Heard before the Agrarian Court of the Second Judicial Circuit of Guanacaste. * WHEREAS: * 1. * * The applicants filed a possessory information proceeding for the purpose of having the property described in the survey plan registered with the Catastro Nacional under number G-uno uno uno siete ocho cuatro cero- dos mil seis recorded in their names in the Registro Público de la Propiedad.
It is described as follows: “Mountain land,* located at [Dirección1], in the Province of Guanacaste. Area: TWENTY-FOUR HECTARES SIXTY-EIGHT SQUARE METERS AND SIXTY-ONE SQUARE DECIMETERS. Bounded on the North by: El Partenón del Rincón de Guanacaste Sociedad Anónima; South: [Nombre9] ; East: [Nombre10] ;* and West: [Nombre10] , located in the Province of Guanacaste” (folios 27, 28, 354 to 357). * 2. * The Procuraduría General de la República entered an appearance in the proceeding on the terms set forth at folios 80 to 82; the Instituto de Desarrollo Agrario, in turn, did so at folio 83. * 3. Judge José Walter Ávila Quirós of the Agrarian Court of the Second Judicial Circuit of Guanacaste, by judgment number 342-2012 issued at ten hours and forty-one minutes on twenty November two thousand twelve, ruled: “POR TANTO: The possessory information is approved. Subject to the encumbrances referred to in article 17 of the Ley de informaciones Posesorias and without prejudice to third parties having superior rights, the Registrar of the Registro de la Propiedad is ordered to register, for the first time, in the name of EL PARTENON (sic) DE RINCÓN GRANDE DE GUANACASTE SOCIEDAD ANÓNIMA, * with * corporate * identification * number CED14, represented by its General Attorney-in-Fact with Unlimited Authority [Nombre11] , who has a single surname by reason of his United States nationality, * of legal age, divorced once, businessman, resident of Flamingo, Guanacaste, passport number CED15, the property described in the survey plan registered with the Catastro Nacional under number G-uno uno uno siete ocho cuatro cero-dos * mil * seis, * which * is * described * as * follows:* * Mountain * land, located at [Dirección2], in the Province of Guanacaste.
Area: TWENTY-FOUR HECTARES SIXTY-EIGHT SQUARE METERS AND SIXTY-ONE SQUARE DECIMETERS. Bounded on the North by: El Partenón del * Rincón de * Guanacaste * Sociedad Anónima;* * South: [Nombre9]* * [Nombre9] ; East: [Nombre10] ;* and West: [Nombre10] , located in the Province of Guanacaste. The property at issue in this proceeding is valued at TEN MILLION COLONES. a) The property to which title is to be granted shall remain subject to the reservations concerning the rights-of-way (derechos de vía) of 14-meter-wide public roads established by articles 4 of the Ley General de Caminos Públicos and 19, subsection a), of the Ley de Informaciones Posesorias. b) The area adjacent to watercourses is a protection area (área de protección), pursuant to article 33, subsections a) and b), of Ley Forestal N° 7575, and the cutting or removal of trees is prohibited, which must be stated in the judgment for registration purposes (article 34 ibídem).
Likewise, the beds and waters of those watercourses are in the public domain (dominio público) (Ley de Aguas, articles 1, subsection IV, and 3, subsection III), as we requested in our submission of 17 de abril de 2007. c) The surface water and groundwater existing on the property are in the public domain of the State and do not form part of the property, pursuant to the Ley de Aguas, articles 1, subsection IV, and 3, subsection III, and the Código de Minería, article 4°, which brought all of the country’s groundwater and surface water into the public domain and nationalized it, reserving it to the State. The Ley Orgánica del Ambiente reinforced this declaration of public-domain status (demanialidad) in article 50, which ‘presupposes* an express dedication of all inland waters (surface water and groundwater—by making no distinction between them—to the public domain of the State).’ A certified copy of this judgment shall serve to register the aforementioned property in the Registro de la Propiedad” (emphasis in the text appearing at folios 356 verso to 357). * 4.
Attorney Lydiana* Rodríguez Paniagua, in her capacity as Deputy State Attorney, filed an appeal, expressly stating the reasons for contesting the trial court’s position (folios 367 to 373). * 5. * The * legal requirements have been observed in the * conduct of the * proceeding, * and there are no errors or omissions capable of rendering the judgment null and void. * Drafted by Judge Díaz Bolaños; and * CONSIDERING: *
I.The list of proven facts is adopted because it is consistent with the evidence in the record, except for those numbered 3, 6, and 8, as they concern procedural events. The following fact of that nature is added: 9) The applicants* and the person who transferred the possessory rights (derechos posesorios) to them have taken care to protect the forest resource existing on the property for more than fifteen years (see the witness testimony of [Nombre12] , [Nombre13] , and [Nombre14], at folios 122, 123, and 124, respectively; the land-use conformity certificate at page 167; and the judicial inspection at folio 314). *
II.The State’s representative, Lidyana* Rodríguez Paniagua, in her capacity as Deputy State Attorney, filed an appeal against the judgment issued at 10 hours 41 minutes on 20 de noviembre de 2012 (folio 354). She * objected on the following grounds: She asserts that the statements made by the party in the initial pleading and the findings in the judgment show that the land for which title is sought is mountain land and that, because it is located within national reserves, it has been subject to the public-domain regime as part of the State Natural Heritage (Patrimonio Natural del Estado) since Ley Forestal number 4465 of 1969, article 33, as amended by Ley Forestal 7174 of 1990 (articles 32 and 33), and that its public-domain character is maintained by Ley 7575 (articles 13 and 14). She argues that the law allows title to be granted to properties outside protected wild areas (áreas silvestres protegidas) if the applicant proves her legitimate rights arising from ten years of possession, together with the other conditions required for that purpose, that she has protected the resource, and that the property has been duly demarcated.
This leads her to conclude that title may be granted if acquisitive prescription (usucapión) was completed before the property became part of the Patrimonio Natural del Estado by operation of law, because, in her view, the witness testimony does not establish the possession required to obtain title to the property. She cites decision number 4587-97 of the Sala Constitucional de la Corte Suprema de Justicia and further argues that forest lands are immediately dedicated by law to the public domain. As grounds for appeal, she contends that the statements of those who testified do not prove the ten years of possession necessary for the applicant to acquire title by acquisitive prescription. She then cites judicial precedents and opinions issued by the Procuraduría General de la República, specifying the following:
III. * * * Regarding the argument presented by the State’s representative concerning the dedication of forests to the public domain (dominio público) in perpetuity, the Court finds that it is indeed possible to obtain title to unregistered land (terrenos no inscritos) with forest cover (cobertura forestal), whether within or outside protected wilderness areas (áreas silvestres protegidas), provided that the legal requirements established in Article 7 of the Ley de Informaciones Posesorias are met. That provision, as amended following the currently effective Ley Forestal 7575, expressly authorized the titling of forested real property (bienes inmuebles boscosos) through these proceedings, stating: “... Properties located outside those areas and containing forests * may be titled only if the petitioner* proves that he is the holder of the legal rights arising from ten-year possession (posesión decenal), exercised for at least ten years, and that he has protected that natural resource, it being understood that the property must be duly demarcated and enclosed by fences or cleared boundary paths.” The constitutionality of that provision and of the interpretation previously adopted by this Court was challenged, resulting in the issuance of Judgment No. 4587-97 by the Constitutional Chamber of the Supreme Court of Justice, which declared the provision constitutional and * the position adopted by the Agrarian Court—requiring personal possession of the property—to be unconstitutional.
Likewise, the aforementioned Constitutional Chamber rejected the constitutional challenge filed against Article 7 of the Ley de Informaciones Posesorias by one composition of this Court in case EXPN2- , leaving that provision and its effects in force. In view of this situation, the appropriate course in this case is to verify compliance with the requirements established by the aforementioned provision. IV. These proceedings seek title to a property located in Paso Hondo, [Dirección3] , Santa Cruz canton, in the province of Guanacaste; it has an area of 24 hectares, 68 square meters, and 61 square decimeters and is devoted to forest, according to cadastral plan (plano catastrado) G-1117840-2006 (folio 34 and the land-use conformity report (informe de uso conforme de suelo) at folio 167). This property was acquired through an award in the probate proceedings (proceso sucesorio) of the prior possessor, who during his lifetime was named [Nombre15] , as recorded in instrument number 231 executed before Notary José ángel Ruiz Cabalceta*, in which documents from the aforementioned decedent’s extrajudicial probate proceedings (proceso sucesorio extrajudicial) were incorporated into a notarial protocol (protocolizan) (folio 18).
For its part, the Instituto Nacional de Innovación y * Transferencia en Tecnología Agropecuaria certified that the property has one hundred percent regenerating forest cover, containing several species such as cornizuelo, chaperno, and guácimo, among others (folio 167). It further certifies that the petitioner* * has used the land for the activity being conducted in accordance with the approved methodology. The office of the Sistema Nacional de Áreas de Conservación certified that the property is located outside the protected wilderness areas declared by the Ministerio de Ambiente, Energía y Telecomunicaciones (folio 35). To prove possession (posesión), testimonial evidence (declaración testimonial) was received * from [Nombre12] (folio 122), who stated that he had known the land for 15 years and attested to the chain of transfers (cadena de transmisión), the existence of the stream shown on the cadastral plan, the care provided by the petitioners*, and that possession had been peaceful. [Nombre13] and [Nombre14] made statements to the same effect; the former stated that he had known the property for 14 years and the latter for more than 15 years (folios 123 and 124, respectively).
All the witnesses consistently stated that the property is duly demarcated. The foregoing evidence demonstrates compliance with the requirements established in Article 7 of the Ley de Informaciones Posesorias, since the property is duly * demarcated by fences and boundary paths, the forest resource in the forested area has been protected, and the petitioner has possessed the property for more than 15 years, including the possession transferred through the decedent. Accordingly, the Court finds that the conclusions reached by the lower court after assessing the various items of evidence appearing * in the record pursuant to Article 54 of the Ley de Jurisdicción Agraria are consistent with that * evidence. Therefore, the grounds for appeal (agravios) presented by the State’s representative are not accepted. *
V.For the foregoing reasons, pursuant to Articles 6, 26, 54, and 79 of the Ley de Jurisdicción Agraria and Articles 1, 2, 6, 7, and 11 of the Ley de Informaciones Posesorias, the appealed portion of the challenged decision must be affirmed. *

Linda al Norte: El Partenón del * Rincón de * Guanacaste * Sociedad Anónima;* * Sur: [Nombre9]* * [Nombre9] ; Este: [Nombre10] ;* y Oeste: [Nombre10] , situada en la Provincia de Guanacaste. El inmueble objeto de este proceso se estima en la suma de DIEZ MILLONES DE COLONES. a) Que el inmueble a titular queda afecto a las reservas en cuanto a los derechos de vía de calles públicas de 14 metros de ancho que disponen los artículos 4 de la Ley General de Caminos Públicos y 19, inciso a), de la Ley de Informaciones Posesorias. b) Que el área contigua a las corrientes es área de protección, según el artículo 33, incisos a) y b) de la Ley Forestal N° 7575, y queda prohibida la corta o eliminación de árboles, debiéndose consignar en sentencia para efectos de inscripción en el Registro (artículo 34 ibídem).
Asimismo, que el cauce y las aguas de esas corrientes son de dominio público (Ley de Aguas, artículos 1, inciso IV, y 3, inciso III), conforme lo requerimos en nuestro escrito del 17 de abril de 2007. c) Que las aguas superficiales y subterráneas existentes en el inmueble, son de dominio público estatal y no forman parte de la finca, con fundamento en la Ley de Aguas, artículos 1, inciso IV, y 3, inciso III y Código de Minería, artículo 4°, lo cual produjo una publificación y nacionalización de todas las aguas subterráneas y superficiales del país, reservadas para el Estado. La Ley Orgánica del Ambiente reforzó esta declaratoria de demanialidad en el artículo 50, que ³supone* una afectación expresa de todas las aguas continentales (aguas superficiales y subterráneas -al no distinguirlas - al demanio público del Estado) ´. Sirva la certificación de esta sentencia para inscribir en el Registro de la Propiedad la finca relacionada " (lo destacado es del texto visible en fojas 356 vuelto al 357). * 4.
La abogada Lydiana* Rodríguez Paniagua, en su condición de Procuradora Adjunta , formuló recurso de apelación con indicación expresa de las razones por las cuales refuta la tesis del Juzgado de instancia (folio 367 a 373). * 5. * En la * substanciación del * proceso * se * han observado las prescripciones legales, y no se nota la existencia de errores u omisiones capaces de producir su nulidad de la sentencia. * Redacta el juez Díaz Bolaños, y; * CONSIDERANDO: *
I.Se comparte el elenco de hechos probados al ser acordes con las probanzas constantes en autos, a excepción del marcado con los números 3, 6 y 8, por tratarse de eventos procesales. De tal naturaleza se adiciona el siguiente hecho: 9) Los gestionantes* y quien les transmitió los derechos posesorios se han ocupado de proteger el recurso forestal existente en el inmueble por más de quince años (ver declaraciones testimoniales de [Nombre12] , [Nombre13] y [Nombre14] , en folios 122, 123 y 124 respectivamente, certificación de uso conforme de suelo en página 167y reconocimiento judicial de foja 314 ). *
II.La representante * del Estado, Lidyana* Rodríguez Paniagua, en condición de Procuradora Adjunta, interpuso recurso de apelación contra la sentencia de las 10 horas 41 minutos del 20 de noviembre de 2012 (folio 354). Se mostró * inconforme por lo siguiente: Afirma de las manifestaciones de la parte en memorial inicial y lo acreditado * en la sentencia, se desprende que la naturaleza del terreno pretendido titular es montaña, por lo que, al ubicarse en reservas nacionales está afectado a régimen de dominio público, Patrimonio Natural del Estado, desde la Ley Forestal número 4465 de 1969, artículo 33, reformada por la Ley Forestal 7174 de 1990 (artículos 32 y 33) y de carácter demanial que mantiene la Ley 7575, (artículos 13 y 14). Argumenta, la ley permite titular inmuebles fuera de las áreas silvestres protegidas si la promovente demuestra sus legítimos derechos de posesión decenal, con las demás condiciones exigidas al efecto, haber protegido el recurso y tener el inmueble debidamente deslindado.
Lo anterior la lleva a concluir, es posible titular si la usucapión se ha consolidado antes de ingresar por ley a Patrimonio Natural del Estado, pues en su criterio la declaración de las personas testigas* no acredita la posesión requerida para poder titular el bien. Cita el voto de la Sala Constitucional de la Corte Suprema de Justicia número 4587-97, además esgrime los terrenos de bosques tienen una afectación inmediata por ley a dominio público. Agravia, las manifestaciones * de quienes declararon no demuestran la posesión decenal apta para usucapir en cabeza de la promovente. Procede a citar precedentes jurisprudenciales y pronunciamientos emitidos por la Procuraduría General de la República, especificando los siguientes:
III. * * * Sobre el argumento expuesto por la representante del Estado acerca de la afectación al dominio público de bosques a perpetuidad, estima el Tribunal que sí es posible titular terrenos no inscritos con cobertura forestal dentro o fuera de áreas silvestres protegidas, siempre y cuando se cumpla con los requisitos legales exigidos por el artículo 7 de la Ley de Informaciones Posesorias. Dicha norma, reformada a partir de la Ley Forestal 7575 vigente, autorizó en forma expresa la titulación de bienes inmuebles boscosos mediante el presente trámite, al señalar: "... Las fincas ubicadas fuera de esas áreas y que tengan bosques, * sólo podrán ser tituladas si el promovente* demuestra ser el titular de los derechos legales de posesión decenal, ejercida por lo menos durante diez años y haber protegido ese recurso natural, en el entendido de que el inmueble tendrá que estar debidamente deslindado y con cercas o carriles limpios".
La constitucionalidad de dicha norma y de la interpretación dada en algún momento por este Tribunal fue cuestionada de constitucionalidad, gestión que generó la emisión del voto de la Sala Constitucional de la Corte Suprema de Justicia número 4587-97, en el cual se declaró la constitucionalidad de la norma y la inconstitucionalidad * de la posición asumida por Tribunal Agrario al exigir el ejercicio de una posesión personal del bien. De igual forma, la Sala Constitucional citada rechazó la consulta de constitucionalidad planteada contra el artículo 7 de la Ley de Informaciones Posesorias por una de las integraciones de este Tribunal, en el expediente EXPN2- , quedando vigente tal norma y sus efectos. Ante tal situación, lo procedente en este caso es verificar el cumplimiento de los requisitos que señala la citada norma. IV. Con el presente proceso se pretende la titulación de un inmueble ubicado en Paso Hondo, [Dirección3] , cantón Santa Cruz, de la provincia de Guanacaste; tiene una medida de 24 hectáreas con 68 metros 61 decímetros cuadrados y está destinado a bosque, según el plano catastrado G-1117840-2006 (folio 34 e informe de uso conforme de suelo en foja 167).
Tal bien fue adquirido mediante adjudicación del proceso sucesorio del anterior poseedor quien en vida se llamó [Nombre15] , tal y como consta en la escritura número 231 otorgada ante los oficios del Notario José ángel Ruiz Cabalceta* donde se protocolizan las piezas del proceso sucesorio extrajudicial del citado causante (folio 18). Por su parte, el Instituto Nacional de Innovación y * Transferencia en Tecnología Agropecuaria certificó que en el bien existe una cobertura del cien por ciento de bosque en regeneración con varias especies, como el cornizuelo, chaperno, guácimo entre otras (folio 167). Además certifica, el promovente* * ha ejercido el uso del suelo para la actividad que se realiza de acuerdo a la metodología aprobada. La oficina del Sistema Nacional de Áreas de Conservación certificó que dicho bien está ubicado fuera de las áreas silvestres protegidas declaradas por el Ministerio de Ambiente, Energía y Telecomunicaciones (folio 35).
Para acreditar la posesión se recibió la declaración testimonial * de [Nombre12] (folio 122), quien dijo conocer el terreno desde hacía 15 años, da fe de la cadena de transmisión, de la existencia de la quebrada graficada en el plano catastado, el cuido realizado por los gestionantes* y la posesión ha sido de forma pacífica. En los mismos términos declararon [Nombre13] y [Nombre14] ; manifestaron conocer el inmueble por 14 años el primero, y el segundo por más de 15 años (folios 123 y 124 respectivamente). Todos las declarantes fueron contestes en exponer que el bien se encuentra debidamente deslindado. De las probanzas aludidas se desprende el cumplimiento de los presupuestos señalados en el artículo 7 de la Ley de Informaciones Posesorias, pues el inmueble está debidamente * delimitado mediante cercas y carriles, se ha protegido el recurso forestal en el sector de bosque y el promovente ha ejercido la posesión del inmueble por más de 15 años contabilizando la posesión transmitida por medio de la persona causante.
Conforme a lo anterior, estima el Tribunal, las conclusiones a las que arribó el Juzgado de origen luego de valorar los distintos elementos probatorios constantes * en autos conforme al artículo 54 de la Ley de Jurisdicción Agraria, responden a estas * últimas. De ahí, no se compartan los agravios expuestos por la representante del Estado. *
V.Por lo expuesto, con fundamento en los artículos 6, 26, 54 y 79 de la Ley de Jurisdicción Agraria y 1, 2, 6, 7 y 11 de la Ley de Informaciones Posesorias, en lo apelado, deberá confirmarse la resolución recurrida. *
