VOTO N° 93-F-13 TRIBUNAL AGRARIO. SECOND JUDICIAL CIRCUIT OF SAN JOSÉ.- At sixteen hours and twenty-seven minutes on the thirty-first day of January, two thousand thirteen.- POSSESSORY TITLE PROCEEDING, brought by [Nombre1] , of legal age, single, farmer, resident of San Vito de Coto Brus, holder of identity card number CED1 - - . Participating in the proceeding are the PROCURADURÍA GENERAL DE LA REPÚBLICA, represented by Lydiana Rodríguez Paniagua, whose personal details are not shown in the record, in her capacity as Deputy Attorney General; and the INSTITUTO DE DESARROLLO AGRARIO, legal entity identification number CED2 - - -, represented by Carmelina Vargas Hidalgo, of legal age, divorced, attorney, resident of Escazú, holder of identity card number CED3 - - , acting under a general power of attorney without limitation as to amount. Attorney Carlos Rodríguez Carmona, bar membership number fifteen thousand nine hundred fifty-four, acts as counsel for the petitioner. RECITALS:
Drafted by Judge ALVARADO PANIAGUA; and
CONSIDERING:
I.This Court adopts the statement of facts found proven in the appealed judgment, as it faithfully reflects the contents of the record.- The following fact is likewise deemed proven: f) The petitioner performed acts of possession (actos posesorios) for more than ten years, both personally and through possession derived from [Nombre5] . (See witness testimony appearing at folios 90 to 92 and the document at folio 7).-
II.Deputy Attorney General Lydiana Rodríguez Paniagua appeals the judgment issued at fourteen hours and forty minutes on the fifth day of November, two thousand twelve, arguing that witness [Nombre6] stated, when his testimony was taken, that he had known the property to be titled for three years, and therefore ten years of possession was not established.- She likewise states that the land is mountain land and is therefore subject to the State’s natural heritage (patrimonio natural del Estado). She contends that the property sought to be registered consists of forest lands and forests within national reserves and is therefore in the public domain, and that it has formed part of the State’s natural heritage since Ley Forestal 4465 de 1969, artículo 33 reformada por la Ley Forestal 7174 de 1990, while its public-domain status (carácter demanial) is maintained in Ley 7575 en los artículos 13 y 14.- She considers that the witness testimony does not establish the ten years of possession required for acquisitive prescription (usucapión). (See folios 195 to 204).-
III.The appellant’s grounds for appeal are not accepted for the following reasons: 1) Regarding the claim that the witness [Nombre6] stated that he had known the land for three years, the following considerations must be made. That testimony appears at folio 90 of the case file, and although he did state that he had known the land for three years, it is also true that he has personal knowledge that, before the property belonged to [Nombre1] (the petitioner), it belonged to Mr. [Nombre5], who held it for several years. That statement, considered together with the other two witness statements of [Nombre7] and [Nombre8], appearing at folios 92 front and back, respectively, proves the existence of derivative possession (posesión derivada) transferred to Mr. [Nombre1] for a ten-year period by Mr. [Nombre5], who was the previous possessor. This fact is supplemented by the assertion contained in the document evidencing the sale of possessory rights (derechos de posesión) by Mr. [Nombre5] to Mr. [Nombre1], appearing at folio 7, regarding the existence of the chain of transfers (cadena transmisoria).- 2) Regarding the existence of forest on the property, it should be noted that it is located within a protection area (área de protección) for the stream and spring (naciente) and consists of regenerating secondary forest (bosque secundario); therefore, the criterion of public-domain status (demanialidad) as part of the State’s natural heritage (patrimonio natural del Estado) is not considered applicable, as explained below.
The soil study prepared by the Instituto Nacional de Innovación y Transferencia de Tecnología Agropecuaria (INTA) shows that the property described in registered cadastral plan number P-1086989-2006 consists of land with secondary forest and natural pasture with trees. Although it is true that a majority of a differently constituted panel of this Court has held that the ten-year possession period for forested lands must be counted from before they became subject to the public domain under Ley Forestal de 1969, that holding does not apply to this specific case, because it should be noted that the property consists of secondary forest, which means that the land was regenerated by its possessor; moreover, the judicial inspection (reconocimiento judicial) shows that this resource has been cared for. The Comisión Nacional de Certificación Forestal de Costa Rica defines secondary forest as “... land with woody vegetation of a secondary successional nature that develops once the original vegetation has been removed by human activities or natural phenomena; with a minimum area of 0,5 ha and a density of no fewer than 500 trees per ha of all species, with dbh of no less than 5 cm” (CNCF 1999, Comisión Nacional de Certificación Forestal. 1999.

Costa Rica. 54 p.).- Based on this definition and the INTA technical study appearing at folios 144, the original forest was converted into brushland (charral), which subsequently gave rise to a secondary forest that, as stated, has been cared for by its possessor. Declaring this type of secondary forest to be public-domain property (bien demanial) would discourage this type of forest-regeneration activity, because possessors would prefer to maintain their lands as pasture so that the lands remain within their estates and they do not risk having them declared State property. Silvicultural activity (actividad silvícola) and the regeneration of secondary forests are activities necessary for capturing carbon from the atmosphere and, therefore, are environmental measures against global warming.
Because these activities benefit the environment, it would be inconsistent to punish possessors who engage in this type of forest-regeneration activity by denying them the ability to obtain title to their property. Nor is the property located within any protected zone (zona protectora); on the contrary, according to the document at folio 2, it is located outside protected wilderness areas (áreas silvestres protegidas). Based on the foregoing and an overall analysis of all the evidence gathered, the existence of possession for a period sufficient to acquire ownership by adverse possession (usucapir) is established, because the requirement of ten-year derivative possession, originating with Mr. [Nombre5] and subsequently exercised by Mr. [Nombre1], has been satisfied, and that possession has been public, peaceful, continuous, and in good faith. It is unnecessary to address ten-year possession predating the Ley Forestal because the land was converted into secondary forest, an activity undertaken by the possessors that it would be contradictory to punish by refusing to recognize it as valid for purposes of acquiring ownership by adverse possession.-
THEREFORE:

VOTO N° 93-F-13 TRIBUNAL AGRARIO. SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ.- A las dieciséis horas y veintisiete minutos del treinta y uno de enero de dos mil trece.- PROCESO DE INFORMACIÓN POSESORIA, promovido por [Nombre1] , mayor, soltero, agricultor, vecino de San Vito de Coto Brus, cédula de identidad número CED1 - - . Intervienen en el proceso, la PROCURADURÍA GENERAL DE LA REPÚBLICA, representada por Lydiana Rodríguez Paniagua, de calidades desconocidas en autos, en su condición de procuradora adjunta; y el INSTITUTO DE DESARROLLO AGRARIO, cédula jurídica CED2 - - -, representado por Carmelina Vargas Hidalgo, mayor, divorciada, abogada, vecina de Escazú, cédula de identidad número CED3 - - , en calidad de apoderada generalísima sin limite de suma. Actúa como abogado director del promovente, el licenciado Carlos Rodríguez Carmona, colegiado número quince mil novecientos cincuenta y cuatro. Tramitada ante el Juzgado Agrario del Segundo Circuito Judicial de la Zona Sur, Corredores.
RESULTANDO:
Redacta la jueza ALVARADO PANIAGUA, y ;
CONSIDERANDO:
I.Este Tribunal prohija la relación de hechos tenidos por probados en el fallo recurrido al ser fiel reflejo de lo constante en autos.- De igual naturaleza se tiene el siguiente hecho probado: f) La parte promovente realizó actos posesorios por más de diez años de manera personal y derivada por parte de [Nombre5] . (Ver declaraciones testimoniales visibles a folios 90 a 92, y documento de folio 7).-
II.La Procuradora adjunta Licenciada Lydiana Rodríguez Paniagua, apela la sentencia de las catorce horas cuarenta minutos del cinco de noviembre del dos mil doce, argumentando que el testigo [Nombre6] afirmó tener 3 años de conocer el inmueble a titular al momento de recibir su declaración, con lo cual no quedó demostrada la posesión decenal.- Igualmente indica el terreno es montaña por lo que está afecto al patrimonio natural del Estado. Aduce el inmueble que se pretende inscribir son terrenos forestales y bosques de las reservas nacionales por lo que están afectos a dominio público, y son patrimonio natural del Estado desde la Ley Forestal 4465 de 1969, artículo 33 reformada por la Ley Forestal 7174 de 1990, y el carácter demanial se mantiene en la Ley 7575 en los artículos 13 y 14.- Considera las declaraciones de los testigos no demuestran la posesión decenal apta para usucapir. (ver folios 195 a 204).-
III.No se comparten los agravios expuestos por la apelante por las siguientes razones: 1) Con relación al agravio de que el testigo [Nombre6] manifestó conocer el terreno desde hace tres años, debe hacerse las siguientes consideraciones. Dicho testimonio es visible a folio 90 del expediente, y si bien es cierto indicó conocer el terreno desde hace tres años, también es cierto que le consta que antes de que el inmueble fuera de [Nombre1] (el promovente), el mismo pertenecía a don [Nombre5] quien lo tuvo por varios años. Tal declaración integrada con las otras dos declaraciones testimoniales de [Nombre7] e [Nombre8] a folios 92 fte y vto respectivamente, se comprueba la existencia de una posesión derivada a don [Nombre1] por un plazo decenal por parte de don [Nombre5] quien era el anterior poseedor. Tal hecho hace complemento con lo afirmado mediante documento de venta de los derechos de posesión por parte de don [Nombre5] a don [Nombre1] , visible a folio 7, en el sentido de la existencia de la cadena transmisoria.- 2) Con relación a la existencia de bosque en el inmueble, nótese el mismo es en un área de protección de la quebrada y la naciente y se trata de bosque secundario en regeneración, de allí no se considere la aplicación del criterio de demanialidad por patrimonio natural del Estado conforme se dirá de seguido.
Del estudio de suelos elaborado por el Instituto Nacional de Innovación y Transferencia de Tecnología Agropecuaria (INTA), se desprende que el inmueble descrito en el plano catastrado número P-1086989-2006 es terreno con bosque secundario y pasto natural con árboles. Si bien es cierto, por mayoría de otra integración de Tribunal se considera el conteo el plazo decenal de posesión de terrenos boscosos lo es antes de la afectación de dominio público según Ley Forestal de 1969, ello no es de aplicación a este caso concreto, pues nótese se trata de un inmueble compuesto de bosque secundario, lo que implica ese terreno fue regenerado por parte de su poseedor además del reconocimiento judicial se desprende se ha cuidado ese recurso. La Comisión Nacional de Certificación Forestal de Costa Rica define el bosque secundario como ³... aquella tierra con vegetación leñosa de carácter sucesional secundaria que se desarrolla una vez que la vegetación original fue eliminada por actividades humanas o fenómenos naturales; con una superficie mínima de 0,5 ha y una densidad no menor a 500 árboles por ha de todas las especies, con dap no menor a 5 cm´(CNCF 1999, Comisión Nacional de Certificación Forestal. 1999.

Con base en lo anterior, del análisis en conjunto de toda la prueba recabada, se determina la existencia de una posesión con tiempo apto para usucapir, pues se cumple con el requisito del ejercicio de una posesión decenal derivada proveniente de don [Nombre5] y luego por don [Nombre1] cual ha sido de manera pública, pacífica, contínua y de buena fe, sin que sea necesario referirnos a la posesión decenal anterior a la Ley Forestal, pues el terreno fue convertido a bosque secundario, actividad ejercida por los poseedores que sería un contrasentido castigar no teniendo esa actividad como válida para usucapir.-
POR TANTO:
