agrarian possession (posesión agraria), the social function of property, and special agrarian succession (Sucesión especial agraria), it is clear that the matter must be decided by a judge specializing in agrarian matters rather than by an administrative-litigation judge.

V. The agrarian administrative act comprises legally relevant interests arising from the exercise of the administrative function and the regulation of agriculture by a public agrarian entity. If a distinction is drawn among the rules governing agrarian administrative acts, some will be specifically agrarian and others will be general administrative rules. Specifically agrarian rules are those containing provisions concerning the grounds, content, cause, and purpose of the agrarian administrative act. Their core revolves around the concept of agrarian character (agrariedad), since they are characterized by the development of a biological cycle in agrarian activity for the fulfillment of the economic, social, and environmental function of the institutions of Agrarian Law. It has therefore been stated that: The agrarian administrative act differs from other administrative acts by virtue of its specific purpose, which is the fulfillment of the social function of the agrarian enterprise.

Analysis of the purpose of the agrarian administrative act is one of the stages richest in possibilities: the act will be defective if its purpose is inconsistent with the purposes of agrarian law, including, among others, the welfare of farming families, the country’s food security, and the full realization of justice in relationships immediately connected with agriculture.´ (CHACON* CHANG*, Hector et al. The Agrarian-Administrative Proceeding. Analysis of the Conflict of Jurisdiction between the Agrarian and Administrative Jurisdictions. Degree Thesis. Licentiate Degree in Law, Universidad de Costa Rica, 1993, p. 64). VI. But there is another, more compelling reason for holding that this matter must be heard in the Agrarian Jurisdiction. On the one hand, the general jurisdiction established in Article 2(h) provides that all disputes arising from acts and contracts to which an agrarian entrepreneur (empresario agrario) is a party must be heard in the Agrarian Jurisdiction.

In this case, the dispute concerns an agrarian administrative act that resulted in the revocation of a parcel. VII. Finally, it should be noted that the Ley General de Administración Pública itself excludes the Ley de Tierras y Colonización from its scope of application with respect to administrative procedure (see Voto del Tribunal Superior Agrario No. 561 de las 15:00 horas del 28 de julio de 1993.). Accordingly, this matter must be analyzed by the Agrarian Courts rather than by the Administrative Litigation Jurisdiction because, pursuant to Article 22 of the Ley de Jurisdicción Agraria, the Instituto de Desarrollo Agrario is a party to all agrarian proceedings in which its interests may be affected. (See the decisions of this Court, No. 801-C-05 de las 11:14 horas del 7 de octubre del 2005 and No. 379-C-07 de las 11:05 horas del 10 de mayo del 2007).*

V.In another matter similar to the one now before us, this Court ruled that * jurisdiction should remain with the Agrarian Jurisdiction: “...in the present case, the ordinary agrarian action was brought by a farmer, Mr. [Nombre6] (see folio 200), against Banco Nacional de Costa Rica, seeking the annulment of an agrarian mortgage enforcement proceeding (proceso ejecutivo hipotecario agrario), heard under expediente No. EXPN2- , in the Juzgado Agrario de San Carlos. Compensation for damages is also sought as a consequence of the judicial auction of his agrarian property (see claims at folio 206). That is, the present proceeding is a consequence of an earlier agrarian proceeding and therefore, regardless * of the parties involved, must be heard by the Agrarian Jurisdiction. In addition, it should be noted that the Ley de Cobro Judicial itself, in Article 1, respected the specialized nature of agrarian matters by retaining jurisdiction over the collection of agrarian debts.” (Tribunal Agrario, No. 16 de las 11:03 hroas del 22 de enero del 2009). *

VI.In relation to the foregoing, * the present ordinary agrarian proceeding, brought * * by [Nombre1] , represented by the agrarian public defense service (defensa pública agraria), concerns a dispute purely involving proprietary matters and rights in rem. The plaintiff claims rights over the real property registered in the Limón Registry District under folio [Placa1] , and therefore seeks the annulment of the deed by which [Nombre2] sold it to Hacienda El Coyol de Palmito Sociedad Anónima, alleging that the power of attorney used to carry out that transfer was void. That is, she seeks the annulment of a purely private contract. She further requests that, as a result of the foregoing, the mortgage in favor of Banco Nacional be declared void. * Moreover, the record shows that the land at issue in the litigation is agrarian property cultivated almost entirely with hearts of palm. * As may be seen, the nullity of an administrative act is not at issue, and therefore there is no basis for determining that the matter falls within the administrative-litigation jurisdiction. This is a matter between private parties involving the granting of security in rem (garantía real) in favor of Banco Nacional, but that does not deprive the matter of its agrarian character.-*

POR TANTO:* The objection for lack of subject-matter jurisdiction (excepción de falta de competencia material), filed by co-defendant Banco Nacional de Costa Rica, is denied. * * * * * * * * * * * * * * * * * * * * * * * * * * * AG4JYCYRDRY61 * * * * * [Nombre7] -* * * * * * * * * * * * * * * * * * * * * * * * DECIDING JUDGE * * * * * * * UVBJEUBNI9I61 * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * XZFIJSNCNDW61* * * * [Nombre8] - * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * [Nombre9] -* * * DECIDING JUDGE * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * DECIDING JUDGE* * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * *

* * * * * * * * * * * * * * * * * * * * * * * * * * * AG4JYCYRDRY61 * * * * * [Nombre7] -* * * * * * * * * * * * * * * * * * * * * * * * JUEZ/A DECISOR/A * * * * * * * UVBJEUBNI9I61 * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * XZFIJSNCNDW61* * * * [Nombre8] - * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * [Nombre9] -* * * JUEZ/A DECISOR/A * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * JUEZ/A DECISOR/A* * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * *
